			 2007</short-title></quote>.</text>

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42
			 U.S.C. 7401</external-xref> et seq.) is amended by adding at the end the
			 following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID4AD362A1191145D6A31D371F28ADC611"><enum>(1)</enum><text display-inline="yes-display-inline">public health and the environment continue
				to suffer as a result of pollution emitted by powerplants across the United
				States, despite the success of
				<external-xref legal-doc="public-law" parsable-cite="pl/101/549">Public Law
				101–549</external-xref> (commonly known as the <quote><act-name parsable-cite="CAA">Clean Air Act</act-name> Amendments of 1990</quote>)
				(<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C.
				7401</external-xref> et seq.) in reducing emissions;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0A44393E3929435BB65306CFE068B3E3"><enum>(2)</enum><text display-inline="yes-display-inline">according to the most reliable scientific
				knowledge, acid rain precursors must be significantly reduced for the
				ecosystems of the Northeast and Southeast to recover from the ecological harm
				caused by acid deposition;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID19277E4055FE46438F009ED174425417"><enum>(3)</enum><text display-inline="yes-display-inline">because lakes and sediments across the
				United States are being contaminated by mercury emitted by powerplants, there
				is an increasing risk of mercury poisoning of aquatic habitats and
				fish-consuming human populations;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7FAA17596A84472690A1B7BA42EC0071"><enum>(4)</enum><text display-inline="yes-display-inline">electricity generation accounts for
				approximately 40 percent of the total emissions in the United States of carbon
				dioxide, a major global warming pollutant causing global warming;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID62047E5ED2B14E1698FC629162090078"><enum>(5)</enum><text display-inline="yes-display-inline">the cumulative impact of powerplant
				emissions on public and environmental health must be addressed swiftly by
				reducing those harmful emissions to levels that are less threatening;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID582ca77428974993b68a712fdd666a42"><enum>(6)</enum><text display-inline="yes-display-inline">1,803,000,000 metric tons of carbon dioxide
				equivalent were emitted during 1990;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFAF2385502CA4E50A292DAE172F0F619"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDAD085CB47D12492A853D4250AEB21960"><enum>(A)</enum><text display-inline="yes-display-inline">the atmosphere is a public resource;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF10540055E5B44BEB9F04D21ADFB60A9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">emission allowances, representing
				permission to use that resource for disposal of air pollution from electricity
				generation, should be allocated to promote public purposes, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID8EE768D612904FB783FE687F663105B5"><enum>(i)</enum><text display-inline="yes-display-inline">protecting electricity consumers from
				adverse economic impacts;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID0E6E0B85DBF34E60AD79D4789B10CA7F"><enum>(ii)</enum><text display-inline="yes-display-inline">providing transition assistance to
				adversely affected employees, communities, and industries; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID52EF8F56CAA844128D73ED0766A35F66"><enum>(iii)</enum><text display-inline="yes-display-inline">promoting clean energy resources and energy
				efficiency;</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7bda79a8183241ec8b9745c9f8f2def6"><enum>(8)</enum><text display-inline="yes-display-inline">an array of technological options exist for
				use in reducing global warming pollution emissions, and significant reductions
				can be attained using a portfolio of options that will not adversely impact the
				economy;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB2B7D61E76749CDB19BFE28D69FF560"><enum>(9)</enum><text display-inline="yes-display-inline">the ingenuity of the people of the United
				States will allow the United States to become a leader in solving global
				warming; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32BEF35BE08C4991B0A552B6FBFA97DA"><enum>(10)</enum><text display-inline="yes-display-inline">it should be a goal of the United States to
				achieve a reduction in global warming pollution emissions in the United
				States—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idD419DFFCEFF14CC78A5C7B3C6DB8B133"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure that the average global
				temperature does not increase by more than 3.6 degrees Fahrenheit (2 degrees
				Celsius); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48DE72E22B074C22A4D16C056D69FA1B"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure the achievement of an average
				global atmospheric concentration of global warming pollutants that does not
				exceed 450 parts per million in carbon dioxide equivalent.</text>
								</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="IDA4AACD742880421690CDDB09265058F8" section-type="subsequent-section"><enum>702.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDC87F5AEB7F0744CFAF856F0022F95BD1"><enum>(1)</enum><text display-inline="yes-display-inline">to alleviate the environmental and public
				health damage caused by emissions of sulfur dioxide, nitrogen oxides, global
				warming pollutants, and mercury resulting from the combustion of fossil fuels
				in the generation of electric and thermal energy;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCDDBDF6401AA437D00C5A526ABA29824"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce the annual national emissions
				from electric generation facilities to not more than—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id5A7BF5C5A483440FBAE78E7DA843F475"><enum>(A)</enum><text display-inline="yes-display-inline">for calendar years 2010 through
				2012—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID97BB80230D484A86B25D77A6140267CD"><enum>(i)</enum><text display-inline="yes-display-inline">2,250,000 tons of sulfur dioxide;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID1037B9654BBF4DA3B62E6DFA97A29E02"><enum>(ii)</enum><text display-inline="yes-display-inline">1,510,000 tons of nitrogen oxides;
				and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA41D250A45E4AF6896F18CBE47BE8E6"><enum>(B)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter—</text>
									<clause commented="no" display-inline="no-display-inline" id="id0E2B68CA87C64C058B87CE442D717131"><enum>(i)</enum><text display-inline="yes-display-inline">1,300,000 tons of sulfur dioxide;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id0E7BB82E4D374908B826085159D0C340"><enum>(ii)</enum><text display-inline="yes-display-inline">900,000 tons of nitrogen oxides;</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9804D6EF0DB743BAAA1F623ED3E1805E"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC62BB070580E4BDD8D339AFE6FA4C0EA"><enum>(A)</enum><text display-inline="yes-display-inline">to reduce, by December 31, 2012, the annual
				national emissions of mercury from electric generation facilities to not more
				than 5 tons; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F408E7DFAC34EBD9984202F037F3D1B" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">to
				the maximum extent practicable, to achieve a facility-specific reduction in
				emissions of mercury of more than 90 percent;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA0FB15F11F034B1CB4C073E9DB7420D9"><enum>(4)</enum><text display-inline="yes-display-inline">beginning in calendar year 2010, to reduce
				each calendar year the annual national emissions of global warming pollutants
				from electric generation facilities to achieve a reduction in emissions of
				global warming pollutants equal to—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID1b5615612c2c4e62a637d262cf6bbff1"><enum>(A)</enum><text display-inline="yes-display-inline">by December 31, 2011, not more than
				2,300,000,000 metric tons of carbon dioxide equivalent;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9948711c6cf34c5db13d5461d14d655d"><enum>(B)</enum><text display-inline="yes-display-inline">by December 31, 2015, not more than
				2,100,000,000 metric tons of carbon dioxide equivalent;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2794BC1E28D54F9BA69EE8ABBDDDA92E"><enum>(C)</enum><text display-inline="yes-display-inline">by December 31, 2020, not more than
				1,803,000,000 metric tons of carbon dioxide equivalent; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90788E2DF3504072B427DA1A1C68045F"><enum>(D)</enum><text display-inline="yes-display-inline">by December 31, 2025, not more than
				1,500,000,000 metric tons of carbon dioxide equivalent;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID813588B4489B4BA6A638E7EF6D5105BF"><enum>(5)</enum><text display-inline="yes-display-inline">to effectuate the reductions described in
				paragraphs (2) through (4) by—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDA8B5C581F92640DB94989BBE902BABB6"><enum>(A)</enum><text display-inline="yes-display-inline">requiring electric generation facilities to
				comply with specified emission limitations by specified deadlines; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID281868F0958A4FEBA089CD112D5F68FF"><enum>(B)</enum><text display-inline="yes-display-inline">allowing electric generation facilities to
				meet the emission limitations (other than the emission limitation for mercury)
				through an alternative method of compliance consisting of an emission allowance
				and transfer system;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ECDEE3392994CC4ADC0D7A2A8457B86"><enum>(6)</enum><text display-inline="yes-display-inline">to reduce, by December 31, 2050, emissions
				from power plants of global warming pollutants that cause global warming to
				facilitate the achievement of an economy-wide reduction, consistent with the
				goal of stabilization of worldwide atmospheric concentrations of global warming
				pollutants at 450 parts per million carbon dioxide equivalent; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D067DEC0A5046D8B2DA00785DAFCC06"><enum>(7)</enum><text display-inline="yes-display-inline">to encourage energy conservation, use of
				renewable and clean alternative technologies, and pollution prevention as
				long-range strategies, consistent with this title, for reducing air pollution
				and other adverse impacts of energy generation and use.</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID369370C3A3B04A7A9FC1C53621EFA2B6" section-type="subsequent-section"><enum>703.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id44952403B20C4291A3D269A687A12AEF"><enum>(1)</enum><header display-inline="yes-display-inline">Academy</header><text display-inline="yes-display-inline">The term <term>Academy</term> means the
				National Academy of Sciences.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1c55fb1125b446908b012e15455f72d9"><enum>(2)</enum><header display-inline="yes-display-inline">Carbon dioxide equivalent</header><text display-inline="yes-display-inline">The term <term>carbon dioxide
				equivalent</term> means, for each global warming pollutant, the quantity of the
				global warming pollutant that makes the same contribution to global warming as
				1 metric ton of carbon dioxide, as determined by the Administrator, taking into
				consideration the report described in section 705(d)(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5DC36D0056044672B31E37F84DCA0126"><enum>(3)</enum><header display-inline="yes-display-inline">Covered pollutant</header><text display-inline="yes-display-inline">The term <term>covered pollutant</term>
				means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDC0B2047B06C349939940D9FE03269515"><enum>(A)</enum><text display-inline="yes-display-inline">sulfur dioxide;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5970CC6948E545D8ADEFC076AD372C8F"><enum>(B)</enum><text display-inline="yes-display-inline">any nitrogen oxide;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID776D894EF1FA4B1597EEE86ED7D07642"><enum>(C)</enum><text display-inline="yes-display-inline">mercury; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id211242392AC14ABDA32ECDC5CAE77E69"><enum>(D)</enum><text display-inline="yes-display-inline">any global warming pollutant.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC1728738D17A4D709015FE26A8FA001F"><enum>(4)</enum><header display-inline="yes-display-inline">Electric generation facility</header><text display-inline="yes-display-inline">The term <term>electric generation
				facility</term> means an electric or thermal electricity generating unit, a
				combination of such units, or a combination of 1 or more such units and 1 or
				more combustion devices, that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7D23C79F83374D5CBF1610702B483EEA"><enum>(A)</enum><text display-inline="yes-display-inline">has a nameplate capacity of 25 megawatts or
				more (or the equivalent in thermal energy generation, determined in accordance
				with a methodology developed by the Administrator);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1D63E89C10D9454E97032500383E8BD9"><enum>(B)</enum><text display-inline="yes-display-inline">generates electric energy, for sale,
				through combustion of fossil fuel; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9E988315434C4812AC1B6F5C9B2F81E1"><enum>(C)</enum><text display-inline="yes-display-inline">emits a covered pollutant into the
				atmosphere.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6B3F4ACAE93F4652B640F9CD79A27E2F"><enum>(5)</enum><header display-inline="yes-display-inline">Electricity intensive product</header><text display-inline="yes-display-inline">The term <term>electricity intensive
				product</term> means a product with respect to which the cost of electricity
				consumed in the production of the product represents more than 5 percent of the
				value of the product.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID211D6FCD4545491E99066122C2131B09"><enum>(6)</enum><header display-inline="yes-display-inline">Emission allowance</header><text display-inline="yes-display-inline">The term <term>emission allowance</term>
				means a limited authorization to emit in accordance with this title—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDFD2E8068CF0A4C26B1961FBD07ACEE86"><enum>(A)</enum><text display-inline="yes-display-inline">1 ton of sulfur dioxide;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBD2581BCC7E94A15BBFE8D56EF519434"><enum>(B)</enum><text display-inline="yes-display-inline">1 ton of nitrogen oxides; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE000C381E044D46985F388F2E85594C"><enum>(C)</enum><text display-inline="yes-display-inline">1 ton of global warming pollutant.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC201268407FC43BDB48E08E484E7F399"><enum>(7)</enum><header display-inline="yes-display-inline">Energy efficiency project</header><text display-inline="yes-display-inline">The term <term>energy efficiency
				project</term> means any specific action (other than ownership or operation of
				an energy efficient building) commenced after the date of enactment of this
				title—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDDEB031FF79A847EF9BD91E438309A08C"><enum>(A)</enum><text display-inline="yes-display-inline">at a facility (other than an electric
				generation facility), that verifiably reduces the annual electricity or natural
				gas consumption per unit output of the facility, as compared with the annual
				electricity or natural gas consumption per unit output that would be expected
				in the absence of an allocation of emission allowances (as determined by the
				Administrator); or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID871A5AB7C9A74419BE9328019EC285CF"><enum>(B)</enum><text display-inline="yes-display-inline">by an entity that is primarily engaged in
				the transmission and distribution of electricity, that significantly improves
				the efficiency of that type of entity, as compared with standards for
				efficiency developed by the Administrator, in consultation with the Secretary
				of Energy, after the date of enactment of this title.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2046C8F5290A41E9AEE59D6368992DEA"><enum>(8)</enum><header display-inline="yes-display-inline">Energy efficient building</header><text display-inline="yes-display-inline">The term <term>energy efficient
				building</term> means a residential building or commercial building completed
				after the date of enactment of this title for which the projected lifetime
				consumption of electricity or natural gas for heating, cooling, and ventilation
				is at least 30 percent less than the lifetime consumption of a typical new
				residential building or commercial building, as determined by the Administrator
				(in consultation with the Secretary of Energy)—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID6AFA8BE4BBB145EEA6003883B5AD28C7"><enum>(A)</enum><text display-inline="yes-display-inline">on a State or regional basis; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC39D01455F884C64B926F14BAFAD92DB"><enum>(B)</enum><text display-inline="yes-display-inline">taking into consideration—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID17D61C4AC6CF470C92F75E4FBA762422"><enum>(i)</enum><text display-inline="yes-display-inline">applicable building codes; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID3B364BF2A94C4D91A1EB0548D38DA1F0"><enum>(ii)</enum><text display-inline="yes-display-inline">consumption levels achieved in practice by
				new residential buildings or commercial buildings in the absence of an
				allocation of emission allowances.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3A65712190174D4D00E69CFB0067FD33"><enum>(9)</enum><header display-inline="yes-display-inline">Energy efficient product</header><text display-inline="yes-display-inline">The term <term>energy efficient
				product</term> means a product manufactured after the date of enactment of this
				title that has an expected lifetime electricity or natural gas consumption
				that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDAC944083DC3F4345B3FA25AB4858D094"><enum>(A)</enum><text display-inline="yes-display-inline">is less than the average lifetime
				electricity or natural gas consumption for that type of product; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBB4C651EC35F4C63934B44FBE78BDA21"><enum>(B)</enum><text display-inline="yes-display-inline">does not exceed the lesser of—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDAAD311539B4C4CAB99A222A8BB0064C0"><enum>(i)</enum><text display-inline="yes-display-inline">the maximum energy consumption that
				qualifies for the applicable Energy Star label for that type of product;
				or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID2FA2D15683E24D40B12920354597D733"><enum>(ii)</enum><text display-inline="yes-display-inline">the average energy consumption of the most
				efficient 25 percent of that type of product manufactured in the same
				year.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2d5a5f28a91749638dcf7dd6d27f7dda"><enum>(10)</enum><header display-inline="yes-display-inline">Facility</header><text display-inline="yes-display-inline">The term <term>facility</term> means any
				building, structure, or installation that is located—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id589C32456CA04C40BDEEE2CE26019B5A"><enum>(A)</enum><text display-inline="yes-display-inline">on 1 or more contiguous or adjacent
				properties under the common control of at least 1 person; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7F6EBA284D74A288C3F4B982109E2A2"><enum>(B)</enum><text display-inline="yes-display-inline">in the United States.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa407aec3a8a401c95f7536e86a2cc9a"><enum>(11)</enum><header display-inline="yes-display-inline">Global warming pollutant</header><text display-inline="yes-display-inline">The term <term>global warming
				pollutant</term> means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID29f8f9ccfe324fa4ad9157ffb0d2e567"><enum>(A)</enum><text display-inline="yes-display-inline">carbon dioxide;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8d7763157191468085a0706ac2394809"><enum>(B)</enum><text display-inline="yes-display-inline">methane;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID940791470be842e0a20e7053b855cb35"><enum>(C)</enum><text display-inline="yes-display-inline">nitrous oxide;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4428b399e60d43f29d197e98b9c7e488"><enum>(D)</enum><text display-inline="yes-display-inline">hydrofluorocarbons;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0738632bf0334d339250b274051189ae"><enum>(E)</enum><text display-inline="yes-display-inline">perfluorocarbons;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID319706f18a944b46aafb7a804067129a"><enum>(F)</enum><text display-inline="yes-display-inline">sulfur hexafluoride; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd28a2b086dcd43c49126ab424d63a27b"><enum>(G)</enum><text display-inline="yes-display-inline">any other anthropogenically-emitted gas
				that the Administrator, after notice and comment, determines to contribute to
				global warming.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77024F69D1F44A1F9A9E4C38AA53C27B"><enum>(12)</enum><header display-inline="yes-display-inline">Global warming pollution</header><text display-inline="yes-display-inline">The term <term>global warming
				pollution</term> means any combination of 1 or more global warming pollutants
				emitted into the ambient air or atmosphere.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB96C9B7914AF4FC49DAC272F56F956D3"><enum>(13)</enum><header display-inline="yes-display-inline">Lifetime</header><text display-inline="yes-display-inline">The term <term>lifetime</term>
				means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID738350FF1C8A4F54BDF76F429900377F"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a residential building that
				is an energy efficient building, 30 years;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5C0CD3C71D8742A19DE06EDE3B2C66FB"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a commercial building that
				is an energy efficient building, 15 years; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID564CD37E262E4C4D8885F475B000F006"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of an energy efficient product,
				a period determined by the Administrator to be the average life of that type of
				energy efficient product.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID737D815B3BFC45B4B01E2DB4E59C0461"><enum>(14)</enum><header display-inline="yes-display-inline">Mercury</header><text display-inline="yes-display-inline">The term <term>mercury</term> includes any
				mercury compound.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B994A8255B24D23B5D3741013CF6364"><enum>(15)</enum><header display-inline="yes-display-inline">NAS report</header><text display-inline="yes-display-inline">The term <term>NAS report</term> means a
				report completed by the Academy under subsection (d)(1) or (e)(2) of section
				705.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID759B9AABCFDE42DD918D70B19FFAAD81"><enum>(16)</enum><header display-inline="yes-display-inline">Nonwestern region</header><text display-inline="yes-display-inline">The term <term>nonwestern region</term>
				means the area of the States that is not included in the western region.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3A0D1BAAAD95417DB04BDC9969437CDC"><enum>(17)</enum><header display-inline="yes-display-inline">Renewable electricity generating
				unit</header><text display-inline="yes-display-inline">The term <term>renewable
				electricity generating unit</term> means a unit that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDEA4DBAE7F6734D77B9BCC0D1C3894671"><enum>(A)</enum><text display-inline="yes-display-inline">has been in operation for 10 years or less;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID210B0C39B14D442BAAF59E6990825BC8"><enum>(B)</enum><text display-inline="yes-display-inline">generates electric energy by means
				of—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDCAB3413BF72C4D6BA343E13B43E11BCF"><enum>(i)</enum><text display-inline="yes-display-inline">wind;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID17E4D1C5E5F2458E972063F228733608"><enum>(ii)</enum><text display-inline="yes-display-inline">biomass;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID606C62D5C1DE4EAD80147225FDE5106C"><enum>(iii)</enum><text display-inline="yes-display-inline">landfill gas;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID934BCEC2578E4068BE32AF19D8712C7F"><enum>(iv)</enum><text display-inline="yes-display-inline">a geothermal, solar thermal, or
				photovoltaic source; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDBE0061F1715442EDA16B4465EB297035"><enum>(v)</enum><text display-inline="yes-display-inline">a fuel cell operating on fuel derived from
				a renewable source of energy.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDECA7E9C952DD4DD9BF0404F7B2F6C282"><enum>(18)</enum><header display-inline="yes-display-inline">Small electric generation
				facility</header><text display-inline="yes-display-inline">The term <term>small
				electric generation facility</term> means an electric or thermal electricity
				generating unit, or combination of units, that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID00027506AE354BB697E91ED91214F068"><enum>(A)</enum><text display-inline="yes-display-inline">has a nameplate capacity of less than 25
				megawatts (or the equivalent in thermal energy generation, determined in
				accordance with a methodology developed by the Administrator);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4296E6575A9844CD828D0066E66966BC"><enum>(B)</enum><text display-inline="yes-display-inline">generates electric energy, for sale,
				through combustion of fossil fuel; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3BA10C0D6D784BC796ADABC3E8D8EF67"><enum>(C)</enum><text display-inline="yes-display-inline">emits a covered pollutant into the
				atmosphere.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD174FB7A98DB4459822D082D09A07B00"><enum>(19)</enum><header display-inline="yes-display-inline">Western
				region</header><text display-inline="yes-display-inline">The term <term>western
				region</term> means the area comprising the States of Arizona, California,
				Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, and
				Wyoming.</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID3F8221784A7C4FC4BFD85964378DCC68" section-type="subsequent-section"><enum>704.</enum><header display-inline="yes-display-inline">Condition for treatment of electric
				generation facilities after 2020</header><text display-inline="no-display-inline">If, by December 31, 2012, Congress does not
				enact, and the President does not sign, an Act affecting at least 85 percent of
				manmade sources of global warming pollution in the United States designed to
				reduce, on an economy-wide basis, the quantity of global warming pollutants
				emitted from those sources, the emissions limitations for electric generation
				facilities shall be successively decreased by at least 3 percent below the
				limitations required by this title for the preceding calendar year—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id29CEED4F4034466B935508F90261C2CF"><enum>(1)</enum><text display-inline="yes-display-inline">for each of calendar years 2026 through
				2050;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8519FA86E89D420F940A6BBB075C491B"><enum>(2)</enum><text display-inline="yes-display-inline">until, as determined by the Administrator,
				the purpose described in section 702(6) is achieved; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA2E13CB975B848B6B38300E73CC6FD2E"><enum>(3)</enum><text display-inline="yes-display-inline">until Congress enacts, and the President
				signs, such an Act.</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID3DE66C12234E4D2E90113F2F86F8B0AF" section-type="subsequent-section"><enum>705.</enum><header display-inline="yes-display-inline">Emission limitations</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID089E614A60304CD6981BCBA3CCBA3674"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsections (b) through (e), the
				Administrator shall promulgate regulations to ensure that the total annual
				emissions of covered pollutants from all electric generation facilities located
				in all States does not exceed—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID4DAF8088A01F4B8AB77065C148CAA568"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of sulfur dioxide—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDF68713483E704216878FF93C6EF100A5"><enum>(A)</enum><text display-inline="yes-display-inline">in the western region—</text>
										<clause commented="no" display-inline="no-display-inline" id="idE5B7510E62EE4FBA9ABC9BED36D4B4B3"><enum>(i)</enum><text display-inline="yes-display-inline">for calendar years 2010 through 2012,
				274,500 tons; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id7EAF1D317FBE4E77868DBE389B07B952"><enum>(ii)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter, 158,600 tons; and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF71849631F264405874838200405AE88"><enum>(B)</enum><text display-inline="yes-display-inline">in the nonwestern region—</text>
										<clause commented="no" display-inline="no-display-inline" id="idDF40935A9D0F450297BCE2B20CFFB899"><enum>(i)</enum><text display-inline="yes-display-inline">for calendar years 2010 through 2012,
				1,975,500 tons; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE91E735747B341B6B97FA6C94F1C922A"><enum>(ii)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter, 1,141,400 tons;</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB77A3EAB3621463181132C95E5D0E280"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of nitrogen oxides—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idE90FC884C4984BBCA4DD7402580662BB"><enum>(A)</enum><text display-inline="yes-display-inline">for calendar years 2010 through 2012,
				1,510,000 tons; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF60A5540FF864F1D85B5A5E43DAD7DF0"><enum>(B)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter, 900,000 tons;</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA625F5C3A01E4074B5FA0E4AD3C4ADFA"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of global warming pollutants,
				beginning in calendar year 2010, a quantity to be reduced each calendar year to
				achieve a reduction in emissions of global warming pollutants equal to—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id97C60DEDC0E14EFEA1779561B70C1F29"><enum>(A)</enum><text display-inline="yes-display-inline">by December 31, 2011, not more than
				2,300,000,000 metric tons of carbon dioxide equivalent;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7EB59F27717145C7BF98A4784F9FEC1E"><enum>(B)</enum><text display-inline="yes-display-inline">by December 31, 2015, not more than
				2,100,000,000 metric tons of carbon dioxide equivalent;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08281F8EFE444D37B44E71AE7C583710"><enum>(C)</enum><text display-inline="yes-display-inline">by December 31, 2020, not more than
				1,803,000,000 metric tons of carbon dioxide equivalent; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id40E048DE7D8A487395C696A9AEB38B81"><enum>(D)</enum><text display-inline="yes-display-inline">by December 31, 2025, not more than
				1,500,000,000 metric tons of carbon dioxide equivalent; and</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB0C06624AFD0403FAFA4A1EC9DB91400"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of mercury, by December 31,
				2012, and during each calendar year thereafter, the lower of, as
				applicable—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id298A84BD42FA40049B2AC40727F0C337"><enum>(A)</enum><text display-inline="yes-display-inline">5 tons; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF1741AEE5AEA494BAB7C3D74BDB30CCF"><enum>(B)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, with
				respect to an electric generation facility, a quantity of mercury emissions
				that represents more than a 90-percent reduction of emissions of mercury by the
				electric generation facility, as compared to the average emissions of mercury
				during calendar years 2009 through 2011.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC231DAA7022344C78DFF0699F0794D02"><enum>(b)</enum><header display-inline="yes-display-inline">Excess emissions based on unused
				allowances</header><text display-inline="yes-display-inline">The regulations
				promulgated under subsection (a) shall authorize emissions of covered
				pollutants in excess of the national emission limitations established under
				that subsection for a calendar year to the extent that the number of tons of
				the excess emissions is less than or equal to the number of emission allowances
				that are—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID6842F0E74F20432BBE2B1FA3F962A663"><enum>(1)</enum><text display-inline="yes-display-inline">used in the calendar year; but</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21BAE7A14E9A49FEB34F6B00DB930829"><enum>(2)</enum><text display-inline="yes-display-inline">allocated for any preceding calendar year
				under section 708.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB7575B2388C64FC7A17DB3667D9FAD9F"><enum>(c)</enum><header display-inline="yes-display-inline">Reductions</header><text display-inline="yes-display-inline">For calendar year 2010 and each calendar
				year thereafter, the quantity of emissions specified for each covered pollutant
				in subsection (a) shall be reduced by the sum of—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID7BC0A2BDB4624C3EA9F61FEBD6D3094D"><enum>(1)</enum><text display-inline="yes-display-inline">the number of tons of the covered pollutant
				that were emitted by small electric generation facilities in the second
				preceding calendar year; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3222CADF97FB43AA9900AE2C4D2244D3"><enum>(2)</enum><text display-inline="yes-display-inline">any number of tons of reductions in
				emissions of the covered pollutant required under section 706(h).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID543c9af18f9c46a2a8f2158c222b42e6"><enum>(d)</enum><header display-inline="yes-display-inline">Accelerated global warming pollution
				emissions limitations</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID3058b41ee5ba4bb9b113c4d945da813a"><enum>(1)</enum><header display-inline="yes-display-inline">Academy report on global change
				events</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id162BA3EDDF2A4ABD8A478ADB4665E5B4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall offer to enter into
				a contract with the Academy under which the Academy, not later than 2 years
				after the date of enactment of this title, and every 3 years thereafter, shall
				submit to Congress and the Administrator a report that describes whether any
				event described in subparagraph (B)—</text>
										<clause commented="no" display-inline="no-display-inline" id="id277C9CC604F44A2A9661F5C5DEC26123"><enum>(i)</enum><text display-inline="yes-display-inline">has occurred or is more likely than not to
				occur in the foreseeable future; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id2FE183142A10488C9C1D8F3503A5FF19"><enum>(ii)</enum><text display-inline="yes-display-inline">in the judgment of the Academy, is the
				result of anthropogenic climate change.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96930ACBC2FE49FBA523D7FE5B8DB494"><enum>(B)</enum><header display-inline="yes-display-inline">Events</header><text display-inline="yes-display-inline">The events referred to in subparagraph (A)
				are—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDf630494051844162bf26410d7acbaca1"><enum>(i)</enum><text display-inline="yes-display-inline">the exceedance of an atmospheric
				concentration of global warming pollutants of 450 parts per million in carbon
				dioxide equivalent; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID9c53469da7eb478ca6b8aecc6f599b17"><enum>(ii)</enum><text display-inline="yes-display-inline">an increase of global average temperatures
				in excess of 3.6 degrees Fahrenheit (2 degrees Celsius) above the preindustrial
				average.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE18DA8436A6454C88D98605B12B103C"><enum>(2)</enum><header display-inline="yes-display-inline">Acceleration of limitations</header><text display-inline="yes-display-inline">If a NAS report determines that an event
				described in paragraph (1)(B) has occurred, or is more likely than not to occur
				in the foreseeable future, not later than 2 years after the date of completion
				of the NAS report, the Administrator, after an opportunity for notice and
				public comment and taking into consideration the new information contained in
				the NAS report, may—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9297AA14221B495AADA4E2CCF8E5C52D"><enum>(A)</enum><text display-inline="yes-display-inline">adjust any global warming pollution
				emissions limitation under this section; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A73188CDB3046BF81CD8E1B0F509A56"><enum>(B)</enum><text display-inline="yes-display-inline">promulgate such regulations as the
				Administrator determines to be necessary—</text>
										<clause commented="no" display-inline="no-display-inline" id="id111D5509344A44309A15E49900933617"><enum>(i)</enum><text display-inline="yes-display-inline">to reduce the aggregate net levels of
				global warming pollution emissions from the United States on an accelerated
				schedule; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idA33BE53B4CC8421F8B475AC3D1D2470F"><enum>(ii)</enum><text display-inline="yes-display-inline">to minimize the effects of rapid climate
				change and otherwise achieve the purposes of this title.</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID57797c676a70465b8f8b94a1291c58b2"><enum>(e)</enum><header display-inline="yes-display-inline">Report on achievement of global warming
				pollution emissions limitations</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id133C4F71A08B4CBD85A709F88A7E9D8F"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of technologically
				infeasible</header><text display-inline="yes-display-inline">In this
				subsection, the term <term>technologically infeasible</term>, with respect to
				compliance with a standard or requirement under this subsection, means that
				adequate technology or infrastructure does not exist, or is not reasonably
				anticipated to exist, within a sufficient time to permit compliance with the
				standard or requirement.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC370E9CCD22549F8BD7A95476C5AA248"><enum>(2)</enum><header display-inline="yes-display-inline">Technology reports</header><text display-inline="yes-display-inline">The Administrator shall offer to enter into
				a contract with the Academy under which the Academy, not later than 2 years
				after the date of enactment of this title and every 3 years thereafter, shall
				submit to Congress and the Administrator a report that analyzes—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID4acfbfd9ee8940c6976a3879aa44bea4"><enum>(A)</enum><text display-inline="yes-display-inline">the status of current global warming
				pollution emission reduction technologies, including—</text>
										<clause commented="no" display-inline="no-display-inline" id="idA79EA9ABF580411B9A97AB3DA48497BD"><enum>(i)</enum><text display-inline="yes-display-inline">technologies for capture and disposal of
				global warming pollutants;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idA8AB8AF0FF704BC4AF039D16EAC66B85"><enum>(ii)</enum><text display-inline="yes-display-inline">efficiency improvement technologies;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id43AFDF5BC4E542C6AA01D49448399D93"><enum>(iii)</enum><text display-inline="yes-display-inline">zero-global-warming-pollution-emitting
				energy technologies; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idA482ED28631C4FC4A00CAEA788C5B981"><enum>(iv)</enum><text display-inline="yes-display-inline">above- and below-ground biological
				sequestration technologies;</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6a9cd33204024d1fb1ca673d2de3f3bc"><enum>(B)</enum><text display-inline="yes-display-inline">whether any requirement under this title
				(including regulations promulgated pursuant to this title) requires a level of
				emission control or reduction that, based on available or expected technology,
				will be technologically infeasible at the time at which the requirement becomes
				effective;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf6705d4965db4031b908573fde9f3d9f"><enum>(C)</enum><text display-inline="yes-display-inline">the projected date on which any technology
				determined to be technologically infeasible will become technologically
				feasible;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID06522c73b32a4b3f905b627f265e3904"><enum>(D)</enum><text display-inline="yes-display-inline">whether any technology determined to be
				technologically infeasible cannot reasonably be expected to become
				technologically feasible before January 1, 2050; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa3b2e12c926d4288816df66bde9cec93"><enum>(E)</enum><text display-inline="yes-display-inline">the costs of available alternative global
				warming pollution emission reduction strategies that could be used or pursued
				in lieu of any technology that is determined to be technologically
				infeasible.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEFB60B185F504DC9AFE1CE3D3B70E30D"><enum>(3)</enum><header display-inline="yes-display-inline">Conclusion</header><text display-inline="yes-display-inline">If a NAS report concludes that a global
				warming pollution emissions limitation required by this section cannot be
				achieved because the limitation is technologically infeasible, the
				Administrator shall submit to Congress a notification of that
				conclusion.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1A96131E3DE844ABAE9B085B0AF3FC71"><enum>(4)</enum><header display-inline="yes-display-inline">Evaluation of certain purpose</header><text display-inline="yes-display-inline">Not later than December 31, 2037, the
				Administrator shall offer to enter into a contract with the Academy under
				which, not later than December 31, 2039, the Academy shall prepare and submit
				to Congress and the Administrator a report on the appropriateness of the
				purpose described in section 702(6), taking into consideration—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idE323B2F4792E4592A5194E1811020D85"><enum>(A)</enum><text display-inline="yes-display-inline">information that was not available as of
				the date of enactment of this title; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE13E2BDDF3142E98B3DDCEAAEA6292D"><enum>(B)</enum><text display-inline="yes-display-inline">events that have occurred since that date
				relating to—</text>
										<clause commented="no" display-inline="no-display-inline" id="id16CC9253DDEE4DA5B652E087D0F7D6C1"><enum>(i)</enum><text display-inline="yes-display-inline">climate change;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idFFAFD56EBE7F4831ABE3611087459CE5"><enum>(ii)</enum><text display-inline="yes-display-inline">climate change technologies; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id6DB666F62FBA48449EAFD6C5F541E5DA"><enum>(iii)</enum><text display-inline="yes-display-inline">national and international climate change
				commitments.</text>
										</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDC8BC8D9B85C34567A49162FCA20904FD" section-type="subsequent-section"><enum>706.</enum><header display-inline="yes-display-inline">Emission allowances</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID0572B46B244E488AB25320D49DEB6705"><enum>(a)</enum><header display-inline="yes-display-inline">Creation and allocation</header>
								<paragraph commented="no" display-inline="no-display-inline" id="IDE2491DC5B1924B82BDF2B0E6622BE58C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), there
				are created, and the Administrator shall allocate in accordance with section
				708, emission allowances as follows:</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDF52E5A20323440F8A126253188E4EA5E"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of sulfur dioxide—</text>
										<clause commented="no" display-inline="no-display-inline" id="id08D4076805A14C08AC3D9998DF7E9883"><enum>(i)</enum><text display-inline="yes-display-inline">in the western region—</text>
											<subclause commented="no" display-inline="no-display-inline" id="id17F8F496EC774FFC97A847DF0E2243CE"><enum>(I)</enum><text display-inline="yes-display-inline">for calendar years 2010 through 2012,
				emission allowances for 274,500 tons; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id051140B566604FD9950CA0B575FDE0C5"><enum>(II)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter, emission allowances for 158,600 tons; and</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idAFE94043031A4FEC9C99ACCC7B360E89"><enum>(ii)</enum><text display-inline="yes-display-inline">in the nonwestern region—</text>
											<subclause commented="no" display-inline="no-display-inline" id="id73C894625669476AAA764E681EE6788C"><enum>(I)</enum><text display-inline="yes-display-inline">for calendar years 2010 through 2012,
				emission allowances for 1,975,500 tons; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id2BA0AAC673D5435BB73097468AEAFC9A"><enum>(II)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter, emission allowances for 1,141,400 tons.</text>
											</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID06046E7EE64A46EDAF661C831C4E7048"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of nitrogen oxides—</text>
										<clause commented="no" display-inline="no-display-inline" id="idCBEEDDA8E2B44748BFE5B1963EA515F4"><enum>(i)</enum><text display-inline="yes-display-inline">for calendar years 2010 through 2012,
				emission allowances for 1,510,000 tons; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id5178419E17484AACABD2A4451D2B68F5"><enum>(ii)</enum><text display-inline="yes-display-inline">for calendar year 2013 and each calendar
				year thereafter, emission allowances for 900,000 tons.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13A500E1AE14444EAE925BE30F18D159"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of global warming pollutants,
				beginning in calendar year 2010, a quantity of emission allowances to be
				reduced each calendar year to achieve a reduction in emissions of global
				warming pollutants equal to—</text>
										<clause commented="no" display-inline="no-display-inline" id="id44530DABAB134AF68F8CDCE6343AAFE6"><enum>(i)</enum><text display-inline="yes-display-inline">by December 31, 2011, not more than
				2,300,000,000 metric tons of carbon dioxide equivalent;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id2A5F7DF409FF40C8A43D6DF17DC61C0C"><enum>(ii)</enum><text display-inline="yes-display-inline">by December 31, 2015, not more than
				2,100,000,000 metric tons of carbon dioxide equivalent;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id92C1147D3E5E42B89753170B4B460F09"><enum>(iii)</enum><text display-inline="yes-display-inline">by December 31, 2020, not more than
				1,803,000,000 metric tons of carbon dioxide equivalent; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id93F9B0BEE0C2450888919B1C220EED72"><enum>(iv)</enum><text display-inline="yes-display-inline">by December 31, 2025, not more than
				1,500,000,000 metric tons of carbon dioxide equivalent.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF713D204CF1740B1BBAFA2D2319EF521"><enum>(2)</enum><header display-inline="yes-display-inline">Reductions</header><text display-inline="yes-display-inline">For calendar year 2010 and each calendar
				year thereafter, the number of emission allowances specified for each covered
				pollutant in paragraph (1) shall be reduced by a number equal to the sum
				of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID969D96E452E9470E91A1BECB2340866C"><enum>(A)</enum><text display-inline="yes-display-inline">the number of tons of the covered pollutant
				that were emitted by small electric generation facilities in the second
				preceding calendar year; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAE0E5106C8FA4492B93FE8965D5D4098"><enum>(B)</enum><text display-inline="yes-display-inline">any number of tons of reductions in
				emissions of the covered pollutant required under subsection (h).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idED8962B2B68F421C95F1E5A3C0999C91"><enum>(3)</enum><header display-inline="yes-display-inline">Updates</header><text display-inline="yes-display-inline">Once every 5 years, the Administrator
				shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idEB4E7F5F77A54476A902B96D4E08D11B"><enum>(A)</enum><text display-inline="yes-display-inline">review the formula by which the
				Administrator allocates allowances under this title; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84E0027F7070465E9FA9BDDD2B36195F"><enum>(B)</enum><text display-inline="yes-display-inline">update that formula, as the Administrator
				determines to be necessary given the results of the review.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID83ADA75CA79E43EABA3C0700308E497D"><enum>(b)</enum><header display-inline="yes-display-inline">Nature of emission allowances</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID03DAB428705F455EA0F33B9C68C760A5"><enum>(1)</enum><header display-inline="yes-display-inline">Not a property right</header><text display-inline="yes-display-inline">An emission allowance allocated by the
				Administrator under subsection (a) is not a property right.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3C323351AF0E4BE298A172E1D9574B55"><enum>(2)</enum><header display-inline="yes-display-inline">No limit on authority to terminate or
				limit</header><text display-inline="yes-display-inline">Nothing in this title
				or any other provision of law limits the authority of the United States to
				terminate or limit an emission allowance.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID403A84C1A36249F8A203296D4BC3E465"><enum>(3)</enum><header display-inline="yes-display-inline">Tracking and transfer of emission
				allowances</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID1E5953D5646F46B7B500CF47F69DB4A9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Administrator shall promulgate regulations to
				establish an emission allowance tracking and transfer system for emission
				allowances of sulfur dioxide, nitrogen oxides, and global warming
				pollutants.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID05DB1515C28F4A928900BCA126D27FD7"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The emission allowance tracking and
				transfer system established under subparagraph (A) shall—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID840D9469381847FC9FBB92E5B064E330"><enum>(i)</enum><text display-inline="yes-display-inline">incorporate the requirements of subsections
				(b) and (d) of section 412 (except that written certification by the transferee
				shall not be necessary to effect a transfer); and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID2FE119EBA8004FEB9EA5A046753C4CFA"><enum>(ii)</enum><text display-inline="yes-display-inline">permit any entity—</text>
											<subclause commented="no" display-inline="no-display-inline" id="ID5E8FB58A9BA540D500EC7C84CD4D96F2"><enum>(I)</enum><text display-inline="yes-display-inline">to buy, sell, or hold an emission
				allowance; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID04E5846EE89B405EB7A44DE3C024D0E9"><enum>(II)</enum><text display-inline="yes-display-inline">to permanently retire an unused emission
				allowance.</text>
											</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD41128A78563406D00E193F79BB56B44"><enum>(C)</enum><header display-inline="yes-display-inline">Proceeds of transfers</header><text display-inline="yes-display-inline">Proceeds from the transfer of emission
				allowances by any person to which the emission allowances have been
				allocated—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID44946DC2A15145E7BFB256AA27D7E061"><enum>(i)</enum><text display-inline="yes-display-inline">shall not constitute funds of the United
				States; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID99102393275B476EB965D29C1CF19FCC"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be available to meet any
				obligations of the United States.</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID99E154535C294AE89D09888F536B6E6C"><enum>(c)</enum><header display-inline="yes-display-inline">Identification and use</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID9334C5A53F76414688E378E437005620"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each emission allowance allocated by the
				Administrator shall bear a unique serial number, including—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDFADCF75B721744ADABD6C6CC560020F7"><enum>(A)</enum><text display-inline="yes-display-inline">an identifier of the covered pollutant to
				which the emission allowance pertains; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB00BA7F8704940AF8F5E63C53F37A6BD"><enum>(B)</enum><text display-inline="yes-display-inline">the first calendar year for which the
				allowance may be used.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID325C7F96B2A947B982A57292B45E3231"><enum>(2)</enum><header display-inline="yes-display-inline">Sulfur dioxide emission
				allowances</header><text display-inline="yes-display-inline">In the case of
				sulfur dioxide emission allowances, the Administrator shall ensure that the
				emission allowances allocated to electric generation facilities in the western
				region are distinguishable from emission allowances allocated to electric
				generation facilities in the nonwestern region.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3F223B798C084720874C1FA77044A445"><enum>(3)</enum><header display-inline="yes-display-inline">Year of use</header><text display-inline="yes-display-inline">Each emission allowance may be used in the
				calendar year for which the emission allowance is allocated or in any
				subsequent calendar year.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0239B1CDB31B4587AC887E7B52011767"><enum>(d)</enum><header display-inline="yes-display-inline">Annual submission of emission
				allowances</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID6D8D23ACE1484833AB603258FDCB6DA2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On or before April 1, 2011, and April 1 of
				each year thereafter, the owner or operator of each electric generation
				facility shall submit to the Administrator 1 emission allowance for the
				applicable covered pollutant (other than mercury) for each ton of sulfur
				dioxide, nitrogen oxides, or global warming pollutants emitted by the electric
				generation facility during the preceding calendar year.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4AF809472C004E9D927742C9B4C70033"><enum>(2)</enum><header display-inline="yes-display-inline">Special rule for ozone exceedances</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID82497A6EF0584DA481D3DAA552E900F2"><enum>(A)</enum><header display-inline="yes-display-inline">Identification of facilities contributing
				to nonattainment</header><text display-inline="yes-display-inline">Not later
				than December 31, 2009, and the end of each 3-year period thereafter, each
				State, consistent with the obligations of the State under section 110(a)(2)(D),
				shall identify the electric generation facilities in the State and in other
				States that are significantly contributing (as determined based on guidance
				issued by the Administrator) to nonattainment of the national ambient air
				quality standard for ozone in the State.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID83B26C4700064FBBAEA553539CDDA5B8"><enum>(B)</enum><header display-inline="yes-display-inline">Submission of additional
				allowances</header><text display-inline="yes-display-inline">In calendar year
				2010 and each calendar year thereafter, on petition from a State or a person
				demonstrating that the control measures in effect at an electric generation
				facility that is identified under subparagraph (A) as significantly
				contributing to nonattainment of the national ambient air quality standard for
				ozone in a State during the preceding calendar year are inadequate to prevent
				the significant contribution described in subparagraph (A), the Administrator,
				if the Administrator determines that the electric generation facility is
				inadequately controlled for nitrogen oxides, may require that the electric
				generation facility submit 3 nitrogen oxide emission allowances for each ton of
				nitrogen oxides emitted by the electric generation facility during any period
				of an exceedance of the national ambient air quality standard for ozone in the
				State during the preceding calendar year.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5084F25127ED4EB4AC6D3834FBB7C8BD"><enum>(3)</enum><header display-inline="yes-display-inline">Regional limitations for sulfur
				dioxide</header><text display-inline="yes-display-inline">The Administrator
				shall not allow—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDFED5116A21BC41158F8CE56EEE4641EA"><enum>(A)</enum><text display-inline="yes-display-inline">the use of sulfur dioxide emission
				allowances allocated for the western region to meet the obligations under this
				subsection of electric generation facilities in the nonwestern region;
				or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEF12064370C044A4BBEEF694E64577AF"><enum>(B)</enum><text display-inline="yes-display-inline">the use of sulfur dioxide emission
				allowances allocated for the nonwestern region to meet the obligations under
				this subsection of electric generation facilities in the western region.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB97FD5649F594A87BA4BBE1FBFDBD66E"><enum>(e)</enum><header display-inline="yes-display-inline">Emission verification, monitoring, and
				recordkeeping</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID04131E6CD707446181E85640798FE333"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall ensure that Federal
				regulations, in combination with any applicable State regulations, are adequate
				to verify, monitor, and document emissions of covered pollutants from electric
				generation facilities.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9B72F6D32D014E8FB41EDD3527F077F5"><enum>(2)</enum><header display-inline="yes-display-inline">Inventory of emissions from small electric
				generation facilities</header><text display-inline="yes-display-inline">On or
				before July 1, 2008, the Administrator, in cooperation with State agencies,
				shall complete, and on an annual basis update, a comprehensive inventory of
				emissions of sulfur dioxide, nitrogen oxides, global warming pollutants, and
				particulate matter from small electric generation facilities.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDBC85C82D3E34629B4F224B3BE087D54"><enum>(3)</enum><header display-inline="yes-display-inline">Monitoring information</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID86DF7727FF7142C4B3CB00CC5BC32592"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this title, the Administrator shall promulgate regulations to
				require each electric generation facility to submit to the
				Administrator—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID248EE6355CEF4CFE969BACCA9156574B"><enum>(i)</enum><text display-inline="yes-display-inline">not later than April 1 of each year,
				verifiable information on covered pollutants emitted by the electric generation
				facility in the preceding calendar year, expressed in—</text>
											<subclause commented="no" display-inline="no-display-inline" id="ID85F7AB3F403E4B1AA19B4E40C3430821"><enum>(I)</enum><text display-inline="yes-display-inline">tons of covered pollutants; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1F087C48388C478B9709FE6087A2657E"><enum>(II)</enum><text display-inline="yes-display-inline">tons of covered pollutants per megawatt
				hour of energy (or the equivalent thermal energy) generated; and</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDA0032EE1458D4D069BDF90CE2E063053"><enum>(ii)</enum><text display-inline="yes-display-inline">as part of the first submission under
				clause (i), verifiable information on covered pollutants emitted by the
				electric generation facility in each of calendar years 2002 through 2006 if the
				electric generation facility was required to report that information in those
				calendar years.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE34539AD0EF41A8A9005E5DB7F6AEFD"><enum>(B)</enum><header display-inline="yes-display-inline">Source of information</header><text display-inline="yes-display-inline">Information submitted under subparagraph
				(A) shall be obtained using a continuous emission monitoring system (as defined
				in section 402).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA7D990471C994C17AD3B4F9D2B5929E3"><enum>(C)</enum><header display-inline="yes-display-inline">Availability to the public</header><text display-inline="yes-display-inline">The information described in subparagraph
				(A) shall be made available to the public—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID5B52538303804E60AEC6001E07FC2CC7"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of the first year in which the
				information is required to be submitted under that subparagraph, not later than
				18 months after the date of enactment of this title; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDF3251DF82EF94A2E8C01F7AAF7C42826"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of each year thereafter, not
				later than April 1 of the year.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAF8C3F8BAF594985885E6E678C4CF6E8"><enum>(4)</enum><header display-inline="yes-display-inline">Ambient air quality monitoring for sulfur
				dioxide and hazardous air pollutants</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID2CD170CC21AE45178CD0E5920097B03D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning January 1, 2008, each coal-fired
				electric generation facility with an aggregate generating capacity of 50
				megawatts or more shall, in accordance with guidelines issued by the
				Administrator, commence ambient air quality monitoring within a 30-mile radius
				of the coal-fired electric generation facility for the purpose of measuring
				maximum concentrations of sulfur dioxide and hazardous air pollutants emitted
				by the coal-fired electric generation facility.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID138F679F2F71465A9B79B685E9272126"><enum>(B)</enum><header display-inline="yes-display-inline">Location of monitoring points</header><text display-inline="yes-display-inline">Monitoring under subparagraph (A) shall
				include monitoring at not fewer than 2 points—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID284D0C617F484A41AA3C968200D090CE"><enum>(i)</enum><text display-inline="yes-display-inline">that are at ground level and within 3 miles
				of the coal-fired electric generation facility;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDEAB5698F4F684F61A22F00D407C25EDE"><enum>(ii)</enum><text display-inline="yes-display-inline">at which the concentration of pollutants
				being monitored is expected to be the greatest; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID70A6DE3082A0487A941318C8C3AE297B"><enum>(iii)</enum><text display-inline="yes-display-inline">at which the monitoring shall be the most
				frequent.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1FB9071FB2A74A04BEBF83B3610060A5"><enum>(C)</enum><header display-inline="yes-display-inline">Frequency of monitoring of sulfur
				dioxide</header><text display-inline="yes-display-inline">Monitoring of sulfur
				dioxide under subparagraph (A) shall be carried out on a continuous basis and
				averaged over 5-minute periods.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1727AABAB66C415CB2D6ACB7FB2EC5CB"><enum>(D)</enum><header display-inline="yes-display-inline">Availability to the public</header><text display-inline="yes-display-inline">The results of the monitoring under
				subparagraph (A) shall be made available to the public.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD481B44D728D46D1A279A4EEC317B75C"><enum>(f)</enum><header display-inline="yes-display-inline">Excess emission penalty</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID640F72FC2722439AAA3493AB5E57276C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), section 411 shall
				be applicable to an owner or operator of an electric generation
				facility.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA7A4164E43C6485991B6F6E15015A9AF"><enum>(2)</enum><header display-inline="yes-display-inline">Calculation of penalty</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID4CC4FABAE0494DB79700552997C19D22"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the
				penalty for failure to submit emission allowances for covered pollutants as
				required under subsection (d) shall be equal to 3 times the product obtained by
				multiplying—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID6898B66C59DD4CD3BF43130257D6CA68"><enum>(i)</enum><text display-inline="yes-display-inline">as applicable—</text>
											<subclause commented="no" display-inline="no-display-inline" id="IDED4F3F515CB0487388132BD2E7A400BA"><enum>(I)</enum><text display-inline="yes-display-inline">the number of tons emitted in excess of the
				emission limitation requirement applicable to the electric generation facility;
				or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDE01890BEF9C14A84817C33A600D69EC6"><enum>(II)</enum><text display-inline="yes-display-inline">the number of emission allowances that the
				owner or operator failed to submit; and</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID25488FAD92784D6C97EF5B153F59BBEE"><enum>(ii)</enum><text display-inline="yes-display-inline">the average annual market price of emission
				allowances (as determined by the Administrator).</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3EF7A872A4624D1BA47097F932DCAD20"><enum>(B)</enum><header display-inline="yes-display-inline">Mercury</header><text display-inline="yes-display-inline">In the case of mercury, the penalty shall
				be equal to 3 times the product obtained by multiplying—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID5F94E02DBEA145809978D48BD29200F4"><enum>(i)</enum><text display-inline="yes-display-inline">the number of grams emitted in excess of
				the emission limitation requirement for mercury applicable to the electric
				generation facility; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID65CC69979DC445C7A100748CE928EC1E"><enum>(ii)</enum><text display-inline="yes-display-inline">the average cost of mercury controls at
				electricity generating units that have a nameplate capacity of 25 megawatts or
				more in all States (as determined by the Administrator).</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA47D25F9DAFE46BF00F6D03B78DB6E63"><enum>(g)</enum><header display-inline="yes-display-inline">Significant adverse local impacts</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID74F442BD93FA4B71BE34840005719100"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Administrator determines that
				emissions of an electric generation facility may reasonably be anticipated to
				cause or contribute to a significant adverse impact on an area (including
				endangerment of public health, contribution to acid deposition in a sensitive
				receptor area, and other degradation of the environment), the Administrator
				shall limit the emissions of the electric generation facility as necessary to
				avoid that impact.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID58C48E4FED3B4370AA5F2BA7DD20BD4E"><enum>(2)</enum><header display-inline="yes-display-inline">Violation</header><text display-inline="yes-display-inline">Notwithstanding the availability of
				emission allowances, it shall be a violation of this Act for any electric
				generation facility to exceed any limitation on emissions established under
				paragraph (1).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5A1BF5F01EA24A57B6712B6D8665AD1D"><enum>(h)</enum><header display-inline="yes-display-inline">Additional reductions</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID8F49CBF1188B48608654C40610A641FC"><enum>(1)</enum><header display-inline="yes-display-inline">Protection of public health or welfare or
				the environment</header><text display-inline="yes-display-inline">If the
				Administrator determines that the emission levels necessary to achieve the
				national emission limitations established under section 705 are not reasonably
				anticipated to protect public health or welfare or the environment (including
				protection of children, pregnant women, minority or low-income communities, and
				other sensitive populations), the Administrator may require reductions in
				emissions from electric generation facilities in addition to the reductions
				required under the other provisions of this title.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB8608B2C84F84AE5B13F528E0670A3B7"><enum>(2)</enum><header display-inline="yes-display-inline">Emission allowance trading</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID3EBA5DB3264544BCA8F467E2BF495E5B"><enum>(A)</enum><header display-inline="yes-display-inline">Studies</header>
										<clause commented="no" display-inline="no-display-inline" id="ID293B767AE25C44778B52DB7D78CDCDF7"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In 2015 and at the end of each 3-year
				period thereafter, the Administrator shall complete a study of the impacts of
				the emission allowance trading authorized under this title.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID18FD2E3F1F9A43F284AAEC8600CB9EB9"><enum>(ii)</enum><header display-inline="yes-display-inline">Required assessment</header><text display-inline="yes-display-inline">The study shall include an assessment of
				ambient air quality in areas surrounding electric generation facilities that
				participate in emission allowance trading, including a comparison
				between—</text>
											<subclause commented="no" display-inline="no-display-inline" id="ID17550694FD7A4AD9891E3F65FB8FA346"><enum>(I)</enum><text display-inline="yes-display-inline">the ambient air quality in those areas;
				and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDBB85E5E29902468CBEF714B455B59065"><enum>(II)</enum><text display-inline="yes-display-inline">the national average ambient air
				quality.</text>
											</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2BA55E67E4264A0DA9BA6629A7185E6B"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation on emissions</header><text display-inline="yes-display-inline">If the Administrator determines, based on
				the results of a study under subparagraph (A), that adverse local impacts
				result from emission allowance trading, the Administrator may require
				reductions in emissions from electric generation facilities in addition to the
				reductions required under the other provisions of this title.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5F5223205FBD43D2921053219D4B7BAC"><enum>(i)</enum><header display-inline="yes-display-inline">Use of certain other emission
				allowances</header>
								<paragraph commented="no" display-inline="no-display-inline" id="IDC6C7560C48E14E9DA046DF1CF1BAC2E0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), emission
				allowances or other emission trading instruments created under title I or IV
				for sulfur dioxide or nitrogen oxides shall not be valid for submission under
				subsection (d).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF905046AE4AC4D1CB710EFC74F5D0859"><enum>(2)</enum><header display-inline="yes-display-inline">Emission allowances placed in
				reserve</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDB8A22191E7E14C21A97831E0E4189D32"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An emission allowance described in
				paragraph (1) that was placed in reserve under section 404(a)(2) or 405 or
				through regulations implementing controls on nitrogen oxides, because an
				affected unit emitted fewer tons of sulfur dioxide or nitrogen oxides than were
				permitted under an emission limitation imposed under title I or IV before the
				date of enactment of this title, shall be valid for submission under subsection
				(d).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF6DA1D01A27E49A98922B3C3E49EF533"><enum>(B)</enum><header display-inline="yes-display-inline">Emission allowances resulting from
				achievement of new source performance standards</header><text display-inline="yes-display-inline">If an emission allowance described in
				subparagraph (A) was created and placed in reserve during the period of 2001
				through 2009 by the owner or operator of an electric generation facility
				through the application of pollution control technology that resulted in the
				achievement and maintenance by the electric generation facility of the
				applicable standards of performance required of new sources under section 111,
				the emission allowance shall be valid for submission under subsection
				(d).</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDE41BF0A660774DD1800917AE3273A9A6" section-type="subsequent-section"><enum>707.</enum><header display-inline="yes-display-inline">Permitting and trading of emission
				allowances</header><text display-inline="no-display-inline">Not later than 1
				year after the date of enactment of this title, the Administrator shall
				promulgate regulations to establish a permitting and emission allowance trading
				compliance program to implement the limitations on emissions of covered
				pollutants from electric generation facilities established under section
				705.</text>
						</section><section commented="no" display-inline="no-display-inline" id="idB2BE699721D64A9BB76667891285E65A" section-type="subsequent-section"><enum>708.</enum><header display-inline="yes-display-inline">Emission allowance allocation</header>
							<subsection commented="no" display-inline="no-display-inline" id="id33DA76AEF11B4C249FF6E9FC9AFA8F3E"><enum>(a)</enum><header display-inline="yes-display-inline">Sulfur dioxide and nitrogen oxides</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id690C32A351884836A3F184F8572AED06"><enum>(1)</enum><header display-inline="yes-display-inline">Initial allocations</header><text display-inline="yes-display-inline">For calendar years 2010 through 2012, the
				Administrator shall allocate emission allowances for sulfur dioxide and
				nitrogen oxides, consistent with applicable law (including regulations).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6F97A37B2214B01907923FB24CCD367"><enum>(2)</enum><header display-inline="yes-display-inline">Subsequent allocations</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="idC7DB8D5613C7462AB2FF44478A7FEAA5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For calendar year 2013 and each calendar
				year thereafter, the Administrator shall allocate emission allowances for
				sulfur dioxide and nitrogen oxides as the Administrator determines to be
				appropriate in accordance with subparagraphs (B) and (C).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC0B288D46CD4D0CB9AA525B07EDE02C"><enum>(B)</enum><header display-inline="yes-display-inline">Allocation factors</header><text display-inline="yes-display-inline">In allocating emission allowances for
				sulfur dioxide and nitrogen oxides under subparagraph (A), the Administrator,
				in consultation with the Secretary of Commerce, shall take into consideration
				the factors described in subsection (c)(1).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8705A5F021E5423487DEE88F1EC38CA3"><enum>(b)</enum><header display-inline="yes-display-inline">Global warming pollutants</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF9A6DE3157B4471785284F89E0D33C3C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For calendar year 2010, the Administrator
				shall transfer to each trustee appointed pursuant to paragraph (4)(A) for
				auction not less than 50 percent of the quantity of emission allowances
				available for allocation for global warming pollutants for the calendar year
				for the purposes described in paragraph (4).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF08A266947604E8D9679CD9F03E7511D"><enum>(2)</enum><header display-inline="yes-display-inline">Increase in quantity</header><text display-inline="yes-display-inline">For calendar year 2011 and each calendar
				year thereafter, taking into consideration the factors described in paragraph
				(3), the Administrator shall successively increase the quantity of emission
				allowances transferred to trustees for auction under paragraph (1) until, by
				not later than 15 years after the date of enactment of this title, 100 percent
				of emission allowances available for allocation for global warming pollutants
				for a calendar year are available for auction.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD705C9B397024DEB8F3038AEDFF519AD"><enum>(3)</enum><header display-inline="yes-display-inline">Allocation factors</header><text display-inline="yes-display-inline">In transferring emission allowances to
				trustees for auction under paragraph (1), the Administrator, in consultation
				with the Secretary of Commerce, shall take into consideration the factors
				described in subsection (c)(1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64B7990F743A4F778EEF3F2047899031"><enum>(4)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Regulations promulgated to carry out this
				subsection may provide for, as the Administrator determines to be necessary,
				the appointment of 1 or more trustees—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9D4980A0D23947F18E5DCF59DE6D5B3C"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id4F189D09794C4517828713E06CE2EFE0"><enum>(i)</enum><text display-inline="yes-display-inline">to receive emission allowances for the
				benefit of households, communities, and other entities;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idB25DC53D6EA34A2C9A8DA5D581E2254B" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">to sell the emission allowances at fair
				market value; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id5C6F510747DB43229B736D3DD66CCF81" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">to distribute the proceeds of any sale of
				emission allowances to the appropriate beneficiaries; or</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA186AD94F3B741E49693E09CE4AFE944"><enum>(B)</enum><text display-inline="yes-display-inline">to allocate emission allowances, in
				accordance with applicable regulations, to—</text>
										<clause commented="no" display-inline="no-display-inline" id="idE0BECE4DC359407BAF9A4378640DF1EB"><enum>(i)</enum><text display-inline="yes-display-inline">communities, individuals, and companies
				that have experienced disproportionate adverse impacts as a result of—</text>
											<subclause commented="no" display-inline="no-display-inline" id="id4B641323BB0741C4851563ECC9731F9A"><enum>(I)</enum><text display-inline="yes-display-inline">the transition to a lower carbon-emitting
				economy; or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="idDDD4536E818E4614A64C4C08A07A8F71"><enum>(II)</enum><text display-inline="yes-display-inline">global warming;</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id14F65B1DE36F4ABF96432A95902144F1"><enum>(ii)</enum><text display-inline="yes-display-inline">owners and operators of highly
				energy-efficient buildings, including—</text>
											<subclause commented="no" display-inline="no-display-inline" id="IDdd34bde3f825477a95149ffa34029db6"><enum>(I)</enum><text display-inline="yes-display-inline">residential users;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID62262a53dbd84271a2e0e9b8f191280e"><enum>(II)</enum><text display-inline="yes-display-inline">producers of highly energy-efficient
				products; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID92db2a8282f64587bdbb68fd7bfca5d5"><enum>(III)</enum><text display-inline="yes-display-inline">entities that carry out energy-efficiency
				improvement projects that result in consumer-side reductions in electricity
				use;</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEE7346582DDB461DAD4E18D57305DDA8"><enum>(iii)</enum><text display-inline="yes-display-inline">entities that will use the emission
				allowances for the purpose of carrying out geological sequestration of carbon
				dioxide produced by an anthropogenic global warming pollution emission source
				in accordance with requirements established by the Administrator;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE7E7B34CDFBA404B9925AC1DCF5F9297"><enum>(iv)</enum><text display-inline="yes-display-inline">such individuals and entities as the
				Administrator determines to be appropriate, for use in carrying out projects to
				reduce net carbon dioxide emissions through above-ground and below-ground
				biological carbon dioxide sequestration (including sequestration in forests,
				forest soils, agricultural soils, rangeland, or grassland in the United
				States);</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id6C1A5BFC9E694EE0B5CA49CEE9EC879D"><enum>(v)</enum><text display-inline="yes-display-inline">such individuals and entities (including
				fish and wildlife agencies) as the Administrator determines to be appropriate,
				for use in carrying out projects to protect and restore ecosystems (including
				fish and wildlife) affected by climate change; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id9632D57D3F244DF981E860CCB8459841"><enum>(vi)</enum><text display-inline="yes-display-inline">manufacturers producing consumer products
				that result in substantially reduced global warming pollution emissions, for
				use in funding rebates for purchasers of those products.</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAA79312B3F884AB2AE3EB24973BA1908"><enum>(c)</enum><header display-inline="yes-display-inline">Administration</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF6B98C04B762436D93CD9775BF5BFC47"><enum>(1)</enum><header display-inline="yes-display-inline">Allocation factors</header><text display-inline="yes-display-inline">Before making any allocation or transfer of
				emission allowances under subsection (a) or (b), the Administrator, in
				consultation with the Secretary of Commerce, shall take into
				consideration—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idD7E587BD360C4F439465F48CBDE7329B"><enum>(A)</enum><text display-inline="yes-display-inline">the distributive effect of the allocations
				on household income and net worth of individuals;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA441F579D6D483E8F0F3E85512F2DD2"><enum>(B)</enum><text display-inline="yes-display-inline">the impact of the allocations on corporate
				income, taxes, and asset value;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63FAAD1083E547E0A7377B2131DA5879"><enum>(C)</enum><text display-inline="yes-display-inline">the impact of the allocations on income
				levels and energy consumption of consumers;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8617C8762AB9429EBE8CB7BFDAE9D924"><enum>(D)</enum><text display-inline="yes-display-inline">the effects of the allocations with respect
				to economic efficiency;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C2476AB6EBB412983AF78C3BEB6D0DC"><enum>(E)</enum><text display-inline="yes-display-inline">the ability of electric generation
				facilities to pass through compliance costs to customers of the electric
				generation facilities;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id229381642FAB47CC820D62A333CDFBED"><enum>(F)</enum><text display-inline="yes-display-inline">the degree to which the quantity of
				allocations to the covered sectors should decrease over time; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC61BD1FC75034EA5A76DE4FEF1683C42"><enum>(G)</enum><text display-inline="yes-display-inline">the need to maintain the international
				competitiveness of United States manufacturing and avoid the additional loss of
				United States manufacturing jobs.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF224BC6BF1FA431DBF96E019747C3A5E"><enum>(2)</enum><header display-inline="yes-display-inline">Allocation recommendations and
				implementation</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id3E4A9D775DF04ED4AD0DEB75DAEC3E50"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, and before making any allocation or transfer of
				emission allowances under subsection (a) or (b), the Administrator shall submit
				a description of any determination of the Administrator relating to the
				allocation or transfer under that subsection to—</text>
										<clause commented="no" display-inline="no-display-inline" id="idB01F30AECDDB4EEAAED52369030CEB0A"><enum>(i)</enum><text display-inline="yes-display-inline">the Committees on Environment and Public
				Works and Commerce, Science, and Transportation of the Senate; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id02EFA62F15F24C5A8833C62C74A523E3"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committees on Energy and Commerce and
				Science of the House of Representatives.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6DA181B6E13442D94219C536EC71222"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment of determinations</header><text display-inline="yes-display-inline">A determination of the Administrator
				described in subparagraph (A), and any allocation or transfer of emission
				allowances made pursuant to such a determination, shall be—</text>
										<clause commented="no" display-inline="no-display-inline" id="idCC7D3A6A013740848C674A9997FB641F"><enum>(i)</enum><text display-inline="yes-display-inline">considered to be a major rule (as defined
				in section 804 of title 5, United States Code); and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id74B8396FAF544B728146BEC20B618405"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the requirements of chapter 8 of
				that title.</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id096111DFA9044837A426540F95E8ACAB"><enum>(d)</enum><header display-inline="yes-display-inline">Ratepayer protection</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id105FA421774E48379F4B9013D9B04B77"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id1D2F72A039EE4C0190A362D6F0C0B0AC"><enum>(A)</enum><header display-inline="yes-display-inline">Affected facility</header><text display-inline="yes-display-inline">The term <term>affected facility</term>
				means an electric generation facility that uses a conventional coal
				technology.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id493678599F02482782BAD5A573064650"><enum>(B)</enum><header display-inline="yes-display-inline">Authorized rate</header><text display-inline="yes-display-inline">The term <term>authorized rate</term> means
				a rate charged for electricity generated by an affected facility that
				is—</text>
										<clause commented="no" display-inline="no-display-inline" id="id2EDED4AE8998479AA4CFBDD193B05B17"><enum>(i)</enum><text display-inline="yes-display-inline">authorized by an appropriate regulatory
				agency; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id160C7BB77CCC478F8406DFD4DDA35118"><enum>(ii)</enum><text display-inline="yes-display-inline">based on, or calculated to recover, the
				reasonable capital and operating costs of the generation.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB844ADD196694555B448684BACEA2F4A"><enum>(C)</enum><header display-inline="yes-display-inline">Conventional coal technology</header><text display-inline="yes-display-inline">The term <term>conventional coal
				technology</term> means a technology for the generation of electricity
				that—</text>
										<clause commented="no" display-inline="no-display-inline" id="id92AB0708D3954C709E61325FA1539720"><enum>(i)</enum><text display-inline="yes-display-inline">involves the combustion of coal in a
				boiler; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id5C193FC036D547C29795BC4C73C29DED"><enum>(ii)</enum><text display-inline="yes-display-inline">does not provide for the capture or
				sequestration of carbon.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0A87623EBED6448189DEACACE4053040"><enum>(2)</enum><header display-inline="yes-display-inline">Protection</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="idD529F5A99D9F49749B36F93A44DA7B4F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (3) and except as
				provided in subparagraph (B), no owner or lessor of an affected facility who
				sells, at wholesale or retail, any electricity generated by the affected
				facility at an authorized rate shall recover through the authorized rate, in
				whole or in part, the cost of compliance with any Federal greenhouse gas
				reduction requirement relating to emissions from the affected facility.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDBA33B37C2DB4DDA95D69A8DABE7CF3B"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to an
				owner or lessor of an affected facility if the appropriate regulatory agency
				determines no feasible alternative exists to the use of conventional coal
				technology by the affected facility.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC4967E40C6274BD586F0664450F403FD"><enum>(3)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Paragraph (2)(A) shall apply to an owner or
				lessor described in that paragraph only if—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id604BEE45D53740978601CC8AC6729A48"><enum>(A)</enum><text display-inline="yes-display-inline">the affected facility enters operation
				after January 1, 2009; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E7BD20577CC4763B03D3F73ADB29336"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of compliance described in
				paragraph (2) is incurred after the date of enactment of this title.</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDEA50A078FC6244D19CA9001180767505" section-type="subsequent-section"><enum>709.</enum><header display-inline="yes-display-inline">Mercury emission limitations</header>
							<subsection commented="no" display-inline="no-display-inline" id="IDE5DB10298F234E00B23800AF22A28D06"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID7A5E150B7C58454BBE355900F4BE6E85"><enum>(1)</enum><header display-inline="yes-display-inline">Regulations</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID45E241EF0AA34BC19302B5A06749534B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Administrator shall promulgate regulations to
				establish emission limitations for mercury emissions by coal-fired electric
				generation facilities.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC7CE6BEDE045497592C68432085213C5"><enum>(B)</enum><header display-inline="yes-display-inline">No exceedance of national
				limitation</header><text display-inline="yes-display-inline">The regulations
				shall ensure that the national limitation for mercury emissions from each
				coal-fired electric generation facility established under section 705(a)(4)(A)
				(and, to the maximum extent practicable, the goal described in section
				705(a)(4)(B)) is not exceeded.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5EFCD8543CDD45F490451E5EAB7D8FE2"><enum>(C)</enum><header display-inline="yes-display-inline">Emission limitations for 2012 and
				thereafter</header><text display-inline="yes-display-inline">In carrying out
				subparagraph (A), for calendar year 2012 and each calendar year thereafter, the
				Administrator shall not—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID89631BD45E52465784EBFCC70006F5E6"><enum>(i)</enum><text display-inline="yes-display-inline">subject to subsections (e) and (f) of
				section 112, establish limitations on emissions of mercury from coal-fired
				electric generation facilities that allow emissions in excess of 2.48 grams of
				mercury per 1000 megawatt hours; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID54959B6288FB470E87A342466EC04914"><enum>(ii)</enum><text display-inline="yes-display-inline">differentiate between facilities that burn
				different types of coal.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6B0C8754B7254782B76171CF053229B2"><enum>(2)</enum><header display-inline="yes-display-inline">Annual review and determination</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID7697737BC0144A398BF600CC9D3100E2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than April 1 of each year, the
				Administrator shall—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDD7DCA30DC66943BA956444F530AE31C4"><enum>(i)</enum><text display-inline="yes-display-inline">review the total mercury emissions during
				the 2 preceding calendar years from electric generation facilities located in
				all States; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID9DABDB99CCFA4E22BE4150FDB4C1505D"><enum>(ii)</enum><text display-inline="yes-display-inline">determine whether, during the 2 preceding
				calendar years, the total mercury emissions from facilities described in clause
				(i) exceeded the national limitation for mercury emissions established under
				section 705(a)(4)(A).</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6D666D0407C148178C72E277665B9056"><enum>(B)</enum><header display-inline="yes-display-inline">Exceedance of national
				limitation</header><text display-inline="yes-display-inline">If the
				Administrator determines under subparagraph (A)(ii) that, during the 2
				preceding calendar years, the total mercury emissions from facilities described
				in subparagraph (A)(i) exceeded the national limitation for mercury emissions
				established under section 705(a)(4)(A), the Administrator shall, not later than
				1 year after the date of the determination, revise the regulations promulgated
				under paragraph (1) to reduce the emission rates specified in the regulations
				as necessary to ensure that the national limitation for mercury emissions is
				not exceeded in any future year.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6C75915E91B84A05B5B0861E697E59D2"><enum>(3)</enum><header display-inline="yes-display-inline">Compliance flexibility</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID040A2BD30C174DEF993EEC784C7D2628"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each coal-fired electric generation
				facility subject to an emission limitation under this section shall be in
				compliance with that limitation if that limitation is greater than or equal to
				the quotient obtained by dividing—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDF2025E798D604D1F8B0621C7D542A4F9"><enum>(i)</enum><text display-inline="yes-display-inline">the total mercury emissions of the
				coal-fired electric generation facility during each 30-day period; by</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID30BD07A29B7844298400BF612CDAF13E"><enum>(ii)</enum><text display-inline="yes-display-inline">the quantity of electricity generated by
				the coal-fired electric generation facility during that period.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID68DD133D03914D7BB331CF2BC54C0000"><enum>(B)</enum><header display-inline="yes-display-inline">More than 1 unit at a
				facility</header><text display-inline="yes-display-inline">In any case in which
				more than 1 coal-fired electricity generating unit at a coal-fired electric
				generation facility subject to an emission limitation under this section was
				operated in 1999 under common ownership or control, compliance with the
				emission limitation may be determined by averaging the emission rates of all
				coal-fired electricity generating units at the electric generation facility
				during each 30-day period.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2618EA9FE9154968825B598BD7F26839"><enum>(b)</enum><header display-inline="yes-display-inline">Prevention of re-release</header>
								<paragraph commented="no" display-inline="no-display-inline" id="IDEA35255FFEF040E6B96CA8F64BFE0706"><enum>(1)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than July 1, 2008, the
				Administrator shall promulgate regulations to ensure that any mercury captured
				or recovered by emission controls installed at an electric generation facility
				is not re-released into the environment.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBFCE1370A254455B9679CACAE25EC806"><enum>(2)</enum><header display-inline="yes-display-inline">Required elements</header><text display-inline="yes-display-inline">The regulations shall require—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDFD9B986B8249407B95634114B800F846"><enum>(A)</enum><text display-inline="yes-display-inline">daily covers on all active waste disposal
				units, and permanent covers on all inactive waste disposal units, to prevent
				the release of mercury into the air;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDA23253CF7ED422B8323128360E8D312"><enum>(B)</enum><text display-inline="yes-display-inline">monitoring of groundwater to ensure that
				mercury or mercury compounds do not migrate from the waste disposal
				unit;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID350FC59CBBD64996813E5F8E75E078BA"><enum>(C)</enum><text display-inline="yes-display-inline">waste disposal siting requirements and
				cleanup requirements to protect groundwater and surface water resources;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID99CD3F5E58AA4E6BA55B904893E06631"><enum>(D)</enum><text display-inline="yes-display-inline">elimination of agricultural application of
				coal combustion wastes; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID650BA74AB6E1455B94B88D200049CEA4"><enum>(E)</enum><text display-inline="yes-display-inline">appropriate limitations on mercury
				emissions from sources or processes that reprocess or use coal combustion
				waste, including manufacturers of wallboard and cement.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id88473353661942F6ABA72931EBC0AB01"><enum>(c)</enum><header display-inline="yes-display-inline">New affected unit limitation</header><text display-inline="yes-display-inline">An affected unit that enters operation on
				or after the date of enactment of this title shall achieve, on an annual
				average basis, a mercury emission rate of not more than 2.48 grams of mercury
				per 1,000 megawatt hours, regardless of the type of coal used at the affected
				unit.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="IDF58A326BC733458F8B84E7B6EF5DF754" section-type="subsequent-section"><enum>710.</enum><header display-inline="yes-display-inline">Other hazardous air pollutants</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID953C6FA492E345089E2DC34D404CB000"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2008, the
				Administrator shall issue to owners and operators of coal-fired electric
				generation facilities requests for information under section 114 that are of
				sufficient scope to generate data sufficient to support issuance of standards
				under section 112(d) for hazardous air pollutants other than mercury emitted by
				coal-fired electric generation facilities.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAA90BF63471A41D1BD95C024C436436E"><enum>(b)</enum><header display-inline="yes-display-inline">Deadline for submission of requested
				information</header><text display-inline="yes-display-inline">The Administrator
				shall require each recipient of a request for information described in
				subsection (a) to submit the requested data not later than 180 days after the
				date of the request.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDBBC4F4CEC4CF4EBD00BF2B07B058A1A5"><enum>(c)</enum><header display-inline="yes-display-inline">Promulgation of emission
				standards</header><text display-inline="yes-display-inline">The Administrator
				shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDF04DF96C166844AF95724790D81EA800"><enum>(1)</enum><text display-inline="yes-display-inline">not later than January 1, 2008, propose
				emission standards under section 112(d) for hazardous air pollutants other than
				mercury; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5E93D14350574B58A90071402B003B9F"><enum>(2)</enum><text display-inline="yes-display-inline">not later than January 1, 2009, promulgate
				emission standards under section 112(d) for hazardous air pollutants other than
				mercury.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE75953E996E947638DD4970031149187"><enum>(d)</enum><header display-inline="yes-display-inline">Prohibition on excess
				emissions</header><text display-inline="yes-display-inline">It shall be
				unlawful for an electric generation facility subject to standards for hazardous
				air pollutants other than mercury promulgated under subsection (c) to emit,
				after December 31, 2010, any such pollutant in excess of the standards.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID825CCBDF017D4A34A275008C4FD3D233"><enum>(e)</enum><header display-inline="yes-display-inline">Effect on other law</header><text display-inline="yes-display-inline">Nothing in this section or section 709
				affects any requirement of subsection (e), (f)(2), or (n)(1)(A) of section 112,
				except that the emission limitations established by regulations promulgated
				under this section shall be deemed to represent the maximum achievable control
				technology for mercury emissions from electricity generating units under
				section 112(d).</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="IDcbc3c9ae01074e4cbcba2502a922a5c9" section-type="subsequent-section"><enum>711.</enum><header display-inline="yes-display-inline">Emission standards for affected
				units</header>
							<subsection commented="no" display-inline="no-display-inline" id="idA4F082E00BFB44279281B1E06012ADFC"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of affected unit</header><text display-inline="yes-display-inline">In this subsection, the term <term>affected
				unit</term> means a unit that—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idBC55BF8F32F243E18BC1DDADDB577596"><enum>(1)</enum><text display-inline="yes-display-inline">is designed and intended to provide
				electricity at a unit capacity factor of at least 60 percent; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9EAE3D4C4AF46578C74A253AEF08001"><enum>(2)</enum><text display-inline="yes-display-inline">begins operation after December 31,
				2011.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID189ab93fe2b04787bee73dc5359b7b39"><enum>(b)</enum><header display-inline="yes-display-inline">Initial standard</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id7F7B6DA531084B0FA041B7548968A766"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall promulgate regulations
				requiring each affected unit to meet the standard described in paragraph
				(2).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6052179806BC472796062B3FA93DFCC3"><enum>(2)</enum><header display-inline="yes-display-inline">Standard</header><text display-inline="yes-display-inline">Beginning on December 31, 2015, an affected
				unit shall meet a global warming pollution emission standard that is not higher
				than the emission rate of a new combined cycle natural gas generating
				unit.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD1B8AE4CC2CA4E32B1EA4B26CB462C86"><enum>(3)</enum><header display-inline="yes-display-inline">More stringent requirements</header><text display-inline="yes-display-inline">For the period beginning on January 1 of
				the calendar year following the effective date of the regulations promulgated
				pursuant to paragraph (1) and ending on December 31, 2029, the Administrator
				may increase the stringency of the global warming pollution emission standard
				described in paragraph (2) with respect to affected units as the Administrator
				determines to be appropriate to ensure a reduction in the emission rate of
				global warming pollutants of at least 90 percent from each affected
				unit.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0d21f62267af47a4897bdfa57f67243c"><enum>(c)</enum><header display-inline="yes-display-inline">Final
				standard</header><text display-inline="yes-display-inline">Not later than
				December 31, 2030, the Administrator shall require each unit that is designed
				and intended to provide electricity at a unit capacity factor of at least 60
				percent, regardless of the date on which the unit entered operation, to meet
				the applicable emission standard under subsection (b).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id4243D4623A254ABC93C47AD62FFCE2A0"><enum>(d)</enum><header display-inline="yes-display-inline">Adjustment of requirements</header><text display-inline="yes-display-inline">If the Academy determines, pursuant to
				section 705(e), that a requirement of this section is or will be
				technologically infeasible at the time at which the requirement becomes
				effective, the Administrator, by regulation, may adjust or delay the effective
				date of the requirement as the Administrator determines to be necessary, taking
				into consideration the determination of the Academy.</text>

							<subsection commented="no" display-inline="no-display-inline" id="IDae655417ac034182a58ba271d9eb1868"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id47DB7C4362594144AF7E8013A95C6CD7"><enum>(1)</enum><header display-inline="yes-display-inline">Base quantity of electricity</header><text display-inline="yes-display-inline">The term <term>base quantity of
				electricity</term> means the total quantity of electricity produced for sale by
				a covered generator during the calendar year immediately preceding a compliance
				year from—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idE03795A276B849B188B3F9C115D1A28F"><enum>(A)</enum><text display-inline="yes-display-inline">coal;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB3D8F0C06FF24CB9894F8CF787173616"><enum>(B)</enum><text display-inline="yes-display-inline">petroleum coke;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BAACB3E463C44C8B3447C71F2E0DD7C"><enum>(C)</enum><text display-inline="yes-display-inline">lignite; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2EE7B76A6DA04920A49D8ED06A177DDB"><enum>(D)</enum><text display-inline="yes-display-inline">any combination of the fuels described in
				subparagraphs (A) through (C).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf83ba1aebc9e4125ad3528c96b8ef1b4"><enum>(2)</enum><header display-inline="yes-display-inline">Covered generator</header><text display-inline="yes-display-inline">The term <term>covered generator</term>
				means an electric generation facility that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id4AF55E3FFBF3465D9AC93062A3F44074"><enum>(A)</enum><text display-inline="yes-display-inline">has a rated capacity of 25 megawatts or
				more; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE848DF666923435EB56CEA0873C981F1"><enum>(B)</enum><text display-inline="yes-display-inline">has an annual fuel input at least 50
				percent of which is provided by—</text>
										<clause commented="no" display-inline="no-display-inline" id="idD00F297BA043405DB110FEEEAD36E067"><enum>(i)</enum><text display-inline="yes-display-inline">coal;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id8BD56189E7A84CE0A5C97EBFBECDB4FD"><enum>(ii)</enum><text display-inline="yes-display-inline">petroleum coke;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id358EC945AD694DEE8FC2121B71AC2768"><enum>(iii)</enum><text display-inline="yes-display-inline">lignite; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id91B4163F9A104822984EF2023414D1CF"><enum>(iv)</enum><text display-inline="yes-display-inline">any combination of the fuels described in
				clauses (i) through (iii).</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcdbff856d0d44d5aa44dc0511a62c8d5"><enum>(3)</enum><header display-inline="yes-display-inline">Low-carbon generation</header><text display-inline="yes-display-inline">The term <term>low-carbon generation</term>
				means electric energy generated from an electric generation facility at least
				50 percent of the annual fuel input of which, in any year—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9DE8CB18B95D4F0E8FB16380ABE3A9DD"><enum>(A)</enum><text display-inline="yes-display-inline">is provided by—</text>
										<clause commented="no" display-inline="no-display-inline" id="id9AA4BCF059A64521A5651F16961A73DF"><enum>(i)</enum><text display-inline="yes-display-inline">coal;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE76357A5F75348EA8CC0B8FB2B86F12E"><enum>(ii)</enum><text display-inline="yes-display-inline">petroleum coke;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idD6A4FB9CF25C4731B7C91728FF504F40"><enum>(iii)</enum><text display-inline="yes-display-inline">lignite; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id71C328691E3942BE8E0A44B857D4F732"><enum>(iv)</enum><text display-inline="yes-display-inline">any combination of the fuels described in
				clauses (i) through (iii); and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E30CDB0A01042FDAFA0ED40627A591B"><enum>(B)</enum><text display-inline="yes-display-inline">results in an emission rate into the
				atmosphere of not more than 250 pounds of carbon dioxide per megawatt-hour
				(after adjustment for any carbon dioxide emitted from the electric generation
				facility that is geologically sequestered in a geological repository approved
				by the Administrator pursuant to section 713).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3466E69B1EC7494688B997F8E3C89788"><enum>(4)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
				low-carbon generation credit trading program established under subsection
				(d)(1).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID32a6477f9f9d4d358df79d4bbc01252a"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF8E22D4056B2403EB6B6879C94924B89"><enum>(1)</enum><header display-inline="yes-display-inline">Calendar years 2015 through
				2020</header><text display-inline="yes-display-inline">Of the base quantity of
				electricity produced for sale by a covered generator for a calendar year, the
				covered generator shall provide a minimum percentage of that base quantity of
				electricity for the calendar year from low-carbon generation, as specified in
				the following table:</text>

				2025</header><text display-inline="yes-display-inline">For each of calendar
				years 2021 through 2025, the Administrator may increase the minimum percentage
				of the base quantity of electricity from low-carbon generation described in
				paragraph (1) by not more than 2 percentage points from the preceding year, as
				the Administrator determines to be necessary to achieve the emission reduction
				goal described in section 705(a)(3).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id925922615C7E41C9B2E094D5B2EED857"><enum>(3)</enum><header display-inline="yes-display-inline">Calendar years 2026 through
				2030</header><text display-inline="yes-display-inline">For each of calendar
				years 2026 through 2030, the Administrator may increase the minimum percentage
				of the base quantity of electricity from low-carbon generation described in
				paragraph (1) by not more than 3 percentage points from the preceding year, as
				the Administrator determines to be necessary to achieve the emission reduction
				goal described in section 705(a)(3).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC306E58168054F879E65388D95F5C3C4"><enum>(c)</enum><header display-inline="yes-display-inline">Means of compliance</header><text display-inline="yes-display-inline">An owner or operator of a covered generator
				shall comply with subsection (b) by—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDe8847807937745529a5106a87e86049c"><enum>(1)</enum><text display-inline="yes-display-inline">generating electric energy using low-carbon
				generation;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14FBA952AD204BD298A2FEFBCE73E835"><enum>(2)</enum><text display-inline="yes-display-inline">purchasing electric energy generated by
				low-carbon generation;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A832B6800C24B69B85EC6BA8A9A498F"><enum>(3)</enum><text display-inline="yes-display-inline">purchasing low-carbon generation credits
				issued under the program; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79974711E15E423CA1C967E5A9CF5177"><enum>(4)</enum><text display-inline="yes-display-inline">any combination of the actions described in
				paragraphs (1) through (3).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA415FFE658BC4D0CAC6F8012FC1640CC"><enum>(d)</enum><header display-inline="yes-display-inline">Low-carbon generation credit trading
				program</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idE9752CA81C5044A2B09DB6951C25F21B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2008, the
				Administrator shall establish, by regulation, after notice and opportunity for
				comment, a low-carbon generation trading program to permit an owner or operator
				of a covered generator that does not generate or purchase enough electric
				energy from low-carbon generation to comply with subsection (b) to achieve that
				compliance by purchasing sufficient low-carbon generation credits.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47f69e780811473f87e96e2d6e769eaa"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out the program, the
				Administrator shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id102D3AAB38114F009CC014324447FF57"><enum>(A)</enum><text display-inline="yes-display-inline">issue to producers of low-carbon
				generation, on a quarterly basis, a single low-carbon generation credit for
				each kilowatt hour of low-carbon generation sold during the preceding quarter;
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf67764f52c8b4d09ab8b85cd5c4281d7"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that a kilowatt hour, including the
				associated low-carbon generation credit, shall be used only once for purposes
				of compliance with subsection (b).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDea39790621aa4328966d481a2192c70d"><enum>(e)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">An owner or operator of a covered generator
				that fails to comply with subsection (b) shall be subject to a civil penalty in
				an amount equal to the product obtained by multiplying—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id4CCEE2CC61A14DBAABA9BC8DC992A4F9"><enum>(1)</enum><text display-inline="yes-display-inline">the number of kilowatt-hours of electric
				energy sold to electric consumers in violation of subsection (b); and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id360B49A43F8A4637B423A6178DC3EB8B"><enum>(2)</enum><text display-inline="yes-display-inline">the greater of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idADC17E7BB5BA445CB2A6B7F3C427040E"><enum>(A)</enum><text display-inline="yes-display-inline">2.5 cents (as adjusted under subsection
				(g)); or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC434D0895AC04403B424545CF0BB290E"><enum>(B)</enum><text display-inline="yes-display-inline">200 percent of the average market value of
				those low-carbon generation credits during the year in which the violation
				occurred.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1fda12a74ef34783a76a003114bf1cfe"><enum>(f)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">This section shall not apply, for any
				calendar year, to an owner or operator of a covered generator that sold less
				than 40,000 megawatt-hours of electric energy produced from covered generators
				during the preceding calendar year.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0c59ae165ca442768de66bd785cbef87"><enum>(g)</enum><header display-inline="yes-display-inline">Inflation adjustment</header><text display-inline="yes-display-inline">Not later than December 31, 2008, and
				annually thereafter, the Administrator shall adjust the amount of the civil
				penalty for each kilowatt-hour calculated under subsection (e)(2) to reflect
				changes for the 12-month period ending on the preceding November 30 in the
				Consumer Price Index for All Urban Consumers published by the Bureau of Labor
				Statistics of the Department of Labor.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id4DDECB6691CA46F7BB0C95E082BC96C1"><enum>(h)</enum><header display-inline="yes-display-inline">Technological infeasibility</header><text display-inline="yes-display-inline">If the Academy determines, pursuant to
				section 705(e), that the schedule for compliance described in subsection (b) is
				or will be technologically infeasible for covered generators to meet, the
				Administrator, by regulation, may adjust the schedule as the Administrator
				determines to be necessary, taking into consideration the determination of the
				Academy.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID940eaac18e7a454db52d7198fa3b5fa5"><enum>(i)</enum><header display-inline="yes-display-inline">Termination of authority</header><text display-inline="yes-display-inline">This section and the authority provided by
				this section shall terminate on December 31, 2030.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="ID97e56362a79041f0aa91e7cc49510b5d" section-type="subsequent-section"><enum>713.</enum><header display-inline="yes-display-inline">Geological disposal of global warming
				pollutants</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID739ee2c7bbd94d569893f02b6789fc66"><enum>(a)</enum><header display-inline="yes-display-inline">Geological carbon dioxide disposal
				deployment projects</header>
								<paragraph commented="no" display-inline="no-display-inline" id="IDb599b20ca92f443b9d2b5e9baaf4b2d9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish a
				competitive grant program to provide grants to 5 entities for the deployment of
				projects to geologically dispose of carbon dioxide (referred to in this
				subsection as <term>geological disposal deployment projects</term>).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26bf18f3242a4ef98b154148a1fd44dd"><enum>(2)</enum><header display-inline="yes-display-inline">Location</header><text display-inline="yes-display-inline">Each geological disposal deployment project
				shall be conducted in a geologically distinct location in order to demonstrate
				the suitability of a variety of geological structures for carbon dioxide
				disposal.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e8b166da8844ceda8cdb3560ac1ac10"><enum>(3)</enum><header display-inline="yes-display-inline">Components</header><text display-inline="yes-display-inline">Each geological disposal deployment project
				shall include an analysis of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDc9783912ccd043bca5440169f9e930f2"><enum>(A)</enum><text display-inline="yes-display-inline">mechanisms for trapping the carbon dioxide
				to be geologically disposed;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID140a8d132f404ac9b71dc93e2039dbdb"><enum>(B)</enum><text display-inline="yes-display-inline">techniques for monitoring the geologically
				disposed carbon dioxide;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1890b0f2460445fcbd66c9b6b12ea98e"><enum>(C)</enum><text display-inline="yes-display-inline">public response to the geological disposal
				deployment project; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7AACD2B75B4B4EE7A43E414CB0B4BE4F"><enum>(D)</enum><text display-inline="yes-display-inline">the permanency of carbon dioxide storage in
				geological reservoirs.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID77043cd646774a8b81fbc19a5c98eb74"><enum>(4)</enum><header display-inline="yes-display-inline">Requirements</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDf07fc9666c6c4d43aae97bf72438ea05"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall establish—</text>
										<clause commented="no" display-inline="no-display-inline" id="id5F8F35E725954C09BDCFA782F7C926E4"><enum>(i)</enum><text display-inline="yes-display-inline">appropriate conditions for environmental
				protection with respect to geological disposal deployment projects to protect
				public health and the environment, including—</text>
											<subclause commented="no" display-inline="no-display-inline" id="IDa185230a1a5c4d17a972709bc09afbc9"><enum>(I)</enum><text display-inline="yes-display-inline">site characterization and selection;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5ff5ff4066b649efab5b480ceeffdd0f"><enum>(II)</enum><text display-inline="yes-display-inline">geomechanical, geochemical, and
				hydrogeological simulation;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID51579e3ec6e64c11b6ff6ab8e7cf196d"><enum>(III)</enum><text display-inline="yes-display-inline">risk assessment;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5366e76db14b44118e201c94c4d9f43e"><enum>(IV)</enum><text display-inline="yes-display-inline">mitigation and remediation
				protocols;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID00762ca4e6894fec836dadf9f4fff8ff"><enum>(V)</enum><text display-inline="yes-display-inline">the issuance of permits for test,
				injection, and monitoring wells;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDae080364039a46c2a0113d3ce7b156fa"><enum>(VI)</enum><text display-inline="yes-display-inline">specifications for the drilling,
				construction, and maintenance of wells;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDdfdbe0379dd246bb981bd8f56c4717ee"><enum>(VII)</enum><text display-inline="yes-display-inline">ownership of subsurface rights and pore
				space;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID919fce046c534f66b1e63281261f9d53"><enum>(VIII)</enum><text display-inline="yes-display-inline">transportation pipeline
				specifications;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf84e78d83e104cb3b3bd105f73520e83"><enum>(IX)</enum><text display-inline="yes-display-inline">the allowed composition of injected
				matter;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID11596297ccd94ac79abc925b3cfc5599"><enum>(X)</enum><text display-inline="yes-display-inline">testing, monitoring, measurement, and
				verification for the entire chain of operations, beginning with the point of
				capture of carbon dioxide to a storage site;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID934ffa14bf384f1ab03e85bc52ca2319"><enum>(XI)</enum><text display-inline="yes-display-inline">closure and decommissioning
				procedures;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6a6eaa14a66840c1827faca30dcf8514"><enum>(XII)</enum><text display-inline="yes-display-inline">transportation pipeline siting; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID51b431ddb9b44b039d5531a4a95afad7"><enum>(XIII)</enum><text display-inline="yes-display-inline">short- and long-term legal responsibility
				and indemnification procedures for storage sites; and</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC02CF3DAEC5B4731889E9615BEE80B3C"><enum>(ii)</enum><text display-inline="yes-display-inline">requirements relating to applications for
				grants under this subsection.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID929c5f7a4e83446a82ce743fd6c6c37a"><enum>(B)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">The establishment of requirements under
				subparagraph (A) shall not require a rulemaking.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd786a06989fd43ae985c9ab77f874d84"><enum>(C)</enum><header display-inline="yes-display-inline">Minimum requirements</header><text display-inline="yes-display-inline">At a minimum, each application for a grant
				under this subsection shall include—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDf9162101c8fb42d7a53121060848ba41"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the geological disposal
				deployment project proposed in the application;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID79222f8a8afb4c95945c0b64b7f48a71"><enum>(ii)</enum><text display-inline="yes-display-inline">an estimate of the quantity of carbon
				dioxide to be geologically disposed over the life of the geological disposal
				deployment project; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID08dc10aa369a431a9f1b0778faf16123"><enum>(iii)</enum><text display-inline="yes-display-inline">a plan to collect and disseminate data
				relating to each geological disposal deployment project to be funded by the
				grant.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb5da53973fa24d7194de2e4d8411cb4d"><enum>(5)</enum><header display-inline="yes-display-inline">Partners</header><text display-inline="yes-display-inline">An applicant for a grant under this
				subsection may carry out a geological disposal deployment project under a pilot
				program in partnership with 1 or more public or private entities.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4d3f3372a5db42f78bfb8c0c663f16f3"><enum>(6)</enum><header display-inline="yes-display-inline">Selection criteria</header><text display-inline="yes-display-inline">In evaluating applications under this
				subsection, the Administrator shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDc09bcbe5728f45c98a9f2e73fed8035c"><enum>(A)</enum><text display-inline="yes-display-inline">consider the previous experience of each
				applicant with similar projects; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID44ae10d13cfd45459f8b7afa4576ac20"><enum>(B)</enum><text display-inline="yes-display-inline">give priority consideration to applications
				for geological disposal deployment projects that—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID50a3025b6fe14d39a9eced922ef015e0"><enum>(i)</enum><text display-inline="yes-display-inline">offer the greatest geological diversity, as
				compared to other geological disposal deployment projects that received grants
				under this subsection;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDefb7e77078374e3db62aeaa73f2c35aa"><enum>(ii)</enum><text display-inline="yes-display-inline">are located in closest proximity to a
				source of carbon dioxide;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID6dc181a3fa9d4f368c65170b9da3fb81"><enum>(iii)</enum><text display-inline="yes-display-inline">make use of the most affordable source of
				carbon dioxide;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID44f1c352774b4ca5b1d746bb08027a8b"><enum>(iv)</enum><text display-inline="yes-display-inline">are expected to geologically dispose
				of—</text>
											<subclause commented="no" display-inline="no-display-inline" id="id17C8361D70FE4402AC93DEB447F504C1"><enum>(I)</enum><text display-inline="yes-display-inline">the largest quantity of carbon dioxide;
				and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id05AC17294AD14B078CB6FEEB1C46FF19"><enum>(II)</enum><text display-inline="yes-display-inline">a minimum quantity of 1,000,000 tons of
				carbon dioxide for each project carried out as part of the demonstration
				project;</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID363caa149e9a4aff98ea9b984f387e60"><enum>(v)</enum><text display-inline="yes-display-inline">are combined with demonstrations of
				advanced coal electricity generation technologies;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDe8f758fa15af4c9282a37a6550610a98"><enum>(vi)</enum><text display-inline="yes-display-inline">demonstrate the greatest commitment on the
				part of the applicant to ensure funding for the proposed demonstration project
				and the greatest likelihood that the demonstration project will be maintained
				or expanded after Federal assistance under this subsection is completed;
				and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID5f1c26a8333a44218783d8c43e677bb5"><enum>(vii)</enum><text display-inline="yes-display-inline">minimize any adverse environmental effects
				from the project.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2a44c721cd384fe6a591c7172a87fb08"><enum>(7)</enum><header display-inline="yes-display-inline">Period of grants</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID1fae4a00a3da424eb89362b7cd425857"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A geological disposal deployment project
				funded by a grant under this subsection shall begin construction not later than
				3 years after the date on which the grant is provided.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd4dc7e5ac5f948659b0693e4dd5fccfd"><enum>(B)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">The Administrator shall not provide grant
				funds to any applicant under this subsection for a period of more than 5
				years.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID84b7b3f4cbaf48219ceb1d2c86b34eca"><enum>(8)</enum><header display-inline="yes-display-inline">Transfer of information and
				knowledge</header><text display-inline="yes-display-inline">The Administrator
				shall establish mechanisms to ensure that the information and knowledge gained
				by participants in the program are published and disseminated, including to
				other applicants that submitted applications for a grant under this
				subsection.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67c5f3f001904de7af9a3f59ef264109"><enum>(9)</enum><header display-inline="yes-display-inline">Schedule</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID7474c26bf84d40389a8a3cac8b26aec7"><enum>(A)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this title, the Administrator shall publish in the Federal
				Register, and elsewhere as appropriate, a request for applications to carry out
				geological disposal deployment projects.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc98b7ea799544293a1885a31b1ec5657"><enum>(B)</enum><header display-inline="yes-display-inline">Date for applications</header><text display-inline="yes-display-inline">An application for a grant under this
				subsection shall be submitted not later than 180 days after the date of
				publication of the request under subparagraph (A).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb41e0b23153645e6af7bb410d817b053"><enum>(C)</enum><header display-inline="yes-display-inline">Selection</header><text display-inline="yes-display-inline">After the date by which applications for
				grants are required to be submitted under subparagraph (B), the Administrator,
				in a timely manner, shall select, after peer review and based on the criteria
				under paragraph (6), those geological disposal deployment projects to be
				provided a grant under this subsection.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID85fe8ee7cd2e4bce9f274733812b2313"><enum>(b)</enum><header display-inline="yes-display-inline">Interim standards</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Administrator, in consultation with the Secretary
				of Energy, shall, by regulation, establish interim geological carbon dioxide
				disposal standards that address—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID0e65fd8027f84f5da3064dd2ec330cf0"><enum>(1)</enum><text display-inline="yes-display-inline">site selection;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd527a390762b43b6a5748ec6f18a6f43"><enum>(2)</enum><text display-inline="yes-display-inline">permitting processes;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID915c64e559304998ac78c1e6ff9d7999"><enum>(3)</enum><text display-inline="yes-display-inline">monitoring requirements;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2ef89e10500f4b38a1ba2ab93628d1cb"><enum>(4)</enum><text display-inline="yes-display-inline">public participation; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb52185cc750e4ecf8cdca2450eb133f5"><enum>(5)</enum><text display-inline="yes-display-inline">such other issues as the Administrator and
				the Secretary of Energy determine to be appropriate.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB89F0DCC8B9B499C90C528ECE0B63758"><enum>(c)</enum><header display-inline="yes-display-inline">Final standards</header><text display-inline="yes-display-inline">Not later than 6 years after the date of
				enactment of this title, taking into consideration the results of geological
				disposal deployment projects carried out under subsection (a), the
				Administrator, by regulation, shall establish final geological carbon dioxide
				disposal standards.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4c4171abf2c64cf2a8353124ecd0d798"><enum>(d)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In developing standards under subsections
				(b) and (c), the Administrator shall consider the experience in the United
				States in regulating—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id23A4ED55E37241F9A5673E27F1A258D8"><enum>(1)</enum><text display-inline="yes-display-inline">underground injection of waste;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id234870CF8DB54FAB9011E7C9D026867D"><enum>(2)</enum><text display-inline="yes-display-inline">enhanced oil recovery;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30A81FC16377413390C1134BDDC7DEA6"><enum>(3)</enum><text display-inline="yes-display-inline">short-term storage of natural gas;
				and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DB12CC227914B2D9F4A1E87CCD620D4"><enum>(4)</enum><text display-inline="yes-display-inline">long-term waste storage.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE9800FA0C22E41399BD545BB0BADD71E"><enum>(e)</enum><header display-inline="yes-display-inline">Termination of authority</header><text display-inline="yes-display-inline">This section and the authority provided by
				this section shall terminate on December 31, 2030.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id1D1CC3435F3940B9850FBFA002D32AC9" section-type="subsequent-section"><enum>714.</enum><header display-inline="yes-display-inline">Energy efficiency performance
				standard</header>
							<subsection commented="no" display-inline="no-display-inline" id="id16138240B57B4D64B69015D25928264A"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id5CBE3425A4ED48B18C00DC7D79B65DFC"><enum>(1)</enum><header display-inline="yes-display-inline">Electricity savings</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id243CAD1722D94FFCB827227AA6C06747"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>electricity savings</term>
				means reductions in end-use electricity consumption relative to consumption by
				the same customer or at the same new or existing facility in a given year, as
				defined in regulations promulgated by the Administrator under subsection
				(e).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa8ffb3e3d0e4c72b7c6c257a7f935dc"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>electricity savings</term>
				includes savings achieved as a result of—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDd9c4e9703d204560a1019dbee0e1ea8c"><enum>(i)</enum><text display-inline="yes-display-inline">installation of energy-saving technologies
				and devices; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDf9252701fdf14aa993c3736acd6652a4"><enum>(ii)</enum><text display-inline="yes-display-inline">the use of combined heat and power systems,
				fuel cells, or any other technology identified by the Administrator that
				recaptures or generates energy solely for onsite customer use.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9BCF95C6B3F64869AFCD723EFB72DCDE"><enum>(C)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>electricity savings</term>
				does not include savings from measures that would likely be adopted in the
				absence of energy-efficiency programs, as determined by the
				Administrator.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDafe590fee11a4804ac909290a1df36fe"><enum>(2)</enum><header display-inline="yes-display-inline">Retail electricity sales</header><text display-inline="yes-display-inline">The term <term>retail electricity
				sales</term> means the total quantity of electric energy sold by a retail
				electricity supplier to retail customers during the most recent calendar year
				for which that information is available.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfd4081506c31482794f2bb0ba10d7cd3"><enum>(3)</enum><header display-inline="yes-display-inline">Retail electricity supplier</header><text display-inline="yes-display-inline">The term <term>retail electricity
				supplier</term> means a distribution or integrated utility, or an independent
				company or entity, that sells electric energy to consumers.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdacbd1876a6042d3b0d86a3ac3e523d4"><enum>(b)</enum><header display-inline="yes-display-inline">Energy efficiency performance
				standard</header><text display-inline="yes-display-inline">Each retail
				electricity supplier shall implement programs and measures to achieve
				improvements in energy efficiency and peak load reduction, as verified by the
				Administrator.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDcaa87bc20c9242218f18b1fb7845ee99"><enum>(c)</enum><header display-inline="yes-display-inline">Targets</header><text display-inline="yes-display-inline">For calendar year 2008 and each calendar
				year thereafter, the Administrator shall ensure that retail electric suppliers
				annually achieve electricity savings and reduce peak power demand and
				electricity use by retail customers by a percentage that is not less than the
				applicable target percentage specified in the following table:</text>

				date</header><text display-inline="yes-display-inline">For the purpose of
				meeting the targets established under subsection (c), electricity savings shall
				be calculated based on the sum of—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id4B8C7B08B54B4F15AEBFA3BC54246EB4"><enum>(1)</enum><text display-inline="yes-display-inline">electricity savings realized as a result of
				actions taken by the retail electric supplier during the specified calendar
				year; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id903AB6A8B9F74BCF9E9E2AA7A643A370"><enum>(2)</enum><text display-inline="yes-display-inline">cumulative electricity savings realized as
				a result of electricity savings achieved in all preceding calendar years
				(beginning with calendar year 2006).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDee4b6a60d5a345e28939a825937376fd"><enum>(e)</enum><header display-inline="yes-display-inline">Implementing regulations</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF0E8DEEB125B48AF990F6BE75299C71C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Administrator shall promulgate regulations to
				implement the targets established under subsection (c).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07DFAC2AC1964954B8A4E385C643DFBF"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The regulations shall establish—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDa1177710b3984c74a7e408ff82f1f044"><enum>(A)</enum><text display-inline="yes-display-inline">a national credit system permitting credits
				to be awarded, bought, sold, or traded by and among retail electricity
				suppliers;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7a029c846d8d400cb1d53248b0b65cf0"><enum>(B)</enum><text display-inline="yes-display-inline">a fee equivalent to not less than 4 cents
				per kilowatt hour for retail energy suppliers that do not meet the targets
				established under subsection (c); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2758bb75730f4d0ca7d7913c1bf8fa87"><enum>(C)</enum><text display-inline="yes-display-inline">standards for monitoring and verification
				of electricity use and demand savings reported by the retail electricity
				suppliers.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id769267ABB1EB48578A83C685BB9E453A"><enum>(3)</enum><header display-inline="yes-display-inline">Consideration of transmission and
				distribution efficiency</header><text display-inline="yes-display-inline">In
				developing regulations under this subsection, the Administrator shall consider
				whether electricity savings, in whole or part, achieved by retail electricity
				suppliers by improving the efficiency of electric distribution and use should
				be eligible for credits established under this section.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID92ab7fc8730749cc9beaf51e378d51b5"><enum>(f)</enum><header display-inline="yes-display-inline">Compliance with State law</header><text display-inline="yes-display-inline">Nothing in this section supersedes or
				otherwise affects any State or local law requiring, or otherwise relating to,
				reductions in total annual electricity consumption or peak power consumption by
				electric consumers to the extent that the State or local law requires more
				stringent reductions than the reductions required under this section.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id7C9025CAC94442F687A20A0D55EAD0A3"><enum>(g)</enum><header display-inline="yes-display-inline">Voluntary participation</header><text display-inline="yes-display-inline">The Administrator may—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id6C0CC080B56F42F18872D8081D2623E4"><enum>(1)</enum><text display-inline="yes-display-inline">pursuant to the regulations promulgated
				under subsection (e)(1), issue a credit to any entity that is not a retail
				electric supplier if the entity implements electricity savings; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id856B967209EF4602868F61CA05BF1FBA"><enum>(2)</enum><text display-inline="yes-display-inline">in a case in which an entity described in
				paragraph (1) is a nonprofit or educational organization, provide to the entity
				1 or more grants in lieu of a credit.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDFCEC963B3FE34D7D8DC7AC598754C545" section-type="subsequent-section"><enum>715.</enum><header display-inline="yes-display-inline">Renewable portfolio standard</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID1697de44d0f94e85937e89f448ab67f7"><enum>(a)</enum><header display-inline="yes-display-inline">Renewable energy</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id466F8AA0485749A7977721D3F4E20B3A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with the
				Secretary of Energy, shall promulgate regulations defining the types and
				sources of renewable energy generation that may be carried out in accordance
				with this section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe424267d1bea47c39fa5c24693379faa"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">In promulgating regulations under paragraph
				(1), the Administrator shall include of all types of renewable energy (as
				defined in section 203(b) of the Energy Policy Act of 2005 (42 U.S.C.
				15852(b))) other than energy generated from—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id602438F09612435F84B5345B0C1EC7A3"><enum>(A)</enum><text display-inline="yes-display-inline">municipal solid waste;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C06345448254FED9E59C057A5B99C4D"><enum>(B)</enum><text display-inline="yes-display-inline">wood contaminated with plastics or metals;
				or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E31DFC9C07F4DD7BA7E5C1840792A87"><enum>(C)</enum><text display-inline="yes-display-inline">tires.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcea26cd32eee4276a9b725f37dc1748c"><enum>(b)</enum><header display-inline="yes-display-inline">Renewable energy requirement</header><text display-inline="yes-display-inline">Of the base quantity of electricity sold by
				each retail electric supplier to electric consumers during a calendar year, the
				quantity generated by renewable energy sources shall be not less than the
				following percentages:</text>

				program</header><text display-inline="yes-display-inline">Not later than 1 year
				after the date of enactment of this title, the Administrator shall
				establish—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id9002560FD3A44DD591EA85A8F757B47C"><enum>(1)</enum><text display-inline="yes-display-inline">a program to issue, establish the value of,
				monitor the sale or exchange of, and track renewable energy credits; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F6EA5747156486888AC58FE7A8CA87A"><enum>(2)</enum><text display-inline="yes-display-inline">penalties for any retail electric supplier
				that does not comply with this section.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID410854136267498097EB1C9AE08544D9"><enum>(d)</enum><header display-inline="yes-display-inline">Prohibition on double
				counting</header><text display-inline="yes-display-inline">A renewable energy
				credit issued under subsection (c)—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id093C65DA3C454B4682B273A359650543"><enum>(1)</enum><text display-inline="yes-display-inline">may be counted toward meeting the
				requirements of subsection (b) only once; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ECF994978B34C89BD26E773D4648DA8"><enum>(2)</enum><text display-inline="yes-display-inline">shall vest with the owner of the system or
				facility that generates the renewable energy that is covered by the renewable
				energy credit, unless the owner explicitly transfers the renewable energy
				credit.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID19E1C9C7AA364BFE9978FAB8E2A8BA27"><enum>(e)</enum><header display-inline="yes-display-inline">Sale under PURPA contract</header><text display-inline="yes-display-inline">If the Administrator, after consultation
				with the Secretary of Energy, determines that a renewable energy generator is
				selling electricity to comply with this section to a retail electric supplier
				under a contract subject to section 210 of the Public Utilities Regulatory
				Policies Act of 1978 (16 U.S.C. 824a–3), the retail electric supplier shall be
				treated as the generator of the electric energy for the purposes of this title
				for the duration of the contract.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6C0C45213A73487DAD66D1D3958F7A65"><enum>(f)</enum><header display-inline="yes-display-inline">State
				programs</header><text display-inline="yes-display-inline">Nothing in this
				section precludes any State from requiring additional renewable energy
				generation under any State renewable energy program.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9BA758BCAEB3470284558D3139E5018B"><enum>(g)</enum><header display-inline="yes-display-inline">Voluntary participation</header><text display-inline="yes-display-inline">The Administrator may issue a renewable
				energy credit pursuant to subsection (c) to any entity that is not subject to
				this section only if the entity applying for the renewable energy credit meets
				the terms and conditions of this section to the same extent as retail electric
				suppliers subject to this section.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id569328AE7F37466EA0CED9D1BC2132BF" section-type="subsequent-section"><enum>716.</enum><header display-inline="yes-display-inline">Standards to account for biological
				sequestration of carbon</header>
							<subsection commented="no" display-inline="no-display-inline" id="idAF2B6EC9DB5E4D30BB3A3DF7D1FED2E6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of title, the Secretary of Agriculture, with the concurrence of the
				Administrator, shall establish standards for accrediting certified reductions
				in the emission of carbon dioxide through above-ground and below-ground
				biological sequestration activities.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idD1F06BF4FD954ECAA8293897DF9DCDE3"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The standards shall include—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID6b008a2a83d3499c933bc97ebe8a4f20"><enum>(1)</enum><text display-inline="yes-display-inline">a national biological carbon storage
				baseline or inventory; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7d2627bb979b4866a7e4efa73c4fdc28"><enum>(2)</enum><text display-inline="yes-display-inline">measurement, monitoring, and verification
				guidelines based on—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDbe8d3ff44ee74b49b135140fd1eb7f9d"><enum>(A)</enum><text display-inline="yes-display-inline">measurement of increases in carbon storage
				in excess of the carbon storage that would have occurred in the absence of a
				new management practice designed to achieve biological sequestration of
				carbon;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa3707a65a6e440fa80eeced527d1bd62"><enum>(B)</enum><text display-inline="yes-display-inline">comprehensive carbon accounting
				that—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID5f78a51908e4431182d2c31cabec9818"><enum>(i)</enum><text display-inline="yes-display-inline">reflects sustained net increases in carbon
				reservoirs; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID7fb15290277d49359afcf83d92d41c7f"><enum>(ii)</enum><text display-inline="yes-display-inline">takes into account any carbon emissions
				resulting from disturbance of carbon reservoirs in existence as of the date of
				commencement of any new management practice designed to achieve biological
				sequestration of carbon;</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1112d1b0c07742908277f2d7254e3c32"><enum>(C)</enum><text display-inline="yes-display-inline">adjustments to account for—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDf5afb1a2286548348f5225ba24c993ae"><enum>(i)</enum><text display-inline="yes-display-inline">emissions of carbon that may result at
				other locations as a result of the impact of the new biological sequestration
				management practice on timber supplies; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID52ccc2ed98ea49aa96f7e9e9485e6d7e"><enum>(ii)</enum><text display-inline="yes-display-inline">potential displacement of carbon emissions
				to other land owned by the entity that carries out the new biological
				sequestration management practice; and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd25cf67543bd4e3d899e359f72af016c"><enum>(D)</enum><text display-inline="yes-display-inline">adjustments to reflect the expected carbon
				storage over various time periods, taking into account the likely duration of
				the storage of carbon in a biological reservoir.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE62BEA8711244061AA6DE7C024275372"><enum>(c)</enum><header display-inline="yes-display-inline">Updating of standards</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				establishment of the standards under subsection (a), and every 3 years
				thereafter, the Secretary of Agriculture shall update the standards to take
				into consideration the most recent scientific information.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="ID4064350240364DF3000061E47C49C744" section-type="subsequent-section"><enum>717.</enum><header display-inline="yes-display-inline">Effect of failure to promulgate
				regulations</header><text display-inline="no-display-inline">If the
				Administrator fails to promulgate regulations to implement and enforce the
				limitations specified in section 705—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID782095DD4F6E4A568E968FF73FB581F0"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID3F67A33632DE4885BD449EF462E81C54"><enum>(A)</enum><text display-inline="yes-display-inline">each electric generation facility shall
				achieve, not later than January 1, 2010, an annual quantity of emissions that
				is less than or equal to—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDE197F2FB780E4207AB0089D5A7999900" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of nitrogen oxides, 15 percent
				of the annual emissions by a similar electric generation facility that has no
				controls for emissions of nitrogen oxides; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID6BFAAADFB20C4A79A500F711BA51321F" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of global warming pollutants,
				75 percent of the annual emissions by a similar electric generation facility
				that has no controls for emissions of global warming pollutants; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID700E2E2A25A04997AA23AA8710486DD9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">each electric generation facility that does
				not use natural gas as the primary combustion fuel shall achieve, not later
				than January 1, 2010, an annual quantity of emissions that is less than or
				equal to—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID434A225ED2FF4847A8B6FD80D01D4623"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of sulfur dioxide, 5 percent of
				the annual emissions by a similar electric generation facility that has no
				controls for emissions of sulfur dioxide; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID7186DCE6F50F47E98F54DFA47EB34118"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of mercury, 10 percent of the
				annual emissions by a similar electric generation facility that has no controls
				included specifically for the purpose of controlling emissions of mercury;
				and</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3A8090B1815B4CC9A5D2692F518C9743"><enum>(2)</enum><text display-inline="yes-display-inline">the applicable permit under this Act for
				each electric generation facility shall be deemed to incorporate a requirement
				for achievement of the reduced levels of emissions specified in paragraph
				(1).</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID9D3C93279F8A4464A61B8753E1004FF1" section-type="subsequent-section"><enum>718.</enum><header display-inline="yes-display-inline">Prohibitions</header><text display-inline="no-display-inline">It shall be unlawful—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID582CB49EEF1C4D5E9B339DCEFF1400F6"><enum>(1)</enum><text display-inline="yes-display-inline">for the owner or operator of any electric
				generation facility—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID38C59380CBF441F6910064ABF6B59F93"><enum>(A)</enum><text display-inline="yes-display-inline">to operate the electric generation facility
				in noncompliance with the requirements of this title (including any regulations
				implementing this title);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID936E456991D5427D8D50324BBBB5354D"><enum>(B)</enum><text display-inline="yes-display-inline">to fail to submit by the required date any
				emission allowances, or pay any penalty, for which the owner or operator is
				liable under section 706;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0E8382823C5C479489AD0444C4309CB0"><enum>(C)</enum><text display-inline="yes-display-inline">to fail to provide and comply with any plan
				to offset excess emissions required under section 706(f); or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD9B604659F08466693C41C8639301D00"><enum>(D)</enum><text display-inline="yes-display-inline">to emit mercury in excess of the emission
				limitations established under section 709; or</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD655AE57B9194BAF84C3EB8CB1783300"><enum>(2)</enum><text display-inline="yes-display-inline">for any person to hold, use, or transfer
				any emission allowance allocated under this title except in accordance with
				regulations promulgated by the Administrator.</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID319B665901A348799CABF5A14BDEB810" section-type="subsequent-section"><enum>719.</enum><header display-inline="yes-display-inline">Modernization of electric generation
				facilities</header>
							<subsection commented="no" display-inline="no-display-inline" id="IDD1451F6AB34D4E819E00682D5DAD7C56"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the later of January 1, 2015,
				or the date that is 40 years after the date on which the electric generation
				facility commences operation, each electric generation facility shall be
				subject to emission limitations reflecting the application of best available
				control technology on a new major source of a similar size and type (as
				determined by the Administrator) as determined in accordance with the
				procedures specified in part C of title I.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1636F71090D0405395D19D6C705CFE8C"><enum>(b)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">The requirements of this section shall be
				in addition to the other requirements of this title.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id3C3D0E942CD84BF1B8B017B84F3B1721" section-type="subsequent-section"><enum>720.</enum><header display-inline="yes-display-inline">Paramount interest waiver</header>
							<subsection commented="no" display-inline="no-display-inline" id="id006F8E65C7B7436DAFB651D2144AF170"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the President determines that a national
				security emergency exists and, in light of information that was not available
				as of the date of enactment of this title, that it is in the paramount interest
				of the United States to modify any requirement under this title to minimize the
				effects of the emergency, the President, after opportunity for notice and
				public comment, may temporarily adjust, suspend, or waive any regulation
				promulgated pursuant to this title to achieve that minimization.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id77092BFB2BDD41CDA13B72A3B7D4FDB7"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In making an emergency determination under
				subsection (a), the President, to the maximum extent practicable, shall consult
				with and take into consideration any advice received from—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id33FC6E2186004F2B9FF94DE520B19FF4"><enum>(1)</enum><text display-inline="yes-display-inline">the Academy;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA499B04A2FDD4EA9946472FB3CB9738C"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0334567B08B411AA2C64E3C0A5218FD"><enum>(3)</enum><text display-inline="yes-display-inline">the Administrator.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3A73075A6FF44ABBBD8B85219290FFC8"><enum>(c)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">An emergency determination under subsection
				(a) shall be subject to judicial review under section 307.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id1C5551391D1A44E5BCAFBE849603DD2C" section-type="subsequent-section"><enum>721.</enum><header display-inline="yes-display-inline">Relationship to other law</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID7136FB86957A409490385C2E00FB1FC5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as expressly provided in this title,
				nothing in this title—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDAB86B90F92BE403CBA07DA2E0012B16B"><enum>(1)</enum><text display-inline="yes-display-inline">limits or otherwise affects the application
				of any other provision of this Act; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D5D90D008884195B588AF0054FCE831"><enum>(2)</enum><text display-inline="yes-display-inline">precludes a State from adopting and
				enforcing any requirement for the control of emissions of air pollutants that
				is more stringent than the requirements imposed under this title.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC8D83C2AA3CA4BF0B600EAB5DFD77F74"><enum>(b)</enum><header display-inline="yes-display-inline">Regional seasonal emission
				controls</header><text display-inline="yes-display-inline">Nothing in this
				title affects any regional seasonal emission control for nitrogen oxides
				established by the Administrator or a State under title
				I.</text>
							</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID419ED78A91324BE0A6C6DF73E6AE2985"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="CAA/412(a)">Section 412(a)</external-xref> of the

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID469E2387A60D4BEDA8A82EC8DF0895C1"><enum>(II)</enum><text display-inline="yes-display-inline">changes in the number of water bodies in
				the sensitive ecosystems referred to in subparagraph (G)(ii) with an
				acid-neutralizing capacity greater than zero;
				and</text>
						</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID541EDDEF3E3F4C9097BA8D441700CCA9"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID88A4A2F2642A451781656D5CD73B767E" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDAF018C37009947959FC345016B1957A1"><enum>(G)</enum><header display-inline="yes-display-inline">Sensitive ecosystems</header>
							<clause commented="no" display-inline="no-display-inline" id="ID8B13F26AF0EE45FF9B9CF2346D8C701B"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning in 2008, and every 4 years
				thereafter, the report under subparagraph (E) shall include—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID7DC10D07DFD84A34B360A0B01E98743E"><enum>(I)</enum><text display-inline="yes-display-inline">an identification of environmental
				objectives necessary to be achieved (and related indicators to be used in
				measuring achievement of the objectives) to adequately protect and restore
				sensitive ecosystems; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDBF8A9AE79635458C8229003BC18CCF61"><enum>(II)</enum><text display-inline="yes-display-inline">an assessment of the status and trends of
				the environmental objectives and indicators identified in preceding reports
				under this paragraph.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID54095D2409AA4F4093BEF637B924EB2F"><enum>(ii)</enum><header display-inline="yes-display-inline">Sensitive ecosystems to be
				addressed</header><text display-inline="yes-display-inline">Sensitive
				ecosystems to be addressed under clause (i) include—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID10BABC3CA5F947A3A9B819C7972699EA"><enum>(I)</enum><text display-inline="yes-display-inline">the Adirondack Mountains, mid-Appalachian
				Mountains, Rocky Mountains, and southern Blue Ridge Mountains;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDA22D8ABCA6AB463E82D127ECCF1E4B00"><enum>(II)</enum><text display-inline="yes-display-inline">the Great Lakes, Lake Champlain, Long
				Island Sound, and the Chesapeake Bay; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID102CD16DE0FF44ED812C2EDD2EDFAD10"><enum>(III)</enum><text display-inline="yes-display-inline">other sensitive ecosystems, as determined
				by the Administrator.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID70AB4E16BFB7472490A4206898AB248B"><enum>(H)</enum><header display-inline="yes-display-inline">Acid deposition standards</header><text display-inline="yes-display-inline">Beginning in 2008, and every 4 years
				thereafter, the report under subparagraph (E) shall include a revision of the
				report under section 404 of
				<external-xref legal-doc="public-law" parsable-cite="pl/101/549">Public Law
				101–549</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/7651 note">42 U.S.C. 7651 note</external-xref>) that
				includes a reassessment of the health and chemistry of the lakes and streams
				that were subjects of the original report under that
				section.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3751ED0447B14D749C3B00A1EE7686D0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="IDABC2816B6580409B844C51D97233A472" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID1C44608506F0419EBEDD9C7700EAB184"><enum>(4)</enum><header display-inline="yes-display-inline">Protection of sensitive ecosystems</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDDCA4502516D94B40A3A5DC7D58D048F1"><enum>(A)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">Not later than December 31, 2014, the
				Administrator, taking into consideration the findings and recommendations of
				the report revisions under paragraph (3)(H), shall determine whether emission
				reductions under titles IV and VII are sufficient to—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDCAD14E33A4F24B8E93CE2E646B15AB99"><enum>(i)</enum><text display-inline="yes-display-inline">achieve the necessary reductions identified
				under paragraph (3)(F); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6D5582A5F60744A98C42C09F1BBB90B3"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure achievement of the environmental
				objectives identified under paragraph (3)(G).</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5A0554C011DC4B3293BEEEC3D9F676E6"><enum>(B)</enum><header display-inline="yes-display-inline">Regulations</header>
							<clause commented="no" display-inline="no-display-inline" id="IDF063707E0631422F9DA5F42B6B89D08D"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the
				Administrator makes a determination under subparagraph (A) that emission
				reductions are not sufficient, the Administrator shall promulgate regulations
				to protect the sensitive ecosystems referred to in paragraph (3)(G)(ii).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6EDAEEECA3384381A52D9BBE18001019"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Regulations under clause (i) shall include
				modifications to—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID47B4E505E7044EB18282C5854425B3DF"><enum>(I)</enum><text display-inline="yes-display-inline">provisions relating to nitrogen oxide and
				sulfur dioxide emission reductions;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID363A059CF2FF4D62BD3CAF1826E21502"><enum>(II)</enum><text display-inline="yes-display-inline">provisions relating to allocations of
				nitrogen oxide and sulfur dioxide allowances; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID212D9E0A77EC41119C07C58442A3B162"><enum>(III)</enum><text display-inline="yes-display-inline">such other provisions as the Administrator
				determines to be
				necessary.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDBF715F565D1849539E799310D9ACA6FD" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Authorization of appropriations for
			 deposition monitoring</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID0566DF6B37AA4E7B87819F3122015352"><enum>(a)</enum><header display-inline="yes-display-inline">Operational support</header><text display-inline="yes-display-inline">In addition to amounts made available under
			 any other law, there are authorized to be appropriated for each of fiscal years
			 2008 through 2017—</text>

			 Survey;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7B2C5EB262AC452585B118A9B786915E"><enum>(B)</enum><text display-inline="yes-display-inline">$600,000 to the Environmental Protection
			 Agency;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBAC0DBFFE2A340D1BCC2815CE3E6C66F"><enum>(C)</enum><text display-inline="yes-display-inline">$600,000 to the National Park Service;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID05141B3D4E034EF182B9F5602EE8C38B"><enum>(D)</enum><text display-inline="yes-display-inline">$400,000 to the Forest Service;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDA4A684B331A4016B4F36DC7DABB6486"><enum>(2)</enum><text display-inline="yes-display-inline">for operational support of the National
			 Atmospheric Deposition Program Mercury Deposition Network—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5696A9997B594BEC9831E309E50010B6"><enum>(A)</enum><text display-inline="yes-display-inline">$400,000 to the Environmental Protection
			 Agency;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID01AB4BCCF8224870AB2C385733BB8DFF"><enum>(D)</enum><text display-inline="yes-display-inline">$100,000 to the National Park
			 Service;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID74E4FBEF1CA942C9A900BCF9F9548EB9"><enum>(3)</enum><text display-inline="yes-display-inline">for the National Atmospheric Deposition
			 Program Atmospheric Integrated Research Monitoring Network $1,500,000 to the
			 National Oceanic and Atmospheric Administration;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID764A3DB21FE740F3BB84D02E95DAB54C"><enum>(4)</enum><text display-inline="yes-display-inline">for the Clean Air Status and Trends Network
			 $5,000,000 to the Environmental Protection Agency; and</text>

			 pollution) (<external-xref legal-doc="usc" parsable-cite="usc/42/7641">42
			 U.S.C. 7641</external-xref> et seq.)—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID4BC331E21F644A3A84FDA1A628471387"><enum>(1)</enum><text display-inline="yes-display-inline">is amended by redesignating sections 401
			 through 403 as sections 801 through 803, respectively; and</text>
