		<official-title display="yes">To require the Department of Justice to
		  develop and implement a National Strategy Child Exploitation Prevention and
		  Interdiction, to improve the Internet Crimes Against Children Task Force, to
		  increase resources for regional computer forensic labs, and to make other
		  improvements to increase the ability of law enforcement agencies to investigate

			 apply:</text>
			<paragraph id="HE6E0BE988F15461E905CEFE0E74FB62E"><enum>(1)</enum><header>Child
			 exploitation</header><text>The term <quote>child exploitation</quote> means any
			 conduct, attempted conduct, or conspiracy to engage in conduct involving a
			 minor that violates section 1591, chapter 109A, chapter 110, and chapter 117 of
			 title 18, United States Code, or any sexual activity involving a minor for
			 which any person can be charged with a criminal offense.</text>
			</paragraph><paragraph id="id08F47FC7DAF743BF993585EF62E4C6CC"><enum>(2)</enum><header>Child
			 obscenity</header><text>The term <quote>child obscenity</quote> means any
			 visual depiction proscribed by <external-xref legal-doc="usc" parsable-cite="usc/18/1466A">section 1466A</external-xref> of title 18, United States
			 Code.</text>
			</paragraph><paragraph id="H57AEDE41D3664ED5BC9C99B43FEEEF00"><enum>(3)</enum><header>Minor</header><text>The
			 term <quote>minor</quote> means any person under the age of 18 years.</text>
			</paragraph><paragraph id="HBF8F46D65F1647AA00D2709B6FB45EBF"><enum>(4)</enum><header>Sexually
			 explicit conduct</header><text>The term <quote>sexually explicit
			 conduct</quote> has the meaning given such term in
			 section
			 2256 of title 18, United States Code.</text>
			</paragraph></section><title id="HBC6754948A9F4231AA1E1BF097DE4F11"><enum>I</enum><header>National Strategy
			 for Child Exploitation Prevention and Interdiction</header>
			<section id="H62AC7B92E3004205BBCA3142B700FA2E"><enum>101.</enum><header>Establishment
			 of National Strategy for Child Exploitation Prevention and
			 Interdiction</header>
				<subsection id="ID9f50752283b344e5848749254e32cb80"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General of the United States shall create
			 and implement a National Strategy for Child Exploitation Prevention and
			 Interdiction.</text>
				</subsection><subsection id="id7E24E6F8C293431B900E79ECDFE664EE"><enum>(b)</enum><header>Timing</header><text>Not
			 later than 1 year after the date of enactment of this Act and on February 1 of
			 every second year thereafter, the Attorney General shall submit to Congress the
			 National Strategy established under subsection (a).</text>
				</subsection><subsection id="id68E15173687E4248AE2B6ACCD7CB79DA"><enum>(c)</enum><header>Required
			 contents of National Strategy</header><text>The National Strategy established
			 under subsection (a) shall include the following:</text>
					<paragraph id="ID6f95805f1fce49c1b6669591a55b42e8"><enum>(1)</enum><text>Comprehensive
			 long-range, goals for reducing child exploitation.</text>
					</paragraph><paragraph id="ID11329c164a5041bbb40aee60e4f87b06"><enum>(2)</enum><text>Annual measurable
			 objectives and specific targets to accomplish long-term, quantifiable goals
			 that the Attorney General determines may be achieved during each year beginning
			 on the date when the National Strategy is submitted.</text>
					</paragraph><paragraph id="ID9fec3870e0cd4ea8a48e9eabb9cd879d"><enum>(3)</enum><text>Annual budget
			 priorities and Federal efforts dedicated to combating child exploitation,
			 including resources dedicated to Internet Crimes Against Children task forces,
			 Project Safe Childhood, FBI Innocent Images Initiative, the National Center for
			 Missing and Exploited Children, regional forensic computer labs, Internet
			 Safety programs, and all other entities whose goal or mission is to combat the
			 exploitation of children that receive Federal support.</text>
					</paragraph><paragraph id="ID8e34f61b5041489c8d7fdb9afbf62c8e"><enum>(4)</enum><text>A 5-year
			 projection for program and budget goals and priorities.</text>
					</paragraph><paragraph id="IDce5c6bf55ad142acbf3e5213c82aaab3"><enum>(5)</enum><text>A review of the
			 policies and work of the Department of Justice related to the prevention and
			 investigation of child exploitation crimes, including efforts at the Office of
			 Justice Programs, the Criminal Division of the Department of Justice, the
			 Executive Office of United States Attorneys, the Federal Bureau of
			 Investigation, the Office of the Attorney General, the Office of the Deputy
			 Attorney General, the Office of Legal Policy, and any other agency or bureau of
			 the Department of Justice whose activities relate to child exploitation.</text>
					</paragraph><paragraph id="ID6cabcc866c50478eb13b3eee76cc7e0f"><enum>(6)</enum><text>A description of
			 the Department’s efforts to coordinate with international, State, local, tribal
			 law enforcement, and private sector entities on child exploitation prevention
			 and interdiction efforts.</text>
					</paragraph><paragraph id="ID4563f41d92074ee18e1a2ce5f54eced3"><enum>(7)</enum><text>Plans for
			 interagency coordination regarding the prevention, investigation, and
			 apprehension of individuals exploiting children, including cooperation and
			 collaboration with—</text>
						<subparagraph id="ID414daaceae3b40b7a5c75006b8d5848e"><enum>(A)</enum><text>Immigration and
			 Customs Enforcement;</text>
						</subparagraph><subparagraph id="IDdfb255c7ab474655b8f14fbf944da953"><enum>(B)</enum><text>the United States
			 Postal Inspection Service;</text>
						</subparagraph><subparagraph id="IDc0ba2b0c7d3c4be3b24d12417c793131"><enum>(C)</enum><text>the Department of
			 State;</text>
						</subparagraph><subparagraph id="ID6fe374d0abcc4fee8749c6d826f0a87d"><enum>(D)</enum><text>the Department of
			 Commerce;</text>
						</subparagraph><subparagraph id="IDc2e989417228455691188972512882ca"><enum>(E)</enum><text>the Department of
			 Education;</text>
						</subparagraph><subparagraph id="ID2311224801c64a5c988f83368be31c52"><enum>(F)</enum><text>the Department of
			 Health and Human Services; and</text>
						</subparagraph><subparagraph id="id2D9C3B32495244AEA8196C10CE1EE182"><enum>(G)</enum><text>other appropriate
			 Federal agencies.</text>
						</subparagraph></paragraph><paragraph id="IDa3c60399a30b4c8b8b88cebf465d6ac7"><enum>(8)</enum><text>A review of the
			 Internet Crimes Against Children Task Force Program, including—</text>
						<subparagraph id="IDd94945fcd51e4e18b6862acc5d10f0b1"><enum>(A)</enum><text>the number of
			 ICAC task forces and location of each ICAC task force;</text>
						</subparagraph><subparagraph id="ID03af69a5a8a04aae8e22fc2734d40257"><enum>(B)</enum><text>the number of
			 trained personnel at each ICAC task force;</text>
						</subparagraph><subparagraph id="IDb3496e841a5b42f8936ad89f5b4e0c61"><enum>(C)</enum><text>the amount of
			 Federal grants awarded to each ICAC task force;</text>
						</subparagraph><subparagraph id="ID9358b42b088d4871b155e1a2467aee34"><enum>(D)</enum><text>an assessment of
			 the Federal, State, and local cooperation in each task force, including—</text>
							<clause id="ID7aec67938d4a450f8c73df9631ed2e6f"><enum>(i)</enum><text>the
			 number of arrests made by each task force;</text>
							</clause><clause id="ID4359bd06e3ec45a999cb25c7321573d9"><enum>(ii)</enum><text>the number of
			 criminal referrals to United States attorneys for prosecution;</text>
							</clause><clause id="ID352c483f22734e33954db2d47673f92f"><enum>(iii)</enum><text>the number of
			 prosecutions and convictions from the referrals made under clause (ii);</text>
							</clause><clause id="IDdc14493dad9d44a5bca361403a0bff11"><enum>(iv)</enum><text>the number, if
			 available, of local prosecutions and convictions based on ICAC task force
			 investigations; and</text>
							</clause><clause id="IDe5d8d3be36eb4cf58ccd29df08cb5e4f"><enum>(v)</enum><text>any
			 other information demonstrating the level of Federal, State, and local
			 coordination and cooperation, as such information is to be determined by the
			 Attorney General;</text>
							</clause></subparagraph><subparagraph id="ID1f2cf9d754d545048c95126da386f4d1"><enum>(E)</enum><text>an assessment of
			 the training opportunities and technical assistance available to support ICAC
			 task force grantees; and</text>
						</subparagraph><subparagraph id="ID24e0379bcbb848c2ac622bad5a4b5774"><enum>(F)</enum><text>an assessment of
			 the success of the Internet Crimes Against Children Task Force Program at
			 leveraging State and local resources and matching funds.</text>
						</subparagraph></paragraph><paragraph id="IDe038f66bc69744d3b17f409d6644edbd"><enum>(9)</enum><text>An assessment of
			 the technical assistance and support available for Federal, State, local, and
			 tribal law enforcement agencies, in the prevention, investigation, and
			 prosecution of child exploitation crimes.</text>
					</paragraph><paragraph id="ID18baa47c7d594fefa3f3c5eaf694e7d2"><enum>(10)</enum><text>A review of the
			 backlog of forensic analysis for child exploitation cases at each FBI Regional
			 Forensic lab and an estimate of the backlog at State and local labs.</text>
					</paragraph><paragraph id="IDbb1ae24e29cc466f9c0c353b168ed944"><enum>(11)</enum><text>Plans for
			 reducing the forensic backlog described in paragraph (10), if any, at Federal,
			 State and local forensic labs.</text>
					</paragraph><paragraph id="ID72d7490310424e6fa4d19bc081b68693"><enum>(12)</enum><text>A review of the
			 Federal programs related to child exploitation prevention and education,
			 including those related to Internet safety, including efforts by the private
			 sector and nonprofit entities, or any other initiatives, that have proven
			 successful in promoting child safety and Internet safety.</text>
					</paragraph><paragraph id="ID147111bf52414dc4a535cd66eaacd1b2"><enum>(13)</enum><text>An assessment of
			 the future trends, challenges, and opportunities, including new technologies,
			 that will impact Federal, State, local, and tribal efforts to combat child
			 exploitation.</text>
					</paragraph><paragraph id="ID72ede953719743979bd7f7dd80d91743"><enum>(14)</enum><text>Plans for
			 liaisons with the judicial branches of the Federal and State governments on
			 matters relating to child exploitation.</text>
					</paragraph><paragraph id="ID7e75c91ced214893af6a6f008b5e2bcc"><enum>(15)</enum><text>An assessment of
			 Federal investigative and prosecution activity relating to reported incidents
			 of child exploitation crimes, which shall include a number of factors,
			 including—</text>
						<subparagraph id="id82B99D8F9A1349A195C2A03C277DEC05"><enum>(A)</enum><text>the number of
			 high-priority suspects (identified because of the volume of suspected criminal
			 activity or because of the danger to the community or a potential victim) who
			 were investigated and prosecuted;</text>
						</subparagraph><subparagraph id="idCDDBA1427F6D4FEFBFB56960278B4CA8"><enum>(B)</enum><text>the number of
			 investigations, arrests, prosecutions and convictions for a crime of child
			 exploitation; and</text>
						</subparagraph><subparagraph id="id5ECBCC34228B49A19FA471A2A27AEA47"><enum>(C)</enum><text>the average
			 sentence imposed and statutory maximum for each crime of child
			 exploitation.</text>
						</subparagraph></paragraph><paragraph id="ID6e5f174fe91547eba49058a1aead9a5d"><enum>(16)</enum><text>A review of all
			 available statistical data indicating the overall magnitude of child
			 pornography trafficking in the United States and internationally,
			 including—</text>
						<subparagraph id="ID8bbcc260212047f8aef79cd813f14405"><enum>(A)</enum><text>the number of
			 computers or computer users, foreign and domestic, observed engaging in, or
			 suspected by law enforcement agencies and other sources of engaging in,
			 peer-to-peer file sharing of child pornography;</text>
						</subparagraph><subparagraph id="ID277d10f558df4061a71a64395aac7b08"><enum>(B)</enum><text>the number of
			 computers or computer users, foreign and domestic, observed engaging in, or
			 suspected by law enforcement agencies and other reporting sources of engaging
			 in, buying and selling, or other commercial activity related to child
			 pornography;</text>
						</subparagraph><subparagraph id="ID11a3244ac2c3481aad40e3d3401c1204"><enum>(C)</enum><text>the number of
			 computers or computer users, foreign and domestic, observed engaging in, or
			 suspected by law enforcement agencies and other sources of engaging in, all
			 other forms of activity related to child pornography;</text>
						</subparagraph><subparagraph id="ID8289f21c3f954203a07a973a4918a035"><enum>(D)</enum><text>the number of
			 tips or other statistical data from the National Center for Missing and
			 Exploited Children’s CyberTipline and other data indicating the magnitude of
			 child pornography trafficking; and</text>
						</subparagraph><subparagraph id="ID852c8a674b0e49b89fd0941ac36aa5ca"><enum>(E)</enum><text>any other
			 statistical data indicating the type, nature, and extent of child exploitation
			 crime in the United States and abroad.</text>
						</subparagraph></paragraph><paragraph id="ID66496e73f6f749209cea7bea829c7670"><enum>(17)</enum><text>Copies of recent
			 relevant research and studies related to child exploitation, including—</text>
						<subparagraph id="IDd73fe9d30e734fd4b2f9042e5ddcdbb7"><enum>(A)</enum><text>studies related
			 to the link between possession or trafficking of child pornography and actual
			 abuse of a child;</text>
						</subparagraph><subparagraph id="IDcc77ecd6d9d7412da62981b795efd5ca"><enum>(B)</enum><text>studies related
			 to establishing a link between the types of files being viewed or shared and
			 the type of illegal activity; and</text>
						</subparagraph><subparagraph id="IDb19a3418e828494bb6d7637650a249f7"><enum>(C)</enum><text>any other
			 research, studies, and available information related to child
			 exploitation.</text>
						</subparagraph></paragraph><paragraph id="ID1a8324b10c6d470eb9b3f08f104197e4"><enum>(18)</enum><text>A review of the
			 extent of cooperation, coordination, and mutual support between private sector
			 and other entities and organizations and Federal agencies, including the
			 involvement of States, local and tribal government agencies to the extent
			 Federal programs are involved.</text>
					</paragraph><paragraph id="ID2b8e8420dbcd499689915e11a245d890"><enum>(19)</enum><text>The results of
			 the Project Safe Childhood Conference or other conferences or meetings convened
			 by the Department of Justice related to combating child exploitation</text>
					</paragraph></subsection><subsection id="ID849cf74277074b3c97ce0a8e99312f9b"><enum>(d)</enum><header>Appointment of
			 high-level official</header>
					<paragraph id="id34570C9079B946849D857E44C1EA2A10"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall designate a senior official at
			 the Department of Justice to be responsible for coordinating the development of
			 the National Strategy established under subsection (a).</text>
					</paragraph><paragraph id="idECEBFF5433D74CACBD886D5305D4A545"><enum>(2)</enum><header>Duties</header><text>The
			 duties of the official designated under paragraph (1) shall include—</text>
						<subparagraph id="ID5ce4e073ef644df5aa26b15923015bb0"><enum>(A)</enum><text>acting as a
			 liaison with all Federal agencies regarding the development of the National
			 Strategy;</text>
						</subparagraph><subparagraph id="ID3bcb85f05e354f658581418751c7e8c4"><enum>(B)</enum><text>working to ensure
			 that there is proper coordination among agencies in developing the National
			 Strategy;</text>
						</subparagraph><subparagraph id="IDd877375be9964f3fb76c9cff89808113"><enum>(C)</enum><text>being
			 knowledgeable about budget priorities and familiar with all efforts within the
			 Department of Justice and the FBI related to child exploitation prevention and
			 interdiction; and</text>
						</subparagraph><subparagraph id="ID3270ee8be97f4c0a80d7a5fcc3ed1fd6"><enum>(D)</enum><text>communicating the
			 National Strategy to Congress and being available to answer questions related
			 to the strategy at congressional hearings, if requested by committees of
			 appropriate jurisdictions, on the contents of the National Strategy and
			 progress of the Department of Justice in implementing the National
			 Strategy.</text>
						</subparagraph></paragraph></subsection></section><section id="H0FBED0CD1FBE4797A112230809B671DC"><enum>102.</enum><header>Establishment
			 of National ICAC Task Force Program</header>
				<subsection id="H955D867FF7174BF684002C17FC777030"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="id1CBDE2B40BCE44FB903FEC5C147AE6CE"><enum>(1)</enum><header>In
			 general</header><text>There is established within the Department of Justice,
			 under the general authority of the Attorney General, a National Internet Crimes
			 Against Children Task Force Program (hereinafter in this title referred to as
			 the <quote>ICAC Task Force Program</quote>), which shall consist of a national
			 program of State and local law enforcement task forces dedicated to developing
			 effective responses to online enticement of children by sexual predators, child
			 exploitation, and child obscenity and pornography cases.</text>
					</paragraph><paragraph id="id8AACF8486B9346DAA45B9547E55E6394"><enum>(2)</enum><header>Intent of
			 Congress</header><text>It is the purpose and intent of Congress that the ICAC
			 Task Force Program established under paragraph (1) is intended to continue the
			 ICAC Task Force Program authorized under title I of the Departments of
			 Commerce, Justice, and State, the Judiciary, and Related Agencies
			 Appropriations Act, 1998, and funded under title IV of the Juvenile Justice and
			 Delinquency Prevention Act of 1974.</text>
					</paragraph></subsection><subsection id="H7160D1F795254ED593D1118D33E9C1EA"><enum>(b)</enum><header>National
			 Program</header>
					<paragraph id="id0DEFEEFF00EF40569616208A77C92FD1"><enum>(1)</enum><header>State
			 representation</header><text>The ICAC Task Force Program established under
			 subsection (a) shall include at least 1 ICAC task force in each State.</text>
					</paragraph><paragraph id="ID37fc9ae76f9b48419d4140e2a93d677c"><enum>(2)</enum><header>Capacity and
			 continuity of investigations</header><text>In order to maintain established
			 capacity and continuity of investigations and prosecutions of child
			 exploitation cases, the Attorney General, shall, in establishing the ICAC Task
			 Force Program under subsection (a) consult with and consider all 59 task forces
			 in existence on the date of enactment of this Act. The Attorney General shall
			 include all existing ICAC task forces in the ICAC Task Force Program, unless
			 the Attorney General makes a determination that an existing ICAC does not have
			 a proven track record of success.</text>
					</paragraph><paragraph id="ID9aa92b0569d940459ecf8561ab4b12ce"><enum>(3)</enum><header>Ongoing
			 review</header><text>The Attorney General shall—</text>
						<subparagraph id="idEA1F1C72D873482AB98FEB2F4712B957"><enum>(A)</enum><text>conduct periodic
			 reviews of the effectiveness of each ICAC task force established under this
			 section; and</text>
						</subparagraph><subparagraph id="id73FBB57D987242549332A1B7EF7231F6"><enum>(B)</enum><text>have the
			 discretion to establish a new task force if the Attorney General determines
			 that such decision will enhance the effectiveness of combating child
			 exploitation provided that the Attorney General notifies Congress in advance of
			 any such decision and that each state maintains at least 1 ICAC task force at
			 all times.</text>
						</subparagraph></paragraph><paragraph id="IDfa657b04ba24460aa279ea9fdaca3bd7"><enum>(4)</enum><header>Training</header>
						<subparagraph id="idAE335A30C2034EFB97C14D955E8BB311"><enum>(A)</enum><header>In
			 general</header><text>The Attorney General may establish national training
			 programs to support the mission of the ICAC task forces, including the
			 effective use of the National Internet Crimes Against Children Data
			 System.</text>
						</subparagraph><subparagraph id="id3B437165096B4BEA9F4D900CB196D393"><enum>(B)</enum><header>Limitation</header><text>In
			 establishing training courses under this paragraph, the Attorney General may
			 not award any one entity other than a law enforcement agency more than
			 $2,000,000 annually to establish and conduct training courses for ICAC task
			 force members and other law enforcement officials.</text>
						</subparagraph><subparagraph id="id19C8441E96894D4A8EE6C09311B54E37"><enum>(C)</enum><header>Review</header><text>The
			 Attorney General shall—</text>
							<clause id="id13F814288BDD41D7AB074564187E5A2C"><enum>(i)</enum><text>conduct periodic
			 reviews of the effectiveness of each training session authorized by this
			 paragraph; and</text>
							</clause><clause id="idE68FEA27C2B845B48C2FFD0EA75D6CD6"><enum>(ii)</enum><text>consider outside
			 reports related to the effective use of Federal funding in making future grant
			 awards for training.</text>
							</clause></subparagraph></paragraph></subsection></section><section id="H21F6964326194244941856B0CDD27EFE"><enum>103.</enum><header>Purpose of ICAC
			 task forces</header><text display-inline="no-display-inline">The ICAC Task
			 Force Program, and each State or local ICAC task force that is part of the
			 national program of task forces, shall be dedicated toward—</text>
				<paragraph id="HB55D17569CC045678DC5DBF53C6C409"><enum>(1)</enum><text>increasing the
			 investigative capabilities of State and local law enforcement officers in the
			 detection, investigation, and apprehension of Internet crimes against children
			 offenses or offenders, including technology-facilitated child exploitation
			 offenses;</text>
				</paragraph><paragraph id="HF9171BECA36F4A7C8CED8EBEE72A147"><enum>(2)</enum><text>conducting
			 proactive and reactive Internet crimes against children investigations;</text>
				</paragraph><paragraph id="H015CB50ECB8849598F99A2FD0068E8C8"><enum>(3)</enum><text>providing training
			 and technical assistance to ICAC task forces and other Federal, State, and
			 local law enforcement agencies in the areas of investigations, forensics,
			 prosecution, community outreach, and capacity-building, using recognized
			 experts to assist in the development and delivery of training programs;</text>
				</paragraph><paragraph id="HC5502FDEB7634241AF5567652E421033"><enum>(4)</enum><text>increasing the
			 number of Internet crimes against children offenses being investigated and
			 prosecuted in both Federal and State courts;</text>
				</paragraph><paragraph id="HE01BEBABC4504759B2794D55A6D45BE2"><enum>(5)</enum><text>creating a
			 multiagency task force response to Internet crimes against children offenses
			 within each State;</text>
				</paragraph><paragraph id="IDd45b9b64375c400fbe37d7651ec1ecda"><enum>(6)</enum><text>participating in
			 the Department of Justice’s Project Safe Childhood initiative, the purpose of
			 which is to combat technology-facilitated sexual exploitation crimes against
			 children;</text>
				</paragraph><paragraph id="H932E5FD0218D4C20AEC792F3FDB68CD8"><enum>(7)</enum><text>enhancing
			 nationwide responses to Internet crimes against children offenses, including
			 assisting other ICAC task forces, as well as other Federal, State, and local
			 agencies with Internet crimes against children investigations and
			 prosecutions;</text>
				</paragraph><paragraph id="HA4A6914A623C49F19DF90594D778582"><enum>(8)</enum><text>developing and
			 delivering Internet crimes against children public awareness and prevention
			 programs; and</text>
				</paragraph><paragraph id="HB500FEF323C84FA68552E1ABB6DA6C91"><enum>(9)</enum><text>participating in
			 such other activities, both proactive and reactive, that will enhance
			 investigations and prosecutions of Internet crimes against children.</text>
				</paragraph></section><section id="H9B673C6ED659429B90814C8EE3277ED3"><enum>104.</enum><header>Duties and
			 functions of task forces</header><text display-inline="no-display-inline">Each
			 State or local ICAC task force that is part of the national program of task
			 forces shall—</text>
				<paragraph id="H0B20BB2D10AD4E60B01B65BE39F4CC37"><enum>(1)</enum><text>consist of State
			 and local investigators, prosecutors, forensic specialists, and education
			 specialists who are dedicated to addressing the goals of such task
			 force;</text>
				</paragraph><paragraph id="H3748603476764109B8F638026C00995D"><enum>(2)</enum><text>work consistently
			 toward achieving the purposes described in section 103;</text>
				</paragraph><paragraph id="H41EA6F3931BA48219BD6653654928B7B"><enum>(3)</enum><text>engage in
			 proactive investigations, forensic examinations, and effective prosecutions of
			 Internet crimes against children;</text>
				</paragraph><paragraph id="HFD1ACA1AD2AF45D9A8720699224B25D9"><enum>(4)</enum><text>provide forensic,
			 preventive, and investigative assistance to parents, educators, prosecutors,
			 law enforcement, and others concerned with Internet crimes against
			 children;</text>
				</paragraph><paragraph id="H45C909B468C9452AB647981DE98B23D2"><enum>(5)</enum><text>develop
			 multijurisdictional, multiagency responses and partnerships to Internet crimes
			 against children offenses through ongoing informational, administrative, and
			 technological support to other State and local law enforcement agencies, as a
			 means for such agencies to acquire the necessary knowledge, personnel, and
			 specialized equipment to investigate and prosecute such offenses;</text>
				</paragraph><paragraph id="HBC1456D4269D4FB7BF64DF428E501E8E"><enum>(6)</enum><text>participate in
			 nationally coordinated investigations in any case in which the Attorney General
			 determines such participation to be necessary, as permitted by the available
			 resources of such task force;</text>
				</paragraph><paragraph id="HDF8D36D45BE6493B84DE01D1E58C02B"><enum>(7)</enum><text>establish or adopt
			 investigative and prosecution standards, consistent with established norms, to
			 which such task force shall comply;</text>
				</paragraph><paragraph id="HF37F047791414837A74FB725486E15DF"><enum>(8)</enum><text>investigate, and
			 seek prosecution on, tips related to Internet crimes against children,
			 including tips from Operation Fairplay, the National Internet Crimes Against
			 Children Data System established in section 105, the National Center for
			 Missing and Exploited Children’s CyberTipline, ICAC task forces, and other
			 Federal, State, and local agencies, with priority being given to investigative
			 leads that indicate the possibility of identifying or rescuing child victims,
			 including investigative leads that indicate a likelihood of seriousness of
			 offense or dangerousness to the community;</text>
				</paragraph><paragraph id="H5C63BE7413194BE5AEC6400A53E8088"><enum>(9)</enum><text>develop procedures
			 for handling seized evidence;</text>
				</paragraph><paragraph id="H35675AD7846140CDBEB70012215D7429"><enum>(10)</enum><text>maintain—</text>
					<subparagraph id="idCB1D13CF539A45D9AB02E2339011B3E4"><enum>(A)</enum><text>such reports and
			 records as are required under this title; and</text>
					</subparagraph><subparagraph id="id9EA1809E320C47B1B453F19D79CC1596"><enum>(B)</enum><text>such other
			 reports and records as determined by the Attorney General; and</text>
					</subparagraph></paragraph><paragraph id="H74016E7C00D34F6FB7B8646CF3C2D9DB"><enum>(11)</enum><text>seek to comply
			 with national standards regarding the investigation and prosecution of Internet
			 crimes against children, as set forth by the Attorney General, to the extent
			 such standards are consistent with the law of the State where the task force is
			 located.</text>
				</paragraph></section><section id="H01B52470AD1A4DC98BCF9949E5D64B90"><enum>105.</enum><header>National
			 Internet Crimes Against Children Data System</header>
				<subsection id="id417D6E23115E40EE8450929A835CC65C"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall establish, consistent with all
			 existing Federal laws relating to the protection of privacy, a National
			 Internet Crimes Against Children Data System. The system shall not be used to
			 search for or obtain any information that does not involve the use of the
			 Internet to facilitate child exploitation.</text>
				</subsection><subsection id="id841C6807CA73404A89D2965102320560"><enum>(b)</enum><header>Intent of
			 Congress</header><text>It is the purpose and intent of Congress that the
			 National Internet Crimes Against Children Data System established in subsection
			 (a) is intended to continue and build upon Operation Fairplay developed by the
			 Wyoming Attorney General’s office, which has established a secure, dynamic
			 undercover infrastructure that has facilitated online law enforcement
			 investigations of child exploitation, information sharing, and the capacity to
			 collect and aggregate data on the extent of the problems of child
			 exploitation.</text>
				</subsection><subsection id="idC7F84D83381345FFA98B208D72B2FF67"><enum>(c)</enum><header>Purpose of
			 system</header><text>The National Internet Crimes Against Children Data System
			 established under subsection (a) shall be dedicated to assisting and supporting
			 credentialed law enforcement agencies authorized to investigate child
			 exploitation in accordance with Federal, State, local, and tribal laws,
			 including by providing assistance and support to—</text>
					<paragraph id="ID2489ec5727a34df5be62822c007b04cd"><enum>(1)</enum><text>Federal agencies
			 investigating and prosecuting child exploitation;</text>
					</paragraph><paragraph id="ID4edb1049eb0f47f6ad8b5379d8e10a87"><enum>(2)</enum><text>the ICAC Task
			 Force Program established under section 102;</text>
					</paragraph><paragraph id="ID933100cb9b2d4a0ca0087e1e4d8ea0eb"><enum>(3)</enum><text>State, local, and
			 tribal agencies investigating and prosecuting child exploitation; and</text>
					</paragraph><paragraph id="idDD5D0F0BDC4A4AD194856C4FE58DFCA8"><enum>(4)</enum><text>foreign or
			 international law enforcement agencies, subject to approval by the Attorney
			 General.</text>
					</paragraph></subsection><subsection id="id80F94476F14F447C800155D4BE137918"><enum>(d)</enum><header>Cyber safe
			 deconfliction and information sharing</header><text>The National Internet
			 Crimes Against Children Data System established under subsection (a)—</text>
					<paragraph id="id5E0EF601DF3641AA821C915DCF4A7973"><enum>(1)</enum><text>shall be housed
			 and maintained within the Department of Justice or a credentialed law
			 enforcement agency;</text>
					</paragraph><paragraph id="id4943A8463D9A4CCB9CED95D6FBE7F4C8"><enum>(2)</enum><text>shall be made
			 available for a nominal charge to support credentialed law enforcement agencies
			 in accordance with subsection (c); and</text>
					</paragraph><paragraph id="ID9ffd058de7ca4199add726fdeac71e66"><enum>(3)</enum><text>shall—</text>
						<subparagraph id="idAE011F70B8B244B4991884F519AFF24F"><enum>(A)</enum><text>allow Federal,
			 State, local, and tribal agencies and ICAC task forces investigating and
			 prosecuting child exploitation to contribute and access data for use in
			 resolving case conflicts;</text>
						</subparagraph><subparagraph id="ID4f00bcb3b45b4242b76a16f86240db82"><enum>(B)</enum><text>provide, directly
			 or in partnership with a credentialed law enforcement agency, a dynamic
			 undercover infrastructure to facilitate online law enforcement investigations
			 of child exploitation;</text>
						</subparagraph><subparagraph id="ID719b36ec373d48079e23e380a6516ab9"><enum>(C)</enum><text>facilitate the
			 development of essential software and network capability for law enforcement
			 participants; and</text>
						</subparagraph><subparagraph id="ID77f005c8ad97435ebbaaecea7a4c27db"><enum>(D)</enum><text>provide software
			 or direct hosting and support for online investigations of child exploitation
			 activities, or, in the alternative, provide users with a secure connection to
			 an alternative system that provides such capabilities, provided that the system
			 is hosted within a governmental agency or a credentialed law enforcement
			 agency.</text>
						</subparagraph></paragraph></subsection><subsection id="id7498A08671A64A67BFB84516A726D902"><enum>(e)</enum><header>Collection and
			 reporting of data</header>
					<paragraph id="idE4A196A3F5144572A92D916493CC1244"><enum>(1)</enum><header>In
			 general</header><text>The National Internet Crimes Against Children Data System
			 established under subsection (a) shall ensure the following:</text>
						<subparagraph id="ID6602467d601146308b885f6fb847db40"><enum>(A)</enum><header>Real-time
			 reporting</header><text>All child exploitation cases involving local child
			 victims that are reasonably detectable using available software and data are,
			 immediately upon their detection, made available to participating law
			 enforcement agencies.</text>
						</subparagraph><subparagraph id="IDc9f85a51fb2d4972a92fad0a78cedd0a"><enum>(B)</enum><header>High-priority
			 suspects</header><text>Every 30 days, at minimum, the National Internet Crimes
			 Against Children Data System shall—</text>
							<clause id="id4024C8255F8840BDA8754C439DFBE2CC"><enum>(i)</enum><text>identify
			 high-priority suspects, as such suspects are determined by the volume of
			 suspected criminal activity or other indicators of seriousness of offense or
			 dangerousness to the community or a potential local victim; and</text>
							</clause><clause id="id186A64CFC9D74DF89C7594E7C29F247B"><enum>(ii)</enum><text>report all such
			 identified high-priority suspects to participating law enforcement
			 agencies.</text>
							</clause></subparagraph><subparagraph id="ID82ad914a6a284a019b9ca8b3274b70f5"><enum>(C)</enum><header>Annual
			 reports</header><text>Any statistical data indicating the overall magnitude of
			 child pornography trafficking and child exploitation in the United States and
			 internationally is made available and included in the National Strategy, as is
			 required under section 101(c)(16).</text>
						</subparagraph></paragraph><paragraph id="idAA62D7A82FAC486589578E2BA2CD2CD2"><enum>(2)</enum><header>Rule of
			 construction</header><text>Nothing in this subsection shall be construed to
			 limit the ability of participating law enforcement agencies to disseminate
			 investigative leads or statistical information in accordance with State and
			 local laws.</text>
					</paragraph></subsection><subsection id="id43AC50BEDF3D450C841243A0101FDC2C"><enum>(f)</enum><header>Mandatory
			 requirements of network</header><text>The National Internet Crimes Against
			 Children Data System established under subsection (a) shall develop, deploy,
			 and maintain an integrated technology and training program that
			 provides—</text>
					<paragraph id="ID82905fec439f4b2b9e6176ab86c18786"><enum>(1)</enum><text>a secure, online
			 system for Federal law enforcement agencies, ICAC task forces, and other State,
			 local, and tribal law enforcement agencies for use in resolving case conflicts,
			 as provided in subsection (d);</text>
					</paragraph><paragraph id="ID7efd1db083e04329bde69f9a94fee27c"><enum>(2)</enum><text>a secure system
			 enabling online communication and collaboration by Federal law enforcement
			 agencies, ICAC task forces, and other State, local, and tribal law enforcement
			 agencies regarding ongoing investigations, investigatory techniques, best
			 practices, and any other relevant news and professional information;</text>
					</paragraph><paragraph id="ID240451e3cddd4112a4ae8e15b48b04d1"><enum>(3)</enum><text>a secure online
			 data storage and analysis system for use by Federal law enforcement agencies,
			 ICAC task forces, and other State, local, and tribal law enforcement
			 agencies;</text>
					</paragraph><paragraph id="IDb05388f683e3453e80d025f6a1ff1dcb"><enum>(4)</enum><text>secure
			 connections or interaction with State and local law enforcement computer
			 networks, consistent with reasonable and established security protocols and
			 guidelines;</text>
					</paragraph><paragraph id="ID91e724cce8cb4b37b42fadda38aa5d29"><enum>(5)</enum><text>guidelines for
			 use of the National Internet Crimes Against Children Data System by Federal,
			 State, local, and tribal law enforcement agencies and ICAC task forces;
			 and</text>
					</paragraph><paragraph id="ID05bc96b0e3f1404589972451f02e1240"><enum>(6)</enum><text>training and
			 technical assistance on the use of the National Internet Crimes Against
			 Children Data System by Federal, State, local, and tribal law enforcement
			 agencies and ICAC task forces.</text>
					</paragraph></subsection><subsection id="H200E35BB42524826A126BFEF1FB2A3E6"><enum>(g)</enum><header>National
			 Internet Crimes Against Children Data System steering
			 committee</header><text>The Attorney General shall establish a National
			 Internet Crimes Against Children Data System Steering Committee to provide
			 guidance to the Network relating to the program under subsection (f), and to
			 assist in the development of strategic plans for the System. The Steering
			 Committee shall consist of 10 members with expertise in child exploitation
			 prevention and interdiction prosecution, investigation, or prevention,
			 including—</text>
					<paragraph id="H1EECDC2A6A6449AABCD2F71502579425"><enum>(1)</enum><text>3
			 representatives elected by the local directors of the ICAC task forces, such
			 representatives shall represent different geographic regions of the
			 country;</text>
					</paragraph><paragraph id="IDe280b7a28a204b108f6ea449b6bbbc9a"><enum>(2)</enum><text>1 representative
			 of the Department of Justice Office of Information Services;</text>
					</paragraph><paragraph id="id80EED333F6C64E689EB6C21391512E12"><enum>(3)</enum><text>1 representative
			 from Operation Fairplay, currently hosted at the Wyoming Office of the Attorney
			 General;</text>
					</paragraph><paragraph id="H2D5F006B8E69448BB975C0442750D22E"><enum>(4)</enum><text>1
			 representative from the law enforcement agency having primary responsibility
			 for hosting and maintaining the National Internet Crimes Against Children Data
			 System;</text>
					</paragraph><paragraph id="H53E24A45A0F1478DBEC12900553F7997"><enum>(5)</enum><text>1
			 representative of the Federal Bureau of Investigation’s Innocent Images
			 National Initiative or Regional Computer Forensic Lab program;</text>
					</paragraph><paragraph id="HC7DE2CF81ED843559916F43B2DE639E3"><enum>(6)</enum><text>1
			 representative of the Immigration and Customs Enforcement’s Cyber Crimes
			 Center;</text>
					</paragraph><paragraph id="HE62894D4FB804F7AA8D0BE6DBC19D2E"><enum>(7)</enum><text>1
			 representative of the United States Postal Inspection Service; and</text>
					</paragraph><paragraph id="H4BE10435BE42465C8647F6F6D4B01C00"><enum>(8)</enum><text>1
			 representative of the Department of Justice.</text>
					</paragraph></subsection><subsection id="HE912A284A6A843A6AAB933989B22B10"><enum>(h)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated for each
			 of the fiscal years 2009 through 2016, $2,000,000 to carry out the provisions
			 of this section.</text>
				</subsection></section><section id="HE2436CF1026F4E46A200F80042464D6D"><enum>106.</enum><header>ICAC grant
			 program</header>
				<subsection id="H9F3C84418F254A1BACD8C48047BBF7C1"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="H577358B2B4A04E028C7094895631004E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Attorney General
			 is authorized to award grants to State and local ICAC task forces to assist in
			 carrying out the duties and functions described under section 104.</text>
					</paragraph><paragraph id="HA752D80EF5A8443EA12D9FBC32192E17"><enum>(2)</enum><header>Formula
			 grants</header>
						<subparagraph id="H9EEFF045F2514FDC9400E9B944217541"><enum>(A)</enum><header>Development of
			 formula</header><text display-inline="yes-display-inline">At least 75 percent
			 of the total funds appropriated to carry out this section shall be available to
			 award or otherwise distribute grants pursuant to a funding formula established
			 by the Attorney General in accordance with the requirements in
			 <internal-xref idref="H62EB0C21BDDC4CAA90091165F4504CEC" legis-path="106.(a)(2)(B)">subparagraph (B)</internal-xref>.</text>
						</subparagraph><subparagraph id="H62EB0C21BDDC4CAA90091165F4504CEC"><enum>(B)</enum><header>Formula
			 requirements</header><text display-inline="yes-display-inline">Any formula
			 established by the Attorney General under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">subparagraph (A)</internal-xref> shall—</text>
							<clause id="HC9BDC0F5D0E044E6AB301575BD4D32C8"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that each State or local ICAC task
			 force shall, at a minimum, receive an amount equal to 0.5 percent of the funds
			 available to award or otherwise distribute grants under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">subparagraph (A)</internal-xref>; and</text>
							</clause><clause id="HFB34F42BA16746ADBDEE7495C2F3DE39"><enum>(ii)</enum><text>take into
			 consideration the following factors:</text>
								<subclause id="H49750386C9DB46CDBB837EB8F4086B4C"><enum>(I)</enum><text>The population of
			 each State, as determined by the most recent decennial census performed by the
			 Bureau of the Census.</text>
								</subclause><subclause id="H4F5E2AD89BEE4ABB908D10DBD2033CBC"><enum>(II)</enum><text>The number of
			 investigative leads within the applicant’s jurisdiction generated by Operation
			 Fairplay, the ICAC Data Network, the CyberTipline, and other sources.</text>
								</subclause><subclause id="H421908D53C974E64A29EAA20CB237E73"><enum>(III)</enum><text>The number of
			 criminal cases related to Internet crimes against children referred to a task
			 force for Federal, State, or local prosecution.</text>
								</subclause><subclause id="H8DF6D239011D4E86BCA2EAC88D3F71A7"><enum>(IV)</enum><text>The number of
			 successful prosecutions of child exploitation cases by a task force.</text>
								</subclause><subclause id="HA4B85C767062418F87F1FDE752B6983B"><enum>(V)</enum><text>The amount of
			 training, technical assistance, and public education or outreach by a task
			 force related to the prevention, investigation, or prosecution of child
			 exploitation offenses.</text>
								</subclause><subclause id="H53F541F66776494ABEF53D73595E3B05"><enum>(VI)</enum><text>Such other
			 criteria as the Attorney General determines demonstrate the level of need for
			 additional resources by a task force.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H1BB50AECFBC94DB8924C049000D122E0"><enum>(3)</enum><header>Distribution of
			 remaining funds based on need</header>
						<subparagraph id="H449894314FF64B5D8248D467178B234B"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any funds remaining
			 from the total funds appropriated to carry out this section after funds have
			 been made available to award or otherwise distribute formula grants under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">paragraph (2)(A)</internal-xref> shall be
			 distributed to State and local ICAC task forces based upon need, as set forth
			 by criteria established by the Attorney General. Such criteria shall include
			 the factors under
			 <internal-xref idref="HFB34F42BA16746ADBDEE7495C2F3DE39" legis-path="106.(a)(2)(B)(ii)">paragraph (2)(B)(ii)</internal-xref>.</text>
						</subparagraph><subparagraph id="HC09725B0C39F46D489CE8902B514F37"><enum>(B)</enum><header>Matching
			 requirement</header><text display-inline="yes-display-inline">A State or local
			 ICAC task force shall contribute matching non-Federal funds in an amount equal
			 to not less than 25 percent of the amount of funds received by the State or
			 local ICAC task force under
			 <internal-xref idref="H449894314FF64B5D8248D467178B234B" legis-path="106.(a)(3)(A)">subparagraph (A)</internal-xref>. A State or local
			 ICAC task force that is not able or willing to contribute matching funds in
			 accordance with this subparagraph shall not be eligible for funds under
			 <internal-xref idref="H449894314FF64B5D8248D467178B234B" legis-path="106.(a)(3)(A)">subparagraph (A)</internal-xref>.</text>
						</subparagraph><subparagraph id="id79BD819F77F8454DB18A3E62192C03C4"><enum>(C)</enum><header>Waiver</header><text>The
			 Attorney General may waive, in whole or in part, the matching requirement under
			 subparagraph (B) if the State or local ICAC task force demonstrates good cause
			 or financial hardship.</text>
						</subparagraph></paragraph></subsection><subsection id="HA3F8269482E64E2EA89DB0EBD8C5DA01"><enum>(b)</enum><header>Application</header>
					<paragraph id="HA7672C38EC424B3DB72FF9131202DC03"><enum>(1)</enum><header>In
			 general</header><text>Each State or local ICAC task force seeking a grant under
			 this section shall submit an application to the Attorney General at such time,
			 in such manner, and accompanied by such information as the Attorney General may
			 reasonably require.</text>
					</paragraph><paragraph id="HF544DB18C27A4D38854E851D0565C779"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted pursuant to paragraph (1) shall—</text>
						<subparagraph id="H36D6ED7C12B6479A83EB00550117C564"><enum>(A)</enum><text>describe the
			 activities for which assistance under this section is sought; and</text>
						</subparagraph><subparagraph id="HC8923BD506E1473D8300EC6176766259"><enum>(B)</enum><text>provide such
			 additional assurances as the Attorney General determines to be essential to
			 ensure compliance with the requirements of this title.</text>
						</subparagraph></paragraph></subsection><subsection id="HAC610608EDAB46259EED63E4C39600A1"><enum>(c)</enum><header>Allowable
			 Uses</header><text>Grants awarded under this section may be used to—</text>
					<paragraph id="HAE8292460CC1425DB55698DC76F02500"><enum>(1)</enum><text>hire personnel,
			 investigators, prosecutors, education specialists, and forensic
			 specialists;</text>
					</paragraph><paragraph id="HD4E0C978B7664531A209F8D2565937C5"><enum>(2)</enum><text>establish and
			 support forensic laboratories utilized in Internet crimes against children
			 investigations;</text>
					</paragraph><paragraph id="H7AC80AF327A7498B9884DE719D2D18F2"><enum>(3)</enum><text>support
			 investigations and prosecutions of Internet crimes against children;</text>
					</paragraph><paragraph id="H55570CDFE0544072BFDD9F13D34EA3FF"><enum>(4)</enum><text>conduct and assist
			 with education programs to help children and parents protect themselves from
			 Internet predators;</text>
					</paragraph><paragraph id="HFDEE77A290B14D5A8E53C64DB1BD7258"><enum>(5)</enum><text>conduct and attend
			 training sessions related to successful investigations and prosecutions of
			 Internet crimes against children; and</text>
					</paragraph><paragraph id="HD969F8F1B70143F4BE43FFEC529EB45"><enum>(6)</enum><text>fund any other
			 activities directly related to preventing, investigating, or prosecuting
			 Internet crimes against children.</text>
					</paragraph></subsection><subsection id="HCF81B93F81B94855B75DA162D89B9228"><enum>(d)</enum><header>Reporting
			 Requirements</header>
					<paragraph id="HEE91E7E914994F88001358F600C774EE"><enum>(1)</enum><header>ICAC
			 reports</header><text>To measure the results of the activities funded by grants
			 under this section, and to assist the Attorney General in complying with the
			 Government Performance and Results Act (<external-xref legal-doc="public-law" parsable-cite="pl/103/62">Public Law 103–62</external-xref>; 107 Stat. 285),
			 each State or local ICAC task force receiving a grant under this section shall,
			 on an annual basis, submit a report to the Attorney General that sets forth the
			 following:</text>
						<subparagraph id="H2B5B8CA1B92D4FA5B2F924119BA014D8"><enum>(A)</enum><text>Staffing levels of
			 the task force, including the number of investigators, prosecutors, education
			 specialists, and forensic specialists dedicated to investigating and
			 prosecuting Internet crimes against children.</text>
						</subparagraph><subparagraph id="H4DC37CB782F44A3DBFAA86B083D0C81F"><enum>(B)</enum><text>Investigation and
			 prosecution performance measures of the task force, including—</text>
							<clause id="HB0DDDD7F1D20410893B680C884F983A2"><enum>(i)</enum><text>the
			 number of investigations initiated related to Internet crimes against
			 children;</text>
							</clause><clause id="H28C2403466C8475AA0CBAA353F22C063"><enum>(ii)</enum><text>the
			 number of arrests related to Internet crimes against children; and</text>
							</clause><clause id="H8850A59D416D443485C16DBC74776673"><enum>(iii)</enum><text>the number of
			 prosecutions for Internet crimes against children, including—</text>
								<subclause id="H079188C986A148BCB3D2CD00DD57CA16"><enum>(I)</enum><text>whether the
			 prosecution resulted in a conviction for such crime; and</text>
								</subclause><subclause id="HBECBC79E53B441E0005D779B1C78388D"><enum>(II)</enum><text>the sentence and
			 the statutory maximum for such crime under State law.</text>
								</subclause></clause></subparagraph><subparagraph id="H980A06D5183040D489100016958B94F2"><enum>(C)</enum><text>The number of
			 referrals made by the task force to the United States Attorneys office,
			 including whether the referral was accepted by the United States
			 Attorney.</text>
						</subparagraph><subparagraph id="H017380C7503C4F5E919BFF800A836B1"><enum>(D)</enum><text>Statistics that
			 account for the disposition of investigations that do not result in arrests or
			 prosecutions, such as referrals to other law enforcement.</text>
						</subparagraph><subparagraph id="H5D50F72320FA4EE093D630C70966DFE"><enum>(E)</enum><text>The number of
			 investigative technical assistance sessions that the task force provided to
			 nonmember law enforcement agencies.</text>
						</subparagraph><subparagraph id="H623FDD21B6D4473400A5F8644FCA8203"><enum>(F)</enum><text>The number of
			 computer forensic examinations that the task force completed.</text>
						</subparagraph><subparagraph id="HEB1217F0CBD74781BEA63151F542FEEF"><enum>(G)</enum><text>The number of law
			 enforcement agencies participating in Internet crimes against children program
			 standards established by the task force.</text>
						</subparagraph></paragraph><paragraph id="H229DC7F6AF304DDBB485D7B42DFF1D14"><enum>(2)</enum><header>Report to
			 congress</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Attorney General shall submit a report to Congress on—</text>
						<subparagraph id="HB9CD52DAE40F4B818C32D2FD8F7DC92C"><enum>(A)</enum><text>the progress of
			 the development of the ICAC Task Force Program established under section 102;
			 and</text>
						</subparagraph><subparagraph id="HDC2BA7721CCE4ED99CDA40FEA7894A"><enum>(B)</enum><text>the number of
			 Federal and State investigations, prosecutions, and convictions in the prior
			 12-month period related to child exploitation.</text>
						</subparagraph></paragraph></subsection></section><section id="HC77EE830635544A7AC886B8390F2A508"><enum>107.</enum><header>Authorization
			 of appropriations</header>
				<subsection id="H676387854D2D4779AFDA88B3DFAFB612"><enum>(a)</enum><header>In
			 General</header><text>There are authorized to be appropriated to carry out this
			 title—</text>
					<paragraph id="H7B7F26368BBC4AA39FE8A84DCCEA8FA0"><enum>(1)</enum><text>$60,000,000 for
			 fiscal year 2009;</text>
					</paragraph><paragraph id="H0B33FDA1A14242E79E1B00D0B9DAABA5"><enum>(2)</enum><text>$60,000,000 for
			 fiscal year 2010;</text>
					</paragraph><paragraph id="H3138C335F2F949F386A271AA2EC6FE6C"><enum>(3)</enum><text>$60,000,000 for
			 fiscal year 2011;</text>
					</paragraph><paragraph id="H5FEEA33F66EA47599663E31F00004C7B"><enum>(4)</enum><text>$60,000,000 for
			 fiscal year 2012; and</text>
					</paragraph><paragraph id="H78E56D4C6E014B4BA8A94DCB00B28612"><enum>(5)</enum><text>$60,000,000 for
			 fiscal year 2013.</text>
					</paragraph></subsection><subsection id="H8225CEB3FF3949F5924B005394C830BF"><enum>(b)</enum><header>Availability</header><text>Funds
			 appropriated under subsection (a) shall remain available until expended.</text>
				</subsection></section></title><title id="id62BF4BE90D6C46AB85C1EDCAC63774AA"><enum>II</enum><header>ADDITIONAL
			 MEASURES TO COMBAT CHILD EXPLOITATION </header>
			<section id="HCC48CBE86D7E4D68B1DA40058D405085"><enum>201.</enum><header>Additional
			 regional computer forensic labs</header>
				<subsection id="H0827F49E9C5441C39737DE30B6B256FC"><enum>(a)</enum><header>Additional
			 Resources</header><text>The Attorney General shall establish additional
			 computer forensic capacity to address the current backlog for computer
			 forensics, including for child exploitation investigations. The Attorney
			 General may utilize funds under this title to increase capacity at existing
			 regional forensic laboratories or to add laboratories under the Regional
			 Computer Forensic Laboratories Program operated by the Federal Bureau of
			 Investigation.</text>
				</subsection><subsection id="H7733EDDF10204A59A80785B571D386B1"><enum>(b)</enum><header>Purpose of New
			 Resources</header><text>The additional forensic capacity established by
			 resources provided under this section shall be dedicated to assist Federal
			 agencies, State and local Internet Crimes Against Children task forces, and
			 other Federal, State, and local law enforcement agencies in preventing,
			 investigating, and prosecuting Internet crimes against children.</text>
				</subsection><subsection id="idD9216AC5878F4D0A82B255B71520FA5E"><enum>(c)</enum><header>New Computer
			 Forensic labs</header><text>If the Attorney General determines that new
			 regional computer forensic laboratories are required under subsection (a) to
			 best address existing backlogs, such new laboratories shall be established
			 pursuant to subsection (d).</text>
				</subsection><subsection id="H1C7F9D1B25244311A4BFEE934B5BB1F"><enum>(d)</enum><header>Location of New
			 Labs</header><text>The location of any new regional computer forensic
			 laboratories under this section shall be determined by the Attorney General, in
			 consultation with the Director of the Federal Bureau of Investigation, the
			 Regional Computer Forensic Laboratory National Steering Committee, and other
			 relevant stakeholders.</text>
				</subsection><subsection id="H41020E9651B643BCA5341FE798AF09A3"><enum>(e)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and every year
			 thereafter, the Attorney General shall submit a report to the Congress on how
			 the funds appropriated under this section were utilized.</text>
				</subsection><subsection id="H8EBA01C12976474B9068926CD6926F72"><enum>(f)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated for fiscal
			 years 2009 through 2013, $2,000,000 to carry out the provisions of this
			 section.</text>
				</subsection></section></title><title id="idCF584731891E4D6794E6ABC79B951031"><enum>III</enum><header>Effective child
			 pornography prosecution</header>
			<section id="id28BA7F645DA449B78ADE91AB48174C17" section-type="subsequent-section"><enum>301.</enum><header>Prohibit the
			 broadcast of live images of child abuse</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2251">Section 2251</external-xref> of title 18, United States Code
			 is amended—</text>
				<paragraph id="ID46ec584e33f846e1bc57e2b9ce7799da"><enum>(1)</enum><text>in subsection
			 (a), by—</text>
					<subparagraph id="idA7543B4D7FF54E1FB0003903F3EA1E23"><enum>(A)</enum><text>inserting
			 <quote>or for the purpose of transmitting a live visual depiction of such
			 conduct</quote> after <quote>for the purpose of producing any visual depiction
			 of such conduct</quote>;</text>

			 Code, is amended by—</text>

			 the adaptation or modification of an image of an identifiable minor to produce
			 child pornography</header>
				<subsection id="id7C9F1D9ABF0144E5879B15452024FC7A"><enum>(a)</enum><header>Offense</header><text>Subsection
			 (a) of <external-xref legal-doc="usc" parsable-cite="usc/18/2252A">section 2252A</external-xref> of title 18, United States Code, is amended—</text>

					</paragraph></subsection><subsection id="idF909FAAB3B7D40B38DFB324E237BFBED"><enum>(b)</enum><header>Punishment</header><text>Subsection
			 (b) of <external-xref legal-doc="usc" parsable-cite="usc/18/2252A">section 2252A</external-xref> of title 18, United States Code, is amended by adding at
			 the end the following:</text>

						<paragraph id="id2288F391CCDD4438A17E91C31A0706B4"><enum>(3)</enum><text>Whoever violates,
				or attempts or conspires to violate, subsection (a)(7) shall be fined under

				</subsection></section></title><title id="idD1721753EE22425F8B0CA0AD394E46EE"><enum>IV</enum><header>National
			 Institute of Justice Study of Risk Factors</header>
			<section id="ID15c8fe336eb443a38f6c801fc433299c"><enum>401.</enum><header>NIJ study of
			 risk factors for assessing dangerousness</header>
				<subsection id="ID67039e8bf67146409509e8cfe39eb884"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the National Institute of Justice shall prepare a report to identify
			 investigative factors that reliably indicate whether a subject of an online
			 child exploitation investigation poses a high risk of harm to children. Such a
			 report shall be prepared in consultation and coordination with Federal law
			 enforcement agencies, the National Center for Missing and Exploited Children,
			 Operation Fairplay at the Wyoming Attorney General's Office, the Internet
			 Crimes Against Children Task Force, and other State and local law
			 enforcement.</text>
				</subsection><subsection id="ID41fee81b9bf04a89a66bda57f191554f"><enum>(b)</enum><header>Contents of
			 analysis</header><text>The report required by subsection (a) shall include a
			 thorough analysis of potential investigative factors in on-line child
			 exploitation cases and an appropriate examination of investigative data from
			 prior prosecutions and case files of identified child victims.</text>
				</subsection><subsection id="idD000D3C2D0A849FDAD225AC5A29C9690"><enum>(c)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than 1
			 year after the date of enactment of this Act, the National Institute of Justice
			 shall submit a report to the House and Senate Judiciary Committees that
			 includes the findings of the study required by this section and makes
			 recommendations on technological tools and law enforcement procedures to help
			 investigators prioritize scarce resources to those cases where there is actual
			 hands-on abuse by the suspect.</text>
				</subsection><subsection id="idDB91912AA8B14927B2902873E98178FD"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated $500,000 to the National Institute of Justice to
			 conduct the study required under this section.</text>
				</subsection></section></title><title id="idE49010130AAA4D6C874939488508EBBA"><enum>V</enum><header>Securing
			 Adolescents From Online Exploitation</header>
			<section id="IDbdec1d3b52b942758b8a54fb46da78af"><enum>501.</enum><header>Reporting
			 requirements of electronic communication service providers and remote computing
			 service providers</header>
				<subsection id="ID1986b35ae05842c7a804cc571d5a40de"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended
			 by inserting after section 2258 the following:</text>

				communication service or a remote computing service to the public through a
				facility or means of interstate or foreign commerce, obtains actual knowledge
				of any facts or circumstances described in paragraph (2) shall, as soon as
				reasonably possible—</text>
									<subparagraph id="IDc48abc2f17404333aca932d17036a8da"><enum>(A)</enum><text>provide to the
				CyberTipline of the National Center for Missing and Exploited Children, or any
				successor to the CyberTipline operated by such center, the mailing address,
				telephone number, facsimile number, electronic mail address of, and individual
				point of contact for, such electronic communication service provider or remote
				computing service provider; and</text>
									</subparagraph><subparagraph id="ID5221dd6abc7e4082832d83f969d227fb"><enum>(B)</enum><text>make a report of
				such facts or circumstances to the CyberTipline, or any successor to the
				CyberTipline operated by such center.</text>
									</subparagraph></paragraph><paragraph id="ID7fca86441c52450787f2a6c6a3e22c5f"><enum>(2)</enum><header>Facts or
				circumstances</header><text>The facts or circumstances described in this
				paragraph are any facts or circumstances from which there is an apparent
				violation of—</text>
									<subparagraph id="id74BB4730212C408090B9946DD2696417"><enum>(A)</enum><text>section 2251,
				2251A, 2252, 2252A, 2252B, or 2260 that involves child pornography; or</text>
									</subparagraph><subparagraph id="id0420FAA41DEF4478A58AAFD4540EE8B6"><enum>(B)</enum><text>section
				1466A.</text>
									</subparagraph></paragraph></subsection><subsection id="ID312755dd9f25444d8708ace10a58b3fd"><enum>(b)</enum><header>Contents of
				report</header><text>To the extent the information is within the custody or
				control of an electronic communication service provider or a remote computing
				service provider, the facts and circumstances included in each report under
				subsection (a)(1) may include the following information:</text>
								<paragraph id="ID812264b9c53449408cc6ba0dd0bf2ccb"><enum>(1)</enum><header>Information
				about the involved individual</header><text>Information relating to the
				identity of any individual who appears to have violated a Federal law described
				in subsection (a)(2), which may, to the extent reasonably practicable, include
				the electronic mail address, Internet Protocol address, uniform resource
				locator, or any other identifying information, including self-reported
				identifying information.</text>
								</paragraph><paragraph id="ID85d9edb0893e43b690b8915c6fd0059e"><enum>(2)</enum><header>Historical
				reference</header><text>Information relating to when and how a customer or
				subscriber of an electronic communication service or a remote computing service
				uploaded, transmitted, or received apparent child pornography or when and how
				apparent child pornography was reported to, or discovered by the electronic
				communication service provider or remote computing service provider, including
				a date and time stamp and time zone.</text>
								</paragraph><paragraph id="ID2d5dec921cab41b6af9985500d00fed2"><enum>(3)</enum><header>Geographic
				location information</header>
									<subparagraph id="id83A39D9B80B94F97BDD410BA082EDC0F"><enum>(A)</enum><header>In
				general</header><text>Information relating to the geographic location of the
				involved individual or website, which may include the Internet Protocol address
				or verified billing address, or, if not reasonably available, at least 1 form
				of geographic identifying information, including area code or zip code.</text>
									</subparagraph><subparagraph id="id03B47509BC694A65B72349BB1315650D"><enum>(B)</enum><header>Inclusion</header><text>The
				information described in subparagraph (A) may also include any geographic
				information provided to the electronic communication service or remote
				computing service by the customer or subscriber.</text>
									</subparagraph></paragraph><paragraph id="ID0e18a3f55f784fe6b15d26dc96abad73"><enum>(4)</enum><header>Images of
				apparent child pornography</header><text>Any image of apparent child
				pornography relating to the incident such report is regarding.</text>
								</paragraph><paragraph id="IDbba3b922c2a34d0ea638163b4b793696"><enum>(5)</enum><header>Complete
				communication</header><text>The complete communication containing any image of
				apparent child pornography, including—</text>
									<subparagraph id="idA1DCF518097F41C1AB334611928CEFB9"><enum>(A)</enum><text>any data or
				information regarding the transmission of the communication; and</text>
									</subparagraph><subparagraph id="id28E189B984BA4F30B64CD091A286B2F5"><enum>(B)</enum><text>any images, data,
				or other digital files contained in, or attached to, the communication.</text>
									</subparagraph></paragraph></subsection><subsection id="ID7a2020e04fb24281bb53f39fe13eba29"><enum>(c)</enum><header>Forwarding of
				report to law enforcement</header>
								<paragraph id="ID1b42725582a2480dbb17a42c7da0f1f6"><enum>(1)</enum><header>In
				general</header><text>The National Center for Missing and Exploited Children
				shall forward each report made under subsection (a)(1) to any appropriate law
				enforcement agency designated by the Attorney General under subsection
				(d)(2).</text>
								</paragraph><paragraph id="ID56a896108a994cd7ba1e1ecb63874714"><enum>(2)</enum><header>State and local
				law enforcement</header><text>The National Center for Missing and Exploited
				Children may forward any report made under subsection (a)(1) to an appropriate
				law enforcement official of a State or political subdivision of a State for the
				purpose of enforcing State criminal law.</text>
								</paragraph><paragraph id="IDd895ae84b6fa49e4840895d09054eff8"><enum>(3)</enum><header>Foreign law
				enforcement</header>
									<subparagraph id="id0A1E545E9408445EB9753CA6799344B1"><enum>(A)</enum><header>In
				general</header><text>The National Center for Missing and Exploited Children
				may forward any report made under subsection (a)(1) to any appropriate foreign
				law enforcement agency designated by the Attorney General under subsection
				(d)(3), subject to the conditions established by the Attorney General under
				subsection (d)(3).</text>
									</subparagraph><subparagraph id="id83045FEAC3DA4F768B7EC425344315B1"><enum>(B)</enum><header>Transmittal to
				designated Federal agencies</header><text>If the National Center for Missing
				and Exploited Children forwards a report to a foreign law enforcement agency
				under subparagraph (A), the National Center for Missing and Exploited Children
				shall concurrently provide a copy of the report and the identity of the foreign
				law enforcement agency to—</text>
										<clause id="idB2F5E9B557484493A31B0260CDB778B3"><enum>(i)</enum><text>the Attorney
				General; or</text>
										</clause><clause id="id583DC3319FD241268CF9954D4772E0AC"><enum>(ii)</enum><text>the Federal law
				enforcement agency or agencies designated by the Attorney General under
				subsection (d)(2).</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID99f17566e4f948cbb499defdbf1bed1a"><enum>(d)</enum><header>Attorney
				general responsibilities</header>
								<paragraph id="IDda43785abc334754953a1a3acce7937a"><enum>(1)</enum><header>In
				general</header><text>The Attorney General shall enforce this section.</text>
								</paragraph><paragraph id="IDec6fcc805d794e3f885e2fab5a968ad5"><enum>(2)</enum><header>Designation of
				Federal agencies</header><text>The Attorney General shall designate promptly
				the Federal law enforcement agency or agencies to which a report shall be
				forwarded under subsection (c)(1).</text>
								</paragraph><paragraph id="ID7f475a456a5a481c9dda9531750fcb64"><enum>(3)</enum><header>Designation of
				foreign agencies</header><text>The Attorney General shall promptly—</text>
									<subparagraph id="ID5102cc94ff1543e39540e489ef5254a2"><enum>(A)</enum><text>in consultation
				with the Secretary of State, designate the foreign law enforcement agencies to
				which a report may be forwarded under subsection (c)(3);</text>
									</subparagraph><subparagraph id="IDdf36c1c6ea9943418d109dbf56fbae15"><enum>(B)</enum><text>establish the
				conditions under which such a report may be forwarded to such agencies;
				and</text>
									</subparagraph><subparagraph id="ID4d3c32cfce184894b81ab2f876b88111"><enum>(C)</enum><text>develop a process
				for foreign law enforcement agencies to request assistance from Federal law
				enforcement agencies in obtaining evidence related to a report referred under
				subsection (c)(3).</text>
									</subparagraph></paragraph><paragraph id="ID02df0ca8132b4833ab77af8e8be3d036"><enum>(4)</enum><header>Reporting
				designated foreign agencies</header><text>The Attorney General shall maintain
				and make available to the Department of State, the National Center for Missing
				and Exploited Children, electronic communication service providers, remote
				computing service providers, the Committee on the Judiciary of the Senate, and
				the Committee on the Judiciary of the House of Representatives a list of the
				foreign law enforcement agencies designated under paragraph (3).</text>
								</paragraph><paragraph id="IDcfeb025dfdab4c1e811ff4cf894db573"><enum>(5)</enum><header>Sense of
				congress regarding designation of foreign agencies</header><text>It is the
				sense of Congress that—</text>
									<subparagraph id="id0FABFDF52CF44224A95ABF8D34D559D2"><enum>(A)</enum><text>combating the
				international manufacturing, possession, and trade in online child pornography
				requires cooperation with competent, qualified, and appropriately trained
				foreign law enforcement agencies; and</text>
									</subparagraph><subparagraph id="idF6622F5F5E374827B17E283969E79D01"><enum>(B)</enum><text>the Attorney
				General, in cooperation with the Secretary of State, should make a substantial
				effort to expand the list of foreign agencies designated under paragraph
				(3).</text>
									</subparagraph></paragraph><paragraph id="ID68c37f1d00b14f9f878cc257b92d61ed"><enum>(6)</enum><header>Notification to
				providers</header><text>If an electronic communication service provider or
				remote computing service provider notifies the National Center for Missing and
				Exploited Children that the electronic communication service provider or remote
				computing service provider is making a report under this section as the result
				of a request by a foreign law enforcement agency, the National Center for
				Missing and Exploited Children shall—</text>
									<subparagraph id="id354A83C1FFA64609913C97DBC8CD357C"><enum>(A)</enum><text>if the Center
				forwards the report to the requesting foreign law enforcement agency or another
				agency in the same country designated by the Attorney General under paragraph
				(3), notify the electronic communication service provider or remote computing
				service provider of—</text>
										<clause id="id3BC21B83F11D48CEA35A7EE0034C1E4E"><enum>(i)</enum><text>the identity of
				the foreign law enforcement agency to which the report was forwarded;
				and</text>
										</clause><clause id="idD44BCD5E9DFD4248A29B48F9C40670F2"><enum>(ii)</enum><text>the date on
				which the report was forwarded; or</text>
										</clause></subparagraph><subparagraph id="ID4ad10738ff784d188728ca0ca8e61f2f"><enum>(B)</enum><text>notify the
				electronic communication service provider or remote computing service provider
				if the Center declines to forward the report because the Center, in
				consultation with the Attorney General, determines that no law enforcement
				agency in the foreign country has been designated by the Attorney General under
				paragraph (3).</text>
									</subparagraph></paragraph></subsection><subsection id="ID17c8dc7dc0f94512bb93e20674fd6d36"><enum>(e)</enum><header>Failure To
				report</header><text>An electronic communication service provider or remote
				computing service provider that knowingly and willfully fails to make a report
				required under subsection (a)(1) shall be fined—</text>
								<paragraph id="IDe2aa7e7905dc4b31b99c183c6407cefe"><enum>(1)</enum><text>in the case of an
				initial knowing and willful failure to make a report, not more than $150,000;
				and</text>
								</paragraph><paragraph id="IDa6b45481b3bb4d93a5b1e91df54a7f57"><enum>(2)</enum><text>in the case of
				any second or subsequent knowing and willful failure to make a report, not more
				than $300,000.</text>
								</paragraph></subsection><subsection id="ID24da85828f594252aed1207768dfda58"><enum>(f)</enum><header>Protection of
				privacy</header><text>Nothing in this section shall be construed to require an
				electronic communication service provider or a remote computing service
				provider to—</text>
								<paragraph id="IDee78d3308b5647e8bafecb68c16c7ec1"><enum>(1)</enum><text>monitor any user,
				subscriber, or customer of that provider;</text>
								</paragraph><paragraph id="ID9d8ae16399184a60b313ed139a9d3401"><enum>(2)</enum><text>monitor the
				content of any communication of any person described in paragraph (1);
				or</text>
								</paragraph><paragraph id="ID546c23b778f34f22bc8aaffac60a4343"><enum>(3)</enum><text>affirmatively
				seek facts or circumstances described in sections (a) and (b).</text>
								</paragraph></subsection><subsection id="ID69e97bd2e340419aaad072fc7ecefd60"><enum>(g)</enum><header>Conditions of
				disclosure information contained within report</header>
								<paragraph id="IDcca496a783464d3e9c52bfff9ddec092"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), a law enforcement
				agency that receives a report under subsection (c) shall not disclose any
				information contained in that report.</text>
								</paragraph><paragraph id="ID82e180ce19464882b063e1fc7e5e4c5a"><enum>(2)</enum><header>Permitted
				disclosures by law enforcement</header>
									<subparagraph id="id31A74F0B1F2D4737B051459933A3DE02"><enum>(A)</enum><header>In
				general</header><text>A law enforcement agency may disclose information in a
				report received under subsection (c)—</text>
										<clause id="IDc8198c38fd28489bab056694b0226212"><enum>(i)</enum><text>to an attorney
				for the government for use in the performance of the official duties of that
				attorney;</text>
										</clause><clause id="ID885dc41968a546329c13dae6d9773d09"><enum>(ii)</enum><text>to such officers
				and employees of that law enforcement agency, as may be necessary in the
				performance of their investigative and recordkeeping functions;</text>
										</clause><clause id="IDa3d1159c24bf4fe69bfef3058d4ca407"><enum>(iii)</enum><text>to such other
				government personnel (including personnel of a State or subdivision of a State)
				as are determined to be necessary by an attorney for the government to assist
				the attorney in the performance of the official duties of the attorney in
				enforcing Federal criminal law;</text>
										</clause><clause id="ID37923aebf7384113b0dfc002712fb7bf"><enum>(iv)</enum><text>if the report
				discloses a violation of State criminal law, to an appropriate official of a
				State or subdivision of a State for the purpose of enforcing such State
				law;</text>
										</clause><clause id="ID3faaec82b3594e819c822e251db1c1f6"><enum>(v)</enum><text>to a defendant in
				a criminal case or the attorney for that defendant, subject to the terms and
				limitations under section 3509(m) or a similar State law, to the extent the
				information relates to a criminal charge pending against that defendant;</text>
										</clause><clause id="IDecf33b04961e4abd9e388662b0135f76"><enum>(vi)</enum><text>subject to
				subparagraph (B), to an electronic communication service provider or remote
				computing provider if necessary to facilitate response to legal process issued
				in connection to a criminal investigation, prosecution, or post-conviction
				remedy relating to that report; and</text>
										</clause><clause id="ID0e696c39d6f64a1584aba2ee87e1ac12"><enum>(vii)</enum><text>as ordered by a
				court upon a showing of good cause and pursuant to any protective orders or
				other conditions that the court may impose.</text>
										</clause></subparagraph><subparagraph id="idA4281715CC52457280A3DEC3D2DB1C60"><enum>(B)</enum><header>Limitations</header>
										<clause id="id149E19AFC8A54DECB0FD254A1D950627"><enum>(i)</enum><header>Limitations on
				further disclosure</header><text>The electronic communication service provider
				or remote computing service provider shall be prohibited from disclosing the
				contents of a report provided under subparagraph (A)(vi) to any person, except
				as necessary to respond to the legal process.</text>
										</clause><clause id="id6BE456988059495AB8C86C0ED690C0AA"><enum>(ii)</enum><header>Effect</header><text>Nothing
				in subparagraph (A)(vi) authorizes a law enforcement agency to provide child
				pornography images to an electronic communications service provider or a remote
				computing service.</text>
										</clause></subparagraph></paragraph><paragraph id="ID452eac2071c24277960a28e283be7ffe"><enum>(3)</enum><header>Permitted
				disclosures by the national center for missing and exploited
				children</header><text>The National Center for Missing and Exploited Children
				may disclose information received in a report under subsection (a) only—</text>
									<subparagraph id="ID5cfaa7d14ff643e6b7afbe02da079d7f"><enum>(A)</enum><text>to any Federal
				law enforcement agency designated by the Attorney General under subsection
				(d)(2);</text>
									</subparagraph><subparagraph id="ID3d6a66eaa7ce41e0bd55989ff70d92e7"><enum>(B)</enum><text>to any State,
				local, or tribal law enforcement agency involved in the investigation of child
				pornography, child exploitation, kidnapping, or enticement crimes;</text>
									</subparagraph><subparagraph id="ID5bd1c78f60c547dbbd70aaebbc487341"><enum>(C)</enum><text>to any foreign
				law enforcement agency designated by the Attorney General under subsection
				(d)(3); and</text>
									</subparagraph><subparagraph id="ID8b35f02c577040009842d61367c94b2d"><enum>(D)</enum><text>to an electronic
				communication service provider or remote computing service provider as
				described in section 2258C.</text>
									</subparagraph></paragraph></subsection><subsection id="ID93a9e95433e54a16a36e1b68c38d7982"><enum>(h)</enum><header>Preservation</header>
								<paragraph id="IDdd902306938046c8ac111117c3555ff1"><enum>(1)</enum><header>In
				general</header><text>For the purposes of this section, the notification to an
				electronic communication service provider or a remote computing service
				provider by the CyberTipline of receipt of a report under subsection (a)(1)
				shall be treated as a request to preserve, as if such request was made pursuant
				to section 2703(f).</text>
								</paragraph><paragraph id="ID76edacc76fdf445093bd6a4043fc4806"><enum>(2)</enum><header>Preservation of
				report</header><text>Pursuant to paragraph (1), an electronic communication
				service provider or a remote computing service shall preserve the contents of
				the report provided pursuant to subsection (b) for 90 days after such
				notification by the CyberTipline.</text>
								</paragraph><paragraph id="ID6f9b287b4f10447d834d444bcb74bde5"><enum>(3)</enum><header>Preservation of
				commingled images</header><text>Pursuant to paragraph (1), an electronic
				communication service provider or a remote computing service shall preserve any
				images, data, or other digital files that are commingled or interspersed among
				the images of apparent child pornography within a particular communication or
				user-created folder or directory.</text>
								</paragraph><paragraph id="ID4e58d8c64b42499d9eb5eddaf1150c1d"><enum>(4)</enum><header>Protection of
				preserved materials</header><text>An electronic communications service or
				remote computing service preserving materials under this section shall maintain
				the materials in a secure location and take appropriate steps to limit access
				by agents or employees of the service to the materials to that access necessary
				to comply with the requirements of this subsection.</text>
								</paragraph><paragraph id="ID1b7ee22b7214432eae3f20697a006f17"><enum>(5)</enum><header>Authorities and
				duties not affected</header><text>Nothing in this section shall be construed as
				replacing, amending, or otherwise interfering with the authorities and duties
				under section 2703.</text>
								</paragraph></subsection></section><section id="ID495b506ddd654810841c894aaa968c66"><enum>2258B.</enum><header>Limited
				liability for electronic communication service providers, remote computing
				service providers, or domain name registrar</header>
							<subsection id="ID452991f1258746dd99c466643a855aea"><enum>(a)</enum><header>In
				general</header><text>Except as provided in subsection (b), a civil claim or
				criminal charge against an electronic communication service provider, a remote
				computing service provider, or domain name registrar, including any director,
				officer, employee, or agent of such electronic communication service provider,
				remote computing service provider, or domain name registrar arising from the
				performance of the reporting or preservation responsibilities of such
				electronic communication service provider, remote computing service provider,
				or domain name registrar under this section, section 2258A, or section 2258C
				may not be brought in any Federal or State court.</text>
							</subsection><subsection id="IDc11a9ddba51646fbbce32669409ddd03"><enum>(b)</enum><header>Intentional,
				reckless, or other misconduct</header><text>Subsection (a) shall not apply to a
				claim if the electronic communication service provider, remote computing
				service provider, or domain name registrar, or a director, officer, employee,
				or agent of that electronic communication service provider, remote computing
				service provider, or domain name registrar—</text>
								<paragraph id="ID2f6924f7e22c4db4a35e79cb839cf7cd"><enum>(1)</enum><text>engaged in
				intentional misconduct; or</text>
								</paragraph><paragraph id="IDc624615af548454fa0039376146a27f9"><enum>(2)</enum><text>acted, or failed
				to act—</text>
									<subparagraph id="ID446d5d65c7c349b0a09f17cf089d2da4"><enum>(A)</enum><text>with actual
				malice;</text>
									</subparagraph><subparagraph id="IDdd2b390754b644d981636f9a5fa09737"><enum>(B)</enum><text>with reckless
				disregard to a substantial risk of causing physical injury without legal
				justification; or</text>
									</subparagraph><subparagraph id="ID78d46514b70a4fd5a590caa2bebf2fe9"><enum>(C)</enum><text>for a purpose
				unrelated to the performance of any responsibility or function under this
				section, sections 2258A, 2258C, 2702, or 2703.</text>
									</subparagraph></paragraph></subsection><subsection id="ID88829d829d24453a8646f2779d9cdd4d"><enum>(c)</enum><header>Minimizing
				access</header><text>An electronic communication service provider, a remote
				computing service provider, and domain name registrar shall—</text>
								<paragraph id="ID66958e23b72d46f9b53f8642f5ec11e8"><enum>(1)</enum><text>minimize the
				number of employees that are provided access to any image provided under
				section 2258A or 2258C; and</text>
								</paragraph><paragraph id="ID52f7ff40d7ad4a8fa2b41f68bd36ccc6"><enum>(2)</enum><text>ensure that any
				such image is permanently destroyed, upon a request from a law enforcement
				agency to destroy the image.</text>
								</paragraph></subsection></section><section id="IDbfd60a99578d4ebba2f76aa767f9aa16"><enum>2258C.</enum><header>Use to
				combat child pornography of technical elements relating to images reported to
				the CyberTipline</header>
							<subsection id="ID6929651bbf0b408b842381789ddb3b2f"><enum>(a)</enum><header>Elements</header>
								<paragraph id="id3A7E4934EFE14BF388E69D5BAF73131C"><enum>(1)</enum><header>In
				general</header><text>The National Center for Missing and Exploited Children
				may provide elements relating to any apparent child pornography image of an
				identified child to an electronic communication service provider or a remote
				computing service provider for the sole and exclusive purpose of permitting
				that electronic communication service provider or remote computing service
				provider to stop the further transmission of images.</text>
								</paragraph><paragraph id="id2813B902D41F488F933CD63217393C44"><enum>(2)</enum><header>Inclusions</header><text>The
				elements authorized under paragraph (1) may include hash values or other unique
				identifiers associated with a specific image, Internet location of images, and
				other technological elements that can be used to identify and stop the
				transmission of child pornography.</text>
								</paragraph><paragraph id="id1F9B7A29090D469A9C7CAB706D03E8DB"><enum>(3)</enum><header>Exclusion</header><text>The
				elements authorized under paragraph (1) may not include the actual
				images.</text>
								</paragraph></subsection><subsection id="ID4caf8ea321434d909239ae250cffbcb8"><enum>(b)</enum><header>Use by
				electronic communication service providers and remote computing service
				providers</header><text>Any electronic communication service provider or remote
				computing service provider that receives elements relating to any apparent
				child pornography image of an identified child from the National Center for
				Missing and Exploited Children under this section may use such information only
				for the purposes described in this section, provided that such use shall not
				relieve that electronic communication service provider or remote computing
				service provider from its reporting obligations under section 2258A.</text>
							</subsection><subsection id="ID685274a0667a4afa9d344c690ab4dec4"><enum>(c)</enum><header>Limitations</header><text>Nothing
				in subsections (a) or (b) requires electronic communication service providers
				or remote computing service providers receiving elements relating to any
				apparent child pornography image of an identified child from the National
				Center for Missing and Exploited Children to use the elements to stop the
				further transmission of the images.</text>
							</subsection><subsection id="IDf25681fa7edb4b108c802fff36fb5ee4"><enum>(d)</enum><header>Provision of
				elements to law enforcement</header><text>The National Center for Missing and
				Exploited Children shall make available to Federal, State, and local law
				enforcement involved in the investigation of child pornography crimes elements,
				including hash values, relating to any apparent child pornography image of an
				identified child reported to the National Center for Missing and Exploited
				Children.</text>
							</subsection><subsection id="ID5cf351c8fc7b41f2ba00b30665c5d73b"><enum>(e)</enum><header>Use by law
				enforcement</header><text>Any Federal, State, or local law enforcement agency
				that receives elements relating to any apparent child pornography image of an
				identified child from the National Center for Missing and Exploited Children
				under section (d) may use such elements only in the performance of the official
				duties of that agency to investigate child pornography crimes.</text>
							</subsection></section><section id="ID771361c9d371492b917116939eb0a37f"><enum>2258D.</enum><header>Limited
				liability for the National Center for Missing and Exploited Children</header>
							<subsection id="ID7f96c9fb405342f39db86f145b12ec01"><enum>(a)</enum><header>In
				general</header><text>Except as provided in subsections (b) and (c), a civil
				claim or criminal charge against the National Center for Missing and Exploited
				Children, including any director, officer, employee, or agent of such center,
				arising from the performance of the CyberTipline responsibilities or functions
				of such center, as described in this section, section 2258A or 2258C of this
				title, or section 404 of the Missing Children's Assistance Act (42 U.S.C.
				5773), or from the effort of such center to identify child victims may not be
				brought in any Federal or State court.</text>
							</subsection><subsection id="ID284d5db3b2644e159e91075d7df98c57"><enum>(b)</enum><header>Intentional,
				reckless, or other misconduct</header><text>Subsection (a) shall not apply to a
				claim or charge if the National Center for Missing and Exploited Children, or a
				director, officer, employee, or agent of such center—</text>
								<paragraph id="ID99bf28c9a6d24f198a6521c836a15fd2"><enum>(1)</enum><text>engaged in
				intentional misconduct; or</text>
								</paragraph><paragraph id="IDc5e8bcc9ee384c79ac97b7a3da14cdbf"><enum>(2)</enum><text>acted, or failed
				to act—</text>
									<subparagraph id="ID545aee1ac8b848099f893bf6c5b2a56d"><enum>(A)</enum><text>with actual
				malice;</text>
									</subparagraph><subparagraph id="IDfb016b3271e74798a5e757681665fde9"><enum>(B)</enum><text>with reckless
				disregard to a substantial risk of causing injury without legal justification;
				or</text>
									</subparagraph><subparagraph id="ID2c3a37d9ccc34055a40f054c5e164bc2"><enum>(C)</enum><text>for a purpose
				unrelated to the performance of any responsibility or function under this
				section, section 2258A or 2258C of this title, or section 404 of the Missing
				Children's Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5773">42 U.S.C. 5773</external-xref>).</text>
									</subparagraph></paragraph></subsection><subsection id="IDf2a644c3cdfc4638a1a3f6504a7d7112"><enum>(c)</enum><header>Ordinary
				business activities</header><text>Subsection (a) shall not apply to an act or
				omission relating to an ordinary business activity, including general
				administration or operations, the use of motor vehicles, or personnel
				management.</text>
							</subsection><subsection id="IDae95e63a041d46f39263ab36c6093d77"><enum>(d)</enum><header>Minimizing
				access</header><text>The National Center for Missing and Exploited Children
				shall—</text>
								<paragraph id="IDcc83bdeb49d04c3bb5afc7c78e802455"><enum>(1)</enum><text>minimize the
				number of employees that are provided access to any image provided under
				section 2258A; and</text>
								</paragraph><paragraph id="ID94beb6fdc4e84189b2d5d2974484a11e"><enum>(2)</enum><text>ensure that any
				such image is permanently destroyed upon notification from a law enforcement
				agency.</text>
								</paragraph></subsection></section><section id="ID7467ae5c3daf4e71bf62dd3129a58f69"><enum>2258E.</enum><header>Definitions</header><text display-inline="no-display-inline">In sections 2258A through 2258D—</text>
							<paragraph id="IDe07eadf71c9c47cb8e8d1d0093b11f1a"><enum>(1)</enum><text>the terms
				<term>attorney for the government</term> and <term>State</term> have the
				meanings given those terms in rule 1 of the Federal Rules of Criminal
				Procedure;</text>
							</paragraph><paragraph id="IDb8c27ec885f34672b2e70df3f5d9c5a7"><enum>(2)</enum><text>the term
				<term>electronic communication service</term> has the meaning given that term
				in section 2510;</text>
							</paragraph><paragraph id="ID512df1cbad88461fbf34868b87697dae"><enum>(3)</enum><text>the term
				<term>electronic mail address</term> has the meaning given that term in section
				3 of the CAN–SPAM Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/15/7702">15 U.S.C. 7702</external-xref>);</text>
							</paragraph><paragraph id="ID000d77e575e84bc8a2375cc2d3b3a23f"><enum>(4)</enum><text>the term
				<term>Internet</term> has the meaning given that term in section 1101 of the
				Internet Tax Freedom Act (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> note);</text>
							</paragraph><paragraph id="ID63958f9db1e9496b90227c834b6e16a2"><enum>(5)</enum><text>the term
				<term>remote computing service</term> has the meaning given that term in
				section 2711; and</text>
							</paragraph><paragraph id="ID744d4c7995414975bbb30209acdadbfb"><enum>(6)</enum><text>the term
				<term>website</term> means any collection of material placed in a computer
				server-based file archive so that it is publicly accessible, over the Internet,
				using hypertext transfer protocol or any successor
				protocol.</text>
							</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID4fbd05b7f2084d91ba40396efa66ca82"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
					<paragraph id="ID275da30f127640919a09cff4c212409c"><enum>(1)</enum><header>Repeal of
			 superceded provision</header><text>Section 227 of the Crime Control Act of 1990
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032</external-xref>) is repealed.</text>
					</paragraph><paragraph id="ID082cd118dd5b4c918f229dd809476203"><enum>(2)</enum><header>Technical
			 corrections</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2702">Section 2702</external-xref> of title 18, United States Code, is
			 amended—</text>
						<subparagraph id="id6C27316E64714ACB98BDE7DA7CB1303C"><enum>(A)</enum><text>in subsection
			 (b)(6), by striking <quote>section 227 of the Victims of Child Abuse Act of
			 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032</external-xref>)</quote> and inserting <quote>section 2258A</quote>;
			 and</text>

			 (c)(5), by striking <quote>section 227 of the Victims of Child Abuse Act of

					</paragraph></subsection></section><section id="idFD2FE64E83EC438CB975286181344F3F"><enum>502.</enum><header>Reports</header>
				<subsection id="id2A4E47D019BF46E18275917099A216C7"><enum>(a)</enum><header>Attorney
			 General report on implementation, investigative methods and information
			 sharing</header><text>Not later than 12 months after the date of enactment of
			 this Act, the Attorney General shall submit a report to the Committee on the
			 Judiciary of Senate and the Committee on the Judiciary of the House of
			 Representatives on —</text>
					<paragraph id="IDf6126aea515c47f9ba9182cac2500250"><enum>(1)</enum><text>the structure
			 established in this Act, including the respective functions of the National
			 Center for Missing and Exploited Children, Department of Justice, and other
			 entities that participate in information sharing under this Act;</text>
					</paragraph><paragraph id="ID224cf84849d54c9c9cc7822dc9809cd3"><enum>(2)</enum><text>an assessment of
			 the legal and constitutional implications of such structure;</text>
					</paragraph><paragraph id="ID5b42375bd4c8425cb69c8f0ca0521aa3"><enum>(3)</enum><text>the privacy
			 safeguards contained in the reporting requirements, including the training,
			 qualifications, recruitment and screening of all Federal and non-Federal
			 personnel implementing this Act; and</text>
					</paragraph><paragraph id="idB5A4B4CB3738499BBDDFC7732D4A5DDF"><enum>(4)</enum><text>information
			 relating to the aggregate number of incidents reported under section 2258A(b)
			 of title 18, United States Code, to Federal and State law enforcement agencies
			 based on the reporting requirements under this Act and the aggregate number of
			 times that elements are provided to communication service providers under
			 section 2258C of such title.</text>
					</paragraph></subsection><subsection id="id708B6AA240BE4A55BBEB6028195D3E28"><enum>(b)</enum><header>GAO audit and
			 report on efficiency and effectiveness</header><text>Not later than 2 years
			 after the date of enactment of this Act, the Comptroller General shall conduct
			 an audit and submit a report to the Committee on the Judiciary of the Senate
			 and to the Committee on the Judiciary of the House of Representatives
			 on—</text>
					<paragraph id="ID675cc12991df490597f42c47cd991c02"><enum>(1)</enum><text>the efforts,
			 activities, and actions of the CyberTipline of the National Center for Missing
			 and Exploited Children, or any successor to the CyberTipline, and the Attorney
			 General in achieving the goals and purposes of this Act, as well as in carrying
			 out any responsibilities or duties assigned to each such individual or agency
			 under this Act;</text>
					</paragraph><paragraph id="ID21cce390ade14eb9a0995a042f4153bc"><enum>(2)</enum><text>any legislative,
			 administrative, or regulatory changes that the Comptroller General recommends
			 be taken by or on behalf of the Attorney General to better achieve such goals
			 and purposes, and to more effectively carry out such responsibilities and
			 duties;</text>
					</paragraph><paragraph id="ID8eb6fa4eef6e4fa8b0cc3a5259d2c830"><enum>(3)</enum><text>the effectiveness
			 of any actions taken and efforts made by the CyberTipline of the National
			 Center for Missing and Exploited Children, or any successor to the CyberTipline
			 and the Attorney General to—</text>
						<subparagraph id="IDe629cde47f674e0a8bee79f1a7c55853"><enum>(A)</enum><text>minimize
			 duplicating the efforts, materials, facilities, and procedures of any other
			 Federal agency responsible for the enforcement, investigation, or prosecution
			 of child pornography crimes; and</text>
						</subparagraph><subparagraph id="ID9acadd004b1041b6a801e7dbb6c56e7d"><enum>(B)</enum><text>enhance the
			 efficiency and consistency with which Federal funds and resources are expended
			 to enforce, investigate, or prosecute child pornography crimes, including the
			 use of existing personnel, materials, technologies, and facilities; and</text>
						</subparagraph></paragraph><paragraph id="ID34a4350892a74527aa3f5b19c8af6284"><enum>(4)</enum><text>any actions or
			 efforts that the Comptroller General recommends be taken by the Attorney
			 General to reduce duplication of efforts and increase the efficiency and
			 consistency with which Federal funds and resources are expended to enforce,
			 investigate, or prosecute child pornography crimes.</text>
					</paragraph></subsection></section><section id="idAE2A5A4779A849DE9BA535D70678D183"><enum>503.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title or amendment
			 made by this title is held to be unconstitutional, the remainder of the
			 provisions of this title or amendments made by this title—</text>
				<paragraph id="id18BA4392E87B48BBB1E9AFB66C0046E7"><enum>(1)</enum><text display-inline="yes-display-inline">shall remain in full force and effect;
			 and</text>
				</paragraph><paragraph id="idDD994665749A427D901CD0312FC31A0A"><enum>(2)</enum><text display-inline="yes-display-inline">shall not be affected by the
			 holding.</text>
