			 title <enum-in-header>35</enum-in-header>, United States Code</header><text display-inline="no-display-inline">Whenever in this Act a section or other
			 provision is amended or repealed, that amendment or repeal shall be considered
			 to be made to that section or other provision of title 35, United States
			 Code.</text>
		</section><section id="H0C365BA5521440C39D407E6731EB17EE"><enum>3.</enum><header>Right of the
			 first inventor to file</header>
			<subsection id="H32D15C33E71E4A119CB918B80055C06"><enum>(a)</enum><header>Definitions</header><text>Section
			 100 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0DDC2C424A3249D19B457993B80456A9" style="OLC">
					<subsection id="H6C451ACFF4DC492D9BD49CC2F01D7E12"><enum>(f)</enum><text>The term
				<term>inventor</term> means the individual or, if a joint invention, the
				individuals collectively who invented or discovered the subject matter of the
				invention.</text>
					</subsection><subsection id="H15C62D5EFA4D4384BBFAB98FC9A3E163"><enum>(g)</enum><text>The terms
				<term>joint inventor</term> and <term>coinventor</term> mean any 1 of the
				individuals who invented or discovered the subject matter of a joint
				invention.</text>
					</subsection><subsection id="H4B079F48388C4B51A96C00AD59897116"><enum>(h)</enum><text>The
				<term>effective filing date of a claimed invention</term> is—</text>
						<paragraph id="H301A41C70DDC4C81BE9E8EAAB8973FE"><enum>(1)</enum><text>the filing date of
				the patent or the application for patent containing the claim to the invention;
				or</text>
						</paragraph><paragraph id="H0AA5DBDDAB584ACEA46DB208173E35F9"><enum>(2)</enum><text>if the patent or
				application for patent is entitled to a right of priority of any other
				application under section 119, 365(a), or 365(b) or to the benefit of an
				earlier filing date in the United States under section 120, 121, or 365(c), the
				filing date of the earliest such application in which the claimed invention is
				disclosed in the manner provided by the first paragraph of section 112.</text>
						</paragraph></subsection><subsection id="HF22A482A519A4865A96170AB51DBC32B"><enum>(i)</enum><text>The term
				<term>claimed invention</term> means the subject matter defined by a claim in a
				patent or an application for a patent.</text>
					</subsection><subsection id="H8313C6E4905B4C53B3CE837B871CD184"><enum>(j)</enum><text>The term
				<term>joint invention</term> means an invention resulting from the
				collaboration of inventive endeavors of 2 or more persons working toward the
				same end and producing an invention by their collective
				efforts.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3086E9C09A3B4BC9003EBDF5AB7044F4"><enum>(b)</enum><header>Conditions for
			 patentability</header>
				<paragraph id="H67802B064F2C4100AFD27D3FAFF1149D"><enum>(1)</enum><header>In
			 general</header><text>Section 102 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HD9BF0F06514641DD96648897C9BA00B6" style="USC">
						<section id="HED8C2D84B8724FEAA848F2A7003C8837"><enum>102.</enum><header>Conditions for
				patentability; novelty</header>
							<subsection id="H16CAAF4566D64DBF001286126362F191"><enum>(a)</enum><header>Novelty; Prior
				Art</header><text>A patent for a claimed invention may not be obtained
				if—</text>
								<paragraph id="HC61AD671A67F4EFC9C7C8228BA5FA054"><enum>(1)</enum><text>the claimed
				invention was patented, described in a printed publication, or in public use or
				on sale—</text>
									<subparagraph id="HC2F0E8E4B0674CD2B73C6D1635FE33D5"><enum>(A)</enum><text>more than one year
				before the effective filing date of the claimed invention; or</text>
									</subparagraph><subparagraph id="H0A6F423D7527415BA4B686F799BD49C"><enum>(B)</enum><text>one year or less
				before the effective filing date of the claimed invention, other than through
				disclosures made by the inventor or a joint inventor or by others who obtained
				the subject matter disclosed directly or indirectly from the inventor or a
				joint inventor; or</text>
									</subparagraph></paragraph><paragraph id="H9E2E3AE285BB4B408719AE7C50134C00"><enum>(2)</enum><text>the claimed
				invention was described in a patent issued under section 151, or in an
				application for patent published or deemed published under section 122(b), in
				which the patent or application, as the case may be, names another inventor and
				was effectively filed before the effective filing date of the claimed
				invention.</text>
								</paragraph></subsection><subsection id="HF0BDB5E9DFD845949D08413644EBB169"><enum>(b)</enum><header>Exceptions</header>
								<paragraph id="HF7B0236A4CB242A1BF48ADE19EE5AFCF"><enum>(1)</enum><header>Prior Inventor
				Disclosure Exception</header><text>Subject matter that would otherwise qualify
				as prior art under subparagraph (B) of subsection (a)(1) shall not be prior art
				to a claimed invention under that subparagraph if the subject matter had,
				before the applicable date under such subparagraph (B), been publicly disclosed
				by the inventor or a joint inventor or others who obtained the subject matter
				disclosed directly or indirectly from the inventor, joint inventor, or
				applicant.</text>
								</paragraph><paragraph id="H5B880BF6495B4E10A23BEFB257CF5FFE"><enum>(2)</enum><header>Derivation and
				common assignment exceptions</header><text>Subject matter that would otherwise
				qualify as prior art only under subsection (a)(2), after taking into account
				the exception under paragraph (1), shall not be prior art to a claimed
				invention if—</text>
									<subparagraph id="HCE62258B93A34290957534FD90EEF973"><enum>(A)</enum><text>the subject matter
				was obtained directly or indirectly from the inventor or a joint inventor;
				or</text>
									</subparagraph><subparagraph id="HE6290D4EE999484086ADFDABF1003707"><enum>(B)</enum><text>the subject matter
				and the claimed invention, not later than the effective filing date of the
				claimed invention, were owned by the same person or subject to an obligation of
				assignment to the same person.</text>
									</subparagraph></paragraph><paragraph id="HD3F051E7285C4DC787005B678018008E"><enum>(3)</enum><header>Joint research
				agreement exception</header>
									<subparagraph id="H1F17DE616BC049868503549CD005B73E"><enum>(A)</enum><header>In
				general</header><text>Subject matter and a claimed invention shall be deemed to
				have been owned by the same person or subject to an obligation of assignment to
				the same person in applying the provisions of paragraph (2) if—</text>
										<clause id="H9CF693DABA8A490591C81962C6D19723"><enum>(i)</enum><text>the claimed
				invention was made by or on behalf of parties to a joint research agreement
				that was in effect on or before the effective filing date of the claimed
				invention;</text>
										</clause><clause id="HA84035DB060F4EA79C93E004FEFBA32"><enum>(ii)</enum><text>the claimed
				invention was made as a result of activities undertaken within the scope of the
				joint research agreement; and</text>
										</clause><clause id="H6C56392B3B514F8795433F9E9443036F"><enum>(iii)</enum><text>the application
				for patent for the claimed invention discloses or is amended to disclose the
				names of the parties to the joint research agreement.</text>
										</clause></subparagraph><subparagraph id="HC4EE34C7956F414FBB00A06E3B9CC6A9"><enum>(B)</enum><text>For purposes of
				subparagraph (A), the term <quote>joint research agreement</quote> means a
				written contract, grant, or cooperative agreement entered into by two or more
				persons or entities for the performance of experimental, developmental, or
				research work in the field of the claimed invention.</text>
									</subparagraph></paragraph><paragraph id="H21A1FD3FD0C2406DA300E600361E2C9C"><enum>(4)</enum><header>Patents and
				published applications effectively filed</header><text>A patent or application
				for patent is effectively filed under subsection (a)(2) with respect to any
				subject matter described in the patent or application—</text>
									<subparagraph id="HEB1DC6D9BABD4B198377ACD3E0815190"><enum>(A)</enum><text>as of the filing
				date of the patent or the application for patent; or</text>
									</subparagraph><subparagraph id="H8E511F791FB04A349856BB51C607C94C"><enum>(B)</enum><text>if the patent or
				application for patent is entitled to claim a right of priority under section
				119, 365(a), or 365(b) or to claim the benefit of an earlier filing date under
				section 120, 121, or 365(c), based upon one or more prior filed applications
				for patent, as of the filing date of the earliest such application that
				describes the subject
				matter.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF419B3E9463C47E1A02B224CBE375D79"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The item relating to section 102 in the table of
			 sections for chapter 10 is amended to read as follows:</text>

			 patentability; non-obvious subject matter</header><text>Section 103 is amended
			 to read as follows:</text>

					<section id="HF5829FB9783C499AB3DEA89DC617366C"><enum>103.</enum><header>Conditions for
				patentability; nonobvious subject matter</header><text display-inline="no-display-inline">A patent for a claimed invention may not be
				obtained though the claimed invention is not identically disclosed as set forth
				in section 102, if the differences between the claimed invention and the prior
				art are such that the claimed invention as a whole would have been obvious
				before the effective filing date of the claimed invention to a person having
				ordinary skill in the art to which the claimed invention pertains.
				Patentability shall not be negated by the manner in which the invention was
				made.</text>
					</section><after-quoted-block>. </after-quoted-block></quoted-block>
			</subsection><subsection id="H39D89DC4875C4FB5AEA86D068C944E62"><enum>(d)</enum><header>Repeal of
			 requirements for inventions made abroad</header><text>Section 104, and the item
			 relating to that section in the table of sections for chapter 10, are
			 repealed.</text>
			</subsection><subsection id="H3DFDB06940EC4E0EBCF4C987BF634100"><enum>(e)</enum><header>Repeal of
			 statutory invention registration</header>
				<paragraph id="H8F9D76AD86194992BC2D2500381EA209"><enum>(1)</enum><header>In
			 general</header><text>Section 157, and the item relating to that section in the
			 table of sections for chapter 14, are repealed.</text>
				</paragraph><paragraph id="HEF58F734E00D41178FB98EBDEFBF64D9"><enum>(2)</enum><header>Removal of cross
			 references</header><text>Section 111(b)(8) is amended by striking
			 <quote>sections 115, 131, 135, and 157</quote> and inserting <quote>sections
			 131 and 135</quote>.</text>
				</paragraph></subsection><subsection id="H267DA766F7D34B549EAAB26394BC4CBB"><enum>(f)</enum><header>Earlier filing
			 date for inventor and joint inventor</header><text>Section 120 is amended by
			 striking <quote>which is filed by an inventor or inventors named</quote> and
			 inserting <quote>which names an inventor or joint inventor</quote>.</text>
			</subsection><subsection id="HFD0EE2D33F014D17BF774DF6CD710607"><enum>(g)</enum><header>Conforming
			 amendments</header>

				</paragraph><paragraph id="H5CAED7674C5241BE8FDBCF4514BF868B"><enum>(2)</enum><header>Limitation on
			 remedies</header><text>Section 287(c)(4) is amended by striking <quote>the
			 earliest effective filing date of which is prior to</quote> and inserting
			 <quote>which has an effective filing date before</quote>.</text>

				</paragraph><paragraph id="HD12D5B59FE494D2FA9D0E34575D68D23"><enum>(5)</enum><header>Patent issued on
			 international application: effect</header><text>The second sentence of section
			 375(a) is amended by striking <quote>Subject to section 102(e) of this title,
			 such</quote> and inserting <quote>Such</quote>.</text>
				</paragraph><paragraph id="H708EC928D72747FAACD050DABEF2B12C"><enum>(6)</enum><header>Limit on right
			 of priority</header><text>Section 119(a) is amended by striking <quote>; but no
			 patent shall be granted</quote> and all that follows through <quote>one year
			 prior to such filing</quote>.</text>
				</paragraph><paragraph id="H7314C0E88812403EB9EA6F1F829B06C4"><enum>(7)</enum><header>Inventions made
			 with Federal assistance</header><text>Section 202(c) is amended—</text>
					<subparagraph id="H61564C35D51B4D128BEFCB04132119A8"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H490D6142896544DEA62D83D7AFEBF19"><enum>(i)</enum><text>by
			 striking <quote>publication, on sale, or public use,</quote> and all that
			 follows through <quote>obtained in the United States</quote> and inserting
			 <quote>the 1-year period referred to in section 102(a) would end before the end
			 of that 2-year period</quote>; and</text>
						</clause><clause id="H0188F1CC7DAC4D1F96D8D243DC6CB1BE"><enum>(ii)</enum><text>by
			 striking <quote>the statutory</quote> and inserting <quote>that 1-year</quote>;
			 and</text>

			 by striking <quote>any statutory bar date that may occur under this title due

					</subparagraph></paragraph></subsection><subsection id="HAAAA7F9ADF3B4F0CB4EC61DB5907A2DB"><enum>(h)</enum><header>Repeal of
			 interfering patent remedies</header><text>Section 291, and the item relating to
			 that section in the table of sections for chapter 29, are repealed.</text>
			</subsection><subsection commented="no" id="HD26D4AD198A64F11AAEF99AB81164609"><enum>(i)</enum><header>Action for claim
			 to patent on derived invention</header><text>Section 135(a) is amended to read
			 as follows:</text>

					<subsection id="H5044FB3664A84C6E889335A15FAD80CF"><enum>(a)</enum><header>Dispute over
				right to patent</header>
						<paragraph id="H3795D0F6D95F426C91D81B19BF5C699D"><enum>(1)</enum><header>Institution of
				derivation proceeding</header><text>An applicant may request initiation of a
				derivation proceeding to determine the right of the applicant to a patent by
				filing a request which sets forth with particularity the basis for finding that
				an earlier applicant derived the claimed invention from the applicant
				requesting the proceeding and, without authorization, filed an application
				claiming such invention. Any such request may only be made within 12 months
				after the date of first publication of an application containing a claim that
				is the same or is substantially the same as the claimed invention, must be made
				under oath, and must be supported by substantial evidence. Whenever the
				Director determines that patents or applications for patent naming different
				individuals as the inventor interfere with one another because of a dispute
				over the right to patent under section 101, the Director shall institute a
				derivation proceeding for the purpose of determining which applicant is
				entitled to a patent.</text>
						</paragraph><paragraph id="H3B2CE07B68CC45F18840DF1BE17D6C69"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">A proceeding under this subsection may not
				be commenced unless the party requesting the proceeding has filed an
				application that was filed not later than 18 months after the effective filing
				date of the application or patent deemed to interfere with the subsequent
				application or patent.</text>
						</paragraph><paragraph id="H647A2F6B87324B71A83B37EC6BCAF95E"><enum>(3)</enum><header>Determination by
				Patent Trial and Appeal Board</header><text>In any proceeding under this
				subsection, the Patent Trial and Appeal Board—</text>
							<subparagraph id="H756E376016D04E1A9B23B04F1D5B4222"><enum>(A)</enum><text>shall determine
				the question of the right to patent;</text>
							</subparagraph><subparagraph id="H7A7BDF679CA14B128CCB56C297E5BC3B"><enum>(B)</enum><text>in appropriate
				circumstances, may correct the naming of the inventor in any application or
				patent at issue; and</text>
							</subparagraph><subparagraph id="H551D59F5E1194C80BB7507FFAE19E068"><enum>(C)</enum><text>shall issue a
				final decision on the right to patent.</text>
							</subparagraph></paragraph><paragraph id="H76F1CD135E834BD8B2F0CF22C90032E2"><enum>(4)</enum><header>Derivation
				proceeding</header><text>The Board may defer action on a request to initiate a
				derivation proceeding until 3 months after the date on which the Director
				issues a patent to the applicant that filed the earlier application.</text>
						</paragraph><paragraph id="H64A7C33BA57A4B9698D17010DDBD1B4B"><enum>(5)</enum><header>Effect of final
				decision</header><text>The final decision of the Patent Trial and Appeal Board,
				if adverse to the claim of an applicant, shall constitute the final refusal by
				the Patent and Trademark Office on the claims involved. The Director may issue
				a patent to an applicant who is determined by the Patent Trial and Appeal Board
				to have the right to patent. The final decision of the Board, if adverse to a
				patentee, shall, if no appeal or other review of the decision has been or can
				be taken or had, constitute cancellation of the claims involved in the patent,
				and notice of such cancellation shall be endorsed on copies of the patent
				distributed after such cancellation by the Patent and Trademark
				Office.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2E73756741CC4269A2AC7917B09C1084"><enum>(j)</enum><header>Elimination of
			 references to interferences</header><paragraph commented="no" display-inline="yes-display-inline" id="HE7ED31AB0ACA42D9A71F25B8B5F087D"><enum>(1)</enum><text>Sections 6, 41, 134, 141,
			 145, 146, 154, 305, and 314 are each amended by striking <quote>Board of Patent
			 Appeals and Interferences</quote> each place it appears and inserting
			 <quote>Patent Trial and Appeal Board</quote>.</text>
				</paragraph><paragraph id="H2949CF137CBD4E0FABF6F8FB8070BD9F" indent="up1"><enum>(2)</enum><text>Sections 141, 146, and 154 are each
			 amended—</text>
					<subparagraph id="H73083997DA41478390DC2C88C3F47FDE"><enum>(A)</enum><text>by striking <quote>an
			 interference</quote> each place it appears and inserting <quote>a derivation

				statements</header><text>An oath or declaration under subsection (a) shall
				contain statements that—</text>

				was made or was authorized to be made by the affiant or declarant; and</text>
								</paragraph><paragraph id="H310D616499604578BA3D60C249AD7F84"><enum>(2)</enum><text>such individual
				believes himself or herself to be the original inventor or an original joint
				inventor of a claimed invention in the application.</text>
								</paragraph></subsection><subsection id="H39E8BBF936044EBBABAB99C1A6D686EF"><enum>(c)</enum><header>Additional
				requirements</header><text>The Director may specify additional information
				relating to the inventor and the invention that is required to be included in
				an oath or declaration under subsection (a).</text>
							</subsection><subsection id="HF20A72C8E19746F0A156EC6E961F9473"><enum>(d)</enum><header>Substitute
				statement</header>
								<paragraph id="H5EC1E7FE074D48548C88870885C132AC"><enum>(1)</enum><header>In
				general</header><text>In lieu of executing an oath or declaration under
				subsection (a), the applicant for patent may provide a substitute statement
				under the circumstances described in paragraph (2) and such additional
				circumstances that the Director may specify by regulation.</text>

										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HD845E20D321447599223081118E88200"><enum>(B)</enum><text>is under an
				obligation to assign the invention but has refused to make the oath or
				declaration required under subsection (a).</text>
									</subparagraph></paragraph><paragraph id="H22E95F3F56784C65A39BB9936176FBCC"><enum>(3)</enum><header>Contents</header><text>A
				substitute statement under this subsection shall—</text>
									<subparagraph id="H24B1507E3BDA4409A01BCC4BF57F605D"><enum>(A)</enum><text>identify the

							</subsection><subsection id="HF9627A2B4DF248229684135BEE1804F"><enum>(f)</enum><header>Time for
				filing</header><text>A notice of allowance under section 151 may be provided to
				an applicant for patent only if the applicant for patent has filed each
				required oath or declaration under subsection (a) or has filed a substitute
				statement under subsection (d) or recorded an assignment meeting the
				requirements of subsection (e).</text>
							</subsection><subsection id="H2F43C1FA3DD34B83B41DAA73E4FD2309"><enum>(g)</enum><header>Earlier-filed
				application containing required statements or substitute
				statement</header><text>The requirements under this section shall not apply to
				an individual with respect to an application for patent in which the individual
				is named as the inventor or a joint inventor and that claims the benefit under
				section 120 or 365(c) of the filing of an earlier-filed application, if—</text>

				statement meeting the requirements of subsection (d) was filed in the earlier
				filed application with respect to the individual; or</text>

				meeting the requirements of subsection (e) was executed with respect to the
				earlier-filed application by the individual and was recorded in connection with
				the earlier-filed application.</text>
								</paragraph></subsection><subsection id="HB4C21F2614C2401EA06689ABC0F20473"><enum>(h)</enum><header>Supplemental and
				corrected statements; filing additional statements</header>
								<paragraph id="H45B360548C1E462BB1004C002EA012EB"><enum>(1)</enum><header>In
				general</header><text>Any person making a statement required under this section
				may withdraw, replace, or otherwise correct the statement at any time. If a
				change is made in the naming of the inventor requiring the filing of 1 or more
				additional statements under this section, the Director shall establish
				regulations under which such additional statements may be filed.</text>

				factors relevant to the determination of a reasonable royalty under this
				subsection, and the court or the jury, as the case may be, shall consider only

				analysis the economic value properly attributable to the prior art, and other
				features or improvements, whether or not themselves patented, that contribute
				economic value to the infringing product or process.</text>
							</paragraph><paragraph id="HB744E4007B924E46B1ED08A01B8B0EA"><enum>(3)</enum><header>Entire market
				value</header><text display-inline="yes-display-inline">Unless the claimant
				shows that the patent’s specific contribution over the prior art is the
				predominant basis for market demand for an infringing product or process,
				damages may not be based upon the entire market value of that infringing
				product or process.</text>
							</paragraph><paragraph id="HE71BA5129BB44351B9DACD7D2DD6585"><enum>(4)</enum><header>Other
				factors</header><text display-inline="yes-display-inline">In determining
				damages, the court may also consider, or direct the jury to consider, the terms
				of any nonexclusive marketplace licensing of the invention, where appropriate,
				as well as any other relevant factors under applicable
				law.</text>

				grounds for willfulness</header><text>A court may find that an infringer has
				willfully infringed a patent only if the patent owner presents clear and
				convincing evidence that—</text>
								<subparagraph id="H3D3AA2EEFF6B4FA5A5C74E7F579B84C1"><enum>(A)</enum><text>after receiving
				written notice from the patentee—</text>
									<clause id="H8883867342A34F1294A8B9433820BB32"><enum>(i)</enum><text>alleging acts of
				infringement in a manner sufficient to give the infringer an objectively
				reasonable apprehension of suit on such patent, and</text>
									</clause><clause id="H1698C670E1C14A25B50036B91B1670D4"><enum>(ii)</enum><text>identifying with
				particularity each claim of the patent, each product or process that the patent
				owner alleges infringes the patent, and the relationship of such product or
				process to such claim,</text>
									</clause><continuation-text continuation-text-level="subparagraph">the
				infringer, after a reasonable opportunity to investigate, thereafter performed
				one or more of the alleged acts of infringement;</continuation-text></subparagraph><subparagraph id="H53468ACC691D49FABAC91CB0A5DA4242"><enum>(B)</enum><text>the infringer
				intentionally copied the patented invention with knowledge that it was
				patented; or</text>
								</subparagraph><subparagraph id="H96EF9D23546A4231A49FD9FB90E95126"><enum>(C)</enum><text>after having been
				found by a court to have infringed that patent, the infringer engaged in
				conduct that was not colorably different from the conduct previously found to
				have infringed the patent, and which resulted in a separate finding of
				infringement of the same patent.</text>
								</subparagraph></paragraph><paragraph id="H408758F5322A448D8D005F1428B68CAE"><enum>(3)</enum><header>Limitations on
				willfulness</header><subparagraph commented="no" display-inline="yes-display-inline" id="H873A399CEC624AD9A45678CC4E85A090"><enum>(A)</enum><text>A court may not find
				that an infringer has willfully infringed a patent under paragraph (2) for any
				period of time during which the infringer had an informed good faith belief
				that the patent was invalid or unenforceable, or would not be infringed by the
				conduct later shown to constitute infringement of the patent.</text>
								</subparagraph><subparagraph id="H9A12EBC25C2C492C9E8C26431415E04F" indent="up1"><enum>(B)</enum><text>An informed good faith belief within
				the meaning of subparagraph (A) may be established by—</text>
									<clause id="HE6200F3C721243F48112B910953FBD7"><enum>(i)</enum><text>reasonable reliance on advice of
				counsel;</text>
									</clause><clause id="HBEC3C098C50F41A0BD22C51EBB695394"><enum>(ii)</enum><text>evidence that the infringer sought
				to modify its conduct to avoid infringement once it had discovered the patent;
				or</text>

				post-grant review</header><text display-inline="no-display-inline">Subject to
				sections 322, 324, 332, and 333, a person who is not the patent owner may file
				with the Office a petition for cancellation seeking to institute a post-grant
				review proceeding to cancel as unpatentable any claim of a patent on any ground
				that could be raised under paragraph (2) or (3) of section 282(b) (relating to
				invalidity of the patent or any claim). The Director shall establish, by
				regulation, fees to be paid by the person requesting the proceeding, in such
				amounts as the Director determines to be reasonable.</text>
							</section><section id="H023E9811AE6947DFBD6946C749D952F8"><enum>322.</enum><header>Timing and
				bases of petition</header><text display-inline="no-display-inline">A post-grant
				proceeding may be instituted under this chapter pursuant to a cancellation
				petition filed under section 321 only if—</text>
								<paragraph id="H229D8C58700F4782ADC413A1CADC2B00"><enum>(1)</enum><text>the petition is
				filed not later than 12 months after the grant of the patent or issuance of a
				reissue patent, as the case may be;</text>
								</paragraph><paragraph id="H56BE14D156614020A406DD3DAB434326"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4308023BD548415A9151499972E10717"><enum>(A)</enum><text>the petitioner
				establishes a substantial reason to believe that the continued existence of the
				challenged claim in the petition causes or is likely to cause the petitioner
				significant economic harm; or</text>
									</subparagraph><subparagraph id="HEEE9E9386DFD464E00ED0876B3A5394" indent="up1"><enum>(B)</enum><text>the petitioner has received notice
				from the patent holder alleging infringement by the petitioner of the patent;
				or</text>
									</subparagraph></paragraph><paragraph id="H1D99CC79BE2F4AEDB8CC2FF154204E8"><enum>(3)</enum><text display-inline="yes-display-inline">the patent owner consents in writing to the
				proceeding.</text>
								</paragraph></section><section id="HB25B2BED9972408EA776C00043B1A583"><enum>323.</enum><header>Requirements of
				petition</header><text display-inline="no-display-inline">A cancellation
				petition filed under section 321 may be considered only if—</text>
								<paragraph id="HA3F2F42756CD459E9693587787D3E385"><enum>(1)</enum><text>the petition is
				accompanied by payment of the fee established by the Director under section
				321;</text>
								</paragraph><paragraph id="HE1C66A7727FF4273AC61A428F9514BED"><enum>(2)</enum><text>the petition
				identifies the cancellation petitioner; and</text>
								</paragraph><paragraph id="H7736D2223701452A8E20C00A990CA4E"><enum>(3)</enum><text>the petition sets
				forth in writing the basis for the cancellation, identifying each claim
				challenged and providing such information as the Director may require by
				regulation, and includes copies of patents and printed publications that the
				cancellation petitioner relies upon in support of the petition; and</text>
								</paragraph><paragraph id="HBB80D99EEB1F4A92BB31BA5D1F1993AB"><enum>(4)</enum><text display-inline="yes-display-inline">the petitioner provides copies of those
				documents to the patent owner or, if applicable, the designated representative
				of the patent owner.</text>
								</paragraph></section><section id="HDB115DB26D80441ABAEDCC191CD6DF2"><enum>324.</enum><header>Prohibited
				filings</header><text display-inline="no-display-inline">A post-grant review
				proceeding may not be instituted under paragraph (1), (2), or (3) of section
				322 if the petition for cancellation requesting the proceeding identifies the
				same cancellation petitioner and the same patent as a previous petition for
				cancellation filed under the same paragraph of section 322.</text>
							</section><section id="H0F95CB7DDFB949999CE47D9678C78CD4"><enum>325.</enum><header>Submission of
				additional information; showing of sufficient grounds</header><text display-inline="no-display-inline">The cancellation petitioner shall file such
				additional information with respect to the petition as the Director may
				require. The Director may not authorize a post-grant review proceeding to
				commence unless the Director determines that the information presented provides
				sufficient grounds to proceed.</text>
							</section><section id="H52E8C89CE1D643A9A8888888374728F5"><enum>326.</enum><header>Conduct of
				post-grant review proceedings</header>
								<subsection id="H1AAE31705C5145F388DAB5C2C114EA5D"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director
				shall—</text>
									<paragraph id="H738FBE2A327C4900A01F34BCF3C75092"><enum>(1)</enum><text>prescribe
				regulations, in accordance with section 2(b)(2), establishing and governing
				post-grant review proceedings under this chapter and their relationship to
				other proceedings under this title;</text>
									</paragraph><paragraph id="HC91EC753DBA343D7914322C3243FA463"><enum>(2)</enum><text>prescribe
				regulations setting forth the standards for showings of substantial reason to
				believe and significant economic harm under section 322(2) and sufficient
				grounds under section 325;</text>
									</paragraph><paragraph id="H41C1D8D3732648DF9F3D9E2642B61CDE"><enum>(3)</enum><text>prescribe
				regulations establishing procedures for the submission of supplemental
				information after the petition for cancellation is filed; and</text>
									</paragraph><paragraph id="H18CB81813D7C41A8AD72E8968D36AA9"><enum>(4)</enum><text display-inline="yes-display-inline">prescribe regulations setting forth
				procedures for discovery of relevant evidence, including that such discovery
				shall be limited to evidence directly related to factual assertions advanced by
				either party in the proceeding, and the procedures for obtaining such evidence
				shall be consistent with the purpose and nature of the proceeding.</text>
									</paragraph></subsection><subsection id="HB1F519480553409E9BF27CAD64457FB7"><enum>(b)</enum><header>Post-grant
				regulations</header><text>Regulations under subsection (a)(1)—</text>
									<paragraph id="H92239E63C9044626B45663D2E0B824F6"><enum>(1)</enum><text>shall require that
				the final determination in a post-grant proceeding issue not later than one
				year after the date on which the post-grant review proceeding is instituted
				under this chapter, except that, for good cause shown, the Director may extend
				the 1-year period by not more than six months;</text>
									</paragraph><paragraph id="H5A3AB4D3F7BA4CCDBBA3ED4E43389C8C"><enum>(2)</enum><text>shall provide for
				discovery upon order of the Director;</text>
									</paragraph><paragraph id="H0180641C53CA49B5A2618E5892C5CFD1"><enum>(3)</enum><text>shall prescribe
				sanctions for abuse of discovery, abuse of process, or any other improper use
				of the proceeding, such as to harass or to cause unnecessary delay or
				unnecessary increase in the cost of the proceeding;</text>
									</paragraph><paragraph id="H0E677D135A3A42DEBE094D85585030B1"><enum>(4)</enum><text>may provide for
				protective orders governing the exchange and submission of confidential
				information; and</text>
									</paragraph><paragraph id="H9C0D7C0D39554626B4F8357D8315D255"><enum>(5)</enum><text>shall ensure that
				any information submitted by the patent owner in support of any amendment
				entered under section 328 is made available to the public as part of the
				prosecution history of the patent.</text>
									</paragraph></subsection><subsection id="H3600A500D95C4AC9ABCB072E375011EC"><enum>(c)</enum><header>Considerations</header><text>In
				prescribing regulations under this section, the Director shall consider the
				effect on the economy, the integrity of the patent system, and the efficient
				administration of the Office.</text>
								</subsection><subsection commented="no" id="H6053D742144C4D3581F44E4EDFBB12E3"><enum>(d)</enum><header>Conduct of
				proceeding</header><text>The Patent Trial and Appeal Board shall, in accordance
				with section 6(b), conduct each post-grant review proceeding authorized by the
				Director.</text>
								</subsection></section><section id="HDBC40B0B82034387862880F767A12B77"><enum>327.</enum><header>Patent owner
				response</header><text display-inline="no-display-inline">After a post-grant
				proceeding under this chapter has been instituted with respect to a patent, the
				patent owner shall have the right to file, within a time period set by the
				Director, a response to the cancellation petition. The patent owner shall file
				with the response, through affidavits or declarations, any additional factual
				evidence and expert opinions on which the patent owner relies in support of the
				response.</text>
							</section><section id="HCA89E27104274BA1985BC563FF52E4CB"><enum>328.</enum><header>Proof and
				evidentiary standards</header>
								<subsection id="H6109F9DB4EE5464C887E6D91D369147"><enum>(a)</enum><header>In
				general</header><text>The presumption of validity set forth in section 282
				shall not apply in a challenge to any patent claim under this chapter.</text>
								</subsection><subsection id="HC4B176057FEB4D579800BE013DFBF346"><enum>(b)</enum><header>Burden of
				proof</header><text>The party advancing a proposition under this chapter shall
				have the burden of proving that proposition by a preponderance of the
				evidence.</text>
								</subsection></section><section id="H6A6D8200F9EB410C88B5C92F257EEA6"><enum>329.</enum><header>Amendment of the
				patent</header>
								<subsection id="H607E55C0C0BC4CE0B912478FFF0016E4"><enum>(a)</enum><header>In
				general</header><text>In response to a challenge in a petition for
				cancellation, the patent owner may file 1 motion to amend the patent in 1 or
				more of the following ways:</text>
									<paragraph id="HD979F2AC68064C4B9369A07D1B2E454"><enum>(1)</enum><text>Cancel any
				challenged patent claim.</text>
									</paragraph><paragraph id="H3568B7F7E08A4AF9009BBEC3791DF5CC"><enum>(2)</enum><text>For each
				challenged claim, propose a substitute claim.</text>
									</paragraph><paragraph id="H4F28EA8527D84867A29E814EB998007D"><enum>(3)</enum><text>Amend the patent
				drawings or otherwise amend the patent other than the claims.</text>
									</paragraph></subsection><subsection id="H8903202013334080B4C31ACFA046C5F"><enum>(b)</enum><header>Additional
				motions</header><text>Additional motions to amend may be permitted only for
				good cause shown.</text>
								</subsection><subsection id="H647638F4E47D46D6B6D27E9BF7763725"><enum>(c)</enum><header>Scope of
				claims</header><text>An amendment under this section may not enlarge the scope
				of the claims of the patent or introduce new matter.</text>
								</subsection></section><section id="H459AC75F636441D794C33D3133049414"><enum>330.</enum><header>Decision of the
				Board</header><text display-inline="no-display-inline">If the post-grant review
				proceeding is instituted and not dismissed under this chapter, the Patent Trial
				and Appeal Board shall issue a final written decision with respect to the
				patentability of any patent claim challenged and any new claim added under
				section 329.</text>
							</section><section id="HAC78642EA85741979BAE44D3B621817D"><enum>331.</enum><header>Effect of
				decision</header>
								<subsection id="HDDA32955B73C42D79D9C8100BEF0F56D"><enum>(a)</enum><header>In
				general</header><text>If the Patent Trial and Appeal Board issues a final
				decision under section 330 and the time for appeal has expired or any appeal
				proceeding has terminated, the Director shall issue and publish a certificate
				canceling any claim of the patent finally determined to be unpatentable and
				incorporating in the patent by operation of the certificate any new claim
				determined to be patentable.</text>
								</subsection><subsection id="HF333FEE558FC46C2ACE0007BB105EDC3"><enum>(b)</enum><header>New
				claims</header><text>Any new claim held to be patentable and incorporated into
				a patent in a post-grant review proceeding shall have the same effect as that
				specified in section 252 for reissued patents on the right of any person who
				made, purchased, offered to sell, or used within the United States, or imported
				into the United States, anything patented by such new claim, or who made
				substantial preparations therefore, prior to issuance of a certificate under
				subsection (a) of this section.</text>
								</subsection></section><section id="HA1EE9008A0BF4F2295CE402D001D99B1"><enum>332.</enum><header>Relationship to
				other pending proceedings</header><text display-inline="no-display-inline">Notwithstanding subsection 135(a), sections
				251 and 252, and chapter 30, the Director may determine the manner in which any
				reexamination proceeding, reissue proceeding, interference proceeding
				(commenced before the effective date of the Patent Reform Act of 2007),
				derivation proceeding, or post-grant review proceeding, that is pending during
				a post-grant review proceeding, may proceed, including providing for stay,
				transfer, consolidation, or termination of any such proceeding.</text>
							</section><section id="H77DE6C7E9792460C9B4567B4C2EBC800"><enum>333.</enum><header>Effect of
				decisions rendered in civil action on future post-grant review
				proceedings</header><text display-inline="no-display-inline">If a final
				decision has been entered against a party in a civil action arising in whole or
				in part under section 1338 of title 28 establishing that the party has not
				sustained its burden of proving the invalidity of any patent claim—</text>
								<paragraph id="HCAD16D108AEF42A1A9CCFB24C76D9E37"><enum>(1)</enum><text>that party to the
				civil action and the privies of that party may not thereafter request a
				post-grant review proceeding on that patent claim on the basis of any grounds,
				under the provisions of section 311, which that party or the privies of that
				party raised or had actual knowledge of; and</text>
								</paragraph><paragraph id="H6C13CA62D65248869F003D2CC31E966D"><enum>(2)</enum><text>the Director may
				not thereafter maintain a post-grant review proceeding previously requested by
				that party or the privies of that party on the basis of such grounds.</text>
								</paragraph></section><section id="H3CD6A8E8D0F345639D8B100091182850"><enum>334.</enum><header>Effect of final
				decision on future proceedings</header>
								<subsection id="H41246291EA0344B0A85BB4AD19916EDB"><enum>(a)</enum><header>In
				general</header><text>If a final decision under section 330 is favorable to the
				patentability of any original or new claim of the patent challenged by the
				cancellation petitioner, the cancellation petitioner may not thereafter, based
				on any ground which the cancellation petitioner raised during the post-grant
				review proceeding—</text>
									<paragraph id="HB0E335842B7D4FC0A25246C681F07EC4"><enum>(1)</enum><text>request or pursue
				a reexamination of such claim under chapter 31;</text>
									</paragraph><paragraph id="H512D5D41DEF24A2D85EED8745DB98D5D"><enum>(2)</enum><text>request or pursue
				a derivation proceeding with respect to such claim;</text>
									</paragraph><paragraph id="H417FB2A7C59D4EE5B16CAC576851B819"><enum>(3)</enum><text>request or pursue
				a post-grant review proceeding under this chapter with respect to such claim;
				or</text>
									</paragraph><paragraph id="H12E366FEBA6B44248800E02946364D55"><enum>(4)</enum><text>assert the
				invalidity of any such claim, in any civil action arising in whole or in part
				under section 1338 of title 28.</text>
									</paragraph></subsection><subsection id="H51CF5D94C272434DB83735472BD76800"><enum>(b)</enum><header>Extension of
				prohibition</header><text>If the final decision is the result of a petition for
				cancellation filed on the basis of paragraph (2) of section 322, the
				prohibition under this section shall extend to any ground which the
				cancellation petitioner raised during the post-grant review proceeding.</text>
								</subsection></section><section commented="no" id="HB8CB0D4295614430A9C3C494274BE1EB"><enum>335.</enum><header>Appeal</header><text display-inline="no-display-inline">A party dissatisfied with the final
				determination of the Patent Trial and Appeal Board in a post-grant proceeding
				under this chapter may appeal the determination under sections 141 through 144.
				Any party to the post-grant proceeding shall have the right to be a party to
				the
				appeal.</text>
							</section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF07FB381F01C455D907E7B92E6157DC1"><enum>(f)</enum><header>Conforming

			 Act, issue regulations to carry out chapter 32 of title 35, United States Code,

			 take effect on the date that is 1 year after the date of the enactment of this
			 Act and shall apply to patents issued before, on, or after that date, except
			 that, in the case of a patent issued before that date, a petition for
			 cancellation under section 321 of title 35, United States Code, may be filed
			 only if a circumstance described in paragraph (2), (3), or (4) of section 322
			 of title 35, United States Code, applies to the petition.</text>
				</paragraph><paragraph commented="no" id="H9353B5A0A5064CDBBE87DF9E1200511D"><enum>(3)</enum><header>Pending
			 interferences</header><text>The Director shall determine the procedures under
			 which interferences commenced before the effective date under paragraph (2) are
			 to proceed, including whether any such interference is to be dismissed without
			 prejudice to the filing of a cancellation petition for a post-grant opposition
			 proceeding under chapter 32 of title 35, United States Code, or is to proceed
			 as if this Act had not been enacted. The Director shall include such procedures
			 in regulations issued under paragraph (1).</text>
				</paragraph></subsection></section><section id="HA50647DB89294F88A2BAD7C1CE77EC51"><enum>7.</enum><header>Definitions;
			 patent trial and appeal board</header>
			<subsection id="HD14F73EE83184332ABC8EB776C5C49E2"><enum>(a)</enum><header>Definitions</header><text>Section
			 100 (as amended by this Act) is further amended—</text>
				<paragraph id="H5D19786FBD314E52B51C7D43051F9975"><enum>(1)</enum><text>in subsection (e),
			 by striking <quote>or inter partes reexamination under section 311</quote>;
			 and</text>
				</paragraph><paragraph id="H4357E2D8F8BD4EF0B522EB7353D2C9E8"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

			 Appeal board</header><text>Section 6 is amended to read as follows:</text>

					<section id="H73F00DF6C6E3417E8628E8724E00ECE8"><enum>6.</enum><header>Patent Trial and
				Appeal Board</header>
						<subsection id="H442B4819B9F64B2900575CB6A0076C9"><enum>(a)</enum><header>Establishment and
				composition</header><text>There shall be in the Office a Patent Trial and
				Appeal Board. The Director, the Deputy Director, the Commissioner for Patents,
				the Commissioner for Trademarks, and the administrative patent judges shall
				constitute the Patent Trial and Appeal Board. The administrative patent judges
				shall be persons of competent legal knowledge and scientific ability who are
				appointed by the Director. Any reference in any Federal law, Executive order,
				rule, regulation, or delegation of authority, or any document of or pertaining
				to the Board of Patent Appeals and Interferences is deemed to refer to the
				Patent Trial and Appeal Board.</text>
						</subsection><subsection id="H2D6380F113F24FDEA022F0F192A9BD9E"><enum>(b)</enum><header>Duties</header><text>The
				Patent Trial and Appeal Board shall—</text>
							<paragraph id="H7EA47FEDD55F443283A310FE68207120"><enum>(1)</enum><text>on written appeal
				of an applicant, review adverse decisions of examiners upon application for
				patents;</text>
							</paragraph><paragraph id="H4879364541AD427AA8D24CD9EB2682FB"><enum>(2)</enum><text>on written appeal
				of a patent owner, review adverse decisions of examiners upon patents in
				reexamination proceedings under chapter 30; and</text>
							</paragraph><paragraph id="H5CAED78475C54366981926D370808262"><enum>(3)</enum><text>determine priority
				and patentability of invention in derivation proceedings under subsection
				135(a); and</text>
							</paragraph><paragraph id="H462FBAB2BADB492F9EEE6389C6886CC4"><enum>(4)</enum><text>conduct post-grant
				opposition proceedings under chapter 32.</text>
							</paragraph><continuation-text continuation-text-level="subsection">Each
				appeal and derivation proceeding shall be heard by at least 3 members of the
				Patent Trial and Appeal Board, who shall be designated by the Director. Only
				the Patent Trial and Appeal Board may grant rehearings. The Director shall
				assign each post-grant review proceeding to a panel of 3 administrative patent
				judges. Once assigned, each such panel of administrative patent judges shall
				have the responsibilities under chapter 32 in connection with post-grant review
				proceedings.</continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H50F4F56A5791485CBAF1FD2D0000AD32"><enum>8.</enum><header>Study and report
			 on reexamination proceedings</header><text display-inline="no-display-inline">The Under Secretary of Commerce for
			 Intellectual Property and Director of the Patent and Trademark Office shall,
			 not later than 3 years after the date of the enactment of this Act—</text>
			<paragraph id="H091D1F6AEB844D2AB9F11FED505C00FE"><enum>(1)</enum><text>conduct a study of
			 the effectiveness and efficiency of the different forms of proceedings
			 available under title 35, United States Code, for the reexamination of patents;
			 and</text>
			</paragraph><paragraph id="H3F83128A107E4A218EAC4648075FE417"><enum>(2)</enum><text>submit to the
			 Committees on the Judiciary of the House of Representatives and the Senate a
			 report on the results of the study, including any of the Director’s suggestions
			 for amending the law, and any other recommendations the Director has with
			 respect to patent reexamination proceedings.</text>
			</paragraph></section><section id="HFC9C8F0ED4A746139676CC9C57372DFD"><enum>9.</enum><header>Submissions by
			 third parties and other quality enhancements</header>
			<subsection id="H4391D030DBFB4A129F13E1751279FCB"><enum>(a)</enum><header>Publication</header><text>Section
			 122(b)(2) is amended—</text>

				of allowance under section 151 is mailed in the application for patent;
				or</text>

								<clause id="HF263C88C35464930A40148D31BD461A4"><enum>(i)</enum><text>6
				months after the date on which the application for patent is published under

				such fee as the Director may prescribe; and</text>

				by the submitter affirming that the submission was made in compliance with this
				section.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HC0401590E97C4F03B5A9D4A5E1F39558"><enum>10.</enum><header>Venue and
			 jurisdiction</header>
			<subsection id="HF0F7EB83427641079C6B1D9300E0CF45"><enum>(a)</enum><header>Venue for patent
			 cases</header><text>Section 1400 of title 28, United States Code, is amended by
			 striking subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD1A70262813741BC8D654D790163E600" style="OLC">
					<subsection id="HFC78C210F66E4623A7857ED4784B4000"><enum>(b)</enum><text>Any civil action
				arising under any Act of Congress relating to patents, other than an action for
				declaratory judgment or an action seeking review of a decision of the Patent
				Trial and Appeal Board under chapter 13 of title 35, may be brought
				only—</text>
						<paragraph id="H916812843177462F8700005E0086E934"><enum>(1)</enum><text>in the judicial
				district where either party resides; or</text>
						</paragraph><paragraph id="H2581BF2650DA43B8BC4896FC96A6766"><enum>(2)</enum><text>in the judicial
				district where the defendant has committed acts of infringement and has a
				regular and established place of business.</text>
						</paragraph></subsection><subsection id="HB940B5A9F14144E587D87F836CEFFC"><enum>(c)</enum><text>Notwithstanding
				section 1391(c) of this title, for purposes of venue under subsection (b), a
				corporation shall be deemed to reside in the judicial district in which the
				corporation has its principal place of business or in the State in which the
				corporation is
				incorporated.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8C02BE156B2F44BAA7D8B867A532E26"><enum>(b)</enum><header>Interlocutory
			 appeals</header><text>Subsection (c)(2) of section 1292 of title 28, United

				</paragraph></subsection></section><section id="H8F7FC87201FD430DA9A18D077526A32C"><enum>13.</enum><header>Effective date;
			 rule of construction</header>
			<subsection id="H2089E9A166BA4844AA03A74E6FB5D500"><enum>(a)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, the provisions of this Act shall take effect 12 months
			 after the date of the enactment of this Act and shall apply to any patent
			 issued on or after that effective date.</text>
			</subsection><subsection id="HEFCF388C7AE34AE7A20622D30572FD"><enum>(b)</enum><header>Continuity of
			 intent under the Create Act</header><text>The enactment of section 102(b)(3) of
			 title 35, United States Code, under section (3)(b) of this Act is done with the
			 same intent to promote joint research activities that was expressed, including
			 in the legislative history, through the enactment of the Cooperative Research
			 and Technology Enhancement Act of 2004 (Public Law 108–453; the <quote>CREATE
			 Act</quote>), the amendments of which are stricken by section 3(c) of this Act.
			 The United States Patent and Trademark Office shall administer section
			 102(b)(3) of title 35, United States Code, in a manner consistent with the
			 legislative history of the CREATE Act that was relevant to its administration
			 by the Patent and Trademark Office.</text>
