2.The Congress finds as follows:
(1)Each year approximately 9,000,000 people
become ill with active tuberculosis ( referred to in this section as
TB
), and it is estimated that 1,600,000 of those people die, a
result of critical underinvestment in quality TB control and the research and
development of new TB drugs, diagnostics and a vaccine, as well as the comorbid
relationship between TB and HIV/AIDS. Such levels of morbidity and mortality
are complicated by the disease having the ability to develop resistance to
treatments and to travel easily across borders.
(2)In 2006, there
were 13,767 cases of active TB reported in the United States. The average
annual decline in the national TB rate slowed from 7.3 percent per year in the
period of 1993 to 2000 to 3.8 percent per year in the period of 2000 to
2006.
(3)In addition to
those with active TB, an estimated 10,000,000 to 15,000,000 people in the
United States have latent TB infection.
(4)The increasing
occurrence of multidrug resistant (MDR
) TB, including
extensively drug resistant (XDR
) TB—which is resistant to at
least almost all drugs used to treat TB, including the two recommended
first-line drugs and the recommended second-line medications, raises concerns
of a future epidemic of virtually untreatable TB.
(5)To prevent the
spread of extensively drug resistant TB, the immediate strengthening of TB
control systems must be a priority. This includes improved case detection,
strengthened laboratory capacity, rapid implementation of infection control
measures, enhanced treatment programs, and immediate support to existing public
sector infrastructure.
(6)The Centers for Disease Control and
Prevention is increasingly relied upon globally for its expertise and technical
assistance in global tuberculosis preparedness and outbreak response capacity
to identify and investigate outbreaks of multidrug resistant and extensively
drug resistant TB.
(7)New tools are
needed to more effectively prevent, diagnose, and treat TB. The standard method
of diagnosing TB is over 100 years old, and fails to adequately detect TB,
especially in children and those co-infected with HIV/AIDS. The newest class of
anti-TB drug is over 40 years old, while rates of multidrug resistant TB are
rising globally. The existing vaccine confers no protection to adolescents and
adults, protecting only against severe forms of TB in infants and young
children.

Disease Control and Prevention</header>
<subtitle id="HAAD1F03A12D044DFA9DF9ECEB3D14DFC"><enum>A</enum><header>National program
for elimination of tuberculosis</header>
<section id="H22FA78E8BB6A4639854052F13949F8EE"><enum>101.</enum><header>National
program</header><text display-inline="no-display-inline">Section 317E of the
Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b–6</external-xref>) is
amended—</text>
<paragraph id="H23D535A6AD964297A709DDFED7388F1E"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the heading for the section and
inserting the following: <quote><header-in-text level="section" style="traditional">national program for elimination of
tuberculosis</header-in-text></quote>; and</text>
</paragraph><paragraph id="HE02032D80251476A9847319998CAE968"><enum>(2)</enum><text>by amending
subsection (b) to read as follows:</text>

development; demonstration projects; education and training</header><text display-inline="yes-display-inline">With respect to the prevention, treatment,
control, and elimination of tuberculosis, the Secretary may, directly or
through grants to public or nonprofit private entities, carry out the
following:</text>
<paragraph id="HB09B96FF7FB44D70A9A22EBC6655677B"><enum>(1)</enum><text display-inline="yes-display-inline">Research, with priority given to research
and development concerning—</text>
<subparagraph id="H25BE22C1AC1E4D93972B56FEAEE5D474"><enum>(A)</enum><text>clinical trials to
evaluate the safety and effectiveness of new drugs, diagnostics, and vaccines
for latent tuberculosis infection and active tuberculosis, including
drug-resistant tuberculosis, that are suitable for use by patients with
HIV/AIDS;</text>
</subparagraph><subparagraph id="H54051D48914E4832BDA148493967E468"><enum>(B)</enum><text>epidemiological
studies of populations at risk for tuberculosis; and</text>
</subparagraph><subparagraph id="H1225F168206B4A3C917E73DD277D059E"><enum>(C)</enum><text display-inline="yes-display-inline">field studies to evaluate the effectiveness
of new drugs, diagnostics, and vaccines, to assess the incidence and prevalence
of multidrug resistant and extensively drug resistant strains of
tuberculosis.</text>
</subparagraph></paragraph><paragraph id="HA3C93F7FF44540B200D5F193E03BFAF"><enum>(2)</enum><text>Demonstration
projects for—</text>
<subparagraph id="HC2CBD812F9D040FA8E14FE69114EA6B"><enum>(A)</enum><text>the development of
regional capabilities to prevent, control and eliminate tuberculosis and
prevent mutidrug resistant and extensively drug resistant strains of
tuberculosis;</text>
</subparagraph><subparagraph id="HA614CD8F452741198FE8875E2233E5D5"><enum>(B)</enum><text display-inline="yes-display-inline">the intensification of efforts—</text>
<clause id="HC5194A86232746B681DB6199D906A818"><enum>(i)</enum><text>to prevent,
detect, and treat tuberculosis among African Americans, Hispanic Americans,
Asian Americans, and other United States-born populations with documented
health disparities; and</text>
</clause><clause id="H25BA0F068D364B2D92DDA3ACA5E06700"><enum>(ii)</enum><text>to reduce or
eliminate racial disparities in the incidence of tuberculosis in these
populations;</text>
</clause></subparagraph><subparagraph id="H8E56B60EB4E84027B4355877A5F7CF92"><enum>(C)</enum><text display-inline="yes-display-inline">the intensification of efforts to control
tuberculosis along the United States-Mexico border and among United
States-Mexico binational populations;</text>
</subparagraph><subparagraph id="H8A5F317A9F134203978BFEFC5BB1E619"><enum>(D)</enum><text>the
intensification of efforts to prevent, detect, and treat tuberculosis among
foreign-born persons who are in the United States;</text>
</subparagraph><subparagraph id="IDe44cf8220ec64bd6a373989799b07dd3"><enum>(E)</enum><text>providing guidance
to Immigration and Customs Enforcement in developing risk-based screening
procedures based on current epidemiological data;</text>
</subparagraph><subparagraph id="ID225effc8abfb4daf9ebfc761f341164f"><enum>(F)</enum><text>the
intensification of efforts to increase targeted testing and treatment of latent
tuberculosis infection and drug-resistant tuberculosis; and</text>
</subparagraph><subparagraph id="ID405722446c5b4d60bcbe0999fad07a9a"><enum>(G)</enum><text>the
intensification of efforts to prevent, detect, and treat tuberculosis among
other high risk populations and settings, including among children and
adolescents, homeless persons, detainees and prisoners, HIV-infected persons,
and within health care settings.</text>
</subparagraph></paragraph><paragraph id="HC1FB71F339784B0380C3CC72CA639C2C"><enum>(3)</enum><text>A public
information and education program to include components that raise awareness
regarding tuberculosis among the general population as well as those that
target populations documented as having high risk for tuberculosis.</text>
</paragraph><paragraph id="HDD4A6A80B6BB4D349D6D82413916C8A1"><enum>(4)</enum><text>Education,
training and clinical skills improvement activities for health professionals,
including allied health personnel and emergency response employees.</text>
</paragraph><paragraph id="H93BB588B28FD4394AE84D13BE4A34D31"><enum>(5)</enum><text display-inline="yes-display-inline">Provide support for the Tuberculosis Trials
Consortium, the Tuberculosis Epidemiologic Studies Consortium, the National
Laboratory Training Network, and Regional Training and Medical Consultation
Centers to carry out activities under paragraphs (1) through (4).</text>
</paragraph><paragraph id="HBCF7D762D99040199094B355A4001E5F"><enum>(6)</enum><text display-inline="yes-display-inline">Collaboration with international
organizations and foreign countries in intensifying efforts to prevent, treat,
control, and eliminate tuberculosis, including efforts that address risks
associated with international travel.</text>
</paragraph><paragraph id="ID8bfc3d782bc9466484abe983ae6ebeca"><enum>(7)</enum><text>Develop, enhance,
and expand information technologies that support tuberculosis control,
including surveillance and database management systems with
cross-jurisdictional
capabilities.</text>

</paragraph></section></subtitle><subtitle id="H0266F1D89689432481228C71179D004B"><enum>B</enum><header>Interagency
collaboration</header>
<section id="HC7F6865EC76C447DA900D96E65065700"><enum>111.</enum><header>Advisory
council for elimination of tuberculosis</header>
<subsection id="H9D38BC19C11541FB9EDFD90294E39C"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Section 317E(f) of
the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b–6(f)</external-xref>) is
amended—</text>
<paragraph id="HF41465F9D5E440E58E1F57EB1068F607"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph
(6); and</text>
</paragraph><paragraph id="HEEA6870E6F2A4F328E585C3569B84799"><enum>(2)</enum><text>by striking
paragraphs (2) through (4), and inserting the following:</text>

<paragraph id="HB5F36E9952144D07BCD7F5DAF503EC00"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The Council shall provide advice and
recommendations regarding the elimination of tuberculosis to the Secretary, the
Assistant Secretary for Health, and the Director of the Centers for Disease
Control and Prevention. In addition, the Council shall, with respect to
eliminating such disease, provide to the Secretary and other appropriate
Federal officials advice on—</text>
<subparagraph id="HCF6339CB477D4F749BDC219700A02FD"><enum>(A)</enum><text>coordinating the
activities of the Public Health Service and other Federal agencies that relate
to the disease, including activities under subsection (b);</text>
</subparagraph><subparagraph id="ID273b47b646d846fb952f29979e8ce074"><enum>(B)</enum><text>responding rapidly
and effectively to cases of extensively drug resistant strains of tuberculosis;
and</text>
</subparagraph><subparagraph id="HCE781C38199E4D71AFF993647EF5B9B"><enum>(C)</enum><text>efficiently
utilizing the Federal resources involved.</text>
</subparagraph></paragraph><paragraph id="HC41E1E0E5DD24EF8A56064A697CECCA"><enum>(3)</enum><header>Comprehensive
plan</header>
<subparagraph id="H1D118840450949019FADBC3640DA1C74"><enum>(A)</enum><header>In
general</header><text>In carrying out paragraph (2), the Council shall make
recommendations on the development, revision, and implementation of a
comprehensive plan to eliminate tuberculosis in the United States.</text>
</subparagraph><subparagraph id="H52BFFE6A97A64A0E9506688D04A743F8"><enum>(B)</enum><header>Consultation</header><text>In
carrying out subparagraph (A), the Council shall consult with public and
private entities, including—</text>
<clause id="HA9943EC3C3314845B01293205C2C86CF"><enum>(i)</enum><text>individuals who
are scientists, physicians, laboratorians, and other health professionals, who
are not officers or employees of the Federal Government and who represent the
disciplines relevant to tuberculosis elimination;</text>
</clause><clause commented="no" id="H5B768872B16B4B37B40129558F00EB5"><enum>(ii)</enum><text>members of
public-private partnerships established to address the elimination of
tuberculosis;</text>
</clause><clause id="HBF22159D321F44AD8390ABF6C9A9894F"><enum>(iii)</enum><text>members of
national and international nongovernmental organizations established to address
tuberculosis elimination; and</text>
</clause><clause id="H5EDFA585B62D4999B98EEFAD7CA489FE"><enum>(iv)</enum><text>members from the
general public who are knowledgeable with respect to tuberculosis elimination
including individuals who have or have had tuberculosis.</text>
</clause></subparagraph><subparagraph commented="no" id="HC24E745883924C26A304A417D56CCD73"><enum>(C)</enum><header>Certain
components of plan</header><text display-inline="yes-display-inline">In
carrying out subparagraph (A), the Council shall—</text>
<clause commented="no" id="H1873697423FA4FFBB2DB907843058B78"><enum>(i)</enum><text>consider the
recommendations of the Institute of Medicine regarding the elimination of
tuberculosis;</text>
</clause><clause commented="no" id="H42099F892868412396A8282CCCABF1E2"><enum>(ii)</enum><text>consider
recommendations for the involvement of the United States in continuing global
and cross-border tuberculosis control activities in countries where a high
incidence of tuberculosis directly affects the United States such as Mexico;
and</text>
</clause><clause commented="no" id="H24DAC00AF9FD47679DD5C6CB5D5CDCB"><enum>(iii)</enum><text>review the
extent to which progress has been made toward eliminating tuberculosis.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H878B11381C304C0A921408BF80DB3B96"><enum>(4)</enum><header>Annual
report</header><text>The Council shall annually submit to Congress and the
Secretary a report on the activities carried under this section, other than
subsection (g). Each such report shall include the opinion of the Council on
the extent to which its recommendations regarding the elimination of
tuberculosis have been implemented, including with respect to—</text>
<subparagraph commented="no" id="H8D4963E8A43B401585F08C5E2CB4097F"><enum>(A)</enum><text>activities under
subsection (b); and</text>
</subparagraph><subparagraph commented="no" id="HD84D44A50D824C3F9CC67367E009E67B"><enum>(B)</enum><text>the national plan
referred to in paragraph (3).</text>
</subparagraph></paragraph><paragraph id="HC091791F7C2C44E4A8FCD2F43E3636F8"><enum>(5)</enum><header>Composition</header><text>The
Council shall be composed of—</text>
<subparagraph id="H6614962D492B4224A0213370CA138F6D"><enum>(A)</enum><text>representatives
from the Centers for Disease Control and Prevention, the National Institutes of
Health, the United States Agency for International Development, the Agency for
Healthcare Research and Quality, the Health Resources and Services
Administration, the United States-Mexico Border Health Commission, and other
Federal departments and agencies that carry out significant activities related
to tuberculosis;</text>
</subparagraph><subparagraph id="H5C2AF207847A458B81A251C3DB71E398"><enum>(B)</enum><text>State and local
tuberculosis control and public health officials;</text>
</subparagraph><subparagraph id="H800A9B23B28840E4A19B857D46C71486"><enum>(C)</enum><text display-inline="yes-display-inline">individuals who are scientists, physicians,
laboratorians, and other health professionals who represent disciplines
relevant to tuberculosis elimination;</text>
</subparagraph><subparagraph id="H7C695176C7DE4CAEB553732855764909"><enum>(D)</enum><text>members of
national and international nongovernmental organizations established to address
the elimination of tuberculosis; and</text>
</subparagraph><subparagraph id="HB7FCA9D1C0D94156964B958E35712C1F"><enum>(E)</enum><text>members from the
general public who are knowledgeable with respect to the elimination of
tuberculosis, including individuals who have or have had
tuberculosis.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="H8722352FD20943479C6EE33369B18B23"><enum>(b)</enum><header>Rule of
construction regarding current membership</header><text>With respect to the
advisory council under section 317E(f) of the Public Health Service Act, the
amendments made by subsection (a) may not be construed as terminating the
membership on such council of any individual serving as such a member as of the
day before the date of the enactment of this Act.</text>
</subsection></section></subtitle><subtitle id="H855320789197443681E3A972C4D626E2"><enum>C</enum><header>New tools for
tuberculosis elimination</header>
<section id="H3485E3CB46A842B098EF3CEAC1CD788"><enum>121.</enum><header>New
tools</header><text display-inline="no-display-inline">Section 317E of the
Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b–6</external-xref>) is
amended—</text>
<paragraph id="HBF7F762E800A440EB8D9C667AAE91DC"><enum>(1)</enum><text>by redesignating
subsection (g) as subsection (h); and</text>
</paragraph><paragraph id="H3281035885A44243A38E50781673F47D"><enum>(2)</enum><text>by inserting after
subsection (f) the following subsection:</text>

elimination of tuberculosis</header>
<paragraph id="H936738584DC4458E8275B8E4001DAD46"><enum>(1)</enum><header>Research and
development on drugs, diagnostics, vaccines, and public health
interventions</header><text>The Secretary, acting through the Director of the
Centers for Disease Control and Prevention, shall expand, intensify, and
coordinate research and development and related activities of such Centers to
develop new tools for the elimination of tuberculosis, including drugs,
diagnostics, vaccines, and public health interventions, such as directly
observed therapy and non-pharmaceutical intervention.</text>
</paragraph><paragraph id="H8408E30BCB0B4FF99F58F93BE971EE3"><enum>(2)</enum><header>Federal
tuberculosis task force</header>
<subparagraph id="HA28C20AC3B374290BC97E400892CF001"><enum>(A)</enum><header>Duties</header><text>The
Federal Tuberculosis Task Force (established in December 2001 as part of the
Centers for Disease Control and Prevention) (in this subsection referred to as
the <quote>Task Force</quote>) shall provide to the Secretary and other
appropriate Federal officials advice on the implementation of paragraph (1),
including advice regarding the efficient utilization of the Federal resources
involved.</text>
</subparagraph><subparagraph id="H5580C2C12FAE4776AD04C9D4838FEBB3"><enum>(B)</enum><header>Comprehensive
plan for new tools development</header><text>In carrying out paragraph (1), the
Task Force shall make recommendations on the development of a comprehensive
plan for the creation of new tools for the elimination of tuberculosis,
including drugs, diagnostics, and vaccines.</text>
</subparagraph><subparagraph id="HA7E49ACB6B014836B0898C3317E56970"><enum>(C)</enum><header>Consultation</header><text>In
developing the comprehensive plan under paragraph (1), the Task Force shall
consult with—</text>
<clause id="H259E762A49AC47958E9DE0D963DC3AB"><enum>(i)</enum><text>scientists,
physicians, laboratorians, and other health professionals and who represent the
specialties and disciplines relevant to the research under
consideration;</text>
</clause><clause id="H363DED60A0A344B6A0273DFB28996EB7"><enum>(ii)</enum><text display-inline="yes-display-inline">members from public-private partnerships or
foundations (or both) engaged in research relevant to research under
consideration;</text>
</clause><clause id="HDCBF504FF10C4FDBAFAEA00557C6ADE8"><enum>(iii)</enum><text>members of
national and international nongovernmental organizations established to address
tuberculosis elimination;</text>
</clause><clause id="HE97DC39269424CEC8F6BC6DAD6BB73B8"><enum>(iv)</enum><text>members from the
general public who are knowledgeable with respect to tuberculosis, including
individuals who have or have had tuberculosis; and</text>
</clause><clause id="HF37451D3E82B419FB710AB64C9EA101"><enum>(v)</enum><text>scientists,
physicians, laboratorians, and other health professionals who reside in a
foreign country with a substantial incidence or prevalence of tuberculosis, and
who represent the specialties and disciplines relevant to the research under
consideration.</text>
</clause></subparagraph></paragraph><paragraph id="H72EC28D2EA244D1198CD881628FA8852"><enum>(3)</enum><header>Grants and
contracts</header><text>The Secretary shall carry out paragraph (1) directly
and through awards of grants, cooperative agreements, and contracts to public
and private entities, including—</text>
<subparagraph id="HD5F283C20B2D44648D9B43A52EE850E0"><enum>(A)</enum><text>public-private
partnerships;</text>
</subparagraph><subparagraph id="HEBDF78CA071C4B7E964E5200DE48B983"><enum>(B)</enum><text>academic
institutions, including institutions of higher education;</text>
</subparagraph><subparagraph id="H5E45ECBA17F443488053E95760D834E0"><enum>(C)</enum><text>research
institutions; and</text>
</subparagraph><subparagraph id="HA3672B7A569E40F18300DB7CF2B51F98"><enum>(D)</enum><text display-inline="yes-display-inline">the Tuberculosis Trials Consortium and the
Tuberculosis Epidemiologic Studies
Consortium.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section></subtitle><subtitle id="H20A2471BF09344B6B35193CECC1FE620"><enum>D</enum><header>Authorizations of
appropriations</header>
<section id="HDA4BDE586B724F75B70059A41006B74"><enum>131.</enum><header>Authorizations
of appropriations</header><text display-inline="no-display-inline">Section 317E
of the Public Health Service Act, as amended by section 121(1) of this Act, is
amended by striking subsection (h) and inserting the following:</text>

program</header>
<subparagraph id="H7AF52EA720774E91A0B763CB928D5BA0"><enum>(A)</enum><header>In
general</header><text>For the purpose of carrying out this section, other than
subsections (b) and (g), there are authorized to be appropriated $300,000,000
for fiscal year 2008, and such sums as may be necessary for each of the fiscal
years 2009 through 2012.</text>
</subparagraph><subparagraph id="H2FDA6F125689406CB717FAC45FE97D79"><enum>(B)</enum><header>Reservation for
emergency grants</header><text>Of the amounts appropriated under subparagraph
(A) for a fiscal year, the Secretary may reserve not more than 25 percent for
emergency grants under subsection (a) for any State, political subdivision of a
States, or other public entity in which there is, relative to other areas, a
substantial number of cases of tuberculosis, multidrug resistant tuberculosis,
or extensively drug resistant tuberculosis or a substantial rate of increase in
such cases.</text>
</subparagraph><subparagraph id="id6F18CECA2D7A49E48A6D3F760E329CA7"><enum>(C)</enum><header>Research,
demonstration projects, education, and training</header><text>For the purpose
of carrying out subsection (b), there are authorized to be appropriated such
sums as may be necessary for each of fiscal years 2008 through 2012.</text>
</subparagraph><subparagraph id="HA849F22132CA40BB8970C632FBEA8EE9"><enum>(D)</enum><header>Priority</header><text display-inline="yes-display-inline">In allocating amounts appropriated under
subparagraph (A) and not reserved under subparagraph (B), the Secretary shall
give priority to allocating such amounts for grants under subsection
(a).</text>
</subparagraph><subparagraph id="HEDA3A1FB868C4F65938C1265C5AD2D77"><enum>(E)</enum><header>Allocation of
funds</header>

formula</header><text>Of the amounts appropriated under subparagraph (A), not
reserved under subparagraph (B), and allocated by the Secretary for grants
under subsection (a), the Secretary shall distribute such amounts to grantees
under subsection (a) on the basis of a formula.</text>
</clause><clause id="HFD1A6AE4E9634397BEA3CD22BED25E55"><enum>(ii)</enum><header>Relevant
factors</header><text>The formula developed by the Secretary under clause (i)
shall take into account the level of tuberculosis morbidity in the respective
geographic area and may consider other factors relevant to tuberculosis in such
area.</text>

formula required</header><text>This subparagraph does not require the Secretary
to modify the formula that was used by the Secretary to distribute funds to

tools</header>
<subparagraph id="H306A74315CBA4921A5FEEE00BFF40006"><enum>(A)</enum><header>In
general</header><text>For the purpose of carrying out subsection (g), there are
authorized to be appropriated $100,000,000 for fiscal year 2008, and such sums
as may be necessary for each of the fiscal years 2009 through 2012.</text>
</subparagraph><subparagraph id="HE85053E9A33247CCB1A5C0405D944C89"><enum>(B)</enum><header>Limitation</header><text>The
authorization of appropriations established in subparagraph (A) for a fiscal
year is effective only if the amount appropriated under paragraph (1) for such
year equals or exceeds the amount appropriated to carry out this section for

Activities</header><text>Activities under subsection (a) shall include—</text>

nursing, public health, or related fields to assist such faculty in developing
high quality curricula in such schools designed to significantly increase the
opportunities for interested individuals, including students of the school and
practicing physicians and nurses, to learn the principles and practices of
preventing, managing, and controlling tuberculosis.</text>
</subsection><subsection id="H5C91B92140C34F45AEC4ED8FC7CC00B0"><enum>(b)</enum><header>Tuberculosis/pulmonary
infection awards</header><text>The Director of the National Institutes of
Health may provide awards to support the career development of clinically
trained professionals who are committed to research regarding pulmonary
infections and tuberculosis by providing for supervised study and
research.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><section id="H0C00B4FE21C640E392F20027F309F441"><enum>202.</enum><header>Activities of
National institute of Allergy and Infectious Diseases</header><text display-inline="no-display-inline">Section 447A of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
285f–2) is amended—</text>

for—</text>
<subparagraph id="id58d054db-4f6e-4ddd-8d3c-bb77d4d51eb7"><enum>(A)</enum><text>the development of
regional capabilities to prevent, control and eliminate tuberculosis and
prevent multidrug resistant and extensively drug resistant strains of
tuberculosis;</text>
</subparagraph><subparagraph id="idfa361a0f-2f98-4ce7-abae-3efff77b927d"><enum>(B)</enum><text display-inline="yes-display-inline">the intensification of efforts to reduce
health disparities in the incidence of tuberculosis;</text>
</subparagraph><subparagraph id="id0c42b499-7ca8-438c-b217-6620380fa2ad"><enum>(C)</enum><text display-inline="yes-display-inline">the intensification of efforts to control
tuberculosis along the United States-Mexico border and among United
States-Mexico binational populations, including through expansion of the scope
and number of programs that—</text>
<clause id="idB0B5CC9B1BE849DB87973A8F7DA5675F"><enum>(i)</enum><text display-inline="yes-display-inline">detect and treat binational cases of
tuberculosis; and</text>
</clause><clause id="id1665601B55E3491B9DC41D38AE7F3E56"><enum>(ii)</enum><text display-inline="yes-display-inline">treat high-risk cases of tuberculosis
referred from Mexican health departments;</text>
</clause></subparagraph><subparagraph id="id265690f2-fe84-4717-9fc0-c572f2849c58"><enum>(D)</enum><text>the intensification of
efforts to prevent, detect, and treat tuberculosis among foreign-born persons
who are in the United States;</text>
</subparagraph><subparagraph id="idcb304259-90b2-4cbd-8847-bd25b7bd6550"><enum>(E)</enum><text>the intensification of
efforts to prevent, detect, and treat tuberculosis among populations and
settings documented as having a high risk for tuberculosis; and</text>
</subparagraph><subparagraph id="id06D7ED2EA08A42EBA05257D7515DD49B"><enum>(F)</enum><text>tuberculosis detection,
control, and prevention.</text>
</subparagraph></paragraph><paragraph id="idb32e6630-6e3b-4350-b49f-89c22882b0b9"><enum>(3)</enum><text>Public information and
education activities.</text>
</paragraph><paragraph id="id210d8d37-29ac-47e7-a36b-ac03b952ae78"><enum>(4)</enum><text>Education, training,
clinical skills improvement activities, and workplace exposure prevention for
health professionals, including allied health personnel and emergency response
employees.</text>

</subparagraph><subparagraph id="id4A45D6ECB8D2454B9A642B4374CDF156"><enum>(B)</enum><header>Federal amounts not to
be included as contributions</header><text>Amounts provided by the Federal
Government, or services assisted or subsidized to any significant extent by the
Federal Government, may not be included in determining the amount of
non-Federal contributions as described in subparagraph
(A).</text>

elimination of tuberculosis</header>
<subsection id="id3ecb060f-ada2-4c47-9cc5-7a2d5314831f"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Section 317E(f) of
the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b–6(f)</external-xref>) is
amended—</text>
<paragraph id="id268c516e-f9b6-47e0-9d5d-43672ac52eec"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph
(6); and</text>
</paragraph><paragraph id="id982c0330-b5c9-4756-b91a-74d294c31315"><enum>(2)</enum><text>by striking paragraphs
(2) through (4), and inserting the following:</text>

recommendations regarding the elimination of tuberculosis to the Secretary. In
addition, the Council shall, with respect to eliminating such disease, provide
to the Secretary and other appropriate Federal officials advice on—</text>
<subparagraph id="idfd9bfed8-07c9-428b-a013-531700112c14"><enum>(A)</enum><text>coordinating the
activities of the Department of Health and Human Services and other Federal
agencies that relate to the disease, including activities under subsection
(b);</text>
</subparagraph><subparagraph id="id518c8bd7-3db4-4e11-9859-c5533fd19ec8"><enum>(B)</enum><text>responding rapidly and
effectively to emerging issues in tuberculosis; and</text>
</subparagraph><subparagraph id="id93563921-acc2-4dbc-b212-733a048ba084"><enum>(C)</enum><text>efficiently utilizing the
Federal resources involved.</text>
</subparagraph></paragraph><paragraph id="idb9c9fb3b-ff94-4daf-8115-978c243be43b"><enum>(3)</enum><header>Comprehensive
plan</header>
<subparagraph id="idd6de77ea-6f82-419f-9787-a18fcbc31934"><enum>(A)</enum><header>In
general</header><text>In carrying out paragraph (2), the Council shall make or
update recommendations on the development, revision, and implementation of a
comprehensive plan to eliminate tuberculosis in the United States.</text>
</subparagraph><subparagraph id="id338fe522-f2dd-41f2-b8ae-e9cd9f63e694"><enum>(B)</enum><header>Consultation</header><text>In
carrying out subparagraph (A), the Council may consult with appropriate public
and private entities, which may, subject to the direction or discretion of the
Secretary, include—</text>
<clause id="idb1590054-4429-435e-b573-96005de3101c"><enum>(i)</enum><text>individuals who are
scientists, physicians, laboratorians, and other health professionals, who are
not officers or employees of the Federal Government and who represent the
disciplines relevant to tuberculosis elimination;</text>
</clause><clause commented="no" id="id7a1d9612-2129-4188-a78b-931a78bcff93"><enum>(ii)</enum><text>members of
public-private partnerships or private entities established to address the
elimination of tuberculosis;</text>
</clause><clause id="id6f70fda8-8940-4177-b2d2-178093e39a69"><enum>(iii)</enum><text>members of national and
international nongovernmental organizations whose purpose is to eliminate
tuberculosis; and</text>
</clause><clause id="ida46ab431-e944-4229-a92a-86cc2718e7c0"><enum>(iv)</enum><text>members from the general
public who are knowledgeable with respect to tuberculosis elimination including
individuals who have or have had tuberculosis.</text>
</clause></subparagraph><subparagraph commented="no" id="id17b4f6c3-8fc6-4fb5-9067-9d6ba9a51e41"><enum>(C)</enum><header>Certain components of
plan</header><text display-inline="yes-display-inline">In carrying out
subparagraph (A), the Council shall, subject to the direction or discretion of
the Secretary—</text>
<clause commented="no" id="idec8ac7a5-ee22-41c0-8a9d-d6698f7da647"><enum>(i)</enum><text>consider recommendations
for the involvement of the United States in continuing global and cross-border
tuberculosis control activities in countries where a high incidence of
tuberculosis directly affects the United States; and</text>
</clause><clause commented="no" id="id3c33b1e4-cd44-4a70-ad55-e7ebfa996763"><enum>(ii)</enum><text>review the extent to
which progress has been made toward eliminating tuberculosis.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="id1d9e7257-1943-43b9-ab4e-c947f5b95525"><enum>(4)</enum><header>Biennial
report</header>
<subparagraph commented="no" id="id46312BDE2635426297C349A31BF7A66D"><enum>(A)</enum><header>In
general</header><text>The Council shall submit a biennial report to the
Secretary, as determined necessary by the Secretary, on the activities carried
under this section, other than subsection (g). Each such report shall include
the opinion of the Council on the extent to which its recommendations regarding
the elimination of tuberculosis have been implemented, including with respect
to—</text>

subsection (b); and</text>
</clause><clause commented="no" id="idecc8786e-f139-4032-a96b-5f3b15135729"><enum>(ii)</enum><text>the national plan
referred to in paragraph (3).</text>
</clause></subparagraph><subparagraph commented="no" id="id0F09DDD5883B447B8A527281081A6D75"><enum>(B)</enum><header>Public</header><text>The
Secretary shall make a report submitted under subparagraph (A) public.</text>
</subparagraph></paragraph><paragraph id="id1b95122b-1cc6-4a9c-8520-7e698955558e"><enum>(5)</enum><header>Composition</header><text>The
Council shall be composed of—</text>
<subparagraph id="id47b377a1-ca16-4a0c-b344-6a34904a579d"><enum>(A)</enum><text>ex officio
representatives from the Centers for Disease Control and Prevention, the
National Institutes of Health, the United States Agency for International
Development, the Agency for Healthcare Research and Quality, the Health
Resources and Services Administration, the United States-Mexico Border Health
Commission, and other Federal departments and agencies that carry out
significant activities related to tuberculosis;</text>
</subparagraph><subparagraph id="id367b70b5-008e-4fa8-b95a-42b9fc81082e"><enum>(B)</enum><text>State and local
tuberculosis control and public health officials;</text>
</subparagraph><subparagraph id="id99e33d88-d112-4afc-90ac-caeef05e1e90"><enum>(C)</enum><text display-inline="yes-display-inline">individuals who are scientists, physicians,
laboratorians, and other health professionals who represent disciplines
relevant to tuberculosis elimination; and</text>
</subparagraph><subparagraph id="id4fe94a0f-8c6a-4e28-9cd5-4b1dcd4bfaa7"><enum>(D)</enum><text>members of national and
international nongovernmental organizations established to address the
elimination of
tuberculosis.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="id9fb81a7b-e822-4bef-82f5-611484863117"><enum>(b)</enum><header>Rule of construction
regarding current membership</header><text>With respect to the advisory council
under section 317E(f) of the Public Health Service Act, the amendments made by
subsection (a) may not be construed as terminating the membership on such
council of any individual serving as such a member as of the day before the
date of the enactment of this Act.</text>
</subsection></section></subtitle><subtitle id="idfa3216e3-889c-4fc2-b697-7ddccb91a3a3"><enum>C</enum><header>New tools for
tuberculosis elimination</header>
<section id="id8ca57c6a-02dc-4321-b46e-f49688d0b672"><enum>121.</enum><header>New
tools</header><text display-inline="no-display-inline">Section 317E of the
Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b–6</external-xref>) is
amended—</text>
<paragraph id="id9edf8091-0332-42f9-a32f-7d76a26c3e84"><enum>(1)</enum><text>by redesignating
subsection (g) as subsection (h); and</text>
</paragraph><paragraph id="idd3bd9261-1fd8-4efb-a7ad-dd2c2cb3534a"><enum>(2)</enum><text>by inserting after
subsection (f) the following subsection:</text>

elimination of tuberculosis</header>
<paragraph id="id080ee0f0-8822-4df2-9ce3-d4bc114e058d"><enum>(1)</enum><header>Research and
development on drugs, diagnostics, vaccines, and public health
interventions</header><text>The Secretary may expand, intensify, and coordinate
research and development and related activities to develop new tools for the
elimination of tuberculosis, including drugs, diagnostics, vaccines, and public
health interventions, such as directly observed therapy and non-pharmaceutical
intervention, and methods to enhance detection and response to outbreaks of
tuberculosis, including multidrug resistant tuberculosis. The Secretary shall
give priority to programmatically relevant research so that new tools can be
utilized in public health practice.</text>
</paragraph><paragraph id="id96f67def-bf39-4d9d-9192-8bc957178a36"><enum>(2)</enum><header>Federal tuberculosis
task force</header>
<subparagraph id="id25ba9b8c-248b-478d-8013-1507e634addd"><enum>(A)</enum><header>Duties</header><text>The
Federal Tuberculosis Task Force (in this subsection referred to as the
<quote>Task Force</quote>) shall provide to the Secretary and other appropriate
Federal officials advice on the implementation of paragraph (1), including
advice regarding the efficient utilization of the Federal resources
involved.</text>
</subparagraph><subparagraph id="ide5cddc64-9589-4064-9a0c-8c07ab3310b9"><enum>(B)</enum><header>Comprehensive plan for
new tools development</header><text>In carrying out paragraph (1), the Task
Force shall make recommendations on the development of a comprehensive plan for
the creation of new tools for the elimination of tuberculosis, including drugs,
diagnostics, and vaccines.</text>
</subparagraph><subparagraph id="id84521df5-6e55-40d2-9e99-d543f8ff3889"><enum>(C)</enum><header>Consultation</header><text>In
developing the comprehensive plan under paragraph (1), the Task Force shall
consult with external parties including representatives from groups such
as—</text>
<clause id="id0df5d827-4315-44e0-9f15-ac44caf3238c"><enum>(i)</enum><text>scientists, physicians,
laboratorians, and other health professionals who represent the specialties and
disciplines relevant to the research under consideration;</text>
</clause><clause id="idcd12cb0e-ec2e-43c9-a7bc-ce5e761cb5c2"><enum>(ii)</enum><text display-inline="yes-display-inline">members from public-private partnerships,
private entities, or foundations (or both) engaged in activities relevant to
research under consideration;</text>
</clause><clause id="id91ad5b6b-72d8-4eea-8357-f081f248e544"><enum>(iii)</enum><text>members of national and
international nongovernmental organizations established to address tuberculosis
elimination;</text>
</clause><clause id="idb17f4ee6-b479-4450-9c01-a2bd9aa555cb"><enum>(iv)</enum><text>members from the general
public who are knowledgeable with respect to tuberculosis including individuals
who have or have had tuberculosis; and</text>
</clause><clause id="id38e34be9-2140-41ec-8c1d-23a77759fd8f"><enum>(v)</enum><text>scientists, physicians,
laboratorians, and other health professionals who reside in a foreign country
with a substantial incidence or prevalence of tuberculosis, and who represent
the specialties and disciplines relevant to the research under
consideration.</text>
</clause></subparagraph></paragraph><paragraph id="id3af30ea4-be18-41ff-993d-aaa7b8242939"><enum>(3)</enum><header>Grants and
contracts</header><text>The Secretary may carry out paragraph (1) directly and
through awards of grants, cooperative agreements, and contracts to public and
private entities, including—</text>
<subparagraph id="idb6d61d06-672c-4018-a759-c89651739c00"><enum>(A)</enum><text>public-private
partnerships;</text>
</subparagraph><subparagraph id="idfbf8c469-bbb1-4b12-ae83-a0d1ae87b399"><enum>(B)</enum><text>academic institutions,
including institutions of higher education;</text>
</subparagraph><subparagraph id="idb18ed626-0f72-4f8f-937e-2c60f9d18a87"><enum>(C)</enum><text>research institutions;
and</text>
</subparagraph><subparagraph id="IDc10c0f045eb54653974556bd04e9bd61"><enum>(D)</enum><text>nonprofit entities
established and dedicated to tuberculosis vaccine and treatment product
development.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section></subtitle><subtitle id="iddc8a545f-1218-4b83-8c78-9709e143d32b"><enum>D</enum><header>Evaluation of public
health authorities</header>
<section id="idBDC1DACFCCEE422B997A1426654F2A84"><enum>131.</enum><header>Evaluation of public
health authorities</header>
<subsection id="idF0611AEA547C48D88E9DE955FC3BB71B"><enum>(a)</enum><header>In
general</header><text>Not later than 180 days after the date of enactment of
the Comprehensive Tuberculosis Elimination Act of 2007, the Secretary of Health
and Human Services shall prepare and submit to the appropriate committees of
Congress a report that evaluates and provides recommendations on changes needed
to Federal and State public health authorities to address current disease
containment challenges such as isolation and quarantine.</text>
</subsection><subsection id="idF64074C29AFB48518F024465C248EFCB"><enum>(b)</enum><header>Contents of
evaluation</header><text>The report described in subsection (a) shall
include—</text>
<paragraph id="IDa00c4ca1a2da44b1a92d4ac549f952cf"><enum>(1)</enum><text>an evaluation of the
effectiveness of current policies to detain patients with active
tuberculosis;</text>
</paragraph><paragraph id="ID6472d1ae78c5470a8b4776345f06b9aa"><enum>(2)</enum><text>an evaluation of whether
Federal laws should be strengthened to expressly address the movement of
individuals with active tuberculosis; and</text>
</paragraph><paragraph id="ID28e2a6ec7e864914bd7839d7b04b2cd1"><enum>(3)</enum><text>specific legislative
recommendations for changes to Federal laws, if any.</text>
</paragraph></subsection><subsection id="id3D89D053F14E413295B1C42D5DB0C523"><enum><added-phrase reported-display-style="italic">(c)</added-phrase></enum><header>Update of
quarantine regulations</header><text>Not later than 240 days after the date of
enactment of this Act, the Secretary of Health and Human Services shall
promulgate regulations to update the current interstate and foreign quarantine
regulations found in parts 70 and 71 of title 42, Code of Federal
Regulations.</text>
</subsection></section></subtitle><subtitle id="id2D60AA45B81F43B6927A9C6B46D2D6B8"><enum>E</enum><header>Authorization of
appropriations</header>
<section id="idddbf66e0-2007-48be-b993-b5bc46276bd6"><enum>141.</enum><header>Authorizations of
appropriations</header><text display-inline="no-display-inline">Section 317E of
the Public Health Service Act, as amended by section 121(1) of this Act, is
amended by striking subsection (h) and inserting the following:</text>

<subparagraph id="idaa7d2610-6169-470e-b768-6f7763b83422"><enum>(A)</enum><header>In
general</header><text>For the purpose of carrying out this section, other than
subsections (b) and (g), there are authorized to be appropriated $300,000,000
for fiscal year 2008, and such sums as may be necessary for each of the fiscal
years 2009 through 2012.</text>
</subparagraph><subparagraph id="id16f50572-6041-477b-b45b-bb8185046e96"><enum>(B)</enum><header>Reservation for
emergency grants</header><text>Of the amounts appropriated under subparagraph
(A) for a fiscal year, the Secretary may reserve not more than 25 percent for
emergency grants under subsection (a) for any geographic area, State, political
subdivision of a State, or other public entity in which there is, relative to
other areas, a substantial number of cases of tuberculosis, multidrug resistant
tuberculosis, or extensively drug resistant tuberculosis or a substantial rate
of increase in such cases.</text>
</subparagraph><subparagraph id="id146bc490-5f3c-4b3f-a5b1-cd6bbb0af1af"><enum>(C)</enum><header>Research, demonstration
projects, education, and training</header><text>For the purpose of carrying out
subsection (b), there are authorized to be appropriated such sums as may be
necessary for each of fiscal years 2008 through 2012.</text>
</subparagraph><subparagraph id="id6ac18c87-d654-4738-96bf-b68a287aae0c"><enum>(D)</enum><header>Priority</header><text display-inline="yes-display-inline">In allocating amounts appropriated under
subparagraph (A) and not reserved under subparagraph (B), the Secretary shall
give priority to allocating such amounts for grants under subsection
(a).</text>
</subparagraph><subparagraph id="id785dfd61-b4a2-4e5d-8c32-188bb7befa9d"><enum>(E)</enum><header>Allocation of
funds</header>
<clause id="id274a3df8-f03d-4029-9b3e-18e246dcbc25"><enum>(i)</enum><header>Requirement of
formula</header><text>Of the amounts appropriated under subparagraph (A), not
reserved under subparagraph (B), and allocated by the Secretary for grants
under subsection (a), the Secretary shall distribute a portion of such amounts
to grantees under subsection (a) on the basis of a formula.</text>
</clause><clause id="idb2f3b442-7442-4b6c-af88-cdeb0fb49b98"><enum>(ii)</enum><header>Relevant
factors</header><text>The formula developed by the Secretary under clause (i)
shall take into account the level of tuberculosis morbidity and case complexity
in the respective geographic area and may consider other factors relevant to
tuberculosis in such area.</text>
</clause><clause id="id491b915e-8131-418c-a71c-9c1ebcfbc4e2"><enum>(iii)</enum><header>No change to formula
required</header><text>This subparagraph does not require the Secretary to
modify the formula that was used by the Secretary to distribute funds to
grantees under subsection (a) for fiscal year 2007.</text>
</clause></subparagraph></paragraph><paragraph id="id724e0390-05b5-4118-b40b-2dfa68b92325"><enum>(2)</enum><header>New tools</header>
<subparagraph id="id86850176-a842-428c-b310-89626507e670"><enum>(A)</enum><header>In
general</header><text>For the purpose of carrying out subsection (g), there are
authorized to be appropriated $100,000,000 for fiscal year 2008, and such sums
as may be necessary for each of the fiscal years 2009 through 2012.</text>
</subparagraph><subparagraph id="id3980e8fa-06f4-4d2c-860f-7db8fe0ca241"><enum>(B)</enum><header>Limitation</header><text>The
authorization of appropriations established in subparagraph (A) for a fiscal
year is effective only if the amount appropriated under paragraph (1) for such
year equals or exceeds the amount appropriated to carry out this section for
fiscal year
2007.</text>

Activities</header><text>Activities under subsection (a) may include—</text>
<paragraph id="id68733f6d-ad41-4e0d-89bc-ed74ec1ba401"><enum>(1)</enum><text>enhancing basic and
clinical research on tuberculosis, including drug resistant tuberculosis;
and</text>
</paragraph><paragraph id="ida07ee074-0fa6-4ec7-aba1-1fe5334f8ff7"><enum>(2)</enum><text>expanding research on the
relationship between such disease and the human immunodeficiency
virus.</text>
