			</subsection></section><section changed="deleted" committee-id="SSJU00" id="id425D8C52ED154282A0E4351815CF4DC8" reported-display-style="strikethrough"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="IDaa31d5ab4cd646809a30b85637adcde3"><enum>(1)</enum><text>The Internet has
			 facilitated the growth of a multi-billion dollar global market for images and
			 video of children being sexually-displayed, raped, and tortured, far exceeding
			 law enforcement's capacity to respond at the Federal, State, and local
			 level.</text>
			</paragraph><paragraph id="IDfc818c354c644743af31d4608982fcb2"><enum>(2)</enum><text>The explosion of
			 child pornography trafficking is claiming very young victims. Research by the
			 Department of Justice, the University of New Hampshire, and the National Center
			 for Missing and Exploited Children indicates that among those arrested for
			 possession of child pornography, 83 percent have images of children 6-12 years
			 old, 39 percent have images of children 3-5 years old, and 19 percent have
			 images of children under the age of 3 years old.</text>
			</paragraph><paragraph id="IDa048470f9aa54533ba450c8be7a0862c"><enum>(3)</enum><text>The images and
			 videos being trafficked typically depict sexual assaults that are both graphic
			 and brutal. The same research indicates that 80 percent of known child
			 pornography possessors have images of children being sexually penetrated and 21
			 percent have images depicting children bound, gagged, blindfolded, or
			 <quote>otherwise enduring sadistic sex.</quote> Just 1 percent restricted their
			 collecting to images of simple child nudity.</text>
			</paragraph><paragraph id="IDeb2dbac90b7b4476ab5369a57ed6bc87"><enum>(4)</enum><text>Millions of
			 American children and teens are at risk from sexual predators who are hunting,
			 stalking, and luring minors online. Along with the incredible access to the
			 world offered our children by the Internet, the Internet also offers the world
			 access to our children.</text>
			</paragraph><paragraph id="ID5469cbbdefa741a0a2584eaaa3fdfa0b"><enum>(5)</enum><text>The Internet
			 Crimes Against Children Task Force program (<quote>ICAC Program</quote>) of the
			 Department of Justice has identified millions of child pornography transactions
			 involving images and video of child sexual assault from millions of computer IP
			 addresses worldwide.</text>
			</paragraph><paragraph id="ID8ddf4d9c7a27439eb754c952c9d992c1"><enum>(6)</enum><text>The ICAC Program
			 has been highly successful in creating and sustaining an emerging national
			 network of 46 Federal, State, and local task forces, which form the backbone of
			 America's national readiness to combat child exploitation.</text>
			</paragraph><paragraph id="IDdba41a41e3224bf0877fcb439d844507"><enum>(7)</enum><text>In testimony
			 before Congress, law enforcement experts have expressed consensus that lack of
			 dedicated forensic analysis capacity is a severe problem at the Federal, State,
			 and local level, severely limiting the number of predators that can be
			 interdicted and children that can be identified and rescued.</text>
			</paragraph><paragraph id="IDf0693f0e2b3c4cde898e132dc0229c0d"><enum>(8)</enum><text>The Federal Bureau
			 of Investigation, the Department of Immigrations and Customs Enforcement, and
			 the United States Postal Inspection Service have each developed highly
			 specialized and successful child exploitation investigative capabilities, yet
			 these agencies have testified to Congress that they must triage the
			 overwhelming number of child exploitation crimes and cannot investigate a large
			 percentage of known crimes.</text>
			</paragraph><paragraph id="ID628e2c61bfcc4ab7b649a574c882f23f"><enum>(9)</enum><text>Child pornography
			 and online child enticement crimes have among the highest conviction rates of
			 any child sexual offense, and the Department of Justice funded research
			 indicates that the majority of child pornography offenders have committed or
			 attempted direct sexual contact offenses against children. Investigating and
			 prosecuting these predators is thus one of the most concrete and measurable
			 strategies for the prevention of future child sexual abuse.</text>
			</paragraph></section><section changed="deleted" committee-id="SSJU00" id="id56C65A4A922C433EB54264041B1AF42C" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions shall
			 apply:</text>
			<paragraph id="id3446711DA7C344C8AC76F0F5A9A1E218"><enum>(1)</enum><header>Child
			 exploitation</header><text>The term <term>child exploitation</term> means any
			 conduct, or an attempt or conspiracy to commit such conduct, constituting
			 criminal sexual abuse of a minor, sexual exploitation of a minor, abusive
			 sexual contact of a minor, sexually explicit conduct with a minor, or any
			 similar offense under Federal or State law.</text>
			</paragraph><paragraph id="id15BF36C36E524D68822473F86716055E"><enum>(2)</enum><header>Minor</header><text>The
			 term <term>minor</term> means any person under the age of 18 years.</text>
			</paragraph><paragraph id="ID5f1aae43a7c045bb9ec5329b8fb76175"><enum>(3)</enum><header>Sexually
			 explicit conduct</header><text>The term <quote>sexually explicit
			 conduct</quote> has the meaning as in section 2256 of title 18, United States
			 Code.</text>
			</paragraph></section><title changed="deleted" committee-id="SSJU00" id="id129012093A3540A0AB481324096F305A" reported-display-style="strikethrough"><enum>I</enum><header>Special Counsel
			 for Child Exploitation Prevention and Interdiction</header>
			<section id="IDF04A770F759543678E4AC354A1A084FF"><enum>101.</enum><header>Establishment
			 of Special Counsel for Child Exploitation Prevention and Interdiction</header>
				<subsection id="ID322DC2ACE69541F38CA1642CC2263831"><enum>(a)</enum><header>In
			 General</header><text>The Attorney General shall appoint a Special Counsel for
			 Child Exploitation Prevention and Interdiction within the Office of the Deputy
			 Attorney General.</text>
				</subsection><subsection id="IDc0be3f3fd5f943b4b3edc584b31cccf5"><enum>(b)</enum><header>Duties of the
			 special counsel</header><text>The Special Counsel appointed under subsection
			 (a) shall have the following duties:</text>
					<paragraph id="ID76692d88515d4c52be1affcdbb69e6db"><enum>(1)</enum><text>Coordinating the
			 policies and strategies of the Department of Justice related to the prevention
			 and investigation of child exploitation cases, including the policies and
			 strategies of the Office of Justice Programs, the Criminal Division of the
			 Department of Justice, the Executive Office of United States Attorneys, the
			 Federal Bureau of Investigation, and any other agency or bureau of the
			 Department of Justice whose activities relate to child exploitation
			 cases.</text>
					</paragraph><paragraph id="ID15967e8cfc0c4b2daaf73168d7a4644e"><enum>(2)</enum><text>Pursuing
			 memorandums of understanding or other interagency agreements related to the
			 prevention, investigation, and apprehension of individuals exploiting children,
			 including seeking cooperation and collaboration with—</text>
						<subparagraph id="id00C0D8E7878840228D39406DDE9D1127"><enum>(A)</enum><text>the Bureau of
			 Immigration and Customs Enforcement;</text>
						</subparagraph><subparagraph id="id98FCE0DEA3374B9FA53900D934CB4A43"><enum>(B)</enum><text>the Department of
			 State;</text>
						</subparagraph><subparagraph id="id4D81FDAAD065490E8D2C11DEBBC3C654"><enum>(C)</enum><text>the Department of
			 Commerce;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0C680303B65A49819C478B77FDCC9AF6"><enum>(D)</enum><text>the Department of
			 Education; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA47D5FD9EB894A95B045A68F584D1534"><enum>(E)</enum><text>other Federal
			 agencies.</text>
						</subparagraph></paragraph><paragraph id="ID6077edf9eb5842a8aea2b40de97d5839"><enum>(3)</enum><text>Directing and
			 overseeing the ICAC Task Force Program established under section 102.</text>
					</paragraph><paragraph id="ID1f43722110854fbc9f98d0d9590699df"><enum>(4)</enum><text>Directing and
			 overseeing the National Internet Crimes Against Children Data Network Center
			 established under section 105.</text>
					</paragraph><paragraph id="idF764AD273C544602A1204DCEE83D66E8"><enum>(5)</enum><text>Directing and
			 overseeing the ICAC grant program established under section 106.</text>
					</paragraph><paragraph id="ID1b955b7e23024c53907f1803c874eb58"><enum>(6)</enum><text>Coordinating
			 technical assistance to Federal, State, local, and tribal law enforcement
			 agencies in the prevention, investigation, and prosecution of child
			 exploitation crimes.</text>
					</paragraph><paragraph id="ID0603332e60db46b1b8c6ca8c58441cbe"><enum>(7)</enum><text>Coordinating
			 training to Federal, State, local, and tribal law enforcement agencies in the
			 prevention, investigation, and prosecution of child exploitation crimes.</text>
					</paragraph><paragraph id="IDe22d441e0b504841a25e721fb920c30c"><enum>(8)</enum><text>Coordinating
			 training and technical assistance to Federal, State, local, and tribal on
			 forensic computer examination and analysis.</text>
					</paragraph><paragraph id="IDaa7a98816fc547659a99b1507320e5eb"><enum>(9)</enum><text>Directing and
			 overseeing programs for child exploitation prevention and education, including
			 programs related to Internet safety.</text>
					</paragraph><paragraph id="ID7ce4e7a258f1457eb498c5d9c3d133e2"><enum>(10)</enum><text>Maintaining
			 liaison with the judicial branches of the Federal and State Governments on
			 matters relating to child exploitation.</text>
					</paragraph><paragraph id="ID9310f2adfd384f07a85fdb45afbc00bf"><enum>(11)</enum><text>Providing
			 information to the President, the Congress, the judiciary, State, local, and
			 tribal governments, and the general public on matters relating to child
			 exploitation.</text>
					</paragraph><paragraph id="ID005dc2c6eb2b49118dd958e760e0612f"><enum>(12)</enum><text>Serving, at the
			 request of the Attorney General, as the representative of the Department of
			 Justice on domestic task forces, committees, or commissions addressing policy
			 or issues relating to child exploitation.</text>
					</paragraph><paragraph id="ID3f71b8c4ce2c4374b3200b03e596ecc2"><enum>(13)</enum><text>Serving, at the
			 request of the President, acting through the Attorney General, as the
			 representative of the United States Government on human rights and economic
			 justice matters related to child exploitation in international fora, including
			 the United Nations.</text>
					</paragraph><paragraph id="ID2eede9a8f20e4f5fb11d594e21d4aada"><enum>(14)</enum><text>Providing
			 technical assistance, coordination, and support to—</text>
						<subparagraph id="IDd3ae4308324f49b6bb54372b51841d71"><enum>(A)</enum><text>other components
			 of the Department of Justice, in efforts to develop policy and to enforce
			 Federal laws relating to child exploitation cases, including the litigation of
			 civil and criminal actions relating to enforcing such laws;</text>
						</subparagraph><subparagraph id="IDe15a7888ba5c46bc91cfa0f58abf533b"><enum>(B)</enum><text>other Federal,
			 State, local, and tribal agencies, in efforts to develop policy, provide
			 technical assistance, and improve coordination among agencies carrying out
			 efforts to eliminate child exploitation; and</text>
						</subparagraph><subparagraph id="ID1679bf8027c64b14aa1b17b54c6c2e57"><enum>(C)</enum><text>grantees, in
			 efforts to combat child exploitation and to provide support and assistance to
			 victims of such exploitation.</text>
						</subparagraph></paragraph></subsection></section><section id="id39ACB1936A224735BA227360DFF6440F"><enum>102.</enum><header>Establishment
			 of ICAC Task Force Program</header>
				<subsection id="id42CBEB6823BA41F88CF9A7EB2D03E37C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Office of
			 Justice Programs in the Department of Justice, under the general authority of
			 the Attorney General, an Internet Crimes Against Children Task Force
			 (hereinafter in this title referred to as the <quote>ICAC Task Force</quote>),
			 which shall consist of a national program of State and local law enforcement
			 task forces dedicated to developing effective responses to online enticement of
			 children by sexual predators, child exploitation, and child obscenity and
			 pornography cases.</text>
				</subsection><subsection id="idCEBA9F2CAEF2480DBA361410FDDE8A6E"><enum>(b)</enum><header>National
			 program</header><text>The national ICAC Task Force program required under
			 subsection (a) shall consist of at least 1 ICAC task force in each
			 State.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id1064E0C6F7A4426DAE16D3D6E6ED8C5E"><enum>103.</enum><header>Purpose of ICAC
			 Task Forces</header><text display-inline="no-display-inline">The ICAC Task
			 Force, and each State or local ICAC task force that is part of the national
			 program of task forces shall be dedicated towards—</text>
				<paragraph id="IDda52cea2b8fe40a8abc81331de7d758e"><enum>(1)</enum><text>increasing the
			 investigative capabilities of State and local law enforcement officers in the
			 detection, investigation, and apprehension of Internet crimes against children
			 offenses or offenders, including technology-facilitated child exploitation
			 offenses;</text>
				</paragraph><paragraph id="ID5df33e3e3ba74fcab74818a45961c923"><enum>(2)</enum><text>conducting
			 proactive and reactive Internet crimes against children investigations;</text>
				</paragraph><paragraph id="IDadd329c844b240b899ad1d015b6aeceb"><enum>(3)</enum><text>providing training
			 and technical assistance to ICAC Task Forces and other Federal, State, and
			 local law enforcement agencies in the areas of investigations, forensics,
			 prosecution, community outreach, and capacity-building, using recognized
			 experts to assist in the development and delivery of training programs;</text>
				</paragraph><paragraph id="ID4aa15f4cc6764400a278d2611f884065"><enum>(4)</enum><text>increasing the
			 number of Internet crimes against children offenses being prosecuted in both
			 Federal and State courts;</text>
				</paragraph><paragraph id="ID35d6376306ed4618841bd0badb26dcaf"><enum>(5)</enum><text>creating a
			 multiagency task force response to Internet crimes against children offenses
			 within each State;</text>
				</paragraph><paragraph id="IDce9de45fbfa94a999dd7e52a56ad9551"><enum>(6)</enum><text>enhancing
			 nationwide responses to Internet crimes against children offenses, including
			 assisting other ICAC task forces, as well as other Federal, State, and local
			 agencies with Internet crimes against children investigations and
			 prosecutions;</text>
				</paragraph><paragraph id="ID7630d69b4dcc43eda16f6575ef35e985"><enum>(7)</enum><text>developing and
			 delivering Internet crimes against children public awareness and prevention
			 programs; and</text>
				</paragraph><paragraph id="ID76b4cd93376448a8b2b059d018854885"><enum>(8)</enum><text>participating in
			 such other activities, both proactive and reactive, that will enhance
			 investigations and prosecutions of Internet crimes against children.</text>
				</paragraph></section><section id="idE5D4068F049F4EFDB53FC5641395A2D4"><enum>104.</enum><header>Duties and
			 functions of Task Forces</header><text display-inline="no-display-inline">Each
			 State or local ICAC task force that is part of the national program of task
			 forces shall—</text>
				<paragraph id="ID1d974324c6e3486792febe47e588f045"><enum>(1)</enum><text>consist of State
			 and local investigators, prosecutors, forensic specialists, and education
			 specialists who are dedicated full-time to address the goals of such task
			 force;</text>
				</paragraph><paragraph id="id5D02C37C4B35493EAEAF838F9FB1514C"><enum>(2)</enum><text>work consistently
			 towards achieving the purposes described in section 103;</text>
				</paragraph><paragraph id="id6E716EE210E64513B98C092288D70EC2"><enum>(3)</enum><text>engage in
			 proactive investigations, forensic examinations, and effective prosecutions of
			 Internet crimes against children;</text>
				</paragraph><paragraph id="idA8311F890CE140B59D6D883432787722"><enum>(4)</enum><text>provide forensic,
			 preventive, and investigative assistance to parents, educators, prosecutors,
			 law enforcement, and others concerned with Internet crimes against
			 children;</text>
				</paragraph><paragraph id="idFFFEF924E31F42318899D6B5C3394E04"><enum>(5)</enum><text>develop
			 multijurisdictional, multiagency responses and partnerships to Internet crimes
			 against children offenses through ongoing informational, administrative, and
			 technological support to other State and local law enforcement agencies, as a
			 means for such agencies to acquire the necessary knowledge, personnel, and
			 specialized equipment to investigate and prosecute such offenses;</text>
				</paragraph><paragraph id="id07E3F59E2F814FD996EF5337C13A7C90"><enum>(6)</enum><text>fully participate
			 in any nationally coordinated investigation, as requested by the Attorney
			 General;</text>
				</paragraph><paragraph id="IDd7d4b68355354a4ea4f8f07b4505cf60"><enum>(7)</enum><text>establish
			 investigative and prosecution standards, consistent with established norms, to
			 which that task force shall comply;</text>
				</paragraph><paragraph id="ID2027382e634642ab860ae68894c4e9f3"><enum>(8)</enum><text>investigate, and
			 seek prosecution on, tips related to Internet crimes against children,
			 including tips from other law enforcement agencies, ICAC task forces, the
			 National Center for Missing and Exploited Children, and other Federal, State,
			 and local agencies;</text>
				</paragraph><paragraph id="ID6bc3178bbdf545d382265972e4e8b0dc"><enum>(9)</enum><text>develop procedures
			 for handling seized evidence;</text>
				</paragraph><paragraph id="id36B51D4826264BA398692CA0D5C35A8F"><enum>(10)</enum><text>maintain such
			 reports and records as are required under this title; and</text>
				</paragraph><paragraph id="ID6d29b439b8644d7495c482c13c376053"><enum>(11)</enum><text>seek to comply
			 with national standards regarding the investigation and prosecution of Internet
			 crimes against children, as set forth by the Attorney General, to the extent
			 such standards are consistent with the law of the State where the task force is
			 located.</text>
				</paragraph></section><section id="id3DE44791CD954C9F83AA2074AE44F241"><enum>105.</enum><header>National ICAC
			 Data Network Center</header>
				<subsection id="id8647B8880D944ADB8CCEE2645C566D6A"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall establish a National Internet
			 Crimes Against Children Data Network Center.</text>
				</subsection><subsection id="id079781CCBD984B66BFD54475151301BA"><enum>(b)</enum><header>Purpose of
			 Center</header><text>The National Internet Crimes Against Children Data Network
			 Center established under subsection (a) shall be dedicated to assisting—</text>
					<paragraph id="id823F310106574121B75D64F800A3ED20"><enum>(1)</enum><text>the ICAC Task
			 Force Program established under this title; and</text>
					</paragraph><paragraph id="id6EDAB6AAED854AFB92409931E629B36B"><enum>(2)</enum><text>Federal, State,
			 local, and tribal agencies investigating and prosecuting child
			 exploitation.</text>
					</paragraph></subsection><subsection id="id3F7DD8DD146A4B259D629B91DA339C2D"><enum>(c)</enum><header>Mandatory
			 requirements for Center</header><text>The National Internet Crimes Against
			 Children Data Network Center established under subsection (a) shall develop and
			 maintain an integrated technology and training program that provides—</text>
					<paragraph id="IDcbb6e390f9004a969e9d2eb776b8faf7"><enum>(1)</enum><text>a secure, online
			 information-sharing and case management system for use by ICAC Task Forces,
			 Federal law enforcement agencies, and other State and local law enforcement
			 agencies;</text>
					</paragraph><paragraph id="ID67f27de1e0b643e09f206e50da858c2b"><enum>(2)</enum><text>a secure, online
			 system for resolving case conflicts, for use by ICAC Task Forces, Federal law
			 enforcement agencies, and other State and local law enforcement
			 agencies;</text>
					</paragraph><paragraph id="ID9fc764f3a0f04cc6b670649037f12e3a"><enum>(3)</enum><text>a secure
			 intelligence data storage and analysis system for use by ICAC Task Forces,
			 Federal law enforcement agencies, and other State and local law enforcement
			 agencies;</text>
					</paragraph><paragraph id="ID28368f898669481f88d0e9c5009bb986"><enum>(4)</enum><text>guidelines for the
			 use of such Data Network by Federal, State, and local law enforcement agencies;
			 and</text>
					</paragraph><paragraph id="IDd344f6f0c4d74ef2825e9fc5d6b221e2"><enum>(5)</enum><text>training and
			 technical assistance on the use of such Data Network by Federal, State, and
			 local law enforcement agencies.</text>
					</paragraph></subsection><subsection id="idD0B3E1EB7EDB4F1192FEF99308D75DE2"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated for each
			 of the fiscal years 2008 through 2015, $2,000,000 to carry out the provisions
			 of this section, including for—</text>
					<paragraph id="idB4EFBEBD81694BE9B83E329A8AFB06AB"><enum>(1)</enum><text>the establishment
			 of the National Internet Crimes Against Children Data Network Center;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id639CAA34A6A74C1E85D86BF415143D2B"><enum>(2)</enum><text>the costs of
			 operating and maintaining such Center.</text>
					</paragraph></subsection></section><section id="idC40BBD117BCB499DA3BCB54531EA6DF4"><enum>106.</enum><header>ICAC grant
			 program</header>
				<subsection id="id87E055A0E3AB46469FD142CD85F79321"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="id3E9A72F51EAF48F7AC824496056C2C2D"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General is authorized to award grants to
			 State and local ICAC task forces to assist in carrying out the duties and
			 functions described under section 104.</text>
					</paragraph><paragraph id="idC7CB699810AD4FC79334A6261D1FDDDC"><enum>(2)</enum><header>Formula</header>
						<subparagraph id="idA63373F3ACFB47B4AC814DB95B14DEC0"><enum>(A)</enum><header>Attorney General
			 to develop</header><text>At least 75 percent of the total funds appropriated
			 for grants under paragraph (1) shall be awarded or otherwise distributed
			 pursuant to a funding formula established by the Attorney General.</text>
						</subparagraph><subparagraph id="id8166BEF7181944ABBFEA81E4E55415F2"><enum>(B)</enum><header>Baseline
			 amount</header><text>Any formula established by the Attorney General under
			 subparagraph (A), shall—</text>
							<clause id="idA8BEC081963F495CB10542F3F7B33488"><enum>(i)</enum><text>ensure that each
			 State or local ICAC task force shall, at a minimum, receive an amount equal to
			 1 percent of the total funds appropriated for grants under paragraph (1);
			 and</text>
							</clause><clause id="idCA98F7A275F449258986B5B5992C3DDE"><enum>(ii)</enum><text>take into
			 consideration the following factors:</text>
								<subclause id="idE2A68D40533647CF9B77659629CF5705"><enum>(I)</enum><text>The population of
			 each State, as determined by the most recent decennial census performed by the
			 Bureau of the Census.</text>
								</subclause><subclause id="idE4E9865BD67E4534AA2F04FFAEAECCEF"><enum>(II)</enum><text>The number of
			 investigative leads generated by the integrated technology system of each ICAC
			 Task Force.</text>
								</subclause><subclause id="id4325C97CB60E44A0BA2C05E445373280"><enum>(III)</enum><text>The number of
			 Internet crimes against children criminal cases referred by a task force for
			 Federal, State, or local prosecution.</text>
								</subclause><subclause id="id9DA2E8A020D547CB9E46AEC189FB11D3"><enum>(IV)</enum><text>The number of
			 successful prosecutions of child exploitation cases by a task force.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id61BEEA3699974979B2E14A7FB93D1219"><enum>(V)</enum><text>Such other
			 criteria as the Attorney General determines demonstrates the level of need for
			 additional resources by a task force.</text>
								</subclause></clause></subparagraph><subparagraph id="idC7D9285CB26F4BF28EA34E9D876117C9"><enum>(C)</enum><header>Remaining
			 funds</header>
							<clause id="idA7CF4F484DCE4BE98809BFE8B7056C2B"><enum>(i)</enum><header>In
			 general</header><text>The funds remaining for grants under this section after
			 allocation of the baseline amounts under subparagraph (B) shall be distributed
			 to State and local ICAC task forces based upon need, as set forth by criteria
			 established by the Attorney General. Such criteria shall include:</text>
								<subclause id="id855AAD7056924C4DA2EC3C87E13E2C40"><enum>(I)</enum><text>The population of
			 each State, as determined by the most recent decennial census performed by the
			 Bureau of the Census.</text>
								</subclause><subclause id="id528DC257CC4E449CBF4717A81906D9D4"><enum>(II)</enum><text>The number of
			 investigative leads generated by the integrated technology system of each ICAC
			 Task Force.</text>
								</subclause><subclause id="id3DA0A05C055C46BE9293401F66F99C88"><enum>(III)</enum><text>The number of
			 Internet crimes against children criminal cases referred by a task force for
			 Federal, State, or local prosecution.</text>
								</subclause><subclause id="id1ECDA4B976284ED98C607A67E8559A31"><enum>(IV)</enum><text>The number of
			 successful prosecutions of child exploitation cases by a task force.</text>
								</subclause><subclause id="id246C41E9DF394180B6A36B923855884C"><enum>(V)</enum><text>Such other
			 criteria as the Attorney General determines demonstrates the level of need for
			 additional resources by a task force.</text>
								</subclause></clause><clause id="idDD4830CCF3D04916BEA87E13B45A496D"><enum>(ii)</enum><header>Matching
			 requirement</header><text>To be eligible to receive any remaining grant funds
			 under this subparagraph, a State or local ICAC task force shall contribute
			 matching non-Federal funds in an amount equal to not less than 25 percent of
			 the total amount of the grant.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="idE2154881110546A08DA08FE4976995B2"><enum>(b)</enum><header>Application</header>
					<paragraph id="ID0a085edaa4164ec7ae4c74d433060522"><enum>(1)</enum><header>In
			 general</header><text>Each State or local ICAC task force seeking a grant under
			 this section shall submit an application to the Attorney General at such time,
			 in such manner, and accompanied by such information as the Attorney General may
			 reasonably require.</text>
					</paragraph><paragraph id="ID5e3e23086f3049fd9ddcfd409b1d1680"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted pursuant to paragraph (1) shall—</text>
						<subparagraph id="ID7fbbe9d6ea4d4625b8173317c302385d"><enum>(A)</enum><text>describe the
			 activities for which assistance under this section is sought; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe202502743754b93a913f9232fb9950c"><enum>(B)</enum><text>provide such
			 additional assurances as the Attorney General determines to be essential to
			 ensure compliance with the requirements of this title.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8E0AD6ECE0C8463EBFE558B9B2652103"><enum>(c)</enum><header>Allowable
			 uses</header><text>Grants awarded under this section may be used to—</text>
					<paragraph id="IDb6cd9c49c6f441efb22c6133cb4b3c1f"><enum>(1)</enum><text>hire personnel,
			 investigators, prosecutors, education specialists, and forensic
			 specialists;</text>
					</paragraph><paragraph id="IDd798b26cfda64d208c5af2850ee5cde9"><enum>(2)</enum><text>establish and
			 support forensic laboratories utilized in Internet crimes against children
			 investigations;</text>
					</paragraph><paragraph id="ID0e3ecef0525b45a084aa7da52e995fb9"><enum>(3)</enum><text>support
			 investigations and prosecutions of Internet crimes against children;</text>
					</paragraph><paragraph id="IDe4843beb56ac4ed9a36833aa80490017"><enum>(4)</enum><text>conduct and assist
			 with education programs to help children and parents protect themselves from
			 Internet predators;</text>
					</paragraph><paragraph id="ID67b88f85ffc34f25a38dcabf404fa873"><enum>(5)</enum><text>conduct and attend
			 training sessions related to successful investigations and prosecutions of
			 Internet crimes against children; and</text>
					</paragraph><paragraph id="ID97973b4b15134ba3a7348a6fd2b11dea"><enum>(6)</enum><text>fund any other
			 activities directly related to preventing, investigating, or prosecuting
			 Internet crimes against children.</text>
					</paragraph></subsection><subsection id="id004892601A5C4E27A9E9DD937FA36E78"><enum>(d)</enum><header>Reporting
			 requirements</header>
					<paragraph id="id208D32E21CDD40AD943101ADEA2D3E40"><enum>(1)</enum><header>ICAC
			 reports</header><text>To measure the results of the activities funded by grants
			 under this section, and to assist the Attorney General in complying with the
			 Government Performance and Results Act (Public Law 103–62; 107 Stat. 285), each
			 State or local ICAC task force receiving a grant under this section shall, on
			 an annual basis, submit a report to the Attorney General that sets forth the
			 following:</text>
						<subparagraph id="id55B8247504CE4B998708C27D0D7B4D77"><enum>(A)</enum><text>Staffing levels of
			 the task force, including the number of investigators, prosecutors, education
			 specialists, and forensic specialists dedicated to investigating and
			 prosecuting Internet crimes against children.</text>
						</subparagraph><subparagraph id="id331068DCACCA4399A8F6CABD80F83ED7"><enum>(B)</enum><text>Investigation and
			 prosecution performance measures of the task force, including—</text>
							<clause id="ID8da581182abb4e4caf16aeb0e1f03303"><enum>(i)</enum><text>the number of
			 Internet crimes against children related arrests;</text>
							</clause><clause id="ID5652519fc29b4daca9aa7fffa81f2ea6"><enum>(ii)</enum><text>the number of
			 prosecutions for Internet crimes against children, including—</text>
								<subclause id="ID23eb02c0181b4393b09c5c984a98787a"><enum>(I)</enum><text>whether the
			 prosecution resulted in a conviction for such crime; and</text>
								</subclause><subclause id="ID7edc92c3eaac4ff4b5d540c057575756"><enum>(II)</enum><text>the sentence and
			 the statutory maximum for such crime under State law.</text>
								</subclause></clause></subparagraph><subparagraph id="IDf3676a1e18ab42699abae125cdd93b40"><enum>(C)</enum><text>The number of
			 referrals made by the task force to the United States Attorneys office,
			 including whether the referral was accepted by the United States
			 Attorney.</text>
						</subparagraph><subparagraph id="IDddd6d7930712497a840b46c51aa8b3b9"><enum>(D)</enum><text>The number of
			 investigative technical assistance sessions that the task force provided to
			 non-member law enforcement agencies.</text>
						</subparagraph><subparagraph id="ID962a4dcb56234e09a979c9f32bb097f1"><enum>(E)</enum><text>The number of
			 computer forensic examinations that the task force completed.</text>
						</subparagraph><subparagraph id="ID7e1eea59791a41f99ef506d90ffac60a"><enum>(F)</enum><text>The number of law
			 enforcement agencies participating in Internet crimes against children program
			 standards established by the task force.</text>
						</subparagraph></paragraph><paragraph id="id3608BDF601D9471CA2B9F7F2EDC4EFE0"><enum>(2)</enum><header>Report to
			 Congress</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Attorney General shall submit a report to Congress on—</text>
						<subparagraph id="ID8a1ad42f93fd482e90e263af9deb1bcf"><enum>(A)</enum><text>the progress of
			 the development of the ICAC Task Forces established under this title;
			 and</text>
						</subparagraph><subparagraph id="id00680444CA3646A0BF57B88F220D3512"><enum>(B)</enum><text>the number of
			 Federal and State investigations, prosecutions, and convictions in the prior
			 12-month period related to child exploitation.</text>
						</subparagraph></paragraph></subsection></section><section id="ID95a44f76578b4ae7b0d4ea091ef95d54"><enum>107.</enum><header>Authorization
			 of appropriations</header>
				<subsection id="ID36a80e96fb0243d09fa050633fafb93f"><enum>(a)</enum><header>In
			 general</header><text>There are authorized to be appropriated to carry out this
			 title—</text>

			 fiscal year 2013;</text>
					</paragraph><paragraph id="id8D48029F675B4DD2B0687E5344859E37"><enum>(7)</enum><text>$100,000,000 for
			 fiscal year 2014; and</text>
					</paragraph><paragraph id="idAC46F5706D6D4F9FBBAB12F05D661497"><enum>(8)</enum><text>$100,000,000 for
			 fiscal year 2015.</text>
					</paragraph></subsection><subsection id="ID97d269421bce4936ab23bae08d4cfc79"><enum>(b)</enum><header>Availability</header><text>Funds
			 appropriated under subsection (a) shall remain available until expended.</text>
				</subsection></section></title><title changed="deleted" committee-id="SSJU00" id="id4FFBB10D5E4F471E88DA7C83805F4042" reported-display-style="strikethrough"><enum>II</enum><header>Additional
			 measures to combat child exploitation</header>
			<section id="idF19401C8B18A400C9540311C26930A36"><enum>201.</enum><header>Additional
			 regional computer forensic labs</header>
				<subsection id="idEDE81E24B3BC4932AA760C09CFD836FB"><enum>(a)</enum><header>Additional
			 resources</header><text>The Attorney shall establish additional computer
			 forensic capacity to address the current backlog for computer forensics,
			 including for child exploitation investigations. The Attorney General may
			 utilize funds under this title to establish new regional computer forensic
			 laboratories within the Regional Computer Forensic Laboratories Program
			 operated by the Federal Bureau of Investigation or may increase capacity at
			 existing laboratories.</text>
				</subsection><subsection id="id61D8A2386BEE44319FB6F7EA0E618C6B"><enum>(b)</enum><header>New computer
			 forensic labs</header><text>If the Attorney General determines that new
			 regional computer forensic laboratories are needed under subsection (a) to
			 address existing backlogs, such new laboratories shall be established pursuant
			 to subsection (d).</text>
				</subsection><subsection id="id3CF31A0AB1A94EDC8D244AF95598886F"><enum>(c)</enum><header>Purpose of new
			 resources</header><text>The additional forensic capacity established by the
			 resources provided under this section shall prioritize its activities to assist
			 Federal agencies, State and local Internet Crimes Against Children task forces,
			 and other Federal, State, and local law enforcement agencies in preventing,
			 investigating, and prosecuting Internet crimes against children.</text>
				</subsection><subsection id="idC5CB1B4ED26B4F378CA419C5D9A136E9"><enum>(d)</enum><header>Purpose of new
			 additional capacity</header><text>The location of any new regional computer
			 forensic laboratories under this section shall be determined by the Attorney
			 General, in consultation with the Director of the Federal Bureau of
			 Investigation, the Regional Computer Forensic Laboratory National Steering
			 Committee, and other relevant stakeholders.</text>
				</subsection><subsection id="idF0491334A50448439F4205AB826E0324"><enum>(e)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and every year
			 thereafter, the Attorney General shall submit a report to the Congress on how
			 the funds appropriated under this section were utilized.</text>
				</subsection><subsection id="id12FA00BAC75A42A9AD815D5B0A330418"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated for fiscal
			 years 2008 through 2015, $7,00,000 to carry out the provisions of this
			 section.</text>
				</subsection></section><section id="id7C0B3C2515654380920D10A33D140ACF"><enum>202.</enum><header>Enhanced
			 authority to investigate Internet crimes against children</header><text display-inline="no-display-inline">Section 2516(2) of title 18, United States
			 Code, is amended by inserting <quote>or crimes against children, including
			 child exploitation, child obscenity, or other crimes dangerous to the life,
			 limb, and well-being of minor children,</quote> after <quote>other dangerous
			 drugs,</quote>.</text>
			</section><section id="idD9580B037FCC45E6851222B78B9A271F"><enum>203.</enum><header>Additional
			 field agents for the FBI</header>
				<subsection id="id41EB5CA238B0453398F9FE31FA3D0504"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to the Attorney General $20,000,000, for each of the fiscal
			 years 2008 through 2009, and $25,000,000 for each of fiscal years 2010 through
			 2015, to fund the hiring of full-time Federal Bureau of Investigation field
			 agents and associated analysts and support staff in addition to the number of
			 such employees serving in those capacities on the date of enactment of this
			 Act.</text>
				</subsection><subsection id="id073B89F030DB4A46AC71D20115F2BA77"><enum>(b)</enum><header>Sole
			 purpose</header><text>The sole purpose of the additional staff required to be
			 hired under subsection (a) is to work on child exploitation cases as part of
			 the Federal Bureau of Investigation's Innocent Images National
			 Initiative.</text>
				</subsection></section><section id="id1633876A9523438ABB04F8A2FB5C0299"><enum>204.</enum><header>Immigrations
			 and customs enforcement enhancement</header>
				<subsection id="id6604F23F2CF740A995D9153753FB133C"><enum>(a)</enum><header>Additional
			 agents</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to the Secretary of Homeland Security $15,000,000, for each
			 of the fiscal years 2008 through 2015, to fund the hiring of full-time agents
			 and associated analysts and support staff within the Bureau of Immigration and
			 Customs Enforcement in addition to the number of such employees serving in
			 those capacities on the date of enactment of this Act.</text>
				</subsection><subsection id="id1580E35F65CA4E0BA4075A78DE449591"><enum>(b)</enum><header>Sole
			 purpose</header><text>The sole purpose of the additional staff required to be
			 hired under subsection (a) is to work on child exploitation and child obscenity
			 cases.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idA6C88E3E600B423AA6CD8F3BCC659A61"><enum>205.</enum><header>Combating
			 trafficking via the United States Postal Service</header>
				<subsection id="id27D005EA41C447748209465E33BF977B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to the Postmaster General $5,000,000, for each of the fiscal
			 years 2008 through 2015, to fund the hiring of full-time agents and associated
			 analysts and support staff in addition to the number of such employees serving
			 in those capacities on the date of enactment of this Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4E15AA14348543E1899A296FBE4D70B7"><enum>(b)</enum><header>Sole
			 purpose</header><text>The sole purpose of the additional staff required to be
			 hired under subsection (a) is to work on child exploitation and child obscenity
			 cases.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idCE148411318347488B00C5CE6B09095D"><enum>206.</enum><header>Accountability
			 provisions for child exploitation prevention and interdiction</header><text display-inline="no-display-inline">The Attorney General, in consultation with
			 the Secretary of Homeland Security and the Postmaster General, shall report to
			 the Committees on the Judiciary of the Senate and House of Representatives and
			 any other relevant committee of jurisdiction, on an annual basis, on the
			 resources (agents, forensic labs, prosecutors, etc.) being utilized by such
			 agencies to investigate and prosecute child exploitation and child obscenity
			 cases, including the resources established under this title, the Adam Walsh
			 Child Protection and Safety Act of 2006 (Public Law 109–248; 120 Stat. 587),
			 and any other law related to combating child exploitation and child
			 obscenity.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idCC890A2E45B84BF98634B7E2DDF362DE"><enum>207.</enum><header>Truth in
			 sentencing report</header><text display-inline="no-display-inline">Not later
			 than 1 year after the date of enactment of this Act, the Comptroller General of
			 the United States shall conduct a study and report to Congress on the efforts
			 to combat child exploitation at the Federal, State, and local level, including
			 an examination of the average sentences for child sex offenders and the length
			 of time served for each individual child sex offender.</text>

			 apply:</text>
			<paragraph id="HE6E0BE988F15461E905CEFE0E74FB62E"><enum>(1)</enum><header>Child
			 exploitation</header><text>The term <quote>child exploitation</quote> means any
			 conduct, attempted conduct, or conspiracy to engage in conduct involving a
			 minor that violates section 1591, chapter 109A, chapter 110, and chapter 117 of
			 title 18, United States Code, or any sexual activity involving a minor for
			 which any person can be charged with a criminal offense.</text>
			</paragraph><paragraph id="id08F47FC7DAF743BF993585EF62E4C6CC"><enum>(2)</enum><header>Child
			 obscenity</header><text>The term <quote>child obscenity</quote> means any
			 visual depiction proscribed by section 1466A of title 18, United States
			 Code.</text>
			</paragraph><paragraph id="H57AEDE41D3664ED5BC9C99B43FEEEF00"><enum>(3)</enum><header>Minor</header><text>The
			 term <quote>minor</quote> means any person under the age of 18 years.</text>
			</paragraph><paragraph id="HBF8F46D65F1647AA00D2709B6FB45EBF"><enum>(4)</enum><header>Sexually explicit
			 conduct</header><text>The term <quote>sexually explicit conduct</quote> has the
			 meaning given such term in
			 <external-xref legal-doc="usc" parsable-cite="usc/18/2256">section
			 2256</external-xref> of title 18, United States Code.</text>
			</paragraph></section><title changed="added" committee-id="SSJU00" id="HBC6754948A9F4231AA1E1BF097DE4F11" reported-display-style="italic"><enum>I</enum><header>National Strategy for
			 Child Exploitation Prevention and Interdiction</header>
			<section id="H62AC7B92E3004205BBCA3142B700FA2E"><enum>101.</enum><header>Establishment of
			 National Strategy for Child Exploitation Prevention and Interdiction</header>
				<subsection id="ID9f50752283b344e5848749254e32cb80"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General of the United States shall create
			 and implement a National Strategy for Child Exploitation Prevention and
			 Interdiction.</text>
				</subsection><subsection id="id7E24E6F8C293431B900E79ECDFE664EE"><enum>(b)</enum><header>Timing</header><text>Not
			 later than February 1 of each year, the Attorney General shall submit to
			 Congress the National Strategy established under subsection (a).</text>
				</subsection><subsection id="id68E15173687E4248AE2B6ACCD7CB79DA"><enum>(c)</enum><header>Required contents of
			 National Strategy</header><text>The National Strategy established under
			 subsection (a) shall include the following:</text>
					<paragraph id="ID6f95805f1fce49c1b6669591a55b42e8"><enum>(1)</enum><text>Comprehensive long-range,
			 goals for reducing child exploitation.</text>
					</paragraph><paragraph id="ID11329c164a5041bbb40aee60e4f87b06"><enum>(2)</enum><text>Annual measurable
			 objectives and specific targets to accomplish long-term, quantifiable goals
			 that the Attorney General determines may be achieved during each year beginning
			 on the date when the National Strategy is submitted.</text>
					</paragraph><paragraph id="ID9fec3870e0cd4ea8a48e9eabb9cd879d"><enum>(3)</enum><text>Annual budget priorities
			 and Federal efforts dedicated to combating child exploitation, including
			 resources dedicated to Internet Crimes Against Children task forces, Project
			 Safe Childhood, FBI Innocent Images Initiative, the National Center for Missing
			 and Exploited Children, regional forensic computer labs, Internet Safety
			 programs, and all other entities whose goal or mission is to combat the
			 exploitation of children that receive Federal support.</text>
					</paragraph><paragraph id="ID8e34f61b5041489c8d7fdb9afbf62c8e"><enum>(4)</enum><text>A 5-year projection for
			 program and budget goals and priorities.</text>
					</paragraph><paragraph id="IDce5c6bf55ad142acbf3e5213c82aaab3"><enum>(5)</enum><text>A review of the policies
			 and work of the Department of Justice related to the prevention and
			 investigation of child exploitation crimes, including efforts at the Office of
			 Justice Programs, the Criminal Division of the Department of Justice, the
			 Executive Office of United States Attorneys, the Federal Bureau of
			 Investigation, the Office of the Attorney General, the Office of the Deputy
			 Attorney General, the Office of Legal Policy, and any other agency or bureau of
			 the Department of Justice whose activities relate to child exploitation.</text>
					</paragraph><paragraph id="ID6cabcc866c50478eb13b3eee76cc7e0f"><enum>(6)</enum><text>A description of the
			 Department’s efforts to coordinate with international, State, local, tribal law
			 enforcement, and private sector entities on child exploitation prevention and
			 interdiction efforts.</text>
					</paragraph><paragraph id="ID4563f41d92074ee18e1a2ce5f54eced3"><enum>(7)</enum><text>Plans for interagency
			 coordination regarding the prevention, investigation, and apprehension of
			 individuals exploiting children, including cooperation and collaboration
			 with—</text>
						<subparagraph id="ID414daaceae3b40b7a5c75006b8d5848e"><enum>(A)</enum><text>Immigration and Customs
			 Enforcement;</text>
						</subparagraph><subparagraph id="IDdfb255c7ab474655b8f14fbf944da953"><enum>(B)</enum><text>the United States Postal
			 Inspection Service;</text>
						</subparagraph><subparagraph id="IDc0ba2b0c7d3c4be3b24d12417c793131"><enum>(C)</enum><text>the Department of
			 State;</text>
						</subparagraph><subparagraph id="ID6fe374d0abcc4fee8749c6d826f0a87d"><enum>(D)</enum><text>the Department of
			 Commerce;</text>
						</subparagraph><subparagraph id="IDc2e989417228455691188972512882ca"><enum>(E)</enum><text>the Department of
			 Education;</text>
						</subparagraph><subparagraph id="ID2311224801c64a5c988f83368be31c52"><enum>(F)</enum><text>the Department of Health
			 and Human Services; and</text>
						</subparagraph><subparagraph id="id2D9C3B32495244AEA8196C10CE1EE182"><enum>(G)</enum><text>other appropriate Federal
			 agencies.</text>
						</subparagraph></paragraph><paragraph id="IDa3c60399a30b4c8b8b88cebf465d6ac7"><enum>(8)</enum><text>A review of the Internet
			 Crimes Against Children Task Force Program, including—</text>
						<subparagraph id="IDd94945fcd51e4e18b6862acc5d10f0b1"><enum>(A)</enum><text>the number of ICAC task
			 forces and location of each ICAC task force;</text>
						</subparagraph><subparagraph id="ID03af69a5a8a04aae8e22fc2734d40257"><enum>(B)</enum><text>the number of trained
			 personnel at each ICAC task force;</text>
						</subparagraph><subparagraph id="IDb3496e841a5b42f8936ad89f5b4e0c61"><enum>(C)</enum><text>the amount of Federal
			 grants awarded to each ICAC task force;</text>
						</subparagraph><subparagraph id="ID9358b42b088d4871b155e1a2467aee34"><enum>(D)</enum><text>an assessment of the
			 Federal, State, and local cooperation in each task force, including—</text>
							<clause id="ID7aec67938d4a450f8c73df9631ed2e6f"><enum>(i)</enum><text>the number of arrests
			 made by each task force;</text>
							</clause><clause id="ID4359bd06e3ec45a999cb25c7321573d9"><enum>(ii)</enum><text>the number of criminal
			 referrals to United States attorneys for prosecution;</text>
							</clause><clause id="ID352c483f22734e33954db2d47673f92f"><enum>(iii)</enum><text>the number of
			 prosecutions and convictions from the referrals made under clause (ii);</text>
							</clause><clause id="IDdc14493dad9d44a5bca361403a0bff11"><enum>(iv)</enum><text>the number, if
			 available, of local prosecutions and convictions based on ICAC task force
			 investigations; and</text>
							</clause><clause id="IDe5d8d3be36eb4cf58ccd29df08cb5e4f"><enum>(v)</enum><text>any other information
			 demonstrating the level of Federal, State, and local coordination and
			 cooperation, as such information is to be determined by the Attorney
			 General;</text>
							</clause></subparagraph><subparagraph id="ID1f2cf9d754d545048c95126da386f4d1"><enum>(E)</enum><text>an assessment of the
			 training opportunities and technical assistance available to support ICAC task
			 force grantees; and</text>
						</subparagraph><subparagraph id="ID24e0379bcbb848c2ac622bad5a4b5774"><enum>(F)</enum><text>an assessment of the
			 success of the Internet Crimes Against Children Task Force Program at
			 leveraging State and local resources and matching funds.</text>
						</subparagraph></paragraph><paragraph id="IDe038f66bc69744d3b17f409d6644edbd"><enum>(9)</enum><text>An assessment of the
			 technical assistance and support available for Federal, State, local, and
			 tribal law enforcement agencies, in the prevention, investigation, and
			 prosecution of child exploitation crimes.</text>
					</paragraph><paragraph id="ID18baa47c7d594fefa3f3c5eaf694e7d2"><enum>(10)</enum><text>The backlog of forensic
			 analysis for child exploitation cases at each FBI Regional Forensic lab and an
			 estimate of the backlog at State and local labs.</text>
					</paragraph><paragraph id="IDbb1ae24e29cc466f9c0c353b168ed944"><enum>(11)</enum><text>Plans for reducing the
			 forensic backlog described in paragraph (10), if any, at Federal, State and
			 local forensic labs.</text>
					</paragraph><paragraph id="ID72d7490310424e6fa4d19bc081b68693"><enum>(12)</enum><text>A review of the Federal
			 programs related to child exploitation prevention and education, including
			 those related to Internet safety, including efforts by the private sector and
			 nonprofit entities, or any other initiatives, that have proven successful in
			 promoting child safety and Internet safety.</text>
					</paragraph><paragraph id="ID147111bf52414dc4a535cd66eaacd1b2"><enum>(13)</enum><text>An assessment of the
			 future trends, challenges, and opportunities, including new technologies, that
			 will impact Federal, State, local, and tribal efforts to combat child
			 exploitation.</text>
					</paragraph><paragraph id="ID72ede953719743979bd7f7dd80d91743"><enum>(14)</enum><text>Plans for liaisons with
			 the judicial branches of the Federal and State governments on matters relating
			 to child exploitation.</text>
					</paragraph><paragraph id="ID7e75c91ced214893af6a6f008b5e2bcc"><enum>(15)</enum><text>An assessment of Federal
			 investigative and prosecution activity relating to reported incidents of child
			 exploitation crimes, which shall include a number of factors, including—</text>
						<subparagraph id="id82B99D8F9A1349A195C2A03C277DEC05"><enum>(A)</enum><text>the number of
			 high-priority suspects (identified because of the volume of suspected criminal
			 activity or because of the danger to the community or a potential victim) who
			 were investigated and prosecuted;</text>
						</subparagraph><subparagraph id="idCDDBA1427F6D4FEFBFB56960278B4CA8"><enum>(B)</enum><text>the number of
			 investigations, arrests, prosecutions and convictions for a crime of child
			 exploitation; and</text>
						</subparagraph><subparagraph id="id5ECBCC34228B49A19FA471A2A27AEA47"><enum>(C)</enum><text>the average sentence
			 imposed and statutory maximum for each crime of child exploitation.</text>
						</subparagraph></paragraph><paragraph id="ID6e5f174fe91547eba49058a1aead9a5d"><enum>(16)</enum><text>A review of all
			 available statistical data indicating the overall magnitude of child
			 pornography trafficking in the United States and internationally,
			 including—</text>
						<subparagraph id="ID8bbcc260212047f8aef79cd813f14405"><enum>(A)</enum><text>the number of computers
			 or computer users, foreign and domestic, observed engaging in, or suspected by
			 law enforcement agencies and other sources of engaging in, peer-to-peer file
			 sharing of child pornography;</text>
						</subparagraph><subparagraph id="ID277d10f558df4061a71a64395aac7b08"><enum>(B)</enum><text>the number of computers
			 or computer users, foreign and domestic, observed engaging in, or suspected by
			 law enforcement agencies and other reporting sources of engaging in, buying and
			 selling, or other commercial activity related to child pornography;</text>
						</subparagraph><subparagraph id="ID11a3244ac2c3481aad40e3d3401c1204"><enum>(C)</enum><text>the number of computers
			 or computer users, foreign and domestic, observed engaging in, or suspected by
			 law enforcement agencies and other sources of engaging in, all other forms of
			 activity related to child pornography;</text>
						</subparagraph><subparagraph id="ID8289f21c3f954203a07a973a4918a035"><enum>(D)</enum><text>the number of tips or
			 other statistical data from the National Center for Missing and Exploited
			 Children’s CybertTipline and other data indicating the magnitude of child
			 pornography trafficking; and</text>
						</subparagraph><subparagraph id="ID852c8a674b0e49b89fd0941ac36aa5ca"><enum>(E)</enum><text>any other statistical
			 data indicating the type, nature, and extent of child exploitation crime in the
			 United States and abroad.</text>
						</subparagraph></paragraph><paragraph id="ID66496e73f6f749209cea7bea829c7670"><enum>(17)</enum><text>Copies of recent
			 relevant research and studies related to child exploitation, including—</text>
						<subparagraph id="IDd73fe9d30e734fd4b2f9042e5ddcdbb7"><enum>(A)</enum><text>studies related to the
			 link between possession or trafficking of child pornography and actual abuse of
			 a child;</text>
						</subparagraph><subparagraph id="IDcc77ecd6d9d7412da62981b795efd5ca"><enum>(B)</enum><text>studies related to
			 establishing a link between the types of files being viewed or shared and the
			 type of illegal activity; and</text>
						</subparagraph><subparagraph id="IDb19a3418e828494bb6d7637650a249f7"><enum>(C)</enum><text>any other research,
			 studies, and available information related to child exploitation.</text>
						</subparagraph></paragraph><paragraph id="ID1a8324b10c6d470eb9b3f08f104197e4"><enum>(18)</enum><text>A review of the extent
			 of cooperation, coordination, and mutual support between private sector and
			 other entities and organizations and Federal agencies, including the
			 involvement of States, local and tribal government agencies to the extent
			 Federal programs are involved.</text>
					</paragraph><paragraph id="ID2b8e8420dbcd499689915e11a245d890"><enum>(19)</enum><text>The results of the
			 Project Safe Childhood Conference or other conferences or meetings convened by
			 the Department of Justice related to combating child exploitation</text>
					</paragraph></subsection><subsection id="ID849cf74277074b3c97ce0a8e99312f9b"><enum>(d)</enum><header>Appointment of
			 high-level official</header>
					<paragraph id="id34570C9079B946849D857E44C1EA2A10"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall designate a senior official at
			 the Department of Justice to be responsible for coordinating the development of
			 the National Strategy established under subsection (a).</text>
					</paragraph><paragraph id="idECEBFF5433D74CACBD886D5305D4A545"><enum>(2)</enum><header>Duties</header><text>The
			 duties of the official designated under paragraph (1) shall include—</text>
						<subparagraph id="ID5ce4e073ef644df5aa26b15923015bb0"><enum>(A)</enum><text>acting as a liaison with
			 all Federal agencies regarding the development of the National Strategy;</text>
						</subparagraph><subparagraph id="ID3bcb85f05e354f658581418751c7e8c4"><enum>(B)</enum><text>working to ensure that
			 there is proper coordination among agencies in developing the National
			 Strategy;</text>
						</subparagraph><subparagraph id="IDd877375be9964f3fb76c9cff89808113"><enum>(C)</enum><text>being knowledgeable about
			 budget priorities and familiar with all efforts within the Department of
			 Justice and the FBI related to child exploitation prevention and interdiction;
			 and</text>
						</subparagraph><subparagraph id="ID3270ee8be97f4c0a80d7a5fcc3ed1fd6"><enum>(D)</enum><text>presenting the National
			 Strategy to Congress and being available to answer questions related to the
			 strategy at congressional hearings, if requested by committees of appropriate
			 jurisdictions, on the contents of the National Strategy and progress of the
			 Department of Justice in implementing the National Strategy.</text>
						</subparagraph></paragraph></subsection></section><section id="H0FBED0CD1FBE4797A112230809B671DC"><enum>102.</enum><header>Establishment of
			 National ICAC Task Force Program</header>
				<subsection id="H955D867FF7174BF684002C17FC777030"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="id1CBDE2B40BCE44FB903FEC5C147AE6CE"><enum>(1)</enum><header>In
			 general</header><text>There is established within the Department of Justice,
			 under the general authority of the Attorney General, a National Internet Crimes
			 Against Children Task Force Program (hereinafter in this title referred to as
			 the <quote>ICAC Task Force Program</quote>), which shall consist of a national
			 program of State and local law enforcement task forces dedicated to developing
			 effective responses to online enticement of children by sexual predators, child
			 exploitation, and child obscenity and pornography cases.</text>
					</paragraph><paragraph id="id8AACF8486B9346DAA45B9547E55E6394"><enum>(2)</enum><header>Intent of
			 Congress</header><text>It is the purpose and intent of Congress that the ICAC
			 Task Force Program established under paragraph (1) is intended to continue the
			 ICAC Task Force Program authorized under title I of the Departments of
			 Commerce, Justice, and State, the Judiciary, and Related Agencies
			 Appropriations Act, 1998, and funded under title IV of the Juvenile Justice and
			 Delinquency Prevention Act of 1974.</text>
					</paragraph></subsection><subsection id="H7160D1F795254ED593D1118D33E9C1EA"><enum>(b)</enum><header>National
			 Program</header>
					<paragraph id="id0DEFEEFF00EF40569616208A77C92FD1"><enum>(1)</enum><header>State
			 representation</header><text>The ICAC Task Force Program established under
			 subsection (a) shall include at least 1 ICAC task force in each State.</text>
					</paragraph><paragraph id="ID37fc9ae76f9b48419d4140e2a93d677c"><enum>(2)</enum><header>Capacity and continuity
			 of investigations</header><text>In order to maintain established capacity and
			 continuity of investigations and prosecutions of child exploitation cases, the
			 Attorney General, shall, in establishing the ICAC Task Force Program under
			 subsection (a) consult with and consider all 59 task forces in existence on the
			 date of enactment of this Act. The Attorney General shall include all existing
			 ICAC task forces in the ICAC Task Force Program, unless the Attorney General
			 makes a determination that an existing ICAC does not have a proven track record
			 of success.</text>
					</paragraph></subsection></section><section id="H21F6964326194244941856B0CDD27EFE"><enum>103.</enum><header>Purpose of ICAC task
			 forces</header><text display-inline="no-display-inline">The ICAC Task Force
			 Program, and each State or local ICAC task force that is part of the national
			 program of task forces, shall be dedicated toward—</text>
				<paragraph id="HB55D17569CC045678DC5DBF53C6C409"><enum>(1)</enum><text>increasing the
			 investigative capabilities of State and local law enforcement officers in the
			 detection, investigation, and apprehension of Internet crimes against children
			 offenses or offenders, including technology-facilitated child exploitation
			 offenses;</text>
				</paragraph><paragraph id="HF9171BECA36F4A7C8CED8EBEE72A147"><enum>(2)</enum><text>conducting proactive and
			 reactive Internet crimes against children investigations;</text>
				</paragraph><paragraph id="H015CB50ECB8849598F99A2FD0068E8C8"><enum>(3)</enum><text>providing training and
			 technical assistance to ICAC task forces and other Federal, State, and local
			 law enforcement agencies in the areas of investigations, forensics,
			 prosecution, community outreach, and capacity-building, using recognized
			 experts to assist in the development and delivery of training programs;</text>
				</paragraph><paragraph id="HC5502FDEB7634241AF5567652E421033"><enum>(4)</enum><text>increasing the number of
			 Internet crimes against children offenses being investigated and prosecuted in
			 both Federal and State courts;</text>
				</paragraph><paragraph id="HE01BEBABC4504759B2794D55A6D45BE2"><enum>(5)</enum><text>creating a multiagency
			 task force response to Internet crimes against children offenses within each
			 State;</text>
				</paragraph><paragraph id="IDd45b9b64375c400fbe37d7651ec1ecda"><enum>(6)</enum><text>participating in the
			 Department of Justice’s Project Safe Childhood initiative, the purpose of which
			 is to combat technology-facilitated sexual exploitation crimes against
			 children;</text>
				</paragraph><paragraph id="H932E5FD0218D4C20AEC792F3FDB68CD8"><enum>(7)</enum><text>enhancing nationwide
			 responses to Internet crimes against children offenses, including assisting
			 other ICAC task forces, as well as other Federal, State, and local agencies
			 with Internet crimes against children investigations and prosecutions;</text>
				</paragraph><paragraph id="HA4A6914A623C49F19DF90594D778582"><enum>(8)</enum><text>developing and delivering
			 Internet crimes against children public awareness and prevention programs;
			 and</text>
				</paragraph><paragraph id="HB500FEF323C84FA68552E1ABB6DA6C91"><enum>(9)</enum><text>participating in such
			 other activities, both proactive and reactive, that will enhance investigations
			 and prosecutions of Internet crimes against children.</text>
				</paragraph></section><section id="H9B673C6ED659429B90814C8EE3277ED3"><enum>104.</enum><header>Duties and functions
			 of task forces</header><text display-inline="no-display-inline">Each State or
			 local ICAC task force that is part of the national program of task forces
			 shall—</text>
				<paragraph id="H0B20BB2D10AD4E60B01B65BE39F4CC37"><enum>(1)</enum><text>consist of State and
			 local investigators, prosecutors, forensic specialists, and education
			 specialists who are dedicated to addressing the goals of such task
			 force;</text>
				</paragraph><paragraph id="H3748603476764109B8F638026C00995D"><enum>(2)</enum><text>work consistently toward
			 achieving the purposes described in section 103;</text>
				</paragraph><paragraph id="H41EA6F3931BA48219BD6653654928B7B"><enum>(3)</enum><text>engage in proactive
			 investigations, forensic examinations, and effective prosecutions of Internet
			 crimes against children;</text>
				</paragraph><paragraph id="HFD1ACA1AD2AF45D9A8720699224B25D9"><enum>(4)</enum><text>provide forensic,
			 preventive, and investigative assistance to parents, educators, prosecutors,
			 law enforcement, and others concerned with Internet crimes against
			 children;</text>
				</paragraph><paragraph id="H45C909B468C9452AB647981DE98B23D2"><enum>(5)</enum><text>develop
			 multijurisdictional, multiagency responses and partnerships to Internet crimes
			 against children offenses through ongoing informational, administrative, and
			 technological support to other State and local law enforcement agencies, as a
			 means for such agencies to acquire the necessary knowledge, personnel, and
			 specialized equipment to investigate and prosecute such offenses;</text>
				</paragraph><paragraph id="HBC1456D4269D4FB7BF64DF428E501E8E"><enum>(6)</enum><text>participate in nationally
			 coordinated investigations in any case in which the Attorney General determines
			 such participation to be necessary, as permitted by the available resources of
			 such task force;</text>
				</paragraph><paragraph id="HDF8D36D45BE6493B84DE01D1E58C02B"><enum>(7)</enum><text>establish or adopt
			 investigative and prosecution standards, consistent with established norms, to
			 which such task force shall comply;</text>
				</paragraph><paragraph id="HF37F047791414837A74FB725486E15DF"><enum>(8)</enum><text>investigate, and seek
			 prosecution on, tips related to Internet crimes against children, including
			 tips from the National Internet Crimes Against Children Data System established
			 in section 105, the National Center for Missing and Exploited Children’s
			 CyberTipline, ICAC task forces, and other Federal, State, and local agencies,
			 with priority being given to investigative leads that indicate the possibility
			 of identifying or rescuing child victims, including investigative leads that
			 indicate a likelihood of seriousness of offense or dangerousness to the
			 community;</text>
				</paragraph><paragraph id="H5C63BE7413194BE5AEC6400A53E8088"><enum>(9)</enum><text>develop procedures for
			 handling seized evidence;</text>
				</paragraph><paragraph id="H35675AD7846140CDBEB70012215D7429"><enum>(10)</enum><text>maintain—</text>
					<subparagraph id="idCB1D13CF539A45D9AB02E2339011B3E4"><enum>(A)</enum><text>such reports and records
			 as are required under this title; and</text>
					</subparagraph><subparagraph id="id9EA1809E320C47B1B453F19D79CC1596"><enum>(B)</enum><text>such other reports and
			 records as determined by the Attorney General; and</text>
					</subparagraph></paragraph><paragraph id="H74016E7C00D34F6FB7B8646CF3C2D9DB"><enum>(11)</enum><text>seek to comply with
			 national standards regarding the investigation and prosecution of Internet
			 crimes against children, as set forth by the Attorney General, to the extent
			 such standards are consistent with the law of the State where the task force is
			 located.</text>
				</paragraph></section><section id="H01B52470AD1A4DC98BCF9949E5D64B90"><enum>105.</enum><header>National Internet
			 Crimes Against Children Data System</header>
				<subsection id="id417D6E23115E40EE8450929A835CC65C"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall establish a National Internet
			 Crimes Against Children Data System.</text>
				</subsection><subsection id="id841C6807CA73404A89D2965102320560"><enum>(b)</enum><header>Intent of
			 Congress</header><text>It is the purpose and intent of Congress that the
			 National Internet Crimes Against Children Data System established in subsection
			 (a) is intended to continue and build upon Operation Fairplay developed by the
			 Wyoming Attorney General’s office, which has established a secure, dynamic
			 undercover infrastructure that has facilitated online law enforcement
			 investigations of child exploitation, information sharing, and the capacity to
			 collect and aggregate data on the extent of the problems of child
			 exploitation.</text>
				</subsection><subsection id="idC7F84D83381345FFA98B208D72B2FF67"><enum>(c)</enum><header>Purpose of
			 system</header><text>The National Internet Crimes Against Children Data System
			 established under subsection (a) shall be dedicated to assisting and supporting
			 credentialed law enforcement agencies authorized to investigate child
			 exploitation in accordance with Federal, State, local, and tribal laws,
			 including by providing assistance and support to—</text>
					<paragraph id="ID2489ec5727a34df5be62822c007b04cd"><enum>(1)</enum><text>Federal agencies
			 investigating and prosecuting child exploitation;</text>
					</paragraph><paragraph id="ID4edb1049eb0f47f6ad8b5379d8e10a87"><enum>(2)</enum><text>the ICAC Task Force
			 Program established under section 102; and</text>
					</paragraph><paragraph id="ID933100cb9b2d4a0ca0087e1e4d8ea0eb"><enum>(3)</enum><text>State, local, and tribal
			 agencies investigating and prosecuting child exploitation.</text>
					</paragraph></subsection><subsection id="id80F94476F14F447C800155D4BE137918"><enum>(d)</enum><header>Cyber safe
			 deconfliction and information sharing</header><text>The National Internet
			 Crimes Against Children Data System established under subsection (a)—</text>
					<paragraph id="id5E0EF601DF3641AA821C915DCF4A7973"><enum>(1)</enum><text>shall be housed and
			 maintained within the Department of Justice or a credentialed law enforcement
			 agency;</text>
					</paragraph><paragraph id="id4943A8463D9A4CCB9CED95D6FBE7F4C8"><enum>(2)</enum><text>shall be made available
			 for a nominal charge to support credentialed law enforcement agencies in
			 accordance with subsection (c); and</text>
					</paragraph><paragraph id="ID9ffd058de7ca4199add726fdeac71e66"><enum>(3)</enum><text>shall—</text>
						<subparagraph id="idAE011F70B8B244B4991884F519AFF24F"><enum>(A)</enum><text>allow Federal, State,
			 local, and tribal agencies and ICAC task forces investigating and prosecuting
			 child exploitation to contribute and access data for use in resolving case
			 conflicts;</text>
						</subparagraph><subparagraph id="ID4f00bcb3b45b4242b76a16f86240db82"><enum>(B)</enum><text>provide, directly or in
			 partnership with a credentialed law enforcement agency, a dynamic undercover
			 infrastructure to facilitate online law enforcement investigations of child
			 exploitation;</text>
						</subparagraph><subparagraph id="ID719b36ec373d48079e23e380a6516ab9"><enum>(C)</enum><text>facilitate the
			 development of essential software and network capability for law enforcement
			 participants; and</text>
						</subparagraph><subparagraph id="ID77f005c8ad97435ebbaaecea7a4c27db"><enum>(D)</enum><text>provide software or
			 direct hosting and support for online investigations of child exploitation
			 activities, or, in the alternative, provide users with a secure connection to
			 an alternative system that provides such capabilities, provided that the system
			 is hosted within a governmental agency or a credentialed law enforcement
			 agency.</text>
						</subparagraph></paragraph></subsection><subsection id="id7498A08671A64A67BFB84516A726D902"><enum>(e)</enum><header>Collection and
			 reporting of data</header>
					<paragraph id="idE4A196A3F5144572A92D916493CC1244"><enum>(1)</enum><header>In
			 general</header><text>The National Internet Crimes Against Children Data System
			 established under subsection (a) shall ensure the following:</text>
						<subparagraph id="ID6602467d601146308b885f6fb847db40"><enum>(A)</enum><header>Real-time
			 reporting</header><text>All child exploitation cases involving local child
			 victims that are reasonably detectable using available software and data are,
			 immediately upon their detection, made available to participating law
			 enforcement agencies.</text>
						</subparagraph><subparagraph id="IDc9f85a51fb2d4972a92fad0a78cedd0a"><enum>(B)</enum><header>High-priority
			 suspects</header><text>Every 30 days, at minimum, the National Internet Crimes
			 Against Children Data System shall—</text>
							<clause id="id4024C8255F8840BDA8754C439DFBE2CC"><enum>(i)</enum><text>identify high-priority
			 suspects, as such suspects are determined by the volume of suspected criminal
			 activity or other indicators of seriousness of offense or dangerousness to the
			 community or a potential local victim; and</text>
							</clause><clause id="id186A64CFC9D74DF89C7594E7C29F247B"><enum>(ii)</enum><text>report all such
			 identified high-priority suspects to participating law enforcement
			 agencies.</text>
							</clause></subparagraph><subparagraph id="ID82ad914a6a284a019b9ca8b3274b70f5"><enum>(C)</enum><header>Annual
			 reports</header><text>Any statistical data indicating the overall magnitude of
			 child pornography trafficking and child exploitation in the United States and
			 internationally is made available and included in the National Strategy, as is
			 required under section 101(c)(16).</text>
						</subparagraph></paragraph><paragraph id="idAA62D7A82FAC486589578E2BA2CD2CD2"><enum>(2)</enum><header>Rule of
			 construction</header><text>Nothing in this subsection shall be construed to
			 limit the ability of participating law enforcement agencies to disseminate
			 investigative leads or statistical information in accordance with State and
			 local laws.</text>
					</paragraph></subsection><subsection id="id43AC50BEDF3D450C841243A0101FDC2C"><enum>(f)</enum><header>Mandatory requirements
			 of network</header><text>The National Internet Crimes Against Children Data
			 System established under subsection (a) shall develop, deploy, and maintain an
			 integrated technology and training program that provides—</text>
					<paragraph id="ID82905fec439f4b2b9e6176ab86c18786"><enum>(1)</enum><text>a secure, online system
			 for Federal law enforcement agencies, ICAC task forces, and other State, local,
			 and tribal law enforcement agencies for use in resolving case conflicts, as
			 provided in subsection (d);</text>
					</paragraph><paragraph id="ID7efd1db083e04329bde69f9a94fee27c"><enum>(2)</enum><text>a secure system enabling
			 online communication and collaboration by Federal law enforcement agencies,
			 ICAC task forces, and other State, local, and tribal law enforcement agencies
			 regarding ongoing investigations, investigatory techniques, best practices, and
			 any other relevant news and professional information;</text>
					</paragraph><paragraph id="ID240451e3cddd4112a4ae8e15b48b04d1"><enum>(3)</enum><text>a secure online data
			 storage and analysis system for use by Federal law enforcement agencies, ICAC
			 task forces, and other State, local, and tribal law enforcement
			 agencies;</text>
					</paragraph><paragraph id="IDb05388f683e3453e80d025f6a1ff1dcb"><enum>(4)</enum><text>secure connections or
			 interaction with State and local law enforcement computer networks, consistent
			 with reasonable and established security protocols and guidelines;</text>
					</paragraph><paragraph id="ID91e724cce8cb4b37b42fadda38aa5d29"><enum>(5)</enum><text>guidelines for use of the
			 National Internet Crimes Against Children Data System by Federal, State, local,
			 and tribal law enforcement agencies and ICAC task forces; and</text>
					</paragraph><paragraph id="ID05bc96b0e3f1404589972451f02e1240"><enum>(6)</enum><text>training and technical
			 assistance on the use of the National Internet Crimes Against Children Data
			 System by Federal, State, local, and tribal law enforcement agencies and ICAC
			 task forces.</text>
					</paragraph></subsection><subsection id="H200E35BB42524826A126BFEF1FB2A3E6"><enum>(g)</enum><header>National Internet
			 Crimes Against Children Data System steering committee</header><text>The
			 Attorney General shall establish a National Internet Crimes Against Children
			 Data System Steering Committee to provide guidance to the Network relating to
			 the program under subsection (f), and to assist in the development of strategic
			 plans for the System. The Steering Committee shall consist of 10 members with
			 expertise in child exploitation prevention and interdiction prosecution,
			 investigation, or prevention, including—</text>
					<paragraph id="H1EECDC2A6A6449AABCD2F71502579425"><enum>(1)</enum><text>3 representatives elected
			 by the local directors of the ICAC task forces, such representatives shall
			 represent different geographic regions of the country;</text>
					</paragraph><paragraph id="IDe280b7a28a204b108f6ea449b6bbbc9a"><enum>(2)</enum><text>1 representative of the
			 Department of Justice Office of Information Services;</text>
					</paragraph><paragraph id="id80EED333F6C64E689EB6C21391512E12"><enum>(3)</enum><text>1 representative from
			 Operation Fairplay, currently hosted at the Wyoming Office of the Attorney
			 General;</text>
					</paragraph><paragraph id="H2D5F006B8E69448BB975C0442750D22E"><enum>(4)</enum><text>1 representative from the
			 law enforcement agency having primary responsibility for hosting and
			 maintaining the National Internet Crimes Against Children Data System;</text>
					</paragraph><paragraph id="H53E24A45A0F1478DBEC12900553F7997"><enum>(5)</enum><text>1 representative of the
			 Federal Bureau of Investigation’s Innocent Images National Initiative or
			 Regional Computer Forensic Lab program;</text>
					</paragraph><paragraph id="HC7DE2CF81ED843559916F43B2DE639E3"><enum>(6)</enum><text>1 representative of the
			 Immigration and Customs Enforcement’s Cyber Crimes Center;</text>
					</paragraph><paragraph id="HE62894D4FB804F7AA8D0BE6DBC19D2E"><enum>(7)</enum><text>1 representative of the
			 United States Postal Inspection Service; and</text>
					</paragraph><paragraph id="H4BE10435BE42465C8647F6F6D4B01C00"><enum>(8)</enum><text>1 representative of the
			 Department of Justice.</text>
					</paragraph></subsection><subsection id="HE912A284A6A843A6AAB933989B22B10"><enum>(h)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated for each
			 of the fiscal years 2009 through 2016, $2,000,000 to carry out the provisions
			 of this section.</text>
				</subsection></section><section id="HE2436CF1026F4E46A200F80042464D6D"><enum>106.</enum><header>ICAC grant
			 program</header>
				<subsection id="H9F3C84418F254A1BACD8C48047BBF7C1"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="H577358B2B4A04E028C7094895631004E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Attorney General
			 is authorized to award grants to State and local ICAC task forces to assist in
			 carrying out the duties and functions described under section 104.</text>
					</paragraph><paragraph id="HA752D80EF5A8443EA12D9FBC32192E17"><enum>(2)</enum><header>Formula grants</header>
						<subparagraph id="H9EEFF045F2514FDC9400E9B944217541"><enum>(A)</enum><header>Development of
			 formula</header><text display-inline="yes-display-inline">At least 75 percent
			 of the total funds appropriated to carry out this section shall be available to
			 award or otherwise distribute grants pursuant to a funding formula established
			 by the Attorney General in accordance with the requirements in
			 <internal-xref idref="H62EB0C21BDDC4CAA90091165F4504CEC" legis-path="106.(a)(2)(B)">subparagraph (B)</internal-xref>.</text>
						</subparagraph><subparagraph id="H62EB0C21BDDC4CAA90091165F4504CEC"><enum>(B)</enum><header>Formula
			 requirements</header><text display-inline="yes-display-inline">Any formula
			 established by the Attorney General under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">subparagraph (A)</internal-xref> shall—</text>
							<clause id="HC9BDC0F5D0E044E6AB301575BD4D32C8"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that each State or local ICAC task
			 force shall, at a minimum, receive an amount equal to 0.5 percent of the funds
			 available to award or otherwise distribute grants under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">subparagraph (A)</internal-xref>; and</text>
							</clause><clause id="HFB34F42BA16746ADBDEE7495C2F3DE39"><enum>(ii)</enum><text>take into consideration
			 the following factors:</text>
								<subclause id="H49750386C9DB46CDBB837EB8F4086B4C"><enum>(I)</enum><text>The population of each
			 State, as determined by the most recent decennial census performed by the
			 Bureau of the Census.</text>
								</subclause><subclause id="H4F5E2AD89BEE4ABB908D10DBD2033CBC"><enum>(II)</enum><text>The number of
			 investigative leads within the applicant’s jurisdiction generated by the ICAC
			 Data Network, the CyberTipline, and other sources.</text>
								</subclause><subclause id="H421908D53C974E64A29EAA20CB237E73"><enum>(III)</enum><text>The number of criminal
			 cases related to Internet crimes against children referred to a task force for
			 Federal, State, or local prosecution.</text>
								</subclause><subclause id="H8DF6D239011D4E86BCA2EAC88D3F71A7"><enum>(IV)</enum><text>The number of successful
			 prosecutions of child exploitation cases by a task force.</text>
								</subclause><subclause id="HA4B85C767062418F87F1FDE752B6983B"><enum>(V)</enum><text>The amount of training,
			 technical assistance, and public education or outreach by a task force related
			 to the prevention, investigation, or prosecution of child exploitation
			 offenses.</text>
								</subclause><subclause id="H53F541F66776494ABEF53D73595E3B05"><enum>(VI)</enum><text>Such other criteria as
			 the Attorney General determines demonstrate the level of need for additional
			 resources by a task force.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H1BB50AECFBC94DB8924C049000D122E0"><enum>(3)</enum><header>Distribution of
			 remaining funds based on need</header>
						<subparagraph id="H449894314FF64B5D8248D467178B234B"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any funds remaining
			 from the total funds appropriated to carry out this section after funds have
			 been made available to award or otherwise distribute formula grants under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">paragraph (2)(A)</internal-xref> shall be
			 distributed to State and local ICAC task forces based upon need, as set forth
			 by criteria established by the Attorney General. Such criteria shall include
			 the factors under
			 <internal-xref idref="HFB34F42BA16746ADBDEE7495C2F3DE39" legis-path="106.(a)(2)(B)(ii)">paragraph (2)(B)(ii)</internal-xref>.</text>
						</subparagraph><subparagraph id="HC09725B0C39F46D489CE8902B514F37"><enum>(B)</enum><header>Matching
			 requirement</header><text display-inline="yes-display-inline">A State or local
			 ICAC task force shall contribute matching non-Federal funds in an amount equal
			 to not less than 25 percent of the amount of funds received by the State or
			 local ICAC task force under
			 <internal-xref idref="H449894314FF64B5D8248D467178B234B" legis-path="106.(a)(3)(A)">subparagraph (A)</internal-xref>. A State or local
			 ICAC task force that is not able or willing to contribute matching funds in
			 accordance with this subparagraph shall not be eligible for funds under
			 <internal-xref idref="H449894314FF64B5D8248D467178B234B" legis-path="106.(a)(3)(A)">subparagraph (A)</internal-xref>.</text>
						</subparagraph><subparagraph id="ID7ada3e0522304a2da84e7f149034cdb4"><enum>(C)</enum><header>Waiver</header><text>The
			 Attorney General may waive, in whole or in part, the matching requirement under
			 subparagraph (B) if the State or local ICAC task force demonstrates good cause
			 or financial hardship.</text>
						</subparagraph></paragraph></subsection><subsection id="HA3F8269482E64E2EA89DB0EBD8C5DA01"><enum>(b)</enum><header>Application</header>
					<paragraph id="HA7672C38EC424B3DB72FF9131202DC03"><enum>(1)</enum><header>In
			 general</header><text>Each State or local ICAC task force seeking a grant under
			 this section shall submit an application to the Attorney General at such time,
			 in such manner, and accompanied by such information as the Attorney General may
			 reasonably require.</text>
					</paragraph><paragraph id="HF544DB18C27A4D38854E851D0565C779"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted pursuant to paragraph (1) shall—</text>
						<subparagraph id="H36D6ED7C12B6479A83EB00550117C564"><enum>(A)</enum><text>describe the activities
			 for which assistance under this section is sought; and</text>
						</subparagraph><subparagraph id="HC8923BD506E1473D8300EC6176766259"><enum>(B)</enum><text>provide such additional
			 assurances as the Attorney General determines to be essential to ensure
			 compliance with the requirements of this title.</text>
						</subparagraph></paragraph></subsection><subsection id="HAC610608EDAB46259EED63E4C39600A1"><enum>(c)</enum><header>Allowable
			 Uses</header><text>Grants awarded under this section may be used to—</text>
					<paragraph id="HAE8292460CC1425DB55698DC76F02500"><enum>(1)</enum><text>hire personnel,
			 investigators, prosecutors, education specialists, and forensic
			 specialists;</text>
					</paragraph><paragraph id="HD4E0C978B7664531A209F8D2565937C5"><enum>(2)</enum><text>establish and support
			 forensic laboratories utilized in Internet crimes against children
			 investigations;</text>
					</paragraph><paragraph id="H7AC80AF327A7498B9884DE719D2D18F2"><enum>(3)</enum><text>support investigations
			 and prosecutions of Internet crimes against children;</text>
					</paragraph><paragraph id="H55570CDFE0544072BFDD9F13D34EA3FF"><enum>(4)</enum><text>conduct and assist with
			 education programs to help children and parents protect themselves from
			 Internet predators;</text>
					</paragraph><paragraph id="HFDEE77A290B14D5A8E53C64DB1BD7258"><enum>(5)</enum><text>conduct and attend
			 training sessions related to successful investigations and prosecutions of
			 Internet crimes against children; and</text>
					</paragraph><paragraph id="HD969F8F1B70143F4BE43FFEC529EB45"><enum>(6)</enum><text>fund any other activities
			 directly related to preventing, investigating, or prosecuting Internet crimes
			 against children.</text>
					</paragraph></subsection><subsection id="HCF81B93F81B94855B75DA162D89B9228"><enum>(d)</enum><header>Reporting
			 Requirements</header>
					<paragraph id="HEE91E7E914994F88001358F600C774EE"><enum>(1)</enum><header>ICAC
			 reports</header><text>To measure the results of the activities funded by grants
			 under this section, and to assist the Attorney General in complying with the
			 Government Performance and Results Act (<external-xref legal-doc="public-law" parsable-cite="pl/103/62">Public Law 103–62</external-xref>; 107 Stat. 285),
			 each State or local ICAC task force receiving a grant under this section shall,
			 on an annual basis, submit a report to the Attorney General that sets forth the
			 following:</text>
						<subparagraph id="H2B5B8CA1B92D4FA5B2F924119BA014D8"><enum>(A)</enum><text>Staffing levels of the
			 task force, including the number of investigators, prosecutors, education
			 specialists, and forensic specialists dedicated to investigating and
			 prosecuting Internet crimes against children.</text>
						</subparagraph><subparagraph id="H4DC37CB782F44A3DBFAA86B083D0C81F"><enum>(B)</enum><text>Investigation and
			 prosecution performance measures of the task force, including—</text>
							<clause id="HB0DDDD7F1D20410893B680C884F983A2"><enum>(i)</enum><text>the number of
			 investigations initiated related to Internet crimes against children;</text>
							</clause><clause id="H28C2403466C8475AA0CBAA353F22C063"><enum>(ii)</enum><text>the number of arrests
			 related to Internet crimes against children; and</text>
							</clause><clause id="H8850A59D416D443485C16DBC74776673"><enum>(iii)</enum><text>the number of
			 prosecutions for Internet crimes against children, including—</text>
								<subclause id="H079188C986A148BCB3D2CD00DD57CA16"><enum>(I)</enum><text>whether the prosecution
			 resulted in a conviction for such crime; and</text>
								</subclause><subclause id="HBECBC79E53B441E0005D779B1C78388D"><enum>(II)</enum><text>the sentence and the
			 statutory maximum for such crime under State law.</text>
								</subclause></clause></subparagraph><subparagraph id="H980A06D5183040D489100016958B94F2"><enum>(C)</enum><text>The number of referrals
			 made by the task force to the United States Attorneys office, including whether
			 the referral was accepted by the United States Attorney.</text>
						</subparagraph><subparagraph id="H017380C7503C4F5E919BFF800A836B1"><enum>(D)</enum><text>Statistics that account
			 for the disposition of investigations that do not result in arrests or
			 prosecutions, such as referrals to other law enforcement.</text>
						</subparagraph><subparagraph id="H5D50F72320FA4EE093D630C70966DFE"><enum>(E)</enum><text>The number of
			 investigative technical assistance sessions that the task force provided to
			 nonmember law enforcement agencies.</text>
						</subparagraph><subparagraph id="H623FDD21B6D4473400A5F8644FCA8203"><enum>(F)</enum><text>The number of computer
			 forensic examinations that the task force completed.</text>
						</subparagraph><subparagraph id="HEB1217F0CBD74781BEA63151F542FEEF"><enum>(G)</enum><text>The number of law
			 enforcement agencies participating in Internet crimes against children program
			 standards established by the task force.</text>
						</subparagraph></paragraph><paragraph id="H229DC7F6AF304DDBB485D7B42DFF1D14"><enum>(2)</enum><header>Report to
			 congress</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Attorney General shall submit a report to Congress on—</text>
						<subparagraph id="HB9CD52DAE40F4B818C32D2FD8F7DC92C"><enum>(A)</enum><text>the progress of the
			 development of the ICAC Task Force Program established under section 102;
			 and</text>
						</subparagraph><subparagraph id="HDC2BA7721CCE4ED99CDA40FEA7894A"><enum>(B)</enum><text>the number of Federal and
			 State investigations, prosecutions, and convictions in the prior 12-month
			 period related to child exploitation.</text>
						</subparagraph></paragraph></subsection></section><section id="HC77EE830635544A7AC886B8390F2A508"><enum>107.</enum><header>Authorization of
			 appropriations</header>

			 combat child exploitation</header>
			<section id="HCC48CBE86D7E4D68B1DA40058D405085"><enum>201.</enum><header>Additional regional
			 computer forensic labs</header>
				<subsection id="H0827F49E9C5441C39737DE30B6B256FC"><enum>(a)</enum><header>Additional
			 Resources</header><text>The Attorney General shall establish additional
			 computer forensic capacity to address the current backlog for computer
			 forensics, including for child exploitation investigations. The Attorney
			 General may utilize funds under this title to increase capacity at existing
			 regional forensic laboratories or to add laboratories under the Regional
			 Computer Forensic Laboratories Program operated by the Federal Bureau of
			 Investigation.</text>
				</subsection><subsection id="H7733EDDF10204A59A80785B571D386B1"><enum>(b)</enum><header>Purpose of New
			 Resources</header><text>The additional forensic capacity established by
			 resources provided under this section shall be dedicated to assist Federal
			 agencies, State and local Internet Crimes Against Children task forces, and
			 other Federal, State, and local law enforcement agencies in preventing,
			 investigating, and prosecuting Internet crimes against children.</text>
				</subsection><subsection id="idD9216AC5878F4D0A82B255B71520FA5E"><enum>(c)</enum><header>New Computer Forensic
			 labs</header><text>If the Attorney General determines that new regional
			 computer forensic laboratories are required under subsection (a) to best
			 address existing backlogs, such new laboratories shall be established pursuant
			 to subsection (d).</text>
				</subsection><subsection id="H1C7F9D1B25244311A4BFEE934B5BB1F"><enum>(d)</enum><header>Location of New
			 Labs</header><text>The location of any new regional computer forensic
			 laboratories under this section shall be determined by the Attorney General, in
			 consultation with the Director of the Federal Bureau of Investigation, the
			 Regional Computer Forensic Laboratory National Steering Committee, and other
			 relevant stakeholders.</text>
				</subsection><subsection id="H41020E9651B643BCA5341FE798AF09A3"><enum>(e)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and every year
			 thereafter, the Attorney General shall submit a report to the Congress on how
			 the funds appropriated under this section were utilized.</text>
				</subsection><subsection id="H8EBA01C12976474B9068926CD6926F72"><enum>(f)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated for fiscal
			 years 2009 through 2016, $7,000,000 to carry out the provisions of this
			 section.</text>
				</subsection></section><section id="H835027A8990E46228772CE971D002040"><enum>202.</enum><header>Additional field
			 agents for the FBI</header>
				<subsection id="HAC3C6FB09E304EC39B90261BD8CFF128"><enum>(a)</enum><header>In
			 General</header><text>There are authorized to be appropriated to the Attorney
			 General $30,000,000 for each of the fiscal years 2009 through 2016 to fund the
			 hiring of full-time Federal Bureau of Investigation field agents and associated
			 analysts and support staff in addition to the number of such employees serving
			 in those capacities on the date of enactment of this Act.</text>
				</subsection><subsection id="H990D949F760849CE9461275E61AC5C1C"><enum>(b)</enum><header>Sole
			 Purpose</header><text>The sole purpose of the additional staff required to be
			 hired under subsection (a) is to work on child exploitation cases as part of
			 the Federal Bureau of Investigation’s Innocent Images National
			 Initiative.</text>
				</subsection></section><section id="HE4F21C8EEC004200AFD0DA9C92C9BF2"><enum>203.</enum><header>Immigration and
			 customs enforcement enhancement</header>
				<subsection id="H2193CC54035F4A6194AD0205540495EB"><enum>(a)</enum><header>Additional
			 Agents</header><text>There are authorized to be appropriated to the Secretary
			 of Homeland Security $15,000,000, for each of the fiscal years 2009 through
			 2016, to fund the hiring of full-time agents and associated analysts and
			 support staff within the Bureau of Immigration and Customs Enforcement in
			 addition to the number of such employees serving in those capacities on the
			 date of enactment of this Act.</text>
				</subsection><subsection id="H86E0129522314A0DBA94A293024A1B3"><enum>(b)</enum><header>Sole
			 Purpose</header><text>The sole purpose of the additional staff required to be
			 hired under subsection (a) is to work on child exploitation and child obscenity
			 cases.</text>
				</subsection></section><section id="HC8A4B45C9CF8493582EA0000D7003DF5"><enum>204.</enum><header>Combating child
			 exploitation via the United States Postal Service</header>
				<subsection id="HBE2A0F4232C1408E9446351D502BDBE7"><enum>(a)</enum><header>In
			 General</header><text>There are authorized to be appropriated to the Postmaster
			 General $5,000,000, for each of the fiscal years 2009 through 2016, to fund the
			 hiring of full-time postal inspectors and associated analysts and support staff
			 in addition to the number of such employees serving in those capacities on the
			 date of the enactment of this Act.</text>
				</subsection><subsection id="H39E0B63F53354AEFBD23B91D3BC48100"><enum>(b)</enum><header>Sole
			 Purpose</header><text>The sole purpose of the additional staff required to be
			 hired under subsection (a) is to work on child exploitation and child obscenity
			 cases and may be used to support the Deliver Me Home program developed by the
			 United States Postal Service.</text>

			 striking <quote>in interstate or foreign</quote> and all that follows through
			 <quote>computer</quote> and inserting <quote>in or affecting interstate or

			 commerce</quote>;</text>
					</paragraph><paragraph id="id2E2BB352CD264C8BAE1B69589EE52FC0"><enum>(2)</enum><text>in paragraph (2)—</text>
						<subparagraph id="id141D7E68E3BC4457BCC322A9572E4351"><enum>(A)</enum><text>by striking <quote>has

			 interstate or foreign commerce by any means, including by computer</quote> each
			 place that term appears and inserting <quote>in or affecting interstate or
			 foreign commerce or using a facility or means of interstate or foreign
			 commerce</quote>; and</text>
					</paragraph><paragraph id="id3D62308C1EA648819054281EB3B34CA1"><enum>(2)</enum><text>in paragraph (6)(C), by
			 striking <quote>or by transmitting or causing to be transmitted any wire
			 communication in interstate or foreign commerce, including by computer</quote>
			 and inserting <quote>or a facility or means of interstate or foreign
			 commerce</quote>.</text>
					</paragraph></subsection><subsection id="id51117A36F8534A1E8B10D21B06F0A9DA"><enum>(e)</enum><header>Obscene visual
			 representations of the sexual abuse of children</header><text>Subsection (d)(4)
			 of section 1466A of title 18, United States Code, is amended by striking
			 <quote>has been shipped transported in interstate or foreign commerce by any
			 means, including by computer</quote> and inserting <quote>has been shipped or
			 transported in or affecting interstate or foreign commerce or using a facility
			 or means of interstate or foreign commerce</quote>.</text>
				</subsection><subsection id="id0D569C9E690F40E7921E53C229C159A9"><enum>(f)</enum><header>Rule of
			 construction</header><text>Nothing in this title, or any amendment by this
			 title, shall be construed to foreclose any argument or ruling with respect to
			 any Federal law that, for the purposes of Federal jurisdiction, the use of a
			 facility or means of interstate or foreign commerce affects interstate or
			 foreign commerce.</text>
				</subsection></section><section id="id28BA7F645DA449B78ADE91AB48174C17" section-type="subsequent-section"><enum>302.</enum><header>Prohibit the
			 broadcast of live images of child abuse</header><text display-inline="no-display-inline">Section 2251 of title 18, United States Code
			 is amended—</text>

			 by—</text>

			 the purpose of transmitting a live visual depiction of such conduct</quote>
			 after <quote>for the purpose of producing any visual depiction of such
			 conduct</quote>;</text>
					</subparagraph><subparagraph id="IDa727faa3251f481599aabc419cb61b75"><enum>(B)</enum><text>inserting <quote>or
			 transmitted</quote> after <quote>if such person knows or has reason to know
			 that such visual depiction will be transported</quote>;</text>
					</subparagraph><subparagraph id="ID11c8c904ebf3435da81f5a94763b0cae"><enum>(C)</enum><text>inserting <quote>or
			 transmitted</quote> after <quote>if that visual depiction was produced</quote>;
			 and</text>
					</subparagraph><subparagraph id="IDe99e9534e6fc4ab98432760ba37eb2dc"><enum>(D)</enum><text>inserting <quote>or
			 transmitted</quote> after <quote>has actually been transported</quote>;
			 and</text>

			 by—</text>

			 transmitted</quote> after <quote>has actually been transported</quote>.</text>
					</subparagraph></paragraph></section><section id="ID701f42db034b4acfa4054158e9297ca0"><enum>303.</enum><header>Amendment to section

			 the purpose of transmitting a live visual depiction of such conduct</quote>
			 after <quote>for the purpose of producing any visual depiction of such
			 conduct</quote>; and</text>
				</paragraph><paragraph id="IDef244b4ae5a9406d9acbe57f0dd571e8"><enum>(2)</enum><text>inserting <quote>or
			 transmitted</quote> after <quote>imported</quote>.</text>
				</paragraph></section><section id="ID3a74901183104ae6aaf2f4e2c7aaabbf"><enum>305.</enum><header>Prohibiting the
			 alteration of an image of a real child to create an image of sexually explicit
			 conduct</header>
				<subsection id="ID3161a01904e84c70acb739f1f8176aea"><enum>(a)</enum><header>In
			 general</header><text>Subsection (a) of section 2252A of title 18, United
			 States Code, is amended—</text>

				produced using materials that have been mailed, shipped, or transported in
				interstate or foreign commerce by any means, including by
				computer,</text>

					</paragraph></subsection><subsection id="ID97dc88ad11c848a595b13cb6164e05ab"><enum>(b)</enum><header>Penalty</header><text>Section
			 2252A(b) of title 18, United States Code, is amended by striking <quote>(4), or
			 (6)</quote> and inserting <quote>(4), (6), or (7)</quote>.</text>
				</subsection></section><section id="IDdaa4f95444174dcf88cea6506f54b1d6"><enum>306.</enum><header>Referrals to
			 authorized foreign law enforcement agencies</header>
				<subsection id="ID9ec7f240aa91469d9e958784d2c60c1e"><enum>(a)</enum><header>Voluntary
			 reports</header><text>A provider of electronic communication services or remote
			 computing services may voluntarily make a report, as defined at section
			 227(b)(1) of the Victims of Child abuse Act of 1990 (42 U.S.C. 13032(b)(1)),
			 directly to a representative of a foreign law enforcement agency—</text>
					<paragraph id="IDaff5285fc8b146a2980e033731d660cd"><enum>(1)</enum><text>of a foreign state that
			 is a signatory to a Mutual Legal Assistance Treaty with the United States that
			 has been ratified by the United States Senate and has come into force;
			 and</text>
					</paragraph><paragraph id="IDcda168af1032497b8ad4f5aa543e58c4"><enum>(2)</enum><text>that has certified in
			 writing that the request is made for the purpose of investigating, or engaging
			 in enforcement proceedings related to, possible violations of foreign laws
			 related to child pornography and child exploitation similar to practices
			 prohibited by sections 2251, 2251A, 2252, 2252A, 2252B, or 2260 of title 18,
			 United States Code, involving child pornography (as defined in section 2256 of
			 that title), or 1466A of that title.</text>
					</paragraph></subsection><subsection id="IDd17674ff5df14af5a5b84df47e545614"><enum>(b)</enum><header>Reports to foreign law
			 enforcement</header><text>Reports to foreign law enforcement may only be
			 transmitted to the Central Authority designated in the foreign country's Mutual
			 Legal Assistance Treaty with the United States and may only be transmitted via
			 mail or fax, or via electronic mail to a government-owned e-mail domain.</text>
				</subsection><subsection id="ID6c870d87a5034144ace5b3c129ba376e"><enum>(c)</enum><header>Reports to
			 NCMEC</header><text>Nothing in this section shall be construed to relieve
			 providers of electronic communication services or remote computing services of
			 their obligations under section 227(b)(1) of the Victims of Child abuse Act of
			 1990 (42 U.S.C. 13032(b)(1)) to make reports to the National Center for Missing
			 and Exploited Children.</text>
				</subsection><subsection id="ID7cc47e2486cd4c089cdcbad60594464e"><enum>(d)</enum><header>Limitation on
			 liability</header>
					<paragraph id="ID8f550e46cdbe4a3d8728c1c9b517cad4"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), a provider of
			 electronic communication services or remote computing services, or any of its
			 directors, officers, employees, or agents, is not liable in any civil or
			 criminal action arising from the performance of the reporting activities
			 described in subsection (a).</text>
					</paragraph><paragraph id="ID16fcf09e24594d6183a755b054eff258"><enum>(2)</enum><header>Intentional, reckless,
			 or other misconduct</header><text>Paragraph (1) does not apply in an action in
			 which a party proves that the provider of electronic communication services or
			 remote computing services, or its officer, employee, or agent as the case may
			 be, engaged in intentional misconduct or acted with actual malice, or with
			 reckless disregard to a substantial risk of causing injury without legal
			 justification.</text>
					</paragraph></subsection></section></title><title changed="added" committee-id="SSJU00" id="idD1721753EE22425F8B0CA0AD394E46EE" reported-display-style="italic"><enum>IV</enum><header>National Institute of
			 Justice Study of Risk Factors</header>
			<section id="ID15c8fe336eb443a38f6c801fc433299c"><enum>401.</enum><header>NIJ Study of Risk
			 Factors for Assessing Dangerousness</header>
				<subsection id="ID67039e8bf67146409509e8cfe39eb884"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the National Institute of Justice shall prepare a report to identify
			 investigative factors that reliably indicate whether a subject of an online
			 child exploitation investigation poses a higher risk of harm to children. Such
			 a report shall be prepared in consultation and coordination with Federal law
			 enforcement agencies, the National Center for Missing and Exploited Children,
			 Operation Fairplay at the Wyoming Attorney General's Office, the Internet
			 Crimes Against Children Task Force, and other State and local law
			 enforcement.</text>
				</subsection><subsection id="ID41fee81b9bf04a89a66bda57f191554f"><enum>(b)</enum><header>Contents of
			 analysis</header><text>The report required by subsection (a) shall include a
			 thorough analysis of potential investigative factors in on-line child
			 exploitation cases and an appropriate examination of investigative data from
			 prior prosecutions and case files of identified child victims.</text>
				</subsection><subsection id="idD000D3C2D0A849FDAD225AC5A29C9690"><enum>(c)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than 1
			 year after the date of enactment of this Act, the National Institute of Justice
			 shall submit a report to the House and Senate Judiciary Committees that
			 includes the findings of the study required by this section and makes
			 recommendations on technological tools and law enforcement procedures to help
			 investigators prioritize scarce resources to those cases where there is actual
			 hands-on abuse by the suspect.</text>
				</subsection><subsection id="idDB91912AA8B14927B2902873E98178FD"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated $1,000,000 to the National Institute of Justice
			 to conduct the study required under this section.</text>
