<section id="idE4116F2A68C44BDA8DB17F7A252D4D34"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Agriculture.</text> </section>
<title id="idD51F0211FECE48E48B60EACA860753C7"><enum>I</enum><header>Risk management accounts</header> 
<section id="ID41f72a2d9ced4fc2a8a7c4e76e2be9b1"><enum>1001.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="ID1fa7f4f2f9a54bbc83aa20dabcbb02af"><enum>(1)</enum><header>Adjusted gross revenue</header><text>The term <term>adjusted gross revenue</term>, with respect to a farm of an operator or producer, means the adjusted gross income of the farm, as determined by the Secretary, from the sale or transfer of eligible commodities of the farm, as calculated—</text> 
<subparagraph id="ID98fbcc9249704d5c8f320d87aeac1949"><enum>(A)</enum><text>taking into consideration the gross receipts (including insurance indemnities) from each sale;</text> </subparagraph>
<subparagraph id="ID75fa0acc22894a66bed9ce1b349e7372"><enum>(B)</enum><text>including all farm payments received by the operator or producer from any Federal, State, or local government agency relating to the eligible commodities;</text> </subparagraph>
<subparagraph id="ID9c60b36f14784e7ea2393919e7d959ee"><enum>(C)</enum><text>by deducting the cost or basis of any eligible livestock or other item purchased for resale, such as feeder livestock, by the farm;</text> </subparagraph>
<subparagraph id="ID8638707a3a1a408cad08806bb7ac8ef4"><enum>(D)</enum><text>excluding any revenue that does not arise from the sale of eligible commodities of the farm, such as revenue associated with the packaging, merchandising, marketing, or reprocessing beyond what is typically carried out by a producer of the eligible commodity, as determined by the Secretary; and</text> </subparagraph>
<subparagraph id="ID2ff5092d76ca47b7ba6177473fe18341"><enum>(E)</enum><text>using such adjustments, additions, and additional documentation as the Secretary determines to be appropriate, as presented on—</text> 
<clause id="ID9a53348a8bc64d3aa510c8397c185cac"><enum>(i)</enum><text>a schedule F form of the Federal income tax returns of the operator or producer; or</text> </clause>
<clause id="ID5af0e65c021045e19015868057b44a1d"><enum>(ii)</enum><text>a comparable tax form relating to the farm, as approved by the Secretary.</text> </clause></subparagraph></paragraph>
<paragraph id="ID01544913d59b4f37a5225065c723b781"><enum>(2)</enum><header>Agricultural crop</header><text>The term <term>agricultural crop</term> means any annual or perennial crop raised or produced by an operator or producer.</text> </paragraph>
<paragraph id="IDd145d8912bb042b1be19bb3c962ccc11"><enum>(3)</enum><header>Applicable year</header><text>The term <term>applicable year</term> means a fiscal year covered by a risk management account contract.</text> </paragraph>
<paragraph id="IDcf6d9ff67da74bf68193951affeda306"><enum>(4)</enum><header>Average adjusted gross revenue</header><text>The term <term>average adjusted gross revenue</term> means—</text> 
<subparagraph id="IDffcb43bce6f84104bacfca0ab65293b1"><enum>(A)</enum><text>the rolling average of the adjusted gross revenue of an operator or producer for each of the 5 preceding taxable years; or</text> </subparagraph>
<subparagraph id="IDcc0c534ea13d438ab2258ac70ed062fe"><enum>(B)</enum><text>in the case of a beginning farmer or rancher, or another agricultural operation that does not have adjusted gross revenue for each of the 5 preceding taxable years, the estimated income of the operation for the applicable year, as determined by the Secretary.</text> </subparagraph></paragraph>
<paragraph id="ID7244da2146944aa981d8d9cdb2155ec8"><enum>(5)</enum><header>Dairy product</header><text>The term <term>dairy product</term> means fluid milk produced on a farm or ranch.</text> </paragraph>
<paragraph id="id69068AD6F91F4230A28271D3481FF61E"><enum>(6)</enum><header>Eligible commodity</header><text>The term <term>eligible commodity</term> means—</text> 
<subparagraph id="id844235B098B4484BAF285B6B4E3E5436"><enum>(A)</enum><text>an agricultural crop; and</text> </subparagraph>
<subparagraph id="id6DEE0C93E5FC4633AC9CFA7EE8E34DF9"><enum>(B)</enum><text>a dairy product.</text> </subparagraph></paragraph>
<paragraph id="ID897e450c848b40e283cea1d741a1a2a3"><enum>(7)</enum><header>Farm</header> 
<subparagraph id="id3E6F6F2E73954AC88779E1FAA806B107"><enum>(A)</enum><header>In general</header><text>The term <term>farm</term> means any parcel of land used for the raising or production of an eligible commodity that is considered to be a separate operation, as determined by the Secretary.</text> </subparagraph>
<subparagraph id="id87D71E5484194DE9947A20F35F26FF58"><enum>(B)</enum><header>Inclusions</header><text>The term <term>farm</term> includes—</text> 
<clause id="id125778EFE3EB4C768AD58D0A4C1EF6BD"><enum>(i)</enum><text>any parcel of land and related agricultural production facilities on which an operator or producer has more than de minimis operational control; and</text> </clause>
<clause id="id64C47752F9FD46DFB7F414704D2910D8"><enum>(ii)</enum><text>any parcel of land subject to more than de minimis common ownership, as determined by the Secretary, unless the common owners of the parcel—</text> 
<subclause id="id9BF46382ED92439E80330E8050D483C0"><enum>(I)</enum><text>except with respect to a conservation condition established in an applicable rental agreement, do not have operational control regarding any portion of the parcel; and</text> </subclause>
<subclause id="id9DD9E3141C654823A664C46D550D340B"><enum>(II)</enum><text>do not share in the proceeds of the parcel, other than cash rent.</text> </subclause></clause></subparagraph>
<subparagraph id="id7F61D0578F514C098FDD9D7AB78D0999"><enum>(C)</enum><header>Exclusion</header><text>The term <term>farm</term> does not include a parcel that is not a portion of a farm subject to a risk management account contract.</text> </subparagraph>
<subparagraph id="id2ABCF5ABAA224A94A089A781A06F8AFE"><enum>(D)</enum><header>Applicability of CFR</header><text>Except as otherwise provided in this title or by the Secretary, by regulation, part 718 of title 7, Code of Federal Regulations (or successor regulations), shall apply to the definition, constitution, and reconstitution of a farm for purposes of this paragraph.</text> </subparagraph></paragraph>
<paragraph id="IDc88510ba1f8d4a28bc1bc19c80c6da66"><enum>(8)</enum><header>Operator</header><text>The term <term>operator</term> means a producer who controls an agricultural operation on a farm, as determined by the Secretary.</text> </paragraph>
<paragraph id="IDafe86a289d194817ba99d088d844f9ed"><enum>(9)</enum><header>Producer</header><text>The term <term>producer</term> means a person that, as determined by the Secretary, for an applicable year—</text> 
<subparagraph id="ID635ac39c5fc94b71a745d2e01d03e430"><enum>(A)</enum><text>shares in the risk of producing, or provides a material contribution in producing, an eligible commodity;</text> </subparagraph>
<subparagraph id="ID1b62d2cabd1f4c469e4aab56ef2c7288"><enum>(B)</enum><text>has a substantial beneficial interest in the farm on which the eligible commodity is produced;</text> </subparagraph>
<subparagraph id="IDf88e9b5b4b824e0d9e208495b294d0eb"><enum>(C)</enum>
<clause commented="no" display-inline="yes-display-inline" id="id7D437E11667C4DC29B8C7CC1C20CE211"><enum>(i)</enum><text>for each of the 5 preceding taxable years, has filed—</text> 
<subclause id="id6A88F7E3C9D84A4284EC501849CE1B7F" indent="up1"><enum>(I)</enum><text>a schedule F form of the Federal income tax return relating to the eligible commodity; or</text> </subclause>
<subclause id="id5B0AA823623E4C9791964B5C45C2B743" indent="up1"><enum>(II)</enum><text>a comparable tax form related to the eligible commodity, as approved by the Secretary; or</text> </subclause></clause>
<clause id="idA7756F6A218845E6A3966CA4B62FF4A9" indent="up1"><enum>(ii)</enum><text>is a beginning farmer or rancher, or another producer that does not have adjusted gross revenue for each of the 5 preceding taxable years, as determined by the Secretary; and</text> </clause></subparagraph>
<subparagraph id="ID93c5c3f652484782979aac4f50a6a07d"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="idC297B797D1E347E08476BB17AE7FB397"><enum>(i)</enum><text>during the 5 preceding taxable years, has earned at least $10,000 in average adjusted gross revenue;</text> </clause>
<clause id="idCBF523F3AFCC4F4E98B92D1BB5A26938" indent="up1"><enum>(ii)</enum><text>is a limited resource farmer or rancher, as determined by the Secretary; or</text> </clause>
<clause id="id6E6416E7FA234770A6E55486F4794027" indent="up1"><enum>(iii)</enum><text>in the case of a beginning farmer or rancher, or another producer that does not have adjusted gross revenue for each of the 5 preceding taxable years, has at least $10,000 in estimated income from all farms for the applicable year, as determined by the Secretary.</text> </clause></subparagraph></paragraph>
<paragraph id="ID155cb73d497448748610cfff06615a8f"><enum>(10)</enum><header>Risk management account</header><text>The term <term>risk management account</term> means a farm income stabilization assistance account maintained at a qualified financial institution in accordance with such terms as the Secretary may establish.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID91283e3f8f5f41a2a0aa5e9228c4c1d6"><enum>(11)</enum><header>Risk management account contract</header><text>The term <term>risk management account contract</term> means a farm income stabilization assistance contract entered into under section 1002.</text> </paragraph></section>
<section id="ID31e60d732381429b9c29316c03299d95"><enum>1002.</enum><header>Risk management account contracts</header> 
<subsection id="id30988A7F4B504010A90BC86E91B900C3"><enum>(a)</enum><header>Establishment of program</header><text>The Secretary shall establish and carry out a program under which the Secretary shall offer to enter into contracts with eligible operators and producers in accordance with this section—</text> 
<paragraph id="id74F92B98E2A849FD988BC43E92D1CC45"><enum>(1)</enum><text>to provide to the operators and producers a reserve to assist in the stabilization of farm income during low-revenue years;</text> </paragraph>
<paragraph id="id4A447DBFA2C9419A9E12BEB793E8C5D9"><enum>(2)</enum><text>to assist operators and producers to invest in value-added farms; and</text> </paragraph>
<paragraph id="id6C9950F8C9674DA79352E0A73DDC4FE1"><enum>(3)</enum><text>to recognize high levels of environmental stewardship.</text> </paragraph></subsection>
<subsection id="idF49078B3DB014092B7C247A734B44E58"><enum>(b)</enum><header>Eligibility</header> 
<paragraph id="id0D76931807EE418E939A8421AC9D96D1"><enum>(1)</enum><header>In general</header><text>Any operator that has participated in a commodity program under title I of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7901 et seq.), and that otherwise meets each eligibility requirement under this title, shall be eligible to enter into a risk management account contract for agricultural production during each of fiscal years 2008 through 2014.</text> </paragraph>
<paragraph id="id1B4C235B87DE42E492ABDC5AEB66D0AA"><enum>(2)</enum><header>Other producers</header><text>A producer that is not an operator described in paragraph (1) shall be eligible to enter into a risk management account contract for agricultural production during each of fiscal years 2008 through 2014.</text> </paragraph>
<paragraph id="id83860172BEFC478EB72CD4A35C83F774"><enum>(3)</enum><header>Limitations</header> 
<subparagraph id="idF996D29C1AB047FBB3A8131DB66705ED"><enum>(A)</enum><header>In general</header><text>No farm or portion of a farm shall be subject to more than 1 risk management account contract during any fiscal year.</text> </subparagraph>
<subparagraph id="id69A27BC4D2B547A5899C8D220DA60B65"><enum>(B)</enum><header>Multiple risk management account contracts</header> 
<clause id="id23A7DE0C84584B1DADE7BAE6E8FAE954"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), no operator or producer shall participate or have a beneficial interest in more than 1 risk management account contract during any fiscal year.</text> </clause>
<clause id="id7592D9E9057A438EA6F6C4C343B2507C"><enum>(ii)</enum><header>Exception</header><text>Notwithstanding clause (i), an operator that is eligible to receive a transition payment during a fiscal year, and that participates or has a beneficial interest in a risk management account contract during that fiscal year, may enter into an additional risk management account contract during the fiscal year if—</text> 
<subclause id="idBA0FB81AAB024FC9AAA90BB8A927CA4D"><enum>(I)</enum><text>the additional risk management account contract is entered into solely for the purpose of receiving the transition payment; and</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="id882C3F6D0644444E9AD1A26841D67C2B"><enum>(II)</enum><text>the operator is not otherwise eligible to participate or have a beneficial interest in the additional risk management account contract.</text> </subclause></clause></subparagraph></paragraph></subsection>
<subsection id="idC1722617FDCC4698A1FB4566A1B799FA"><enum>(c)</enum><header>Risk management accounts</header> 
<paragraph id="id57965FF872C143D1A4A87FE4A151DA5C"><enum>(1)</enum><header>In general</header><text>Each risk management account contract entered into under this section shall establish, in the name of the farm of the operator or producer, as applicable, in an appropriate financial institution and subject to such investment rules and other procedures as the Secretary, on approval of the Secretary of the Treasury, determines to be necessary to provide reasonable assurance of the viability and stability of the account, a risk management account, to consist of—</text> 
<subparagraph id="id7EA9E0D79A5A4088831EC1D941CB2E42"><enum>(A)</enum><text>such amounts as are transferred to the risk management account by the Secretary during an applicable year in accordance with paragraph (2) (including the amendments made by that paragraph); and</text> </subparagraph>
<subparagraph id="id713A1F1773F24755A0EC03516F2414EB"><enum>(B)</enum><text>such amounts as are voluntarily contributed by the operator or producer during the applicable year in accordance with paragraph (6).</text> </subparagraph></paragraph>
<paragraph id="ID9d3e1c6b47c1463db362309510356852"><enum>(2)</enum><header>Transfers</header> 
<subparagraph id="idFB394972EF804D15A4DA64E29A5E0B47"><enum>(A)</enum><header>Availability of direct payments</header><text>Section 1103 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7913) is amended—</text> 
<clause id="IDccdf74866f4f4107814416d1e13fb1c3"><enum>(i)</enum><text>in subsection (a), by striking <quote>For each of the 2002 through 2007</quote> and inserting <quote>For each of the 2008 through 2014</quote>;</text> </clause>

<subparagraph id="IDc91b4ce287404189a16bcf5940418f6e"><enum>(B)</enum><header>Availability of counter-cyclical payments</header><text>Section 1104 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7914) is amended—</text>

<subsection commented="no" id="id0A952E0A2BA74D5BA422D7113792A8BB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For each of fiscal years 2008 through 2012, the Secretary shall make an equal annual payment to producers on a dairy farm.</text> </subsection>
<subsection commented="no" id="id5AD213E0806840BF992BCBCF20A62BE3"><enum>(b)</enum><header>Amount</header><text display-inline="yes-display-inline">The total amount of payments made under subsection (a) to the producers on a dairy farm shall be equal to 25 percent of the average amount of payments that the producers on the dairy farm received under this section during the period of fiscal years 2003 through 2007.</text> </subsection>
<subsection commented="no" id="id3FF9C542D368449C93D4C0B7877FA706"><enum>(c)</enum><header>Availability of payments</header><text display-inline="yes-display-inline">For each payment described in subsection (a)—</text> 
<paragraph commented="no" id="id3DDBE67D181B47FE84917E4D06FC140A"><enum>(1)</enum><text display-inline="yes-display-inline">50 percent shall be made directly to the producer; and</text> </paragraph>
<paragraph commented="no" id="idE6F88E36532C4C11B683C035C6D41ED1"><enum>(2)</enum><text display-inline="yes-display-inline">50 percent shall be placed in the risk management account for the producers on the dairy farm established pursuant to section 1002 of the <short-title>Farm Risk Management Act for the 21st Century</short-title>.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph>
<subparagraph commented="no" id="idBA78795A829D4AC0BBD0524EF79BF274"><enum>(D)</enum><header>Stewardship payments</header> 
<clause commented="no" id="idE03646E08FCB4978BF4337B9967F1FBA"><enum>(i)</enum><header>Amount</header> 
<subclause commented="no" id="id2F4E8ED4BED5493297D47610EE8DCEAB"><enum>(I)</enum><header>In general</header><text>For each applicable year during fiscal years 2010 through 2014, the Secretary shall transfer to the risk management account of an operator or producer described in subclause (II) a stewardship payment in an amount equal to a percentage, as determined under clause (ii), of the adjusted gross revenue of the operator or producer for the applicable year, based on the level of stewardship of the conservation plan, as determined by the Chief of the Natural Resources Conservation Service, in accordance with subsection (d).</text> </subclause>
<subclause commented="no" id="ID04eabe0086cc4029ad45992e60a29e89"><enum>(II)</enum><header>Eligibility</header><text>To be eligible to receive a stewardship payment under subclause (I), an operator or producer shall comply with a conservation plan that describes the conservation and performance measures to be maintained or achieved on the farm of the operator or producer.</text> </subclause></clause>
<clause commented="no" id="id3604B01C2D8A43F4A6B9AA5BDFF45C71"><enum>(ii)</enum><header>Percentages</header><text>The Secretary shall transfer to the risk management account of an operator or producer described in clause (i) an amount equal to—</text> 
<subclause commented="no" id="id5D55A0CAA9A64F0FA1810A63F4A51426"><enum>(I)</enum><text>for an operator or producer that complies with a level 1 conservation plan, $0;</text> </subclause>
<subclause commented="no" id="id312B8C8751934ECAA514A9F762316461"><enum>(II)</enum><text>for an operator or producer that complies with a level 2 conservation plan, an amount equal to the sum of—</text> 
<item commented="no" id="id66DD23CC51C642D09690F036D709074B"><enum>(aa)</enum><text>3 percent of the adjusted gross revenue of the operator or producer that are not more than $250,000; and</text> </item>
<item commented="no" id="id260ACE5118D04DAB8AA5A7338BD7CA20"><enum>(bb)</enum><text>0.5 percent of the adjusted gross revenue of the operator or producer that are more than $250,000 and less than $1,000,000; and</text> </item></subclause>
<subclause commented="no" id="id14BE79D595AB45849C524FCB3299DBEA"><enum>(III)</enum><text>for an operator or producer that complies with a level 3 conservation plan, an amount equal to the sum of—</text> 
<item commented="no" id="id964A18B6C6874A02B5DC6713B6F15FF0"><enum>(aa)</enum><text>4 percent of adjusted the gross revenue of the operator or producer that are not more than $250,000; and</text> </item>
<item commented="no" display-inline="no-display-inline" id="idFCB3271D39454356904B0484B6842812"><enum>(bb)</enum><text>1 percent of adjusted the gross revenue of the operator or producer that are more than $250,000 and less than $1,000,000.</text> </item></subclause></clause></subparagraph></paragraph>
<paragraph id="ID8c176f186c2f4d599694c8e993f410f7"><enum>(3)</enum><header>Operator and producer contributions</header><text>During any applicable year, an operator or producer may voluntarily contribute to the risk management account of the operator or producer not more than $8,000.</text> </paragraph>
<paragraph id="id47FD5A69A7A14A689461E3BBB3A5DD77"><enum>(4)</enum><header>Withdrawals</header> 
<subparagraph id="id21499464F59D47248D237C2549A905CF"><enum>(A)</enum><header>In general</header><text>An operator or producer may withdraw amounts in the risk management account of the operator or producer only—</text> 
<clause id="idA01566EF87D74A0A8B7421CED37228CB"><enum>(i)</enum><text>for an applicable year during which the adjusted gross revenue of the operator or producer is equal to less than 95 percent of the average adjusted gross revenue of the operator or producer, in an amount that is equal to the lesser of—</text> 
<subclause id="id77F3B084DC1C48BB937A96051D5CB337"><enum>(I)</enum><text>the difference between—</text> 
<item id="idDAD8673B7A1A4069A57B7A63AB7A92A1"><enum>(aa)</enum><text>the average adjusted gross revenue of the operator or producer; and</text> </item>
<item id="id39D4F28B95E74F748BB89CCACE99F3B9"><enum>(bb)</enum><text>the adjusted gross revenue of the operator or producer; and</text> </item></subclause>
<subclause id="id4EFFC57D1B8544BE873C00DF00E52870"><enum>(II)</enum><text>the amount of coverage that could be purchased under an adjusted gross revenue product available to the operator or producer through the Federal crop insurance program;</text> </subclause></clause>
<clause id="idF72F0D59F40E4A93A69C6E928D88296F"><enum>(ii)</enum><text>for investment in a value-added agricultural operation that contributes to the agricultural economy, as determined by the Secretary, and is not farmland or equipment used to produce raw agricultural products, an amount equal to the product obtained by multiplying—</text> 
<subclause id="idC2F56AB43A0D471E869BCAA7F65ACB36"><enum>(I)</enum><text>the total amount in the risk management account of the operator or producer on September 30 of the preceding applicable year; and</text> </subclause>
<subclause id="id20F315F5310E473EA6F0C9F58B457BFF"><enum>(II)</enum><text>10 percent;</text> </subclause></clause>
<clause id="id8E629CA69D754E19872F9595DFFD287F"><enum>(iii)</enum><text>as the Secretary determines to be necessary to protect the solvency of a farm of the operator or producer; or</text> </clause>
<clause id="id32F74237119946DC952EB248AEE8386B"><enum>(iv)</enum><text>to purchase revenue insurance or crop insurance.</text> </clause></subparagraph>
<subparagraph id="id4273BFB54B134B77B91A33EB37E54DA9"><enum>(B)</enum><header>Transfer to IRA account</header><text>In any calendar year, an individual operator or producer aged 65 years or older who is the holder of a risk management account in existence for at least 5 years may elect to rollover not more than 15 percent of the balance of the risk management account into an individual retirement account pursuant to section 408 of the Internal Revenue Code of 1986.</text> </subparagraph></paragraph>
<paragraph id="ID4f2a709b2200474292d73088ff5ce1fe"><enum>(5)</enum><header>Limitations</header> 
<subparagraph id="idAF67D149183142A39CDCB815D42914C4"><enum>(A)</enum><header>Attribution requirement</header><text>The Secretary shall ensure that each payment transferred to a risk management account under this subsection is attributed to an individual operator or producer that is a party to the applicable risk management account contract.</text> </subparagraph>
<subparagraph id="idCDEBEC0D6E244D1FAF7C10F2BA79E390"><enum>(B)</enum><header>No individual benefit</header> 
<clause id="id0B0524743D52480EB986FEF06612450E"><enum>(i)</enum><header>In general</header><text>The Secretary shall ensure that no individual operator or producer receives a direct benefit from more than 1 risk management account account.</text> </clause>
<clause id="idDFEE3D9537964103BB9749E65B732990"><enum>(ii)</enum><header>Proportional reduction</header><text>The Secretary shall reduce the amount of a standard payment or stewardship payment under this subsection in an amount equal to the proportion that—</text> 
<subclause id="idF826508DE4E144B088A27D3C77431BBD"><enum>(I)</enum><text>the amount of each direct or indirect benefit received by the applicable individual operator or producer under the applicable risk management account contract; bears to</text> </subclause>
<subclause id="idFFD0332585084456ACD089D479DBCB67"><enum>(II)</enum><text>the amount of any direct or indirect benefit received by the individual operator or producer under any other risk management account contract under which a standard or stewardship payment is transferred to a risk management account.</text> </subclause></clause></subparagraph>
<subparagraph id="id074CF7213FB0422DB1F07FE4B1EAA66C"><enum>(C)</enum><header>Maximum amount</header><text>The total amount of standard and stewardship payments attributed to an individual operator or producer for any applicable year shall not exceed the maximum total payment a risk management account is eligible to receive during the applicable year.</text> </subparagraph></paragraph>
<paragraph id="IDef510fc7b1464bff9bb144d658820c0f"><enum>(6)</enum><header>Conservation compliance</header><text>Each operator, and each holder of a beneficial interest in a farm subject to a risk management account contract, shall comply with—</text> 
<subparagraph id="IDb65d6ddb70404474aefce51cea6ae140"><enum>(A)</enum><text>applicable highly erodible land conservation requirements under subtitle B of title XII of the Food Security Act of 1985 (16 U.S.C. 3811 et seq.); and</text> </subparagraph>
<subparagraph id="IDa0e5c9f0db784166bc3c662ebf73d484"><enum>(B)</enum><text>applicable wetland conservation requirements under subtitle C of title XII of that Act (16 U.S.C. 3821 et seq.).</text> </subparagraph></paragraph>
<paragraph id="id327362FA278E436CBB58BC4EBC0D12A1"><enum>(7)</enum><header>Regulations</header><text>The Secretary shall promulgate such regulations as the Secretary determines to be necessary to carry out this subsection.</text> </paragraph></subsection>
<subsection id="IDeddeca3620f64c1682608608b41377ef"><enum>(d)</enum><header>Administration of stewardship payments</header> 
<paragraph id="idA77D3CA769664DA2B224805455973955"><enum>(1)</enum><header>Determination of levels</header> 
<subparagraph id="idA0C0110ED23846D2B5F0C555C441756C"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a stewardship index through which conservation plans of farms that are subject to risk management account contracts shall be categorized.</text> </subparagraph>
<subparagraph id="idCCFF2B4D67EC4B0297E684337A0E34B7"><enum>(B)</enum><header>Levels</header><text>The index under subparagraph (A) shall be comprised of 5 levels, of which—</text> 
<clause id="id55910A8CEF104D56A3C543E2DC1B7828"><enum>(i)</enum><text>level 1 shall represent the lowest level of stewardship of a conservation plan; and</text> </clause>
<clause id="id9E5F442EF2944FC6BFE10C6FDA7E798E"><enum>(ii)</enum><text>level 5 shall represent the highest level of stewardship of a conservation plan.</text> </clause></subparagraph>
<subparagraph id="idEB65423AAA1C4FC29BF3310E2EF64030"><enum>(C)</enum><header>Requirements</header> 
<clause id="idA9CEBABB80184DF18C18BE006F35E204"><enum>(i)</enum><header>In general</header><text>The Secretary shall ensure that each level of the index consists of an equal number of farms.</text> </clause>
<clause id="id1C797470163F41B9B2392488C5E5167F"><enum>(ii)</enum><header>Factors for consideration</header><text>In classifying farms into the index under this paragraph, the Secretary shall take into consideration—</text> 
<subclause id="idDFB54B67218D40E0879AA25DFAAB8427"><enum>(I)</enum><text>the production type of the farms; and</text> </subclause>
<subclause id="id510ECA1AF89E449BAE1AB8DF272CB3F9"><enum>(II)</enum><text>such other factors as the Secretary determines to be appropriate to ensure that each farm is evaluated using the same criteria.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="idE943DA1B6C234C2D855DFFCEB586F169"><enum>(2)</enum><header>Eligibility</header><text>To be eligible to receive a stewardship payment under subsection (c)(2)(D), an operator or producer shall—</text> 
<subparagraph id="id6D39969040304A70BBFE89082B474DA3"><enum>(A)</enum><text>ensure that the farm of the operator or producer complies with a conservation plan that—</text> 
<clause id="idB78B92F786D14DA1B19DE47486024F94"><enum>(i)</enum><text>describes the conservation practices, measures, and performance standards to be achieved by the farm to maintain the stewardship level of the conservation plan; and</text> </clause>
<clause id="id3A21EAAA90634B3096AF88CE742586F5"><enum>(ii)</enum><text>is objective, specific, and written in plain language, to the maximum extent practicable;</text> </clause></subparagraph>
<subparagraph id="id3ADFE0CD02EE46498919B41F7E513903"><enum>(B)</enum><text>submit to the Secretary—</text> 
<clause id="idC7665F1585D4463F89F8C3AF975ADF42"><enum>(i)</enum><text>together with the risk management account contract of the operator or producer a copy of the conservation plan of the applicable farm (including a concise summary of the plan); and</text> </clause>
<clause id="id4EBEC2237BA8485081CD4F7BF863C2C2"><enum>(ii)</enum><text>a certified application at such time, in such manner, and containing such information as the Secretary may require; and</text> </clause></subparagraph>
<subparagraph id="id20C2ED3DFE224C5B93562E985F677B78"><enum>(C)</enum><text>accommodate such on-farm evaluations as the Secretary determines to be necessary.</text> </subparagraph></paragraph>
<paragraph id="idF019A23873DE4996ACD947910E6797B8"><enum>(3)</enum><header>Notification</header><text>The Secretary shall provide to each operator and producer selected to receive a stewardship payment under paragraph (2) a notification of—</text> 
<subparagraph id="id87937CD2E887405AADC3DE404DD5336F"><enum>(A)</enum><text>the stewardship level of the conservation plan of the applicable farm; and</text> </subparagraph>
<subparagraph id="idC0BE675ECB2842E5A085F641064117D5"><enum>(B)</enum><text>the amount of the stewardship payment to be transferred to the risk management account of the farm.</text> </subparagraph></paragraph>
<paragraph id="id05D2C89F65FA4CAA826B688EE660F991"><enum>(4)</enum><header>Certification requirement</header> 
<subparagraph id="idCE9492216AEE46F79667ED27B2309891"><enum>(A)</enum><header>In general</header><text>As a condition of receiving a stewardship payment under subsection (c)(2)(D) for an applicable year, an operator or producer shall certify to the Secretary that the farm subject to the applicable risk management account contract is in compliance with—</text> 
<clause id="id87DF401326BE4E1586F216A8B6126629"><enum>(i)</enum><text>the conservation plan of the farm; and</text> </clause>
<clause id="id168C0FE28BB44BF1805F4646C2A9B4B9"><enum>(ii)</enum><text>such other conservation requirements as the Secretary may establish.</text> </clause></subparagraph>
<subparagraph id="id992887727C164BAC96A6445624FD8539"><enum>(B)</enum><header>Failure to certify</header><text>In any applicable year during which an operator or producer does not make a certification under subparagraph (A)—</text> 
<clause id="id9022FA664E1042BF961A47957B11E19B"><enum>(i)</enum><text>the Secretary shall not transfer to the risk management account of the operator or producer a stewardship payment; but</text> </clause>
<clause id="idE9529FD9EAC84DD29478E12F92DE8114"><enum>(ii)</enum><text>the Secretary shall not—</text> 
<subclause id="id72BA2EE938FA4F83A1BBC3267DF988A0"><enum>(I)</enum><text>reduce the amount of any other payment to the risk management account; or</text> </subclause>
<subclause id="id4FE9DEF0FC8E4F6794C737DD6173F2FB"><enum>(II)</enum><text>impose on the operator or producer any other penalty.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="id30F119BB917B4213BA67420C42A91610"><enum>(5)</enum><header>Evaluations</header> 
<subparagraph id="id9E8B573089C94342BF5E6A104A084470"><enum>(A)</enum><header>In general</header><text>To ensure compliance with an applicable conservation plan, the Secretary shall ensure that each farm that receives a stewardship payment under subsection (c)(2)(D) is independently evaluated not less that once during the term of the applicable risk management account contract.</text> </subparagraph>
<subparagraph id="id2A32C2280EE64683B52CE468159546FE"><enum>(B)</enum><header>Certification of private entities</header><text>The Secretary, in coordination with appropriate private, cooperative entities, may certify to carry out evaluations under subparagraph (A) such private entities as the Secretary determines to be appropriate to ensure compliance with conservation plans.</text> </subparagraph>
<subparagraph id="idEE5550EBE0DC401587FBE731102FE408"><enum>(C)</enum><header>Reimbursement</header><text>The Secretary may reimburse the Chief of the Natural Resources Conservation Service for the cost of any evaluation carried out by the Chief under subparagraph (A).</text> </subparagraph></paragraph></subsection></section>
<section id="ID867e9426fe5f4c68aeb170b677ee2b2b"><enum>1003.</enum><header>Treatment of risk management account accounts on transfer</header> 
<subsection id="ID4877f656eff64ec78f7691111eae3fdf"><enum>(a)</enum><header>In general</header><text>In transferring, by sale or other means, any interest in a farm subject to a risk management account, an operator or producer may elect—</text> 
<paragraph id="id8059A0DD316345AC8B055E4ECDCB1F14"><enum>(1)</enum><text>to transfer the risk management account to another farm in which the operator or producer—</text> 
<subparagraph id="id858DF60BF686420B80FCDCCA1382C630"><enum>(A)</enum><text>has a controlling ownership interest; or</text> </subparagraph>
<subparagraph id="id2BC9CDEC00984A2C9DB8F09ADFE66ABA"><enum>(B)</enum><text>not later than 2 years after the date of the transfer, will acquire a controlling ownership interest;</text> </subparagraph></paragraph>
<paragraph id="idD6E840312BD44C98B6CD4196896109DB"><enum>(2)</enum><text>to transfer the risk management account to the purchaser of the interest in the farm, if the purchaser is not already a holder of a risk management account; or</text> </paragraph>
<paragraph id="id9F3DBD5C46A04B4F9FE7F30FD759360D"><enum>(3)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="idFA341A6854F54CE8B5991B8ED3A2015B"><enum>(A)</enum><text>if the operator or producer is an individual, to rollover amounts in the risk management account account into an individual retirement account of the operator or producer pursuant to section 408 of the Internal Revenue Code of 1986; or</text> </subparagraph>
<subparagraph id="id06C9CDF9A872486494FEC8E0ACF7EA37" indent="up1"><enum>(B)</enum><text>if the operator or producer is not an individual, to transfer amounts in the risk management account into an account of any individual who has a substantial beneficial interest in the farm (including a substantial beneficiary of a trust that holds at least a 50 percent ownership interest in the farm).</text> </subparagraph></paragraph></subsection>
<subsection id="ID7258a78f0fe44d87b6bfe5666468182e"><enum>(b)</enum><header>Transfer or acquisition of land or portion of operation</header><text>The Secretary shall promulgate such regulations as the Secretary determines to be appropriate to require reformulation, reaffirmation, or abandonment of a risk management account contract—</text> 
<paragraph id="id7BEE706AE4B9416B8E799F0E81E2F163"><enum>(1)</enum><text>on transfer of all or part of a farm under this section; or</text> </paragraph>
<paragraph id="id5939A1D9F05C4E6B909AFDE63D79C1C9"><enum>(2)</enum><text>on any other major change to the farm, as determined by the Secretary.</text> </paragraph></subsection></section>
<section id="ID8fd2b795d04f4bb99ebb9cbc917923a2"><enum>1004.</enum><header>Tax treatment of risk management account accounts</header> 
<subsection id="id14E12884C7524D1595A4D818D5926635"><enum>(a)</enum><header>Transfers</header><text display-inline="yes-display-inline">No transfer by the Secretary, or by an operator or producer, of funds to a risk management account pursuant to this title shall be subject to Federal income tax.</text> </subsection>
<subsection id="id039772DFC7C94A11890DCE3A80BA0917"><enum>(b)</enum><header>Withdrawals</header><text display-inline="yes-display-inline">A withdrawal of funds from a risk management account pursuant to section 1002(c)(4) shall be treated as part of the gross income of an operator or producer for the calendar year during which the funds are withdrawn.</text> </subsection>
<subsection id="idBD06245478084A3FA2C343120E7C57E8"><enum>(c)</enum><header>Rollovers</header> 
<paragraph id="idE1083C383B4B4FF9A5E542690637B9EE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A rollover of amounts in a risk management account into an individual retirement account pursuant to section 1002(c)(4)(B) or 1003(a)(3) shall not be subject to Federal income tax.</text> </paragraph>
<paragraph id="id678AF2E527BB48E090128892D642EBEE"><enum>(2)</enum><header>Termination without rollover</header><text display-inline="yes-display-inline">If a risk management account is terminated without a rollover under section 1002(c)(4)(B) or 1003(a)(3), amounts in the risk management account shall be considered to be withdrawn under subsection (b).</text> </paragraph></subsection></section>
<section id="IDd30d37c92fd64b239f5a1d685579c16f"><enum>1005.</enum><header>Administration</header> 
<subsection id="IDb80ef018d06f4b11bca9e28cccde27c7"><enum>(a)</enum><header>Implementation</header> 
<paragraph id="idB63634567AB54775B6E39DF7D9BF36AB"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall carry out this title through the Farm Services Agency.</text> </paragraph>
<paragraph id="idBD2B5023A03144888B60C542FF20A64D"><enum>(2)</enum><header>Exception</header><text>In providing stewardship payments under section 1002(c)(2)(D), the Secretary shall act through the Natural Resources Conservation Service.</text> </paragraph></subsection>
<subsection id="ID22676ec19fd345ec9a543de7163e85fe"><enum>(b)</enum><header>Compliance</header><text>In addition to evaluations under section 1002(d)(5), the Secretary shall conduct random audits of operators and producers subject to risk management account contracts under this title as the Secretary determines to be necessary to ensure compliance with the risk management account contracts.</text> </subsection>
<subsection id="IDc1cea28101b9485586ef0b8090172338"><enum>(c)</enum><header>Violations</header><text>If the Secretary determines that an operator or producer is in violation of the terms of an applicable risk management account contract—</text> 
<paragraph id="IDad68a7e6d65c409faeb9b8b5030c2552"><enum>(1)</enum><text>the operator or producer shall refund to the Secretary an amount equal to the amount transferred by the Secretary under section 1002(c)(2) to the affected risk management account during the applicable year in which the violation occurred;</text> </paragraph>
<paragraph id="IDd17d6cbf729f44dfae524ad5aaff5425"><enum>(2)</enum><text>for a serious or deliberate violation, as determined by the Secretary—</text> 
<subparagraph id="idF3A4B383B1A24272ABDD5659D8C84A78"><enum>(A)</enum><text>the risk management account contract shall be terminated; and</text> </subparagraph>
<subparagraph id="idCDD2F408A4F549F1BCB82794DF400D0B"><enum>(B)</enum><text>amounts remaining in each applicable risk management account as the result of a transfer by the Secretary under section 1002(c)(2) shall be refunded to the Secretary; and</text> </subparagraph></paragraph>
<paragraph id="IDd8f1cd37dbde46cc9ce6b6497eaed941"><enum>(3)</enum><text>for failure to comply with the terms of an applicable conservation plan during an applicable year in which the operator or producer certified compliance with the plan, the operator or producer shall refund to the Secretary an amount equal to the amount of the stewardship payment under section 1002(c)(2)(D) for each applicable year in which a violation occurred.</text> </paragraph></subsection>
<subsection id="IDbe9d82f81bb745fe8e3a60416fb7f8fa"><enum>(d)</enum><header>Regulations</header><text>The Secretary shall promulgate such regulations as the Secretary determines to be necessary to carry out this title.</text> </subsection>
<subsection id="IDa3bf6eaac0ec4bf596231fd2c02b62da"><enum>(e)</enum><header>Adjusted gross income limitation</header><text>The adjusted gross income limitation under section 1001D of the Food Security Act of 1985 (7 U.S.C. 1308–3a) shall apply to participation in the farm income stabilization assistance program under this title.</text> </subsection>
<subsection id="ID62629e1be9054d86b020ce6e98139ae0"><enum>(f)</enum><header>Commodity Credit Corporation</header><text>The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this title.</text> </subsection></section>
<section id="idE6B70ED96DB14CCBA0DCCEAA68553C1B"><enum>1006.</enum><header>Commodity programs</header> 
<subsection id="id0950F577DD0F4E9FBDE0CA55888E05D5"><enum>(a)</enum><header>Repeals</header><text>Subtitles A through E of title I of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7901 et seq.) (other than sections 1001, 1103, 1104, 1106, 1502) are repealed.</text> </subsection>
<subsection id="idAF7123B9289842E8AC0D9D9B5D892EC2"><enum>(b)</enum><header>Planting flexibility</header><text>Section 1106 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 7916) is amended to read as follows:</text>

<section id="ID940b4562849346beb443ae802d33b9d9"><enum>4005.</enum><header>Supporting State efforts during natural disasters</header><text display-inline="no-display-inline">Section 5(h) of the Food Stamp Act of 1977 (7 U.S.C. 2014(h)) is amended by adding at the end the following:</text>

<paragraph id="IDc7ca5fa57db24af7ac75d6c78645505e"><enum>(4)</enum><header>Administrative cost share payments</header><text>In case of a disaster determined under paragraph (1), in lieu of the administrative cost share payments otherwise required by section 16(a), the Secretary shall pay each State agency an amount equal to 90 percent of the administrative costs allowable under that section for costs related to planning and operating disaster food stamp programs under this subsection.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<paragraph id="id36E3F705D5FC4CBFBE6067B06DC3FCA4"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), the Secretary may increase the administrative cost share percentage specified in subsection (a) for eligible administrative expenditures.</text> </paragraph>
<paragraph id="id55771688374441DB935380697CBB83F9"><enum>(2)</enum><header>Eligible administrative expenditures</header><text>Administrative expenditures that are eligible for an increased cost share percentage under this subsection are expenditures that—</text> 
<subparagraph id="idCBD3F09A75C340A6967A04F6C0CA127D"><enum>(A)</enum><text>are described in subsection (a); and</text> </subparagraph>
<subparagraph id="idDB2F29EEE1834D6781D5B17F2634C558"><enum>(B)</enum><text>as demonstrated by a State agency to the satisfaction of the Secretary, are attributable to a program innovation that improves—</text> 
<clause id="idC7113A1462C349C38F5AFD38448FDD48"><enum>(i)</enum><text>access to the food stamp program;</text> </clause>
<clause id="idA49A60A0D21A49FC857844703D95B006"><enum>(ii)</enum><text>the efficiency and effectiveness of program operations; and</text> </clause>
<clause id="id4E1C88CCAF6F40759E4B54BD48E4A7B9"><enum>(iii)</enum><text>program integrity.</text> </clause></subparagraph></paragraph>
<paragraph id="id2CEE7FCADBA648E69A4A355A1BA87A6C"><enum>(3)</enum><header>Limitations</header> 
<subparagraph id="id5996F5C1B5514E9F9D51B65B620E3AF8"><enum>(A)</enum><header>In general</header><text>In carrying out this subsection, the Secretary shall provide an increased administrative cost share percentage for those eligible administrative expenditures that, as determined by the Secretary—</text> 
<clause id="id6CAE0D61ABE54A98864DE3351E218B98"><enum>(i)</enum><text>have the greatest likelihood of meeting the goals described in paragraph (2)(B); and</text> </clause>
<clause id="id814C13BBBD914E4DA64647EB21F55042"><enum>(ii)</enum><text>will result in new activities or operations.</text> </clause></subparagraph>

<paragraph id="ID62bd9d6c70364881923f2d24f7b2c0fb"><enum>(1)</enum><header>In general</header><text>For fiscal year 2008, the Secretary shall use not more than $5,000,000 of funds made available under section 18(a)(1) to make grants to pay 100 percent of the costs of eligible entities approved by the Secretary to carry out projects to expand the number of farmer’ markets that accept food stamp benefits by—</text> 
<subparagraph id="ID83b9b77e4d1c41bdb7f9f5df146a5326"><enum>(A)</enum><text>providing equipment and training necessary for the farmers' markets to accept food stamp benefits;</text> </subparagraph>
<subparagraph id="ID56c3c064ecb64b54b56b5c0e4c4611d4"><enum>(B)</enum><text>educating and providing technical assistance to agricultural producers and farmers’ market operators about the process and benefits of accepting food stamp benefits; or</text> </subparagraph>
<subparagraph id="IDd3a2d6c10a4c43ab9006cf0e2f42ea76"><enum>(C)</enum><text>other activities determined to be appropriate by the Secretary.</text> </subparagraph></paragraph>
<paragraph id="IDd9cfe24d6f364252ba4068c51aa4d6b7"><enum>(2)</enum><header>Limitation</header><text>A grant made under this subsection may not be used to pay the ongoing cost of carrying out any project.</text> </paragraph>
<paragraph id="IDf70219c5a6af4abdb30ef34852f95a59"><enum>(3)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this subsection, an entity shall be—</text> 
<subparagraph id="IDa47cffad1ca547c6a51235cb0dd69841"><enum>(A)</enum><text>a State agency administering the food stamp program;</text> </subparagraph>
<subparagraph id="ID09070e090b5745f3a6a1520bc005a5bf"><enum>(B)</enum><text>a State or local government; or</text> </subparagraph>
<subparagraph id="ID4cf00b7c5fa448c5a15c84d5aa9c2dfe"><enum>(C)</enum><text>a private nonprofit entity that—</text> 
<clause id="idAFF67C928ABE4092858D2852F67640A5"><enum>(i)</enum><text>coordinates farmers' markets in a State; and</text> </clause>
<clause id="idBBA9C97F7E524A57973B338EC6F3558C"><enum>(ii)</enum><text>operates in cooperation with State or local government.</text> </clause></subparagraph></paragraph>
<paragraph id="ID230b7b9886dd4db0a7872da61248866d"><enum>(4)</enum><header>Selection of eligible entities</header><text>The Secretary—</text> 
<subparagraph id="ID15d0deb2d66d4b4d98df2de19b382342"><enum>(A)</enum><text>shall develop criteria for the selection of eligible entities to receive grants under this subsection; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID2393cf0067894ec9b2c324d5c5006a3a"><enum>(B)</enum><text>may give preference to any eligible entity that consists of a partnership between a government entity and a nongovernmental entity.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="ID837818c6e2f645adac3ced95c5e7ae93"><enum>4012.</enum><header>Commodities for the emergency food assistance program</header><text display-inline="no-display-inline">Section 27(a) of the Food Stamp Act of 1977 (7 U.S.C. 2036(a)) is amended—</text> 
<paragraph id="ID09c167cd3ce74a6186fea2b4cff978b9"><enum>(1)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Purchase of commodities</header-in-text>.—</quote> and all that follows through <quote>through 2007</quote> and inserting the following:</text>

<section id="ID8100aa46aa5e41bb91b6ff8992cb21dd"><enum>4013.</enum><header>Community food assistance and food bank infrastructure competitive grants</header><text display-inline="no-display-inline">The Food Stamp Act of 1977 is amended by adding after section 27 (7 U.S.C. 2036) the following:</text> 
<quoted-block display-inline="no-display-inline" id="id696A0FFBBB7A44829A364E593B596262" style="OLC"> 
<section id="idCDA1F18A14C443A7B533850CFFC4769C"><enum>28.</enum><header>Community food assistance and food bank infrastructure competitive grants</header> 
<subsection id="IDe059d8f3644a4e8a9d536b002b1af94f"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means an emergency feeding organization (as defined in section 201A of the Emergency Food Assistance Act of 1983 (7 U.S.C. 7501)).</text> </subsection>
<subsection id="ID600d6e3f579a40aab2b6081a2a6f5997"><enum>(b)</enum><header>Application</header> 
<paragraph id="ID4bff7361661842c080a69b2bfe7aeca5"><enum>(1)</enum><header>In general</header><text>To receive a grant under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text> </paragraph>
<paragraph id="ID442e4c03a4f64734a1cda12477b55ecd"><enum>(2)</enum><header>Contents</header><text>Each application submitted under paragraph (1) shall—</text> 
<subparagraph id="ID691ac38ff1dc4845b98db621e6c88024"><enum>(A)</enum><text>identify the activity described in subsection (c) that the grant will be used to fund; and</text> </subparagraph>
<subparagraph id="ID91f8d2144ea741868aef89521a406cbf"><enum>(B)</enum><text>describe the means by which an activity identified under subparagraph (A) will reduce hunger in the community or support the efforts of food banks or other nonprofit emergency feeding organizations to reduce hunger or food insecurity in the communities served by the emergency feeding organizations.</text> </subparagraph></paragraph>
<paragraph id="ID613e45a4914c42139b2619747289fc3c"><enum>(3)</enum><header>Priority</header><text>In making grants under this section, the Secretary shall give priority to eligible entities the applications of which demonstrate at least 2 of the following criteria, as determined by the Secretary:</text> 
<subparagraph id="ID3adf762b669144ccb3d4e9ec1e693a71"><enum>(A)</enum><text>The eligible entity serves a predominantly rural and geographically underserved area.</text> </subparagraph>
<subparagraph id="IDcf18ef6a42624d0dad75d3945c521252"><enum>(B)</enum><text>The eligible entity serves a community in which the rates of food insecurity, very low food insecurity, hunger, poverty, or unemployment are demonstrably higher than national average rates.</text> </subparagraph>
<subparagraph id="ID2c336c8883904e14b058103338d5c2fa"><enum>(C)</enum><text>The eligible entity serves a community that provides demonstrable public support for the efforts of the eligible entity through the direct provision of private sector food assistance to low-income individuals.</text> </subparagraph>
<subparagraph id="IDba95bd7a26144542a4d31f5d6e37a1af"><enum>(D)</enum><text>The grant will assist in the support of rural communities, small or mid-size agricultural operations, and the consumption of locally-produced agricultural products by low-income people in need of temporary food assistance.</text> </subparagraph></paragraph></subsection>
<subsection id="IDfbc3b672359a40f29202c5abe2861693"><enum>(c)</enum><header>Use of funds</header><text>An eligible entity shall use a grant received under this section to carry out activities of the eligible entity, including—</text> 
<paragraph id="IDe7588fbbffab4d5cb64b415736a051f8"><enum>(1)</enum><text>constructing, expanding, or repairing a facility or equipment to support hunger relief agencies in the community;</text> </paragraph>
<paragraph id="IDcb7bb6ad1e1b4fd39d7a6feb99f37e3a"><enum>(2)</enum><text>assisting an emergency feeding organization in the community in obtaining locally-grown or raised produce, dairy, or protein products; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDd3b87387ce3f4e59889b4454706d89bf"><enum>(3)</enum><text>assisting an emergency feeding organization in the community for the procurement, storage, handling, and distribution of locally-produced agricultural commodities and products.</text> </paragraph></subsection>
<subsection id="ID84c697362704458bb34590cd4a08976b"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2008 through 2014.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section></subtitle>

<section id="idD88D5D0172E24A05B87B75822E26E4F0"><enum>4203.</enum><header>Food for the hungry transportation grant program</header> 
<subsection id="HACADED0FCE9A48C295A9C291D623A54E"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text> 
<paragraph id="H8A05C89006A544EEA9B9507CAB309B95"><enum>(1)</enum><text>to authorize the creation of the National Food for the Hungry Transportation, Self-Help, and Job Training Fund to facilitate the procurement and transportation of highly-perishable, healthy food to low-income individuals in the United States;</text> </paragraph>
<paragraph id="H2C07A71BFC73419AB95043B8A0E6E373"><enum>(2)</enum><text>to establish a competitive mechanism in the Department of Agriculture by which appropriations made available from the Fund would be allocated;</text> </paragraph>
<paragraph id="H83EE0107E67F4CBCA65C8C55CBB8E633"><enum>(3)</enum><text>to ensure the direct involvement of the private carrier trucking fleet of the United States in carrying out this section;</text> </paragraph>
<paragraph id="H6245EC3ECC544087B14F671254CC42A3"><enum>(4)</enum><text>to increase the quantity of nutritious food available to low-income individuals in the United States by supporting the procurement and distribution of highly-perishable food, such as fresh produce and protein products, to the low-income individuals;</text> </paragraph>
<paragraph id="H5CC249578FFF444984EEE54014FF95ED"><enum>(5)</enum><text>to offer job training and employment opportunities in the food transportation and distribution systems;</text> </paragraph>
<paragraph id="H969EEEE0FF0C477F8B630064B5BD4EDA"><enum>(6)</enum><text>to better identify potential providers of donated foods and enhance the nonprofit food donation system; and</text> </paragraph>
<paragraph id="HC2EDE27796F143BEB1FBE7128FF5E8A9"><enum>(7)</enum><text>to provide adequate funding to carry out this section.</text> </paragraph></subsection>
<subsection id="H54D2B146AF474024AB59972B625E3969"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HD93BC82104AC46989EC36378CA279B04"><enum>(1)</enum><header>Fund</header><text>The term <term>Fund</term> means the National Food for the Hungry Transportation, Self-Help, and Job Training Fund established under subsection (c).</text> </paragraph>
<paragraph id="H7DF473EA37D2444ABA8029E4C3C581A5"><enum>(2)</enum><header>Nongovernmental organization</header><text>The term <term>nongovernmental organization</term> means a national nonprofit charitable organization that—</text> 
<subparagraph id="HD2D104362D024B77B58C0000CB73BDBD"><enum>(A)</enum><text>is described in section 501(c)(3) of the Internal Revenue Code of 1986;</text> </subparagraph>
<subparagraph id="H8C7D3287C6844815BA771FA520FF8338"><enum>(B)</enum><text>is capable of, and has at least 10 years experience in, procuring donated food and other services from major domestic food manufacturers and processors, grocery wholesalers and retailers, food warehouse operations, agricultural producer organizations, fishing interests commercial transport providers (such as trucking companies), and Federal and State food assistance agencies;</text> </subparagraph>
<subparagraph id="H4272EDFE7D114384B3DFD222C9D0E81B"><enum>(C)</enum><text>is capable of, and has shown proficiency in, the national distribution of highly-perishable food through contracts with member emergency feeding organizations (as defined in section 201A of the Emergency Food Assistance Act of 1983 (7 U.S.C. 7501));</text> </subparagraph>
<subparagraph id="H2FDED05473B54FDB0073839DC1A9524E"><enum>(D)</enum><text>has at least 10 years experience in procuring commercial freight for the distribution of time-sensitive food products through a network of emergency food assistance organizations;</text> </subparagraph>
<subparagraph id="HE03E0F62E3FF4EA285ECA159A339006E"><enum>(E)</enum><text>has at least 10 years experience in working with transport providers in creating, coordinating, and maintaining transfer systems designed to assist, at the national level, the delivery of time-sensitive food products, for distribution to emergency food assistance organizations in all 50 States and the District of Columbia;</text> </subparagraph>
<subparagraph id="HF6221B218F92408DBA510607A4A75BE8"><enum>(F)</enum><text>does not operate any commercial, private, or public subsidiary trucking or freight operations for the purposes of transporting food; and</text> </subparagraph>
<subparagraph id="HA03DAD238CF741E18BAC649EFBACFAB"><enum>(G)</enum><text>agrees—</text> 
<clause id="H286BE7B2DDD442ED91B91ACF6993C4C"><enum>(i)</enum><text>to contribute in-kind resources to assist in carrying out this section;</text> </clause>
<clause id="H6E7B601206FD4EF587F2D62CA7C42EC3"><enum>(ii)</enum><text>to provide to eligible emergency food assistance organizations services and information free of charge; and</text> </clause>
<clause id="H7CB327F3806B4F04B91B2F14ACBF8734"><enum>(iii)</enum><text>to regularly certify and inspect any member emergency feeding organization with which the nongovernmental organization entered into a contract to carry out an activity described in subparagraph (B).</text> </clause></subparagraph></paragraph>
<paragraph id="HC0A0EDB897CC4764A29064D3F400EDEA"><enum>(3)</enum><header>Primary nongovernmental organization</header><text>The term <term>primary nongovernmental organization</term> means a nongovernmental organization selected by the Secretary on a competitive basis from among nongovernmental organizations.</text> </paragraph>
<paragraph id="H2006FFD0CDC1452B8686A040891B26C0"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text> </paragraph>
<paragraph id="H3900E41E0F0C49EBA3D6C3D00713481B"><enum>(5)</enum><header>Time-sensitive food product</header> 
<subparagraph id="H953EAF5B19B145E1A9BAD18942472D15"><enum>(A)</enum><header>In general</header><text>The term <term>time-sensitive food product</term> means a fresh, raw, or processed food with a short time limitation for safe and acceptable consumption, as determined by the Secretary.</text> </subparagraph>
<subparagraph id="H5A65C732709545F38D9360E71137E500"><enum>(B)</enum><header>Inclusions</header><text>The term <term>time-sensitive food product</term> includes fruits, vegetables, dairy products, meat, fish, and poultry.</text> </subparagraph></paragraph></subsection>
<subsection id="H133D502AA04C4B57BDA3B3F77E08AD85"><enum>(c)</enum><header>National Food for the Hungry Transportation Fund</header><text>The Secretary shall offer to enter into a contract or grant agreement with a primary nongovernmental organization to establish a fund, to be known as the <quote>National Food for the Hungry Transportation Fund</quote>, to track, collect, and deliver time-sensitive food products.</text> </subsection>
<subsection id="HFEEC4B9D67F44DBABC53F21F451A77E"><enum>(d)</enum><header>Program requirements</header><text>The Secretary shall ensure that funds made available to carry out this section are used for—</text> 
<paragraph id="HCDF04F41F79C48D28369ED08376740F8"><enum>(1)</enum><text>the development and maintenance of a computerized system for the tracking of time-sensitive food products;</text> </paragraph>
<paragraph id="H109B38EB39AA445A938D82799E4646C9"><enum>(2)</enum><text>capital and operating costs associated with the collection and transportation of time-sensitive food products;</text> </paragraph>
<paragraph id="HD6ED829FC07C422F915FC66F9C4D515"><enum>(3)</enum><text>capital and operating costs associated with the storage and distribution of time-sensitive food products;</text> </paragraph>
<paragraph id="H71A9E17E65604976AE00F23854614390"><enum>(4)</enum><text>job training opportunities in trucking, food handling, food recovery, and related industries;</text> </paragraph>
<paragraph id="HF2EEF94B1BF54D27A35970CCDFC3DB50"><enum>(5)</enum><text>improving the security and diversity of the food distribution and recovery systems of the United States with the use of—</text> 
<subparagraph id="H9E6E656795A64370883FA947138453CF"><enum>(A)</enum><text>family-sized farms; and</text> </subparagraph>
<subparagraph id="HA56E822987704F0C88422BFDCBC81D34"><enum>(B)</enum><text>donations from entities of food products to persons in need;</text> </subparagraph></paragraph>
<paragraph id="HBD9CB57586AC4002B38000629DA34800"><enum>(6)</enum><text>providing recovered healthy foods to nonprofit emergency food providers to reduce hunger in the United States; and</text> </paragraph>
<paragraph id="H299A6B1B08EC46799CACE43A2CDAABB"><enum>(7)</enum><text>improving the identification of—</text> 
<subparagraph id="HB90758ED6F774E08945714F4D658C607"><enum>(A)</enum><text>potential providers of donated foods;</text> </subparagraph>
<subparagraph id="HE0B5DC8F98794600AFDB60591DD2CF3D"><enum>(B)</enum><text>potential nonprofit emergency food providers; and</text> </subparagraph>
<subparagraph id="H85CC84F6A11E478BBA608F069B76F77D"><enum>(C)</enum><text>persons in need of emergency food assistance throughout the United States.</text> </subparagraph></paragraph></subsection>
<subsection id="H90C93D8E531246038EEFEA5B6CFBEE4F"><enum>(e)</enum><header>Additional nongovernmental organizations</header> 
<paragraph id="H0D49EA3F6A90435887FCD8C00909C79"><enum>(1)</enum><header>In general</header><text>A primary nongovernmental organization may enter into 1 or more contracts with, and provide funds to, not more than 2 other nongovernmental organizations that the Secretary determines meet the requirements of paragraph (2) to carry out the activities required under this section.</text> </paragraph>
<paragraph id="H06F8AA104CBC46E3B358002363AF5A4"><enum>(2)</enum><header>Requirements</header><text>An additional nongovernmental organization selected under paragraph (1) shall—</text> 
<subparagraph id="HA12BB7F2C3574C0AB200006FABA62386"><enum>(A)</enum><text>have expertise in operating for several years a national information clearinghouse relating to anti-hunger activities;</text> </subparagraph>
<subparagraph id="H47A28F8DBE314DE2814743B7EFF3DD93"><enum>(B)</enum><text>have extensive experience in working with other anti-hunger organizations throughout the United States;</text> </subparagraph>
<subparagraph id="HCCF357C185F047F200B722E04C7D97CC"><enum>(C)</enum><text>have significant experience in working with the Department of Agriculture; and</text> </subparagraph>
<subparagraph id="H851831CC0A354D9A80C2CFF773B64F99"><enum>(D)</enum><text>operate, at a national level, a hotline to provide information about—</text> 
<clause id="H26C53103DE024ED1A576C05EDF6397D1"><enum>(i)</enum><text>access to food for low-income families;</text> </clause>
<clause id="HBEEE42EFF69B49F3B4AADCFF5DEB9700"><enum>(ii)</enum><text>programs in existence on the date of enactment of this Act that transport fresh produce to food pantries, homeless shelters, and soup kitchens that could serve as national models for replication in other areas; and</text> </clause>
<clause id="H3F17B33D18A149A79106AD4FE6EF5D96"><enum>(iii)</enum><text>means through which low-income individuals and families may become self-reliant.</text> </clause></subparagraph></paragraph></subsection>
<subsection id="HE1EA994A74B0467BB4021D23A153DF77"><enum>(f)</enum><header>Audits</header><text>The Secretary shall establish fair and reasonable procedures to audit the expenditure of funds made available to carry out this section.</text> </subsection>
<subsection id="id668F7F3B15B24E38BBBB561B1266141B"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> 
<paragraph id="idAF4CB2E162B345D68CD2B2C7D320B2A7"><enum>(1)</enum><text>$5,000,000 for fiscal year 2008; and</text> </paragraph>
<paragraph id="id8E022507FD9247CD8849E42B00242815"><enum>(2)</enum><text>for each subsequent fiscal year, the applicable amount during the preceding fiscal year, as adjusted to reflect changes for the 12-month period ending the preceding November 30 in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text> </paragraph></subsection></section></subtitle></title>

<subparagraph id="ID6bebffd55d7140a998468b9e35113186"><enum>(C)</enum><text>the percentage of farmers, ranchers, and rural small businesses to be assisted by the program in the service territory covered by the eligible entity;</text> </subparagraph>
<subparagraph id="ID93caac0f170c4db9b730133c51cd2cc0"><enum>(D)</enum><text>the potential for energy savings and environmental and public health benefits resulting from the program;</text> </subparagraph>
<subparagraph id="ID86c84834a55a404783d074ceab24ab00"><enum>(E)</enum><text>the plan of the eligible entity for providing information to farmers, ranchers, and rural small businesses on the benefits of energy efficiency and renewable energy development;</text> </subparagraph>
<subparagraph id="ID8e7b4420e5b24f589b4f9f9442992a2b"><enum>(F)</enum><text>demonstration of multi-stakeholder collaborations;</text> </subparagraph>
<subparagraph id="IDad0b2e22064240d19bbd8c8a28535dbc"><enum>(G)</enum><text>demonstration of matching funds; and</text> </subparagraph>
<subparagraph id="IDcd9115acf22e47c783b667cb53a01e95"><enum>(H)</enum><text>clear performance metrics.</text> </subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block> </paragraph>

<clause id="IDfb64f44f5d5a429387fe68a07d08f933"><enum>(ii)</enum><text>assessments of fertilizer, pesticide, or diesel use efficiency;</text> </clause>
<clause id="ID355fdc5b7f7f464282803ee03fedcc03"><enum>(iii)</enum><text>renewable energy assessments; or</text> </clause>
<clause id="ID2006009edfd84fa692ed1d822e828c27"><enum>(iv)</enum><text>environmental management system planning;</text> </clause></subparagraph></paragraph>
<paragraph id="ID05a81e11b51b4ad59e609ced72f0dd39"><enum>(2)</enum><text>to make farmers, ranchers, and rural small businesses aware of and able to apply for and ensure access to—</text> 
<subparagraph id="IDdbd01eab00fc41499fb90a793e1ace36"><enum>(A)</enum><text>financial assistance under section 9006; and</text> </subparagraph>
<subparagraph id="ID5478711132d2425cb5fc76ce9ec887e1"><enum>(B)</enum><text>other Federal, State, and local financial assistance programs for which farmers, ranchers, and rural small businesses may be eligible; or</text> </subparagraph></paragraph>
<paragraph id="ID5d9d3ef86d9b4ce3b8e4a5cdc522c36c"><enum>(3)</enum><text>to employ staff that—</text> 
<subparagraph id="id3CB56233B6744F49837D7258E50BACF5"><enum>(A)</enum><text>serve as central points of contact for farmers, ranchers and rural businesses seeking to evaluate energy practices and technologies; and</text> </subparagraph>
<subparagraph id="idDD2A1E0664C6406682DA81961F3B5AF0"><enum>(B)</enum><text>are properly trained to collect data for audits and renewable energy assessments.</text> </subparagraph></paragraph>
<paragraph id="ID34987356af3e46699ceb010feea98c2c"><enum>(4)</enum><header>Permitted uses</header><text>A recipient of a grant may use funds to finance—</text> 
<subparagraph id="IDa5a9ee31897c4b25924f6b7943d11581"><enum>(A)</enum><text>in partnership with the private sector, agricultural demonstrations to demonstrate cost-effective high efficiency equipment and energy management practices such as precision agriculture, proper tire tractor inflation, and conservation tillage; and</text> </subparagraph>
<subparagraph id="ID6148e17dc8754e0cb2783b228940a758"><enum>(B)</enum><text>educational workshops on different clean energy technologies and techniques.</text> </subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="idDD750512A05244B8941A7D19660F32C0"><enum>(6)</enum><text>in subsection (e)—</text> 
<subparagraph id="idC19E15396D4B4649AC2E782785558FC4"><enum>(A)</enum><text>by striking <quote>an energy audit</quote> and inserting <quote>energy technical assistance</quote>;</text> </subparagraph>

<subsection id="IDaebcb0a943f74561a8a6bd916b1e69b0"><enum>(e)</enum><header>Production-based incentive in lieu of grant</header> 
<paragraph id="ID04510e25df9f4469a64d378d33ed235c"><enum>(1)</enum><header>In general</header><text>In addition to the authority under subsection (a), to encourage the production of electricity from renewable energy systems, the Secretary shall, on the request of an eligible applicant under this section, make production-based payments to the applicant in lieu of a grant.</text> </paragraph>
<paragraph id="IDfb932ddee9f94f7e886e91164e85b66d"><enum>(2)</enum><header>Contingency</header><text>Payments under paragraph (1) shall be contingent on documented energy production and sales from the renewable energy system to a third party.</text> </paragraph>
<paragraph id="ID9ec1f2682d1a414d8955a48776ac0e66"><enum>(3)</enum><header>Limitation</header><text>The total net present value of a production-based incentive may not exceed the lower of—</text> 
<subparagraph id="ID79a8bcc0aa4145a8a609635392cd56d3"><enum>(A)</enum><text>25 percent of the eligible project costs; and</text> </subparagraph>
<subparagraph id="ID41078ed4562d4f6daf804561d7410a6e"><enum>(B)</enum><text>any other limits that the Secretary establishes by rule or guidance.</text> </subparagraph></paragraph></subsection>
<subsection id="IDc20c3377914d4a0f9b74f1f9a432bcc0"><enum>(f)</enum><header>Feasibility studies</header> 
<paragraph id="ID77d3c97697b04da9a800922c76398203"><enum>(1)</enum><header>In general</header><text>The Secretary may provide assistance to eligible applicants to conduct feasibility studies of projects for which assistance may be provided under this section.</text> </paragraph>
<paragraph id="IDe19fbfa0cb04491ba3ab2d0e47182403"><enum>(2)</enum><header>Limitation</header><text>The Secretary shall use not more than 10 percent of funds made available to carry out this section to provide assistance described in paragraph (1).</text> </paragraph>
<paragraph id="ID9a312bd4006548f5a0f5ed5d09383330"><enum>(3)</enum><header>Criteria</header><text>The Secretary shall, by regulation, establish criteria for the receipt of assistance under this subsection.</text> </paragraph>
<paragraph id="IDff406ed4d003499ca7d57488fac9a266"><enum>(4)</enum><header>Avoidance of duplicative assistance</header><text>An applicant that receives assistance to carry out a feasibility study for a project under this subsection shall not be eligible for assistance to carry out a feasibility study for the project under any other provision of Federal law.</text> </paragraph>
<paragraph id="IDe25f267f61cb443eab5309cbe5f5c4f2"><enum>(5)</enum><header>Matching funds</header><text>To be eligible for assistance under this subsection, a recipient of funds under this subsection shall contribute an amount of non-Federal funds that is equal to at least 75 percent of the amount of Federal funds received.</text> </paragraph></subsection>
<subsection id="IDaa8d55a23ce34683ba771fe4b636c393"><enum>(g)</enum><header>Rebate program</header> 
<paragraph id="IDa20dd770b2bd43a884bbad69ee1dba4c"><enum>(1)</enum><header>In general</header><text>The Secretary shall make competitive grants to eligible entities to provide rebates for farmers, ranchers, rural school districts, and rural small businesses to purchase renewable energy systems and make energy efficiency improvements.</text> </paragraph>
<paragraph id="ID5b349d1dd40043b0a029436463485f07"><enum>(2)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under paragraph (1), an entity shall be—</text> 
<subparagraph id="IDdff5e171834f41deb7aef9941a13c4eb"><enum>(A)</enum><text>a State energy or agricultural office;</text> </subparagraph>
<subparagraph id="ID5b777937bf324ed4a0d63c21ebdae508"><enum>(B)</enum><text>a nonprofit State-based energy efficiency or renewable energy organization that uses public funds provided directly or under contract with a State agency;</text> </subparagraph>
<subparagraph id="IDe8fce02962e64bbd9f846b2b375bb93a"><enum>(C)</enum><text>any other nonprofit organization with a demonstrated ability to administer a State-wide energy efficiency or renewable energy rebate program; or</text> </subparagraph>
<subparagraph id="ID11e67669215c483b81b9d79c872bc2a4"><enum>(D)</enum><text>a consortium of entities described in subparagraphs (A) through (C).</text> </subparagraph></paragraph>
<paragraph id="ID9d650a8e3f5e4db0ad036791ba26c3c0"><enum>(3)</enum><header>Merit review</header> 
<subparagraph id="IDbcba36b352eb47dab64b3346d5b35379"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a merit review process to review applications for grants under paragraph (1) that uses the expertise of the Department of Agriculture, other Federal and State agencies, and non-governmental organizations.</text> </subparagraph>
<subparagraph id="IDbaf3fedc55ba4c9d89b38e22f7e87fb7"><enum>(B)</enum><header>Requirements</header><text>In reviewing the application of an eligible entity to receive a grant under paragraph (1), the Secretary shall consider—</text> 
<clause id="ID517002b66166463d819ef8a30a7b0699"><enum>(i)</enum><text>the experience and expertise of the entity in establishing and administering a State-wide clean energy rebate program;</text> </clause>
<clause id="ID69d398e6dde14cd5b91371f168dc98db"><enum>(ii)</enum><text>the annual projected energy savings or production increases resulting from the proposed program;</text> </clause>
<clause id="ID3ddc0d18d53a455d95dc9986cd57efaf"><enum>(iii)</enum><text>the environmental benefits resulting from the proposed program; and</text> </clause>
<clause id="IDfa0890f99b054a2ebea69d5183062b4e"><enum>(iv)</enum><text>other appropriate factors, as determined by the Secretary.</text> </clause></subparagraph></paragraph>
<paragraph id="IDa8abe348397a4841b1bbd50a6dcfcd72"><enum>(4)</enum><header>Maintenance of effort</header><text>An entity that receives a grant under paragraph (1) shall provide assurances to the Secretary that funds provided to the entity under this subsection will be used to supplement, not to supplant, the amount of Federal, State, and local funds otherwise expended for rebate programs.</text> </paragraph>
<paragraph id="ID646f421e78024521998452e801ffc908"><enum>(5)</enum><header>Rebate amount</header><text>The amount of a rebate provided from a grant under this subsection shall not exceed the lower of—</text> 
<subparagraph id="IDa22bb9de8d9b482aa6e21b425955ba89"><enum>(A)</enum><text>$10,000; or</text> </subparagraph>
<subparagraph id="IDa1f3cd85719f464da1ddbdc2b8c142df"><enum>(B)</enum><text>50 percent of the cost incurred to purchase a renewable energy system or an energy efficiency improvement, as determined by the Secretary.</text> </subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="IDbc075a0252924914b8dcc7950fd08f2f"><enum>(6)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id5876A16FFD2C401FB2E9FA3B7D1DD7BA" style="OLC"> 
<subsection id="ID733e69cb482a4296ae8c75d86de13d9d"><enum>(i)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall make available to carry out this section, to remain available until expended—</text> 
<paragraph id="ID21676ff94211491a9227f7d1eea738e8"><enum>(1)</enum><text>$60,000,000 for fiscal year 2008, of which not more than $12,000,000 shall be used to carry out subsection (g);</text> </paragraph>
<paragraph id="ID4194630af79f4f0c8703f3c63f0f5305"><enum>(2)</enum><text>$90,000,000 for fiscal year 2009, of which not more than $18,000,000 shall be used to carry out subsection (g);</text> </paragraph>
<paragraph id="ID5ba01f258e194273b7d5bbed45831120"><enum>(3)</enum><text>$130,000,000 for fiscal year 2010, of which not more than $26,000,000 shall be used to carry out subsection (g);</text> </paragraph>
<paragraph id="ID8dc0e98040dd487ea945d3baf308e9b1"><enum>(4)</enum><text>$180,000,000 for fiscal year 2011, of which not more than $36,000,000 shall be used to carry out subsection (g); and</text> </paragraph>
<paragraph id="ID8e4d313c56354ed6bd7c34fcb2d7193f"><enum>(5)</enum><text>$200,000,000 for each of fiscal years 2012 through 2014, of which not more than $50,000,000 shall be used to carry out subsection (g).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="ID92B7411875AD4FB097594A06125912EC"><enum>6005.</enum><header>Biomass research and development</header> 
<subsection commented="no" id="id6B2A7534AB144FEFB68E59EA14AD60D5"><enum>(a)</enum><header>Distribution of funding By and within each technical area</header><text display-inline="yes-display-inline">Section 307(g) of the Biomass Research and Development Act of 2000 (7 U.S.C. 8606(g)) is amended in paragraphs (2) and (3) by striking <quote>2010</quote> each place it appears and inserting <quote>2014</quote>.</text> </subsection>

<section id="id3E851AC5054A441F99CBD2539F760FED"><enum>7001.</enum><header>Adjusted gross revenue insurance pilot program</header><text display-inline="no-display-inline">Section 523(e) of the Federal Crop Insurance Act (7 U.S.C. 1523(e)) is amended—</text> 
<paragraph id="idF031E4BE4B7E43C8BB18891D19E4AA67"><enum>(1)</enum><text>in paragraph (1), by striking <quote>2004 reinsurance year</quote> and inserting <quote>2010 reinsurance year</quote>; and</text> </paragraph>
<paragraph id="idD9730A61E7DD4F489473E7504491F316"><enum>(2)</enum><text>in paragraph (2), by striking subparagraph (A) and inserting the following:</text>

<section id="IDb689b26b3af747faa4ce2cdd3c6e8227"><enum>7002.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes recommendations for legislative or regulatory changes that would save at least $1,000,000,000 per fiscal year in Federal expenditures in carrying out the Federal crop insurance program while—</text> 
<paragraph id="id1ED1BDBDF787438D8B3020A63FDAB8C1"><enum>(1)</enum><text display-inline="yes-display-inline">not reducing overall risk management options to agricultural producers;</text> </paragraph>
<paragraph id="id4D3C0D48F0814AB69585A7FE24055D84"><enum>(2)</enum><text display-inline="yes-display-inline">expanding whole farm revenue-based insurance programs to all agricultural operations in all States; and</text> </paragraph>
<paragraph id="id581893B0658340E49F9D3A5B66C9C008"><enum>(3)</enum><text display-inline="yes-display-inline">maintaining actuarial soundness.</text> </paragraph></section></subtitle>
<subtitle id="IDB7CA77B71C54407D942A6C08ADC13887"><enum>B</enum><header>Specialty Crops</header> 
<section id="ID183E9506A2304FF28A857314347BB7E9"><enum>7101.</enum><header>Farmers’ market promotion program</header><text display-inline="no-display-inline">Section 6 of the Farmer-to-Consumer Direct Marketing Act of 1976 (7 U.S.C. 3005) is amended by striking subsections (d) and (e) and inserting the following:</text>

<subsection id="idE8B66FB984954BA2A9EB14A3443B1E3F"><enum>(e)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $25,000,000 for each of fiscal years 2008 through 2014, to remain available until expended.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="id656D8BFC61F1432BBC286596291B031D"><enum>7102.</enum><header>Fruit and vegetable nutrition promotion program</header><text display-inline="no-display-inline">The Specialty Crops Competitiveness Act of 2004 (7 U.S.C. 1621 note; Public Law 108–465) is amended by adding at the end of title II the following:</text>

<section commented="no" id="IDb365bd202aa8429c9269fe3f2efb791e"><enum>204.</enum><header>Fruit and vegetable nutrition promotion program</header> 
<subsection commented="no" id="ID09474bef5b0540e19190627e1f533ec7"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture (acting through the Administrator of the Agricultural Marketing Service) (referred to in this section as the <quote>Secretary</quote>) shall establish and carry out a program to provide assistance to eligible trade organizations described in subsection (c) to increase the consumption of fruits and vegetables in the United States to meet Federal health guidelines.</text> </subsection>
<subsection commented="no" id="IDab24e14636cf48e0a12b6ad071804c55"><enum>(b)</enum><header>Requirements for participation</header><text>To be eligible for assistance under this section, an organization shall—</text> 
<paragraph commented="no" id="ID36e71d43d4e3453599ce8fcb9b2ca43a"><enum>(1)</enum><text>be an eligible trade organization;</text> </paragraph>
<paragraph commented="no" id="ID554f05e7edc645749d4253aca9202531"><enum>(2)</enum><text>prepare and submit a plan to increase the consumption of fruits and vegetables in the United States to the Secretary that meets any guidelines governing such plans established by the Secretary; and</text> </paragraph>
<paragraph commented="no" id="IDb4a98b11030745c0b81cccf221b647d4"><enum>(3)</enum><text>meet any other requirements established by the Secretary.</text> </paragraph></subsection>
<subsection commented="no" id="IDc19eb983d7984a5eb007c7fb6d70b83f"><enum>(c)</enum><header>Eligible trade organizations</header><text>An eligible trade organization under this section shall be—</text> 
<paragraph commented="no" id="IDee7571863bb0498887e810fdc9995224"><enum>(1)</enum><text>a nonprofit fruit or vegetable trade organization in the United States;</text> </paragraph>
<paragraph commented="no" id="ID25460a76ef4f4679a4978c4c29d80771"><enum>(2)</enum><text>a nonprofit State or regional fruit or vegetable organization;</text> </paragraph>
<paragraph commented="no" id="IDdd72b8cda2fd444ea5f85282c7f38d3a"><enum>(3)</enum><text>a fruit or vegetable agricultural cooperative in the United States;</text> </paragraph>
<paragraph commented="no" id="ID18d9962a4db34236b8e1b0f3d00c887e"><enum>(4)</enum><text>a commodity board or commission in the United States; or</text> </paragraph>
<paragraph commented="no" id="IDff10e417ba424fafae8fff83413fcc16"><enum>(5)</enum><text>a small business engaged in the fruit or vegetable industry in the United States.</text> </paragraph></subsection>
<subsection commented="no" id="IDb1818ef85b2e43aeae7474b8e0acbc6a"><enum>(d)</enum><header>Matching funds</header><text>Assistance provided under this section shall not exceed—</text> 
<paragraph commented="no" id="IDd703a4a36c294b9fbcf81fe7118af41c"><enum>(1)</enum><text>in the case of an organization described in paragraphs (1) through (4) of subsection (c), 90 percent of the cost of carrying out a plan to increase the consumption of fruits and vegetables in the United States submitted under subsection (b)(2); and</text> </paragraph>
<paragraph commented="no" id="ID6af617edae87458283ede9fadc2b6826"><enum>(2)</enum><text>in the case of an organization described in subsection (c)(5), 50 percent of the cost of carrying out a plan to increase the consumption of fruits and vegetables in the United States submitted under subsection (b)(2).</text> </paragraph></subsection>
