			 Fairness Act</short-title></quote>.</text>

			 visas</header>
			<subsection id="IDecf439974a3049b99bd56e7ec3735ef6"><enum>(a)</enum><header>Exemptions to
			 numerical limitations</header>
				<paragraph id="id2A23CBC954F6471D9F857C0E274048E2"><enum>(1)</enum><header>In
			 general</header><text>Section 214(g)(5) of the Immigration and Nationality Act
			 (8 U.S.C. 1184(g)(5)) is amended—</text>
					<subparagraph id="ID7219997b4cd947a399b206058f7aa888"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>until the number of aliens who are exempted from such
			 numerical limitation during such year exceeds 20,000.</quote> and inserting
			 <quote>or has been awarded a medical specialty certification based on
			 post-doctoral training and experience in the United States; or</quote>;
			 and</text>
					</subparagraph><subparagraph id="ID796b45971bd54b3caa2ec2bdac1708d2"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id6DF9A09C34024DFA84CC45998C6BA158" style="OLC">
							<subparagraph id="ID5ef2be4323a3434d915da85df8e97ec6"><enum>(D)</enum><text>has earned a
				masters or higher degree in science, technology, engineering, or mathematics
				from an institution of higher education outside of the United
				States.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID9091b0cdb0ce4eaf883e6257fb878604"><enum>(2)</enum><header>Applicability</header><text>The
			 amendments made by paragraph (1) shall apply to—</text>
					<subparagraph id="idD452E92FC75C4C78BE35C3281CEEDB18"><enum>(A)</enum><text>any petition or
			 visa application pending on the date of the enactment of this Act; and</text>
					</subparagraph><subparagraph id="id4D802A15DE5741E0AD86059CF6F2DDA9"><enum>(B)</enum><text>any petition or
			 visa application filed on or after such date.</text>
					</subparagraph></paragraph></subsection><subsection id="ID7078a4768db74358a22f4ac8b84bba10"><enum>(b)</enum><header>Market-based
			 visa limits</header><text>Section 214(g) of such Act (8 U.S.C. 1184(g)), as
			 amended by subsection (a), is further amended—</text>
				<paragraph id="ID3323236ebca2447dab7c6cb6b7113fa4"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="ID327c2689ba9e4eb4bdb8e3d98bfad0ec"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>(beginning with fiscal year
			 1992)</quote>; and</text>
					</subparagraph><subparagraph id="IDb4604cdaea0e42a5ab838bac4bedf454"><enum>(B)</enum><text>in subparagraph
			 (A), by striking clauses (i) through (vii) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id5B75E2C06C4D4D328BA371578429BF64" style="OLC">
							<clause id="IDce340bf25b5146dd8f2b0721ac04dda6" indent="up1"><enum>(i)</enum><text>115,000 in fiscal year 2007;
				and</text>
							</clause><clause id="IDd68c069d91f9427db06dfa1aea948619" indent="up1"><enum>(ii)</enum><text>in fiscal year 2008, and in each
				subsequent fiscal year, the greater of—</text>
								<subclause id="id7DE7018470E54DB6BB0A6A64E6BF33E6"><enum>(I)</enum><text>115,000; or</text>
								</subclause><subclause id="idB0D2FA16E6AB45A5AE1DA9890B719B2E"><enum>(II)</enum><text>the number calculated under paragraph
				(9);</text>
								</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDcdffbf7819b34916a99549a9da9bd7e6"><enum>(2)</enum><text>in paragraph
			 (8)—</text>
					<subparagraph id="IDfba5bdee3dbf49b9b76164ea2eeb23e9"><enum>(A)</enum><text>in subparagraph
			 (B), by striking clause (iv); and</text>
					</subparagraph><subparagraph id="IDd29b47a019b247b7bcbf4cf6f7fb2659"><enum>(B)</enum><text>by striking
			 subparagraph (D);</text>
					</subparagraph></paragraph><paragraph id="ID16b621ef81b64b3cabbfd35eace134f9"><enum>(3)</enum><text>by redesignating
			 paragraphs (9), (10), and (11) as paragraphs (10), (11), and (12),

			 after paragraph (8) the following:</text>

						<paragraph id="ID93db1fcb6adb4d55896f20d09da99d61" indent="up1"><enum>(9)</enum><text>If the numerical limitation under
				paragraph (1)(A)—</text>
							<subparagraph id="IDcb9ca86a1548424889264737e9d12e6c"><enum>(A)</enum><text>is reached during a given fiscal year,
				the numerical limitation under paragraph (1)(A) for the subsequent fiscal year
				shall be equal to the lesser of—</text>
								<clause id="idAECE205DB4BB4F5CB7538710897B27AB"><enum>(i)</enum><text>120 percent of the numerical
				limitation for the given fiscal year; or</text>
								</clause><clause id="id38F085405C1846339BE1DFB646797528"><enum>(ii)</enum><text>180,000; and</text>
								</clause></subparagraph><subparagraph id="IDd7149a4b105f468c81f277e4d71a97b2"><enum>(B)</enum><text>is not reached during a given fiscal
				year, the numerical limitation under paragraph (1)(A) for the subsequent fiscal
				year shall be equal to the numerical limitation for the given fiscal
				year.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="IDd4923f0c70524614be0e8c3f7019eb8f"><enum>3.</enum><header>Employment-based
			 immigration</header>
			<subsection id="ID9116868792f644e99b60edc7258fb60a"><enum>(a)</enum><header>In
			 general</header><text>Section 201(b)(1) of the Immigration and Nationality Act
			 (8 U.S.C. 1151(b)(1)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCC72F5D6513D42FD9A497BAD4CCBA67F" style="OLC">
					<subparagraph id="ID07ce6d6dc2644d2bb1c6f02109b0e769" indent="up1"><enum>(F)</enum><text>Aliens who have earned a master's or
				higher degree from an accredited university in the United States.</text>
					</subparagraph><subparagraph id="idFDD428A7E67447E794756488DAC2B601" indent="up1"><enum>(G)</enum><text>Aliens who—</text>
						<clause id="id0DB8CCFF2FF74A2D8FC3B59662B42152"><enum>(i)</enum><text>have earned an advanced degree in
				science, technology, engineering, or mathematics; and</text>
						</clause><clause id="id728CCC788CFE4E5FB91634A7906BC9EA"><enum>(ii)</enum><text>have been working in a related
				field in the United States under a nonimmigrant visa during the 3-year period
				preceding their application for an immigrant visa under section 203(b).</text>
						</clause></subparagraph><subparagraph id="ID34ba9c4b78e1421587d2414eded31ad9" indent="up1"><enum>(H)</enum><text>Aliens who—</text>
						<clause id="ID48b4b03370474329afaa5a001bda6f29"><enum>(i)</enum><text>are described in subparagraph (A)
				or (B) of section 203(b)(1); or</text>
						</clause><clause id="ID54a9b9ea67dd454d8f4ffd55a1dba139"><enum>(ii)</enum><text>have received a national interest
				waiver under section 203(b)(2)(B).</text>
						</clause></subparagraph><subparagraph id="ID0575dab1da114324bcad9c02803fbecb" indent="up1"><enum>(I)</enum><text>The immediate relatives of an alien
				who is admitted as an employment-based immigrant under section
				203(b).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID48b9d6c089f94ec1b348268bfe86dfd4"><enum>(b)</enum><header>Adjustment of
			 status for employment-based immigrants</header>
				<paragraph id="id10B578026B6445DCA660A6C38B412EDC"><enum>(1)</enum><header>In
			 general</header><text>Section 245 of the Immigration and Nationality Act (8
			 U.S.C. 1255) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF513E6048E324476A851DEA7AE8596B7" style="OLC">
						<subsection id="ID90d2a175f800454d9432d932ea7f8033"><enum>(n)</enum><header>Adjustment of
				status to employment-based immigrant</header>
							<paragraph id="ID7746acf58b2d4aeb9e266faf44483e0d"><enum>(1)</enum><header>Eligibility</header><text>An
				alien, and any eligible dependents of such alien, may file an application for
				adjustment of status with the Secretary of Homeland Security, whether or not an
				employment-based immigrant visa is immediately available at the time the
				application is filed, if—</text>
								<subparagraph id="id88B773BEE9F941A7959F642CD2814CF8"><enum>(A)</enum><text>a petition filed
				under subparagraph (E) or (F) of section 204(a)(1) on behalf of the alien has
				been approved; or</text>
								</subparagraph><subparagraph id="idD0C4388A55C94B3386A35A9B1BDCC30C"><enum>(B)</enum><text>in the discretion
				of the Secretary, the adjudication of such petition is pending.</text>
								</subparagraph></paragraph><paragraph id="ID029f75a5c3134f0fb8cd958198f52c58"><enum>(2)</enum><header>Visa
				availability</header><text>An application filed under paragraph (1) may not be
				approved until the appropriate employment-based immigrant visa becomes
				available under section 203(b).</text>
							</paragraph><paragraph id="ID514f8e107dfd406cb7f58314e706e50e"><enum>(3)</enum><header>Fees</header><text>If
				an employment-based immigrant visa is not available on the date on which an
				application is filed under paragraph (1), a supplemental fee of $500 shall be
				paid on behalf of the beneficiary of such application. Such fee may not be
				charged with respect to any dependent accompanying or following to join such
				beneficiary.</text>
							</paragraph></subsection><subsection id="ID7d7114582480472fafa50acf38e0ad27"><enum>(o)</enum><header>Extension of
				employment authorization and advanced parole document</header><text>The
				Secretary of Homeland Security—</text>
							<paragraph id="idB4D57A0FDFC84926A98DC16C201C2DE6"><enum>(1)</enum><text>shall issue a
				3-year employment authorization and 3-year advanced parole document to any
				beneficiary of an application for adjustment of status if a petition has been
				filed or is pending under subparagraph (E) or (F) of section 204(a)(1);
				and</text>
							</paragraph><paragraph id="ID11caae50aaaf4662a9518d2490fbda7c"><enum>(2)</enum><text>may adjust fees
				assessed under this section in accordance to the 3-year period of validity
				assigned to the employment authorization or advanced parole documents issued
				under subparagraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id5136796D5FA741F6B8F3095687F1724D"><enum>(2)</enum><header>Use of
			 fees</header><text>Section 286 of such Act (8 U.S.C. 1356) is amended—</text>
					<subparagraph id="idD8975C9CA203452EA6F961BE8355B0D3"><enum>(A)</enum><text>in subsection
			 (m), by striking <quote>provisions of law, all adjudication fees</quote> and
			 inserting <quote>provision of law, all adjudication fees and the fees collected
			 under section 245(n)(3)</quote>; and</text>
					</subparagraph><subparagraph id="idB8D094BA1B7947078E93CE6883EC93EF"><enum>(B)</enum><text>in subsection
			 (n)—</text>
						<clause id="id55D95BB65DB9454F96F43C8E5DA8989B"><enum>(i)</enum><text>by
			 striking <quote>All deposits</quote> and inserting the following: <quote>(1)
			 Except as provided in paragraph (2), all deposits</quote>; and</text>
						</clause><clause id="id30EBD70E8614405D8D7C5F6BD848AC72"><enum>(ii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idD507A24958AF4C7E9D422248ADD483D5" style="OLC">
								<paragraph id="idC688697BEB9B4922AD9BA07FC2C68129" indent="up1"><enum>(2)</enum><text>All deposits in the Immigration
				Examinations Fee Account that were originally collected under section 245(n)(3)
				shall be used to clear security background check
				delays.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></subsection><subsection id="IDdbee472132a347f894e3c3a1aa992b44"><enum>(c)</enum><header>Applicability</header><text>The
			 amendments made by subsections (a) and (b) shall apply to any visa
			 application—</text>
				<paragraph id="IDecdedb0a72fe49239e44736ef5f685c7"><enum>(1)</enum><text>pending on the
			 date of the enactment of this Act; or</text>
				</paragraph><paragraph id="ID5fa502d271ed417c9cdf63def81535ec"><enum>(2)</enum><text>filed on or after
			 such date.</text>
				</paragraph></subsection></section><section id="ID1b13bfe94f4e4e6f8da7237d8ad48e0e"><enum>4.</enum><header>H–1B visa fraud
			 and abuse protections</header>
			<subsection id="ID5f088e5edb86453bb11e311c3ebbc58b"><enum>(a)</enum><header>Prohibition
			 against advertising exclusively to H–1B nonimmigrants</header><text>Section
			 212(n)(1) of the Immigration and Nationality Act (8 U.S.C. 1182(n)(1)) is
			 amended—</text>
				<paragraph id="IDa544071cdafb4744be4c119530cb464b"><enum>(1)</enum><text>by redesignating
			 subparagraph (G) as subparagraph (H);</text>
				</paragraph><paragraph id="id08583F1A539443B3814C8EEFF79FCE7F"><enum>(2)</enum><text>by inserting
			 after subparagraph (H), as redesignated, the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6924B71C14FD4AE38B2267ED03C2431B" style="OLC">
						<subparagraph id="IDc3902980c9db4da28bc056ad05dd8aaa" indent="up1"><enum>(I)</enum><text>The employer has not advertised the
				available jobs specified in the application in an advertisement that states or
				indicates that—</text>
							<clause id="idBD5B60B8C7424277958F7EB900C7DFA7"><enum>(i)</enum><text>the jobs are only available to
				persons who are, or may become, H–1B nonimmigrants; or</text>
							</clause><clause id="id49F4667840284229A6E427B3212D5C33"><enum>(ii)</enum><text>persons will receive priority or
				preference in the hiring process because they are, or may become, H–1B
				nonimmigrants.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDb62d330801ca4c2ab3d67a19c2a64556"><enum>(3)</enum><text>in the
			 undesignated paragraph at the end, by striking <quote>The employer</quote> and
			 inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id12CB52CC763D4B16802CDE554303AC3C" style="OLC">
						<subparagraph id="ID7c77881e4b904aa59dbbd4b5abb55eab" indent="up1"><enum>(K)</enum><text>The
				employer</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID20414609f55546ff8107ebdd86a33c7e"><enum>(b)</enum><header>Limit on
			 percentage of H–1B employees</header><text>Section 212(n)(1) of such Act, as
			 amended by this section, is further amended by inserting after subparagraph
			 (I), as added by subsection (a)(1), the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD76C33EBFC954044926679AECD330614" style="OLC">
					<subparagraph id="ID2751a9bcefbd4b7b9b0949c319be18f1" indent="up1"><enum>(J)</enum><text>If the employer employs 50 or more
				employees in the United States, not more than 50 percent of such employees are
				H–1B
				nonimmigrants.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID3e01a21d197642e4ac79eb276fd6eb2a"><enum>(c)</enum><header>Safeguards
			 against fraud and misrepresentation in application review
			 process</header><text>Section 212(n)(1)(K) of such Act, as designated by
			 subsection (a)(2), is amended—</text>
				<paragraph id="IDf42d6c2e53924159861ebb719916c905"><enum>(1)</enum><text>by inserting
			 <quote>, clear indicators of fraud, misrepresentation of material fact,</quote>
			 after <quote>completeness</quote>;</text>
				</paragraph><paragraph id="IDec52248744764579a0f72b64cd0f85b3"><enum>(2)</enum><text>by striking
			 <quote>or obviously inaccurate</quote> and inserting <quote>, presents clear
			 indicators of fraud or misrepresentation of material fact, or is obviously
			 inaccurate</quote>; and</text>
				</paragraph><paragraph id="ID2a248f1442ef45538e4f03a4a1e52165"><enum>(3)</enum><text>by adding at the
			 end the following: <quote>If the Secretary’s review of an application
			 identifies clear indicators of fraud or misrepresentation of material fact, the
			 Secretary may conduct an investigation and hearing under paragraph
			 (2).</quote>.</text>
				</paragraph></subsection><subsection id="ID4f9da2dcb450490590afed950e255d6a"><enum>(d)</enum><header>Investigations
			 by department of labor</header><text>Section 212(n)(2) of such Act is
			 amended—</text>
				<paragraph id="ID73ee3578a1e241c8a504a6002cc9cb93"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>12 months</quote> and all that follows and inserting
			 <quote>24 months after the date of the failure or misrepresentation,
			 respectively. Upon the receipt of such a complaint, the Secretary may initiate
			 an investigation to determine if such a failure or misrepresentation has
			 occurred.</quote>;</text>
				</paragraph><paragraph id="IDbdc280a11f4149449fefd59661feaaaf"><enum>(2)</enum><text>in subparagraph
			 (C)(i)—</text>
					<subparagraph id="IDd6ba24d2ff1a41219c52d819bcbb451a"><enum>(A)</enum><text>by striking
			 <quote>a condition of paragraph (1)(B), (1)(E), or (1)(F)</quote> and inserting
			 <quote>a condition under subparagraph (B), (C), (E), (F), (H), (I), or (J) of
			 paragraph (1)</quote>; and</text>
					</subparagraph><subparagraph id="ID05500d9a1c1b43d481b6c5ce0898a2da"><enum>(B)</enum><text>by striking
			 <quote>paragraph (1)(C), (1)(D), or (1)(G)(i)(I)</quote> and inserting
			 <quote>subparagraph (C), (D) or (G)(i)(I) of paragraph (1)</quote>;</text>
					</subparagraph></paragraph><paragraph id="ID0adbde03869143b49fb318c878d3dae9"><enum>(3)</enum><text>in subparagraph
			 (G)—</text>
					<subparagraph id="ID4b516e82a9c34de9be2f57110d5053db"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>if the Secretary</quote> and all that follows and inserting
			 <quote>with regard to the employer’s compliance with the requirements under
			 this subsection.</quote>;</text>
					</subparagraph><subparagraph id="IDd222d684dce040c7bcf73b4afc15c482"><enum>(B)</enum><text>in clause (ii),
			 by striking <quote>and whose identity</quote> and all that follows through
			 <quote>failure or failures.</quote> and inserting <quote>the Secretary of Labor
			 may conduct an investigation into the employer’s compliance with the
			 requirements under this subsection.</quote>;</text>
					</subparagraph><subparagraph id="ID6dd1e0c34454425db1a257014453f009"><enum>(C)</enum><text>in clause (iii),
			 by striking the last sentence;</text>
					</subparagraph><subparagraph id="IDac2f6392c22641e09af0413e20743aa1"><enum>(D)</enum><text>by striking
			 clauses (iv) and (v);</text>
					</subparagraph><subparagraph id="ID4428a9cf33654eb6ba64bd63303fbd2d"><enum>(E)</enum><text>by redesignating
			 clauses (vi), (vii), and (viii) as clauses (iv), (v), and (vi),
			 respectively;</text>
					</subparagraph><subparagraph id="IDa18e0db5ee0a42ceb4b39a6286ae5af6"><enum>(F)</enum><text>in clause (iv),
			 as redesignated, by striking <quote>meet a condition</quote> and all that
			 follows and inserting <quote>comply with the requirements under this
			 subsection, unless the Secretary of Labor receives the information not later
			 than 24 months after the date of the alleged failure.</quote>;</text>
					</subparagraph><subparagraph id="ID63fe9ed3b6894b14af93ec10c3fb2745"><enum>(G)</enum><text>by amending
			 clause (v), as redesignated, to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idDCD8F9C889674816826F398E3706534D" style="OLC">
							<clause id="IDe8fab67e1ad2432a8fd856292496359f" indent="up3"><enum>(v)</enum><text>The Secretary of Labor shall provide
				notice to an employer of the intent to conduct an investigation. The notice
				shall be provided in such a manner, and shall contain sufficient detail, to
				permit the employer to respond to the allegations before an investigation is
				commenced. The Secretary is not required to comply with this clause if the
				Secretary determines that such compliance would interfere with an effort by the
				Secretary to investigate the employer or secure the employer’s compliance with
				this subsection. A determination by the Secretary under this clause is not
				subject to judicial
				review.</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="IDa0d4f138a7d84728a89c7afb55905f83"><enum>(H)</enum><text>in clause (vi),
			 as redesignated, by striking <quote>An investigation</quote> and all that
			 follows through <quote>the determination.</quote> and inserting <quote>If the
			 Secretary of Labor, after an investigation under clause (i) or (ii), determines
			 that a reasonable basis exists to make a finding that the employer has failed
			 to comply with the requirements under this subsection, the Secretary shall
			 provide interested parties with notice of such determination and an opportunity
			 for a hearing in accordance with section 556 of title 5, United States Code,
			 not later than 120 days after the date of such determination.</quote>;
			 and</text>
					</subparagraph><subparagraph id="IDe72f6739c7f34e17b3edb9c6dc943128"><enum>(I)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idED4CCF9A22314AEA8571F87CFD9AAB66" style="OLC">
							<clause id="ID8d096d248b3f406a9c2143e3c3d51b54" indent="up3"><enum>(vii)</enum><text>If the Secretary of Labor, after a
				hearing, finds a reasonable basis to believe that the employer has violated a
				requirement under this subsection, the Secretary may impose a penalty under
				subparagraph
				(C).</text>

					</subparagraph></paragraph><paragraph id="idCF8C347A68014C8C9C04AE84DFD33929"><enum>(4)</enum><text>by redesignating

				</paragraph></subsection><subsection commented="no" id="idA75B04C2AB9544BCB4705A32B5AC4895"><enum>(e)</enum><header>Additional
			 department of labor employees</header>
				<paragraph commented="no" id="id99B94B55555F491AA1D958A743A83BA6"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor is authorized to hire 200
			 additional employees to administer, oversee, investigate, and enforce programs
			 involving H–1B nonimmigrant workers.</text>
				</paragraph><paragraph commented="no" id="id1719546038F7402E880D3EF48DEE7CE6"><enum>(2)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary to carry out this subsection.</text>
				</paragraph></subsection><subsection commented="no" id="id8BD718F824F144688FFBADC35FF95773"><enum>(f)</enum><header>Schedule of
			 fees</header><text>Section 214(c)(12)(C) of the Immigration and Nationality Act
			 (8 U.S.C. 1184(c)(12)(C)) is amended by striking <quote>$500</quote> and
			 inserting <quote>$1,000</quote>.</text>
			</subsection><subsection id="ID4afd37cacbf745d78375fed925580721"><enum>(g)</enum><header>Information
			 sharing between department of labor and department of homeland
			 security</header><text>Section 212(n)(2) of such Act, as amended by this
			 section, is further amended by inserting after subparagraph (H) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id22C4F1E0A4D142D2B4FAEE806E09E928" style="OLC">
					<subparagraph id="IDae9d05d6f8b84dbdb93500a5beacbfb4" indent="up2"><enum>(I)</enum><text>If any information contained in the
				materials submitted by employers of H–1B nonimmigrants as part of the
				adjudication process indicates that the employer is not complying with the
				requirements under this subsection, the Director of United States Citizenship
				and Immigration Services shall provide such information to the Secretary of
				Labor. The Secretary may initiate and conduct an investigation and hearing
				under this paragraph after receiving such
				information.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID73736d357d9845fc92c245361a9f8353"><enum>(h)</enum><header>Audits</header><text>Section
			 212(n)(2)(A) of such Act, as amended by this section, is further amended by
			 adding at the end the following: <quote>The Secretary may conduct surveys
			 regarding the degree to which employers comply with the requirements under this
			 subsection and may conduct annual compliance audits of employers of H–1B
			 nonimmigrants. The Secretary shall conduct annual compliance audits of not less
			 than 1 percent of the employers of H–1B nonimmigrants during the applicable
			 calendar year. The Secretary shall conduct annual compliance audits of each
			 employer with more than 100 employees who work in the United States if more
			 than 15 percent of such employees are H–1B nonimmigrants.</quote>.</text>
			</subsection><subsection id="IDe5c3b313b8d44d3fbaffc34fd015254b"><enum>(i)</enum><header>Penalties</header><text>Section
			 212(n)(2)(C) of such Act, as amended by this section, is further
			 amended—</text>
				<paragraph id="ID3540ee65571b495b941d74b9af6f4ce9"><enum>(1)</enum><text>in clause (i)(I),
			 by striking <quote>$1,000</quote> and inserting <quote>$2,000</quote>;</text>
				</paragraph><paragraph id="IDcd3f512c7c5840daaaad332cf7992c4c"><enum>(2)</enum><text>in clause
			 (ii)(I), by striking <quote>$5,000</quote> and inserting
			 <quote>$10,000</quote>; and</text>
				</paragraph><paragraph id="IDfff6e2ab80e442bd95f97b352e94f87e"><enum>(3)</enum><text>in clause
			 (vi)(III), by striking <quote>$1,000</quote> and inserting
			 <quote>$2,000</quote>.</text>
				</paragraph></subsection><subsection id="ID90970e9e42ad4d8f951bcc6356ac5ceb"><enum>(j)</enum><header>Information
			 provided to H–1B nonimmigrants upon visa issuance</header><text>Section 212(n)
			 of such Act, as amended by this section, is further amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC3DB36CDB6A24A61836A43F4952310BD" style="OLC">
					<paragraph id="IDb55e2202380c4b9e8356cf3c097bb509" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id865AC1E9029646D9B3A0A4ADB269D613"><enum>(A)</enum><text>Upon providing H–1B
				nonimmigrant status to an alien in the United States, the office processing the
				petition for such status shall provide the applicant with—</text>
							<clause id="id6EF7BAB94CC5445CA961610E5DAB007C" indent="up1"><enum>(i)</enum><text>a brochure outlining the employer’s
				obligations and the employee’s rights under Federal law, including labor and
				wage protections; and</text>
							</clause><clause id="idE52DB11DE89140368C9A4EAAC24812DA" indent="up1"><enum>(ii)</enum><text>the contact information for Federal
				agencies that can offer more information or assistance in clarifying employer
				obligations and workers’ rights.</text>
							</clause></subparagraph><subparagraph id="id66D86C8D20A648D491E6C77AE2004AA2" indent="up1"><enum>(B)</enum><text>Upon issuing an H–1B nonimmigrant
				visa to an alien outside the United States, the officer of the Department of
				State shall provide the applicant with the items described in clauses (i) and
				(ii) of subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
