			<paragraph id="ID21e2913bd69d453294cbabcd5be26d58"><enum>(1)</enum><text>diabetes, heart
			 disease, and other diet-related diseases can be reduced in part by improved
			 access to affordable healthy foods, including fresh fruit and
			 vegetables;</text>
			</paragraph><paragraph id="ID9d452d0744694f96ba98c6766a6c9bca"><enum>(2)</enum><text>increasing the
			 availability of healthy and fresh food in schools, hospitals, and underserved
			 communities is an important aspect of improving overall health and food
			 security in the United States;</text>
			</paragraph><paragraph id="ID903e8a3cc11e42c59ff6db730ace67bf"><enum>(3)</enum><text>strengthening
			 local and regional food systems—</text>
				<subparagraph id="id605F1CF0A859486AB61977EE68C381BA"><enum>(A)</enum><text>is necessary for
			 the long-term provision of fresh and healthy food to underserved communities;
			 and</text>
				</subparagraph><subparagraph id="id64CE7A85939542A3A4D31BE81DD59F46"><enum>(B)</enum><text>helps support
			 family farmers and the communities of the farmers by providing alternative
			 marketing channels for the agricultural products of the farmers;</text>
				</subparagraph></paragraph><paragraph id="ID1c6ddcbf936d455285cb41d94534ca9c"><enum>(4)</enum><text>local and
			 regional food systems that supply underserved communities should be provided
			 Federal financial and technical support, with a focus on—</text>
				<subparagraph id="idDF137FE2CDA34B0DBA55E348909EC5E3"><enum>(A)</enum><text>locally-led food
			 access initiatives;</text>
				</subparagraph><subparagraph id="idD7FE8ADBB8924E8BBF0BC6062E655BCC"><enum>(B)</enum><text>infrastructure
			 needs, such as food processing, transportation, and marketing;</text>
				</subparagraph><subparagraph id="ID1d81f8f0f523463f9f6368101c211b3a"><enum>(C)</enum><text>direct
			 farmer-to-consumer marketing activities, such as farmers’ markets;</text>
				</subparagraph><subparagraph id="idA586A7E9856549A5B12A57F6C6A19518"><enum>(D)</enum><text>the protection of
			 productive farmland in close proximity to urban areas, which is necessary to
			 grow food; and</text>
				</subparagraph><subparagraph id="ID440aaf8cf0f74d59baf9b9c5d8f69406"><enum>(E)</enum><text>access to fresh
			 fruit and vegetables for school children.</text>
				</subparagraph></paragraph></section><title id="id11269766463144DEAD431EC26F72F1EF"><enum>I</enum><header>Food
			 Stamp Program</header>
			<section id="idE2CB4F3C6B5A4A57B962CF8AC1EFBB57"><enum>101.</enum><header>Assistance for
			 community food projects</header><text display-inline="no-display-inline">Section 25 of the
			 <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (7 U.S.C.
			 2034) is amended—</text>
				<paragraph id="id569C5F5309A44521BD449205A8340DF3"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(B)—</text>
					<subparagraph id="idC471E42C39284D7A801B7BDB0E39E1E6"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>$5,000,000</quote> and
			 inserting <quote>$30,000,000</quote>; and</text>
					</subparagraph><subparagraph id="idC3872AD13E7C4691BBED005AB0E4EA25"><enum>(B)</enum><text>by striking
			 <quote>2007</quote> and inserting <quote>2013</quote>; and</text>
					</subparagraph></paragraph><paragraph id="idE655A9F22C684CE9A4FBE3B9B4BCEEE5"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (h)(4)—</text>

					</subparagraph></paragraph></section><section id="IDeb7f5c7d9d9948baad7d583628ec75c1"><enum>102.</enum><header>Food Stamp
			 nutrition education</header>
				<subsection id="ID88ab03cd67e047088fc4f412102878e2"><enum>(a)</enum><header>Definition of
			 food stamp nutrition education</header><text>Section 3 of the Food Stamp Act of
			 1977 (7 U.S.C. 2012) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0B98C14FE7B5422D9405C0151755A221" style="OLC">
						<subsection id="ID9b5a5c55ed2e42b9b198bbe069485fc7"><enum>(v)</enum><header>Food stamp
				nutrition education</header><text>The term <term>food stamp nutrition
				education</term> means direct education, group activities, community health
				promotion, and comprehensive public health approaches (including marketing,
				mass media, public-private partnerships, policy, systems and environmental
				changes, and evaluation) that—</text>
							<paragraph id="idC77FCABD18ED4A91B8C285D9D8AB22C8"><enum>(1)</enum><text>promote healthy
				eating;</text>
							</paragraph><paragraph id="id2734C394EB89444A89CFA48C9DEE465D"><enum>(2)</enum><text>make healthy food
				and physical activity choices more desired, affordable, and accessible;</text>
							</paragraph><paragraph id="idE49A094E310D42968D87523629D434C6"><enum>(3)</enum><text>are designed to
				reach large numbers of low-income households; and</text>
							</paragraph><paragraph id="idD43ECDC8598F467186BE0C1CF31581CE"><enum>(4)</enum><text>support behavior
				change consistent with the most recent Dietary Guidelines for Americans
				published under section 301 of the National Nutrition Monitoring and Related
				Research Act of 1990 (7 U.S.C. 5341), including promotion of a diet rich in
				fruits and vegetables, whole grains, and low-fat milk
				products.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDda0e3ea8892b49a7a74c48f611fc8d03"><enum>(b)</enum><header>Administration</header><text>Section
			 11(e)(1)(A) of the Food Stamp Act of 1977 (7 U.S.C. 2020(e)(1)(A)) is amended
			 by inserting <quote>, and provide food stamp nutrition education</quote> after
			 <quote>program</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4F84139F215C45FAB23BB588A733540B"><enum>(c)</enum><header>Funding</header><text>Section
			 18(a) of the Food Stamp Act of 1977 (7 U.S.C. 2027(a)) is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id52517B4D4E0C4FF99A892B663AA39CB8" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="idA36EBF17001441B7879CDDE638FDFC74"><enum>(4)</enum><header>Nutrition
				education</header><text>Of the amounts made available to carry out this Act
				under paragraph (1), the Secretary shall use not less than $100,000,000 for
				each of fiscal years 2008 through 2013 to provide food stamp nutrition
				education in accordance with section
				11(e)(1)(A).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="id6439DD38EA954257A59C7028578297B0"><enum>II</enum><header>National school
			 lunch program</header>
			<section id="idA7ECEB5E27D549DFB1B27D01BB476593"><enum>201.</enum><header>Fresh fruit
			 and vegetable program</header><text display-inline="no-display-inline">Section
			 18(g) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1769(g))
			 is amended—</text>
				<paragraph id="IDb459736c391e4799beee6ebb87d646a4"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="ID656ad9b3d1e34f5587da8e70fd7595d3"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>July 2004</quote> and inserting
			 <quote>July 2007</quote>; and</text>
					</subparagraph><subparagraph id="ID20b1618f80e9424785b481b13a816d96"><enum>(B)</enum><text>by striking
			 subparagraphs (A) and (B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id6524DA7DEC3548B8ADE4F028E661EC61" style="OLC">
							<subparagraph id="IDfa5a6b5725b4414f906c24c287c15112"><enum>(A)</enum><text>100 elementary
				schools or secondary schools in each State;</text>
							</subparagraph><subparagraph id="ID787c9bf8368541a19a8e23d2ca459b5c"><enum>(B)</enum><text>additional
				elementary schools or secondary schools in each State, in accordance with the
				proportion that—</text>
								<clause id="id6272593DADCD4284B8428814E368E3BC"><enum>(i)</enum><text>the student
				population of the State; bears to</text>
								</clause><clause id="id68E27C6C61B74C9BB0AF8189BDFA36C7"><enum>(ii)</enum><text>the total
				student population of all States;
				and</text>
								</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID57478046934f460aa9374e82bc073d73"><enum>(2)</enum><text>in paragraph
			 (3)(A), by striking <quote>paragraph (1)(B)</quote> and inserting
			 <quote>paragraph (1)</quote>;</text>
				</paragraph><paragraph id="IDec2850f53a5a4a1eb2c885c9b49a7f68"><enum>(3)</enum><text>in subparagraphs
			 (A) and (B) of paragraph (5) by striking <quote>2008</quote> each place it
			 appears and inserting <quote>2011</quote>; and</text>
				</paragraph><paragraph id="IDce08f8312c244a3abbcc9f605749ef03"><enum>(4)</enum><text>in paragraph
			 (6)(B)—</text>
					<subparagraph id="IDa7fbb253878541f1b669ca7506b01a09"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="IDdffc3470b4a7409fa17515accb01ceda"><enum>(i)</enum><text>by
			 striking <quote>October 1, 2004</quote> and inserting <quote>October 1,
			 2007</quote>; and</text>
						</clause><clause id="IDfe963fc1eb8e42ae953e7c6d0a1f1814"><enum>(ii)</enum><text>by
			 striking <quote>$9,000,000</quote> and inserting <quote>$300,000,000</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="ID3a9599f362bd434c8cdd8f943895e661"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id35C5A2C9E8AB4E68B731D4AF4F1040CE" style="OLC">
							<clause id="IDf6d36d5fcd9c4937b66e1f8a04d019d8"><enum>(iii)</enum><header>Administrative
				expenses</header><text>For fiscal year 2008 and each fiscal year thereafter, of
				amounts made available to carry out this subsection, the Secretary may use not
				more than 1 percent for administrative expenses of carrying out this
				subsection.</text>
							</clause><clause id="ID0c19528009554cb9910b586d62663c7f"><enum>(iv)</enum><header>State
				administrative costs</header>
								<subclause id="idC5275FA4F92D4698B31E3704529BB9D2"><enum>(I)</enum><header>In
				general</header><text>Subject to subclause (II), for fiscal year 2008 and each
				fiscal year thereafter, of amounts made available to a State to carry out this
				subsection, the State may use not more than 5 percent for administrative
				expenses of carrying out this subsection.</text>
								</subclause><subclause id="id5A4E9FB0639B44A197599B183FDBDB1C"><enum>(II)</enum><header>Requirement</header><text>To
				be eligible to use funds under subclause (I), a State shall submit to the
				Secretary a plan indicating the manner in which the State intends to use the
				funds.</text>
								</subclause></clause><clause id="ID4fb94eead13b4ebdb70c5ff7481c55f1"><enum>(v)</enum><header>Federal
				requirements</header><text>Not later than 1 year after the date of enactment of
				this clause, and periodically thereafter as the Secretary determines to be
				appropriate, the Secretary shall establish requirements for States in
				administering this
				subsection.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></section><section id="id79DE4EC0628F4311BF02188E0BE5AAF4"><enum>202.</enum><header>Farm-to-cafeteria
			 program</header><text display-inline="no-display-inline">Section 18(i)(2) of
			 the Richard B. Russell National School Lunch Act (42 U.S.C. 1769(i)(2)) is
			 amended by striking <quote>such sums as are necessary</quote> and all that
			 follows through the period at the end and inserting <quote>to carry out this
			 subsection $20,000,000 for each of fiscal years 2008 through
			 2013.</quote>.</text>
			</section><section id="id4CD15C2B0F114D869132970960B57BA5"><enum>203.</enum><header>Purchases of
			 locally produced foods</header><text display-inline="no-display-inline">Section
			 9(j) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1758(j)) is
			 amended—</text>
				<paragraph id="idC12026E441E34D1CADB3E56689D7C062"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
					<subparagraph id="idD180E3200AC0432382DBEC5C40D78F40"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="paragraph" style="OLC">In general</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">Purchases</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="idD5609A5996FB44AD9FAF8D50E07358A7"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subparagraph (A) and inserting
			 the following:</text>
						<quoted-block display-inline="no-display-inline" id="id6EE147EBFADD4D45873CEA6AD7689977" style="OLC">
							<subparagraph id="id3581796A00E6479EA2417972E4F8C013"><enum>(A)</enum><text>allow
				institutions described in paragraph (3)(A) to use geographical preferences in
				bidding and procurement programs to purchase, in addition to other food
				purchases, locally produced foods for meal
				programs;</text>
							</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id22688D6C062F41DA87F7072A8C86185D"><enum>(C)</enum><text>in subparagraph
			 (B), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="idBFF8349E6F164E0BB4887CA07FFF9CAC"><enum>(D)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="ID656e0d15d1fb4a948e94b1b6d87d9ad6"><enum>(E)</enum><text>by inserting
			 after subparagraph (C) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idC027DBC8E59C4053AB03BBF600B602A1" style="OLC">
							<subparagraph id="ID0cfd0a9441fc4f4e8ae3262a6c1aabd2"><enum>(D)</enum><text>submit to
				Congress an annual report on the implementation of this
				subsection.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id810B7119862A49F5BE2666C0524AA263"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph
			 (6); and</text>
				</paragraph><paragraph id="id53587EF092B14B8C9D8C450CA404E5EA"><enum>(3)</enum><text>by inserting
			 after paragraph (1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA48001BBCACE40B4948EDAEAF82C37FD" style="OLC">
						<paragraph id="ID736394dd5035406f860f79167551d4ea"><enum>(2)</enum><header>Department of
				Defense</header><text>Notwithstanding any other provision of law, the Secretary
				of Defense may elect to use a geographic preference to purchase locally
				produced agricultural products for—</text>
							<subparagraph id="IDc1178de8ad3f49b180be25ac41fb6198"><enum>(A)</enum><text>the Defense
				Supply Center Philadelphia;</text>
							</subparagraph><subparagraph id="IDaa084d0a1180449583aba3b62da0eec2"><enum>(B)</enum><text>the Department of
				Defense Farm to School Program;</text>
							</subparagraph><subparagraph id="ID981ec1bb32044094b3509a794ea990a6"><enum>(C)</enum><text>the Department of
				Defense Fresh Fruit and Vegetable Program;</text>
							</subparagraph><subparagraph id="IDdc8872765b4746689c15d468d3f6414c"><enum>(D)</enum><text>the service
				academies of the Department of Defense;</text>
							</subparagraph><subparagraph id="IDafbdf55bb7684e65b43de7b1395a1f6b"><enum>(E)</enum><text>Department of
				Defense domestic dependent schools;</text>
							</subparagraph><subparagraph id="ID7b2dfca6650c4ee0a0ba58d56cae2ed4"><enum>(F)</enum><text>other Department
				of Defense schools under chapter 108 of title 10, United States Code;</text>
							</subparagraph><subparagraph id="ID16f3ad677bff417ba9bd5435052ebeaf"><enum>(G)</enum><text>commissary and
				exchange stores of the Department of Defense; and</text>
							</subparagraph><subparagraph id="IDa35ef5faf83d4f5da0311f5f3c61b4ae"><enum>(H)</enum><text>morale, welfare,
				and recreation facilities operated by the Department of Defense.</text>
							</subparagraph></paragraph><paragraph id="ID5d0c1c2efafe46fca400e4257508bf3b"><enum>(3)</enum><header>Department of
				Agriculture and related entities</header>
							<subparagraph id="idBEC681592E1F4DF08D3BA6CBA96AC7A3"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the Secretary
				or the head of any school, local educational agency, or other entity, as
				applicable, may elect to use a geographic preference to purchase locally
				produced agricultural products for—</text>
								<clause id="ID2ff34e6056da4534a6b4cb2ab5a803e5"><enum>(i)</enum><text>the school
				breakfast program established by section 4 of the Child Nutrition Act of 1966
				(42 U.S.C. 1773);</text>
								</clause><clause id="IDf10281d61f2845b5ad3f4905cbc645ef"><enum>(ii)</enum><text>the school lunch
				program established under this Act;</text>
								</clause><clause id="ID1bc9837e106f4b5eb315d08c190c3481"><enum>(iii)</enum><text>the summer food
				service program for children established under section 13; and</text>
								</clause><clause id="IDecbe9e7b46334e7cb7d80194e35e20fd"><enum>(iv)</enum><text>the child and
				adult care food program established under section 17.</text>
								</clause></subparagraph><subparagraph id="idB01365B99FE241AD95309C9046A9DD7E"><enum>(B)</enum><header>Report</header><text>The
				head of any school, local educational agency, or other entity participating in
				a program described in subparagraph (A) that makes an election under that
				subparagraph shall submit to the Secretary a report describing any case in
				which the school, local educational agency, or other entity pays an amount in
				excess of an amount equal to 10 percent more than the lowest applicable bid to
				purchase locally produced agricultural products.</text>
							</subparagraph></paragraph><paragraph id="IDa6e208f25e3f4a63bd9de4f0c966c353"><enum>(4)</enum><header>Treatment of
				certain bids</header><text>On making an election under paragraph (2) or (3),
				the Secretary, the Secretary of Defense, or the head of any school, local
				educational agency, or other entity participating in a program described in
				paragraph (3)(A) may—</text>
							<subparagraph id="idDCE8D4BF7E814594B43CF9DCDB6EB1C9"><enum>(A)</enum><text>include in the

				involving a locally produced agricultural product, regardless of whether the
				bid is the lowest bid relating to the agricultural product.</text>
							</subparagraph></paragraph><paragraph id="ID5552340bcc5b441d82393b8c67c9e959"><enum>(5)</enum><header>Review</header><text>The
				Secretary and the Secretary of Defense shall periodically review each election
				to use a geographic preference under this subsection to prevent fraud or
				abuse.</text>

			 protection program</header>
			<section id="idD0E910A3364A4499A66CF6477E5B16C4"><enum>301.</enum><header>Farmland
			 protection program</header>
				<subsection id="id739BA4BA480C40C0A179177FB3DCE6A8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1238H of the Food Security Act of
			 1985 (16 U.S.C. 3838h) is amended—</text>
					<paragraph id="idCDCA606A2DC64F7FAA617504F739E85D"><enum>(1)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id3671631991F647EEADD915600B373230" style="OLC">
							<paragraph id="ID257c32ae16f5437784f34b9c8e49e848"><enum>(2)</enum><header>Eligible
				land</header>
								<subparagraph id="IDf9602aaf98474d17af7541b9bf50bd56"><enum>(A)</enum><header>In
				general</header><text>The term <term>eligible land</term> means land on a farm
				or ranch that is—</text>
									<clause id="ID59fd988f576f472a9bc42782e7fb1ce2"><enum>(i)</enum><text>cropland;</text>
									</clause><clause id="ID56084f18b52e48d5acc0f8fd6c609135"><enum>(ii)</enum><text>rangeland;</text>
									</clause><clause id="ID9db8af53218f44e88d20890b42d4ebf8"><enum>(iii)</enum><text>grassland;</text>
									</clause><clause id="IDedd6d57f97a642ae969398f700c78c76"><enum>(iv)</enum><text>pasture land;
				or</text>
									</clause><clause id="ID567935ea59ce48babc685a46fb32e573"><enum>(v)</enum><text>forest land that
				is an incidental part of an agricultural operation, as determined by the
				Secretary.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id1B639466587F4BFBBDCCA9843A0F83BD"><enum>(2)</enum><text>by redesignating
			 paragraph (4) as paragraph (5);</text>
					</paragraph><paragraph id="id1F663D9B7B624BD99A79389DA451BD07"><enum>(3)</enum><text>by inserting
			 after paragraph (3) the following:</text>

				primary purpose of protecting the agricultural production capacity of the
				eligible land; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50344DE1611B4863877A3FF2DEAB8F80"><enum>(B)</enum><text>is permanent or
				for the maximum duration allowed under State
				law.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id4F2230FB56C04DB8AABEF2B0C618FDE2"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idBF7F227FF0E04B83B0C539CFF81DBDA2" style="OLC">
							<paragraph id="id4F9598B66D70424C85B17DB1AD29C7F2"><enum>(6)</enum><header>Qualified State
				or local entity</header><text>The term <term>qualified State or local
				entity</term> means a public or private entity that—</text>
								<subparagraph id="idB1DFCB1D45DC40AAAE3A4853F20F83AB"><enum>(A)</enum><text>operates a farm
				and ranch land protection program that—</text>
									<clause id="id654E7BC3F74A4BF188C19B7192F3FF33"><enum>(i)</enum><text>has for at least
				3 calendar or fiscal years used or provided public or private funds to purchase
				permanent conservation easements on not less than 10 farms or ranches;</text>
									</clause><clause id="idBCF66195BA3441F4962B541503F0D775"><enum>(ii)</enum><text>has the
				necessary authority under State law, as well as the technical and financial
				capacity—</text>
										<subclause id="id0B16AAF4A8DF4F549C5930030DF566D8"><enum>(I)</enum><text>to monitor and
				enforce the terms of the permanent conservation easements so that the purpose
				of the permanent conservation easements is carried out for the maximum
				allowable duration; or</text>
										</subclause><subclause id="id526B4FC898A047128E8D5FC94DB2C19C"><enum>(II)</enum><text>in the case of a
				governmental entity, to require other public or private holders of the
				permanent conservation easements acquired with public funding to hold, monitor,
				and enforce the permanent conservation easements for the purpose described in
				subclause (I); and</text>
										</subclause></clause><clause id="id3143DFBC90994C18A2BE1295A7F93FBB"><enum>(iii)</enum><text>has financial
				control policies to ensure that, on average, the purchase price of the
				permanent conservation easements does not exceed the appraised fair market
				value of the permanent conservation easements; and</text>
									</clause></subparagraph><subparagraph id="idF47AF60435B44AAAA78F918895DF8C0E"><enum>(B)</enum><text>is an eligible
				entity.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id40D23ABD7C584352BDEE501E9F77AB7C"><enum>(b)</enum><header>Farmland
			 Protection</header><text>Section 1238I of the Food Security Act of 1985 (16
			 U.S.C. 3838i) is amended—</text>
					<paragraph id="idD6F7E8D5C8514D018C4FFF2726321649"><enum>(1)</enum><text>by redesignating
			 subsections (b) and (c) as subsections (e) and (f), respectively;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id400A6889BC7A4011AF3CEA6BA29E463B"><enum>(2)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id9E869F393CCF409D8C640485B5BE4D2D" style="OLC">
							<subsection id="id7FC114138198482B827D07A00DEA681B"><enum>(a)</enum><header>Program</header>
								<paragraph id="idDB8E83222B96457D90807A57B44AA76F"><enum>(1)</enum><header>In
				general</header><text>The Secretary, acting through the Natural Resources
				Conservation Service, shall carry out a farm and ranch land protection program
				under which the Secretary shall facilitate and provide funding for the purchase
				of conservation easements or other interests in eligible land for the purpose
				of protecting the agricultural production capacity of the land and related
				conservation values by limiting incompatible nonagricultural uses of the
				land.</text>
								</paragraph><paragraph id="id9F65DD15BF534C3790129A8AFBD11432"><enum>(2)</enum><header>Priority</header><text>In
				carrying out the program, the Secretary shall give the highest priority to
				protecting farm and ranch land with prime, unique, or other productive soils
				that are at risk of nonagricultural development.</text>
								</paragraph></subsection><subsection id="id971A923E7C594B1FA700BE2A5B907C1D"><enum>(b)</enum><header>Grants</header>
								<paragraph id="id2D207D25B75D483CA833715FB0AB8024"><enum>(1)</enum><header>In
				General</header><text>The Secretary, acting through the Natural Resources
				Conservation Service, shall use funds made available to carry out this
				subchapter to award grants to qualified State or local entities for the
				purchase of conservation easements and other interests in land.</text>
								</paragraph><paragraph id="idC6B48BF0A55F4DED8C58D303BFE328A6"><enum>(2)</enum><header>Distribution</header><text>The
				Secretary shall distribute grants described in paragraph (1) among States based
				on—</text>
									<subparagraph id="id2BF5661B36F4402EA8F2DA0BAAEF8630"><enum>(A)</enum><text>the demonstrated
				need for farm and ranch land protection; and</text>
									</subparagraph><subparagraph id="id6EA88EABCA5642EBA8095ECFAFFBE49C"><enum>(B)</enum><text>the relative
				contribution of funds provided by State or local entities for the protection of
				farm and ranch land.</text>
									</subparagraph></paragraph><paragraph id="id5333F59BEEC740D69AADDAFB05C1A2D1"><enum>(3)</enum><header>Use of
				grants</header><text>A qualified State or local entity that receives a grant
				under this subsection—</text>
									<subparagraph id="id864798A08A414A44ABE2AF92CFAB2FEB"><enum>(A)</enum><text>may use the grant
				funds to purchase 1 or more conservation easements, regardless of whether the
				qualified State or local entity has a pending purchase offer for any of the
				conversation easements at the time of receiving the grant;</text>
									</subparagraph><subparagraph id="idE4446293688C4AB9A9FE3031D1D1C85A"><enum>(B)</enum><text>shall use the
				grant funds only for the purchase of conservation easements and other interests
				in land; and</text>
									</subparagraph><subparagraph id="ID45ca2e235bcf4ce785b768233a9a2812"><enum>(C)</enum><text>may use an amount
				equal to not more than 10 percent of the amount of the grant for reasonable
				costs of purchasing and enforcing conservation easements and other interests in
				land.</text>
									</subparagraph></paragraph><paragraph id="id1BE762C0941D459F983E4C4E0F11FEF3"><enum>(4)</enum><header>Remaining
				funds</header><text>Any funds remaining after grants are distributed to
				qualified State or local entities shall be available to other eligible entities
				as matching funds for individual purchases of conservation easements and other
				interests in land.</text>
								</paragraph></subsection><subsection id="idE5B609648C6E4D708F205CB60FD37115"><enum>(c)</enum><header>Grant
				Agreements</header>
								<paragraph id="idD3636AD36AB142D482DB784657A08DCB"><enum>(1)</enum><header>In
				General</header><text>The Secretary, acting through the Natural Resources
				Conservation Service, may enter into agreements with qualified State or local
				entities, under which a State or local entity may purchase conservation
				easements using a combination of the funds of the entity and grant funds made
				available by the Secretary under subsection (b).</text>
								</paragraph><paragraph id="idCED42E83BEBA4E3B9E6FD2F861B4A9D9"><enum>(2)</enum><header>Terms and
				Conditions</header>
									<subparagraph id="id91AE2D6E06FE4C7386731701842B3840"><enum>(A)</enum><header>In
				General</header><text>Subject to subparagraph (B), an agreement described in
				paragraph (1) shall stipulate the terms and conditions under which qualified
				State or local entities shall use grant funds distributed by the Secretary
				under subsection (b).</text>
									</subparagraph><subparagraph id="idCCB4E2DDEEB942DE952F01CDEE4043D1"><enum>(B)</enum><header>Requirements</header><text>Each
				agreement shall—</text>
										<clause id="id6CA6B551EEB7443B99CC6908829CFE6D"><enum>(i)</enum><text>authorize the
				State or local entity to determine the criteria and priorities of the entity
				for purchasing conservation easements and other interests in land;</text>
										</clause><clause id="id4C47ED9A122C4CEC8E4CA86A5CC28EF5"><enum>(ii)</enum><text>authorize the
				State or local entity to establish terms and conditions for conservation
				easements and other interests in land, if—</text>
											<subclause id="IDf2d94651bd4148f298f007feec817fca"><enum>(I)</enum><text>the terms and
				conditions are adequate under State law to achieve and permit effective
				enforcement of the conservation purposes of the conservation easements or other
				interests; and</text>
											</subclause><subclause id="ID48124ceb60a9416283be0459cc8a6466"><enum>(II)</enum><text>the State or
				local entity includes in the terms and conditions a requirement consistent with
				the purposes of the program regarding the impervious surfaces to be permitted
				for any conservation easement or other interest in land purchased using a grant
				provided under this section;</text>
											</subclause></clause><clause id="id715DBCD9F6A241EA9058CFBE73FF4790"><enum>(iii)</enum><text>not require a
				Federal contingent right of enforcement or reversionary interest in the
				conservation easement or other interest in land; and</text>
										</clause><clause id="ID797b5ca42acd4156bf2ad3cf24526791"><enum>(iv)</enum><text>permit qualified
				entities to use an amount equal to not more than 10 percent of the amount of
				the grant for reasonable costs of purchasing and enforcing conservation
				easements and other interests in land..</text>
										</clause></subparagraph></paragraph></subsection><subsection id="id1276931C0800493EB2D969ACEE6DDE41"><enum>(d)</enum><header>Individual
				purchases</header>
								<paragraph id="id3920C38D55BA456F81DE3B75B0152BF1"><enum>(1)</enum><header>In
				general</header><text>The Secretary may enter into agreements with eligible
				entities under which the Secretary shall provide matching funds to the eligible
				entities for the purpose of purchasing conservation easements or other
				interests in land on individual farm and ranch properties.</text>
								</paragraph><paragraph id="id681889E280BD44ACB1110E9AE4306C1F"><enum>(2)</enum><header>Requirements</header><text>An
				agreement described in paragraph (1) shall—</text>
									<subparagraph id="id3BF9CDE3E0D443A7828035A4BE8D9536"><enum>(A)</enum><text>include such
				terms and conditions as the Secretary considers appropriate to ensure that the
				purposes of the farmland protection program are carried out;</text>
									</subparagraph><subparagraph id="idE308EF99D46B4AD594CAFF7CA4295907"><enum>(B)</enum><text>not require a
				Federal continent right of enforcement or reversionary interest in the
				conservation easement or other interest in land, if—</text>
										<clause id="id1F2A1455DEC94650BECF6CAC2764E8AA"><enum>(i)</enum><text>the conservation
				easement or other interest in land is held by a State or local agency;
				or</text>
										</clause><clause id="id2A5D80425A60455498008395E95DFF8D"><enum>(ii)</enum><text>a qualified
				State or local entity will hold a contingent right of enforcement in the
				conservation easement or other
				interest.</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id45372CC0D21B472E8CB7C8D1CEE61596"><enum>(3)</enum><text>in subsection (e)
			 (as redesignated by paragraph (1))—</text>
						<subparagraph id="id178AB5A4D31245F7AA685F68CFFDF1DC"><enum>(A)</enum><text>by striking
			 <quote>Any highly</quote> and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id96A4E315E27D4F7FA91894CF5E1159A3" style="OLC">
								<paragraph id="id1EA90D185E094EB18120D1538E1297B3"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding subsection (c)(2)(B)(ii), subject to

								<paragraph id="idBF9F0F77C7B247E5868A3AB0739F7402"><enum>(2)</enum><header>Permanent
				conservation easements</header><text>In the case of a permanent conservation
				easement, the Secretary may not require the conversion of cropland to less
				intensive uses if, under the conservation plan, soil erosion can be reduced to
				<quote>T</quote> or below.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id016B74E90C7842FD9B1C60F4B55BD9EC"><enum>(4)</enum><text>in paragraph
			 (1)(A) of subsection (f) (as redesignated by paragraph (1))—</text>
						<subparagraph id="ID35077e112475432580b4dfa30512db6b"><enum>(A)</enum><text>by striking
			 <quote>section 1241(d)</quote> and inserting <quote>1241(a)(4)</quote>;</text>
						</subparagraph><subparagraph id="ID72d8d34557cc44ce9fc7f5e773a75f3a"><enum>(B)</enum><text>by striking
			 <quote>shall not exceed 50 percent</quote> and inserting the following: “shall
			 not exceed—</text>

			 period at the end and inserting <quote>; or</quote>; and</text>
						</subparagraph><subparagraph id="id1C95A425A30548E9B84A2FB34B1E6E67"><enum>(D)</enum><text>by adding at the
			 end the following:</text>

								<clause id="id6B8C47F844AE4E23BECA0ABBC522E9CD"><enum>(ii)</enum><text>if a qualified
				conservation contribution, as defined by section 170(h) of the Internal Revenue
				Code of 1986, of at least 25 percent of the market value is made by the
				landowner in connection with the purchase of a conservation easement or other
				interest in land, <fraction>2/3</fraction> of the actual cost of purchasing the
				conservation easement or other interest in
				land.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection></section></title><title id="id03E5AF0EF1754716BF196B22E37A320C"><enum>IV</enum><header>Miscellaneous</header>
			<section id="ID465eb325fe00453d9d64a054f647387b"><enum>401.</enum><header>Farmers’
			 Market Promotion Program Plus</header>
				<subsection id="ID772999e26356498fb4daebe357d14011"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
					<paragraph id="IDdaa01fe1a25c4816bd626beb52cba52a"><enum>(1)</enum><text>agricultural
			 direct farmer-to-consumer marketing activities, including farmers' markets,
			 roadside stands, on-farm markets, community-supported agriculture, Internet,
			 mail order, and other similar direct order marketing activities, significantly
			 enhance the ability of agricultural producers to retain a greater share of the
			 retail value of the products of the producers;</text>
					</paragraph><paragraph id="IDb24fde878a014ba6ac822e4ea12d7888"><enum>(2)</enum><text>direct
			 farmer-to-consumer marketing activities are a crucial component of the current
			 and future viability of small- and mid-sized family farms and ranches,
			 including those owned by beginning and socially disadvantaged farmers and
			 ranchers; and</text>
					</paragraph><paragraph id="ID9684869574b5457794c887f9c3b5e21b"><enum>(3)</enum><text>agricultural
			 direct marketing activities contribute to the health and well-being of
			 consumers in rural, urban, and Indian tribal communities by providing access to
			 healthy, fresh, and affordable food.</text>
					</paragraph></subsection><subsection id="idAB1A3EBB22C0454FB3F0DDB70E870432"><enum>(b)</enum><header>Program</header><text>The
			 Farmer-to-Consumer Direct Marketing Act of 1976 (7 U.S.C. 3001 et seq.) is
			 amended by inserting after section 6 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0CC970A3E310484991FDA0F34CE6D995" style="OLC">
						<section id="idF51DEEC1EA28424D84A0F0BEC3E3FE77"><enum>6A.</enum><header>Farmers’ market
				promotion program plus</header>
							<subsection id="IDc15eef1d638a4167ace77925af24cc92"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary shall carry out a program, to be known as the <quote>Farmers’ Market
				Promotion Program Plus</quote> (referred to in this section as the
				<term>Program</term>), to make grants to eligible entities for projects to
				establish, expand, and promote the full spectrum of direct farmer-to-consumer
				marketing opportunities.</text>
							</subsection><subsection id="IDc0be98e5666548f1b50e13153d7697c4"><enum>(b)</enum><header>Program
				purposes</header>
								<paragraph id="ID8b5d9bce283244a7880e39b035b6e9a9"><enum>(1)</enum><header>In
				general</header><text>The purposes of the Program are—</text>
									<subparagraph id="IDfbe8f18cfee34f689811c739ee37a756"><enum>(A)</enum><text>to increase
				domestic consumption of agricultural commodities by improving and expanding, or
				assisting in the improvement and expansion of, direct farmer-to-consumer
				marketing opportunities;</text>
									</subparagraph><subparagraph id="ID1eae23bb22654e11952eb63c71392a79"><enum>(B)</enum><text>to develop, or
				aid in the development of, new direct farmer-to-consumer marketing
				opportunities; and</text>
									</subparagraph><subparagraph id="IDa33cb3f09747466fba58f3dcdd6a08e9"><enum>(C)</enum><text>to increase
				direct farmer-to-consumer direct marketing opportunities in underserved areas
				by providing, to the maximum extent practicable, not less than 25 percent of
				grants to projects in underserved areas, as determined by the Secretary.</text>
									</subparagraph></paragraph><paragraph id="ID21a05b111ae64dd382bacac7482e15fa"><enum>(2)</enum><header>Limitations</header><text>An
				eligible entity shall not use a grant or other assistance provided under the
				Program for the purchase, construction, or rehabilitation of a building or
				structure.</text>
								</paragraph></subsection><subsection id="IDe6617931e85742119848cc88f77de14f"><enum>(c)</enum><header>Eligible
				entities</header><text>An entity shall be eligible to receive a grant under the
				Program if the entity is—</text>
								<paragraph id="ID6ba1e0e5017b41619bc7065ff3af0386"><enum>(1)</enum><text>composed of 2 or
				more agricultural producers that produce and sell products through a common
				distribution channel;</text>
								</paragraph><paragraph id="IDfaadfb3860604d61876ebc538d8df9ec"><enum>(2)</enum><text>an agricultural
				cooperative or producer association or network;</text>
								</paragraph><paragraph id="IDa6d78d9024844e609055ae946c28eb0f"><enum>(3)</enum><text>a local
				government;</text>
								</paragraph><paragraph id="ID003e31595f534bb6bae6ff95ae5aab40"><enum>(4)</enum><text>a nonprofit
				corporation;</text>
								</paragraph><paragraph id="IDae8b71b832294c8f952c4916dffb1f0d"><enum>(5)</enum><text>a public benefit
				corporation;</text>
								</paragraph><paragraph id="IDca570496d546443ca36286db2fe00a49"><enum>(6)</enum><text>an economic
				development corporation;</text>
								</paragraph><paragraph id="ID41935abd525349c289490a5c4db95410"><enum>(7)</enum><text>a regional
				farmers' market authority; or</text>
								</paragraph><paragraph id="ID4c217aa65cc1421d9a13d9bbe6d8fe09"><enum>(8)</enum><text>such other entity
				as the Secretary may designate.</text>
								</paragraph></subsection><subsection id="ID0af2b7ea892f41ae8727b810b0244ac5"><enum>(d)</enum><header>Eligible
				activities</header><text>An eligible entity may use a grant provided under this
				section to carry out activities relating to—</text>
								<paragraph id="ID10b5b45a554c45a487d5651eddc33422"><enum>(1)</enum><text>farmers'
				markets;</text>
								</paragraph><paragraph id="ID116ba58fd04f4ae783d389bec6936591"><enum>(2)</enum><text>roadside
				stands;</text>
								</paragraph><paragraph id="ID759c51e120f94a0885a9f66c9bf1ef78"><enum>(3)</enum><text>community-supported
				agriculture;</text>
								</paragraph><paragraph id="IDd8b322c1bc8f49f0b24111cc66e74444"><enum>(4)</enum><text>supporting the
				use of electronic benefits transfer systems at farmers' markets and, where
				feasible, other direct market enterprises;</text>

				operations;</text>
								</paragraph><paragraph id="ID12be07689d054be398ce0c82a7e1997e"><enum>(6)</enum><text>direct Internet
				and mail order sales;</text>
								</paragraph><paragraph id="IDebfa666d9d974de7ae193f9161758481"><enum>(7)</enum><text>producer-owned
				agritourism activities facilitating the direct sale of agricultural products;
				and</text>
								</paragraph><paragraph id="ID967f18d182cb40e58945a3fac35e4314"><enum>(8)</enum><text>other similar
				ventures, as determined by the Secretary.</text>
								</paragraph></subsection><subsection id="IDf21db9967b0745ce89076b9a01ca41c2"><enum>(e)</enum><header>Criteria and
				guidelines</header><text>The Secretary shall establish criteria and guidelines
				for the submission, evaluation, and funding of proposed projects under the
				Program.</text>
							</subsection><subsection id="ID92c76163bdfd4e77893480002962a567"><enum>(f)</enum><header>Funding</header><text>Of
				the funds of the Commodity Credit Corporation, the Secretary shall use to carry
				out this section $25,000,000 for each of fiscal years 2008 through
				2013.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="idB643E6964F9B41BF9AECA8311B4E66E0"><enum>402.</enum><header>Seniors
			 farmers’ market nutrition program</header><text display-inline="no-display-inline">Section 4402 of the Farm Security and Rural
			 Investment Act of 2002 (7 U.S.C. 3007) is amended—</text>
				<paragraph id="id3CCFE964432D4EBF8DA4A6D48BE81124"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD1758A84C29F40559FE874DC81727B0F" style="OLC">
						<subsection id="id37F34FEFD9DB436FB8EA50CE31A9F558"><enum>(a)</enum><header>Establishment</header><text>Of
				funds available to the Commodity Credit Corporation, the Secretary of
				Agriculture (referred to in this section as the <term>Secretary</term>) shall
				use to carry out and expand a seniors farmers' market nutrition program—</text>
							<paragraph id="id274B250954994BCC912850B33A589C4C"><enum>(1)</enum><text>$20,000,000 for
				fiscal year 2008;</text>
							</paragraph><paragraph id="idF57AF61C421C4F62AFCC5105EA8C02E4"><enum>(2)</enum><text>$30,000,000 for
				fiscal year 2009;</text>
							</paragraph><paragraph id="id8E76026D9B124F4585EE80F2AC6C64E5"><enum>(3)</enum><text>$45,000,000 for
				fiscal year 2010;</text>
							</paragraph><paragraph id="id5F3D73DA3745470598847A982856A71F"><enum>(4)</enum><text>$60,000,000 for
				fiscal year 2011; and</text>
							</paragraph><paragraph id="id027A3A52F87B41CEA834BAD30E94605B"><enum>(5)</enum><text>not less than
				$75,000,000 for fiscal year 2012 and each fiscal year
				thereafter.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id7C4D242A32C943268F8D10DDEF85C9EF"><enum>(2)</enum><text>by redesignating
			 subsection (c) as subsection (d); and</text>
				</paragraph><paragraph id="ID39d8898dcc6347a78ce663fc219700ad"><enum>(3)</enum><text>by inserting
			 after subsection (b) the following:</text>

				participation by participants in farmers' markets, roadside stands, and
				community supported agriculture programs; and</text>

				the ability of any State or regional program to set benefit levels for
				individual
				seniors.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idEE9678C3EDAF46B186D5D6499CBC63A8"><enum>403.</enum><header>Healthy food
			 enterprise development program</header><text display-inline="no-display-inline">Title II of the Specialty Crops
			 Competitiveness Act of 2004 (Public Law 108–465) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3A3F15BCDB2348658C03C4CC9AA20DF9" style="OLC">
					<section id="idDF1AA7C2FB1F4EA59BDB8F7D5380B38C"><enum>204.</enum><header>Healthy food
				enterprise development program</header>
						<subsection id="IDe0b3ae47fc524e56ae74483f17605721"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section is to promote the health and well-being of all people
				in the United States, particularly school-aged children, low-income
				populations, and individuals residing in underserved communities, by increasing
				the availability and affordability of healthy foods, such as fresh fruit and
				vegetables, which, when produced, processed, and packaged locally or
				regionally, can significantly enhance the income of agricultural producers by
				increasing the share of the producers of the final retail price of the
				foods.</text>
						</subsection><subsection id="id4CFE409488B04C7DB723792B5C0CC660"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="IDb2174979b3134481a9880dcbb3fa09e5"><enum>(1)</enum><header>Beginning
				farmer or rancher</header><text>The term <term>beginning farmer or
				rancher</term> has the meaning given the term <term>qualified beginning farmer
				or rancher</term> in section 343(a) of the Consolidated Farm and Rural
				Development Act (7 U.S.C. 1991(a)).</text>
							</paragraph><paragraph id="IDa6430341c434483da31fcf8cac6d31e9"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> includes—</text>
								<subparagraph id="idD79A5C3AA4664A268B056C020BD6CA71"><enum>(A)</enum><text>a small or
				midsized processor, distributor, wholesaler, or retail food outlet;</text>
								</subparagraph><subparagraph id="idB6657C3C2B7B4A66869E731AD2B54DCC"><enum>(B)</enum><text>a group of
				producers operating as a legally recognized marketing alliance;</text>
								</subparagraph><subparagraph id="id847D768A88B1433C9D18922DA01BFA9C"><enum>(C)</enum><text>a producer-owned
				cooperative;</text>
								</subparagraph><subparagraph id="idB0FA75DD7BAC440893E4E18A696C2BDF"><enum>(D)</enum><text>a nonprofit
				organization;</text>
								</subparagraph><subparagraph id="idB1E1F913AE5E4365A1741E3314FB799D"><enum>(E)</enum><text>an economic
				development or community development corporation;</text>
								</subparagraph><subparagraph id="id5EBE1BA183EE4BDEA0C300900AFB8BAE"><enum>(F)</enum><text>a unit of State
				or local government; and</text>
								</subparagraph><subparagraph id="id8DB3DD2DB79047E5A215881E84BB00E9"><enum>(G)</enum><text>an academic
				institution.</text>
								</subparagraph></paragraph><paragraph id="IDe3ede03a63724ca295f81d9962cfb2e3"><enum>(3)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the Indian Self-Determination and Education Assistance
				Act (25 U.S.C. 450b).</text>
							</paragraph><paragraph id="id168B29EF1ED04F6E9D420C4F05EE5030"><enum>(4)</enum><header>Locally or
				regionally produced food</header><text>The term <term>locally or regionally
				produced food</term> means any agricultural product distributed within the
				locality or region in which the agricultural product is produced in a manner
				that ensures that—</text>
								<subparagraph id="ID8c644e8f9a6d4f148bb6b972f554e039"><enum>(A)</enum><text>information is
				typically conveyed to the end-use consumer regarding the product origin,
				production practices, or other valuable information;</text>
								</subparagraph><subparagraph id="id9B0E75750DA541AF8DEDA076F2854669"><enum>(B)</enum><text>the income of the
				producer is increased through maximization of the share of the retail food
				price retained by the producer;</text>
								</subparagraph><subparagraph id="idD5C755F13CC9475584A76743B85DF037"><enum>(C)</enum><text>consumers are
				provided with affordable agricultural products produced, processed, and
				distributed in the locality or region of the consumers;</text>
								</subparagraph><subparagraph id="ID5381cb49e21b42a4868545c01f9aea0d"><enum>(D)</enum><text>the produce has
				been shipped not greater than <fraction>1/2</fraction> of the current average
				distance of all food produced and consumed in the United States, as determined
				by the Secretary; and</text>
								</subparagraph><subparagraph id="id0ABF78EA18BF4B168E7766D78ED82DA2"><enum>(E)</enum><text>environmental
				integrity and social welfare are maintained and enhanced, respectively,
				throughout the supply chain with respect to the product.</text>
								</subparagraph></paragraph><paragraph id="id83883154DB96418495042166627C4F05"><enum>(5)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Agriculture.</text>
							</paragraph><paragraph id="id1C1501CC09314CB7A8D01A5910B3430C"><enum>(6)</enum><header>Socially
				disadvantaged farmer or rancher</header><text>The term <term>socially
				disadvantaged farmer or rancher</term> has the meaning given the term in
				section 355(e) of the Consolidated Farm and Rural Development Act (7 U.S.C.
				2003(e)).</text>
							</paragraph><paragraph id="id2CC2165DB4DC4E04A63E3E6388E53BDD"><enum>(7)</enum><header>Underserved
				community</header><text>The term <term>underserved community</term> includes
				any community that may have, as determined by the Secretary—</text>
								<subparagraph id="id7706E7A8C5C741DEA92C59687FB2327A"><enum>(A)</enum><text>limited access to
				affordable, healthy foods, including fresh fruits and vegetables, in grocery
				retail stores or farmer-to-consumer direct markets;</text>
								</subparagraph><subparagraph id="idF8691D64379E43F7A374153850C07669"><enum>(B)</enum><text>high incidences
				of diet-related diseases, including obesity;</text>
								</subparagraph><subparagraph id="id0A0C6D56200A40D382819317864D6D28"><enum>(C)</enum><text>high rates of
				hunger or food insecurity; or</text>
								</subparagraph><subparagraph id="idC29666C6045A410493C6B4DCD3BDFDD0"><enum>(D)</enum><text>severe or
				persistent poverty in urban or rural communities, including Indian tribal
				communities.</text>
								</subparagraph></paragraph></subsection><subsection id="id8109E015B74848DAA417F64A438C1A45"><enum>(c)</enum><header>Grant
				program</header>
							<paragraph id="id907A728ACE8F4128841A6031710C822A"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary, acting through the head of the market services branch of the
				Agricultural Marketing Service, shall establish a program under which the
				Secretary shall provide grants, on a competitive basis, to eligible entities to
				conduct enterprise feasibility studies (including studies of consumer
				preference), in accordance with the purpose of this section.</text>
							</paragraph><paragraph id="idE0EDBC97F9214B9494CB484D507BF1F1"><enum>(2)</enum><header>Application</header><text>To
				be eligible to receive a grant under this subsection, an eligible entity shall
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
							</paragraph><paragraph id="idD419D31E4682462A9714ED7FE005CF2F"><enum>(3)</enum><header>Coordination
				with other agencies</header><text>In carrying out the program under this
				subsection, the Secretary shall coordinate, with respect to the development of
				the program and reviews of grant applications, with—</text>
								<subparagraph id="idA24D14C33DCB4ADAB1A6FAE5E1229434"><enum>(A)</enum><text>the Cooperative
				State Research, Education, and Extension Service; and</text>
								</subparagraph><subparagraph id="id0054107BF7124E21AB4D7ECC15059B67"><enum>(B)</enum><text>the Rural
				Business Cooperative Service.</text>
								</subparagraph></paragraph><paragraph id="id9AB7155A1A2641D3BE811F06257CF06A"><enum>(4)</enum><header>Priority</header><text>In
				providing grants under this subsection, the Secretary shall give priority to
				applications with proposed projects that—</text>
								<subparagraph id="ID1b24348382954f6caebe73697e6ee0c8"><enum>(A)</enum><text>convey locally or
				regionally produced food products that are processed and distributed near the
				point of final retail purchase;</text>
								</subparagraph><subparagraph id="id0957E02BDF5740B49026B91A4274DBD8"><enum>(B)</enum><text>are from
				partnerships of 2 or more eligible entities;</text>
								</subparagraph><subparagraph id="idA2A2D47C800E4B1CADD825BD0FE8BFF7"><enum>(C)</enum><text>include features
				effectively targeting participation by socially disadvantaged farmers or
				ranchers or beginning farmers or ranchers;</text>
								</subparagraph><subparagraph id="idF52149CE7DEA4248BF5453401C9CCD01"><enum>(D)</enum><text>increase
				employment opportunities in underserved communities; or</text>
								</subparagraph><subparagraph id="idC34575A31E874BB7A8175B335CED5645"><enum>(E)</enum><text>establish and
				maintain satisfactory environmental and labor standards, including worker
				protection.</text>
								</subparagraph></paragraph><paragraph id="idE1E9DBB9A13D475EBC2E2CD656545289"><enum>(5)</enum><header>Maximum
				amount</header><text>The amount of a grant provided under this subsection shall
				not exceed $250,000.</text>
							</paragraph><paragraph id="id069EC59625AE4FB99D3EF8AB7A45CD50"><enum>(6)</enum><header>Term</header><text>A
				grant provided under this subsection shall have a term of not more than 3
				years.</text>
							</paragraph><paragraph id="idB5CEFAEB242C42E0980E9A382ABD75C7"><enum>(7)</enum><header>Reports</header>
								<subparagraph id="id5C97EA3BF7BF44E288681403EC19949E"><enum>(A)</enum><header>In
				general</header><text>Each eligible entity that receives a grant under this
				subsection shall submit to the Secretary an annual report describing the
				results and progress of each feasibility study to ensure sufficient progress is
				achieved with respect to the goals of the projects carried out by the eligible
				entity.</text>
								</subparagraph><subparagraph id="id60281BABF7364DAFB0315C0BC3C1310E"><enum>(B)</enum><header>Public
				availability</header><text>The Secretary shall ensure that any information
				contained in a report under subparagraph (A) relating to consumer preference or
				producer availability is made available to the public.</text>
								</subparagraph></paragraph><paragraph id="id5B1CB79A9E274BE2B36011AB81305CB2"><enum>(8)</enum><header>Funding</header><text>On
				October 1, 2008, and on each October 1 thereafter through October 1, 2013, out
				of any funds in the Treasury not otherwise appropriated, the Secretary of the
				Treasury shall transfer to the Secretary to carry out this subsection
				$5,000,000, to remain available until expended.</text>
							</paragraph></subsection><subsection id="id5B12A10DCA5A4960A2785617F0AB2B17"><enum>(d)</enum><header>Enterprise
				development loan program</header>
							<paragraph id="id342D5BE757B24BA1965387C5BBD71A3C"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary, acting through the Agricultural Marketing Service, shall establish a
				program under which the Secretary shall provide loans and loan guarantees to
				eligible entities and individual producers for use in accordance with paragraph
				(6).</text>
							</paragraph><paragraph id="ID932449e2115b46d3b5747ec719052a6f"><enum>(2)</enum><header>Coordination
				with other agencies</header><text>In carrying out the program under this
				subsection, the Secretary shall coordinate, with respect to the development of
				the program, reviews of applications, and implementation, with the Rural
				Business Cooperative Service.</text>
							</paragraph><paragraph id="idA8C8352BF1B64F028D089466581B6D80"><enum>(3)</enum><header>Application</header><text>To
				be eligible to receive a loan or loan guarantee under this subsection, an
				eligible entity or individual producer shall submit to the Secretary an
				application at such time, in such manner, and containing such information as
				the Secretary may require.</text>
							</paragraph><paragraph id="id6C0DC80821D7409FB439455F50CC8958"><enum>(4)</enum><header>Requirements</header>
								<subparagraph id="idE26540A3E71742DB902600A402258818"><enum>(A)</enum><header>Priority</header><text>In
				providing loans and loan guarantees under this subsection, the Secretary shall
				give priority to applications that represent—</text>
									<clause id="IDccc14dfea66b450db1408d6f0e2b7fd3"><enum>(i)</enum><text>projects that
				convey locally or regionally produced food products that are processed and
				distributed near the point of final retail purchase;</text>
									</clause><clause id="idEFC19C9D16114AD082659240268A6640"><enum>(ii)</enum><text>partnerships of
				2 or more eligible entities;</text>
									</clause><clause id="id302CD70B1CDE4A66AFCE9014F4C3681A"><enum>(iii)</enum><text>socially
				disadvantaged farmers or ranchers or beginning farmers or ranchers;</text>
									</clause><clause id="id7946FBF14090444387559868C1F6976A"><enum>(iv)</enum><text>projects that
				increase employment opportunities in underserved communities; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id88CF29FE25A94EE3B7118D1B0D1E275D"><enum>(v)</enum><text>projects that
				establish and maintain clear environmental and labor standards, including
				worker protection.</text>
									</clause></subparagraph><subparagraph id="idDDB8CFA0EB354B30914D8FD4F7299532"><enum>(B)</enum><header>Limitation</header><text>The
				Secretary shall ensure that no recipient of a loan or loan guarantee under this
				subsection holds, or significantly benefits from, more than 1 loan or guarantee
				for the term of the loan or guarantee.</text>
								</subparagraph></paragraph><paragraph id="id74E79A7405E44AB7A58FBF324EBCD138"><enum>(5)</enum><header>Direct
				loans</header>
								<subparagraph id="id0B1B61E958DC4929B285E00D448F3FA0"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall provide loans under this
				subsection—</text>
									<clause id="id3A4FF3ECCC944F4AA571FF83476AFC40"><enum>(i)</enum><text>on an annual and
				competitive basis;</text>
									</clause><clause id="id92F305000FF7465DB864B7A112D78C19"><enum>(ii)</enum><text>after conducting
				a review of applicable applications in accordance with subsection
				(c)(3);</text>
									</clause><clause id="id9E66FB6467A64B59B0966C7760C86162"><enum>(iii)</enum><text>in a manner
				that is economically sound, as determined by the Secretary;</text>
									</clause><clause id="ID2e1f3ac300db4c60bc74013a701c867b"><enum>(iv)</enum><text>that may be
				subordinated to loans made by local private lenders; and</text>
									</clause><clause id="IDefca575ad56643fb89675f0a61744e1b"><enum>(v)</enum><text>in an amount
				equal to not more than $1,500,000, as adjusted to reflect changes for the
				12-month period ending the preceding November 30 in the Consumer Price Index
				for All Urban Consumers published by the Bureau of Labor Statistics of the
				Department of Labor.</text>
									</clause></subparagraph><subparagraph id="id0E2FBC76B65E4C058E513C343FD29B11"><enum>(B)</enum><header>Interest
				rate</header><text>The interest rate of a loan provided under this
				subsection—</text>
									<clause id="idEC1282EB1B1746DC858654CC7A034046"><enum>(i)</enum><text>shall be
				equivalent to the interest rate of securities of the United States Treasury of
				comparable maturity as of the date on which the loan is provided;</text>
									</clause><clause id="IDb1484307d8f0433698fc434988e528d7"><enum>(ii)</enum><text>may be offered
				as a variable rate to allow lower-interest payments until an eligible entity is
				able to pay higher-interest payments, subject to the condition that the total
				interest rate does not exceed the standard interest rate of the Department of
				the Treasury, as in existence on the date on which the loan is approved;
				and</text>
									</clause><clause id="ID3ff30af50d654cdea5a1171e9aa074c1"><enum>(iii)</enum><text>shall not
				change, in the aggregate, during the term of the loan.</text>
									</clause></subparagraph><subparagraph id="id16CFB70E0F7D46B99510EF961FDA5E9E"><enum>(C)</enum><header>Repayment</header><text>An
				eligible entity or individual producer shall repay the Secretary an amount
				equal to the amount of the loan received by the eligible entity or individual
				producer (including interest) by not later than 15 years after the date on
				which the loan is provided.</text>
								</subparagraph><subparagraph id="ID74fcec5fa1294c4da9c1a86d70e995e9"><enum>(D)</enum><header>Underserved
				communities</header><text>The Secretary shall defer repayment of a loan
				(including interest) provided to an eligible entity located in an underserved
				community for the 3-year period beginning on the date on which the loan is
				provided.</text>
								</subparagraph></paragraph><paragraph id="id5B0DEBA55F434FC69426F1FD06B87697"><enum>(6)</enum><header>Loan
				guarantees</header>
								<subparagraph id="id18F491E78301496DB6AD91DEE68656D1"><enum>(A)</enum><header>Rates</header>
									<clause id="id72983824FB2344D8B4E37BE1EB14588D"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clauses (ii) and (iii), the rate of
				a loan guarantee provided under this subsection shall be not less than 80
				percent and not more than 90 percent.</text>
									</clause><clause id="id384602507E49475CA1C62EB850CE28AF"><enum>(ii)</enum><header>Certain
				recipients</header><text>The rate of a loan guarantee provided under this
				subsection to an eligible entity that serves primarily a majority of socially
				disadvantaged farmers or ranchers or beginning farmers or ranchers, as
				determined by the Secretary, shall be not less than 95 percent.</text>
									</clause><clause id="idCF26866E5DA14E2B9BA1DD1A5955017B"><enum>(iii)</enum><header>Certain
				projects</header><text>The rate of a loan guarantee provided under this
				subsection for a project that, as determined by the Secretary, will result in
				increased employment in a low-income community, an economic empowerment zone,
				or such other similar area as the Secretary may designate, shall be not less
				than 95 percent.</text>
									</clause></subparagraph><subparagraph id="ID25ce99d030fd4a43812c249e968d6102"><enum>(B)</enum><header>Eligible
				lenders</header><text>For purposes of loan guarantees under this paragraph,
				eligible lender institutions include—</text>
									<clause id="idD8B7600BC7824BE1AED1935F0F69F70F"><enum>(i)</enum><text>community
				development financial institutions;</text>
									</clause><clause id="ID4e056e07602f426fabd98fbf904be573"><enum>(ii)</enum><text>community
				development banks;</text>
									</clause><clause id="IDcbd8b599cea94d2f84377fb3561bb1fe"><enum>(iii)</enum><text>credit
				unions;</text>
									</clause><clause id="ID8af6269533634627864d25f94cf79324"><enum>(iv)</enum><text>banks owned by
				Indian tribes; and</text>
									</clause><clause id="id901A74A815294D799E2E22DCD54E0108"><enum>(v)</enum><text>such other
				institutions as the Secretary may designate to ensure equitable access to loan
				guarantees—</text>
										<subclause id="id6AF57AA0DAC740458D8751B16C52A472"><enum>(I)</enum><text>in each State;
				and</text>
										</subclause><subclause id="id45F0AFD8B8B24CCE9D1BB60EDC6797FB"><enum>(II)</enum><text>to Indian tribal
				organizations.</text>
										</subclause></clause></subparagraph><subparagraph id="ID6b4567103ce6422d914e1916ee92cf72"><enum>(C)</enum><header>Maximum
				amount</header><text>The amount of a loan guaranteed under this subsection
				shall not exceed $1,500,000, as adjusted to reflect changes for the 12-month
				period ending the preceding November 30 in the Consumer Price Index for All
				Urban Consumers published by the Bureau of Labor Statistics of the Department
				of Labor.</text>
								</subparagraph></paragraph><paragraph id="id788B253ADF364E94B0876CF521B567CE"><enum>(7)</enum><header>Use of
				funds</header><text>An eligible entity or individual producer shall use funds
				provided pursuant to a loan or loan guarantee under this subsection to develop
				processing, distribution, and information infrastructure for locally or
				regionally produced food, in accordance with the purpose of this section,
				including through—</text>
								<subparagraph id="ID684adb7aa10a45678c71c2c7096e7ecd"><enum>(A)</enum><text>construction of
				new infrastructure;</text>
								</subparagraph><subparagraph id="ID4aa01e9654054c5088737828da2f9a1a"><enum>(B)</enum><text>rehabilitation of
				existing infrastructure;</text>
								</subparagraph><subparagraph id="ID6f0f102519e54f91a1519dfdce83ab38"><enum>(C)</enum><text>activities to
				support the development of marketing networks and alliances;</text>
								</subparagraph><subparagraph id="ID44e66165ec3d470f870fa829c0ae0109"><enum>(D)</enum><text>development of
				information infrastructure, including websites;</text>
								</subparagraph><subparagraph id="IDb6714104bdcf4a20a466bc280bb04a3c"><enum>(E)</enum><text>purchases of
				equipment for processing, distribution, transportation, storage, and other
				related purposes; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc3a6819455144b52b0161d634facd1e6"><enum>(F)</enum><text>other activities,
				as the Secretary determines to be appropriate.</text>
								</subparagraph></paragraph><paragraph id="id66665326821247DEA69EB2E97E2D0358"><enum>(8)</enum><header>Funding</header><text>On
				October 1, 2008, and on each October 1 thereafter through October 1, 2013, out
				of any funds in the Treasury not otherwise appropriated, the Secretary of the
				Treasury shall transfer to the Secretary to carry out this subsection
				$35,000,000, to remain available until expended, of which—</text>
								<subparagraph id="id442885F2B0CF4A6EA13F097D413A159C"><enum>(A)</enum><text>not less than
				$15,000,000 shall be used for each fiscal year to provide loans under paragraph
				(4); and</text>
								</subparagraph><subparagraph id="idFDA96EC7582842E9BB9B150713EA9B7B"><enum>(B)</enum><text>not less than
				$10,000,000 shall be used for each fiscal year to provide loan guarantees under
				paragraph (5).</text>
								</subparagraph></paragraph></subsection><subsection id="id407FDDFAEA934181AA1B6D9B38C3688D"><enum>(e)</enum><header>Grant and loan
				program requirements</header>
							<paragraph id="id2EA032E2BAD14AD1A3B2AFFDA11D4847"><enum>(1)</enum><header>Technical
				assistance and outreach</header>
								<subparagraph id="id6A1312B0975D49A081C65A9502BC6DF6"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall—</text>
									<clause id="id3335CB1F25AD439F84CC8A8AEFE500E4"><enum>(i)</enum><text>provide to the
				public information relating to the grant and loan programs under this section;
				and</text>
									</clause><clause id="idB31E3E7F255347809E8122B9744228EB"><enum>(ii)</enum><text>provide
				technical assistance to—</text>
										<subclause id="id2CA95A0B50AA4F8FAAA014F19CDA40B7"><enum>(I)</enum><text>socially
				disadvantaged farmers or ranchers;</text>
										</subclause><subclause id="id861FF274A01A427C914D40EC42D303BC"><enum>(II)</enum><text>Indian tribal
				organizations;</text>
										</subclause><subclause id="idB4C0103B4A784EBA91DC20B51A895421"><enum>(III)</enum><text>low-income
				populations; and</text>
										</subclause><subclause id="id79D084B0746F433B8FA869E4BE928166"><enum>(IV)</enum><text>other
				underserved communities and producers.</text>
										</subclause></clause></subparagraph><subparagraph id="idA347A1AC92C04076B908C8A82CE71C09"><enum>(B)</enum><header>Service
				providers</header><text>In carrying out subparagraph (A), the Secretary may
				enter into contracts, on a competitive basis, with entities that, as determined
				by the Secretary—</text>
									<clause id="id0383E3C3F9144E228AB17E88F3EC4919"><enum>(i)</enum><text>demonstrate
				experience in serving socially disadvantaged farmers or ranchers and other
				underserved communities and producers;</text>
									</clause><clause id="ID24f59c374f7e47849d8fcdb13a7a2889"><enum>(ii)</enum><text>include, in the
				governance structure of the entity, 2 or more members representing the targeted
				communities served by the entity; and</text>
									</clause><clause id="id32BF7AC18C114B898A8AF6C4C3863D78"><enum>(iii)</enum><text>will share
				information developed or used by the entity with—</text>
										<subclause id="id529FCCAC2BB246A3A2D33CAC887CEC80"><enum>(I)</enum><text>researchers;</text>
										</subclause><subclause id="idD85335BED0E143659AB2DFEADAA29187"><enum>(II)</enum><text>practitioners;
				and</text>
										</subclause><subclause id="id44CC251898B646C8A9BC8E5F82A129A1"><enum>(III)</enum><text>other
				interested parties.</text>
										</subclause></clause></subparagraph><subparagraph id="id767EB122606D40C0B9F132269E00D235"><enum>(C)</enum><header>Funding</header><text>On
				October 1, 2008, and on each October 1 thereafter through October 1, 2013, out
				of any funds in the Treasury not otherwise appropriated, the Secretary of the
				Treasury shall transfer to the Secretary to carry out this paragraph not less
				than $200,000 and not more than an amount equal to 5 percent of the funds
				required to carry out this program, to remain available until expended.</text>
								</subparagraph></paragraph><paragraph id="idB8CEB533A8554D4B88F2E8121CA9E400"><enum>(2)</enum><header>Limitations</header><text>For
				purposes of the programs under this section, the Secretary—</text>
								<subparagraph id="ID36cd7e1175924c29a3118a8bf17feeac"><enum>(A)</enum><text>shall not give
				preference to any entity based on an agricultural commodity produced or
				supported by the entity; and</text>
								</subparagraph><subparagraph id="idC6DD0C9925F24EB3818226C32E054AF0"><enum>(B)</enum><text>shall encourage,
				to the maximum extent practicable, projects that use infrastructure efficiently
				for more than 1 agricultural product.</text>
								</subparagraph></paragraph><paragraph id="id1F6CB3877F7D4FB2AC58D045BBE4F839"><enum>(3)</enum><header>Report</header><text>Not
				less frequently than once each year, the Secretary shall submit to Congress a
				report that describes the programs (including the level of participation in
				each program) under this section, including information relating to—</text>
								<subparagraph id="idE85DB67BCD404A4EA6E6B4807BF197EF"><enum>(A)</enum><text>projects carried
				out under this section;</text>
								</subparagraph><subparagraph id="id637DA90579764FF3AB93FB3BF2BA55D9"><enum>(B)</enum><text>characteristics
				of the agricultural producers and communities served by the projects;</text>
								</subparagraph><subparagraph id="idD3BFF728E2C1401181B8D6E0297B6A8D"><enum>(C)</enum><text>the benefits of
				the projects;</text>
								</subparagraph><subparagraph id="ID7414983419db47bd9afa382b33d62bfb"><enum>(D)</enum><text>data necessary to
				comply with—</text>
									<clause id="id1BDF2BD422074C2BA06B78830C46C370"><enum>(i)</enum><text>section 2501A of
				the Food, Agriculture, Conservation, and Trade Act of 1990 (7 U.S.C. 2279–1);
				or</text>
									</clause><clause id="id57B32788A823434F9DD30ECC5FB7EA25"><enum>(ii)</enum><text>section
				8(b)(5)(B) of the Soil Conservation and Domestic Allotment Act (16 U.S.C.
				590h(b)(5)); and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BC4C919FC8F475CBE68D3C645D64B05"><enum>(E)</enum><text>outreach and
				technical assistance activities carried out by the Secretary under paragraph
				(1).</text>
