<official-title>To amend title 10, United States Code, to improve the management of medical care for members of the Armed Forces, to improve the speed and efficiency of the physical disability evaluation system of the Department of Defense, and for other purposes.</official-title>

<section id="id6494AB24105949ABB9FEB717140159B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemembers' Healthcare Benefits and Rehabilitation Enhancement Act of 2007</short-title></quote>.</text> </section>
<section display-inline="no-display-inline" id="H4618E4698DB34FF9B5A94459D412D7FF" section-type="subsequent-section"><enum>2.</enum><header>Improvements to medical and dental care for recovering service members</header> 
<subsection commented="no" display-inline="no-display-inline" id="HC5D6BD9D8E2C4C5392A9E6D6DFCD0373"><enum>(a)</enum><header>In general</header><text>Chapter 55 of title 10, United States Code, is amended by inserting after section 1074k the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="id73D80456EAA948CA987836DE3D17F5AB" style="OLC"> 
<section id="H4B37FB9DDAA941F18183317D3DF21313"><enum>1074l.</enum><header>Management of medical and dental care for recovering service members</header> 
<subsection id="id380EA25D8DFE459AB53470E939F85B23"><enum>(a)</enum><header>Medical care managers</header>
<paragraph commented="no" display-inline="yes-display-inline" id="id11BC873E8ED5483F8D9F86145B5E965B"><enum>(1)</enum><text>The Secretary of Defense shall assign a medical care manager to each recovering service member.</text> </paragraph>
<paragraph id="H268F28CF487E46FBA3843132A3002B30" indent="up1"><enum>(2)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="id0DCE17D076F845D99C913417F44DC99C"><enum>(A)</enum><text>The duties of the medical care manager shall include the following with respect to the recovering service member:</text> 
<clause id="H419AECB2D0F940B38CC9822C2E657074" indent="up1"><enum>(i)</enum><text>To assist in understanding the recovering service member’s medical status.</text> </clause>
<clause id="H5B6374A091CB416995F2539476B012BA" indent="up1"><enum>(ii)</enum><text>To assist in receiving prescribed medical care.</text> </clause>
<clause id="H93596B5D27164682B1450005156D9BBB" indent="up1"><enum>(iii)</enum><text>To conduct a review, at least once a week, of the recovering service member’s medical status.</text> </clause></subparagraph>
<subparagraph display-inline="no-display-inline" id="HBB51B7D1F0C449D1BCBA86FC63574FCF" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The weekly medical status review described in subparagraph (A)(iii) shall be conducted in person with—</text> 
<clause display-inline="no-display-inline" id="id249F3CBDD1BF43ACB9D97206ED06E6F2"><enum>(i)</enum><text display-inline="yes-display-inline">in the case the recovering service member is not incapacitated, the recovering service member; or</text> </clause>
<clause display-inline="no-display-inline" id="id0DC315D406C84C9DB7BBF811EC656DB9"><enum>(ii)</enum><text>in the case the recovering service member is incapacitated—</text> 
<subclause display-inline="no-display-inline" id="idA160F7485F6A41A9A1CE50698FA38080"><enum>(I)</enum><text>in the case a family member of the recovering service member is available, such family member; or</text> </subclause>
<subclause display-inline="no-display-inline" id="idB670A8F560374FDFBFE8C6D5FC19BBA3"><enum>(II)</enum><text>in the case a family member of the recovering service member is not available, an independent service member advocate from a veterans service organization.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="id63BAD7FED37A41619D287565F4BCA5C7" indent="up1"><enum>(3)</enum><text>Each medical care manager shall not be assigned at any one time to manage more than 17 recovering service members.</text> </paragraph>
<paragraph id="H084F5E9DD3954CAD832EC2F3B3A7AFFE" indent="up1"><enum>(4)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="id2B1DE191AF224F3DB47D41FDDA89E645"><enum>(A)</enum><text>The Secretary of Defense shall establish a standard training and certification program and curriculum for medical care managers.</text> </subparagraph>
<subparagraph id="id1F94972219974CC0A2021B2B3F4C83CC" indent="up1"><enum>(B)</enum><text>Successful completion of the training program and annual certification shall be required before a person may assume the duties of a medical care case manager.</text> </subparagraph></paragraph></subsection>
<subsection id="id8B33C8DB97BA42E58DE2F00E0A041DD6"><enum>(b)</enum><header>Caseworkers</header>
<paragraph commented="no" display-inline="yes-display-inline" id="id482CBEA4318947DB99B9FA5851EBA4FE"><enum>(1)</enum><text>The Secretary of Defense shall assign a caseworker to each recovering service member.</text> </paragraph>
<paragraph id="id0E5D3C54CA5D4FA094FCC6C368B0C02D" indent="up1"><enum>(2)</enum><text>The duties of a caseworker shall include assisting each such recovering service member and their family members in obtaining all the information necessary for the following:</text> 
<subparagraph id="idD07BA06F71D34984852C744337462827"><enum>(A)</enum><text>The recovery of such recovering service member from an injury or illness.</text> </subparagraph>
<subparagraph id="id41BDC0B402C04CB1B22C365014071172"><enum>(B)</enum><text>The transition of such recovering service member to civilian life or to other duties within the Department of Defense.</text> </subparagraph>
<subparagraph id="id054CCBAFB895446AAD682C1BD87E87D5"><enum>(C)</enum><text>The receipt of benefits to which such recovering service member is entitled under the laws administered by the Secretary of Defense.</text> </subparagraph></paragraph>
<paragraph id="idA0C760D810984E86B014E204B20383B1" indent="up1"><enum>(3)</enum><text>Each caseworker shall not be assigned at any one time to manage more than 34 recovering service members.</text> </paragraph>
<paragraph id="id0F8656439507437BA7E5C9DCDA1A4790" indent="up1"><enum>(4)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="id7BECB029E04D435EBB26165D8ADF56B2"><enum>(A)</enum><text>The Secretary of Defense shall establish a standard training and certification program and curriculum for caseworkers.</text> </subparagraph>
<subparagraph id="idA21E9DAF57F24DD19DA85603FEDA8A84" indent="up1"><enum>(B)</enum><text>Successful completion of the training program and annual certification shall be required before a person may assume the duties of a caseworker.</text> </subparagraph></paragraph>
<paragraph id="id83C45F2AE2AA4D24A3686251528ED9D4" indent="up1"><enum>(5)</enum><text>Each caseworker shall report to the department-wide Ombudsman Office established by section 3 of the <short-title>Servicemembers' Healthcare Benefits and Rehabilitation Enhancement Act of 2007</short-title>.</text> </paragraph></subsection>
<subsection id="IDdee9d7a2406b42658d8db584e1039438"><enum>(c)</enum><header>Independent service member advocates</header><text>The Secretary of Defense shall work to expand access to veterans service organizations to provide independent service member advocates to recovering service members that—</text> 
<paragraph id="idD58EEBD1D51147F8B4A1405DD043AD84"><enum>(1)</enum><text>do not report to the Secretary of Defense;</text> </paragraph>
<paragraph id="id38B770406E5942EAA3EA1DF75AB17ED0"><enum>(2)</enum><text>advise recovering service members on issues related to the medical records and service records of such recovering service members; and</text> </paragraph>
<paragraph id="idCAF08BB4A7B54376ACDEAF59C7BE6D19"><enum>(3)</enum><text>provide recovering service members with such information as may be necessary for such recovering service members to prepare for reviews by physical evaluation boards.</text> </paragraph></subsection>
<subsection id="id40B825C3095D416ABE8A40753CA989F1"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id42922924B07C40C484FFC0FC8720A625"><enum>(1)</enum><text>The term <term>family member</term>, with respect to a recovering service member, has the meaning given that term in section 411h(b) of title 37.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id97C0884BF92C4BBDA163ABA0AA762A58"><enum>(2)</enum><text>The term <term>physical disability evaluation system</term> means the Department of Defense system or process for evaluating the nature of and extent of disabilities affecting members of the armed forces (other than the Coast Guard) and comprised of medical evaluation boards, physical evaluation boards, counseling of members, and final disposition by appropriate personnel authorities, as operated by the Secretaries concerned, and, in the case of the Coast Guard, a similar system or process operated by the Secretary of Homeland Security.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id51F366BDAE2C4556B74A732DFF0DEA79"><enum>(3)</enum><text>The term <term>recovering service member</term> means a member of the armed forces, including a member of the National Guard or a Reserve, who is undergoing medical treatment, recuperation, or therapy, or is otherwise in medical hold or holdover status, for an injury, illness, or disease incurred or aggravated while on active duty in the armed forces.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id18DCB24E487A42B28F071318F89B9AB0"><enum>(4)</enum><text>The term <term>veterans service organization</term> means any organization organized by the Secretary of Veterans Affairs for the representation of veterans under section 5902 of title 38.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H1A3E142425294916AF7CAED7119FC7ED"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<toc-entry level="section">1074l. Management of medical and dental care for recovering service members.</toc-entry> </toc> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="id76103567A6CE470A84F9D0DCA25BEF0F"><enum>3.</enum><header>Establishment of Ombudsman Office for entire Department of Defense</header> 
<subsection id="id1F7D69A234AA43CFA51BD3553FD8002D"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Defense shall establish within the Office of the Secretary of Defense a department-wide Ombudsman Office (in this subsection referred to as the <quote>Ombudsman Office</quote>).</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="id5A150DC6218B4DFD881670FF4C4F9146"><enum>(b)</enum><header>Functions</header><text>The functions of the Ombudsman Office established under subsection (a) are—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id77230474A03540EFBFEE9B574C936EDE"><enum>(1)</enum><text>to provide policy guidance to, and oversight of, the ombudsman offices in the military departments; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idDF4CA5F3FAE8406780BE933CAB6E3AA8"><enum>(2)</enum><text>to monitor the medical system of the Department of Defense, including the following:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id223034994CDF4EB1A37DAC81D754C220"><enum>(A)</enum><text>The physical disability evaluation system.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idD979F9B126AB481E96E388BB5BDD09F2"><enum>(B)</enum><text>The caseworkers, medical care managers, and independent advocates described in section 1074l of title 10, United States Code, as added by section 2 of this Act.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idAB54DD09EACF45CAAE4D49AE9D241759"><enum>(C)</enum><text>The condition of health care treatment facilities of the Department of Defense.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idD952E364420F48C2A5ABB7BBB366B73D"><enum>(D)</enum><text>The transition of care for recovering service members from care provided by the Department of Defense to care provided by the Department of Veterans Affairs.</text> </subparagraph></paragraph></subsection></section>
<section id="IDc50a13cc655c463ca9784d60ad0f05fb"><enum>4.</enum><header>Improvement of physical disability evaluation system, schedule for rating disabilities, and disability retirement evaluation</header> 
<subsection id="id0E9D3DCBB18D48DA9F4EA5FEB468D11F"><enum>(a)</enum><header>Improvement of physical disability evaluation system</header><text>Section 1222 of title 10, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="id3CD1E8A6C9184F0AA3C23D302860C35A" style="OLC"> 
<subsection id="id3E71E4CEFD7A4540824E320B0F12DA68"><enum>(d)</enum><header>Efforts To improve speed and efficiency of physical disability evaluation system</header>
<paragraph commented="no" display-inline="yes-display-inline" id="idBB4D43D4AFDA42419D05EBE29C245156"><enum>(1)</enum><text>The Secretary of Defense shall undertake efforts to improve the speed and efficiency of the physical disability evaluation system.</text> </paragraph>
<paragraph id="id98F685975F9B46DB9037E386F870702F" indent="up1"><enum>(2)</enum><text>The Secretary of Defense shall place the physical evaluation boards of each military department under one command to make the physical disability evaluation system more expeditious.</text> </paragraph>
<paragraph id="idF50B736A858B47F3B1ECEFD45FB25689" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>physical disability evaluation system</term> means the Department of Defense system or process for evaluating the nature of and extent of disabilities affecting members of the armed forces (other than the Coast Guard) and comprised of medical evaluation boards, physical evaluation boards, counseling of members, and final disposition by appropriate personnel authorities, as operated by the Secretaries concerned, and, in the case of the Coast Guard, a similar system or process operated by the Secretary of Homeland Security.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="id6209E09ECDBF40B6AF760D4B50D25F22"><enum>(b)</enum><header>Joint report on modernization of the schedule for rating disabilities in use by Department of Veterans Affairs</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the appropriate committees of Congress a plan to update the schedule for rating disabilities in use by the Department of Veterans Affairs to reflect the effects of mental health disorders, including traumatic brian injury and post-traumatic stress disorder, on the modern workforce.</text> </subsection>
<subsection id="id47811894E27C4836BF6E46F6E5122268"><enum>(c)</enum><header>Retirement or separation for physical disability</header> 
<paragraph id="id5B5F569A0F314BB7A46461E47666B2B1"><enum>(1)</enum><header>In general</header><text>Chapter 61 of title 10, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="id64B4301A304E44DC8CC2453DB41BD7A3" style="USC"> 
<section id="idA042DB3E4AAE40C4A2D1E6CABF15B12F"><enum>1223.</enum><header>Members with multiple disabilities</header><text display-inline="no-display-inline">In making a determination under this chapter, the Secretary concerned shall consider all of the disabilities, injuries, illnesses, or disease of a member incurred or aggravated while on active duty and consider the cumulative severity of all of those disabilities, injuries, illnesses, or diseases.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="id58F69460A31B4CB5852E957AD1ACDE3E"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 61 is amended by adding at the end the following new item:</text>

<toc-entry bold="off" level="section">1223. Members with multiple disabilities.</toc-entry> </toc> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="idD450CD3B1C3E4F629D21A0FD85073DB8"><enum>(d)</enum><header>Prioritization of retirement processing</header><text>The Secretary of Defense shall establish a system for the prioritization of processing the separation of members of the Armed Forces. Such system shall place the highest priority on recovering service members.</text> </subsection>
<subsection id="IDb27eb25d413948198203f9021abe7d85"><enum>(e)</enum><header>No reduction in disability rating</header><text>Once a disability rating is assigned by an informal physical evaluation board, the Secretary of Defense may not reduce such rating upon appeal.</text> </subsection></section>
<section id="IDb12041750f7a4e86a5c21e8fe1dfe67c"><enum>5.</enum><header>Establishment of medical record database</header> 
<subsection id="idB324007ED6B645CE9E3B0A5B9E9C2474"><enum>(a)</enum><header>In general</header><text>The Secretary of Defense shall establish a medical record database to track and record the medical status of all members of the Armed Forces.</text> </subsection>
<subsection id="id3A4E493EF29347C59644EF5F12D87D0B"><enum>(b)</enum><header>Database design</header><text>To the extent practicable, the database established under subsection (a) shall be substantially the same as the Computerized Patient Record System of the Department of Veterans Affairs' Veterans Health Information Systems and Technology Architecture (VistA).</text> </subsection>
<subsection id="idC7D2D870FC59493DA56CE8E5D22BD7B8"><enum>(c)</enum><header>Access to Department of Defense medical record database by Department of Veterans Affairs</header><text>The Secretary of Defense shall make such system accessible to the Department of Veterans Affairs through the Joint Patient Tracking Application of the Department of Defense.</text> </subsection>
<subsection id="idB1263A97709A4F438E5D9BC1FAC294C5"><enum>(d)</enum><header>Privacy and security</header><text>The Secretary of Defense shall—</text> 
<paragraph id="id89824917C5CB4C9FA2992716306CB2A4"><enum>(1)</enum><text>ensure that the system conforms with all applicable privacy laws; and</text> </paragraph>
<paragraph id="id1A2D81B213874BE3B75CE7D0B0F3FC81"><enum>(2)</enum><text>take appropriate measures to ensure the security of the system.</text> </paragraph></subsection>
<subsection id="id9F5E5426D99E44EC8EFE15CF3907CF45"><enum>(e)</enum><header>Tracking of members of the Armed Forces and veterans with traumatic brain injury</header> 
<paragraph id="idC2A9B98AAD224993946A23EC3D359774"><enum>(1)</enum><header>Members of the Armed Forces</header><text>The Secretary of Defense shall use the system established under subsection (a) to track members of the Armed Forces who have been diagnosed with traumatic brain injury.</text> </paragraph>
<paragraph id="id70D6A9DB1CF24411BFA14216BBAF64E3"><enum>(2)</enum><header>Veterans</header><text>The Secretary of Veterans Affairs shall use the Veterans Health Information Systems and Technology Architecture (VistA) to track veterans who have been diagnosed with traumatic brain injury.</text> </paragraph></subsection></section>
<section id="ID80d3bb37759b42adbe7a4549c8eb4139"><enum>6.</enum><header>Assessing the mental health of members of the Armed Forces before and after deployment in a combat theater</header> 
<subsection id="id9732D4388A144A2EA738620DBA0A9AE4"><enum>(a)</enum><header>In general</header><text>The Secretary of Defense shall assess the mental health of each member of the Armed Forces who is deployed to a combat theater, or who the Secretary expects to deploy to a combat theater, at least once during—</text> 
<paragraph id="idD63E795A8D9341CBB2926020114D821B"><enum>(1)</enum><text>the 240-day period beginning 120 days before the date on which a member is deployed in a combat theater;</text> </paragraph>
<paragraph id="id03DA9D1C21104FBF941BE04D4D3771CC"><enum>(2)</enum><text>the 60-day period beginning on the date that such member returns from deployment in a combat theater; and</text> </paragraph>
<paragraph id="idB6D39DF9595A4B6594FFB4C2AB692667"><enum>(3)</enum><text>the predischarge physical of such member.</text> </paragraph></subsection>
<subsection id="idEEB02D935DCE4D0FB555D97DD50B4B6D"><enum>(b)</enum><header>Testing of neurocognitive functioning</header><text>A mental health assessment provided to a member in accordance with subsection (a)(1) shall test the neurocognitive functioning of such member.</text> </subsection>
<subsection id="id01B19EA064CA4A9F99911C793172DA9B"><enum>(c)</enum><header>Testing for traumatic brain injury</header><text>A mental health assessment provided to a member in accordance with paragraphs (2) and (3) of subsection (a) shall include a comprehensive screening for mild, moderate, and severe cases of traumatic brain injury.</text> </subsection></section>
<section id="id0BE321F1DDB5478F8C9E49115DF7EFC3"><enum>7.</enum><header>Report on access to private health care</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense and the Secretary of Veterans Affairs shall submit to the appropriate committees of Congress a report detailing plans to increase the role of eligible private sector rehabilitation providers in the provision of comprehensive post acute inpatient and outpatient rehabilitation by the Department of Veterans Affairs to members and former members of the Armed Forces with traumatic brain injury or post-traumatic stress disorder when the Department is unable to provide such services without the assistance.</text> </section>
<section display-inline="no-display-inline" id="H75839BE1E07249E7AC2E50CCF1F7ADD" section-type="subsequent-section"><enum>8.</enum><header>Notification to Congress of hospitalization of combat wounded service members</header> 
<subsection display-inline="no-display-inline" id="H670A7726B3F34E75A2CAA64C2B6D1463"><enum>(a)</enum><header>Notification required</header><text>Chapter 55 of title 10, United States Code, is further amended by inserting after section 1074l, as added by section 2 of this Act, the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H2B0FB76893704DEFB7DC4D325FCF60CF" style="USC"> 
<section id="H0DD3A5F857E541668CA7E200B40C624"><enum>1074m.</enum><header>Notification to Congress of hospitalization of combat wounded members</header> 
<subsection id="HBE1B56E31B8843BBAE994C00E5E8F80"><enum>(a)</enum><header>Notification required</header><text display-inline="yes-display-inline">The Secretary concerned shall provide to the appropriate Members of Congress notification of the hospitalization of any recovering service member (within the meaning of section 1074l(d)(3) of this title) evacuated from a theater of combat to allow such Members of Congress to provide such recovering service member with assistance if necessary.</text> </subsection>
<subsection id="idCD47FE188AA04816A8558A94BF47ED0F"><enum>(b)</enum><header>Appropriate Members</header><text>In this section, the term <term>appropriate Members of Congress</term>, with respect to the member of the armed forces about whom notification is being made, means the Senators and the Members of the House of Representatives representing the States or districts, respectively, that include the member's home of record and, if different, the residence of the next of kin, or a different location as provided by the member.</text> </subsection>
<subsection id="HD10439A35A1D4DBA9CD9CD5D9B651F85"><enum>(c)</enum><header>Consent of member required</header><text>The notification under subsection (a) may be provided only with the consent of the member of the armed forces about whom notification is to be made. In the case of a member who is unable to provide consent, information and consent may be provided by next of kin.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<paragraph id="id8BF5C48FEAEC43F0BA89BFB402978F9D"><enum>(1)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text> 
<subparagraph id="id114E9C07711949B182187AB8874016D6"><enum>(A)</enum><text>the Committees on Armed Services and Veterans' Affairs of the Senate; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id1FD21C3193BF4ABDBC7891A592DA86B0"><enum>(B)</enum><text>the Committees on Armed Services and Veterans' Affairs of the House of Representatives.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8B2D962BF9834C5DB44CEFF41AE03D5C"><enum>(2)</enum><header>Physical disability evaluation system</header><text>The term <term>physical disability evaluation system</term> means the Department of Defense system or process for evaluating the nature of and extent of disabilities affecting members of the Armed Forces (other than the Coast Guard) and comprised of medical evaluation boards, physical evaluation boards, counseling of members, and final disposition by appropriate personnel authorities, as operated by the Secretaries of the military departments, and, in the case of the Coast Guard, a similar system or process operated by the Secretary of Homeland Security.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idF86F47B512E143A19974703CFB4896A9"><enum>(3)</enum><header>Recovering service member</header><text>The term <term>recovering service member</term> means a member of the Armed Forces, including a member of the National Guard or a Reserve, who is undergoing medical treatment, recuperation, or therapy, or is otherwise in medical hold or holdover status, for an injury, illness, or disease incurred or aggravated while on active duty in the Armed Forces.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id2C686A4170F64149B12D7AA451355F48"><enum>(4)</enum><header>Combat theater</header><text>The term <term>combat theater</term> means the geographical area outside the continental United States required by combat and support forces for the conduct of military operations.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8DD1B84B70304E42B5926F4FA89FAEE3"><enum>(5)</enum><header>Neurocognitive</header><text>The term <term>neurocognitive</term> means of, relating to, or involving the central nervous system and cognitive or information processing abilities (thinking, memory, and reasoning), as well as sensory processing (sight, hearing, touch, taste, and smell), and communication (expression and understanding).</text> </paragraph></section>
