		<official-title>To establish a grant program to facilitate the creation
		  of methamphetamine precursor electronic logbook systems, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Methamphetamine Production
			 Prevention Act of 2007</short-title></quote>.</text>
		</section><section id="ID750361e017f14d1eb33d50b19914ec5b"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="IDf44419d10542490ca33a0f86e5603ae4"><enum>(1)</enum><text>the manufacture,
			 distribution and use of methamphetamine have inflicted damages on individuals,
			 families, communities, businesses, the economy, and the environment throughout
			 the United States;</text>
			</paragraph><paragraph id="ID14fed511f3584d3a9b799f47d56cfe52"><enum>(2)</enum><text>methamphetamine
			 is unique among illicit drugs in that the harms relating to methamphetamine
			 stem not only from its distribution and use, but also from the manufacture of
			 the drug by <quote>cooks</quote> in clandestine labs throughout the United
			 States;</text>
			</paragraph><paragraph id="ID657ed22717ac472285fdd1b040b71c2d"><enum>(3)</enum><text>Federal and State
			 restrictions limiting the sale of legal drug products that contain
			 methamphetamine precursors have reduced the number and size of domestic
			 methamphetamine labs;</text>
			</paragraph><paragraph id="IDdecfb699dbc44851a00db51a15050124"><enum>(4)</enum><text>domestic
			 methamphetamine cooks have managed to circumvent restrictions on the sale of
			 methamphetamine precursors by <quote>smurfing</quote>, or purchasing
			 impermissibly large cumulative amounts of precursor products by traveling from
			 retailer to retailer and buying permissible quantities at each retailer;</text>
			</paragraph><paragraph id="IDc05d86621c544f4b8fa74212cb60e726"><enum>(5)</enum><text>although Federal
			 and State laws require retailers of methamphetamine precursor products to keep
			 written or electronic logbooks recording sales of precursor products, retailers
			 are not always required to transmit this logbook information to appropriate law
			 enforcement and regulatory agencies, except upon request;</text>
			</paragraph><paragraph id="IDf13da5304c8147d1be64401bbe367cdc"><enum>(6)</enum><text>when retailers’
			 logbook information regarding sales of methamphetamine precursor products is
			 kept in a database in an electronic format and transmitted between retailers
			 and appropriate law enforcement and regulatory agencies, such information can
			 be used to further reduce the number of domestic methamphetamine labs by
			 preventing the sale of methamphetamine precursors in excess of legal limits,
			 and by identifying and prosecuting <quote>smurfs</quote> and others involved in
			 methamphetamine manufacturing;</text>
			</paragraph><paragraph id="ID2f4ce40c97cf4a1d8d8b7a1dd606c972"><enum>(7)</enum><text>States and local
			 governments are already beginning to develop such electronic logbook database
			 systems, but they are hindered by a lack of resources;</text>
			</paragraph><paragraph id="IDe682707e2bdc4ea29e5a79178ed65287"><enum>(8)</enum><text>efforts by States
			 and local governments to develop such electronic logbook database systems may
			 also be hindered by logbook recordkeeping requirements contained in section
			 310(e) of the Controlled Substances Act (21 U.S.C. 830(e)) that are tailored to
			 written logbooks and not to electronic logbooks; and</text>
			</paragraph><paragraph id="IDbb4bda3ad8d94ca0b641ec2fbd7ecd5b"><enum>(9)</enum><text>providing
			 resources to States and localities and making technical corrections to the
			 Combat Methamphetamine Epidemic Act of 2005 will allow more rapid and
			 widespread development of such electronic logbook systems, thereby reducing the
			 domestic manufacture of methamphetamine and its associated harms.</text>
			</paragraph></section><section id="IDf836bc48cd9d4f5da183619f25f92273"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="IDfd65ef6db21d4ce8b61b3207caf64846"><enum>(1)</enum><text>the term
			 <term>local</term> means a county, city, town, township, parish, village, or
			 other general purpose political subdivision of a State;</text>
			</paragraph><paragraph id="IDe321c6f444db49aba2204c1c56d179a1"><enum>(2)</enum><text>the term
			 <term>methamphetamine precursor electronic logbook system</term> means a system
			 by which a regulated seller electronically records and transmits to an
			 electronic database accessible to appropriate law enforcement and regulatory
			 agencies information regarding the sale of a scheduled listed chemical product
			 that is required to be maintained under section 310(e) of the Controlled
			 Substances Act (21 U.S.C. 830(e)) (as amended by this Act), State law governing
			 the distribution of a scheduled listed chemical product, or any other Federal,
			 State, or local law;</text>
			</paragraph><paragraph id="ID694c1bf35d2a426888fbb1160a10ba36"><enum>(3)</enum><text>the terms
			 <term>regulated seller</term> and <term>scheduled listed chemical
			 product</term> have the meanings given such terms in section 102 of the
			 Controlled Substances Act (21 U.S.C. 802); and</text>
			</paragraph><paragraph id="ID9cf2577d782f4f36a6246825d8eada1b"><enum>(4)</enum><text>the term
			 <term>State</term>—</text>
				<subparagraph id="id32E3F2AB21424627A35E81F71F1ADCD9"><enum>(A)</enum><text>means a State of
			 the United States, the District of Columbia, and any commonwealth, territory,
			 or possession of the United States; and</text>
				</subparagraph><subparagraph id="id63400C5BCA3E4F7DAC6EDEEA49998540"><enum>(B)</enum><text>includes an
			 <quote>Indian tribe</quote>, as that term is defined in section 102 of the
			 Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. 479a).</text>
				</subparagraph></paragraph></section><section id="ID5e984325df73400ba4109156957a12d7"><enum>4.</enum><header>Authorization
			 for Effective Methamphetamine Precursor Electronic Logbook
			 Systems</header><text display-inline="no-display-inline">Section 310(e)(1) of
			 the Controlled Substances Act (21 U.S.C. 830(e)(1)) is amended—</text>
			<paragraph id="idFDDEA2FE74AB4483BC7EFF93DCB4D024"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(iii), by striking
			 <quote>a written or electronic list</quote> and inserting <quote>a written list
			 or an electronic list that complies with subparagraph (H)</quote>; and</text>
			</paragraph><paragraph id="idF6880EF5B26444FC9EB0C5AE8F1D5D8D"><enum>(2)</enum><text display-inline="yes-display-inline">adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idAD012E32B89848FE8BCA630F81C11600" style="OLC">
					<subparagraph id="IDdef4dd96a94d4b1aa23221bdae66096c"><enum>(H)</enum><header>Electronic
				logbooks</header>
						<clause id="idD78AE23A80C44712AA2086369A73DA16"><enum>(i)</enum><header>In
				general</header><text>A logbook maintained in electronic form shall include,
				for each sale to which the requirement of subparagraph (A)(iii) applies, the
				name of any product sold, the quantity of that product sold, the name and
				address of each purchaser, the date and time of the sale, and any other
				information required by State or local law.</text>
						</clause><clause id="id0AB33F3C818544D48FF1A2331F333F1B"><enum>(ii)</enum><header>Sellers</header><text>In
				complying with the requirements of clause (i), a regulated seller may—</text>
							<subclause id="IDbc0859d372a74b6db75014da693862b5"><enum>(I)</enum><text>ask a prospective
				purchaser for the name and address, and enter such information into the
				electronic logbook, and if the seller enters the name and address of the
				prospective purchaser into the electronic logbook, the seller shall determine
				that the name entered into the electronic logbook corresponds to the name
				provided on the identification presented by the purchaser under subparagraph
				(A)(iv)(I)(aa); and</text>
							</subclause><subclause id="IDea7b3ad7e9cf4a7bbd113a050c4bdeeb"><enum>(II)</enum><text>use a software
				program that automatically and accurately records the date and time of each
				sale.</text>
							</subclause></clause><clause id="ID4910b85769034065a6c655330db0e067"><enum>(iii)</enum><header>Purchasers</header><text>A
				prospective purchaser in a sale to which the requirement of subparagraph
				(A)(iii) applies that is being documented in an electronic logbook shall
				provide a signature in at least one of the following ways:</text>
							<subclause commented="no" id="ID2339b8296443420493e4eae368240f45"><enum>(I)</enum><text>Signing a device
				presented by the seller that captures signatures in an electronic
				format.</text>
							</subclause><subclause commented="no" id="ID7a46e9f6f1544a159f2df8eaeae5954d"><enum>(II)</enum><text>Signing a bound
				paper book.</text>
							</subclause><subclause commented="no" id="ID937f8abdb4974aef830805466f039eac"><enum>(III)</enum><text>Signing a
				printed document that corresponds to the electronically-captured logbook
				information for such purchaser.</text>
							</subclause></clause><clause commented="no" id="idF020FAD3C6E64299A111CE392526262D"><enum>(iv)</enum><header>Electronic
				signatures</header>
							<subclause commented="no" id="id7D18B47BE5B6486686F1E3549D8012DC"><enum>(I)</enum><header>Device</header><text>Any
				device used under clause (iii)(I) shall—</text>
								<item commented="no" id="id04E305D5408D459896DF1328DB31A796"><enum>(aa)</enum><text>preserve each
				signature in a manner that clearly links that signature to the other
				electronically-captured logbook information relating to the prospective
				purchaser providing that signature; and</text>
								</item><item commented="no" id="id5FE625D3E06740CD9A5D2690267285A8"><enum>(bb)</enum><text>display
				information that complies with subparagraph (A)(v).</text>
								</item></subclause><subclause commented="no" id="idB568110AD8D1413F85912EB8F00F1659"><enum>(II)</enum><header>Document
				retention</header><text>A regulated seller that uses a device under clause
				(iii)(I) to capture signatures shall maintain each such signature for not less
				than 2 years after the date on which that signature is captured.</text>
							</subclause></clause><clause commented="no" id="id447CF0DF8D434F0D8DBD86BF790EBF6B"><enum>(v)</enum><header>Paper
				books</header>
							<subclause commented="no" id="idA8592E4CDB9748DEB1105FCB15180E8C"><enum>(I)</enum><header>In
				general</header><text>Any bound paper book used under clause (iii)(II)
				shall—</text>
								<item commented="no" id="id8A027E6390AF4861AD7562C4D95AC443"><enum>(aa)</enum><text>ensure that the
				signature of the prospective purchaser is adjacent to a unique identifier
				number or a printed sticker that clearly links that signature to the
				electronically-captured logbook information relating to that prospective
				purchaser; and</text>
								</item><item commented="no" id="idEC5C3033A0054700B1F772C4E3AA38E8"><enum>(bb)</enum><text>display
				information that complies with subparagraph (A)(v).</text>
								</item></subclause><subclause commented="no" id="idB7D2CBC2A6B54D69BDDAF27DF750258D"><enum>(II)</enum><header>Document
				retention</header><text>A regulated seller that uses bound paper books under
				clause (iii)(II) shall maintain any entry in such books for not less than 2
				years after the date on which that entry is made.</text>
							</subclause></clause><clause commented="no" id="id05B3FFE98B9A41A1A4E63F3F612E3066"><enum>(vi)</enum><header>Printed
				documents</header>
							<subclause commented="no" id="id8321DF11435D42AC9C721057413C5D55"><enum>(I)</enum><header>In
				general</header><text>Any printed document used under clause (iii)(III)
				shall—</text>
								<item id="IDcfaa9be7cea44602a2b40f0e11a80b32"><enum>(aa)</enum><text>be
				printed by the seller at the time of the sale that document relates to;</text>
								</item><item commented="no" id="id84C142DB41474A208A2C8C28087EBC8E"><enum>(bb)</enum><text>display
				information that complies with subparagraph (A)(v);</text>
								</item><item commented="no" id="id53CA05DC66B24BCB858B38BF1672459A"><enum>(cc)</enum><text>for the relevant
				sale, list the name of each product sold, the quantity sold, the name and
				address of the purchaser, and the date and time of the sale;</text>
								</item><item commented="no" id="idBFFDAE364904426797DEDFDB5CA8338E"><enum>(dd)</enum><text>contain a
				clearly identified signature line for a purchaser to sign; and</text>
								</item><item commented="no" id="id6ED66C301B314CE79AF6B56EA2BCE729"><enum>(ee)</enum><text>include a notice
				that the signer has read the printed information and agrees that it is
				accurate.</text>
								</item></subclause><subclause commented="no" id="id2B3C88B8A0314CAE85BC233E08BA3F28"><enum>(II)</enum><header>Document
				retention</header>
								<item commented="no" id="id35A8AA6D83F44E3FA18A268F141E0605"><enum>(aa)</enum><header>In
				general</header><text>A regulated seller that uses printed documents under
				clause (iii)(III) shall maintain each such document for not less than 2 years
				after the date on which that document is signed.</text>
								</item><item commented="no" id="id90A391B44BA14C4AABEB8C1753F982C6"><enum>(bb)</enum><header>Secure
				storage</header><text>Each signed document shall be inserted into a binder or
				other secure means of document storage immediately after the purchaser signs
				the
				document.</text>
								</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="IDa1a5998670254fb9a41cc6886eb219b6"><enum>5.</enum><header>Grants for
			 Methamphetamine Precursor Electronic Logbook Systems</header>
			<subsection id="IDb9365239aad34b60a234cdb763653846"><enum>(a)</enum><header>Establishment</header><text>The
			 Attorney General of the United States, through the Office of Justice Programs
			 of the Department of Justice, may make grants, in accordance with such
			 regulations as the Attorney General may prescribe, to State and local
			 governments to plan, develop, implement, or enhance methamphetamine precursor
			 electronic logbook systems.</text>
			</subsection><subsection id="ID1712155951fa473c99a26b65b941c8f6"><enum>(b)</enum><header>Use of
			 funds</header>
				<paragraph id="ID5a6091b841d14741a1526cb82cb74424"><enum>(1)</enum><header>In
			 general</header><text>A grant under this section may be used to enable a
			 methamphetamine precursor electronic logbook system to—</text>
					<subparagraph id="IDeb6c5b5077b9465f87063eac85aa07c9"><enum>(A)</enum><text>indicate to a
			 regulated seller, upon the entry of information regarding a prospective
			 purchaser into the methamphetamine precursor electronic logbook system, whether
			 that prospective purchaser has been determined by appropriate law enforcement
			 or regulatory agencies to be eligible, ineligible, or potentially ineligible to
			 purchase a scheduled listed chemical product under Federal, State, or local
			 law; and</text>
					</subparagraph><subparagraph id="IDd6f5e726d0944f64b5d60ed6065cbd81"><enum>(B)</enum><text>provide contact
			 information for a prospective purchaser to use if the prospective purchaser
			 wishes to question a determination by appropriate law enforcement or regulatory
			 agencies that the prospective purchaser is ineligible or potentially ineligible
			 to purchase a scheduled listed chemical product.</text>
					</subparagraph></paragraph><paragraph id="IDc7fd088a50ec4b20a0b602e63782280d"><enum>(2)</enum><header>Access to
			 information</header><text>Any methamphetamine precursor electronic logbook
			 system planned, developed, implemented, or enhanced with a grant under this
			 section shall prohibit accessing, using, or sharing information entered into
			 that system for any purpose other than to—</text>
					<subparagraph id="IDbe72988e3fda432ba45cb891172d41ee"><enum>(A)</enum><text>ensure compliance
			 with this Act, section 310(e) of the Controlled Substances Act (21 U.S.C.
			 830(e)) (as amended by this Act), State law governing the distribution of any
			 scheduled listed chemical product, or other applicable Federal, State, or local
			 law; or</text>
					</subparagraph><subparagraph id="IDa5cd52f137b24b1e95ed382c15b9d0e0"><enum>(B)</enum><text>facilitate a
			 product recall to protect public safety.</text>
					</subparagraph></paragraph></subsection><subsection id="ID905e96419dd847338b5a8c15a76f653a"><enum>(c)</enum><header>Grant
			 requirements</header>
				<paragraph id="ID515bc5d56c4f4f69b10b3a04542cfa6e"><enum>(1)</enum><header>Maximum
			 amount</header><text>The Attorney General shall not award a grant under this
			 section in an amount that exceeds $300,000.</text>
				</paragraph><paragraph id="id92E1C3392267453188ECE7A7052216B9"><enum>(2)</enum><header>Duration</header><text>The
			 period of a grant made under this section shall not exceed 3 years.</text>
				</paragraph><paragraph id="ID91a55216868e4cbbbf1e5cab09b8cf0a"><enum>(3)</enum><header>Matching
			 requirement</header><text>Not less than 25 percent of the cost of a project for
			 which a grant is made under this section shall be provided by non-Federal
			 sources.</text>
				</paragraph><paragraph id="IDc2070f2424504e76aa49f616530cd2b4"><enum>(4)</enum><header>Preference for
			 grants</header><text>In awarding grants under this section, the Attorney
			 General shall give priority to any grant application involving a proposed or
			 ongoing methamphetamine precursor electronic logbook system that is—</text>
					<subparagraph id="IDf3e116c79ba74b56bdbeb3370a1c6dcb"><enum>(A)</enum><text>statewide in
			 scope;</text>
					</subparagraph><subparagraph id="ID3d42c49d5e824cd3a557e99e6d6c2e74"><enum>(B)</enum><text>capable of
			 real-time capture and transmission of logbook information to appropriate law
			 enforcement and regulatory agencies;</text>
					</subparagraph><subparagraph id="IDfd242d1a6fdc40bb99fee11c96295e77"><enum>(C)</enum><text>designed in a
			 manner that will facilitate the exchange of logbook information between
			 appropriate law enforcement and regulatory agencies across jurisdictional
			 boundaries, including State boundaries; and</text>
					</subparagraph><subparagraph id="ID2098619e7ae64dc2968bd19aa9ed1161"><enum>(D)</enum><text>developed and
			 operated, to the extent feasible, in consultation and ongoing coordination with
			 the Drug Enforcement Administration, the Office of Justice Programs, the Office
			 of National Drug Control Policy, the non-profit corporation described in
			 section 1105 of the Office of National Drug Control Policy Reauthorization Act
			 of 2006 (21 U.S.C. 1701 note), other Federal, State, and local law enforcement
			 and regulatory agencies, as appropriate, and regulated sellers.</text>
					</subparagraph></paragraph><paragraph id="ID754c6e1356404a5bb8aaeb8d90e16050"><enum>(5)</enum><header>Annual
			 report</header>
					<subparagraph id="id8279EB11969B494389616D4200D21ACD"><enum>(A)</enum><header>In
			 general</header><text>Not later than December 31 of each calendar year in which
			 funds from a grant received under this section are expended, the Attorney
			 General shall submit a report to Congress containing—</text>
						<clause id="ID7e66cbdb7d124e9b8383c5906626529f"><enum>(i)</enum><text>a
			 summary of the activities carried out with grant funds during that year;</text>
						</clause><clause id="ID5c879fe738ba434c818dcc377abf8b52"><enum>(ii)</enum><text>an
			 assessment of the effectiveness of the activities described in clause (i) on
			 the planning, development, implementation or enhancement of methamphetamine
			 precursor electronic logbook systems;</text>
						</clause><clause id="IDdf79eb36dc2d4e9f9674beffd3028ec3"><enum>(iii)</enum><text>an assessment
			 of the effect of the activities described in clause (i) on curtailing the
			 manufacturing of methamphetamine in the United States and the harms associated
			 with such manufacturing; and</text>
						</clause><clause id="ID0c7076f89437404ba7653fcc64e4221f"><enum>(iv)</enum><text>a
			 strategic plan for the year following the year of that report.</text>
						</clause></subparagraph><subparagraph id="ID3e3c192f382744ef983bb1d504b6af03"><enum>(B)</enum><header>Additional
			 information</header><text>The Attorney General may require the recipient of a
			 grant under this section to provide information relevant to preparing any
			 report under subparagraph (A) in a report that grant recipient is required to
			 submit to the Office of Justice Programs of the Department of Justice.</text>
					</subparagraph></paragraph></subsection></section><section id="ID2f6de19edc6e4f978266d2c6558e3129"><enum>6.</enum><header>Study</header>
			<subsection id="ID11cbd4a80af74f82adabdb22ae749f1e"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date on which grant funds
			 under section 5 are first distributed, the Comptroller General of the United
			 States shall conduct a study and submit to Congress a report regarding the
			 effectiveness of methamphetamine precursor electronic logbook systems that
			 receive funding under that section.</text>
			</subsection><subsection id="ID40fe0f534a5c48e6919c377df6523381"><enum>(b)</enum><header>Contents</header><text>The
			 report submitted under subsection (a) shall include—</text>
				<paragraph id="IDe4330a23a73145baa671f09088b1c851"><enum>(1)</enum><text>a summary of the
			 activities carried out with grant funds during the previous year;</text>
				</paragraph><paragraph id="ID683ecb3ce34d43b5a8a45a049f1f0a8c"><enum>(2)</enum><text>an assessment of
			 the effectiveness of the activities described in paragraph (1) on the planning,
			 development, implementation or enhancement of methamphetamine precursor
			 electronic logbook systems in the United States;</text>
				</paragraph><paragraph id="ID12f20ce9173a4278a8da7ea639519c32"><enum>(3)</enum><text>an assessment of
			 the extent to which proposed or operational methamphetamine precursor
			 electronic logbook systems in the United States, including those that receive
			 funding under section 5, are—</text>
					<subparagraph id="ID9fdbb31eb1ea43688f292432d873593d"><enum>(A)</enum><text>statewide in
			 scope;</text>
					</subparagraph><subparagraph id="ID124f115313814baf800b815daae20ddb"><enum>(B)</enum><text>capable of
			 real-time capture and transmission of logbook information to appropriate law
			 enforcement and regulatory agencies;</text>
					</subparagraph><subparagraph id="ID27cbdecb490948d2a4a36d63b80735cb"><enum>(C)</enum><text>designed in a
			 manner that will facilitate the exchange of logbook information between
			 appropriate law enforcement and regulatory agencies across jurisdictional
			 boundaries, including State boundaries; and</text>
					</subparagraph><subparagraph id="IDba9736baf17744cc9b6b9721d5180f0f"><enum>(D)</enum><text>developed and
			 operated, to the extent feasible, upon consultation with and in ongoing
			 coordination with the Drug Enforcement Administration, the Office of Justice
			 Programs, the Office of National Drug Control Policy, the non-profit
			 corporation described in section 1105 of the Office of National Drug Control
			 Policy Reauthorization Act of 2006 (21 U.S.C. 1701 note), other Federal, State,
			 and local law enforcement and regulatory agencies, as appropriate, and
			 regulated sellers;</text>
					</subparagraph></paragraph><paragraph id="ID94886901dc134cd5ae3e3e3b410e5cea"><enum>(4)</enum><text>an assessment of
			 the effect of methamphetamine precursor electronic logbook systems, including
			 those that receive funding under this Act, on curtailing the manufacturing of
			 methamphetamine in the United States and reducing its associated harms;</text>
				</paragraph><paragraph id="ID977afd1028064869b0e6d6145141428e"><enum>(5)</enum><text>recommendations
			 for further curtailing the domestic manufacturing of methamphetamine and
			 reducing its associated harms; and</text>
				</paragraph><paragraph id="IDd1ce9b87fefd42b18190be1a99d3275e"><enum>(6)</enum><text>such other
			 information as the Comptroller General determines appropriate.</text>
				</paragraph></subsection></section><section id="ID5df790d967d04cf59e39218f47ecceb9"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act—</text>
			<paragraph id="ID83ceba1174a545278e353223b1a08637"><enum>(1)</enum><text>$3,000,000 for
			 fiscal year 2008; and</text>
			</paragraph><paragraph id="ID521fd7f87c8c44648b0f8ff60a270279"><enum>(2)</enum><text>such sums as may
			 be necessary for each fiscal year thereafter.</text>
