			 general</header><text display-inline="yes-display-inline">Section 2104 of the
			 Social Security Act (42 U.S.C. 1397dd) is amended—</text>
					<paragraph id="H3E36D53C54254290AD829FF51DE481CF"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="H774262561065491D8C28B3067E6320D0"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (9);</text>
						</subparagraph><subparagraph id="HF5D2FF7A63E4480898511347C71F8CA4"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (10) and inserting <quote>; and</quote>;
			 and</text>
						</subparagraph><subparagraph id="H7227772F5B4F44229DA8C63B00A9A91"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>

				year 2008 and each subsequent fiscal year, $7,500,000,000 multiplied by the
				population and cost inflation factor for that fiscal year, as determined under
				subsection (i).</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H826F46465F0C42009677141C35D75C1E"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>

							<subsection id="H6F2D53A7B5004A719F1F61F3004B0C"><enum>(i)</enum><header>Population and
				cost inflation factor</header><text display-inline="yes-display-inline">For
				purposes of subsection (a)(11), the population and cost inflation factor for a
				fiscal year is equal to the product of the following:</text>
								<paragraph id="HDD794457710049D580001F201956ABAC"><enum>(1)</enum><header>Child population
				growth factor</header><text>One plus the percentage increase in the population
				of children under 20 years of age in the United States from July 1, 2007, to
				July 1 during the fiscal year involved, as projected by the Secretary based on
				the most recent published estimates of the Bureau of the Census before the
				beginning of the fiscal year involved.</text>
								</paragraph><paragraph id="H05541EC3CDDC4207BFE6DB2F7E65C9CF"><enum>(2)</enum><header>Per capita
				health care growth factor</header><text>One plus the percentage increase in the
				projected per capita amount of National Health Expenditures from fiscal year
				2007 to the fiscal year involved, as most recently published by the Secretary
				before the beginning of the fiscal year
				involved.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idEACC35F7F6D34CD2AD4C9F1E48119F2E"><enum>(b)</enum><header>Additional
			 allotments to territories</header><text>Section 2104(c)(4)(B) of such Act (42
			 U.S.C. 1397dd(c)(4)(B)) is amended by striking <quote>and $40,000,000 for
			 fiscal year 2007</quote> and inserting <quote>$40,000,000 for fiscal year 2007,
			 and for each of fiscal years 2008 through 2017, the amount appropriated under
			 this subparagraph for the preceding fiscal year increased by the population and
			 cost inflation factor for that fiscal year, as determined under subsection
			 (i)</quote>.</text>
				</subsection></section><section display-inline="no-display-inline" id="H728F9D86DA264AFAAC80562241A6439E"><enum>102.</enum><header>2-year initial
			 availability of SCHIP allotments</header><text display-inline="no-display-inline">Section 2104(e) of the Social Security Act
			 (42 U.S.C. 1397dd(e)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H452F9C80602E41058DAF621500FE3F28" style="OLC">
					<subsection id="H175C33E1640A4EE000374C27624D8312"><enum>(e)</enum><header>Availability of
				amounts allotted</header>
						<paragraph id="H82FDFFBACB314013B3722B69CD458ECC"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraphs (2) and (3), amounts
				allotted to a State pursuant to this section—</text>
							<subparagraph id="HDDB7D2E5DD4A41FCB11977451B063777"><enum>(A)</enum><text>for each of fiscal
				years 1998 through 2007, shall remain available for expenditure by the State
				through the end of the second succeeding fiscal year; and</text>
							</subparagraph><subparagraph id="HF69D55BB346C4827B9DFE0EDEB16B34E"><enum>(B)</enum><text>for fiscal year
				2008 and each fiscal year thereafter, shall remain available for expenditure by
				the State through the end of the succeeding fiscal year.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H48E369813279470F9271059B84DA9446"><enum>(2)</enum><header>Availability of
				amounts reallotted</header><text>Subject to paragraph (3), amounts reallotted
				to a State under subsection (f) shall be available for expenditure by the State
				through the end of the fiscal year in which they are reallotted.</text>
						</paragraph><paragraph id="HA6DE1522DC0141F6B4F4F41BC1C743E2"><enum>(3)</enum><header>Permanent
				availability of unused funds</header><text>Reallotted funds that are not used
				by the end of the fiscal year described in paragraph (2) shall be subject to
				reallotment under subsection (f) in subsequent fiscal years subject to such
				paragraph and shall remain available for subsequent reallotment until
				expended.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HFC5F29D9052E4303B242433BEAEA3FE8"><enum>103.</enum><header>Redistribution
			 of unused allotments to address State funding shortfalls</header><text display-inline="no-display-inline">Section 2104(f) of the Social Security Act
			 (42 U.S.C. 1397dd(f)) is amended—</text>
				<paragraph id="HCC443314C4A845F597B56FD3083BF9D7"><enum>(1)</enum><text>by striking
			 <quote>The Secretary</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H40D11643128F4A1E9DC02F1D1FE417B3" style="OLC">
						<paragraph id="HAF051A91106A4F9EAAC2CCD447EF467"><enum>(1)</enum><header>In
				general</header><text>The
				Secretary</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H128047F9EDF3418FAD89249E9F5D9150"><enum>(2)</enum><text>by striking
			 <quote>States that have fully expended the amount of their allotments under
			 this section</quote> and inserting <quote>States that the Secretary determines
			 with respect to the fiscal year for which unused allotments are available for
			 redistribution under this subsection, are shortfall States described in
			 paragraph (2) for such fiscal year</quote>; and</text>
				</paragraph><paragraph id="H185084C1549644D8B83783D4FA51CFB9"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H5F608EE7B81F439CA573E0751600C6B2" style="OLC">
						<paragraph id="H0F136CAD9D674CFF83C00447BCA0A735"><enum>(2)</enum><header>Shortfall states
				described</header>
							<subparagraph id="HBFC363DD091F40D8BFA8D1B44E1F00C8"><enum>(A)</enum><header>In
				general</header><text>For purposes of paragraph (1), with respect to a fiscal
				year, a shortfall State described in this subparagraph is a State with a State
				child health plan approved under this title for which the Secretary estimates
				on the basis of the most recent data available to the Secretary, that the
				projected expenditures under such plan for the State for the fiscal year will
				exceed the sum of—</text>
								<clause id="HF7F170667EB64606948255D830C0B8BA"><enum>(i)</enum><text>the amount of the
				State's allotments for any preceding fiscal years that remain available for
				expenditure and that will not be expended by the end of the immediately
				preceding fiscal year; and</text>
								</clause><clause id="H87B2EFBBD35040A099DF147F413050D1"><enum>(ii)</enum><text>the amount of the
				State's allotment for the fiscal year (taking into account any increase made in
				such allotment under section 2104(j), as added by section 205(a) of the Healthy
				Kids Act of 2007).</text>
								</clause></subparagraph><subparagraph id="H4F8F0B75E82A4FCDB11366B77B862C4C"><enum>(B)</enum><header>Proration
				rule</header><text>If the amounts available for redistribution under paragraph
				(1) for a fiscal year are less than the total amounts of the estimated
				shortfalls determined for the year under subparagraph (A), the amount to be
				reallotted under such paragraph for each shortfall State shall be reduced
				proportionally.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2E3A16737FC3499FAD4B4CC8B18D7CB3"><enum>(C)</enum><header>Retrospective
				adjustment</header><text>The Secretary may adjust the estimates and
				determinations made under paragraph (1) and this paragraph with respect to a
				fiscal year as necessary on the basis of the amounts reported by States not
				later than November 30 of the succeeding fiscal year, as approved by the
				Secretary.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="id29549745AE4545539CFB00AF225D4012"><enum>II</enum><header>State Options
			 for Increasing Coverage of Children and Pregnant Women under Medicaid and SCHIP
			 </header>
			<section id="H907624FF5EEA4E6796AD47F178D252D4"><enum>201.</enum><header>Bonus payments
			 for States that implement administrative policies to streamline enrollment
			 process</header>
				<subsection id="HB67078390AB94D09AD005B61B67938B"><enum>(a)</enum><header>Bonus in FMAP and
			 enhanced FMAP for application of streamline enrollment procedures under
			 Medicaid and SCHIP</header><text>Section 2102 of the Social Security Act (42
			 U.S.C. 1397bb) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H60FCB5FCD6AF4D14AA6729710001397D" style="OLC">
						<subsection id="H92045D25F8CE4E84A400A3907E5E599"><enum>(d)</enum><header>Streamline
				enrollment procedures</header>
							<paragraph id="H00E86AFB862642B8A200054847EDCE5"><enum>(1)</enum><header>Increase in
				Federal matching rate</header>
								<subparagraph id="HA65598759548453D9839C0CF00D362E9"><enum>(A)</enum><header>In
				general</header><text>In the case of a State that meets the conditions
				described in subparagraph (B) (relating to agreeing to implement administrative
				enrollment policies under this title and title XIX) for a fiscal year, the
				Federal medical assistance percentage (for purposes of title XIX only) and the
				enhanced FMAP (for purposes of this title, but determined without regard to the
				application of this subsection to the Federal medical assistance percentage
				under title XIX) otherwise computed for such fiscal year as applied to medical
				assistance for children and child health assistance, respectively, shall be
				increased by such number of percentage points as the Secretary determines is
				necessary to provide an incentive for the State to satisfy the conditions
				described in subparagraph (B) (but not to exceed such number of percentage
				points that would result in a Federal medical assistance percentage or enhanced
				FMAP for the State that would exceed 83 or 85 percent, respectively).</text>
								</subparagraph><subparagraph id="H654DCBBF171E4EEDB136B8141BA4F232"><enum>(B)</enum><header>Agreeing to
				remove enrollment and access barriers</header><text>The conditions described in
				this subparagraph, for a State for a fiscal year are that the State agrees to
				do the following:</text>
									<clause id="HF380E94B45A846CCB62CE44EDC27CE2"><enum>(i)</enum><header>Presumptive
				eligibility for children</header><text display-inline="yes-display-inline">The
				State agrees—</text>
										<subclause id="H3E874AA05E8E4790BF8FCFD18F1CD734"><enum>(I)</enum><text>to provide
				presumptive eligibility for children under this title and title XIX in
				accordance with section 1920A; and</text>
										</subclause><subclause id="H132CB1D928B1477E99F8B1207F16E111"><enum>(II)</enum><text>to treat any
				items or services that are provided to an uncovered child (as defined in
				section 2110(c)(8)) who is determined ineligible for medical assistance under
				title XIX as child health assistance for purposes of paying a provider of such
				items or services, so long as such items or services would be considered child
				health assistance for a targeted low-income child under this title.</text>
										</subclause></clause><clause id="H53CD8E2D73D34C58BD6160BE2F133C46"><enum>(ii)</enum><header>12-month
				continuous eligibility</header><text display-inline="yes-display-inline">The
				State agrees to provide that eligibility of children for assistance under this
				title and title XIX shall not be regularly redetermined more often than once
				every year.</text>
									</clause><clause id="H62857ABB015A4E40AAA5412DDA64C6BC"><enum>(iii)</enum><header>Automatic
				renewal</header><text display-inline="yes-display-inline">The State agrees to
				provide for the automatic renewal of the eligibility of children for assistance
				under this title and under title XIX if the child’s family does not report any
				changes to family income or other relevant circumstances, subject to
				verification of information from databases available to the State for such
				purpose.</text>
									</clause><clause id="H2CB59E1FC3C946A1B72EE5866C1E4454"><enum>(iv)</enum><header>Elimination of
				asset test</header><text display-inline="yes-display-inline">The State has
				amended its plans under this title and title XIX so that no asset or resource
				test is applied for eligibility under this title or title XIX with respect to
				children.</text>
									</clause><clause id="H49D5C0740AC84BFABC98A350250603AF"><enum>(v)</enum><header>Administrative
				verification of income</header><text display-inline="yes-display-inline">The
				State agrees to permit the family of a child applying for child health
				assistance under this title or medical assistance under title XIX to declare
				and certify, by signature under penalty of perjury, the family income for
				purposes of collecting financial eligibility
				information.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6D36338EF21E4386B75E7E279E9850A7"><enum>(b)</enum><header>Conforming
			 Medicaid amendments</header>
					<paragraph id="H43D7DCFE85244C4895674FF56B5CDC94"><enum>(1)</enum><header>In
			 general</header><text>Section 1905(b) of the Social Security Act (42 U.S.C.
			 1396d(b)) is amended by inserting <quote>and section 2102(d)(1)</quote> after
			 <quote>section 1933(d)</quote>.</text>
					</paragraph><paragraph id="H0C9256366AFC4DF8A8FB00144E6B1CE4"><enum>(2)</enum><header>Increase in
			 Medicaid cap for territories</header><text>Section 1108(g) of such Act (42
			 U.S.C. 1308(g)) is amended—</text>
						<subparagraph id="HB2D994B190014624A8B2AA92002CC9E3"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>paragraph (3)</quote> and inserting <quote>paragraphs (3)
			 and (4)</quote>; and</text>
						</subparagraph><subparagraph id="H39AC02A01855429EAB45F6A5DA8DC7E0"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="H746235781D374E9986ACCFFF653318F9" style="OLC">
								<paragraph id="H9DD729D52FDF41C0AD2EE3E97344E756"><enum>(4)</enum><header>Disregard of
				increased expenditures directly attributable to increase in FMAP for
				application of streamlined enrollment procedures</header><text>The limitation
				of paragraph (2) shall not apply to payment under title XIX to a territory
				insofar as such payment is attributable to an increase in the Federal medical
				assistance percentage under subparagraph (A) of section
				2102(d)(1).</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H1D37B14D702A4F9FBEE41EE0277BCE63"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply beginning
			 with fiscal year 2007.</text>
				</subsection></section><section display-inline="no-display-inline" id="H349057E1D1AA464EBC5F6BF9186687D6"><enum>202.</enum><header>State option to
			 provide for <quote>express lane</quote> and simplified determinations of a
			 child’s financial eligibility for medical assistance under Medicaid or child
			 health assistance under SCHIP</header>
				<subsection id="HAF2902D977144C3AA8FAB2352C2E3217"><enum>(a)</enum><header>Medicaid</header><text>Section
			 1902(e) of the Social Security Act (42 U.S.C. 1396a(e)) is amended by adding at
			 the end the following:</text>
					<quoted-block act-name="Social" id="H2AE39F4794DA47049EC318A7EDBAC8EA" style="traditional">
						<paragraph id="H2B3E337A1514428AACBC539841E46EEA" indent="up1"><enum>(13)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HCF15DA95E3F9499B8256E49735B019B5"><enum>(A)</enum><text display-inline="yes-display-inline">At the option of the State, the plan may
				provide that eligibility requirements (including such requirements applicable
				to redeterminations or renewals of eligibility) for medical assistance relating
				to income, assets (or resources), or citizenship status are met for a child who
				is under an age specified by the State (not to exceed 21 years of age) by using
				a determination made within a reasonable period (as determined by the State)
				before its use for this purpose, of the child’s family or household income, or
				if applicable for purposes of determining eligibility under this title or title
				XXI, assets or resources, or citizenship status, respectively, (notwithstanding
				any other provision of law, including sections 1902(a)(46)(B), 1903(x), and
				1137(d)), by a Federal or State agency, or a public or private entity making
				such determination on behalf of such agency, specified by the plan, including
				an agency administering the <act-name parsable-cite="FSA77">State program
				funded under part A of title IV, the Food Stamp Act of 1977</act-name>, the
				Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch
				Act</act-name>, or the <act-name parsable-cite="CNA66">Child Nutrition Act of
				1966</act-name>, notwithstanding any differences in budget unit, disregard,
				deeming, or other methodology, but only if—</text>
								<clause id="H7F606444AB694A36B1A2A4B0D8F1D7A" indent="up1"><enum>(i)</enum><text>the agency has fiscal liabilities or
				responsibilities affected by such determination; and</text>
								</clause><clause display-inline="no-display-inline" id="H7EEB4DA6A28E4DFD8EA2F48411A98DB4" indent="up1"><enum>(ii)</enum><text>the agency or entity notifies the
				child's family—</text>
									<subclause id="H73B5063DA10446BF80FBB151D37AB10"><enum>(I)</enum><text>of the information which shall be
				disclosed in accordance with this subparagraph;</text>
									</subclause><subclause id="HEFF4F0CA399749B7A49B1EAABB3110F4"><enum>(II)</enum><text>that the information disclosed
				will be used solely for purposes of determining eligibility for medical
				assistance under this title or for child health assistance under title XXI;
				and</text>
									</subclause><subclause id="H3D5C6B0539684FFE9507BD02229C2117"><enum>(III)</enum><text>that interagency agreements limit
				the use of such information to that purpose; and</text>
									</subclause></clause><clause id="H466F78BA9D1D40F28BECD4120ABDF5E" indent="up1"><enum>(iii)</enum><text>the requirements of section 1939 are
				satisfied.</text>
								</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H9C800920CDC7412D92F270A6A5E5ADBD" indent="up1"><enum>(B)</enum><text>Nothing in this paragraph shall be
				construed to relieve a State of the obligation to determine, on another basis,
				eligibility for medical assistance under this title or for child health
				assistance under title XXI if a child is determined ineligible for such
				assistance on the basis of information furnished pursuant to this
				paragraph.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H6C8FC5CCD4A948A4918527055CD74DDF" indent="up1"><enum>(C)</enum><text>If a State applies the eligibility
				process described in subparagraph (A) to individuals eligible under this title
				and to individuals eligible under title XXI, the State may, at its option,
				implement its duties under subparagraphs (A) and (B) of section 2102(b)(3)
				using either or both of the following approaches:</text>
								<clause id="HADF8800D95D5416ABA85DC1C685FD9F0"><enum>(i)</enum><text>The State may—</text>
									<subclause id="H1CA001EFBB534940873D9297792C61C5"><enum>(I)</enum><text>establish a threshold percentage of
				the Federal poverty level (that shall exceed the income eligibility level
				applicable for a population of individuals under this title by 30 percentage
				points (as a fraction of the Federal poverty level) or such other higher number
				of percentage points as the State determines reflects the typical application
				of income methodologies by the non-health program and the State plan under this
				title); and</text>
									</subclause><subclause id="H32F4E3E1CC4E4D689DDA4ED708157719"><enum>(II)</enum><text>provide that, with respect to any
				individual within such population whom a non-health agency determines has
				income that does not exceed such threshold percentage for such population, such
				individual is eligible for medical assistance under this title (regardless of
				whether such individual would otherwise be determined to be eligible to receive
				such assistance).</text>
									</subclause><continuation-text continuation-text-level="clause">In exercising
				the approach under this clause, a State shall inform families whose children
				are enrolled in a State child health plan under title XXI based on having
				family income above the threshold described in subclause (I) that they may
				qualify for medical assistance under this title and, at their option, can seek
				a regular eligibility determination for such assistance for their child.</continuation-text></clause><clause id="HE193F714F4E64E1CAE556F91F9CE0000"><enum>(ii)</enum><text>Regardless of whether a State
				otherwise provides for presumptive eligibility under section 1920A, a State may
				provide presumptive eligibility under this title, consistent with subsection
				(e) of section 1920A, to a child who, based on a determination by a non-health
				agency, would qualify for child health assistance under a State child health
				plan under title XXI. During such presumptive eligibility period, the State may
				determine the child’s eligibility for medical assistance under this title,
				pursuant to subparagraph (A) of section 2102(b)(3), based on telephone contact
				with family members, access to data available in electronic or paper form, and
				other means of gathering information that are less burdensome to the family
				than completing an application form on behalf of the child. The procedures
				described in the previous sentence may be used regardless of whether the State
				uses similar procedures under other circumstances for purposes of determining
				eligibility for medical assistance under this title.</text>
								</clause></subparagraph><subparagraph id="H27963C1952BD4791BEF13F1B87B9FA01" indent="up1"><enum>(D)</enum><text>At the option of a State, the
				eligibility process described in subparagraph (A) may apply to an individual
				who is not a child.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="HCAF4474042B147BC96D380451ECC802C" indent="up1"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="HC08B264FD4A248A28995E8019D150000"><enum>(i)</enum><text>At the option of a
				State, an individual determined to be eligible for medical assistance or child
				health assistance pursuant to subparagraph (A), (C), or (D) or other procedures
				through which eligibility is determined based on data obtained from sources
				other than the individual may receive medical assistance under this title if
				such individual (or, in the case of an individual under age 19 (or if the State
				elects the option under subparagraph (A), age 20 or 21) who is not authorized
				to consent to medical care, the individual’s parent, guardian, or other
				caretaker relative) has acknowledged notice of such determination and has
				consented to such eligibility determination. The State (at its option) may
				waive any otherwise applicable requirements for signatures by or on behalf of
				an individual who has so consented.</text>
								</clause><clause id="H8313E249BE474D8FB900512710DD92A1" indent="up1"><enum>(ii)</enum><text>In the case of an individual
				enrolled pursuant to clause (i), the State shall inform the individual (or, in
				the case of an individual under age 19 (or if the State elects the option under
				subparagraph (A), age 20 or 21), the individual’s parent, guardian, or other
				caretaker relative) about the significance of such enrollment, including
				appropriate methods to access covered services.</text>
								</clause></subparagraph><subparagraph id="H9F2012A9EE574193A5D4AD14B33892D6" indent="up1"><enum>(F)</enum><text>For purposes of this
				paragraph—</text>
								<clause id="HA2F00A1D8752452BB7BDBE1B95F8DB36"><enum>(i)</enum><text>the term <term>non-health
				agency</term> means an agency or entity described in subparagraph (A);
				and</text>
								</clause><clause id="HFE58C9BAAD764F5196FFABFBA9FEB078"><enum>(ii)</enum><text>the term <term>non-health
				benefits</term> means the benefits or assistance provided by a non-health
				agency.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HD5B4C606DEF54D5DB08C3065E8A727DB"><enum>(b)</enum><header>SCHIP</header><text display-inline="yes-display-inline">Section 2107(e)(1) of such Act (42 U.S.C.
			 1397gg(e)(1)) is amended by redesignating subparagraphs (B) through (E) as
			 subparagraphs (C) through (F) and by inserting after subparagraph (B) the
			 following new subparagraph:</text>
					<quoted-block act-name="Social" id="H21B35A4E7206422B86368C899CD33F55">
						<subparagraph id="H3A093E8EFE474A969002A3C546FA00E1"><enum>(C)</enum><text>Section
				1902(e)(13) (relating to the State option to base a determination of a child's
				eligibility for assistance on determinations made by a program providing
				nutrition or other public assistance (except that the State option under
				subparagraph (D) of such section shall apply under this title only if an
				individual is
				pregnant)).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H2EA0DC3DAAA1436F91895224DCB90069"><enum>(c)</enum><header>Presumptive
			 eligibility</header><text>Section 1920A of such Act (42 U.S.C. 1396r–1a) is
			 amended—</text>
					<paragraph id="H4AF47F286F514B209E8B9035CE219398"><enum>(1)</enum><text>in subsection
			 (b)(3)(A)(i), is amended by striking <quote>or (IV)</quote> and inserting
			 <quote>(IV) is an agency or entity described in section 1902(e)(13)(A), or
			 (V)</quote>; and</text>
					</paragraph><paragraph id="H3CD8CB2666ED4A97946B8436EFC2D78"><enum>(2)</enum><text>by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9618E268C2464E82B5BA7FC2FF7E5B91" style="OLC">
							<subsection id="H3265ADDD308549C384489CFF30CB7E6C"><enum>(e)</enum><text>In the case of a
				State with a child health plan under title XXI that provides for presumptive
				eligibility under such plan for children, the State shall make a reasonable
				effort to place each presumptively eligible child in the program under this
				title or title XXI for which the child appears most likely to qualify. During
				the child's period of presumptive eligibility, the State shall receive Federal
				matching funds under section 1903 or section 2105, depending on the program in
				which the child has been placed. If at the conclusion of such period, the child
				is found to qualify for, and is enrolled in, the program established under this
				title or title XXI when the child was enrolled in the program under the other
				such title during such period, the State’s receipt of Federal matching funds
				shall be adjusted both retroactively and prospectively so that Federal matching
				funds are provided, both during and following such period of presumptive
				eligibility, based on the program in which the child is
				enrolled.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H9237A4E89670401091489E92B55C03F8"><enum>(d)</enum><header>Signature
			 requirements</header><text>Section 1902(a) of such Act (42 U.S.C. 1396a(a)) is
			 amended by adding at the end the following: “Notwithstanding any other
			 provision of law, a signature under penalty of perjury shall not be required on
			 an application form for medical assistance as to any element of eligibility for
			 which eligibility is based on information received from a source other than
			 applicant, rather than on representations from the applicant. Notwithstanding
			 any other provision of law, any signature requirement for an application for
			 medical assistance may be satisfied through an electronic signature, as defined
			 in section 1710(1) of the Government Paperwork Elimination Act (44 U.S.C. 3504
			 note).”.</text>
				</subsection></section><section display-inline="no-display-inline" id="HAD1B87AB12F14D178B2F5410D7B66207"><enum>203.</enum><header>Information
			 technology connections to improve health coverage determinations</header>
				<subsection id="HF5452EA12A16429A00A508ECE7B54C00"><enum>(a)</enum><header>Enhanced federal
			 funding for improvements related to implementation of certain model outreach
			 and enrollment practices</header>
					<paragraph id="H55A6F610CE4C4FDC9B46585FDDCE89B6"><enum>(1)</enum><header>In
			 general</header><text>Section 1903(a)(3)(A) of the Social Security Act (42
			 U.S.C. 1396b(a)(3)(A)) is amended—</text>
						<subparagraph id="H398CC7E089E7405CB8B3FB7883CEC345"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of clause (i); and</text>
						</subparagraph><subparagraph id="HE917E01B8966457E88EEEC4C7C001FC5"><enum>(B)</enum><text>by adding at the
			 end the following new clause:</text>
							<quoted-block display-inline="no-display-inline" id="HB61C8FB92CF74C3B8F5F6FF1661A89D" style="traditional">
								<clause id="HA8BA494584664DA6917577D587890447" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">75 percent of so much of the sums expended
				during such quarter as are attributable to the design, development, or
				installation of such mechanized claims processing and information retrieval
				systems and the implementation of administrative systems and processes
				(including modification of eligibility computer systems to permit the exchange
				of electronic information with other Federal or State programs) as the
				Secretary determines are directly related to the implementation of a model
				outreach and enrollment practice described in subparagraph (B), (C), (D), (E),
				or (F) of section 1905(y)(3),
				and</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H55096CC56FD34F739B992CCA2895F801"><enum>(2)</enum><header>Conforming
			 amendment to ensure availability for territories</header><text>Section 1108(g)
			 of such Act (42 U.S.C. 1308(g)), as amended by section 201(b)(2)(B), is
			 amended—</text>
						<subparagraph id="HF7E77843702545B08951D7C26391D5A5"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>and (4)</quote> and inserting <quote>, (4), and (5)</quote>;
			 and</text>
						</subparagraph><subparagraph id="H8450E7E5856E408A85E156786F5D379"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>

				increase for certain expenditures</header><text>With respect to fiscal year
				2008 and each fiscal year thereafter, if Puerto Rico, the Virgin Islands, Guam,
				the Northern Mariana Islands, or American Samoa qualify for a payment under
				section 1903(a)(3)(A)(iii) for a calendar quarter of such fiscal year, the
				additional Federal financial participation under such section shall not be
				counted towards the limitation on expenditures under title XIX for such
				commonwealth or territory otherwise determined under subsection (f) and this
				subsection for such fiscal
				year.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H951E64463F414D0FA4013639D0F9B630"><enum>(b)</enum><header>Authorization of
			 information disclosure</header>
					<paragraph id="HEF71FF950F834182A0B594B0E308E94"><enum>(1)</enum><header>In
			 general</header><text>Title XIX of such Act (42 U.S.C. 1396 et seq.) is
			 amended—</text>
						<subparagraph id="H72F4B52568D94549AD3E2E8638537D5F"><enum>(A)</enum><text>by redesignating
			 section 1939 as section 1940; and</text>
						</subparagraph><subparagraph id="H1D1D051CF7C545A9BD5580DDFC3D1C00"><enum>(B)</enum><text>by inserting after
			 section 1938 the following:</text>

				general</header><text>Notwithstanding any other provision of law, a Federal or
				State agency or private entity in possession of the sources of data potentially
				pertinent to eligibility determinations under this title or title XXI
				(including eligibility files maintained by programs described in section
				1902(e)(13)(A), information described in paragraph (2) or (3) of section
				1137(a), vital records information about births in any State, and information
				described in sections 453(i) and 1902(a)(25)(I)) is authorized to convey such
				data or information to a State agency administering a State plan under this
				title or title XXI, if—</text>
										<paragraph id="H392A9AC41E2C4931B53EA8F2BDE071EC"><enum>(1)</enum><text>such data or
				information are used only to establish or verify eligibility or provide
				coverage under this title or title XXI; and</text>
										</paragraph><paragraph id="HCE2A1531073D4D5F944B611C64D42C12"><enum>(2)</enum><text>an interagency or
				other agreement, consistent with standards developed by the Secretary, prevents
				the unauthorized use, disclosure, or modification of such data and otherwise
				meets applicable Federal requirements safeguarding privacy and data
				security.</text>
										</paragraph></subsection><subsection id="H0606E14469434DE088E000A3B1735BF2"><enum>(b)</enum><header>Requirements for
				conveyance</header><text>Data or information may be conveyed pursuant to this
				section only if the following requirements are met:</text>
										<paragraph id="H80B4018F7E894E98BB1E5EA297ABAD8B"><enum>(1)</enum><text>The individual
				whose circumstances are described in the data or information (or such
				individual’s parent, guardian, caretaker relative, or authorized
				representative) has either provided advance consent to disclosure or has not
				objected to disclosure after receiving advance notice of disclosure and a
				reasonable opportunity to object.</text>
										</paragraph><paragraph id="HBC16A6CCB48D4FB88FBF39083046DCB4"><enum>(2)</enum><text>Such data or
				information are used solely for the purposes of—</text>
											<subparagraph id="H2FB27547CBFE4DB28FE62CAB4D5333F"><enum>(A)</enum><text>identifying
				individuals who are eligible or potentially eligible for assistance under this
				title or title XXI and enrolling such individuals in the State plans
				established under such titles; and</text>
											</subparagraph><subparagraph id="HCDA39202D84443D183321B3C66A60394"><enum>(B)</enum><text>verifying the
				eligibility of individuals for assistance under the State plans established
				under this title or title XXI.</text>
											</subparagraph></paragraph><paragraph id="H14B8AB0602F34E69BD38182D10B2BB59"><enum>(3)</enum><text>An interagency or
				other agreement, consistent with standards developed by the Secretary—</text>
											<subparagraph id="H94F2F86A31AA4C40897BB58C35155592"><enum>(A)</enum><text>prevents the
				unauthorized use, disclosure, or modification of such data and otherwise meets
				applicable Federal requirements safeguarding privacy and data security;
				and</text>
											</subparagraph><subparagraph id="HCF51FA4B6532412190D44FCDDD82BD34"><enum>(B)</enum><text>requires the State
				agencies administering the State plans established under this title and title
				XXI to use the data and information obtained under this section to seek to
				enroll individuals in such plans.</text>
											</subparagraph></paragraph></subsection><subsection id="HBBA503776F1C441697A2C213A0C92488"><enum>(c)</enum><header>Criminal
				penalty</header><text>A person described in the subsection (a) who publishes,
				divulges, discloses, or makes known in any manner, or to any extent not
				authorized by Federal law, any information obtained under this section shall be
				fined not more than $1,000 or imprisoned not more than 1 year, or both for each
				such unauthorized activity.</text>
									</subsection><subsection id="H86EDA983348640EAAAC51BA86FC03BEF"><enum>(d)</enum><header>Rule of
				construction</header><text>The limitations and requirements that apply to
				disclosure pursuant to this section shall not be construed to prohibit the
				conveyance or disclosure of data or information otherwise permitted under
				Federal law (without regard to this
				section).</text>
									</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H77C6C7D1151C47DCBAD8489995483727"><enum>(2)</enum><header>Conforming
			 amendment to assure access to national new hires database</header><text>Section
			 453(i)(1) of such Act (42 U.S.C. 653(i)(1)) is amended by striking <quote>and
			 programs funded under part A</quote> and inserting <quote>, programs funded
			 under part A, and State plans approved under title XIX or XXI</quote>.</text>
					</paragraph><paragraph id="H8B07951A129A40A39BF061365880C568"><enum>(3)</enum><header>Conforming
			 amendment to provide schip programs with access to national income
			 data</header><text>Section 6103(l)(7)(D)(ii) of the Internal Revenue Code of
			 1986 is amended by inserting <quote>or title XXI</quote> after <quote>title
			 XIX</quote>.</text>
					</paragraph><paragraph id="HB5AF4EBC9E7E42D1B482EABA86091FD2"><enum>(4)</enum><header>Conforming
			 amendment to provide access to data about enrollment in insurance for purposes
			 of evaluating applications and for SCHIP</header><text>Section
			 1902(a)(25)(I)(i) of the Social Security Act (42 U.S.C. 1396a(a)(25)(I)(i)) is
			 amended—</text>
						<subparagraph id="HD2283FFF43EB4E8C85FC46A23B156ECB"><enum>(A)</enum><text>by inserting
			 <quote>(and, at State option, individuals who are potentially eligible or who
			 apply)</quote> after <quote>with respect to individuals who are
			 eligible</quote>; and</text>
						</subparagraph><subparagraph id="H920A2C7BFD4043F9A6F354724F3674F0"><enum>(B)</enum><text>by inserting
			 <quote>under this title (and, at State option, child health assistance under
			 title XXI)</quote> after <quote>the State plan</quote>.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID7AEFC9E3E0CD4207A936CB2C8F9284AF" section-type="subsequent-section"><enum>204.</enum><header>State option to
			 expand or add coverage of certain pregnant women under medicaid and
			 SCHIP</header>

			 matching funds available if certain conditions met</header><text display-inline="yes-display-inline">Section
			 1905 of such Act (42 U.S.C. 1396d) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDCB941D8A32514B948846F7F7CD9F30B4"><enum>(A)</enum><text display-inline="yes-display-inline">in the fourth sentence of subsection (b),

									<paragraph commented="no" display-inline="no-display-inline" id="ID64999B69B85D41488F5871170982F9DA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of the fourth sentence of
				subsection (b) and section 2105(a), the expenditures described in this
				paragraph are the following:</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="ID040D840902AA43A19E31CC931D6044E5"><enum>(A)</enum><header>Certain pregnant women</header><text display-inline="yes-display-inline">If the conditions described in subparagraph
				(B) are met, expenditures for medical assistance for pregnant women described
				in subsection (n) or in section 1902(l)(1)(A) in a family the income of which
				exceeds 185 percent of the poverty line, but does not exceed the income
				eligibility level established under title XXI for a targeted low-income
				child.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID36DE91E4FFCA4CC996FA782E68A46387"><enum>(B)</enum><header>Conditions</header><text display-inline="yes-display-inline">The conditions described in this
				subparagraph are the following:</text>
											<clause commented="no" display-inline="no-display-inline" id="ID90DE8AEE6CA74D4000AF49E26410F901"><enum>(i)</enum><text display-inline="yes-display-inline">The State plans under this title and title
				XXI do not provide coverage for pregnant women described in subparagraph (A)
				with higher family income without covering such pregnant women with a lower
				family income.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="ID31D099FDDDF947CD8F2197F29FB1FD41"><enum>(ii)</enum><text display-inline="yes-display-inline">The State does not apply an effective
				income level for pregnant women that is lower than the effective income level
				(expressed as a percent of the poverty line and considering applicable income
				disregards) specified under the State plan under subsection (a)(10)(A)(i)(III)
				or (l)(2)(A) of section 1902, on the date of enactment of this paragraph to be
				eligible for medical assistance as a pregnant woman.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID662820B1713E48BE8CACA3B756226C32"><enum>(C)</enum><header>Definition of poverty
				line</header><text display-inline="yes-display-inline">In this subsection, the
				term <term>poverty line</term> has the meaning given such term in section
				2110(c)(5).</text>
										</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD58943F956DC42CAADA670B1A1B4F04C"><enum>(3)</enum><header>Payment from
			 title XXI allotment for medicaid expansion costs</header><text display-inline="yes-display-inline">Section 2105(a)(1) of such Act (42 U.S.C.
			 1397ee(a)(1)), as amended by section 211, is amended by striking subparagraph
			 (B) and inserting the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="ID01268C93CD7F482B86C07C05414CB64D" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="IDE96D9E3F12E84A1CBE79F3B89DB86FC4"><enum>(B)</enum><text display-inline="yes-display-inline">for the portion of the payments made for
				expenditures described in section 1905(u)(4)(A) that represents the additional
				amount paid for such expenditures as a result of the enhanced FMAP being
				substituted for the Federal medical assistance percentage of such
				expenditures;</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID43BD412A80C24C46A2726431BE14F470"><enum>(b)</enum><header>CHIP</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID732CBE73A47E4651A97BC647D900A84C"><enum>(1)</enum><header>Coverage</header><text display-inline="yes-display-inline">Title XXI of such Act(42 U.S.C. 1397aa et
			 seq.) is amended by adding at the end the following new section:</text>
						<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="ID5FD3632BD2A74E9DA0F8C6CBBCFC1D00" style="OLC">
							<section commented="no" display-inline="no-display-inline" id="IDD7AF655DC13C4C9F9048A8CE43E6F120" section-type="subsequent-section"><enum>2111.</enum><header>Optional coverage
				of targeted low-income pregnant women</header>
								<subsection commented="no" display-inline="no-display-inline" id="ID82ECD28FE79A4984A2F08F78A085E8CF"><enum>(a)</enum><header>Optional
				coverage</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this title, a State may provide for coverage, through an
				amendment to its State child health plan under section 2102, of
				pregnancy-related assistance for targeted low-income pregnant women in
				accordance with this section, but only if—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID3FA989589425420B91FDA32900F3AE1D"><enum>(1)</enum><text display-inline="yes-display-inline">the State has established an income
				eligibility level for pregnant women under subsection (a)(10)(A)(i)(III) or
				(l)(2)(A) of section 1902 that is at least 185 percent of the income official
				poverty line; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4CF9BDFF56F54C36AB94F9AE09AE99D9"><enum>(2)</enum><text display-inline="yes-display-inline">the State meets the conditions described in
				section 1905(u)(4)(B).</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB8D94856B2FD4C4F91A2E7E17F8B83C4"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this title:</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID36EC781FC4754B7999D9D82F1BCE3205"><enum>(1)</enum><header>Pregnancy-related
				assistance</header><text display-inline="yes-display-inline">The term
				<term>pregnancy-related assistance</term> has the meaning given the term
				<term>child health assistance</term> in section 2110(a) as if any reference to
				targeted low-income children were a reference to targeted low-income pregnant
				women.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0520FB790D5A4321A48B3C401600D1F5"><enum>(2)</enum><header>Targeted
				low-income pregnant woman</header><text display-inline="yes-display-inline">The
				term <term>targeted low-income pregnant woman</term> means a woman—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="ID381C34808AA74E20951094E04E67C57F"><enum>(A)</enum><text display-inline="yes-display-inline">during pregnancy and through the end of the
				month in which the 60-day period (beginning on the last day of her pregnancy)
				ends;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8D614DFA375B4F5EBB616F6C6E1E94E7"><enum>(B)</enum><text display-inline="yes-display-inline">whose family income exceeds the effective
				income level (expressed as a percent of the poverty line and considering
				applicable income disregards) specified under subsection (a)(10)(A)(i)(III) or
				(l)(2)(A) of section 1902, on January 1, 2008, to be eligible for medical
				assistance as a pregnant woman under title XIX but does not exceed the income
				eligibility level established under the State child health plan under this
				title for a targeted low-income child; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA5EEEC26DD184F188751E0A300070075"><enum>(C)</enum><text display-inline="yes-display-inline">who satisfies the requirements of
				paragraphs (1)(A), (1)(C), (2), and (3) of section 2110(b) in the same manner
				as a child applying for child health assistance would have to satisfy such
				requirements.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA008ECDA547B4260B91C71EFA1E0FDF0"><enum>(c)</enum><header>References to
				terms and special rules</header><text display-inline="yes-display-inline">In
				the case of, and with respect to, a State providing for coverage of
				pregnancy-related assistance to targeted low-income pregnant women under
				subsection (a), the following special rules apply:</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID321E59612CAB4467ADBB06A52E8C5598"><enum>(1)</enum><text display-inline="yes-display-inline">Any reference in this title (other than in
				subsection (b)) to a targeted low-income child is deemed to include a reference
				to a targeted low-income pregnant woman.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCB5720A612684A0C99CF693CB2C1B6EF"><enum>(2)</enum><text display-inline="yes-display-inline">Any such reference to child health
				assistance with respect to such women is deemed a reference to
				pregnancy-related assistance.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID27BB6336EAD540EBA0C953E9742DCF15"><enum>(3)</enum><text display-inline="yes-display-inline">Any such reference to a child is deemed a
				reference to a woman during pregnancy and the period described in subsection
				(b)(2)(A).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75C95DEC2C0B4199B8A76E9CA2396692"><enum>(4)</enum><text display-inline="yes-display-inline">In applying section 2102(b)(3)(B), any
				reference to children found through screening to be eligible for medical
				assistance under the State Medicaid plan under title XIX is deemed a reference
				to pregnant women.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8559949E7E6543E897E0A3B913C1BCC1"><enum>(5)</enum><text display-inline="yes-display-inline">There shall be no exclusion of benefits for
				services described in subsection (b)(1) based on any preexisting condition and
				no waiting period (including any waiting period imposed to carry out section
				2102(b)(3)(C)) shall apply.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF34EFAA3FAAE4509ACC56E51D9C96803"><enum>(6)</enum><text display-inline="yes-display-inline">In applying section 2103(e)(3)(B) in the
				case of a pregnant woman provided coverage under this section, the limitation
				on total annual aggregate cost sharing shall be applied to such pregnant
				woman.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID504E12078EF74B8698FC3BFCCFD44ECE"><enum>(7)</enum><text display-inline="yes-display-inline">The reference in section 2107(e)(1)(F) to
				section 1920A (relating to presumptive eligibility for children) is deemed a
				reference to section 1920 (relating to presumptive eligibility for pregnant
				women).</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9F11AD5F77784CDAB615134F8E075742"><enum>(d)</enum><header>Automatic
				enrollment for children born to women receiving Pregnancy-Related
				assistance</header><text display-inline="yes-display-inline">If a child is born
				to a targeted low-income pregnant woman who was receiving pregnancy-related
				assistance under this section on the date of the child’s birth, the child shall
				be deemed to have applied for child health assistance under the State child
				health plan and to have been found eligible for such assistance under such plan
				or to have applied for medical assistance under title XIX and to have been
				found eligible for such assistance under such title, as appropriate, on the
				date of such birth and to remain eligible for such assistance until the child
				attains 1 year of age. During the period in which a child is deemed under the
				preceding sentence to be eligible for child health or medical assistance, the
				child health or medical assistance eligibility identification number of the
				mother shall also serve as the identification number of the child, and all
				claims shall be submitted and paid under such number (unless the State issues a
				separate identification number for the child before such period
				expires).</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID28A27A0EE98C42C5B0FC61B2BA001B58"><enum>(2)</enum><header>Additional
			 conforming amendments</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID2F3C732C48414F14A23E309F53003F4E"><enum>(A)</enum><header>No cost sharing
			 for pregnancy-related benefits</header><text display-inline="yes-display-inline">Section 2103(e)(2) (42 U.S.C. 1397cc(e)(2))
			 is amended—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID5479183C43C24FAB914C30C967D5002B"><enum>(i)</enum><text display-inline="yes-display-inline">in the heading, by inserting
			 <quote><header-in-text level="paragraph" style="OLC">or pregnancy-related
			 services</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">preventive services</header-in-text></quote>;
			 and</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID900C71B656A04D8899D0225F4C4912A2"><enum>(B)</enum><header>No waiting
			 period</header><text display-inline="yes-display-inline">Section 2102(b)(1)(B)
			 (42 U.S.C. 1397bb(b)(1)(B)) is amended—</text>

			 a newborn</header><text display-inline="yes-display-inline">Section 1902(e)(4)
			 (42 U.S.C. 1396a(e)(4)) is amended in the first sentence by striking <quote>so
			 long as the child is a member of the woman’s household and the woman remains
			 (or would remain if pregnant) eligible for such assistance</quote>.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9E9525603B7B4B908F1082433D02E083"><enum>(2)</enum><header>Application of
			 qualified entities to presumptive eligibility for pregnant women under

			 legal immigrants under Medicaid and SCHIP</header>
				<subsection id="H85960A3292E244ABB7B132CDDC45E260"><enum>(a)</enum><header>Medicaid
			 program</header><text>Section 1903(v) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1396b(v)) is
			 amended—</text>
					<paragraph id="H8CA739DEB98747AF800086FBA3E689C7"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2)
			 and (4)</quote>; and</text>
					</paragraph><paragraph id="HB7EA0299C6CF424B96009F4E6F700018"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block id="H7792C68E491C400EADA8B4541FF71570">
							<paragraph id="HE2307DAF537A4FF0B6C51102DC3DACEE" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5DA4127CC308477B89812E2FF521B4A4"><enum>(A)</enum><text>A State may elect (in a
				plan amendment under this title) to provide medical assistance under this
				title, notwithstanding sections 401(a), 402(b), 403, and 421 of the Personal
				Responsibility and Work Opportunity Reconciliation Act of 1996, for aliens who
				are lawfully residing in the United States (including battered aliens described
				in section 431(c) of such Act) and who are otherwise eligible for such
				assistance, within either or both of the following eligibility
				categories:</text>
									<clause id="H85883A20738F4F6DB89E6E88D86BFD74" indent="up1"><enum>(i)</enum><header>Pregnant women</header><text>Women
				during pregnancy (and during the 60-day period beginning on the last day of the
				pregnancy).</text>
									</clause><clause id="HE73E275F0B4B4C2ABA19B4D0E4ED247E" indent="up1"><enum>(ii)</enum><header>Children</header><text display-inline="yes-display-inline">Individuals under 21 years of age,
				including optional targeted low-income children described in section
				1905(u)(2)(B).</text>
									</clause></subparagraph><subparagraph id="H28397E68921C429B009066C2DE498051" indent="up1"><enum>(B)</enum><text>In the case of a State that has
				elected to provide medical assistance to a category of aliens under
				subparagraph (A), no debt shall accrue under an affidavit of support against
				any sponsor of such an alien on the basis of provision of assistance to such
				category and the cost of such assistance shall not be considered as an
				unreimbursed
				cost.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0D0DEA3459A4404186158E05F59FC6EF"><enum>(b)</enum><header>SCHIP</header><text>Section
			 2107(e)(1) of such Act (42 U.S.C. 1397gg(e)(1)), as amended by section 202(b),
			 is amended by redesignating subparagraphs (D) and (E) as subparagraph (E) and
			 (F), respectively, and by inserting after subparagraph (C) the following new
			 subparagraph:</text>
					<quoted-block id="H581408F64A7343168C85733D102E786B">
						<subparagraph id="HA236BBEF7AEF423CB22E8E60C6122754"><enum>(D)</enum><text>Section 1903(v)(4)
				(relating to optional coverage of categories of lawfully residing immigrant
				children), but only if the State has elected to apply such section to the
				category of children under title
				XIX.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H34AE89B3B3C541BDB5E0A6D047B998C4"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section take effect on October
			 1, 2007, and apply to medical assistance and child health assistance furnished
			 on or after such date.</text>
				</subsection><subsection id="H4CBA433CBB594E3100DEB01A39B13F"><enum>(d)</enum><header>Construction</header><text>Nothing
			 in this section shall be construed as affecting eligibility of aliens who are
			 not lawfully residing in the United States to benefits under the Medicaid
			 program under title XIX of the Social Security Act or under the State
			 children’s health insurance program (SCHIP) under title XXI of such Act.</text>
				</subsection></section><section id="H9BE6D968C9FA4ECE94D5EE8EB117B99B"><enum>206.</enum><header>Authorizing
			 adjustment of SCHIP allotment due to increased outreach</header>
				<subsection id="HD8F895B7D40140A7910940F4C5C16396"><enum>(a)</enum><header>In
			 general</header><text>Section 2104 of the Social Security Act (42 U.S.C.
			 1397dd), as amended by section 101, is further amended by adding at the end the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H4090619258144814B13958B47A5D08E" style="OLC">
						<subsection id="H4BA083111A6144D98DC519A938B53B55"><enum>(j)</enum><header>Authorizing
				allotment adjustment due to increased outreach</header>
							<paragraph id="H358DA0A9EC1E4328953F18E2CEB8122"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding the previous provisions of this section,
				if the Secretary determines that—</text>
								<subparagraph id="H5A62DCC1D8D441F28B13E5A078281570"><enum>(A)</enum><text>a State has an
				increase in the average number of children enrolled under its State child
				health plan in a fiscal year that exceeds the enrollment of children projected
				under paragraph (2) for the State for such fiscal year, and</text>
								</subparagraph><subparagraph commented="no" id="H8791323FBFE64228B77D5BAD30C519BD"><enum>(B)</enum><text display-inline="yes-display-inline">the total Federal expenditures under the
				State child health plan (or waiver) under this title exceeds the amount of the
				allotment made available to the State for the fiscal year,</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">the
				Secretary shall increase the allotment under this section for the State for the
				fiscal year by the amount specified in paragraph (3). There are hereby
				appropriated, out of any money in the Treasury not otherwise appropriated, such
				sums as may be necessary to provide for such increase in allotment.</continuation-text></paragraph><paragraph id="H094FE883A3784E309F864F4D4615BECC"><enum>(2)</enum><header>Projected
				enrollment of children</header><text>The projected enrollment of children for a
				State under this paragraph for a fiscal year is equal to the average number of
				children enrolled under the State child health plan in fiscal year 2007
				increased, for each subsequent fiscal year through the fiscal year involved, by
				a factor equal to the population growth of children in the State for such
				fiscal year, as projected by the Secretary before the beginning of the fiscal
				year involved.</text>
							</paragraph><paragraph id="H8F990D26D690462CA9FA29250407113E"><enum>(3)</enum><header>Amount of
				allotment increase</header>
								<subparagraph id="HCD8329AB91F94121834BE8D038CE8800"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B), the amount of the allotment increase under this subsection
				for a State for a fiscal year shall be an amount equal to the product
				of—</text>
									<clause id="H7E0FAA18DE40432AB500064175C6144E"><enum>(i)</enum><text display-inline="yes-display-inline">the number by which the average number of
				children enrolled under the State child health plan in the fiscal year exceeds
				the enrollment of children projected under paragraph (2) for such State for
				such fiscal year; and</text>
									</clause><clause id="HCEB39D36977B4DB4823BA35D4DCE87D9"><enum>(ii)</enum><text>the per capita
				expenditures for children under the State child health plan for the previous
				year, increased by the average annual rate of increase (for the three previous
				fiscal years) in the amount of such per capita expenditures.</text>
									</clause><continuation-text continuation-text-level="subparagraph">The
				amount of the allotment increase under this subsection shall not be subject to
				administrative or judicial review.</continuation-text></subparagraph><subparagraph id="HB934C0E29D154D238C17AC299486F4D"><enum>(B)</enum><header>Limitation</header>
									<clause id="H4202EE135F4348AFA0DD1C4EF9B12515"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), in no case shall the sum of the
				allotment increases for all States under this subsection for a fiscal year
				exceed an amount equal to 20 percent of the total Federal payments to all of
				the States otherwise made under this title for the fiscal year. If such sum
				exceeds such amount, subject to clause (ii), the allotment increase for each
				State under this subsection for the fiscal year shall be reduced in a pro rata
				manner in order that such sum does not exceed such amount.</text>
									</clause><clause id="H8258BBC49C6F40C388801CD8624EC7A7"><enum>(ii)</enum><header>Congressional
				approval of additional amounts</header><text>If the Secretary estimates that
				the allotment increases that should be provided under this subsection, but for
				clause (i), would exceed the limitation established under such clause, the
				Secretary shall submit to Congress a request for supplemental appropriations
				for the purpose of meeting such shortfall.</text>
									</clause></subparagraph></paragraph><paragraph id="H56C5084990E046638608AC39960157CA"><enum>(4)</enum><header>Clarification</header><text>An
				adjustment in an allotment shall not be made under this subsection due to
				excess State expenditures resulting from a growth in per capita costs,
				increased reimbursement to providers, or other factors not directly related to
				outreach to eligible, but previously unenrolled
				children.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H34F4B3E92F7043CDA8588E92C57300E0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect
			 beginning with allotments for fiscal year 2008.</text>
				</subsection></section><section id="HC6A094A737C9485F8B8B130051378FD2"><enum>207.</enum><header>Model of
			 Interstate coordinated enrollment and coverage process</header><text display-inline="no-display-inline">In order to assure continuity of coverage of
			 low-income children under the Medicaid program and the State Children’s Health
			 Insurance Program (SCHIP), the Secretary of Health and Human Services, in
			 consultation with State Medicaid and SCHIP directors, shall develop and
			 disseminate a model process for the coordination of the enrollment and coverage
			 under such programs of children who, because of migration of families,
			 emergency evacuations, educational needs, or otherwise, frequently change their
			 State of residency or otherwise are temporarily present outside of the State of
			 their residency.</text>
			</section><section commented="no" display-inline="no-display-inline" id="HD20C065CCA0943C5BE6928EC50589DC5" section-type="subsequent-section"><enum>208.</enum><header>Authority for
			 qualifying States to use portion of SCHIP allotment for any fiscal year for
			 certain Medicaid expenditures</header><text display-inline="no-display-inline">Section 2105(g)(1)(A) of the Social Security
			 Act (42 U.S.C. 1397ee(g)(1)(A)), as amended by section 201(b) of the National
			 Institutes of Health Reform Act of 2006 (Public Law 109–482) is amended by
			 striking <quote>fiscal year 1998, 1999, 2000, 2001, 2004, 2005, 2006, or
			 2007</quote> and inserting <quote>a fiscal year</quote>.</text>
			</section><section id="H5E55C8B936C94CDD00F52B093792EB6"><enum>209.</enum><header>Application of
			 Medicaid outreach procedures to all pregnant women and children</header>
				<subsection id="H7C48BFFDA20B448CB1D6A2858B377074"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1902(a)(55)
			 of the Social Security Act (42 U.S.C. 1396a(a)(55)) is amended by striking
			 <quote>individuals for medical assistance under subsection (a)(10)(A)(i)(IV),
			 (a)(10)(A)(i)(VI), (a)(10)(A)(i)(VII), or (a)(10)(A)(ii)(IX)</quote> and
			 inserting <quote>child and pregnant women for medical assistance (including
			 under clauses (i)(IV), (i)(VI), (i)(VII), and (ii)(IX) of paragraph
			 (10)(A))</quote>.</text>
				</subsection><subsection id="H207BE62303C147FC9FE1C3E22CB30008"><enum>(b)</enum><header>Effective
			 date</header>
					<paragraph id="HDD6BA729CD29463FA4CF4E40402727AB"><enum>(1)</enum><header>In
			 general</header>
					</paragraph><paragraph id="HAB730AD37DF2410AA7AE43E1F7690600"><enum>(2)</enum><header>Exception for
			 State legislation</header><text>In the case of a State plan under title XIX of
			 the Social Security Act, which the Secretary of Health and Human Services
			 determines requires State legislation in order for the plan to meet the
			 additional requirements imposed by the amendment made by subsection (a), the
			 State plan shall not be regarded as failing to comply with the requirements of
			 such Act solely on the basis of its failure to meet these additional
			 requirements before the first day of the first calendar quarter beginning after
			 the close of the first regular session of the State legislature that begins
			 after the date of enactment of this Act. For purposes of the previous sentence,
			 in the case of a State that has a 2-year legislative session, each year of the
			 session shall be considered to be a separate regular session of the State
			 legislature.</text>
					</paragraph></subsection></section><section id="H52F4227DED1D406EB51FBB9926DC99AC"><enum>210.</enum><header>No impact on
			 section 1115 waivers</header><text display-inline="no-display-inline">Nothing
			 in this Act shall be construed to affect State flexibility on eligibility and
			 waivers approved by the Federal government under section 1115 of the Social
			 Security Act (42 U.S.C. 1315).</text>
			</section><section id="H7D02BDDD35314F64936482B46718345D"><enum>211.</enum><header>Elimination of
			 counting Medicaid child presumptive eligibility costs against title XXI
			 allotment</header><text display-inline="no-display-inline">Section 2105(a)(1)
			 of the Social Security Act (42 U.S.C. 1397ee(a)(1)) is amended—</text>
				<paragraph id="H5431A80D51A4415B8B03575F6D9C1F11"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>(or, in the case of expenditures
			 described in subparagraph (B), the Federal medical assistance percentage (as
			 defined in the first sentence of section 1905(b)))</quote>; and</text>
				</paragraph><paragraph id="HD4945005D3584C25901355A1762275B"><enum>(2)</enum><text>by
			 amending subparagraph (B) to read as follows:</text>

			 limitations on enrollment</header>
				<subsection id="HDF3E62ACA57D4589A71BF1E9DC300083"><enum>(a)</enum><header>In
			 general</header><text>Section 2102(b)(3)(B) of the Social Security Act (42
			 U.S.C. 1397bb(b)(3)(B)) is amended—</text>
					<paragraph id="H67F89D583D42491DB5E83BCC1961D8D6"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of clause (i);</text>
					</paragraph><paragraph id="H7A04092565E14C17A955E203CF286512"><enum>(2)</enum><text>by striking the
			 period at the end of clause (ii) and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph id="H8A1F70B72B6245D9965FE5C0BF50FC8"><enum>(3)</enum><text>by
			 adding at the end the following new clause:</text>

							<clause id="HD4460B1BCF674FFBB4E700DE8BD0C924"><enum>(iii)</enum><text display-inline="yes-display-inline">shall not impose, with respect to
				enrollment of targeted low-income children under the State child health plan,
				any enrollment cap or other numerical limitation on enrollment, any waiting
				list, any procedures designed to delay the consideration of applications for
				enrollment, or similar limitation with respect to
				enrollment.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H43C6B1DE433B4EB9B5AAC2CEBDA90EF"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to State
			 child health plans as of October 1, 2007.</text>
				</subsection></section></title><title id="id400B1091FF4D405680FED4DFB4EFA2D5"><enum>III</enum><header>Elimination of
			 Certain Barriers to Coverage </header>
			<section id="idB7CE8662A8034780AFDBF0889CE32E09"><enum>301.</enum><header>State option
			 to require certain individuals to present satisfactory documentary evidence of
			 proof of citizenship or nationality for purposes of eligibility for
			 Medicaid</header>
				<subsection id="id10F916C1DF7F400495EE3E21DB74F418"><enum>(a)</enum><header>In
			 general</header><text>Section 1902(a)(46) of the Social Security Act (42 U.S.C.
			 1396a(a)(46)) is amended—</text>
					<paragraph id="id3E742D0EEE9941A1BD3E7BF1D3DB861B"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(46)</quote>;</text>
					</paragraph><paragraph id="idC55A42D2602E440F8E5E5DC1CF42721D"><enum>(2)</enum><text>by adding
			 <quote>and</quote> after the semicolon; and</text>
					</paragraph><paragraph id="id8D3EA228C39944A8B0102B5DE9809E1B"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="id312BED5E5CA34CF69CC810EE64273E95" style="OLC">
							<subparagraph id="id8FA8EAA40BDF4646BCFFF473A9B98606" indent="up1"><enum>(B)</enum><text>at the option of the State and subject
				to section 1903(x), require that, with respect to an individual (other than an
				individual described in section 1903(x)(1)) who declares to be a citizen or
				national of the United States for purposes of establishing initial eligibility
				for medical assistance under this title (or, at State option, for purposes of
				renewing or redetermining such eligibility to the extent that such satisfactory
				documentary evidence of citizenship or nationality has not yet been presented),
				there is presented satisfactory documentary evidence of citizenship or
				nationality of the individual (using criteria determined by the State, which
				shall be no more restrictive than the criteria used by the Social Security
				Administration to determine citizenship, and which shall accept as such
				evidence a document issued by a federally recognized Indian tribe evidencing
				membership or enrollment in, or affiliation with, such tribe (such as a tribal
				enrollment card or certificate of degree of Indian blood, and, with respect to
				those federally recognized Indian tribes located within States having an
				international border whose membership includes individuals who are not citizens
				of the United States, such other forms of documentation (including tribal
				documentation, if appropriate) that the Secretary, after consulting with such
				tribes, determines to be satisfactory documentary evidence of citizenship or
				nationality for purposes of satisfying the requirement of this
				subparagraph));</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idACEFEADD962B48A991435CEF37AF9E8F"><enum>(b)</enum><header>Limitation on
			 waiver authority</header><text>Notwithstanding any provision of section 1115 of
			 the Social Security Act (42 U.S.C. 1315), or any other provision of law, the
			 Secretary may not waive the requirements of section 1902(a)(46)(B) of such Act
			 (42 U.S.C. 1396a(a)(46)(B)) with respect to a State.</text>
				</subsection><subsection id="idFB52F9AA635F4CA1926C97BD694007D9"><enum>(c)</enum><header>Conforming
			 amendments</header><text>Section 1903 of such Act (42 U.S.C. 1396b) is
			 amended—</text>
					<paragraph id="id491503A5039F450BBBDB61C0B3C95E5A"><enum>(1)</enum><text>in subsection
			 (i)—</text>
						<subparagraph id="id27A4C71A3D1342F4BE06468C768471D0"><enum>(A)</enum><text>in paragraph
			 (20), by adding <quote>or</quote> after the semicolon;</text>
						</subparagraph><subparagraph id="id60FEEC42A1304BFA988162DED4293F4A"><enum>(B)</enum><text>in paragraph
			 (21), by striking <quote>; or</quote> and inserting a period; and</text>
						</subparagraph><subparagraph id="id8A39EAD33F5B48929DF1DB0283B2D674"><enum>(C)</enum><text>by striking
			 paragraph (22); and</text>
						</subparagraph></paragraph><paragraph id="id218AF314B88B40279599BC00C36260C5"><enum>(2)</enum><text>in subsection (x)
			 (as amended by section 405(c)(1)(A) of division B of the Tax Relief and Health
			 Care Act of 2006 (Public Law 109–432))—</text>
						<subparagraph id="id0F0D143F4A8B4F0A877937E7A0F74653"><enum>(A)</enum><text>by striking
			 paragraphs (1) and (3);</text>
						</subparagraph><subparagraph id="idFED12DB6A2614184983B475A52BD7530"><enum>(B)</enum><text>by redesignating
			 paragraph (2) as paragraph (1);</text>
						</subparagraph><subparagraph id="idD804BDE4B65648FDAC0C20DE3C27502A"><enum>(C)</enum><text>in paragraph (1),
			 as so redesignated, by striking <quote>paragraph (1)</quote> and inserting
			 <quote>section 1902(a)(46)(B)</quote>; and</text>
						</subparagraph><subparagraph id="id67369237DA6F408F9C8082A4B37DBAF6"><enum>(D)</enum><text>by adding at the
			 end the following new paragraphs:</text>
							<quoted-block display-inline="no-display-inline" id="id484A6C18D79B442AB9B3EF2AA7582F6E" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="ID998E5A231C83480CA923B3E232CF1EFB" indent="up1"><enum>(2)</enum><text>In the case of an individual
				declaring to be a citizen or national of the United States with respect to whom
				a State requires the presentation of satisfactory documentary evidence of
				citizenship or nationality under section 1902(a)(46)(B), the individual shall
				be provided at least the reasonable opportunity to present satisfactory
				documentary evidence of citizenship or nationality under this subsection as is
				provided under clauses (i) and (ii) of section 1137(d)(4)(A) to an individual
				for the submittal to the State of evidence indicating a satisfactory
				immigration status.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1BD35444C8D444D393B2B74C7D8BADE0" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9FD62FE1F7E0404CAA24FC6CDC8796BD"><enum>(A)</enum><text>In addition to the
				criteria established by the State for purposes of section 1902(a)(46)(B), a
				State shall deem presentation of the following documents to be
				<quote>satisfactory documentary evidence of citizenship or nationality</quote>
				(and shall not favor presentation of 1 type of document described over
				another):</text>
										<clause id="ID88A48632B0FE43EA87A2DED685F1F481" indent="up1"><enum>(i)</enum><text>Any document described in subparagraph
				(B).</text>
										</clause><clause id="ID396B54CA51C14B26BBAA3AF06B3B2C4F" indent="up1"><enum>(ii)</enum><text>Any document described in
				subparagraph (C) when presented with any document described in subparagraph
				(D).</text>
										</clause><clause id="id35BBDBB4D280413EBDC4967464F5630C" indent="up1"><enum>(iii)</enum><text>Any document described in
				subparagraph (E) if the requirements of that subparagraph are met.</text>
										</clause></subparagraph><subparagraph id="IDAABA406D2BB74148808920E3FC691B2B" indent="up1"><enum>(B)</enum><text>The following are documents described
				in this subparagraph:</text>
										<clause id="ID04C3DB27DB504B3A9932E31DF4DE6BA6"><enum>(i)</enum><text>A United States passport.</text>
										</clause><clause id="ID1DC77EE8F97A4A7CBBF3BB3152E6A98D"><enum>(ii)</enum><text>Form N–550 or N–570 (Certificate of
				Naturalization).</text>
										</clause><clause id="ID0A0396208F28404DA57DAB1774E670D0"><enum>(iii)</enum><text>Form N–560 or N–561 (Certificate of
				United States Citizenship).</text>
										</clause><clause id="ID3B2E81A7EAAA4A3A963804FA67FC3F8F"><enum>(iv)</enum><text>A valid State-issued driver’s license
				or other identity document described in section 274A(b)(1)(D) of the
				<act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, but
				only if the State issuing the license or such document requires proof of United
				States citizenship before issuance of such license or document or obtains a
				social security number from the applicant and verifies before certification
				that such number is valid and assigned to the applicant who is a
				citizen.</text>
										</clause><clause id="ID4A9AB936318146E897036F777018F0A8"><enum>(v)</enum><text>Such other document as the Secretary
				may specify, by regulation, that provides proof of United States citizenship or
				nationality and that provides a reliable means of documentation of personal
				identity.</text>
										</clause></subparagraph><subparagraph id="ID41714A016CD440B2AA0B903EF0FFDDE6" indent="up1"><enum>(C)</enum><text>The following are documents described
				in this subparagraph:</text>
										<clause id="IDA499979C907B47B8AFB741E2B604E60D"><enum>(i)</enum><text>A certificate of birth in the United
				States.</text>
										</clause><clause id="ID59342CE09D644A41AEB1299E15E89509"><enum>(ii)</enum><text>Form FS–545 or Form DS–1350
				(Certification of Birth Abroad).</text>
										</clause><clause id="ID2BC086A6E4FD4666AD24142B7AFEE31F"><enum>(iii)</enum><text>Form I–197 (United States Citizen
				Identification Card).</text>
										</clause><clause id="ID409193C2958A4FC885254A55888CD9DC"><enum>(iv)</enum><text>Form FS–240 (Report of Birth Abroad
				of a Citizen of the United States).</text>
										</clause><clause id="ID0F2FBC457F184D2DBF7B7C9A8B9F8906"><enum>(v)</enum><text>Such other document (not described in
				subparagraph (B)(iv)) as the Secretary may specify that provides proof of
				United States citizenship or nationality.</text>
										</clause></subparagraph><subparagraph id="ID3D91F4E07DB744F1966D7541A80C8C2D" indent="up1"><enum>(D)</enum><text>The following are documents described
				in this subparagraph:</text>
										<clause id="ID898B56730FBC4E9587EA9E4A844F3B22"><enum>(i)</enum><text>Any identity document described in
				section 274A(b)(1)(D) of the <act-name parsable-cite="INA">Immigration and
				Nationality Act</act-name>.</text>
										</clause><clause id="ID2AB40E8CE6ED45F1AE94967D9880DFAB"><enum>(ii)</enum><text>Any other documentation of personal
				identity of such other type as the Secretary finds, by regulation, provides a
				reliable means of identification.</text>
										</clause></subparagraph><subparagraph id="id28D453D33CA54700A30DBDCAB7817E73" indent="up1"><enum>(E)</enum><text>A document described in this
				subparagraph is an affidavit of citizenship or identity, or both, which need
				not be notarized or witnessed, but only if the individual has been unable to
				acquire other satisfactory documentary evidence within the reasonable
				opportunity period established by the State, despite a good faith effort to do
				so. An individual shall be deemed unable to acquire such documentary
				evidence—</text>
										<clause id="id668EA322BDFF4C55906E2F8203AFD713"><enum>(i)</enum><text>if there is good reason to believe
				that such documentary evidence does not exist;</text>
										</clause><clause id="id8AF43818A75245B9A164400C5E64AAE6"><enum>(ii)</enum><text>if, after a timely request for such
				documentary evidence, it has not been received by the State or the individual
				within the reasonable opportunity period established by the State;</text>
										</clause><clause id="id033753D322A64EABB20CB3706D1BDB9D"><enum>(iii)</enum><text>if such documentary evidence cannot
				be acquired at a nominal cost to the individual; or</text>
										</clause><clause id="id672F3F668BDA4AC1A29FA697120D8150"><enum>(iv)</enum><text>in such additional situations as the
				Secretary may describe.</text>
										</clause></subparagraph><subparagraph id="ID09B0208CD2E34E8987C0B3BB38BEECAB" indent="up1"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="id5DDC5306DF7B4178B05B554A88EBBD15"><enum>(i)</enum><text>A reference in this
				paragraph to a form includes a reference to any successor form.</text>
										</clause><clause id="idF33FECAA69064103BFAF4D2EE90AE694" indent="up1"><enum>(ii)</enum><text>Any legible copy of a form described
				in this paragraph shall be accepted as if it were the original of such
				form.</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="idCFBCEFA2069943738889A51B06DDD956"><enum>(d)</enum><header>Clarification
			 of rules for children born in the United States to mothers eligible for
			 Medicaid</header><text display-inline="yes-display-inline">Section 1903(x) of
			 such Act (42 U.S.C. 1396b(x)), as amended by subsection (c)(2), is
			 amended—</text>
					<paragraph id="id298C5B02966A4000BE16CDE3BD335064"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
						<subparagraph id="id43F93601427F4A8B83D55EA8B6915ED3"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>or</quote> at the end;</text>
						</subparagraph><subparagraph id="id0317F076126242EFAF6BD22772B10D4E"><enum>(B)</enum><text>by redesignating
			 subparagraph (D) as subparagraph (E); and</text>
						</subparagraph><subparagraph id="idBE1E79BAEA3C40559A656D36672C6EBF"><enum>(C)</enum><text>by inserting
			 after subparagraph (C) the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="id166E250601BE49568E4458FA34AD960D" style="OLC">
								<subparagraph id="idE13F27FB2664456E88B7F59F6A1916C7" indent="up1"><enum>(D)</enum><text>pursuant to the application of section
				1902(e)(4) (and, in the case of an individual who is eligible for medical
				assistance on such basis, the individual shall be deemed to have provided
				satisfactory documentary evidence of citizenship or nationality and shall not
				be required to provide further documentary evidence on any date that occurs
				during or after the period in which the individual is eligible for medical
				assistance on such basis); or</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="idED735FB86DC94629A77665B357313BBB"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="id8973D8BC7CFE46F188AB6750135F9537" style="OLC">
							<paragraph id="idF1261AE0183B422185CB312BEA5F2205" indent="up1"><enum>(4)</enum><text>Nothing in subparagraph (A) or (B) of
				section 1902(a)(46), the preceding paragraphs of this subsection, or the
				Deficit Reduction Act of 2005, including section 6036 of such Act, shall be
				construed as changing the requirement of section 1902(e)(4) that a child born
				in the United States to an alien mother for whom medical assistance for the
				delivery of such child is available as treatment of an emergency medical
				condition pursuant to subsection (v) shall be deemed eligible for medical
				assistance during the first year of such child’s
				life.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id0E9EFDD4EAE5458696FC88A05B88D4FC"><enum>(e)</enum><header>Effective
			 date</header>
					<paragraph id="id41BB388571F249519E7939A0C87C2442"><enum>(1)</enum><header>Retroactive
			 application</header><text>The amendments made by this section shall take effect
			 as if included in the enactment of the Deficit Reduction Act of 2005 (Public
			 Law 109–171; 120 Stat. 4).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD906E6D0B0E94BC3821E007B3F17EA1D"><enum>(2)</enum><header>Restoration of
			 eligibility</header><text>In the case of an individual who, during the period
			 that began on July 1, 2006, and ends on the date of enactment of this Act, was
			 determined to be ineligible for medical assistance under a State Medicaid
			 program solely as a result of the application of subsections (i)(22) and (x) of
			 section 1903 of the Social Security Act (as in effect during such period), but
			 who would have been determined eligible for such assistance if such
			 subsections, as amended by this section, had applied to the individual, a State
			 may deem the individual to be eligible for such assistance as of the date that
			 the individual was determined to be ineligible for such medical assistance on
			 such basis.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id10202B77361A46B794C14A83EE2DD52C"><enum>302.</enum><header>Increased
			 Federal matching rate for language services provided under Medicaid or
			 SCHIP</header>
				<subsection commented="no" display-inline="no-display-inline" id="id8B9C70043CAE43EF8546AA1A65916CD0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1903(a)(3) of
			 the Social Security Act (42 U.S.C. 1396b(a)(3)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idE9D7541577AD47ADA21F8711CD934D2A"><enum>(1)</enum><text>in subparagraph
			 (E)(ii), by striking <quote>plus</quote> at the end; and</text>

				to any waiver authority of the Secretary) or child health assistance under
				title XXI;

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFED77EA3AD7E4EE8B2ED3E0390AEA15F"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) take effect on October
			 1, 2007, and apply to language services provided on or after that date.</text>
				</subsection></section></title><title id="id4207458119854E06A6D729F52D0B26D0"><enum>IV</enum><header>Grants to
			 promote innovative outreach and enrollment under Medicaid and SCHIP</header>
			<section id="HD6F166638DCA4CB49685A8864B42FEE7" section-type="subsequent-section"><enum>401.</enum><header>Grants to promote
			 innovative outreach and enrollment under Medicaid and SCHIP</header><text display-inline="no-display-inline">Title XXI of the Social Security Act (42
			 U.S.C. 1397aa et seq.), as amended by section 204(b), is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE7C2857E29914C95B6B794C624916991" style="OLC">
					<section id="HB6ED0E456D8D47B5AF45C22F46A0007"><enum>2112.</enum><header>Expanded
				outreach and enrollment activities</header>
						<subsection id="idCFAEDA0F2EB84D78B72AFB4CAA21E357"><enum>(a)</enum><header>Grants To
				conduct innovative outreach and enrollment efforts</header>
							<paragraph id="H82B5187A8B6E400EBCBB41C84B18397F"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall award grants to eligible entities
				to—</text>
								<subparagraph id="H02210FFFB0204D60B56DF857E4EE007"><enum>(A)</enum><text>conduct innovative
				outreach and enrollment efforts that are designed to increase the enrollment
				and participation of eligible children under this title and title XIX;
				and</text>
								</subparagraph><subparagraph id="H8A8E74D8B75147BCAE7BC06E254CB9B3"><enum>(B)</enum><text>promote
				understanding of the importance of health insurance coverage for prenatal care
				and children.</text>
								</subparagraph></paragraph><paragraph id="idB9F13BAD62EF4FE890252FE9D57149C9"><enum>(2)</enum><header>Performance
				bonuses</header><text>The Secretary may reserve a portion of the funds
				appropriated under subsection (g) for a fiscal year for the purpose of awarding
				performance bonuses during the succeeding fiscal year to eligible entities that
				meet enrollment goals or other criteria established by the Secretary.</text>
							</paragraph></subsection><subsection id="HD9531EDAF8E64FF3895D1431393F57F6"><enum>(b)</enum><header>Priority for
				award of grants</header>
							<paragraph id="H28E40AE677A94728A78D00A900D4467B"><enum>(1)</enum><header>In
				general</header><text>In making grants under subsection (a)(1), the Secretary
				shall give priority to—</text>
								<subparagraph id="H8FC9AF3F749145B9B1D5CA4F6B93151B"><enum>(A)</enum><text>eligible entities
				that propose to target geographic areas with high rates of—</text>
									<clause id="HAC20C81D9C2D4C52AC7B6D76AFBFE09F"><enum>(i)</enum><text>eligible but
				unenrolled children, including such children who reside in rural areas;
				or</text>
									</clause><clause id="HAE76136FF547422B947BC51CAE31E7F0"><enum>(ii)</enum><text>racial and ethnic
				minorities and health disparity populations, including those proposals that
				address cultural and linguistic barriers to enrollment; and</text>
									</clause></subparagraph><subparagraph id="H205CC0C96DD14C16BBBDCAA2A16B3665"><enum>(B)</enum><text>eligible entities
				that plan to engage in outreach efforts with respect to individuals described
				in subparagraph (A) and that are—</text>
									<clause id="H12ADD256599641BD9D3451655FE71EB4"><enum>(i)</enum><text>Federal health
				safety net organizations; or</text>
									</clause><clause id="H849489B227444A3AACA7C47C69126B9F"><enum>(ii)</enum><text>faith-based
				organizations or consortia.</text>
									</clause></subparagraph></paragraph><paragraph id="id29BD8BC6F34647438D063E0C69DE4A3C"><enum>(2)</enum><header>10 percent set
				aside for outreach to Indian children</header><text>An amount equal to 10
				percent of the funds appropriated under subsection (g) for a fiscal year shall
				be used by the Secretary to award grants to Indian Health Service providers and
				urban Indian organizations receiving funds under title V of the Indian Health
				Care Improvement Act (25 U.S.C. 1651 et seq.) for outreach to, and enrollment
				of, children who are Indians.</text>
							</paragraph></subsection><subsection id="HF1216AB414C44A31ABA169236BB92C80"><enum>(c)</enum><header>Application</header><text>An
				eligible entity that desires to receive a grant under subsection (a)(1) shall
				submit an application to the Secretary in such form and manner, and containing
				such information, as the Secretary may decide. Such application shall
				include—</text>
							<paragraph id="H8822AF1844D84D9EA37BEA5200A5679F"><enum>(1)</enum><text>quality and
				outcomes performance measures to evaluate the effectiveness of activities
				funded by a grant awarded under this section to ensure that the activities are
				meeting their goals; and</text>
							</paragraph><paragraph id="H3DD8BF57379647C4BF309EB060C981D7"><enum>(2)</enum><text>an assurance that
				the entity shall—</text>
								<subparagraph id="HAFB1DB3ED34946C0AF876DEFCE2F08C0"><enum>(A)</enum><text>conduct an
				assessment of the effectiveness of such activities against such performance
				measures; and</text>
								</subparagraph><subparagraph id="H026884DD0B7243C988DE00754EDBF217"><enum>(B)</enum><text>cooperate with the
				collection and reporting of enrollment data and other information determined as
				a result of conducting such assessments to the Secretary, in such form and
				manner as the Secretary shall require.</text>
								</subparagraph></paragraph></subsection><subsection id="HD66B3513821B46899200BDDB2D1FA613"><enum>(d)</enum><header>Dissemination of
				enrollment data and information determined from effectiveness assessments;
				annual report</header><text>The Secretary shall—</text>
							<paragraph id="H6AFB53FE3A0A49C59890D8BF199009F"><enum>(1)</enum><text>disseminate to
				eligible entities and make publicly available the enrollment data and
				information collected and reported in accordance with subsection (c)(2)(B);
				and</text>
							</paragraph><paragraph id="HB8AAA26E0AED4390BDE5EF1C14659999"><enum>(2)</enum><text>submit an annual
				report to Congress on the outreach activities funded by grants awarded under
				this section.</text>
							</paragraph></subsection><subsection id="HC077ACDA9B0F428299E1E427D4B5B638"><enum>(e)</enum><header>Supplement, not
				supplant</header><text>Federal funds awarded under this section shall be used
				to supplement, not supplant, non-Federal funds that are otherwise available for
				activities funded under this section.</text>
						</subsection><subsection id="HE03B1FDD6EAC416ABA1D57200356C05C"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H73BC4AAC8C43411D853F00DF43002F21"><enum>(1)</enum><header>Eligible
				entity</header><text>The term <quote>eligible entity</quote> means any of the
				following:</text>
								<subparagraph id="HEBD22B20BB7B4AF200BCCF758E00EF6B"><enum>(A)</enum><text>A State or local
				government.</text>
								</subparagraph><subparagraph id="H89071E8B01A04EFC8742920576A70000"><enum>(B)</enum><text>A Federal health
				safety net organization.</text>
								</subparagraph><subparagraph id="H1B068A44ABA1471DB043C4C39C7EAA20"><enum>(C)</enum><text>A national, local,
				or community-based public or nonprofit private organization, including
				organizations that use community health workers or community-based doula
				programs.</text>
								</subparagraph><subparagraph id="HE2AD5144A87347FD86B0A8521FD300CE"><enum>(D)</enum><text>A faith-based
				organization or consortia, to the extent that a grant awarded to such an entity
				is consistent with the requirements of section 1955 of the Public Health
				Service Act (42 U.S.C. 300x–65) relating to a grant award to non-governmental
				entities.</text>
								</subparagraph><subparagraph id="HB2B756A150364B979C6CF2003000A044"><enum>(E)</enum><text>An elementary or
				secondary school.</text>
								</subparagraph></paragraph><paragraph id="HC46FC0E9A2944785B07D8B3D18A8B854"><enum>(2)</enum><header>Federal health
				safety net organization</header><text>The term <quote>Federal health safety net
				organization</quote> means—</text>
								<subparagraph id="H8B3B34AA9231409E80E5E12FFBC41F7"><enum>(A)</enum><text>an Indian tribe,
				tribal organization, or an urban Indian organization receiving funds under
				title V of the Indian Health Care Improvement Act (25 U.S.C. 1651 et seq.), or
				an Indian Health Service provider;</text>
								</subparagraph><subparagraph id="H751AAA889E12424E8D67AFA2CB9E380"><enum>(B)</enum><text>a
				Federally-qualified health center (as defined in section 1905(l)(2)(B));</text>
								</subparagraph><subparagraph id="H189EB9844A444EFD814320E6E9002770"><enum>(C)</enum><text>a hospital defined
				as a disproportionate share hospital for purposes of section 1923;</text>
								</subparagraph><subparagraph id="HBE4017AB560543CDB662C49B79A8831B"><enum>(D)</enum><text>a covered entity
				described in section 340B(a)(4) of the Public Health Service Act (42 U.S.C.
				256b(a)(4)); and</text>
								</subparagraph><subparagraph id="HE987F936489D4D0DB61991DD66AB07D5"><enum>(E)</enum><text>any other entity
				or a consortium that serves children under a federally-funded program,
				including the special supplemental nutrition program for women, infants, and
				children (WIC) established under section 17 of the Child Nutrition Act of 1966
				(42 U.S.C. 1786), the head start and early head start programs under the Head
				Start Act (42 U.S.C. 9801 et seq.), the school lunch program established under
				the Richard B. Russell National School Lunch Act, and an elementary or
				secondary school.</text>
								</subparagraph></paragraph><paragraph id="HAD9B5C548E29417B85B51B4601E08661"><enum>(3)</enum><header>Indians; indian
				tribe; tribal organization; urban indian organization</header><text>The terms
				<quote>Indian</quote>, <quote>Indian tribe</quote>, <quote>tribal
				organization</quote>, and <quote>urban Indian organization</quote> have the
				meanings given such terms in section 4 of the Indian Health Care Improvement
				Act (25 U.S.C. 1603).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H57465790CECB43EAA6EFDF41999FA2F5"><enum>(g)</enum><header>Appropriation</header><text>There
				is appropriated, out of any money in the Treasury not otherwise appropriated,
				$50,000,000 for each of fiscal years 2008 through 2012 for the purpose of
				awarding grants under this section. Amounts appropriated and paid under the
				authority of this section shall be in addition to amounts appropriated under
				section 2104 and paid to States in accordance with section 2105, including with
				respect to expenditures for outreach activities in accordance with subsection
				(a)(1)(D)(iii) of such
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="id234C187210774D3C819BD05F35584F98"><enum>V</enum><header>Improving the
			 quality of pediatric care</header>
			<section id="idD7D0257CD2A3422EBCBFC33B68D98AD9"><enum>501.</enum><header>Requiring
			 coverage of EPSDT services, including dental services; State option to provide
			 supplemental coverage of dental services</header>
				<subsection id="idE94F84C9FED74AF9894B487841D60F73"><enum>(a)</enum><header>Additional
			 required services</header>
					<paragraph id="id12E2CA666FDB44AFAD4E9CA07EF2C3B8"><enum>(1)</enum><header>Required
			 coverage of EPSDT services, including dental services</header><text>Section
			 2103(c) of the Social Security Act (42 U.S.C. 1397cc(c)) is amended—</text>
						<subparagraph id="id41FB1E19D58E426BA86A3DBDC074B3FA"><enum>(A)</enum><text>by redesignating
			 paragraph (5) as paragraph (6); and</text>
						</subparagraph><subparagraph id="id3BE510FC8B644DF686A721D8B177D4E1"><enum>(B)</enum><text>by inserting
			 after paragraph (4), the following:</text>
							<quoted-block display-inline="no-display-inline" id="idD56AC4E6343E491095E97996DA4276F2" style="OLC">
								<paragraph id="id25259A69AAFA49D68F2C539F073C9613"><enum>(5)</enum><header>Other required
				services</header><text>The child health assistance provided to a targeted
				low-income child shall include coverage of early and periodic screening,
				diagnostic, and treatment services described in subsections (a)(4)(B) and (r)
				of section 1905 and provided in accordance with section 1903(a)(43) (including
				dental services that are necessary to prevent disease and promote oral health,
				restore oral structures to health and function, and treat emergency
				conditions).</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id4B50E6247B554903A7B590D25AD448E5"><enum>(2)</enum><header>State child
			 health plan requirement</header><text>Section 2102(a)(7)(B) of such Act (42
			 U.S.C. 1397bb(c)(2)) is amended by inserting <quote>and services described in
			 section 2103(c)(5)</quote> after <quote>emergency services</quote>.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29CDE62761084A77A540519E9B065F5F"><enum>(3)</enum><header>Conforming
			 amendment</header><text>Section 2103(a) of such Act (42 U.S.C. 1397cc(a)) is
			 amended, in the matter preceding paragraph (1), by striking <quote>subsection
			 (c)(5)</quote> and inserting <quote>paragraphs (5) and (6) of subsection
			 (c)</quote>.</text>
					</paragraph></subsection><subsection id="H557C984FC980488FB4B5A54936A7467D"><enum>(b)</enum><header>State option To
			 provide supplemental coverage of dental services under SCHIP to children with
			 other health coverage</header>
					<paragraph id="H49151133F63A4B338088F6FEA8007363"><enum>(1)</enum><header>In
			 general</header><text>Section 2110(b) of the Social Security Act (42 U.S.C.
			 1397jj(b)) is amended—</text>
						<subparagraph id="H2434F205CDD7498D909C80B784515BDE"><enum>(A)</enum><text>in paragraph
			 (1)(C), by inserting <quote>, subject to paragraph (5),</quote> after
			 <quote>under title XIX or</quote>; and</text>
						</subparagraph><subparagraph id="HC2FC8999D5394F13BD2E138502D0A6E"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HB62B99B0D15A4A56B65EECBCD725AB2E" style="OLC">
								<paragraph id="H7BFC4CC0B60B462487F423178495FF2"><enum>(5)</enum><header>State option to
				provide supplemental coverage of dental services to children with other health
				coverage</header>
									<subparagraph id="HFB1D38C3954841DF94006DC62D988401"><enum>(A)</enum><header>In
				general</header><text>A State may waive the requirement of paragraph (1)(C)
				that a targeted low-income child may not be covered under a group health plan
				or under health insurance coverage in order to provide dental services that are
				not covered, or are only partially covered, under such plan or coverage.
				Nothing in subsection (c)(5) of section 2103 shall be construed as prohibiting
				a State from limiting the supplemental coverage of dental services provided in
				accordance with this paragraph and nothing in paragraph (2) or (3) of
				subsection (e) of such section shall be construed as prohibiting a State from
				imposing premiums, deductibles, cost-sharing, or similar charges for such
				coverage without regard to the requirements of either such paragraph.</text>
									</subparagraph><subparagraph id="HE2C1ABB7A233420FADF900D1282D9866"><enum>(B)</enum><header>Eligibility</header><text>In
				waiving such requirement, a State may limit the application of the waiver to
				children whose family income does not exceed a level specified by the State,
				which may not exceed the maximum income level otherwise established for other
				children under the State child health plan.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HED4F3C2010334C99B52CBCCEC638A443"><enum>(C)</enum><header>Continued
				application of duty to prevent substitution of existing
				coverage</header><text>Nothing in this paragraph shall be construed as
				modifying the application of section 2102(b)(3)(C) to a
				State.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H497627A6C8424BB3A146A7D07B291C67"><enum>(2)</enum><header>Application of
			 enhanced match under Medicaid</header><text>Section 1905 of such Act (42 U.S.C.
			 1396d) is amended—</text>
						<subparagraph id="H357738D3185541379FAC568B1102AF1"><enum>(A)</enum><text>in subsection (b),
			 in the fourth sentence, by striking <quote>subsection (u)(3)</quote> and
			 inserting <quote>(u)(3), or (u)(4)</quote>; and</text>
						</subparagraph><subparagraph id="H8A3E9CEEA4D9461EA0525EB8F38507CD"><enum>(B)</enum><text>in subsection (u),
			 by redesignating paragraph (4) as paragraph (5) and by inserting after
			 paragraph (3) the following:</text>

								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HAA35064962D0481EB8ED00DE4F89EC39"><enum>(3)</enum><header>Application of
			 secondary payor provisions</header><text>Section 2107(e)(1) of such Act (42
			 U.S.C. 1397gg(e)(1)) is amended—</text>
						<subparagraph id="HB1CDE21D8F1E452FA3522269DB4C5300"><enum>(A)</enum><text>by redesignating
			 subparagraphs (B) through (D) as subparagraphs (C) through (E), respectively;
			 and</text>
						</subparagraph><subparagraph id="HCC2F00AD222F4054B8D7FF1B16FCB493"><enum>(B)</enum><text>by inserting after
			 subparagraph (A) the following new subparagraph:</text>

								<subparagraph id="H7ED91A63C24C47D5B6FBC10010D3CDF0"><enum>(B)</enum><text>Section
				1902(a)(25) (relating to coordination of benefits and secondary payor

				services under a waiver described in section
				2110(b)(5).</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection></section><section id="id6DEABEF84E6149CC9B049A44253CEF02"><enum>502.</enum><header>Pediatric
			 quality and performance measures program</header><text display-inline="no-display-inline">Title XIX of the Social Security Act (42
			 U.S.C. 1396 et seq.) is amended—</text>
				<paragraph id="id025EF6D850BE4487AEFF1EBA295B2A60"><enum>(1)</enum><text>by redesignating
			 section 1939 as section 1941; and</text>
				</paragraph><paragraph id="idDCFB1505E011486282FFC3559E32F9E9"><enum>(2)</enum><text>by inserting
			 after section 1938 the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB2DBA2B7137E4C11B0DCD1DB22B1027F" style="traditional">
						<section id="id0DB081A7C6004771B23439414F87F6F3"><enum>1939.</enum><header>Pediatric quality and performance measures
		  program</header><subsection commented="no" display-inline="yes-display-inline" id="id7DD49DE603844C638E8D2D0FA4163F3F"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary, acting through the Administrator of the Centers for Medicare &amp;
				Medicaid Services and in consultation with the Director of the Agency for
				Healthcare Research and Quality, shall establish a program to encourage and
				support the development of new and emerging quality and performance measures
				for providers of pediatric care through the activities described in subsection
				(c). In establishing the program, gaps in existing evidence-based measures and
				priority areas for advancement shall be identified.</text>
							</subsection><subsection id="id2BD4A08DD14347F5A0F6D6D47EA7627F"><enum>(b)</enum><header>Purpose</header><text>The
				purpose of the program is to ensure that—</text>
								<paragraph id="id8FD59BE2130047B5B8FBA06EB6402266"><enum>(1)</enum><text>evidence-based
				pediatric quality and performance measures are developed; and</text>
								</paragraph><paragraph id="idB8E4928009AB46659B4AED13A32E7633"><enum>(2)</enum><text>such measures are
				available for States, other purchasers of pediatric health care services,
				health care providers, and consumers to use.</text>
								</paragraph></subsection><subsection id="ID2235e81c33f244b7abbf3ed2d1dbb6d7"><enum>(c)</enum><header>Program
				activities</header>
								<paragraph id="ID171832e0e9a34da3a96b6a8b6d8e6534"><enum>(1)</enum><header>Identifying
				quality and performance measures for providers of pediatric services and
				opportunities for new measures</header><text>Not later than 3 months after the
				date of enactment of this section, the Secretary shall identify quality and
				performance measures for providers of pediatric services and opportunities for
				the development of new measures, taking into consideration existing
				evidence-based measures. In conducting this review, the Secretary shall—</text>
									<subparagraph id="idFE872317F4D34CA1BC65B0A33AFCFBCB"><enum>(A)</enum><text>ensure the
				inclusion of at least 1 measure related to children’s dental and oral health;
				and</text>
									</subparagraph><subparagraph id="idE107EA736FAC404FA1333B1C7DEB93D9"><enum>(B)</enum><text>convene and
				consult with representatives of—</text>
										<clause id="id616E0A268E294EEEA6EAC637D0C1F8A0"><enum>(i)</enum><text>States;</text>
										</clause><clause id="id7EF77DF3573F4698ADFAB7AC23B78DB5"><enum>(ii)</enum><text>pediatric
				hospitals, pediatricians, and other pediatric health professionals;</text>
										</clause><clause commented="no" id="idC556E76FF8EB426A8063974718EA8AC2"><enum>(iii)</enum><text>national
				organizations representing—</text>
											<subclause commented="no" id="id83C5976DEA5C423AB4C77E74A50EAC15"><enum>(I)</enum><text>consumers of
				children’s health care; and</text>
											</subclause><subclause commented="no" id="idA77D75F0C82A4969810F351B3F8E41E0"><enum>(II)</enum><text>purchasers of
				children’s health care;</text>
											</subclause></clause><clause id="ID06bf6089e8b34d2c9db060432b44730a"><enum>(iv)</enum><text>experts in
				pediatric quality and performance measurement; and</text>
										</clause><clause id="id4ACD256A54B54CA0BE0CFB89530DA1B5"><enum>(v)</enum><text>a
				voluntary consensus standards setting organization and other organizations
				involved in the advancement of consensus on evidence-based measures of health
				care.</text>
										</clause></subparagraph></paragraph><paragraph id="ID0cc6eb82ce54444a82a3ebc9dc188e0f"><enum>(2)</enum><header>Developing,
				validating, and testing new measures</header><text>The Secretary shall award
				grants or contracts to eligible entities (as defined in subsection (d)(1)) for
				the development, validation, and testing of new and emerging quality and
				performance measures, including at least 1 measure related to children’s dental
				and oral health, for providers of pediatric services. Such measures
				shall—</text>
									<subparagraph id="idB3124DD459FB4E298FC40594AF6AEB2D"><enum>(A)</enum><text>provide consumers
				and purchasers (including States and beneficiaries under the program under this
				title and title XXI) with information about provider performance and quality;
				and</text>
									</subparagraph><subparagraph id="id5FEC5505B0C245C88491E0088FDF1124"><enum>(B)</enum><text>assist health
				care providers in improving the quality of the items and services they provide
				and their performance with respect to the provision of such items and
				services.</text>
									</subparagraph></paragraph><paragraph id="idD0E932284C144AE3971A78134B968074"><enum>(3)</enum><header>Achieving
				consensus on evidence-based measures</header><text>The Secretary shall award
				grants or contracts to eligible consensus entities (as defined in subsection
				(d)(2)) for the development of consensus on evidence-based measures for
				pediatric care, including at least 1 measure related to children’s dental and
				oral health, that have broad acceptability in the health care industry.</text>
								</paragraph></subsection><subsection id="ID773f9b34c0344656a8936a0b9306e1e8"><enum>(d)</enum><header>Eligible
				entities</header>
								<paragraph id="idB255DB186FB3419A8A0923DFFAEF40E6"><enum>(1)</enum><header>Development,
				validation, and testing</header><text>For purposes of paragraph (2) of
				subsection (c), the term <quote>eligible entity</quote> means—</text>
									<subparagraph id="id0FC46A79938D43369182CF93A2DD578D"><enum>(A)</enum><text>organizations
				with demonstrated expertise and capacity in the development and evaluation of
				pediatric quality and performance measures;</text>
									</subparagraph><subparagraph id="id49C43036F9AA42F293DA0A8BA0E293A2"><enum>(B)</enum><text>an organization
				or association of health care providers with demonstrated experience in working
				with accrediting organizations in developing pediatric quality and performance
				measures; and</text>
									</subparagraph><subparagraph id="id9B786B00F84640B7A6A800474AED7998"><enum>(C)</enum><text>a collaboration
				of national pediatric organizations working to improve pediatric quality and
				performance measures.</text>
									</subparagraph></paragraph><paragraph id="ID0355d995b9ee46508e40a3fa69a174f9"><enum>(2)</enum><header>Achievement of
				consensus</header><text>For purposes of paragraph (3) of such subsection, the
				term <quote>eligible consensus entity</quote> means an organization, including
				a voluntary consensus standards setting organization involved in the
				advancement of consensus on evidence-based measures of health care.</text>
								</paragraph></subsection><subsection id="idFAE8A62979A744F8B8D7743EC2A08BD2"><enum>(e)</enum><header>Ongoing
				authority To update and adjust pediatric measures</header><text>The Secretary
				may update and adjust measures developed and advanced under the program under
				this section in accordance with—</text>
								<paragraph id="id22A0B73356714090A1825838F9711BE4"><enum>(1)</enum><text>any changes that
				a voluntary consensus standards setting organization determines should be made
				with respect to such measures; or</text>
								</paragraph><paragraph id="id19F3D84B88664F80B3AD5C66A0B5A2F1"><enum>(2)</enum><text>new evidence
				indicating the need for changes with respect to such measures.</text>
								</paragraph></subsection><subsection id="idCBEE34DB36C54BFCAE57A8CCDDA53FBF"><enum>(f)</enum><header>Addition of
				pediatric consumer assessment measures to CAHPS Hospital Survey conducted by
				AHRQ</header><text>The Director of the Agency for Healthcare Research and
				Quality shall ensure that consumer assessment measures for hospital services
				for children are added to the Consumer Assessment of Healthcare Providers and
				Systems (CAHPS) Hospital survey conducted by such Agency.</text>
							</subsection><subsection id="ID3994a617dec446edb47906f068f5c4a6"><enum>(g)</enum><header>Appropriation</header><text>There
				are authorized to be appropriated and there are appropriated, for the purpose
				of carrying out this section, $10,000,000, for each of fiscal years 2008
				through 2012, to remain available until
				expended.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="ID46e6c63b772c4b91bdf10a3476d8ab43"><enum>503.</enum><header>Grants to
			 states for demonstration projects transforming delivery of pediatric
			 care</header><text display-inline="no-display-inline">Title XIX of the Social
			 Security Act (42 U.S.C. 1396 et seq.), as amended by section 502, is amended by
			 inserting after section 1939 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id533656EECEB74C0B96A9F362909C241D" style="traditional">
					<section id="id9F904DEB90634DE59446F6E0ECFE7F29"><enum>1940.</enum><header>Grants to states for demonstration projects transforming
		  delivery of pediatric care</header><subsection commented="no" display-inline="yes-display-inline" id="id3D1EA0F138FB4815B081BD503C008F8A"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary, acting through the Administrator of the Centers for Medicare &amp;
				Medicaid Services, shall establish demonstration projects, including
				demonstration projects in each of the 4 categories described in subsection (d),
				to award grants to States to improve the delivery of health care services
				provided to children under this title and title XXI.</text>
						</subsection><subsection id="id08C24AF0FCFB46528436E384974C2EEF"><enum>(b)</enum><header>Duration</header><text>The
				demonstration projects shall be conducted for a period of 4 years.</text>
						</subsection><subsection id="IDbd65d19b3af94bfcb7cde0019f7ff31c"><enum>(c)</enum><header>Eligibility</header><text>A
				State shall not be eligible to receive a grant under this section unless the
				State has demonstrated experience or commitment to the concept of
				transformation in the delivery of pediatric care.</text>
						</subsection><subsection id="IDf063dbb0cab040c2afe3c990cc1ad4da"><enum>(d)</enum><header>Categories of
				projects</header><text>The following categories of projects are described in
				this subsection:</text>
							<paragraph id="ID115cd4833f4c4cbe893b265a7233e90a"><enum>(1)</enum><header>Health
				information technology systems</header><text>Projects for developing health
				information technology systems, including technology acquisition, electronic
				health record development, data standards development, and software
				development, for pediatric hospital and physician services and other
				community-based services; implementing model systems; and evaluating their
				impact on the quality, safety, and costs of care.</text>
							</paragraph><paragraph id="ID10c2a157b7f845139551e886ec090ad3"><enum>(2)</enum><header>Disease
				management</header><text>Projects for providing provider-based care disease
				management for children with chronic conditions (including physical,
				developmental, behavioral, and psychological conditions), demonstrating the
				effectiveness of provider-based management models in promoting better care,
				reducing adverse health outcomes, and preventing avoidable
				hospitalizations.</text>
							</paragraph><paragraph id="IDcf8e8bcebe37402fba9dfb1c9c01ec6a"><enum>(3)</enum><header>Evidence-based
				quality improvements</header><text>Projects for implementing evidence-based
				approaches to improving efficiency, safety, and effectiveness in the delivery
				of hospital care for children across hospital services, evaluating the
				translation of successful models of such evidence-based approaches to other
				institutions, and the impact of such changes on the quality, safety, and costs
				of care.</text>
							</paragraph><paragraph id="ID10d315e752774013bd31724e674a2dae"><enum>(4)</enum><header>Quality and
				performance measures for providers of children’s health care
				services</header><text>Projects to pilot test evidence-based pediatric quality
				and performance measures for inpatient hospital services, physician services,
				or services of other health professionals, determining the reliability,
				feasibility, and validity of such measures, and evaluating their potential
				impact on improving the quality and delivery of children’s health care. To the
				extent feasible, such measures shall have been approved by consensus standards
				setting organizations.</text>
							</paragraph></subsection><subsection id="IDf9d6b775b8f24f4e9af9077c9c2f6b2e"><enum>(e)</enum><header>Uniform
				metrics</header><text>The Secretary shall establish uniform metrics (adjusted,
				as appropriate, for patient acuity), collect data, and conduct evaluations with
				respect to each demonstration project category described in subsection (d). In
				establishing such metrics, collecting such data, and conducting such
				evaluations, the Secretary shall consult with—</text>
							<paragraph id="idF615F3C7EA084AD6BD956285A4F9BD5A"><enum>(1)</enum><text>experts in each
				such demonstration project category;</text>
							</paragraph><paragraph id="idBF16FC791028440D89D0916EF25EA539"><enum>(2)</enum><text>participating
				States;</text>
							</paragraph><paragraph id="id209B8B119E42437F969CA05AA7BEA18E"><enum>(3)</enum><text>national
				pediatric provider organizations;</text>
							</paragraph><paragraph id="id8DC667F6593341FA9AA06F0AE1B58FB8"><enum>(4)</enum><text>health care
				consumers; and</text>
							</paragraph><paragraph id="id7957AF2787DB4F93BEE239F94CD2ED49"><enum>(5)</enum><text>such other
				entities or individuals with relevant expertise as the Secretary determines
				appropriate.</text>
							</paragraph></subsection><subsection id="ID30f34d4c0fce43219d09d4b294327398"><enum>(f)</enum><header>Evaluation and
				report</header><text>The Secretary shall evaluate the demonstration projects
				conducted under this section and submit a report to Congress not later than 3
				months before the completion of each demonstration project that includes the
				findings of the evaluation and recommendations with respect to—</text>
							<paragraph id="ID447f20bf21eb4172a5d91d66accb0d6f"><enum>(1)</enum><text>expansion of the
				demonstration project to additional States and sites; and</text>
							</paragraph><paragraph id="IDde30d285d0cc4004878443b530f84faa"><enum>(2)</enum><text>the broader
				implementation of approaches identified as being successful in advancing
				quality and performance in the delivery of medical assistance provided to
				children under this title and title XXI.</text>
							</paragraph></subsection><subsection id="id493787D5979641A78A8D3E77FA07936B"><enum>(g)</enum><header>Waiver</header><text>The
				Secretary may waive the requirements of this title and title XXI to the extent
				necessary to carry out the demonstration projects under this section.</text>
						</subsection><subsection id="ID1c557c4f57f94ef0ba7b516d48f59847"><enum>(h)</enum><header>Amounts paid to
				a State</header><text>Amounts paid to a State under this section—</text>
							<paragraph id="idEA2C49EEA6464F6EB56395600C5B148B"><enum>(1)</enum><text>shall be in
				addition to Federal payments made to the State under section 1903(a);</text>
							</paragraph><paragraph id="id312B2009E41F4251A96E66140C99E4B5"><enum>(2)</enum><text>shall not be used
				for the State share of any expenditures claimed for payment under such section;
				and</text>
							</paragraph><paragraph id="id9B95EB1147DC451094C61593C81F1FF2"><enum>(3)</enum><text>shall be used
				only for expenditures of the State for participating in the demonstration
				projects, or for expenditures of providers in participating in the
				demonstration projects, including—</text>
								<subparagraph id="idD824DB814D654285AEBBFA0052E3CFC5"><enum>(A)</enum><text>administrative
				costs of States and participating providers (such as costs associated with the
				design and evaluation of, and data collection under, the demonstration
				projects); and</text>
								</subparagraph><subparagraph id="idE7E483F3CA3E4F479DF59EDE8E6F44BD"><enum>(B)</enum><text>such other
				expenditures that are not otherwise eligible for reimbursement under this title
				or title XXI as the Secretary may determine appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="id17D19D3E93324FAA822B927EBD0A5CAD"><enum>(i)</enum><header>Appropriation</header><text>There
				are authorized to be appropriated and there are appropriated, for the purpose
				of carrying out this section, to remain available until expended $10,000,000
				for each of fiscal years 2008 through
				2012.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idA284E4A7A12441FBB97CBA9A33DFF823"><enum>504.</enum><header>Report by the
			 comptroller general on design and implementation of a demonstration project
			 evaluating existing quality and performance measures for children’s inpatient
			 hospital services</header>
				<subsection id="id9181857D82104B598410045A9E6844AA"><enum>(a)</enum><header>In
			 general</header><text>Not later than 12 months after the date of enactment of
			 this Act, the Comptroller General of the United States (in this section
			 referred to as the <quote>Comptroller General</quote>) shall submit a report to
			 Congress containing recommendations for the design and implementation of a
			 demonstration project to evaluate the suitability of existing quality and
			 performance measures for children’s inpatient hospital services for public
			 reporting, differentiating quality, identifying best practices, and providing a
			 basis for payment rewards.</text>
				</subsection><subsection id="idF11FDE693DAA4EBEB8504EB1FB20C1ED"><enum>(b)</enum><header>Development of
			 recommendations</header><text>In developing the recommendations submitted under
			 subsection (a), the Comptroller General shall accomplish the following:</text>
					<paragraph id="ID36e3fa03586c4ddd88d706c184899e14"><enum>(1)</enum><text>Consider which
			 agency within the Department of Health and Human Services should have primary
			 responsibility and oversight for such a demonstration project.</text>
					</paragraph><paragraph id="IDd71fc815f2ef4ed7a67abafdf574a289"><enum>(2)</enum><text>Determine a
			 sufficient number of participating hospitals and volume of children’s cases,
			 given existing measures that might be chosen for evaluation under such a
			 demonstration project.</text>
					</paragraph><paragraph id="ID2fa8b362efc1459481c9677fa655cab9"><enum>(3)</enum><text>Determine the
			 number of States and variety of geographic locations that may be required to
			 conduct such a demonstration project.</text>
					</paragraph><paragraph id="ID8c31d3b7228f46b998b1c153a6004347"><enum>(4)</enum><text>Describe
			 alternatives for administering and directing funding for such a demonstration
			 project, taking into consideration the potential involvement of multiple
			 States, State plans under title XIX of the Social Security Act (42 U.S.C. 1396
			 et seq.), and State child health plans under title XXI of such Act (42 U.S.C.
			 1397aa et seq.). Such description shall be included in the recommendations
			 submitted under subsection (a).</text>
					</paragraph><paragraph id="ID11c9a68038fa4b02ac243ac8217519a4"><enum>(5)</enum><text>Determine
			 requirements for consistency in measures, metrics, and risk adjustment for such
			 a demonstration project, across hospitals and across State lines.</text>
					</paragraph><paragraph id="IDff4ab0b5824849fa9b40b4ae30f41f5e"><enum>(6)</enum><text>Consider the
			 infrastructure requirements involved in public reporting of quality and
			 performance measures for children’s inpatient hospital services at the national
			 and State levels, including the requirements involved with respect to
			 maintaining such measures and data.</text>
					</paragraph><paragraph id="ID05906c98752543eb8b317fe612998066"><enum>(7)</enum><text>Estimate the cost
			 of undertaking such a demonstration project.</text>
					</paragraph></subsection><subsection id="id021EB08AA9CD4C97B9796C5CED24F9AD"><enum>(c)</enum><header>Suggestion of
			 existing measures for evaluation under the demonstration project</header>
					<paragraph id="idBB3A6E04ABED4699A02AE089A0E30B81"><enum>(1)</enum><header>In
			 general</header><text>The report submitted under subsection (a) shall include
			 suggestions for existing measures to be evaluated under the demonstration
			 project recommended in such report, including, to the extent feasible, measures
			 with respect to—</text>
						<subparagraph id="ID1fcf0005884e40ffadf48c5b11ee7e0f"><enum>(A)</enum><text>high volume
			 pediatric inpatient conditions;</text>
						</subparagraph><subparagraph id="ID067da05361684d0ab40355224f5c8ba6"><enum>(B)</enum><text>high cost
			 pediatric inpatient services;</text>
						</subparagraph><subparagraph id="ID69ddfce87fb748fb8a8ac96c5a4e56fe"><enum>(C)</enum><text>pediatric
			 conditions with predicted high morbidities; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc4ef353d402142f9aae24007a54f27af"><enum>(D)</enum><text>pediatric cases
			 at high risk of patient safety failures.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD25535C4357E478C91A7B32170754DF2"><enum>(2)</enum><header>Suggested
			 measures</header><text>The measures suggested under paragraph (1) shall be
			 measures representing process, structure, patient outcomes, or patient and
			 family experience—</text>
						<subparagraph id="ID756f83c0a72c458388fb8acaf1b75460"><enum>(A)</enum><text>that are
			 evidence-based;</text>
						</subparagraph><subparagraph id="ID0388ad069e804a9c919506ae45a01f59"><enum>(B)</enum><text>that are feasible
			 to collect and report;</text>
						</subparagraph><subparagraph id="IDca7617e709fb47d1ab7127a9b7fd6e5d"><enum>(C)</enum><text>that include a
			 mechanism for risk adjustment when necessary; and</text>
						</subparagraph><subparagraph id="IDe25fff7f3923489dbf0a2484ae2f08f9"><enum>(D)</enum><text>for which there
			 is a consensus within the pediatric hospital community or a consensus
			 determined by a voluntary consensus standards setting organization involved in
			 the advancement of evidence-based measures of health care.</text>
						</subparagraph></paragraph><paragraph id="id53E1ECADA4E14ED8A38A5AA90FC031E6"><enum>(3)</enum><header>Consultation</header><text>In
			 determining the existing measures suggested under paragraph (1), the
			 Comptroller General shall consult with representatives of the following:</text>
						<subparagraph id="ID0aa0d7b2a49e4d1eb7e9f9dcdeaa1bea"><enum>(A)</enum><text>National
			 associations of pediatric hospitals and pediatric health professionals.</text>
						</subparagraph><subparagraph id="IDdc9c4e0c13304d0bb6367ea14baee9bc"><enum>(B)</enum><text>Experts in
			 pediatric quality and performance measurement.</text>
						</subparagraph><subparagraph id="ID6d78a1e7ae474dce88f070326bf05685"><enum>(C)</enum><text>Voluntary
			 consensus standards setting organizations and other organizations involved in
			 the advancement of consensus on evidence-based measures.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3c382abec4e842a098ca39eaadbefc7c"><enum>(D)</enum><text>The Department of
			 Health and Human Services, States, and other purchasers of health care items
			 and services.</text>
						</subparagraph></paragraph></subsection></section><section id="id5C4042C3C71041F08E08088BD6840895"><enum>505.</enum><header>Medical home
			 demonstration project</header>
				<subsection id="ID3935c319f6c5451eb36f11047373a70b"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="ID79b9de9dda8548e798418624d1621f61"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>) shall establish a medical
			 home demonstration project (in this section referred to as the
			 <quote>project</quote>) under titles XIX and XXI of the Social Security Act (42
			 U.S.C. 1396 et seq.; 1397aa et seq.) to redesign the health care delivery
			 system by providing targeted, accessible, continuous, coordinated, and
			 family-centered care to eligible individuals.</text>
					</paragraph><paragraph id="id9DF94403F9474E60A62FFBE089E545EC"><enum>(2)</enum><header>Eligible
			 individuals defined</header><text>In this section, the term <quote>eligible
			 individual</quote> means an individual who—</text>
						<subparagraph id="id9EDAA01E84574508A4F7EE4E8B63EC90"><enum>(A)</enum><text>is receiving
			 child health assistance under a State child health plan implemented under title
			 XXI of the Social Security Act (42 U.S.C. 1397aa et seq.), title XIX of such
			 Act (42 U.S.C. 1396 et seq.), or both such titles; and</text>
						</subparagraph><subparagraph id="idE2A4D5227EFB47E98808182AB979DA28"><enum>(B)</enum><text>is a member of a
			 high need population (as determined by the Secretary).</text>
						</subparagraph></paragraph><paragraph id="ID3715a6008a4d45999a606a596e1fa658"><enum>(3)</enum><header>Project
			 goals</header><text>The project shall be designed in order to determine
			 whether, and if so, the extent to which, medical homes accomplish the
			 following:</text>
						<subparagraph id="IDedf0e9a13839420f9eab86d7eae93358"><enum>(A)</enum><text>Increase—</text>
							<clause id="idF9143A5767A84083B85055A25CC16FBB"><enum>(i)</enum><text>cost efficiencies
			 of health care delivery;</text>
							</clause><clause id="IDefc8ebc7482c47159f196d36fdf5b7fe"><enum>(ii)</enum><text>access to
			 appropriate health care services;</text>
							</clause><clause id="ID29dcac397e54441a857d350d17d998c6"><enum>(iii)</enum><text>patient
			 satisfaction;</text>
							</clause><clause id="idB93CED433813438D90A0900328422189"><enum>(iv)</enum><text>school
			 attendance; and</text>
							</clause><clause id="id0BF86FE4CB2F4119BB17105655DAFA8D"><enum>(v)</enum><text>the
			 quality of health care services provided, as determined based on measures of
			 quality the Secretary determines are broadly accepted in the health care
			 community.</text>
							</clause></subparagraph><subparagraph id="IDf1068b7602e942c4a8bd531818ff79c4"><enum>(B)</enum><text>Decrease—</text>
							<clause id="id091680718A3945EE956560FD9353FE11"><enum>(i)</enum><text>inappropriate
			 emergency room utilization; and</text>
							</clause><clause id="ID45d4fc729ce045e68aeaaeb0bf0db817"><enum>(ii)</enum><text>duplication of
			 health care services provided.</text>
							</clause></subparagraph><subparagraph id="ID0b173778714946aeaaae63e95b21568d"><enum>(C)</enum><text>Provide
			 appropriate—</text>
							<clause id="id4D66E2D49842466791732BDFEF9F5606"><enum>(i)</enum><text>preventive care;
			 and</text>
							</clause><clause id="IDccb61b57fc2c45b0aec4568fe28f2fcf"><enum>(ii)</enum><text>referrals to
			 multidisciplinary services.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="IDefb13fe29d314b8ea78c2ca55bcf17ed"><enum>(b)</enum><header>Project
			 Design</header>
					<paragraph id="idA8F074B998CB46F49FFAF0FB5931DD11"><enum>(1)</enum><header>Duration</header><text>The
			 project shall be conducted for a 5 year period.</text>
					</paragraph><paragraph id="id7B98793C2AC54F6B97D8D9D36932F53A"><enum>(2)</enum><header>Sites</header>
						<subparagraph id="id60257CB4BAAF429381F611F28340FA13"><enum>(A)</enum><header>In
			 general</header><text>The project shall be conducted in 8 States on a
			 State-wide basis.</text>
						</subparagraph><subparagraph id="id907FB612A7D140D7BA6FCCAA5B5745C8"><enum>(B)</enum><header>Application</header><text>A
			 State seeking to participate in the project shall submit an application to the
			 Secretary at such time, in such manner, and containing such information as the
			 Secretary may require.</text>
						</subparagraph></paragraph><paragraph id="ID555be7098ec94f868f86c60219aee70f"><enum>(3)</enum><header>Conduct of
			 project</header>
						<subparagraph id="idBC6C91D8C75D4D0CB862FF4DDAF69C6F"><enum>(A)</enum><header>Agreements with
			 academic institutions</header><text>A participating State may enter into an
			 agreement with an academic institution in order to have the institution conduct
			 the project, provide technical assistance and monitoring, and to participate in
			 the evaluation of the project under subsection (e)(1).</text>
						</subparagraph><subparagraph id="id254F5F1B93624E87BF6F33B2D7DD826A"><enum>(B)</enum><header>Choice of
			 participating physician practices</header>
							<clause id="id6B9D304E7B4D4F5CA1D9D60340E0483D"><enum>(i)</enum><header>In
			 general</header><text>A participating State shall establish procedures for
			 physician practices to participate in the project by providing coordinated care
			 to eligible individuals. Such participation shall be on a voluntary
			 basis.</text>
							</clause><clause id="ID6eb090a9e4704b9893a63faa05def003"><enum>(ii)</enum><header>Standards for
			 participating physician practices</header><text>The procedures established
			 under clause (i) shall encourage physician practices participating in the
			 project to demonstrate that they have—</text>
								<subclause id="id7A67BAA53F454E1AA58FA7C86BCEAE63"><enum>(I)</enum><text>identified care
			 coordinators, family resource guides, family advisors, and a family advisory
			 committee;</text>
								</subclause><subclause id="id1D213943375F41BFADDAB57B7F814FB3"><enum>(II)</enum><text>developed care
			 plans for eligible individuals; and</text>
								</subclause><subclause id="id715318C8AEF84A87BB5829DA9F273A7F"><enum>(III)</enum><text>taken such
			 other actions as the State determines appropriate in order to provide
			 coordinated care to eligible individuals.</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="IDb50fe46217054c35be2f2211c68d6d5d"><enum>(c)</enum><header>Project
			 requirements</header><text>Each participating State shall establish procedures
			 in order to ensure that the following requirements are met:</text>
					<paragraph id="id5A4910B43CE044DDBB62C6B5806CDC02"><enum>(1)</enum><text>Each eligible
			 individual in the State who is enrolled in the project is provided a medical
			 home with access to appropriate medical care.</text>
					</paragraph><paragraph id="IDae7024aa029f449bb23b15fd6c9470a0"><enum>(2)</enum><text>Each medical home
			 in the State that is participating in the project—</text>
						<subparagraph id="id9C01A713D35049FB9E505F38B349AD2D"><enum>(A)</enum><text>provides for
			 physician-directed care coordination;</text>
						</subparagraph><subparagraph id="idC4426438A36E4BABBF3B75422368C166"><enum>(B)</enum><text>uses health
			 information technology (including patient registry systems, clinical decision
			 support tools, remote monitoring, and electronic medical record
			 systems);</text>
						</subparagraph><subparagraph id="id7BE1EB78F3FB48AE8EE444E76FFC60FA"><enum>(C)</enum><text>communicates with
			 physician practices participating in the project, eligible individuals
			 receiving health care through the medical home, and other health care providers
			 (as appropriate) with respect to health matters, including through electronic
			 mail and telephone consultations;</text>
						</subparagraph><subparagraph id="id75C904E8B1C746ED8333835290638842"><enum>(D)</enum><text>makes
			 arrangements with teams of other health professionals, including care
			 coordinators, and facilitates linkages to community resources to extend access
			 to the full spectrum of health care services that eligible individuals
			 require;</text>
						</subparagraph><subparagraph id="id7E9BB120A65E4FB285EC229F5626426D"><enum>(E)</enum><text>establishes
			 networks with community practices, hospitals, and community health care
			 providers to facilitate the exchange of ideas and resources in order to improve
			 project outcomes; and</text>
						</subparagraph><subparagraph id="idD2D472D6FC6548DA9A4070DCBE19E714"><enum>(F)</enum><text>acts as a
			 facilitator in order to ensure that eligible individuals enrolled in the
			 medical home under the project receive high-quality care at the appropriate
			 time and place in a cost-effective manner.</text>
						</subparagraph></paragraph><paragraph id="ID81afff8e27df4b3da88893486d15850a"><enum>(3)</enum><text>The State
			 provides payment (in accordance with subsection (d)) and appropriate support
			 for physician-directed care coordination services provided to eligible
			 individuals under the project.</text>
					</paragraph></subsection><subsection id="ID8882a58ede214606bcde88d71c45e5f1"><enum>(d)</enum><header>Payment</header>
					<paragraph id="idD7349E99208D47D0AE1A18EC2817DEE2"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish a structure for payments to
			 participating States for the cost of services provided under the project. Such
			 structure shall provide payments based on the performance of medical homes
			 located in the State in achieving quality and efficiency goals (as defined by
			 the Secretary).</text>
					</paragraph><paragraph id="ID13086ef44bd1441bba894a95ccb298ed"><enum>(2)</enum><header>Payments for
			 health information technology</header>
						<subparagraph id="ID166641c9698f408c986dbce075977aa8"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall establish a prospective, bundled, and
			 risk adjusted structural practice payment to cover health information
			 technology expenses incurred by medical homes under the project.</text>
						</subparagraph><subparagraph id="id5091BA632BBE4BAF8A68CCCE1A2A7E84"><enum>(B)</enum><header>In
			 general</header><text>Such payments shall take into account any expenses the
			 medical home incurs in order to acquire and utilize health information
			 technology, such as clinical decision support tools, patient registries, and
			 electronic medical records.</text>
						</subparagraph></paragraph><paragraph id="id99440DA78B4D4AE7A4A29CF6C094277D"><enum>(3)</enum><header>Payments for
			 physician work outside of office visits</header><text>The Secretary shall
			 establish a prospective, bundled, and risk adjusted structural care
			 coordination payment that represents the value of physician work provided to
			 eligible individuals under the project that is done outside of any office
			 visits.</text>
					</paragraph></subsection><subsection id="ID7b20fd639ddb43adb6ffc0c52816905d"><enum>(e)</enum><header>Evaluation and
			 report</header>
					<paragraph id="idBA8B1DFB84624B4EA61FA68B5B650418"><enum>(1)</enum><header>Evaluation</header><text>The
			 Secretary, in consultation with appropriate pediatric medical associations,
			 shall evaluate the project in order to determine the effectiveness of medical
			 homes in terms of quality improvement, patient and provider satisfaction, and
			 the improvement of health outcomes.</text>
					</paragraph><paragraph id="id46B059EDBE1B48F79EF28E610908E35D"><enum>(2)</enum><header>Report</header><text>Not
			 later than 12 months after completion of the project, the Secretary shall
			 submit to Congress a report on the project containing the results of the
			 evaluation conducted under paragraph (1), together with recommendations for
			 such legislation and administrative action as the Secretary determines to be
			 appropriate.</text>
					</paragraph></subsection><subsection id="id23217F9EC5E346229B58BD3595070880"><enum>(f)</enum><header>Funding</header>
					<paragraph id="id23122A15A95D4FCABCC89701A02C322B"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated, such sums as may
			 be necessary to carry out this section.</text>
					</paragraph><paragraph commented="no" id="id9EC9D3A880F24FB1AAE5D160C8C1FC72"><enum>(2)</enum><header>Prohibition</header><text>Amounts
			 paid to a State under the project shall not be used for purposes of claiming a
			 Federal matching payment under section 1903(a) or 2105(a) of the Social
			 Security Act (42 U.S.C. 1396b(a); 1397ee(a)).</text>
					</paragraph></subsection><subsection commented="no" id="id57D1A4C9D93C4E2B8BE71974CE44C75B"><enum>(g)</enum><header>Waiver</header><text>The
			 Secretary shall waive compliance with such requirements of titles XIX and XXI
			 of the Social Security Act (42 U.S.C. 1396 et seq.; 1397aa et seq.) to the
			 extent and for the period the Secretary finds necessary to conduct the
			 project.</text>
				</subsection></section><section id="id991C3F5BBC3048CAA21A04083CB5F6B5"><enum>506.</enum><header>Disease
			 prevention and treatment demonstration projects for ethnic and racial minority
			 children</header>
				<subsection id="id2030C2EC410B46CBA0A8FBE26AA4B5D2"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="id15852486892D4F96A345646C16118E80"><enum>(1)</enum><header>Child</header><text>The
			 term <quote>child</quote> has the meaning given such term in section 2110(c)(1)
			 of the Social Security Act (42 U.S.C. 1397jj(c)(1)).</text>
					</paragraph><paragraph id="idEAEE4F651CF5490EB83E0E47B60DCA6E"><enum>(2)</enum><header>Medicaid</header><text>The
			 term <quote>Medicaid</quote> means the program established under title XIX of
			 the Social Security Act (42 U.S.C. 1396 et seq.).</text>
					</paragraph><paragraph id="idD685BFDE9FF0483E84E5572FC1EFE0F4"><enum>(3)</enum><header>Projects</header><text>The
			 term <quote>projects</quote> means the demonstration projects established under
			 subsection (b)(1).</text>
					</paragraph><paragraph id="idD8AC246C1A274ECEBA6952DED44CB067"><enum>(4)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Health and Human
			 Services.</text>
					</paragraph><paragraph id="id3FCCCE9B62974FE18CDBEEB020477B0C"><enum>(5)</enum><header>SCHIP</header><text>The
			 term <quote>SCHIP</quote> means the State Children’s Health Insurance Program
			 established under title XXI of the Social Security Act (42 U.S.C. 1397aa et
			 seq.).</text>
					</paragraph><paragraph id="idE61488DC9071426CACEFE1211D3B5C91"><enum>(6)</enum><header>Target
			 individual</header>
						<subparagraph id="id2E2088A7B72F4301A514319594A09014"><enum>(A)</enum><header>In
			 general</header><text>The term <quote>target individual</quote> means a
			 child—</text>
							<clause id="id186D16A0285F48408673F484389F1ACF"><enum>(i)</enum><text>who
			 is a member of a racial and ethnic minority group; and</text>
							</clause><clause id="id8A354EBA26924CA5ADD691C1B42849DA"><enum>(ii)</enum><text>who is enrolled
			 in a State Medicaid program or a State child health plan under SCHIP.</text>
							</clause></subparagraph><subparagraph id="idB2310B5F975F4923BCA8ABCFEBA59BCB"><enum>(B)</enum><header>Racial and
			 ethnic minority group</header><text>The term <quote>racial and ethnic minority
			 group</quote> has the meaning given such term in section 1707(g)(1) of the
			 Public Health Service Act (42 U.S.C. 300u–6(1)).</text>
						</subparagraph></paragraph></subsection><subsection id="ID6f71e11238034f4494004bb7365de470"><enum>(b)</enum><header>Demonstration
			 projects</header>
					<paragraph id="id0FD61DFAAECC4F32A971824E87EC1638"><enum>(1)</enum><header>Establishment</header><text>The
			 Secretary shall establish demonstration projects for the purpose of developing
			 models and evaluating methods that—</text>
						<subparagraph id="IDb2acd6a46c7b48bab29b94b0efc69533"><enum>(A)</enum><text>improve the
			 quality of medical assistance and child health assistance provided to target
			 individuals under Medicaid and SCHIP in order to reduce disparities in the
			 provision of health care services;</text>
						</subparagraph><subparagraph id="IDa6ee220185d946d0b80e774ee2ce72ab"><enum>(B)</enum><text>improve clinical
			 outcomes, satisfaction, quality of life, and the appropriate use of services
			 covered and referral patterns under Medicaid and SCHIP among target
			 individuals;</text>
						</subparagraph><subparagraph id="ID325ffa1b754c46b0829214c3958f6d02"><enum>(C)</enum><text>eliminate
			 disparities in the rate of preventive measures, such as well child visits and
			 immunizations, among target individuals; and</text>
						</subparagraph><subparagraph id="ID0fd0fab82c3a4d019ed3ed3036cd119a"><enum>(D)</enum><text>promote
			 collaboration with community-based organizations to ensure cultural competency
			 of health care professionals and linguistic access for persons with limited
			 English proficiency.</text>
						</subparagraph></paragraph><paragraph id="ID881abd3e4d7244c982e9508dc493d827"><enum>(2)</enum><header>Design</header>
						<subparagraph id="ID9193476fd2114aa0baba6a5bc9989360"><enum>(A)</enum><header>Initial
			 design</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary shall—</text>
							<clause id="idF44288A6A41F405491FB08C71AE418CC"><enum>(i)</enum><text>evaluate best
			 practices in the private sector, community programs, and academic research with
			 respect to methods for reducing health care disparities among target
			 individuals; and</text>
							</clause><clause id="idEED5FFEB437D4170AA1024EEA1BF9D7F"><enum>(ii)</enum><text>design the
			 projects based on such evaluation.</text>
							</clause></subparagraph><subparagraph id="IDa251af3c50704439bb49a26e7c93b26a"><enum>(B)</enum><header>Number and
			 project areas</header>
							<clause id="idBCA4D1195CFC42669ADB39AA34C49554"><enum>(i)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary shall implement not less than 9 projects, including the
			 following:</text>
								<subclause id="IDc50409f11fe346d3ae01e221eaa28dac"><enum>(I)</enum><text>Two projects for
			 each of the 4 following racial and ethnic minority groups:</text>
									<item id="ID0a35117bfda24beda8a39a53eee9282a"><enum>(aa)</enum><text>American
			 Indians, including Alaskan Natives, Eskimos, and Aleuts.</text>
									</item><item id="ID10775b008d104fedb1f2e433200e00ed"><enum>(bb)</enum><text>Asian Americans
			 and Pacific Islanders.</text>
									</item><item id="ID09387e891e324b67aa01047304c08c6d"><enum>(cc)</enum><text>Blacks.</text>
									</item><item id="ID35e9e2698ae34584b9b95a1a3a827836"><enum>(dd)</enum><text>Hispanics (as
			 defined in section 1707(g)(2) of the Public Health Service Act (42 U.S.C.
			 300u–6(g)(2)).</text>
									</item></subclause><subclause id="ID9d386e8c9fbe4d82b69d4e04db380152"><enum>(II)</enum><text>One project
			 within Puerto Rico.</text>
								</subclause></clause><clause id="id69FED4FFBE704AA7AECBE546F48167F3"><enum>(ii)</enum><header>Subpopulations</header><text>The
			 2 projects implemented for the groups described in clause (i)(I) shall each
			 target different ethnic subpopulations within such groups.</text>
							</clause><clause id="id03F4FA7813124C78AFC72586BEAD89A8"><enum>(iii)</enum><header>Rural and
			 inner-city areas</header><text>Not less than 1 of the projects implemented
			 under clause (i)(I) shall be conducted in a rural area and not less than 1 of
			 such projects shall be conducted in an inner-city area.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="IDa759f04890be498dab92b338326e6519"><enum>(c)</enum><header>Reports to
			 congress</header>
					<paragraph id="ID512d4828c9af4014a0024ef511289f5c"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date on which the
			 Secretary initially implements the projects, and biannually thereafter for the
			 duration of the projects, the Secretary shall submit to Congress a report on
			 the projects.</text>
					</paragraph><paragraph id="IDd00e2e4e303e47cb9ed6fe6dfaf738ed"><enum>(2)</enum><header>Contents of
			 report</header><text>Each report submitted under paragraph (1) shall include
			 the following:</text>
						<subparagraph id="IDb023a3d1a6ab4ded8503137d90f0cf96"><enum>(A)</enum><text>A description of
			 the projects.</text>
						</subparagraph><subparagraph id="ID5faf003d86534437a656c805f4adbd1e"><enum>(B)</enum><text>An evaluation
			 of—</text>
							<clause id="ID366dfdd0ff4e4daf865c746a72717e04"><enum>(i)</enum><text>the
			 cost and benefits of the projects, including whether the projects have reduced
			 expenditures under Medicaid and SCHIP;</text>
							</clause><clause id="ID9bfa7347c8c142eeab6b60c364de5f81"><enum>(ii)</enum><text>the quality of
			 the health care services provided to target individuals under the projects,
			 including whether the projects have reduced racial and ethnic health
			 disparities in the quality of health care services provided to such
			 individuals;</text>
							</clause><clause id="ID8364fdde143c4db4a74638753c47c4e9"><enum>(iii)</enum><text>beneficiary and
			 health care provider satisfaction under the projects; and</text>
							</clause><clause id="id039E9F0441984AE783FFA16A5A25BD95"><enum>(iv)</enum><text>whether, based
			 on the factors evaluated under clauses (i) through (iii), the projects should
			 be continued or conducted on an expanded basis.</text>
							</clause></subparagraph><subparagraph id="ID05894485fecd43f899e8169100b9ff7b"><enum>(C)</enum><text>Any other
			 information with respect to the projects the Secretary determines
			 appropriate.</text>
						</subparagraph></paragraph><paragraph id="IDd4f100993f6c4492bca128a650d511e3"><enum>(3)</enum><header>Expansion of
			 projects; implementation of results</header><text>If the initial report
			 submitted under paragraph (1) includes an evaluation under paragraph (2)(B)(iv)
			 that the projects initially established under subsection (b)(1) should be
			 continued or conducted on an expanded basis, the Secretary—</text>
						<subparagraph id="idFEA2D2833CFE4E33A5A24E6AA22290C8"><enum>(A)</enum><text>shall continue to
			 conduct such projects; and</text>
						</subparagraph><subparagraph id="idDE2C92B67F5B4BC58975345711F276FB"><enum>(B)</enum><text>may conduct such
			 additional projects as the Secretary determines appropriate.</text>
						</subparagraph></paragraph></subsection><subsection id="ID09196d03bbfc4a3dacd1294b937e6c88"><enum>(d)</enum><header>Funding for
			 projects</header>
					<paragraph id="idD83804686BC143339721EE5B5491C6CE"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated, such sums as may
			 be necessary to carry out projects under this section.</text>
					</paragraph><paragraph commented="no" id="id0CFA3F6B201046759CCEDE5269AD6860"><enum>(2)</enum><header>Prohibition</header><text>Amounts
			 paid to a State or territory under the projects shall not be used for purposes
			 of claiming a Federal matching payment under section 1903(a) or 2105(a) of the
			 Social Security Act (42 U.S.C. 1396b(a); 1397ee(a)).</text>
					</paragraph></subsection><subsection commented="no" id="id1727DB6FC8014997B679614A8579C9F8"><enum>(e)</enum><header>Waiver</header><text>The
			 Secretary shall waive compliance with such requirements of titles XIX and XXI
			 of the Social Security Act (42 U.S.C. 1396 et seq.; 1397aa et seq.) to the
			 extent and for the period the Secretary finds necessary to conduct the
			 projects.</text>
				</subsection></section></title><title id="id5DDBDEAED6AA4097BED2BF182A110FE1"><enum>VI</enum><header>Commission on
			 children’s health coverage</header>
			<section commented="no" display-inline="no-display-inline" id="id906E5CE760EE4BBEA36D50FE4FBDA665"><enum>601.</enum><header>Commission on
			 children’s health coverage</header>
				<subsection id="ID522301C657484C14A8409FAC789E3C2B"><enum>(a)</enum><header>Establishment
			 of Commission</header>
					<paragraph id="IDFF26917619E146A894A6DDD0521C8CC3"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <quote>Commission on Children’s
			 Health Coverage</quote> (referred to in this section as the
			 <quote>Commission</quote>).</text>
					</paragraph><paragraph id="IDE66DED6B9FD448588D810E13AEF3D4FD"><enum>(2)</enum><header>Membership</header>
						<subparagraph id="id9304D204043D445CA44A933D86AFEDD7"><enum>(A)</enum><header>In
			 general</header><text>The Committee shall be composed of 10 members with
			 academic training and practical experience in—</text>
							<clause id="id288DAD346CC743EC92CAE98B14B9FB47"><enum>(i)</enum><text>the
			 areas of—</text>
								<subclause id="idB25BE8F64CF143349B79FA7611F205CA"><enum>(I)</enum><text>child health and
			 development;</text>
								</subclause><subclause id="id33F9C987F632475CAFCFC56E92E9644C"><enum>(II)</enum><text>maternal health
			 and development;</text>
								</subclause><subclause id="id6E10D6D40042410CB2D4725790A9F922"><enum>(III)</enum><text>pediatric
			 care;</text>
								</subclause><subclause id="id48DC5450F57F4BAABE447B6153E761B7"><enum>(IV)</enum><text>health care
			 financing;</text>
								</subclause><subclause id="idF44C79C163794ED792BDC08238F0F17D"><enum>(V)</enum><text>community-based
			 participatory research;</text>
								</subclause><subclause id="id1B91B1BDA9D3457D89DF44379C90C951"><enum>(VI)</enum><text>public
			 health;</text>
								</subclause><subclause id="id711B9AC3C5B843C4A1013B2141BE3D4D"><enum>(VII)</enum><text>data
			 collection, analysis, and reporting; and</text>
								</subclause><subclause id="id289EBB3F63F24A46A6F803B612456B45"><enum>(VIII)</enum><text>health and
			 health care disparities; and</text>
								</subclause></clause><clause id="id9C90DD73BD2F4E9C855C1AFD0DBB54ED"><enum>(ii)</enum><text>such other areas
			 as the Secretary of Health and Human Services (in this section referred to as
			 the <quote>Secretary</quote>) determines appropriate.</text>
							</clause></subparagraph><subparagraph id="idA9289D89A6DC49869C97619CD39C8139"><enum>(B)</enum><header>Selection</header><text>The
			 Secretary shall appoint members of the Committee. No candidate for appointment
			 on the Committee shall be asked to provide non-relevant information, such as
			 voting record, political party affiliation, or position on particular
			 policies.</text>
						</subparagraph></paragraph><paragraph id="ID3273B8FC42DA4116888CF5C5B78C3EE2"><enum>(3)</enum><header>Term;
			 vacancies</header>
						<subparagraph id="IDB24D11E1E20D4B2395171A2E56662091"><enum>(A)</enum><header>Term</header><text>A
			 member shall be appointed for the life of the Commission.</text>
						</subparagraph><subparagraph id="IDF9EBBD586A6D43A2814C9D7D8FAF76A8"><enum>(B)</enum><header>Vacancies</header><text>A
			 vacancy on the Commission—</text>
							<clause id="IDA9631872155B4CE58B499962B1D0217B"><enum>(i)</enum><text>shall not affect
			 the powers of the Commission; and</text>
							</clause><clause id="ID22AE9E5E9568490B908023D1C2BCBD2E"><enum>(ii)</enum><text>shall be filled
			 in the same manner as the original appointment was made.</text>
							</clause></subparagraph></paragraph><paragraph id="IDD209FD1ED0F9443ABD8B94A9D757B60B"><enum>(4)</enum><header>Meetings</header><text>The
			 Commission shall meet at the call of the Chairperson.</text>
					</paragraph><paragraph id="IDFA8C485DEF7E44919228ECD7C7403119"><enum>(5)</enum><header>Quorum</header><text>A
			 majority of the members of the Commission shall constitute a quorum, but a
			 lesser number of members may hold hearings.</text>
					</paragraph><paragraph id="ID1E82C49D916F4B068A2D96CD14B3CCEF"><enum>(6)</enum><header>Chairperson and
			 Vice Chairperson</header><text>The Commission shall select a Chairperson from
			 among the members of the Commission.</text>
					</paragraph></subsection><subsection id="IDB7C043BB83214712B28C0E9FD1A77847"><enum>(b)</enum><header>Duties</header>
					<paragraph id="ID28ABCDCE8A0F46EC8107C8B841C9DFCD"><enum>(1)</enum><header>Study</header><text>The
			 Commission shall conduct a study of all matters relating to children’s health
			 coverage.</text>
					</paragraph><paragraph id="IDB0884C8E282242119A7C1045E27AC0A2"><enum>(2)</enum><header>Recommendations</header><text>The
			 Commission shall develop recommendations on policy improvements at the State
			 and national levels, and in the private sector, with respect to children’s
			 health coverage.</text>
					</paragraph><paragraph id="ID7D240A7538A64ACD9B6004A70C5C8C19"><enum>(3)</enum><header>Report</header>
						<subparagraph id="idF4E75E55D17E41878F0B33F711A3E430"><enum>(A)</enum><header>Annual
			 reports</header><text>During the 2 year period beginning on the date of
			 enactment of this Act, the Commission shall submit to the President and
			 Congress annual reports evaluating the status of children’s health coverage,
			 together with recommendations for such legislation and administrative
			 administrative actions as the Commission determines would result in
			 improvements in such health coverage at the State and national levels, and in
			 the private sector.</text>
						</subparagraph><subparagraph id="idC88A72C295AC48D5BFB6C5251015390C"><enum>(B)</enum><header>Final
			 report</header><text>Not later than 3 years after such date of enactment, the
			 Commission shall submit to the President and Congress a report that contains
			 the recommendations of the Commission for such legislation and administrative
			 actions as the Commission determines would result in comprehensive health
			 coverage of all children in the United States.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="IDF07ACC39769C491DB68AA3328182CA9D"><enum>(c)</enum><header>Powers</header>
					<paragraph id="ID1618657E01794A3CBD30B1CA7C721E46"><enum>(1)</enum><header>Hearings</header><text>The
			 Commission may hold such hearings, meet and act at such times and places, take
			 such testimony, and receive such evidence as the Commission considers advisable
			 to carry out this Act.</text>
					</paragraph><paragraph id="ID9F2DFF4FD67B4848850FB6A9D5163A41"><enum>(2)</enum><header>Information
			 from Federal agencies</header>
						<subparagraph id="IDC441D234895B4B08BF9511974F6BE278"><enum>(A)</enum><header>In
			 general</header><text>The Commission may secure directly from a Federal agency
			 such information as the Commission considers necessary to carry out this
			 Act.</text>
						</subparagraph><subparagraph id="IDAD56F68235BE45E78F03E5540FE7301A"><enum>(B)</enum><header>Provision of
			 information</header><text>On request of the Chairperson of the Commission, the
			 head of the agency shall provide the information to the Commission.</text>
						</subparagraph></paragraph><paragraph id="ID628DFFD3FCE443AFBBA043B8634B7263"><enum>(3)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other agencies of the Federal
			 Government.</text>
					</paragraph><paragraph commented="no" id="IDD17FC2DA8DE9489C9C793A204115E648"><enum>(4)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
					</paragraph></subsection><subsection commented="no" id="IDCF2AFC6016204C4992172D7E1050ACA9"><enum>(d)</enum><header>Commission
			 personnel matters</header>
					<paragraph id="ID40CD19C2755743E0A877328695537261"><enum>(1)</enum><header>Compensation of
			 members</header>
						<subparagraph id="ID1A40196105E04287A11950D7E5282201"><enum>(A)</enum><header>Non-federal
			 employees</header><text>A member of the Commission who is not an officer or
			 employee of the Federal Government shall be compensated at a rate equal to the
			 daily equivalent of the annual rate of basic pay prescribed for level IV of the
			 Executive Schedule under section 5315 of title 5, United States Code, for each
			 day (including travel time) during which the member is engaged in the
			 performance of the duties of the Commission.</text>
						</subparagraph><subparagraph id="IDF170DB3F2EB24A4DA5FE6C27B54F1CFD"><enum>(B)</enum><header>Federal
			 employees</header><text>A member of the Commission who is an officer or
			 employee of the Federal Government shall serve without compensation in addition
			 to the compensation received for the services of the member as an officer or
			 employee of the Federal Government.</text>
						</subparagraph></paragraph><paragraph id="ID2806C7831D624B0282FF382049442273"><enum>(2)</enum><header>Travel
			 expenses</header><text>A member of the Commission shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for an
			 employee of an agency under subchapter I of chapter 57 of title 5, United
			 States Code, while away from the home or regular place of business of the
			 member in the performance of the duties of the Commission.</text>
					</paragraph><paragraph id="ID0C94A54F18724CA78604561BDE2A59AC"><enum>(3)</enum><header>Staff</header>
						<subparagraph id="IDE0F4CB3012E4442EBCCA7C3B0E2CB797"><enum>(A)</enum><header>In
			 general</header><text>The Chairperson of the Commission may, without regard to
			 the civil service laws (including regulations), appoint and terminate an
			 executive director and such other additional personnel as are necessary to
			 enable the Commission to perform the duties of the Commission.</text>
						</subparagraph><subparagraph id="IDE702DC947A0449AA8F55F169AFCADE1C"><enum>(B)</enum><header>Confirmation of
			 executive director</header><text>The employment of an executive director shall
			 be subject to confirmation by the Commission.</text>
						</subparagraph><subparagraph id="ID5E46BDE4566A42EB82523C89E701671B"><enum>(C)</enum><header>Compensation</header>
							<clause id="IDAA2990FA9B504AEB9E14B14852EACEDD"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the Chairperson
			 of the Commission may fix the compensation of the executive director and other
			 personnel without regard to the provisions of chapter 51 and subchapter III of
			 chapter 53 of title 5, United States Code, relating to classification of
			 positions and General Schedule pay rates.</text>
							</clause><clause id="ID53852F21B50A4AD49866A188D63DA634"><enum>(ii)</enum><header>Maximum rate
			 of pay</header><text>The rate of pay for the executive director and other
			 personnel shall not exceed the rate payable for level V of the Executive
			 Schedule under section 5316 of title 5, United States Code.</text>
							</clause></subparagraph></paragraph><paragraph id="ID2B7B620D91FF4CBD8C1299B90E180B9D"><enum>(4)</enum><header>Detail of
			 Federal Government employees</header>
						<subparagraph id="ID6494AD933D7D4EC79DB151E93E4BA5BD"><enum>(A)</enum><header>In
			 general</header><text>An employee of the Federal Government may be detailed to
			 the Commission without reimbursement.</text>
						</subparagraph><subparagraph id="ID3A4FD5B4FBB244FAA53CA36D5B4E7F64"><enum>(B)</enum><header>Civil service
			 status</header><text>The detail of the employee shall be without interruption
			 or loss of civil service status or privilege.</text>
						</subparagraph></paragraph><paragraph id="ID0B6BBB4F11C648BBA937F2BCD7909B6C"><enum>(5)</enum><header>Procurement of
			 temporary and intermittent services</header><text>The Chairperson of the
			 Commission may procure temporary and intermittent services in accordance with
			 section 3109(b) of title 5, United States Code, at rates for individuals that
			 do not exceed the daily equivalent of the annual rate of basic pay prescribed
			 for level V of the Executive Schedule under section 5316 of that title.</text>
					</paragraph></subsection><subsection id="ID25A6EB519DDD44C08D519751B984DF19"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 section.</text>
				</subsection><subsection id="id22C515DCA5AF4F9697BFC4F37047A882"><enum>(f)</enum><header>Termination of
			 commission</header><text display-inline="yes-display-inline">The Commission
			 shall terminate 90 days after the date on which the Commission submits the
			 final report of the Commission under subsection (b)(3)(B).</text>
