		<section id="IDA2A3FD7B7710408CBD4925CF1C4A6E01" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Higher Education Affordability,
			 Access, and Opportunity Act of 2007</short-title></quote>.</text>
		</section><section id="ID0F7EB3C0A7B74A3EB923A7C1C64AA901"><enum>2.</enum><header>Improvements in
			 market information and public accountability</header>
			<subsection id="IDC95A92771157452F9C00BDD5DD519B06"><enum>(a)</enum><header>Data
			 dissemination</header><text>Section 131(b) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1015(b)) is amended to read as follows:</text>

					<subsection id="IDFA5FD4D2A38A42A693872508F383F85D"><enum>(b)</enum><header>Comparative
				data</header>
						<paragraph id="ID0C02B6F8181140DAB112CDAE2E3951D0"><enum>(1)</enum><header>In
				general</header><text>Each year the Secretary shall make available to the
				public the information described in paragraph (2), disaggregated by institution
				of higher education, in a form that enables the public to compare the
				information among institutions.</text>
						</paragraph><paragraph id="IDDF398A8F36324A62965B0550967B1869"><enum>(2)</enum><header>Information</header><text>The
				information referred to in paragraph (1) is the following:</text>
							<subparagraph id="IDEB98562CF9C149539A403EDA182153C4"><enum>(A)</enum><text>Tuition and fees
				for a full-time undergraduate student.</text>
							</subparagraph><subparagraph id="ID3915D9F12EDE4A178EED52D6D058BA9E"><enum>(B)</enum><text>Cost of
				attendance for a full-time undergraduate student.</text>
							</subparagraph><subparagraph id="ID4A566D662AD2433B8C7A5E56B33B9D12"><enum>(C)</enum><text>The average
				annual cost of attendance for a full-time undergraduate student for the 10
				preceding academic years, or if data is not available for the 10 preceding
				academic years, data for as many of the 10 preceding academic years as is
				available.</text>
							</subparagraph><subparagraph id="IDB908224D229F45D980C6C5FB4EE1FC86"><enum>(D)</enum><text>The percentage of
				full-time undergraduate students receiving financial assistance,
				including—</text>
								<clause id="ID6441329A5913409180AFEBF84696380B"><enum>(i)</enum><text>Federal
				grants;</text>
								</clause><clause id="ID65179134361C4A85A2E47A9EADD7E5FB"><enum>(ii)</enum><text>State and local
				grants;</text>
								</clause><clause id="ID1111902C0D8049108BA9ACBB8C5641E9"><enum>(iii)</enum><text>institutional
				grants; and</text>
								</clause><clause id="ID31C0BD99CA084520AC154004CA11127E"><enum>(iv)</enum><text>loans to
				students.</text>
								</clause></subparagraph><subparagraph id="ID7DB3E863528E40F5BB4085379EF8C0E4"><enum>(E)</enum><text>The average
				percentage of credit hours accepted from students transferring to an
				institution of higher education from another institution of higher education,
				and the policy of the accepting institution of higher education for the
				transfer of credit.</text>
							</subparagraph><subparagraph id="ID1C70D8988A4B4BA3BF40DF4614B3080A"><enum>(F)</enum><text>The percentage of
				students who have completed an undergraduate program who are placed in
				unsubsidized employment not later than 12 months after the date of completion
				of the program.</text>
							</subparagraph><subparagraph id="IDF148CFC95C754F0CADC4A0ECEF3364BE"><enum>(G)</enum><text>A ranking of the
				dollar and percentage increases in tuition and fees for all institutions of
				higher education for which data is available, disaggregated by quartile.</text>
							</subparagraph></paragraph><paragraph id="IDA7763081CC3741A4AD95642030A03188"><enum>(3)</enum><header>Standard
				definitions</header><text>In carrying out this section, the Secretary shall use
				the standard definitions developed under subsection
				(a)(3).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDF9739D5F67024A1090A8A8AAEA01CB6D"><enum>(b)</enum><header>Study and
			 annual report</header><text>Section 131(c) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1015(c)) is amended—</text>
				<paragraph id="IDB96925E98A90443D81B3848B3B7D09C0"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="IDFA515AE07EE24E01B0A09131448B107E"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by inserting <quote>and costs</quote> after
			 <quote>expenditures</quote>;</text>
					</subparagraph><subparagraph id="ID43BCFAA1B00141E1BC9DAE26B56C6F05"><enum>(B)</enum><text>in subparagraph
			 (F), by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="ID1C11468E293741A0807BCBE4CDFCE169"><enum>(C)</enum><text>in subparagraph
			 (G), by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="IDDEC48067A5E24DACA9E761811626D5E2"><enum>(D)</enum><text>by adding at the

				cost of attending an institution of higher education for the 10 preceding
				academic years (if available), disaggregated by type of institution of higher
				education; and</text>
							</subparagraph><subparagraph id="IDC6637D298F094115AC13DF9C566A3BDA"><enum>(G)</enum><text>the assistance
				provided to institutions of higher education by each State, which information
				the Secretary shall make available to the
				public.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID44554080C3ED408D90AE3D69C51113B3"><enum>(3)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="ID20AE15BBADCA4976A0298F2CAD98DA18"><enum>(A)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection">Final</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection">Annual</header-in-text></quote>;</text>

					</subparagraph></paragraph></subsection></section><section id="IDA421EBA297BE47ABBF3BE6DDC0D230E7"><enum>3.</enum><header>Teacher quality
			 enhancement grants</header>
			<subsection id="IDA819B7432CCD4808A3B12C4CE0EA1972"><enum>(a)</enum><header>Definition of
			 high need local educational agency</header><text>Section 201(b)(2) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1021(b)(2)) is amended—</text>
				<paragraph id="IDE1F2933E12B54479B6092284168D3D4B"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>that serves an elementary school
			 or secondary school located in an area in which there is</quote>;</text>
				</paragraph><paragraph id="ID83322F03283F48C7BAA1911D6873A8A1"><enum>(2)</enum><text>in each of
			 subparagraphs (A), (B), and (C), by inserting <quote>that serves an elementary
			 school or secondary school located in an area in which there is</quote> before
			 <quote>a high</quote>;</text>
				</paragraph><paragraph id="ID824EB9BBED3C44CCA173BF47E8B824EC"><enum>(3)</enum><text>in subparagraph
			 (B) (as so amended), by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="ID9E33862AAD4D4F07A9BF0A783C04A3C6"><enum>(4)</enum><text>in subparagraph
			 (C) (as so amended), by striking the period and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="ID3E4B7552FA974E2EA99F72CB9DC41453"><enum>(5)</enum><text>by adding at the
			 end the following:</text>

				less than 600 students in average daily attendance at the schools that are
				served by the local educational agency and all of those schools are designated
				with a school locale code of 7 or 8, as determined by the
				Secretary.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDEEEA4BC301974BECAA125F915FFFDE50"><enum>(b)</enum><header>Definition of
			 eligible partnerships</header><text>Section 203(b)(1)(B) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1023(b)(1)(B)) is amended by inserting <quote>educational service agency
			 (as defined in section 9101 of the <act-name parsable-cite="ESEA">Elementary
			 and Secondary Education Act of 1965</act-name>),</quote> after <quote>State
			 educational agency,</quote>.</text>
			</subsection></section><section id="IDC1CC5C76DEAA464F9C5516F1C8B4F2B4"><enum>4.</enum><header>Grants for job
			 skill training</header><text display-inline="no-display-inline">Title III of
			 the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1051 et seq.) is amended—</text>
			<paragraph id="ID2C012886F87F49A296A38468CD0E6C40"><enum>(1)</enum><text>by redesignating
			 part F as part G; and</text>
			</paragraph><paragraph id="ID40AFA007DD3244508421EFAE59890AD6"><enum>(2)</enum><text>by inserting
			 after part E the following:</text>

					<part id="ID3F335A2DC49040149829CF06FC4C10BB"><enum>F</enum><header>Job
				skill training</header>
						<subpart id="ID9ABE88571CA8407F873EA241D3C029D3"><enum>1</enum><header>Job skill
				training in high-Growth occupations or industries</header>
							<section id="IDDF5EFBC6B9C444F6909ACCFDE9D6AB7A"><enum>371.</enum><header>Job skill
				training in high-growth occupations or industries</header>
								<subsection id="ID279AF72E83D048F7B29DB9081E6CC8A9"><enum>(a)</enum><header>Grants
				authorized</header><text>The Secretary is authorized to award grants, on a
				competitive basis, to eligible partnerships to enable the eligible partnerships
				to provide relevant job skill training in high-growth industries or
				occupations.</text>
								</subsection><subsection id="ID67AF56C700234891AEAFC8E69865FB01"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
									<paragraph id="IDBDFD11931D0A4BDB9DE35A01C617E99C"><enum>(1)</enum><header>Eligible
				partnership</header><text>The term <term>eligible partnership</term> means a
				partnership—</text>
										<subparagraph id="ID56B24B65B0264DB49914880905EA30D4"><enum>(A)</enum><text>between an
				institution of higher education and a local board (as such term is defined in
				section 101 of the Workforce Investment Act of 1998); or</text>
										</subparagraph><subparagraph id="IDC3D0C1EEDE7D4FCFBC784CEF6720A1DC"><enum>(B)</enum><text>if an institution
				of higher education is located within a State that does not operate local
				boards, between the institution of higher education and a State board (as such
				term is defined in section 101 of the Workforce Investment Act of 1998).</text>
										</subparagraph></paragraph><paragraph id="IDF9764500BCBB4D8D878A48CDB924E518"><enum>(2)</enum><header>Nontraditional
				student</header><text>The term <term>nontraditional student</term> means a
				student who—</text>
										<subparagraph id="IDCF4974B46C164E4DA0B8D54D36F7C0F1"><enum>(A)</enum><text>is independent,
				as defined in section 480(d);</text>
										</subparagraph><subparagraph id="ID2D8828F2B5E140488BC86272BB777627"><enum>(B)</enum><text>attends an
				institution of higher education—</text>
											<clause id="ID15767323C7B64A529A26A73C75A5DE99"><enum>(i)</enum><text>on less than a
				full-time basis;</text>
											</clause><clause id="IDCEFF9EC4A4AA4954B85776CF2E22E6D8"><enum>(ii)</enum><text>via evening,
				weekend, modular, or compressed courses; or</text>
											</clause><clause id="IDA606DB20BEF14D35B50465755DCB4A42"><enum>(iii)</enum><text>via distance
				learning methods; or</text>
											</clause></subparagraph><subparagraph id="ID85FC62C9B68D4A129BC32FD7D8D329D9"><enum>(C)</enum><text>has delayed
				enrollment at an institution of higher education.</text>
										</subparagraph></paragraph><paragraph id="ID70BC5C63816D499DA6E954F0CDE6D382"><enum>(3)</enum><header>Institution of
				higher education</header><text>The term <term>institution of higher
				education</term> means an institution of higher education, as defined in
				section 101(b), that offers a 1- or 2-year program of study leading to a degree
				or certificate.</text>
									</paragraph></subsection><subsection id="IDE60F363DFA8C411183761A5579065FBA"><enum>(c)</enum><header>Application</header>
									<paragraph id="ID2A01A10502654A53809E5FC2C3A5D81F"><enum>(1)</enum><header>In
				general</header><text>Each eligible partnership that desires a grant under this
				section shall submit an application to the Secretary at such time, in such
				manner, and accompanied by such additional information as the Secretary may
				require.</text>
									</paragraph><paragraph id="ID14752B4815414C75980F692F187D7112"><enum>(2)</enum><header>Contents</header><text>Each
				application submitted under paragraph (1) shall include a description
				of—</text>
										<subparagraph id="ID22A184C3CE074DFCAACED561B28403EA"><enum>(A)</enum><text>how the eligible
				partnership, through the institution of higher education, will provide relevant
				job skill training for students to enter high-growth occupations or
				industries;</text>
										</subparagraph><subparagraph id="ID98BA27D606154A8A9877C66216C084F4"><enum>(B)</enum><text>local high-growth
				occupations or industries; and</text>
										</subparagraph><subparagraph id="ID15C04DC6CA6743FAB525F5147E815AF9"><enum>(C)</enum><text>the need for
				qualified workers to meet the local demand of high-growth occupations or
				industries.</text>
										</subparagraph></paragraph></subsection><subsection id="ID9756015E69D14C43A6CC288B28D7588E"><enum>(d)</enum><header>Award
				basis</header><text>In awarding grants under this section, the Secretary
				shall—</text>
									<paragraph id="IDFE6A03513D394D59B2411B6899C737E7"><enum>(1)</enum><text>ensure an
				equitable distribution of grant funds under this section among urban and rural
				areas of the United States; and</text>
									</paragraph><paragraph id="ID32C1AE18E3EE40888E732F0FBC1730E5"><enum>(2)</enum><text>take into
				consideration the capability of the institution of higher education—</text>
										<subparagraph id="ID38AD76F7BCF8439EAD713D8A87BD27B8"><enum>(A)</enum><text>to offer
				relevant, high quality instruction and job skill training for students entering
				a high-growth occupation or industry;</text>
										</subparagraph><subparagraph id="ID3B878A2D5D0B488F8939E6464B68EAE9"><enum>(B)</enum><text>to involve the
				local business community and to place graduates in the community in employment
				in high-growth occupations or industries;</text>
										</subparagraph><subparagraph id="IDAE732EBF41D54CF1ACCD11CC88138D35"><enum>(C)</enum><text>to assist
				students in obtaining loans under section 428L, if appropriate, or other forms
				of student financial assistance;</text>
										</subparagraph><subparagraph id="ID19315F4491F248C48DC4BF9C8F30A215"><enum>(D)</enum><text>to serve
				nontraditional or low-income students, or adult or displaced workers;
				and</text>
										</subparagraph><subparagraph id="IDD7C3391685F040AD93FF463E58C43B4F"><enum>(E)</enum><text>to serve students
				from rural or remote communities.</text>
										</subparagraph></paragraph></subsection><subsection id="ID5EFA6A09DF374FE997A7A3FE96357A4B"><enum>(e)</enum><header>Use of
				funds</header><text>Grant funds provided under this section may be used—</text>
									<paragraph id="ID950FB0930372479FAE573431910CA9BE"><enum>(1)</enum><text>to expand or
				create academic programs or programs of training that provide relevant job
				skill training for high-growth occupations or industries;</text>
									</paragraph><paragraph id="ID58749A8F47D04597B0FBDE528692E8A8"><enum>(2)</enum><text>to purchase
				equipment which will facilitate the development of academic programs or
				programs of training that provide training for high-growth occupations or
				industries;</text>
									</paragraph><paragraph id="ID49AFBEEEE6D94C928853FCC23CE37DA7"><enum>(3)</enum><text>to support
				outreach efforts that enable students to attend institutions of higher
				education with academic programs or programs of training focused on high-growth
				occupations or industries;</text>
									</paragraph><paragraph id="ID30D2C37117A54CF09A5473A50CEDB233"><enum>(4)</enum><text>to expand or
				create programs for distance, evening, weekend, modular, or compressed learning
				opportunities that provide relevant job skill training in high-growth
				occupations or industries;</text>
									</paragraph><paragraph id="ID2503A523437944A7870765A87F57FFF3"><enum>(5)</enum><text>to build
				partnerships with local businesses in high-growth occupations or industries;
				and</text>
									</paragraph><paragraph id="IDF6FDD3A35CAA4BE08C070C8B4A8D7A1A"><enum>(6)</enum><text>for other uses
				that the Secretary determines to be consistent with the intent of this
				section.</text>
									</paragraph></subsection><subsection id="ID1E52736A8CCB429E8FC161858F396653"><enum>(f)</enum><header>Requirements</header>
									<paragraph id="IDDB781EABF6BD4A0B8F9190AF648E23D0"><enum>(1)</enum><header>Fiscal
				agent</header><text>For the purpose of this section, the institution of higher
				education in an eligible partnership shall serve as the fiscal agent and grant
				recipient for the eligible partnership.</text>
									</paragraph><paragraph id="IDFFF185C00DEA4106BB6D6B5E567C56AB"><enum>(2)</enum><header>Duration</header><text>The
				Secretary shall award grants under this section for a 1-year period.</text>
									</paragraph><paragraph id="ID1F7FB63612ED4E3A8C66E5025EBA7025"><enum>(3)</enum><header>Availability of
				grant funds</header><text>Grant funds awarded under this section shall be
				available for not more than 18 months unless, at the Secretary’s discretion,
				the Secretary extends the availability of the grant funds.</text>
									</paragraph><paragraph id="ID2376DEF154294B49911CF87B9A9F58B6"><enum>(4)</enum><header>Supplement, not
				supplant</header><text>Funds made available under this section shall be used to
				supplement and not supplant other Federal, State, and local funds available to
				the eligible partnership for carrying out the activities described in
				subsection (e).</text>
									</paragraph></subsection></section></subpart><subpart id="IDE12ADE0F2F614009BFBCE79FCE541CB2"><enum>2</enum><header>Small business
				innovation partnership grants</header>
							<section id="ID8F120A90DC33431D97287D0973B9DD4E"><enum>375.</enum><header>Small business
				innovation partnership grants</header>
								<subsection id="ID2844B00008C04E15BE9B023BB7A78E67"><enum>(a)</enum><header>Grants
				authorized</header><text>The Secretary is authorized to award grants to
				eligible partnerships to enable the eligible partnerships to provide training
				and relevant job skills to small business owners or operators for the purpose
				of facilitating small business development in the communities served by the
				eligible partnerships.</text>
								</subsection><subsection id="ID4074D2378AE543EEA2FB276F3F1D46E1"><enum>(b)</enum><header>Definition of
				eligible partnership</header><text>In this section the term <term>eligible
				partnership</term> means a partnership between or among an institution of
				higher education and 1 or more entities that the Secretary, in consultation
				with the Administrator of the Small Business Administration, identifies as
				facilitating small business development, which may include—</text>
									<paragraph id="ID275532D4F0B343CE84CCB98AC637AFF1"><enum>(1)</enum><text>a community
				development financial institution;</text>
									</paragraph><paragraph id="ID42E041B309C345A385AA654C6AECB404"><enum>(2)</enum><text>a small business
				development center; or</text>
									</paragraph><paragraph id="ID40059FC60DB942FAB22D4D26FEB0DC98"><enum>(3)</enum><text>a microenterprise
				lending institution.</text>
									</paragraph></subsection><subsection id="ID89ECBEF891E049B78E01973F2B543F83"><enum>(c)</enum><header>Award
				basis</header><text>The Secretary shall award grants under this section on the
				basis of—</text>
									<paragraph id="ID596E893A644E461A880491E6A4202A9A"><enum>(1)</enum><text>the ability of an
				eligible partnership to facilitate small business development; and</text>

				eligible partnership to serve a rural community;</text>
										</subparagraph><subparagraph id="ID19A8AD68A128452B8F2D04F3ABDA406F" indent="up1"><enum>(B)</enum><text>the ability of an eligible partnership
				to serve a low-income population; or</text>
										</subparagraph><subparagraph id="ID258A04CE4BDF4151B3E3A6D53E918089" indent="up1"><enum>(C)</enum><text>other criteria developed by the
				Secretary in consultation with the Administrator of the Small Business
				Administration.</text>
										</subparagraph></paragraph></subsection><subsection id="ID8C18A11D13694E169AFA06A85A43D25D"><enum>(d)</enum><header>Limitation</header><text>Of
				the funds appropriated under section 378 for this part for a fiscal year, the
				Secretary is authorized to use not more than $15,000,000 of such funds to carry
				out this section.</text>
								</subsection></section></subpart><subpart id="ID4A9D0DD4F9A7465E9CE94AE892DBB07C"><enum>3</enum><header>Administrative
				provisions</header>
							<section id="ID18F56A766F1B455184E50CB8F07F5F86"><enum>378.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated to carry out this part $65,000,000 for fiscal
				year 2008 and such sums as may be necessary for each of the 4 succeeding fiscal
				years.</text>
							</section></subpart></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="IDE712E7CA80BB4C52B7D52F1E60777A86"><enum>5.</enum><header>Leap
			 applications</header><text display-inline="no-display-inline">Section 415C of
			 the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1070c–2) is amended—</text>
			<paragraph id="ID260E8CB29A7049938274BF45415A8641"><enum>(1)</enum><text>in subsection
			 (a), by inserting after the first sentence the following: <quote>A State agency
			 may submit an application under this section in partnership with a
			 philanthropic organization within the State, a public or private degree
			 granting institution of higher education within the State, or a combination of
			 such organizations or institutions.</quote>; and</text>
			</paragraph><paragraph id="ID0ACFC79B7D194AD88B823D30160880B2"><enum>(2)</enum><text>in subsection
			 (b)(10), by inserting <quote>, from philanthropic, institutional, or private
			 funds, or from a combination of such sources</quote> before the period.</text>
			</paragraph></section><section id="IDF877CBD865294A618791AAB90B4E3809"><enum>6.</enum><header>Workforce
			 development loan program</header><text display-inline="no-display-inline">Part
			 B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of
			 1965</act-name> (20 U.S.C. 1071 et seq.) is amended by inserting after section
			 428K (20 U.S.C. 1078–11) the following:</text>
			<quoted-block act-name="Higher Education Act of 1965" id="ID039CABFC8218433E9A68A164CC80A186">
				<section id="ID79AC07364639436B98898E919CEB057F"><enum>428L.</enum><header>High-Growth
				occupation or industry workforce development student loans</header>
					<subsection id="IDC3A9FB1E10374E57AC088F0434725F9A"><enum>(a)</enum><header>Loan program
				authorized</header><text>The Secretary shall carry out a loan program under
				which eligible students may receive a loan of not more than $2,000 for each of
				the first 2 years of the eligible students’ undergraduate program of study in
				the same manner as the eligible students receive loans under this part and part
				D.</text>
					</subsection><subsection id="IDA7498062081549E080729B403CCE52FA"><enum>(b)</enum><header>Definitions</header>
						<paragraph id="ID7986C4D6E83B42E1AA3EA9F44779BE5D"><enum>(1)</enum><header>Eligible
				institution of higher education</header><text>The term <term>eligible
				institution of higher education</term> means an institution of higher education
				that offers undergraduate academic programs or undergraduate programs of
				training in a subject identified under subsection (d)(1) by the State board of
				the State where the institution of higher education is located.</text>
						</paragraph><paragraph id="IDDE2E47C001B94A88B56E7DCDE44FB398"><enum>(2)</enum><header>Eligible
				student</header><text>The term <term>eligible student</term> means an
				undergraduate student who—</text>
							<subparagraph id="IDBAC6AEE93E324D758E77468CFA965E19"><enum>(A)</enum><text>is otherwise
				eligible for a loan under this part or part D;</text>
							</subparagraph><subparagraph id="IDD6728D7591254BBAA95E4B993F350C2A"><enum>(B)</enum><text>enters into an
				agreement with the eligible institution of higher education where the student
				is or will be in attendance, under which the student agrees to pursue an
				undergraduate academic program or undergraduate program of training that trains
				the student for employment in a high-growth occupation or industry identified
				under subsection (d)(1);</text>
							</subparagraph><subparagraph id="IDAAD9B037ADAC40D292059D484FD3183D"><enum>(C)</enum><text>is age 18 or
				older; and</text>
							</subparagraph><subparagraph id="ID3E73F120CB564AFABABBE61B6662665C"><enum>(D)</enum><text>has an expected
				family contribution (calculated under part F) equal to or less than
				zero.</text>
							</subparagraph></paragraph><paragraph id="ID6E126B11DB5F4E07B195F3889BFAA2F8"><enum>(3)</enum><header>State board;
				local board</header><text>The terms <term>State board</term> and <term>local
				board</term> have the meanings given such terms in section 101 of the Workforce
				Investment Act of 1998.</text>
						</paragraph></subsection><subsection id="IDBDFF8596ED744E7697735D65983D9911"><enum>(c)</enum><header>Limits on loan
				amounts</header>
						<paragraph id="IDE6E7D494492849949C0DE33B3102A8BD"><enum>(1)</enum><header>Annual loan
				limits</header><text>The total aggregate amount of loans made to an eligible
				student under this part (including this section) and part D for each of the
				first and second years of the eligible student’s program of study at an
				eligible institution of higher education, or their equivalent (as determined by
				the Secretary), that may be covered by Federal loan insurance may not exceed an
				amount determined by the Secretary for each such year, notwithstanding sections
				425 and 428.</text>
						</paragraph><paragraph id="ID097DA442394A453AA63982E43BA03309"><enum>(2)</enum><header>Aggregate
				limits</header><text>The Secretary shall include the amount of any loans
				received by an eligible student under this section in calculating the eligible
				student’s aggregate loan limits under sections 425(a)(2) and
				428(b)(1)(B).</text>
						</paragraph><paragraph id="ID34E92257FC6E4B10862A0036954C3872"><enum>(3)</enum><header>Availability of
				other funds</header><text>An eligible student who receives the maximum loan
				amount allowed under this section remains eligible for any other program for
				which the eligible student qualifies under this Act.</text>
						</paragraph></subsection><subsection id="IDEB3EE633F0C645E2AF652D06F968FB0E"><enum>(d)</enum><header>Identification
				of High-Growth occupations or industries</header>
						<paragraph id="ID0C6B7F263CFE48B0B891AE6E09D5DF10"><enum>(1)</enum><header>In
				general</header><text>The State board, in consultation with the local boards
				and the State entity or agency responsible for licensing institutions of higher
				education, shall identify high growth occupations or industries in accordance
				with paragraph (2).</text>
						</paragraph><paragraph id="ID0966BC9A38324F6A886228F102C07856"><enum>(2)</enum><header>Timing</header><text>The
				State board shall review and update the identification required under paragraph
				(1) each time the State board is required to submit or resubmit a State plan
				under section 112 of the Workforce Investment Act of 1998.</text>
						</paragraph><paragraph id="ID2D6CBD39833F47EB810BAA17F0363B7B"><enum>(3)</enum><header>Special
				rule</header><text>A student who has completed 1 year of a 2-year undergraduate
				academic program or undergraduate program of training in a subject which was
				previously identified as preparation for a high-growth occupation or industry
				but, after the review under paragraph (2), is no longer so identified, shall be
				eligible to receive a loan under this section for the student’s second year of
				such program of study if the student—</text>
							<subparagraph id="ID62319931949C4FA3AB562B49533D225B"><enum>(A)</enum><text>qualified as an
				eligible student, as defined in subsection (b)(2), and received a loan under
				this section, for the first year of such program of study; and</text>
							</subparagraph><subparagraph id="ID196249CEF0F0400F97EB6E510A7C01B4"><enum>(B)</enum><text>meets the
				qualifications of subparagraphs (A), (C), and (D) of subsection (b)(2).</text>
							</subparagraph></paragraph></subsection><subsection id="ID388C54FDBC7F443583B86CC28AD25C02"><enum>(e)</enum><header>Funds for
				administration</header>
						<paragraph id="ID28DBE02CE36D426290C2F4A8331638DD"><enum>(1)</enum><header>In
				general</header><text>From funds appropriated under subsection (f), the
				Secretary shall make available to each eligible institution of higher education
				serving an eligible student with a loan made under this section not more than
				the amount determined under paragraph (2).</text>
						</paragraph><paragraph id="ID9D78ACC9B92E4A899B443D637EDE09AF"><enum>(2)</enum><header>Amount</header><text>The
				amount referred to in paragraph (1) for each eligible institution of higher
				education serving an eligible student with a loan made under this section is 2
				percent of the total amount of all loans made under this section to eligible
				students at the eligible institution of higher education, or $100,000,
				whichever is less.</text>
						</paragraph><paragraph id="IDBFC14DCF1CE1494D8CEB1BDFB402BD75"><enum>(3)</enum><header>Uses</header><text>The
				funds made available under paragraph (1) may be used for the following
				purposes:</text>
							<subparagraph id="ID666E7500F8924442BF05C76FB7DAF861"><enum>(A)</enum><header>Office</header><text>To
				create an office of business and workforce partnerships at the eligible
				institution of higher education to provide staff support for building
				relationships between the eligible institution of higher education and local
				businesses.</text>
							</subparagraph><subparagraph id="ID2888E1848F604218853127CD4353630C"><enum>(B)</enum><header>Annual
				report</header><text>To provide an annual report to the Secretary regarding the
				number of eligible students receiving loans made under this section who—</text>
								<clause id="IDA719386C13CA45929825A0C10B6E284E"><enum>(i)</enum><text>remain in their
				academic program or program of training;</text>
								</clause><clause id="ID9F0FCB6E19154CDE823AAD7F482915EE"><enum>(ii)</enum><text>graduate from
				their academic program or program of training;</text>
								</clause><clause id="ID9AC5D35B8EEC40BD958E3EE0218E6567"><enum>(iii)</enum><text>transfer to
				another institution of higher education; or</text>
								</clause><clause id="IDD443E66778424F369CF1E0E9BA4DC35F"><enum>(iv)</enum><text>are placed in
				unsubsidized employment not later than 12 months after graduation.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="ID88EDCF47D64A447DA7E33A1AF5042B6B"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section such sums as may be necessary for fiscal year 2008 and
				each of the 4 succeeding fiscal
				years.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID162A6AB0CB944DEAA6B53498241B1F3B"><enum>7.</enum><header>Requirement
			 relating to credit transfer</header>
			<subsection id="ID75D7E3A92BEA4E8DAE7D92263A95BABC"><enum>(a)</enum><header>Program
			 participation agreements</header><text>Section 487(a) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1094(a)) is amended by adding at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" id="IDDB834737B3F84C8E9FE449FF3EBFE8A6">
					<paragraph id="ID9DA5D916F4C34695806404B4C497CE39"><enum>(24)</enum><text>The institution
				will not exclude the transfer of credits earned by a student completing courses
				or programs at other eligible institutions of higher education solely on the
				basis of the agency or association that accredited such other eligible
				institution if that agency or association is recognized by the Secretary
				pursuant to section 496 to be a reliable authority as to the quality of the
				education or training offered and is currently listed by the Secretary pursuant
				to section
				101(c).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDFCD92853D7B140C59F01FF8D53FA376D"><enum>(b)</enum><header>Accrediting
			 agency and association requirements</header><text>Section 496(a) (20 U.S.C.
			 1099b(a)) is amended—</text>
				<paragraph id="ID49262B9F76F14475BEA422980AC9179D"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (7);</text>
				</paragraph><paragraph id="IDC520375C3DA343A6AA046FC26B4912A9"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (8) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="ID6ED823F3D8BF45C5B49C03440B799DB0"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

				section to be a reliable authority as to the quality of the education or
				training offered and is currently listed by the Secretary pursuant to section
				101(c).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID7223389C2C0446408DCB7D5820026B81"><enum>(c)</enum><header>Accrediting
			 agency standards</header><text>Section 496(a)(5) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1099b(a)(5)) is amended—</text>
				<paragraph id="ID8BF25410426442809D621FE0F8610D26"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (I);</text>
				</paragraph><paragraph id="ID0051429BE12A4854AB69D2C1ADADC66A"><enum>(2)</enum><text>by inserting
			 <quote>and</quote> after the semicolon at the end of subparagraph (J);
			 and</text>
