		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Consumer Product Safety
			 Modernization Act of 2007</short-title></quote>.</text>
		</section><section id="idB86E3BE6F4E14C6AA02E0527984C8ED4"><enum>2.</enum><header>Reauthorization
			 of Consumer Product Safety Act</header>
			<subsection id="id1345C4EA9201478584ED4D20F8BE0F63"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 32(a) of the
			 <act-name>Consumer Product Safety Act</act-name> (15 U.S.C. 2081) is amended by
			 striking paragraphs (1) and (2), and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7AC597DF28D54552B950990D21BFFC98" style="OLC">
					<paragraph id="idC3DE13C3EAFC4E91AF808F28D1389475"><enum>(1)</enum><text>$70,000,000 for
				fiscal year 2008.</text>
					</paragraph><paragraph id="id8DD136150A854BBCABD6DA9524D5EE17"><enum>(2)</enum><text>$77,500,000 for
				fiscal year 2009.</text>
					</paragraph><paragraph id="id2AED54AE29CC4BD8A378FC2276F7466F"><enum>(3)</enum><text>$85,000,000 for
				fiscal year 2010.</text>
					</paragraph><paragraph id="id330E674564014F2DB6ADF03F757A602F"><enum>(4)</enum><text>$92,500,000 for
				fiscal year 2011.</text>
					</paragraph><paragraph id="id98C7A1348D3C4F2EA7CF4785DA46AF39"><enum>(5)</enum><text>$100,000,000 for
				fiscal year
				2012.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idCB0B93F5EB624AD6A9BB3BE554D230ED"><enum>(b)</enum><header>Repeal of
			 quorum requirement for transaction of business</header><text display-inline="yes-display-inline">Section 4(d) of such Act (15 U.S.C.
			 2053(d)) is amended by striking <quote>, but three</quote> and all that follows
			 through <quote>to decline to two</quote>.</text>
			</subsection><subsection id="id7902A8D763D34174A38BB4FE0E6C51CB"><enum>(c)</enum><header>Reduced period
			 of notice to manufacturers and private labelers with respect to disclosure of
			 information</header><text display-inline="yes-display-inline">Section 6(b)(1)
			 of such Act (15 U.S.C. 2055(b)(1)) is amended by striking <quote>not less than
			 30 days</quote> and inserting <quote>not fewer than 10 days</quote>.</text>
			</subsection><subsection id="id510D217805BD4AA79EE62E7EBA955114"><enum>(d)</enum><header>Expedition of
			 release of information in case of noncooperation by manufacturer or private
			 labeler</header><text display-inline="yes-display-inline">Section 6(b) of such
			 Act (15 U.S.C. 2055(b)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id62014788507F4461A6722B0199C1FB76" style="OLC">
					<paragraph id="id8C6FEAA608754954BC265FCE42EA2D18" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idEFE71DF2B1AC4CE8B112F1FD71103C76"><enum>(A)</enum><text>Notwithstanding any
				other provision of this subsection and paragraphs (5) and (6) of subsection
				(a), if the Commission makes an affirmative determination under subparagraph
				(B) with respect to information obtained under this Act pertaining to a
				consumer product of a manufacturer or private labeler, the Commission may
				immediately disclose such information to the public.</text>
						</subparagraph><subparagraph id="id1053517523D74BFF93D9C82533CA1161" indent="up1"><enum>(B)</enum><text>An affirmative determination under
				this subparagraph with respect to information obtained under this Act
				pertaining to a consumer product of a manufacturer or private labeler is a
				determination by the Commission that—</text>
							<clause id="id9D433189C584422CB21E3F1F77E606F8"><enum>(i)</enum><text>disclosure of such information is
				necessary to prevent an unreasonable risk to health and safety; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idCE1958ECCFD74113AA32E3DB269454CF"><enum>(ii)</enum><text>such manufacturer or private labeler
				is not cooperating with the Commission.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF765A93CAC3F4147BDA46D9611A5D7FC" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (B)(ii),
				a manufacturer or private labeler shall be considered uncooperative with the
				Commission if the Commission determines that such manufacturer or private
				labeler has failed to furnish information required by section 15(b) or to
				comply with an order under section 15(c) of such section within a reasonable
				amount of
				time.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id361F852F3A2242C5B244996ECC090539"><enum>(e)</enum><header>Establishment
			 of minimum fine for failure To comply with recall order</header>
				<paragraph id="idA6445566517A4CF98F7827625C6B77E7"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 20(a) of such Act (15 U.S.C. 2069(a)(1)) is amended—</text>
					<subparagraph id="idDB2D90C2BA1C4EF4BEBF0B4E2A3E63E0"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence, by inserting
			 <quote>and in the case of a person who violates subsection (a)(5) of such
			 section, such person shall be subject to a civil penalty of not less than $500
			 for each such violation and not more than $5,000 for each such
			 violation</quote> after <quote>for each such violation</quote>; and</text>
					</subparagraph><subparagraph id="id3E5B8E01B64C4A6AA55FD51F2D05B4AF"><enum>(B)</enum><text>in the third
			 sentence, by striking <quote>of section 19(a)(3)</quote> and inserting
			 <quote>of paragraph (3) or (5) of section 19(a)</quote>.</text>
					</subparagraph></paragraph><paragraph id="id6D653B68D906400D97E7663EB1EE2C4D"><enum>(2)</enum><header>Adjustment for
			 inflation</header><text>Paragraph (3) of such section 20(a) is amended by
			 striking <quote>maximum</quote> each place it appears and inserting
			 <quote>minimum and maximum</quote>.</text>
				</paragraph></subsection><subsection id="id5B32343AA9644512A230B2D2558010B0"><enum>(f)</enum><header>Increase in
			 maximum civil penalties</header><text>Section 20(a)(1) of such Act (15 U.S.C.
			 2069(a)(1)) is amended by striking <quote>$1,250,000</quote> each place it
			 appears and inserting <quote>$20,000,000</quote>.</text>
