		<official-title>To amend the Farm Security and Rural Investment Act of
		  2002 to provide incentives for the production of bioenergy

		<section id="id30143CD885BA46FEBA22B65D99215266" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Farm-to-Fuel Investment Act of
			 2007</short-title></quote>.</text>
		</section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Bioenergy transition
			 assistance</header>
			<subsection id="idBEF691AEAAC74049BC6889E7D04C6B0D"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 9003(b) of the Farm Security and
			 Rural Investment Act of 2002 (7 U.S.C. 8103(b)) is amended—</text>
				<paragraph id="idC6ED67B12FF54837BCE29D4A51E2D216"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (4)
			 as paragraphs (5) through (7), respectively; and</text>
				</paragraph><paragraph id="id2E1EC0B0CC904632816FC05BF465AD8D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id446852F42F10453187469CB68DCA3B82" style="OLC">
						<paragraph id="idFF7D8729B66C4FC098BD548735610F14"><enum>(2)</enum><header>Bioenergy
				crop</header>
							<subparagraph id="id50C850361872465AA54FF743190B3736"><enum>(A)</enum><header>In
				general</header><text>The term <term>bioenergy crop</term> means—</text>
								<clause id="id10D0C29BDE7845C3BD43ADC29AA201F7"><enum>(i)</enum><text>a
				perennial plant that can be used as feedstock for bioenergy production;
				or</text>
								</clause><clause id="id687A80C57614451EB779D3C5354730DF"><enum>(ii)</enum><text>an annual plant
				that—</text>
									<subclause id="id92A6C7D68F1E4853B5025906CC65529E"><enum>(I)</enum><text>can be used as
				feedstock for bioenergy production; and</text>
									</subclause><subclause id="id9EA028F237B4445C96383FBF8E388F6B"><enum>(II)</enum><text>is grown in a
				resource-conserving crop rotation.</text>
									</subclause></clause></subparagraph><subparagraph id="id2E77F18B1A72485FB08248F0F68CD62E"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>bioenergy crop</term> does not include—</text>
								<clause id="id5A0D07DE6D8B479C8A2AD0E4AB0D5248"><enum>(i)</enum><text>any crop that is
				eligible for any payments under title I; or</text>
								</clause><clause id="id39777629140848BC81D9DB3ECEA6C9DB"><enum>(ii)</enum><text>any plant
				that—</text>
									<subclause id="id7654AF59FEBF433B9FBE00207BD05C05"><enum>(I)</enum><text>the Secretary
				determines to be invasive or noxious; or</text>
									</subclause><subclause id="id3A667E71F2334EF0B3E22EA9081449C9"><enum>(II)</enum><text>has the
				potential to become invasive or noxious, as determined by the Secretary, in
				consultation with the United States Fish and Wildlife Service or a State
				conservation agency.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="idEEBD5CC7F02C49B9A8C3E8DEF88F6D9F"><enum>(3)</enum><header>Bioenergy
				cropshed</header><text>The term <term>bioenergy cropshed</term> means a
				bioenergy cropshed designated by the Secretary under subsection (g)(1).</text>
						</paragraph><paragraph id="id27A42F656E5D4267AD8C6776DE558D44"><enum>(4)</enum><header>Bioenergy
				producer</header><text>The term <term>bioenergy producer</term> means a
				producer that produces a bioenergy crop that, as determined by the
				Secretary—</text>
							<subparagraph id="id5412738B4C4B4A8496FB4E8F87D9A968"><enum>(A)</enum><text>is physically
				located in a bioenergy cropshed; and</text>
							</subparagraph><subparagraph id="id218987389559492CB97A0A3A6907D7EE"><enum>(B)</enum><text>can be used by
				the local
				biorefinery.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idE7DE58C057394471A26C5E983EE07050"><enum>(b)</enum><header>Bioenergy
			 transition assistance</header><text>Section 9003 of the Farm Security and Rural
			 Investment Act of 2002 (7 U.S.C. 8103) is amended—</text>
				<paragraph id="id58BA4C31FB7D48D9B5C4E3FADB617346"><enum>(1)</enum><text>by redesignating
			 subsections (g) and (h) as subsections (h) and (i), respectively; and</text>
				</paragraph><paragraph id="id8B736D582FC64A6DBBC95642BD834485"><enum>(2)</enum><text>by inserting
			 after subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC68347453FF1440BB736220353A036EB" style="OLC">
						<subsection id="id686371F9C1164CDF9CBAF5E709E7E62D"><enum>(g)</enum><header>Bioenergy
				transition assistance</header>
							<paragraph id="id18712EA43BFC4338811F7C81B42272BC"><enum>(1)</enum><header>Designation of
				bioenergy cropsheds</header>
								<subparagraph id="id0D546720FA744D3489439EF57DC8D4D1"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall designate as bioenergy cropsheds,
				areas that are physically located within, as determined by the
				Secretary—</text>
									<clause id="idEED7923286B34C79B04A178CA70B532B"><enum>(i)</enum><text>a
				50-mile radius of an existing or planned biorefinery; or</text>
									</clause><clause id="idC0376F3523FB4B63AF56A040DB82834B"><enum>(ii)</enum><text>some other
				economically-practicable distance from an existing or planned
				biorefinery.</text>
									</clause></subparagraph><subparagraph id="idF0B46B2CF68A4D9480133421899FE664"><enum>(B)</enum><header>Specific
				conservation objectives</header><text>Each bioenergy cropshed designated under
				subparagraph (A) shall include specific conservation objectives for local
				resources of concern, including water quality, wildlife habitat, soil quality,
				and air quality, as determined by the Secretary, acting through the Natural
				Resources Conservation Service and in consultation with State technical
				committees.</text>
								</subparagraph><subparagraph id="id7A2E5F32651149CE8FB0437A6387996F"><enum>(C)</enum><header>Priority</header><text>In
				designating bioenergy cropsheds under subparagraph (A), the Secretary shall
				give priority to—</text>
									<clause id="id8F789FE31CC642C4B0058157185B04A0"><enum>(i)</enum><text>locations in
				which the establishment of bioenergy cropsheds is most likely, as determined by
				the Secretary, to result in—</text>
										<subclause id="idDFF70273C0C140F1AE19E0B3A6321FA8"><enum>(I)</enum><text>geographic
				diversity;</text>
										</subclause><subclause id="id8DC03AD2C5684FB6BC7C92E27C03DB4B"><enum>(II)</enum><text>diversity of
				feedstocks;</text>
										</subclause><subclause id="id65F8306DC2374DDF970ECE087CC6425C"><enum>(III)</enum><text>net
				environmental benefit; and</text>
										</subclause><subclause id="id0A3BD197D7694E3D9D5ADF836A0DEF86"><enum>(IV)</enum><text>minimal
				environmental harm; and</text>
										</subclause></clause><clause id="id02B6EEB3E4D448FAB80EDA06548D30CB"><enum>(ii)</enum><text>areas in which
				the existing or planned biorefinery is owned primarily by residents of a rural
				area.</text>
									</clause></subparagraph></paragraph><paragraph id="id1F1F4980A0F44E2D8024A7E6663CA09B"><enum>(2)</enum><header>Bioenergy crop
				transition assistance</header>
								<subparagraph id="idD00C84F513504F96878E60DFF49AC666"><enum>(A)</enum><header>In
				general</header><text>The Secretary, acting through the Natural Resources
				Conservation Service, shall offer to enter into contracts with producers on a
				farm in a bioenergy cropshed to provide bioenergy crop transition assistance to
				encourage the producers to produce bioenergy crops for a biorefinery located in
				the bioenergy cropshed.</text>
								</subparagraph><subparagraph id="id7636F6A6F9754819883787D07DF210F5"><enum>(B)</enum><header>Term of
				contract</header><text>Contracts described in subparagraph (A) shall be for a
				term of 3 years.</text>
								</subparagraph></paragraph><paragraph id="idD8A881B86EDD424880126109290E540A"><enum>(3)</enum><header>Eligibility</header>
								<subparagraph id="id99234FB7DAF54049955A06368C022C5D"><enum>(A)</enum><header>In
				general</header><text>As a condition of entering into a bioenergy crop
				transition assistance contract, the producers on a farm shall, as determined by
				the Secretary—</text>
									<clause id="id2297B6ADD7D04A87A672D5CB1827B109"><enum>(i)</enum><text>demonstrate that
				the producers are producing a bioenergy crop that is contracted for use by the
				biorefinery in the bioenergy cropshed;</text>
									</clause><clause id="id83B70DBF067F4B24A37629CA044D3B2E"><enum>(ii)</enum><text>agree to meet
				the quality criteria for water quality, wildlife habitat, and soil quality by
				the end of the contract period; and</text>
									</clause><clause id="id6C84E63DA8884B2A821EC5C034106DE7"><enum>(iii)</enum><text>agree to make
				available to the Secretary (or to an institution of higher education designated
				by the Secretary) such information as the Secretary considers to be
				appropriate—</text>
										<subclause id="id677EAB5766B9460191B0A87985EB3163"><enum>(I)</enum><text>to promote the
				production of bioenergy crops and the development of biorefinery technology;
				and</text>
										</subclause><subclause id="idA9C100376E4D41FF8288392D01B758A2"><enum>(II)</enum><text>to evaluate the
				bioenergy transition assistance.</text>
										</subclause></clause></subparagraph><subparagraph id="id428C3EC448FE441CB477E39E5CC6D3C6"><enum>(B)</enum><header>Best practices
				database</header><text>Subject to section 1770 of the Food Security Act of 1985
				(7 U.S.C. 2276), the Secretary shall make available to the public in a database
				format the best practices information developed by the Secretary in providing
				bioenergy transition assistance.</text>
								</subparagraph></paragraph><paragraph id="id9518C6161D05464D9F789D1AB223723E"><enum>(4)</enum><header>Amount of
				payments</header><text>In determining the amount of annual bioenergy crop
				transition assistance to be paid to producers on a farm under this subsection,
				the Secretary shall consider—</text>
								<subparagraph id="id8E1126554A2A4ED09682BB0334CC9673"><enum>(A)</enum><text>the cost of
				establishing the bioenergy crop;</text>
								</subparagraph><subparagraph id="id639CF252702B41C5AC1481F4B4D1C2F8"><enum>(B)</enum><text>the amount
				necessary to encourage producers on a farm to produce bioenergy crops in the
				quantity needed by the biorefinery in the bioenergy cropshed;</text>
								</subparagraph><subparagraph id="idF7007B55FFE047A0A132EAD8C9BF79F7"><enum>(C)</enum><text>the amount that
				the producers on a farm would have earned if the producers had produced a crop
				other than a bioenergy crop; and</text>
								</subparagraph><subparagraph id="idBF9082CA8E3C4943AFE061BEA0E9ABF9"><enum>(D)</enum><text>such other
				factors as the Secretary considers to be appropriate.</text>
								</subparagraph></paragraph><paragraph id="id392C6E07FBE748368D4420B1F87E7E4A"><enum>(5)</enum><header>Funding</header><text>Of
				the funds of the Commodity Credit Corporation, the Secretary shall use to carry
				out this subsection $350,000,000 for the period of fiscal years 2008 through
				2012, to remain available until
				expended.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id60311DF341BB43498DC13C2927A9DA26"><enum>(c)</enum><header>Conforming
			 amendments</header><text>Section 1770(d) of the Food Security Act of 1985 (7
			 U.S.C. 2276(d)) is amended—</text>
				<paragraph id="id65F8DF43D0344D73920C8CF798BAF3C0"><enum>(1)</enum><text>in paragraph
			 (11), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="id42FA66FA4B664C9B852908A2FA5685FD"><enum>(2)</enum><text>in paragraph
			 (12), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="id3A7F7E9E58634040B96B28B8EED8F4E1"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2917186781054CE8AC3BF5109D90C4CB" style="OLC">
						<paragraph id="id6EC46004A6FF419DAB500416B3150B31"><enum>(13)</enum><text>section 9003(g)
				of the Farm Security and Rural Investment of 2002 (7 U.S.C.
				8103(g))</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idB5A2054073C44520BD7A16479995201E"><enum>3.</enum><header>Conservation
			 security program</header>
			<subsection id="id49227BCDD97D4D43BAD11E05DA92AD33"><enum>(a)</enum><header>Definition of
			 bioenergy crops</header><text display-inline="yes-display-inline">Section 1238
			 of the Food Security Act of 1985 (16 U.S.C. 3838) is amended—</text>
				<paragraph id="id0AC1B1ED544940D8A5DE81D63A3801B5"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) through (15) as paragraphs (5) through (17), respectively;
			 and</text>
				</paragraph><paragraph id="idC7F2EB9473E3429C991E53269DA06575"><enum>(2)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA183B992BE0042E2AEAF1D5E5893C96B" style="OLC">
						<paragraph id="id26FD1C0ACA474F249B154B53D383AE22"><enum>(3)</enum><header>Bioenergy
				crop</header><text>The term <term>bioenergy crop</term> has the meaning given
				the term in section 9003(b) of the Farm Security and Rural Investment of 2002
				(7 U.S.C. 8103(b)).</text>
						</paragraph><paragraph id="idF6A29670A6F248D2A6E01685B152D79D"><enum>(4)</enum><header>Bioenergy
				producer</header><text>The term <term>bioenergy producer</term> has the meaning
				given the term in section 9003(b) of the Farm Security and Rural Investment of
				2002 (7 U.S.C.
				8103(b)).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id3A2CCE1AE71A42CCB9DE67E56B1057B7"><enum>(b)</enum><header>Conservation
			 security contracts</header><text>Section 1238C(b)(1)(C)(iii) of the Food
			 Security Act of 1985 (16 U.S.C. 3838c(b)(1)(C)(iii)) is amended—</text>
				<paragraph id="idF677660D145E48D695DA818740452141"><enum>(1)</enum><text>in subclause
			 (IV), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="idF8DAB88468434CA3A551058EDB85DCB7"><enum>(2)</enum><text>in subclause (V),
			 by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id644842FE1EE44F4088F571032090C7F7"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id31EFE4B7B87F48BF94F802A2CF2673E6" style="OLC">
						<subclause id="ID63102eb244484bfda06e6d45bebe0745"><enum>(VI)</enum><text>is a bioenergy
				producer and maintains and actively manages a conservation system that
				incorporates 2 or more native perennial bioenergy crop species; or</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="id076753EB983D4A12BB7F4833656FB34F"><enum>(VII)</enum><text>is a bioenergy
				producer and participates in a bioenergy crop system research and demonstration
				project.</text>
