		<official-title>To provide for limitations in certain communications
		  between the Department of Justice and the White House Office relating to civil
		  and criminal investigations, and for other purposes.</official-title>

		<section changed="deleted" committee-id="SSJU00" id="idCD62606BE9A047DBB34D23EC689A4FBE" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="id794ED6403F924923BBD75D2943BACC64"><enum>(1)</enum><text>the term
			 <term>covered communication</term>—</text>
				<subparagraph id="id6EFD6E46EA9646F08C65948956E9F378"><enum>(A)</enum><text>means any
			 communication relating to an ongoing investigation conducted by the Department
			 of Justice in any civil or criminal matter (regardless of whether a civil
			 action or criminal indictment or information has been filed); and</text>
				</subparagraph><subparagraph id="id5CE6B39E202445DBB72E49C955679E88"><enum>(B)</enum><text>does not include
			 any communication relating to policy, appointments, legislation, budgets,
			 public relations, programmatic matters, intergovernmental relations,
			 administrative or personnel matters, or requests for legal advice;</text>
				</subparagraph></paragraph><paragraph id="id32B6C7A66C77408DBAED535E183F6FFA"><enum>(2)</enum><text>the term
			 <term>covered Department of Justice officer</term> means—</text>
				<subparagraph id="id838371E79004410EB9DB4BACBAB7830E"><enum>(A)</enum><text>the Attorney
			 General;</text>
				</subparagraph><subparagraph id="id641E30BF94D844D59E211618BB2CAECF"><enum>(B)</enum><text>the Deputy
			 Attorney General;</text>
				</subparagraph><subparagraph id="idCFFD2621ECCC4B6C86D2A4B38A90E76C"><enum>(C)</enum><text>the Associate
			 Attorney General; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8B61C516D7194AE89FDF82ABD18E5976"><enum>(D)</enum><text display-inline="yes-display-inline">any officer or employee designated under
			 section 2(a); and</text>
				</subparagraph></paragraph><paragraph id="idF71F23E693F84B6A973D14AD05585A16"><enum>(3)</enum><text>the term
			 <term>covered White House officer</term> means—</text>
				<subparagraph id="id24F9587E709943738F55EE337EBFB0D3"><enum>(A)</enum><text>the
			 President;</text>
				</subparagraph><subparagraph id="id2D760FE954A84F7DB12C28CCF4B97C66"><enum>(B)</enum><text>the Vice
			 President;</text>
				</subparagraph><subparagraph id="idC6BD2E5129AC405D84964D36F2DF8BCE"><enum>(C)</enum><text>the Counsel to the
			 President;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA0A19E71FAB84A04B0FC22486E4E4318"><enum>(D)</enum><text display-inline="yes-display-inline">the Counselor to the President; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA069CA4844504D799A93664C5C25C76B"><enum>(E)</enum><text display-inline="yes-display-inline">any officer or employee designated under
			 section 2(b).</text>
				</subparagraph></paragraph></section><section changed="deleted" commented="no" committee-id="SSJU00" display-inline="no-display-inline" id="idDFB71B6AE09C4E419B4BABD2C986614F" reported-display-style="strikethrough"><enum>2.</enum><header>Designation of
			 other covered officers</header>
			<subsection commented="no" display-inline="no-display-inline" id="id85411705F0F746F0A36722A9182ED001"><enum>(a)</enum><header>Department of
			 Justice</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idFC0631866BA64774B217345947E3BC70"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General may designate any officer or
			 employee of the Department of Justice as a covered Department of Justice
			 officer.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1D0C7A37C2CB41E09FA39DB5B4EC9BE6"><enum>(2)</enum><header>Nondelegable
			 authority</header><text>The Attorney General may not delegate the authority
			 under paragraph (1) to any officer or employee of the Department of
			 Justice.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id199E098C9C74438086096079358DCC7B"><enum>(b)</enum><header>White
			 House</header><text>The President may designate any officer or employee of the
			 White House Office as a covered White House officer.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1263B6FDCD304D49A8C7EB1AE60CB910"><enum>(c)</enum><header>Notification to
			 Congress</header><text>Not later than 3 days after making a designation under
			 this section, the Attorney General or the President, as the case may be, shall
			 submit a notification of that designation, with an explanation of the necessity
			 of that designation, to the Committee on the Judiciary of the Senate and the
			 Committee on the Judiciary of the House of Representatives.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSJU00" display-inline="no-display-inline" id="idC8E8E04803FD418FAB604808F476B5D8" reported-display-style="strikethrough"><enum>3.</enum><header>Limitations on
			 communications</header><text display-inline="no-display-inline">Any covered
			 communication between an officer or employee of the Department of Justice and
			 an officer or employee of the White House Office may only be made between a
			 covered Department of Justice officer and a covered White House officer.</text>
		</section><section changed="deleted" commented="no" committee-id="SSJU00" display-inline="no-display-inline" id="idCCF68210B43144B3BF14F39F5DF847FF" reported-display-style="strikethrough"><enum>4.</enum><header>Rule of
			 Construction</header><text display-inline="no-display-inline">Nothing in this
			 Act shall be construed as affecting any limitation on covered communications by
			 the Department of Justice or the White House Office that is more restrictive
			 than the limitations under this Act.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSJU00" id="id0a515f9e-d7e6-4a65-a32c-cc9531c38305" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Security from Political Interference
			 in Justice Act of 2007</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSJU00" id="id8DB1402E4FDB46AB8F19204CE14B8E81" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="id27f77c90-74a5-4391-9e7d-aa974ff8e721"><enum>(1)</enum><text>the term <term>covered
			 communication</term>—</text>
				<subparagraph id="ide78366af-b13b-40fc-9c44-173073909fe9"><enum>(A)</enum><text>means any communication
			 relating to an ongoing investigation conducted by the Department of Justice in
			 any civil or criminal matter (regardless of whether a civil action or criminal
			 indictment or information has been filed); and</text>
				</subparagraph><subparagraph id="id985c947f-2968-4402-8dfd-2b72a4e5090b"><enum>(B)</enum><text>does not include any
			 communication relating to policy, appointments, legislation, rulemaking,
			 budgets, public relations, programmatic matters, intergovernmental relations,
			 administrative or personnel matters, appellate litigation, or requests for
			 legal advice;</text>
				</subparagraph></paragraph><paragraph id="id35d94567-3bfb-49e5-9a0d-5329b57c6520"><enum>(2)</enum><text>the term <term>covered
			 Department of Justice officer</term> means—</text>
				<subparagraph id="id2c6db86c-3804-4c60-af0c-a74e1dd7540d"><enum>(A)</enum><text>the Attorney
			 General;</text>
				</subparagraph><subparagraph id="ide9dfb729-7f2f-4a12-b22f-60dc8698c6df"><enum>(B)</enum><text>the Deputy Attorney
			 General; and</text>
				</subparagraph><subparagraph id="id0ab12510-8508-4614-bcab-8c602726461b"><enum>(C)</enum><text>the Associate Attorney
			 General; and</text>
				</subparagraph></paragraph><paragraph id="idf1a71a8b-fbca-415f-957b-8e54e9a43d34"><enum>(3)</enum><text>the term <term>covered
			 White House officer</term> means—</text>
				<subparagraph id="id433c5b04-3da2-49d0-9304-a5a64bc19d52"><enum>(A)</enum><text>the President;</text>
				</subparagraph><subparagraph id="id83f6ab64-fc4f-4450-8e76-747daff918ae"><enum>(B)</enum><text>the Vice
			 President;</text>
				</subparagraph><subparagraph id="idfb6c41e3-30e3-4ef1-94c4-365ed319b7e8"><enum>(C)</enum><text>the Counsel to the
			 President; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89166aee-bbe7-4d8d-bcd0-020771cd8ab7"><enum>(D)</enum><text display-inline="yes-display-inline">the Counselor to the President.</text>
				</subparagraph></paragraph></section><section changed="added" commented="no" committee-id="SSJU00" display-inline="no-display-inline" id="id258155f7-4454-48b8-9459-69e00f0fc090" reported-display-style="italic"><enum>3.</enum><header>Reports to
			 Congress</header>
			<subsection commented="no" display-inline="no-display-inline" id="id88b48ea4-2464-4011-8e79-b64806198974"><enum>(a)</enum><header>Department of Justice
			 report</header><text>Not later than 30 days after each January 1 and July 1 of
			 each calendar year, the Attorney General shall submit to the Committee on the
			 Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives a report with the name and title of each officer or employee of
			 the Department of Justice who made a covered communication during the 6-month
			 period preceding that January 1 or July 1 with any officer or employee of the
			 Executive Office of the President. The report need not include any covered
			 Department of Justice officer.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id20f8626c-1f86-4943-8589-304d1976186e"><enum>(b)</enum><header>White House
			 report</header><text>Not later than 30 days after each January 1 and July 1 of
			 each calendar year, the Counsel to the President shall submit to the Committee
			 on the Judiciary of the Senate and the Committee on the Judiciary of the House
			 of Representatives a report with the name and title of each officer or employee
			 of the Executive Office of the President who made a covered communication
			 during the 6-month period preceding that January 1 or July 1 with any officer
			 or employee of the Department of Justice. The report need not include any
			 covered White House officer.</text>
			</subsection></section></legis-body><official-title-amendment>Amend the title so as to read:
	 <quote>To provide for a reporting requirement regarding communications between
	 the Department of Justice and the White House relating to civil and criminal
	 investigations, and for other purposes.</quote>.</official-title-amendment>
