			 Medicare disproportionate share hospital (DSH) adjustment for rural
			 hospitals</header><text display-inline="no-display-inline">Section
			 1886(d)(5)(F)(xiv)(II) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395ww(d)(5)(F)(xiv)(II)) is amended—</text>
			<paragraph id="idB4AC5F89220E40A49A0A1B71058740F5"><enum>(1)</enum><text>by striking
			 <quote>or, in the case</quote> and all that follows through <quote>subparagraph
			 (G)(iv)</quote>; and</text>
			</paragraph><paragraph id="idA83B4AD3BF6D409CA17516F9526EC10D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting at the end the following new
			 sentence: <quote>The preceding sentence shall not apply to any hospital with
			 respect to discharges occurring on or after October 1, 2008.</quote>.</text>
			</paragraph></section><section display-inline="no-display-inline" id="HDD1E73D2D39C4E389B65CE6EA0BDB058"><enum>3.</enum><header>Revision of the
			 Medicare hold harmless provision under the prospective payment system for
			 hospital outpatient department (HOPD) services</header><text display-inline="no-display-inline">Section 1833(t)(7)(D)(i) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42
			 U.S.C. 1395l(t)(7)(D)</external-xref>(i)) is amended—</text>
			<paragraph display-inline="no-display-inline" id="id0AA557243EAE41EB946D49F24217B1D4"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>85
			 percent</quote> and inserting <quote>100 percent</quote>; and</text>
			</paragraph><paragraph display-inline="no-display-inline" id="id542FD63A7AC64C9C92335A1EF0FEEA79"><enum>(2)</enum><text>by adding at the
			 end the following new subclause:</text>
				<quoted-block display-inline="no-display-inline" id="idBA2299F4EBAE4096B84D5D1419002E08" style="OLC">
					<subclause commented="no" display-inline="no-display-inline" id="H88468B0D56F440408CF5C3054BBDDDA" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">In the case of a sole community hospital
				(as defined in section 1886(d)(5)(D)(iii)), for covered OPD services furnished
				during 2008, for which the PPS amount is less than the pre-BBA amount, the
				amount of payment under this subsection shall be increased by the amount of
				such
				difference.</text>
					</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID48D66CE8B9974B56BE58F5213CE23819"><enum>4.</enum><header>Improvement of
			 definition of low-volume hospital for purposes of the Medicare inpatient
			 hospital payment adjustment</header><text display-inline="no-display-inline">Section 1886(d)(12)(C)(i) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395ww(d)(12)(C)(i)) is amended by inserting <quote>(or, beginning with fiscal
			 year 2008, 2,000 discharges)</quote> after <quote>800
			 discharges</quote>.</text>
		</section><section id="id82163FA9E3764E4FA49AA382F99BCF37"><enum>5.</enum><header>Extension of
			 Medicare wage index reclassifications for certain hospitals</header>
			<subsection id="id5925DDF1F1C3401FBCD257FD847B3103"><enum>(a)</enum><header>Extension of
			 correction of mid-year reclassification expiration for certain
			 hospitals</header>
				<paragraph id="id2821D16148AF4A038A19B5D56E5F89B5"><enum>(1)</enum><header>In
			 general</header><text>In the case of a hospital described in paragraph (2),
			 effective September 30, 2007, the Secretary of Health and Human Services shall
			 apply subsection (a) of section 106 of division B of the Tax Relief and Health
			 Care Act of 2006 (42 U.S.C. 1395ww note) by substituting <quote>September 30,
			 2008</quote> for <quote>September 30, 2007</quote>.</text>
				</paragraph><paragraph id="idFD2817E359F14A49B100364AA26BBC94"><enum>(2)</enum><header>Hospital
			 described</header><text>A hospital described in this paragraph is a
			 hospital—</text>
					<subparagraph id="id9950397804924417AD0027829925E554"><enum>(A)</enum><text>that is described
			 in subsection (a) of such section 106; and</text>
					</subparagraph><subparagraph id="id435CA298418A4FA48CE8A7E5410E6F06"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id0EBB14C2861542D990375081AC9F5E99"><enum>(i)</enum><text>that is located in a
			 State with less than 10 people per square mile; or</text>
						</clause><clause id="idAF7DD9713EEA47B594EB2D48A6BACB19" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idC65D400712C44E65B8D79B1B025459FE"><enum>(I)</enum><text>that is located in a
			 rural area; and</text>
							</subclause><subclause id="id5BDED58AC07F4478B0D1D69B1244DFC7" indent="up1"><enum>(II)</enum><text>for which the Secretary of Health
			 and Human Services has determined the extension under this subsection to be
			 appropriate.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID84749740FE9B426B927BD470023CA0C9"><enum>(b)</enum><header>Additional
			 Extension</header><text>The Secretary of Health and Human Services shall extend
			 the special exception reclassification of a sole community hospital located in
			 a State with less than 10 people per square mile (made under the authority of
			 section 1886(d)(5)(I)(i) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395ww(d)(5)(I)(i)) and contained in the final rule
			 promulgated by the Secretary in the Federal Register on August 11, 2004 (69
			 Fed. Reg. 49107)) for 1 year through September 30, 2008.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD524336E88234FB99C706BEB4B1089FB"><enum>(c)</enum><header>Not budget
			 neutral</header><text>The provisions of this section shall not be effected in a
			 budget-neutral manner.</text>
			</subsection></section><section id="H61CAD1A8DD724C82B120A3131DA1E88"><enum>6.</enum><header>Extension of
			 Medicare reasonable costs payments for certain clinical diagnostic laboratory
			 tests furnished to hospital patients in certain rural areas</header><text display-inline="no-display-inline">Section 416(b) of the Medicare Prescription
			 Drug, Improvement, and Modernization Act of 2003 (42 U.S.C. 1395l–4(b)), as
			 amended by section 105 of division B of the Tax Relief and Health Care Act of
			 2006 (42 U.S.C. 1395l note), is amended by striking <quote>3-year</quote> and
			 inserting <quote>5-year</quote>.</text>
		</section><section id="ID9FCE33DE1B1C4573B9263745C7617587"><enum>7.</enum><header>Critical access
			 hospital improvements</header>
			<subsection id="IDDE8421828FAD4828880279B2DAB3BC10"><enum>(a)</enum><header>Clarification
			 of payment for clinical laboratory tests furnished by critical access
			 hospitals</header>
				<paragraph id="IDACEA5FC2C6D043499DF60FC08154EB56"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="act" parsable-cite="SSA/1834(g)(4)">Section 1834(g)(4)</external-xref> of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m(g)(4)">42 U.S.C.
			 1395m(g)(4)</external-xref>) is amended—</text>
					<subparagraph id="IDB07589F68E134799801E119434BEDF65"><enum>(A)</enum><text>in the heading,
			 by striking <quote><header-in-text level="paragraph" style="OLC">no beneficiary
			 cost-sharing for</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">treatment of</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="ID2EB4011E34D84FCABF2D6E15BB03E6EC"><enum>(B)</enum><text>by adding at the
			 end the following new sentence: “For purposes of the preceding sentence and
			 section 1861(mm)(3), clinical diagnostic laboratory services furnished by a
			 critical access hospital shall be treated as being furnished as part of
			 outpatient critical access services without regard to whether—</text>
						<quoted-block id="ID048393CA22214F71BD85A822109D74C1">
							<subparagraph id="IDC678129258F84C7EA9B5B243E63DFFE9"><enum>(A)</enum><text>the individual
				with respect to whom such services are furnished is physically present in the
				critical access hospital at the time the specimen is collected;</text>
							</subparagraph><subparagraph id="IDD5E792BC36194C35B5A5B0D684280B2D"><enum>(B)</enum><text>such individual
				is registered as an outpatient on the records of, and receives such services
				directly from, the critical access hospital; or</text>
							</subparagraph><subparagraph id="IDDD45CB475B2E4471AAE87B8E22E5F4AB"><enum>(C)</enum><text>payment is (or,
				but for this subsection, would be) available for such services under the fee
				schedule established under section
				1833(h).</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06BE084B07864328AC0A877A09FEA541"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply to cost
			 reporting periods beginning on or after the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="IDBA19DE7CBF59439EAD7B5D3721326A6A"><enum>(b)</enum><header>Elimination of
			 Isolation Test for cost-based ambulance reimbursement</header>
				<paragraph id="ID1D63C99A732A46429EDCF2E516E25E96"><enum>(1)</enum><header>In
			 general</header><text>Section 1834(l)(8) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395m(l)(8)) is
			 amended—</text>
					<subparagraph id="IDB2CC400B5F94449ABCBAF01874E1BB34"><enum>(A)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="IDD7FB93D42EB145C59F52CDF71F1987DC"><enum>(i)</enum><text>by
			 striking <quote>owned and</quote>; and</text>
						</clause><clause id="IDC4D2F919EC4D4498968A394356DDD6D7"><enum>(ii)</enum><text>by
			 inserting <quote>(including when such services are provided by the entity under
			 an arrangement with the hospital)</quote> after <quote>hospital</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="IDB1B90D28D00B408085ABA5A30B453088"><enum>(B)</enum><text>by striking the
			 comma at the end of subparagraph (B) and all that follows and inserting a
			 period.</text>
					</subparagraph></paragraph><paragraph id="ID49C9F92F66E542B98BB295AE23B4E03A"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply to
			 services furnished on or after January 1, 2008.</text>
				</paragraph></subsection></section><section id="ID9DF22DB327EB4A8FBB24F83D2967A9F4"><enum>8.</enum><header>Capital
			 infrastructure revolving loan program</header>
			<subsection id="ID30B774620D2E41EF820CA5C572EBB543"><enum>(a)</enum><header>In
			 General</header><text>Part A of title XVI of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C. 300q et
			 seq.) is amended by adding at the end the following new section:</text>
				<quoted-block act-name="Public Health Service Act" id="ID6B37A0D1BE1843349FE0A9499A85ADAF" style="traditional">
					<section id="ID24677C5583E149A7B03DA74387646DA9"><enum>1603.</enum><header>Capital infrastructure revolving loan
		  program</header><subsection commented="no" display-inline="yes-display-inline" id="ID45D16B8AA88F4B2A851355536B918D36"><enum>(a)</enum><header>Authority To Make and
				Guarantee Loans</header>
							<paragraph id="IDA923D807A3804C05B9F99DD814C26731"><enum>(1)</enum><header>Authority to
				make loans</header><text>The Secretary may make loans from the fund established
				under section 1602(d) to any rural entity for projects for capital
				improvements, including—</text>
								<subparagraph id="ID2D4384706AE3465180A763615994F859"><enum>(A)</enum><text>the acquisition
				of land necessary for the capital improvements;</text>
								</subparagraph><subparagraph id="ID6A36FE6008AD468799CFD8C24214D85D"><enum>(B)</enum><text>the renovation or
				modernization of any building;</text>
								</subparagraph><subparagraph id="IDF646C630AD974D63A517FDF055D8CF5A"><enum>(C)</enum><text>the acquisition
				or repair of fixed or major movable equipment; and</text>
								</subparagraph><subparagraph id="ID78A844011EC34D33BCDC000FE46BD840"><enum>(D)</enum><text>such other
				project expenses as the Secretary determines appropriate.</text>
								</subparagraph></paragraph><paragraph id="ID9CEB3A75B43449F7A4BB8FC0DF74E588"><enum>(2)</enum><header>Authority to
				guarantee loans</header>
								<subparagraph id="IDF4AE7CC704AA4AF6B9A937C86791DD1B"><enum>(A)</enum><header>In
				general</header><text>The Secretary may guarantee the payment of principal and
				interest for loans made to rural entities for projects for any capital
				improvement described in paragraph (1) to any non-Federal lender.</text>
								</subparagraph><subparagraph id="ID6E92B627E2214AAAB09526BB4484A19F"><enum>(B)</enum><header>Interest
				subsidies</header><text>In the case of a guarantee of any loan made to a rural
				entity under subparagraph (A), the Secretary may pay to the holder of such
				loan, for and on behalf of the project for which the loan was made, amounts
				sufficient to reduce (by not more than 3 percent) the net effective interest
				rate otherwise payable on such loan.</text>
								</subparagraph></paragraph></subsection><subsection id="IDD9B9775C3A6F4A1A97143D4CC81ACFD2"><enum>(b)</enum><header>Amount of
				Loan</header><text>The principal amount of a loan directly made or guaranteed
				under subsection (a) for a project for capital improvement may not exceed
				$5,000,000.</text>
						</subsection><subsection id="IDA660E0F212C24E7EB09BFCEFCA547E91"><enum>(c)</enum><header>Funding
				Limitations</header>
							<paragraph id="IDCE792DC3B1BA4392A4EB8666BA675914"><enum>(1)</enum><header>Government
				credit subsidy exposure</header><text>The total of the Government credit
				subsidy exposure under the Credit Reform Act of 1990 scoring protocol with
				respect to the loans outstanding at any time with respect to which guarantees
				have been issued, or which have been directly made, under subsection (a) may
				not exceed $50,000,000 per year.</text>
							</paragraph><paragraph id="ID2842435E32484253BC7460BFBBC37D6A"><enum>(2)</enum><header>Total
				amounts</header><text>Subject to paragraph (1), the total of the principal
				amount of all loans directly made or guaranteed under subsection (a) may not
				exceed $250,000,000 per year.</text>
							</paragraph></subsection><subsection id="IDD9AD8BA561A24C3785BEDE2387281083"><enum>(d)</enum><header>Capital
				Assessment and Planning Grants</header>
							<paragraph id="IDDB6A379C68B24AF391B87E5ACEE4DF3B"><enum>(1)</enum><header>Nonrepayable
				grants</header><text>Subject to paragraph (2), the Secretary may make a grant
				to a rural entity, in an amount not to exceed $50,000, for purposes of capital
				assessment and business planning.</text>
							</paragraph><paragraph id="IDDA3C0F16C24B4FB5805F3E102BD44728"><enum>(2)</enum><header>Limitation</header><text>The
				cumulative total of grants awarded under this subsection may not exceed
				$2,500,000 per year.</text>
							</paragraph></subsection><subsection id="ID9187FF4B9D1742E49B4E44B0CB7E4DA1"><enum>(e)</enum><header>Termination of
				Authority</header><text>The Secretary may not directly make or guarantee any
				loan under subsection (a) or make a grant under subsection (d) after September
				30,
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2B374EF62E194D619987DACD76E65BB7"><enum>(b)</enum><header>Rural Entity
			 Defined</header><text>Section 1624 of the <act-name parsable-cite="PHSA">Public
			 Health Service Act</act-name> (42 U.S.C. 300s–3) is amended by adding at the
			 end the following new paragraph:</text>
				<quoted-block act-name="Public Health Service Act" id="IDA559C79651CB45ABA706495B81E8F6C4" style="OLC">
					<paragraph id="ID1315CBB900AE455F84A611A56969FE88"><enum>(15)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID52A792E6C91A4B02AACAA822B3FC46FE"><enum>(A)</enum><text>The term <term>rural
				entity</term> includes—</text>
							<clause id="IDD76DCFFD14C04F46AA6FEF27A21C27A5" indent="up1"><enum>(i)</enum><text>a rural health clinic, as defined
				in section 1861(aa)(2) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name>;</text>
							</clause><clause id="ID32C99B685FD743F1A6C8BAC454BA81BA" indent="up1"><enum>(ii)</enum><text>any medical facility with at least
				1 bed, but with less than 50 beds, that is located in—</text>
								<subclause id="IDC2D69A2AA7574AA88F96D3F27DCC076A"><enum>(I)</enum><text>a county that is not part of a
				metropolitan statistical area; or</text>
								</subclause><subclause id="ID949F7A07D6124B838DA7FF4A4D45F757"><enum>(II)</enum><text>a rural census tract of a metropolitan
				statistical area (as determined under the most recent modification of the
				Goldsmith Modification, originally published in the Federal Register on
				February 27, 1992 (57 Fed. Reg. 6725));</text>
								</subclause></clause><clause id="ID5D09EC6E1C0E4021B1CDAE916633815A" indent="up1"><enum>(iii)</enum><text>a hospital that is classified as
				a rural, regional, or national referral center under section 1886(d)(5)(C) of
				the <act-name parsable-cite="SSA">Social Security Act</act-name>; and</text>
							</clause><clause id="IDC4D22F1C51A8432989ADD8EA48AA9C2F" indent="up1"><enum>(iv)</enum><text>a hospital that is a sole
				community hospital (as defined in section 1886(d)(5)(D)(iii) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>).</text>
							</clause></subparagraph><subparagraph id="IDD687A1084070457785D0E116AF8964F3" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the
				fact that a clinic, facility, or hospital has been geographically reclassified
				under the Medicare program under title XVIII of the
				<act-name parsable-cite="SSA">Social Security Act</act-name> shall not preclude
				a hospital from being considered a rural entity under clause (i) or (ii) of
				subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2E24FCD57A7542ECAF20132C7D040161"><enum>(c)</enum><header>Conforming

			<paragraph id="id1FCD466A204C465F8E1F7FA44F50F2C2"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>, and</quote> at the end and inserting a semicolon;</text>

			 health center collaborative access expansion</header><text display-inline="no-display-inline">Section 330 of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 254b) is amended by adding at the end the following:</text>

				construction with respect to rural health clinics</header>
						<subparagraph id="IDA70C4EA7B860460DBDDA9E300C755C57"><enum>(A)</enum><header>In
				general</header><text>Nothing in this section shall be construed to prevent a
				community health center from contracting with a federally certified rural
				health clinic (as defined by section 1861(aa)(2) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>) for the delivery
				of primary health care services that are available at the rural health clinic
				to individuals who would otherwise be eligible for free or reduced cost care if
				that individual were able to obtain that care at the community health center.
				Such services may be limited in scope to those primary health care services
				available in that rural health clinic.</text>
						</subparagraph><subparagraph id="ID0D4E66EB3B87454991C63DBE4CEB0383"><enum>(B)</enum><header>Assurances</header><text>In
				order for a rural health clinic to receive funds under this section through a
				contract with a community health center under paragraph (1), such rural health
				clinic shall establish policies to ensure—</text>
							<clause id="ID90E925D0F83F4A0DA061EA5930B2F8A3"><enum>(i)</enum><text>nondiscrimination
				based upon the ability of a patient to pay; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDE7707504AF2B486F824AEFA4A4333F66"><enum>(ii)</enum><text>the
				establishment of a sliding fee scale for low-income
				patients.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id549E2641A77046ED93F3B5F988649A24" section-type="subsequent-section"><enum>14.</enum><header>Application of the
			 temporary Medicare payment increase for home health services furnished in a
			 rural area to 2008</header><text display-inline="no-display-inline">Section 421
			 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395fff note">42 U.S.C.
			 1395fff note</external-xref>), as amended by section 5201(b) of the Deficit
			 Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395fff note">42 U.S.C. 1395fff note</external-xref>), is
			 amended—</text>

			 end the following new subparagraph:</text>

					</subparagraph></paragraph><paragraph id="IDF052ABBA499747DBBD0C789AFCFC0A03"><enum>(2)</enum><header>Definitions</header><text>Section
			 1861 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1395x) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block act-name="Social Security Act" id="ID1E6A4FF3B6B142E0B45CB5E535C33A97" other-style="archaic" style="other">
						<subsection id="ID57DA98880EFF44F1A9C1521D81ECE381"><enum>(ccc)</enum><header>Marriage and Family Therapist Services; Marriage and Family
		  Therapist; Mental Health Counselor Services; Mental Health
		  Counselor</header><paragraph commented="no" display-inline="yes-display-inline" id="ID873164F7BB9346C8B20A5365518F73EE"><enum>(1)</enum><text>The term <term>marriage
				and family therapist services</term> means services performed by a marriage and
				family therapist (as defined in paragraph (2)) for the diagnosis and treatment
				of mental illnesses, which the marriage and family therapist is legally
				authorized to perform under State law (or the State regulatory mechanism
				provided by State law) of the State in which such services are performed, as
				would otherwise be covered if furnished by a physician or as an incident to a
				physician’s professional service, but only if no facility or other provider
				charges or is paid any amounts with respect to the furnishing of such
				services.</text>
							</paragraph><paragraph id="IDBBE7065D72354C5B8EDD51F1F8938376" indent="up1"><enum>(2)</enum><text>The term <term>marriage and family
				therapist</term> means an individual who—</text>
								<subparagraph id="ID0BE7C20F4B5D4477A0B302AA938FDF20"><enum>(A)</enum><text>possesses a master’s or doctoral
				degree which qualifies for licensure or certification as a marriage and family
				therapist pursuant to State law;</text>
								</subparagraph><subparagraph id="ID1E5FBF1768EB4767925093E91F50DEEE"><enum>(B)</enum><text>after obtaining such degree has
				performed at least 2 years of clinical supervised experience in marriage and
				family therapy; and</text>
								</subparagraph><subparagraph id="ID026DA4EAA6D94832B9BAED18393B65CA"><enum>(C)</enum><text>in the case of an individual
				performing services in a State that provides for licensure or certification of
				marriage and family therapists, is licensed or certified as a marriage and
				family therapist in such State.</text>
								</subparagraph></paragraph><paragraph id="IDDC13F4AC00254F0C8E824305E9EDB008" indent="up1"><enum>(3)</enum><text>The term <term>mental health
				counselor services</term> means services performed by a mental health counselor
				(as defined in paragraph (4)) for the diagnosis and treatment of mental
				illnesses which the mental health counselor is legally authorized to perform
				under State law (or the State regulatory mechanism provided by the State law)
				of the State in which such services are performed, as would otherwise be
				covered if furnished by a physician or as incident to a physician’s
				professional service, but only if no facility or other provider charges or is
				paid any amounts with respect to the furnishing of such services.</text>
							</paragraph><paragraph id="ID69AD080BB38345338DF7ABC03B0D535C" indent="up1"><enum>(4)</enum><text>The term <term>mental health
				counselor</term> means an individual who—</text>
								<subparagraph id="IDB1297F3987FF4741880262F475EEA375"><enum>(A)</enum><text>possesses a master’s or doctor’s
				degree in mental health counseling or a related field;</text>
								</subparagraph><subparagraph id="IDEBACE4CDBFF64DE598C1CC7911513CCC"><enum>(B)</enum><text>after obtaining such a degree has
				performed at least 2 years of supervised mental health counselor practice;
				and</text>
								</subparagraph><subparagraph id="ID788BC64A30A84EAA96D797BDB2A1AAA4"><enum>(C)</enum><text>in the case of an individual
				performing services in a State that provides for licensure or certification of
				mental health counselors or professional counselors, is licensed or certified
				as a mental health counselor or professional counselor in such
				State.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDA97C47041D4F4E0A880B39784847507A"><enum>(3)</enum><header>Provision for
			 payment under part <enum-in-header>B</enum-in-header></header><text>Section
			 1832(a)(2)(B) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395k(a)(2)(B)) is amended by adding at the end the
			 following new clause:</text>

				</paragraph><paragraph id="ID630362D1EE71465DA69B2DC6AF23F6F7"><enum>(4)</enum><header>Amount of
			 payment</header><text>Section 1833(a)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395l(a)(1)) is
			 amended—</text>
					<subparagraph id="IDD637546AE84B4D65AC102494E5D6D138"><enum>(A)</enum><text>by striking
			 <quote>and (V)</quote> and inserting <quote>(V)</quote>; and</text>
					</subparagraph><subparagraph id="ID45D6F8F475A34D2094F563769C3379A3"><enum>(B)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (W) with respect to
			 marriage and family therapist services and mental health counselor services
			 under section 1861(s)(2)(BB), the amounts paid shall be 80 percent of the
			 lesser of the actual charge for the services or 75 percent of the amount
			 determined for payment of a psychologist under subparagraph (L)</quote>.</text>
					</subparagraph></paragraph><paragraph id="IDDD920735B7904576A872F024C18C8139"><enum>(5)</enum><header>Exclusion of
			 marriage and family therapist services and mental health counselor services
			 from skilled nursing facility prospective payment system</header><text>Section
			 1888(e)(2)(A)(ii) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395yy(e)(2)(A)(ii)) is amended by inserting
			 <quote>marriage and family therapist services (as defined in section
			 1861(ccc)(1)), mental health counselor services (as defined in section
			 1861(ccc)(3)),</quote> after <quote>qualified psychologist
			 services,</quote>.</text>
				</paragraph><paragraph id="ID42CDED8040754B42B74517983D2E8509"><enum>(6)</enum><header>Inclusion of
			 marriage and family therapists and mental health counselors as practitioners
			 for assignment of claims</header><text>Section 1842(b)(18)(C) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395u(b)(18)(C)) is amended by adding at the end the following new
			 clauses:</text>

				</paragraph></subsection><subsection id="IDC87F270CC1AF466F948652059D64AA94"><enum>(b)</enum><header>Coverage of
			 Certain Mental Health Services Provided in Certain Settings</header>
				<paragraph id="ID66ECDFF0D59D431C99FA3D7F6B9B81E6"><enum>(1)</enum><header>Rural health
			 clinics and federally qualified health centers</header><text>Section
			 1861(aa)(1)(B) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395x(aa)(1)(B)) is amended by striking <quote>or by
			 a clinical social worker (as defined in subsection (hh)(1))</quote> and
			 inserting <quote>, by a clinical social worker (as defined in subsection
			 (hh)(1)), by a marriage and family therapist (as defined in subsection
			 (ccc)(2)), or by a mental health counselor (as defined in subsection
			 (ccc)(4))</quote>.</text>
				</paragraph><paragraph id="ID8113CB708D0E4CD7BCFEA82FFF912BB8"><enum>(2)</enum><header>Hospice
			 programs</header><text>Section 1861(dd)(2)(B)(i)(III) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395x(dd)(2)(B)(i)(III)) is amended by inserting <quote>or one marriage and
			 family therapist (as defined in subsection (ccc)(2))</quote> after
			 <quote>social worker</quote>.</text>
				</paragraph></subsection><subsection id="ID4E1F2676E03B4D8E8DF6BD3FAA70A86D"><enum>(c)</enum><header>Authorization
			 of Marriage and Family Therapists To Develop Discharge Plans for Post-Hospital
			 Services</header><text>Section 1861(ee)(2)(G) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395x(ee)(2)(G)) is amended by inserting <quote>marriage and family therapist
			 (as defined in subsection (ccc)(2)),</quote> after <quote>social
			 worker,</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID90B43F8A08F34B8D93BABC0BCB5C6118"><enum>(d)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply with respect
			 to services furnished on or after January 1, 2008.</text>
			</subsection></section><section id="IDB4F6FB08B8FB4763AF28883C6819D5F2"><enum>17.</enum><header>Extension of
			 treatment of certain physician pathology services under Medicare</header><text display-inline="no-display-inline">Section 542(c) of the Medicare, Medicaid,
			 and SCHIP Benefits Improvement and Protection Act of 2000 (as enacted into law
			 by section 1(a)(6) of Public Law 106–554), as amended by section 732 of the
			 Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (42
			 U.S.C. 1395w–4 note) and section 104 of division B of the Tax Relief and Health
			 Care Act of 2006 (42 U.S.C. 1395w–4 note), is amended by striking <quote>and
			 2007</quote> and inserting <quote>2007, 2008, and 2009</quote>.</text>
		</section><section id="id2F82E7C7E31246CFBD32CAEC62161C44"><enum>18.</enum><header>Medicare remote
			 monitoring pilot projects</header>
			<subsection id="id805017BFD3A849C9ADD0CEFFAA1194F1"><enum>(a)</enum><header>Pilot
			 projects</header>
				<paragraph id="id9A1456A6307840E7B84E61E85151D6E5"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 9
			 months after the date of enactment of this Act, the Secretary of Health and
			 Human Services (in this section referred to as the <quote>Secretary</quote>)
			 shall conduct pilot projects under title XVIII of the Social Security Act for
			 the purpose of providing incentives to home health agencies to utilize home
			 monitoring and communications technologies that—</text>
					<subparagraph id="idEF981425ED7F445E84246ADF849E7AA6"><enum>(A)</enum><text>enhance health
			 outcomes for Medicare beneficiaries; and</text>
					</subparagraph><subparagraph id="idC1FC09CFFB784CC98D0E40B33322D212"><enum>(B)</enum><text>reduce
			 expenditures under such title.</text>
					</subparagraph></paragraph><paragraph id="idFAB7FCDBC10245EB807F7C024AED1FD6"><enum>(2)</enum><header>Site
			 requirements</header>
					<subparagraph id="id3C9E1D20F21B41C5B31DFC1773D355A5"><enum>(A)</enum><header>Urban and
			 Rural</header><text>The Secretary shall conduct the pilot projects under this
			 section in both urban and rural areas.</text>
					</subparagraph><subparagraph id="id0401A61F3F1D4CC481B7ED10302C197E"><enum>(B)</enum><header>Site in a small
			 state</header><text>The Secretary shall conduct at least 3 of the pilot
			 projects in a State with a population of less than 1,000,000.</text>
					</subparagraph></paragraph><paragraph id="id1AEAFD4C75EF4A5796749404D356F050"><enum>(3)</enum><header>Definition of
			 home health agency</header><text>In this section, the term <quote>home health
			 agency</quote> has the meaning given that term in section 1861(o) of the Social
			 Security Act (42 U.S.C. 1395x(o)).</text>
				</paragraph></subsection><subsection id="idA105E433343347AE86B07DD8681C3F03"><enum>(b)</enum><header>Medicare
			 beneficiaries within the scope of projects</header><text>The Secretary shall
			 specify the criteria for identifying those Medicare beneficiaries who shall be
			 considered within the scope of the pilot projects under this section for
			 purposes of the application of subsection (c) and for the assessment of the
			 effectiveness of the home health agency in achieving the objectives of this
			 section. Such criteria may provide for the inclusion in the projects of
			 Medicare beneficiaries who begin receiving home health services under title
			 XVIII of the Social Security Act after the date of the implementation of the
			 projects.</text>
			</subsection><subsection id="id56BF0662E8E64096A5B0DBE223B868BA"><enum>(c)</enum><header>Incentives</header>
				<paragraph id="id55520AD800DA4F40A79206E6B0AD2649"><enum>(1)</enum><header>Performance
			 targets</header><text>The Secretary shall establish for each home health agency
			 participating in a pilot project under this section a performance target using
			 one of the following methodologies, as determined appropriate by the
			 Secretary:</text>
					<subparagraph id="id5553D221C57E4DF1A09E086B21534C52"><enum>(A)</enum><header>Adjusted
			 historical performance target</header><text>The Secretary shall establish for
			 the agency—</text>
						<clause id="id647D33FD0C944815BE2F855080AA2FFE"><enum>(i)</enum><text>a
			 base expenditure amount equal to the average total payments made to the agency
			 under parts A and B of title XVIII of the Social Security Act for Medicare
			 beneficiaries determined to be within the scope of the pilot project in a base
			 period determined by the Secretary; and</text>
						</clause><clause id="id6FBE2E4BA1454C858EA4E59E6750B350"><enum>(ii)</enum><text>an
			 annual per capita expenditure target for such beneficiaries, reflecting the
			 base expenditure amount adjusted for risk and adjusted growth rates.</text>
						</clause></subparagraph><subparagraph id="idF6F67BB1C66240CDA4D5A12AF797A96E"><enum>(B)</enum><header>Comparative
			 performance target</header><text>The Secretary shall establish for the agency a
			 comparative performance target equal to the average total payments under such
			 parts A and B during the pilot project for comparable individuals in the same
			 geographic area that are not determined to be within the scope of the pilot
			 project.</text>
					</subparagraph></paragraph><paragraph id="idDA60E2E2B917452F83AE2EBB449D10AA"><enum>(2)</enum><header>Incentive</header><text>Subject
			 to paragraph (3), the Secretary shall pay to each participating home care
			 agency an incentive payment for each year under the pilot project equal to a
			 portion of the Medicare savings realized for such year relative to the
			 performance target under paragraph (1).</text>
				</paragraph><paragraph id="id6E6456B4406D44C8889E63F06522B390"><enum>(3)</enum><header>Limitation on
			 expenditures</header><text>The Secretary shall limit incentive payments under
			 this section in order to ensure that the aggregate expenditures under title
			 XVIII of the Social Security Act (including incentive payments under this
			 subsection) do not exceed the amount that the Secretary estimates would have
			 been expended if the pilot projects under this section had not been
			 implemented.</text>
				</paragraph></subsection><subsection id="id65EFC3C335464EF6901FC7BEEA738D7A"><enum>(d)</enum><header>Waiver
			 authority</header><text>The Secretary may waive such provisions of titles XI
			 and XVIII of the Social Security Act as the Secretary determines to be
			 appropriate for the conduct of the pilot projects under this section.</text>
			</subsection><subsection id="idA7A3DEF684374C498B4C283FE7E4A4E4"><enum>(e)</enum><header>Report to
			 Congress</header><text>Not later than 5 years after the date that the first
			 pilot project under this section is implemented, the Secretary shall submit to
			 Congress a report on the pilot projects. Such report shall contain a detailed
			 description of issues related to the expansion of the projects under subsection
			 (f) and recommendations for such legislation and administrative actions as the
			 Secretary considers appropriate.</text>
			</subsection><subsection id="id2A127837C9314CD294CB084D5BD06714"><enum>(f)</enum><header>Expansion</header><text>If
			 the Secretary determines that any of the pilot projects under this section
			 enhance health outcomes for Medicare beneficiaries and reduce expenditures
			 under title XVIII of the Social Security Act, the Secretary may initiate
			 comparable projects in additional areas.</text>
			</subsection><subsection id="id239E24C11A2F4CC49D34C26570F5C76E"><enum>(g)</enum><header>Incentive
			 payments have no effect on other Medicare payments to agencies</header><text>An
			 incentive payment under this section—</text>
				<paragraph id="id367730818BE44CEEBE8B89424B4BD1D6"><enum>(1)</enum><text>shall be in
			 addition to the payments that a home health agency would otherwise receive
			 under title XVIII of the Social Security Act for the provision of home health
			 services; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD2B2730C57F0420DA8101216D7E961B7"><enum>(2)</enum><text>shall have no
			 effect on the amount of such payments.</text>
				</paragraph></subsection></section><section id="ID9A6FF121C6BF4A1A8FBDE8FFC8AE663E"><enum>19.</enum><header>Facilitating
			 the provision of telehealth services across State lines</header>
			<subsection id="ID39A9E55570AF4B67855F4935846F2863"><enum>(a)</enum><header>In
			 general</header><text>For purposes of expediting the provision of telehealth
			 services, for which payment is made under the Medicare program, across State
			 lines, the Secretary of Health and Human Services shall, in consultation with
			 representatives of States, physicians, health care practitioners, and patient
			 advocates, encourage and facilitate the adoption of provisions allowing for
			 multistate practitioner practice across State lines.</text>
			</subsection><subsection id="ID4A5E74E8E24F4221A790800ED732545B"><enum>(b)</enum><header>Definitions</header><text>In
			 subsection (a):</text>
				<paragraph id="ID6E4F8D8189A145E6B9B022718503C7A5"><enum>(1)</enum><header>Telehealth
			 service</header><text>The term <term>telehealth service</term> has the meaning
			 given that term in subparagraph (F) of section 1834(m)(4) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395m(m)(4)).</text>
				</paragraph><paragraph id="ID4F2E9F8EDA304316A1F201DAFD62B5ED"><enum>(2)</enum><header>Physician,
			 practitioner</header><text>The terms <term>physician</term> and
			 <term>practitioner</term> have the meaning given those terms in subparagraphs
			 (D) and (E), respectively, of such section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41BBE758276147D0A201779BEF90D32C"><enum>(3)</enum><header>Medicare
			 program</header><text>The term <quote>Medicare program</quote> means the
			 program of health insurance administered by the Secretary of Health and Human
			 Services under title XVIII of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395 et seq.).</text>
