			 inserting <quote>firm, and workers in a service sector firm or subdivision of a
			 service sector firm, or public agency)</quote>.</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id7A316D714F5A4EDDBEA576E95E5F392E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">such workers' firm, subdivision, or public
				agency has obtained or is likely to obtain such services from a foreign
				country.</text>

				secretary’s determinations</header>
								<paragraph commented="no" display-inline="no-display-inline" id="IDA2AE86E54C054468B591FF181DB420B7"><enum>(1)</enum><header>Increased
				imports</header><text display-inline="yes-display-inline">For purposes of
				subsection (a)(2)(A)(ii), the Secretary may determine that increased imports of
				like or directly competitive articles or services exist if the workers’ firm or
				subdivision or customers of the workers’ firm or subdivision accounting for not
				less than 20 percent of the sales of the workers’ firm or subdivision certify
				to the Secretary that they are obtaining such articles or services from a
				foreign country.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID03F6399EC37C4A118A5D0F1453441EC6"><enum>(2)</enum><header>Obtaining
				services abroad</header><text display-inline="yes-display-inline">For purposes
				of subsection (a)(2)(B)(ii), the Secretary may determine that the workers’
				firm, subdivision, or public agency has obtained or is likely to obtain like or
				directly competitive services from a foreign country based on a certification
				thereof from the workers’ firm, subdivision, or public agency.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6BB3849E7D449D2821D10865C02AC48"><enum>(3)</enum><header>Authority of
				the Secretary</header><text display-inline="yes-display-inline">The Secretary
				may obtain the certifications under paragraphs (1) and (2) through
				questionnaires or in such other manner as the Secretary determines is
				appropriate.</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID79BC8C30B40043129F92358E59B18927"><enum>(1)</enum><header>Assistance</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="TA74/251">Section 251</external-xref> of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341</external-xref>) is
			 amended—</text>

				services, including methods to identify increased imports due to the relocation
				of United States firms to foreign countries, and increased imports due to

			 date</header><text display-inline="no-display-inline">The amendments made by
			 this title shall take effect on the date that is 90 days after the date of the

			 Assistance for Industries</header>

			 requesting investigation</header><text display-inline="no-display-inline">Section 221 of the

			 determination</header><text display-inline="no-display-inline">Section 223 of
			 the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) is
			 amended by adding at the end the following:</text>

				recent marketing

				(c), (d), or (e), the Secretary shall certify as eligible for trade adjustment
				assistance under section 223(a) workers employed in the domestic production of
				the article that is the subject of the trade remedy, safeguard determination,
				or antidumping or countervailing duty determination, as the case may be, if
				such workers become totally or partially separated, or are threatened to become
				totally or partially separated not more than 1 year before or not more than 1
				year after the applicable date.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8AE3DA7625304A11ABE154E0B3F2FA8F"><enum>(2)</enum><header>Applicable
				date</header><text display-inline="yes-display-inline">In this section, the
				term <term>applicable date</term> means—</text>

				requirements for workers</header><text display-inline="yes-display-inline">The
				provisions of subchapter B shall apply in the case of a worker covered by a
				certification under this section or section 223(e), except as follows:</text>

				for <quote>26th week</quote> in subclause (I); and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB55367A6D7A14748889848FE304070BF"><enum>(B)</enum><text display-inline="yes-display-inline">by substituting <quote>26th week</quote>
				for <quote>20th week</quote> in subclause (II).</text>

			 separation tolled during litigation</header><text display-inline="no-display-inline">Section 233 of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2293) is
			 amended by adding at the end the following:</text>

			 general</header><text>Subchapter A of chapter 2 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> is amended by
			 inserting after section 221, the following new section:</text>

				advice to any person or entity described in section 221(a)(1) desiring to file
				a petition for certification of eligibility under section 221.</text>

				assistance</header><text>The Director shall coordinate with each agency
				responsible for providing adjustment assistance under this chapter or chapter 6

				255A) and shall provide technical and legal assistance and advice to enable
				persons or entities described in section 221(a)(1) to prepare and file
				petitions for certification under section

			 insurance</header>
					<subsection id="ID1142F38C33424E54AE388503681072A8"><enum>(a)</enum><header>In
			 general</header><text>Section 246(a)(3) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2318(a)(3)) is
			 amended to read as follows:</text>

				years of age;</text>

					</subsection><subsection id="idC8C1B0963A9646138F76061EA387DA40"><enum>(c)</enum><header>Funding for
			 training</header><text>Section 236(a) of the Trade Act of 1974 (19 U.S.C.
			 2296(a)) is amended—</text>

			 by striking <quote>Upon such approval</quote> and all that follows to the end;

			 paragraph (2) to read as follows:</text>

								<paragraph id="idA6C9932B0CFB40BC91D08AAC4297C1ED"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDB79C1E7ED4A4D4CAC6DB326A3FE9242"><enum>(A)</enum><text>Upon approval of a
				training program under paragraph (l), and subject to the limitations imposed by
				this section, an adversely affected worker covered by a certification issued
				under section 223 shall be eligible to have payment of the costs of that
				training, including any costs of an approved training program incurred by a
				worker before a certification was issued under section 223, made on behalf of
				the worker by the Secretary directly or through a voucher system.</text>
									</subparagraph><subparagraph id="IDa15621f66dc943bb8c72c3b5a426eaf5" indent="up1"><enum>(B)</enum><text>Not later than 6 months after the date
				of enactment of the Trade Adjustment Assistance Improvement Act of 2007, the
				Secretary shall develop, and submit to Congress for approval, a formula that
				provides workers with an individual entitlement for training costs to be
				administered pursuant to sections 239 and 240. The formula shall take into
				account—</text>
										<clause id="IDbaecb1ccfb9146cf98c329c6e36bffa6"><enum>(i)</enum><text>the number of workers enrolled in
				trade adjustment assistance;</text>
										</clause><clause id="IDae8a17518c9a488fb438bb7a9487aa20"><enum>(ii)</enum><text>the duration of the
				assistance;</text>
										</clause><clause id="ID9b3841f784ba476a83b93ef7cbb05e32"><enum>(iii)</enum><text>the anticipated training costs
				for workers; and</text>
										</clause><clause id="ID03a3135f8d4840ad9b5ddac4a9695da1"><enum>(iv)</enum><text>any other factors the Secretary
				deems appropriate.</text>
										</clause></subparagraph><subparagraph id="ID09fc84010a9c4cd4acf9d67f9868a7d7" indent="up1"><enum>(C)</enum><text>Until such time as Congress approves
				the formula, the total amount of payments that may be made under subparagraph
				(A) for any fiscal year shall not exceed 50 percent of the amount of trade
				readjustment allowances paid to workers during that fiscal
				year.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="id38B7E85CDFDA4DCC913DABF2210A88FF"><enum>(d)</enum><header>Approved
			 training programs</header>

				to cover all costs of the State associated with operating the trade adjustment
				assistance program, including case worker

			 collection</header><text>Subchapter C of chapter 2 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> is amended by
			 inserting after section 249, the following new section:</text>

				prescribed by the Secretary, collect any data necessary to meet the
				requirements of this chapter. The Secretary shall collect and publish, on an
				annual basis, the following:</text>
									<paragraph id="ID64F9487C9015452294CFCBBB0B17AB52"><enum>(1)</enum><text>The number of
				workers certified and the number of workers actually participating in the trade
				adjustment assistance program.</text>
									</paragraph><paragraph id="IDE18D283DB97C415F9B660B4D929B1785"><enum>(2)</enum><text>The time for
				processing petitions.</text>
									</paragraph><paragraph id="ID1BEC04CA965C47649852AAE114CE2632"><enum>(3)</enum><text>The number of
				training waivers granted.</text>
									</paragraph><paragraph id="ID6BA616CBCA974CB38041036FA1F6DA5C"><enum>(4)</enum><text>The number of
				workers receiving benefits and the type of benefits being received.</text>
									</paragraph><paragraph id="ID1ACB5A1E44C24A42870453B743EF2F3F"><enum>(5)</enum><text>The number of
				workers enrolled in, and the duration of, training by major types of
				training.</text>
									</paragraph><paragraph id="IDC86186532A044E7DAB485F3012E4264D"><enum>(6)</enum><text>Earnings history
				of workers that reflects wages before separation and wages in any job obtained
				after receiving benefits under this Act.</text>
									</paragraph><paragraph id="ID5DC8BD9027A246E1ACB068F4922F853E"><enum>(7)</enum><text>Reemployment
				rates and sectors in which dislocated workers have been employed.</text>
									</paragraph><paragraph id="IDCF11E5E1D1B44CA6997FD7C6448862E9"><enum>(8)</enum><text>The cause of
				dislocation identified in each petition that resulted in a certification under
				this chapter.</text>
									</paragraph><paragraph id="IDE64FB94BC8DF4606BDBA09344D64FE8E"><enum>(9)</enum><text>The number of
				petitions filed and workers certified in each congressional district of the
				United States.</text>
									</paragraph></subsection><subsection id="IDC8D2C2A51C374CEEA2A3346B7EFEB51E"><enum>(b)</enum><header>State
				participation</header><text>The Secretary shall ensure, to the extent
				practicable, through oversight and effective internal control measures the
				following:</text>
									<paragraph id="ID98CB5C3494B74605963283450744284A"><enum>(1)</enum><header>State
				participation</header><text>Participation by each State in the collection of
				data required under subsection (a) and shall provide incentives for States to
				supplement employment and wage data obtained through the use of unemployment
				insurance wage records.</text>
									</paragraph><paragraph id="ID964A0B904BDD4EB8AE4530694480235E"><enum>(2)</enum><header>Monitoring</header><text>Monitoring
				by each State of internal control measures with respect to program measurement
				data collected by each State.</text>
									</paragraph><paragraph id="ID440EBD605A294843BEE4C95D127318AA"><enum>(3)</enum><header>Response</header><text>The
				quality and speed of the rapid response provided by each State under section
				134(a)(2)(A) of the Workforce Investment Act of 1998 (29 U.S.C.
				2864(a)(2)(A)).</text>
									</paragraph></subsection><subsection commented="no" id="ID84838591FFF64DA6BF4A0A49B0667850"><enum>(c)</enum><header>Report</header>
									<paragraph commented="no" id="IDF95EAE17602645A4BDF5143E5BC2FA4C"><enum>(1)</enum><header>Annual
				report</header><text>Not later than 1 year after the date of enactment of this
				Act, and annually thereafter, the Secretary shall submit to the Committee on
				Finance of the Senate and the Committee on Ways and Means of the House of
				Representatives and make available to each State and to the public a report
				that includes the information collected under this
				section.</text>

			 of marketing year and other provisions</header>
					<subsection id="ID404F35BC4E314578BDF25925188093B6"><enum>(a)</enum><header>In
			 general</header><text>Section 291(5) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401(5)) is
			 amended by inserting before the end period the following: <quote>, or in the
			 case of an agricultural commodity that has no officially designated marketing
			 year, in a 12-month period for which the petitioner provides written
			 request</quote>.</text>
					</subsection><subsection id="ID74D3DB9A94144209B7861C11BB100D41"><enum>(b)</enum><header>Fishermen</header><text>Notwithstanding
			 any other provision of law, for purposes of chapter 2 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2271 et
			 seq.) fishermen who harvest wild stock shall be eligible for adjustment
			 assistance to the same extent and in the same manner as a group of workers
			 under such chapter 2.</text>
					</subsection></section><section id="ID0E13A54F8EB540A4A98E393BA2F4C4AE"><enum>322.</enum><header>Eligibility</header>
					<subsection id="ID6984522319E84AA9ACAF9809A5328C2F"><enum>(a)</enum><header>In
			 general</header><text>Section 292(c)(1) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401a(c)(1)) is
			 amended by striking <quote>80 percent</quote> and inserting <quote>90
			 percent</quote>.</text>
					</subsection><subsection id="id3F4274D48BE04040BB738791AE941C26"><enum>(b)</enum><header>Special rule
			 for qualified subsequent years</header><text>Paragraph (2) of section 292(d) of
			 the Trade Act of 1974 (19 U.S.C. 2401A(d)(2)) is amended to read as

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9F0CC3CF57B74954BF172C0380BCA75B"><enum>(c)</enum><header>Net farm
			 income</header><text>Section 296(a)(1)(C) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401e(a)(1)(C)) is
			 amended by inserting before the end period the following: <quote>or the
			 producer had no positive net farm income for the 2 most recent consecutive
			 years in which no adjustment assistance was received by the producer under this
			 chapter</quote>.</text>
