		<official-title>To provide for 2 programs to authorize the use of leave
		  by caregivers for family members of certain individuals performing military
		  service, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Military Family Support Act of
			 2007</short-title></quote>.</text>
		</section><section id="idD35BB932EFD84E42A1212A3372DB744B"><enum>2.</enum><header>Programs for use
			 of leave by caregivers for family members of individuals performing certain
			 military service</header>
			<subsection id="id43AA0AE2BE084E50B9030004C057231C"><enum>(a)</enum><header>Federal
			 employees program</header>
				<paragraph id="idDFD9495B2E3849BD93E858D721B4ED0F"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="idD6EAE6B6EB754DC28F9E841A247A1A7C"><enum>(A)</enum><header>Caregiver</header><text>The
			 term <term>caregiver</term> means an individual who—</text>
						<clause id="id7F2BC3B3727D4B99985AF1E453EDC0E7"><enum>(i)</enum><text>is
			 an employee;</text>
						</clause><clause id="idF5B9EDB92F44417CB73BDCB9D0C2BA87"><enum>(ii)</enum><text>is
			 at least 21 years of age; and</text>
						</clause><clause id="id215CE9B806384892A802026AC14521C2"><enum>(iii)</enum><text>is capable of
			 self care and care of children or other dependent family members of a qualified
			 member of the Armed Forces.</text>
						</clause></subparagraph><subparagraph id="idF591016A5F1847178F53B80A37117674"><enum>(B)</enum><header>Covered period
			 of service</header><text>The term <term>covered period of service</term> means
			 any period of service performed by an employee as a caregiver while the
			 individual who designated the caregiver under paragraph (3) remains a qualified
			 member of the Armed Forces.</text>
					</subparagraph><subparagraph id="idEBA8225E125E4653A362C1CCD1231772"><enum>(C)</enum><header>Employee</header><text>The
			 term <term>employee</term> has the meaning given under section 6331 of title 5,
			 United States Code.</text>
					</subparagraph><subparagraph id="id1CBD349A82B84E0A8064DAF1D8E70E02"><enum>(D)</enum><header>Family
			 member</header><text>The term <term>family member</term> includes—</text>
						<clause id="id158C8AF53C544ABEBABA88705B3FCE3B"><enum>(i)</enum><text>individuals for
			 whom the qualified member of the Armed Forces provides medical, financial, and
			 logistical support (such as housing, food, clothing, or transportation);
			 and</text>
						</clause><clause id="idCE9D08E849ED49FFB984EA00AF81611F"><enum>(ii)</enum><text>children under
			 the age of 19 years, elderly adults, persons with disabilities, and other
			 persons who are unable to care for themselves in the absence of the qualified
			 member of the Armed Forces.</text>
						</clause></subparagraph><subparagraph id="id0CF10C595BD441F7989A36D076148594"><enum>(E)</enum><header>Qualified
			 member of the armed forces</header><text>The term <term>qualified member of the
			 Armed Forces</term> means—</text>
						<clause id="id28ACCE1DBF714731BD51C72CA19612BA"><enum>(i)</enum><text>a
			 member of a reserve component of the Armed Forces as described under section
			 10101 of title 10, United States Code, who has received notice to report to, or
			 is serving on, active duty in the Armed Forces in support of a contingency
			 operation as defined under section 101(a)(13) of title 10, United States Code;
			 or</text>
						</clause><clause id="id49F92A54B5C4481F9E2C266896DD4898"><enum>(ii)</enum><text>a
			 member of the Armed Forces on active duty who is eligible for hostile fire or
			 imminent danger special pay under section 310 of title 37, United States
			 Code.</text>
						</clause></subparagraph></paragraph><paragraph id="idFD60AC332C36400084CFDEE2FD901C4D"><enum>(2)</enum><header>Establishment
			 of program</header><text>The Office of Personnel Management shall establish a
			 program to authorize a caregiver to—</text>
					<subparagraph id="id2E517A34575243DFB5F676824CEB4B29"><enum>(A)</enum><text>use any sick
			 leave of that caregiver during a covered period of service in the same manner
			 and to the same extent as annual leave is used; and</text>
					</subparagraph><subparagraph id="id4404D7E595D7450190241D0FB4F18B71"><enum>(B)</enum><text>use any leave
			 available to that caregiver under subchapter III or IV of chapter 63 of title
			 5, United States Code, during a covered period of service as though that
			 covered period of service is a medical emergency.</text>
					</subparagraph></paragraph><paragraph id="idFCCFDFC700E04B278F2DE9F6D82DF5A8"><enum>(3)</enum><header>Designation of
			 caregiver</header>
					<subparagraph id="idDF66EDA15219422BAFB2BA1EA9C8B091"><enum>(A)</enum><header>In
			 general</header><text>A qualified member of the Armed Forces shall submit a
			 written designation of the individual who is the caregiver for any family
			 member of that member of the Armed Forces during a covered period of service to
			 the employing agency and the Office of Personnel Management.</text>
					</subparagraph><subparagraph id="id329D8FD2163144319E4667FD17E1AC78"><enum>(B)</enum><header>Designation of
			 spouse</header><text>Notwithstanding paragraph (1)(A)(ii), an individual less
			 than 21 years of age may be designated as a caregiver if that individual is the
			 spouse of the qualified member of the Armed Forces making the
			 designation.</text>
					</subparagraph></paragraph><paragraph id="id9079AF187080435EB05DBF85474F6231"><enum>(4)</enum><header>Use of
			 caregiver leave</header><text>Leave may only be used under this subsection for
			 purposes directly relating to, or resulting from, the designation of an
			 employee as a caregiver.</text>
				</paragraph><paragraph id="id8E19CAD0485D48F89C8B29CEC2B966DE"><enum>(5)</enum><header>Regulations</header><text>Not
			 later than 120 days after the date of enactment of this Act, the Office of
			 Personnel Management shall prescribe regulations to carry out this
			 subsection.</text>
				</paragraph><paragraph id="id2951C9F73A5A46D795ED2FE0729D0C2E"><enum>(6)</enum><header>Termination</header><text>The
			 program under this subsection shall terminate on December 31, 2012.</text>
				</paragraph></subsection><subsection id="idAAAF72884A5C414CBDE7F296FCCEFAE2"><enum>(b)</enum><header>Voluntary
			 private sector leave program</header>
				<paragraph id="idC9515F6C566D45FD981C2D808BE77EA4"><enum>(1)</enum><header>Definitions</header>
					<subparagraph id="idCB44327319BA4499B421CF6FFF0857E0"><enum>(A)</enum><header>Caregiver</header><text>The
			 term <term>caregiver</term> means an individual who—</text>
						<clause id="id5E2D1CF025F34262B25F69B6730000A7"><enum>(i)</enum><text>is
			 an employee;</text>
						</clause><clause id="id070C203CF6484F1091F1DFC2AF19B2E0"><enum>(ii)</enum><text>is
			 at least 21 years of age; and</text>
						</clause><clause id="id68D92E2A72EB40E6B833E94EAE7D857E"><enum>(iii)</enum><text>is capable of
			 self care and care of children or other dependent family members of a qualified
			 member of the Armed Forces.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54E4092DCCF04926B54EFE1B4C29AD1D"><enum>(B)</enum><header>Covered period
			 of service</header><text>The term <term>covered period of service</term> means
			 any period of service performed by an employee as a caregiver while the
			 individual who designated the caregiver under paragraph (4) remains a qualified
			 member of the Armed Forces.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id894C30CD33B24FD59E214090841F1B9A"><enum>(C)</enum><header>Employee</header><text>The
			 term <term>employee</term> means an employee of a business entity participating
			 in the program under this subsection.</text>
					</subparagraph><subparagraph id="id869F0CF5776E4DB98ABE1ABBA9C4C12C"><enum>(D)</enum><header>Family
			 member</header><text>The term <term>family member</term> includes—</text>
						<clause id="idE75EA5A928894DC69BCE52375709F3CD"><enum>(i)</enum><text>individuals for
			 whom the qualified member of the Armed Forces provides medical, financial, and
			 logistical support (such as housing, food, clothing, or transportation);
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id93D1399344074FD2BE8715B2E5141A39"><enum>(ii)</enum><text>children under
			 the age of 19 years, elderly adults, persons with disabilities, and other
			 persons who are unable to care for themselves in the absence of the qualified
			 member of the Armed Forces.</text>
						</clause></subparagraph><subparagraph id="id32E97E3D710B4E7584B5A64A8FE19527"><enum>(E)</enum><header>Qualified
			 member of the armed forces</header><text>The term <term>qualified member of the
			 Armed Forces</term> means—</text>
						<clause id="idC46DF022C5244B13A2ED2298A53445B5"><enum>(i)</enum><text>a
			 member of a reserve component of the Armed Forces as described under section
			 10101 of title 10, United States Code, who has received notice to report to, or
			 is serving on, active duty in the Armed Forces in support of a contingency
			 operation as defined under section 101(a)(13) of title 10, United States Code;
			 or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8AF27814DD5E41369CC14CF6199FFDD0"><enum>(ii)</enum><text>a member of the
			 Armed Forces on active duty who is eligible for hostile fire or imminent danger
			 special pay under section 310 of title 37, United States Code.</text>
						</clause></subparagraph></paragraph><paragraph id="id6D919FB23CBF49A1AC9A756DC20B867B"><enum>(2)</enum><header>Establishment
			 of program</header>
					<subparagraph id="id08106C10733548A58935411CA89A8388"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Labor shall establish a program to
			 authorize employees of business entities described under paragraph (3) to use
			 sick leave, or any other leave available to an employee, during a covered
			 period of service in the same manner and to the same extent as annual leave (or
			 its equivalent) is used.</text>
					</subparagraph><subparagraph id="id932395CCCA2E4E698F8866A9F9B6B666"><enum>(B)</enum><header>Exception</header><text>Subparagraph
			 (A) shall not apply to leave made available under the Family and Medical Leave
			 Act of 1993 (29 U.S.C. 2601 et seq.).</text>
					</subparagraph></paragraph><paragraph id="idEA5A4599D70C4BD49882CEC6C16B2658"><enum>(3)</enum><header>Voluntary
			 business participation</header><text>The Secretary of Labor shall solicit
			 business entities to voluntarily participate in the program under this
			 subsection.</text>
				</paragraph><paragraph id="id54DDF90223114C4DB548F3C8F30E8646"><enum>(4)</enum><header>Designation of
			 caregiver</header>
					<subparagraph id="idEA1014AAD3AE4CBE98972BB75D3B9E81"><enum>(A)</enum><header>In
			 general</header><text>A qualified member of the Armed Forces shall submit a
			 written designation of the individual who is the caregiver for any family
			 member of that member of the Armed Forces during a covered period of service to
			 the employing business entity.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBD20C3B6F407424E9EA630A9189109F3"><enum>(B)</enum><header>Designation of
			 spouse</header><text>Notwithstanding paragraph (1)(A)(ii), an individual less
			 than 21 years of age may be designated as a caregiver if that individual is the
			 spouse of the qualified member of the Armed Forces making the
			 designation.</text>
					</subparagraph></paragraph><paragraph id="idA0A5D3D0E38144879C0A9053BAD051D1"><enum>(5)</enum><header>Use of
			 caregiver leave</header><text>Leave may only be used under this subsection for
			 purposes directly relating to, or resulting from, the designation of an
			 employee as a caregiver.</text>
				</paragraph><paragraph id="idC081AC89B7C14CBFBEB04CA65A87C955"><enum>(6)</enum><header>Regulations</header><text>Not
			 later than 120 days after the date of enactment of this Act, the Secretary of
			 Labor shall prescribe regulations to carry out this subsection.</text>
				</paragraph><paragraph id="id51B469FA69524E25B85DC09CCC7EA2B5"><enum>(7)</enum><header>Termination</header><text>The
			 program under this subsection shall terminate on December 31, 2012.</text>
				</paragraph></subsection><subsection id="id79B0D9FFAFCB430AA104A0A5AF7A6933"><enum>(c)</enum><header>GAO
			 report</header><text display-inline="yes-display-inline">Not later than June
			 30, 2010, the Government Accountability Office shall submit a report to
			 Congress on the programs under subsections (a) and (b) that includes—</text>
				<paragraph id="idC307EFDB58D24A4BAF79B5EEE6D2D1E3"><enum>(1)</enum><text>an evaluation of
			 the success of each program; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE37CA6AF57404D25AC77EDBF765E7409"><enum>(2)</enum><text>recommendations
			 for the continuance or termination of each program.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA42E52D6BBAB41E09262ED74654AD721"><enum>(d)</enum><header>Offset</header><text>The
			 aggregate amount authorized to be appropriated for fiscal year 2008 for the use
			 of the Department of Defense for research, development, test and evaluation
			 shall be reduced by $2,000,000.</text>
