			 <quote><short-title>Protecting Pregnant Women and Children
			 From Perchlorate Act of 2007</short-title></quote>.</text>

			<subsection commented="no" display-inline="no-display-inline" id="ID220a674aa2df48a9b02fd9e35400bd22"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDc909724ea7954dd4918c3133bdd08780"><enum>(1)</enum><text display-inline="yes-display-inline">perchlorate—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id84138303E854424B9990789EBC10999B"><enum>(A)</enum><text display-inline="yes-display-inline">is a chemical used as the primary
			 ingredient of solid rocket propellant; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF3862F49373745499046960A46F0DE19"><enum>(B)</enum><text display-inline="yes-display-inline">is also used in fireworks, road flares, and
			 other applications;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID420b57bc528f409ea3d9d434d92fc97a"><enum>(2)</enum><text display-inline="yes-display-inline">waste from the manufacture and improper
			 disposal of chemicals containing perchlorate is increasingly being discovered
			 in soil and water;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID780a683a08a64a64abbdd59d6bdc353b"><enum>(3)</enum><text display-inline="yes-display-inline">according to the Government Accountability
			 Office, perchlorate contamination has been detected in water and soil at almost
			 400 sites in the United States, with concentration levels ranging from 4 parts
			 per billion to millions of parts per billion;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID68eac4bc27444fea85e8719d6bdbbe94"><enum>(4)</enum><text display-inline="yes-display-inline">the Government Accountability Office has
			 determined that the Environmental Protection Agency does not centrally track or
			 monitor perchlorate detections or the status of perchlorate cleanup, so a
			 greater number of contaminated sites may already exist;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5d999186fee04c328f995325b0fffadf"><enum>(5)</enum><text display-inline="yes-display-inline">according to the Government Accountability
			 Office, limited Environmental Protection Agency data show that perchlorate has
			 been found in 35 States and the District of Columbia and is known to have
			 contaminated 153 public water systems in 26 States;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd94b4510d14243c2800415885eca22ff"><enum>(6)</enum><text display-inline="yes-display-inline">those data are likely underestimates of
			 total drinking water exposure, as illustrated by the finding of the California
			 Department of Health Services that perchlorate contamination sites have
			 affected approximately 276 drinking water sources and 77 drinking water systems
			 in the State of California alone;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0526c09ba14d45278f9db5df9da9e2aa"><enum>(7)</enum><text display-inline="yes-display-inline">Food and Drug Administration scientists and
			 other scientific researchers have detected perchlorate in the United States
			 food supply, including in lettuce, milk, cucumbers, tomatoes, carrots,
			 cantaloupe, wheat, and spinach, and in human breast milk;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID205b255e830d4e999b81428717810610"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id981258D1907844AC9E28909EC5934080"><enum>(A)</enum><text display-inline="yes-display-inline">perchlorate can harm human health,
			 especially in pregnant women and children, by interfering with uptake of iodide
			 by the thyroid gland, which is necessary to produce important hormones that
			 help control human health and development;</text>
					</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id40919837FA7A4944AF68A0FABCAD1B26" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">in adults, the thyroid helps to regulate
			 metabolism;</text>
					</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id72D8A69E2D2E4DB3A6FE077DBE6346B6" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">in children, the thyroid helps to ensure
			 proper mental and physical development; and</text>
					</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id8E3E9BAEBB734A648E2D4331F53BEE16" indent="up1" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">impairment of thyroid function in expectant
			 mothers or infants may result in effects including delayed development and
			 decreased learning capability;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID66963bf20dd44cb992a3eb84840d87b1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB56593DBD278407C8A13B14E785F9115"><enum>(A)</enum><text display-inline="yes-display-inline">in October 2006, researchers from the
			 Centers for Disease Control and Prevention published the largest, most
			 comprehensive study to date on the effects of low levels of perchlorate
			 exposure in women, finding that—</text>
						<clause changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="idD6FC8A856F9B4C3D81DC5568360D0CF4" indent="up1" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">significant changes existed in thyroid
			 hormones in women with low iodine levels who were exposed to perchlorate;
			 and</text>
						</clause><clause changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="idF77718E6E50D41E4B184A0054AABFBD0" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">even low-level perchlorate exposure may
			 affect the production of hormones by the thyroid in iodine-deficient women;
			 and</text>
						</clause></subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="idF37AC6AC2893433192DEEAD5FE8222AB" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">in the United States, about 36 percent of
			 women have iodine levels equivalent to or below the levels of the women in the
			 study described in subparagraph (A); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID15bb961e33634cca9a7389271603bec4"><enum>(10)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency has not
			 established a health advisory or national primary drinking water regulation for
			 perchlorate, but instead established a <quote>Drinking Water Equivalent
			 Level</quote> of 24.5 parts per billion for perchlorate, which—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id90C42EFCEBC74BA49A861C79F22C9D38"><enum>(A)</enum><text display-inline="yes-display-inline">does not take into consideration all routes
			 of exposure to perchlorate;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id890CD054D9CF40D0B737CDCF62357BE5"><enum>(B)</enum><text display-inline="yes-display-inline">has been criticized by experts as failing
			 to sufficiently consider the body weight, unique exposure, and vulnerabilities
			 of certain pregnant women and fetuses, infants, and children; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id924E90C8710C4FD6B258B6078D3E35DF"><enum>(C)</enum><text display-inline="yes-display-inline">is based primarily on a small study and
			 does not take into account new, larger studies of the Centers for Disease
			 Control and Prevention or other data indicating potential effects at lower
			 perchlorate levels than previously found.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID58555bc497bf46848bbcaa03589b30da"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDb6787759753c49d3a63b6b6e449165f2"><enum>(1)</enum><text display-inline="yes-display-inline">to require the Administrator of the
			 Environmental Protection Agency to establish, by not later than 90 days after
			 the date of enactment of this Act, a health advisory for perchlorate in
			 drinking water that fully protects pregnant women, fetuses, infants, and
			 children, taking into consideration body weight and exposure patterns and all
			 routes of exposure to perchlorate; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID877bd1e6df0340219943d72bda0bdc3b"><enum>(2)</enum><text display-inline="yes-display-inline">to require the Administrator of the
			 Environmental Protection Agency to establish promptly a national primary
			 drinking water regulation for perchlorate that fully protects pregnant women,
			 fetuses, infants, and children, taking into consideration body weight and
			 exposure patterns and all routes of exposure to perchlorate.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="ID686589d38ebf4e9a87416a123d93d867" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Health advisory and national primary
			 drinking water regulation for perchlorate</header><text display-inline="no-display-inline">Section 1412(b)(12) of the Safe Drinking
			 Water Act (42 U.S.C. 300g–1(b)(12)) is amended by adding at the end the
			 following:</text>
			<quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="idC68ED4F54FBB4780B8C6F6C16D64426A" reported-display-style="strikethrough" style="OLC">
				<subparagraph commented="no" display-inline="no-display-inline" id="IDca17eaed8ddc40dfbdca12a62acf9260"><enum>(C)</enum><header display-inline="yes-display-inline">Perchlorate</header>
					<clause commented="no" display-inline="no-display-inline" id="IDcc7d5d2bc2d943e588accd41a1e578c2"><enum>(i)</enum><header display-inline="yes-display-inline">Schedule, health advisory, and
				standard</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this section, the Administrator shall publish a health
				advisory and promulgate a national primary drinking water regulation for
				perchlorate, in accordance with the schedule and provisions established by this
				subparagraph, that fully protect, with an adequate margin of safety, the health
				of vulnerable persons (including pregnant women, fetuses, infants, and
				children), taking into consideration body weight, exposure patterns, and all
				routes of exposure.</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDbf8c675addd14465aa181db710988b50"><enum>(ii)</enum><header display-inline="yes-display-inline">Health advisory</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				enactment of this subparagraph, the Administrator shall publish a health
				advisory for perchlorate in accordance with clause (i).</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDabdf7efc67674f7ebb74ed7fca6de2d8"><enum>(iii)</enum><header display-inline="yes-display-inline">Proposed regulations</header><text display-inline="yes-display-inline">Not later than August 1, 2007, the
				Administrator shall propose a national primary drinking water regulation for
				perchlorate in accordance with clause (i).</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDe7ae8e1cebe34fdcae8a99fb0251ed5c"><enum>(iv)</enum><header display-inline="yes-display-inline">Final regulations</header><text display-inline="yes-display-inline">Not later than December 31, 2007, after
				providing notice and an opportunity for public comment, the Administrator shall
				promulgate a national primary drinking water regulation for perchlorate in
				accordance with clause
				(i).</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph><subparagraph changed="added" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id83933afb-8f03-41fb-a227-3b6090bf70da" indent="up1" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">impairment of thyroid function in expectant
			 mothers or infants may result in effects including delayed development and

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a25e496-9fa0-4bfa-ad6f-787d3041a36b"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id562c5867-752c-4e03-b2bc-680fb47d9f32"><enum>(A)</enum><text display-inline="yes-display-inline">in October 2006, researchers from the
			 Centers for Disease Control and Prevention published the largest, most

						</clause></subparagraph><subparagraph changed="added" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id915a1a7d-1be5-4ad1-be7b-31600d54a339" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">in the United States, about 36 percent of
			 women have iodine levels equivalent to or below the levels of the women in the
			 study described in subparagraph (A); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43e4e680-268c-4bda-b543-c52bb6b6ac80"><enum>(10)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency has not
			 established a health advisory or national primary drinking water regulation for
			 perchlorate, but instead established a <quote>Drinking Water Equivalent
			 Level</quote> of 24.5 parts per billion for perchlorate, which—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idb6a93816-599a-4ea5-842a-f8ac6df59a2a"><enum>(A)</enum><text display-inline="yes-display-inline">does not take into consideration all routes
			 of exposure to perchlorate;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97578c8c-6a77-4d9a-946c-7393cf76eec3"><enum>(B)</enum><text display-inline="yes-display-inline">has been criticized by experts as failing
			 to sufficiently consider the body weight, unique exposure, and vulnerabilities

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5095d4bf-1d5f-4591-84a5-90c6a6144246"><enum>(C)</enum><text display-inline="yes-display-inline">is based primarily on a small study and
			 does not take into account new, larger studies of the Centers for Disease
			 Control and Prevention or other data indicating potential effects at lower
			 perchlorate levels than previously found.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8f320101-802e-42b9-8830-758ae8e37c84"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idacb6dd5b-52e4-4f56-9428-c9a975ca1d7d"><enum>(1)</enum><text display-inline="yes-display-inline">to require the Administrator of the
			 Environmental Protection Agency to establish, by not later than 90 days after
			 the date of enactment of this Act, a health advisory for perchlorate in
			 drinking water that—</text>
					<subparagraph id="ID60bfe59547734398804f1ccbc7523573"><enum>(A)</enum><text>is fully protective of,
			 and considers, the body weight and exposure patterns of pregnant women,
			 infants, and children;</text>
					</subparagraph><subparagraph id="ID94f37f3d7dc14108815c97db0f07dcf6"><enum>(B)</enum><text>provides an adequate
			 margin of safety; and</text>
					</subparagraph><subparagraph id="ID573de795a02d4a209771b52e92df57d7"><enum>(C)</enum><text>takes into account all
			 routes of exposure to perchlorate;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5bbb24da-222d-4845-94c1-2694dc40a62c"><enum>(2)</enum><text display-inline="yes-display-inline">to require the Administrator of the
			 Environmental Protection Agency to establish not later than 18 months after the
			 date of enactment of this Act a national primary drinking water regulation for
			 perchlorate that fully protects pregnant women, infants, and children, taking
			 into consideration body weight, exposure patterns, and all routes of exposure
			 to perchlorate.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="ida906f1b9-51e3-4494-a9c1-6f67be4109e8" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Health advisory and national primary
			 drinking water regulation for perchlorate</header><text display-inline="no-display-inline">Section 1412(b)(12) of the Safe Drinking
			 Water Act (42 U.S.C. 300g–1(b)(12)) is amended by adding at the end the
			 following:</text>

					<clause commented="no" display-inline="no-display-inline" id="id3969c735-74a0-4fc1-9ad3-1e9f747a4662"><enum>(i)</enum><header display-inline="yes-display-inline">Health advisory</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, not later than 90 days after the date of enactment of this
				subparagraph, the Administrator shall publish a health advisory for perchlorate
				that is fully protective, with an adequate margin of safety, of the health of
				vulnerable persons (including pregnant women, infants, and children), taking
				into consideration body weight, exposure patterns, and all routes of
				exposure.</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id4d7891be-c28b-42a4-88b7-b685caa21c90"><enum>(ii)</enum><header display-inline="yes-display-inline">Proposed regulations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, the Administrator shall propose (within 9 months of the date of
				enactment of this subparagraph) and shall finalize (within 18 months of the
				date of enactment) a national primary drinking water regulation for
				perchlorate—</text>
						<subclause id="ID91be12d08cd741d095c671bc2750661d"><enum>(I)</enum><text>that based on the factors
				in clause (i) and other relevant data, is protective, with an adequate margin
				of safety, of vulnerable persons (including pregnant women, infants, and
				children); and</text>
						</subclause><subclause id="ID2683a79819ec4bc2896e404e90415810"><enum>(II)</enum><text>the maximum contaminant
				level of which is as close to the maximum contaminant level goal for
				perchlorate, and as protective of vulnerable persons, as is
				feasible.</text>
						</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
