		<official-title>To amend title XXI of the Social Security Act to provide
		  for equal coverage of mental health services under the State Children's Health
		  Insurance Program.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Children's Mental Health Parity
			 Act</short-title></quote>.</text>
		</section><section id="id40BABA7B75614A2F95EF1350B7FFBC05"><enum>2.</enum><header>Parity for
			 mental health services in SCHIP</header>
			<subsection id="id6A0CF148366C40A0BB957CF94D442DD8"><enum>(a)</enum><header>Assurance of
			 parity</header><text>Section 2103(c) of the Social Security Act (42 U.S.C.
			 1397cc(c)) is amended—</text>
				<paragraph id="idE8776343A7684BE68F52D6A141B6FC56"><enum>(1)</enum><text>by redesignating
			 paragraph (5) as paragraph (6); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58508027258C424AA16CE7A6454B7A33"><enum>(2)</enum><text>by inserting
			 after paragraph (4), the following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="idB64C6AC9F96B4C6C832022A86B4EE7CD"><enum>(5)</enum><header>Mental health
				services parity</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id2459673981EA49C99F180CD8730FDEAB"><enum>(A)</enum><header>In
				general</header><text>In the case of a State child health plan that provides
				both medical and surgical benefits and mental health or substance abuse
				benefits, such plan shall ensure that the financial requirements and treatment
				limitations applicable to such mental health or substance abuse benefits are no
				more restrictive than the financial requirements and treatment limitations
				applied to substantially all medical and surgical benefits covered by the
				plan.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id359E849D36CC43FAA22E86EEFCB93383"><enum>(B)</enum><header>Deemed
				compliance</header><text>To the extent that a State child health plan includes
				coverage with respect to an individual described in section 1905(a)(4)(B) and
				covered under the State plan under section 1902(a)(10)(A) of the services
				described in section 1905(a)(4)(B) (relating to early and periodic screening,
				diagnostic, and treatment services defined in section 1905(r)) and provided in
				accordance with section 1902(a)(43), such plan shall be deemed to satisfy the
				requirements of subparagraph
				(A).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id912D360F01DD4CA08FB96797FAEF9315"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 2103 of such Act (42 U.S.C. 1397cc)
			 is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id5A586349CCA0406B922335517049F58F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding
			 paragraph (1), by striking <quote>subsection (c)(5)</quote> and inserting
			 <quote>paragraphs (5) and (6) of subsection (c)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF9429A7F4E474731B7DC2FD7BD4FFAC5"><enum>(2)</enum><text>in subsection
			 (c)(2), by striking subparagraph (B) and redesignating subparagraphs (C) and
			 (D) as subparagraphs (B) and (C), respectively.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD0A0703178F04616AE6BB5708F1032BD"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section take effect on October
			 1, 2007.</text>
