			 prescription drugs</header><text display-inline="no-display-inline">Section
			 1860D–11 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-111">42 U.S.C. 1395w–111</external-xref>) is amended by
			 striking subsection (i) (relating to noninterference) and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idA6D165397BEC42A78A724F7B27129A6A" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="id3899F7C4AF414D53B6E3D59051A5DC44"><enum>(i)</enum><header display-inline="yes-display-inline">Negotiation; no national formulary or price
				structure</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDb7124033671c4c569696a062629b031e"><enum>(1)</enum><header display-inline="yes-display-inline">Negotiation of prices with
				manufacturers</header><text display-inline="yes-display-inline">In order to
				ensure that beneficiaries enrolled under prescription drug plans and MA–PD
				plans pay the lowest possible price, the Secretary shall have and exercise
				authority similar to that of other Federal entities that purchase prescription
				drugs in bulk to negotiate contracts with manufacturers of covered part D
				drugs, consistent with the requirements and in furtherance of the goals of
				providing quality care and containing costs under this part.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID467dccbb1283457396d50371cfa721a8"><enum>(2)</enum><header display-inline="yes-display-inline">No national formulary or price
				structure</header><text display-inline="yes-display-inline">In order to promote
				competition under this part and in carrying out this part, the Secretary may
				not require a particular formulary or institute a price structure for the
				reimbursement of covered part D
				drugs.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="H0DC4A99D61B044F4B1006EFCA28803CD" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Guaranteed prescription drug
			 benefits</header>
			<subsection commented="no" display-inline="no-display-inline" id="HBEC6CDDC96EF441781783CF9D23E03B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1860D–3 of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-103">42 U.S.C. 1395w–103</external-xref>) is amended to read as follows:</text>
				<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="H8CFDBC7273F242D09361BC64DF4000FF" other-style="archaic" style="traditional"><section commented="no" display-inline="no-display-inline" id="H0C00D0DBFEF04B0E87A5B3F2E993BBF9" section-type="subsequent-section"><enum>1860D–3.</enum><header>Access to a choice
		  of qualified prescription drug coverage</header><subsection commented="no" display-inline="yes-display-inline" id="H039E3A5E2CA340EA9EDDA384EE9BA77B"><enum>(a)</enum>
							<header>Assuring access to a choice of coverage</header>
							<paragraph commented="no" display-inline="no-display-inline" id="HEBED0DAE57B749148957F16600B2533F"><enum>(1)</enum><header display-inline="yes-display-inline">Choice of at least three plans in each
				area</header><text display-inline="yes-display-inline">Beginning on January 1,
				2008, the Secretary shall ensure that each part D eligible individual has
				available, consistent with paragraph (2), a choice of enrollment in—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H3875B48FF0074B82B41DBF7F5F5244E7"><enum>(A)</enum><text display-inline="yes-display-inline">a nationwide prescription drug plan offered
				by the Secretary in accordance with subsection (b); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCFDED4FA5542479D9DD1A4F70559FAB3"><enum>(B)</enum><text display-inline="yes-display-inline">at least 2 qualifying plans (as defined in
				paragraph (3)) in the area in which the individual resides, at least one of
				which is a prescription drug plan.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7D7C480C67A4C0FAF239D67EB3FBA4E"><enum>(2)</enum><header display-inline="yes-display-inline">Requirement for different plan
				sponsors</header><text display-inline="yes-display-inline">The requirement in
				paragraph (1)(B) is not satisfied with respect to an area if only one entity
				offers all the qualifying plans in the area.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H623546DA646A4342BB8299C3E508AF68"><enum>(3)</enum><header display-inline="yes-display-inline">Qualifying plan defined</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>qualifying plan</term> means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HFC2D315BC37743B190C1C6DE9DC82B29"><enum>(A)</enum><text display-inline="yes-display-inline">a prescription drug plan;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD70E3D860B294F548FF131A8DEEA6551"><enum>(B)</enum><text display-inline="yes-display-inline">an MA–PD plan described in section
				1851(a)(2)(A)(i) that provides—</text>
									<clause commented="no" display-inline="no-display-inline" id="H2BEFC29F74A04E6F87289BFC0746446"><enum>(i)</enum><text display-inline="yes-display-inline">basic prescription drug coverage; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H42A1773600DD4B38902B43CDFBA8FA37"><enum>(ii)</enum><text display-inline="yes-display-inline">qualified prescription drug coverage that
				provides supplemental prescription drug coverage so long as there is no MA
				monthly supplemental beneficiary premium applied under the plan, due to the
				application of a credit against such premium of a rebate under section
				1854(b)(1)(C); or</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7FDB8221E7734D0BA973CF7996846E68"><enum>(C)</enum><text display-inline="yes-display-inline">a nationwide prescription drug plan offered
				by the Secretary in accordance with subsection (b).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2B4794176A74D85A27FC4D6B600D4F7"><enum>(b)</enum>
							<header>HHS as PDP sponsor for a nationwide
		  prescription drug plan</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H94C1451062344D61BD279BD6DDF57CC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the
				Administrator of the Centers for Medicare &amp; Medicaid Services, shall take
				such steps as may be necessary to qualify and serve as a PDP sponsor and to
				offer a prescription drug plan that offers basic prescription drug coverage
				throughout the United States. Such a plan shall be in addition to, and not in
				lieu of, other prescription drug plans offered under this part.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H92557A7B1FB64D93BD6DF956E2758CF2"><enum>(2)</enum><header display-inline="yes-display-inline">Premium; solvency;
				authorities</header><text display-inline="yes-display-inline">In carrying out
				paragraph (1), the Secretary—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HB5B7C63987104529A3D52BE7F124DB3B"><enum>(A)</enum><text display-inline="yes-display-inline">shall establish a premium in the amount of
				$35 for months in 2008 and, for months in subsequent years, in the amount
				specified in this paragraph for months in the previous year increased by the
				annual percentage increase described in section 1860D–2(b)(6) (relating to
				growth in medicare prescription drug costs per beneficiary) for the year
				involved;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7ABB0524C52C4141B3A6B0AE9974C1D2"><enum>(B)</enum><text display-inline="yes-display-inline">is deemed to have met any applicable
				solvency and capital adequacy standards; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC8FABA02B1754025AEB99253A5D931ED"><enum>(C)</enum><text display-inline="yes-display-inline">shall exercise such authorities (including
				the use of regional or other pharmaceutical benefit managers) as the Secretary
				determines necessary to offer the prescription drug plan in the same or a
				comparable manner as is the case for prescription drug plans offered by private
				PDP sponsors.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDEA4CE910A2C404EBC28D7642F495788"><enum>(c)</enum><header>Flexibility in risk
		  assumed</header><text display-inline="yes-display-inline">In order to ensure access pursuant to
				subsection (a) in an area the Secretary may approve limited risk plans under
				section 1860D–11(f) for the
				area.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H2B2A35CD188D4E57A3B5FD8266DB7E5E"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1860D–11(g) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395w–111(g)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="id3DDA9A09AAEF4DEBA42BA3AD3376989B" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id072EAE2A4F344C32BDAD17CFFF5E31C8"><enum>(8)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">This subsection shall not apply on or after
				January 1,
				2008.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HF91324C805494844988700565C9BEDCA" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Full reimbursement for qualified retiree
			 prescription drug plans</header>
			<subsection commented="no" display-inline="no-display-inline" id="HA1D594B908494C29A6DE17B673A5B9E7"><enum>(a)</enum><header display-inline="yes-display-inline">Elimination of true Out-of-Pocket
			 limitation</header><text display-inline="yes-display-inline">Section
			 1860D–2(b)(4)(C)(ii) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(b)(4)(C)(ii)</external-xref> is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H793662FC57F043D99CAC907FA88BB983"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>under a qualified
			 retiree prescription drug plan (as defined in section 1860D–22(a)(2)),</quote>
			 after <quote>under section 1860D–14,</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4219F8E5513C4F6CAD5DB755B00ACB4"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>, under such a
			 qualified retiree prescription drug plan,</quote> after <quote>(other than
			 under such section</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDA6068FDAA7C4D7FAF60763179B60036"><enum>(b)</enum><header display-inline="yes-display-inline">Equalization of subsidies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Health and Human Services shall provide for such increase in
			 the special subsidy payment amounts under section 1860D–22(a)(3) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395w–132(a)(3)) as may be appropriate to provide for payments in the aggregate
			 equivalent to the payments that would have been made under section 1860D–15 of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-115">42 U.S.C. 1395w–115</external-xref>) if the individuals were not enrolled in a
			 qualified retiree prescription drug plan. In making such computation, the
			 Secretary shall not take into account the application of the amendments made by
			 section 1202 of the Medicare Prescription Drug, Improvement, and Modernization
			 Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2480).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id26AE19F5506E4270818260B34B52C54C"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This section, and the
			 amendments made by this section, shall take effect on January 1, 2008.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HDE27F9D607C14F29A911FA87E927A62" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Repeal of comparative cost adjustment (cca)
			 program</header><text display-inline="no-display-inline">Subtitle E of title II
			 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003
			 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2214), and the amendments made by such subtitle,
			 are repealed.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H4EACEFBACE0F4D13B9B45BE975A7C9A0" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Repeal of MA Regional Plan Stabilization
			 Fund</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID458CFF35053A44CD814947025FC6E3F2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (e) of section 1858 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-27a">42 U.S.C. 1395w–27a</external-xref>) is repealed.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD40D41DAD5564FDBB0CAD03D0BF6B8D0"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming Amendment</header><text display-inline="yes-display-inline">Section 1858(f)(1) of the Social Security
			 Act (42 U.S.C. 1395w–27a(f)(1)) is amended by striking <quote>subject to
			 subsection (e),</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H960A5FC4E8C54EC182483000F079C6F" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Repeal of cost containment
			 provisions</header><text display-inline="no-display-inline">Subtitle A of title
			 VIII of the Medicare Prescription Drug, Improvement, and Modernization Act of
			 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2357) is repealed and any provisions of law
			 amended by such subtitle are restored as if such subtitle had not been
			 enacted.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idED1A2EC30E6E4F9ABF9D5E4EAFB61841" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Removal of exclusion of benzodiazepines
			 from required coverage under the Medicare prescription drug program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0CEF839F75E14CA194D4D3FB96108E9C"><enum>(a)</enum><header display-inline="yes-display-inline">Removal of exclusion</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H5604E244999E4D0BA1212C123D4DDD20"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1860D–2(e)(2) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)(2)</external-xref>) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H80B579F9086F4E8ABE756EDF60205B68"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>subparagraph (E)</quote>
			 and inserting <quote>subparagraphs (E) and (J)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H83A26C31D3AA4CA4A01E808E84F0819F"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>and
			 benzodiazepines</quote> after <quote>smoking cessation agents</quote>.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7D15821D6C2344509E372D244E195A2D"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 paragraph (1) shall apply to prescriptions dispensed on or after January 1,
			 2008.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9CA43EF90CB64647A3002C00DD3DEDD1"><enum>(b)</enum><header display-inline="yes-display-inline">Review of benzodiazepine prescription
			 policies to assure appropriateness and to avoid abuse</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 shall review the policies of Medicare prescription drug plans (and MA–PD plans)
			 under parts C and D of title XVIII of the Social Security Act regarding the
			 filling of prescriptions for benzodiazepine to ensure that these policies are
			 consistent with accepted clinical guidelines, are appropriate to individual
			 health histories, and are designed to minimize long term use, guard against
			 over-prescribing, and prevent patient abuse.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H40598D64820E49208EA9E481E514EBCB"><enum>(c)</enum><header display-inline="yes-display-inline">Development by medicare quality improvement
			 organizations of educational guidelines for physicians regarding prescribing of
			 benzodiazepines</header><text display-inline="yes-display-inline">The Secretary
			 of Health and Human Services shall provide, in contracts entered into with
			 Medicare quality improvement organizations under part B of title XI of the
			 Social Security Act, for the development by such organizations of appropriate
			 educational guidelines for physicians regarding the prescribing of
			 benzodiazepines.</text>
