		  to improve disclosures for private student loans, and for other

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Private Student Loan Disclosure
			 Enhancement Act of 2007</short-title></quote>.</text>
		</section><section id="id02306E5C611147AB81592CA6F01B9F15" section-type="subsequent-section"><enum>2.</enum><header>Application of Truth
			 in Lending Act </header><text display-inline="no-display-inline">Section 104(3)
			 of the <act-name>Truth in Lending Act</act-name> (15 U.S.C. 1603(3)) is amended
			 by inserting before the period at the end the following <quote>, and other than
			 private education loans, as that term is defined in section 128(e), regardless
			 of the amount financed</quote>.</text>
		</section><section id="idB3AF1F6ABD82435BB0A1156CEE695441" section-type="subsequent-section"><enum>3.</enum><header>Enhanced disclosures
			 for private student loans</header>
			<subsection id="idA931C52C21F142C191423FAD61314C5B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 128 of the
			 <act-name>Truth in Lending Act</act-name> (15 U.S.C. 1638) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id867D878D8D1142DAA361C07BF77A4D59" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID9478AFDA936D4875A819D777E509CCA3"><enum>(e)</enum><header display-inline="yes-display-inline">Terms and disclosure with respect to
				private student loans</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID4043896C65D0469282D0DBB36B654688"><enum>(1)</enum><header>Disclosures
				required in private student loan applications and
				solicitations</header><text>In any application for a private student loan, or a
				solicitation for a private student loan without requiring an application, the
				lender shall disclose to the borrower, clearly and conspicuously—</text>
							<subparagraph id="IDF5A9669A11AF4DDDAF0F077085161653"><enum>(A)</enum><text>the potential
				range of annual percentage rates of interest applicable to the private student
				loan;</text>
							</subparagraph><subparagraph id="id5B47305224B043EAACE395895C29895F"><enum>(B)</enum><text>whether the rate
				of interest applicable to the private student loan is fixed or variable;</text>
							</subparagraph><subparagraph id="idBB3F967570274BB2B7FCA40D311AFCD0"><enum>(C)</enum><text>limitations on
				interest rate adjustments, both in terms of frequency and amount, or the lack
				thereof;</text>
							</subparagraph><subparagraph id="ID2ef6bd7a1d7b4db98c22387210359b7f"><enum>(D)</enum><text>requirements for
				a parent or co-borrower, including any changes in the applicable interest rates
				without a parent or co-borrower;</text>
							</subparagraph><subparagraph id="ID7c6b03c7f8f1489fb2c98ced30bd28f3"><enum>(E)</enum><text>all potential
				finance charges, late fees, penalties, and adjustments to principal, based on
				transgressions of the borrower;</text>
							</subparagraph><subparagraph id="ID18ba727ede27471aa214c46e7078d272"><enum>(F)</enum><text>fees or range of
				fees (along with basis for variations in fees) applicable to the private
				student loan;</text>
							</subparagraph><subparagraph id="ID35be6d836fc7408292ee878110f44f9b"><enum>(G)</enum><text>the term of
				loan;</text>
							</subparagraph><subparagraph id="IDf233d7efaf374a289d36569ec129234d"><enum>(H)</enum><text>whether interest
				will accrue while the student to whom the private student loan relates is
				enrolled at an institution of higher education;</text>
							</subparagraph><subparagraph id="ID612e217dcfc849cbb904585942eb58e7"><enum>(I)</enum><text>payment deferral
				options, including whether the deferment would apply to interest or principal,
				or both;</text>
							</subparagraph><subparagraph id="IDc3ed56028c954fb984f06a5f30bcd905"><enum>(J)</enum><text>if only principal
				may be deferred, whether the student may postpone the payment of interest by
				capitalization of the interest;</text>
							</subparagraph><subparagraph id="ID5aa34eab7fe84186be22d7e29e871a40"><enum>(K)</enum><text>whether deferrals
				may be extended for additional periods of enrollment at an institution of
				higher education;</text>
							</subparagraph><subparagraph id="IDcb9d9ab16aa54aa6a5d2694f09842dd7"><enum>(L)</enum><text>the duration of
				any payment grace period;</text>
							</subparagraph><subparagraph id="IDc21b73c08c194cec8589942fd1ce485c"><enum>(M)</enum><text>eligibility
				criteria for the private student loan;</text>
							</subparagraph><subparagraph id="ID3ff81ceb616446a6b47e010b0850fe18"><enum>(N)</enum><text>3 examples of the
				total cost of the private student loan over the life of the loan—</text>
								<clause id="id58EA69229C39469280D1ECACFE8C0045"><enum>(i)</enum><text>2
				of which shall be calculated using the same principal amount, one of those
				using the maximum possible rate of interest (or 36 percent, if no maximum
				amount is specified in the terms of the loan); and</text>
								</clause><clause id="id0EAB0F0AFA194764B41737A661225429"><enum>(ii)</enum><text>calculated both
				with and without capitalization of interest if that is an option for postponing
				interest payments;</text>
								</clause></subparagraph><subparagraph id="id195AD5250D1F4DE08E98162A3ECA2B4A"><enum>(O)</enum><text>in any case in
				which the applicable rate of interest is variable, a disclosure that interest
				rates are variable and that any projected cost at less than the maximum rate of
				interest is likely to go up significantly;</text>
							</subparagraph><subparagraph id="ID599ae0dda9754fe3a21ba2b8f609f959"><enum>(P)</enum><text>a statement that
				an institution of higher education may have school-specific student loan
				benefits and terms not detailed on the disclosure form; and</text>
							</subparagraph><subparagraph commented="no" id="idB1DA7AB5F8FF4D1682217ADCBD65954F"><enum>(Q)</enum><text>such other
				information as the Board shall prescribe, by rule, as necessary for consumers
				to make informed borrowing decisions.</text>
							</subparagraph></paragraph><paragraph id="IDB8725C5EB08E45019E12FB3D06D1C2CE"><enum>(2)</enum><header>Disclosures at
				the time of private student loan approval</header><text>Contemporaneously with
				the approval of a private student loan application, and before the loan
				transaction is consummated, the lender shall disclose to the borrower, clearly
				and conspicuously—</text>
							<subparagraph id="ID255ad22e868d45f7845526a8b1eb4d54"><enum>(A)</enum><text>the applicable
				rate of interest;</text>
							</subparagraph><subparagraph id="IDf65376469583402e9b9f220f64f4540f"><enum>(B)</enum><text>whether the rate
				of interest applicable to the private student loan is fixed or variable;</text>
							</subparagraph><subparagraph id="IDddef91ccb6bf44f38845f347dea4424f"><enum>(C)</enum><text>limitations on
				interest rate adjustments, both in terms of frequency and amount, or the lack
				thereof;</text>
							</subparagraph><subparagraph id="ID4c2dc6a89cde4f8aa8a82d133fa2bc0b"><enum>(D)</enum><text>the principal
				amount for repayment;</text>
							</subparagraph><subparagraph id="IDada375a474834254b92c1d286ea8f100"><enum>(E)</enum><text>the applicable
				annual percentage rate (or <term>APR</term>) with respect to the private
				student loan;</text>
							</subparagraph><subparagraph id="IDa1f60da54c634defb014fcca65e128e7"><enum>(F)</enum><text>applicable
				finance charges, late fees, penalties, and adjustments to principal, based upon
				borrower transgressions;</text>
							</subparagraph><subparagraph id="IDe9801a8d29254b33a43e5537936dc36e"><enum>(G)</enum><text>fees upon
				disbursement of the private student loan;</text>
							</subparagraph><subparagraph id="ID34983dfe6a6c4ee98c60f58c0774e5ce"><enum>(H)</enum><text>the term of the
				private student loan;</text>
							</subparagraph><subparagraph id="ID52a33d0cd05547138bbe45f4cba29c7a"><enum>(I)</enum><text>the monthly
				payment, calculated using the rate of interest in effect on the date of
				approval, initially required after the student to whom the private student loan
				relates is no longer enrolled at an institution of higher education, and the
				maximum monthly payment to which such amount could increase if rates are
				variable, which amounts shall be calculated—</text>
								<clause commented="no" id="id5B95A5A384F0473894CD0F0B6C1AA500"><enum>(i)</enum><text>using the
				principal amount that will be in effect at that post-enrollment time
				(incorporating accrual of interest during the educational years, if
				applicable), rather than at the time of consummation of the loan; and</text>
								</clause><clause id="IDae40c7e1653a4cc98aa2a87c6521a693"><enum>(ii)</enum><text>in the case of a
				variable rate private student loan that has no cap on the rate of interest,
				assuming a maximum interest rate of 36 percent;</text>
								</clause></subparagraph><subparagraph id="IDaf82db10bd334517887ae4fc99812718"><enum>(J)</enum><text>an estimate of
				the total amount for repayment, at both the interest rate in effect on the date
				of approval, and at the maximum possible rate of interest if the rate is
				variable (assuming a maximum rate of 36 percent if no maximum rate is specified
				by the terms of the loan);</text>
							</subparagraph><subparagraph id="ID3958fcc87af24f8a90f498af20869986"><enum>(K)</enum><text>any principal and
				interest payments required while the student to whom the private student loan
				relates is enrolled at an institution of higher education and interest which
				will accrue during such enrollment;</text>
							</subparagraph><subparagraph id="id5DDAC1B5579A4720A37677D68496BEA8"><enum>(L)</enum><text>payment deferral
				options, including whether the deferment would apply to interest or principal,
				or both;</text>
							</subparagraph><subparagraph id="id5A6302AE2D364608A228CB8B84012742"><enum>(M)</enum><text>if only principal
				may be deferred, whether the student may postpone the payment of interest by
				capitalization of the interest;</text>
							</subparagraph><subparagraph id="id4D5F6F7EB5B64510A3BB16BF422F1FCB"><enum>(N)</enum><text>whether deferrals
				may be extended for additional periods of enrollment at an institution of
				higher education;</text>
							</subparagraph><subparagraph id="id760D04B4753A431AA5C69D33DB475925"><enum>(O)</enum><text>the duration of
				any payment grace period;</text>
							</subparagraph><subparagraph id="IDaaacbbecd47f46b3aa903149c3312f50"><enum>(P)</enum><text>any penalty for
				early repayment of the private student loan;</text>
							</subparagraph><subparagraph id="ID01b8fe29ba69475f8a198a93c9edc922"><enum>(Q)</enum><text>whether monthly
				payments are graduated;</text>
							</subparagraph><subparagraph id="idCB34B965F1CC405A9617905831B0411C"><enum>(R)</enum><text>that the borrower
				shall have 30 calendar days following the date on which the application for the
				private education loan is approved and the borrower receives the disclosure
				documents required under this subsection for the loan, to accept the terms of
				the private education loan and consummate the transaction, and the rates and
				terms of the loan may not be changed by the lender during that period;
				and</text>
							</subparagraph><subparagraph commented="no" id="id84EB8B520E3A41F38CAF0A6015EDB8A1"><enum>(S)</enum><text>such other
				information as the Board shall prescribe, by rule, as necessary for consumers
				to make informed borrowing decisions.</text>
							</subparagraph></paragraph><paragraph id="id70CF6911659B49F98E793A4990263005"><enum>(3)</enum><header>Format of
				disclosures</header><text>Disclosures required under paragraphs (1) and (2)
				shall appear in a clearly legible (not less than 12-point font), uniform
				format, subject to section 122(c).</text>
						</paragraph><paragraph commented="no" id="id13F1BBF78FB14E3E86911AC4D96E4CDB"><enum>(4)</enum><header>Effective
				period of approved rate of interest and loan terms</header><text>With respect
				to a private student loan, the borrower shall have 30 calendar days following
				the date on which the application for the private education loan is approved
				and the borrower receives the disclosure documents required under this
				subsection for the loan to accept the terms of the loan and consummate the
				transaction, and the rates and terms of the loan may not be changed by the
				lender during that period, subject to the rules of the Board.</text>
						</paragraph><paragraph id="id0C71BF05B14F40B191E8145E4F529659"><enum>(5)</enum><header>Definitions</header><text>For
				purposes of this subsection—</text>
							<subparagraph id="id688F48884E66438B9D42A904B57C7117"><enum>(A)</enum><text>the term
				<term>institution of higher education</term> has the same meaning as in section
				102 of the <act-name>Higher Education Act of 1965</act-name> (20 U.S.C.
				1002);</text>
							</subparagraph><subparagraph id="idAB4A423DF138450891EEDEECE6A9D6FD"><enum>(B)</enum><text>the term
				<term>lender</term> means a creditor, other than an issuer of credit under a
				residential mortgage transaction, and any agent thereof; and</text>
							</subparagraph><subparagraph id="ID73c9c505e6e048198819ad4d27e6b712"><enum>(C)</enum><text>the term
				<term>private education loan</term> means a private loan provided by a lender
				that—</text>
								<clause id="id8488E151FB6749F2801CEB409675BD15"><enum>(i)</enum><text>is not made,
				insured, or guaranteed under any Federal, State, or local government unit,
				including under subtitle B of title IV of the <act-name>Higher Education Act of
				1965</act-name> (20 U.S.C. 1070 et seq.); and</text>
								</clause><clause id="IDbdeff1cf8f6b432b8aed743fe77e7cc7"><enum>(ii)</enum><text>is issued by a
				lender for postsecondary educational expenses to a student, or the parent of
				the student, regardless of whether the loan is provided through the educational
				institution that the student attends or directly to the student or parent from
				the
				lender.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idDA3A7A8110EA432A8D796F8896274FA0"><enum>(b)</enum><header>Regulations To
			 carry out private education loan disclosures</header>
				<paragraph id="id7E30BDBAF71042F08E46235122A25977"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Board of
			 Governors of the Federal Reserve System (in this section referred to as the
			 <term>Board</term>) shall issue regulations in final form to carry out section
			 128(e) of the <act-name>Truth in Lending Act</act-name>, as added by this
			 section, not later than 6 months after the date of enactment of this
			 Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2519D3436DE04523917E0366DB764E9E"><enum>(2)</enum><header>Development and
			 testing of disclosure statement</header><text>The Board shall, in issuing
			 regulations under paragraph (1), develop and test for readability a disclosure
			 statement for student borrowers that is consistent with the requirements of
			 section 122(c) of the <act-name>Truth in Lending Act</act-name> (15 U.S.C.
			 1638(c)).</text>
				</paragraph></subsection><subsection id="idC6B8CD71F5B84CF4A9BD2E48344F233E"><enum>(c)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 122(c) of
			 the <act-name>Truth in Lending Act</act-name> (15 U.S.C. 1632(c)) is amended by
			 inserting <quote>and in section 128(e)</quote> before <quote>shall
			 be</quote>.</text>
			</subsection></section><section id="id933F8076B7B8496281C775205C557236"><enum>4.</enum><header>Enforcement of
			 requirements for private education loans</header><text display-inline="no-display-inline">Section 130 of the <act-name>Truth in
			 Lending Act</act-name> (15 U.S.C. 1640) is amended—</text>
			<paragraph id="idAEDE4094E2E24593BDB19498BFAC8E78"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the fourth sentence
			 of the undesignated matter at the end, by inserting <quote>or section
			 128(e),</quote> before <quote>or for failing</quote>; and</text>
			</paragraph><paragraph id="id212CB568705741AF9EDAC1A93F6C6531"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e), in the first sentence,
			 by inserting before the period the following: <quote>, except that, in the case
			 of a private education loan (as defined in section 127(e)), such an action may
			 be brought not later than one year after the date on which the first monthly
			 payment on the loan is due after the student to whom the private student loan
			 relates is no longer enrolled at an institution of higher education, unless
			 full repayment begins earlier with no deferral of interest or
			 principal</quote>.</text>
			</paragraph></section><section id="idEE34D916897541078DD4BD3DE963A50D"><enum>5.</enum><header>Disclosures of
			 Federal loan availability</header>
			<subsection id="idB0EA935E47924A88B67D1020C507566D"><enum>(a)</enum><header>Disclosure
			 required</header><text>The Board shall issue regulations in final form not
			 later than 6 months after the date of enactment of this Act to require each
			 lender to disclose in accordance with subsection (b), contemporaneously with
			 the disclosures required under paragraphs (1) and (2) of section 128(e) of the
			 <act-name>Truth in Lending Act</act-name> (as added by this Act), that the
			 student borrower may be eligible for a Federal education loan.</text>
			</subsection><subsection id="id33E58B674C064DE9AB2B680FC9E35587"><enum>(b)</enum><header>Development and
			 testing of disclosure statement</header><text>The Board shall, in issuing
			 regulations under subsection (a), develop and test for readability a disclosure
			 statement for student borrowers that—</text>
				<paragraph id="idBE89BF0AA5F74BB2A05D2438E61D6DEF"><enum>(1)</enum><text>encourages
			 students to maximize their use of Federal education loans;</text>
				</paragraph><paragraph id="id98EF6B81ECF04FEA8DAB8CFD529B8679"><enum>(2)</enum><text>discloses that
			 Federal educational loans are less costly than private education loans;
			 and</text>
				</paragraph><paragraph id="id638E71BE213544F784BA31D72D3090C4"><enum>(3)</enum><text>discloses the
			 average rate of interest for Federal educational loans.</text>
				</paragraph></subsection><subsection id="id5F077A883E3341E89B7535E97EC259CA"><enum>(c)</enum><header>Format</header><text>The
			 disclosures developed under this section shall be made in clear language and in
			 a conspicuous location separate from the disclosures made under section 128(e)
			 of the <act-name>Truth in Lending Act</act-name>, as added by this Act, using
			 at least size 12 point font.</text>
			</subsection><subsection id="id2DD9F8747E1F46A396271BA92E8FB966"><enum>(d)</enum><header>Definitions</header><text>As
			 used in this section—</text>
				<paragraph id="id6A550AEF352E4F7AA919438FC741009F"><enum>(1)</enum><text>the term
			 <term>Board</term> means the Board of Governors of the Federal Reserve System
			 ;</text>
				</paragraph><paragraph id="id30ACB9B94DD3403897070D554FCC8181"><enum>(2)</enum><text>the term
			 <term>Federal education loan</term> means a loan that is —</text>
					<subparagraph id="id2F47D333065B4A49A33A81852352D15C"><enum>(A)</enum><text>made, insured, or
			 guaranteed under title IV of the <act-name>Higher Education Act of
			 1965</act-name> (20 U.S.C. 1070 et seq.); and</text>
					</subparagraph><subparagraph id="id18C076C21A9A49E1B3A2E9EA296CD21E"><enum>(B)</enum><text>is issued for
			 postsecondary educational expenses to a student, or the parent of the student,
			 regardless of whether the loan is provided through the educational institution
			 that the student attends or directly to the student or parent from the
			 lender;</text>
					</subparagraph></paragraph><paragraph id="id3099B41BCAFD4C8C9CD78AFE3CAF3D5D"><enum>(3)</enum><text>the term
			 <term>institution of higher education</term> has the same meaning as in section
			 102 of the <act-name>Higher Education Act of 1965</act-name> (20 U.S.C.
			 1002);</text>
				</paragraph><paragraph id="id40D6D2B3AD264173AC25DE1AC4DA0442"><enum>(4)</enum><text>the term
			 <term>lender</term> means a creditor, other than an issuer of credit under a
			 residential mortgage transaction, and any agent thereof, as those terms are
			 defined in section 103 of the <act-name>Truth in Lending Act</act-name>;
			 and</text>
				</paragraph><paragraph id="idB92D3042DA3D4D8D9EC91520398799E4"><enum>(5)</enum><text>the term
			 <term>private education loan</term> means a private loan provided by a lender
			 that—</text>
					<subparagraph id="idFB5C872B6E0646B2963877A35CC9E8DA"><enum>(A)</enum><text>is not made,
			 insured, or guaranteed under any Federal, State, or local government unit,
			 including under subtitle B of title IV of the <act-name>Higher Education Act of
			 1965</act-name> (20 U.S.C. 1070 et seq.); and</text>
					</subparagraph><subparagraph id="id0AAD9AEC22B84737B32EB2109DF191E0"><enum>(B)</enum><text>is issued by a
			 lender for postsecondary educational expenses to a student, or the parent of
			 the student, regardless of whether the loan is provided through the educational
			 institution that the student attends or directly to the student or parent from
			 the lender.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
