		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Federal Employees Electronic
			 Personal Health Records Act of 2007</short-title></quote>.</text>
		</section><section id="idA44A26C6180E4DB0B5A4F79CB0321262"><enum>2.</enum><header>Electronic
			 personal health records for Federal employee health benefits plans</header>
			<subsection id="id88E53442960D422E8AD8FD713944AD53"><enum>(a)</enum><header>Contract
			 requirement</header><text>Section 8902 of title 5, United States Code, is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id079EDAE5556A4CEBB29BD02D7E43AC97" style="OLC">
					<subsection id="id60146BE120C04A54A4DDA8540A9D4AA7"><enum>(p)</enum><text>Each contract
				under this chapter shall require the carrier to provide for the establishment
				and maintenance of electronic personal health records in accordance with
				section
				8915.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id953C99B2F8F343DC924058F3C28E308B"><enum>(b)</enum><header>Electronic
			 personal health records</header><text>Chapter 89 of title 5, United States
			 Code, is amended by adding after section 8914 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8AB47C133AA64EF6A3024B8EDC1CCEA7" style="USC">
					<section id="id77F05755B9624AF9846843AF0526BEBD"><enum>8915.</enum><header>Electronic
				personal health records</header>
						<subsection id="id9D47B9A934B246FE8E7715E396505A73"><enum>(a)</enum><text>In this section,
				the term—</text>
							<paragraph id="ID8f53af945fa14faaba02036bb08a929c"><enum>(1)</enum><text><term>claims
				data</term> means—</text>
								<subparagraph id="id5954BA5E0A104158B16F485F8DD02F23"><enum>(A)</enum><text>a comprehensive
				record of health care services provided to an individual, including
				prescriptions; and</text>
								</subparagraph><subparagraph id="id05000B9591504A9C8D6ABC1BE4BE95AD"><enum>(B)</enum><text>contact
				information for providers of health care services; and</text>
								</subparagraph></paragraph><paragraph id="ID4de52b3b83484e338b6fc773217ec1ce"><enum>(2)</enum><text><term>standard
				electronic format</term> means a format that—</text>
								<subparagraph id="idBFF4B022CD904A36BA33F8538138F8E0"><enum>(A)</enum><text>uses open
				electronic standards;</text>
								</subparagraph><subparagraph id="ID41576fa2e75543e88a5eb9ba68cd47f9"><enum>(B)</enum><text>enables health
				information technology to be used for the collection of clinically specific
				data;</text>
								</subparagraph><subparagraph id="IDfd31d879291f40beb9b211cfc6cfc149"><enum>(C)</enum><text>promotes the
				interoperability of health care information across health care settings,
				including reporting under this section and to other Federal agencies;</text>
								</subparagraph><subparagraph id="ID4f59a1acf38546cd9a395ab6dfadc8af"><enum>(D)</enum><text>facilitates
				clinical decision support;</text>
								</subparagraph><subparagraph id="id22747A5377D8463089B75E15F167B304"><enum>(E)</enum><text>is useful for
				diagnosis and treatment and is understandable for the individual or family
				member; and</text>
								</subparagraph><subparagraph id="ID3b52871cf5bd463d909db98fbaf57ccc"><enum>(F)</enum><text>is based on the
				Federal messaging and health vocabulary standard endorsed by—</text>
									<clause id="idAE4CDBA7612B4F0EAF713E8D9432ACF5"><enum>(i)</enum><text>the Office of the
				National Coordinator for Health Information Technology;</text>
									</clause><clause id="id35114A8915204A1486CE32725A3D5842"><enum>(ii)</enum><text>the American
				Health Information Community; or</text>
									</clause><clause id="id85DA1E4C6F81491E9F93689AA5310A8C"><enum>(iii)</enum><text>the Secretary
				of Health and Human Services.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="id4EA9EC4BD8E84271AB50F4FEC8AFBA2C"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id27CF01102F1243C681B4DA845B06B1A8"><enum>(1)</enum><text>Each carrier entering
				into a contract for a health benefits plan under section 8915 shall provide for
				the establishment and maintenance of electronic personal health records for
				each individual and family member enrolled in that health benefits plan in
				accordance with this section.</text>
							</paragraph><paragraph id="id60831CE7367746968732DA60D9C57299" indent="up1"><enum>(2)</enum><text>In the administration of this
				section, the Office of Personnel Management—</text>
								<subparagraph id="id594120A650C5496BA899AA8D93751601"><enum>(A)</enum><text>shall ensure that each individual and
				family member is provided—</text>
									<clause id="id62C2EB787C014EE28A413609A990A15E"><enum>(i)</enum><text>timely notice of the establishment
				and maintenance of electronic personal health records; and</text>
									</clause><clause id="idE402373DE8CC492AA45EC4A523F46632"><enum>(ii)</enum><text>an opportunity to file an election
				at any time to—</text>
										<subclause id="idFBCD85413584474BB9EB398DDB81274F"><enum>(I)</enum><text>not participate in the establishment or
				maintenance of an electronic personal health record for that individual or
				family member; and</text>
										</subclause><subclause id="idC0D053EE6B924102B2924FB260530ED5"><enum>(II)</enum><text>in the case of an electronic personal
				health record that is established under this section, terminate that electronic
				personal health record;</text>
										</subclause></clause></subparagraph><subparagraph id="idAC5B306316644002AB8824B3CCEB0FFB"><enum>(B)</enum><text>shall ensure that each electronic
				personal health record shall—</text>
									<clause id="IDdb439ea5fd13408db131002987ee8aec"><enum>(i)</enum><text>be based on standard electronic
				formats;</text>
									</clause><clause id="idEE501202876B4329B95A5B5DF2D98ED0"><enum>(ii)</enum><text>be available for electronic access
				through the Internet for the use of the individual or family member to whom the
				record applies;</text>
									</clause><clause id="ID69676bd12f6b4d9e98432d2e30ae21cf"><enum>(iii)</enum><text>enable the individual or family
				member to—</text>
										<subclause id="idA0F266EE8EB34244AE4D3A10ADDD3D8E"><enum>(I)</enum><text>share any contents of the electronic
				personal health record through transmission in standard electronic format, fax
				transmission, or other additional means to providers of health care services or
				other persons;</text>
										</subclause><subclause id="id9F7FCE1B6C6848B2B20A7BCF9D32892C"><enum>(II)</enum><text>copy or print any contents of the
				electronic personal health record; and</text>
										</subclause><subclause id="IDf963d98181734fe7bf02d65cdf7217f8"><enum>(III)</enum><text>add supplementary health information,
				such as information relating to—</text>
											<item id="IDc205ea15a9cc46758b75c438d6bce4b9"><enum>(aa)</enum><text>personal, medical, and emergency
				contacts;</text>
											</item><item id="ID493cd3ddd2c6466e9ab5b14c62e47f24"><enum>(bb)</enum><text>laboratory tests;</text>
											</item><item id="IDea22bdb61bd94dc2ae3abafa261997f2"><enum>(cc)</enum><text>social history;</text>
											</item><item id="ID87647b93a1d94934bac2e79e02a3652a"><enum>(dd)</enum><text>health conditions;</text>
											</item><item id="ID3a169e94bd124011bae375e3f2746cd1"><enum>(ee)</enum><text>allergies;</text>
											</item><item id="IDf1db4817cb3b48fc952d9f58c0e6eda4"><enum>(ff)</enum><text>dental services;</text>
											</item><item id="IDce098f01aed84c7eb0d53907600d6841"><enum>(gg)</enum><text>immunizations;</text>
											</item><item id="IDc0fd1989945845c19ae9cfc2535f13da"><enum>(hh)</enum><text>prescriptions;</text>
											</item><item id="ID9b462025dafa4772823f9bba04918bb2"><enum>(ii)</enum><text>family health history;</text>
											</item><item id="ID4c91af914e414ba192e392fcdac4aedc"><enum>(jj)</enum><text>alternative treatments;</text>
											</item><item id="ID2cafe53e7c9a4b1381ed0b337542a6da"><enum>(kk)</enum><text>appointments; and</text>
											</item><item id="ID8b5419474ab440d59948b2b1ba7defd2"><enum>(ll)</enum><text>any additional information as
				needed;</text>
											</item></subclause></clause><clause id="IDbdf6a98028e240778613aea0715c2506"><enum>(iv)</enum><text>contain—</text>
										<subclause id="idD38EB0B9DCC947889B51A99F4C00B7B4"><enum>(I)</enum><text>to the extent feasible, claims data
				from—</text>
											<item id="idC3F427989B054485A06E22F445680E39"><enum>(aa)</enum><text>providers of health care services
				that participate in health benefits plans under this chapter;</text>
											</item><item id="id1284C7F4AAF54D3FAF79AA1C1D58A2C7"><enum>(bb)</enum><text>other providers of health care
				services; and</text>
											</item><item id="id1CE4C3C96EEA4F558E756ABC0B7FB896"><enum>(cc)</enum><text>other health benefits plans in which
				the individual or family members have participated;</text>
											</item></subclause><subclause id="ID546ee30ed3f04f4589f809d4844b56d3"><enum>(II)</enum><text>to the extent feasible, clinical care,
				pharmaceutical, and laboratory records; and</text>
										</subclause><subclause id="ID8594655fd1fa474eac84cf682020dcb0"><enum>(III)</enum><text>the name of the source for each item of
				health information;</text>
										</subclause></clause><clause id="ID86582750db894c86b34bc352f2382fbf"><enum>(v)</enum><text>authenticate the identity of each
				individual upon accessing the electronic personal health record; and</text>
									</clause><clause id="idF81668F2523A4BE797201C4E4DD906CA"><enum>(vi)</enum><text>contain an audit trail to list the
				identity of individuals who access the electronic personal health record;
				and</text>
									</clause></subparagraph><subparagraph id="IDb85b1b43adc3400f9f604af390c3b010"><enum>(C)</enum><text>shall ensure that the individual or
				family member may designate—</text>
									<clause id="idFB7EBA52EA5D4602AD4C120F00CF8222"><enum>(i)</enum><text>any other individual to access and
				exercise control over the sharing of the electronic personal health record;
				and</text>
									</clause><clause id="idA2B64B0B35714E73B7E62B8B24C90C0C"><enum>(ii)</enum><text>any other individual to access the
				electronic personal health record in an emergency;</text>
									</clause></subparagraph><subparagraph id="IDd83456565ce04e3196fe0e7a674abb6f"><enum>(D)</enum><text>shall require each health benefits
				plan to comply with all privacy and security regulations promulgated under
				section 246(c) of the Health Insurance Portability and Accountability Act of
				1996 (42 U.S.C. 1320d–2) and other relevant laws relating to privacy and
				security;</text>
								</subparagraph><subparagraph id="ID07bc0cd6156b40f0980cc45dbc3b6d17"><enum>(E)</enum><text>shall require each carrier that enters
				into a contract for a health benefits plan to provide for the electronic
				transfer of the contents of an electronic personal health record to another
				electronic personal health record under a different health benefits plan
				maintained under this section or a similar record not maintained under this
				section if—</text>
									<clause id="id20CB53C469F847EBAA99DEC1FF6D9061"><enum>(i)</enum><text>coverage in a health benefits plan
				under this chapter for an individual or family member terminates; and</text>
									</clause><clause id="id432B69F878EC48B3900B2A55EF28584E"><enum>(ii)</enum><text>that individual or family member
				elects such a transfer;</text>
									</clause></subparagraph><subparagraph id="idEBA32F0D7B6742278FBA2FB5BED4F9B4"><enum>(F)</enum><text>shall require each carrier to provide
				for education, awareness, and training on electronic personal health records
				for individuals and family members enrolled in health benefits plans;
				and</text>
								</subparagraph><subparagraph id="idBEA6F599A8B94E49B91DF1D858F11CE5"><enum>(G)</enum><text>may require each carrier to provide
				for an electronic personal health record to be made available for electronic
				access, other than through the Internet, for the use of the individual or
				family member to whom the record applies, if that individual or family member
				requests such access.</text>
								</subparagraph></paragraph><paragraph id="id40D91E859370420C8362E198CCD9B193" indent="up1"><enum>(3)</enum><text>Nothing in paragraph (2)(C) shall be
				construed to provide any rights additional to the rights provided under the
				privacy and security regulations promulgated under section 246(c) of the Health
				Insurance Portability and Accountability Act of 1996 (42 U.S.C. 1320d–2) and
				other relevant laws relating to privacy and
				security.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id06F34FEBB86840E6B84D1937FF1EF075"><enum>(c)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 89 of
			 title 5, United States Code, is amended by adding at the end the
			 following:</text>

			</subsection></section><section id="idD7FF696C75EB499EB8ED05C2F5B93A07"><enum>3.</enum><header>Effective dates
			 and application</header>
			<subsection id="id5FBE3F99D2B94E39BF7AA94A5C0BBE20"><enum>(a)</enum><header>In
			 general</header><text>Except as provided under subsection (b), the amendments
			 made by this Act shall take effect 30 days after the date of enactment of this
			 Act.</text>
			</subsection><subsection id="id45E1D5D7F4AB45C5A5E253F2F30CCC60"><enum>(b)</enum><header>Establishment
			 and maintenance of electronic personal health records</header><text>The
			 requirement for the establishment and maintenance of electronic personal health
			 records under sections 8902(p) and 8915 of title 5, United States Code (as
			 added by this Act), shall apply with respect to contracts for health benefits
			 plans under chapter 89 of that title which take effect on and after January of
			 the earlier of—</text>
				<paragraph id="id1B845C14E91E4505A9D84546369F7F40"><enum>(1)</enum><text>the first
			 calendar year following 2 years after the date of enactment of this Act;
			 or</text>
				</paragraph><paragraph id="idF0D51E144C914320B6F99212A379801E"><enum>(2)</enum><text>any calendar year
			 determined by the Office of Personnel Management.</text>
				</paragraph></subsection></section></legis-body>
