			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8815663E7EE0458788D4AC773CCC48B6" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purpose of this Act is to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idD6B5162FAB8541D58307DC00F6AF8456"><enum>(1)</enum><text display-inline="yes-display-inline">continue the progress of the Multifamily
			 Assisted Housing Reform and Affordability Act of 1997, as amended by the
			 Mark-To-Market Extension Act of 2001;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC8D1312DFC804029BB245AF14DB2A257"><enum>(2)</enum><text display-inline="yes-display-inline">expand eligibility for Mark-to-Market
			 restructuring so as to further the preservation of affordable housing in a
			 cost-effective manner; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F0EE89956EF49758988E40DB238E9CF"><enum>(3)</enum><text display-inline="yes-display-inline">provide for the preservation and
			 rehabilitation of projects damaged by Hurricanes Katrina, Rita, and Wilma, or
			 by other natural disasters.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id46723BAC4BDB4C988E98F89E5F798A32" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 512 of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1473f">42 U.S.C. 1473f</external-xref> note) is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id194A924C6BA341359ED44F21C7D79282" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="idADF4CF6E7EC140D9BC8D0E1B4B6C037D"><enum>(20)</enum><header display-inline="yes-display-inline">Disaster-damaged eligible project</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id1693453EE1544DE0907C640CC0B2A8C2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <quote>disaster-damaged eligible
				project</quote> means an otherwise eligible multifamily housing project—</text>
						<clause commented="no" display-inline="no-display-inline" id="id27739A327E844229B1C026935798271F"><enum>(i)</enum><text display-inline="yes-display-inline">that is located in a county that was
				designated a major disaster area on or after January 1, 2005, by the President
				pursuant to title IV of the Robert T. Stafford Disaster Relief and Emergency
				Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idFAD0D7EF951B450D95F6E0D0E4DBB032"><enum>(ii)</enum><text display-inline="yes-display-inline">whose owner carried casualty and liability
				insurance covering such project in an amount required by the Secretary;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idAF96F8F2622F4DA8847A4024CA3939E4"><enum>(iii)</enum><text display-inline="yes-display-inline">that suffered damages not covered by such
				insurance that the Secretary determines is likely to exceed $5,000 per unit in
				connection with the natural disaster that was the subject of the designation
				described in subparagraph (A); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id80A5BAE8F5FF4E4286AEF010BBE89A0D"><enum>(iv)</enum><text display-inline="yes-display-inline">whose owner requests restructuring of the
				project not later than 2 years after the date that such damage occurred.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBDD71721D1A04D7F8369D8C4E079D545"><enum>(B)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">A disaster-damaged eligible project shall
				be eligible for amounts under this Act without regard to the relationship
				between rent levels for the assisted units in such project and comparable rents
				for the relevant market
				area.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id489CC5EF1D724790B8007101960E90D1" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Extension of Mark-to-Market
			 program</header><text display-inline="no-display-inline">Section 579 of the
			 Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C.
			 1473f note) is amended by striking <quote>October 1, 2006</quote> each place
			 that term appears and inserting <quote>October 1, 2011</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id033AFCFB39AD407084FADC9C46A63B0D" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Exception rents</header><text display-inline="no-display-inline">Section 514(g)(2) of the Multifamily
			 Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1473f">42 U.S.C. 1473f</external-xref> note) is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idD4FAC266BF3C4A9C8098EE9CF87061F6"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>disaster-damaged
			 eligible projects and</quote> after <quote>waive this limit</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id612C74B6FB85480EBCE493685FA539D9"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>five percent</quote> and
			 inserting <quote>9 percent</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idA157194D4E9148468C3D3959B87DB7E7" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Otherwise eligible projects</header><text display-inline="no-display-inline">Section 514 of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1473f">42 U.S.C. 1473f</external-xref> note) is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idF01B3D2E2F804BE582E8AF2389670169" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="ID477a5c1035c649379527455b8676e5be"><enum>(i)</enum><header display-inline="yes-display-inline">Other eligible projects</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id1B639AEBC96547C6B6A564831D20784C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subtitle, a project that meets the requirements of subparagraphs (B) and (C) of
				section 512(2) but does not meet the requirements of subparagraph (A) of
				section 512(2), may be treated as an eligible multifamily housing project on an
				exception basis if the Secretary determines, subject to paragraph (2), that
				such treatment is necessary to preserve the project in the most cost-effective
				manner in relation to other alternative preservation options.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4d0be3ca2ff04d7ca26cc5d080d0ba53"><enum>(2)</enum><header display-inline="yes-display-inline">Owner request</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9688B89F9ACE43AA8682014F8A3C7C66"><enum>(A)</enum><header display-inline="yes-display-inline">Request required</header><text display-inline="yes-display-inline">The Secretary shall not treat an otherwise
				eligible project described under paragraph (1) as an eligible multifamily
				housing project unless the owner of the project requests such treatment.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBFC7C457AECE419FB4B3CCBE02DC4AD0"><enum>(B)</enum><header display-inline="yes-display-inline">No adverse treatment if no request
				made</header><text display-inline="yes-display-inline">If the owner of a
				project does not make a request under subparagraph (A), the Secretary shall not
				withhold from such project any other available preservation option.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa0c621faa9e24161a95ea172d07f9e64"><enum>(3)</enum><header display-inline="yes-display-inline">Cancellation</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id1A133528127D4035A84119D7ABA4EB98"><enum>(A)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">At any time prior to the completion of a
				mortgage restructuring under this subtitle, the owner of a project may—</text>
							<clause commented="no" display-inline="no-display-inline" id="id4C8DF3EF1D5A4090B52D863F31D214EE"><enum>(i)</enum><text display-inline="yes-display-inline">withdraw any request made under paragraph
				(2)(A); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id825D6C0E09274234A9D164327BCFA29B"><enum>(ii)</enum><text display-inline="yes-display-inline">pursue any other option with respect to the
				renewal of such owner's section 8 contract pursuant to any applicable statute
				or regulation.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE4FA31D4C70841D482FBEDA3D9742FE5"><enum>(B)</enum><header display-inline="yes-display-inline">Documentation</header><text display-inline="yes-display-inline">If an owner of a project withdraws such
				owner's request and pursues other renewal options under this paragraph, such
				owner shall be entitled to submit documentation or other information to replace
				the documentation or other information used during processing for mortgage
				restructuring under this subtitle.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe6a6df834f1c48889f4966e321828b8b"><enum>(4)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The Secretary may exercise the authority to
				treat projects as eligible multifamily housing projects pursuant to this
				subsection only to the extent that the number of units in such projects do not
				exceed 10 percent of all units for which mortgage restructuring pursuant to
				section 517 is
				completed.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id579FFC78D40A46E29461F9CB62CBF7CB" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Disaster-damaged eligible projects</header>
			<subsection commented="no" display-inline="no-display-inline" id="id6294324D4DA0477EA80B9D977429BB2C"><enum>(a)</enum><header display-inline="yes-display-inline">Market rent determinations</header><text display-inline="yes-display-inline">Section 514(g)(1)(B) of the Multifamily
			 Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1473f">42 U.S.C. 1473f</external-xref> note) is
			 amended by striking <quote>determined, are equal</quote> and inserting the
			 following: “determined—</text>
				<quoted-block display-inline="no-display-inline" id="id431B0DE3FE9F45B79D7CE9EC2F35BE53" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="id22B3B4350B644E61B89BDBD0DB21A20B"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a disaster-damaged eligible
				property, are equal to 100 percent of the fair market rents for the relevant
				market area (as such rents were in effect at the time of such disaster;
				and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idB2DC8CCE02B9437182B34C8059C15C2E"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to other eligible multifamily
				housing projects, are
				equal</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id61D8589C2CE149A08A42F5B4232166C8"><enum>(b)</enum><header display-inline="yes-display-inline">Owner investment</header><text display-inline="yes-display-inline">Section 517(c) of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1473f">42 U.S.C. 1473f</external-xref> note) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8131C968ECF3454E9B61D290B14BC477" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id1ECB49E504184028B0EDFFAC76BADE12"><enum>(3)</enum><header display-inline="yes-display-inline">Properties damaged by natural
				disasters</header><text display-inline="yes-display-inline">With respect to a
				disaster-damaged eligible property, the owner contribution toward
				rehabilitation needs shall be determined in accordance with paragraph
				(2)(C).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id99658A68E0874F089D5D6E82893BAB02" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Period of eligibility for nonprofit debt
			 relief</header><text display-inline="no-display-inline">Section 517(a)(5) of
			 the Multifamily Assisted Housing Reform and Affordability Act of 1997 (42
			 U.S.C. 1473f note) is amended by adding at the end the following: “If such
			 purchaser acquires such project subsequent to the date of recordation of the
			 affordability agreement described in section 514(e)(6)—</text>
			<quoted-block display-inline="no-display-inline" id="id6FC47762872E446591702A3874C4442D" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="id5EBF3BA006704179A6ABFF9D930F0F20"><enum>(1)</enum><text display-inline="yes-display-inline">such purchaser shall acquire such project
				on or before the later of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id14A5296BAAD646619263FBEDD9730392"><enum>(A)</enum><text display-inline="yes-display-inline">5 years after the date of recordation of
				the affordability agreement; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61A98F8DEDA54055876E4BA78E66E289"><enum>(B)</enum><text display-inline="yes-display-inline">2 years after the date of enactment of the
				<short-title>Mark-to-Market Extension Act of
				2007</short-title>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6E4E52D9BF174416B76060190C542816"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary shall have received, and
				determined acceptable, such purchaser's application for modification,
				assignment, or forgiveness prior to the acquisition of the project by such
				purchaser.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="idD2970019A5EE43EAA2CF6E1F26ECCCCC" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect on the earlier of—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id814C8AADEB6348E7910F856B5A96B5A8"><enum>(1)</enum><text display-inline="yes-display-inline">the date of enactment of this Act;
			 or</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF79185550CD64DC9988B57BD0F7D5DCF"><enum>(2)</enum><text display-inline="yes-display-inline">September 30, 2007.</text>
