		<official-title>To amend the Clean Air Act to establish carbon dioxide
		  new source performance standards for new coal-fired electric generating
		  units.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Clean Coal Act of
			 2007</short-title></quote>.</text>
		</section><section id="ID47a91828de854572ba1baccd014e617d"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID7b2fabc119944f27a0d9554745f0a7bf"><enum>(1)</enum><text>fossil fuel-fired
			 power plants are the largest source of carbon dioxide emissions in the United
			 States, releasing approximately 2,500,000,000 tons of heat-trapping carbon
			 dioxide in 2004;</text>
			</paragraph><paragraph id="IDb410fe9e880f45bbad0f8943898f6781"><enum>(2)</enum><text>United States
			 power plants are responsible for nearly 40 percent of the carbon dioxide
			 emissions of the United States;</text>
			</paragraph><paragraph id="ID616537f89418416c9d2e07b26c08bef4"><enum>(3)</enum><text>coal power plants
			 are responsible for producing approximately 30 percent of United States annual
			 carbon dioxide emissions;</text>
			</paragraph><paragraph id="IDaf5afd62930b4fce98712a0d007a3b93"><enum>(4)</enum><text>according to the
			 National Energy Technology Laboratory of the Department of Energy—</text>
				<subparagraph id="ID2cfa5b3d0d264d42b06ce04ba90a447d"><enum>(A)</enum><text>over 150 new
			 coal-fired electric generating units are proposed to be constructed in the
			 United States, which would produce 96 gigawatts of new electric generating
			 capacity; and</text>
				</subparagraph><subparagraph id="ID49968e5951a447e9a39ef7077895b296"><enum>(B)</enum><text>if the units
			 described in subparagraph (A) are constructed, the units would produce—</text>
					<clause id="ID0204b79c6e46468fbc510da2ef83dbf4"><enum>(i)</enum><text>an
			 incremental increase of 500,000,000 tons of carbon dioxide per year from the
			 production by the power sector in the United States as in existence on the date
			 of enactment of this Act; and</text>
					</clause><clause id="ID0b031064452343b49db0fc8ca4821164"><enum>(ii)</enum><text>an
			 estimated 30,000,000,000 additional tons of carbon dioxide over the course of
			 the useful lives of the units;</text>
					</clause></subparagraph></paragraph><paragraph id="ID7e6682595e2d40eab320c0f4104e1133"><enum>(5)</enum><text>once completed,
			 power plants often operate for 50 years or more;</text>
			</paragraph><paragraph id="ID972ae2cb4dfd4702a69bd7b8d55c48b7"><enum>(6)</enum><text>in August 2006,
			 Xcel Energy announced a project for generating electricity from coal that will
			 use available technology to capture carbon dioxide and store the carbon dioxide
			 underground;</text>
			</paragraph><paragraph id="ID589e7f9e2b0b4741a6dd97d1b6227cae"><enum>(7)</enum><text>designing and
			 building power plants to achieve lower carbon dioxide emissions is far less
			 expensive and more efficient than retrofitting conventional power plants that
			 have excessive carbon dioxide emissions;</text>
			</paragraph><paragraph id="ID2552a6e58cbd483fb9995c2a2139bd52"><enum>(8)</enum><text>on February 26,
			 2006, the Administrator of the Environmental Protection Agency published final
			 emission standards for new fossil fuel-fired electric utility steam generating
			 units and improperly failed to include emission standards for heat-trapping
			 carbon dioxide;</text>
			</paragraph><paragraph id="ID6b2e048747b444638169fd7a04f5edaa"><enum>(9)</enum><text>in 2006, the
			 Energy Information Administration forecast that annual carbon dioxide pollution
			 from power plants will increase by 1,100,000,000 tons between 2004 and
			 2030;</text>
			</paragraph><paragraph id="ID000ec1b82d3e495c9a7dd7e8ac3ee145"><enum>(10)</enum><text>the projected
			 increase in annual carbon dioxide pollution from power plants in 2030 is
			 equivalent to the annual carbon dioxide emissions from 196,000,000 cars;</text>
			</paragraph><paragraph id="IDeb58d568b6a3424f8d5aa6cffc150f16"><enum>(11)</enum><text>global
			 temperatures increased an average of 1.4 degrees Fahrenheit during the 21st
			 century, which contribute to—</text>
				<subparagraph id="idABA822C25F8D47F4ACD6E7DAFD042075"><enum>(A)</enum><text>melting
			 glaciers;</text>
				</subparagraph><subparagraph id="idFE6BD05DEE0F457FA7361C498B695C32"><enum>(B)</enum><text>disappearing
			 species;</text>
				</subparagraph><subparagraph id="id9BF6D364E91A468E90303C3889C65C59"><enum>(C)</enum><text>more extreme
			 weather patterns, including heat waves in 2006 that killed more than 200
			 Americans, including more than 160 Californians; and</text>
				</subparagraph><subparagraph id="idF48BC4A37D20451C8164C5DF0EBD46CE"><enum>(D)</enum><text>more intense
			 hurricanes;</text>
				</subparagraph></paragraph><paragraph id="IDecb3dcf517024dfeb944b2d30db7fd2a"><enum>(12)</enum><text>the temperature
			 of the Earth is now the highest it has been in the past 12,000 years, and is
			 only 1.8 degrees Fahrenheit cooler than the maximum temperature of the past
			 1,000,000 million years; and</text>
			</paragraph><paragraph id="ID2bd49d6bfc7f4411a28d2cb53541e013"><enum>(13)</enum><text>unless
			 significant action is taken today to reduce emissions, the Earth could warm
			 between 5 and 9 degrees Fahrenheit causing the ice sheets to melt, sea levels
			 to rise, and flooding to occur.</text>
			</paragraph></section><section id="ID9368328a42844a309be4a5377a808f55"><enum>3.</enum><header>Carbon dioxide
			 new source performance standards for new coal-fired electric generating
			 units</header><text display-inline="no-display-inline">Section 111 of the Clean
			 Air Act (42 U.S.C. 7411) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id65599797CBF14C4EAE619F7DF4118CC9" style="OLC">
				<subsection id="ID9cc388a78f38487e8a10a06406f9e64c"><enum>(k)</enum><header>Carbon dioxide
				standards of performance for affected units</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idF2DD6C72B7E94F8CA7AEFB54F32D7A81"><enum>(1)</enum><header>Definition of
				affected unit</header><text display-inline="yes-display-inline">In this
				subsection, the term <term>affected unit</term> means a new coal-fired electric
				generating unit (including a cogeneration facility) that commences construction
				on or after April 26, 2007.</text>
					</paragraph><paragraph id="ID4993f673b933494cbbf1b3ef065bc42d"><enum>(2)</enum><header>Emissions
				limitation</header><text>Each affected unit shall meet, without interruption
				throughout the lifetime operation of the affected unit, a standard of
				performance that, at a minimum, requires the affected unit to produce not more
				than 285 pounds of carbon dioxide per megawatt-hour for supply to the
				grid.</text>
					</paragraph><paragraph id="ID156fe0e9904043519d4abf5ca20b1db9"><enum>(3)</enum><header>Revisions</header>
						<subparagraph id="id878D93E70D214BAAA3C3B5063712D2C8"><enum>(A)</enum><header>In
				general</header><text>Not later than January 1, 2012, and every 5 years
				thereafter, the Administrator shall revise the carbon dioxide standard of
				performance established under paragraph (2) to reduce the maximum rate of
				carbon dioxide emissions if a reduced level is achievable through the
				application of the best technological system of continuous emission reduction
				demonstrated at the time of the revision.</text>
						</subparagraph><subparagraph id="idE540B22DB1474FF380691E452C1FCBC9"><enum>(B)</enum><header>Publication</header><text>The
				revision (or determination that a reduced level is not achievable) shall be
				published in the Federal Register (after notice and opportunity for public
				comment) not later than the deadline required, and shall be considered final
				agency action, under section 307(b)(1).</text>
						</subparagraph></paragraph><paragraph id="ID7aacefa537a148e6be6c21f6b4f7d442"><enum>(4)</enum><header>Injection into
				geological formations</header><text>Carbon dioxide that is injected into a
				geological formation in a manner that prevents the release of the carbon
				dioxide into the atmosphere, as determined by the Administrator, shall not be
				counted as carbon dioxide emissions discharged from an affected unit for
				purposes of meeting the carbon dioxide standard of performance under this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
