<enum>I</enum><header>Through Higher Education: Promoting the Advancement of Tribal Health</header> <section id="id2239522000344A969C393370B39DE132"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Through Higher Education: Promoting the Advancement of Tribal Health Act</quote> or <quote>THE PATH Act</quote>.</text> </section><section id="ID76a1d44bcdec4065b17b5f8c9e63d9bd"><enum>102.</enum><header>Findings and purpose</header> <subsection id="IDd31ac477323543869264b9381e9fdd38"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="IDbcd4d0ff062e49cb8b72a7d59bd0e77a"><enum>(1)</enum><text>because there is a significant lack of health-related education and training opportunities for Indians, few Indians are represented in the health-related workforce of the United States;</text> </paragraph><paragraph id="ID79d37f3e5a2549fc9403892bf71a78bc"><enum>(2)</enum><text>tribal colleges and universities remain the most poorly-funded institutions of higher education in the United States, yet, as engaged institutions, tribal colleges and universities serve as true catalysts for positive change in Indian communities;</text> </paragraph><paragraph id="IDf616065d4ba84c8cb1bd5cfd03c95835"><enum>(3)</enum><text>tribal colleges and universities with nursing programs train hundreds of students to hold critically-needed leadership and management positions in the Indian Health Service, tribal health organizations, and private and community agencies serving rural Indian populations;</text> </paragraph><paragraph id="IDbbb19df2d15c47df9d5b347e0f1deeb5"><enum>(4)</enum><text>to the extent that tribal colleges and universities are able, the colleges and universities have begun to address the many societal challenges faced by Indian communities;</text> </paragraph><paragraph id="ID505ff874630e4bec9c1d1202a9547d94"><enum>(5)</enum><text>tribal colleges and universities offer critically-needed education and outreach programs, including—</text> <subparagraph id="id4FDADC1DD1474361AFD5833B50C11A24"><enum>(A)</enum><text>community health fairs;</text> </subparagraph><subparagraph id="idA888B06A74A64C38B35C3C97B6573225"><enum>(B)</enum><text>HIV–AIDS education programs;</text> </subparagraph><subparagraph id="id38667F91D21B498BA71F0CDC366F1C3A"><enum>(C)</enum><text>extensive diabetes programs;</text> </subparagraph><subparagraph id="idB7B82824A9454FA4A5974B13671336CA"><enum>(D)</enum><text>nutritional and obesity programs, including community garden programs;</text> </subparagraph><subparagraph id="idC34D1AECC9C742F6B4F90B1FCC378438"><enum>(E)</enum><text>substance abuse prevention programs;</text> </subparagraph><subparagraph id="idFB12B5C8C6804597A4AF6C187E680481"><enum>(F)</enum><text>youth-at-risk programs;</text> </subparagraph><subparagraph id="idB07FB592E86241FC867CAE5E9D806C49"><enum>(G)</enum><text>parenting classes; and</text> </subparagraph><subparagraph id="id9474CEC2CB314AC492ADDAD3C413D6A1"><enum>(H)</enum><text>child and elder care services; and</text> </subparagraph></paragraph><paragraph id="IDe091fe0713504728a718601774ccf5ff"><enum>(6)</enum><text>due to a chronic lack of operational and targeted program funding, together with the unwillingness of certain Federal agencies to recognize tribal colleges and universities as valuable partners in addressing rural community issues, including health issues, tribal colleges and universities have limited resources available to adequately address the perennial health challenges of the rural communities served by the tribal colleges and universities.</text> </paragraph></subsection><subsection id="IDa434fa66057e49db9c6d4660c8bd7ac9"><enum>(b)</enum><header>Purpose</header><text>The purpose of this title is to assist tribal colleges and universities to strengthen Indian communities through the provision of health promotion and disease prevention education, outreach, and workforce development programs, including through program implementation, research, and capacity-building.</text> </subsection></section><section id="IDab1800cabbc54d27adc4b6969f1de8da"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="idD20CA96653E44B62A2A57E9BCE8A7D89"><enum>(1)</enum><header>Deputy Assistant Secretary</header><text>The term <term>Deputy Assistant Secretary</term> means the Deputy Assistant Secretary for Minority Health, within the Office of Public Health and Science.</text> </paragraph><paragraph id="id8E89AB3A14374E03AF2837AD22EEC6A2"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Institutes of Health.</text> </paragraph><paragraph id="id5B1285114D5B4E008DE345FFE83C3E52"><enum>(3)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (25 U.S.C. 1603).</text> </paragraph><paragraph id="idE376CD62453040169CC8AF62CB4E2D98"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph><paragraph id="idA0439E8B9BF8441FAED4F12EF1B26AF7"><enum>(5)</enum><header>Tribal college or university</header><text display-inline="yes-display-inline">The term <term>tribal college or university</term> means—</text> <subparagraph id="id5C4B7D7F927247ABAFED6D7E54553AFA"><enum>(A)</enum><text>an institution that is eligible to receive funds under the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801 et seq.);</text> </subparagraph><subparagraph id="idE89E960CCECC4E268931FFA8EB772A55"><enum>(B)</enum><text>Diné College; and</text> </subparagraph><subparagraph id="idF5F4AA2CD20E4185B0A7E1C4E4B3BB12"><enum>(C)</enum><text>any 1 of the 1994 Institutions (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (7 U.S.C. 301 note; Public Law 103–382)).</text> </subparagraph></paragraph></section><section id="id239A05E2E1B047D5B4EAFB09B316DA9A"><enum>104.</enum><header>Administration by coordinating officer</header> <subsection id="id91A0D30F14E54030B16EBAAA10439A3A"><enum>(a)</enum><header>Designation</header><text>The Deputy Assistant Secretary shall serve as the coordinating officer with respect to programs of tribal colleges and universities relating to health promotion and disease prevention.</text> </subsection><subsection id="id9A6B87DECA29457E964015647CBCF70A"><enum>(b)</enum><header>Staff</header><text>The Secretary shall appoint such additional staff as the Secretary determines to be necessary—</text> <paragraph id="id8950BE99E4F34940B37F5E6C9AE0AE88"><enum>(1)</enum><text>to assist the Deputy Assistant Secretary in carrying out the duties under this section; and</text> </paragraph><paragraph id="id58EB5377E23B42DC869F8723C6C91B09"><enum>(2)</enum><text>to provide appropriate technical assistance to tribal colleges and universities that receive grants or enter into cooperative agreements under this title.</text> </paragraph></subsection><subsection id="ID5da355eb370b4251ad2b16270d35c92b"><enum>(c)</enum><header>Memorandum of agreement</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in consultation with the Deputy Assistant Secretary, shall develop and implement a formal memorandum of agreement with the American Indian Higher Education Consortium to establish programs—</text> <paragraph id="id2F4890D546E44D21910041366EBE4522"><enum>(1)</enum><text>to ensure that Native American communities, through tribal colleges and universities, participate equitably in employment programs, services, and resources of the Department of Health and Human Services; and</text> </paragraph><paragraph id="id3DC23C5B31DD45D5936BF87A9821D63F"><enum>(2)</enum><text>to provide necessary technical assistance to the tribal colleges and universities.</text> </paragraph></subsection></section><section id="idAAED366CA4A64E3C90EC58D54297D13C"><enum>105.</enum><header>Community-based health and wellness fairs</header> <subsection id="id08D3429C354C4D5B9A2D889BFFB36CC3"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to carry out annual, community-based, and culturally relevant health and wellness fairs at the tribal colleges and universities.</text> </subsection><subsection id="id928E067E41DE46FAAE98A08ADBC8716F"><enum>(b)</enum><header>Funding</header> <paragraph id="id496266C4CB764D30A4026BDA5F0C06B6"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section for each of fiscal years 2009 through 2017 an amount equal to the sum of—</text> <subparagraph id="id605A0BF8DE374F5FB537D6C0FD50E035"><enum>(A)</enum><text>the product obtained by multiplying—</text> <clause id="id65EE5A46D12B449EBA516CF96CA86A05"><enum>(i)</enum><text>the number of tribal colleges and universities in operation on October 1 of the fiscal year; and</text> </clause><clause id="id7E1DA87A5BFD4A8288DED0E146915046"><enum>(ii)</enum><text>$15,000; and</text> </clause></subparagraph><subparagraph id="id95C4EAA3A5134A1990E28E187013C5CF"><enum>(B)</enum><text>such amount as the Secretary determines to be necessary for the costs of administering the program under this section.</text> </subparagraph></paragraph><paragraph id="idB9A3D62DDF2D4122AC1B89F85553EB32"><enum>(2)</enum><header>Total amount</header><text>Subject to paragraph (3), the Secretary shall use all amounts made available under paragraph (1)(A) to provide grants or enter into cooperative agreements pursuant to this section.</text> </paragraph><paragraph id="idB5CE93F65D57498283C7AAE32BF8DAA9"><enum>(3)</enum><header>Nonapplicability of limitation</header><text>The limitation under section 1703(c) of the Public Health Service Act (42 U.S.C. 300u–2(c)) shall not apply to this section.</text> </paragraph></subsection></section><section id="idA54E25F1E20F4B588D61669CA6D25464"><enum>106.</enum><header>Health promotion and disease prevention targeted programs; wellness centers</header> <subsection id="idB58CF305794E4769B20B58FB224FE765"><enum>(a)</enum><header>Health promotion and disease prevention targeted programs</header> <paragraph id="id3CF50C730E6E4FB1A9A798EC5C63FA7A"><enum>(1)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to carry out activities to improve and expand the capacity of the tribal colleges and universities—</text> <subparagraph id="idA53F57EF6F6F430FA3EEEA7D354C8B00"><enum>(A)</enum><text>to carry out activities relating to health promotion and disease prevention; and</text> </subparagraph><subparagraph id="id5E5C3BFFCC29432483806F7ED6C501C4"><enum>(B)</enum><text>to eliminate health disparities in tribal communities, to the maximum extent practicable.</text> </subparagraph></paragraph><paragraph id="id909D712BB61B4BD0835C1F0D58F0B43A"><enum>(2)</enum><header>Requirements</header><text>In providing grants and entering into cooperative agreements under this subsection, the Secretary, to the maximum extent practicable, shall—</text> <subparagraph id="id0D8511A246C24BD5A3A9A953CB38D14B"><enum>(A)</enum><text>approve applications on a competitive basis; and</text> </subparagraph><subparagraph id="id89F324B22A6A42968BAF9368F82D08A1"><enum>(B)</enum><text>ensure maximum and equitable distribution among eligible tribal colleges and universities.</text> </subparagraph></paragraph><paragraph id="idF5CBF5D2D1DE445EB911EC863754C5CD"><enum>(3)</enum><header>Application</header> <subparagraph id="idF543839AE6FC4D939EDA1E68EC6A8F1E"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant or enter into a cooperative agreement under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </subparagraph><subparagraph id="id0556F1CD01CA448EAA4354374092752B"><enum>(B)</enum><header>Inclusion</header><text>An application under subparagraph (A) shall include a description of a 5-year strategy of the applicable tribal college or university for meeting the health promotion and disease prevention needs of Indians or Alaska Natives, as appropriate, in the area served by the tribal college or university.</text> </subparagraph><subparagraph id="idC820345EEE49476D93D3DA133553A2B4"><enum>(C)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under subparagraph (A), taking into consideration the limited number of institutions that are eligible to receive assistance under this subsection.</text> </subparagraph></paragraph><paragraph id="idB52CAB9E0A474387822C9D198FC06488"><enum>(4)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this subsection may use the grant or cooperative agreement to develop and carry out activities to address targeted areas of health promotion and disease prevention in tribal communities, including activities relating to—</text> <subparagraph id="id7869D7FD84734DD0BE584C8FD7E25AB1"><enum>(A)</enum><text>diabetes education and prevention;</text> </subparagraph><subparagraph id="IDc8c3794e6a8a4388b0e84d3d99109079"><enum>(B)</enum><text>injury prevention;</text> </subparagraph><subparagraph id="ID7241419f694043b69092234d2270f8b1"><enum>(C)</enum><text>substance abuse, including methamphetamine abuse;</text> </subparagraph><subparagraph id="ID2dbd37f294c74f93b93ecfbe94817c3f"><enum>(D)</enum><text>HIV–AIDS prevention;</text> </subparagraph><subparagraph id="IDacd57c89ab2d43d69c0b79e187522e87"><enum>(E)</enum><text>emerging health promotion and disease prevention program and response development; and</text> </subparagraph><subparagraph id="IDbcbf1098c717460fb3dd9490e6d415ac"><enum>(F)</enum><text>obesity and nutrition.</text> </subparagraph></paragraph><paragraph id="id45A25D1A3E854A20B1A7BDE6F554D6BA"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for each of fiscal years 2009 through 2017.</text> </paragraph></subsection><subsection id="id61B01BFBE96F4506983762FB77FCEE8F"><enum>(b)</enum><header>Wellness centers</header> <paragraph id="idCAE7D3F00D3E4910959B6D962A1C2D21"><enum>(1)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities for purposes of—</text> <subparagraph id="ID0ef20fb6b3c44b379c3ef976afd3cdac"><enum>(A)</enum><text>construction, renovation, and modernization of community wellness centers located on the campuses of the tribal colleges and universities; and</text> </subparagraph><subparagraph id="ID1eddbfff6ead481a8f2582783557d11e"><enum>(B)</enum><text>construction, renovation, and modernization of outpatient student health clinics located on those campuses.</text> </subparagraph></paragraph><paragraph id="id123CB0CB0D70472DBF6F85322ABB92A7"><enum>(2)</enum><header>Maximum amount</header> <subparagraph id="id5C961C12A9F14495A1E0B73F34CFB120"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the maximum amount of a grant provided under paragraph (1) shall not exceed an amount equal to 95 percent of the cost of the project carried out by the applicable tribal college or university.</text> </subparagraph><subparagraph id="id4EE6C71CBE364D03BF47CC7849134075"><enum>(B)</enum><header>Exception</header><text>The limitation under subparagraph (A) shall not apply to a tribal college or university located in, as determined by the Secretary—</text> <clause id="idFBB393EC30314C4BAC7B5F629D23FFC8"><enum>(i)</enum><text>an urban area; or</text> </clause><clause id="idC6814217EB23478F937300C1EE0A334F"><enum>(ii)</enum><text>a poor rural area.</text> </clause></subparagraph></paragraph><paragraph id="ID9cc5093203cf46cfb72ec4bcd7e50226"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $15,000,000 for each of fiscal years 2009 through 2017.</text> </paragraph></subsection></section><section id="id55CA0C1D52064411A503AF132B770645"><enum>107.</enum><header>Development and expansion of public health professional degree programs</header> <subsection id="idB72C8A791DD643D4A42B9D43EEB1BCC8"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities for purposes of developing curricula, courses, and degree and in-service programs for health-related professions.</text> </subsection><subsection id="id174855AD5861499B961BBFD3077874AE"><enum>(b)</enum><header>Application</header> <paragraph id="id0F8597FF456444C3BC890958BFD5A1C4"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph id="idBF19FCA098014DA881129DC21B77C439"><enum>(2)</enum><header>Inclusion</header><text>An application under paragraph (1) shall include a description of a 5-year strategy of the applicable tribal college or university for increasing the number of Indians in the health workforce of the United States.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17FD89D70AB04A6B8029841271975597"><enum>(3)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="id669F372A2F6B4C2996E13BB9C7E1DB4A"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section><section id="idE4AED306049A4C09A17198086BF61532"><enum>108.</enum><header>Tribal College and University Rural Health Equity Endowment Fund</header> <subsection id="IDB87E6EB3E15A423C9459B522069F2D1F"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Tribal College and University Rural Health Equity Endowment Fund</quote> (referred to in this section as the <term>Fund</term>), consisting of—</text> <paragraph id="IDD2EF1B70D5204F73B84970D1BF09ABCD"><enum>(1)</enum><text>such amounts as are appropriated to the Fund under subsection (b); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID908456CA111641D6B7C30309EB6057AB"><enum>(2)</enum><text>any interest earned on those amounts.</text> </paragraph></subsection><subsection id="ID75847D4BD6B24B8E83CBB81F88EF90BB"><enum>(b)</enum><header>Transfers to Fund</header><text>There is appropriated to the Fund, out of funds of the Treasury not otherwise appropriated, $9,000,000 for each of fiscal years 2009 through 2017.</text> </subsection><subsection id="ID9c9c13e5cab84ae2b85f10f53d0b98a4"><enum>(c)</enum><header>Investments</header><text>The Secretary shall invest amounts in the Fund in interest-bearing obligations of the United States.</text> </subsection><subsection id="id49CD8300EEBD4B71A61C19AD806D49A3"><enum>(d)</enum><header>Expenditures from Fund</header> <paragraph id="idA2023A1F6C7A47FFACCCBD355893787A"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), on September 30 of fiscal year 2009 and annually thereafter through September 30, 2017, on request by the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary an amount equal to the amount of interest income earned on amounts in the Fund during the preceding fiscal year.</text> </paragraph><paragraph id="ID9724CABDFFA844AE9AEFD47A75CBECA6"><enum>(2)</enum><header>Administrative expenses</header><text>An amount not exceeding 1 percent of the annual interest yield distributed to tribal colleges and universities shall be available for each fiscal year to pay the administrative expenses necessary to carry out this section.</text> </paragraph></subsection><subsection id="id42772C7A818E48CC90829440093746AA"><enum>(e)</enum><header>Distribution of amounts</header><text>Of amounts transferred under subsection (d)(1), the Secretary shall distribute—</text> <paragraph id="id406A635EF339424B91AD3B3C0BEC88E0"><enum>(1)</enum><text>60 percent to tribal colleges and universities on a pro rata basis, based on the proportion that—</text> <subparagraph id="idE19E3095A1754942B717662AB0318970"><enum>(A)</enum><text>the Indian student count (as defined in section 2(a) of the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801(a)) of a tribal college or university for the applicable fiscal year; bears to</text> </subparagraph><subparagraph id="idA096A91EBA734819ABB9F46372BC1F9C"><enum>(B)</enum><text>the Indian student count of all tribal colleges and universities for that fiscal year; and</text> </subparagraph></paragraph><paragraph id="idC1D0D61A26494324865F8D8A3575F052"><enum>(2)</enum><text>40 percent in payments of equal amounts to each tribal college and university.</text> </paragraph></subsection><subsection id="idE643994CA2C943D58116E0C2E9991E76"><enum>(f)</enum><header>Use of funds</header><text>A tribal college or university shall use amounts received under this section to establish an endowment for a rural health-related program at the tribal college or university.</text> </subsection></section><section id="idA05B74231D8344748C68D61C1C527BEA"><enum>109.</enum><header>Offices of sponsored programs</header> <subsection id="idC97E7EA2FFFC4484950B6E9D9394B981"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Director, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities to establish and maintain at the tribal colleges and universities offices of sponsored programs described in subsection (b).</text> </subsection><subsection id="idC86B7F31321B417FA036D93C2B1FD9AA"><enum>(b)</enum><header>Sponsored programs</header><text>The sponsored programs referred to in subsection (a) include programs for—</text> <paragraph id="ID03b76ab918884de9a7772e530d473ac4"><enum>(1)</enum><text>pre- and post-grant award research, data collection, and analyses, through a method that ensures—</text> <subparagraph id="idB74D090EDD8E401E8B97DFD4D8858EBE"><enum>(A)</enum><text>proper documentation of relevant applications; and</text> </subparagraph><subparagraph id="id04DC3117CB124DD68706268345125A03"><enum>(B)</enum><text>compliance with applicable regulations and guidelines;</text> </subparagraph></paragraph><paragraph id="ID7750cab8b761413a9e80a2bc7a92695d"><enum>(2)</enum><text>advancing specific institutional grant application procedures and processes through coordination of external funding sources and faculty, staff, and financial officers;</text> </paragraph><paragraph id="ID71f1e71348604848b0a743d69bd62590"><enum>(3)</enum><text>assisting in negotiations with Federal funding sources;</text> </paragraph><paragraph id="ID143110608de84a25b7f1302b89412095"><enum>(4)</enum><text>providing liaisons with Federal counterparts of tribal colleges and universities—</text> <subparagraph id="id18450ED617DC4AEE82703FCE21B96BA4"><enum>(A)</enum><text>to train and assist principal investigators, faculty, and college staff with respect to grant management, reporting, and program implementation; and</text> </subparagraph><subparagraph id="id1DA2C6E06E7E485BAFC92BCA29FFCB83"><enum>(B)</enum><text>to ensure that applicable deadlines are met and required reports are completed;</text> </subparagraph></paragraph><paragraph id="IDf320e2c0bcfb42cd9a9d69312fe55761"><enum>(5)</enum><text>coordinating partnerships between tribal colleges and universities, Federal agencies, and the private sector for collaborative programs and activities; and</text> </paragraph><paragraph id="IDc9e8475cd3ef47b984bab92db437b409"><enum>(6)</enum><text>in consultation with Federal agencies, identifying and proposing solutions to—</text> <subparagraph id="id5F35D5894DC9488EB8CD635E498190C9"><enum>(A)</enum><text>obstacles relating to Federal agency grant application procedures and requirements; and</text> </subparagraph><subparagraph id="id06E127ADB50142569491CC831DCCD3BA"><enum>(B)</enum><text>other problems relating to Federal grant program structures and requirements.</text> </subparagraph></paragraph></subsection><subsection id="id68FD9BA49A5047DD9259B9EA6F082F42"><enum>(c)</enum><header>Application</header> <paragraph id="idC385D66ECC86412E8A6E70B7A45A6DA3"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF745D902AB15482AB0A19C09798E31FB"><enum>(2)</enum><header>Inclusion</header><text>An application under paragraph (1) shall include a description of a 5-year strategy of the applicable tribal college or university for carrying out a sponsored program at the tribal college or university, including performance indicators by which success of the tribal college or university will be evaluated.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id427309D06200410CA67FBA5D31CEBBF5"><enum>(d)</enum><header>Distribution of funds</header><text>For each of fiscal years 2009 through 2017, the Secretary, acting through the Director, shall provide to each tribal college and university the application of which is approved under subsection (c) a grant in an amount equal to the quotient obtained by dividing—</text> <paragraph id="idB40E813205544930A556CA7E2AB57114"><enum>(1)</enum><text>the total amount made available under subsection (f) for the fiscal year; by</text> </paragraph><paragraph id="id21E60D65C07C42218B2258EA4BE50328"><enum>(2)</enum><text>the number of tribal colleges and universities the applications of which are approved under subsection (c) for the fiscal year.</text> </paragraph></subsection><subsection id="id4DC728C160C741609E91D90631B62950"><enum>(e)</enum><header>Reports</header><text>For each of fiscal years 2010 through 2018, each tribal college or university that receives a grant under this section shall submit to the Director a report describing the success of the office of sponsored programs of the tribal college or university during the preceding fiscal year, as determined in accordance with the performance indicators contained in the application of the tribal college or university under subsection (c)(2).</text> </subsection><subsection id="idCF8C4D8D30754B079E4F3E08B632C157"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section for each of fiscal years 2009 through 2017 an amount equal to the product obtained by multiplying—</text> <paragraph id="id7C6F7C351E9C4338859C1213E5BFA423"><enum>(1)</enum><text>the number of tribal colleges and universities in operation on October 1 of the applicable fiscal year; and</text> </paragraph><paragraph id="idC2D40B053DE14C8881C7206375FE48FE"><enum>(2)</enum><text>$50,000.</text> </paragraph></subsection></section><section id="idDB3037E5E09341D181C0EBC111F992F7"><enum>110.</enum><header>Health promotion and disease prevention research programs</header> <subsection id="id95B9F432D7ED45A69F5C4D674744804C"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Director, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to conduct research relating to health promotion and disease prevention at the tribal colleges and universities.</text> </subsection><subsection id="idE114A4E8C65C4234957A8F9D6F8D2884"><enum>(b)</enum><header>Requirements</header> <paragraph id="id078B775F82094D2FBC24E641A066DFE1"><enum>(1)</enum><header>Competition</header><text>The Secretary shall provide grants and offer to enter into cooperative agreements under subsection (a) on a competitive basis.</text> </paragraph><paragraph id="idF340A46A1C3E48AAB76E94CF8E7D343B"><enum>(2)</enum><header>General terms and amounts</header><text>Except as provided in paragraph (3)—</text> <subparagraph id="idD80113BA35624061A75192796AF714C3"><enum>(A)</enum><text>the term of a grant or cooperative agreement under subsection (a) shall be not more than 3 years; and</text> </subparagraph><subparagraph id="id9F3A8E9A987E47308B898C55712D699D"><enum>(B)</enum><text>the minimum amount of a grant under subsection (a) for a fiscal year shall be $150,000.</text> </subparagraph></paragraph><paragraph id="idB1AF70EDA6CD4D77B1C69A3136035E9A"><enum>(3)</enum><header>Undergraduate research experience programs</header><text>With respect to a grant or cooperative agreement provided for an undergraduate research experience program under subsection (d)(3)—</text> <subparagraph id="idD36D9B93158542AFA942C7E2ACB42C9E"><enum>(A)</enum><text>the term of such a grant or cooperative agreement shall be not more than 1 year; and</text> </subparagraph><subparagraph id="id2EA584545D8844DB8C8443BD1ACFC41C"><enum>(B)</enum><text>the minimum amount of such a grant for a fiscal year shall be $10,000.</text> </subparagraph></paragraph></subsection><subsection id="id99AB7BB787C34D8D975DF2413B9DEB38"><enum>(c)</enum><header>Application</header> <paragraph id="id6DAC6EBDEC3B4E4A9072115447425CA5"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant, or to enter into a cooperative agreement, under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id066170D3914D4AD0BE63CFF6D00AE388"><enum>(2)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="idA730F6DA9A934439ABA4949D81A8ABED"><enum>(d)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this section may use the grant or cooperative agreement to carry out activities, including—</text> <paragraph id="ID1849ade931674379b34fced5bdc9227d"><enum>(1)</enum><text>research on culturally relevant and innovative health promotion and disease prevention strategies;</text> </paragraph><paragraph id="IDa289e8dd451c4d36973968b0b70aa60a"><enum>(2)</enum><text>epidemiological research on the health status of Indian populations and communities; and</text> </paragraph><paragraph id="ID3f83cbf28b304128ae38c29dec3ee5b8"><enum>(3)</enum><text>undergraduate research experience programs as the tribal college or university determines to be appropriate.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA349B08677A74131B0ED8DF5F4DA09B3"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $12,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section>

<enum>I</enum><header>Through Higher Education: Promoting the Advancement of Tribal Health</header> <section id="id2239522000344A969C393370B39DE132"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Through Higher Education: Promoting the Advancement of Tribal Health Act</quote> or <quote>THE PATH Act</quote>.</text> </section><section id="ID76a1d44bcdec4065b17b5f8c9e63d9bd"><enum>102.</enum><header>Findings and purpose</header> <subsection id="IDd31ac477323543869264b9381e9fdd38"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="IDbcd4d0ff062e49cb8b72a7d59bd0e77a"><enum>(1)</enum><text>because there is a significant lack of health-related education and training opportunities for Indians, few Indians are represented in the health-related workforce of the United States;</text> </paragraph><paragraph id="ID79d37f3e5a2549fc9403892bf71a78bc"><enum>(2)</enum><text>tribal colleges and universities remain the most poorly-funded institutions of higher education in the United States, yet, as engaged institutions, tribal colleges and universities serve as true catalysts for positive change in Indian communities;</text> </paragraph><paragraph id="IDf616065d4ba84c8cb1bd5cfd03c95835"><enum>(3)</enum><text>tribal colleges and universities with nursing programs train hundreds of students to hold critically-needed leadership and management positions in the Indian Health Service, tribal health organizations, and private and community agencies serving rural Indian populations;</text> </paragraph><paragraph id="IDbbb19df2d15c47df9d5b347e0f1deeb5"><enum>(4)</enum><text>to the extent that tribal colleges and universities are able, the colleges and universities have begun to address the many societal challenges faced by Indian communities;</text> </paragraph><paragraph id="ID505ff874630e4bec9c1d1202a9547d94"><enum>(5)</enum><text>tribal colleges and universities offer critically-needed education and outreach programs, including—</text> <subparagraph id="id4FDADC1DD1474361AFD5833B50C11A24"><enum>(A)</enum><text>community health fairs;</text> </subparagraph><subparagraph id="idA888B06A74A64C38B35C3C97B6573225"><enum>(B)</enum><text>HIV–AIDS education programs;</text> </subparagraph><subparagraph id="id38667F91D21B498BA71F0CDC366F1C3A"><enum>(C)</enum><text>extensive diabetes programs;</text> </subparagraph><subparagraph id="idB7B82824A9454FA4A5974B13671336CA"><enum>(D)</enum><text>nutritional and obesity programs, including community garden programs;</text> </subparagraph><subparagraph id="idC34D1AECC9C742F6B4F90B1FCC378438"><enum>(E)</enum><text>substance abuse prevention programs;</text> </subparagraph><subparagraph id="idFB12B5C8C6804597A4AF6C187E680481"><enum>(F)</enum><text>youth-at-risk programs;</text> </subparagraph><subparagraph id="idB07FB592E86241FC867CAE5E9D806C49"><enum>(G)</enum><text>parenting classes; and</text> </subparagraph><subparagraph id="id9474CEC2CB314AC492ADDAD3C413D6A1"><enum>(H)</enum><text>child and elder care services; and</text> </subparagraph></paragraph><paragraph id="IDe091fe0713504728a718601774ccf5ff"><enum>(6)</enum><text>due to a chronic lack of operational and targeted program funding, together with the unwillingness of certain Federal agencies to recognize tribal colleges and universities as valuable partners in addressing rural community issues, including health issues, tribal colleges and universities have limited resources available to adequately address the perennial health challenges of the rural communities served by the tribal colleges and universities.</text> </paragraph></subsection><subsection id="IDa434fa66057e49db9c6d4660c8bd7ac9"><enum>(b)</enum><header>Purpose</header><text>The purpose of this title is to assist tribal colleges and universities to strengthen Indian communities through the provision of health promotion and disease prevention education, outreach, and workforce development programs, including through program implementation, research, and capacity-building.</text> </subsection></section><section id="IDab1800cabbc54d27adc4b6969f1de8da"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="idD20CA96653E44B62A2A57E9BCE8A7D89"><enum>(1)</enum><header>Deputy Assistant Secretary</header><text>The term <term>Deputy Assistant Secretary</term> means the Deputy Assistant Secretary for Minority Health, within the Office of Public Health and Science.</text> </paragraph><paragraph id="id8E89AB3A14374E03AF2837AD22EEC6A2"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Institutes of Health.</text> </paragraph><paragraph id="id5B1285114D5B4E008DE345FFE83C3E52"><enum>(3)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (25 U.S.C. 1603).</text> </paragraph><paragraph id="idE376CD62453040169CC8AF62CB4E2D98"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph><paragraph id="idA0439E8B9BF8441FAED4F12EF1B26AF7"><enum>(5)</enum><header>Tribal college or university</header><text display-inline="yes-display-inline">The term <term>tribal college or university</term> means—</text> <subparagraph id="id5C4B7D7F927247ABAFED6D7E54553AFA"><enum>(A)</enum><text>an institution that is eligible to receive funds under the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801 et seq.);</text> </subparagraph><subparagraph id="idE89E960CCECC4E268931FFA8EB772A55"><enum>(B)</enum><text>Diné College; and</text> </subparagraph><subparagraph id="idF5F4AA2CD20E4185B0A7E1C4E4B3BB12"><enum>(C)</enum><text>any 1 of the 1994 Institutions (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (7 U.S.C. 301 note; Public Law 103–382)).</text> </subparagraph></paragraph></section><section id="id239A05E2E1B047D5B4EAFB09B316DA9A"><enum>104.</enum><header>Administration by coordinating officer</header> <subsection id="id91A0D30F14E54030B16EBAAA10439A3A"><enum>(a)</enum><header>Designation</header><text>The Deputy Assistant Secretary shall serve as the coordinating officer with respect to programs of tribal colleges and universities relating to health promotion and disease prevention.</text> </subsection><subsection id="id9A6B87DECA29457E964015647CBCF70A"><enum>(b)</enum><header>Staff</header><text>The Secretary shall appoint such additional staff as the Secretary determines to be necessary—</text> <paragraph id="id8950BE99E4F34940B37F5E6C9AE0AE88"><enum>(1)</enum><text>to assist the Deputy Assistant Secretary in carrying out the duties under this section; and</text> </paragraph><paragraph id="id58EB5377E23B42DC869F8723C6C91B09"><enum>(2)</enum><text>to provide appropriate technical assistance to tribal colleges and universities that receive grants or enter into cooperative agreements under this title.</text> </paragraph></subsection><subsection id="ID5da355eb370b4251ad2b16270d35c92b"><enum>(c)</enum><header>Memorandum of agreement</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in consultation with the Deputy Assistant Secretary, shall develop and implement a formal memorandum of agreement with the American Indian Higher Education Consortium to establish programs—</text> <paragraph id="id2F4890D546E44D21910041366EBE4522"><enum>(1)</enum><text>to ensure that Native American communities, through tribal colleges and universities, participate equitably in employment programs, services, and resources of the Department of Health and Human Services; and</text> </paragraph><paragraph id="id3DC23C5B31DD45D5936BF87A9821D63F"><enum>(2)</enum><text>to provide necessary technical assistance to the tribal colleges and universities.</text> </paragraph></subsection></section><section id="idAAED366CA4A64E3C90EC58D54297D13C"><enum>105.</enum><header>Community-based health and wellness fairs</header> <subsection id="id08D3429C354C4D5B9A2D889BFFB36CC3"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to carry out annual, community-based, and culturally relevant health and wellness fairs at the tribal colleges and universities.</text> </subsection><subsection id="id928E067E41DE46FAAE98A08ADBC8716F"><enum>(b)</enum><header>Funding</header> <paragraph id="id496266C4CB764D30A4026BDA5F0C06B6"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section for each of fiscal years 2009 through 2017 an amount equal to the sum of—</text> <subparagraph id="id605A0BF8DE374F5FB537D6C0FD50E035"><enum>(A)</enum><text>the product obtained by multiplying—</text> <clause id="id65EE5A46D12B449EBA516CF96CA86A05"><enum>(i)</enum><text>the number of tribal colleges and universities in operation on October 1 of the fiscal year; and</text> </clause><clause id="id7E1DA87A5BFD4A8288DED0E146915046"><enum>(ii)</enum><text>$15,000; and</text> </clause></subparagraph><subparagraph id="id95C4EAA3A5134A1990E28E187013C5CF"><enum>(B)</enum><text>such amount as the Secretary determines to be necessary for the costs of administering the program under this section.</text> </subparagraph></paragraph><paragraph id="idB9A3D62DDF2D4122AC1B89F85553EB32"><enum>(2)</enum><header>Total amount</header><text>Subject to paragraph (3), the Secretary shall use all amounts made available under paragraph (1)(A) to provide grants or enter into cooperative agreements pursuant to this section.</text> </paragraph><paragraph id="idB5CE93F65D57498283C7AAE32BF8DAA9"><enum>(3)</enum><header>Nonapplicability of limitation</header><text>The limitation under section 1703(c) of the Public Health Service Act (42 U.S.C. 300u–2(c)) shall not apply to this section.</text> </paragraph></subsection></section><section id="idA54E25F1E20F4B588D61669CA6D25464"><enum>106.</enum><header>Health promotion and disease prevention targeted programs; wellness centers</header> <subsection id="idB58CF305794E4769B20B58FB224FE765"><enum>(a)</enum><header>Health promotion and disease prevention targeted programs</header> <paragraph id="id3CF50C730E6E4FB1A9A798EC5C63FA7A"><enum>(1)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to carry out activities to improve and expand the capacity of the tribal colleges and universities—</text> <subparagraph id="idA53F57EF6F6F430FA3EEEA7D354C8B00"><enum>(A)</enum><text>to carry out activities relating to health promotion and disease prevention; and</text> </subparagraph><subparagraph id="id5E5C3BFFCC29432483806F7ED6C501C4"><enum>(B)</enum><text>to eliminate health disparities in tribal communities, to the maximum extent practicable.</text> </subparagraph></paragraph><paragraph id="id909D712BB61B4BD0835C1F0D58F0B43A"><enum>(2)</enum><header>Requirements</header><text>In providing grants and entering into cooperative agreements under this subsection, the Secretary, to the maximum extent practicable, shall—</text> <subparagraph id="id0D8511A246C24BD5A3A9A953CB38D14B"><enum>(A)</enum><text>approve applications on a competitive basis; and</text> </subparagraph><subparagraph id="id89F324B22A6A42968BAF9368F82D08A1"><enum>(B)</enum><text>ensure maximum and equitable distribution among eligible tribal colleges and universities.</text> </subparagraph></paragraph><paragraph id="idF5CBF5D2D1DE445EB911EC863754C5CD"><enum>(3)</enum><header>Application</header> <subparagraph id="idF543839AE6FC4D939EDA1E68EC6A8F1E"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant or enter into a cooperative agreement under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </subparagraph><subparagraph id="id0556F1CD01CA448EAA4354374092752B"><enum>(B)</enum><header>Inclusion</header><text>An application under subparagraph (A) shall include a description of a 5-year strategy of the applicable tribal college or university for meeting the health promotion and disease prevention needs of Indians or Alaska Natives, as appropriate, in the area served by the tribal college or university.</text> </subparagraph><subparagraph id="idC820345EEE49476D93D3DA133553A2B4"><enum>(C)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under subparagraph (A), taking into consideration the limited number of institutions that are eligible to receive assistance under this subsection.</text> </subparagraph></paragraph><paragraph id="idB52CAB9E0A474387822C9D198FC06488"><enum>(4)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this subsection may use the grant or cooperative agreement to develop and carry out activities to address targeted areas of health promotion and disease prevention in tribal communities, including activities relating to—</text> <subparagraph id="id7869D7FD84734DD0BE584C8FD7E25AB1"><enum>(A)</enum><text>diabetes education and prevention;</text> </subparagraph><subparagraph id="IDc8c3794e6a8a4388b0e84d3d99109079"><enum>(B)</enum><text>injury prevention;</text> </subparagraph><subparagraph id="ID7241419f694043b69092234d2270f8b1"><enum>(C)</enum><text>substance abuse, including methamphetamine abuse;</text> </subparagraph><subparagraph id="ID2dbd37f294c74f93b93ecfbe94817c3f"><enum>(D)</enum><text>HIV–AIDS prevention;</text> </subparagraph><subparagraph id="IDacd57c89ab2d43d69c0b79e187522e87"><enum>(E)</enum><text>emerging health promotion and disease prevention program and response development; and</text> </subparagraph><subparagraph id="IDbcbf1098c717460fb3dd9490e6d415ac"><enum>(F)</enum><text>obesity and nutrition.</text> </subparagraph></paragraph><paragraph id="id45A25D1A3E854A20B1A7BDE6F554D6BA"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for each of fiscal years 2009 through 2017.</text> </paragraph></subsection><subsection id="id61B01BFBE96F4506983762FB77FCEE8F"><enum>(b)</enum><header>Wellness centers</header> <paragraph id="idCAE7D3F00D3E4910959B6D962A1C2D21"><enum>(1)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities for purposes of—</text> <subparagraph id="ID0ef20fb6b3c44b379c3ef976afd3cdac"><enum>(A)</enum><text>construction, renovation, and modernization of community wellness centers located on the campuses of the tribal colleges and universities; and</text> </subparagraph><subparagraph id="ID1eddbfff6ead481a8f2582783557d11e"><enum>(B)</enum><text>construction, renovation, and modernization of outpatient student health clinics located on those campuses.</text> </subparagraph></paragraph><paragraph id="id123CB0CB0D70472DBF6F85322ABB92A7"><enum>(2)</enum><header>Maximum amount</header> <subparagraph id="id5C961C12A9F14495A1E0B73F34CFB120"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the maximum amount of a grant provided under paragraph (1) shall not exceed an amount equal to 95 percent of the cost of the project carried out by the applicable tribal college or university.</text> </subparagraph><subparagraph id="id4EE6C71CBE364D03BF47CC7849134075"><enum>(B)</enum><header>Exception</header><text>The limitation under subparagraph (A) shall not apply to a tribal college or university located in, as determined by the Secretary—</text> <clause id="idFBB393EC30314C4BAC7B5F629D23FFC8"><enum>(i)</enum><text>an urban area; or</text> </clause><clause id="idC6814217EB23478F937300C1EE0A334F"><enum>(ii)</enum><text>a poor rural area.</text> </clause></subparagraph></paragraph><paragraph id="ID9cc5093203cf46cfb72ec4bcd7e50226"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $15,000,000 for each of fiscal years 2009 through 2017.</text> </paragraph></subsection></section><section id="id55CA0C1D52064411A503AF132B770645"><enum>107.</enum><header>Development and expansion of public health professional degree programs</header> <subsection id="idB72C8A791DD643D4A42B9D43EEB1BCC8"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities for purposes of developing curricula, courses, and degree and in-service programs for health-related professions.</text> </subsection><subsection id="id174855AD5861499B961BBFD3077874AE"><enum>(b)</enum><header>Application</header> <paragraph id="id0F8597FF456444C3BC890958BFD5A1C4"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph id="idBF19FCA098014DA881129DC21B77C439"><enum>(2)</enum><header>Inclusion</header><text>An application under paragraph (1) shall include a description of a 5-year strategy of the applicable tribal college or university for increasing the number of Indians in the health workforce of the United States.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17FD89D70AB04A6B8029841271975597"><enum>(3)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="id669F372A2F6B4C2996E13BB9C7E1DB4A"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section><section id="idE4AED306049A4C09A17198086BF61532"><enum>108.</enum><header>Tribal College and University Rural Health Equity Endowment Fund</header> <subsection id="IDB87E6EB3E15A423C9459B522069F2D1F"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Tribal College and University Rural Health Equity Endowment Fund</quote> (referred to in this section as the <term>Fund</term>), consisting of—</text> <paragraph id="IDD2EF1B70D5204F73B84970D1BF09ABCD"><enum>(1)</enum><text>such amounts as are appropriated to the Fund under subsection (b); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID908456CA111641D6B7C30309EB6057AB"><enum>(2)</enum><text>any interest earned on those amounts.</text> </paragraph></subsection><subsection id="ID75847D4BD6B24B8E83CBB81F88EF90BB"><enum>(b)</enum><header>Transfers to Fund</header><text>There is appropriated to the Fund, out of funds of the Treasury not otherwise appropriated, $9,000,000 for each of fiscal years 2009 through 2017.</text> </subsection><subsection id="ID9c9c13e5cab84ae2b85f10f53d0b98a4"><enum>(c)</enum><header>Investments</header><text>The Secretary shall invest amounts in the Fund in interest-bearing obligations of the United States.</text> </subsection><subsection id="id49CD8300EEBD4B71A61C19AD806D49A3"><enum>(d)</enum><header>Expenditures from Fund</header> <paragraph id="idA2023A1F6C7A47FFACCCBD355893787A"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), on September 30 of fiscal year 2009 and annually thereafter through September 30, 2017, on request by the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary an amount equal to the amount of interest income earned on amounts in the Fund during the preceding fiscal year.</text> </paragraph><paragraph id="ID9724CABDFFA844AE9AEFD47A75CBECA6"><enum>(2)</enum><header>Administrative expenses</header><text>An amount not exceeding 1 percent of the annual interest yield distributed to tribal colleges and universities shall be available for each fiscal year to pay the administrative expenses necessary to carry out this section.</text> </paragraph></subsection><subsection id="id42772C7A818E48CC90829440093746AA"><enum>(e)</enum><header>Distribution of amounts</header><text>Of amounts transferred under subsection (d)(1), the Secretary shall distribute—</text> <paragraph id="id406A635EF339424B91AD3B3C0BEC88E0"><enum>(1)</enum><text>60 percent to tribal colleges and universities on a pro rata basis, based on the proportion that—</text> <subparagraph id="idE19E3095A1754942B717662AB0318970"><enum>(A)</enum><text>the Indian student count (as defined in section 2(a) of the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801(a)) of a tribal college or university for the applicable fiscal year; bears to</text> </subparagraph><subparagraph id="idA096A91EBA734819ABB9F46372BC1F9C"><enum>(B)</enum><text>the Indian student count of all tribal colleges and universities for that fiscal year; and</text> </subparagraph></paragraph><paragraph id="idC1D0D61A26494324865F8D8A3575F052"><enum>(2)</enum><text>40 percent in payments of equal amounts to each tribal college and university.</text> </paragraph></subsection><subsection id="idE643994CA2C943D58116E0C2E9991E76"><enum>(f)</enum><header>Use of funds</header><text>A tribal college or university shall use amounts received under this section to establish an endowment for a rural health-related program at the tribal college or university.</text> </subsection></section><section id="idA05B74231D8344748C68D61C1C527BEA"><enum>109.</enum><header>Offices of sponsored programs</header> <subsection id="idC97E7EA2FFFC4484950B6E9D9394B981"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Director, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities to establish and maintain at the tribal colleges and universities offices of sponsored programs described in subsection (b).</text> </subsection><subsection id="idC86B7F31321B417FA036D93C2B1FD9AA"><enum>(b)</enum><header>Sponsored programs</header><text>The sponsored programs referred to in subsection (a) include programs for—</text> <paragraph id="ID03b76ab918884de9a7772e530d473ac4"><enum>(1)</enum><text>pre- and post-grant award research, data collection, and analyses, through a method that ensures—</text> <subparagraph id="idB74D090EDD8E401E8B97DFD4D8858EBE"><enum>(A)</enum><text>proper documentation of relevant applications; and</text> </subparagraph><subparagraph id="id04DC3117CB124DD68706268345125A03"><enum>(B)</enum><text>compliance with applicable regulations and guidelines;</text> </subparagraph></paragraph><paragraph id="ID7750cab8b761413a9e80a2bc7a92695d"><enum>(2)</enum><text>advancing specific institutional grant application procedures and processes through coordination of external funding sources and faculty, staff, and financial officers;</text> </paragraph><paragraph id="ID71f1e71348604848b0a743d69bd62590"><enum>(3)</enum><text>assisting in negotiations with Federal funding sources;</text> </paragraph><paragraph id="ID143110608de84a25b7f1302b89412095"><enum>(4)</enum><text>providing liaisons with Federal counterparts of tribal colleges and universities—</text> <subparagraph id="id18450ED617DC4AEE82703FCE21B96BA4"><enum>(A)</enum><text>to train and assist principal investigators, faculty, and college staff with respect to grant management, reporting, and program implementation; and</text> </subparagraph><subparagraph id="id1DA2C6E06E7E485BAFC92BCA29FFCB83"><enum>(B)</enum><text>to ensure that applicable deadlines are met and required reports are completed;</text> </subparagraph></paragraph><paragraph id="IDf320e2c0bcfb42cd9a9d69312fe55761"><enum>(5)</enum><text>coordinating partnerships between tribal colleges and universities, Federal agencies, and the private sector for collaborative programs and activities; and</text> </paragraph><paragraph id="IDc9e8475cd3ef47b984bab92db437b409"><enum>(6)</enum><text>in consultation with Federal agencies, identifying and proposing solutions to—</text> <subparagraph id="id5F35D5894DC9488EB8CD635E498190C9"><enum>(A)</enum><text>obstacles relating to Federal agency grant application procedures and requirements; and</text> </subparagraph><subparagraph id="id06E127ADB50142569491CC831DCCD3BA"><enum>(B)</enum><text>other problems relating to Federal grant program structures and requirements.</text> </subparagraph></paragraph></subsection><subsection id="id68FD9BA49A5047DD9259B9EA6F082F42"><enum>(c)</enum><header>Application</header> <paragraph id="idC385D66ECC86412E8A6E70B7A45A6DA3"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF745D902AB15482AB0A19C09798E31FB"><enum>(2)</enum><header>Inclusion</header><text>An application under paragraph (1) shall include a description of a 5-year strategy of the applicable tribal college or university for carrying out a sponsored program at the tribal college or university, including performance indicators by which success of the tribal college or university will be evaluated.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id427309D06200410CA67FBA5D31CEBBF5"><enum>(d)</enum><header>Distribution of funds</header><text>For each of fiscal years 2009 through 2017, the Secretary, acting through the Director, shall provide to each tribal college and university the application of which is approved under subsection (c) a grant in an amount equal to the quotient obtained by dividing—</text> <paragraph id="idB40E813205544930A556CA7E2AB57114"><enum>(1)</enum><text>the total amount made available under subsection (f) for the fiscal year; by</text> </paragraph><paragraph id="id21E60D65C07C42218B2258EA4BE50328"><enum>(2)</enum><text>the number of tribal colleges and universities the applications of which are approved under subsection (c) for the fiscal year.</text> </paragraph></subsection><subsection id="id4DC728C160C741609E91D90631B62950"><enum>(e)</enum><header>Reports</header><text>For each of fiscal years 2010 through 2018, each tribal college or university that receives a grant under this section shall submit to the Director a report describing the success of the office of sponsored programs of the tribal college or university during the preceding fiscal year, as determined in accordance with the performance indicators contained in the application of the tribal college or university under subsection (c)(2).</text> </subsection><subsection id="idCF8C4D8D30754B079E4F3E08B632C157"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section for each of fiscal years 2009 through 2017 an amount equal to the product obtained by multiplying—</text> <paragraph id="id7C6F7C351E9C4338859C1213E5BFA423"><enum>(1)</enum><text>the number of tribal colleges and universities in operation on October 1 of the applicable fiscal year; and</text> </paragraph><paragraph id="idC2D40B053DE14C8881C7206375FE48FE"><enum>(2)</enum><text>$50,000.</text> </paragraph></subsection></section><section id="idDB3037E5E09341D181C0EBC111F992F7"><enum>110.</enum><header>Health promotion and disease prevention research programs</header> <subsection id="id95B9F432D7ED45A69F5C4D674744804C"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Director, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to conduct research relating to health promotion and disease prevention at the tribal colleges and universities.</text> </subsection><subsection id="idE114A4E8C65C4234957A8F9D6F8D2884"><enum>(b)</enum><header>Requirements</header> <paragraph id="id078B775F82094D2FBC24E641A066DFE1"><enum>(1)</enum><header>Competition</header><text>The Secretary shall provide grants and offer to enter into cooperative agreements under subsection (a) on a competitive basis.</text> </paragraph><paragraph id="idF340A46A1C3E48AAB76E94CF8E7D343B"><enum>(2)</enum><header>General terms and amounts</header><text>Except as provided in paragraph (3)—</text> <subparagraph id="idD80113BA35624061A75192796AF714C3"><enum>(A)</enum><text>the term of a grant or cooperative agreement under subsection (a) shall be not more than 3 years; and</text> </subparagraph><subparagraph id="id9F3A8E9A987E47308B898C55712D699D"><enum>(B)</enum><text>the minimum amount of a grant under subsection (a) for a fiscal year shall be $150,000.</text> </subparagraph></paragraph><paragraph id="idB1AF70EDA6CD4D77B1C69A3136035E9A"><enum>(3)</enum><header>Undergraduate research experience programs</header><text>With respect to a grant or cooperative agreement provided for an undergraduate research experience program under subsection (d)(3)—</text> <subparagraph id="idD36D9B93158542AFA942C7E2ACB42C9E"><enum>(A)</enum><text>the term of such a grant or cooperative agreement shall be not more than 1 year; and</text> </subparagraph><subparagraph id="id2EA584545D8844DB8C8443BD1ACFC41C"><enum>(B)</enum><text>the minimum amount of such a grant for a fiscal year shall be $10,000.</text> </subparagraph></paragraph></subsection><subsection id="id99AB7BB787C34D8D975DF2413B9DEB38"><enum>(c)</enum><header>Application</header> <paragraph id="id6DAC6EBDEC3B4E4A9072115447425CA5"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant, or to enter into a cooperative agreement, under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id066170D3914D4AD0BE63CFF6D00AE388"><enum>(2)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="idA730F6DA9A934439ABA4949D81A8ABED"><enum>(d)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this section may use the grant or cooperative agreement to carry out activities, including—</text> <paragraph id="ID1849ade931674379b34fced5bdc9227d"><enum>(1)</enum><text>research on culturally relevant and innovative health promotion and disease prevention strategies;</text> </paragraph><paragraph id="IDa289e8dd451c4d36973968b0b70aa60a"><enum>(2)</enum><text>epidemiological research on the health status of Indian populations and communities; and</text> </paragraph><paragraph id="ID3f83cbf28b304128ae38c29dec3ee5b8"><enum>(3)</enum><text>undergraduate research experience programs as the tribal college or university determines to be appropriate.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA349B08677A74131B0ED8DF5F4DA09B3"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $12,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section><enum>II</enum><header>Advancing Tribes Through Tribal Colleges and Universities</header> <section id="id03DF130E5F7E49FA9636782664202A50"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Advancing Tribes Through Tribal Colleges and Universities Act</quote> or the <quote>AT TCUs Act</quote>.</text> </section><section id="IDd24d7085dcbb4f3aaeaca209f256fd3f"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="IDe32229dca1f24e6fbdf200e9b50980d8"><enum>(1)</enum><text>a primary goal of providing Federal support for higher education is to ensure social and economic self-sufficiency and growth for all residents of the United States;</text> </paragraph><paragraph id="IDafd4f1d8931346a0bf90ef37466bb3da"><enum>(2)</enum><text>social and economic underdevelopment is the primary obstacle to the self-sufficiency of Indian communities and families;</text> </paragraph><paragraph id="IDe25ba3072c97422bb99a3716ecae4ddb"><enum>(3)</enum><text>research has demonstrated that higher education is a primary method of achieving economic and social development for Indian communities;</text> </paragraph><paragraph id="IDa2e0f33189844d64a075d4dd73713316"><enum>(4)</enum><text>tribal colleges and universities are institutions of higher education created by Indians for Indians primarily on rural and isolated Indian reservations, which were virtually excluded from the general system of higher education in the United States;</text> </paragraph><paragraph id="IDd70413180d8b413cba6405f612d7be14"><enum>(5)</enum><text>underlying goals of tribal colleges and universities are—</text> <subparagraph id="idCB1FE9151FA3406897FE574AB8F16D5B"><enum>(A)</enum><text>to improve the lives of Indians through higher education; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id921191318B9D461B93E0D845CD66E44D"><enum>(B)</enum><text>to assist Indians in achieving self-sufficiency;</text> </subparagraph></paragraph><paragraph id="id0A5530B0DE1440C993E6FAC888829A68"><enum>(6)</enum><text>tribal colleges and universities—</text> <subparagraph id="idA25375DCF1EA46E6AD9CCDE4B77DD969"><enum>(A)</enum><text>offer a variety of social services for students and community members; and</text> </subparagraph><subparagraph id="idD7B257286DEC459482CD4A737618D395"><enum>(B)</enum><text>often serve as community centers, libraries, tribal archives, career and business centers, economic development centers, public meeting places, and childcare and wellness centers;</text> </subparagraph></paragraph><paragraph id="ID3f73b1e82df74dd0a28233c3de415699"><enum>(7)</enum><text>tribal colleges and universities and students of those colleges or universities contribute significantly to the economic and social health of Indian communities;</text> </paragraph><paragraph id="ID0dbbf52536dc4bcca8b01c60a59772f7"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idF8A9C31D16B2406F8B79944049DE53A8"><enum>(A)</enum><text>tribal colleges and universities have been more successful than any other institution of higher education in educating and helping to retain Indians in high-need fields, such as nursing and teaching;</text> </subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="idE27AC1D3797F494D87754BA7143D8B37" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>data from 2005 indicates that—</text> <clause id="id3A61C35BC9244E70AB952815336EAEA4"><enum>(i)</enum><text>approximately <fraction>1/2</fraction> of all graduates of tribal colleges and universities pursue advanced education; and</text> </clause><clause id="idB8A6EA6B93B94A5FACEA86ECB28E2D9D"><enum>(ii)</enum><text>of those graduates, more than 86 percent pursue bachelor’s degrees;</text> </clause></subparagraph></paragraph><paragraph id="IDe7043db63cfc498db2bf0225887f3823"><enum>(9)</enum><text>individuals, including Indians, with bachelor’s or advanced degrees earn—</text> <subparagraph id="id53F08D78AD44472CBC21CD01357EAE6F"><enum>(A)</enum><text>almost 4 times as much as individuals who do not graduate from high school; and</text> </subparagraph><subparagraph id="id5924454465F243F9B4D5D31E4A0A9C86"><enum>(B)</enum><text>more than twice as much as individuals with high school diplomas;</text> </subparagraph></paragraph><paragraph id="IDfa0b455f8c8e4d0b93bbe09a95878931"><enum>(10)</enum><text>of the 155 indigenous languages spoken in the United States as of the date of enactment of this Act, 135 are spoken only by Indian elders;</text> </paragraph><paragraph id="ID9c07b21df03e4e0ca4ba5b06f6d81a4e"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6FD1E8729A7A4A99BCD72A27F7B04A09"><enum>(A)</enum><text display-inline="yes-display-inline">language and culture are at the heart of the mission of each tribal college and university;</text> </subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id1C4CADBCB9F440BFA9B60F2406945F74" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">tribal colleges and universities—</text> <clause id="idAD6912F8BC49407A96E9B8AA5BF13AF5"><enum>(i)</enum><text display-inline="yes-display-inline">play a strong leadership role in Native American language immersion; and</text> </clause><clause id="id11C9774AEAD34C63B0C798DB63477790"><enum>(ii)</enum><text display-inline="yes-display-inline">are responsible for the majority of the approximately 50 Native American language immersion programs in the United States; and</text> </clause></subparagraph></paragraph><paragraph id="ID3c5371e4d4b3456798883561a5aa65d7"><enum>(12)</enum><text>despite the proven success of Native American language preservation and vitalization efforts of tribal colleges and universities, only minimal Federal and private sector resources are used for the activities.</text> </paragraph></section><section id="ID451a8aad3df44ce4bead7df10cfdf0cc"><enum>203.</enum><header>Office on Tribal College and University Programs</header><text display-inline="no-display-inline">Section 803B of the Native American Programs Act of 1974 (42 U.S.C. 2991b–2) is amended—</text> <paragraph id="idAD9DD0E55A894BE99A3180045650A3FB"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text> </paragraph><paragraph id="IDa3c4eb1618d943dba55504f02f1561e5"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text> <quoted-block changed="deleted" committee-id="SLIA00" display-inline="no-display-inline" id="id7BD817B4389240CF9808D365992BC088" reported-display-style="strikethrough" style="OLC"> <subsection id="id5E9230181646427B93FE3E786BFDD976"><enum>(e)</enum><header>Office on Tribal College and University Programs</header> <paragraph id="id94B1F88E00734D43A69BEEA725E48DFC"><enum>(1)</enum><header>Establishment</header><text>There is established within the Administration on Native Americans an office, to be known as the <quote>Office on Tribal College and University Programs</quote> (referred to in this subsection as the <term>Office</term>), for the purposes of—</text> <subparagraph id="id4073065DDD324F3FB1E1B7070B79879B"><enum>(A)</enum><text>administering the programs authorized by this Act; and</text> </subparagraph><subparagraph id="id38F587FB8E52430B9A2A4183CA5D76C9"><enum>(B)</enum><text>coordinating intra- and inter-departmental activities relating to tribal colleges and universities.</text> </subparagraph></paragraph><paragraph id="id6DF198527E3E454DB654E72169C8CBAE"><enum>(2)</enum><header>Director</header><text>The Secretary shall appoint a Director of the Office, who shall—</text> <subparagraph id="idC5EEA4ED2537441AB98C8011D28DF8AC"><enum>(A)</enum><text>serve on a full-time basis; and</text> </subparagraph><subparagraph id="idF6A857BB8D1E45BAA3600D71697010DE"><enum>(B)</enum><text>carry out the duties described in paragraph (1).</text> </subparagraph></paragraph><paragraph id="id647FBB96520F4C6AAB54BC06B888F951"><enum>(3)</enum><header>Staff</header><text>The Secretary shall appoint such additional staff as the Secretary determines to be necessary—</text> <subparagraph id="id6FB4696920B34A6D86591328621A12FB"><enum>(A)</enum><text>to assist the Director in carrying out the duties described in paragraph (1); and</text> </subparagraph><subparagraph id="id19AB3FEF226144DFBCAF6A12DDB0F13D"><enum>(B)</enum><text>to provide appropriate technical assistance to tribal colleges and universities that receive grants or enter into cooperative agreements under this Act.</text> </subparagraph></paragraph><paragraph id="id378DFCCB32F543CAA524997781B3834C"><enum>(4)</enum><header>Technical assistance</header><text>To ensure that tribal colleges and universities receive timely, equitable, and culturally-relevant technical assistance under section 804, the Secretary, acting through the Commissioner, may enter into any cooperative agreement the Secretary determines to be necessary with the American Indian Higher Education Consortium.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="IDc56f4a5ce96b48eaaa43005d79db21ab"><enum>204.</enum><header>Native Prosperity and Native American Language Vitalization and Training Programs at TCUs</header> <subsection id="id6715F62C83524AA4B1F0CFF3099CB1E6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Native American Programs Act of 1974 is amended by inserting after section 803C (42 U.S.C. 2991b–3) the following:</text> <quoted-block changed="deleted" committee-id="SLIA00" display-inline="no-display-inline" id="id373F2A8BB5BF49B69DF4068DC0EDEB8B" reported-display-style="strikethrough" style="OLC"> <section id="ID291244bba3ca441d8c542316350f4691"><enum>803D.</enum><header>Native Prosperity and Native American Language Vitalization and Training Programs at TCUs</header> <subsection id="IDf48623d9158d4102bad15b0197fb28f7"><enum>(a)</enum><header>Native Prosperity Program</header> <paragraph id="id83F4CA9379124EAC87DA7BF6D39B8129"><enum>(1)</enum><header>Establishment</header><text>The Secretary, acting through the Commissioner, shall establish a program, to be known as the <quote>Native Prosperity Program</quote>, under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, eligible tribal colleges and universities to promote economic development, entrepreneurship, community development, and sound fiscal leadership in Indian communities.</text> </paragraph><paragraph id="idB16E110516E1491A963BD1D298044A65"><enum>(2)</enum><header>Requirements</header> <subparagraph id="id219266D2C5694B5CBC131DE0791204F3"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B)—</text> <clause id="id041C8EDCBEEA4B1B932B1113A5DD0BD3"><enum>(i)</enum><text>the Secretary shall provide grants and offer to enter into cooperative agreements under paragraph (1) on a competitive basis; and</text> </clause><clause id="id941543B1F2EE46578D51FDEA47DA6DBA"><enum>(ii)</enum><text>the term of a grant or cooperative agreement under paragraph (1) shall be not more than 5 years.</text> </clause></subparagraph><subparagraph id="id87DF0A7A8D9E40E485EFFD0B1366F2EE"><enum>(B)</enum><header>Exception</header><text>If the Secretary determines that a tribal college or university that receives a grant or enters into a cooperative agreement under this subsection has performed satisfactorily throughout the initial 5-year term of the grant or cooperative agreement under subparagraph (A)(ii)—</text> <clause id="id93F79D6A27F24B3AB81DBF9A41A1BC91"><enum>(i)</enum><text>the tribal college or university may submit to the Secretary an application to extend the grant or cooperative agreement, as applicable, for a period of not more than 3 additional years; and</text> </clause><clause id="idEE283D87A7FA4C9C86448C9E23774C77"><enum>(ii)</enum><text>the Secretary may waive the competitiveness requirement of subparagraph (A)(i) with respect to the application.</text> </clause></subparagraph></paragraph><paragraph id="id58CCAC33D2374F8F9A9442B024148371"><enum>(3)</enum><header>Application</header> <subparagraph id="id6787AE99AA5E4259A36C584CB2421109"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant or enter into a cooperative agreement under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </subparagraph><subparagraph id="id1BD1CA2A14ED4D33AA55E0327C7EA3AC"><enum>(B)</enum><header>Program plan</header> <clause id="idF4615F2854304CB1A90BE232E17283E8"><enum>(i)</enum><header>In general</header><text>An application under subparagraph (A) shall include a plan for the program proposed to be carried out by the eligible tribal college or university using the grant or pursuant to the cooperative agreement, as applicable.</text> </clause><clause id="id97B556BC406C4A73BA1131BCB53E1C1E"><enum>(ii)</enum><header>Inclusions</header><text>A program plan under subparagraph (A) shall include—</text> <subclause id="idC16B240E62D545788F8F6B714EC7CDEA"><enum>(I)</enum><text>a description of a 5-year strategy of the applicable tribal college or university for meeting the needs of Indians or Alaska Natives, as appropriate, in the area served by the tribal college or university;</text> </subclause><subclause id="id7AEF72E09AC84FD3A78B09CA50CFD920"><enum>(II)</enum><text>an identification of the population to be served by the tribal college or university;</text> </subclause><subclause id="idE5A81F9AB7D042DDA3F3DBDF88BE1993"><enum>(III)</enum><text>an identification of the education and employment needs of that population and a description of the manner in which the program will—</text> <item id="id67D85441E0F146D7B9D2AA74E2EC10BD"><enum>(aa)</enum><text>strengthen the economic development potential of the population; or</text> </item><item id="id9526C0902E8E46BFAEA08FFB688A5D62"><enum>(bb)</enum><text>contribute to the development of high-quality local and community services;</text> </item></subclause><subclause id="idCE8E0707F7AB447CBF9611412F9F561A"><enum>(IV)</enum><text>a description of the services to be provided under the program, including the manner in which the services will be integrated with other appropriate activities; and</text> </subclause><subclause id="idE9576418F917468CBFF43FFBC158951C"><enum>(V)</enum><text>a description, to be prepared in consultation with the Secretary, of the performance measures to be used to assess the performance of the tribal college or university in carrying out the program.</text> </subclause></clause><clause id="id4C03E1C0093641D1AB656ED0853535B7"><enum>(iii)</enum><header>Requirement</header><text>A program plan shall be consistent with the purposes of this section, as determined by the Secretary.</text> </clause></subparagraph></paragraph><paragraph id="id2645B5D8FBB04105B4E94D396923B908"><enum>(4)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this subsection may use the grant or cooperative agreement to carry out activities, including—</text> <subparagraph id="idE934D7450E4D4D33A72A10A8C1EA3A6A"><enum>(A)</enum><text>microenterprise development;</text> </subparagraph><subparagraph id="idACBCF0B3F8064624A809ED7EB8CCF7F3"><enum>(B)</enum><text>business development and administration courses and degree programs;</text> </subparagraph><subparagraph id="id49D4B9BEF0A348D9B1833083E5DF6C25"><enum>(C)</enum><text>entrepreneurship programs;</text> </subparagraph><subparagraph id="id114E3ECF1648499294B39C18CEC4F944"><enum>(D)</enum><text>municipality planning and administration courses, degree programs, and in-service training; and</text> </subparagraph><subparagraph id="id2484324F46304A43929A2F48DBE520AB"><enum>(E)</enum><text>executive leadership training in economic development, planning, and emerging management issues.</text> </subparagraph></paragraph><paragraph id="idCFB590EFEE9544A5BCBEBD2266C8EABD"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $12,000,000 for each of fiscal years 2009 through 2012.</text> </paragraph></subsection><subsection id="ID0d339f8b867944309e5deb54d1c9859e"><enum>(b)</enum><header>Native American language Vitalization and Training Program</header> <paragraph id="idBB6E6480C0254A72A9A5E99552FCE3AB"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Commissioner, shall establish a program, to be known as the <quote>Native American Language Vitalization and Training Program</quote>, under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, eligible tribal colleges and universities to promote the preservation, revitalization, relevancy, and use of Native American languages.</text> </paragraph><paragraph id="id66BE1A98DD3A4FF9BD50B09682CF4AAC"><enum>(2)</enum><header>Requirements</header> <subparagraph id="idF99034FC30424DB4B184D3299C9904D3"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B)—</text> <clause id="id505AA678474145BB81F5A134AA092E8A"><enum>(i)</enum><text>the Secretary shall provide grants and offer to enter into cooperative agreements under paragraph (1) on a competitive basis; and</text> </subclause><subclause id="idA44E19835AC0478AA3207F515651632E"><enum>(V)</enum><text>a description, to be prepared in consultation with the Secretary, of the performance measures to be used to assess the performance of the tribal college or university in carrying out the program.</text> </subclause></clause><clause id="id2201EFE6DCD141BC92D2D986EFA5A57B"><enum>(iii)</enum><header>Requirement</header><text>A program plan shall be consistent with the purposes of this section, as determined by the Secretary.</text> </clause></subparagraph></paragraph><paragraph id="id2E2D442A68A04ABA8D6334852ACC2EAB"><enum>(4)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this subsection may use the grant or cooperative agreement to carry out activities, including—</text> <subparagraph id="id54B030F4B7FF4CF3B9283858DC5605CF"><enum>(A)</enum><text>curricula development and academic instruction, including educational activities, programs, and partnerships relating to students in prekindergarten through grade 12;</text> </subparagraph><subparagraph id="id9248326B918747909554C0A8F981C600"><enum>(B)</enum><text>professional development for college and university faculty and in-service training programs for prekindergarten through grade 12 instructors and administrators; and</text> </subparagraph><subparagraph id="IDbb37ed77878044baaa1041942fcab572"><enum>(C)</enum><text>economic development research, including research relating to—</text> <clause id="ID5df37b47e910445ab6a958c154749893"><enum>(i)</enum><text>workforce inventory and industrial analysis;</text> </clause><clause id="IDbff055deaffe41448b3ab328241558fb"><enum>(ii)</enum><text>community development through coordinated planning; <enum>I</enum><header>Through Higher Education: Promoting the Advancement of Tribal Health</header> <section id="idddafcf0d-6f01-4533-97fc-e6be4bb0cc0e"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Through Higher Education: Promoting the Advancement of Tribal Health Act</quote> or <quote>THE PATH Act</quote>.</text> </section><section id="idfb132126-e936-4222-8410-e9b45021a931"><enum>102.</enum><header>Findings and purpose</header> <subsection id="id4e4333c0-f5a9-40c3-817f-2c435b8e3a66"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="idb839298d-8755-42d7-8d22-8f7336dff7fc"><enum>(1)</enum><text>because there is a significant lack of accessible health-related education and training opportunities for Indians, few Indians are represented in the health-related workforce of the United States;</text> </paragraph><paragraph id="id10fd64d0-7108-4ce0-9992-cfc639877b21"><enum>(2)</enum><text>tribal colleges and universities remain the most poorly-funded institutions of higher education in the United States, yet, as engaged institutions, tribal colleges and universities serve as catalysts for positive change in Indian communities;</text> </paragraph><paragraph id="idf3c7c09f-2f20-412a-a9e8-bf43136ada32"><enum>(3)</enum><text>tribal colleges and universities with nursing programs train hundreds of students to hold critically-needed professional and management positions in the Indian Health Service, tribal health organizations, and private and community agencies serving rural Indian populations;</text> </paragraph><paragraph id="id99816075-f9ac-400b-889a-19cdd508809f"><enum>(4)</enum><text>to the extent that tribal colleges and universities are able, the colleges and universities have begun to address the many societal challenges faced by Indian communities;</text> </paragraph><paragraph id="idb6d9d9f6-7ace-4b94-9d73-88d391a5dfd2"><enum>(5)</enum><text>tribal colleges and universities offer critically-needed education and outreach programs, including—</text> <subparagraph id="idffc854f7-252f-4ef8-ac53-deda18ee3ed8"><enum>(A)</enum><text>community health fairs;</text> </subparagraph><subparagraph id="id414451b6-ba12-43a6-9d42-234e786a6640"><enum>(B)</enum><text>HIV–AIDS education programs;</text> </subparagraph><subparagraph id="idcbbf0669-e6f7-4ee0-83cc-3f98dbb4b6c2"><enum>(C)</enum><text>diabetes education programs;</text> </subparagraph><subparagraph id="ide4057730-4e37-4425-a9e6-13dba105b043"><enum>(D)</enum><text>nutritional and obesity programs, including community garden programs;</text> </subparagraph><subparagraph id="id0f1f81ba-d0fb-4986-8568-22893a7ad610"><enum>(E)</enum><text>substance abuse prevention programs;</text> </subparagraph><subparagraph id="iddab4aa89-e6fa-42c0-99dd-8b0fc9a11509"><enum>(F)</enum><text>youth-at-risk programs;</text> </subparagraph><subparagraph id="id4b44b4f8-fd61-4489-9c8a-9d2f042f7ac4"><enum>(G)</enum><text>parenting classes; and</text> </subparagraph><subparagraph id="idbfc8718a-34b5-4984-b9b3-d5d1ff7f9c56"><enum>(H)</enum><text>child and elder care services; and</text> </subparagraph></paragraph><paragraph id="idcb306423-7772-4443-84f0-a738114ce917"><enum>(6)</enum><text>due to a chronic lack of operational and targeted program funding, together with the unwillingness of certain Federal agencies to recognize tribal colleges and universities as valuable partners in addressing rural community issues, including health care professional shortages, tribal colleges and universities have limited resources available to help adequately address the perennial health challenges of rural Indian communities.</text> </paragraph></subsection><subsection id="idcd659776-8e61-49c7-a855-96bda53f2c2c"><enum>(b)</enum><header>Purpose</header><text>The purpose of this title is to assist tribal colleges and universities to strengthen Indian communities through the provision of health promotion and disease prevention education, outreach, and workforce development programs, including program implementation, research, and capacity-building.</text> </subsection></section><section id="id1db86506-46e2-4b5b-be78-d0dc7aff5ea1"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="id39bfa70e-0ebb-4823-bc69-a5cad6b83302"><enum>(1)</enum><header>Deputy Assistant Secretary</header><text>The term <term>Deputy Assistant Secretary</term> means the Deputy Assistant Secretary for Minority Health, within the Office of Public Health and Science.</text> </paragraph><paragraph id="ide91534b2-ec19-4b39-be5a-0298b079f561"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Institutes of Health.</text> </paragraph><paragraph id="ida8d62ad1-8702-4d26-8b2e-f98e6f5a6ff6"><enum>(3)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (25 U.S.C. 1603).</text> </paragraph><paragraph id="id0376518b-9fbb-4700-adfa-150a3994d119"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph><paragraph id="id81ffa77a-5697-4a05-8aba-0c5258fb79c7"><enum>(5)</enum><header>Tribal college or university</header><text display-inline="yes-display-inline">The term <term>tribal college or university</term> means—</text> <subparagraph id="id6c1b2cf8-402d-4d9c-9295-2e544dc39712"><enum>(A)</enum><text>an institution that is eligible to receive funds under the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801 et seq.);</text> </subparagraph><subparagraph id="idfb1c7eaf-6a9d-4068-94ac-ae44b8f3195e"><enum>(B)</enum><text>Diné College; and</text> </subparagraph><subparagraph id="id5050a9bb-c063-4457-ac36-065aad5aea73"><enum>(C)</enum><text>any 1 of the 1994 Institutions (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (7 U.S.C. 301 note; Public Law 103–382)).</text> </subparagraph></paragraph></section><section id="id2c5a81fc-41ea-4dac-a171-9e7b25580fa9"><enum>104.</enum><header>Administration by coordinating officer</header> <subsection id="ida0f70fa1-c8ed-4d94-8331-41accc91ca0b"><enum>(a)</enum><header>Designation</header><text>The Deputy Assistant Secretary shall serve as the coordinating officer with respect to programs of tribal colleges and universities relating to—</text> <paragraph id="idE50B66D2FB8E4B129A0B6E4C55E14B50"><enum>(1)</enum><text>health care workforce development; and</text> </paragraph><paragraph id="id7878858C9FDC490AB817FEF53B139B62"><enum>(2)</enum><text>health promotion and disease prevention.</text> </paragraph></subsection><subsection id="idb727b577-142b-487d-91c4-003e89238bc2"><enum>(b)</enum><header>Staff</header><text>The Secretary shall appoint such additional staff as the Secretary determines to be necessary—</text> <paragraph id="id5f8f8c05-2212-4de3-a24b-b702fbc359a2"><enum>(1)</enum><text>to assist the Deputy Assistant Secretary in carrying out the duties under this section; and</text> </paragraph><paragraph id="id30137414-5f74-4857-86e5-e652c29e3c46"><enum>(2)</enum><text>to provide appropriate technical assistance to tribal colleges and universities eligible to receive grants or enter into cooperative agreements under this title.</text> </paragraph></subsection><subsection id="id1874b531-3511-48e1-b9ca-45a5ead9c1e2"><enum>(c)</enum><header>Memorandum of agreement</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall develop and implement a formal memorandum of agreement with the American Indian Higher Education Consortium to establish programs—</text> <paragraph id="idfed3953c-73ad-487f-ad29-ef7a0bf1034d"><enum>(1)</enum><text>to help ensure that Native American communities, through tribal colleges and universities, participate equitably in programs, services, and resources of the Department of Health and Human Services; and</text> </paragraph><paragraph id="id59eae8e7-0c09-4d68-b4e5-cd74b9e8395d"><enum>(2)</enum><text>to provide necessary technical assistance to the tribal colleges and universities, including in establishing collaborations among tribal colleges and universities and institutions of higher education or other organizations that carry out activities for culturally integrated education and training and research programs, delivered onsite or though distance learning.</text> </paragraph></subsection></section><section id="id74b0be77-1946-4474-9e0a-596d8ea1e535"><enum>105.</enum><header>Community-based health and wellness fairs</header> <subsection id="idf70f641b-58f2-4c53-8760-704282ee7620"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to carry out annual, community-based, and culturally relevant health and wellness fairs at the tribal colleges and universities.</text> </subsection><subsection id="idc4e69c6b-7714-497f-a9c7-adec63ec23ca"><enum>(b)</enum><header>Funding</header> <paragraph id="idc75c7764-5eac-463a-9e6a-4fd88b420bc5"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section for each of fiscal years 2009 through 2017 an amount equal to the sum of—</text> <subparagraph id="idb9a1e4a0-dde5-447d-8472-fc21b5e26b53"><enum>(A)</enum><text>the product obtained by multiplying—</text> <clause id="id9f2e4dd7-b0a0-4a09-8bad-0a7b83a56d76"><enum>(i)</enum><text>the number of tribal colleges and universities in operation on October 1 of the fiscal year; and</text> </clause><clause id="id883a379e-ff69-4bbd-8f4d-b8c88b221674"><enum>(ii)</enum><text>$15,000; and</text> </clause></subparagraph><subparagraph id="idf723c081-2b42-4a6d-a5e0-7689ee537496"><enum>(B)</enum><text>such amount as the Secretary determines to be necessary for the costs of administering the program under this section.</text> </subparagraph></paragraph><paragraph id="idd487ec86-26a0-4379-86d3-c321176edf40"><enum>(2)</enum><header>Total amount</header><text>Subject to paragraph (3), the Secretary shall use all amounts made available under paragraph (1)(A) to provide grants or enter into cooperative agreements pursuant to this section.</text> </paragraph><paragraph id="id9fc4bd55-6b6f-42ab-9be5-c611471e3b4c"><enum>(3)</enum><header>Nonapplicability of limitation</header><text>The limitation under section 1703(c) of the Public Health Service Act (42 U.S.C. 300u–2(c)) shall not apply to this section.</text> </paragraph></subsection></section><section id="ide0e7478a-d107-4a07-996d-9cf96809d71a"><enum>106.</enum><header>Health promotion and disease prevention targeted programs</header> <subsection id="id9ddc1fd5-0d8d-4f1a-9c8b-6709529e1d84"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Deputy Assistant Secretary, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to assist the tribal colleges and universities to build and expand the capacity to work collaboratively with relevant Indian tribes—</text> <paragraph id="idc9743322-e269-4559-b06b-7a9f5aec0539"><enum>(1)</enum><text>to conduct coordinated community-based health promotion and disease prevention activities; and</text> </paragraph><paragraph id="id9d6a653d-e285-4ac0-8828-58b4fa077ebf"><enum>(2)</enum><text>to jointly plan and implement programs to help reduce health disparities in tribal communities, to the maximum extent practicable.</text> </paragraph></subsection><subsection id="id7e2d65a4-944c-4b92-be67-7133cfec6371"><enum>(b)</enum><header>Requirements</header><text>In providing grants and entering into cooperative agreements under this section, the Secretary, to the maximum extent practicable, shall—</text> <paragraph id="id45b17996-987a-4ec3-acdd-6da3e48d2a4d"><enum>(1)</enum><text>approve applications on a competitive basis; and</text> </paragraph><paragraph id="id78f46aba-129f-44b9-b4f0-36974722b85f"><enum>(2)</enum><text>ensure maximum and equitable distribution among eligible tribal colleges and universities.</text> </paragraph></subsection><subsection id="id113b29db-213b-4fc7-8a3d-4b58a25eb2d1"><enum>(c)</enum><header>Application</header> <paragraph id="id4034c2ba-7864-42bd-b3d0-f2c433239058"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant or enter into a cooperative agreement under this section, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph id="id5bb396ca-d519-4008-810c-f78dc5d4bdc5"><enum>(2)</enum><header>Inclusions</header><text>An application under paragraph (1) shall include—</text> <subparagraph id="id9AC04B3EB6BF4D15BD1F35D57AD4F9AE"><enum>(A)</enum><text>a signed agreement between the tribal college or university and each relevant Indian tribe that—</text> <clause id="id4C13280B46E242B5A6D0E095AD7E1D30"><enum>(i)</enum><text>requires the entities to establish a partnership to implement the proposed community-based program; and</text> </clause><clause id="idE5072C65A595405EB2E1A1A3F50649F8"><enum>(ii)</enum><text>specifies the roles of each entity;</text> </clause></subparagraph><subparagraph id="idA37D93F2967B4561BA5F292158D8A06A"><enum>(B)</enum><text>a jointly prepared 5-year plan for addressing the health promotion and disease prevention needs of Indians or Alaska Natives, as appropriate, in the area served by the tribal college or university;</text> </subparagraph><subparagraph id="id10C3E177641D488DB36FCAE9D1ACCF54"><enum>(C)</enum><text>a demonstration of need for the proposed program;</text> </subparagraph><subparagraph id="id069D374E668940469E9C8794CF111BF5"><enum>(D)</enum><text>an assurance that measures will be implemented and monitored to minimize duplication of services; and</text> </subparagraph><subparagraph id="id28634FC0422B4C7BB8951BEF539E91A2"><enum>(E)</enum><text>an assurance that, under the proposed program, the tribal college or university shall not be a direct provider of any health care treatment or service.</text> </subparagraph></paragraph><paragraph id="id849ec121-3e67-42ee-9534-55d1959088f5"><enum>(3)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="idad033cbd-537c-4af3-8574-dd1853e02a9a"><enum>(d)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this section may use the grant or cooperative agreement to develop and carry out activities to address targeted areas of health promotion and disease prevention in tribal communities, including activities described in a partnership agreement under subsection (c)(2)(A) relating to—</text> <paragraph id="id968344cd-5028-4eee-a300-5bd1e0936b83"><enum>(1)</enum><text>diabetes education and prevention;</text> </paragraph><paragraph id="id0cbbf74b-8c5a-4001-af7b-3d448287b94c"><enum>(2)</enum><text>injury prevention;</text> </paragraph><paragraph id="idef8ac690-daba-455d-ae9d-21c78d876cfe"><enum>(3)</enum><text>substance abuse, including methamphetamine abuse;</text> </paragraph><paragraph id="id7bc7ae3f-3992-4295-9b6d-c970a6156699"><enum>(4)</enum><text>HIV–AIDS prevention;</text> </paragraph><paragraph id="id42555ef1-c8c0-45f6-9546-8e4130289516"><enum>(5)</enum><text>emerging health promotion and disease prevention program and response development; and</text> </paragraph><paragraph id="id3cb7dfe1-a7eb-4d52-baa8-dbd9767ca115"><enum>(6)</enum><text>obesity and nutrition education.</text> </paragraph></subsection><subsection id="idfa4016fa-b1fc-466d-a174-99df0522effb"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section><section id="id60f8bd37-9faa-4403-8af3-b99d15cb0d44"><enum>107.</enum><header>Development and expansion of public health professional degree programs</header> <subsection id="idf3c6e6ab-69de-4417-81a6-320f54c84015"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities (which may include consortia of tribal colleges and universities and other institutions of higher education) for purposes of—</text> <paragraph id="id078D771CEC164893953DB5B7C89DC3F8"><enum>(1)</enum><text>developing curricula, courses, degree, and in-service programs for health-related professions; and</text> </paragraph><paragraph id="id69991A84752840759A4BC461CA6855F9"><enum>(2)</enum><text>strengthening those programs through the acquisition of basic and advanced laboratory, research, and classroom equipment, instruments, and computers (including software).</text> </paragraph></subsection><subsection id="id6aa3f770-f547-4598-88ba-fd63e19a4a01"><enum>(b)</enum><header>Application</header> <paragraph id="id835dc7ff-ef66-46a4-9f3a-e8e8c50f23d8"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph id="id08c34359-d2c6-4c8b-990a-3c134ffa95d2"><enum>(2)</enum><header>Inclusion</header><text>An application under paragraph (1) shall include a description of a 5-year strategy of the applicable tribal college or university for increasing the number of Indians in the health workforce of the United States.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3f08c92-83ee-45a5-b4ad-5ada7d61f266"><enum>(3)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="id419c78d3-6fe3-4de3-ae5c-7d6736120afb"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $15,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section><section id="id91182aac-ba25-4bcd-b2e2-726d95ba5172"><enum>108.</enum><header>Tribal College and University Rural Health Equity Endowment Fund</header> <subsection id="ide2fe601d-ea44-4173-874a-52b55508f72e"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Tribal College and University Rural Health Equity Endowment Fund</quote> (referred to in this section as the <term>Fund</term>), consisting of—</text> <paragraph id="idaa000918-4379-48a3-9bde-628a7b7320a5"><enum>(1)</enum><text>such amounts as are appropriated to the Fund under subsection (b); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc7dec5a-2c7b-478a-af7d-b7882d8f366a"><enum>(2)</enum><text>any interest earned on those amounts.</text> </paragraph></subsection><subsection id="id24abc747-b1fa-4e07-9457-3906a0a31ceb"><enum>(b)</enum><header>Transfers to Fund</header><text>There is appropriated to the Fund, out of funds of the Treasury not otherwise appropriated, $9,000,000 for each of fiscal years 2009 through 2017.</text> </subsection><subsection id="idea00bb6b-7d99-4517-984d-f02536ae537a"><enum>(c)</enum><header>Investments</header><text>The Secretary shall invest amounts in the Fund in interest-bearing obligations of the United States.</text> </subsection><subsection id="id71a40603-36b9-4d92-b1f2-af746b6858e1"><enum>(d)</enum><header>Expenditures from Fund</header> <paragraph id="id7974b4fc-a50d-4c2c-a561-dc5f948998ee"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), on September 30 of fiscal year 2009 and annually thereafter through September 30, 2017, on request by the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary an amount equal to the amount of interest income earned on amounts in the Fund during the preceding fiscal year.</text> </paragraph><paragraph id="idb69e3886-7c24-400b-84c2-16a9b84b2442"><enum>(2)</enum><header>Administrative expenses</header><text>An amount not exceeding 1 percent of the annual interest yield distributed to tribal colleges and universities shall be available for each fiscal year to pay the administrative expenses necessary to carry out this section.</text> </paragraph></subsection><subsection id="id939bfe04-ef00-40bc-bf4d-0df7291baf4a"><enum>(e)</enum><header>Distribution of amounts</header><text>Of amounts transferred under subsection (d)(1), the Secretary shall distribute—</text> <paragraph id="id4744e3c8-dbbd-4b4b-9873-7149005600af"><enum>(1)</enum><text>60 percent to tribal colleges and universities on a pro rata basis, based on the proportion that—</text> <subparagraph id="id43cec564-43f9-405b-a58a-ec24df2f60bc"><enum>(A)</enum><text>the Indian student count (as defined in section 2(a) of the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801(a)) of a tribal college or university for the applicable fiscal year; bears to</text> </subparagraph><subparagraph id="id6391fe5e-919f-45a5-abc2-8fee5151dc21"><enum>(B)</enum><text>the Indian student count of all tribal colleges and universities for that fiscal year; and</text> </subparagraph></paragraph><paragraph id="id6e5a4a0b-3df8-4432-92f0-ea0288884b4e"><enum>(2)</enum><text>40 percent in payments of equal amounts to each tribal college and university.</text> </paragraph></subsection><subsection id="id2eb2e80a-9ae9-46cc-9769-18507c1dbcb7"><enum>(f)</enum><header>Use of funds</header><text>A tribal college or university shall use amounts received under this section to establish and maintain an endowment for a health professions workforce development program at the tribal college or university.</text> </subsection></section><section id="id24b605c7-6762-423c-b466-a16aff180ce2"><enum>109.</enum><header>Offices of sponsored programs</header> <subsection id="id9619e7ad-2d56-4cbb-b3ce-efdf391bddb5"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Director, shall establish a program under which the Secretary shall provide grants to tribal colleges and universities to establish and maintain at the tribal colleges and universities offices of sponsored programs described in subsection (b).</text> </subsection><subsection id="ide8fa9004-4559-454a-a1f2-342591f3e545"><enum>(b)</enum><header>Sponsored programs</header><text>The sponsored programs referred to in subsection (a) include programs for—</text> <paragraph id="ida71db43c-f17e-4f2a-b2a6-6e3afde004f6"><enum>(1)</enum><text>pre- and post-grant award research, data collection, and analyses, through a method that ensures—</text> <subparagraph id="id82abe442-61a6-4466-9691-043d734d30d9"><enum>(A)</enum><text>proper documentation of relevant applications; and</text> </subparagraph><subparagraph id="idc3a7b1b1-adf6-4b4b-b3f6-472b8c8eb868"><enum>(B)</enum><text>compliance with applicable regulations and guidelines;</text> </subparagraph></paragraph><paragraph id="id48d27bd4-5b02-4f83-a036-da8c8a2e1d75"><enum>(2)</enum><text>advancing specific institutional grant application procedures and processes through coordination of external funding sources and faculty, staff, and financial officers;</text> </paragraph><paragraph id="id15496a97-42fe-4b19-99e8-f6524cb906df"><enum>(3)</enum><text>assisting in negotiations with Federal funding sources;</text> </paragraph><paragraph id="idc0b7265b-83c6-4cf6-84ac-4a0bca82f233"><enum>(4)</enum><text>providing liaisons with Federal counterparts of tribal colleges and universities—</text> <subparagraph id="id05e0391b-9924-4232-8175-ba885d11a0c5"><enum>(A)</enum><text>to train and assist principal investigators, faculty, and college staff with respect to grant management, reporting, and program implementation; and</text> </subparagraph><subparagraph id="id74ebc52c-8842-4847-bed4-4a56ef07f965"><enum>(B)</enum><text>to ensure that applicable deadlines are met and required reports are completed;</text> </subparagraph></paragraph><paragraph id="id194b6b45-c668-40d2-88f5-5656e76c016b"><enum>(5)</enum><text>coordinating partnerships between tribal colleges and universities, Federal agencies, and the private sector for collaborative programs and activities; and</text> </paragraph><paragraph id="id74ddc955-d780-44a7-9423-e3a986413b72"><enum>(6)</enum><text>in consultation with Federal agencies, identifying and proposing solutions to—</text> <subparagraph id="iddef9d9b9-6000-4d13-af0d-83838109099e"><enum>(A)</enum><text>obstacles relating to Federal agency grant application procedures and requirements; and</text> </subparagraph><subparagraph id="idaeecf19c-2dd6-4106-b71a-63e1831f2cbf"><enum>(B)</enum><text>other problems relating to Federal grant program structures and requirements.</text> </subparagraph></paragraph></subsection><subsection id="id74f3d100-2946-4b39-bdf5-e7bc38bc25aa"><enum>(c)</enum><header>Application</header> <paragraph id="idc9321eef-75b7-4092-9bc5-65ad07d0de82"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8304dbb9-fd40-4b40-a26f-c87ca9a9473a"><enum>(2)</enum><header>Inclusion</header><text>An application under paragraph (1) shall include a description of a 5-year strategy of the applicable tribal college or university for carrying out a sponsored program at the tribal college or university, including performance indicators by which success of the tribal college or university will be evaluated.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id67a67ad0-1486-4742-a088-fd2a605a6f82"><enum>(d)</enum><header>Distribution of funds</header><text>For each of fiscal years 2009 through 2017, the Secretary, acting through the Director, shall provide to each tribal college and university the application of which is approved under subsection (c) a grant in an amount equal to the quotient obtained by dividing—</text> <paragraph id="id67ba6889-2e40-44cf-b45d-07e58ca2f9a0"><enum>(1)</enum><text>the total amount made available under subsection (f) for the fiscal year; by</text> </paragraph><paragraph id="id6e91d22f-1424-4926-8df1-6961b2ad8788"><enum>(2)</enum><text>the number of tribal colleges and universities the applications of which are approved under subsection (c) for the fiscal year.</text> </paragraph></subsection><subsection id="id7106d7b2-1a17-40c8-836b-6e5ec2efdcf9"><enum>(e)</enum><header>Reports</header><text>For each of fiscal years 2010 through 2018, each tribal college or university that receives a grant under this section shall submit to the Director a report describing the success of the office of sponsored programs of the tribal college or university during the preceding fiscal year, as determined in accordance with the performance indicators contained in the application of the tribal college or university under subsection (c)(2).</text> </subsection><subsection id="id471c8b20-abef-4f5d-afaf-728f8393d637"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section for each of fiscal years 2009 through 2017 an amount equal to the product obtained by multiplying—</text> <paragraph id="id338c74d6-d3bf-4777-935d-e9bda298ab42"><enum>(1)</enum><text>the number of tribal colleges and universities in operation on October 1 of the applicable fiscal year; and</text> </paragraph><paragraph id="id7a256a4e-fc34-4f8a-a7b6-8e81b613387a"><enum>(2)</enum><text>$50,000.</text> </paragraph></subsection></section><section id="idfb44c0d8-cf8f-4528-9241-b320d10cddf4"><enum>110.</enum><header>Health promotion and disease prevention research programs</header> <subsection id="id651ea19d-bbbc-4db7-b4da-67cd0c7bfe38"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Director, shall establish a program under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, tribal colleges and universities to conduct research relating to health promotion and disease prevention at the tribal colleges and universities.</text> </subsection><subsection id="idbb1572cc-8bbd-4db7-a1f6-32012f7901c2"><enum>(b)</enum><header>Requirements</header> <paragraph id="id931430a2-2b6b-4d95-a64a-28c44bdf7a12"><enum>(1)</enum><header>Competition</header><text>The Secretary shall provide grants and offer to enter into cooperative agreements under subsection (a) on a competitive basis.</text> </paragraph><paragraph id="id8c15b9ea-26bd-4b8f-a2d2-87e319349cfb"><enum>(2)</enum><header>General terms and amounts</header><text>Except as provided in paragraph (3)—</text> <subparagraph id="idb65ffd36-a861-4600-8425-3c76b47cd148"><enum>(A)</enum><text>the term of a grant or cooperative agreement under subsection (a) shall be not more than 3 years; and</text> </subparagraph><subparagraph id="id39a9d31d-047c-4bb9-b776-9c238a32e42c"><enum>(B)</enum><text>the minimum amount of a grant under subsection (a) for a fiscal year shall be $150,000.</text> </subparagraph></paragraph><paragraph id="idd3654103-19fc-444f-ae0a-311a25af940e"><enum>(3)</enum><header>Undergraduate research experience programs</header><text>With respect to a grant or cooperative agreement provided for an undergraduate research experience program under subsection (d)(3)—</text> <subparagraph id="id5dd7bd72-678a-4a6f-9224-7e7da909a2fc"><enum>(A)</enum><text>the term of such a grant or cooperative agreement shall be not more than 1 year; and</text> </subparagraph><subparagraph id="id4996c5e0-15cb-4d1f-87b0-4821ad2ac375"><enum>(B)</enum><text>the minimum amount of such a grant for a fiscal year shall be $10,000.</text> </subparagraph></paragraph></subsection><subsection id="idd4178317-0d74-42a8-b3bf-ba7d5c527eea"><enum>(c)</enum><header>Application</header> <paragraph id="idc7a7b609-a7db-4e6c-9315-e9250d47d086"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant, or to enter into a cooperative agreement, under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id292fd256-454e-4d54-bdbc-c18365fa92b6"><enum>(2)</enum><header>Streamlined procedure</header><text>The Secretary shall ensure, to the maximum extent practicable, a simplified and streamlined procedure for the submission and approval of applications under paragraph (1), taking into consideration the limited number of institutions that are eligible to receive assistance under this section.</text> </paragraph></subsection><subsection id="idc083a15d-79aa-4347-b642-b290f2cf338a"><enum>(d)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this section may use the grant or cooperative agreement to carry out activities, including—</text> <paragraph id="id214e1715-f1bf-4ac7-9e64-4d6f7ed081db"><enum>(1)</enum><text>research on culturally relevant and innovative health promotion and disease prevention strategies;</text> </paragraph><paragraph id="id0190ad19-dd53-44e1-af85-62f507355abc"><enum>(2)</enum><text>epidemiological research on the health status of Indian populations and communities; and</text> </paragraph><paragraph id="id34f93ff4-acdf-4aca-8c7b-5eecac5a94d5"><enum>(3)</enum><text>undergraduate research experience programs as the tribal college or university determines to be appropriate.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4c0286ed-98e4-48d0-90fd-d1964e91e602"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $12,000,000 for each of fiscal years 2009 through 2017.</text> </subsection></section><enum>II</enum><header>Advancing Tribes Through Tribal Colleges and Universities</header> <section id="id91664e1a-7844-4313-832e-e43126a688dc"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Advancing Tribes Through Tribal Colleges and Universities Act</quote> or the <quote>AT TCUs Act</quote>.</text> </section><section id="idf9fe2572-9ec9-4973-942e-930100859105"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id42ac0fc1-bf2d-44f9-b09d-f483bf5e3e91"><enum>(1)</enum><text>a primary goal of providing Federal support for higher education is to ensure social and economic self-sufficiency and growth for all residents of the United States;</text> </paragraph><paragraph id="idfbe1a7c0-85f9-4877-8593-44d45f16e889"><enum>(2)</enum><text>social and economic underdevelopment is the primary obstacle to the self-sufficiency of Indian communities and families;</text> </paragraph><paragraph id="id50105969-401c-4550-b054-05b08cc6eb4b"><enum>(3)</enum><text>research has demonstrated that higher education is a primary method of achieving economic and social development for Indian communities;</text> </paragraph><paragraph id="id3446e551-e6b4-4143-bbc7-b4bb7d540e59"><enum>(4)</enum><text>tribal colleges and universities are institutions of higher education created by Indians for Indians primarily on rural and isolated Indian reservations, which were virtually excluded from the general system of higher education in the United States;</text> </paragraph><paragraph id="id7eefa046-f02d-42f8-84af-28d441493d71"><enum>(5)</enum><text>underlying goals of tribal colleges and universities are—</text> <subparagraph id="idd89c4465-ba38-48c3-956f-70c0513bd11e"><enum>(A)</enum><text>to improve the lives of Indians through higher education; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6a85b980-d178-411d-aff2-3fbb490c0092"><enum>(B)</enum><text>to assist Indians in achieving self-sufficiency;</text> </subparagraph></paragraph><paragraph id="iddc7e6530-5c2a-470f-9051-2be37d144cfd"><enum>(6)</enum><text>tribal colleges and universities—</text> <subparagraph id="id69b8ff64-a7b7-4541-9975-45a3b45d0548"><enum>(A)</enum><text>offer a variety of social services for students and community members; and</text> </subparagraph><subparagraph id="idf7fb519d-e408-4bcb-92c2-07c648031a3b"><enum>(B)</enum><text>often serve as community centers, libraries, tribal archives, career and business centers, economic development centers, public meeting places, and childcare and wellness centers;</text> </subparagraph></paragraph><paragraph id="id6ded8c4a-270b-4426-8c70-eb7030c709d8"><enum>(7)</enum><text>tribal colleges and universities and students of those colleges or universities contribute significantly to the economic and social health of Indian communities;</text> </paragraph><paragraph id="id8d973928-31d0-4c03-a6c1-fafe4a836c8e"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idecc3d9c9-e624-41ac-a8f5-203f6aa5c193"><enum>(A)</enum><text>tribal colleges and universities have been more successful than any other institution of higher education in educating and helping to retain Indians in high-need fields, such as nursing and teaching;</text> </subparagraph><subparagraph changed="added" committee-id="SLIA00" id="idebbc9404-496a-49da-8866-123a72f9940a" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>data from 2005 indicates that—</text> <clause id="id72167df3-457d-43f0-9b0f-f59738f49e1b"><enum>(i)</enum><text>approximately <fraction>1/2</fraction> of all graduates of tribal colleges and universities pursue advanced education; and</text> </clause><clause id="idc928a1d5-1d64-46f8-85cc-f54e6681f84b"><enum>(ii)</enum><text>of those graduates, more than 86 percent pursue bachelor’s degrees;</text> </clause></subparagraph></paragraph><paragraph id="idd6348da8-d267-427a-9e2f-b5667d4f0489"><enum>(9)</enum><text>individuals, including Indians, with bachelor’s or advanced degrees earn—</text> <subparagraph id="id8a8532c7-c3d6-4fe8-81a3-116eff8b5cd8"><enum>(A)</enum><text>almost 4 times as much as individuals who do not graduate from high school; and</text> </subparagraph><subparagraph id="id90190a8d-885b-4bc3-bc27-71334eacb5d3"><enum>(B)</enum><text>more than twice as much as individuals with high school diplomas;</text> </subparagraph></paragraph><paragraph id="idddb982fa-0416-40ef-a6bf-f9a72c1ef09c"><enum>(10)</enum><text>of the 155 indigenous languages spoken in the United States as of the date of enactment of this Act, 135 are spoken only by Indian elders;</text> </paragraph><paragraph id="ide8b1d108-82a6-4638-a6fd-8721948b1da8"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id66bd4c02-af50-4422-b229-eb8c45ee05be"><enum>(A)</enum><text display-inline="yes-display-inline">language and culture are at the heart of the mission of each tribal college and university;</text> </subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id7d4d463e-0d52-40af-b072-199fd638e085" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">tribal colleges and universities—</text> <clause id="id7398efc9-eef7-4267-8afb-c097672aa3e0"><enum>(i)</enum><text display-inline="yes-display-inline">play a strong leadership role in Native American language immersion; and</text> </clause><clause id="id43d403bd-7ac6-4208-bed7-f453e7b207f5"><enum>(ii)</enum><text display-inline="yes-display-inline">are responsible for the majority of the approximately 50 Native American language immersion programs in the United States; and</text> </clause></subparagraph></paragraph><paragraph id="id95da702b-30a6-4896-a313-7130e7cd2d0c"><enum>(12)</enum><text>despite the proven success of Native American language preservation and vitalization efforts of tribal colleges and universities, only minimal Federal and private sector resources are used for the activities.</text> </paragraph></section><section id="ide5fd8ecd-5792-4c3e-9a83-5d0c801f7bdc"><enum>203.</enum><header>Native Prosperity Programs at TCUs</header> <subsection id="id90b0ed0a-c289-4209-b6a6-99b5f322f330"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 166 of the Workforce Investment Act of 1998 (29 U.S.C. 2911) is amended by adding at the end the following:</text> <quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id6372b457-fc2b-48bb-8847-ae39ce1fb82d" reported-display-style="italic" style="OLC"> <subsection id="idcfe82c6d-0dc2-42a3-8274-4bd1893cdd4d"><enum>(k)</enum><header>Native Prosperity Programs at TCUs</header> <paragraph id="idce2f2ba7-d711-4438-a293-1704605d4ea0"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a program, to be known as the <quote>TCU Native Prosperity Program</quote>, under which the Secretary shall provide grants to, or offer to enter into cooperative agreements with, eligible tribal colleges and universities to promote economic development, entrepreneurship, community development, and sound fiscal leadership in Indian communities.</text> </paragraph><paragraph id="id8e26fd99-6eed-4fb5-8676-ca62957345bc"><enum>(2)</enum><header>Requirements</header> <subparagraph id="id243cab9a-5912-40ee-83b5-627da237fa54"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B)—</text> <clause id="idc107681b-bb7c-437f-a724-aa1da9827c16"><enum>(i)</enum><text>the Secretary shall provide grants and offer to enter into cooperative agreements under paragraph (1) on a competitive basis; and</text> </clause><clause id="idb6700554-bdca-4669-8c4d-5bf07c63c4f6"><enum>(ii)</enum><text>the term of a grant or cooperative agreement under paragraph (1) shall be 5 years.</text> </clause></subparagraph><subparagraph id="idfac636da-2caa-4003-aa41-f8710006cb2b"><enum>(B)</enum><header>Exception</header><text>If the Secretary determines that a tribal college or university that receives a grant or enters into a cooperative agreement under this subsection has performed satisfactorily throughout the initial 5-year term of the grant or cooperative agreement under subparagraph (A)(ii)—</text> <clause id="idd2bbee8e-c586-4c04-9fc6-7d9956102025"><enum>(i)</enum><text>the tribal college or university may submit to the Secretary an application to extend the grant or cooperative agreement, as applicable, for a period of not more than 3 additional years; and</text> </clause><clause id="id8b405eeb-0250-46eb-9362-60d8b10b53a3"><enum>(ii)</enum><text>the Secretary may waive the competitiveness requirement of subparagraph (A)(i) with respect to the application.</text> </clause></subparagraph></paragraph><paragraph id="id328c16d9-d964-4ce1-8340-1a68281f62c0"><enum>(3)</enum><header>Application</header> <subparagraph id="idbe172a7e-e85d-4aea-938f-d012524e9cc9"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant or enter into a cooperative agreement under this subsection, a tribal college or university shall submit to the Secretary an application at such time and in such manner as the Secretary may reasonably require.</text> </subparagraph><subparagraph id="idc1d629e7-9791-4ce7-a2a9-564f1873ed96"><enum>(B)</enum><header>Program plan</header> <clause id="id6b9ec3d1-0ab2-4689-a58b-4919868aabe3"><enum>(i)</enum><header>In general</header><text>An application under subparagraph (A) shall include a plan for the program proposed to be carried out by the eligible tribal college or university using the grant or pursuant to the cooperative agreement, as applicable.</text> </clause><clause id="id23572bab-d63e-47c6-ba2d-debd23148a74"><enum>(ii)</enum><header>Inclusions</header><text>A program plan under subparagraph (A) shall include—</text> <subclause id="idfbd5374d-ce66-4814-8c7a-216e2cdb8300"><enum>(I)</enum><text>a description of a 5-year plan for the applicable tribal college or university, developed in consultation with, and approved by, each relevant Indian tribe, through which the tribal college or university will work collaboratively to meet the needs of Indians or Alaska Natives, as appropriate, in the area served by the tribal college or university;</text> </subclause><subclause id="id43731bf4-f5a9-4d78-91a1-f13cdd5f1660"><enum>(II)</enum><text>an identification of the population to be served by the tribal college or university;</text> </subclause><subclause id="id1f4bdfc9-a979-4f5f-ae67-bec4af96c5dd"><enum>(III)</enum><text>an identification of the education and employment needs of that population and a description of the manner in which the program will—</text> <item id="idde1c015f-1401-4d63-bd5a-be69e6aedf27"><enum>(aa)</enum><text>strengthen the economic development potential of the population; or</text> </item><item id="id177638fd-42bb-4eb5-bbf9-8c076e72254b"><enum>(bb)</enum><text>contribute to the development of high-quality local and community services;</text> </item></subclause><subclause id="id3a38e0de-ef77-4fe9-9344-899b16646ac9"><enum>(IV)</enum><text>a description of the services to be provided under the program, including the manner in which the services will be integrated with other appropriate activities to minimize duplication of services; and</text> </subclause><subclause id="id0e380d01-3cc7-4268-87e0-841c28062fe8"><enum>(V)</enum><text>a description, to be prepared in consultation with the Secretary, of the performance measures to be used to assess the performance of the tribal college or university in carrying out the program.</text> </subclause></clause><clause id="id63d1570a-5965-45bb-8c78-4a198fe5cfdd"><enum>(iii)</enum><header>Requirement</header><text>A program plan shall be consistent with the purposes of this section, as determined by the Secretary.</text> </clause></subparagraph></paragraph><paragraph id="idbe676a78-db34-49ef-b3dc-922a2112bcaf"><enum>(4)</enum><header>Activities</header><text>A tribal college or university that receives a grant or enters into a cooperative agreement under this subsection may use the grant or cooperative agreement to carry out activities, including—</text> <subparagraph id="id29ba26ca-6924-4db9-bf78-7f55f6ee9a04"><enum>(A)</enum><text>microenterprise development;</text> </subparagraph><subparagraph id="ida01bcd58-c827-4d9b-96e9-29bb8314b281"><enum>(B)</enum><text>business development and administration courses and degree programs;</text> </subparagraph><subparagraph id="iddc9e431a-c66c-4816-81fd-0f8c2ab8c784"><enum>(C)</enum><text>entrepreneurship programs;</text> </subparagraph><subparagraph id="idccf8dfae-ec64-41ef-bc32-292f937a0878"><enum>(D)</enum><text>municipality planning and administration courses, degree programs, and in-service training; and</text> </subparagraph><subparagraph id="id554a0d1d-4893-492d-b74d-55822ffde72a"><enum>(E)</enum><text>executive leadership training in economic development, planning, and emerging management issues.</text> </subparagraph></paragraph><paragraph id="idBF646878003C48A5BDAD77927D187176"><enum>(5)</enum><header>Technical assistance</header><text>To ensure that tribal colleges and universities receive timely, equitable, and culturally relevant technical assistance, the Secretary may enter into any cooperative agreement the Secretary determines to be necessary with the American Indian Higher Education Consortium.</text> </paragraph><paragraph id="idd400d6de-86ad-4d54-ae00-7e2d515e8fcc"><enum>(6)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $12,000,000 for each of fiscal years 2009 through 2012.</text> </paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block> </subsection></section><section id="idfb726cba-6754-4e86-b23a-7168f670f2ec"><enum>204.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 166(b) of the Workforce Investment Act of 1998 (29 U.S.C. 2911(b)) is amended by adding at the end the following:</text> <quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id53e6272c-36b9-45c9-aa05-123a5342fb53" reported-display-style="italic" style="OLC"> <paragraph id="idb9969980-d93d-4f36-9733-a1f3883d13e5"><enum>(4)</enum><header>Tribal college or university</header><text>The term <term>tribal college or university</term> means—</text> <subparagraph id="idbd03cb4e-03b9-41ec-9010-a45f739a1804"><enum>(A)</enum><text>an institution that is eligible to receive funds under the Tribally Controlled College or University Assistance Act of 1978 (25 U.S.C. 1801 et seq.);</text> </subparagraph><subparagraph id="id60ba5710-0daf-4a94-a532-c340203a9491"><enum>(B)</enum><text>Diné College; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8c350112-9cf9-4473-a17c-a6ebcf62480e"><enum>(C)</enum><text>any 1 of the 1994 Institutions (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (7 U.S.C. 301 note;
