		<official-title>To amend title II of the Social Security Act to provide
		  that the eligibility requirement for disability insurance benefits under which
		  an individual must have 20 quarters of Social Security coverage in the 40
		  quarters preceding a disability shall not be applicable in the case of a
		  disabled individual suffering from a covered terminal disease.</official-title>

		<section id="id42F3509BB0DC4B299324A4DFC999A2AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Claire Collier Social Security
			 Disability Insurance Fairness Act</short-title></quote>.</text>
		</section><section id="IDf069bd79468c4f1d99cb5e383457df23"><enum>2.</enum><header>Exception from
			 20/40 requirement for disability insurance benefits for individuals suffering
			 from a covered terminal disease</header>
			<subsection id="ID2d01d091df5c43a88c7398510fbc6599"><enum>(a)</enum><header>Exception from
			 recent work requirement</header>
				<paragraph id="id0AD29D6F97094143B1837FA656D7C421"><enum>(1)</enum><header>In
			 general</header><text>Section 223(c)(1) of the Social Security Act (42 U.S.C.
			 423(c)(1)) is amended in the flush matter following subparagraph (B)(iii) by
			 inserting <quote>or suffering from a covered terminal disease</quote> after
			 <quote>216(i)(1))</quote>.</text>
				</paragraph><paragraph id="id7D22C9B65C0E4187A232D964A2776900"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 216(i)(3) of such Act (42 U.S.C. 416(i)(3)) is
			 amended in the flush matter following subparagraph (B)(iii) by inserting
			 <quote>or suffering from a covered terminal disease</quote> after
			 <quote>paragraph (1))</quote>.</text>
				</paragraph></subsection><subsection id="ID71c78301849a469aba1bc06e91bd1c9a"><enum>(b)</enum><header>Definition of
			 covered terminal disease</header><text>Not later than 60 days after the date of
			 enactment of this Act, the Commissioner of Social Security shall issue a
			 proposed rule defining the term <term>covered terminal disease</term> for
			 purposes of sections 216(i)(3) and 223(c)(1) of the Social Security Act (as
			 amended by subsection (a)) that shall include (but not be limited to) those
			 diseases that are incurable, progressive, and terminal, including
			 neurodegenerative and neurological diseases that are likely to cause death
			 within a 5-year period of onset.</text>
			</subsection><subsection id="ID76833588027e46f89ee75240bc3cfc84"><enum>(c)</enum><header>Interim final
			 and final rules</header>
				<paragraph id="ID883af531576c4580a6e86fdd7aaa7676"><enum>(1)</enum><header>Interim final
			 rule</header><text>Not later than 90 days after the date of enactment of this
			 Act, the Commissioner of Social Security shall issue an interim final rule
			 defining the term <term>covered terminal disease</term> in accordance with the
			 requirements of subsection (b) and shall provide for a period of public
			 comments on such rule.</text>
				</paragraph><paragraph id="IDef730893259c4375a7175f3bae8fa3b4"><enum>(2)</enum><header>Final
			 rule</header><text>Not later than 6 months after the date of enactment of this
			 Act, the Commissioner of Social Security shall issue a final rule defining the
			 term <term>covered terminal disease</term> in accordance with the requirements
			 of subsection (b) and consideration of any public comments received during the
			 period required under paragraph (1).</text>
				</paragraph></subsection><subsection id="ID1ba26436a3454a0bad449feb2571ee00"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect on
			 the date of enactment of this Act and shall apply to any applications for
			 disability insurance benefits under title II of the Social Security Act that
			 are pending or filed on or after that date.</text>
