		  2002 to promote growth and opportunity for the dairy industry in the United

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Repeal
			 of dairy price support program</header>
			<subsection id="idB636157282C94A84BB4335C7ED04575D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1501 of the
			 Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7981) is
			 repealed.</text>
			</subsection><subsection id="id499D17F10EA84519917FD9CD9D9092D1"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 1507 of the Farm Security and Rural Investment
			 Act of 2002 (7 U.S.C. 7983) is repealed.</text>
			</subsection></section><section id="id91F9247954464AB7B80C92870ACFFE79" section-type="subsequent-section"><enum>2.</enum><header>Milk target price
			 program</header><text display-inline="no-display-inline">Section 1502 of the
			 Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7982) is
			 amended—</text>
			<paragraph id="idC7D23017B4454E988B709C1BFE6708D3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section heading and
			 inserting <quote><header-in-text level="section" style="OLC">Milk target price
			 program</header-in-text></quote>;</text>
			</paragraph><paragraph id="idA6E62208066C4CB1AED54F583A0D4157"><enum>(2)</enum><text>in subsection
			 (a), by striking paragraph (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD92D0833F8C04B79971DB506DED050A8" style="OLC">
					<paragraph id="idBD6CF2A461064BD599E5FD166A4A61D8"><enum>(1)</enum><header>Class III
				milk</header><text>The term <term>Class III milk</term> means milk (including
				milk components) classified as milk for manufacturing purposes under a Federal
				milk marketing
				order.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idE2D5EB20514A4C629B8222CE3411D9C8"><enum>(3)</enum><text>by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0FA42ED2E2514DF08EF6E66FEBD5A8BB" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="IDE79A9E1EBA9B4574BBF717C6F3579D26"><enum>(c)</enum><header>Amount</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id9F1EB3F0658F488A9A4E6E916406BD1A"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (3), payments to a producer under
				this section shall be calculated by multiplying (as determined by the
				Secretary)—</text>
							<subparagraph id="ID3E747C45FCB4491C8384AEB984DE857E"><enum>(A)</enum><text>the payment
				quantity for the producer during the applicable month established under
				subsection (d); by</text>
							</subparagraph><subparagraph id="ID63366A9297FA4E4280EFB9947BD10037"><enum>(B)</enum><text>the amount equal
				to—</text>
								<clause id="ID30559337C5E0429AB26649D29A51920B"><enum>(i)</enum><text>$12.00 per
				hundredweight (as adjusted under paragraph (2)); less</text>
								</clause><clause id="ID32A210C1E7464D76B5101AB8D72C04DA"><enum>(ii)</enum><text>the Class III
				milk price per hundredweight under the applicable Federal milk marketing
				order.</text>
								</clause></subparagraph></paragraph><paragraph id="id89E95D8917E449FEA2D5BBFDD73C864F"><enum>(2)</enum><header>Feed price
				index and adjustment factor</header>
							<subparagraph id="idDC68D13624BE43B9A6940DF660984DC4"><enum>(A)</enum><header>Feed price
				index</header><text>The Secretary shall develop a feed price index, using a
				baseline period of calendar years 2001 through 2005, to reflect the feed cost
				of producing 100 pounds of milk.</text>
							</subparagraph><subparagraph id="idDD286183D3DB4030A59EDBFCF35C1FD1"><enum>(B)</enum><header>Feed adjustment
				factor</header><text>The Secretary shall establish a feed adjustment factor
				that reflects changes in the feed price index, as determined by the
				Secretary.</text>
							</subparagraph><subparagraph id="id0D09C62069A14749A7C91C435E5B3D09"><enum>(C)</enum><header>Adjustment</header><text>Each
				month that there is an increase in the feed price index, the Secretary shall
				adjust the amount described in paragraph (1)(B)(i) to reflect any increases in
				the feed adjustment factor.</text>
							</subparagraph></paragraph><paragraph id="ID15977182c05e460dbbde0b504af1b189"><enum>(3)</enum><header>Maximum
				amount</header><text>The maximum annual payment for all producers on a single
				dairy operation during the months of the applicable fiscal year for which the
				producers receive payments under this section shall not exceed
				$50,000.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idFA48C8A2E8FE49C8BB5FD933EAE2E9F0"><enum>(4)</enum><text>in subsections
			 (f) and (g)(1), by striking <quote>September 30, 2007</quote> both places it
			 appears and inserting <quote>September 30, 2012</quote>.</text>
			</paragraph></section><section id="id00B1F38EB33143CDA4771E7C2C166311" section-type="subsequent-section"><enum>3.</enum><header>Dairy options
			 program</header><text display-inline="no-display-inline">Subtitle E of title I
			 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7981 et seq.)
			 is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE59A9C739C34443EB0DB4C8DE4470782" style="OLC">
				<section id="id34C6F5C262BE44C5BE1D1BFC0C77D043"><enum>1509.</enum><header>Dairy options
				program</header>
					<subsection id="ID1b6c5eb5f472439980c08af22ae84b3b"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary shall carry out a nationwide program under similar terms and
				conditions as the Secretary used to carry out the dairy options pilot program
				established in accordance with section 191 of the Federal Agricultural
				Improvement Reform Act of 1996 (7 U.S.C. 7331).</text>
					</subsection><subsection id="id4330DA00A40E4F4FB05906D142983B48"><enum>(b)</enum><header>Funding</header>
						<paragraph id="id0C0893AAD21748B0A2FDD7D11BA41BCD"><enum>(1)</enum><header>Commodity
				Credit Corporation</header><text>The Secretary shall use the funds, facilities,
				and authorities of the Commodity Credit Corporation to carry out this
				section.</text>
						</paragraph><paragraph id="id550395DFF22E4769861CEE53ADFB115A"><enum>(2)</enum><header>Funding
				amount</header><text>Of the funds of the Commodity Credit Corporation, the
				Secretary shall use to carry out this section $25,000,000 for each of fiscal
				years 2008 through 2012, to remain available until expended.</text>
						</paragraph><paragraph id="idC803E70E87C146FE8FD9C4E8E253CC2C"><enum>(3)</enum><header>Budget
				neutrality</header><text>To the maximum extent practicable, the Secretary shall
				operate the program in a budget neutral
				manner.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id2557CEBEED1B44FD8DF6982B79DC6C22" section-type="subsequent-section"><enum>4.</enum><header>Recourse loan program
			 for commercial producers of dairy products</header><text display-inline="no-display-inline">Subtitle E of title I of the Farm Security
			 and Rural Investment Act of 2002 (7 U.S.C. 7981 et seq.) (as amended by section
			 3) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id896B33A4D15A47D19C4214112812F13F" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="idB8A664E8527246E5BB2B28D23BDE27F2" section-type="subsequent-section"><enum>1510.</enum><header display-inline="yes-display-inline">Recourse loan program for commercial
				producers of dairy products</header>
					<subsection commented="no" display-inline="no-display-inline" id="id3DF2034DB0C34CC480C17DDDDE74BE84"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of eligible dairy
				products</header><text>In this section, the term <term>eligible dairy
				products</term> means cheddar cheese, butter, and nonfat dry milk.</text>
					</subsection><subsection id="idAADCBDA36D6D456EA54745929AC842DB"><enum>(b)</enum><header>Program</header><text>Effective
				beginning on September 30, 2007, the Secretary shall make recourse loans
				available to commercial processors of eligible dairy products—</text>
						<paragraph id="idE4FC5DE8455448228C2DA35E5E8D11F8"><enum>(1)</enum><text>to assist the
				processors to manage inventories of eligible dairy products; and</text>
						</paragraph><paragraph id="id22DC252ED9B04F2EB54168BCA045C03C"><enum>(2)</enum><text>to ensure a
				greater degree of price stability for the dairy industry.</text>
						</paragraph></subsection><subsection id="id338D6FE0BD33489C87F5D5817F45BABE"><enum>(c)</enum><header>Amount of
				loan</header>
						<paragraph id="id2B8D8F4B5D8248A9A96DE0571A184266"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a loan rate for eligible
				dairy products, that reflects a milk equivalent value of $9.90 per
				hundredweight of milk containing 3.67 percent butterfat, as determined by the
				Secretary.</text>
						</paragraph><paragraph id="id438081E78E534410B74ACDCBE49AE049"><enum>(2)</enum><header>Interest</header><text>The
				Secretary shall charge a processor that receives a recourse loan under this
				section a rate of interest that is not less than the rate of interest that the
				Secretary of the Treasury charges the Commodity Credit Corporation, as
				determined by the Secretary.</text>
						</paragraph></subsection><subsection id="id62E6173BDB2A432A87085D28BA5BE917"><enum>(d)</enum><header>Period of
				loan</header>
						<paragraph id="idBB76FC6296B241A497AD21BCBB6171BB"><enum>(1)</enum><header>In
				general</header><text>The original term of a recourse loan made under this
				section may not extend beyond the end of the fiscal year in which the loan is
				made.</text>
						</paragraph><paragraph id="id5DF75DF59A5F430D8BB5F10C0F3F1363"><enum>(2)</enum><header>Extension</header><text>At
				the end of a fiscal year, the Secretary may extend a recourse loan for an
				additional period not to exceed the end of the next fiscal
				year.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id838B8A86A8CA4DBD9A1BB4E38A5A731B" section-type="subsequent-section"><enum>5.</enum><header>Milk revenue insurance
			 pilot program</header><text display-inline="no-display-inline">Section 523 of
			 the Federal Crop Insurance Act (7 U.S.C. 1523) is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="idEDD15FB227564E639AA1D09E69F623B7" style="OLC">
				<subsection id="id65924E6DCCDF4D048FF9996CDA1E41E7"><enum>(f)</enum><header>Milk revenue
				insurance pilot program</header>
					<paragraph id="idF1ADA3265FB445C794088AFB2F733618"><enum>(1)</enum><header>In
				general</header><text>During each of crop years 2008 through 2012, the
				Corporation shall carry out a pilot program under which producers on a dairy
				farm may elect to receive insurance against loss of revenue due to natural
				disasters and price fluctuations, as determined by the Corporation, based on
				the average revenue received by producers for each cow during the 5-year period
				ending the preceding crop year .</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B5E68D6AE78468B9CE57394DA17472B"><enum>(2)</enum><header>Requirements</header><text>The
				Corporation shall carry out the pilot program under this section using similar
				terms and conditions as were contained in the crop insurance policy proposal
				entitled <quote>Milk Revenue Policy (from bovine animals)</quote> submitted to
				the Board on April 26, 2007, in accordance with section
				508(h).</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDb738744024db4f3aacfb1391ed7bbbf4"><enum>6.</enum><header>Federal milk
			 marketing orders</header>
			<subsection id="id10F697CF367E4525A7154E506BE8B573"><enum>(a)</enum><header>2-class system
			 for classifying milk</header>
				<paragraph id="id1A4796CB18294E6EAE9645DF885F50CD"><enum>(1)</enum><header>In
			 general</header><text>Not later than September 30, 2008, the Secretary of
			 Agriculture shall conduct a study of the economic benefits to milk producers of
			 establishing a 2-class system for classifying milk under Federal milk marketing
			 orders issued under section 8c(5) of the Agricultural Adjustment Act (7 U.S.C.
			 608c(5)), reenacted with amendments by the Agricultural Marketing Agreement Act
			 of 1937, consisting of a fluid milk class and a manufacturing grade milk class
			 (with the price for both classes determined using the component prices of
			 butterfat, protein, and other solids).</text>
				</paragraph><paragraph id="idF3B70D17BCF940B0B3207B1C2F4A8BA0"><enum>(2)</enum><header>Amendment to
			 orders</header><text>If the Secretary determines (on the basis of the study
			 conducted under paragraph (1)) that a 2-class system for classifying milk under
			 Federal milk marketing orders would have a positive impact on milk producers,
			 the Secretary shall amend Federal milk marketing orders to implement the
			 2-class system for classifying milk.</text>
				</paragraph></subsection><subsection id="idF4FE82C1559A4D93A1CFAAC30A5B008B"><enum>(b)</enum><header>Deadline for
			 issuance of orders</header><text>Section 8c(4) of the Agricultural Adjustment
			 Act (7 U.S.C. 608c(4)), reenacted with amendments by the Agricultural Marketing
			 Agreement Act of 1937, is amended by striking <quote>After</quote> and
			 inserting <quote>Not later than 30 days after</quote>.</text>
			</subsection><subsection id="idDFC649366BFB4FD8A3CE93C2E6897372"><enum>(c)</enum><header>Advanced
			 pricing</header><text display-inline="yes-display-inline">Section 8c(5) of the
			 Agricultural Adjustment Act (7 U.S.C. 608c(5)), reenacted with amendments by
			 the Agricultural Marketing Agreement Act of 1937, is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1AC34EA4EE294A2B8E44F721D3323DD9" style="OLC">
					<subparagraph id="id112CBDC96EBA4FA6AD5D64CDCA018A15"><enum>(P)</enum><header>Advanced
				pricing</header><text>Not later than September 30, 2007, in calculating the
				advanced price of Class I butterfat milk and Class I and II skim milk under
				Federal milk marketing orders, the Secretary shall use the 4-week component
				prices that are used to calculate prices for Class III and Class IV milk, as
				determined by the
				Secretary.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id21E91A8E17EE4085AFCEF89D546B7D8E"><enum>(d)</enum><header>Economic impact
			 assessment</header><text>The Secretary of Agriculture shall—</text>
				<paragraph id="idC3C9AFD952394ED2B0A68CA8F00E6F1C"><enum>(1)</enum><text>carry out a
			 review of the milk-feed ratio during the 1-year period ending on the date of
			 enactment of this Act; and</text>
				</paragraph><paragraph id="id732FDB8CD0C24B42B3AB8500625945F9"><enum>(2)</enum><text>not later than
			 September 30, 2008, and each time a proposed change in the Federal milk
			 marketing order formulas is considered by the Secretary—</text>
					<subparagraph id="id7EC93C29AC17487790B778B024D8F1E5"><enum>(A)</enum><text>assess the
			 economic impact, over a 1- and 2-year period, of proposed changes in Federal
			 milk marketing order formulas on—</text>
						<clause id="id3E43CD24548B41E7975FC8CEAE09800D"><enum>(i)</enum><text>milk
			 supply;</text>
						</clause><clause id="idDD72CE0DEE434E76A29BE0E56851E5A6"><enum>(ii)</enum><text>farm
			 profitability;</text>
						</clause><clause id="id19461FC590AB422195B518657285F68E"><enum>(iii)</enum><text>consumer
			 demand; and</text>
						</clause><clause id="id66B87EA1BE30429F84F79F046C2F4F7B"><enum>(iv)</enum><text>market
			 prices;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID52b0223f9ae54d88977355bc7b8b2eca"><enum>(B)</enum><text>submit to the
			 Committee on Agriculture of the House of Representatives and the Committee on
			 Agriculture, Nutrition, and Forestry a report that describes the results of the
			 assessment; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35F3FD0C73F14165B8D6F67634DF3AF8"><enum>(C)</enum><text>consider, and
			 include in the record, the results of the assessment before making a decision
			 on any proposed change to the Federal milk marketing order formulas.</text>
					</subparagraph></paragraph></subsection></section><section id="id4DA2C9E38FEF4DBFBBC02BC2837D9232" section-type="subsequent-section"><enum>7.</enum><header>Dairy forward pricing
			 program</header><text display-inline="no-display-inline">Section 23 of the
			 Agricultural Adjustment Act (7 U.S.C. 627), reenacted with amendments by the
			 Agricultural Marketing Agreement Act of 1937, is amended—</text>
			<paragraph id="id17152B84E2D340A5AC15E1F09B74C33D"><enum>(1)</enum><text>in the section
			 heading by striking <quote><header-in-text level="section" style="OLC">pilot</header-in-text></quote>;</text>
			</paragraph><paragraph id="id38A54E0964F24E7C8C30C0A09579D927"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="id4E2E82BC74014543BDC1B436F22EB4A2"><enum>(A)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC">Pilot program
			 required</header-in-text>.—</quote> and all that follows through
			 <quote>pilot</quote> and inserting <quote><header-in-text level="subsection" style="OLC">In general</header-in-text>.—The Secretary of Agriculture shall

			 <quote>handlers.</quote> and inserting “handlers; and</text>
					<quoted-block display-inline="no-display-inline" id="id162A278D777C47DB8014750ACA78315C" style="OLC">
						<paragraph id="idD16EEA997BCD4594855CF6CE0E5D282A"><enum>(2)</enum><text>proprietary
				processors and cooperatives regulated under Federal milk marketing orders are
				authorized to voluntarily enter into forward price contracts with the members
				of the processors and
				cooperatives.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id89F1FD7CA6E44C0BA9BB6F61C4F6BBFA"><enum>(3)</enum><text>by striking
			 subsections (d) and (e); and</text>
			</paragraph><paragraph id="idB068D857B947410EA8554416B5F66C1D"><enum>(4)</enum><text>by adding at the
			 end the following:</text>

			 equipment loan guarantee fund</header>
			<subsection id="ID308a2cd5f5ee4ab0828a493983bc8b14"><enum>(a)</enum><header>Loans</header>
				<paragraph id="id2A8D5702038D447EBDF60EF5EE4A4F31"><enum>(1)</enum><header>In
			 general</header><text>Section 310B(a) of the Consolidated Farm and Rural
			 Development Act (7 U.S.C. 1932(a)) is amended—</text>

				$15,000,000 each fiscal year to provide dairy processing cooperatives with
				working capital lines of credit and accounts receivable financing for the
				purpose of accessing export marketing opportunities for milk and milk
				products.</text>
						</paragraph><paragraph id="id1CA0014845D449FCB73FB396F0E9ECCB"><enum>(2)</enum><header>Limitations</header><text>Financing
				provided by the banks for cooperatives for a project under paragraph (1) may
				not exceed the lesser of—</text>
							<subparagraph id="idF4E8B79F9B894716BEAA863934A72CB3"><enum>(A)</enum><text>$1,000,000;
				or</text>
							</subparagraph><subparagraph id="id83AA105EA5764340B014BFAC8E82033D"><enum>(B)</enum><text>75 percent of the
				costs of carrying out the project.</text>
							</subparagraph></paragraph><paragraph id="id07AABE44B5314BABB70F6EC577F0D0C3"><enum>(3)</enum><header>Term</header>
							<subparagraph id="idB53F7D6135674AFF82D81B8D0F6B3501"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the term of a
				line of credit described in paragraph (1) shall not exceed 24 months.</text>

				financing</header>
							<subparagraph id="id973A3667DB14430BA89F7D3E25272A8B"><enum>(A)</enum><header>Working capital
				line of credit financing</header><text>Working capital line of credit financing
				under this subsection may be used—</text>
								<clause id="IDfa520bab0db64896abb11ec5c2c9a35a"><enum>(i)</enum><text>to acquire
				inventory for the production of milk;</text>
								</clause><clause id="IDae629cfd1449467abd357010a7c0714d"><enum>(ii)</enum><text>to pay direct
				and indirect costs (such as design, engineering, labor, and overhead costs)
				used for—</text>
									<subclause id="id25E47C13099B4B2FAAF07F8C68C55C8D"><enum>(I)</enum><text>the manufacture
				or purchase of goods, including work-in-process, for the production of milk;
				or</text>
									</subclause><subclause id="idD1E69BF289874C9AA9D1DF3EDFE2C77D"><enum>(II)</enum><text>for the
				provision of services for the production of milk; or</text>
									</subclause></clause><clause id="ID64a656a4c3f64c41b8a8d6f5f7b59fae"><enum>(iii)</enum><text>to support
				standby letters of credit used as bid bonds, performance bonds, or payment
				guarantees.</text>
								</clause></subparagraph><subparagraph id="ID83f9455dbbd34897b5861c0f0d81966a"><enum>(B)</enum><header>Accounts
				receivable financing</header><text>Accounts receivable financing under this
				subsection may be used to finance export accounts receivables for milk and milk
				products sold on payment terms of not more than 180 days after the date of
				arrival at the port of importation, if the finance export accounts receivable
				have been insured by the Commodity Credit Corporation or other guarantor
				approved by the
				Secretary.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id850D8D6648614895A11A4CAB6430262D" section-type="subsequent-section"><enum>9.</enum><header>Federal loan
			 forgiveness program</header><text display-inline="no-display-inline">The
			 National Agricultural Research, Extension, and Teaching Policy Act of 1977 (7
			 U.S.C. 3101 et seq.) is amended by adding at the end the following:</text>

				education loan forgiveness</header>
					<section id="ID0400d7148a094ba7a954e9cb11db3eec"><enum>1495.</enum><header>Short
				title</header><text display-inline="no-display-inline">This subtitle may be
				cited as the <quote>Federal Dairy Education Loan Forgiveness
				Act</quote>.</text>
					</section><section id="id41C414F068BB41638AE3A1A2A09E67BE"><enum>1496.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
						<paragraph id="ID8daaa4130bf64a1baa21904fa145640a"><enum>(1)</enum><header>Family dairy
				farm</header><text>The term <term>family dairy farm</term> means the real
				property of a dairy farm—</text>
							<subparagraph id="id8C521C7CF35F40CDB253130F98883A32"><enum>(A)</enum><text>owned by—</text>
								<clause id="idEFB782E120A74CCD89DDDD74FB823463"><enum>(i)</enum><text>1
				or more immediate family members; or</text>
								</clause><clause id="idCF31EBF2CB9A4224B40FFA2AD2117BE5"><enum>(ii)</enum><text>a family dairy
				farm corporation; and</text>
								</clause></subparagraph><subparagraph id="id046B54DD507143A78A8AE90506928BE6"><enum>(B)</enum><text>used for the
				production, for commercial purposes, of milk or milk products.</text>
							</subparagraph></paragraph><paragraph id="ID08fe7e5c2ae244c5827699c8ce57d29f"><enum>(2)</enum><header>Family dairy
				farm corporation</header><text>The term <term>family dairy farm
				corporation</term> means a corporation—</text>
							<subparagraph id="id55D38936EA2E4A0A83C37A529DC974E0"><enum>(A)</enum><text>at least 75
				percent of the assets of which are devoted to active involvement in farming;
				and</text>
							</subparagraph><subparagraph id="id1F1002CA04974BF5831E245638C87DCF"><enum>(B)</enum><text>at least 75
				percent of each class of stock of which is continuously owned by 1 or more
				immediate family members.</text>
							</subparagraph></paragraph><paragraph id="ID0a363fb8144d4601a4c00e8378864ebb"><enum>(3)</enum><header>Immediate
				family member</header><text>The term <term>immediate family member</term> means
				a spouse, child, stepchild, parent, stepparent, grandparent, brother,
				stepbrother, sister, stepsister, or similar relative-in-law of an owner of real
				property, as determined by the Secretary.</text>
						</paragraph><paragraph id="id2C37189B97B947DA91A7DF40BB99D8C8"><enum>(4)</enum><header>Institution of
				higher education</header><text>The term <term>institution of higher
				education</term> has the meaning given the term in section 101(a) of the
				<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
				U.S.C. 1001(a)).</text>
						</paragraph><paragraph id="idC2A5C5B7B9844AFC8115F03561362A2C"><enum>(5)</enum><header>Program</header><text>The
				term <term>program</term> means the Federal dairy education loan forgiveness
				program established under section 1497(a).</text>
						</paragraph><paragraph id="ID4c7b9136f84b42c48e2ecf0033432fa3"><enum>(6)</enum><header>Qualified
				applicant</header><text>The term <term>qualified applicant</term> means a
				resident of the United States who, as determined by the Secretary—</text>
							<subparagraph id="IDad17817e526549f995bd67545a00043d"><enum>(A)</enum><text>holds a 2- or
				4-year degree in a field related to the production of agricultural products
				from an institution of higher education;</text>
							</subparagraph><subparagraph id="ID1ed74faf958d4082ac1c64a592bb7b4a"><enum>(B)</enum><text>on or after
				January 1, 2008, has commenced the first year of full-time ownership or
				operation of a family dairy farm; and</text>
							</subparagraph><subparagraph id="id09569E9AC168476D9B5FEF42EB9BBDE1"><enum>(C)</enum><text>is the borrower
				of an outstanding qualified loan as a result of pursuing a degree described in
				subparagraph (A).</text>
							</subparagraph></paragraph><paragraph id="id9D524403F52540F8A6AD744DE86FC6BE"><enum>(7)</enum><header>Qualified
				loan</header><text>The term <term>qualified loan</term> means—</text>
							<subparagraph id="id95D44BF89E5B42FC9BEB4A81849335DC"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id30D46F5F2318432B8281930A66AFD8F1"><enum>(i)</enum><text>a loan made, insured,
				or guaranteed under section 428 or 428H of the Higher Education Act of 1965 (20
				U.S.C. 1078, 1078–8);</text>
								</clause><clause id="idAE0F173CCE4A43C991AAD4B1A8603D13" indent="up1"><enum>(ii)</enum><text>a Federal Direct Stafford Loan or
				a Federal Direct Unsubsidized Stafford Loan made under section 455 of that Act
				(20 U.S.C. 1087e); or</text>
								</clause><clause id="idA760D98C2C3A46E098BBE1870623B5FE" indent="up1"><enum>(iii)</enum><text>a consolidation loan under
				section 428C of that Act (20 U.S.C. 1078–3), or a Federal Direct Consolidation
				Loan under section 455 of that Act (20 U.S.C. 1087e), to the extent that the
				amount of the loan was used to repay a loan described in clause (i) or (ii);
				and</text>
								</clause></subparagraph><subparagraph id="idC5A277518CB24419B021F6D4DD0242C8"><enum>(B)</enum><text>a loan under part
				B or D of title IV of that Act (20 U.S.C. 1070 et seq.); or</text>
							</subparagraph><subparagraph id="idEA6DD20E54954CB8B08185C050F42805"><enum>(C)</enum><text>a loan under a
				guaranteed student loan program of the Department.</text>
							</subparagraph></paragraph></section><section id="IDa622b9c7b8124f199f6718cf3d65f4dc"><enum>1497.</enum><header>Federal dairy
				education loan forgiveness program</header>
						<subsection id="ID675a662f619b4b4198460c05083d2a3c"><enum>(a)</enum><header>In
				general</header><text>Subject to the availability of appropriations, the
				Secretary shall carry out a Federal dairy education loan forgiveness program
				under which the Secretary shall assume the obligation to repay an amount
				calculated in accordance with subsection (c) for 1 or more qualified loans made
				to eligible qualified applicants in accordance with this section.</text>
						</subsection><subsection id="id295ECCE5AADB4A0D9A1F73B9F0067985"><enum>(b)</enum><header>Eligibility</header><text>A
				qualified applicant shall submit to the Secretary an application and such
				documentation of continued eligibility as the Secretary determines to be
				appropriate.</text>
						</subsection><subsection id="idB7E2750AE9154C2889832485547CAF38"><enum>(c)</enum><header>Maximum
				amount</header><text>The maximum amount that the Secretary may repay under the
				program for each qualified applicant shall be equal to the average annual cost
				of tuition at land–grant colleges and universities (as determined by the
				Secretary annually), for each year that the qualified applicant—</text>
							<paragraph id="id299137FD9E864B2C84CA3E37895E00CC"><enum>(1)</enum><text>is an owner or
				operator of a family dairy farm; and</text>
							</paragraph><paragraph id="id3442A6912E964A5E930B3AE9545EA2B9"><enum>(2)</enum><text>has not otherwise
				received loan repayment on behalf of the qualified applicant under this section
				or any other Federal or State program.</text>
							</paragraph></subsection><subsection id="IDce7f49ede4d342338be72758ca7fdb64"><enum>(d)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Nothing in this section authorizes the
				refunding of any repayment of a qualified loan.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id739DA19B110643E7A3C0A0F1984A40C5"><enum>(e)</enum><header display-inline="yes-display-inline">Exclusion from income</header><text display-inline="yes-display-inline">Any payment to, or on behalf of, a
				qualified applicant under this subtitle shall not be included in the gross
				income of the qualified applicant for purposes of the Internal Revenue Code of
				1986.</text>
						</subsection><subsection id="IDe329630be96444c3a3c8d4c12a3deb32"><enum>(f)</enum><header>Authorization
				of appropriations</header>
							<paragraph id="idB713AACE0F5C4B5CAB79776E7F6562EA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">There are authorized
				to be appropriated such sums as are necessary to carry out this
				subtitle.</text>
							</paragraph><paragraph id="idED3D07C9D6F14C888CDED8F64B0F21EE"><enum>(2)</enum><header>Insufficient
				funds</header><text display-inline="yes-display-inline">If the total amount of
				funds appropriated to carry out this subtitle is insufficient to provide loan
				repayment under the program for all eligible qualified applicants, the
				Secretary shall provide loan repayment to eligible qualified applicants on a
				pro rata
				basis.</text>
							</paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>

			 reporting of dairy commodities</header>

			 Act of 1946 (7 U.S.C. 1637a) is amended to read as follows:</text>

				term <term>dairy commodity</term> includes—</text>

				milk;</text>
								</clause><clause id="id38E2EA1943BA4C84AD5BC84844ECE3E7"><enum>(v)</enum><text>skim milk;</text>
								</clause><clause id="idD75A641A60CB4763B7DDB0636407AA66"><enum>(vi)</enum><text>whey
				products;</text>
								</clause><clause id="idAD88989568D3407C8FC76CAA98F1DE8E"><enum>(vii)</enum><text>dry proteins
				(such as a milk protein concentrate, casein, and a caseinate);</text>
								</clause><clause id="id6857E8D010B24D578893CA0977714E4B"><enum>(viii)</enum><text>a lactose
				product; and</text>
								</clause><clause id="id9676AC0C88C64EF79198CCA6D569D550"><enum>(ix)</enum><text>a fresh dairy
				product (such as yogurt and ice cream).</text>
								</clause></subparagraph></paragraph><paragraph id="idEDB06AC7CFE143B4972136D49899F82C"><enum>(2)</enum><header>Dairy
				processor</header><text>The term <term>dairy processor</term> means a person or
				legal entity that commercially processes milk into cheese, butter, nonfat dry
				milk, or other dairy solids.</text>
						</paragraph><paragraph id="idA5AE92FAD0EF433194A76BE233ED448F"><enum>(3)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of
				Agriculture.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID3c53ec6138284d70af109a34fbb13fe3"><enum>(b)</enum><header>Mandatory
			 reporting</header><text>Section 273 of the Agricultural Marketing Act of 1946
			 (7 U.S.C. 1637b) is amended—</text>
				<paragraph id="ID8e2a2eeafa17409fae4e10e11212a731"><enum>(1)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (d) and (e), respectively; and</text>
				</paragraph><paragraph id="ID546ca379bb534298b039f059cecc6a89"><enum>(2)</enum><text>by striking
			 subsections (a) and (b) and inserting the following:</text>

				price;</text>
								</subparagraph><subparagraph id="ID2bf7156efb1144a39785751a1e10b073"><enum>(B)</enum><text>the quantity
				sold;</text>
								</subparagraph><subparagraph id="IDaa9c21c120d3475194cb07cbb105d60c"><enum>(C)</enum><text>the location of
				the sales transaction; and</text>
								</subparagraph><subparagraph id="IDd6e829f2a5d64665abf51e38efd5adfe"><enum>(D)</enum><text>product
				characteristics, including—</text>
									<clause id="ID1c59e0e490f142fe992f5d95cdc32df2"><enum>(i)</enum><text>moisture
				level;</text>
									</clause><clause id="ID56cbdfd1326041afb752f06287be62da"><enum>(ii)</enum><text>packaging
				size;</text>
									</clause><clause id="IDe30ff9f845514789816832ecdda7d8dd"><enum>(iii)</enum><text>grade;</text>

				Secretary shall make the information reported under paragraph (1) available to
				the public not less frequently than once each reporting day, categorized by
				location and product characteristics.</text>
							</paragraph></subsection><subsection id="ID3224ea70559e4b118274a6434ec9e65c"><enum>(b)</enum><header>Weekly
				reporting</header>
							<paragraph id="id4B48A9D6F6284E02AE1FBF9291AB3EF8"><enum>(1)</enum><header>In
				general</header><text>The corporate officers or officially–designated
				representatives of each dairy processor shall report to the Secretary, on the
				first reporting day of each week, not later than 9:00 a.m. Central Time, for
				the prior week information concerning—</text>
								<subparagraph id="IDaed35d7fe2fd4544a080b6a29c1901cb"><enum>(A)</enum><text>the sales prices
				for sales transactions involving dairy commodities, categorized by product
				characteristics; and</text>
								</subparagraph><subparagraph id="ID23e67d3ac0ed48f886854c6fbfd681f4"><enum>(B)</enum><text>the quantities of
				dairy commodities sold.</text>
								</subparagraph></paragraph><paragraph id="id285865621BFC48EBAC72DB3C3271D217"><enum>(2)</enum><header>Publication</header><text>The
				Secretary shall make the information reported under paragraph (1) available to
				the public on the first reporting day of the each week, not later than 10:00
				a.m. Central Time, categorized by location and product characteristics.</text>
							</paragraph><paragraph id="id3DDE0D4043784B02B8F59377A7E6E6D7"><enum>(3)</enum><header>Federal order
				prices</header><text>The Secretary shall use weekly prices published under
				paragraph (2) to calculate Federal milk marketing order prices.</text>
							</paragraph></subsection><subsection id="IDcd7b7750724649fa8ddcdfe5af073865"><enum>(c)</enum><header>Monthly
				reporting</header>
							<paragraph id="id2A2E5768E29E4CE29C3D3E20A636360B"><enum>(1)</enum><header>In
				general</header><text>The corporate officers or officially-designated
				representatives of each dairy processor shall report to the Secretary, on the
				first reporting day of each month, not later than 9:00 a.m. Central Time, the
				quantity of all dairy commodities processed by the dairy processor during the
				prior month.</text>

				Secretary shall make the information reported under paragraph (1) available to
