		<legis-type display="yes">A BILL</legis-type>
		<official-title display="yes">To amend the Federal Water Pollution
		  Control Act to expand and strengthen cooperative efforts to monitor, restore,
		  and protect the resource productivity, water quality, and marine ecosystems of
		  the Gulf of Mexico.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gulf of Mexico Restoration and
			 Protection Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idFC432FF7DD234086A26E631C26769E2C" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings and purposes</header>
			<subsection commented="no" display-inline="no-display-inline" id="idB17945D4D372436E8E29286149F04D4F"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF0C761B440714349B4E467530426C975"><enum>(1)</enum><text display-inline="yes-display-inline">the Gulf of Mexico is a valuable resource
			 of national and international importance, continuously serving the people of
			 the United States and other countries as an important source of food, economic
			 productivity, recreation, beauty, and enjoyment;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4f11ec847d48443fb1aab92287a0a4fa"><enum>(2)</enum><text display-inline="yes-display-inline">over many years, the resource productivity
			 and water quality of the Gulf of Mexico and its watershed have been diminished
			 by point and nonpoint source pollution resulting largely from the impacts of
			 agricultural runoff, increasing population growth and development in the Gulf
			 of Mexico watershed, and other factors;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd7c488a5b185415d881cbeed63d9cd9a"><enum>(3)</enum><text display-inline="yes-display-inline">the United States should seek to attain the
			 protection and restoration of the Gulf of Mexico ecosystem as a collaborative
			 regional goal of the Gulf of Mexico Program; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60f2574783fb4dc18d1fc425e8c149c8"><enum>(4)</enum><text display-inline="yes-display-inline">the Administrator of the Environmental
			 Protection Agency, in consultation with other Federal agencies and State and
			 local authorities, should coordinate the effort to meet those goals.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID78444906f2574535b56d00e596ad4cac"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID4c01cd125d624752afe56539311cbedc"><enum>(1)</enum><text display-inline="yes-display-inline">to expand and strengthen cooperative
			 efforts to restore and protect the Gulf of Mexico;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID586566a8302f42468cb297f484354824"><enum>(2)</enum><text display-inline="yes-display-inline">to expand Federal support for monitoring,
			 management, and restoration activities in the Gulf of Mexico and its
			 watershed;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2f0ab9e567264c6a80d9a172ac3fff31"><enum>(3)</enum><text display-inline="yes-display-inline">to commit the United States to a
			 comprehensive cooperative program to achieve improved water quality in, and
			 improvements in the productivity of living resources of, the Gulf of Mexico;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDca8e14c0559e4ba0be9e801cbd7c3059"><enum>(4)</enum><text display-inline="yes-display-inline">to establish a Gulf of Mexico Program to
			 serve as a national and international model for the collaborative management of
			 large marine ecosystems.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID1f327d5200864e98ac618ee6a476bc34" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Gulf of Mexico restoration and
			 protection</header><text display-inline="no-display-inline">Title I of the
			 Federal Water Pollution Control Act (33 U.S.C. 1251 et seq.) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idDF0009DDDFC3411CB4D691C2EEDE8779"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating the second section 121 (33
			 U.S.C. 1274) (relating to wet weather watershed pilot projects) as section 122;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20B39C7175774610848CA772D150C11F"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 122 (as
			 designated by paragraph (1)) the following:</text>

					<section commented="no" display-inline="no-display-inline" id="ID3255cdeea4e245a2b3f6fadcd6238110" section-type="subsequent-section"><enum>123.</enum><header display-inline="yes-display-inline">Gulf of mexico restoration and
				protection</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID849ec066f2b942e2b6aa79be1851f9d6"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section;</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDe54e4525a31f4fc69485adc939e9b3e2"><enum>(1)</enum><header display-inline="yes-display-inline">Gulf of mexico ecosystem</header><text display-inline="yes-display-inline">The term <term>Gulf of Mexico
				ecosystem</term> means the ecosystem of the Gulf of Mexico and its
				watershed.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc33778872d9a44058e1b72747300b3de"><enum>(2)</enum><header display-inline="yes-display-inline">Gulf of mexico executive
				council</header><text display-inline="yes-display-inline">The term <term>Gulf
				of Mexico Executive Council</term> means the formal collaborative Federal,
				State, local, and private participants in the Program.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd2c4d8b74d8d4527a20529b73ac2414b"><enum>(3)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the
				Gulf of Mexico Program established by the Administrator in 1988 as a
				nonregulatory, inclusive partnership to provide a broad geographic focus on the
				primary environmental issues affecting the Gulf of Mexico.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4a44c0a7ad3247679ae88a4438d32edb"><enum>(4)</enum><header display-inline="yes-display-inline">Program
				office</header><text display-inline="yes-display-inline">The term <term>Program
				Office</term> means the office established by the Administrator to administer
				the Program that is reestablished by subsection (b)(1)(A).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc575f4b886a34d7e9a1df429d2c29aac"><enum>(b)</enum><header display-inline="yes-display-inline">Continuation of gulf of mexico
				program</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID725deb04930e4c0581b0c98844ea58b1"><enum>(1)</enum><header display-inline="yes-display-inline">Gulf of mexico program office</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id8548176B626E4BAC8984D24D63CD91B1"><enum>(A)</enum><header display-inline="yes-display-inline">Reestablishment</header><text display-inline="yes-display-inline">The Program Office established before the
				date of enactment of this section by the Administrator is reestablished as an
				office of the Environmental Protection Agency.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA45DE1A52CF4459183D969803C71FD7B"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The Program Office shall be—</text>
									<clause commented="no" display-inline="no-display-inline" id="id6FEE3F9A3F5949399627CE580752C32B"><enum>(i)</enum><text display-inline="yes-display-inline">headed by a Director who, by reason of
				management experience and technical expertise relating to the Gulf of Mexico,
				is highly qualified to direct the development of plans and programs on a
				variety of Gulf of Mexico issues, as determined by the Administrator;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id4A4E76386E14445FA7755430A88E9600"><enum>(ii)</enum><text display-inline="yes-display-inline">located in a State all or a portion of the
				coastline of which is on the Gulf of Mexico.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9d2f3436d8de4f8195ba78aa02f5c624"><enum>(C)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">The Program Office shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDc2b70abd13a643c7a5700923746fcadc"><enum>(i)</enum><text display-inline="yes-display-inline">coordinate the actions of the Environmental
				Protection Agency with the actions of the appropriate officials of other
				Federal agencies and State and local authorities in developing
				strategies—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID0c4568d54a824cd3adf252341d833d90"><enum>(I)</enum><text display-inline="yes-display-inline">to improve the water quality and living
				resources in the Gulf of Mexico ecosystem; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDbd1e8bcf57d84ad4a45a6c2be5d32ccf"><enum>(II)</enum><text display-inline="yes-display-inline">to obtain the support of appropriate
				officials;</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID02f69cad317c4ed3afb603f485e67f1b"><enum>(ii)</enum><text display-inline="yes-display-inline">in cooperation with appropriate Federal,
				State, and local authorities, assist in developing and implementing specific
				action plans to carry out the Program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID45d40adaad6e43f1859c613af926e5fd"><enum>(iii)</enum><text display-inline="yes-display-inline">coordinate and implement priority State-led
				and community-led restoration plans and projects and facilitate science,
				research, modeling, monitoring, data collection, and other activities that
				support the Program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID12e86ae2e1fc4884856a01f89433b580"><enum>(iv)</enum><text display-inline="yes-display-inline">implement outreach programs for public
				information, education, and participation to foster stewardship of the
				resources of the Gulf of Mexico;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDc34313bc9a804169b75d757d49e449b8"><enum>(v)</enum><text display-inline="yes-display-inline">develop and make available, through
				publications, technical assistance, and other appropriate means, information
				pertaining to the environmental quality and living resources of the Gulf of
				Mexico ecosystem; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID4086630d38df4ac29f243c6b7e6a7ed9"><enum>(vi)</enum><text display-inline="yes-display-inline">serve as the liaison with, and provide
				information to, the Mexican members of the Gulf of Mexico States Accord and
				Mexican counterparts of the Environmental Protection Agency.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7406b87792884e2285de6145a8172d34"><enum>(c)</enum><header display-inline="yes-display-inline">Interagency agreements</header><text display-inline="yes-display-inline">The Administrator may enter into 1 or more
				interagency agreements with other Federal agencies to carry out this
				section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa7a60840cf6c4ee7a3c2c3c5ab521f08"><enum>(d)</enum><header display-inline="yes-display-inline">Grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID72f0b94f515e4c2ca61a46dba34a9caf"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with the Program, the
				Administrator may provide grants to nonprofit organizations, State and local
				governments, colleges, universities, interstate agencies, and individuals to
				carry out this section for use in—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDb3497454cc0544ac9ab50a05073d7e18"><enum>(A)</enum><text display-inline="yes-display-inline">monitoring the water quality and living
				resources of the Gulf of Mexico ecosystem;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID20b14b9838c0458aa39f16204f3ca3e5"><enum>(B)</enum><text display-inline="yes-display-inline">researching the effects of natural and
				human-induced environmental changes on the water quality and living resources
				of the Gulf of Mexico ecosystem;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb7b7c3a0536d493b87eff76c6a473abb"><enum>(C)</enum><text display-inline="yes-display-inline">developing and executing cooperative
				strategies that address the water quality and living resource needs in the Gulf
				of Mexico ecosystem;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDeba80d39effb414ea5c203cd5e6ddb72"><enum>(D)</enum><text display-inline="yes-display-inline">developing and implementing locally-based
				protection and restoration programs or projects within a watershed that
				complement those strategies, including the creation, restoration, protection,
				or enhancement of habitat associated with the Gulf of Mexico ecosystem;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf9f7c521834e4e6a8584087d39a6dd8c"><enum>(E)</enum><text display-inline="yes-display-inline">eliminating or reducing point sources that
				discharge pollutants that contaminate the Gulf of Mexico ecosystem, including
				activities to eliminate leaking septic systems and construct connections to
				local sewage systems.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID94a6486589304d00853aeee915dd7f2f"><enum>(2)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of any
				project or activity carried out using a grant provided under this section shall
				not exceed 75 percent, as determined by the Administrator.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2ebc2e2e4e554b53ac1df32b184b1eb3"><enum>(3)</enum><header display-inline="yes-display-inline">Administrative costs</header><text display-inline="yes-display-inline">Administrative costs in the form of
				salaries, overhead, or indirect costs for services provided and charged against
				programs or projects carried out using funds made available through a grant
				under this subsection shall not exceed 15 percent of the amount of the
				grant.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7c73719db2f74edcbaff77604ac79168"><enum>(e)</enum><header display-inline="yes-display-inline">Reports</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID47339e44d7c84a159b97e553978452fa"><enum>(1)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Not later than December 30, 2007, and
				annually thereafter, the Director of the Program Office shall submit to the
				Administrator and make available to the public a report that describes—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDc37b2b03d47b40129a045baf3aef2fa7"><enum>(A)</enum><text display-inline="yes-display-inline">each project and activity funded under this
				section during the previous fiscal year;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8ec1ec4c5fb04d8ea84eb37e8301227e"><enum>(B)</enum><text display-inline="yes-display-inline">the goals and objectives of those projects
				and activities; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0c74c5012d054f43825bd9c1be3c7ede"><enum>(C)</enum><text display-inline="yes-display-inline">the net benefits of projects and activities
				funded under this section during previous fiscal years.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc403f2943193461ea7a7981abf2b5e09"><enum>(2)</enum><header display-inline="yes-display-inline">Assessment</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDd1f5ecbd4c61470ea455255adb5d9257"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than April 30, 2008, and every 5
				years thereafter, the Administrator, in coordination with the Gulf of Mexico
				Executive Council, shall complete an assessment, and submit to Congress a
				comprehensive report on the performance, of the Program.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID10385b3a9d7a4856b9a2a96e631969a5"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The assessment and report described in
				subparagraph (A) shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID3049a41d39e04c8087505799d178b3bf"><enum>(i)</enum><text display-inline="yes-display-inline">assess the overall state of the Gulf of
				Mexico ecosystem;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID1519aadd56514734a470f4affe509414"><enum>(ii)</enum><text display-inline="yes-display-inline">compare the current state of the Gulf of
				Mexico ecosystem with a baseline assessment;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID04d5760f032a45619fe95bf83d2e6039"><enum>(iii)</enum><text display-inline="yes-display-inline">assess the effectiveness of the Program
				management strategies being implemented, and the extent to which the priority
				needs of the region are being met through that implementation; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDae803d34c045412d9ae031f43c94bcac"><enum>(iv)</enum><text display-inline="yes-display-inline">make recommendations for the improved
				management of the Program, including strengthening strategies being implemented
				or adopting improved strategies.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID40a626bff258412991a61e35e3f1fbb7"><enum>(f)</enum><header display-inline="yes-display-inline">Budget item</header><text display-inline="yes-display-inline">The Administrator, in the annual submission
				to Congress of the budget of the Environmental Protection Agency, shall include
				a funding line item request for the Program Office as a separate budget line
				item.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd9c868c3fe1b4134b708b7aabd24ec42"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section, to remain available
				until expended—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID6451df03846d4c429a0bed3dd670de68"><enum>(1)</enum><text display-inline="yes-display-inline">$10,000,000 for fiscal year 2008;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4f18702befae4ba99be4f82eecb30685"><enum>(2)</enum><text display-inline="yes-display-inline">$15,000,000 for fiscal year 2009;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDffcecee41b82477eb860d3f037345e1d"><enum>(3)</enum><text display-inline="yes-display-inline">$25,000,000 for each of fiscal years 2010
				through
				2012.</text>
