			 loan program</header><text display-inline="yes-display-inline">Section 601(k)
			 of the Rural Electrification Act of 1936 (7 U.S.C. 950bb(k)) is amended by
			 striking <quote>September 30, 2007</quote> and inserting <quote>September 30,
			 2012</quote>.</text>
			</subsection><subsection commented="no" id="idB81C77D894CF4748BD49D3260B783CA3"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">Section
			 601(j) of the Rural Electrification Act of 1936 (7 U.S.C. 950bb(j)) is
			 amended—</text>
				<paragraph commented="no" id="id90EA8736DE6343EA81AF5DED494CB153"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>

			 eligible rural area</header>
			<subsection id="id1F69201EB9674833B3744206A4D9805B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 601(b)(2) of
			 the Rural Electrification Act of 1936 (7 U.S.C. 950bb(b)(2)) is amended to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idC5FAD047E761425B97D59DA4DD117B82" style="OLC">
					<paragraph id="id26EC9A1D1AE54BCFAC42992AE726D4C5"><enum>(2)</enum><header>Eligible rural
				area</header><text>The term <quote>eligible rural area</quote> means any area
				other than—</text>
						<subparagraph id="IDab876473dd6b40f2806d546a46d941d0"><enum>(A)</enum><text>a city or town
				that has a population of greater than 20,000 inhabitants;</text>
						</subparagraph><subparagraph id="IDd19727809f524593908421f745b34120"><enum>(B)</enum><text>the urbanized
				area contiguous and adjacent to such a city or town; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70C2968EAF5A4CA68B99D69BAD12D24A"><enum>(C)</enum><text>an area
				determined by the Secretary to be predominantly urban in
				character.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE18DC7DAC42E4AB2B80F25B71B4A5363"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 601 of the Rural Electrification Act of 1936 (7
			 U.S.C. 950bb) is amended—</text>
				<paragraph id="id15C216DB3AD34616BEC12558E6AB3F2B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>eligible rural
			 community</quote> each place that term appears and inserting <quote>eligible
			 rural area</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD576D7C3773943F0ADE1004FE86C2F07"><enum>(2)</enum><text>by striking
			 <quote>eligible rural communities</quote> each place that term appears and
			 inserting <quote>eligible rural areas</quote>.</text>
				</paragraph></subsection><subsection id="id030663831AE843C1A11C33720B30672F"><enum>(c)</enum><header>Non-duplication
			 requirement</header><text display-inline="yes-display-inline">Section 601(c) of
			 the Rural Electrification Act of 1936 (7 U.S.C. 950bb(c)) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4DC8FEBE3AA647DDB7163124987B8749" style="OLC">
					<paragraph id="idFA76CE22491A48C481B54E2623AFA281"><enum>(3)</enum><header>Non-duplication
				requirement</header>
						<subparagraph id="id9A7B7D12072248D7B3BE0B0B539D17BD"><enum>(A)</enum><header>In
				general</header><text>No loan shall be made under this section unless the
				Secretary determines (and set forth his reasons therefor in writing) that no
				duplication of terrestrial lines, facilities, or systems, providing broadband
				services will result therefrom.</text>
						</subparagraph><subparagraph id="id6D9D908B709F43C08A74DF454904124E"><enum>(B)</enum><header>Exception</header>
							<clause id="idF01A53769D044B94B7C6670B358AFE06"><enum>(i)</enum><header>In
				general</header><text>The non-duplication prohibition under subparagraph (A)
				may be waived if the Secretary, in his discretion, determines that such
				duplication is necessary and incidental in order to furnish or improve
				broadband service in an eligible rural area.</text>
							</clause><clause id="id87FED54848B945DD96CFE56D00DCE3E7"><enum>(ii)</enum><header>Limitation</header><text>The
				waiver authority granted to the Secretary under clause (i) may only be used to
				provide loans or loan guarantees for duplication of service when at least 75
				percent of the total end users served by the proposed project to be funded by
				such loan or loan guarantee are without access to broadband service.</text>
							</clause></subparagraph></paragraph><paragraph id="idD0FC600095644D98B23B8371C831C70C"><enum>(4)</enum><header>Submission and
				notification of required information</header>
						<subparagraph id="idA8FAB8B7A31B4D1EA72048185A430C61"><enum>(A)</enum><header>In
				general</header><text>No loan shall be made under this section unless the
				entity eligible to obtain such loan or loan guarantee—</text>
							<clause id="id18495AEB5E6C4BADB47BE2706922810C"><enum>(i)</enum><text>submits to the
				Secretary the following information relating to each incumbent broadband
				service provider that provides broadband service in the area to be served by
				the entity:</text>
								<subclause id="id36E5C58137F14FD7B354A685F52FEBA4"><enum>(I)</enum><text>Name and physical
				address of such provider.</text>
								</subclause><subclause id="id8E7A1AA7A2DF48F696519669CF62C662"><enum>(II)</enum><text>The rate such
				provider charges for use of its network or services.</text>
								</subclause><subclause id="idFC3F516D031D43A4BC48106D9A369ED0"><enum>(III)</enum><text>The service
				area of such provider; and</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1D36436FB96F4A0888425A7F5EB9DBC5"><enum>(ii)</enum><text>provides notice,
				in writing, to each such provider when the entity has submitted such
				information to the Secretary.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF8FD25C1ACDC42E58188E5E2F0BADBF4"><enum>(B)</enum><header>30-day public
				comment period</header><text>The Secretary—</text>
							<clause commented="no" display-inline="no-display-inline" id="idDA155203370347829ED176372510996B"><enum>(i)</enum><text>shall make no
				loan under this section unless the Secretary has provided for a 30-day period
				for public comment on the loan and the proposed scope and use of the proceeds
				from such loan; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF8981029415F4C87A6E01511A3BD633D"><enum>(ii)</enum><text>may, in response
				to such comments, make such modifications to the loan as he deems
				appropriate.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id7ED61930CA7A454080827D70D5744FAA"><enum>4.</enum><header>Acceleration of
			 loan applications</header>
			<subsection id="id68278963BC604877BBAAE37EEBC4E43C"><enum>(a)</enum><header>180-day
			 processing period</header><text display-inline="yes-display-inline">Section
			 601(c) of the Rural Electrification Act of 1936 (7 U.S.C. 950bb(c)), as amended
			 by section 4(c), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id77176CADB926454D88C4273B4D3786CD" style="OLC">
					<paragraph id="id240749CFC6254708B2D893105FA6BF97"><enum>(5)</enum><header>180-day
				processing period</header><text display-inline="yes-display-inline">Not later
				than 180 days after the receipt of an application for a loan or loan guarantee
				under this section, the Secretary shall complete processing of each such
				application.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id5D04286E914E4804A9EF061120EF6609"><enum>(b)</enum><header>Simplification
			 of the application process and post-application audit requirements</header>
				<paragraph id="id3FF50276A94B475DA0145F9F98D0D43F"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In carrying out title
			 VI of the Rural Electrification Act of 1936 (7 U.S.C. 950bb et seq.), the
			 Secretary of Agriculture, in consultation with the Administrator of the Rural
			 Utilities Service, shall—</text>
					<subparagraph id="id81FC1DAC86624D3181E94736CCDCAE63"><enum>(A)</enum><text display-inline="yes-display-inline">remove any duplicative or unnecessary
			 application or audit requirements under that title, including allowing parent
			 companies, and their wholly owned subsidiaries, to file a single consolidated
			 application or audit report, if such application or report includes all
			 relevant financial information concerning the project which is the subject of
			 the loan or loan guarantee;</text>
					</subparagraph><subparagraph id="id1D25821929B34AE6BED0EAFCC61C26D3"><enum>(B)</enum><text>reduce the cost
			 and paperwork associated with such requirements;</text>
					</subparagraph><subparagraph id="id53EB6EC3DC4B493A98BAABB7969E43D7"><enum>(C)</enum><text>ensure that the
			 Secretary examines the total business plan of each applicant for a loan or loan
			 guarantee under that title, including the revenue such applicant generated from
			 sources unrelated to its broadband service, but connected or otherwise related
			 to the facilities financed by the loan or loan guarantee;</text>
					</subparagraph><subparagraph id="id7274C15217C24D2F80E4A482D6C8409B"><enum>(D)</enum><text>ensure that the
			 Secretary requires franchise agreements—</text>
						<clause id="idB6F4311DB31D4FF98C681DBA0113BC62"><enum>(i)</enum><text>only from those
			 areas in which the funds from any loan or loan guarantee under that title are
			 to be used; and</text>
						</clause><clause id="idEB8ED4D85C8D4090826CE76B2200F8CB"><enum>(ii)</enum><text>from such areas
			 only upon the release of such funds, as a condition for such release, and not
			 upon the initial filing of any application under section 601 of the Rural
			 Electrification Act of 1936 (7 U.S.C. 950bb);</text>
						</clause></subparagraph><subparagraph id="id66DA53BB72BC445EBB0A4E961B49B6F3"><enum>(E)</enum><text>eliminate the
			 required submission of an area survey under that title; and</text>
					</subparagraph><subparagraph id="idAD7BDEFD11A34D0C9F66FAEF0B5826C6"><enum>(F)</enum><text>require that any
			 recipient of a loan or loan guarantee under that title uses the funds from such
			 loan or loan guarantee within 3 years after receipt of such funds to build out
			 its broadband service in the eligible rural area for which such funds were
			 approved, except if the Secretary determines that the recipient was unable to
			 expend such funds due to circumstances beyond the control of the
			 recipient.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC1DA61C5F44541AA910BCAD94F4C02FF"><enum>(2)</enum><header>Definition of
			 subsidiary</header><text>In this subsection, the term <quote>subsidiary</quote>
			 means a business entity controlled, directly or indirectly, by another business
			 entity or person.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id64E40076FB214AF4B30115FFAA8254D0"><enum>(c)</enum><header>Additional
			 funding for staff</header><text>Section 601 of the Rural Electrification Act of
			 1936 (7 U.S.C. 950bb) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD88B753549A74E0F807CC6BBFB438CC0" style="OLC">
					<subsection id="id3F36AAD6C158445E8A9F594ED5EEA2D0"><enum>(l)</enum><header>Additional
				staff</header><text>The Secretary, in his or her discretion, may hire such
				additional administrative personnel, including general field representatives
				and legal staff, as is necessary to carry out the administrative duties under
				this
				section.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id8B437762089D4815B25C3C0090AEEBDE"><enum>5.</enum><header>Elimination of
			 2-percent limit</header><text display-inline="no-display-inline">Section 601(d)
			 of the Rural Electrification Act of 1936 (7 U.S.C. 950bb(d)) is amended by
			 striking paragraph (3).</text>
		</section><section id="idC22111EB698246008DC16EB3174C005A"><enum>6.</enum><header>Grant
			 program</header><text display-inline="no-display-inline">Title VI of the Rural
			 Electrification Act of 1936 (7 U.S.C. 950bb et seq.) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE3E10BA0E1794764BCD2B9370EC95372" style="OLC">
				<section id="idFB3AD2623C1E40B4AE267E8ABCBDE733"><enum>602.</enum><header>Rural area map
				and connect grant program</header>
					<subsection id="ID089FC5E4F7EE49F98502836D1C93E82D"><enum>(a)</enum><header>Purposes</header><text>The
				purposes of any grant under subsection (b) are—</text>
						<paragraph id="IDf43b1b00519e46579ebeac8371b2815a"><enum>(1)</enum><text>to complement the
				loan and loan guarantee program under section 601 with grants administered by
				the Secretary;</text>
						</paragraph><paragraph id="ID804fa9550ea244d09259d86fac755733"><enum>(2)</enum><text>to promote
				public-private partnerships for the mapping of broadband availability and
				demand in rural areas; and</text>
						</paragraph><paragraph id="ID2f7bb070fbaa4a02aadb12fc320ac74d"><enum>(3)</enum><text>to enhance the
				feasibility of providing broadband service to rural areas.</text>
						</paragraph></subsection><subsection id="id9138B54FEBD04E6398A2F01F77280E16"><enum>(b)</enum><header>Grants
				authorized</header>
						<paragraph id="ID66B1BE28A94D4BDE88C5E8B525376CA2"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall award grants to eligible entities for
				the development and implementation of statewide initiatives to identify and
				track the availability and adoption of broadband services within eligible rural
				areas.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5B7DAA6E8CAB497AB8C591BE7B81ED92"><enum>(2)</enum><header>Competitive
				basis</header><text>All grants under paragraph (1) shall be awarded on a
				competitive basis.</text>
						</paragraph></subsection><subsection id="ID3F2CB34C64F3453D984351D1096BB491"><enum>(c)</enum><header>Application</header><text>To
				be eligible to receive a grant under subsection (b), an eligible entity shall
				submit an application to the Secretary, at such time, in such manner, and
				containing such information as the Secretary may require.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id9EAACB44E44B4074984DA2B5343CBF13"><enum>(d)</enum><header>Cap on grant
				amount</header><text>Any grant awarded under subsection (b) shall not exceed an
				amount that is equal to the amount that is 20 percent of the net projected cost
				of any initiative to be funded by such amounts.</text>
					</subsection><subsection id="ID13B7F8B0528F42708A56968D403DE203"><enum>(e)</enum><header>Use of
				Funds</header><text>A grant awarded to an eligible entity under subsection (b)
				shall be used—</text>
						<paragraph id="ID328775a1482b435687f9820956ece5ab"><enum>(1)</enum><text>to ensure that
				such entity works collaboratively with broadband service providers to encourage
				broadband deployment and use in areas without broadband service;</text>
						</paragraph><paragraph id="IDE3A157003C5E4968B52C0F18C080833D"><enum>(2)</enum><text>to identify and
				track—</text>
							<subparagraph id="ID9500DC631A6242B0901957EBB49C3393"><enum>(A)</enum><text>rural areas in
				each State that do not have broadband service;</text>
							</subparagraph><subparagraph id="IDFE2020251EDD4EC7BE5CE0F438EF081E"><enum>(B)</enum><text>the rate at which
				residential and business end users adopt such service;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1387920A66FB4101A0BF63A0F45A4D50"><enum>(C)</enum><text>possible
				suppliers of such service; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF91DDBDA76C64D94B2E68C0F5665A512"><enum>(D)</enum><text>barriers to the
				adoption of such service, including whether or not—</text>
								<clause id="IDE0496F2DA43D40D893ED292B73E87A1E"><enum>(i)</enum><text>the demand for
				such services is absent; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDF94050A3AF9A4951A0682BF7BA11DF03"><enum>(ii)</enum><text>the supply for
				such services is capable of meeting the demand for such services;</text>
								</clause></subparagraph></paragraph><paragraph id="ID07852D2E960946DA921101832FD7DBBA"><enum>(3)</enum><text>to create and
				facilitate in eligible rural areas in a State a local rural broadband planning
				team—</text>
							<subparagraph id="ID8601074F248D4F0AB9577EAE52BEDA04"><enum>(A)</enum><text>comprised of
				relevant rural area representatives, including, where applicable,
				representatives of business, education, health care, local government,
				agriculture, and broadband service providers; and</text>
							</subparagraph><subparagraph id="ID4D612289DDBE4F46BEF54E70D0473989"><enum>(B)</enum><text>which
				shall—</text>
								<clause id="ID8E45F04F62FC488EB0C2E1CCC57B08D4"><enum>(i)</enum><text>baseline
				broadband use across relevant rural area sectors;</text>
								</clause><clause id="ID31D883180CCC4CE48F427709D9D6C58C"><enum>(ii)</enum><text>set goals for
				improved broadband use within each sector; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDBE26DEBC2E7349518E00BE8DCD3181E5"><enum>(iii)</enum><text>develop a
				tactical business plan for achieving its goals;</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09DDCCBD6134430E9C035EEBE7BE81A9"><enum>(4)</enum><text>to facilitate
				information exchange regarding the use, demand, and existence of broadband
				service between the public and private sectors;</text>
						</paragraph><paragraph id="ID8BFC68B5A85849EA9D81ED42CA9729D1"><enum>(5)</enum><text>to create within
				each State a geographic inventory map of broadband service in order to identify
				gaps in broadband service in eligible rural areas through a method of
				geographic information system mapping of service availability and geographic
				information system analysis at the census block level;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF0E9528E41274C8A81784270F90FF233"><enum>(6)</enum><text>to provide a
				baseline assessment of statewide broadband deployment in eligible rural areas
				within the State; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB261D2A6749B4AA8B9138B2FBA3E2D1E"><enum>(7)</enum><text>to ensure
				nondisclosure of any proprietary content or information that may be accessed,
				discovered, or reported in carrying out any of the activities described in
				paragraphs (1) through (6).</text>
						</paragraph></subsection><subsection id="IDF733D98D80E141B1AEE28350D3E98B27"><enum>(f)</enum><header>Participation
				Limit</header>
						<paragraph id="idD515CD9D503C4F87AA7C78274650C075"><enum>(1)</enum><header>Avoiding
				duplicative initiatives</header><text>No State shall have more than 1 eligible
				entity receive a grant under this section to perform the activities described
				in subsection (d) within that State.</text>
						</paragraph><paragraph id="id88126087BF724D3FA791ED7F297669D5"><enum>(2)</enum><header>Prohibition on
				continuing grants</header><text>For each State, an eligible entity may not
				receive a new grant under this section to fund the activities described in
				subsection (d) within that State, if such entity obtained prior grant awards
				under this section to fund the same activities in that State in any previous
				year.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID06C43E3A2BD643FD93EE4A62F145F07A"><enum>(g)</enum><header>Report</header><text>Each
				recipient of a grant under subsection (b) shall submit a report on the use of
				the funds provided by the grant to the Secretary.</text>
					</subsection><subsection commented="no" id="id36D710220E984333AAFE0E635FF41F75"><enum>(h)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out the provisions of this section $20,000,000 for each of fiscal years
				2008 through 2012.</text>
					</subsection><subsection id="ID5CABFDC7881647748512FE4C8B2C3FA3"><enum>(i)</enum><header>No Regulatory
				Authority</header><text>Nothing in this section shall be construed as giving
				any public or private entity established or affected by this section any
				regulatory jurisdiction or oversight authority over providers of broadband
				services or information technology.</text>
					</subsection><subsection commented="no" id="id842F794B694F4FCBBCE295142AFC8F99"><enum>(j)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph commented="no" id="id1078F0ABABD54EFAAB550627F6660AE4"><enum>(1)</enum><header>Secretary,
				broadband service, and eligible rural area</header><text>The terms
				<quote>Secretary</quote>, <term>broadband service</term>, and <quote>eligible
				rural area</quote> have the same meaning as in section 601 of this Act.</text>
						</paragraph><paragraph commented="no" id="idC967ECB78F5B4B2D9E8EC2F60645D237"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <quote>eligible entity</quote> means a nonprofit
				organization that is selected by a State to work in partnership with State
				agencies and private sector partners in identifying and tracking the
				availability and adoption of broadband services in eligible rural areas of that
				State.</text>
						</paragraph><paragraph id="ID06D066BFA4E04E2BA61498841F3C322B"><enum>(3)</enum><header>Nonprofit
				Organization</header><text>The term <term>nonprofit organization</term> means
				an organization—</text>
							<subparagraph id="IDB5ED0657083346EB8561D9CA9049481F"><enum>(A)</enum><text>described in
				section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from tax
				under section 501(a) of such Code;</text>
							</subparagraph><subparagraph id="IDFD35F5FD8BA1411B8DFCAA995F642D50"><enum>(B)</enum><text>no part of the
				net earnings of which inures to the benefit of any member, founder,
				contributor, or individual;</text>
							</subparagraph><subparagraph id="ID9B774579118F41708D49BDEE61ABDFFA"><enum>(C)</enum><text>that has an
				established competency and proven record of working with public and private
				sectors to accomplish widescale deployment and adoption of broadband services
				and information technology; and</text>
							</subparagraph><subparagraph id="IDA0AD07B3CB0C4456AF7598C1B3BE2714"><enum>(D)</enum><text>the board of
				directors of which is not composed of a majority of individuals who are also
				employed by, or otherwise associated with, any Federal, State, or local
				government or any Federal, State, or local
				agency.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF435E04EC8924F84B189FBEF5FDD7006"><enum>7.</enum><header>Loan
			 security</header>
			<subsection id="id4B0E909C5F0E45E08750029B6162DDCF"><enum>(a)</enum><header>Adequacy of
			 security</header><text display-inline="yes-display-inline">In carrying out
			 title VI of the Rural Electrification Act of 1936 (7 U.S.C. 950bb et seq.), the
			 Secretary of Agriculture, in consultation with the Administrator of the Rural
			 Utilities Service, shall ensure that—</text>
				<paragraph id="id5E10CDDAEE81417CAC7CC30E31CF455D"><enum>(1)</enum><text>the type, amount,
			 and method of security used to secure any loan or loan guarantee under that
			 title is commensurate to the risk involved with each such loan or loan
			 guarantee, particularly when a loan or loan guarantee is issued to a
			 financially healthy, strong, and stable entity; and</text>
				</paragraph><paragraph id="id3979A20995884C23A17C3639720C5D86"><enum>(2)</enum><text>any loan
			 guarantee issued under that title is guaranteed for not less than 80 percent of
			 the amount of the outstanding principal of the loan to be guaranteed.</text>
				</paragraph></subsection><subsection id="id9D6ED2B369774874B6EE04691DA80242"><enum>(b)</enum><header>10 percent
			 equity requirement</header><text>Section 601(d) of the Rural Electrification
			 Act of 1936 (7 U.S.C. 950bb(d)), as amended by section 5, is further amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id90FCC12C3D9C49319B8A4F22D59CE6A5" style="OLC">
					<paragraph id="idD3D35D234253477FAB9AD0423B363BC3"><enum>(3)</enum><header>10 percent
				equity requirement</header>
						<subparagraph id="idEA91D292841F49879ECED4BED6860FC8"><enum>(A)</enum><header>In
				general</header><text>An entity shall not be eligible for a loan or loan
				guarantee under this section unless the entity can demonstrate a minimum equity
				position equal to or greater than 10 percent of the requested loan or loan
				guarantee amount.</text>
						</subparagraph><subparagraph id="idAA13D7EFC3FF4E4D892DD2525B41E298"><enum>(B)</enum><header>Shortfall
				exception</header><text>If at the time an entity submits its application for a
				loan under this section, the entity cannot meet the requirement under
				subparagraph (A), the Secretary may modify or waive the requirement, if the
				entity can meet a minimum TIER requirement of
				1.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id91B007348E5F4896984D92D5C912D0B3"><enum>(c)</enum><header>Proof of
			 financial feasability</header><text>Section 601(d) of the Rural Electrification
			 Act of 1936 (7 U.S.C. 950bb(d)), as amended by subsection (c) and section 5, is
			 further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4A78F9396B59428A85EA18B32E81AF81" style="OLC">
					<paragraph id="id694EE4992D32475D85E27F227A4E8C67"><enum>(4)</enum><header>Proof of
				financial feasability</header>
						<subparagraph id="idFABE3880FF264CB6B266B473D824307D"><enum>(A)</enum><header>In
				general</header><text>An entity shall not be eligible for a loan under this
				section unless the entity can demonstrate the ability to generate sufficient
				revenues to—</text>
							<clause id="idC8AF0CCFE04043CC8984469DC0877256"><enum>(i)</enum><text>cover its
				expenses and service its debt; and</text>
							</clause><clause id="idAF571A94D7E94C568EABC990C957D6B7"><enum>(ii)</enum><text>meet a minimum
				TIER requirement of 1 by the end of the 5-year forecast period used by the
				Secretary to determine the feasability of each loan.</text>
							</clause></subparagraph><subparagraph id="id53E60ABEF3764D049674000CAAC5C5F1"><enum>(B)</enum><header>Limitation</header><text>The
				Secretary shall not promulgate regulations requiring eligible entities to meet
				a minimum TIER requirement greater than 1.</text>
						</subparagraph></paragraph><paragraph id="idF3A06493F8B34D729DEF6E38ACD2A0CA"><enum>(5)</enum><header>Definition of
				TIER</header><text>In this subsection, the term <quote>TIER</quote> or
				<quote>Times Interest Earned Ratio</quote> means the ratio of an entity's net
				income (after taxes) adding back in any interest expense, divided by the
				entity's interest
				expense.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idB8AF9623476946F1B9E92230165DC9DD"><enum>8.</enum><header>Expansion of the
			 terms of loans</header><text display-inline="no-display-inline">Section
			 601(g)(2) of the Rural Electrification Act of 1936 (7 U.S.C. 950bb(g)(2)) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id5C197AD700ED450BA4227B4CEA033F60" style="OLC">
				<paragraph id="id33314D563C544078BD72BCE810CD6443"><enum>(2)</enum><text>have a term to be
				decided by the borrower, provided—</text>
					<subparagraph id="id0B9ABB46157F43B89B9968CDF6CBFFF3"><enum>(A)</enum><text>that such term
				does not exceed 35 years; and</text>
					</subparagraph><subparagraph id="id0D741E8172274BACB78B3BE1F2B2C7A5"><enum>(B)</enum><text>that the loan is
				adequately
				secured.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idDD0D4393B7874C92A335FC56040397F5"><enum>9.</enum><header>Clarification of
			 neutrality standard</header><text display-inline="no-display-inline">Section
			 601(f) of the Rural Electrification Act of 1936 (7 U.S.C. 950bb(g)(2)) is
			 amended by inserting after <quote>neutral</quote> the following: “, including
			 the use of the following technologies:</text>
			<quoted-block display-inline="no-display-inline" id="id187DC5A29DAA483C9AF1F90AD20576F7" style="OLC">
				<paragraph id="id5425148F8084446EA81F8FA6CD473A0E"><enum>(1)</enum><text display-inline="yes-display-inline">Digital subscriber lines.</text>
				</paragraph><paragraph id="id2BAEB747545A478193C51D35A0174F86"><enum>(2)</enum><text display-inline="yes-display-inline">Fiber-optic cable.</text>
				</paragraph><paragraph id="id5357E6E5200748A39598B40FCD351A2D"><enum>(3)</enum><text display-inline="yes-display-inline">Coaxial cable.</text>
				</paragraph><paragraph id="id8DD010A3F65243AABDCD737F132ACC0D"><enum>(4)</enum><text display-inline="yes-display-inline">Wireless technology.</text>
				</paragraph><paragraph id="idE30663EFAF184E08880E2FB062EC0D17"><enum>(5)</enum><text display-inline="yes-display-inline">Satellite.</text>
