		  modify provisions relating to beach monitoring, and for other

		<section id="H88CAF1CBA32D4E0A85AEBAB95DA40070" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Beach Protection Act of
			 2007</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HBFD90D6A52C547D19E79CD5B79601C98"><enum>2.</enum><header>Beach water
			 pollution source identification and prevention</header>
			<subsection id="H6F3892262BB94B4DAED10500A099DC19"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 406 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1346) is amended in each of
			 subsections (b), (c), (d), (g), and (h) by striking <quote>monitoring and
			 notification</quote> each place it appears and inserting <quote>monitoring,
			 public notification, source tracking, sanitary surveys, and prevention efforts
			 to address the identified sources of beachwater pollution</quote>.</text>
			</subsection><subsection id="H18BF8CD0B7D74415B48B165695FE6EF4"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>Section 406(i) of the Federal Water Pollution
			 Control Act (33 U.S.C. 1346(i)) is amended by striking <quote>$30,000,000 for
			 each of fiscal years 2001 through 2005</quote> and inserting <quote>$60,000,000
			 for each of fiscal years 2007 through 2012</quote>.</text>
			</subsection></section><section id="H287C68EDF6854338BA5DFE135F637B39"><enum>3.</enum><header>Funding for
			 Beaches Environmental Assessment and Coastal Health Act</header><text display-inline="no-display-inline">Section 8 of the Beaches Environmental
			 Assessment and Coastal Health Act of 2000 (114 Stat. 877) is amended by
			 striking <quote>2005</quote> and inserting <quote>2012</quote>.</text>
		</section><section id="HA2CDED4EB31944ECABEFEC734CAE4F8E"><enum>4.</enum><header>State
			 reports</header><text display-inline="no-display-inline">Section
			 406(b)(3)(A)(ii) of the Federal Water Pollution Control Act (33 U.S.C.
			 1346(b)(3)(A)(ii)) is amended by inserting <quote>and all environmental
			 agencies of the State with authority to prevent or treat sources of beachwater
			 pollution</quote> after <quote>public</quote>.</text>
		</section><section id="HFF442FB0D9BF40EFA9EA46727EA4F300"><enum>5.</enum><header>Use of rapid
			 testing methods</header>
			<subsection id="H834BECA6840A49C0B2D4F6C929DE7223"><enum>(a)</enum><header>Contents of
			 state and local government programs</header><text display-inline="yes-display-inline">Section 406(c)(4)(A) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1346(c)(4)(A)) is amended by inserting
			 <quote>, including the use of a rapid testing method after the last day of the
			 1-year period following the date of approval of the rapid testing method by the
			 Administrator</quote> before the semicolon at the end.</text>
			</subsection><subsection id="H0A79A664C5AA488092598D791C9DAB3F"><enum>(b)</enum><header>Revised
			 criteria</header><text>Section 304(a)(9) of the Federal Water Pollution Control
			 Act (33 U.S.C. 1314(a)(9)) is amended—</text>
				<paragraph id="H661D23A305234FB4A4C3E1CAF4A820C4"><enum>(1)</enum><text>by inserting
			 <quote>rapid</quote> before <quote>testing</quote>; and</text>
				</paragraph><paragraph id="HEB05D8389EDA4C488E9C5DB89C747D85"><enum>(2)</enum><text>by striking
			 <quote>, as appropriate</quote>.</text>
				</paragraph></subsection><subsection id="H0436F1F09A02449F8D352556BA88DB31"><enum>(c)</enum><header>Definition</header><text>Section
			 502 of the Federal Water Pollution Control Act (33 U.S.C. 1362) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H18CCD981746242B090C3A548E57049AC" style="OLC">
					<paragraph id="HF4467D6579314D46B4E770D330AC2800"><enum>(25)</enum><header>Rapid testing
				method</header><text>The term <term>rapid testing method</term> means a method
				of testing for which results are available within 2
				hours.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H8AA9281DCFBC46D1930241021D35C7EA"><enum>6.</enum><header>Prompt
			 communication with State environmental agencies</header><text display-inline="no-display-inline">Section 406(c)(5) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1346(c)(5)) is amended—</text>
			<paragraph id="H5B329160FA0E4D75B2E18F8EC5BC0076"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>prompt communication</quote> and
			 inserting <quote>communication within 24 hours of the receipt of the results of
			 a water quality sample</quote>;</text>
			</paragraph><paragraph id="HCE9D0F273B644B6C8081D2DC9EB3B306"><enum>(2)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H8BE0061394824C56838136DADCB7FD"><enum>(3)</enum><text>in
			 subparagraph (B), by inserting <quote>and</quote> after the semicolon at the
			 end; and</text>
			</paragraph><paragraph id="H9384E8C268B64CA2AACC782EA2DC4E4"><enum>(4)</enum><text>by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBB9C0795C64049A3B67F72A25700CC3C" style="OLC">
					<subparagraph id="H0DE3F3A5B09A4ADE90B7385D1E4C6F38"><enum>(C)</enum><text>all agencies of
				the State government with authority to require the prevention or treatment of
				the sources of beachwater
				pollution;</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H7A00A176955A4CFAA5C7FAD427700BD"><enum>7.</enum><header>Content of State
			 and local programs</header><text display-inline="no-display-inline">Section
			 406(c) of the Federal Water Pollution Control Act (33 U.S.C. 1346(c)) is
			 amended—</text>
			<paragraph id="HA6A8FA5FC36B43B190593FB496778500"><enum>(1)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="HC67F595D69F5401CB6C61D973960F6A5"><enum>(2)</enum><text>in paragraph (7),
			 by striking the period at the end and inserting a semicolon;</text>
			</paragraph><paragraph id="H1ABC8509BD204586BDD6E44B8284DBD6"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H91D93EDE871F4C84BD6C6615EC12F646" style="OLC">
					<paragraph id="HE9D5603DB75542149CDD78ECDE8457BE"><enum>(8)</enum><text>measures to
				develop and implement a beachwater pollution source identification and tracking
				program for the coastal recreation waters that are not meeting applicable water
				quality standards for pathogens;</text>
					</paragraph><paragraph id="HC60ECF4071D247CEB2A66E7731F194F9"><enum>(9)</enum><text>a publicly
				accessible and searchable global information system database with information
				updated within 24 hours of the availability of the information, organized by
				beach and with defined standards, sampling plan, monitoring protocols, sampling
				results, and number and cause of beach closing and advisory days; and</text>
					</paragraph><paragraph commented="no" id="H6CD5170E50374493002371D80736E589"><enum>(10)</enum><text display-inline="yes-display-inline">measures to ensure that closures or
				advisories are made or issued within 24 hours after the State government
				determines that any coastal recreation waters in the State are not meeting or
				are not expected to meet applicable water quality standards for
				pathogens.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H3E24033412284899B1F4177C00279275"><enum>8.</enum><header>Compliance
			 review</header><text display-inline="no-display-inline">Section 406(h) of the
			 Federal Water Pollution Control Act (33 U.S.C. 1346(h)) is amended—</text>
			<paragraph id="H91E978563F9D40F3A9489E92009FB141"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and
			 indenting the subparagraphs appropriately;</text>
			</paragraph><paragraph id="H837A0CC923EB4984B922921DF9B1AD10"><enum>(2)</enum><text>by striking
			 <quote>In the</quote> and inserting the following: <quote>(1)
			 <header-in-text level="paragraph" style="OLC">In general</header-in-text>.—In
			 the</quote>; and</text>
			</paragraph><paragraph id="HFCC18ABFD2BB496B8E7B00000000AE8"><enum>(3)</enum><text>by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7BA38EA3050F42549D2357DFF2E17C37" style="OLC">
					<paragraph id="HF40B648A16204FE48282C64700A9D3F7"><enum>(2)</enum><header>Compliance
				review</header><text display-inline="yes-display-inline">On or before July 31
				of each calendar year beginning after the date of enactment of this paragraph,
				the Administrator shall—</text>
						<subparagraph id="H5700A8EC62AB44D2A63F540766D00666"><enum>(A)</enum><text>prepare a written
				assessment of compliance with all statutory and regulatory requirements of this
				section for each State and local government and of compliance with conditions
				of each grant made under this section to a State or local government;</text>
						</subparagraph><subparagraph commented="no" id="H1CD76095317A4BA693A0779682EA012E"><enum>(B)</enum><text>notify the State
				or local government of the assessment; and</text>
						</subparagraph><subparagraph id="HB5AD8D55C1D24D418D3500CF00FB37B0"><enum>(C)</enum><text>make each of the
				assessments available to the public in a searchable database on or before
				December 31 of the calendar year.</text>
						</subparagraph></paragraph><paragraph id="H7A94D820ECCE4EE9BBDBEB97A5F40249"><enum>(3)</enum><header>Corrective
				action</header>
						<subparagraph id="id9A7ACCB9CA484B57BCE7FE2027F7ACE9"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any State or local
				government that the Administrator notifies under paragraph (2) that the State
				or local government is not in compliance with any requirement or grant
				condition described in paragraph (2) shall take such action as is necessary to
				comply with the requirement or condition by not later than 1 year after the
				date of the notification.</text>
						</subparagraph><subparagraph id="idF9E8C6EB1E3248E699BE882DE58D5A56"><enum>(B)</enum><header>Noncompliance</header><text display-inline="yes-display-inline">If the State or local government is not in
				compliance with such a requirement or condition by the date that is 1 year
				after the deadline specified in subparagraph (A), any grants made under
				subsection (b) to the State or local government, after the last day of the
				1-year period and while the State or local government is not in compliance with
				all requirements and grant conditions described in paragraph (2), shall require
				a Federal share of not to exceed 50 percent.</text>
						</subparagraph></paragraph><paragraph id="H2F684F2D4DE3424FBCAD121FE32D61A"><enum>(4)</enum><header>GAO
				review</header><text>Not later than December 31 of the third calendar year
				beginning after the date of enactment of this paragraph, the Comptroller
				General of the United States shall—</text>
						<subparagraph id="id9F835748DF444A29BBA224A0979B7E4E"><enum>(A)</enum><text>conduct a review
				of the activities of the Administrator under paragraphs (2) and (3) during the
				first and second calendar years beginning after that date of enactment;
				and</text>
						</subparagraph><subparagraph id="id15CDB5E263A44D4C9CBBEFD21820B0A4"><enum>(B)</enum><text>submit to
				Congress a report on the results of the
				review.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
