		<section id="idF0B6F3193B784BE0B9AF0E92C1BE34BF" section-type="section-one"><enum>1.</enum><header>Energy-related research and
			 development</header>
			<subsection id="idB5BD707032A443BCAB36E610E8FCF5F7"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id0D39F5A13C714320AFEBDBB6355F47DD"><enum>(1)</enum><text>information and
			 opinions provided by individuals and entities of the academic and industrial
			 sectors should be an important consideration with respect to energy-related
			 research and development activities carried out by the Federal
			 Government;</text>
				</paragraph><paragraph id="id61176BE2006648ECAD6E13959112BA07"><enum>(2)</enum><text>in carrying out
			 energy-related research and development activities, the Federal Government
			 should regularly seek input from multiple sources, including the industrial
			 sector, academia, and other relevant sectors;</text>
				</paragraph><paragraph id="IDba9cfc49818943caa97f327d2f547298"><enum>(3)</enum><text>research is
			 better focused around well-defined problems that need to be resolved;</text>
				</paragraph><paragraph id="ID70a715e371044322bb7fa14a1365fa8f"><enum>(4)</enum><text>a number of
			 potential problems to be resolved are likely to require input from a diverse
			 selection of technologies and contributing sectors;</text>
				</paragraph><paragraph id="id0F62C56184A8464F8C387EC13015655B"><enum>(5)</enum><text>sharing of
			 information relating to energy research and development is important to the
			 development and innovation of energy technologies;</text>
				</paragraph><paragraph id="ID3164ff8ba4ae46608263ae46094471a3"><enum>(6)</enum><text>necessary
			 intellectual property protection can lead to delays in sharing valuable
			 information that could aid in resolving major energy-related problems;</text>
				</paragraph><paragraph id="ID2cc563bb3bbf437b9a2d630dbbe7e727"><enum>(7)</enum><text>the Federal
			 Government should facilitate the sharing of information from a diverse array of
			 industries by ensuring the protection of intellectual property while
			 simultaneously creating an environment of openness and cooperation; and</text>
				</paragraph><paragraph id="id6390EC8AA5F542079CE8B308543CBBE3"><enum>(8)</enum><text>the Federal
			 Government should revise the methods of the Federal Government regarding
			 energy-related research and development to encourage faster development and
			 implementation of energy technologies.</text>
				</paragraph></subsection><subsection id="id8938388AC63044B6A4D42EEDC308557D"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id8E0CE057319643B9AC51F3B1F6105E6C"><enum>(1)</enum><header>Network</header><text>The
			 term <term>network</term> means the Energy Technologies Innovation Network
			 established by subsection (d)(1).</text>
				</paragraph><paragraph id="idA9939D13A7334AB9B7963402584B1204"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph><paragraph id="id689F82D78D53469CB89D898A7A534FBC"><enum>(3)</enum><header>Survey</header><text>The
			 term <term>survey</term> means a survey conducted pursuant to subsection
			 (c).</text>
				</paragraph></subsection><subsection id="id8AC9D37CBD6B48D5A759C9E0B7F8C1F0"><enum>(c)</enum><header>Energy-related
			 research and development priorities</header>
				<paragraph id="id54E6AC4103AD44E9A5BAF96D5E0E4776"><enum>(1)</enum><header>In
			 general</header><text>Not less frequently than once every 5 years, the
			 Secretary shall conduct a survey in accordance with this subsection to
			 determine the 10 highest-priority energy-related problems to resolve to ensure
			 the goals of—</text>
					<subparagraph id="IDab727bfac9d24111b8a5356694239521"><enum>(A)</enum><text>maximizing the
			 energy security of the United States;</text>
					</subparagraph><subparagraph id="ID6fae9087a3344e248a00f15ce8e4b1c2"><enum>(B)</enum><text>maximizing
			 improvements in energy efficiency within the United States; and</text>
					</subparagraph><subparagraph id="ID7b3d67f5aaa34b5992ae8d7c94ae1404"><enum>(C)</enum><text>minimizing damage
			 to the economy and the environment of the United States.</text>
					</subparagraph></paragraph><paragraph id="idB53E7C7DD2FF4799B8D085276208569B"><enum>(2)</enum><header>Survey</header>
					<subparagraph id="idDB24CDEC62EF49BA9EBBC9A24EAA8E9E"><enum>(A)</enum><header>In
			 general</header><text>Each survey shall contain a request that the respondent
			 shall list, in descending order of priority, the 10 highest-priority
			 energy-related problems that, in the opinion of the respondent, require
			 resolution as quickly as practicable to ensure the goals described in paragraph
			 (1).</text>
					</subparagraph><subparagraph id="id62EE5D54AC0747F58BF16245BB6C6F40"><enum>(B)</enum><header>Announcement</header><text>The
			 Secretary shall announce the existence of each survey by—</text>
						<clause id="id3B82927B26944EB1986681BE0604DFFA"><enum>(i)</enum><text>publishing an
			 announcement in the Federal Register; and</text>
						</clause><clause id="id04E5B1FE1573495DA3F40FF0F2898FAA"><enum>(ii)</enum><text>placing an
			 announcement in a prominent position on the homepage of the website of the
			 Department of the Energy.</text>
						</clause></subparagraph><subparagraph id="id7C2B59340B024968B0AEE16CCAF8AD01"><enum>(C)</enum><header>Availability</header><text>The
			 Secretary shall ensure that each survey is made available—</text>
						<clause id="idEF640EB4C08244C9B8D5A9DE2C7101E9"><enum>(i)</enum><text>in
			 an electronic format only through a link on the Department of Energy
			 website;</text>
						</clause><clause id="id78B75369B32840E985D1E2296040337B"><enum>(ii)</enum><text>for a period of
			 not less than 21 days and not more than 30 days; and</text>
						</clause><clause id="id4AC18613950C41D8A4ABCD59A5B46B6B"><enum>(iii)</enum><text>to any
			 individual or entity that elects to participate.</text>
						</clause></subparagraph><subparagraph id="idD22B1EC880474731B62B8BB4EAFAD8FB"><enum>(D)</enum><header>Additional
			 information gathering</header><text>Each survey—</text>
						<clause id="id481BD850A09A460BBCC48C9C22482D5B"><enum>(i)</enum><text>shall require
			 each respondent to provide information regarding—</text>
							<subclause id="idAC1ADF258A01469FA5FEC81DC6711DBE"><enum>(I)</enum><text>the age of the
			 respondent;</text>
							</subclause><subclause id="id6399E1E6DF7F451E8184CB6701ED53E9"><enum>(II)</enum><text>the occupational
			 category of the respondent;</text>
							</subclause><subclause id="id373EC24EDC87470288134949D0933EF1"><enum>(III)</enum><text>the period of
			 time during which the respondent has held the current occupation of the
			 respondent; and</text>
							</subclause><subclause id="idEF3D78DFF0944C8099F705B0673C8200"><enum>(IV)</enum><text>the State and
			 country in which the respondent resides; and</text>
							</subclause></clause><clause id="id6C2FFFF330E64EEB9C682347C65DCD2F"><enum>(ii)</enum><text>may request, but
			 shall not require—</text>
							<subclause id="idAD5CE05130034DF4861B00F7CD3A35FB"><enum>(I)</enum><text>the name of the
			 respondent;</text>
							</subclause><subclause id="idE6E77BE0FA5141AF9A5A10482C0D42DC"><enum>(II)</enum><text>an
			 identification of the employer of the respondent;</text>
							</subclause><subclause id="id0B707A6E235D422ABD310FED38FC0A46"><enum>(III)</enum><text>the electronic
			 mail address of the respondent; and</text>
							</subclause><subclause id="idA371E41E99CD41C4B1DE7EE5A6E419ED"><enum>(IV)</enum><text>such other
			 information as the Secretary determines to be appropriate.</text>
							</subclause></clause></subparagraph><subparagraph id="id88CAE97EB54B48709E8FD33031F87C01"><enum>(E)</enum><header>Respondents</header><text>The
			 Secretary shall seek responses to a survey from appropriate representatives
			 of—</text>
						<clause id="idFC1C651376C64C6FB7D617627A699ABE"><enum>(i)</enum><text>the
			 energy, transportation, manufacturing, construction, mining, and electronic
			 industries;</text>
						</clause><clause id="id8830AB0451404B02AEB0FD507561E13C"><enum>(ii)</enum><text>academia;</text>
						</clause><clause id="idB69C2E30F33D496186D2296665E61F04"><enum>(iii)</enum><text>research
			 facilities;</text>
						</clause><clause id="id868A090C2334431384A9F242F84E809C"><enum>(iv)</enum><text>nongovernmental
			 organizations;</text>
						</clause><clause id="idDDD946ED3E854B2E863411FD2CADF613"><enum>(v)</enum><text>the
			 Federal Government; and</text>
						</clause><clause id="id93F49650F406483EA95AB39EEA9DEAE8"><enum>(vi)</enum><text>units of State
			 and local government.</text>
						</clause></subparagraph><subparagraph id="idDB17D4733A934EEE9100E2F355B2D397"><enum>(F)</enum><header>Nonpolitical
			 requirement</header><text>The Secretary shall ensure that each survey is
			 conducted, to the maximum extent practicable—</text>
						<clause id="id9EB7774338F648BF9CF48B30028FEED6"><enum>(i)</enum><text>in
			 a transparent, nonpolitical, and scientific manner; and</text>
						</clause><clause id="id54480C61850E48F7827545B28D732585"><enum>(ii)</enum><text>without any
			 political bias.</text>
						</clause></subparagraph><subparagraph id="idF95FDEC6B6504BCE96E3A1C8E1600D44"><enum>(G)</enum><header>Report</header><text>Not
			 later than 180 days after the date on which a survey under this subsection is
			 no longer available under subparagraph (C)(ii), the Secretary shall submit to
			 Congress and make available to the public (including through publication in the
			 Federal Register and on the website of the Department of Energy) a report
			 that—</text>
						<clause id="id24389A862F804ACD8AE7669ABC4CFB7E"><enum>(i)</enum><text>describes the
			 results of the survey; and</text>
						</clause><clause id="idB38BD01947DD450A8C93CF259431C11E"><enum>(ii)</enum><text>includes a list
			 of the 10 highest-priority energy-related problems based on all responses to
			 the survey.</text>
						</clause></subparagraph></paragraph><paragraph id="id6CADDDDDCFC843B99EB6E18B0D55A260"><enum>(3)</enum><header>Effect of
			 results on energy-related research and development</header>
					<subparagraph id="id22455D1A90EC4018A1564C2331D4E667"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), on receipt of a report under
			 paragraph (2)(G), the Secretary shall ensure that, during the 5-year period
			 beginning on the date of receipt of the report, all energy-related research and
			 development activities of the Department of Energy are carried out for the
			 purpose of resolving, to the maximum extent practicable, the 10 problems
			 included on the list of the report under paragraph (2)(G)(ii).</text>
					</subparagraph><subparagraph id="idB94C57F7016F405FB45206EA7617D9C9"><enum>(B)</enum><header>Additional
			 problems</header><text>In addition to the activities described in subparagraph
			 (A), during the 5-year period beginning on the date of receipt of a report
			 under paragraph (2)(G), the Secretary may carry out, using the same quantity of
			 resources as are allocated to any 1 energy-related problem included on the list
			 of the report under paragraph (2)(G)(ii), energy-related research and
			 development activities for the purpose of resolving, to the maximum extent
			 practicable, 2 additional energy-related problems that—</text>
						<clause id="id42EE43ED461A4B5FB44966E50CF23DF3"><enum>(i)</enum><text>are
			 not included on the list; and</text>
						</clause><clause id="id04B1ED56E6C84FF2B2C286DF4AAEDA82"><enum>(ii)</enum><text>are
			 high-priority energy-related problems, as determined by the Secretary.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idE38E663345B94B94AE8EDB4EE26CC44F"><enum>(d)</enum><header>Energy
			 Technologies Innovation Network</header>
				<paragraph id="id9D90D14E031F447D87BEE0B0B4F63D2A"><enum>(1)</enum><header>Establishment</header><text>There
			 is established an information and collaboration network, to be known as the
			 <quote>Energy Technologies Innovation Network</quote>.</text>
				</paragraph><paragraph id="id65BA871D6F3C4CA1A94CDDE3CEE50F45"><enum>(2)</enum><header>Purpose</header><text>The
			 purpose of the network shall be to provide a forum through which interested
			 parties (including scientists and entrepreneurs) can present, discuss, and
			 collaborate with respect to information and ideas relating to energy
			 technologies.</text>
				</paragraph><paragraph id="idE5216C2F048C444C9D9D4A00BAC5A8E9"><enum>(3)</enum><header>Operation of
			 network</header>
					<subparagraph id="idD02C33B5772D41658DA329515A571042"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall offer to enter into a contract, after
			 an open bidding process, with a third party to operate the network.</text>
					</subparagraph><subparagraph id="idB212A5248AC048499F9CA7EAAB3D2F61"><enum>(B)</enum><header>Requirements</header><text>The
			 third party selected under subparagraph (A) shall—</text>
						<clause id="id28BB29F8F24F4145BC0133E438FD4895"><enum>(i)</enum><text>have experience
			 with respect to the establishment and maintenance of a comprehensive database
			 of Federal research and development projects that is—</text>
							<subclause id="idE085438B62824AB4967D7632D5C06278"><enum>(I)</enum><text>easily
			 searchable;</text>
							</subclause><subclause id="id3478456D852343A08869F96BFA3AE2BC"><enum>(II)</enum><text>open to the
			 public; and</text>
							</subclause><subclause id="id259736338D1D47F6AEC1D70F9A5199EF"><enum>(III)</enum><text>capable of
			 expansion;</text>
							</subclause></clause><clause id="idA385BE6F15584FE6BC30B3776AA933A1"><enum>(ii)</enum><text>provide a secure
			 electronic forum to enable collaboration among users of the network; and</text>
						</clause><clause id="id7B80D50145F64E10AB0F0455EFC234C1"><enum>(iii)</enum><text>collaborate
			 with the Secretary to protect the intellectual property rights of individual
			 users and governmental agencies participating in the network in accordance with
			 paragraph (6).</text>
						</clause></subparagraph></paragraph><paragraph id="idC2DDDC622C074052BD172B0503EAA2E7"><enum>(4)</enum><header>Required
			 contributors</header><text>Each research laboratory or other facility that
			 receives Federal funding shall provide to the network the results of the
			 research conducted using that funding, regardless of whether the research
			 relates to energy, subject to the condition that revelation of the research
			 will not adversely effect national security.</text>
				</paragraph><paragraph id="ID0101775586574d54ace2d798ae3e9e01"><enum>(5)</enum><header>Other
			 contributors</header><text>Other entities, including entities in the academic
			 and industrial sectors and individuals, may participate in the network to
			 actively contribute to resolving—</text>
					<subparagraph id="id708CB3E6F66C411EA57ACE29CC47BBE5"><enum>(A)</enum><text>the
			 energy-related problems included on the list of the report under subsection
			 (c)(2)(G)(ii); or</text>
					</subparagraph><subparagraph id="id492EB53CD75349719C08834D1903F449"><enum>(B)</enum><text>any other
			 energy-related problem that the contributor determines would advance the goals
			 described in subsection (c)(1).</text>
					</subparagraph></paragraph><paragraph id="idBCACBFD72B3D40AC9B1F8CF45A4949AA"><enum>(6)</enum><header>Protection of
			 information and ideas</header><text>In collaborating with a third party in
			 operating the network under paragraph (3), the Secretary shall employ such
			 individuals and entities with experience relating to—</text>
					<subparagraph id="id5B17C30AE7CA4DF2AF247B5E773889BF"><enum>(A)</enum><text>intellectual
			 property as the Secretary determines to be necessary to ensure that—</text>
						<clause id="idD96563DDBFDC43258F40DF6D9AB897E1"><enum>(i)</enum><text>information and
			 ideas presented, and discussed in the network are—</text>
							<subclause id="idE39F17B0F0C94CE7B327DEF2C52A32B8"><enum>(I)</enum><text>monitored with
			 respect to the intellectual property owners and components of the information
			 or ideas; and</text>
							</subclause><subclause id="idF0D7F5BA138D4EDBAFAF6766D7AF56BB"><enum>(II)</enum><text>protected in
			 accordance with applicable Federal intellectual property law (including
			 regulations);</text>
							</subclause></clause><clause id="idDA8DD7AFD99149019E05A916BBAE334E"><enum>(ii)</enum><text>information and
			 ideas developed within the network are—</text>
							<subclause id="ID80d74202988d4bcd858d333b864a01cf"><enum>(I)</enum><text>monitored with
			 respect to the intellectual property components of the developers of the
			 information or ideas; and</text>
							</subclause><subclause id="ID03692e0683fe41cebb0fc6c61fdc5a1a"><enum>(II)</enum><text>protected in
			 accordance with applicable Federal intellectual property law (including
			 regulations); and</text>
							</subclause></clause><clause id="IDe90525d38326487abd940772dc3fe651"><enum>(iii)</enum><text>contributors to
			 the network are provided adequate assurances that intellectual property rights
			 of the contributors will be protected with respect to participation in the
			 network;</text>
						</clause></subparagraph><subparagraph id="ID5fbc6b396f6149a886dee3bee172c6df"><enum>(B)</enum><text>setting up,
			 maintaining, and operating a network that ensures security and
			 reliability.</text>
					</subparagraph></paragraph></subsection><subsection id="idB5F6605EE6B840DE9D9A66FA5C9BF97C"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section.</text>
