		<official-title>To amend title XVIII of the Social Security Act to
		  provide for coverage under the Medicare program of certain medical mobility
		  devices approved as class III medical devices.</official-title>

		<section id="IDf5ac1c785f7042e0aaf413e914cca39b" section-type="section-one"><enum>1.</enum><header>Coverage of class iii medical
			 mobility devices</header>
			<subsection id="IDe6ec49a414eb47c8a84722a6ec4c0aba"><enum>(a)</enum><header>Covered
			 benefit</header><text>Section 1861(s)(2) of the <act-name>Social Security Act
			 </act-name> (42 U.S.C. 1395x(s)(2)) is amended—</text>
				<paragraph id="IDe9b3c0e61a3c43bbbe072b4185ad0666"><enum>(1)</enum><text>in subparagraph
			 (Z), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="IDcd5865547f3c4b09aa97f9c55ce6dec8"><enum>(2)</enum><text>in subparagraph
			 (AA), by inserting <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="ID4b782cbcdf1c4fcd8dfcbfb3502b41c4"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id42FA9B385FED453DAD2FFAF4F2EDA755" style="OLC">
						<subparagraph id="ID9481b900cb55449d875b319bcde29e6b" indent="up1"><enum>(BB)</enum><text>class III medical mobility devices
				(as defined in subsection (ccc)(1)) furnished to a class III medical
				mobility-device eligible individual (as defined in subsection
				(ccc)(2));</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID7a4921ef68bb43299fbf6856918da12f"><enum>(b)</enum><header>Definitions</header><text>Section
			 1861 of the <act-name>Social Security Act</act-name> (42 U.S.C. 1395x) is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="idB22C9FF5D6C34EDABFF31E2571F045E1" other-style="archaic" style="other">
					<subsection id="id9DE76BFBCC61464A92D0AD4F00A01F05"><enum>(ccc)</enum><header>Class <enum-in-header>III</enum-in-header> medical
		  mobility-device; Class <enum-in-header>III</enum-in-header> medical
		  mobility-device eligible individual</header><paragraph commented="no" display-inline="yes-display-inline" id="id713293C18B9B44DA85E0771B05F65011"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>class III medical mobility
				device</term> means a medical mobility device that has been approved as a class
				III medical device pursuant to a premarket approval application under the
				Federal Food, Drug, and Cosmetic Act and that—</text>
							<subparagraph id="id98AFF911C3DD42B7B8330A654670156C" indent="up1"><enum>(A)</enum><text>is able, among other functions—</text>
								<clause id="id4965DF87764C4221AFEB8ACE52E9F141"><enum>(i)</enum><text>to ascend and descend stairs using
				a climbing and descending function;</text>
								</clause><clause id="idAE6D6F480394457B8FE591638BD27BFE"><enum>(ii)</enum><text>to traverse different terrain and
				various obstacles (including uneven terrain, curbs of 5 inches in height,
				grass, gravel and other soft surfaces) using a 4-wheel drive function;
				and</text>
								</clause><clause id="idAE89A5199C11410590D0E928C698B3B4"><enum>(iii)</enum><text>to provide mobility in a seated
				position at an elevated height using a balance function;</text>
								</clause></subparagraph><subparagraph id="id1E63D36052B24109A6A1971D6CF1D577" indent="up1"><enum>(B)</enum><text>has been prescribed for a class III
				medical mobility-device eligible individual (as defined in paragraph (2)) by
				the individual’s treating physician (as defined in subsection (r)(1)) for an
				approved indication of the class III medical mobility device; and</text>
							</subparagraph><subparagraph id="idE737C33F29FC49CF9C45758D4032CBFC" indent="up1"><enum>(C)</enum><text>is only dispensed after an assessment
				of the class III medical mobility-device eligible individual has been completed
				by a health care professional specified in paragraph (3) who has successfully
				completed training in making such assessments under standards specified by the
				Secretary in consultation with representatives of appropriate industry and
				medical organizations.</text>
							</subparagraph></paragraph><paragraph id="id58698EDE236A4B58BAA93BD12B3DA1C4" indent="up1"><enum>(2)</enum><text>The term <term>class III medical
				mobility-device eligible individual</term> means, with respect to a class III
				medical mobility device, an individual who, at the time the prescription for
				the device is written, meets each of the following requirements:</text>
							<subparagraph id="id270A2FEBFE9642A6BF1F936CD6A5E712"><enum>(A)</enum><text>The individual has a functional
				limitation of mobility that hinders the individual’s ability to perform
				mobility-related activities of daily living.</text>
							</subparagraph><subparagraph id="id1CA314232E7C4793A5A7B9864A47E239"><enum>(B)</enum><text>The individual’s use of the class III
				medical mobility device is for approved intended uses of the device.</text>
							</subparagraph><subparagraph id="id60E3661C7A7D4B3ABC4A4CC2F777B176"><enum>(C)</enum><text>The individual demonstrates sufficient
				cognitive and physical ability for the proper and safe operation of the device
				(such as sufficient use of one upper extremity and the ability to dial a push
				button telephone or operate a hand operated joystick) under such medical
				standards as the Secretary may specify.</text>
							</subparagraph><subparagraph id="idFAE2B60582B643EFBF16EDC9B190DBD4"><enum>(D)</enum><text>The individual meets drivers licensing
				criteria established in 1996 by the Epilepsy Foundation of America.</text>
							</subparagraph><subparagraph id="idC610E3CCC4F74C4683C09285206E067A"><enum>(E)</enum><text>The individual is not a resident of an
				institution that meets the requirements of subsection (e)(1) or section
				1819(a)(1).</text>
							</subparagraph><subparagraph id="id9BFEA071E1AB4D358B7A998FFBB8E6D8"><enum>(F)</enum><text>The individual has completed a
				comprehensive training program (that meets standards developed by the Secretary
				in consultation with appropriate industry representatives) on the safe
				operation of the class III medical mobility device and its functions.</text>
							</subparagraph><subparagraph id="id7BF1C249012C46C69A435FEE708AEBBD"><enum>(G)</enum><text>The individual was initially entitled
				to benefits under this title solely by reason of section 226(b).</text>
							</subparagraph><subparagraph id="id45421E66D6994ED9AD95503B3B9F4D07"><enum>(H)</enum><text>The residence of the
				individual—</text>
								<clause id="id3734D37FB59743E992CA79720AF7718D"><enum>(i)</enum><text>has stairs that meet the conditions
				of use of the class III medical mobility device for a stair as indicated in the
				labeling of the device; and</text>
								</clause><clause id="id6B1758CBE4D64A8099E3542AC6846580"><enum>(ii)</enum><text>does not have a mechanical method
				to ascend or descend such a stair or stairs (such as an elevator or such other
				mechanical methods as the Secretary may specify).</text>
								</clause></subparagraph></paragraph><paragraph id="idB835FB41F0BC433B92E85C676559BBA8" indent="up1"><enum>(3)</enum><text>A health care professional specified
				in this paragraph is any of the following:</text>
							<subparagraph id="id30819367C7234B7885245134E3A1711C"><enum>(A)</enum><text>A physician (as defined in subsection
				(r)(1)).</text>
							</subparagraph><subparagraph id="id8202CC6DD7B84538ADC8D2B97137DC97"><enum>(B)</enum><text>A physician assistant.</text>
							</subparagraph><subparagraph id="id59CED8ACF0094A8DB92E533405C02DCC"><enum>(C)</enum><text>A nurse practitioner.</text>
							</subparagraph><subparagraph id="id15F408B405E84BAA9C7E7151EFEB7D1F"><enum>(D)</enum><text>A qualified physical therapist.</text>
							</subparagraph><subparagraph id="idADA97AD12D084A5F973568F86A8A9849"><enum>(E)</enum><text>A qualified occupational
				therapist.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID7045c72ac71748e58ec061a3e754c5fe"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="ID7ad6b6a119a84b329a35e08e0ca5efcc"><enum>(1)</enum><header>Provision of
			 class iii medical mobility device only to class iii medical mobility-device
			 eligible individual; medical necessity</header><text>Section 1862 of the
			 <act-name>Social Security Act </act-name> (42 U.S.C. 1395y) is amended—</text>
					<subparagraph id="ID902f0aa4d6e0493ca9b0bc7b1db6ff47"><enum>(A)</enum><text>in subsection
			 (a)(1)—</text>
						<clause id="ID4eeee87590a243478d3b82954f80658e"><enum>(i)</enum><text>in
			 subparagraph (M), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="IDd5b71a36ce9a4a2f91a52ea8ea22b53b"><enum>(ii)</enum><text>in
			 subparagraph (N), by striking the semicolon at the end and inserting <quote>,
			 and</quote>; and</text>
						</clause><clause id="IDa06f40f8d1014e6694dca372c62e4aa2"><enum>(iii)</enum><text>by inserting
			 after subparagraph (N) the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="id2F1DC396B7DD42A7BC0CAFE8A1AEC190" style="traditional">
								<subparagraph id="IDc42c356e7d314fa98be70a68921df2a1"><enum>(O)</enum><text>in the case of a
				class III medical mobility device (as defined in paragraph (1) of section
				1861(ccc)), which is furnished other than to a class III medical
				mobility-device eligible individual (as defined in paragraph (2) of such
				section);</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="ID99b6927e27534a80b354417cbbb16846"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="id572AB024962C4680B1F4374E5C1E6A8C" style="traditional">
							<subsection id="ID9f42cc7ede8f4750832f51dec155c46c"><enum>(n)</enum><header>Clarification
				of coverage of and payment for all functions of class
				<enum-in-header>III</enum-in-header> medical mobility devices</header><text>In
				the case of a class III medical mobility device (as defined in section
				1861(ccc)(1)) furnished to a class III medical mobility-device eligible
				individual, each function of such device, including the functions described in
				subparagraph (A) of such section, are deemed for purposes of subsection (a)(1),
				to be reasonable and necessary for the treatment of an illness or injury or to
				improve the functioning of a malformed body
				member.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDf6f43dfadfda4a9690ac828ca9c20da3"><enum>(2)</enum><header>Payment in
			 connection with covered items; purchase agreement option;
			 maintenance</header><text>Section 1834(a) of the <act-name>Social Security
			 Act</act-name> (42 U.S.C. 1395m(a)) is amended—</text>
					<subparagraph id="ID33edc11cc3474bc391763b8c9fae658b"><enum>(A)</enum><text>in paragraph
			 (1)(B)(ii), by inserting <quote>and paragraph (22), in the case of a class III
			 medical mobility device,</quote> after <quote>(7)</quote>;</text>
					</subparagraph><subparagraph id="ID216ec8705be7418487038aa9d2ae2a3c"><enum>(B)</enum><text>in paragraph
			 (13), by inserting before the period at the end the following: “, and also
			 includes a class III medical mobility device (as defined in section
			 1861(ccc)(1))”; and</text>
					</subparagraph><subparagraph id="ID0da48c0af89e4791aa7faf9a58925f94"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="id299EBE63F7D140A29181F7EB2DA11AD1" style="traditional">
							<paragraph id="IDf6c4928d1ff14caf84e97875d9ae4ead"><enum>(22)</enum><header>Payment for
				class iii medical mobility devices</header>
								<subparagraph id="ID5196d4e7ecde426f8df3948cb97fa804"><enum>(A)</enum><header>In
				general</header><text>Subject to the succeeding provisions of this paragraph,
				in the case of a class III medical mobility device (as defined in section
				1861(ccc)(1)), the provisions of paragraph (7) (including the option for a
				purchase agreement under subparagraph (A)(iii) of such paragraph) shall apply
				to such device under this paragraph in the same manner as those provisions
				apply to a covered item under paragraph (7).</text>
								</subparagraph><subparagraph id="ID47c0b65908624899bf61e3129b76caee"><enum>(B)</enum><header>Payment for all
				functions of class iii medical mobility devices</header><text>In the case of a
				class III medical mobility device, payment under this paragraph for such device
				shall be made taking into account all functions of such device, consistent with
				section
				1862(n).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID60544e710afc4178847b2d41dc586c10"><enum>(3)</enum><header>Requirement for
			 face-to-face encounter with a physician and for written
			 prescription</header><text>Clause (iv) of section 1834(a)(1)(E) of the
			 <act-name>Social Security Act</act-name> (42 U.S.C. 1395m(a)(1)(E)) is
			 amended—</text>
					<subparagraph id="ID34c66640c80343f3955dc5a02d927805"><enum>(A)</enum><text>by adding at the
			 end the following: “In the case of a covered item consisting of a class III
			 medical mobility device (as defined in paragraph (1) of section 1861(ccc)) for
			 a class III medical mobility-device eligible individual (as defined in
			 paragraph (2) of such section), payment may not be made for such item unless a
			 physician (as so defined) has conducted such examination and written such
			 prescription for the item, and after an assessment of such individual has been
			 completed by a health care professional specified in paragraph (3) of such
			 section.”; and</text>
					</subparagraph><subparagraph id="ID4b5b5517b45340d1b7142398b02ee928"><enum>(B)</enum><text>in the heading,
			 by inserting <quote><header-in-text level="clause" style="OLC">and class iii
			 medical mobility devices</header-in-text></quote> after <quote><header-in-text level="clause" style="OLC">wheelchairs</header-in-text></quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="IDdf4d49318777492eb9daf2b6d934b5f5"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to items and
			 services furnished on or after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
