		<official-title>To establish an emergency fuel assistance grant program
		  for small businesses during energy emergencies.</official-title>

		<section id="ID18ff865a6d7f43a5961149b55211f622" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Emergency Fuel
			 Assistance Act of 2007</short-title></quote>.</text>
		</section><section id="ID0e7622680cd7427a9d4a5a67e93d40f6"><enum>2.</enum><header>Emergency fuel
			 assistance program</header><text display-inline="no-display-inline">There is
			 established within the Economic Development Administration of the Department of
			 Commerce, an emergency assistance program for small businesses and small farms
			 dependent on fuel.</text>
		</section><section id="IDa174b171591540de964c8c3684b27511"><enum>3.</enum><header>Presidential
			 declaration of energy emergency</header>
			<subsection id="ID5becc76e86354ea4ba957eaabdf404ff"><enum>(a)</enum><header>In
			 general</header><text>If the President determines that the health, safety,
			 welfare, or economic well-being of the citizens of the United States is at risk
			 because of a shortage or imminent shortage of adequate supplies of crude oil,
			 gasoline or petroleum distillates due to a disruption in the national
			 distribution system for crude oil, gasoline or petroleum distillates (including
			 such a shortage related to a major disaster (as defined in section 102(2) of
			 the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
			 5122(2)))), or significant pricing anomalies in national energy markets for
			 crude oil, gasoline, or petroleum distillates, the President may declare that a
			 Federal energy emergency exists.</text>
			</subsection><subsection id="IDbaa9a9b53bcd46b990843bca05e7c8b7"><enum>(b)</enum><header>Scope and
			 duration</header><text>The emergency declaration declared pursuant to
			 subsection (a) shall specify—</text>
				<paragraph id="ID71569b05fd6e4c24bc7de602a5af0a24"><enum>(1)</enum><text>the period, not
			 to exceed 30 days, for which the declaration applies;</text>
				</paragraph><paragraph id="ID39babb1938fe4f58b70b33b175cbbab8"><enum>(2)</enum><text>the circumstance
			 or condition necessitating the declaration;</text>
				</paragraph><paragraph id="IDf59748dfcbd640a6bb14586dd92d018e"><enum>(3)</enum><text>the area or
			 region to which it applies which may not be limited to a single State;
			 and</text>
				</paragraph><paragraph id="ID30018d958c6f4fd0987a76607d974de2"><enum>(4)</enum><text>the product or
			 products to which it applies.</text>
				</paragraph></subsection><subsection id="ID2558ddcd1da94cad86a3b6915ec1bdcd"><enum>(c)</enum><header>Extensions</header><text>The
			 President may—</text>
				<paragraph id="IDc579f9aa44f04c798300b93123f0f637"><enum>(1)</enum><text>extend a
			 declaration under subsection (a) for a period of not more than 30 days;</text>
				</paragraph><paragraph id="ID4cfa6e4df098490c8caf2f605aff707d"><enum>(2)</enum><text>extend such a
			 declaration more than once; and</text>
				</paragraph><paragraph id="IDfbe21bc9880d4bcdbbb7f61d42a74b40"><enum>(3)</enum><text>discontinue such
			 a declaration before its expiration.</text>
				</paragraph></subsection></section><section id="ID4f5d6747dfb04f5590d133a4de4b763d"><enum>4.</enum><header>Authorization of
			 grants</header>
			<subsection id="id56F8FBA45C0A4C2B8E9FB6F94C1A3CF9"><enum>(a)</enum><header>In
			 general</header><text>During any energy emergency declared by the President
			 under section 3, the Secretary of Commerce is authorized to award grants to
			 States under a declaration of fuel supply interruption in accordance with this
			 Act.</text>
			</subsection><subsection id="id0B965332DC3B4CD1BA24536A9BB27367"><enum>(b)</enum><header>Allocation
			 formula</header><text>Subject to subsection (c), the Secretary shall award
			 grants to States, in accordance with an allocation formula established by the
			 Secretary, that is based on the pro rata share of each State of the total need
			 among all States, as applicable, for emergency assistance for fuel
			 interruption, as determined on the basis of—</text>
				<paragraph id="id6AF718106C9148DBAE4A6C08F78B39D8"><enum>(1)</enum><text>the number and
			 percentage of qualifying small businesses and small farms operating within a
			 State;</text>
				</paragraph><paragraph id="idB399E05750294B329493CDA23139C1B6"><enum>(2)</enum><text>the increase in
			 price of fuel in a State; and</text>
				</paragraph><paragraph id="id6969E00ECAF94E3BAF745EA62D8C16D6"><enum>(3)</enum><text>such other
			 factors as the Secretary determines to be appropriate.</text>
				</paragraph></subsection><subsection id="idB6D1837433DB4A75A34A948C1963B60B"><enum>(c)</enum><header>State
			 allocation plan</header><text>Each State shall establish, after giving notice
			 to the public, an opportunity for public comment, and consideration of public
			 comments received, an allocation plan for the distribution of financial
			 assistance under this section, which shall be submitted to the Secretary and
			 shall be made available to the public by the State, and shall include—</text>
				<paragraph id="id2C38072C96C34D67861382C5618A4EC5"><enum>(1)</enum><text>application
			 requirements for qualifying small businesses and small farms seeking to receive
			 financial assistance under this section, including a requirement that each
			 application include—</text>
					<subparagraph id="idC61879C135AE48F8B12884569B12A5A7"><enum>(A)</enum><text>demonstration of
			 need for assistance under this section;</text>
					</subparagraph><subparagraph id="idF4A2A79F75564902B267FB66301D28D8"><enum>(B)</enum><text>a plan to
			 decrease the total commercial energy usage of the small business through energy
			 efficiency measures, such as those promoted through the Energy Star Program;
			 and</text>
					</subparagraph><subparagraph id="id97CEB05FCFF94DFDB75C20C0C7F00B17"><enum>(C)</enum><text>if a small
			 business or small farm has previously received assistance under this section,
			 evidence that the small business or small farm has implemented the plan
			 previously documented under subparagraph (B); and</text>
					</subparagraph></paragraph><paragraph id="id9D3C5FCB0F004ACEA7229046A04109AB"><enum>(2)</enum><text>factors for
			 selecting among small businesses and small farms that meet the application
			 requirements, with preference given to small businesses and small farms based
			 on the percentage of operating costs expended on fuel.</text>
				</paragraph></subsection></section><section id="ID84eff15dda0e4f2b8adbdcb7b369127b"><enum>5.</enum><header>Eligibility</header><text display-inline="no-display-inline">A small business or small farm is eligible
			 for a grant under this Act if—</text>
			<subsection id="idF71719ABAB3F4CA8B3BB21EB3192F8A6"><enum>(a)</enum><text>the average gross
			 receipts of the small business or small farm for the 3 preceding taxable years
			 does not exceed $5,000,000; or</text>
			</subsection><subsection id="id565C2DEC11544FA3B4995A7E100A2BB3"><enum>(b)</enum><text>the small
			 business or small farm employed an average of more than 1 and fewer than 50
			 qualified employees on business days during the preceding taxable year.</text>
			</subsection></section><section id="IDf0547442f6544d3e8e788d8f71a565a2"><enum>6.</enum><header>Defined
			 term</header><text display-inline="no-display-inline">In this Act, the term
			 <term>aggregate gross assets</term> has the meaning given such term in section
			 1202(d)(2) of the Internal Revenue Code of 1986.</text>
		</section><section id="IDfa52f91212174e8dba9014fe05b839fc"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Department of Commerce $100,000,000 for
			 each of the fiscal years 2008 through 2012 to carry out this Act.</text>
