		  information on provider and supplier performance, and to enhance the education
		  and awareness of consumers for evaluating health care services through the
		  development and release of reports based on Medicare enrollment, claims,
		  survey, and assessment data.</official-title>

			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Medicare Quality Enhancement Act
			 of 2007</short-title></quote>.</text>
		</section><section id="id9E9D6B9ACF874B8982C184E2AA6CE7BA"><enum>2.</enum><header>Quality and
			 efficiency reports based on Medicare enrollment, claims, survey, and assessment
			 data</header><text display-inline="no-display-inline">Title XVIII of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> is amended by
			 adding at the end the following new section:</text>
			<quoted-block act-name="Social Security Act" id="ID641246C9A0644770B27BA3BC68A3DAEA" style="traditional">
				<section id="ID1F3C06D14B79430B8D2506AC4FE97C05"><enum>1898.</enum><header>Quality and Efficiency Reports Based on Medicare
		  Data</header><subsection commented="no" display-inline="yes-display-inline" id="id2989409B51854E98B06B06AD5533039F"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section is to provide for the development of reports based on
				Medicare data and private data that is publicly available or is provided by the
				entity making the request for the report in order to—</text>
						<paragraph id="ID51FF096E4E294FEB82C359C0E8471B63"><enum>(1)</enum><text>improve the
				quality and efficiency of health care;</text>
						</paragraph><paragraph id="id436C97CF9A0846BB9656E6E0DDA676E5"><enum>(2)</enum><text>enhance the
				education and awareness of consumers for evaluating health care services;
				and</text>
						</paragraph><paragraph id="IDA25E699C7E5B4739A66A0547A3C7CE80"><enum>(3)</enum><text>provide the
				public with reports on national, regional, and provider- and supplier-specific
				performance, which may be in a provider- or supplier-identifiable
				format.</text>
						</paragraph></subsection><subsection id="IDD7F40D9325AC4CA0857BB5F703872A79"><enum>(b)</enum><header>Procedures for
				the development of reports</header>
						<paragraph id="idCE2EE15E258145A7B89052C311ECA9FC"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding section 552(b)(6) or 552a(b) of title 5,
				United States Code, not later than 12 months after the date of enactment of
				this section, the Secretary, in accordance with the purpose described in
				subsection (a), shall establish and implement procedures under which an entity
				may submit a request to a Medicare Quality Reporting Organization for the
				Organization to develop a report based on—</text>
							<subparagraph id="idEF264101B69F47BEBDC7BABF29D11996"><enum>(A)</enum><text>Medicare data
				disclosed to the Organization under subsection (c); and</text>
							</subparagraph><subparagraph id="id87A2AF5C1E8D4320B9B565CD88585CF0"><enum>(B)</enum><text>private data that
				is publicly available or is provided to the Organization by the entity making
				the request for the report.</text>
							</subparagraph></paragraph><paragraph id="id088445A276724433A3BB88D8FD3EB9E7"><enum>(2)</enum><header>Definitions</header><text>In
				this section:</text>
							<subparagraph id="idD8860E8FEB874F36A2511CB32CD52571"><enum>(A)</enum><header>Medicare
				data</header><text>The term ‘Medicare data’ means—</text>
								<clause id="idF18278371EF640899214337DF32BCF75"><enum>(i)</enum><text>enrollment data
				under this title, including de-identified beneficiary enrollment data;</text>
								</clause><clause id="id1398DD1675AE4C1A9720C2246489FD0D"><enum>(ii)</enum><text>all claims for
				reimbursement for all items and services furnished by a provider of services
				(as defined in section 1861(u)) or a supplier (as defined in section 1861(d))
				under part A or B in a research identifiable format;</text>
								</clause><clause id="id169E7FF9A4A3449F860C16BA41CCFFFA"><enum>(iii)</enum><text>on and after
				January 1, 2008, all data relating to enrollment in, and coverage for,
				qualified prescription drug coverage under part D; and</text>
								</clause><clause id="idC2E5A7FEE21D41DEB363EE8DB21B70AD"><enum>(iv)</enum><text>additional data
				files relating to the program under this title collected by the Secretary for
				the purpose of nationwide quality measurement and reporting based on surveys
				and assessment data determined appropriate by the Secretary.</text>
								</clause></subparagraph><subparagraph id="idBB496F5027C64CBA897C7E60AC29F539"><enum>(B)</enum><header>Medicare
				Quality Reporting Organization</header><text>The term <quote>Medicare Quality
				Reporting Organization</quote> means an entity with a contract under subsection
				(d).</text>
							</subparagraph></paragraph></subsection><subsection id="id42843AA0E8BE41B2B4690E6D7A272CEF"><enum>(c)</enum><header>Access to
				Medicare data</header>
						<paragraph id="idF52967200B1745818A1D53D0CAA82D33"><enum>(1)</enum><header>In
				general</header><text>The procedures established under subsection (b)(1) shall
				provide for the secure disclosure of Medicare data to each Medicare Quality
				Reporting Organization.</text>
						</paragraph><paragraph id="id9C34B0D5103F4940B4201FC52DEAAC81"><enum>(2)</enum><header>All
				data</header><text>The Secretary shall ensure that all Medicare data files
				(beginning with files from January 1, 1998) are disclosed under paragraph (1),
				including the most recent data files available to the Secretary. Not less than
				every 6 months, the Secretary shall update the information disclosed under
				paragraph (1) to Medicare Quality Reporting Organizations.</text>
						</paragraph></subsection><subsection id="id80DF04B22A74405A90D53015DC5960AE"><enum>(d)</enum><header>Medicare
				Quality Reporting Organizations</header>
						<paragraph id="id540EB434FEB74B7F9530F45B35606EE5"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="idC0C0C146DA7A4DAF89281DA905F438C6"><enum>(A)</enum><header>Three
				contracts</header><text>Subject to subparagraph (B), the Secretary shall enter
				into a contract with 3 private entities to serve as Medicare Quality Reporting
				Organizations under which an entity shall—</text>
								<clause id="id756FEADE5D6C4A92A61AADDFB9C6364A"><enum>(i)</enum><text>store the
				Medicare data that is to be disclosed under subsection (c); and</text>
								</clause><clause id="idCB62C9786A694AA3AAA766F9819537CD"><enum>(ii)</enum><text>develop and
				release reports pursuant to subsection (e).</text>
								</clause></subparagraph><subparagraph id="id150DC755C2694808AC59F3ECA84BFB88"><enum>(B)</enum><header>Additional
				contracts</header><text>If the Secretary determines that reports are not being
				developed and released within 6 months of the receipt of the request for the
				report, the Secretary shall enter into contracts with additional private
				entities in order to ensure that such reports are developed and released in a
				timely manner.</text>
							</subparagraph></paragraph><paragraph id="id002BD0074AED4F58AE1E85D8E273652C"><enum>(2)</enum><header>Qualifications</header><text>The
				Secretary shall enter into a contract with an entity under paragraph (1) only
				if the Secretary determines that the entity—</text>
							<subparagraph id="idF268D61C1F4746CC986F35682480B87F"><enum>(A)</enum><text>has the research
				capability to conduct and complete reports under this section;</text>
							</subparagraph><subparagraph id="id0794D1972B5D48D3A8FE51833F06C27D"><enum>(B)</enum><text>has in
				place–</text>
								<clause id="id71238C2B34A849F5BB3F90DD9DB49A65"><enum>(i)</enum><text>an information
				technology infrastructure to support the entire database of Medicare data;
				and</text>
								</clause><clause id="id22B678A8B2494E3C99992F445C1A6427"><enum>(ii)</enum><text>operational
				standards to provide security for such database;</text>
								</clause></subparagraph><subparagraph id="id25E77EE48C6342F1B34A345C11ADC848"><enum>(C)</enum><text>has experience
				with, and expertise on, the development of reports on health care quality and
				efficiency based on Medicare or private sector claims data; and</text>
							</subparagraph><subparagraph id="id0E30501EBE194777B5A9071F2C1B2293"><enum>(D)</enum><text>has a significant
				business presence in the United States.</text>
							</subparagraph></paragraph><paragraph id="idBE0DF773A9D6424092056BF1465B9FA6"><enum>(3)</enum><header>Contract
				requirements</header><text>Each contract with an entity under paragraph (1)
				shall contain the following requirements:</text>
							<subparagraph id="id6A292686D9564E5AB6D3FF51D9BD05AB"><enum>(A)</enum><header>Ensuring
				beneficiary privacy</header>
								<clause id="idF0DE3295A62B4115AEB0886E06FDBA65"><enum>(i)</enum><header>HIPAA</header><text>The
				entity shall meet the requirements imposed on a covered entity for purposes of
				applying part C of title XI and all regulatory provisions promulgated
				thereunder, including regulations (relating to privacy) adopted pursuant to the
				authority of the Secretary under section 264(c) of the Health Insurance
				Portability and Accountability Act of 1996 (42 U.S.C. 1320d–2 note).</text>
								</clause><clause id="idD41D4AEDCF5B47A1B210F186367780A1"><enum>(ii)</enum><header>Privacy</header><text>The
				entity shall provide assurances that the entity will not use the Medicare data
				disclosed under subsection (c) in a manner that violates sections 552 or 552a
				of title 5, United States Code, with regard to the privacy of individually
				identifiable beneficiary health information.</text>
								</clause></subparagraph><subparagraph id="id5959257876B54B8FA681E0F5B1B1570A"><enum>(B)</enum><header>Proprietary
				information</header><text>The entity shall provide assurances that the entity
				will not, with respect to data relating to part D, disclose any negotiated
				price concessions, such as discounts, direct or indirect subsidies, rebates,
				and direct or indirect remunerations, obtained by prescription drug plans and
				MA–PD plans for covered part D drugs, or any other proprietary cost
				information.</text>
							</subparagraph><subparagraph id="idD99E7594A2C44756A29B538CC531E67B"><enum>(C)</enum><header>Disclosure</header><text>The
				entity shall disclose—</text>
								<clause id="ID215f86a97e1b4852aef9c4d71e26a665"><enum>(i)</enum><text>any financial,
				reporting, or contractual relationship between the entity and any provider of
				services (as defined in section 1861(u)) or supplier (as defined in section
				1861(d)); and</text>
								</clause><clause id="ID26d94f32ec3a41bf942c9ded6d5b8b85"><enum>(ii)</enum><text>if applicable,
				the fact that the entity is managed, controlled, or operated by any such
				provider of services or supplier.</text>
								</clause></subparagraph><subparagraph id="idDEDF26969400447C84C4D3138DBFCFF3"><enum>(D)</enum><header>Component of
				another organization</header><text>If the entity is a component of another
				organization—</text>
								<clause id="idEF0AAEB5B0E54F7C862F2559A06FC843"><enum>(i)</enum><text>the entity shall
				maintain Medicare data and reports separately from the rest of the organization
				and establish appropriate security measures to maintain the confidentiality and
				privacy of the Medicare data and reports; and</text>
								</clause><clause id="ID469b0f12366c44ed97a2eeb86899f788"><enum>(ii)</enum><text>the entity shall
				not make an unauthorized disclosure to the rest of the organization of Medicare
				data or reports in breach of such confidentiality and privacy
				requirement.</text>
								</clause></subparagraph><subparagraph id="idD38BDEC362C341AFAD2DC237D42A05F5"><enum>(E)</enum><header>Termination or
				nonrenewal</header><text>If a contract under this section is terminated or not
				renewed, the following requirements shall apply:</text>
								<clause id="id93CC807C021A49A69997B1EB7A6B9D3D"><enum>(i)</enum><header>Confidentiality
				and privacy protections</header><text>The entity shall continue to comply with
				the confidentiality and privacy requirements under this section with respect to
				all Medicare data disclosed to the entity and each report developed by the
				entity.</text>
								</clause><clause id="id8AAEF816C1F94FFDA6A1B98047F25311"><enum>(ii)</enum><header>Disposition of
				data and reports</header><text>The entity shall—</text>
									<subclause id="id335FE5C261F6455ABA31FFE8208B4359"><enum>(I)</enum><text>return to the
				Secretary all Medicare data disclosed to the entity and each report developed
				by the entity; or</text>
									</subclause><subclause id="ID0b7f926a04344395ad89584a068af12e"><enum>(II)</enum><text>if returning the
				Medicare data and reports is not practicable, destroy the reports and Medicare
				data.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="id6680373BF46F46488680F62E1F223D96"><enum>(4)</enum><header>Competitive
				procedures</header><text>Competitive procedures (as defined in section 4(5) of
				the Federal Procurement Policy Act) shall be used to enter into contracts under
				paragraph (1).</text>
						</paragraph><paragraph id="idE21FFBC49DFA40BD83F41A81C8EFF694"><enum>(5)</enum><header>Review of
				contract in the event of a merger or acquisition</header><text>The Secretary
				shall review the contract with a Medicare Quality Reporting Organization under
				this section in the event of a merger or acquisition of the Organization in
				order to ensure that the requirements under this section will continue to be
				met.</text>
						</paragraph></subsection><subsection id="id408759ACB863462F8AF4408C30B297A3"><enum>(e)</enum><header>Development and
				release of reports based on requests</header>
						<paragraph id="id4599095F45D74C3EA09089E795E6DF61"><enum>(1)</enum><header>Request for a
				report</header>
							<subparagraph id="id783B4514BA6A4D9CB1E40EAA375CF4C3"><enum>(A)</enum><header>Request</header>
								<clause id="idFD96F27FD6354AA9A3E1C1607061681E"><enum>(i)</enum><header>In
				general</header><text>The procedures established under subsection (b)(1) shall
				include a process for an entity to submit a request to a Medicare Quality
				Reporting Organization for a report based on Medicare data and private data
				that is publicly available or is provided by the entity making the request for
				the report. Such request shall comply with the purpose described in subsection
				(a).</text>
								</clause><clause id="idF10CFF711A7A4595A038A506E165692A"><enum>(ii)</enum><header>Request for
				specific methodology</header><text>The process described in clause (i) shall
				permit an entity making a request for a report to request that a specific
				methodology be used by the Medicare Quality Reporting Organization in
				developing the report. The Organization shall work with the entity making the
				request to finalize the methodology to be used.</text>
								</clause><clause id="idDC60CE2BD2DF43F3A9489763756C56F5"><enum>(iii)</enum><header>Request for a
				specific MQRO</header><text>The process described in clause (i) shall permit an
				entity to submit the request for a report to any Medicare Quality Reporting
				Organization.</text>
								</clause></subparagraph><subparagraph id="idA294ECCEE7174E47940A79E09FD73B71"><enum>(B)</enum><header>Release to
				public</header><text>The procedures established under subsection (b)(1) shall
				provide that at the time a request for a report is finalized under subparagraph
				(A) by a Medicare Quality Reporting Organization, the Organization shall make
				available to the public, through the Internet website of the Centers for
				Medicare &amp; Medicaid Services and other appropriate means, a brief
				description of both the requested report and the methodology to be used to
				develop such report.</text>
							</subparagraph></paragraph><paragraph id="id4E28D879257E4B8CB602CC4BDA90B0A0"><enum>(2)</enum><header>Development and
				release of report</header>
							<subparagraph id="id6E10E9C65BFB4CAC9B6D0FF7C4FBBB40"><enum>(A)</enum><header>Development</header>
								<clause id="id9D3FDFAA642341D8BBB535B91F00FDEB"><enum>(i)</enum><header>In
				general</header><text>If the request for a report complies with the purpose
				described in subsection (a), the Medicare Quality Reporting Organization may
				develop the report based on the request.</text>
								</clause><clause id="id30111CFA66DC459CB6044D7A1F05A36D"><enum>(ii)</enum><header>Requirement</header><text>A
				report developed under clause (i) shall include a detailed description of the
				standards, methodologies, and measures of quality used in developing the
				report.</text>
								</clause></subparagraph><subparagraph id="id7CA0AAF8F8DA4632A87E9B7CAC5A7E6D"><enum>(B)</enum><header>Review of
				report by Secretary to ensure compliance with privacy
				requirement</header><text>Prior to a Medicare Quality Reporting Organization
				releasing a report under subparagraph (C), the Secretary shall review the
				report to ensure that the report complies with the Federal regulations
				(concerning the privacy of individually identifiable beneficiary health
				information) promulgated under section 264(c) of the
				<act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability
				Act of 1996</act-name> and sections 552 or 552a of title 5, United States Code,
				with regard to the privacy of individually identifiable beneficiary health
				information. The Secretary shall act within 30 business days of receiving such
				report.</text>
							</subparagraph><subparagraph id="id6BAD02281D1E45F9BB0CEC513A03FAC1"><enum>(C)</enum><header>Release of
				report</header>
								<clause id="idDA1AB8589FC84E09AFE295C958D0C3BD"><enum>(i)</enum><header>Release to
				entity making request</header><text>If the Secretary finds that the report
				complies with the provisions described in subparagraph (B), the Medicare
				Quality Reporting Organization shall release the report to the entity that made
				the request for the report.</text>
								</clause><clause id="id175236DD1929441B8FC361049AB35402"><enum>(ii)</enum><header>Release to
				public</header><text>The procedures established under subsection (b)(1) shall
				provide for the following:</text>
									<subclause id="idBA3FA85D2D934A829E6F31A633D53883"><enum>(I)</enum><header>Updated
				description</header><text>At the time of the release of a report by a Medicare
				Quality Reporting Organization under clause (i), the entity shall make
				available to the public, through the Internet website of the Centers for
				Medicare &amp; Medicaid Services and other appropriate means, an updated brief
				description of both the requested report and the methodology used to develop
				such report.</text>
									</subclause><subclause id="id9DEB3F525FAA4B1D8D60F86C58626B0B"><enum>(II)</enum><header>Complete
				report</header><text>Not later than 1 year after the date of the release of a
				report under clause (i), the report shall be made available to the public
				through the Internet website of the Centers for Medicare &amp; Medicaid
				Services and other appropriate means.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection id="idCEC31799D9C3494F94323BEC4FDC2DCF"><enum>(f)</enum><header>Annual review
				of reports and termination of contracts</header>
						<paragraph id="idC739D627AA6E471785C57C78AAD0E2E9"><enum>(1)</enum><header>Annual review
				of reports</header><text>The Comptroller General of the United States shall
				review reports released under subsection (e)(2)(C) to ensure that such reports
				comply with the purpose described in subsection (a) and annually submit a
				report to the Secretary on such review.</text>
						</paragraph><paragraph id="id17591C99F1964C2996A81826C5D3B6A8"><enum>(2)</enum><header>Termination of
				contracts</header><text>The Secretary may terminate a contract with a Medicare
				Quality Reporting Organization if the Secretary determines that there is a
				pattern of reports being released by the Organization that do not comply with
				the purpose described in subsection (a).</text>
						</paragraph></subsection><subsection id="id21F8C3AA96EB416CB0B4B0DDC8E5DF0A"><enum>(g)</enum><header>Fees</header>
						<paragraph id="idB334449E7B0F4239B0AAA6A67034B046"><enum>(1)</enum><header>Fees for
				Secretary</header><text>The Secretary shall charge a Medicare Quality Reporting
				Organization a fee for—</text>
							<subparagraph id="id7D96BBDD006D4501B8FC2822BB7943C4"><enum>(A)</enum><text>disclosing the
				data under subsection (c); and</text>
							</subparagraph><subparagraph id="id41EB7670A48E49DCAB9179455367FA55"><enum>(B)</enum><text>conducting the
				review under subsection (e)(2)(B).</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The
				Secretary shall ensure that such fees are sufficient to cover the costs of the
				activities described in subparagraph (A) and (B).</continuation-text></paragraph><paragraph id="id212C7BD2BB44410FB6B5665E0788F966"><enum>(2)</enum><header>Fees for
				MQRO</header>
							<subparagraph id="id426F48CF047E49F5BE208F2EE07A1C55"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraphs (A) and (B), a Medicare Quality
				Reporting Organization may charge an entity making a request for a report a
				reasonable fee for the development and release of the report.</text>
							</subparagraph><subparagraph id="id1E669F444B7C47C98583B35B862E0D5A"><enum>(B)</enum><header>Discount for
				small entities</header><text>In the case of an entity making a request for a
				report (including a not-for-profit) that has annual revenue that does not
				exceed $10,000,000, the Medicare Quality Reporting Organization shall reduce
				the reasonable fee charged to such entity under subparagraph (A) by an amount
				equal to 10 percent of such fee.</text>
							</subparagraph><subparagraph id="id02FB5BC59E7F4F35824164E95AFBC576"><enum>(C)</enum><header>Increase for
				large entities that do not agree to release reports within 6
				months</header><text>In the case of an entity making a request for a report
				that is not described in subparagraph (B) and that does not agree to the report
				being released to the public under clause (ii)(II) of subsection (e)(2)(C)
				within 6 months of the date of the release of the report to the entity under
				clause (i) of such subsection, the Medicare Quality Reporting Organization
				shall increase the reasonable fee charged to such entity under subparagraph (A)
				by an amount equal to 10 percent of such fee.</text>
							</subparagraph><subparagraph id="id9EBC7ADBF422489A9A61A5B1617B5844"><enum>(D)</enum><header>Rule of
				construction</header><text>Nothing in this paragraph shall be construed to
				effect the requirement that a report be released to the public under clause
				(ii)(II) of subsection (e)(2)(C)(ii)(II) by not later than 1 year after the
				date of the release of the report to the requesting entity under clause (i) of
				such subsection.</text>
							</subparagraph></paragraph></subsection><subsection id="IDFC7F094C79A14A5795029E7E2887B1DC"><enum>(h)</enum><header>Regulations</header><text>Not
				later than 6 months after the date of enactment of this section, the Secretary
				shall prescribe regulations to carry out this section.</text>
					</subsection><subsection id="idCDA05879F68F49939A60F95B7ADC593D"><enum>(i)</enum><header>GAO studies and
				report</header>
						<paragraph id="id15FE39337F4F437895A1532543D0E311"><enum>(1)</enum><header>Studies</header><text>The
				Comptroller General of the United States shall conduct a study on each of the
				following:</text>
							<subparagraph id="id7BB613DD53F74A6BB49F24AE521780F8"><enum>(A)</enum><text>The feasibility
				of requiring Medicare Advantage organizations under part C to share utilization
				and quality data with the Secretary for the purpose of releasing such
				information to Medicare Quality Reporting Organizations under this
				section.</text>
							</subparagraph><subparagraph id="id19DC211E88DB4DE387DFDA33CD5F9748"><enum>(B)</enum><text>The Medicare data
				released to Medicare Quality Reporting Organizations under subsection (c) in
				order to determine the accuracy of such data with respect to—</text>
								<clause id="idEC9A4DC9692F4598A1D643DD4B0FBF7D"><enum>(i)</enum><text>the coding of
				demographic data;</text>
								</clause><clause id="idAB9AF91B1D1E4F04B96A906A6648F2B1"><enum>(ii)</enum><text>diagnosis and
				procedures; and</text>
								</clause><clause id="id22508D621B1E46E18F9A5E337B8B6640"><enum>(iii)</enum><text>any other data
				elements important for the development of reports under this section in
				accordance with the purpose described in subsection (a).</text>
								</clause></subparagraph><subparagraph id="id885F2F8E3EA8443F91FDA8CE5FBBA211"><enum>(C)</enum><text>The feasibility
				of collecting State Medicaid data for the purpose of aggregating all Medicaid
				data for study under this section.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B041816869B4E2F81458D791624FEE0"><enum>(2)</enum><header>Report</header><text>Not
				later than 12 months after the date of enactment of this section, the
				Comptroller General of the United States shall submit a report to Congress on
				each of the studies conducted under paragraph (1) together with recommendations
				for such legislation and administrative actions as the Comptroller General
				considers
				appropriate.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id471DC8D12D174670AE4FAF21959C435C"><enum>3.</enum><header>Quality Advisory
			 Board</header>
			<subsection id="id16A42624B993454E861DDE9C0233E3A7"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 12 months after the date of enactment of this Act, the Secretary of
			 Health and Human Services shall establish within the Office of the Secretary a
			 board to be known as the Quality Advisory Board (in this section referred to as
			 the <quote>Board</quote>).</text>
			</subsection><subsection id="idE1C57DE5BA9A496D9EC4F3FD500CFC4A"><enum>(b)</enum><header>Membership</header><text>The
			 members of the Board shall include, but not be limited to, an appropriate
			 number of representatives of—</text>
				<paragraph id="ID0adeece9f2dc480e8b9e3b0d1c9c37b2"><enum>(1)</enum><text>groups
			 representing Medicare beneficiaries;</text>
				</paragraph><paragraph id="IDe273e0dd1f0d41f89e1f45fe5cb17915"><enum>(2)</enum><text>groups
			 representing providers of services (as defined in subsection (u) of section
			 1861 of the Social Security Act (42 U.S.C. 1395x)) and suppliers (as defined in
			 subsection (d) of such section) receiving reimbursement under the Medicare
			 program;</text>
				</paragraph><paragraph id="ID2fcec3c4f0174f47ae5760de876c9ff3"><enum>(3)</enum><text>purchasers and
			 employers or groups representing purchasers and employers;</text>
				</paragraph><paragraph id="IDd89bb705e5f246a79d347f5aabd53247"><enum>(4)</enum><text>organizations
			 focused on the development of quality health care measures;</text>
				</paragraph><paragraph id="ID7e2a873161fc4009923167521540ddc7"><enum>(5)</enum><text>researchers or
			 research institutions with experience in the measurement of, and reporting on,
			 health care quality; and</text>
				</paragraph><paragraph id="IDd1b2335ff72a4e8784a71904b39c9b28"><enum>(6)</enum><text>health plans or
			 groups representing health plans.</text>
				</paragraph></subsection><subsection id="id8E0E5B2344904E3E8E279E5931090BDA"><enum>(c)</enum><header>Duties</header><text>The
			 duties of the Board are as follows:</text>
				<paragraph id="id675F1321AB224AFEA4868D22D921AAC6"><enum>(1)</enum><text>To submit
			 requests for reports to Medicare Quality Reporting Organizations under section
			 1898 of the Social Security Act, as added by section 2.</text>
				</paragraph><paragraph id="idB90AC00F2AC24C918F488255A45A7C89"><enum>(2)</enum><text>To examine how
			 clinical registries can be linked to Medicare data (as defined in subsection
			 (b)(2)(A) of such section 1898) in order to develop reports on the quality and
			 efficiency of providers of services (as defined in subsection (u) of section
			 1861 of the Social Security Act (42 U.S.C. 1395x)) and suppliers (as defined in
			 subsection (d) of such section).</text>
				</paragraph><paragraph id="ID8612ef1a095f468aa35dbdb624fb6885"><enum>(3)</enum><text>To coordinate
			 with existing collaborative efforts identifying quality and efficiency health
			 care measures.</text>
				</paragraph><paragraph id="idC82EB71D51D34108985F0F319340969B"><enum>(4)</enum><text>To provide the
			 Secretary of Health and Human Services with recommendations for the development
			 of model quality health care measurements.</text>
				</paragraph><paragraph id="id6C009E989D0F40398757F5CCF13B3D66"><enum>(5)</enum><text>Other duties
			 determined appropriate by the Secretary.</text>
				</paragraph></subsection><subsection commented="no" id="idF4E8AD87BCBB438DA2BB510169377290"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of Health and Human Services such sums as may be necessary for the
			 purpose of carrying out this section.</text>
			</subsection></section><section id="id54628D76665A48678A1CDB447200CF6A"><enum>4.</enum><header>Research access
			 to Medicare data and reporting on performance</header><text display-inline="no-display-inline">The Secretary of Health and Human Services
			 shall permit researchers that meet existing criteria used to evaluate the
			 appropriateness of the release of Centers for Medicare &amp; Medicaid Services
			 (CMS) data for research purposes to—</text>
			<paragraph id="id2EA97717EF20419DAE0A99EDB071D898"><enum>(1)</enum><text display-inline="yes-display-inline">have access to all Medicare data (as
			 defined in section 1898(b)(2)(A) of the Social Security Act, as added by
			 section 2); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BE6CD2F2E3048A283CA821B54C7DAA1"><enum>(2)</enum><text>report on the
			 performance of providers of services (as defined in subsection (u) of section
			 1861 of such Act (42 U.S.C. 1395x)) and suppliers (as defined in subsection (d)
			 of such section), including reporting in a provider- or supplier-identifiable
			 format.</text>
