		<section id="id610405C8D4CC422180E5F49B62D88732" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Super-Efficient Appliance Incentives
			 and Market Transformation Act of 2007</short-title></quote>.</text>
		</section><section id="id28048004DED74DCC9BA4C0C81097584E" section-type="subsequent-section"><enum>2.</enum><header>Modifications of
			 energy efficient appliance credit for appliances produced after 2007</header>
			<subsection id="idA9193B7420364B5299F99AC580DF8EB5"><enum>(a)</enum><header>In
			 general</header><text>Section 45M of the Internal Revenue Code of 1986 is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id45F47940D2D04B8BAFACBB28C225E56B" style="OLC">
					<section id="id8EE2ABDEAC1A43EB905F55ABBC9D3B81"><enum>45M.</enum><header>Energy
				efficient appliance credit</header>
						<subsection id="ID6d9927ccfa144df09225cb2fc3cbc8b6"><enum>(a)</enum><header>General
				rule</header>
							<paragraph id="ID7e33adf1c698460db4470e69f16ca773"><enum>(1)</enum><header>In
				general</header><text>For purposes of section 38, the energy efficient
				appliance credit determined under this section for any taxable year is an
				amount equal to the sum of the credit amounts determined under paragraph (2)
				for each type of qualified energy efficient appliance produced by the taxpayer
				during the calendar year ending with or within the taxable year.</text>
							</paragraph><paragraph id="ID812397498bc94e9f96d36f5d87ec89cf"><enum>(2)</enum><header>Credit
				amounts</header><text>The credit amount determined for any type of qualified
				energy efficient appliance is—</text>
								<subparagraph id="ID67abcc5524934bd4b2a71be43ece3e9f"><enum>(A)</enum><text>the applicable
				amount determined under subsection (b) with respect to such type, multiplied
				by</text>
								</subparagraph><subparagraph id="ID495ff18a1ba04b589d86415ae7ce1bae"><enum>(B)</enum><text>the eligible
				production for such type.</text>
								</subparagraph></paragraph></subsection><subsection id="ID68267f14a4af45049dea08d67d986234"><enum>(b)</enum><header>Applicable
				amount</header><text>For purposes of subsection (a)—</text>
							<paragraph id="ID2c7ec74f1e204f999c8de3e373aa1c83"><enum>(1)</enum><header>Dishwashers</header><text>The
				applicable amount is—</text>
								<subparagraph id="ID54e4845254c9465ca9671d61b4112b3b"><enum>(A)</enum><text>$45 in the case
				of a residential model dishwasher which—</text>
									<clause id="idE510509BD2D14DF0AA5E56026190D543"><enum>(i)</enum><text>is manufactured
				in calendar year 2008 or 2009, and</text>
									</clause><clause id="id2FA4880270F04E1488E54DC5331CB793"><enum>(ii)</enum><text>uses not more
				than 324 kilowatt hours per year and 5.8 gallons per cycle, and</text>
									</clause></subparagraph><subparagraph id="ID6bdc56c265274e6898c2afc16b48c65d"><enum>(B)</enum><text>$75 in the case
				of a residential model dishwasher which—</text>
									<clause id="id52CC89080BAC4E4797AA478717184FA9"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, 2009, or 2010, and</text>
									</clause><clause id="idD915F6725F3946D8ADEEDEB39BEC336F"><enum>(ii)</enum><text>uses not more
				than 307 kilowatt hours per year and 5.0 gallons per cycle (5.5 gallons for
				dishwashers designed for greater than 12 place settings).</text>
									</clause></subparagraph></paragraph><paragraph id="ID918e69785a0940709a8883760237b553"><enum>(2)</enum><header>Clothes
				washers</header><text>The applicable amount is—</text>
								<subparagraph id="ID60cbd50084b24bdd975c95c9a6228ed3"><enum>(A)</enum><text>$75 in the case
				of a residential model top-loading clothes washer which—</text>
									<clause id="id6D88A521687D4932B8B90E3986ADE959"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, and</text>
									</clause><clause id="id8F1258B0C0844F019DCA88B9C933DB41"><enum>(ii)</enum><text>meets or exceeds
				a 1.72 MEF and does not exceed an 8.0 water consumption factor,</text>
									</clause></subparagraph><subparagraph id="IDac7bb92c11454f229530f542f99a224c"><enum>(B)</enum><text>$125 in the case
				of a residential model top-loading clothes washer which—</text>
									<clause id="id929A1ACF4EF14486A2A773F50C13C7F1"><enum>(i)</enum><text>is manufactured
				in calendar year 2008 or 2009, and</text>
									</clause><clause id="id31CE7126765940EFBCAD2A58C58F7D7B"><enum>(ii)</enum><text>meets or exceeds
				a 1.8 MEF and does not exceed a 7.5 water consumption factor,</text>
									</clause></subparagraph><subparagraph id="ID101fabcd537f470f91aae400651ab1c7"><enum>(C)</enum><text>$150 in the case
				of a residential or commercial model clothes washer which—</text>
									<clause id="id5C77B7D672D94C09981F0D45CBD473D6"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, 2009, or 2010, and</text>
									</clause><clause id="id611366E1DB484DDBB1A702D84B2F33D4"><enum>(ii)</enum><text>meets or exceeds
				2.0 MEF and does not exceed a 6.0 water consumption factor, and</text>
									</clause></subparagraph><subparagraph id="ID885c48752e15434bbba9684ed1931f41"><enum>(D)</enum><text>$250 in the case
				of a residential or commercial model clothes washer which—</text>
									<clause id="id833356E0B06D4743A83B9819E8579BA8"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, 2009, or 2010, and</text>
									</clause><clause id="id4E37542A7A684B3394342B504966944D"><enum>(ii)</enum><text>meets or exceeds
				2.2 MEF and does not exceed a 4.5 water consumption factor.</text>
									</clause></subparagraph></paragraph><paragraph id="IDaa59f1d21f544170a4586664243ccc7d"><enum>(3)</enum><header>Refrigerators</header><text>The
				applicable amount is—</text>
								<subparagraph id="IDc705bb5879ee4646bb2bd1fc9caaf731"><enum>(A)</enum><text>$50 in the case
				of a residential model refrigerator which—</text>
									<clause id="id80ED189C70E345278063419FD1B5A1B6"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, and</text>
									</clause><clause id="id7FEADC9E91D8431A9B67FDCDDAC2BBAE"><enum>(ii)</enum><text>consumes at
				least 20 percent, but not more than 22.9 percent, less kilowatt hours per year
				than the 2001 energy conservation standards,</text>
									</clause></subparagraph><subparagraph id="ID9720be647b574a66898eb98d1f1a7971"><enum>(B)</enum><text>$75 in the case
				of a residential model refrigerator which—</text>
									<clause id="idF4E285CF5B5C41FFB6A3ACE0C1C0EDBF"><enum>(i)</enum><text>is manufactured
				in calendar year 2008 or 2009, and</text>
									</clause><clause id="id3E4EB77F0E534B4195CC8188079CE40C"><enum>(ii)</enum><text>consumes at
				least 23 percent, but not more than 24.9 percent, less kilowatt hours per year
				than the 2001 energy conservation standards,</text>
									</clause></subparagraph><subparagraph id="ID9a6c16ded14e46d78713037845f9ba1f"><enum>(C)</enum><text>$100 in the case
				of a residential model refrigerator which—</text>
									<clause id="id348CEEE69FE74E238515CA3411E49434"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, 2009, or 2010, and</text>
									</clause><clause id="id5C35CBDDA9384FB195F2B9F1FD805F55"><enum>(ii)</enum><text>consumes at
				least 25 percent, but not more than 29.9 percent, less kilowatt hours per year
				than the 2001 energy conservation standards, and</text>
									</clause></subparagraph><subparagraph id="ID721485cb65234f9fa897fe0c89829e12"><enum>(D)</enum><text>$200 in the case
				of a residential model refrigerator which—</text>
									<clause id="idF45DBE0EF5EB4D97AAE19EFBBCB36B00"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, 2009, or 2010, and</text>
									</clause><clause id="id6ADFF0FA239D4495B55AF6D139C7FDA5"><enum>(ii)</enum><text>consumes at
				least 30 percent less kilowatt hours per year than the 2001 energy conservation
				standards.</text>
									</clause></subparagraph></paragraph><paragraph id="ID82dbfceeadac4297a5dc5da5f02453ff"><enum>(4)</enum><header>Dehumidifiers</header><text>The
				applicable amount is—</text>
								<subparagraph id="ID79a4e1e9b7f04d3faace4c65f81965cd"><enum>(A)</enum><text>$15 in the case
				of a dehumidifier which—</text>
									<clause id="id1C8D20C5AC0042F89E612E5860F57565"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, and</text>
									</clause><clause id="idFD2A7D5F728648789FC3CFF289B8CDE8"><enum>(ii)</enum><text>has a capacity
				less than or equal to 45 pints per day and is 7.5 percent more efficient than
				the applicable Department of Energy energy conservation standard effective
				October 2012, and</text>
									</clause></subparagraph><subparagraph id="ID17312af8e1c24cc8864d211cde4c98de"><enum>(B)</enum><text>$25 in the case
				of a dehumidifier which—</text>
									<clause id="idA17C85C9EEC84632B092E3314A2B0535"><enum>(i)</enum><text>is manufactured
				in calendar year 2008, and</text>
									</clause><clause id="id7A29708ED74F487FB87CA46A26794E94"><enum>(ii)</enum><text>has a capacity
				greater than 45 pints per day and is 7.5 percent more efficient than such
				conservation standard.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID9efbc371bec94a91b49408e45ec3855f"><enum>(c)</enum><header>Eligible
				production</header><text>The eligible production in a calendar year with
				respect to each type of qualified energy efficient appliance is the excess
				of—</text>
							<paragraph id="ID2f4f87500624431e987d6989b22638c4"><enum>(1)</enum><text>the number of
				appliances of such type which are produced by the taxpayer for sale within the
				United States during such calendar year, over</text>
							</paragraph><paragraph id="ID44059fdac9234702a680b8f278be6145"><enum>(2)</enum><text>the average
				number of appliances of such type which were produced by the taxpayer (or any
				predecessor) for sale within the United States during the preceding 2-calendar
				year period.</text>
							</paragraph></subsection><subsection id="ID40bea2244ee54df491259ef73547d17f"><enum>(d)</enum><header>Types of
				qualified energy efficient appliances</header><text>For purposes of this
				section, the types of qualified energy efficient appliances are—</text>
							<paragraph id="ID696531b541df483b9299453f05e232fd"><enum>(1)</enum><text>dishwashers
				described in subsection (b)(1),</text>
							</paragraph><paragraph id="IDce6e1d33a71a4a369b0541be78f1d86a"><enum>(2)</enum><text>clothes washers
				described in subsection (b)(2),</text>
							</paragraph><paragraph id="IDae43913ccbc04e01b11ee4b889f49915"><enum>(3)</enum><text>refrigerators
				described in subsection (b)(3), and</text>
							</paragraph><paragraph id="idFF78F4346BAB48788361DAD6E1BB7DBF"><enum>(4)</enum><text>dehumidifiers
				described in subsection (b)(4).</text>
							</paragraph></subsection><subsection id="idD9B78AFB86A047FE926C402AB46D44EF"><enum>(e)</enum><header>Limitations</header>
							<paragraph id="ID6fe4f1971a5740ca88d6a6d3b7bf08c8"><enum>(1)</enum><header>Aggregate
				credit amount allowed</header><text>Except as provided in paragraph (2), the
				aggregate amount of credit allowed under subsection (a) with respect to a
				taxpayer for any taxable year shall not exceed $100,000,000 reduced by the
				amount of the credit allowed under subsection (a) to the taxpayer (or any
				predecessor) for all prior taxable years beginning after December 31,
				2007.</text>
							</paragraph><paragraph id="ID4c371eaa79b74549ab7b538e20e42ad9"><enum>(2)</enum><header>Amount allowed
				for certain clothes washers and refrigerators</header><text>For purposes of
				paragraph (1), clothes washers described in subsection (b)(2)(D) and
				refrigerators described in subsection (b)(3)(D) shall not be taken into
				account.</text>
							</paragraph><paragraph id="IDf2a900654a7046f7aaf156a576d31d5d"><enum>(3)</enum><header>Limitation
				based on gross receipts</header><text>The credit allowed under subsection (a)
				with respect to a taxpayer for the taxable year shall not exceed an amount
				equal to 2 percent of the average annual gross receipts of the taxpayer for the
				3 taxable years preceding the taxable year in which the credit is determined
				beginning after December 31, 2007.</text>
							</paragraph><paragraph id="ID5d517eb6a3ca41c9b84d05a85bb0d978"><enum>(4)</enum><header>Gross
				receipts</header><text>For purposes of this subsection, the rules of paragraphs
				(2) and (3) of section 448(c) shall apply.</text>
							</paragraph></subsection><subsection id="IDa1badcaf7cf74cec9d3ce09b3f7dcb78"><enum>(f)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
							<paragraph id="ID960504ee1e2e40b4906f34ab9d84c5c8"><enum>(1)</enum><header>Dishwasher</header><text>The
				term <term>dishwasher</term> means a dishwasher subject to the energy
				conservation standards established by the Department of Energy.</text>
							</paragraph><paragraph id="ID32847c68c6584920905e3b0703c593d8"><enum>(2)</enum><header>Clothes
				washer</header><text>The term <term>clothes washer</term> includes a clothes
				washer subject to the energy conservation standards established by the
				Department of Energy.</text>
							</paragraph><paragraph id="ID991abab3f87e470880d6cbec0fe17f69"><enum>(3)</enum><header>Top-loading
				clothes washer</header><text>The term <term>top-loading clothes washer</term>
				means a clothes washer with the clothes container compartment access located on
				the top of the machine.</text>
							</paragraph><paragraph id="IDef5ab44c8abf43839a2d55a08e58663e"><enum>(4)</enum><header>Refrigerator</header><text>The
				term <term>refrigerator</term> means an automatic defrost refrigerator-freezer
				which has an internal volume of at least 16.5 cubic feet.</text>
							</paragraph><paragraph id="ID959e3dc594ba4b47b8d881fd5f42c23d"><enum>(5)</enum><header>Dehumidifier</header><text>The
				term <term>dehumidifier</term> means a self-contained, electrically operated,
				and mechanically refrigerated encased assembly consisting of—</text>
								<subparagraph id="IDf06a17d2da0b4d46bb6d45207c3b50ec"><enum>(A)</enum><text>a refrigerated
				surface that condenses moisture from the atmosphere,</text>
								</subparagraph><subparagraph id="ID4034da1b1e2e456f8fb5889d5e36c559"><enum>(B)</enum><text>a refrigerating
				system, including an electric motor,</text>
								</subparagraph><subparagraph id="IDed027a843f4d4098ac1611248f835c8f"><enum>(C)</enum><text>an
				air-circulating fan, and</text>
								</subparagraph><subparagraph id="IDc228d0999be84a6db7c03c5c95c411be"><enum>(D)</enum><text>means for
				collecting or disposing of condensate.</text>
								</subparagraph></paragraph><paragraph id="IDa274f6df5a7446c0b5985801eec26191"><enum>(6)</enum><header>Gallons per
				cycle</header><text>The term <term>gallons per cycle</term> means the amount of
				water, expressed in gallons, required to complete a normal cycle of a
				dishwasher.</text>
							</paragraph><paragraph id="ID300bca8f6619483eb1c041f07679c90d"><enum>(7)</enum><header>MEF</header><text>The
				term <term>MEF</term> means the modified energy factor established by the
				Department of Energy for compliance with the Federal energy conservation
				standard.</text>
							</paragraph><paragraph id="id55E3B44ECD6340E7BE78EA3D1A4F366F"><enum>(8)</enum><header>Water
				consumption factor</header><text>The term <term>water consumption factor</term>
				means the quotient of the total weighted per-cycle water consumption divided by
				the cubic foot capacity of the clothes washer.</text>
							</paragraph><paragraph id="ID418fbbe06e07444d848831b4810486e2"><enum>(9)</enum><header>2001 energy
				conservation standard</header><text>The term <term>2001 energy conservation
				standard</term> means the energy conservation standards promulgated by the
				Department of Energy and effective July 1, 2001.</text>
							</paragraph></subsection><subsection id="ID2104091456fb4a42a19f5bd9e0786356"><enum>(g)</enum><header>Special
				rules</header><text>For purposes of this section:</text>
							<paragraph id="IDc5867663e8c64c9da7b51a6dbe9f5e69"><enum>(1)</enum><header>In
				general</header><text>Rules similar to the rules of subsections (c), (d), and
				(e) of section 52 shall apply.</text>
							</paragraph><paragraph id="ID7481a1067d6f47c98b25ee5e80a812d9"><enum>(2)</enum><header>Controlled
				group</header>
								<subparagraph id="IDba5ed2f59ad149208b0a46d68987396f"><enum>(A)</enum><header>In
				general</header><text>All persons treated as a single employer under subsection
				(a) or (b) of section 52 or subsection (m) or (o) of section 414 shall be
				treated as a single producer.</text>
								</subparagraph><subparagraph id="IDd42886b7b7ff4de1b6ded137235f850b"><enum>(B)</enum><header>Inclusion of
				foreign corporations</header><text>For purposes of subparagraph (A), in
				applying subsections (a) and (b) of section 52 to this section, section 1563
				shall be applied without regard to subsection (b)(2)(C) thereof.</text>
								</subparagraph></paragraph><paragraph id="ID3f78390bf85e4fe3b3011d9f9cf80a29"><enum>(3)</enum><header>Verification</header><text>No
				amount shall be allowed as a credit under subsection (a) with respect to which
				the taxpayer has not submitted such information or certification as the
				Secretary, in consultation with the Secretary of Energy, determines
				necessary.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID55a9f1b7caa644269d30e92acb310fc2"><enum>(b)</enum><header>Credit allowed
			 against the alternative minimum tax</header><text>Section 38(c)(4)(B) of the
			 Internal Revenue Code of 1986 (relating to specified credits) is
			 amended—</text>
				<paragraph id="idBEA20C7B65F94DCB86DBDD3C793002AF"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of clause (i),</text>
				</paragraph><paragraph id="idA32BC5EEC1B04055B9783D025C4DDEA4"><enum>(2)</enum><text>by striking the
			 period at the end of clause (ii)(II) and inserting <quote>, and</quote>,
			 and</text>
				</paragraph><paragraph id="idEDC67BF23E3C4D3F958AB2639C8C650D"><enum>(3)</enum><text>by adding at the
			 end the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="idD20B80E5A9E74E85B7DC87DF102B8035" style="OLC">
						<clause id="ID4ceb6b14d6e44befbdd0095482e63800"><enum>(iii)</enum><text>for taxable
				years beginning after December 31, 2007, the credit determined under section
				45M.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDbc4f7e22786b4252be7518e8599da7ec"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 appliances produced after December 31, 2007.</text>
