		<official-title>To amend the Energy Policy Act of 2005 to provide
		  individuals with an opportunity to participate in the financing or ownership of
		  local biorefineries.</official-title>

		<section id="id8C247B902EF3409D9B0EC534962C6EFE" section-type="section-one"><enum>1.</enum><header>Local ownership of
			 biorefineries</header>
			<subsection id="idC42085130E704CDFA99C61B00DFAF388"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subtitle A of title
			 II of the Energy Policy Act of 2005 (42 U.S.C. 15851 et seq.) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBBA23FF3BF60469D9E0460CE9BD5C3D8" style="OLC">
					<section id="id588B3BB3051147A388D354CCDD2C1DC3"><enum>212.</enum><header>Local
				ownership of biorefineries</header>
						<subsection id="idE51601B022884BD18467E2A910CCC02E"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id7158B35F3DB8426AB7805DE32BC3D0D8"><enum>(1)</enum><header>Biorefinery</header><text>The
				term <term>biorefinery</term> has the meaning given the term in section 9003(b)
				of the Farm Security and Rural Investment Act of 2002 (7 U.S.C.
				8103(b)).</text>
							</paragraph><paragraph id="id7BDF0588A3A14A7B9455E333428572FD"><enum>(2)</enum><header>Eligible
				purchaser</header><text>The term <term>eligible purchaser</term>, with respect
				to a biorefinery, means—</text>
								<subparagraph id="id4B6292DD4B634A7E90BBFF3137271127"><enum>(A)</enum><text>a natural person
				with a principal residence that is located not more than 50 miles from the
				biorefinery; or</text>
								</subparagraph><subparagraph id="idF1890F0D277A46F4A2B416EC43D74EA0"><enum>(B)</enum><text>a farmer or
				rancher cooperative.</text>
								</subparagraph></paragraph></subsection><subsection id="id26D0DB56018040329A0EFDD17E181EFC"><enum>(b)</enum><header>Requirement</header>
							<paragraph id="id819C0DE84AF74DD6B9FD89B57F8ACB0B"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraphs (2) and (3), in the case of a
				biorefinery that is financed, refinanced, or financially supported, in whole or
				in part, using a loan, loan guarantee, or grant made by a Federal agency on or
				after the date of enactment of this section, as a condition of the receipt of
				the loan, loan guarantee, or grant, the recipient shall provide eligible
				purchasers with an opportunity to participate in the financing or ownership of
				the biorefinery in accordance with this section.</text>
							</paragraph><paragraph id="idA2697E23B8A64094B2B4938FC6350AA1"><enum>(2)</enum><header>Farmers and
				rancher cooperatives</header>
								<subparagraph id="id7DDEBDB296F145B8B03252939926D50F"><enum>(A)</enum><header>In
				general</header><text>If the recipient of a loan, loan guarantee, or grant made
				by a Federal agency under paragraph (1) is a farmer or rancher cooperative, the
				requirement described in paragraph (1) is fulfilled.</text>
								</subparagraph><subparagraph id="id943B8590A5F14F0A9BDFC170564CE399"><enum>(B)</enum><header>Authority of
				farmer and rancher cooperative</header><text>A farmer or rancher cooperative
				described in subparagraph (A) may provide eligible purchasers with an
				opportunity to participate in the financing or ownership of the biorefinery in
				accordance with this section.</text>
								</subparagraph></paragraph><paragraph id="id85BBF0A7C00A473D8054B277DF05738F"><enum>(3)</enum><header>Level of
				Federal support</header><text>Paragraph (1) shall apply to a biorefinery only
				if not less than 3 percent of the total amount of funds that is used to
				finance, refinance, or financially support the biorefinery is derived from
				Federal funds.</text>
							</paragraph></subsection><subsection id="id1A076C5BC03C4ACC9AD574134CB28641"><enum>(c)</enum><header>Terms and
				conditions</header><text>To be eligible to receive a loan, loan guarantee, or
				grant from a Federal agency in connection with a biorefinery, the
				recipient—</text>
							<paragraph id="id1D469CDFB64644CC9D2E2EFED9C534FD"><enum>(1)</enum><text>during the 60-day
				period beginning on the date of receipt of the loan, loan guarantee, or grant
				by the recipient, shall permit eligible purchasers to participate in the
				financing or ownership of the biorefinery on the conditions that—</text>
								<subparagraph id="id81A3A497CB4A4E38A6644C10040F37C6"><enum>(A)</enum><text>eligible
				purchasers, collectively, be allowed to invest not less than 40 percent of the
				projected total amount of non-Federal funds that will be used to construct or
				expand the biorefinery; and</text>
								</subparagraph><subparagraph id="idFB60C74FADD749ACB1CBD0E58EB2EBF0"><enum>(B)</enum><text>an individual
				eligible purchaser be allowed to invest not more than 2.5 percent of the
				projected total amount of non-Federal funds that will be used to construct or
				expand the biorefinery;</text>
								</subparagraph></paragraph><paragraph id="idA75FC26DC0D84A968CF8834AED40F860"><enum>(2)</enum><text>shall provide to
				eligible purchasers competitive terms and conditions that are no less favorable
				than the terms and conditions that are offered for funding for similar
				recipients or classes of recipients or, if there are no similar recipients or
				classes of recipients, other entities with similar risk characteristics, as
				determined by the Secretary;</text>
							</paragraph><paragraph id="id44E22AB92E0E47E585C3BEBF54E7E68F"><enum>(3)</enum><text>if the amount of
				funding offered by eligible purchasers for a biorefinery exceeds the amount
				that is solicited by a recipient, may—</text>
								<subparagraph id="id93F799DAFB88431F9A8063C291D8840F"><enum>(A)</enum><text>accept all such
				offered amounts; or</text>
								</subparagraph><subparagraph id="id272C2B2D2F5145FA9A545D846C68114C"><enum>(B)</enum><text>award the amounts
				on a competitive basis; and</text>
								</subparagraph></paragraph><paragraph id="id2C254A1D7A074EB9BB0DCFD6C2AA6475"><enum>(4)</enum><text>shall conduct the
				financing or refinancing of the biorefinery in accordance with Federal law
				(including Federal law governing
				securities).</text>
