		<official-title>To authorize the Secretary of the Interior, acting
		  through the Bureau of Reclamation, to enter into a cooperative agreement with
		  the Madera Irrigation District for purposes of supporting the Madera Water
		  Supply Enhancement Project.</official-title>

		<section id="HD45AFDEFF6204FB492B3921F2F80C900" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Madera Water Supply Enhancement
			 Act</short-title></quote>.</text>
		</section><section id="HF5D6371A691542A79DF05C88E1CADA00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<paragraph id="HD454968AFCB54629A57DDAB9C3C0200"><enum>(1)</enum><text>The term
			 <term>District</term> means the Madera Irrigation District, Madera,
			 California.</text>
			</paragraph><paragraph id="HF640C772C6CF4D96ACBB3B58EE2614CD"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Project</term> means the
			 Madera Water Supply Enhancement Project, a groundwater bank on the 13,646 acre
			 Madera Ranch in Madera, California, owned, operated, maintained, and managed by
			 the District that will plan, design, and construct recharge, recovery, and
			 delivery systems able to store up to 250,000 acre-feet of water and recover up
			 to 55,000 acre-feet of water per year.</text>
			</paragraph><paragraph id="H4B643D1EFC5848DE854203E7B767B59B"><enum>(3)</enum><text>The term
			 <term>Secretary</term> means the Secretary of the United States Department of
			 the Interior.</text>
			</paragraph><paragraph id="H44BF8422681D448E84DB74DBD5D0070"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>total cost</term> means all
			 reasonable costs, such as the planning, design, permitting, financing, and
			 construction of the Project and the fair market value of lands used or acquired
			 by the District for the Project. The total cost of the Project shall not exceed
			 $90,000,000.</text>
			</paragraph></section><section id="H22DA5029F2624FED8000874CCE613C5C"><enum>3.</enum><header>No
			 further studies or reports</header>
			<subsection id="HCD1F693A17A24F32A7FA0019F1009D77"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that the Bureau of
			 Reclamation and others have conducted numerous studies regarding the Project,
			 including, but not limited to the following:</text>

				</paragraph></subsection><subsection id="H898CC422D39F41A5BB536275D165077"><enum>(b)</enum><header>No further
			 studies or reports</header><text display-inline="yes-display-inline">Pursuant
			 to the Reclamation Act of 1902 (32 Stat. 388) and Acts amendatory thereof and
			 supplemental thereto, the Project is feasible and the Bureau of Reclamation
			 shall not conduct any further studies or reports related to determining the
			 feasibility of the Project.</text>
			</subsection></section><section id="H993466EC126E4FA984E653C2AEEF0085"><enum>4.</enum><header>Cooperative
			 agreement</header><text display-inline="no-display-inline">All planning,
			 design, and construction of the Project authorized by this Act shall be
			 undertaken in accordance with a cooperative agreement between the Secretary and
			 the District for the Project. Such cooperative agreement shall set forth in a
			 manner acceptable to the Secretary and the District the responsibilities of the
			 District for participating, which shall include—</text>
			<paragraph id="HF0E679621F61490483DC426253A6638C"><enum>(1)</enum><text>engineering and
			 design;</text>
			</paragraph><paragraph id="HAF1CCF934CED4235AD40787CDB768CAB"><enum>(2)</enum><text>construction;
			 and</text>
			</paragraph><paragraph id="H3CC1A3F03C23487500FB7209D000B280"><enum>(3)</enum><text>the administration
			 of contracts pertaining to any of the foregoing.</text>
			</paragraph></section><section id="H0B5BEE94FE294EFFAA6F324543CDE843"><enum>5.</enum><header>Authorization for
			 the madera water supply and enhancement project</header>
			<subsection id="HC10994069E0F454AA8DACF09F3236457"><enum>(a)</enum><header>Authorization of
			 Construction</header><text>The Secretary, acting pursuant to the Federal
			 reclamation laws (Act of June 17, 1902; 32 Stat. 388), and Acts amendatory
			 thereof or supplementary thereto, as far as those laws are not inconsistent
			 with the provisions of this Act, is authorized to enter into a cooperative
			 agreement through the Bureau with the District for the support of the design,
			 and construction of the Project.</text>
			</subsection><subsection id="H9684799B92584D92826E3CDEDFDA4FF2"><enum>(b)</enum><header>Cost
			 Share</header><text display-inline="yes-display-inline">The Federal share of
			 the capital costs of the Project shall not exceed 25 percent of the total cost
			 as defined in section 2(4). Capital, planning, design, permitting, financing,
			 construction, and land acquisition costs incurred by the District prior to the
			 date of the enactment of this Act shall be considered a portion of the
			 non-Federal cost share.</text>
			</subsection><subsection id="HF614C3646D6F478F8EC1310125C85398"><enum>(c)</enum><header>In-Kind
			 Services</header><text>In-kind services performed by the District shall be
			 considered a part of the local cost share to complete the Project authorized by
			 subsection (a).</text>
			</subsection><subsection id="H1AB88F9926C44967BAF7D121314733D"><enum>(d)</enum><header>Credit for
			 Non-Federal Work</header><text>The District shall receive credit toward the
			 non-Federal share of the cost of the Project for—</text>
				<paragraph id="H68E677413EE94CD78BFB99EFBB50E544"><enum>(1)</enum><text display-inline="yes-display-inline">reasonable costs incurred by the District
			 as a result of participation in the planning, design, permitting, financing,
			 and construction of the Project; and</text>
				</paragraph><paragraph id="H2159DC2461A0451595BD471EAAB98057"><enum>(2)</enum><text>for the fair
			 market value of lands used or acquired by the District for the Project.</text>
				</paragraph></subsection><subsection id="H0E6939CFD2614BFB8BF16D5C09046CD1"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary shall not provide funds for
			 the operation or maintenance of the Project authorized by this section. The
			 operation, ownership, and maintenance of the Project shall be the sole
			 responsibility of the District.</text>
			</subsection><subsection id="HA6320202A6CD4318AE203761762C3304"><enum>(f)</enum><header>Plans and
			 Analyses Consistent With Federal Law</header><text>Before obligating funds for
			 design or construction under this section, the Secretary shall work
			 cooperatively with the District to use, to the extent possible, plans, designs,
			 and engineering and environmental analyses that have already been prepared by
			 the District for the Project. The Secretary shall ensure that such information
			 as is used is consistent with applicable Federal laws and regulations.</text>
			</subsection><subsection id="H5C5A156D114F43E0A49BE13860D4DCC6"><enum>(g)</enum><header>Title;
			 Responsibility; Liability</header><text>Nothing in this section or the
			 assistance provided under this section shall be construed to transfer title,
			 responsibility or liability related to the Project to the United States.</text>
			</subsection><subsection id="H087C4A0460DD4E5E934100CE640004E"><enum>(h)</enum><header>Authorization of
			 Appropriation</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary to carry out this Act
			 $22,500,000 or 25 percent of the total cost of the Project, whichever is
			 less.</text>
			</subsection></section><section id="H40DA16D9C8884AE1937FBB70E500C000"><enum>6.</enum><header>Sunset</header><text display-inline="no-display-inline">The authority of the Secretary to carry out
			 any provisions of this Act shall terminate 10 years after the date of the
			 enactment of this Act.</text>
