		<official-title>To amend the Immigration and Nationality Act to improve
		  the competitiveness of the United States in the global economy and to protect
		  against potential visa fraud and abuse.</official-title>

		<section id="idA9CA395B98F74BDE8ED7DCDF4E4E9D20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>H–1B Visa Program Modernization Act of
			 2007</short-title></quote>.</text>
		</section><section id="id597034ED63CD4267B3AC9ED3AD84EDF6" section-type="subsequent-section"><enum>2.</enum><header>Market-based limits
			 for H–1B visas</header><text display-inline="no-display-inline">Section 214(g)
			 of the Immigration and Nationality Act (8 U.S.C. 1184(g)) is amended—</text>
			<paragraph id="IDe1611d7c33074c14af404655dc644dc7"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph id="IDf52f04177ca3477eaba25d5104fa022e"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>(beginning with fiscal year
			 1992)</quote>; and</text>
				</subparagraph><subparagraph id="ID1f630fa535e84213a417046b9b69574d"><enum>(B)</enum><text>in subparagraph
			 (A)—</text>
					<clause id="id02A03246D639493CB8498D4F898FF4D4"><enum>(i)</enum><text>in
			 clause (vi) by striking <quote>and</quote>;</text>
					</clause><clause id="id215D7EDE749148378D4801BAA7572E2B"><enum>(ii)</enum><text>in
			 clause (vii), by striking <quote>each succeeding fiscal year; or</quote> and
			 inserting <quote>each of fiscal years 2004, 2005, 2006, and 2007;</quote>;
			 and</text>
					</clause><clause id="id85F144D627C84D27BE2B3BF53DA2043C"><enum>(iii)</enum><text>by adding after
			 clause (vii) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id469F8574A8D74184BD6BE266B713BCF9" style="OLC">
							<clause commented="no" id="IDa8244893c5104fa59b216554322706b3"><enum>(viii)</enum><text>150,000 for
				fiscal year 2008; and</text>
							</clause><clause commented="no" id="idA26A52F327464BC0873F25240F132B23"><enum>(ix)</enum><text>the number
				calculated under paragraph (9) for each fiscal year after fiscal year 2008;
				or</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph><paragraph id="id389FE974615F4854B9B401136D93BD0D"><enum>(2)</enum><text>by redesignating
			 paragraphs (9), (10), and (11) as paragraphs (10), (11), and (12),
			 respectively; and</text>
			</paragraph><paragraph id="ID7921ea97a63347ee97bf01155883594f"><enum>(3)</enum><text>by inserting
			 after paragraph (8) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD706B22765C94DCA88D68A57352A867A" style="OLC">
					<paragraph id="IDc97ec663e19b4e47bef494d684ab97e3" indent="up1"><enum>(9)</enum><text>If the numerical limitation in
				paragraph (1)(A)—</text>
						<subparagraph id="id12FFC456DEA24C0599C216037F5DD674"><enum>(A)</enum><text>is reached during the previous fiscal
				year, the numerical limitation under paragraph (1)(A)(ix) for the subsequent
				fiscal year shall be equal to 120 percent of the numerical limitation of the
				previous fiscal year; or</text>
						</subparagraph><subparagraph id="idD16FEBFD765141F7BB611CF7764B5631"><enum>(B)</enum><text>is not reached during the previous
				fiscal year, the numerical limitation under paragraph (1)(A)(ix) for the
				subsequent fiscal year shall be equal to the numerical limitation of the
				previous fiscal
				year.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id20861785017B401C97B297F920B265FD"><enum>3.</enum><header>H–1B visa
			 program improvements</header>
			<subsection id="id1A26FD5CE1AE4183B329E3525C22466C"><enum>(a)</enum><header>Safeguards
			 against fraud and misrepresentation in application review
			 process</header><text>Section 212(n)(1)(G) of the Immigration and Nationality
			 Act (8 U.S.C. 1182(n)(1)(G)) is amended—</text>
				<paragraph id="id1A54599A752B4F8D8F517B482B2F1D84"><enum>(1)</enum><text>by inserting
			 <quote>, clear indicators of fraud or misrepresentation of material
			 fact,</quote> after <quote>completeness</quote>;</text>
				</paragraph><paragraph id="idB738F4F955A143E788BA6098EDAF1DB5"><enum>(2)</enum><text>by striking
			 <quote>or obviously inaccurate</quote> and inserting <quote>, presents clear
			 indicators of fraud or misrepresentation of material fact, or is obviously
			 inaccurate</quote>; and</text>
				</paragraph><paragraph id="idC1FFD497E7C044A5BA8A3B49C00ECE6E"><enum>(3)</enum><text>by adding at the
			 end the following: <quote>If the Secretary's review of an application
			 identifies clear indicators of fraud or misrepresentation of material fact, the
			 Secretary may conduct an investigation and hearing under paragraph
			 (2).</quote>.</text>
				</paragraph></subsection><subsection id="ID10c75809b91b453bab10a3d1b5f00be1"><enum>(b)</enum><header>H–1B
			 nonimmigrants not admitted for jobs advertised or offered only to H–1B
			 nonimmigrants</header><text>Section 212(n)(1) of such Act, as amended by this
			 section, is further amended by inserting after subparagraph (G) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id63F18FEF0707453FAB4EAB91578797A5" style="OLC">
					<subparagraph id="id1FF3A6535C3B4D24B306A0849CBAC434" indent="up1"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="idF57BCEA70912412E9EBCF9C9A1A3EB7A"><enum>(i)</enum><text>The employer has not
				advertised the available jobs specified in the application in an advertisement
				that states or indicates that—</text>
							<subclause id="id9946FD9C2A9244579D20AC2D1AB24B0D" indent="up1"><enum>(I)</enum><text>the job or jobs are only available
				to persons who are or who may become H–1B nonimmigrants; or</text>
							</subclause><subclause id="id1B91DB5EC0E9416EB0099F7D96A7F7D6" indent="up1"><enum>(II)</enum><text>persons who are or who may become
				H–1B nonimmigrants shall receive priority or a preference in the hiring
				process.</text>
							</subclause></clause><clause id="id5D553BBC24E84C6782715B1645E65850" indent="up1"><enum>(ii)</enum><text>The employer has not only recruited
				persons who are, or who may become, H–1B nonimmigrants to fill the job or
				jobs.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID6fe4b4f995334b40bfbc1fa108fcbe01"><enum>(c)</enum><header>Limit on
			 percentage of H–1B employees</header><text>Section 212(n)(1) of such Act, as
			 amended by this section, is further amended by inserting after subparagraph
			 (H), as added by subsection (b), the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFFA3CB07788D4BB9A97F244617A25648" style="OLC">
					<subparagraph id="ID717caec3af9d4c9090de43b9a641c60c" indent="up1"><enum>(I)</enum><text>If the employer employs not less than
				50 employees in the United States, not more than 50 percent of such employees
				are H–1B
				nonimmigrants.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID85e98972520a4382bb1cf1cc6405dedd"><enum>(d)</enum><header>Penalties</header><text>Section
			 212(n)(2)(C) of such Act is amended—</text>
				<paragraph id="IDdaa49d5f927548d19dd0ee7ed39d7bd4"><enum>(1)</enum><text>in clause (i)(I),
			 by striking <quote>$1,000</quote> and inserting <quote>$2,000</quote>;</text>
				</paragraph><paragraph id="ID6127a2f26e0d41898bdcb4dd6ccc870e"><enum>(2)</enum><text>in clause
			 (ii)(I), by striking <quote>$5,000</quote> and inserting
			 <quote>$10,000</quote>; and</text>
				</paragraph><paragraph id="ID93a2dd5b20f44ea18d038e545d413736"><enum>(3)</enum><text>in clause
			 (vi)(III), by striking <quote>$1,000</quote> and inserting
			 <quote>$2,000</quote>.</text>
				</paragraph></subsection><subsection id="ID0663c29fea9c4dccb647c0f348b447d2"><enum>(e)</enum><header>Investigations
			 by Department of Labor</header><text>Section 212(n)(2) of such Act, as amended
			 by this section, is further amended—</text>
				<paragraph id="ID9ed84b44fd0f4c0787dcb139ba4e134e"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>12 months</quote> and inserting <quote>24
			 months</quote>; and</text>
				</paragraph><paragraph id="ID036a8c78569644d081d7b6adc36d30ba"><enum>(2)</enum><text>in subparagraph
			 (G)—</text>
					<subparagraph id="IDdf96b03136ef43c3808150ff628d9ffc"><enum>(A)</enum><text>in clause (i), by
			 striking the second sentence;</text>
					</subparagraph><subparagraph id="ID355cfe69b2264f168725a00d8f5de87f"><enum>(B)</enum><text>in clause (iii),
			 by striking the last sentence;</text>
					</subparagraph><subparagraph id="ID67872a7f1c554f5ea178c64f577dad60"><enum>(C)</enum><text>by striking
			 clauses (iv) and (v);</text>
					</subparagraph><subparagraph id="ID07af2366dbac40e8ac2b2f800b983be6"><enum>(D)</enum><text>by redesignating
			 clauses (vi), (vii), and (viii) as clauses (iv), (v), and (vi),
			 respectively;</text>
					</subparagraph><subparagraph id="IDa3f814ee0b9d4cd9bb6699d54202465f"><enum>(E)</enum><text>in clause (iv),
			 as redesignated—</text>
						<clause id="idD50DE7AD9C1B4F56A22F543F7593873D"><enum>(i)</enum><text>by
			 striking <quote>clause (viii)</quote> and inserting <quote>clause (vi)</quote>;
			 and</text>
						</clause><clause id="id6527DDC7439142CA8BC9466F34C0BF00"><enum>(ii)</enum><text>by
			 striking <quote>12 months</quote> and inserting <quote>24 months</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="ID03769752bce640c5895c8bc34d8d8eaa"><enum>(F)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id71D0918843D542DE86FF2C017BEC1D60" style="OLC">
							<clause id="ID8eea271e25264cfb93956f57cac6fccc" indent="up3"><enum>(vii)</enum><text>If the Secretary of Labor, after a
				hearing, finds a reasonable basis to believe that the employer has violated the
				requirements under this subsection, the Secretary may impose a penalty under
				subparagraph
				(C).</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="IDb544b4ea1fe545c5b6560ada8fd0770b"><enum>(f)</enum><header>Information
			 sharing between Department of Labor and Department of Homeland
			 Security</header><text>Section 212(n)(2) of such Act, as amended by this
			 section, is further amended—</text>
				<paragraph id="id21B7BE2B65AA4B92A0E4C44E48125D84"><enum>(1)</enum><text>by redesignating
			 subparagraph (I) as subparagraph (J); and</text>
				</paragraph><paragraph id="id8266430CEBE44A74A66E31FA6B37A977"><enum>(2)</enum><text>by inserting
			 after subparagraph (H) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8D8FBFD607194A9CA3CA046B15A8DC2A" style="OLC">
						<subparagraph id="IDbfa38cb6c6254356b277d72fe32acd13" indent="up2"><enum>(I)</enum><text>The Director of United States
				Citizenship and Immigration Services shall provide the Secretary of Labor with
				any information contained in the materials submitted by H–1B employers as part
				of the adjudication process that indicates that the employer is not complying
				with H–1B visa program requirements. The Secretary may initiate and conduct an
				investigation and hearing under this paragraph after receiving information of
				noncompliance under this
				subparagraph.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDb113291846614c08abcf1458f837b53b"><enum>(g)</enum><header>Information
			 provided to H–1B nonimmigrants upon visa issuance</header>
				<paragraph id="id3C2BF72103C44287828D57FA8306250E"><enum>(1)</enum><header>In
			 general</header><text>Section 212(n) of such Act, as amended by this section,
			 is further amended—</text>
					<subparagraph id="id2D72EF5D760A401AA6F04AFBD3484C52"><enum>(A)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text>
					</subparagraph><subparagraph id="id99D299E4FA8846798144BC857D33B4CE"><enum>(B)</enum><text>by inserting
			 after paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id103AFCECBBBF4CB0B2E861A5662F1EB3" style="OLC">
							<paragraph id="IDe61dc70e6e994acf92d67df1071c730e" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id417552219A30414DA179861D0CB0CA96"><enum>(A)</enum><text>Upon issuing an H–1B
				visa to an applicant outside the United States, the issuing office shall
				provide the applicant with—</text>
									<clause id="idBF0CD810562C40CFACD0A336540CA663" indent="up1"><enum>(i)</enum><text>a brochure outlining the employer's
				obligations and the employee's rights under Federal law, including labor and
				wage protections;</text>
									</clause><clause id="idBBE5445A685B4EA08554FC3AA8777492" indent="up1"><enum>(ii)</enum><text>the contact information for Federal
				agencies that can offer more information or assistance in clarifying employer
				obligations and workers' rights; and</text>
									</clause><clause id="id1D482070844247CBA6CA3B60CEEBAD8B" indent="up1"><enum>(iii)</enum><text>a copy of the employer's H–1B
				application for the position that the H–1B nonimmigrant has been issued the
				visa to fill.</text>
									</clause></subparagraph><subparagraph id="idE38D26F312104D35AAD9ACB70875291C" indent="up1"><enum>(B)</enum><text>Upon the issuance of an H–1B visa to
				an alien inside the United States, the officer of the Department of Homeland
				Security shall provide the applicant with—</text>
									<clause id="id1755E97AC9CA45E0B6E32C9E7EB9FE3A"><enum>(i)</enum><text>a brochure outlining the employer's
				obligations and the employee's rights under Federal law, including labor and
				wage protections;</text>
									</clause><clause id="id28A4C4F430084F13A412AFF10263E90F"><enum>(ii)</enum><text>the contact information for Federal
				agencies that can offer more information or assistance in clarifying employer's
				obligations and workers' rights; and</text>
									</clause><clause id="idDE6C4F4F55914F9E8144E399F8C5C17A"><enum>(iii)</enum><text>a copy of the employer's H–1B
				application for the position that the H–1B nonimmigrant has been issued the
				visa to
				fill.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id45587DD6A0BA42CD9684BA3E0029ACE7"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Section 212(n) of such Act, as amended by this
			 section, is further amended—</text>
					<subparagraph id="idEAC3ED6318134F2BB672D74591FFFF4C"><enum>(A)</enum><text>in paragraph
			 (1)(E)—</text>
						<clause id="idC672DBBA31984F2999A794EA9A1920BD"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>(4)</quote> and inserting <quote>(5)</quote>;
			 and</text>
						</clause><clause id="id3B95A702B1F946708712E089AFD56902"><enum>(ii)</enum><text>in
			 clause (ii)—</text>
							<subclause id="idDB83763BC2E34E6DBA6C2DBC1CD0AEB7"><enum>(I)</enum><text>by striking
			 <quote>(3)</quote> and inserting <quote>(4)</quote>; and</text>
							</subclause><subclause id="idC8EA0987837A4E4E86514752F2F92851"><enum>(II)</enum><text>by striking
			 <quote>(5)</quote> and inserting <quote>(6)</quote>; and</text>
							</subclause></clause></subparagraph><subparagraph id="idFC2CD6FC159D4C67BCD5706F7795470A"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="id57FCBDE411EA4659BB25F87A17ABC56B"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>(5)(A)</quote> and inserting
			 <quote>(6)(A)</quote>; and</text>
						</clause><clause id="idC41C405488604324AEA92658A06E1A94"><enum>(ii)</enum><text>in
			 subparagraph (F), by striking <quote>(5)</quote> and inserting

						</clause></subparagraph></paragraph></subsection><subsection id="ID4bad93389860433b8ad861622586d1dd"><enum>(h)</enum><header>Effective
			 date</header><text>The amendments made by subsections (b) and (c) shall only
			 apply to applications filed after the date of enactment of this Act.</text>
