		<section id="idCC4570B5B1094C978B91EB3E7D68DA66" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Suburban and Community Forestry and
			 Open Space Program Act of 2007</short-title></quote>.</text>
		</section><section id="ID9AD40C07C0B04ACFAC6B5DC3F44A83DB"><enum>2.</enum><header>Suburban and
			 Community Forestry and Open Space Program; Forest Legacy Program</header>
			<subsection id="ID779B870D10054DDEA73E00D78C01286A"><enum>(a)</enum><header>Suburban and
			 Community Forestry and Open Space Program</header><text>The Cooperative
			 Forestry Assistance Act of 1978 (16 U.S.C. 2101 et seq.) is amended by adding
			 at the end the following:</text>

					<section id="ID0FC7FC2A4AD14B1CB7DF97D3312C7959"><enum>21.</enum><header>Suburban and
				Community Forestry and Open Space Program</header>
						<subsection id="ID15E715B963C04236823F3E000BCA6C99"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="IDD095340DAE3F48EE8D1A3C7497F0D2AD"><enum>(1)</enum><header>Committee</header><text>The
				term <term>Committee</term> means a State Forest Stewardship Coordinating
				Committee established under section 19(b).</text>
							</paragraph><paragraph id="ID0660DE90A51D4F2D9898046DFD5E6BA8"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means a unit of
				local government or a nonprofit organization that—</text>
								<subparagraph id="ID2867409B0AB841888044C5E3DAF5C93F"><enum>(A)</enum><text>the Secretary
				determines, in accordance with the criteria established under subsection
				(c)(1)(A)(ii)(II) is eligible to receive a grant under subsection (c)(2);
				and</text>
								</subparagraph><subparagraph id="IDC9DEA6CE9ECF49B7BA24692A9B9970E7"><enum>(B)</enum><text>the State
				forester, in consultation with the Committee, determines—</text>
									<clause id="ID4A2D30D5D57D4CFD99FFAC8496327F50"><enum>(i)</enum><text>has the abilities
				necessary to acquire and manage interests in real property; and</text>
									</clause><clause id="IDC716C658BE35455786842D6B06ED72C6"><enum>(ii)</enum><text>has the
				resources necessary to monitor and enforce any terms applicable to the eligible
				project.</text>
									</clause></subparagraph></paragraph><paragraph id="ID3CB16B9265954A598EF1951DB7B04306"><enum>(3)</enum><header>Eligible
				project</header><text>The term <term>eligible project</term> means a fee
				purchase, easement, or donation of land to conserve private forest land
				identified for conservation under subsection (c)(1)(A)(ii)(I).</text>
							</paragraph><paragraph id="ID5E9670D241A040B08285537FA34587ED"><enum>(4)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
				450b).</text>
							</paragraph><paragraph id="ID197F80ABD92D4288BE8A1149BF080716"><enum>(5)</enum><header>Nonprofit
				organization</header><text>The term <term>nonprofit organization</term> means
				any organization that is—</text>
								<subparagraph id="IDB97DF1301194419F9F374C5AE98D07B1"><enum>(A)</enum><text>described in
				section 501(c) of the Internal Revenue Code of 1986; and</text>
								</subparagraph><subparagraph id="ID5B38AC1A70B1466A9947D72EF8F450C2"><enum>(B)</enum><text>exempt from
				taxation under 501(a) of the Internal Revenue Code of 1986.</text>
								</subparagraph></paragraph><paragraph id="IDAAC8854E9B704361AE3EDC48ADC2A366"><enum>(6)</enum><header>Private forest
				land</header><text>The term <term>private forest land</term> means land that
				is—</text>
								<subparagraph id="ID3CEA5E5343604A1A91AECBBBB6520E73"><enum>(A)</enum><text>capable of
				producing commercial forest products; and</text>
								</subparagraph><subparagraph id="ID4A7E3E0160D14793A357E90667BC3565"><enum>(B)</enum><text>owned by—</text>
									<clause id="IDCA9FFBA76C5F4DBB89160C996AD05100"><enum>(i)</enum><text>a
				private entity; or</text>
									</clause><clause id="IDF6475D628379484FA5D3B6C536CEE2F9"><enum>(ii)</enum><text>an Indian
				tribe.</text>
									</clause></subparagraph></paragraph><paragraph id="IDEF1278B4B7984F82B6C7EBD0D10638A0"><enum>(7)</enum><header>Program</header><text>The
				term <term>program</term> means the Suburban and Community Forestry and Open
				Space Program established by subsection (b).</text>
							</paragraph><paragraph id="IDEAD9D4E0561A4044A24F398436DE8B28"><enum>(8)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Agriculture, acting through
				the Chief of the Forest Service.</text>
							</paragraph></subsection><subsection id="ID427F51396E974C6FA3B2721ED7505FB3"><enum>(b)</enum><header>Establishment</header>
							<paragraph id="ID64F2794D06874CDB96C3C4069C05DB75"><enum>(1)</enum><header>In
				general</header><text>There is established within the Forest Service a program
				to be known as the <quote>Suburban and Community Forestry and Open Space
				Program</quote>.</text>
							</paragraph><paragraph id="IDF716A1D40F3141798A06A1DF92B209A5"><enum>(2)</enum><header>Purpose</header><text>The
				purpose of the program is to provide assistance to eligible entities to carry
				out eligible projects in States in which less than 25 percent of the land is
				owned by the United States to—</text>
								<subparagraph id="ID7B0ED2181FC2479F9116AC9723946700"><enum>(A)</enum><text>conserve private
				forest land and maintain working forests in areas threatened by significant
				suburban sprawl or by conversion to nonforest uses;</text>
								</subparagraph><subparagraph id="ID6AC1464CD5244BC8BD3D0383035F8DE7"><enum>(B)</enum><text>provide
				communities a means by which to address significant suburban sprawl; and</text>
								</subparagraph><subparagraph id="ID3B36561471974262BA00C2EB948587D4"><enum>(C)</enum><text>support primary
				and secondary value-added forest products industries and employment in areas
				threatened by—</text>
									<clause id="IDECB27873F701402E9C53708157E84FF1"><enum>(i)</enum><text>significant
				suburban sprawl; or</text>
									</clause><clause id="IDF4A767853B4C4333BD6AD113AF44F860"><enum>(ii)</enum><text>conversion to
				nonforest uses.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID3D156BD806A74A048690D13D1C75179A"><enum>(c)</enum><header>Grant
				Program</header>
							<paragraph id="ID37F2ADC7690648A790BD22EF1EB4300D"><enum>(1)</enum><header>Identification
				of eligible private forest land</header>
								<subparagraph id="ID21F5AF8EDEBC4FE58A7381B853D5ED18"><enum>(A)</enum><header>Criteria</header>
									<clause id="ID29B07121DF4C407EBCE6731930913879"><enum>(i)</enum><header>National
				criteria</header><text>The Secretary shall establish national eligibility
				criteria for the identification of private forest land that may be conserved
				under this section.</text>
									</clause><clause id="IDE1A3DE50DAE146ACBA615D943D1D84ED"><enum>(ii)</enum><header>State
				criteria</header><text>The State forester, in consultation with the Committee,
				shall, based on the criteria established under clause (i), and subject to the
				approval of the Secretary, establish criteria for—</text>
										<subclause id="ID10A180EA2E454E97BE9FE156EB4DCAF9"><enum>(I)</enum><text>the
				identification, subject to subparagraph (B), of private forest land in each
				State that may be conserved under this section; and</text>
										</subclause><subclause id="IDA904EB31CD7F47AB98325119CA49B782"><enum>(II)</enum><text>the
				identification of eligible entities.</text>
										</subclause></clause></subparagraph><subparagraph id="ID80DB36F38E2747AC89E1F89E2A175082"><enum>(B)</enum><header>Conditions for
				eligible private forest land</header><text>Private forest land identified for
				conservation under subparagraph (A)(ii)(I) shall be land that—</text>
									<clause id="ID2FB2B21312FD497B8E0107C1267B2BF9"><enum>(i)</enum><text>is located in a
				State in which less than 25 percent of the land is owned by the United States;
				and</text>
									</clause><clause id="ID26577D44E28F4DDF8EADEDE7C74046B8"><enum>(ii)</enum><text>as determined by
				the State forester, in consultation with the Committee and subject to the
				approval of the Secretary—</text>
										<subclause id="ID79E29B81D50B4C1D9F640BC6641EA66B"><enum>(I)</enum><text>is located in an
				area that is affected, or threatened to be affected, by significant suburban
				sprawl, taking into account housing needs in the area; or</text>
										</subclause><subclause id="IDD185072576794FA38B3762F197C2551F"><enum>(II)</enum><text>is threatened by
				present or future conversion to nonforest use.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="ID95D058426BB64123B3A3893E4956BA32"><enum>(2)</enum><header>Grants</header>
								<subparagraph id="ID1FB7BDB25A0D4AE0ABCEC942C7383E58"><enum>(A)</enum><header>Eligible
				projects</header>
									<clause id="ID7461BD160AFD4D53B755906DDA407532"><enum>(i)</enum><header>In
				general</header><text>In carrying out this section, the Secretary shall award
				competitive grants to eligible entities to carry out eligible projects.</text>
									</clause><clause id="IDDB9EB9253EA14831A6E52F5AC74A2003"><enum>(ii)</enum><header>Public
				access</header><text>Eligible entities are encouraged to provide public access
				to land on which an eligible project is carried out, consistent with State law
				and preexisting access agreements.</text>
									</clause></subparagraph><subparagraph id="IDA5B8A7A51F03442E91E95379EA8C89EB"><enum>(B)</enum><header>Application;
				stewardship plan</header><text>An eligible entity that seeks to receive a grant
				under this section shall submit to the State forester—</text>
									<clause id="ID081F1054D9234A8FBB787E259E759AA0"><enum>(i)</enum><text>at such time and
				in such form as the Secretary shall prescribe, an application for the grant
				(including a description of any private forest land to be conserved using funds
				from the grant and a description of the extent of the threat of conversion to
				nonforest use); and</text>
									</clause><clause id="IDAD5987D6F1A04FC2A5C958E8929A8081"><enum>(ii)</enum><text>a stewardship
				plan that describes—</text>
										<subclause id="IDDE9E38BCA5F54827A7F2030CFBECE6A6"><enum>(I)</enum><text>the manner in
				which any private forest land to be conserved using funds from the grant will
				be managed in accordance with this section;</text>
										</subclause><subclause id="ID0A6C9FF54B674A2CA9D1A22D8DF98369"><enum>(II)</enum><text>the manner in
				which the stewardship plan will be implemented; and</text>
										</subclause><subclause id="ID22B8FE1631414173866C5CDA3281A759"><enum>(III)</enum><text>the public
				benefits, including economic and noneconomic benefits, to be achieved from
				implementation of the stewardship plan.</text>
										</subclause></clause></subparagraph><subparagraph id="IDA80B159051A2443EAA464636BE74782D"><enum>(C)</enum><header>Assessment of
				need</header><text>With respect to an application submitted under subparagraph
				(B), the State forester shall—</text>
									<clause id="IDA32B49334B82499088BF151D18326F2F"><enum>(i)</enum><text>assess the need
				for preserving working suburban forest land and open space and containing
				suburban sprawl in the State, taking into account the housing needs of the area
				in which the eligible project is to be carried out; and</text>
									</clause><clause id="ID0355131BB9924C6A99AD2683F4D2C509"><enum>(ii)</enum><text>submit to the
				Secretary—</text>
										<subclause id="ID9FC09063804C4F5C9FF5D33BD7396FB7"><enum>(I)</enum><text>the application
				submitted under subparagraph (B); and</text>
										</subclause><subclause id="ID34946390F1DA4A2599EB6996ABF3870D"><enum>(II)</enum><text>the assessment
				of need.</text>
										</subclause></clause></subparagraph><subparagraph id="IDB9388D84ED65427F93B5241D8C80F675"><enum>(D)</enum><header>Approval or
				disapproval</header>
									<clause id="ID7FE057FAD9594514880703BFF8358C27"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), as soon as practicable after the
				date on which the Secretary receives an application under subparagraph (C)(ii)
				or a resubmission under subclause (II)(bb)(BB), the Secretary shall—</text>
										<subclause id="ID4BB3FD91B6204671ADB870D232FAAFB3"><enum>(I)</enum><text>review the
				application; and</text>
										</subclause><subclause id="IDA23A6431A0194879BD320876895CD1C3"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="ID1B0EC47A8ED44A9197C3487A33FBD9EE"><enum>(aa)</enum><text>award a grant to the
				applicant; or</text>
											</item><item id="ID9A412C38935249AB80638E96656DBE15" indent="up1"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="ID2A85BC6694AE4A068C2B87388FFAA9F9"><enum>(AA)</enum><text>disapprove the
				application; and</text>
												</subitem><subitem id="ID6D0C42A482D549FB8E088855BFB4260A" indent="up1"><enum>(BB)</enum><text>provide the applicant a statement
				that describes the reasons why the application was disapproved (including a
				deadline by which the applicant may resubmit the application).</text>
												</subitem></item></subclause></clause><clause id="ID43CF6AC485FE46D087AFF5423D63F5E7"><enum>(ii)</enum><header>Considerations;
				priority</header><text>In awarding grants under this section, the Secretary
				shall—</text>
										<subclause id="IDEF8C567F177C4E3392A707AA0040C821"><enum>(I)</enum><text>consider the need
				for the eligible project based on the assessment of need submitted under
				subparagraph (C) and subject to any criteria under paragraph (1); and</text>
										</subclause><subclause id="IDF0A04E1F3F7F40D9A7A7D7A24297ED9C"><enum>(II)</enum><text>give priority to
				applicants that propose to fund eligible projects that promote—</text>
											<item id="ID810E1436CE6945D2B887789A1947CC04"><enum>(aa)</enum><text>the preservation
				of suburban forest land and open space;</text>
											</item><item id="ID9BDEAE605B36457AAD8871B3CEE76E5F"><enum>(bb)</enum><text>the containment
				of suburban sprawl;</text>
											</item><item id="IDF33154E4DA96482883AA9E324AA1A56B"><enum>(cc)</enum><text>the sustainable
				management of private forest land;</text>
											</item><item id="IDC3E56ABBEBF3402588EEEC9BB1E9E5BA"><enum>(dd)</enum><text>community
				involvement in determining the objectives for eligible projects that are funded
				under this section;</text>
											</item><item id="IDA5FBE0A77FC84B65948D09E122A4758C"><enum>(ee)</enum><text>community and
				school education programs and curricula relating to sustainable forestry;
				and</text>
											</item><item id="ID37E19E94304E4A29ABD983C4C3A5FB47"><enum>(ff)</enum><text>primary and
				secondary value-added forest products industries and employment.</text>
											</item></subclause></clause></subparagraph></paragraph><paragraph id="ID3DB6FE9A4B224DBC89AFB4E0C7358616"><enum>(3)</enum><header>Cost
				sharing</header>
								<subparagraph id="IDBACA3C4F55E84961980B13ADE98E94B1"><enum>(A)</enum><header>In
				general</header><text>The amount of a grant awarded under this section to carry
				out an eligible project shall not exceed 50 percent of the total cost of the
				eligible project.</text>
								</subparagraph><subparagraph id="IDA56DA8C264AC46EE9564BD7782D9F53A"><enum>(B)</enum><header>Assurances</header><text>As
				a condition of receipt of a grant under this section, an eligible entity shall
				provide to the Secretary such assurances as the Secretary determines are
				sufficient to demonstrate that the share of the cost of each eligible project
				that is not funded by the grant awarded under this section has been
				secured.</text>
								</subparagraph><subparagraph id="IDDE8CFBF8D89A4765803F4D58CEF59556"><enum>(C)</enum><header>Form</header><text>The
				share of the cost of carrying out any eligible project described in
				subparagraph (A) that is not funded by a grant awarded under this section may
				be provided in cash or in kind (including a donation of land).</text>
								</subparagraph></paragraph></subsection><subsection id="ID1D4D0F0977BF41DBBA15C2F2D6EADAF3"><enum>(d)</enum><header>Use of Grant
				Funds for Purchases of Land or Easements</header>
							<paragraph id="IDBFF3A1A8B44745B39E7595A4B6F5E11C"><enum>(1)</enum><header>Purchases</header>
								<subparagraph id="ID0184EB9FCFB14F0CA7D2D9A9A4ABC0ED"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), funds made
				available, and grants awarded, under this section may be used to purchase
				private forest land or interests in private forest land (including conservation
				easements) only from willing sellers at fair market value.</text>
								</subparagraph><subparagraph id="IDCA7695848DD340248A23E2FCA596A5EC"><enum>(B)</enum><header>Sales at less
				than fair market value</header><text>A sale of private forest land or an
				interest in private forest land at less than fair market value shall be
				permitted only on certification by the landowner that the sale is being entered
				into willingly and without coercion.</text>
								</subparagraph></paragraph><paragraph id="ID7540F6987461466DB750D9C16672482E"><enum>(2)</enum><header>Title</header><text>Title
				to private forest land or an interest in private forest land purchased under
				paragraph (1) may be held, as determined appropriate by the Secretary, in
				consultation with the State, by—</text>
								<subparagraph id="ID6031CF2A33524ADA9EF2247F98B56932"><enum>(A)</enum><text>a State;</text>
								</subparagraph><subparagraph id="IDA47A2CBBD46747D8828A18771EAB743D"><enum>(B)</enum><text>a unit of local
				government; or</text>
								</subparagraph><subparagraph id="IDDC2AAA15441D42BBB69409ABA08E7150"><enum>(C)</enum><text>a nonprofit
				organization.</text>
								</subparagraph></paragraph><paragraph id="ID023A878B1B50421D89386ACB6D6DFC8A"><enum>(3)</enum><header>Termination of
				easement</header>
								<subparagraph id="ID74962F99C28F4CB3A8F377C0CC67185E"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), all right, title,
				and interest of a unit of local government or nonprofit organization in and to
				a conservation easement shall terminate and vest in the State if the State
				determines that—</text>
									<clause id="IDEAF99FD2F3B64CC2A22F49B43F9B45DC"><enum>(i)</enum><text>the unit of local
				government or nonprofit organization is unable or unwilling to enforce the
				terms of the conservation easement; or</text>
									</clause><clause id="ID26A073C9FD014EE49928491991C4BE1A"><enum>(ii)</enum><text>the conservation
				easement has been modified in a way that is inconsistent with the purposes of
				the program.</text>
									</clause></subparagraph><subparagraph id="ID61928A1596274B398A755A67C4ACCAAB"><enum>(B)</enum><header>Conveyance to
				another unit of local government or nonprofit organization</header><text>If the
				State makes a determination under subparagraph (A), the State may convey or
				authorize the unit of local government or nonprofit organization to convey the
				conservation easement to another unit of local government or nonprofit
				organization.</text>
								</subparagraph></paragraph></subsection><subsection id="ID0C99F0A4FF5345B2AF64C200941E2A0A"><enum>(e)</enum><header>Administrative
				Costs</header><text>The State, on approval of the Secretary and subject to any
				regulations promulgated by the Secretary, may use amounts made available under
				subsection (g) to pay the administrative costs of the State relating to the
				program.</text>
						</subsection><subsection id="IDBDD455A498064CB8A1F2A1BD8467CD79"><enum>(f)</enum><header>Report</header><text>The
				Secretary shall submit to Congress a report on the eligible projects carried
				out under this section in accordance with section 8(c) of the
				<act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources
				Planning Act of 1974</act-name> (16 U.S.C. 1606(c)).</text>
						</subsection><subsection id="ID66530F0D50AA48F68A55581ADBD9971A"><enum>(g)</enum><header>Authorization
				of Appropriations</header><text>There are authorized to be appropriated to
				carry out this section—</text>
							<paragraph id="ID61A1BB03F21C4BA9A68E5CD374D4DC04"><enum>(1)</enum><text>$50,000,000 for
				fiscal year 2008; and</text>
							</paragraph><paragraph id="ID279042C501F74105B8DCC4C241AC9143"><enum>(2)</enum><text>such sums as are
				necessary for each fiscal year
				thereafter.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID67C44442DCB9458281472551582C5B79"><enum>(b)</enum><header>Forest Legacy
			 Program</header><text>Section 7 of the Cooperative Forestry Assistance Act of
			 1978 (16 U.S.C. 2103c) is amended—</text>
				<paragraph id="ID6592BFE6C0FC4C918D139A702401E40A"><enum>(1)</enum><text>in subsection
			 (c), by striking the last sentence;</text>
				</paragraph><paragraph id="ID010935B695B84530BF9915897FBFD560"><enum>(2)</enum><text>in subsection
			 (i), by striking <quote>subsection (b)</quote> and inserting <quote>this
			 section</quote>;</text>
				</paragraph><paragraph id="ID514E91AAA85A4953B9A55C44EE6268EB"><enum>(3)</enum><text>in subsection
			 (j)(1), by inserting <quote>(other than by donation)</quote> after
			 <quote>acquired</quote>;</text>
				</paragraph><paragraph id="IDD1B9450CF5784B26B82FA3212B90F586"><enum>(4)</enum><text>in subsection
			 (k)(2), by striking <quote>the United States or its</quote> and inserting
			 <quote>the United States, a State, or other entity, or their</quote>;
			 and</text>
				</paragraph><paragraph id="ID7F4A91C495494C60BEB9A687D14CA2C8"><enum>(5)</enum><text>in subsection
			 (l), by adding at the end the following:</text>

						<paragraph id="IDEC0E1F5FD6F7473EB77A6AAB9FEBC491"><enum>(4)</enum><header>State
				authorization</header>
							<subparagraph id="IDABCFCF4E1E0F4DBC98092CED2EAF9834"><enum>(A)</enum><header>Definition of
				state forester</header><text>The term <term>State forester</term> has the
				meaning given the term in section 4(k).</text>
							</subparagraph><subparagraph id="IDB19A60E1207E48DCBC4D3C3F1AF5BA35"><enum>(B)</enum><header>In
				general</header><text>Notwithstanding subsection (c) and paragraph (2)(B), the
				Secretary shall, on request by a State, authorize the State to allow a
				qualified organization (as defined in section 170(h)(3) of the Internal Revenue
				Code of 1986) and that is organized for at least 1 of the purposes described in
				section 170(h)(4)(A) of that Code, using amounts granted to a State under this
				paragraph, to acquire 1 or more conservation easements to carry out the Forest
				Legacy Program in the State.</text>
							</subparagraph><subparagraph id="IDDB97AC2DC6C64E0E8513635396FF5221"><enum>(C)</enum><header>Eligibility</header><text>To
				be eligible to acquire and manage conservation easements under this paragraph,
				a qualified organization described in subparagraph (B) shall, as determined by
				the Secretary, acting through the State forester, demonstrate the abilities
				necessary to acquire, monitor, and enforce interests in forest land consistent
				with the Forest Legacy Program and the assessment of need for the State.</text>
							</subparagraph><subparagraph id="ID5883BDB067D34750834A72E4E39834CA"><enum>(D)</enum><header>Monitoring and
				enforcement</header>
								<clause id="ID1C28EB05C72740B1A221C031313075BD"><enum>(i)</enum><header>In
				general</header><text>A qualified organization that acquires a conservation
				easement under this paragraph shall be responsible for monitoring and enforcing
				the terms of the conservation easement and any of the costs of the qualified
				organization associated with such monitoring and enforcement.</text>
								</clause><clause id="ID8551B7312CF846F2BA4F04C46BB8E9A5"><enum>(ii)</enum><header>Contingent
				rights</header><text>If a qualified organization that acquires a conservation
				easement under this paragraph fails to enforce the terms of the conservation
				easement, as determined by the State, the State or the Secretary shall have the
				right to enforce the terms of the conservation easement under Federal or State
				law.</text>
								</clause><clause id="ID4B64A4CF7F614E84B3337374C74B41CF"><enum>(iii)</enum><header>Amendments</header><text>Any
				amendments to a conservation easement that materially affect the terms of the
				conservation easement shall be subject to approval by the Secretary or the
				State, as appropriate.</text>
								</clause></subparagraph><subparagraph id="ID5CF91BE523474C63A6A6D2BAF1AB10A0"><enum>(E)</enum><header>Termination of
				easement</header>
								<clause id="ID57CDB53036FE44A49116A91C1231E4B1"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clause (ii), all right, title, and
				interest of a qualified organization described in subparagraph (B) in and to a
				conservation easement shall terminate and vest in the State or a qualified
				designee if the State determines that—</text>
									<subclause id="ID19023DBD4D3F4783A53677318127BBAA"><enum>(I)</enum><text>the qualified
				organization fails to enforce the terms of the conservation easement;</text>
									</subclause><subclause id="IDB886D20A928E4FB88D7C92A72657B522"><enum>(II)</enum><text>the conservation
				easement has been modified in a way that is inconsistent with the purposes of
				the Forest Legacy Program or the assessment of need for the State; or</text>
									</subclause><subclause id="IDEB5C81A33AF94A859F497A82B98320F7"><enum>(III)</enum><text>the
				conservation easement has been conveyed to another person (other than to a
				qualified organization).</text>
									</subclause></clause><clause id="IDCD8C1339EED24FB09FC79D9AEE107537"><enum>(ii)</enum><header>Conveyance to
				another qualified organization</header><text>If the State makes a determination
				under clause (i), the State may convey or authorize the qualified organization
				to convey the conservation easement to another qualified organization.</text>
								</clause></subparagraph><subparagraph id="ID527AE353526F433E8FC39920D7C331FC"><enum>(F)</enum><header>Implementation</header><text>The
				Secretary, acting through the State forester, shall implement this paragraph in
				accordance with the assessment of need for the State as approved by the
				Secretary.</text>
