		<official-title>To provide liability protection to volunteer pilot
		  nonprofit organizations that fly for public benefit and to the pilots and staff
		  of such nonprofit organizations, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H68E356F1F834425EA162A2F9D97F405" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Volunteer Pilot Organization
			 Protection Act of 2007</short-title></quote>.</text>
		</section><section id="H6E914542B43D41C3B8724B042DE6532"><enum>2.</enum><header>Findings and
			 purpose</header>
			<subsection id="H6E7A5B7ABD024A2CAA956F24DFE3F483"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="H5591390791924C2288276C34A1E2AEBF"><enum>(1)</enum><text>Many volunteer
			 pilot nonprofit organizations fly for public benefit and provide valuable
			 services to communities and individuals.</text>
				</paragraph><paragraph id="HBEBA7634BC914A8AABF3AF7668E6A8D7"><enum>(2)</enum><text>In calendar year
			 2006, volunteer pilot nonprofit organizations provided long-distance, no-cost
			 transportation for more than 58,000 people during times of special need.</text>
				</paragraph><paragraph id="H793FA388D302442E90FD755BAD138E37"><enum>(3)</enum><text>Such nonprofit
			 organizations are no longer able to purchase non-owned aircraft liability
			 insurance to provide liability protection at a reasonable price, and therefore
			 face a highly detrimental liability risk.</text>
				</paragraph><paragraph id="H2C492D2865194E82829D24E12CD9C1F"><enum>(4)</enum><text>Such nonprofit
			 organizations have supported the homeland security of the United States by
			 providing volunteer pilot services during times of national emergency.</text>
				</paragraph></subsection><subsection id="H92E94ED96027488E9956FC7FDB9EA5AD"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to promote the activities of volunteer pilot nonprofit
			 organizations that fly for public benefit and to sustain the availability of
			 the services that such nonprofit organizations provide, including the
			 following:</text>
				<paragraph id="id19C744E047F54AB4BC7E707B4D382948"><enum>(1)</enum><text>Transportation at
			 no cost to financially needy medical patients for medical treatment,
			 evaluation, and diagnosis.</text>
				</paragraph><paragraph id="id35E234F5F91A4A229E6C1233FBEFCECA"><enum>(2)</enum><text>Flights for
			 humanitarian and charitable purposes.</text>
				</paragraph><paragraph id="idE341838D8A6842A6A85BCE5BF21AD878"><enum>(3)</enum><text>Other flights of
			 compassion.</text>
				</paragraph></subsection></section><section id="H091BB1E09B5844C4A6070076CCC43966"><enum>3.</enum><header>Liability
			 protection for volunteer pilot nonprofit organizations that fly for public
			 benefit and to pilots and staff of such nonprofit organizations</header><text display-inline="no-display-inline">Section 4 of the Volunteer Protection Act of
			 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14503">42 U.S.C.
			 14503</external-xref>) is amended—</text>
			<paragraph id="H8297CE95BC3F4AEF8B8211F6FA83353F"><enum>(1)</enum><text>in subsection
			 (a)(4)—</text>
				<subparagraph id="H6DB5F1394FD345759920A1FD47162EA2"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text>
				</subparagraph><subparagraph id="H0FD003D525E64FF2A379B79215AEF8F1"><enum>(B)</enum><text>by striking
			 <quote>the harm</quote> and inserting <quote>(A) except in the case of
			 subparagraph (B), the harm</quote>;</text>
				</subparagraph><subparagraph id="id4399F60540B64DBC849F7727D99AE776"><enum>(C)</enum><text>in subparagraph
			 (A)(ii), as redesignated by this paragraph, by striking the period at the end
			 and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H39293201DB35419BA7E62BD5F4CADDA"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HB7AAD400F9904C9CBECE6F8FBEB64F9F">
						<subparagraph id="H8346897A6F2944CE8B06207F77EC9061" indent="up1"><enum>(B)</enum><text>the volunteer—</text>
							<clause id="id16CE9147CA974760AB008C9EE1ACE07B"><enum>(i)</enum><text>was operating an aircraft in
				furtherance of the purpose of a volunteer pilot nonprofit organization that
				flies for public benefit; and</text>
							</clause><clause id="id754AFD82947C44959F49602B0F7F7FE8"><enum>(ii)</enum><text>was properly licensed and insured
				for the operation of such aircraft.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H2DC6FCE405254E9C91D635F326603F2B"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="HB0C62BD6FE0547D298A84528FFDF3C60"><enum>(A)</enum><text>by striking
			 <quote>Nothing in this section</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id020AA9EA492C48E988566F001E85B8AF" style="OLC">
						<paragraph id="id99B6F3BA4E564493B6FD870069F95DA9"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), nothing in this
				section</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H022ADD1CD7224C96BE1354ABE49CFCD"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H5386A9BBB14843A000ABDAD503ADC5F4">
						<paragraph id="H6AE8743AAAD6432EA4D2D9EC3957E722"><enum>(2)</enum><header>Exception</header><text>A
				volunteer pilot nonprofit organization that flies for public benefit, the
				staff, mission coordinators, officers, and directors (whether volunteer or
				otherwise) of such nonprofit organization, and a referring agency of such
				nonprofit organization shall not be liable for harm caused to any person by a
				volunteer of such nonprofit organization while such volunteer—</text>
							<subparagraph id="idE453759967E24E6589A77A1F822B8FB1"><enum>(A)</enum><text>is operating an
				aircraft in furtherance of the purpose of such nonprofit organization;</text>
							</subparagraph><subparagraph id="id3C2BFCEAAC624ED8BBEDF66B73CCC9A2"><enum>(B)</enum><text>is properly
				licensed for the operation of such aircraft; and</text>
							</subparagraph><subparagraph id="id47B49CF2DF3D4C4399DACF11DB468CEB"><enum>(C)</enum><text>has certified to
				such nonprofit organization that such volunteer has insurance covering the
				volunteer's operation of such
				aircraft.</text>
