		<official-title display="yes">To amend the Public Health Service Act to
		  provide for the establishment of an Amyotrophic Lateral Sclerosis
		  Registry.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id7772B2DB81744C008E7F8034C131713A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>ALS
			 Registry Act</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id21209e54-4066-4d83-97ac-f296d0eb191f" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Amendment to the Public Health Service
			 Act</header><text display-inline="no-display-inline">Part P of title III of the
			 Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g et seq.</external-xref>) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id3c416764-653e-48dc-a1ea-e544a931a523" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="idc9b9ed71-bc34-45ff-939c-33e0bfb8bc11" section-type="subsequent-section"><enum>399R.</enum><header display-inline="yes-display-inline">Amyotrophic lateral sclerosis
				registry</header>
					<subsection commented="no" display-inline="no-display-inline" id="iddb097419-22a1-4777-9bf3-517e8abb0811"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idb298f9bd-7d97-484e-8e02-04b80c70eae1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the receipt of
				the report described in subsection (b)(2)(A), the Secretary, acting through the
				Director of the Centers for Disease Control and Prevention, may, if
				scientifically advisable—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ida130002e-dbcb-43a9-b3d2-e3fd918ddb82"><enum>(A)</enum><text display-inline="yes-display-inline">develop a system to collect data on
				amyotrophic lateral sclerosis (referred to in this section as
				<quote>ALS</quote>) and other motor neuron disorders that can be confused with
				ALS, misdiagnosed as ALS, and in some cases progress to ALS, including
				information with respect to the incidence and prevalence of the disease in the
				United States; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf5801249-79d1-472c-a834-5d78a4a1c09e"><enum>(B)</enum><text display-inline="yes-display-inline">establish a national registry for the
				collection and storage of such data to develop a population-based registry of
				cases in the United States of ALS and other motor neuron disorders that can be
				confused with ALS, misdiagnosed as ALS, and in some cases progress to
				ALS.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d10c708-f765-4bbf-a0cb-fdb8d932c018"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">It is the purpose of the registry
				established under paragraph (1)(B) to—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id318f5d0a-8a06-48c7-b706-f9acc173def9"><enum>(A)</enum><text display-inline="yes-display-inline">better describe the incidence and
				prevalence of ALS in the United States;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc77d0831-a36a-4f2c-90e2-683355f301a4"><enum>(B)</enum><text display-inline="yes-display-inline">examine appropriate factors, such as
				environmental and occupational, that may be associated with the disease;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1baf34da-2829-4e98-b872-65ddfa5cbdab"><enum>(C)</enum><text display-inline="yes-display-inline">better outline key demographic factors
				(such as age, race or ethnicity, gender, and family history of individuals who
				are diagnosed with the disease) associated with the disease;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0cec8c5-a2e8-45d8-aee4-1a74375113e7"><enum>(D)</enum><text display-inline="yes-display-inline">better examine the connection between ALS
				and other motor neuron disorders that can be confused with ALS, misdiagnosed as
				ALS, and in some cases progress to ALS; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id937fbc61-c65c-4c24-a44e-c6f4dd19d995"><enum>(E)</enum><text display-inline="yes-display-inline">other matters as recommended by the
				Advisory Committee established under subsection (b).</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb7a51f68-a62d-4030-9a43-ffae36cc8089"><enum>(b)</enum><header display-inline="yes-display-inline">Advisory Committee</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idfd57f52b-5a3f-4af7-a4f0-1fbf664009be"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				the enactment of this section, the Secretary, acting through the Director of
				the Centers for Disease Control and Prevention, may establish a committee to be
				known as the Advisory Committee on the National ALS Registry (referred to in
				this section as the <quote>Advisory Committee</quote>). The Advisory Committee
				shall be composed of not more than 27 members to be appointed by the Secretary,
				acting through the Centers for Disease Control and Prevention, of which—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF8320887E82445E7A297F572626B568F"><enum>(A)</enum><text display-inline="yes-display-inline">two-thirds of such members shall represent
				governmental agencies—</text>
								<clause commented="no" display-inline="no-display-inline" id="id8349238AFEA14E60A02B801CDAE181FD"><enum>(i)</enum><text display-inline="yes-display-inline">including at least one member
				representing—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idC0AF480C212D4A73B81BDEAFFCF7CD6A"><enum>(I)</enum><text display-inline="yes-display-inline">the National Institutes of Health, to
				include, upon the recommendation of the Director of the National Institutes of
				Health, representatives from the National Institute of Neurological Disorders
				and Stroke and the National Institute of Environmental Health Sciences;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id2EC87ECF1A864A22A22B23A953D0CEA9"><enum>(II)</enum><text display-inline="yes-display-inline">the Department of Veterans Affairs;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idE6E6946E863C413282F1268B858C3E7D"><enum>(III)</enum><text display-inline="yes-display-inline">the Agency for Toxic Substances and Disease
				Registry; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id6C0B4BD1C9F049DA918569D767987CC1"><enum>(IV)</enum><text display-inline="yes-display-inline">the Centers for Disease Control and
				Prevention; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idE2A3D56D78A74A4E8A407FF655072D1D"><enum>(ii)</enum><text display-inline="yes-display-inline">of which at least one such member shall be
				a clinician with expertise on ALS and related diseases, an epidemiologist with
				experience in data registries, a statistician, an ethicist, and a privacy
				expert (relating to the privacy regulations under the Health Insurance
				Portability and Accountability Act of 1996); and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B0B31DC0DEE415DAEF0CC280BB94763"><enum>(B)</enum><text display-inline="yes-display-inline">one-third of such members shall be public
				members, including at least one member representing—</text>
								<clause commented="no" display-inline="no-display-inline" id="idD38CEAF9F59F4BE58C3F1FD75D97AFCB"><enum>(i)</enum><text display-inline="yes-display-inline">national and voluntary health
				associations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id13ac1916-126f-4554-98fc-391c6d60487c"><enum>(ii)</enum><text display-inline="yes-display-inline">patients with ALS or their family
				members;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idae5a0626-afa7-458a-a480-5291cd20de0b"><enum>(iii)</enum><text display-inline="yes-display-inline">clinicians with expertise on ALS and
				related diseases;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id1c6fc52a-2ab7-4ae6-8ac9-01bfbfdd59c3"><enum>(iv)</enum><text display-inline="yes-display-inline">epidemiologists with experience in data
				registries;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id63280c7e-449c-4b34-ac07-b6765f39a0f0"><enum>(v)</enum><text display-inline="yes-display-inline">geneticists or experts in genetics who have
				experience with the genetics of ALS or other neurological diseases and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id43e300ba-a29c-4cd5-87e1-f78c45a76fae"><enum>(vi)</enum><text display-inline="yes-display-inline">other individuals with an interest in
				developing and maintaining the National ALS Registry.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb632014d-fac6-44d6-bfe9-1a66d6cf90b1"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Advisory Committee may review
				information and make recommendations to the Secretary concerning—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id723088e2-b0b5-47dc-9156-a804cbd1fcc2"><enum>(A)</enum><text display-inline="yes-display-inline">the development and maintenance of the
				National ALS Registry;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0609f0d7-ab06-4e4a-94e3-cb4c9265f8b2"><enum>(B)</enum><text display-inline="yes-display-inline">the type of information to be collected and
				stored in the Registry;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfa703871-c066-4b23-8f93-c3d835dffad4"><enum>(C)</enum><text display-inline="yes-display-inline">the manner in which such data is to be
				collected;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0034e9d-141b-475a-aad2-15eb7e7e4a89"><enum>(D)</enum><text display-inline="yes-display-inline">the use and availability of such data
				including guidelines for such use; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b24b971-1f54-457e-8b10-8da93c1e6166"><enum>(E)</enum><text display-inline="yes-display-inline">the collection of information about
				diseases and disorders that primarily affect motor neurons that are considered
				essential to furthering the study and cure of ALS.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id965fa03e-7342-42b9-a8dc-d00347fcdd4d"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 270 days after the date on
				which the Advisory Committee is established, the Advisory Committee may submit
				a report to the Secretary concerning the review conducted under paragraph (2)
				that contains the recommendations of the Advisory Committee with respect to the
				results of such review.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbdfd69e4-b4b9-4cec-981c-7dba80eaff28"><enum>(c)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Centers for Disease Control and Prevention, may award grants to, and
				enter into contracts and cooperative agreements with, public or private
				nonprofit entities for the collection, analysis, and reporting of data on ALS
				and other motor neuron disorders that can be confused with ALS, misdiagnosed as
				ALS, and in some cases progress to ALS after receiving the report under
				subsection (b)(3).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id41286a3c-6e32-445a-9034-2d21a8c31e47"><enum>(d)</enum><header display-inline="yes-display-inline">Coordination With State, Local, and Federal
				Registries</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idde03a07f-51bd-4a2c-9cf8-842fb1ba8a2b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In establishing the National ALS Registry
				under subsection (a), the Secretary, acting through the Director of the Centers
				for Disease Control and Prevention, may—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id6c217f2b-37b8-4bba-b8d0-8d872ee4db2c"><enum>(A)</enum><text display-inline="yes-display-inline">identify, build upon, expand, and
				coordinate among existing data and surveillance systems, surveys, registries,
				and other Federal public health and environmental infrastructure wherever
				possible, which may include—</text>
								<clause commented="no" display-inline="no-display-inline" id="idd888ab58-37a3-4285-8b61-b7cdc2369331"><enum>(i)</enum><text display-inline="yes-display-inline">any registry pilot projects previously
				supported by the Centers for Disease Control and Prevention;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id3c39e102-693b-4bd6-bd0f-72610bb12ba4"><enum>(ii)</enum><text display-inline="yes-display-inline">the Department of Veterans Affairs ALS
				Registry;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id58cbb5a2-5a75-4847-82db-d82ce8221247"><enum>(iii)</enum><text display-inline="yes-display-inline">the DNA and Cell Line Repository of the
				National Institute of Neurological Disorders and Stroke Human Genetics Resource
				Center at the National Institutes of Health;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idd37ebf76-64a1-4f18-9e07-57c1a75109be"><enum>(iv)</enum><text display-inline="yes-display-inline">Agency for Toxic Substances and Disease
				Registry studies, including studies conducted in Illinois, Missouri, El Paso
				and San Antonio, Texas, and Massachusetts;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id4e177f80-50f2-4b9d-996d-e25e2653c83c"><enum>(v)</enum><text display-inline="yes-display-inline">State-based ALS registries;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id0d6ccfa5-df15-49e9-87ae-29ba04974ee8"><enum>(vi)</enum><text display-inline="yes-display-inline">the National Vital Statistics System;
				and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idb4b493be-78ea-4cf6-aeee-8357ee5ec5bf"><enum>(vii)</enum><text display-inline="yes-display-inline">any other existing or relevant databases
				that collect or maintain information on those motor neuron diseases recommended
				by the Advisory Committee established in subsection (b); and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide1b5cb07-d4c9-4c1b-ac7d-c987ddd0984e"><enum>(B)</enum><text display-inline="yes-display-inline">provide for research access to ALS data as
				recommended by the Advisory Committee established in subsection (b) to the
				extent permitted by applicable statutes and regulations and in a manner that
				protects personal privacy consistent with applicable privacy statutes and
				regulations.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8cafb58-aebb-4d3e-9335-2b0c5a499d46"><enum>(C)</enum><header display-inline="yes-display-inline">Coordination with nih and department of
				veterans affairs</header><text display-inline="yes-display-inline">Consistent
				with applicable privacy statutes and regulations, the Secretary may ensure that
				epidemiological and other types of information obtained under subsection (a) is
				made available to the National Institutes of Health and the Department of
				Veterans Affairs.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb8fc39f3-832a-4173-ae6d-70dde8db772a"><enum>(e)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">For the purposes of this section, the term
				<term>national voluntary health association</term> means a national non-profit
				organization with chapters or other affiliated organizations in States
				throughout the United States with experience serving the population of
				individuals with ALS and have demonstrated experience in ALS research, care,
				and patient
				services.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id656083157B1248369EBB47F42F5F7034" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Report on registries</header><text display-inline="no-display-inline">Not later than 18 months after the date of
			 enactment of this Act, the Secretary of Health and Human Services may submit to
			 the appropriate committees of Congress a report outlining—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idEED8429C98B14BF4B0ED428BDAF952FA"><enum>(1)</enum><text display-inline="yes-display-inline">the registries currently under way;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51BF5BD324464727A2F4393BA04F9350"><enum>(2)</enum><text display-inline="yes-display-inline">future planned registries;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61F40C6840F24FB9BBD11B0C0796B7EF"><enum>(3)</enum><text display-inline="yes-display-inline">the criteria involved in determining what
			 registries to conduct, defer, or suspend; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE2AE6B22ADC343E4B83474323513D7B8"><enum>(4)</enum><text display-inline="yes-display-inline">the scope of those registries.</text>
			</paragraph><continuation-text commented="no" continuation-text-level="section">The report may also include a
			 description of the activities the Secretary undertakes to establish
			 partnerships with research and patient advocacy communities to expand
			 registries.</continuation-text></section></legis-body>
