			 security improvement amendments; clarification of review and investigation
			 process</header><text display-inline="no-display-inline">Section 721 of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2170) is amended by striking
			 subsections (a) and (b) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id354CD0EF57524F6D8DD9813E7569E401" style="OLC">
				<subsection id="ID000e1872e9d24791b57d7255a086d359"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions shall apply:</text>
					<paragraph id="ID3260f3ff69904f18b5a0865b253551bc"><enum>(1)</enum><header>Committee;
				chairperson</header><text>The terms <term>Committee</term> and
				<term>chairperson</term> mean the Committee on Foreign Investment in the United
				States and the chairperson thereof, respectively.</text>
					</paragraph><paragraph id="IDf4068d27c75e401283a9732931395e62"><enum>(2)</enum><header>Control</header><text>The
				term <term>control</term> has the meaning given to such term in regulations
				which the Committee shall prescribe.</text>
					</paragraph><paragraph id="ID6877a1f8772641ebac29c0299147e087"><enum>(3)</enum><header>Covered
				transaction</header><text>The term <term>covered transaction</term> means any
				merger, acquisition, or takeover, by or with any foreign person which could
				result in foreign control of any person engaged in interstate commerce in the
				United States.</text>
					</paragraph><paragraph id="IDb14a13b7caa6413395c4d420e3aa760d"><enum>(4)</enum><header>Foreign
				government-controlled transaction</header><text>The term <term>foreign
				government-controlled transaction</term> means any covered transaction that
				could result in the control of any person engaged in interstate commerce in the
				United States by a foreign government or an entity controlled by or acting on
				behalf of a foreign government.</text>
					</paragraph><paragraph id="ID9744e9dc7db64590b73cd9e69847416e"><enum>(5)</enum><header>Clarification</header><text>The
				term <term>national security</term> shall be construed so as to include those
				issues relating to <term>homeland security</term>, including its application to
				critical infrastructure.</text>
					</paragraph><paragraph id="IDFC8D51243F3B4B3A9F69CBB2355FB968"><enum>(6)</enum><header>Critical
				infrastructure</header><text>The term <term>critical infrastructure</term>
				means, subject to rules issued under this section, any systems and assets,
				whether physical or cyber-based, so vital to the United States that the
				degradation or destruction of such systems or assets would have a debilitating
				impact on national security, including national economic security and national
				public health or safety.</text>
					</paragraph><paragraph id="ID3A66B02CF52E48C3989550D28E29FC6A"><enum>(7)</enum><header>Critical
				technologies</header><text>The term <term>critical technologies</term> means
				technologies identified under title VI of the National Science and Technology
				Policy, Organization, and Priorities Act of 1976, or other critical technology,
				critical components, or critical technology items essential to national defense
				identified pursuant to this section.</text>
					</paragraph><paragraph id="id42FD56AA94D2404CAA7607EC92BFB703"><enum>(8)</enum><header>Lead
				agency</header><text>The term <quote>lead agency</quote> means the agency, or
				agencies, designated as the lead agency or agencies pursuant to subsection
				(k)(4) for the review of a transaction.</text>
					</paragraph></subsection><subsection id="idDBC41145AAD84B6BA8AC2A8A506947C8"><enum>(b)</enum><header>National
				security reviews and investigations</header>
					<paragraph id="IDb7faa45f6f1a47de8cb65049ea63d8f7"><enum>(1)</enum><header>National
				security reviews</header>
						<subparagraph id="ID20d08c74c0c442c4b0fa28d4d003bec7"><enum>(A)</enum><header>In
				general</header><text>Upon receiving written notification under subparagraph
				(C) of any covered transaction, or pursuant to a unilateral notification
				initiated under subparagraph (D) with respect to any covered transaction, the
				President, acting through the Committee—</text>
							<clause id="id20D996AE5E6446849EAFDFE5D48C95A1"><enum>(i)</enum><text>shall review the
				covered transaction to determine the effects of the transaction on the national
				security of the United States; and</text>
							</clause><clause id="idBEB46368DB834B7C8F9980A07FAEDD04"><enum>(ii)</enum><text>shall consider
				the factors specified in subsection (f) for such purpose, as
				appropriate.</text>
							</clause></subparagraph><subparagraph id="IDc3e8cc66e73a4131aa7ce8b096b74819"><enum>(B)</enum><header>Control by
				foreign government</header><text>If the Committee determines that the covered
				transaction is a foreign government-controlled transaction, the Committee shall
				conduct an investigation of the transaction under paragraph (2).</text>
						</subparagraph><subparagraph id="ID5ffdb07a71404f3a9a20c5ff23ce928e"><enum>(C)</enum><header>Written
				notice</header>
							<clause id="IDe44f31ad22f349b78db61195fc8f2eb5"><enum>(i)</enum><header>In
				general</header><text>Any party or parties to any covered transaction may
				initiate a review of the transaction under this paragraph by submitting a
				written notice of the transaction to the Chairperson of the Committee.</text>
							</clause><clause id="IDed0530fe426048a1a84e2f624f5a7c28"><enum>(ii)</enum><header>Withdrawal of
				notice</header><text>No covered transaction for which a notice was submitted
				under clause (i) may be withdrawn from review, unless a written request for
				such withdrawal is submitted to the Committee by any party to the transaction
				and approved by the Committee.</text>
							</clause><clause id="ID8b49479aec584e1e91bde8be048baa29"><enum>(iii)</enum><header>Continuing
				discussions</header><text>A request for withdrawal under clause (ii) shall not
				be construed to preclude any party to the covered transaction from continuing
				informal discussions with the Committee or any member thereof regarding
				possible resubmission for review pursuant to this paragraph.</text>
							</clause></subparagraph><subparagraph id="ID9061b0e6a4664730ab2ec7323777c0c7"><enum>(D)</enum><header>Unilateral
				initiation of review</header><text>Subject to subparagraph (F), the President
				or the Committee may initiate a review under subparagraph (A) of—</text>
							<clause id="ID267d026f162a48fabe05fb6031f6c72a"><enum>(i)</enum><text>any covered
				transaction;</text>
							</clause><clause id="ID44fb41541e24475abc38fcb4ad62cb72"><enum>(ii)</enum><text>any covered
				transaction that has previously been reviewed or investigated under this
				section, if any party to the transaction submitted false or misleading material
				information to the Committee in connection with the review or investigation or
				omitted material information, including material documents, from information
				submitted to the Committee; or</text>
							</clause><clause id="ID3f67acef92a644f7a883b3187ef7f7d6"><enum>(iii)</enum><text>any covered
				transaction that has previously been reviewed or investigated under this
				section, if—</text>
								<subclause id="id8B86CFB1DB404A6DB7043A709587A03F"><enum>(I)</enum><text>any party to the
				transaction or the entity resulting from consummation of the transaction
				intentionally materially breaches a mitigation agreement or condition described
				in subsection (l)(1)(A);</text>
								</subclause><subclause id="ID6925e4e7949944e39352158b35804e92"><enum>(II)</enum><text>such breach is
				certified to the Committee by the lead department or agency monitoring and
				enforcing such agreement or condition as an intentional material breach;
				and</text>
								</subclause><subclause id="ID7a8a61830dff467fb26c7a1e13fdbecc"><enum>(III)</enum><text>the Committee
				determines that there are no other remedies or enforcement tools available to
				address such breach.</text>
								</subclause></clause></subparagraph><subparagraph id="ID40ffed8186894f86a02627336c335e34"><enum>(E)</enum><header>Timing</header><text>Any
				review under this paragraph shall be completed before the end of the 30-day
				period beginning on the date of the acceptance of written notice under
				subparagraph (C) by the chairperson, or beginning on the date of the initiation
				of the review in accordance with subparagraph (D), as applicable.</text>
						</subparagraph><subparagraph id="IDf62a40cedcaa46428a7a830657b5f7eb"><enum>(F)</enum><header>Limit on
				delegation of certain authority</header><text>The authority of the Committee to
				initiate a review under subparagraph (D) may not be delegated to any person,
				other than the Deputy Secretary or an appropriate Under Secretary of the
				department or agency represented on the Committee.</text>
						</subparagraph></paragraph><paragraph id="ID1e97e4a47608420d85db559a9b050313"><enum>(2)</enum><header>National
				security investigations</header>
						<subparagraph id="ID81474dc1171d45e3bd161f06567c25b8"><enum>(A)</enum><header>In
				general</header><text>In each case described in subparagraph (B) the President,
				acting through the Committee, shall immediately conduct an investigation of the
				effects of a covered transaction on the national security of the United States,
				and take any necessary actions in connection with the transaction to protect
				the national security of the United States.</text>
						</subparagraph><subparagraph id="id657D9547CC86473FA02DFFFD943ED21D"><enum>(B)</enum><header>Applicability</header><text>Subparagraph
				(A) shall apply in each case in which—</text>
							<clause id="ID0033eef0595942eeb47856595cc93f35"><enum>(i)</enum><text>a
				review of a covered transaction under paragraph (1) results in a determination
				that—</text>
								<subclause id="ID6fa09f6e02304f0292ae03d7e0f4672c"><enum>(I)</enum><text>the transaction
				threatens to impair the national security of the United States and that threat
				has not been mitigated during or prior to the review of a covered transaction
				under paragraph (1);</text>
								</subclause><subclause id="ID46698e1f87934cd7aee29cb4ba055730"><enum>(II)</enum><text>the transaction
				is a foreign government-controlled transaction; or</text>
								</subclause><subclause id="idF1319B907082456293B2DED78AA6D2A4"><enum>(III)</enum><text>the transaction
				would result in control of any critical infrastructure of or within the United
				States by, with, or on behalf of any foreign person, if the Committee
				determines that the transaction could impair national security, and that such
				impairment to national security has not been mitigated by assurances provided
				or renewed with the approval of the Committee, as described in subsection (l),
				during the review period under paragraph (1); or</text>
								</subclause></clause><clause id="ID6b6fc314492e4b9a882183cfaaa64241"><enum>(ii)</enum><text>the lead agency
				recommends, and the Committee concurs, that an investigation be
				undertaken.</text>
							</clause></subparagraph><subparagraph id="ID22fa3178753749048d0039d7e1dbdd19"><enum>(C)</enum><header>Timing</header><text>Any
				investigation under subparagraph (A) shall be completed before the end of the
				45-day period beginning on the date on which the investigation
				commenced.</text>
						</subparagraph><subparagraph id="ID84c62a98ae714421bcc4900dd2233272"><enum>(D)</enum><header>Exception</header>
							<clause id="idA8B2BF3775E14142AFE74CF74154569F"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding subparagraph (B)(i), an investigation of
				a foreign government-controlled transaction described in subclause (II) of
				subparagraph (B)(i) or a transaction involving critical infrastructure
				described in subclause (III) of subparagraph (B)(i) shall not be required under
				this paragraph, if the Secretary of the Treasury and the head of the lead
				agency jointly determine, on the basis of the review of the transaction under
				paragraph (1), that the transaction will not impair the national security of
				the United States.</text>
							</clause><clause id="id856DE7652D1746D6A2FD9D5B199BCC93"><enum>(ii)</enum><header>Nondelegation</header><text>The
				authority of the Secretary or the head of an agency referred to in clause (i)
				may not be delegated to any person, other than the Deputy Secretary of the
				Treasury or the deputy head (or the equivalent thereof) of the lead agency,
				respectively.</text>
							</clause></subparagraph><subparagraph id="ID728b004f7ba24fd6a9c8638899f206f5"><enum>(E)</enum><header>Guidance on
				certain transactions with national security implications</header><text>The
				Chairperson shall, not later than 180 days after the date of enactment of the
				<short-title>Foreign Investment and National Security Act
				of 2007</short-title>, publish in the Federal Register guidance on the types of
				transactions that the Committee has reviewed and that have presented national
				security considerations, including transactions that may constitute covered
				transactions that would result in control of critical infrastructure relating
				to United States national security by a foreign government or an entity
				controlled by or acting on behalf of a foreign government.</text>
						</subparagraph></paragraph><paragraph id="IDC843397BC35E45A8BD528AA639C9F94B"><enum>(3)</enum><header>Certifications
				to congress</header>
						<subparagraph id="ID8E0469A59E24491AAC1C5686C0A1930C"><enum>(A)</enum><header>Certified
				notice at completion of review</header><text>Upon completion of a review under
				subsection (b) that concludes action under this section, the chairperson and
				the head of the lead agency shall transmit a certified notice to the members of
				Congress specified in subparagraph (C)(iii).</text>
						</subparagraph><subparagraph id="ID6721585B864D48EC89652CD72745E89A"><enum>(B)</enum><header>Certified
				report at completion of investigation</header><text>As soon as is practicable
				after completion of an investigation under subsection (b) that concludes action
				under this section, the chairperson and the head of the lead agency shall
				transmit to the members of Congress specified in subparagraph (C)(iii) a
				certified written report (consistent with the requirements of subsection (c))
				on the results of the investigation, unless the matter under investigation has
				been sent to the President for decision.</text>
						</subparagraph><subparagraph id="IDB2D51BDDAD6B4652AD8DD99F4040EB24"><enum>(C)</enum><header>Certification
				procedures</header>
							<clause id="IDD2ED4E9A9B114E66AF1C47640235B11A"><enum>(i)</enum><header>In
				general</header><text>Each certified notice and report required under
				subparagraphs (A) and (B), respectively, shall be submitted to the members of
				Congress specified in clause (iii), and shall include—</text>
								<subclause id="ID90A191E4256F49CA9567B7F935C3D0B8"><enum>(I)</enum><text>a description of
				the actions taken by the Committee with respect to the transaction; and</text>
								</subclause><subclause id="ID637CC69FF090417FAECA651EAD1CC972"><enum>(II)</enum><text>identification
				of the determinative factors considered under subsection (f).</text>
								</subclause></clause><clause id="ID78AD51CA36FC4E27B7E76B87926CAFE0"><enum>(ii)</enum><header>Content of
				certification</header><text>Each certified notice and report required under
				subparagraphs (A) and (B), respectively, shall be signed by the chairperson and
				the head of the lead agency, and shall state that, in the determination of the
				Committee, there are no unresolved national security concerns with the
				transaction that is the subject of the notice or report.</text>
							</clause><clause id="ID8A7A949659144B87A0E72108E7ED0770"><enum>(iii)</enum><header>Members of
				congress</header><text>Each certified notice and report required under
				subparagraphs (A) and (B), respectively, shall be transmitted to—</text>
								<subclause id="ID5A60895B9F7A44AA874DD0A7FE673EB7"><enum>(I)</enum><text>the Majority
				Leader and the Minority Leader of the Senate;</text>
								</subclause><subclause id="ID85D7349C29934506921EE34C2EE0761D"><enum>(II)</enum><text>the chair and
				ranking member of the Committee on Banking, Housing, and Urban Affairs of the
				Senate and of any committee of the Senate having oversight over the lead
				agency;</text>
								</subclause><subclause id="ID29DFE34988E647C99BAEA92D44952163"><enum>(III)</enum><text>the Speaker and
				the Minority Leader of the House of Representatives; and</text>
								</subclause><subclause id="ID61DA005D750B45A799248C3ABE0D93C5"><enum>(IV)</enum><text>the chair and
				ranking member of the Committee on Financial Services of the House of
				Representatives and of any committee of the House of Representatives having
				oversight over the lead agency.</text>
								</subclause></clause><clause id="ID425BFE1ECC6449619DB80B9A07464A9E"><enum>(iv)</enum><header>Transmittal to
				other members of congress</header><text>The Majority Leader or the Minority
				Leader, in the case of the Senate, and the Speaker or the Minority Leader, in
				the case of the House of Representatives, may provide the certified notices and
				reports required under subparagraphs (A) and (B), respectively, regarding a
				transaction involving critical infrastructure—</text>
								<subclause id="IDBC97D5B0DF15411883151461E95C4D2B"><enum>(I)</enum><text>in the case of
				the Senate, to members of the Senate from the State in which such critical
				infrastructure is located; and</text>
								</subclause><subclause id="ID733E46D9C7F94343AC6075C99B35EA23"><enum>(II)</enum><text>in the case of
				the House of Representatives, to a member from a Congressional District in
				which such critical infrastructure is located.</text>
								</subclause></clause><clause id="ID94060A2048D9425AABBBB73EA02700E7"><enum>(v)</enum><header>Signatures;
				limit on delegation</header>
								<subclause id="id20D691E931E7427ABD6EE7A07F37F092"><enum>(I)</enum><header>In
				general</header><text>Each certified notice and report required under
				subparagraphs (A) and (B), respectively, shall be signed by the chairperson and
				the head of the lead agency, which signature requirement may only be delegated
				in accordance with subclause (II).</text>
								</subclause><subclause id="id37608632AD4D4273BE2BC99CF340D0B8"><enum>(II)</enum><header>Limitation on
				delegation of certifications</header><text>The chairperson and the head of the
				lead agency may delegate the signature requirement under subclause (I)—</text>
									<item id="idE10BE4152BAB4CA1B4B02FA433A3F771"><enum>(aa)</enum><text>only to an
				employee of the Department of the Treasury (in the case of the Secretary of the
				Treasury) or to an employee of the lead agency (in the case of the lead agency)
				who was appointed by the President, by and with the advice and consent of the
				Senate, with respect to any notice provided under paragraph (1) following the
				completion of a review under this section; or</text>
									</item><item id="id5E0B23C89DD543028F0A46A806F9838B"><enum>(bb)</enum><text>only to a Deputy
				Secretary of the Treasury (in the case of the Secretary of the Treasury) or a
				person serving in the Deputy position or the equivalent thereof at the lead
				agency (in the case of the lead agency), with respect to any report provided
				under subparagraph (B) following an investigation under this section.</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph id="ID2c80f99f6a444664a64d81acf842848a"><enum>(4)</enum><header>Analysis by
				director of national intelligence</header>
						<subparagraph id="IDdae9712ed1df4f7fa1b85d049e41a2b8"><enum>(A)</enum><header>In
				general</header><text>The Director of National Intelligence shall expeditiously
				carry out a thorough analysis of any threat to the national security of the
				United States posed by any covered transaction. The Director of National
				Intelligence shall also seek and incorporate the views of all affected or
				appropriate intelligence agencies with respect to the transaction.</text>
						</subparagraph><subparagraph id="IDb260a754dde0436ba83e846da7e92a8e"><enum>(B)</enum><header>Timing</header><text>The
				analysis required under subparagraph (A) shall be provided by the Director of
				National Intelligence to the Committee not later than 20 days after the date on
				which notice of the transaction is accepted by the Committee under paragraph
				(1)(C), but the Director may begin the analysis at any time prior to receipt of
				the notice, in accordance with otherwise applicable law.</text>
						</subparagraph><subparagraph id="idA8874550BB484EC1AF3BA4012FE11105"><enum>(C)</enum><header>Interaction
				with intelligence community</header><text>The Director of National Intelligence
				shall ensure that the intelligence community remains engaged in the collection,
				analysis, and dissemination to the Committee of any additional relevant
				information that may become available during the course of any investigation
				conducted under subsection (b) with respect to a transaction.</text>
						</subparagraph><subparagraph id="ID61d2b4c9433d454e87ba73711ff8c8dd"><enum>(D)</enum><header>Independent
				role of director</header><text>The Director of National Intelligence shall be
				an ex officio member of the Committee, and shall be provided with all notices
				received by the Committee under paragraph (1)(C) regarding covered
				transactions, but shall serve no policy role on the Committee, other than to
				provide analysis under subparagrapha (A) and (C) in connection with a covered
				transaction.</text>
						</subparagraph></paragraph><paragraph id="IDace592670753472f9b46e8fe258ea4e1"><enum>(5)</enum><header>Submission of
				additional information</header><text>No provision of this subsection shall be
				construed as prohibiting any party to a covered transaction from submitting
				additional information concerning the transaction, including any proposed
				restructuring of the transaction or any modifications to any agreements in
				connection with the transaction, while any review or investigation of the
				transaction is ongoing.</text>
					</paragraph><paragraph id="id82B5B5DC0C634D22853FDBB1DBA215F3"><enum>(6)</enum><header>Notice of
				results to parties</header><text>The Committee shall notify the parties to a
				covered transaction of the results of a review or investigation under this
				section, promptly upon completion of all action under this section.</text>
					</paragraph><paragraph id="IDf6c9363f942d4702843c76125ded493d"><enum>(7)</enum><header>Regulations</header><text>Regulations
				prescribed under this section shall include standard procedures for—</text>
						<subparagraph id="IDf4876eaec9754530b22309ca10954c63"><enum>(A)</enum><text>submitting any
				notice of a covered transaction to the Committee;</text>
						</subparagraph><subparagraph id="IDd3c8e6ecf41340a9994331beb73ef682"><enum>(B)</enum><text>submitting a
				request to withdraw a covered transaction from review;</text>
						</subparagraph><subparagraph id="IDaa2fdc3d448c4b6e9941c318cfbdefa5"><enum>(C)</enum><text>resubmitting a
				notice of a covered transaction that was previously withdrawn from review;
				and</text>
						</subparagraph><subparagraph commented="no" id="id4E158CA237F74A1CAC6990212181ED78"><enum>(D)</enum><text>providing notice
				of the results of a review or investigation to the parties to the covered
				transaction, upon completion of all action under this
				section.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID79900a0cd8de415189de026f049d753c"><enum>3.</enum><header>Statutory
			 establishment of the committee on foreign investment in the United
			 States</header><text display-inline="no-display-inline">Section 721 of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2170) is amended by striking
			 subsection (k) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id55A7B30772214FC9892BD44307F5E3A8" style="OLC">
				<subsection id="ID2fd665f2c02e4ce994a6e90c9197c639"><enum>(k)</enum><header>Committee on
				foreign investment in the United States</header>
					<paragraph id="ID09cf77c0afdd4495a17a4cb69d300876"><enum>(1)</enum><header>Establishment</header><text>The
				Committee on Foreign Investment in the United States, established pursuant to
				Executive Order No. 11858, shall be a multi agency committee to carry out this
				section and such other assignments as the President may designate.</text>
					</paragraph><paragraph id="ID723032170fba499391dda29418215d77"><enum>(2)</enum><header>Membership</header><text>The
				Committee shall be comprised of the following members or the designee of any
				such member:</text>
						<subparagraph id="IDa096c2718c63450bb7c74693646806ed"><enum>(A)</enum><text>The Secretary of
				the Treasury.</text>

				Secretary of the Treasury shall serve as the chairperson of the
				Committee.</text>
					</paragraph><paragraph id="id2E99996F057442C8A112F20952D06AF8"><enum>(4)</enum><header>Designation of
				lead agency</header><text>The Secretary of the Treasury shall designate another
				member or members, as appropriate, of the Committee to be the lead agency or
				agencies on behalf of the Committee—</text>
						<subparagraph id="id43FCE77006834CA287FC242C25A982C9"><enum>(A)</enum><text>for each covered
				transaction, and for negotiating any mitigation agreements or other conditions
				necessary to protect national security; and</text>
						</subparagraph><subparagraph id="id4A0814E528914CF08227B8208BFAE171"><enum>(B)</enum><text>for all matters
				related to the monitoring of the completed transaction, to ensure compliance
				with such agreements or conditions and with this section.</text>
						</subparagraph></paragraph><paragraph id="IDc5a65dd13c0d455cabee56e73b359184"><enum>(5)</enum><header>Other
				members</header><text>The chairperson shall consult with the heads of such
				other Federal departments, agencies, and independent establishments in any
				review or investigation under subsection (a), as the chairperson determines to
				be appropriate, on the basis of the facts and circumstances of the covered
				transaction under review or investigation (or the designee of any such
				department or agency head).</text>
					</paragraph><paragraph id="ID198745eaf6514fa5b1605b0b9330e7c6"><enum>(6)</enum><header>Meetings</header><text>The
				Committee shall meet upon the direction of the President or upon the call of
				the chairperson, without regard to section 552b of title 5, United States Code
				(if otherwise
				applicable).</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID1097188bf51a48bfb5f0011a6dd4efd7"><enum>4.</enum><header>Additional
			 factors for consideration</header><text display-inline="no-display-inline">Section 721(f) of the Defense Production Act
			 of 1950 (50 U.S.C. App. 2170(f)) is amended—</text>
			<paragraph id="ID2179b3421b7f417e8ab19a22eb977299"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>among other factors</quote>;</text>
			</paragraph><paragraph id="ID118fbad8320749feb62f61c3d179409c"><enum>(2)</enum><text>in paragraph
			 (4)—</text>
				<subparagraph id="id7771D74E9D654BAE8E2121DD47E5C3D2"><enum>(A)</enum><text>in subparagraph
			 (A) by striking <quote>or</quote> at the end;</text>
				</subparagraph><subparagraph id="id024E1208AF3B4A868C996908151EF78D"><enum>(B)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C);</text>

			 after subparagraph (A) the following:</text>

				Secretary of Defense as posing a potential regional military threat to the
				interests of the United States; or</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idB0F08311FE724151AB6CDDDF88ADE25D"><enum>(D)</enum><text>by striking
			 <quote>and</quote> at the end;</text>
				</subparagraph></paragraph><paragraph id="ID645d1170b782430d955f9e27b407d4e2"><enum>(3)</enum><text>in paragraph (5),
			 by striking the period at the end and inserting a semicolon; and</text>
			</paragraph><paragraph id="ID9d9a5d6b72734581bde4aae6772d58f0"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id725BBF415A6B4276827A1EE8323F1BC0" style="OLC">
					<paragraph id="IDcfaaa2217b724363b81df8fac8d717d4"><enum>(6)</enum><text>whether the
				covered transaction has a security-related impact on critical infrastructure in
				the United States;</text>
					</paragraph><paragraph id="IDadf9d3fc5fef410db210c3a08d400d44"><enum>(7)</enum><text>the potential
				effects on United States critical infrastructure, including major energy
				assets;</text>
					</paragraph><paragraph id="IDb8980da844dd4d228070f3c48b271261"><enum>(8)</enum><text>the potential
				effects on United States critical technologies;</text>
					</paragraph><paragraph id="ID129c119741cf47678d59ed20264d1ec5"><enum>(9)</enum><text>whether the
				covered transaction is a foreign government-controlled transaction, as
				determined under subsection (b)(1)(B);</text>
					</paragraph><paragraph id="id9C9C5091CCA3487388EB6BCB811FDE92"><enum>(10)</enum><text>with respect to
				transactions requiring an investigation under subsection (b)(1)(B) only, a
				review of the current assessment of—</text>
						<subparagraph commented="no" id="IDF73A130C9D8E45D18EDDD80D4C8CABA4"><enum>(A)</enum><text>the adherence of
				the subject country to nonproliferation control regimes, including treaties and
				multilateral supply guidelines, which shall draw on, but not be limited to, the
				annual report on <quote>Adherence to and Compliance with Arms Control,
				Nonproliferation and Disarmament Agreements and Commitments</quote> required by
				section 403 of the Arms Control and Disarmament Act;</text>
						</subparagraph><subparagraph commented="no" id="IDEEC7216C115F403293B7BE80C7EC20B3"><enum>(B)</enum><text>the relationship
				of such country with the United States, specifically on its record on
				cooperating in counter-terrorism efforts, which shall draw on, but not be
				limited to, the report of the President to Congress under section 7120 of the
				Intelligence Reform and Terrorism Prevention Act of 2004; and</text>
						</subparagraph><subparagraph commented="no" id="IDE5F6ED559861433C8A078354D846C51E"><enum>(C)</enum><text>the potential for
				transshipment or diversion of technologies with military applications,
				including an analysis of national export control laws and regulations;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFF4D21991C184BF1B9B72C385F035072"><enum>(11)</enum><text display-inline="yes-display-inline">the long-term projection of United States
				requirements for sources of energy and other critical resources and material;
				and</text>
					</paragraph><paragraph id="IDf17d9a51fffc401ba83e9f266211e3ae"><enum>(12)</enum><text>such other
				factors as the President or the Committee may determine to be appropriate,
				generally or in connection with a specific review or
				investigation.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id9E5A3FBE6C584DC7B44287B9ADE5199F"><enum>5.</enum><header>Mitigation,
			 tracking, and postconsummation monitoring and enforcement</header><text display-inline="no-display-inline">Section 721 of the Defense Production Act of
			 1950 (50 U.S.C. App. 2170) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id9C0209D6AB174A32841EB19007F734D3" style="OLC">
				<subsection id="ID607188c4de6b4ae59e45c27d5d8206dd"><enum>(l)</enum><header>Mitigation,
				tracking, and postconsummation monitoring and enforcement</header>
					<paragraph id="ID9d73defecb8f434f8b7d60b3a263975d"><enum>(1)</enum><header>Mitigation</header>
						<subparagraph id="ID65f03267aed449e8b006f66cad4e9912"><enum>(A)</enum><header>In
				general</header><text>The Committee or a lead agency may, on behalf of the
				Committee, negotiate, enter into or impose, and enforce any agreement or
				condition with any party to the covered transaction in order to mitigate any
				threat to the national security of the United States that arises as a result of
				the covered transaction.</text>
						</subparagraph><subparagraph id="IDb39838fb9f834351979856215a71660b"><enum>(B)</enum><header>Risk-based
				analysis required</header><text>Any agreement entered into or condition imposed
				under subparagraph (A) shall be based on a risk-based analysis, conducted by
				the Committee, of the threat to national security of the covered
				transaction.</text>
						</subparagraph></paragraph><paragraph id="ID73020656dfca49458cc058322e9de5ed"><enum>(2)</enum><header>Tracking
				authority for withdrawn notices</header>
						<subparagraph id="ID41d0b227be2b4b25ac202e4bb1b63100"><enum>(A)</enum><header>In
				general</header><text>If any written notice of a covered transaction that was
				submitted to the Committee under this section is withdrawn before any review or
				investigation by the Committee under subsection (b) is completed, the Committee
				shall establish, as appropriate—</text>
							<clause id="ID52132d8d839f4ff895f4be4c92e4cfa8"><enum>(i)</enum><text>interim
				protections to address specific concerns with such transaction that have been
				raised in connection with any such review or investigation pending any
				resubmission of any written notice under this section with respect to such
				transaction and further action by the President under this section;</text>
							</clause><clause id="ID320c6b45eaf44b749493a005ef47e76b"><enum>(ii)</enum><text>specific time
				frames for resubmitting any such written notice; and</text>
							</clause><clause id="IDd6e06fe9b7424b4082cd1aee24ad1de9"><enum>(iii)</enum><text>a process for
				tracking any actions that may be taken by any party to the transaction, in
				connection with the transaction, before the notice referred to in clause (ii)
				is resubmitted.</text>
							</clause></subparagraph><subparagraph id="ID385a0a34880b48b29c7bb642073d577c"><enum>(B)</enum><header>Designation of
				agency</header><text>The lead agency, other than any entity of the intelligence
				community (as defined in the National Security Act of 1947), shall, on behalf
				of the Committee, ensure that the requirements of subparagraph (A) with respect
				to any covered transaction that is subject to such subparagraph are met.</text>
						</subparagraph></paragraph><paragraph id="IDcbe39c7997f34c5ab47c3faedcf4b662"><enum>(3)</enum><header>Negotiation,
				modification, monitoring, and enforcement</header>
						<subparagraph id="ID7d553a48f4144368a50b45400ec07117"><enum>(A)</enum><header>Designation of
				lead agency</header><text>The lead agency shall negotiate, modify, monitor, and
				enforce, on behalf of the Committee, any agreement entered into or condition
				imposed under paragraph (1) with respect to a covered transaction, based on the
				expertise with and knowledge of the issues related to such transaction on the
				part of the designated department or agency. Nothing in this paragraph shall
				prohibit other departments or agencies in assisting the lead agency in carrying
				out the purposes of this paragraph.</text>
						</subparagraph><subparagraph id="IDbf0c5fb7e25b475b85593116520b3af6"><enum>(B)</enum><header>Reporting by
				designated agency</header>
							<clause id="ID5b828b795de6454daa4a5efd761c3b55"><enum>(i)</enum><header>Modification
				reports</header><text>The lead agency in connection with any agreement entered
				into or condition imposed with respect to a covered transaction shall—</text>
								<subclause id="ID0519a99e16c949ed9238c450aa205f84"><enum>(I)</enum><text>provide periodic
				reports to the Committee on any material modification to any such agreement or
				condition imposed with respect to the transaction; and</text>
								</subclause><subclause id="IDba162a47ad0d477da17aa44620722130"><enum>(II)</enum><text>ensure that any
				material modification to any such agreement or condition is reported to the
				Director of National Intelligence, the Attorney General of the United States,
				and any other Federal department or agency that may have a material interest in
				such modification.</text>
								</subclause></clause><clause id="IDaa51072ab46c4a06a2f09d9d1bf3b71d"><enum>(ii)</enum><header>Compliance</header><text>The
				Committee shall develop and agree upon methods for evaluating compliance with
				any agreement entered into or condition imposed with respect to a covered
				transaction that will allow the Committee to adequately assure compliance,
				without—</text>
								<subclause id="ID18d20c81899342aa9a7f4a7e85674da3"><enum>(I)</enum><text>unnecessarily
				diverting Committee resources from assessing any new covered transaction for
				which a written notice has been filed pursuant to subsection (b)(1)(C), and if
				necessary, reaching a mitigation agreement with or imposing a condition on a
				party to such covered transaction or any covered transaction for which a review
				has been reopened for any reason; or</text>
								</subclause><subclause id="ID71260692593f4d09b3fe1b12c3ce4869"><enum>(II)</enum><text>placing
				unnecessary burdens on a party to a covered
				transaction.</text>
								</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id02F16AFFF4664D9EA010FBF17755435C"><enum>6.</enum><header>Action by the
			 President</header><text display-inline="no-display-inline">Section 721 of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2170) is amended by striking
			 subsections (d) and (e) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="idAC1E8CED508E4179B8CF4D8DFE974572" style="OLC">
				<subsection id="ID5f30e627900d4c9c8d2323afceb3ea29"><enum>(d)</enum><header>Action by the
				president</header>
					<paragraph id="ID3849fb83c74d466d84764bc20b927546"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (4), the President may take such
				action for such time as the President considers appropriate to suspend or
				prohibit any covered transaction by or with a foreign person or government that
				threatens to impair the national security of the United States.</text>
					</paragraph><paragraph id="IDeef532a53be145f488bd69131dc57e1d"><enum>(2)</enum><header>Announcement by
				the president</header><text>The President shall announce the decision on
				whether or not to take action pursuant to paragraph (1) not later than 15 days
				after the date on which an investigation described in subsection (b) is
				completed.</text>
					</paragraph><paragraph id="IDd28814e64d2b47f7bf424965b89dc0de"><enum>(3)</enum><header>Enforcement</header><text>The
				President may direct the Attorney General of the United States to seek
				appropriate relief, including divestment relief, in the district courts of the
				United States, in order to implement and enforce this subsection.</text>
					</paragraph><paragraph id="IDa5b7a7c31e63455db44460a2a2f5d412"><enum>(4)</enum><header>Findings of the
				president</header><text>The President may exercise the authority conferred by
				paragraph (1), only if the President finds that—</text>
						<subparagraph id="ID64838a06dc704bbe82ab27430ebde38f"><enum>(A)</enum><text>there is credible
				evidence that leads the President to believe that the foreign interest
				exercising control might take action that threatens to impair the national
				security; and</text>
						</subparagraph><subparagraph id="ID8397a91496d64c9fa0dc5fd2ff94f360"><enum>(B)</enum><text>provisions of
				law, other than this section and the International Emergency Economic Powers
				Act, do not, in the judgment of the President, provide adequate and appropriate
				authority for the President to protect the national security in the matter
				before the President.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id15C13A294D9D4BE7B5C7D23F5CBCED11"><enum>(5)</enum><header display-inline="yes-display-inline">Factors to be considered</header><text display-inline="yes-display-inline">For purposes of determining whether to take
				action under paragraph (1), the President shall consider, among other factors
				each of the factors described in subsection (f).</text>
					</paragraph></subsection><subsection id="ID02af2082923f4ffbae61c8ad4de417b3"><enum>(e)</enum><header>Actions and
				findings nonreviewable</header><text>The actions of the President under
				paragraph (1) of subsection (d) and the findings of the President under
				paragraph (4) of subsection (d) shall not be subject to judicial
				review.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id28C7B4A5DC51445B8D8E5110CEC9BAC0"><enum>7.</enum><header>Increased
			 oversight by Congress</header>
			<subsection id="id75079AA6F1184E1F844699EAB0224413"><enum>(a)</enum><header>Report on
			 actions</header><text>Section 721(g) of the Defense Production Act of 1950 (50
			 U.S.C. App. 2170(g)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id8D75210C4B63456FA9B80A417A5FC7D4" style="OLC">
					<subsection id="IDbec4fe32b76846ba922026a3474c8f66"><enum>(g)</enum><header>Additional
				information to congress; confidentiality</header>
						<paragraph id="ID3deb8d53282f46e39b99782f6c7c8ea4"><enum>(1)</enum><header>Briefing
				requirement on request</header><text>The Committee shall, upon request from any
				Member of Congress specified in subsection (b)(3)(C)(iii), promptly provide
				briefings on a covered transaction for which all action has concluded under
				this section, or on compliance with a mitigation agreement or condition imposed
				with respect to such transaction, on a classified basis, if deemed necessary by
				the sensitivity of the information. Briefings under this paragraph may be
				provided to the congressional staff of such a Member of Congress having
				appropriate security clearance.</text>
						</paragraph><paragraph id="IDfc0b6e527e3547c2a06f85e84dca4357"><enum>(2)</enum><header>Application of
				confidentiality provisions</header>
							<subparagraph id="IDb69c36156baf4b4580343eb830de9174"><enum>(A)</enum><header>In
				general</header><text>The disclosure of information under this subsection shall
				be consistent with the requirements of subsection (c). Members of Congress and
				staff of either House of Congress or any committee of Congress, shall be
				subject to the same limitations on disclosure of information as are applicable
				under subsection (c).</text>
							</subparagraph><subparagraph id="IDa9282a1db23f4eb199cb99aa6f569b7e"><enum>(B)</enum><header>Proprietary
				information</header><text>Proprietary information which can be associated with
				a particular party to a covered transaction shall be furnished in accordance
				with subparagraph (A) only to a committee of Congress, and only when the
				committee provides assurances of confidentiality, unless such party otherwise
				consents in writing to such
				disclosure.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDc783eaca76cb438482ebb12b6521867f"><enum>(b)</enum><header>Annual
			 report</header><text>Section 721 of the Defense Production Act of 1950 (50
			 U.S.C. App. 2170) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE0A808D595B44F08A139A39F7D0D3C77" style="OLC">
					<subsection id="IDc7eab6e0ca8d4444b9b31e91a256c233"><enum>(m)</enum><header>Annual report
				to Congress</header>
						<paragraph id="IDe3c92ce201bf49a1910e53aaa4e156cd"><enum>(1)</enum><header>In
				general</header><text>The chairperson shall transmit a report to the chairman
				and ranking member of the committee of jurisdiction in the Senate and the House
				of Representatives, before July 31 of each year on all of the reviews and
				investigations of covered transactions completed under subsection (b) during
				the 12-month period covered by the report.</text>
						</paragraph><paragraph id="ID14a9e1b66e624adbac5987df5306dd80"><enum>(2)</enum><header>Contents of
				report relating to covered transactions</header><text>The annual report under
				paragraph (1) shall contain the following information with respect to each
				covered transaction for the reporting period:</text>
							<subparagraph id="ID443c4c674f634a2e92e428c278fc09d7"><enum>(A)</enum><text>A list of all
				notices filed and all reviews or investigations completed during the period,
				with basic information on each party to the transaction, the nature of the
				business activities or products of all pertinent persons, along with
				information about any withdrawal from the process, and any decision or action
				by the President under this section.</text>
							</subparagraph><subparagraph id="ID1a5ae49feb3d4ba19f0e17ce1b6a3e9b"><enum>(B)</enum><text>Specific,
				cumulative, and, as appropriate, trend information on the numbers of filings,
				investigations, withdrawals, and decisions or actions by the President under
				this section.</text>
							</subparagraph><subparagraph id="ID3966dcd9037b46df89776a688003f01c"><enum>(C)</enum><text>Cumulative and,
				as appropriate, trend information on the business sectors involved in the
				filings which have been made, and the countries from which the investments have
				originated.</text>
							</subparagraph><subparagraph id="IDd477a396fc7445788f689601f95b9290"><enum>(D)</enum><text>Information on
				whether companies that withdrew notices to the Committee in accordance with
				subsection (b)(1)(C)(ii) have later refiled such notices, or, alternatively,
				abandoned the transaction.</text>
							</subparagraph><subparagraph id="ID3675d4e5407344d3ad7a6bf2cf14e146"><enum>(E)</enum><text>The types of
				security arrangements and conditions the Committee has used to mitigate
				national security concerns about a transaction, including a discussion of the
				methods that the Committee and any lead agency are using to determine
				compliance with such arrangements or conditions.</text>
							</subparagraph><subparagraph id="ID966b6a14b9424414898fee96168757b3"><enum>(F)</enum><text>A detailed
				discussion of all perceived adverse effects of covered transactions on the
				national security or critical infrastructure of the United States that the
				Committee will take into account in its deliberations during the period before
				delivery of the next report, to the extent possible.</text>
							</subparagraph></paragraph><paragraph id="IDc0efa8683581461bbe9888c59d98929b"><enum>(3)</enum><header>Contents of
				report relating to critical technologies</header>
							<subparagraph id="ID0d49582b4bb245ea9e3010f4b8b4092f"><enum>(A)</enum><header>In
				general</header><text>In order to assist Congress in its oversight
				responsibilities with respect to this section, the President and such agencies
				as the President shall designate shall include in the annual report submitted
				under paragraph (1)—</text>
								<clause id="ID000bd77db5804f03b28c992b923313cc"><enum>(i)</enum><text>an evaluation of
				whether there is credible evidence of a coordinated strategy by 1 or more
				countries or companies to acquire United States companies involved in research,
				development, or production of critical technologies for which the United States
				is a leading producer; and</text>
								</clause><clause id="ID0977c8136a2245e29da17b3534dff565"><enum>(ii)</enum><text>an evaluation of
				whether there are industrial espionage activities directed or directly assisted
				by foreign governments against private United States companies aimed at
				obtaining commercial secrets related to critical technologies.</text>
								</clause></subparagraph><subparagraph id="IDc5015bf936734612974dfd83cdaf482e"><enum>(B)</enum><header>Release of
				unclassified study</header><text>That portion of the annual report under
				paragraph (1) that is required by this paragraph may be classified. An
				unclassified version of the report, as appropriate, consistent with
				safeguarding national security and privacy, shall be made available to the
				public.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8311d8aae5924e38a7cd00f696eefc83"><enum>(c)</enum><header>Study and
			 report</header>
				<paragraph id="ID6e63f9c809044093b7de28b7f36c108f"><enum>(1)</enum><header>Study
			 required</header><text>Before the end of the 120-day period beginning on the
			 date of enactment of this Act and annually thereafter, the Secretary of the
			 Treasury, in consultation with the Secretary of State and the Secretary of
			 Commerce, shall conduct a study on foreign direct investments in the United
			 States, especially investments in critical infrastructure and industries
			 affecting national security, by—</text>
					<subparagraph id="ID2439bf0b5dae427bb8e149c21f3e0668"><enum>(A)</enum><text>foreign
			 governments, entities controlled by or acting on behalf of a foreign
			 government, or persons of foreign countries which comply with any boycott of
			 Israel; or</text>
					</subparagraph><subparagraph id="IDcf6b0513cfb44c76a167b3089505f03c"><enum>(B)</enum><text>foreign
			 governments, entities controlled by or acting on behalf of a foreign
			 government, or persons of foreign countries which do not ban organizations
			 designated by the Secretary of State as foreign terrorist organizations.</text>
					</subparagraph></paragraph><paragraph id="ID0beb038571324188a315825f555fbc62"><enum>(2)</enum><header>Report</header><text>Before
			 the end of the 30-day period beginning upon the date of completion of each
			 study under paragraph (1), or in the next annual report under section 721(m) of
			 the Defense Production Act of 1950 (as added by this section), the Secretary of
			 the Treasury shall submit a report to the Congress, for transmittal to all
			 appropriate committees of the Senate and the House of Representatives,
			 containing the findings and conclusions of the Secretary with respect to the
			 study described in paragraph (1), together with an analysis of the effects of
			 such investment on the national security of the United States and on any
			 efforts to address those effects.</text>
				</paragraph></subsection><subsection id="ID9d692a2c57914f4c9d1fb5e8636bdb45"><enum>(d)</enum><header>Investigation
			 by inspector general</header>
				<paragraph id="ID21928c03af00463598ef7a9fb0fccd72"><enum>(1)</enum><header>In
			 general</header><text>The Inspector General of the Department of the Treasury
			 shall conduct an independent investigation to determine all of the facts and
			 circumstances concerning each failure of the Department of the Treasury to make
			 any report to the Congress that was required under section 721(k) of the
			 Defense Production Act of 1950, as in effect on the day before the date of
			 enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7d3fbb41263349b5bd0fa0040f7e229a"><enum>(2)</enum><header>Report to the
			 congress</header><text>Before the end of the 270-day period beginning on the
			 date of enactment of this Act, the Inspector General of the Department of the
			 Treasury shall submit a report on the investigation under paragraph (1)
			 containing the findings and conclusions of the Inspector General, to the
			 chairman and ranking member of each committee of the Senate and the House of
			 Representatives having jurisdiction over any aspect of the report, including,
			 at a minimum, the Committee on Foreign Relations, the Committee on Banking,
			 Housing, and Urban Affairs, and the Committee on Commerce, Science, and
			 Transportation of the Senate, and the Committee on Foreign Affairs, the
			 Committee on Financial Services, and the Committee on Energy and Commerce of
			 the House of Representatives.</text>
				</paragraph></subsection></section><section id="IDc2235a87103b4567b35bdce5e79eb60a"><enum>8.</enum><header>Certification of
			 notices and assurances</header><text display-inline="no-display-inline">Section
			 721 of the Defense Production Act of 1950 (50 U.S.C. App. 2170) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id82F455EA0F444BC0A6B0681BB6A26096" style="OLC">
				<subsection id="ID925f4bd337944593b47fac15dc6179de"><enum>(n)</enum><header>Certification
				of notices and assurances</header><text>Each notice, and any followup
				information, submitted under this section and regulations prescribed under this
				section to the President or the Committee by a party to a covered transaction,
				and any information submitted by any such party in connection with any action
				for which a report is required pursuant to paragraph (3)(B) of subsection (l),
				with respect to the implementation of any mitigation agreement or condition
				described in paragraph (1)(A) of subsection (l), or any material change in
				circumstances, shall be accompanied by a written statement by the chief
				executive officer or the designee of the person required to submit such notice
				or information certifying that, to the best of the knowledge and belief of that
				person—</text>
					<paragraph id="ID51fdb782415d42e19da6b7155871971f"><enum>(1)</enum><text>the notice or
				information submitted fully complies with the requirements of this section or
				such regulation, agreement, or condition; and</text>
					</paragraph><paragraph id="IDac1863763b0b4fa18128038291acd4cf"><enum>(2)</enum><text>the notice or
				information is accurate and complete in all material
				respects.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDdf75f85ed6fd45d99e3af7bc05c1cdf0"><enum>9.</enum><header>Regulations</header><text display-inline="no-display-inline">Section 721(h) of the Defense Production Act
			 of 1950 (50 U.S.C. App. 2170(h)) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id4C6FBA80ABF04F6E8768C3884C1EE13C" style="OLC">
				<subsection id="IDfe99d2c9403b458fb20553cd880468af"><enum>(h)</enum><header>Regulations</header>
					<paragraph id="id58D389DC891D4AE1B69472A798660F1E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President shall
				direct, subject to notice and comment, the issuance of regulations to carry out
				this section.</text>
					</paragraph><paragraph id="id3CC74EE3986B4A229B8161992DB132B7"><enum>(2)</enum><header>Effective
				date</header><text display-inline="yes-display-inline">Regulations issued under
				this section shall become effective not later than 180 days after the effective
				date of the <short-title>Foreign Investment and National
				Security Act of 2007</short-title>.</text>
					</paragraph><paragraph id="idF12FFCFC6C2E46A28C853ED4F0960451"><enum>(3)</enum><header>Content</header><text display-inline="yes-display-inline">Regulations issued under this subsection
				shall—</text>
						<subparagraph id="idB5978BCE481341CFA12D2CBC901D6457"><enum>(A)</enum><text>provide for the
				imposition of civil penalties for any violation of this section;</text>
						</subparagraph><subparagraph id="id664A2607295945D0BF74DCBA13B4E23A"><enum>(B)</enum><text>to the extent
				possible—</text>
							<clause id="idC900404D82E74C418E9C8847B169E429"><enum>(i)</enum><text>minimize
				paperwork burdens; and</text>
							</clause><clause id="idEE5665FB5A014E11BA2A4EF56124B4ED"><enum>(ii)</enum><text display-inline="yes-display-inline">coordinate reporting requirements under
				this section with reporting requirements under any other provision of Federal
				law; and</text>
							</clause></subparagraph><subparagraph id="IDa0e212e9a96948dcab66116164ffafe6"><enum>(C)</enum><text>provide for an
				appropriate role for the Secretary of Labor with respect to mitigation
				agreements.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDb870ecbb4dcb411c918ca75f9286276f"><enum>10.</enum><header>Effect on other
			 law</header><text display-inline="no-display-inline">Section 721(i) of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2170(i)) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="idF253EB7557DE4896904C6380A9D8F2B3" style="OLC">
				<subsection id="IDa2f3e572985e410fa2964a299cea225f"><enum>(i)</enum><header>Effect on other
				law</header><text>No provision of this section shall be construed as altering
				or affecting any other authority, process, regulation, investigation,
				enforcement measure, or review provided by or established under any other
				provision of Federal law, including the International Emergency Economic Powers
				Act, or any other authority of the President or the Congress under the
				Constitution of the United
				States.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDf277d3a3f8104e52b2aaeae8e5206cb2"><enum>11.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply after the end of the 90-day period beginning on the date
			 of enactment of this Act.</text>
