		<official-title>To amend the Food Stamp Act of 1977 to end benefit
		  erosion, support working families with child care expenses, encourage
		  retirement and education savings, and for other purposes.</official-title>

		<section id="id4D43356645464B638BB82D1F2855A01F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Food Stamp Fairness and Benefit
			 Restoration Act of 2007</short-title></quote>.</text>
		</section><section id="idE4C782814DDA432BA561BD5D4D43F672" section-type="subsequent-section"><enum>2.</enum><header>Ending benefit
			 erosion</header><text display-inline="no-display-inline">Section 5(e)(1) of the
			 Food Stamp Act of 1977 (7 U.S.C. 2014(e)(1)) is amended—</text>
			<paragraph id="ID72895105260e4e99bd2f5e33f897c2f6"><enum>(1)</enum><text>in subparagraph
			 (A)(ii)—</text>
				<subparagraph id="idA74E91BEC4CC4A5BADA5435E90C72343"><enum>(A)</enum><text>by striking
			 <quote>Notwithstanding clause (i)</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0627311C6B3C464AAE7E5BC0C47BC74F" style="OLC">
						<subclause id="idDCDAF6E5EA344E148B4030F9EB80F06D"><enum>(I)</enum><header>In
				general</header><text>Notwithstanding clause (i) and except as provided in
				subclause (II)</text>
						</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idD545D7CED6CD4CFEB7489A35613DF0E4"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB615F386426247C3A2BB5EA9147C6237" style="OLC">
						<subclause id="idE6EF9E80C5574C7EA735BC463A17B8BA"><enum>(II)</enum><header>Inflation
				adjustment</header><text>On October 1, 2008, and each October 1 thereafter,
				each of the amounts specified in subclause (I) shall be adjusted to the nearest
				lower dollar increment to reflect changes for the 12-month period ending on the
				preceding June 30 in the Consumer Price Index for All Urban Consumers published
				by the Bureau of Labor Statistics of the Department of Labor, for items other
				than food.</text>
						</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id82349495D1D54359A8EEA24165819738"><enum>(2)</enum><text>in subparagraph
			 (B)(ii)—</text>
				<subparagraph id="idD7DE8EB410474E57A83C181AC44B0D0C"><enum>(A)</enum><text>by striking
			 <quote>Notwithstanding clause (i)</quote> and inserting the following:</text>

				adjustment</header><text>On October 1, 2008, and each October 1 thereafter, the
				amount specified in subclause (I) shall be adjusted to the nearest lower dollar
				increment to reflect changes for the 12-month period ending on the preceding
				June 30 in the Consumer Price Index for All Urban Consumers published by the

				</subparagraph></paragraph></section><section id="IDb23f5b9c11f64089aa1dc7b2a267f07e"><enum>3.</enum><header>Supporting
			 working families with child care expenses</header><text display-inline="no-display-inline">Section 5(e)(3)(A) of the Food Stamp Act of
			 1977 (7 U.S.C. 2014(e)(3)(A)) is amended by striking <quote>, the maximum
			 allowable level of which shall be $200 per month for each dependent child under
			 2 years of age and $175 per month for each other dependent,</quote>.</text>
		</section><section id="id163335E35A39464BBC7CD9CB5AC767A5"><enum>4.</enum><header>Encouraging
			 retirement and education savings among food stamp recipients</header>
			<subsection id="id1FAEEBFCBF7444278F35BAA950B2019B"><enum>(a)</enum><header>Allowable
			 financial resources</header><text display-inline="yes-display-inline">Section
			 5(g) of the Food Stamp Act of 1977 (7 U.S.C. 2014(g)) is amended—</text>
				<paragraph id="id32606D8AB4914B3781FB09D93CBE5809"><enum>(1)</enum><text>by striking
			 <quote>(g)(1) The Secretary</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id17B0B1D6B5394C5E979FA7C14F93D403" style="OLC">
						<subsection id="id65C9846B0A594513A8B571F836F83123"><enum>(g)</enum><header>Allowable
				financial resources</header>
							<paragraph id="idB435280FD5E546EDBCED6496E6F59A38"><enum>(1)</enum><header>Total
				amount</header>
								<subparagraph id="id3719B6529AA8446B88EFF501DE4D2543"><enum>(A)</enum><header>In
				general</header><text>The
				Secretary</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idB008A521D0564FC5A8195E1D150AFD7A"><enum>(2)</enum><text>in subparagraph
			 (A) (as designated by paragraph (1)—</text>
					<subparagraph id="idDEC23880B2CD4A4887E7B6BE100CDC3B"><enum>(A)</enum><text>by inserting
			 <quote>(as adjusted in accordance with subparagraph (B))</quote> after
			 <quote>$2,000</quote>; and</text>
					</subparagraph><subparagraph id="idE53F149459764A2A9762E5DA6C3EA1D6"><enum>(B)</enum><text>by inserting
			 <quote>(as adjusted in accordance with subparagraph (B))</quote> after
			 <quote>$3,000</quote>; and</text>
					</subparagraph></paragraph><paragraph id="id4CB9DB9FB37841968F22FFE37979D8F3"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id25429A60459A42DFA82F6F56E8B684C2" style="OLC">
						<subparagraph id="id4FFC4390216A42E5A8318DDFA13A5F09"><enum>(B)</enum><header>Adjustment for
				inflation</header>
							<clause id="id77B9BCE691D34614959E1B7575B47451"><enum>(i)</enum><header>In
				general</header><text>Beginning on October 1, 2007, and each October 1
				thereafter, the amounts in subparagraph (A) shall be adjusted to the nearest
				$100 increment to reflect changes for the 12-month period ending the preceding
				June in the Consumer Price Index for All Urban Consumers published by the
				Bureau of Labor Statistics of the Department of Labor.</text>
							</clause><clause id="id75538D6F12CF4DDEBBC7B92162B61BB5"><enum>(ii)</enum><header>Requirement</header><text>Each
				adjustment under clause (i) shall be based on the unrounded amount for the
				prior 12-month
				period.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id7FCE0671319845F781C7BD5D10FAE6FF"><enum>(b)</enum><header>Exclusion of
			 retirement accounts from countable financial resources</header>
				<paragraph id="IDf0a004970a41473193eeb4b8e71dbe49"><enum>(1)</enum><header>In
			 general</header><text>Section 5(g)(2)(B)(v) of the Food Stamp Act of 1977 (7
			 U.S.C. 2014(g)(2)(B)(v)) is amended by striking <quote>or retirement account
			 (including an individual account)</quote> and inserting
			 <quote>account</quote>.</text>
				</paragraph><paragraph id="IDa690a120caac4a40945e2c2001eca67f"><enum>(2)</enum><header>Mandatory and
			 discretionary exclusions</header><text>Section 5(g) of the Food Stamp Act of
			 1977 (7 U.S.C. 2014(g)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF60802315CAB41229C0442C55832C625" style="OLC">
						<paragraph id="ID83ca4a27e5904124a99dc72684cf0d4e"><enum>(7)</enum><header>Exclusion of
				retirement accounts from countable financial resources</header>
							<subparagraph id="idABD1D466993444CA98FAAB87395B161F"><enum>(A)</enum><header>Mandatory
				exclusions</header><text>The Secretary shall exclude from financial resources
				under this subsection the value of any funds in a plan, contract, or account,
				described in sections 401(a), 403(a), 403(b), 408, 408A, 457(b), and 501(c)(18)
				of the Internal Revenue Code of 1986 and the value of funds in a Federal Thrift
				Savings Plan account as provided in section 8439 of title 5, United States
				Code.</text>
							</subparagraph><subparagraph id="id2A9C9BD5EB1D4FC1B3DFD19DBCD2D05B"><enum>(B)</enum><header>Discretionary
				exclusions</header><text>The Secretary may exclude from financial resources
				under this subsection the value of any other retirement plans, contracts, or
				accounts (as determined by the Secretary through
				regulation).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idA7FA6091650145998A2897E03958F637"><enum>(c)</enum><header>Exclusion of
			 education accounts from countable financial resources</header><text display-inline="yes-display-inline">Section 5(g) of the Food Stamp Act of 1977
			 (7 U.S.C. 2014(g)) (as amended by subsection (b)) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1CC244E191F041D897EEBF096A9C8168" style="OLC">
					<paragraph id="id7A4326450B19466D9F6F7762FFEEF415"><enum>(8)</enum><header>Exclusion of
				education accounts from countable financial resources</header>
						<subparagraph id="idEA2B3A0D4FEA43E986B68B898E4A0AFE"><enum>(A)</enum><header>Mandatory
				exclusions</header><text>The Secretary shall exclude from financial resources
				under this subsection the value of any funds in a qualified tuition program
				described in section 529 of the Internal Revenue Code of 1986 or in a Coverdell
				education savings account under section 530 of that Code.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEDF6E3B5836D4AF9A6FE7AFB701B64D7"><enum>(B)</enum><header>Discretionary
				exclusions</header><text>The Secretary may exclude from financial resources
				under this subsection the value of any other education programs, contracts, or
				accounts (as determined by the Secretary through
				regulation).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" id="IDe11d8b8adcab4056b05ea0d8eef44e74"><enum>5.</enum><header>Fairness for
			 legal immigrants</header>
			<subsection commented="no" id="id15451A3B40364C7CABAAD98FB877130B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 6 of the Food
			 Stamp Act of 1977 (7 U.S.C. 2015) is amended by striking subsection (f) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id649200E532484C6394861CE82ACF09FC" style="OLC">
					<subsection id="IDa0cbfd27d22d4a89b8efa64f2026136e"><enum>(f)</enum><header>Aliens</header>
						<paragraph id="ID791248ca65374e98bce73fc4c43f6262"><enum>(1)</enum><header>Eligibility</header><text>—Notwithstanding
				sections 401(a), 402(a), and 403(a) of the Personal Responsibility and Work
				Opportunity Reconciliation Act of 1996 (8 U.S.C. 1611(a), 1612(a), 1613(a)), an
				alien who is lawfully residing in the United States may not be ineligible for
				the food stamp program on the basis of—</text>
							<subparagraph id="ID57aec956f7d9428c8438a0a82be960d7"><enum>(A)</enum><text>the immigration
				status of the alien; or</text>
							</subparagraph><subparagraph id="ID884c8839269244c5821c4b51943f307d"><enum>(B)</enum><text>the date the
				alien entered the United States.</text>
							</subparagraph></paragraph><paragraph id="IDff91e5e092aa48d8b0e6c8f57296af6c"><enum>(2)</enum><header>Consideration
				of income</header><text>The income (less, at State option, a pro rata share)
				and financial resources of the individual rendered ineligible to participate in
				the food stamp program under this subsection shall be considered in determining
				the eligibility and the value of the allotment of the household of which the
				individual is a
				member.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="ID7a3e1d13183d424888a767115b0cac72"><enum>(b)</enum><header>Clarifying
			 eligibility</header><text display-inline="yes-display-inline">Section 421(d)(3)
			 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996
			 (8 U.S.C. 1631(d)(3)) is amended by striking <quote>to the extent that a
			 qualified alien is eligible under section 1612(a)(2)(J) of this title</quote>
			 and inserting <quote>to the extent that a child is a member of a household
			 receiving food stamps under that Act</quote>.</text>
			</subsection><subsection id="ID8d578c37181949e4af95f57b4a7b8b4e"><enum>(c)</enum><header>Ensuring proper
			 screening</header><text display-inline="yes-display-inline">Section 11(e)(2)(B)
			 of the Food Stamp Act of 1977 (7 U.S.C. 2020(e)(2)(B)) is amended—</text>
				<paragraph id="ID30ebfc6357e74dfda0f72c0947fb7ba7"><enum>(1)</enum><text>by redesignating
			 clauses (vi) and (vii) as clauses (vii) and (viii), respectively; and</text>
				</paragraph><paragraph id="ID87856bf182fd40859361569fc5975739"><enum>(2)</enum><text>by inserting
			 after clause (v) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id212DB1BDA6884E61A54630CC587F4855" style="OLC">
						<clause id="id1D0D100058464412AFF964878FE7A6AF"><enum>(vi)</enum><text>shall provide a
				method for implementing section 421 of the Personal Responsibility and Work
				Opportunity Reconciliation Act of 1996 (8 U.S.C. 1631) that does not require
				any unnecessary information from individuals who may be exempt from that
				section;</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID56701934f1954432a5d3a8327cae61df"><enum>(d)</enum><header>Simplified
			 administrative reporting requirement</header><text display-inline="yes-display-inline">Section 11(a) of the Food Stamp Act of 1977
			 (7 U.S.C. 2020(a)) is amended by adding at the end the following:
			 <quote>Notwithstanding subsection (e)(2) of section 421 of the Personal
			 Responsibility and Work Opportunity Reconciliation Act of 1996 (8 U.S.C.
			 1631(e)(2)), the administrative reporting requirement under that subsection
			 shall be satisfied by the submission of an aggregate report on the numbers of
			 exceptions granted under that subsection each year.</quote>.</text>
			</subsection></section><section id="id0215939690454790902C4FE066C7BEA8"><enum>6.</enum><header>Food stamp
			 eligibility for unemployed adults</header><text display-inline="no-display-inline">Section 6(o)(2) of the Food Stamp Act of
			 1977 (7 U.S.C. 2015(o)(2)) is amended in the matter preceding subparagraph
			 (A)—</text>
			<paragraph id="IDac86b30cda0b4ac5b0f51f8863ac74df"><enum>(1)</enum><text>by striking
			 <quote>36-month</quote> and replacing it with <quote>24-month</quote>;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd6bb5ba40b604ed7b58e8a689522d0d8"><enum>(2)</enum><text>by striking
			 <quote>3</quote> and replacing it with <quote>6</quote>.</text>
			</paragraph></section><section id="ID5d8ba4b3f58d46e2bcb669e49471f741"><enum>7.</enum><header>Availability of
			 commodities for the emergency food assistance program</header><text display-inline="no-display-inline">Section 27(a) of the Food Stamp Act of 1977
			 (7 U.S.C. 2036(a)) is amended—</text>
			<paragraph id="IDc08ef195f0544f379b1f47df2c73f3b9"><enum>(1)</enum><text>by striking
			 <quote>(a) <header-in-text level="subsection" style="OLC">Purchase of
			 commodities</header-in-text></quote> and all that follows through
			 <quote>through 2007</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF71F834DDD734A22A3C130A478FF0D97" style="OLC">
					<subsection id="IDc1c6fc9edc89462699f892d98c01efa6"><enum>(a)</enum><header>Purchase of
				commodities</header>
						<paragraph id="ID253b31a553c040c2b662e1a35ec48223"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), for each of fiscal years 2008
				through
				2012;</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="IDd517c7d9786f430aacb6b5ea58f8428e"><enum>(2)</enum><text>by striking
			 <quote>$140,000,000 of</quote>; and</text>
			</paragraph><paragraph id="IDae21e48be3f74c4a84d85cada9ca4851"><enum>(3)</enum><text>by inserting at
			 the end the following:</text>
