		<legis-type display="yes">A BILL</legis-type>
		<official-title display="yes">To amend title XXI of the Social Security
		  Act to allow qualifying States to use all or any portion of their allotments
		  under the State Children's Health Insurance Program for certain Medicaid
		  expenditures.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="id064D3BA84F0A47D091E7CBDDDC01E594" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Authority for qualifying States to use all
			 or any portion of their SCHIP allotments for certain Medicaid
			 expenditures</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID9D21D53167C840FB994D13334E2B1871"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/2105(g)(1)(A)">Section 2105(g)(1)(A)</external-xref> of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee(g)(1)(A)">42 U.S.C.
			 1397ee(g)(1)(A)</external-xref>), as amended by section 201(b) of the National
			 Institutes of Health Reform Act of 2006, is amended by striking <quote>not more
			 than 20 percent of any allotment under section 2104 for fiscal year 1998, 1999,
			 2000, 2001, 2004, 2005, 2006, or 2007</quote> and inserting <quote>all or any
			 portion of any allotment made to the State under section 2104 for a fiscal
			 year</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idAEF38003DE1245B59E84FCDA0D85B9BD"><enum>(b)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">Section 2105(g)(2) of such Act (42 U.S.C.
			 1397ee(g)(2)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idAB97C79E8FF94A24856157169D1B817B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>a State, that,
			 on</quote> and inserting</text>
					<quoted-block display-inline="yes-display-inline" id="id5252CECF211143DB94062A2F67A3228E" style="OLC">
						<text>a State that is
			 described in subparagraph (A) and satisfies all of the requirements of
			 subparagraph (B).</text><subparagraph commented="no" display-inline="no-display-inline" id="id28DEEB72BD4945F79A6069DB05E46CA2"><enum>(A)</enum><header display-inline="yes-display-inline">State described</header><text display-inline="yes-display-inline">A State described in this subparagraph is a
				State that, on</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3C410A8130C6420FA9D0810668D8F96A"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id176F16C0E1F24B77A8511B1583317E5B" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id8D3526F097574E0D8BA65C60797F8A36"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The requirements of this subparagraph are
				the following:</text>
							<clause commented="no" display-inline="no-display-inline" id="ID50469A8FC45249169836F2EF0059C562"><enum>(i)</enum><header display-inline="yes-display-inline">No reduction in medicaid or SCHIP income
				eligibility</header><text display-inline="yes-display-inline">Since January 1,
				2001, the State has not reduced the income, assets, or resource requirements
				for eligibility for medical assistance under title XIX or for child health
				assistance under this title.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDB6334123D0634C01A0B9A3A4D4AF78A0"><enum>(ii)</enum><header display-inline="yes-display-inline">No waiting list imposed</header><text display-inline="yes-display-inline">The State does not impose any numerical
				limitation, waiting list, or similar limitation on the eligibility of children
				for medical assistance under title XIX or child health assistance under this
				title and does not limit the acceptance of applications for such
				assistance.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID9807ABD318C04827ADE160A0C0F4A21C"><enum>(iii)</enum><header display-inline="yes-display-inline">Provides assistance to all children who
				apply and qualify</header><text display-inline="yes-display-inline">The State
				provides medical assistance under title XIX or child health assistance under
				this title to all children in the State who apply for and meet the eligibility
				standards for such assistance.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDD1129A7F560E4F789F5D7F27897DC684"><enum>(iv)</enum><header display-inline="yes-display-inline">Protection against inability to pay
				premiums or copayments</header><text display-inline="yes-display-inline">The
				State ensures that no child loses coverage under title XIX or this title, or is
				denied needed care, as a result of the child’s parents’ inability to pay any
				premiums or cost-sharing required under such title.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDDF9DC7C5B90F43E1A800D1682B6F5B67"><enum>(v)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">The State has implemented at least 3 of the
				following policies and procedures (relating to coverage of children under title
				XIX and this title):</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID5C33B2CA57A04749B83FE471317E8726"><enum>(I)</enum><header display-inline="yes-display-inline">Simplified application form</header><text display-inline="yes-display-inline">With respect to children who are eligible
				for medical assistance under title XIX, the State uses the same simplified
				application form (including, if applicable, permitting application other than
				in person) for purposes of establishing eligibility for assistance under title
				XIX and this title.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0136CFB462B04BD7869B7D8BFACC6D20"><enum>(II)</enum><header display-inline="yes-display-inline">Elimination of asset test</header><text display-inline="yes-display-inline">The State does not apply any asset test for
				eligibility under title XIX or this title with respect to children.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDF2DE4BE03C9346E7A3F9F3CD4293A5EF"><enum>(III)</enum><header display-inline="yes-display-inline">Adoption of 12-month continuous
				enrollment</header><text display-inline="yes-display-inline">The State provides
				that eligibility shall not be regularly redetermined more often than once every
				year under this title or for children eligible for medical assistance under
				title XIX.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDBFE0DEA2196D435180FB61791566CD05"><enum>(IV)</enum><header display-inline="yes-display-inline">Same verification and redetermination
				policies; automatic reassessment of eligibility</header><text display-inline="yes-display-inline">With respect to children who are eligible
				for medical assistance under section 1902(a)(10)(A), the State provides for
				initial eligibility determinations and redeterminations of eligibility using
				the same verification policies (including with respect to face-to-face
				interviews), forms, and frequency as the State uses for such purposes under
				this title, and, as part of such redeterminations, provides for the automatic
				reassessment of the eligibility of such children for assistance under title XIX
				and this title.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDB8EC7D088F9F4D51A8C0B5331D33D0F9"><enum>(V)</enum><header display-inline="yes-display-inline">Outstationing enrollment
				staff</header><text display-inline="yes-display-inline">The State provides for
				the receipt and initial processing of applications for benefits under this
				title and for children under title XIX at facilities defined as
				disproportionate share hospitals under section 1923(a)(1)(A) and
				Federally-qualified health centers described in section 1905(l)(2)(B)
				consistent with section
				1902(a)(55).</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE4E2FC9C9DFE49B482EC7F64B97EECAC"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on October 1, 2007, and shall apply to
			 expenditures described in section 2105(g)(1)(B)(ii) of the Social Security Act
			 (42 U.S.C. 1397ee(g)(1)(B)(ii)) that are made after that date.</text>
