		<official-title>To amend section 485(f) of the Higher Education Act of
		  1965 regarding law enforcement emergencies.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Campus Law Enforcement Emergency
			 Response Act of 2007</short-title></quote>.</text>
		</section><section id="ID77ce558a48f84f2f9d34e53f146007ad"><enum>2.</enum><header>Law enforcement
			 emergencies</header><text display-inline="no-display-inline">Section 485(f) of
			 the Higher Education Act of 1965 (20 U.S.C. 1092(f)) is amended—</text>
			<paragraph id="id51EDF5D00CBF43D4A9DEEBEC77AAC138"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (9) through
			 (15) as paragraphs (10) through (16), respectively;</text>
			</paragraph><paragraph id="id0B1F7032CD9F43F9BD82090C24E3867D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (8) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idF7EEB464ABAF42C391F1FC5104A596F3" style="OLC">
					<paragraph id="IDb2d51bec304247f5ad2bc795d5f7c29d"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id85E3B264860547DCB9CA52C3FA63144B"><enum>(A)</enum><text>Each institution of
				higher education participating in any program under this title shall develop
				and distribute as part of the report described in paragraph (1)—</text>
							<clause id="idF97979335B824462B6031782D88C917F" indent="up1"><enum>(i)</enum><text>a statement of policy regarding the
				institution’s law enforcement emergency response program; and</text>
							</clause><clause id="idEF2EC4627E154DA186946C21E34914C5" indent="up1"><enum>(ii)</enum><text>statistics concerning the
				occurrence of law enforcement emergencies on the campus of the
				institution.</text>
							</clause></subparagraph><subparagraph id="ID1bae32e464d845bf9168f272bb189cd1" indent="up1"><enum>(B)</enum><text>In this paragraph:</text>
							<clause id="idAFC90B3952AF49EB87C469D77CB3034D"><enum>(i)</enum><text>The term <quote>campus</quote> has
				the meaning given the term in paragraph 6(A)(i), except that the term
				includes—</text>
								<subclause id="idFA6A361393234A738C8C3DD3154F89E5"><enum>(I)</enum><text>a noncampus building or property, as
				defined in paragraph (6)(A)(ii), of an institution of higher education;
				and</text>
								</subclause><subclause id="id45963128DFDF42DEA8BDD0FCB35B38D4"><enum>(II)</enum><text>any public property, as defined in
				paragraph (6)(A)(iii), of an institution of higher education.</text>
								</subclause></clause><clause id="id8820508F089D4333AD56E2CAB66DCE7D"><enum>(ii)</enum><text>The term <term>law enforcement
				emergency</term> means a shooting, the presence of an armed and dangerous
				person, a bomb threat, the presence of an unauthorized hazardous or toxic
				material that poses a threat to health and safety, a lock-down, a reverse
				evacuation, or any other comparable type of incident, on the campus of an
				institution of higher education, that involves the participation of one or more
				law enforcement agencies.</text>
							</clause></subparagraph><subparagraph id="ID7e96eadcd8fc4dfe9ecca6c63c81337d" indent="up1"><enum>(C)</enum><text>The policy described in subparagraph
				(A) shall address the following:</text>
							<clause id="IDa5d3c3db39914db2b51254d052f160d7"><enum>(i)</enum><text>Procedures students, employees, and
				others on the campus of the institution will be directed to follow if a law
				enforcement emergency occurs.</text>
							</clause><clause id="ID2d799b063b054a00b1f9b81bdc2115af"><enum>(ii)</enum><text>Procedures the institution and law
				enforcement agencies will follow to inform students, employees, and others on
				the campus of the institution about a law enforcement emergency on the campus
				and will follow to direct the actions of the students, employees, and others.
				Such procedures may include e-mail alerts, telephone alerts, text-message
				alerts, radio announcements, television alerts, audible alert signals, and
				public address announcements.</text>
							</clause></subparagraph><subparagraph id="IDb125108e7f0943b7b4d63992a501cb14" indent="up1"><enum>(D)</enum><text>Each institution participating in any
				program under this title shall test the institution’s law enforcement emergency
				response policy and procedures on at least an annual basis.</text>
						</subparagraph><subparagraph id="ID88eba4ef6ffb4f6bba5584fb669384e4" indent="up1"><enum>(E)</enum><text>Each institution participating in any
				program under this title shall make reports to the students, employees, and
				others on the campus of the institution, not later than 30 minutes after the
				discovery of a law enforcement emergency on the campus, through the procedures
				described in subparagraph (C)(ii).</text>
						</subparagraph><subparagraph id="ID3bbd3656e9504040bae1f27e89f33905" indent="up1"><enum>(F)</enum><text>The Secretary and the Attorney General
				shall jointly have the authority—</text>
							<clause id="id88CB950663CD44CD83508A6FF809B590"><enum>(i)</enum><text>to review, monitor, and ensure
				compliance with this paragraph;</text>
							</clause><clause id="id4F80E650649944A698791E117E8FAFC0"><enum>(ii)</enum><text>to advise institutions of higher
				education on model law enforcement emergency response policies, procedures, and
				practices; and</text>
							</clause><clause id="id87A5A359C7FE4855874713B5349E3942"><enum>(iii)</enum><text>to disseminate information
				concerning those policies, procedures, and practices.</text>
							</clause></subparagraph><subparagraph id="ID1d27ee1132924fb485143bb093caf0ab" indent="up1"><enum>(G)</enum><header>Campus law enforcement emergency
				response grants</header>
							<clause id="ID2f0bd86bf65a4b69afbb81ecfa2ca70f"><enum>(i)</enum><header>Program
				authority</header><text>The Secretary may make grants to institutions of higher
				education or consortia of such institutions, or enter into contracts with such
				institutions, consortia, and other organizations, to develop, implement,
				operate, improve, test, or disseminate campus law enforcement emergency
				response policies, procedures, or programs.</text>
							</clause><clause id="IDa6ae96a159a247a4912af7ce1703424a"><enum>(ii)</enum><header>Awards</header><text>Grants and
				contracts under this subparagraph shall be awarded—</text>
								<subclause id="idCAE557BE3FE0409D9CD7E82921B2BADE"><enum>(I)</enum><text>on a competitive basis; and</text>
								</subclause><subclause id="idE347A9AA2C734357B6054D627AB21773"><enum>(II)</enum><text>for a period not to exceed 1
				year.</text>
								</subclause></clause><clause id="IDa093de4965954f1aa24122dfa3ba729c"><enum>(iii)</enum><header>Applications</header><text>An
				institution of higher education, a consortium, or an organization that desires
				to receive a grant or enter into a contract under this subparagraph shall
				submit an application to the Secretary at such time, in such manner, and
				containing or accompanied by such information as the Secretary may reasonably
				require by regulation.</text>
							</clause><clause id="ID8ed3ce51f8244d88a436b8ef99e7030c"><enum>(iv)</enum><header>Participation</header><text>In
				awarding grants and contracts under this subparagraph, the Secretary shall make
				every effort to ensure—</text>
								<subclause id="ID35f8de8604b54b6abb559af926a8e21f"><enum>(I)</enum><text>the equitable participation of
				institutions of higher education that are eligible to participate in programs
				under this title;</text>
								</subclause><subclause id="ID9c54c9ccb862424ab64fe245162553dd"><enum>(II)</enum><text>the equitable geographic participation
				of such institutions; and</text>
								</subclause><subclause id="ID948a8810a88f46f69269c099034d22ff"><enum>(III)</enum><text>the equitable participation of such
				institutions with large and small enrollments.</text>
								</subclause></clause><clause id="ID134e24e9a9c5454c9cef1ad8f52d7032"><enum>(v)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this subparagraph $5,000,000 for fiscal year 2008 and such sums as may be
				necessary for each of the 4 succeeding fiscal
				years.</text>
