			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Alternative Fuel Standard Act of
			 2007</short-title></quote>.</text>
		</section><section id="IDacea209f26934f5e8d899a60a429ee6b"><enum>2.</enum><header>Renewable and
			 alternative fuel program</header><text display-inline="no-display-inline">Section 211(o) of the Clean Air Act (42
			 U.S.C. 7545(o)) is amended—</text>
			<paragraph id="id8512350530E7481087F9D30F7DB130AB"><enum>(1)</enum><text display-inline="yes-display-inline">in the subsection heading, by inserting
			 <quote><header-in-text level="subsection" style="OLC">and
			 alternative</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Renewable</header-in-text></quote>;</text>
			</paragraph><paragraph id="id79A479AB544B42FA91BDB23B1FB10E05"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph id="id2A9DF73AAF8D4459A41C990F7DABABC4"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A), (B),
			 (C), and (D) as subparagraphs (B), (I), (G), and (H), respectively;</text>
				</subparagraph><subparagraph id="idB113600AF0DB46CB9A8CCB889F6E550F"><enum>(B)</enum><text>by moving
			 subparagraph (I) (as redesignated by subparagraph (A)) to the end of the
			 paragraph;</text>
				</subparagraph><subparagraph id="idD8DB932695E04E39961CE148A02054FE"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting before subparagraph (B) (as so
			 redesignated) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id06BA912EA46F4377917CA7A1AC3DE061" style="OLC">
						<subparagraph id="IDbceb40c8d1114d5f949bcea1d07bf51a"><enum>(A)</enum><header>Alternative
				fuel</header>
							<clause id="IDf36ca1eb4b7c46439733a07a96b038a1"><enum>(i)</enum><header>In
				general</header><text>The term <term>alternative fuel</term> means the portion
				of any motor vehicle or nonroad fuel, as measured by volume, that consists
				of—</text>
								<subclause id="idABC43F346BE44CBA80E860A6874EFAF4"><enum>(I)</enum><text>methanol,
				denatured ethanol, butanol, and other alcohols;</text>
								</subclause><subclause id="id0A102E21355B4436BC0F52AC46F94A3E"><enum>(II)</enum><text>natural gas,
				including liquid fuels domestically produced from natural gas;</text>
								</subclause><subclause id="idD42014AE25C44EAF8DE5FE1387D45783"><enum>(III)</enum><text>liquefied
				petroleum gas;</text>
								</subclause><subclause id="id837C2E523C2C4720939178393918AAE2"><enum>(IV)</enum><text>hydrogen;</text>
								</subclause><subclause id="id00874DDA1DDD443298776226792E94F6"><enum>(V)</enum><text>coal-derived
				liquid fuels;</text>
								</subclause><subclause id="idAFDB6AA60D5C4ED7B8D152B28D061848"><enum>(VI)</enum><text>fuels (not
				including a fuel that consists of alcohol) derived from biological materials
				(including biodiesel);</text>
								</subclause><subclause id="id524AE507002B4EF5B4FA3938D7FB2988"><enum>(VII)</enum><text>electricity;
				and</text>
								</subclause><subclause id="idE488EAE367BE4DF289A4932A63234D49"><enum>(VIII)</enum><text>any other fuel
				that the Administrator determines, by rule, is not derived from crude oil and
				would yield energy security benefits or environmental benefits.</text>
								</subclause></clause><clause id="IDece041cb4ddc4c0aaeec5fa2fbb79bee"><enum>(ii)</enum><header>Inclusion</header><text>The
				term <term>alternative fuel</term> includes any portion of a blending component
				that is derived from an alternative
				fuel.</text>
							</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idB9CF9796E79C49038A519663A1F8D393"><enum>(D)</enum><text>in subparagraph
			 (B) (as so redesignated), by striking the second sentence;</text>
				</subparagraph><subparagraph id="idC86201175DC64FC68288C791E5CE060A"><enum>(E)</enum><text>by inserting
			 after subparagraph (B) (as so redesignated) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5997E59C62BC42058E45D52E951B6E5B" style="OLC">
						<subparagraph id="id12AF9DF07F34402F8D0850023690FC88"><enum>(C)</enum><header>Nonroad
				engine</header><text>The term <term>nonroad engine</term> means an internal
				combustion engine (including the fuel system of the internal combustion engine)
				that is not—</text>
							<clause id="id43F2966AC02C40048E91C1A7B5F24B43"><enum>(i)</enum><text>used—</text>
								<subclause id="id1D6D676B9BD844A1B11F9AC3F5576A8A"><enum>(I)</enum><text>to power a motor
				vehicle; or</text>
								</subclause><subclause id="idD5A5C65031714BC0862F889621019DDA"><enum>(II)</enum><text>in a vehicle
				used solely for competition; and</text>
								</subclause></clause><clause id="id1C8BC10C1A3447E5A2A9FBCFEE3EC205"><enum>(ii)</enum><text>subject to
				standards of performance for stationary sources of air pollution.</text>
							</clause></subparagraph><subparagraph id="IDa6a86e1745c543f89f7baeade59bc615"><enum>(D)</enum><header>Nonroad
				fuel</header><text>The term <term>nonroad fuel</term> means fuel required
				for—</text>
							<clause id="id6B974C9D72F4477A8D1F571D09496712"><enum>(i)</enum><text>a
				nonroad engine; or</text>
							</clause><clause id="id919C274DC02A44FE9444686CA9C57F60"><enum>(ii)</enum><text>a nonroad
				vehicle.</text>
							</clause></subparagraph><subparagraph id="id9180C8260F0C4AA084041EB4062C6DF6"><enum>(E)</enum><header>Nonroad
				vehicle</header><text>The term <term>nonroad vehicle</term> means a vehicle or
				a piece of equipment that is—</text>
							<clause id="id512770E8FA14446BAC8EAAADFA213B22"><enum>(i)</enum><text>powered by a
				nonroad engine; and</text>
							</clause><clause id="idCAE42445D8A4455AAF7AC09183668708"><enum>(ii)</enum><text>not a motor
				vehicle or a vehicle used solely for competition.</text>
							</clause></subparagraph><subparagraph id="idA89873F750A8498FA034E1DBCEF6DC91"><enum>(F)</enum><header>Program</header><text>The
				term <term>program</term> means the renewable and alternative fuel program
				established under paragraph (2).</text>
						</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id94EFB0A42EB14020892C03731441981B"><enum>(3)</enum><text>by striking
			 paragraphs (2) and (3) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9F606F226A014E9F983A68B14709B79D" style="OLC">
					<paragraph id="IDb84116d8da0043e188874d53f1ea7c1b"><enum>(2)</enum><header>Program</header>
						<subparagraph id="ID01e5155ed40242a88e07b169b3d2d21f"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall, by regulation, establish an
				alternative fuel program to ensure that motor vehicle and nonroad fuel sold or
				introduced into commerce in the United States (except in territories of the
				United States), on an annual average basis, contains the applicable volume of
				alternative fuel determined in accordance with subparagraph (C).</text>
						</subparagraph><subparagraph id="ID3872fdcbd0f6461a80fa25b6e97d4d7a"><enum>(B)</enum><header>Provisions</header><text>Regulations
				promulgated under subparagraph (A)—</text>
							<clause id="idC4CFAB91484541F6BB5731C958AC6035"><enum>(i)</enum><text>shall—</text>
								<subclause id="ID03fe3bb68da3483383887e04272ca600"><enum>(I)</enum><text>contain
				compliance provisions applicable to refineries, blenders, distributors, and
				importers, as appropriate, to ensure that the requirements of this section are
				met;</text>
								</subclause><subclause id="ID8c7bd7972d244c5a8ac075d6a148a2d7"><enum>(II)</enum><text>establish
				applicable percentages under subparagraph (D);</text>
								</subclause><subclause id="ID6a20b4c2c7b14b1b80dd7d657d1dd47b"><enum>(III)</enum><text>establish
				compliance values for alternative fuels under subparagraph (E);</text>
								</subclause><subclause id="ID2f906eafbc2e4eb6b9f9f29425d748af"><enum>(IV)</enum><text>provide for the
				generation, banking, trading, and use of identification numbers under
				subparagraph (F);</text>
								</subclause><subclause id="IDda2953e0f9e74b14870082b2f4806373"><enum>(V)</enum><text>require the
				taking of any other action that is necessary for the implementation of the
				alternative fuels program, as determined by the Administrator; and</text>
								</subclause><subclause id="idEB25447F185F4ED5912E9F59109AF77F"><enum>(VI)</enum><text>to the maximum
				extent practicable, incorporate the program structure, compliance, calculation
				of applicable volume, registration, recordkeeping, and reporting requirements
				described in regulations promulgated under subparagraph (A) to implement this
				section; and</text>
								</subclause></clause><clause id="ID34362b7a7ba54652a70ab52eb68c208a"><enum>(ii)</enum><text>shall
				not—</text>
								<subclause id="ID4c3acff8b5294eb09458dbb89a9ebeb3"><enum>(I)</enum><text>restrict the
				geographic area in which alternative fuel may be used; or</text>
								</subclause><subclause id="ID69566bc76c344e57a63b4c6bb99a4f6f"><enum>(II)</enum><text>impose any
				per-gallon obligation for the use of alternative fuel.</text>
								</subclause></clause></subparagraph><subparagraph id="ID630f1e8ac977414fbb8bd973dd3b92ee"><enum>(C)</enum><header>Applicable
				volume</header>
							<clause id="ID05cf9a6d7542431cbcf197af446427a3"><enum>(i)</enum><header>Calendar years
				2010 through 2017</header><text>For the purpose of subparagraph (A), the
				applicable volume of alternative fuel for each of calendar years 2010 through
				2017 shall be determined in accordance with the following table:</text>

							</clause><clause id="ID54c2547d8ede4877b55963ffd40816f9"><enum>(ii)</enum><header>Calendar year
				2018 and thereafter</header>
								<subclause id="id1B710E59F4704F2AA38E5CFF348A71AA"><enum>(I)</enum><header>In
				general</header><text>Subject to clauses (iii) and (iv), for the purpose of
				subparagraph (A), the applicable volume for calendar year 2018 and each
				calendar year thereafter shall be determined by the Administrator based on a
				review containing the information described in subclause (II).</text>
								</subclause><subclause id="id609B0ABA05E0412A926C3F64FAC72E69"><enum>(II)</enum><header>Contents of
				review</header><text>The review described in subclause (I) shall contain a
				evaluation of the implementation of the program during calendar years 2010
				through 2016, including an evaluation of—</text>
									<item id="ID43d1a99b8b1a40f59a59290173e96702"><enum>(aa)</enum><text>the impact of
				the use of alternative fuels on—</text>
										<subitem id="id512762EFA7E34E5D9FFB00DB6B323419"><enum>(AA)</enum><text>public
				health;</text>
										</subitem><subitem id="id3B8A182E4DF24C3D9651D53B33F68FB0"><enum>(BB)</enum><text>air
				quality;</text>
										</subitem><subitem id="idFE884997D3E54ACA83A3C944CE118AFD"><enum>(CC)</enum><text>water
				quality;</text>
										</subitem><subitem id="idF564C5DF6A7440A68286F81FFD96AB8C"><enum>(DD)</enum><text>job
				creation;</text>
										</subitem><subitem id="id2EA9222EC1D94A4782F9629BF8EC3A8E"><enum>(EE)</enum><text>rural economic
				development;</text>
										</subitem><subitem id="ID6d5182175fd149b5aa4dfde575d8b9cf"><enum>(FF)</enum><text>the expected
				annual rate of future production of alternative fuels;</text>
										</subitem><subitem id="id7FC8FDDB40F64B53B2E43AB9DEBAA8DC"><enum>(GG)</enum><text>the reduction of
				the use of fuels derived from crude oil in the United States;</text>
										</subitem><subitem id="id55DD3B314AB74D689F0EE687EA116AE5"><enum>(HH)</enum><text>the energy
				security of the United States; and</text>
										</subitem><subitem id="id44D0E62A3E054E65AE8B657BEC5EA8E4"><enum>(II)</enum><text>costs to
				consumers.</text>
										</subitem></item></subclause></clause><clause id="ID90cef236621c45b6913cebfed5deb052"><enum>(iii)</enum><header>Minimum
				quantity derived from cellulosic biomass</header>
								<subclause id="IDe846e5337a624a37b170c8cf349fcb1e"><enum>(I)</enum><header>Calendar years
				2010 through 2012</header><text>For each of calendar years 2010 through
				2012—</text>
									<item id="idEFC7548DE8C948A5B5A4A03BF9706579"><enum>(aa)</enum><text>the compliance
				value for cellulosic ethanol contained in subparagraph (E) shall not apply;
				and</text>
									</item><item id="idEFFBC8A243DB428DA3DB9A8C41460912"><enum>(bb)</enum><text>a
				compliance value of 2.5 shall apply in the same manner as if included on the
				table contained in subparagraph (E).</text>
									</item></subclause><subclause id="ID50292e5979554b288dcda25113a66fb3"><enum>(II)</enum><header>Calendar years
				2013 and thereafter</header><text>For calendar year 2013, and each calendar
				year thereafter, the applicable volume described in clause (ii) shall contain a
				minimum of 250,000,000 gallons that are derived from cellulosic biomass.</text>
								</subclause></clause><clause id="ID9bb785b40f4245a98ef41c3546dc4853"><enum>(iv)</enum><header>Waste-derived
				ethanol credit</header><text>For each of calendar years 2010 through 2012, the
				compliance value for waste-derived ethanol shall—</text>
								<subclause id="id4447C19B645D4B0EA71056A222D38288"><enum>(I)</enum><text>be 2.5;
				and</text>
								</subclause><subclause id="id9AEC46D040554F69931A87483F77AFC0"><enum>(II)</enum><text>apply in the
				same manner as if included in the table in subparagraph (E).</text>
								</subclause></clause><clause id="ID33c45cf8e815420582a1949aba8e02b8"><enum>(v)</enum><header>Minimum
				applicable volume</header><text>For the purpose of subparagraph (A), the
				applicable volume for calendar year 2018 and each calendar year thereafter
				shall, at a minimum, be equal to the product obtained by multiplying—</text>
								<subclause id="ID660da62ebf594c87a0b63508881bc544"><enum>(I)</enum><text>the number of
				gallons of gasoline that the Administrator of the Energy Information
				Administration estimates will be sold or introduced into commerce in the
				calendar year; and</text>
								</subclause><subclause id="ID32252595705949a0b9521ce7ae850356"><enum>(II)</enum><text>the ratio
				that—</text>
									<item id="ID03cd5bdfd3a048f2a0919b2516bf9ec5"><enum>(aa)</enum><text>35,000,000,000
				gallons; bears to</text>
									</item><item id="IDba3958582a8049c5be09ca68015298c5"><enum>(bb)</enum><text>the number of
				gallons of gasoline projected to be sold or introduced into commerce in
				calendar year 2017.</text>
									</item></subclause></clause></subparagraph><subparagraph id="IDaeb76ef26f4b4ecc9a7210406a522fc9"><enum>(D)</enum><header>Applicable
				percentages</header>
							<clause id="ID569930dca3fe47c2b703314a1f45face"><enum>(i)</enum><header>Provision of
				estimate of volumes of gasoline sales</header><text>Not later than October 31,
				2009, and annually thereafter, the Administrator of the Energy Information
				Administration shall provide to the Administrator an estimate relating to the
				volume of gasoline projected by Administrator of the Energy Information
				Administration to be sold or introduced into commerce in the United States
				during the following calendar year.</text>
							</clause><clause id="ID9479a47650af40ffa815a3755ebabfef"><enum>(ii)</enum><header>Determination
				of applicable percentages</header>
								<subclause id="IDa91c1f31a0bb41eda4739ed92d8cdb36"><enum>(I)</enum><header>In
				general</header><text>Not later than November 30, 2009, and annually
				thereafter, based on the estimate provided under clause (i), the Administrator
				shall determine and notify any obligated party, with respect to the following
				calendar year, of the alternative fuel obligation determined by the
				Administrator to ensure that the requirements of subparagraph (C) will be
				met.</text>
								</subclause><subclause id="ID47ead528912a46fb828430a0131dee85"><enum>(II)</enum><header>Required
				elements</header><text>The alternative fuel obligation determined for a
				calendar year under clause (ii) shall—</text>
									<item id="id68FB1FB9EB584A01897490BC71E471F9"><enum>(aa)</enum><text>be
				applicable to refiners, blenders, and importers of gasoline, as
				appropriate;</text>
									</item><item id="idC80B5511E6D04559AD4A28F38AB4ADE0"><enum>(bb)</enum><text>be
				used in motor vehicle or nonroad applications in the United States;</text>
									</item><item id="IDa6ece19f00ef42128b086e6e5deb0234"><enum>(cc)</enum><text>be
				expressed in terms of a volume percentage of gasoline sold or introduced into
				commerce in the United States; and</text>
									</item><item id="IDfeb53fd30d6c4d9b9fc7fd684e52023f"><enum>(dd)</enum><text>subject to
				clause (iii), consist of a single applicable percentage that applies to an
				obligated party who is a refiner, blender, or importer of gasoline used in
				motor vehicle and nonroad applications in the United States.</text>
									</item></subclause></clause><clause id="IDddf27edf4ebd4f1fa2938c81db95b8ae"><enum>(iii)</enum><header>Adjustments</header><text>In
				determining the applicable percentage for a calendar year, the Administrator
				shall make adjustments to prevent the imposition of redundant obligations on
				any individual or entity described in clause (ii).</text>
							</clause></subparagraph><subparagraph id="ID0f335b9b337d4f3bb6ba55a541aafa75"><enum>(E)</enum><header>Compliance
				value</header>
							<clause id="ID95b2e99f0e23420caf440fe51a0e14c0"><enum>(i)</enum><header>Table</header><text>Subject
				to clauses (ii) and (iii), the Administrator shall assign a compliance value
				for each alternative fuel to satisfy the alternative fuel volume under
				subparagraph (C), in accordance with the following table:</text>

				the Administrator</header>
								<subclause id="id364DBB06B82240568183E391429DE90E"><enum>(I)</enum><header>In
				general</header><text>In accordance with the requirements described in
				subclause (II), the Administrator may—</text>
									<item id="IDab9193fa56994170a74289bcb8a207ed"><enum>(aa)</enum><text>add fuel types
				to the table contained in clause (i);</text>
									</item><item id="idFFE243A43C0047C89876CA883DD58BEC"><enum>(bb)</enum><text>revise any fuel
				type and assign a different compliance value to any fuel type described in the
				table contained in clause (i); and</text>
									</item><item id="IDa2b8ab10afc140009ceebcb6ff65a444"><enum>(cc)</enum><text>assign each new
				or revised category or subcategory of an alternative fuel type an appropriate
				compliance value.</text>
									</item></subclause><subclause id="idBA5D44BA8B5C444BA36F88ECD920C6AE"><enum>(II)</enum><header>Use of
				information</header>
									<item id="idE3AE5FCA44B24EF0B7CBEBE814CC8635"><enum>(aa)</enum><header>In
				general</header><text>In carrying out a modification or revision of any fuel
				type or compliance value under subclause (I), the Administrator shall use
				appropriate scientific and technical information relating to the energy content
				of alternative fuels.</text>
									</item><item commented="no" id="id6FC5918217F74611B3FC1ADAABE99A30"><enum>(bb)</enum><header>Requirement
				relating to compliance values</header><text>In carrying out a modification or
				revision of any compliance value under subclause (I), the Administrator may
				revise the compliance value to the extent that the revision is predominantly
				supported by scientific and technical information.</text>
									</item></subclause></clause><clause id="IDf25cc46e74b7406d9ea9033fcbbe0ccd"><enum>(iii)</enum><header>Use of
				compliance value</header><text>The compliance value described in the table
				contained in clause (i) shall be used as a multiplier to determine the extent
				to which each gallon of the alternative fuel would satisfy the alternative fuel
				volume obligation under subparagraph (C).</text>
							</clause></subparagraph><subparagraph id="IDdb9fd9917aac43e9b109c34b87947525"><enum>(F)</enum><header>Generation,
				banking, trading, and use of identification numbers</header>
							<clause id="IDc31e857b410f40ba8e50eefa9dbddf09"><enum>(i)</enum><header>In
				general</header><text>Regulations promulgated under subparagraph (A) shall
				provide that—</text>
								<subclause id="IDee47eec4c6fd44ba8defccf9260ce851"><enum>(I)</enum><text>unique
				identification numbers shall be generated and assigned to each batch or other
				quantifiable unit of production, as determined by the Administrator, of
				alternative fuel by—</text>
									<item id="idFA3F6FA2C8E84DE4A66850FC11776BA9"><enum>(aa)</enum><text>the producer of
				any facility located in the United States; and</text>
									</item><item id="id231C5DBBBE174E44BEDD4758DAE42F80"><enum>(bb)</enum><text>the importer of
				alternative fuel imported into the United States;</text>
									</item></subclause><subclause id="ID17bdc7e3a94c40bf9412870956ba50ca"><enum>(II)</enum><text>identification
				numbers shall be based on the volume of the alternative fuel and the compliance
				values established under subparagraph (E);</text>
								</subclause><subclause id="IDe6251349856f46539b17ebb3fdb2a849"><enum>(III)</enum><text>identification
				numbers may be used to demonstrate compliance with the alternative fuel volume
				obligation under subparagraph (A);</text>
								</subclause><subclause id="ID2171462eaf764716aab336d2719d9e83"><enum>(IV)</enum><text>identification
				numbers may be held by any individual or entity;</text>
								</subclause><subclause id="id82ED1B86F0894B7298E6147C6520C9EE"><enum>(V)</enum><text>identification
				numbers may be transferred by any individual or entity to any other individual
				or entity;</text>
								</subclause><subclause id="ID7e865b54cb10454aa5e3d597830f1027"><enum>(VI)</enum><text>identification
				numbers shall be valid for use in achieving compliance for the calendar year in
				which the numbers are generated, and each calendar year thereafter, regardless
				of the calendar year in which the alternative fuel that the numbers represent
				is used; and</text>
								</subclause><subclause id="ID193fa08b34824394bb03c13f9d55b12d"><enum>(VII)</enum><text>any obligated
				party that is unable to acquire sufficient identification numbers to meet the
				requirements for any calendar year under this section shall be allowed to carry
				forward a deficit on the condition that the obligated party, in the calendar
				year following the calendar year in which the deficit was created, achieves
				compliance with the obligation for—</text>
									<item id="idE417BCEAF238454AB0B5600E8CD51AF5"><enum>(aa)</enum><text>the calendar
				year following the calendar year in which the deficit was created; and</text>
									</item><item id="idE6D25E884EA8487BA853F223E021BB46"><enum>(bb)</enum><text>the calendar
				year in which the deficit was created.</text>
									</item></subclause></clause></subparagraph><subparagraph id="ID1e2cd462f25d44469236c5c0bdaa9507"><enum>(G)</enum><header>Evaluation and
				adjustment of required volumes</header>
							<clause id="ID1c28198826114d8693df7f27b54c6e2b"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall annually evaluate the domestic
				production and import capabilities relating to the required volumes of the
				alternative fuel standard for each year for which there have been specified
				volumes pursuant to clauses (i) and (ii) of subparagraph (C).</text>
							</clause><clause id="id340620DD4C7B43B890B2D2D7026A399F"><enum>(ii)</enum><header>Adjustment of
				volume of alternative fuels</header>
								<subclause id="id109B3CB4887F4D4590E6C6698090AB37"><enum>(I)</enum><header>In
				general</header><text>If any condition affects the production or importation of
				alternative fuel (including drought, environmental degradation, technological
				difficulties, economic infeasibility, national security interests, or any other
				factor may substantially affect the availability of an alternative fuel in a
				quantity necessary to meet the requirements of this section) the Administrator
				may, to account for the impact of the condition, not later than October 31 of
				each calendar year, adjust the applicable volume of any alternative fuel for
				the following calendar year, or any calendar year thereafter, described in the
				table contained in subparagraph (C)(i).</text>
								</subclause><subclause id="idF2420E80AFC94578B1E1766158256DDE"><enum>(II)</enum><header>Corresponding
				adjustment of applicable percentages</header><text>In making an adjustment to
				the applicable volume of an alternative fuel under subclause (I), the
				Administrator shall make a corresponding adjustment to the determination of the
				alternative fuel obligation of an obligated party under subparagraph
				(D).</text>
								</subclause><subclause commented="no" id="IDff1bebf9b359481ba1425f1453b8cb2e"><enum>(III)</enum><header>Termination
				of adjustment</header>
									<item commented="no" id="id983A17F6AB9643978C10D07F6C5A9793"><enum>(aa)</enum><header>In
				general</header><text>Subject to item (bb), an adjustment made by the
				Administrator to the applicable volume of an alternative fuel under subclause
				(I) shall terminate 1 year after the date on which the adjustment is
				made.</text>
									</item><item commented="no" id="id1F66FE45506C4C34BA3D122B188F3681"><enum>(bb)</enum><header>Authority to
				renew adjustment</header><text>The Administrator may renew the adjustment made
				in accordance with subclause (I) not later than October 31 of the calendar year
				preceding the calendar year in which the adjustment made by the Administrator
				to the applicable volume of an alternative fuel under subclause (I) would
				apply.</text>
									</item></subclause></clause></subparagraph><subparagraph id="ID87cdfe76e6b54ae7bf9e3b69dfc15200"><enum>(H)</enum><header>Sale of
				identification numbers</header>
							<clause id="IDeb196ce2dbae45fbb8dceb05a3e5e2e2"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall make available for sale to any
				obligated party additional identification numbers at a price of $1.00 per
				gallon of gasoline equivalent.</text>
							</clause><clause id="id112E33F55F3C4BBAB50B342FDF4DD94A"><enum>(ii)</enum><header>Use of
				identification numbers</header><text>An additional identification number sold
				by the Administrator under clause (i) may be used by an obligated party to
				comply with any alternative fuel obligation requirement under subsection (C)
				relating to the year in which the identification number was purchased.</text>
							</clause><clause id="IDecd247034b6a4baa8c72c58c6b63e5ba"><enum>(iii)</enum><header>Disposition
				of funds</header><text>For each of fiscal years 2010 through 2017, any funds
				generated by the sale of additional identification numbers by the Administrator
				to obligated parties shall be transferred by the Administrator to the Secretary
				of the Treasury and deposited in the Treasury of the United
				States.</text>
							</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id19F25263E52B4E078D24E08DD878EC02"><enum>(4)</enum><text>by striking
			 paragraph (8);</text>
			</paragraph><paragraph id="id1A97CC4C7614431C9E21F268A23CBF99"><enum>(5)</enum><text>by redesignating
			 paragraphs (4) through (7) as paragraphs (3) through (6), respectively;</text>
			</paragraph><paragraph id="id28F39FE71DEC46D39169C6AB7294C8FB"><enum>(6)</enum><text>by redesignating
			 paragraphs (9) and (10) as paragraphs (7) and (8), respectively;</text>
			</paragraph><paragraph id="id6A5FFBDA4E3E40B689572DED1EBACA30"><enum>(7)</enum><text>in paragraph
			 (4)(A)(iii) (as redesignated by paragraph (5)), by striking <quote>paragraph
			 (9)(C)</quote> and inserting <quote>paragraph (7)(C)</quote>;</text>
			</paragraph><paragraph id="id6404F9547FE84ADF9498547241D6CEB5"><enum>(8)</enum><text>by striking
			 paragraph (6) (as redesignated by paragraph (5)) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idE3CEAA6750C44AB99442714652F72134" style="OLC">
					<paragraph commented="no" id="id5F1A536973A141B4AA5FDB76C6E13650"><enum>(6)</enum><header>Waiver</header>
						<subparagraph id="ID5ee2a1c39bd749448456f786b8cbcb8c"><enum>(A)</enum><header>In
				general</header><text>The Administrator may issue a temporary waiver for any
				requirement of paragraph (2) if the Administrator determines that—</text>
							<clause id="IDb8fd827f3efe45d8be24a9010831b24b"><enum>(i)</enum><text>an extreme or
				unusual fuel supply circumstance has affected the United States, or a region of
				the United States, that—</text>
								<subclause id="id6ECA6C03CD384ECF902C87B37C729B43"><enum>(I)</enum><text>prevents the
				distribution of an adequate supply of 1 or more alternative fuels or the
				feedstock used to produce 1 or more alternative fuels; and</text>
								</subclause><subclause id="id40A15BAF8A5840F18C796242CCF09D56"><enum>(II)</enum><text>is of sufficient
				magnitude to prevent compliance by 1 or more obligated parties with the
				applicable volume of any alternative fuel described in the table contained in
				paragraph (2)(C), as determined by the Administrator;</text>
								</subclause></clause><clause id="ID71a253e9ee2c48cd92e714c0fb4c3bf9"><enum>(ii)</enum><text>the extreme or
				unusual fuel supply circumstance will cause a severe increase in the price of 1
				or more alternative fuels or of the feedstock used to produce 1 or more
				alternative fuels; and</text>
							</clause><clause id="idAF9B453CC90C4F53AFBAACF1522A62BD"><enum>(iii)</enum><text>the extreme or
				unusual fuel supply circumstance was caused by—</text>
								<subclause id="id66618FCC181F4264AF6E2ADA34CE9FA6"><enum>(I)</enum><text>a natural
				disaster;</text>
								</subclause><subclause id="id077FF529CBBE44268FF9ABAE36FCFEF1"><enum>(II)</enum><text>an act of
				God;</text>
								</subclause><subclause id="id403C5ED94D004649A60DA6755265147C"><enum>(III)</enum><text>a pipeline or
				refinery equipment failure;</text>
								</subclause><subclause id="id4AD4B5A40AEE45AA89367685FEDB8725"><enum>(IV)</enum><text>the national
				security interests of the United States; or</text>
								</subclause><subclause id="id4E620FA55BEF4140A235009762CC9B03"><enum>(V)</enum><text>a circumstance
				that could not have been reasonably foreseen or prevented, or prepared for by
				prudent planning of a supplier of alternative fuel to the United States.</text>
								</subclause></clause></subparagraph><subparagraph id="IDbc189816c3ad4a848985290ca145a968"><enum>(B)</enum><header>Effect of
				waiver</header><text>A temporary waiver issued by the Administrator under
				subparagraph (A) shall—</text>
							<clause id="ID9202587f4147476687b145ae6d768518"><enum>(i)</enum><text>apply to—</text>
								<subclause id="id573193638BF947D0977447A218A03E8D"><enum>(I)</enum><text>any obligated
				party affected by the extreme or unusual fuel supply circumstance; and</text>
								</subclause><subclause id="idF4D3C817C086453D906569F6044E65E9"><enum>(II)</enum><text>the smallest
				appropriate geographic area, as determined by the Administrator;</text>
								</subclause></clause><clause id="ID6aaf6189a1dc487da41a02cb327b9d53"><enum>(ii)</enum><text>be effective
				for—</text>
								<subclause id="idA63B74157EB24B6FA32988F3ACC3A2E0"><enum>(I)</enum><text>a period that
				begins on the date on which the Administrator issues the temporary waiver under
				subparagraph (A) and ends 20 calendar days after the date on which the
				Administrator issued the temporary waiver; or</text>
								</subclause><subclause id="id040492A95B5E4DC6A864D202AAEBFFEB"><enum>(II)</enum><text>the shortest
				appropriate period of time, as determined by the Administrator;</text>
								</subclause></clause><clause id="ID4fb2c99a48974d1e888bc325d1ef81dc"><enum>(iii)</enum><text>preempt, for
				the duration of the waiver, any State or local laws (including regulations)
				relating to the renewable or alternative content of motor fuel and nonroad fuel
				that are inconsistent with any adjustment of the volume of an alternative fuel
				under paragraph (2)(G)(ii)(I); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID9a5d4219086646acb3efbebea417a495"><enum>(iv)</enum><text>be renewed for 1
				or more additional 20 calendar day periods if the Administrator determines that
				any extreme or unusual fuel supply circumstance on which the initial
				determination was made under subparagraph (A) continues to warrant a waiver
				under that subparagraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id6BE7EB49F5AA4D5A800367FD98531CD7"><enum>(9)</enum><text>in paragraph (7)
			 (as redesignated by paragraph (6))—</text>
				<subparagraph id="id2D594B63D3824C10BF3C40E68761D89D"><enum>(A)</enum><text>in subparagraph
			 (A)(ii)(I), by striking <quote>2008</quote> and inserting <quote>2009</quote>;
			 and</text>
