			 title</header>
			<subsection id="idCAB6E05AC7B24A1A937CE95B7ED3D4AD"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Defenders of Freedom Tax Relief
			 Act of 2007</short-title></quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="H7BEED08352F642939C1460E9C5B6E5A6"><enum>(b)</enum><header>Amendment of
			 1986 Code</header><text>Except as otherwise expressly provided, whenever in
			 this Act an amendment or repeal is expressed in terms of an amendment to, or
			 repeal of, a section or other provision, the reference shall be considered to
			 be made to a section or other provision of the Internal Revenue Code of
			 1986.</text>
			</subsection><subsection display-inline="no-display-inline" id="id7F9675CCC0F64D8DAB34CDD6ED0B45DF"><enum>(c)</enum><header>Table of

			 claims for refunds relating to disability determinations by Department of
			 Veterans Affairs</header>
			<subsection commented="no" display-inline="no-display-inline" id="idF1401A4457FD4E20977FC85167E25452"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (d) of section 6511 (relating to
			 special rules applicable to income taxes) is amended by adding at the end the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="id16ECF561568B4D48A73FCF5045A05511" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="idA0C5CA872B134098854A9AF130E260BE"><enum>(8)</enum><header display-inline="yes-display-inline">Special rules when uniformed services
				retired pay is reduced as a result of award of disability compensation</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idD649604924E14C98AD603D44BDF1BF82"><enum>(A)</enum><header display-inline="yes-display-inline">Period of limitation on filing
				claim</header><text display-inline="yes-display-inline">If the claim for credit
				or refund relates to an overpayment of tax imposed by subtitle A on account
				of—</text>
							<clause commented="no" display-inline="no-display-inline" id="idD549A9573B364336B8CD2AEA81EF501C"><enum>(i)</enum><text display-inline="yes-display-inline">the reduction of uniformed services retired
				pay computed under section 1406 or 1407 of title 10, United States Code,
				or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id82E07C09FAEF4AFB9B82539E4B302798"><enum>(ii)</enum><text display-inline="yes-display-inline">the waiver of such pay under section 5305
				of title 38 of such Code,</text>
							</clause><continuation-text commented="no" continuation-text-level="subparagraph">as a result of an award of
				compensation under title 38 of such Code pursuant to a determination by the
				Secretary of Veterans Affairs, the 3-year period of limitation prescribed in
				subsection (a) shall be extended, for purposes of permitting a credit or refund
				based upon the amount of such reduction or waiver, until the end of the 1-year
				period beginning on the date of such determination.</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id538787175FF6469988A0517215F1B2E1"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation to 5 taxable years</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply with
				respect to any taxable year which began more than 5 years before the date of
				such
				determination.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4A87909444414500A88D01DF9AE8E1BE"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply to claims for credit or refund filed after the date
			 of the enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD925EF48C7214BF58D7D776158F4786C"><enum>(c)</enum><header display-inline="yes-display-inline">Transition rules</header><text display-inline="yes-display-inline">In the case of a determination described in
			 paragraph (8) of section 6511(d) of the Internal Revenue Code of 1986 (as added
			 by this section) which is made by the Secretary of Veterans Affairs after
			 December 31, 2000, and on or before the date of the enactment of this Act, such
			 paragraph—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idB7414B699E08405986841FB7E531C219"><enum>(1)</enum><text display-inline="yes-display-inline">shall not apply with respect to any taxable
			 year which began before January 1, 2001, and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD69A98E4018542EE8B9CC9DE3663A15C"><enum>(2)</enum><text display-inline="yes-display-inline">shall be applied by substituting <quote>the
			 date of the enactment of the <short-title>Defenders of
			 Freedom Tax Relief Act of 2007</short-title></quote> for <quote>the date of
			 such determination</quote> in subparagraph (A) thereof.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idCE1F80B853AD4FC7B9DEB798A0AE0E86" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Permanent extension of election to treat
			 combat pay as earned income for purposes of earned income credit</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1C60FD1DDE354275B1C825B0D857C899"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Clause (vi) of section 32(c)(2)(B)
			 (defining earned income) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idD34781FE312C444AB1DE883D40C2FC10" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="idCF1EF3548DEF4E48908628CEF568671B"><enum>(vi)</enum><text display-inline="yes-display-inline">a taxpayer may elect to treat amounts
				excluded from gross income by reason of section 112 as earned
				income.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idB6FAA56FB4BF4F9EB30C01403CAE52A4"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to taxable years ending after December 31,
			 2007.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID196DE77B635D4511BD4B95BEFFD5C8C7" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Treatment of differential military pay as
			 wages</header>
			<subsection commented="no" display-inline="no-display-inline" id="id919C3BF3F55B4DBCB9608020173EC340"><enum>(a)</enum><header display-inline="yes-display-inline">Income tax withholding on differential wage
			 payments</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDB04FD1DFA26F4F9C80E346BB29A728A9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 3401 (relating to definitions) is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="ID458EE6D68F624FE5AA8120140072C0B4" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="IDCC99B0F4E50845499A5BD52C433949D7"><enum>(h)</enum><header display-inline="yes-display-inline">Differential wage payments to active duty
				members of the uniformed services</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID2FAB5B6D96924C6BADB8267DCADE99F2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of subsection (a), any
				differential wage payment shall be treated as a payment of wages by the
				employer to the employee.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID332E23E4710D4A16A00AA70B83598F46"><enum>(2)</enum><header display-inline="yes-display-inline">Differential wage payment</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the term
				<term>differential wage payment</term> means any payment which—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDD89EF19B1AE14E2B8E8DC6DF11DCE125"><enum>(A)</enum><text display-inline="yes-display-inline">is made by an employer to an individual
				with respect to any period during which the individual is performing service in
				the uniformed services while on active duty for a period of more than 30 days,
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA0BC29465D4041AA8D139601B0FA1028"><enum>(B)</enum><text display-inline="yes-display-inline">represents all or a portion of the wages
				the individual would have received from the employer if the individual were
				performing service for the
				employer.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDCF4EF8E401C4E65BFF96447EF45FB45"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this subsection shall apply to remuneration paid after December 31,
			 2007.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA5CF5441BEA447E7B6D801BBB909F61E"><enum>(b)</enum><header display-inline="yes-display-inline">Treatment of differential wage payments for
			 retirement plan purposes</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID162C864B83714395B4647DF6C45D1A0B"><enum>(1)</enum><header display-inline="yes-display-inline">Pension plans</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID80C6F488F9A849A4A7D44FFEFCC8968F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 414(u) (relating to special rules
			 relating to veterans’ reemployment rights under USERRA) is amended by adding at
			 the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="IDDA6C1E3702D8488E8D4B678E512E1280" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="ID2C0E86F26D58442EB4758332DBA86A72"><enum>(11)</enum><header display-inline="yes-display-inline">Treatment of differential wage
				payments</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID3FF2884D00614EB1B857A8A403E52E2F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in this paragraph, for
				purposes of applying this title to a retirement plan to which this subsection
				applies—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID788171E4E5B9431B9CBF41D60990703D"><enum>(i)</enum><text display-inline="yes-display-inline">an individual receiving a differential wage
				payment shall be treated as an employee of the employer making the
				payment,</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID71D9E7E40D6B416CA4D19B8AFED56FD4"><enum>(ii)</enum><text display-inline="yes-display-inline">the differential wage payment shall be
				treated as compensation, and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID46E9B8D28AFA43B2AA002E4C5A2CD03E"><enum>(iii)</enum><text display-inline="yes-display-inline">the plan shall not be treated as failing to
				meet the requirements of any provision described in paragraph (1)(C) by reason
				of any contribution or benefit which is based on the differential wage
				payment.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD42CC246B70D4018A0A7BE86882AD9DD"><enum>(B)</enum><header display-inline="yes-display-inline">Special rule for distributions</header>
									<clause commented="no" display-inline="no-display-inline" id="ID0BBE234178A94073A7775968FB209A0B"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A)(i), for
				purposes of section 401(k)(2)(B)(i)(I), 403(b)(7)(A)(ii), 403(b)(11)(A), or
				457(d)(1)(A)(ii), an individual shall be treated as having been severed from
				employment during any period the individual is performing service in the
				uniformed services described in section 3401(h)(2)(A).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDD5CE84B467A946A1A96724817D46F248"><enum>(ii)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">If an individual elects to receive a
				distribution by reason of clause (i), the plan shall provide that the
				individual may not make an elective deferral or employee contribution during
				the 6-month period beginning on the date of the distribution.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID76915A12C0E94D56883E9FF868CEAA86"><enum>(C)</enum><header display-inline="yes-display-inline">Nondiscrimination requirement</header><text display-inline="yes-display-inline">Subparagraph (A)(iii) shall apply only if
				all employees of an employer (as determined under subsections (b), (c), (m),
				and (o)) performing service in the uniformed services described in section
				3401(h)(2)(A) are entitled to receive differential wage payments on reasonably
				equivalent terms and, if eligible to participate in a retirement plan
				maintained by the employer, to make contributions based on the payments on
				reasonably equivalent terms. For purposes of applying this subparagraph, the
				provisions of paragraphs (3), (4), and (5) of section 410(b) shall
				apply.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7CA7CAE4C837486B9A779860AA33A512"><enum>(D)</enum><header display-inline="yes-display-inline">Differential wage payment</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>differential wage payment</term> has the meaning given such term by
				section
				3401(h)(2).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF979485FD15B4CBE911C88BB2AEDD87E"><enum>(B)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The heading for section 414(u) is amended
			 by inserting <quote><header-in-text level="subsection" style="OLC">and to
			 Differential Wage Payments to Members on Active Duty</header-in-text></quote>
			 after <quote><header-in-text level="subsection" style="OLC">USERRA</header-in-text></quote>.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDD8E66A494DA4D0DB9F1F06AD7FEF9AA"><enum>(2)</enum><header display-inline="yes-display-inline">Differential wage payments treated as
			 compensation for individual retirement plans</header><text display-inline="yes-display-inline">Section 219(f)(1) (defining compensation)
			 is amended by adding at the end the following new sentence: <quote>The term
			 <term>compensation</term> includes any differential wage payment (as defined in
			 section 3401(h)(2)).</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01F2C769829B417C9955E2F4F7B6F817"><enum>(3)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall apply to years beginning after December 31, 2007.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8A8580D727E84BB5810FEFF30800AE08"><enum>(c)</enum><header display-inline="yes-display-inline">Provisions relating to plan
			 amendments</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7BA9D419774B40BABF9046BA61C834EF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If this subsection applies to any plan or
			 annuity contract amendment—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5E19E2B9BD594A6EBDB2390A1BAD7E34"><enum>(A)</enum><text display-inline="yes-display-inline">such plan or contract shall be treated as
			 being operated in accordance with the terms of the plan or contract during the
			 period described in paragraph (2)(B)(i), and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5807DF479E3648ED869432E277875EE9"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided by the Secretary of the
			 Treasury, such plan shall not fail to meet the requirements of the Internal
			 Revenue Code of 1986 or the <act-name parsable-cite="ERISA">Employee Retirement
			 Income Security Act of 1974</act-name> by reason of such amendment.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73E020871FEC40779EDE1A47ED396A03"><enum>(2)</enum><header display-inline="yes-display-inline">Amendments to which section
			 applies</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID940976C25FFD40608E3B0F11DDB5CD46"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This subsection shall apply to any
			 amendment to any plan or annuity contract which is made—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID06BB860758214E199F8998432497AF75"><enum>(i)</enum><text display-inline="yes-display-inline">pursuant to any amendment made by this
			 section, and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID52C9A7DB4DA140D2A60C1138C86134C9"><enum>(ii)</enum><text display-inline="yes-display-inline">on or before the last day of the first plan
			 year beginning on or after January 1, 2009.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3A4F11C4E932434D8BED20EB015D9A91"><enum>(B)</enum><header display-inline="yes-display-inline">Conditions</header><text display-inline="yes-display-inline">This subsection shall not apply to any plan
			 or annuity contract amendment unless—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDAFA3329613084AAC8BCB0D20E4B5FA87"><enum>(i)</enum><text display-inline="yes-display-inline">during the period beginning on the date the
			 amendment described in subparagraph (A)(i) takes effect and ending on the date
			 described in subparagraph (A)(ii) (or, if earlier, the date the plan or
			 contract amendment is adopted), the plan or contract is operated as if such
			 plan or contract amendment were in effect, and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID9F8AA12950144DA0B7EBBCAEA393B752"><enum>(ii)</enum><text display-inline="yes-display-inline">such plan or contract amendment applies
			 retroactively for such period.</text>
						</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id48B26074B5394C3F9D4EC89D487F200C"><enum>5.</enum><header>Permanent
			 extension of penalty-free withdrawals from retirement plans by individual
			 called to active duty</header><text display-inline="no-display-inline">Clause
			 (iv) of section 72(t)(2)(G) (relating to distributions from retirement plans to
			 individuals called to active duty) is amended by striking all after
			 <quote>September 11, 2001</quote> and inserting a period.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idB7C98E47B94842BF8E7A9A5814162D78"><enum>6.</enum><header>State payments
			 to service members treated as qualified military benefits</header>

				section 408(d)(3)(B), there shall be disregarded any qualified rollover
				contribution from an individual retirement plan (other than a Roth IRA) to a
				Roth IRA.</text>

				apply</header><text display-inline="yes-display-inline">Section 408(d)(3)(B)
				shall not apply with respect to amounts treated as a rollover by the

				account,</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD4B2BA62F11F4FDC8A5023C3B0E11248"><enum>(B)</enum><text display-inline="yes-display-inline">from an eligible retirement plan, but only
				if—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID742A70FB167D4AB1B2471040E82D4E64"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an individual retirement
				plan, such rollover contribution meets the requirements of section 408(d)(3),
				and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID4C054712847C49E085B5FF1E5F5D9E80"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of any eligible retirement plan
				(as defined in section 402(c)(8)(B) other than clauses (i) and (ii) thereof),
				such rollover contribution meets the requirements of section 402(c), 403(b)(8),
				or 457(e)(16), as applicable.</text>
								</clause></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">For purposes of section 408(d)(3)(B),
				there shall be disregarded any qualified rollover contribution from an
				individual retirement plan (other than a Roth IRA) to a Roth IRA.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id159FD7C1153E476A9E1806D721486FBC"><enum>(2)</enum><header display-inline="yes-display-inline">Military death gratuity</header>

				<paragraph commented="no" display-inline="no-display-inline" id="H0CCF026F01EE429D934450F8D71CF009"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided by paragraphs (2) and
			 (3), the amendments made by this section shall apply with respect to deaths
			 from injuries occurring on or after the date of the enactment of this
			 Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7A3C8847C2C54611AFCC8FC6DB07B081"><enum>(2)</enum><header display-inline="yes-display-inline">Application of amendments to deaths from
			 injuries occurring on or after October 7, 2001, and before
			 enactment</header><text display-inline="yes-display-inline">The amendments made
			 by this section shall apply to any contribution made pursuant to section
			 408A(e)(2) of the Internal Revenue Code of 1986, as amended by this Act, with
			 respect to amounts received under section 1477 of title 10, United States Code,
			 or under section 1967 of title 38 of such Code, for deaths from injuries
			 occurring on or after October 7, 2001, and before the date of the enactment of
			 this Act if such contribution is made not later than 1 year after the date of
			 the enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14B053A4FA034BC7B77A55D1734CA55B"><enum>(3)</enum><header display-inline="yes-display-inline">Pension Protection Act
			 changes</header><text display-inline="yes-display-inline">Section 408A(e)(1) of
			 the Internal Revenue Code of 1986 (as in effect after the amendments made by
			 subsection (b)) shall apply to taxable years beginning after December 31,
			 2007.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID0862E5EF09094B1AA4582B48FECA5D3D" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Credit for employer differential wage
			 payments to employees who are active duty members of the uniformed
			 services</header>
			<subsection id="H87D43C561BCA49839FB78DF4ADCA8302"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1
			 (relating to business credits) is amended by adding at the end the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="IDE617878D72F84A3B89F61346F871FCF2" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="IDC8F27BA508FF446C98EDE93759FFB83E" section-type="subsequent-section"><enum>45O.</enum><header display-inline="yes-display-inline">Employer wage credit for employees who are
				active duty members of the uniformed services</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID1A2FCF38CE064B83A298BEE07BDD65D0"><enum>(a)</enum><header display-inline="yes-display-inline">General rule</header><text display-inline="yes-display-inline">For purposes of section 38, in the case of
				an eligible small business employer, the differential wage payment credit for
				any taxable year is an amount equal to 20 percent of the sum of the eligible
				differential wage payments for each of the qualified employees of the taxpayer
				during such taxable year.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id8F1E4342C1224DDCAA2C2A7C47C170CA"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idB9B3CEA5ACF24CE0B1A1010E0EE4A86A"><enum>(1)</enum><header>Eligible
				differential wage payments</header><text>The term <term>eligible differential
				wage payments</term> means, with respect to each qualified employee, so much of
				the differential wage payments (as defined in section 3401(h)(2)) paid to such
				employee for the taxable year as does not exceed $20,000.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4CD7D0F4BB0A4901812D5410FDE18CCE"><enum>(2)</enum><header display-inline="yes-display-inline">Qualified employee</header><text display-inline="yes-display-inline">The term <term>qualified employee</term>
				means a person who has been an employee of the taxpayer for the 91-day period
				immediately preceding the period for which any differential wage payment is
				made.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID31F9F3B90D6C447BA2D62713501E4AAB"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible small business employer</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID9D1035B9C95444E9A1FB6F0584617E4C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>eligible small business
				employer</term> means, with respect to any taxable year, any employer
				which—</text>
									<clause commented="no" display-inline="no-display-inline" id="idA9E5DA2B6C6344108A959BDAB3BA8931"><enum>(i)</enum><text display-inline="yes-display-inline">employed an average of less that 50
				employees on business days during such taxable year, and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id81CEA15C2E864C988F076F7FB06A35B5"><enum>(ii)</enum><text display-inline="yes-display-inline">under a written plan of the employer,
				provides eligible differential wage payments to every qualified employee of the
				employer.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID12CAA87A1C9646CEA2AF4D4B34E7C485"><enum>(B)</enum><header display-inline="yes-display-inline">Controlled groups</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), all
				persons treated as a single employer under subsection (b), (c), (m), or (o) of
				section 414 shall be treated as a single employer.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID64EEC2F50AC5423CAEF00068C80976EC"><enum>(c)</enum><header display-inline="yes-display-inline">Coordination with other
				credits</header><text display-inline="yes-display-inline">The amount of credit
				otherwise allowable under this chapter with respect to compensation paid to any
				employee shall be reduced by the credit determined under this section with
				respect to such employee.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7BEC0B3850774A13B59C59AE0F6300AD"><enum>(d)</enum><header display-inline="yes-display-inline">Disallowance for failure To comply with
				employment or reemployment rights of members of the reserve components of the
				Armed Forces of the United States</header><text display-inline="yes-display-inline">No credit shall be allowed under subsection
				(a) to a taxpayer for—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID3B9A697284EC4931944C74F52F40D180"><enum>(1)</enum><text display-inline="yes-display-inline">any taxable year, beginning after the date
				of the enactment of this section, in which the taxpayer is under a final order,
				judgment, or other process issued or required by a district court of the United
				States under section 4323 of title 38 of the United States Code with respect to
				a violation of chapter 43 of such title, and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9C470CC1FEDA464DB8DA9F112BA61FAE"><enum>(2)</enum><text display-inline="yes-display-inline">the 2 succeeding taxable years.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC4C2162DE3E8482FB409A8D4C43D3BF8"><enum>(e)</enum><header display-inline="yes-display-inline">Certain rules to apply</header><text display-inline="yes-display-inline">For purposes of this section, rules similar
				to the rules of subsections (c), (d), and (e) of section 52 shall apply.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idA6BAEB3F6E064D28B9639C4299E9E1F6"><enum>(f)</enum><header>Termination</header><text>This
				section shall not apply to any payments made after December 31,
				2009.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H90F013324FAD48A996EF9E00C41C00DB"><enum>(b)</enum><header>Credit treated
			 as part of general business credit</header><text>Section 38(b) (relating to
			 general business credit) is amended by striking <quote>plus</quote> at the end
			 of paragraph (30), by striking the period at the end of paragraph (31) and
			 inserting <quote>, plus</quote>, and by adding at the end of following new
			 paragraph:</text>

			 rules on expatriation of individuals</header>
			<subsection id="ID95C2D27D3ACA4E2F8FD9ABAD15F9593B"><enum>(a)</enum><header>In
			 General</header><text>Subpart A of part II of subchapter N of chapter 1 is
			 amended by inserting after section 877 the following new section:</text>

					<section id="IDD77C697E505646C0BED46487749ACA98"><enum>877A.</enum><header>Tax
				responsibilities of expatriation</header>
						<subsection id="ID69C7CAAC7E384140A88C96D6CCBCA8CB"><enum>(a)</enum><header>General
				Rules</header><text>For purposes of this subtitle—</text>
							<paragraph id="ID1D1EE81E80764DD2A7A7D900177B192D"><enum>(1)</enum><header>Mark to
				market</header><text>Except as provided in subsections (d) and (f), all
				property of a covered expatriate to whom this section applies shall be treated
				as sold on the day before the expatriation date for its fair market
				value.</text>
							</paragraph><paragraph id="IDE96A3C5B274B4C86AC764B769E167A45"><enum>(2)</enum><header>Recognition of
				gain or loss</header><text>In the case of any sale under paragraph (1)—</text>
								<subparagraph id="IDB76B9FE0BA5C40718D41E908362A4C39"><enum>(A)</enum><text>notwithstanding
				any other provision of this title, any gain arising from such sale shall be
				taken into account for the taxable year of the sale, and</text>
								</subparagraph><subparagraph id="ID7052ACA8E6904B048F20825EF36EAA95"><enum>(B)</enum><text>any loss arising
				from such sale shall be taken into account for the taxable year of the sale to
				the extent otherwise provided by this title, except that section 1091 shall not
				apply to any such loss.</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">Proper
				adjustment shall be made in the amount of any gain or loss subsequently
				realized for gain or loss taken into account under the preceding
				sentence.</continuation-text></paragraph><paragraph id="ID750CAF20352C40C1B9B08E208061C26E"><enum>(3)</enum><header>Exclusion for
				certain gain</header>
								<subparagraph id="ID74F0D93909D54EF6A272C8A96B7890AD"><enum>(A)</enum><header>In
				general</header><text>The amount which, but for this paragraph, would be
				includible in the gross income of any individual by reason of this section
				shall be reduced (but not below zero) by $600,000. For purposes of this
				paragraph, allocable expatriation gain taken into account under subsection
				(f)(2) shall be treated in the same manner as an amount required to be
				includible in gross income.</text>
								</subparagraph><subparagraph id="ID0F2CF0AA736F464AAE265BC76BDC4189"><enum>(B)</enum><header>Cost-of-living
				adjustment</header>
									<clause id="ID00C3912A480842AC9DE80E72B53C0C75"><enum>(i)</enum><header>In
				general</header><text>In the case of an expatriation date occurring in any
				calendar year after 2007, the $600,000 amount under subparagraph (A) shall be
				increased by an amount equal to—</text>
										<subclause id="IDC0A8D45575D5469CB0524F264FE16A48"><enum>(I)</enum><text>such dollar
				amount, multiplied by</text>
										</subclause><subclause id="ID8D4075AB85604A89A133BA6CFA99373C"><enum>(II)</enum><text>the
				cost-of-living adjustment determined under section 1(f)(3) for such calendar
				year, determined by substituting <quote>calendar year 2006</quote> for
				<quote>calendar year 1992</quote> in subparagraph (B) thereof.</text>
										</subclause></clause><clause id="IDF94E7F49FB0A4D69BB51444778A021DA"><enum>(ii)</enum><header>Rounding
				rules</header><text>If any amount after adjustment under clause (i) is not a
				multiple of $1,000, such amount shall be rounded to the next lower multiple of
				$1,000.</text>
									</clause></subparagraph></paragraph><paragraph id="IDFAB92860269844E29FD61E6142C19B50"><enum>(4)</enum><header>Election to
				continue to be taxed as united states citizen</header>
								<subparagraph id="ID819FFE49EB8048B79D2E0CD47E929216"><enum>(A)</enum><header>In
				general</header><text>If a covered expatriate elects the application of this
				paragraph—</text>
									<clause id="IDF09E17DB050344A68728C0E690191ED4"><enum>(i)</enum><text>this section
				(other than this paragraph and subsection (i)) shall not apply to the
				expatriate, but</text>
									</clause><clause id="ID39E7E800B74C46B0994ADDC832071576"><enum>(ii)</enum><text>in the case of
				property to which this section would apply but for such election, the
				expatriate shall be subject to tax under this title in the same manner as if
				the individual were a United States citizen.</text>
									</clause></subparagraph><subparagraph id="IDB8F4FBE72ADB4974A4DD5452C8F2109C"><enum>(B)</enum><header>Requirements</header><text>Subparagraph
				(A) shall not apply to an individual unless the individual—</text>
									<clause id="ID06FC9D093C7242519F2C83EB64D16FAA"><enum>(i)</enum><text>provides security
				for payment of tax in such form and manner, and in such amount, as the
				Secretary may require,</text>
									</clause><clause id="ID70E27F93DF07469996F37D63C743F1F2"><enum>(ii)</enum><text>consents to the
				waiver of any right of the individual under any treaty of the United States
				which would preclude assessment or collection of any tax which may be imposed
				by reason of this paragraph, and</text>
									</clause><clause id="ID57DB8F4990C249B295F038418B9A2AA8"><enum>(iii)</enum><text>complies with
				such other requirements as the Secretary may prescribe.</text>
									</clause></subparagraph><subparagraph id="IDEDEE995E21FF45328369B3968E2B1982"><enum>(C)</enum><header>Election</header><text>An
				election under subparagraph (A) shall apply to all property to which this
				section would apply but for the election and, once made, shall be irrevocable.
				Such election shall also apply to property the basis of which is determined in
				whole or in part by reference to the property with respect to which the
				election was made.</text>
								</subparagraph></paragraph></subsection><subsection id="ID52F9325B0B1D4E8B9F88BD269925BFA2"><enum>(b)</enum><header>Election To
				Defer Tax</header>
							<paragraph id="ID035316F705DB488E860F7338865DE669"><enum>(1)</enum><header>In
				general</header><text>If the taxpayer elects the application of this subsection
				with respect to any property treated as sold by reason of subsection (a), the
				payment of the additional tax attributable to such property shall be postponed
				until the due date of the return for the taxable year in which such property is
				disposed of (or, in the case of property disposed of in a transaction in which
				gain is not recognized in whole or in part, until such other date as the
				Secretary may prescribe).</text>
							</paragraph><paragraph id="ID8443B0BD5FC84A31B757B68D1EFE63C8"><enum>(2)</enum><header>Determination
				of tax with respect to property</header><text>For purposes of paragraph (1),
				the additional tax attributable to any property is an amount which bears the
				same ratio to the additional tax imposed by this chapter for the taxable year
				solely by reason of subsection (a) as the gain taken into account under
				subsection (a) with respect to such property bears to the total gain taken into
				account under subsection (a) with respect to all property to which subsection
				(a) applies.</text>
							</paragraph><paragraph id="ID85102A914747438796E570DDE3B7A5C8"><enum>(3)</enum><header>Termination of
				postponement</header><text>No tax may be postponed under this subsection later
				than the due date for the return of tax imposed by this chapter for the taxable
				year which includes the date of death of the expatriate (or, if earlier, the
				time that the security provided with respect to the property fails to meet the
				requirements of paragraph (4), unless the taxpayer corrects such failure within
				the time specified by the Secretary).</text>
							</paragraph><paragraph id="ID361EA6FEB0C6459AB24E8E03CC6DE6E7"><enum>(4)</enum><header>Security</header>
								<subparagraph id="ID91592F143BCC4776B71DF6CD753C581D"><enum>(A)</enum><header>In
				general</header><text>No election may be made under paragraph (1) with respect
				to any property unless adequate security is provided to the Secretary with
				respect to such property.</text>
								</subparagraph><subparagraph id="ID1A78BB5023C941038EF0F58E96F4F166"><enum>(B)</enum><header>Adequate
				security</header><text>For purposes of subparagraph (A), security with respect
				to any property shall be treated as adequate security if—</text>
									<clause id="IDFC6A332439B949A2BF6FD2EF0ECE69B6"><enum>(i)</enum><text>it is a bond in
				an amount equal to the deferred tax amount under paragraph (2) for the
				property, or</text>
									</clause><clause id="ID0D25C72064BA47F6BE05B7B15991974F"><enum>(ii)</enum><text>the taxpayer
				otherwise establishes to the satisfaction of the Secretary that the security is
				adequate.</text>
									</clause></subparagraph></paragraph><paragraph id="ID4E6E545AE4CC4DEF8544D62101EDBFBD"><enum>(5)</enum><header>Waiver of
				certain rights</header><text>No election may be made under paragraph (1) unless
				the taxpayer consents to the waiver of any right under any treaty of the United
				States which would preclude assessment or collection of any tax imposed by
				reason of this section.</text>
							</paragraph><paragraph id="IDA33FB266C18746378A0068C20053B1F9"><enum>(6)</enum><header>Elections</header><text>An
				election under paragraph (1) shall only apply to property described in the
				election and, once made, is irrevocable. An election may be made under
				paragraph (1) with respect to an interest in a trust with respect to which gain
				is required to be recognized under subsection (f)(1).</text>
							</paragraph><paragraph id="IDCC3A13BE525D4DFB851713A25F7FE625"><enum>(7)</enum><header>Interest</header><text>For
				purposes of section 6601—</text>
								<subparagraph id="IDACA92017FBF948ACAA870776C1C81231"><enum>(A)</enum><text>the last date for
				the payment of tax shall be determined without regard to the election under
				this subsection, and</text>
								</subparagraph><subparagraph id="ID9CBB7F85B58F431B94879EBE910AEBFE"><enum>(B)</enum><text>section
				6621(a)(2) shall be applied by substituting <quote>5 percentage points</quote>
				for <quote>3 percentage points</quote> in subparagraph (B) thereof.</text>
								</subparagraph></paragraph></subsection><subsection id="IDFC52A9D8B7AB494AA051F856221391B5"><enum>(c)</enum><header>Covered
				Expatriate</header><text>For purposes of this section—</text>
							<paragraph id="IDC379263D5E4A4B0B9DBB75CFD89D1186"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the term
				<term>covered expatriate</term> means an expatriate.</text>
							</paragraph><paragraph id="IDC19D4C73E19A409DBE985872E979ECAB"><enum>(2)</enum><header>Exceptions</header><text>An
				individual shall not be treated as a covered expatriate if—</text>
								<subparagraph id="ID907D52876A7B485BA9A98AE973217B66"><enum>(A)</enum><text>the
				individual—</text>
									<clause id="ID54023C44301F4F8A95A4F696F574BC26"><enum>(i)</enum><text>became at birth a
				citizen of the United States and a citizen of another country and, as of the
				expatriation date, continues to be a citizen of, and is taxed as a resident of,
				such other country, and</text>
									</clause><clause id="ID5FBE95476E9D4EE29AEC24EE28AE9BE7"><enum>(ii)</enum><text>has not been a
				resident of the United States (as defined in section 7701(b)(1)(A)(ii)) during
				the 5 taxable years ending with the taxable year during which the expatriation
				date occurs, or</text>
									</clause></subparagraph><subparagraph id="ID07946A38713A4845B013C23E05537444"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="IDB917540116B84A7B85DFFF3F62021389"><enum>(i)</enum><text>the individual’s
				relinquishment of United States citizenship occurs before such individual
				attains age 18<fraction>1/2</fraction>, and</text>
									</clause><clause id="IDD96E3C96D3E3485AA3A738F0344AD81F" indent="up1"><enum>(ii)</enum><text>the individual has been a resident
				of the United States (as so defined) for not more than 5 taxable years before
				the date of relinquishment.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="IDBB2331E4495C4164966B60F15A3BE202"><enum>(d)</enum><header>Exempt
				Property; Special Rules for Pension Plans</header>
							<paragraph id="ID509F0850702B45859FEC87489CFA1282"><enum>(1)</enum><header>Exempt
				property</header><text>This section shall not apply to the following:</text>
								<subparagraph id="ID2113FA862C244F87B7D6982E53A13593"><enum>(A)</enum><header>United states
				real property interests</header><text>Any United States real property interest
				(as defined in section 897(c)(1)), other than stock of a United States real
				property holding corporation which does not, on the day before the expatriation
				date, meet the requirements of section 897(c)(2).</text>
								</subparagraph><subparagraph id="IDE28840F9CF344FD6B1F72F5934E69FE9"><enum>(B)</enum><header>Specified
				property</header><text>Any property or interest in property not described in
				subparagraph (A) which the Secretary specifies in regulations.</text>
								</subparagraph></paragraph><paragraph id="ID212283B9D97E4D4598798375859B8513"><enum>(2)</enum><header>Special rules
				for certain retirement plans</header>
								<subparagraph id="ID502FA61CDCEF4270B44FC50DB3BF7142"><enum>(A)</enum><header>In
				general</header><text>If a covered expatriate holds on the day before the
				expatriation date any interest in a retirement plan to which this paragraph
				applies—</text>
									<clause id="IDB3679D33333A4FD0BE63D5FA8C1066F0"><enum>(i)</enum><text>such interest
				shall not be treated as sold for purposes of subsection (a)(1), but</text>
									</clause><clause id="IDF004F36BBFA346D395EF755D14CCA835"><enum>(ii)</enum><text>an amount equal
				to the present value of the expatriate’s nonforfeitable accrued benefit shall
				be treated as having been received by such individual on such date as a
				distribution under the plan.</text>
									</clause></subparagraph><subparagraph id="IDD34EF28E1DDC490CB69A41FD0805536E"><enum>(B)</enum><header>Treatment of
				subsequent distributions</header><text>In the case of any distribution on or
				after the expatriation date to or on behalf of the covered expatriate from a
				plan from which the expatriate was treated as receiving a distribution under
				subparagraph (A), the amount otherwise includible in gross income by reason of
				the subsequent distribution shall be reduced by the excess of the amount
				includible in gross income under subparagraph (A) over any portion of such
				amount to which this subparagraph previously applied.</text>
								</subparagraph><subparagraph id="IDAA80783A1A63498B9BA3453EC28D618B"><enum>(C)</enum><header>Treatment of
				subsequent distributions by plan</header><text>For purposes of this title, a
				retirement plan to which this paragraph applies, and any person acting on the
				plan’s behalf, shall treat any subsequent distribution described in
				subparagraph (B) in the same manner as such distribution would be treated
				without regard to this paragraph.</text>
								</subparagraph><subparagraph id="ID3F3D581D61F540D7A35B60DC9909A3F8"><enum>(D)</enum><header>Applicable
				plans</header><text>This paragraph shall apply to—</text>
									<clause id="IDE18BF04A2A6442E4A1A3B60572897F49"><enum>(i)</enum><text>any qualified
				retirement plan (as defined in section 4974(c)),</text>
									</clause><clause id="ID168023A5D71944549A3DB2974B453064"><enum>(ii)</enum><text>an eligible
				deferred compensation plan (as defined in section 457(b)) of an eligible
				employer described in section 457(e)(1)(A), and</text>
									</clause><clause id="ID1D32C7679FF34CE88B35FC7670E984F6"><enum>(iii)</enum><text>to the extent
				provided in regulations, any foreign pension plan or similar retirement
				arrangements or programs.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID81C2AACA9F4E4491B1B0922FF040A993"><enum>(e)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="ID87780C7CFE204B838434242C3E2EBB89"><enum>(1)</enum><header>Expatriate</header><text>The
				term <term>expatriate</term> means—</text>
								<subparagraph id="ID3C0DD6E2EFA74A819FDD18F71202F751"><enum>(A)</enum><text>any United States
				citizen who relinquishes citizenship, and</text>
								</subparagraph><subparagraph id="ID3EAB4A13123E4047ADF6E63DEF43BA81"><enum>(B)</enum><text>any long-term
				resident of the United States who—</text>
									<clause id="ID1CF61AC75B8644828FE21EE96C415AAD"><enum>(i)</enum><text>ceases to be a
				lawful permanent resident of the United States (within the meaning of section
				7701(b)(6)), or</text>
									</clause><clause id="ID48A4AD15D82E4767981C9C750C8FA9B6"><enum>(ii)</enum><text>commences to be
				treated as a resident of a foreign country under the provisions of a tax treaty
				between the United States and the foreign country and who does not waive the
				benefits of such treaty applicable to residents of the foreign country.</text>
									</clause></subparagraph></paragraph><paragraph id="ID961E7542808347DFA6625A8163675B22"><enum>(2)</enum><header>Expatriation
				date</header><text>The term <term>expatriation date</term> means—</text>
								<subparagraph id="IDFE93A73DB46D4C6AAC8AE8DEDA2D520F"><enum>(A)</enum><text>the date an
				individual relinquishes United States citizenship, or</text>
								</subparagraph><subparagraph id="IDF61D07D99EA44601A84F10D51E786A76"><enum>(B)</enum><text>in the case of a
				long-term resident of the United States, the date of the event described in
				clause (i) or (ii) of paragraph (1)(B).</text>
								</subparagraph></paragraph><paragraph id="ID69927595A79742F9AE732CEE2325C355"><enum>(3)</enum><header>Relinquishment
				of citizenship</header><text>A citizen shall be treated as relinquishing United
				States citizenship on the earliest of—</text>
								<subparagraph id="ID10B44AC05C8548A5962C0EE9B1BE5E7B"><enum>(A)</enum><text>the date the
				individual renounces such individual’s United States nationality before a
				diplomatic or consular officer of the United States pursuant to paragraph (5)
				of section 349(a) of the <act-name parsable-cite="INA">Immigration and
				Nationality Act</act-name> (8 U.S.C. 1481(a)(5)),</text>
								</subparagraph><subparagraph id="IDEF1AAC7FA904443EB0FF4BC5F31A5E72"><enum>(B)</enum><text>the date the
				individual furnishes to the United States Department of State a signed
				statement of voluntary relinquishment of United States nationality confirming
				the performance of an act of expatriation specified in paragraph (1), (2), (3),
				or (4) of section 349(a) of the <act-name parsable-cite="INA">Immigration and
				Nationality Act</act-name> (8 U.S.C. 1481(a)(1)–(4)),</text>
								</subparagraph><subparagraph id="ID38CB2A5AD91A4BD4BD3B7F9352FF289E"><enum>(C)</enum><text>the date the
				United States Department of State issues to the individual a certificate of
				loss of nationality, or</text>
								</subparagraph><subparagraph id="IDF48D8F7153AE4924A495AE280ED0960D"><enum>(D)</enum><text>the date a court
				of the United States cancels a naturalized citizen’s certificate of
				naturalization.</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">Subparagraph (A) or (B) shall not
				apply to any individual unless the renunciation or voluntary relinquishment is
				subsequently approved by the issuance to the individual of a certificate of
				loss of nationality by the United States Department of State.</continuation-text></paragraph><paragraph id="ID6490969DFD4C4FE18B8B7C67547156D3"><enum>(4)</enum><header>Long-term
				resident</header><text>The term <term>long-term resident</term> has the meaning
				given to such term by section 877(e)(2).</text>
							</paragraph></subsection><subsection id="IDA1412210FFFE43E2BA367A2A32869E89"><enum>(f)</enum><header>Special Rules
				Applicable to Beneficiaries’ Interests in Trust</header>
							<paragraph id="ID6F46C113BA0D480285FB36BF95C2739D"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), if an individual is
				determined under paragraph (3) to hold an interest in a trust on the day before
				the expatriation date—</text>
								<subparagraph id="ID5E3DBC5607F24F3EA377F89F509F5AC2"><enum>(A)</enum><text>the individual
				shall not be treated as having sold such interest,</text>
								</subparagraph><subparagraph id="ID5E0582A2E01543ACA105C45B1CCE565C"><enum>(B)</enum><text>such interest
				shall be treated as a separate share in the trust, and</text>
								</subparagraph><subparagraph id="IDD2D2AD5AF7574251B51BA6478E55C743"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="ID1C5288169A99426E917CF55086BB20D6"><enum>(i)</enum><text>such separate share
				shall be treated as a separate trust consisting of the assets allocable to such
				share,</text>
									</clause><clause id="IDF5EB1B838F3C41798D92814369BA247B" indent="up1"><enum>(ii)</enum><text>the separate trust shall be
				treated as having sold its assets on the day before the expatriation date for
				their fair market value and as having distributed all of its assets to the
				individual as of such time, and</text>
									</clause><clause id="ID62D076A105B143FE9382D022A40280ED" indent="up1"><enum>(iii)</enum><text>the individual shall be treated
				as having recontributed the assets to the separate trust.</text>
									</clause></subparagraph><continuation-text continuation-text-level="paragraph">Subsection
				(a)(2) shall apply to any income, gain, or loss of the individual arising from
				a distribution described in subparagraph (C)(ii). In determining the amount of
				such distribution, proper adjustments shall be made for liabilities of the
				trust allocable to an individual’s share in the trust.</continuation-text></paragraph><paragraph id="IDA65EE25420BF430F932130A4CA80900A"><enum>(2)</enum><header>Special rules
				for interests in qualified trusts</header>
								<subparagraph id="ID54FA6EE232EF446293B357758E718D9E"><enum>(A)</enum><header>In
				general</header><text>If the trust interest described in paragraph (1) is an
				interest in a qualified trust—</text>
									<clause id="ID9F8B34E2C08F4FF791025764D9BC1438"><enum>(i)</enum><text>paragraph (1) and
				subsection (a) shall not apply, and</text>
									</clause><clause id="ID9A52871C6F4C4C1AB25F56DF19FE4423"><enum>(ii)</enum><text>in addition to
				any other tax imposed by this title, there is hereby imposed on each
				distribution with respect to such interest a tax in the amount determined under
				subparagraph (B).</text>
									</clause></subparagraph><subparagraph id="IDAEF6C92B28DF4D50BB535C6A96B18AFF"><enum>(B)</enum><header>Amount of
				tax</header><text>The amount of tax under subparagraph (A)(ii) shall be equal
				to the lesser of—</text>
									<clause id="ID960AAE4F917F4F94B751E9CB3BB79B6C"><enum>(i)</enum><text>the highest rate
				of tax imposed by section 1(e) for the taxable year which includes the day
				before the expatriation date, multiplied by the amount of the distribution,
				or</text>
									</clause><clause id="ID1EB7BB33DAB14D3E90BDA2384652BB1F"><enum>(ii)</enum><text>the balance in
				the deferred tax account immediately before the distribution determined without
				regard to any increases under subparagraph (C)(ii) after the 30th day preceding
				the distribution.</text>
									</clause></subparagraph><subparagraph id="IDF80C2FC8460C48ACA8CF0A74521EAE4D"><enum>(C)</enum><header>Deferred tax
				account</header><text>For purposes of subparagraph (B)(ii)—</text>
									<clause id="ID0593887290C643379D5F2DE3C2A2AE59"><enum>(i)</enum><header>Opening
				balance</header><text>The opening balance in a deferred tax account with
				respect to any trust interest is an amount equal to the tax which would have
				been imposed on the allocable expatriation gain with respect to the trust
				interest if such gain had been included in gross income under subsection
				(a).</text>
									</clause><clause id="ID94D8858FF0684553B075F3818B25C61C"><enum>(ii)</enum><header>Increase for
				interest</header><text>The balance in the deferred tax account shall be
				increased by the amount of interest determined (on the balance in the account
				at the time the interest accrues), for periods after the 90th day after the
				expatriation date, by using the rates and method applicable under section 6621
				for underpayments of tax for such periods, except that section 6621(a)(2) shall
				be applied by substituting <quote>5 percentage points</quote> for <quote>3
				percentage points</quote> in subparagraph (B) thereof.</text>
									</clause><clause id="ID829D56FFA44B49F5B297BE4EC61FD64F"><enum>(iii)</enum><header>Decrease for
				taxes previously paid</header><text>The balance in the tax deferred account
				shall be reduced—</text>
										<subclause id="ID4EA51FDE0D824C68934B00FB408AC964"><enum>(I)</enum><text>by the amount of
				taxes imposed by subparagraph (A) on any distribution to the person holding the
				trust interest, and</text>
										</subclause><subclause id="IDDE0F1282813C4B19974986EA81B14820"><enum>(II)</enum><text>in the case of a
				person holding a nonvested interest, to the extent provided in regulations, by
				the amount of taxes imposed by subparagraph (A) on distributions from the trust
				with respect to nonvested interests not held by such person.</text>
										</subclause></clause></subparagraph><subparagraph id="IDCE132F3797F44E21B4DA19843A994699"><enum>(D)</enum><header>Allocable
				expatriation gain</header><text>For purposes of this paragraph, the allocable
				expatriation gain with respect to any beneficiary’s interest in a trust is the
				amount of gain which would be allocable to such beneficiary’s vested and
				nonvested interests in the trust if the beneficiary held directly all assets
				allocable to such interests.</text>
								</subparagraph><subparagraph id="ID6ACE2468693A4EBB985DA2903499A25A"><enum>(E)</enum><header>Tax deducted
				and withheld</header>
									<clause id="IDF78A0873AE894B1DA02BEC050DE0B84A"><enum>(i)</enum><header>In
				general</header><text>The tax imposed by subparagraph (A)(ii) shall be deducted
				and withheld by the trustees from the distribution to which it relates.</text>
									</clause><clause id="ID5025AEA2F3414850AC0CC2D051DA0EFF"><enum>(ii)</enum><header>Exception
				where failure to waive treaty rights</header><text>If an amount may not be
				deducted and withheld under clause (i) by reason of the distributee failing to
				waive any treaty right with respect to such distribution—</text>
										<subclause id="ID78023ADDF7F34776A7C5AC6C9C4C8A75"><enum>(I)</enum><text>the tax imposed
				by subparagraph (A)(ii) shall be imposed on the trust and each trustee shall be
				personally liable for the amount of such tax, and</text>
										</subclause><subclause id="ID5DD5BB4B094743F386E2FCA083918CE1"><enum>(II)</enum><text>any other
				beneficiary of the trust shall be entitled to recover from the distributee the
				amount of such tax imposed on the other beneficiary.</text>
										</subclause></clause></subparagraph><subparagraph id="IDCE1A4CA4243642458A5C85AB13DC9860"><enum>(F)</enum><header>Disposition</header><text>If
				a trust ceases to be a qualified trust at any time, a covered expatriate
				disposes of an interest in a qualified trust, or a covered expatriate holding
				an interest in a qualified trust dies, then, in lieu of the tax imposed by
				subparagraph (A)(ii), there is hereby imposed a tax equal to the lesser
				of—</text>
									<clause id="ID5588090039744539A2A56DA317640CFF"><enum>(i)</enum><text>the tax
				determined under paragraph (1) as if the day before the expatriation date were
				the date of such cessation, disposition, or death, whichever is applicable,
				or</text>
									</clause><clause id="ID7924ECBBCABD42CB8915D706CDA477B4"><enum>(ii)</enum><text>the balance in
				the tax deferred account immediately before such date.</text>
									</clause><continuation-text continuation-text-level="subparagraph">Such
				tax shall be imposed on the trust and each trustee shall be personally liable
				for the amount of such tax and any other beneficiary of the trust shall be
				entitled to recover from the covered expatriate or the estate the amount of
				such tax imposed on the other beneficiary.</continuation-text></subparagraph><subparagraph id="IDA034ED7376194E499F730CFEC78D00E0"><enum>(G)</enum><header>Definitions and
				special rules</header><text>For purposes of this paragraph—</text>
									<clause id="ID4F91EC92ABB346DB965740C0BD97CE76"><enum>(i)</enum><header>Qualified
				trust</header><text>The term <term>qualified trust</term> means a trust which
				is described in section 7701(a)(30)(E).</text>
									</clause><clause id="IDE71D5D209B9C495FB27FB21FBBB33F44"><enum>(ii)</enum><header>Vested
				interest</header><text>The term <term>vested interest</term> means any interest
				which, as of the day before the expatriation date, is vested in the
				beneficiary.</text>
									</clause><clause id="IDFFB0BC5855DF45A18B6263E13CBEED49"><enum>(iii)</enum><header>Nonvested
				interest</header><text>The term <term>nonvested interest</term> means, with
				respect to any beneficiary, any interest in a trust which is not a vested
				interest. Such interest shall be determined by assuming the maximum exercise of
				discretion in favor of the beneficiary and the occurrence of all contingencies
				in favor of the beneficiary.</text>
									</clause><clause id="ID11459D775C0D43B6A2C26C1FC0D0F6F5"><enum>(iv)</enum><header>Adjustments</header><text>The
				Secretary may provide for such adjustments to the bases of assets in a trust or
				a deferred tax account, and the timing of such adjustments, in order to ensure
				that gain is taxed only once.</text>
									</clause><clause id="ID427D427982134A359D6441589193DCAA"><enum>(v)</enum><header>Coordination
				with retirement plan rules</header><text>This subsection shall not apply to an
				interest in a trust which is part of a retirement plan to which subsection
				(d)(2) applies.</text>
									</clause></subparagraph></paragraph><paragraph id="ID362D68A6E7934205922CF8F3A75F3E1B"><enum>(3)</enum><header>Determination
				of beneficiaries’ interest in trust</header>
								<subparagraph id="IDAF38C839CEC04E5791AB60D560041F5A"><enum>(A)</enum><header>Determinations
				under paragraph <enum-in-header>(1)</enum-in-header></header><text>For purposes
				of paragraph (1), a beneficiary’s interest in a trust shall be based upon all
				relevant facts and circumstances, including the terms of the trust instrument
				and any letter of wishes or similar document, historical patterns of trust
				distributions, and the existence of and functions performed by a trust
				protector or any similar adviser.</text>
								</subparagraph><subparagraph id="ID2BEBD5EF9F3F4FC1BA704233AB3CE6F6"><enum>(B)</enum><header>Other
				determinations</header><text>For purposes of this section—</text>
									<clause id="ID1786B28B5C264CBC943EE757A44D0CFA"><enum>(i)</enum><header>Constructive
				ownership</header><text>If a beneficiary of a trust is a corporation,
				partnership, trust, or estate, the shareholders, partners, or beneficiaries
				shall be deemed to be the trust beneficiaries for purposes of this
				section.</text>
									</clause><clause id="ID417079F536E9418D822A7D692C088117"><enum>(ii)</enum><header>Taxpayer
				return position</header><text>A taxpayer shall clearly indicate on its income
				tax return—</text>
										<subclause id="IDA2825FE7ADFE4030A86AAAB2CE9ADCDA"><enum>(I)</enum><text>the methodology
				used to determine that taxpayer’s trust interest under this section, and</text>
										</subclause><subclause id="ID43C715C1613C42CDAC2E3D905667B278"><enum>(II)</enum><text>if the taxpayer
				knows (or has reason to know) that any other beneficiary of such trust is using
				a different methodology to determine such beneficiary’s trust interest under
				this section.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID1B9E74B65B1D4B0792427B5EFD4AD9FB"><enum>(g)</enum><header>Termination of
				Deferrals, Etc</header><text>In the case of any covered expatriate,
				notwithstanding any other provision of this title—</text>
							<paragraph id="ID54E23BA7AD5145EFAC57F1863E21B0CA"><enum>(1)</enum><text>any period during
				which recognition of income or gain is deferred shall terminate on the day
				before the expatriation date, and</text>
							</paragraph><paragraph id="ID80446E434A674674B644DCDB1ED38C3F"><enum>(2)</enum><text>any extension of
				time for payment of tax shall cease to apply on the day before the expatriation
				date and the unpaid portion of such tax shall be due and payable at the time
				and in the manner prescribed by the Secretary.</text>
							</paragraph></subsection><subsection id="ID5A7909B0C1DC4A11AA9DA92417825E17"><enum>(h)</enum><header>Imposition of
				Tentative Tax</header>
							<paragraph id="IDE5DB681026BD4C82AF0A3A752115C8A2"><enum>(1)</enum><header>In
				general</header><text>If an individual is required to include any amount in
				gross income under subsection (a) for any taxable year, there is hereby
				imposed, immediately before the expatriation date, a tax in an amount equal to
				the amount of tax which would be imposed if the taxable year were a short
				taxable year ending on the expatriation date.</text>
							</paragraph><paragraph id="IDD0B3FA3C2889428984B9968134BDE9B7"><enum>(2)</enum><header>Due
				date</header><text>The due date for any tax imposed by paragraph (1) shall be
				the 90th day after the expatriation date.</text>
							</paragraph><paragraph id="ID6CDA7757A92E475781EB1CE7F9C575EB"><enum>(3)</enum><header>Treatment of
				tax</header><text>Any tax paid under paragraph (1) shall be treated as a
				payment of the tax imposed by this chapter for the taxable year to which
				subsection (a) applies.</text>
							</paragraph><paragraph id="ID97B80279D7DF4930A780F412E1044BC9"><enum>(4)</enum><header>Deferral of
				tax</header><text>The provisions of subsection (b) shall apply to the tax
				imposed by this subsection to the extent attributable to gain includible in
				gross income by reason of this section.</text>
							</paragraph></subsection><subsection id="ID4549CB35FAFD45A1A254978D9E0ED66A"><enum>(i)</enum><header>Special Liens
				for Deferred Tax Amounts</header>
							<paragraph id="ID5D510F9C2CDA40219F62B8A2F8ED3C80"><enum>(1)</enum><header>Imposition of
				lien</header>
								<subparagraph id="IDC9C5F33E710F48DE8F33ABB6BFA925C4"><enum>(A)</enum><header>In
				general</header><text>If a covered expatriate makes an election under
				subsection (a)(4) or (b) which results in the deferral of any tax imposed by
				reason of subsection (a), the deferred amount (including any interest,
				additional amount, addition to tax, assessable penalty, and costs attributable
				to the deferred amount) shall be a lien in favor of the United States on all
				property of the expatriate located in the United States (without regard to
				whether this section applies to the property).</text>
								</subparagraph><subparagraph id="ID24F756B3AC994DC9A9C087058D022B36"><enum>(B)</enum><header>Deferred
				amount</header><text>For purposes of this subsection, the deferred amount is
				the amount of the increase in the covered expatriate’s income tax which, but
				for the election under subsection (a)(4) or (b), would have occurred by reason
				of this section for the taxable year including the expatriation date.</text>
								</subparagraph></paragraph><paragraph id="IDBDDFB0974C4941138F7B5A04A4AC32E1"><enum>(2)</enum><header>Period of
				lien</header><text>The lien imposed by this subsection shall arise on the
				expatriation date and continue until—</text>
								<subparagraph id="ID15AB8CC1CECE448282F1165E18005E33"><enum>(A)</enum><text>the liability for
				tax by reason of this section is satisfied or has become unenforceable by
				reason of lapse of time, or</text>
								</subparagraph><subparagraph id="ID2E55CFB5015F48D3987FA41468481389"><enum>(B)</enum><text>it is established
				to the satisfaction of the Secretary that no further tax liability may arise by
				reason of this section.</text>
								</subparagraph></paragraph><paragraph id="IDF2A8F985135649168FCBD69D32D5BA88"><enum>(3)</enum><header>Certain rules
				apply</header><text>The rules set forth in paragraphs (1), (3), and (4) of
				section 6324A(d) shall apply with respect to the lien imposed by this
				subsection as if it were a lien imposed by section 6324A.</text>
							</paragraph></subsection><subsection id="ID1676B4FBE16C4849B140AD08F86DA002"><enum>(j)</enum><header>Regulations</header><text>The
				Secretary shall prescribe such regulations as may be necessary or appropriate
				to carry out the purposes of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8DC7756F170C428CBA25B57E8C7CB705"><enum>(b)</enum><header>Inclusion in
			 Income of Gifts and Bequests Received by United States Citizens and Residents
			 From Expatriates</header><text>Section 102 (relating to gifts, etc. not
			 included in gross income) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block id="IDDCD6327A23974310A96989D5866421CD" style="OLC">
					<subsection id="ID390551995C3C40A0A0A67391C7CAFE86"><enum>(d)</enum><header>Gifts and
				Inheritances From Covered Expatriates</header>
						<paragraph id="IDA0F0BB8E46754646BD88DB48197FC4CB"><enum>(1)</enum><header>Treatment of
				gifts and inheritances</header>
							<subparagraph id="ID65B6DC0BE942485280CB1ABFA711A839"><enum>(A)</enum><header>In
				general</header><text>Subsection (a) shall not exclude from gross income the
				value of any property acquired by gift, bequest, devise, or inheritance from a
				covered expatriate after the expatriation date.</text>
							</subparagraph><subparagraph id="ID6898DB7669544803BD737F2D0B804E57"><enum>(B)</enum><header>Determination
				of basis</header><text>Notwithstanding sections 1015 or 1022, the basis of any
				property described in subparagraph (A) in the hands of the donee or the person
				acquiring such property from the decedent shall be equal to the fair market
				value of the property at the time of the gift, bequest, devise, or
				inheritance.</text>
							</subparagraph></paragraph><paragraph id="IDAA8F66143EFC4CCA9883477DD834BCF1"><enum>(2)</enum><header>Exceptions for
				transfers otherwise subject to estate or gift tax</header><text>Paragraph (1)
				shall not apply to any property if either—</text>
							<subparagraph id="IDED63E1EE486C496FBF733E021372BA4C"><enum>(A)</enum><text>the gift,
				bequest, devise, or inheritance is—</text>
								<clause id="IDB0F31D14AC6340D09AB8FBF15E46D6AE"><enum>(i)</enum><text>shown on a timely
				filed return of tax imposed by chapter 12 as a taxable gift by the covered
				expatriate, or</text>
								</clause><clause id="ID4DAD6936C3C04AB3B8F8720BC8066E2F"><enum>(ii)</enum><text>included in the
				gross estate of the covered expatriate for purposes of chapter 11 and shown on
				a timely filed return of tax imposed by chapter 11 of the estate of the covered
				expatriate, or</text>
								</clause></subparagraph><subparagraph id="IDCF88224282CC4DAFB70C6BD7A835AFC8"><enum>(B)</enum><text>no such return
				was timely filed but no such return would have been required to be filed even
				if the covered expatriate were a citizen or long-term resident of the United
				States.</text>
							</subparagraph></paragraph><paragraph id="ID11278FA24A064FD6A9F19A332852F55A"><enum>(3)</enum><header>Definitions</header><text>For
				purposes of this subsection, any term used in this subsection which is also
				used in section 877A shall have the same meaning as when used in section
				877A.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDE857947600BA49B1B1F33AD336A4AFFB"><enum>(c)</enum><header>Definition of
			 Termination of United States Citizenship</header><text>Section 7701(a) is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block id="ID4975AA2B2C9D4F6AA28C1359A50A11D9" style="OLC">
					<paragraph id="ID01700788FC494D81859405CA5A9AFDC5"><enum>(50)</enum><header>Termination of
				united states citizenship</header>
						<subparagraph id="IDA4CD88B8F7394A68ACD9A0B343AE79C6"><enum>(A)</enum><header>In
				general</header><text>An individual shall not cease to be treated as a United
				States citizen before the date on which—</text>
							<clause id="id36F5CBE2805243EBB960D9D0F3D2C24F"><enum>(i)</enum><text>the individual’s
				citizenship is treated as relinquished under section 877A(e)(3), and</text>
							</clause><clause id="idBDA281B7A11A4C31A1CA3AD63714CD30"><enum>(ii)</enum><text>the individual
				provides a statement in accordance with section 6039G (if such a statement is
				otherwise required).</text>
							</clause></subparagraph><subparagraph id="ID36AC12BD25A34C7C96D8966352C974F2"><enum>(B)</enum><header>Dual
				citizens</header><text>Under regulations prescribed by the Secretary,
				subparagraph (A) shall not apply to an individual who became at birth a citizen
				of the United States and a citizen of another
				country.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID0E0253F317F2400FB3009B546B9A3386"><enum>(d)</enum><header>Ineligibility
			 for Visa or Admission to United States</header>
				<paragraph id="ID6806D79DD3904BD88AB14333A1CB63C9"><enum>(1)</enum><header>In
			 general</header><text>Section 212(a)(10)(E) of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1182(a)(10)(E)) is amended to read as follows:</text>
					<quoted-block act-name="Immigration and Nationality Act" id="ID70C99E28B1254597B928FDAA757E89B1" style="OLC">
						<subparagraph id="IDEE829010064D4E36AE99A01FAD8B2A3F"><enum>(E)</enum><header>Former citizens
				not in compliance with expatriation revenue provisions</header><text>Any alien
				who is a former citizen of the United States who relinquishes United States
				citizenship (within the meaning of section 877A(e)(3) of the Internal Revenue
				Code of 1986) and who is not in compliance with section 877A of such Code
				(relating to expatriation) is
				inadmissible.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID3351F2E43D07454EBE5A37AD0FA22705"><enum>(2)</enum><header>Availability of
			 information</header>
					<subparagraph id="IDB19ABFAAE1C747E48984296FFAFED756"><enum>(A)</enum><header>In
			 general</header><text>Section 6103(l) (relating to disclosure of returns and
			 return information for purposes other than tax administration) is amended by
			 adding at the end the following new paragraph:</text>
						<quoted-block id="ID0B903749B2134F6D9033B78576C27148" style="OLC">
							<paragraph id="ID6A78C905A3604E609B1284281EB9ABBF"><enum>(21)</enum><header>Disclosure to
				deny visa or admission to certain expatriates</header><text>Upon written
				request of the Attorney General or the Attorney General’s delegate, the
				Secretary shall disclose whether an individual is in compliance with section
				877A (and if not in compliance, any items of noncompliance) to officers and
				employees of the Federal agency responsible for administering section
				212(a)(10)(E) of the <act-name parsable-cite="INA">Immigration and Nationality
				Act</act-name> solely for the purpose of, and to the extent necessary in,
				administering such section
				212(a)(10)(E).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID3E53F7F9CBEF4E068BABDD560600DDCC"><enum>(B)</enum><header>Safeguards</header><text>Section
			 6103(p)(4) (relating to safeguards) is amended by striking <quote>or
			 (20)</quote> each place it appears and inserting <quote>(20), or
			 (21)</quote>.</text>
					</subparagraph></paragraph><paragraph id="ID9911E0698F434E718FEDABD3265C305D"><enum>(3)</enum><header>Effective
			 dates</header><text>The amendments made by this subsection shall apply to
			 individuals who relinquish United States citizenship on or after the date of
			 the enactment of this Act.</text>
				</paragraph></subsection><subsection id="ID25A13840518E4A84AD2879411B3A58F5"><enum>(e)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="IDF64572CBBF5B4EAC903733BA601FD9C0"><enum>(1)</enum><text>Section 877 is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block id="ID993F694AF8814F8BAD2527778B5BD123" style="OLC">
						<subsection id="ID64F7AF4782624391811FEAED1ED6687F"><enum>(h)</enum><header>Application</header><text>This
				section shall not apply to an expatriate (as defined in section 877A(e)) whose
				expatriation date (as so defined) occurs on or after the date of the enactment
				of this
				subsection.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID56B697B767B44A429EEDA5CC9CE7D12D"><enum>(2)</enum><text>Section 2107 is
			 amended by adding at the end the following new subsection:</text>

				section shall not apply to any expatriate subject to section

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDD8027C7E4FCD4F3DB6F873C1D67EA2A8"><enum>(3)</enum><text>Section
			 2501(a)(3) is amended by adding at the end the following new
			 subparagraph:</text>

						<subparagraph id="ID8525B77CD3864750ABA5CFA68C174864"><enum>(C)</enum><header>Application</header><text>This
				paragraph shall not apply to any expatriate subject to section
				877A.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID61CA6DDBCC3F40C3A45E38178DFE1058"><enum>(4)</enum><text>Section 6039G(a)
			 is amended by inserting <quote>or 877A</quote> after <quote>section
			 877(b)</quote>.</text>
				</paragraph><paragraph id="ID0EEDAD444A924BF699BF620A3DB3115A"><enum>(5)</enum><text>The second
			 sentence of section 6039G(d) is amended by inserting <quote>or who relinquishes
			 United States citizenship (within the meaning of section 877A(e)(3))</quote>
			 after <quote>section 877(a))</quote>.</text>
				</paragraph><paragraph id="id9C0A6AEC8B974B358308DC556BA9D0C8"><enum>(6)</enum><text>Section 7701(n)
			 is amended by adding at the end the following new paragraph:</text>

				</paragraph></subsection><subsection id="ID6A80B21297DB4DCBB2E2E7E832E56CFF"><enum>(f)</enum><header>Clerical
			 Amendment</header><text>The table of sections for subpart A of part II of
			 subchapter N of chapter 1 is amended by inserting after the item relating to
			 section 877 the following new item:</text>

			 general</header><text>Except as provided in this subsection, the amendments
			 made by this section shall apply to expatriates (within the meaning of section
			 877A(e) of the Internal Revenue Code of 1986, as added by this section) whose
			 expatriation date (as so defined) occurs on or after the date of the enactment
			 of this Act.</text>
				</paragraph><paragraph id="ID5C3CDA5C95394D1FAEBD00CC1D460761"><enum>(2)</enum><header>Gifts and
			 bequests</header><text>Section 102(d) of the Internal Revenue Code of 1986 (as
			 added by subsection (b)) shall apply to gifts and bequests received on or after
			 the date of the enactment of this Act, from an individual or the estate of an
			 individual whose expatriation date (as so defined) occurs after such
			 date.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE8E3A6041B974D64869033FDB28DBE57"><enum>(3)</enum><header>Due date for
			 tentative tax</header><text>The due date under section 877A(h)(2) of the
			 Internal Revenue Code of 1986, as added by this section, shall in no event
			 occur before the 90th day after the date of the enactment of this Act.</text>
