		<official-title>To amend the National Energy Conservation Policy Act to
		  promote the use of energy and water efficiency measures in Federal buildings,
		  to promote energy savings performance contracts and utility energy service
		  contracts, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Federal Building Renewal and
			 Energy Savings Act of 2007</short-title></quote>.</text>
		</section><section id="id1EE0BE6ED9A14999AD2807C278F0E5AB"><enum>2.</enum><header>Use of energy
			 and water efficiency measures in Federal buildings</header><text display-inline="no-display-inline">Section
			 543 of the National Energy Conservation Policy Act (42 U.S.C. 8253) is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id1EC1955D3202495ABD6929FFA9AD11EA" style="OLC">
				<subsection id="id420B9DC4CDDA43C79103261CF2CAB7E0"><enum>(f)</enum><header>Use of energy
				and water efficiency measures in Federal buildings</header>
					<paragraph id="ID410cfd7ffa8c4f89847546c37d7a9318"><enum>(1)</enum><header>Energy and
				water evaluations</header><text display-inline="yes-display-inline">Not later
				than 1 year after the date of enactment of this subsection, and every 3 years
				thereafter, each Federal agency shall complete a comprehensive energy and water
				evaluation for—</text>
						<subparagraph id="idEC75390BE3674487B89721468C9413DE"><enum>(A)</enum><text display-inline="yes-display-inline">each building and other facility of the
				Federal agency that is larger than a minimum size established by the Secretary;
				and</text>
						</subparagraph><subparagraph id="idE7B0E182AB5F4505845C31907C693D1D"><enum>(B)</enum><text display-inline="yes-display-inline">any other building or other facility of the
				Federal agency that meets any other criteria established by the
				Secretary.</text>
						</subparagraph></paragraph><paragraph id="ID0b9105d78cac4887966882c195d5d790"><enum>(2)</enum><header>Implementation
				of identified energy and water efficiency measures</header>
						<subparagraph id="IDdfe09a02055a4a829245b2720bdaf5d3"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of
				this subsection, and every 3 years thereafter, each Federal agency—</text>
							<clause id="id19A9DB7F8B1B44ECA67594656C0D1D50"><enum>(i)</enum><text>shall fully
				implement each energy and water-saving measure that the Federal agency
				identified in the evaluation conducted under paragraph (1) that has a 15-year
				simple payback period; and</text>
							</clause><clause id="id142D303AF62344A7B2610B71E15C1691"><enum>(ii)</enum><text>may implement
				any energy or water-saving measure that the Federal agency identified in the
				evaluation conducted under paragraph (1) that has longer than a 15-year simple
				payback period.</text>
							</clause></subparagraph><subparagraph id="ID57cbd2c445e9430783246c1ccf6fe359"><enum>(B)</enum><header>Payback
				period</header>
							<clause id="id299B4CAC5E1C4D06A27D5CC1444DDDE2"><enum>(i)</enum><header>In
				general</header><text>For the purpose of subparagraph (A), a measure shall be
				considered to have a 15-year simple payback if the quotient obtained under
				clause (ii) is less than or equal to 15.</text>
							</clause><clause id="id5777AF6C0CA74ECA9A34C460FB529983"><enum>(ii)</enum><header>Quotient</header><text>The
				quotient for a measure shall be obtained by dividing—</text>
								<subclause id="idCEFAEC88CBBF4AD99E38384F1B09FF43"><enum>(I)</enum><text>the estimated
				initial implementation cost of the measure (other than financing costs);
				by</text>
								</subclause><subclause id="id01C7C0468F5A4048B34FE2AD8128E2C9"><enum>(II)</enum><text>the annual cost
				savings from the measure.</text>
								</subclause></clause></subparagraph><subparagraph id="idBDBAB5EF839448A49B8085CD987485DE"><enum>(C)</enum><header>Cost
				savings</header><text>For the purpose of subparagraph (B), cost savings shall
				include net savings in estimated—</text>
							<clause id="id468B972C5CE749B5AB893AEFB5507873"><enum>(i)</enum><text>energy and water
				costs;</text>
							</clause><clause id="id46552B542037475E9182095867F9FA85"><enum>(ii)</enum><text>operations,
				maintenance, repair, replacement, and other direct costs; and</text>
							</clause><clause id="id2D45687AFABA43C591BD87D453E6D980"><enum>(iii)</enum><text>external
				environmental, health, security, and other costs based on a cost adder, as
				determined in accordance with the guidelines issued by the Secretary under
				paragraph (4).</text>
							</clause></subparagraph><subparagraph id="idB2201CDF3952400D8C9B49A9575F39A5"><enum>(D)</enum><header>Exceptions</header><text>The
				Secretary may modify or make exceptions to the calculation of a 15-year simple
				payback under this paragraph in the guidelines issued by the Secretary under
				paragraph (4).</text>
						</subparagraph></paragraph><paragraph id="ID7f513515e31a4b50b5e4b03575c9c03e"><enum>(3)</enum><header>Follow-up on
				implemented measures</header><text display-inline="yes-display-inline">For each
				measure implemented under paragraph (2), each Federal agency shall carry
				out—</text>
						<subparagraph id="idF3ACF720DE7C4B78AC6F128A08E35574"><enum>(A)</enum><text display-inline="yes-display-inline">commissioning;</text>
						</subparagraph><subparagraph id="idCB9DEE1505DA4EA3AB60A0C8E1EA98D6"><enum>(B)</enum><text display-inline="yes-display-inline">operations, maintenance, and repair;
				and</text>
						</subparagraph><subparagraph id="idA86C7FF02E9C4CD78C87B99E2B110DF9"><enum>(C)</enum><text display-inline="yes-display-inline">measurement and verification of energy and
				water savings.</text>
						</subparagraph></paragraph><paragraph id="ID7f9e888e44df4e9dba7a678884ff7cb4"><enum>(4)</enum><header>Guidelines</header>
						<subparagraph id="ID755712dbf1f34bb2ab7e0f24fcd70c7b"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall issue guidelines and necessary
				criteria that each Federal agency shall follow for implementation of—</text>
							<clause id="id32DADDE247F44D8398AF2CF29385D729"><enum>(i)</enum><text>paragraph (1) not
				later than 90 days after the date of enactment of this subsection; and</text>
							</clause><clause id="id28F9D414E8BE4AAC9CE92FBDDD14E9B3"><enum>(ii)</enum><text>paragraphs (2)
				and (3) not later than 180 days after the date of enactment of this
				subsection.</text>
							</clause></subparagraph><subparagraph id="id871A3339561044F2B95F671FC58A8894"><enum>(B)</enum><header>Relationship to
				funding source</header><text>The guidelines issued by the Secretary under
				subparagraph (A) shall be appropriate and uniform for measures funded with each
				type of funding made available under paragraph (8).</text>
						</subparagraph></paragraph><paragraph id="ID8caf5e1406454333af067c5eb0e19fae"><enum>(5)</enum><header>Web-based
				certification</header>
						<subparagraph id="ID04fb4cf743384b3d898db4abd11ffeab"><enum>(A)</enum><header>In
				general</header><text>For each building and other facility that meets the
				criteria established by the Secretary under paragraph (1), each Federal agency
				shall use a web-based tracking system to certify compliance with the
				requirements for—</text>
							<clause id="idE8CBAC7970B14FC2B5713DDE923B8470"><enum>(i)</enum><text>energy and water
				evaluations under paragraph (1);</text>
							</clause><clause id="idD2770A224AC144DB81FC6C2B8AD22247"><enum>(ii)</enum><text>implementation
				of identified energy and water measures under paragraph (2); and</text>
							</clause><clause id="idFD4D835937434B7CA911FAAAAEC29635"><enum>(iii)</enum><text>follow-up on
				implemented measures under paragraph (3).</text>
							</clause></subparagraph><subparagraph id="ID9e2b2d908c5c4e4fb9ec009e53586421"><enum>(B)</enum><header>Deployment</header><text>Not
				later than 1 year after the date of enactment of this subsection, the Secretary
				shall deploy the web-based tracking system required under this paragraph in a
				manner that tracks, at a minimum—</text>
							<clause id="id0EE5C9941EB148CBAA262B233E435ACE"><enum>(i)</enum><text>the covered
				buildings and other facilities;</text>
							</clause><clause id="idA3B1A8C8CFAF47A78A0E620821255E9D"><enum>(ii)</enum><text>the status of
				evaluations;</text>
							</clause><clause id="id5A4A81DE3ABA4E0FB3BF928E75A29EBB"><enum>(iii)</enum><text>the identified
				measures, with estimated costs and savings;</text>
							</clause><clause id="id477E5C9FF12346C2831ED3DFFF51210F"><enum>(iv)</enum><text>the status of
				implementing the measures;</text>
							</clause><clause id="id895AEE4219EE4326A5AA535E37183088"><enum>(v)</enum><text>the measured
				savings; and</text>
							</clause><clause id="idAF726DEF24944039AB9FB951D882C06F"><enum>(vi)</enum><text>the persistence
				of savings.</text>
							</clause></subparagraph><subparagraph id="ID4799abc2b54a4f329ec1da39dfa50e92"><enum>(C)</enum><header>Availability</header>
							<clause id="id649460DE13AB46048A1E1BFD26FE9169"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), the Secretary shall make the
				web-based tracking system required under this paragraph available to Congress,
				other Federal agencies, and the public through the Internet.</text>
							</clause><clause id="id0A04E7B570AC4802A17B792FD94A5588"><enum>(ii)</enum><header>Exemptions</header><text>At
				the request of a Federal agency, the Secretary may exempt specific data for
				specific buildings from disclosure under clause (i) for national security
				purposes.</text>
							</clause></subparagraph></paragraph><paragraph id="IDd8899e30e85f419db655bd58637eb0f3"><enum>(6)</enum><header>Benchmarking of
				Federal facilities</header>
						<subparagraph id="IDfa9afb18fdca4d809678f4102d07de13"><enum>(A)</enum><header>In
				general</header><text>Each Federal agency shall enter energy use data for each
				building and other facility of the Federal agency into a building energy use
				benchmarking system, such as the Energy Star Portfolio Manager.</text>
						</subparagraph><subparagraph id="IDba457b13a9bd4fd9822c2e37c7d3eaa5"><enum>(B)</enum><header>System and
				guidance</header><text>Not later than 1 year after the date of enactment of
				this subsection, the Secretary shall—</text>
							<clause id="id8A1C400B158F44F2893E9CABA1722580"><enum>(i)</enum><text>select or develop
				the building energy use benchmarking system required under this paragraph for
				each type of building; and</text>
							</clause><clause id="idF86594668CBD48FDA50BC570129343A9"><enum>(ii)</enum><text>issue guidance
				for use of the system.</text>
							</clause></subparagraph></paragraph><paragraph id="ID6a677c424b45443da70fed56805bd104"><enum>(7)</enum><header>Federal agency
				scorecards</header>
						<subparagraph id="id4DF252B42E6E40FABAC2749E5BE5127F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director of the
				Office of Management and Budget shall issue quarterly scorecards for energy
				management activities carried out by each Federal agency that includes—</text>
							<clause id="idE125C7B15F4148DFB42374CDA8F4DEF2"><enum>(i)</enum><text display-inline="yes-display-inline">summaries of the status of—</text>
								<subclause id="id66478536A4784209B79169C580BC4A02"><enum>(I)</enum><text display-inline="yes-display-inline">energy and water evaluations under
				paragraph (1);</text>
								</subclause><subclause id="id84021FD8D59648229573304A5C577021"><enum>(II)</enum><text display-inline="yes-display-inline">implementation of identified energy and
				water measures under paragraph (2); and</text>
								</subclause><subclause id="idC979077028AD432DACD1A28893E3317F"><enum>(III)</enum><text display-inline="yes-display-inline">follow-up on implemented measures under
				paragraph (3); and</text>
								</subclause></clause><clause id="idDB3A7C82BD6D4820A10C099F3AF74525"><enum>(ii)</enum><text display-inline="yes-display-inline">any other means of measuring performance
				that the Director considers appropriate.</text>
							</clause></subparagraph><subparagraph id="id7DFD8BAD2A944700A77703C42E462745"><enum>(B)</enum><header>Availability</header><text display-inline="yes-display-inline">The Director shall make the scorecards
				required under this paragraph available to Congress, other Federal agencies,
				and the public through the Internet.</text>
						</subparagraph></paragraph><paragraph id="ID8c3fbb7ca3c54b239800c6c29fbaa011"><enum>(8)</enum><header>Funding</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDbbe3de368c9c4bca8f15105610ed3e70"><enum>(A)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated such sums as are necessary to carry out this
				subsection.</text>
						</subparagraph><subparagraph id="IDf3238a8ed17c49d3a26f61b14fca4929"><enum>(B)</enum><header>Funding
				options</header>
							<clause id="id15311DDA7DCA4F5FAAB9BC91FBCD24B6"><enum>(i)</enum><header>In
				general</header><text>To carry out paragraphs (1) through (3), a Federal agency
				may use any combination of—</text>
								<subclause id="idA55BB81928AC4592983C72E9BC2A6018"><enum>(I)</enum><text>appropriated
				funds made available under subparagraph (A); and</text>
								</subclause><subclause id="idBA84E1C178A845D99D206DC618CB5C7A"><enum>(II)</enum><text>private
				financing, including financing available through energy savings performance
				contracts or utility energy savings contracts.</text>
								</subclause></clause><clause id="ID8e4b45f8a4d04560a4c12f52f2adac67"><enum>(ii)</enum><header>Combined
				funding for same measure</header><text>A Federal agency may use any combination
				of appropriated funds and private financing described in clause (i) to carry
				out the same measure under this subsection, with proportional allocation for
				any energy and water savings.</text>
							</clause><clause id="IDd85576634f184a21b729d82d7897998b"><enum>(iii)</enum><header>Lack of
				appropriated funds</header><text>Since measures may be carried out using
				private financing described in clause (i), a lack of available appropriations
				shall not be considered a sufficient reason for the failure of a Federal agency
				to comply with paragraphs (1) through
				(3).</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idC96C6466DA5E4F06BC0534C89178B594"><enum>3.</enum><header>Energy savings
			 performance contracts</header><text display-inline="no-display-inline">Section
			 801 of the National Energy Conservation Policy Act (42 U.S.C. 8287) is
			 amended—</text>
			<paragraph id="id5ED06DA3C8A44B3191CA2FD0446ACDD9"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2)—</text>
				<subparagraph id="idC6E2D136993C4F4E869C0A8C12E0A448"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (D), by inserting
			 <quote>beginning on the date of the delivery order</quote> after <quote>25
			 years</quote>; and</text>
				</subparagraph><subparagraph id="idEC9F9E809FF649F294036BF8535910CA"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC77D0C3585E440959D19B45BA00EBD20" style="OLC">
						<subparagraph id="id81277E63D8DD4E54873CCEB47666EC41"><enum>(E)</enum><header>Promotion of
				contracts</header><text>In carrying out this section, a Federal agency shall
				not—</text>
							<clause id="id2C93E9E3E3524547A22DCD7180D1501A"><enum>(i)</enum><text>establish a
				Federal agency policy that limits the maximum contract term under subparagraph
				(D) to a period shorter than 25 years; or</text>
							</clause><clause id="id163ED1D7CED04A60BF4A639F1100A972"><enum>(ii)</enum><text>limit the total
				amount of obligations under energy savings performance contracts or other
				private financing of energy savings measures.</text>
							</clause></subparagraph><subparagraph id="ID29383c37303f4e8cbd22f504c5b9141f"><enum>(F)</enum><header>Measurement and
				verification requirements for private financing</header>
							<clause id="id784EAF9E4502466B8F522E6C4986D12A"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The evaluations and
				savings measurement and verification required under paragraphs (1) and (3) of
				section 543(f) shall be used by a Federal agency to meet the requirements
				for—</text>
								<subclause id="idC266BEF1D9FC47B5BB2EA6457A97860D"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of energy savings performance
				contracts, the need for energy audits, calculation of energy savings, and any
				other evaluation of costs and savings needed to implement the guarantee of
				savings under this section; and</text>
								</subclause><subclause id="idBF7721EFB2F64197B5215A237A610536"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of utility energy service
				contracts, needs that are similar to the purposes described in subclause
				(I).</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id56A4635C7BF642A7AFB9E32FFA162D6D"><enum>(ii)</enum><header>Modification
				of existing contracts</header><text display-inline="yes-display-inline">Not
				later than 180 days after the date of enactment of this subparagraph, each
				Federal agency shall, to the maximum extent practicable, modify any indefinite
				delivery and indefinite quantity energy savings performance contracts, and
				other indefinite delivery and indefinite quantity contracts using private
				financing, to conform to the amendments made by the
				<short-title>Federal Building Renewal and Energy Savings
				Act of 2007</short-title>.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idD655D62C156D4FEB944F212D6B3299F8"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (c);</text>
