			 Secretary</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Secretary</term> means the Secretary of Energy.</text>
		</section><title commented="no" id="id81F85661143B41E4B191330F23D2BBFB" level-type="subsequent" style="OLC"><enum>I</enum><header display-inline="yes-display-inline">Promoting advanced lighting
			 technologies</header>
			<section id="id65DE3AEBDD8D43C6BF1910FD16488DA0"><enum>101.</enum><header>Accelerated
			 procurement of energy efficient lighting</header><text display-inline="no-display-inline">Section 553 of the National Energy
			 Conservation Policy Act (42 U.S.C. 8259b) is amended by adding the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id185E0B1C99464798BAE8039627C6EBAC" style="OLC">
					<subsection id="ID4f1b16be30a8460db7c81bbc564f8708"><enum>(f)</enum><header>Accelerated
				procurement of energy efficient lighting</header>
						<paragraph id="id398992F99B1E428898C0A7B477D68207"><enum>(1)</enum><header>In
				general</header><text>Not later than October 1, 2010, in accordance with
				guidelines issued by the Secretary, all general purpose lighting in Federal
				buildings shall be Energy Star products or products designated under the
				Federal Energy Management Program.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2033B1E6414F4B1FA3BD6EF27C331DF5"><enum>(2)</enum><header>Guidelines</header><text>Not
				later than 180 days after the date of enactment of this subsection, the
				Secretary shall issue guidelines to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idD882B9296CDE4CED8B98EB55054F19F2"><enum>102.</enum><header>Incandescent
			 reflector lamp efficiency standards</header>
				<subsection id="IDd62b3583ff9a48fcab3df5c0d274ffed"><enum>(a)</enum><header>Definitions</header><text>Section
			 321 of the Energy Policy and Conservation Act (42 U.S.C. 6291) is
			 amended—</text>
					<paragraph id="IDc12e69d2d5d74a848094358e1a3842d0"><enum>(1)</enum><text>in paragraph
			 (30)(C)(ii)—</text>
						<subparagraph id="ID7f227dfe980e47dfbc0631225e220801"><enum>(A)</enum><text>in the matter
			 preceding subclause (I)—</text>
							<clause id="IDfa75a82d207b4d5e9bdabda6c1e39c84"><enum>(i)</enum><text>by
			 striking <quote>or similar bulb shapes (excluding ER or BR)</quote> and
			 inserting <quote>ER, BR, BPAR, or similar bulb shapes</quote>; and</text>
							</clause><clause id="ID5f016e06fa5042e0bcc6f192702f2c74"><enum>(ii)</enum><text>by
			 striking <quote>2.75</quote> and inserting <quote>2.25</quote>; and</text>

			 <quote>is either—</quote> and all that follows through subclause (II) and
			 inserting <quote>has a rated wattage that is 40 watts or higher</quote>;

								</clause><clause id="ID7714b6e51c10486493cfe1d27d38c5b7"><enum>(ii)</enum><text>Lamps rated at
				65 watts that are BR30, BR40, or ER40 lamps.</text>
								</clause><clause id="ID8556829ec8b14d3b8f9d4a7c84c0e31e"><enum>(iii)</enum><text>R20
				incandescent reflector lamps rated 45 watts or less.</text>
								</clause></subparagraph><subparagraph id="ID48594961896047f290e933a7923c52f5"><enum>(D)</enum><header>Effective
				dates</header>
								<clause id="IDfb4077ecff8444aaaf9ddf53953fe6a3"><enum>(i)</enum><header>ER, BR, and
				BPAR lamps</header><text>The standards specified in subparagraph (B) shall
				apply with respect to ER incandescent reflector lamps, BR incandescent
				reflector lamps, BPAR incandescent reflector lamps, and similar bulb shapes on
				and after January 1, 2008.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID8509a042beba44bf8bed580e3c8914b5"><enum>(ii)</enum><header>Lamps between
				2.25–2.75 inches in diameter</header><text>The standards specified in
				subparagraph (B) shall apply with respect to incandescent reflector lamps with
				a diameter of more than 2.25 inches, but not more than 2.75 inches, on and
				after January 1,
				2008.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id13E9C44964394C10BDDCA27BFAB61CA1"><enum>103.</enum><header>Bright
			 Tomorrow Lighting Prizes</header>
				<subsection id="IDa4835e6242f645ebae403f896fa6f081"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 1 year after the date of enactment of this Act, as part of the
			 program carried out under section 1008 of the Energy Policy Act of 2005 (42
			 U.S.C. 16396), the Secretary shall establish and award Bright Tomorrow Lighting
			 Prizes for solid state lighting in accordance with this section.</text>
				</subsection><subsection id="ID67fb7db10e3e465e9bbd1978a536f2b1"><enum>(b)</enum><header>Prize
			 specifications</header>
					<paragraph id="idE2434B4AFADA48BBAF29F0D3D0EFDA5B"><enum>(1)</enum><header>60-Watt
			 Incandescent Replacement Lamp Prize</header><text>The Secretary shall award a
			 60-Watt Incandescent Replacement Lamp Prize to an entrant that produces a
			 solid-state light package simultaneously capable of—</text>
						<subparagraph id="ID6289c77740e94233b912e311ddbfabf5"><enum>(A)</enum><text>producing a
			 luminous flux greater than 900 lumens;</text>
						</subparagraph><subparagraph id="ID2ca79a1d5f4240b3ac3cb6face81fd28"><enum>(B)</enum><text>consuming less
			 than or equal to 10 watts;</text>
						</subparagraph><subparagraph id="IDd506c6797eaf4f6f82027d41fce3ac65"><enum>(C)</enum><text>having an
			 efficiency greater than 90 lumens per watt;</text>
						</subparagraph><subparagraph id="ID53d6cfbbec3942588f6402ed6b1117ae"><enum>(D)</enum><text>having a color
			 rendering index greater than 90;</text>
						</subparagraph><subparagraph id="ID9897ec2eb07a4559b750742281af8e9b"><enum>(E)</enum><text>having a
			 correlated color temperature of not less than 2,750, and not more than 3,000,
			 degrees Kelvin;</text>
						</subparagraph><subparagraph id="ID49b353ea9cd24754b1cd3a2078a40d2a"><enum>(F)</enum><text>having a lifetime
			 exceeding 25,000 hours under typical conditions expected in residential
			 use;</text>
						</subparagraph><subparagraph id="IDed3dda214738421a89f68d776c981d3f"><enum>(G)</enum><text>having a light
			 distribution pattern similar to a soft 60-watt incandescent A19 bulb;</text>
						</subparagraph><subparagraph id="ID5d7199e0335d40fe85b65a7d120f3d8b"><enum>(H)</enum><text>having a size and
			 shape similar to a 60-watt incandescent A19 bulb in accordance with American
			 National Standards Institute standard C78.20–2003, figure C78.20–211;</text>
						</subparagraph><subparagraph id="ID7758e99ff95140d2b8f2f20efa7a858b"><enum>(I)</enum><text>using an
			 incandescent bulb power receptacle; and</text>
						</subparagraph><subparagraph id="id856227049636478DBD046BC263427FED"><enum>(J)</enum><text>mass production
			 for a competitive sales commercial market satisfied by the submission of 10,000
			 such units equal to or exceeding the criteria described in subparagraphs (A)
			 through (I).</text>
						</subparagraph></paragraph><paragraph id="IDfad400c4bb0c484bb4bb76e91aaf1aa2"><enum>(2)</enum><header>PAR Type 38
			 Halogen Replacement Lamp Prize</header><text>The Secretary shall award a
			 Parabolic Aluminized Reflector Type 38 Halogen Replacement Lamp Prize (referred
			 to in this section as the <quote>PAR Type 38 Halogen Replacement Lamp
			 Prize</quote>) to an entrant that produces a solid-state-light package
			 simultaneously capable of—</text>
						<subparagraph id="ID3f652034b75a495da71535e74ef6e67b"><enum>(A)</enum><text>producing a
			 luminous flux greater than or equal to 1,350 lumens;</text>
						</subparagraph><subparagraph id="ID2d971c4357274bcc9fd6f44867744497"><enum>(B)</enum><text>consuming less
			 than or equal to 10 watts;</text>
						</subparagraph><subparagraph id="IDf9398da92ad34b7dbe40a71f7f3b50de"><enum>(C)</enum><text>having an
			 efficiency greater than 90 lumens per watt;</text>
						</subparagraph><subparagraph id="ID3ff9f3af02384e81b2fe0adad210fca3"><enum>(D)</enum><text>having a color
			 rendering index greater than or equal to 90;</text>
						</subparagraph><subparagraph id="id716E1D69847E4545A1FBA1FF4648A5A6"><enum>(E)</enum><text>having a
			 correlated color coordinate temperature of not less than 2,750, and not more
			 than 3,000, degrees Kelvin;</text>
						</subparagraph><subparagraph id="ID8b0740d5edc24a9dbdf0084eda817854"><enum>(F)</enum><text>having a lifetime
			 exceeding 25,000 hours under typical conditions expected in residential
			 use;</text>
						</subparagraph><subparagraph id="ID2babb926745346fa969c6057d3882e71"><enum>(G)</enum><text>having a light
			 distribution pattern similar to a PAR 38 halogen lamp;</text>
						</subparagraph><subparagraph id="ID81b5ffe1d65f4cfebeaa4e3aaa18b5c0"><enum>(H)</enum><text>having a size and
			 shape that fits within the maximum dimensions of a PAR 38 halogen lamp in
			 accordance with American National Standards Institute standard C78–21–2003,
			 figure C78.21–238;</text>
						</subparagraph><subparagraph id="ID78fa9107375a4350b13ffaa020e4564e"><enum>(I)</enum><text>using a PAR 38
			 halogen power receptacle; and</text>
						</subparagraph><subparagraph id="idBA55D8470FB24CE68807BF063EC37EE6"><enum>(J)</enum><text>mass production
			 for a competitive sales commercial market satisfied by the submission of 10,000
			 such units equal to or exceeding the criteria described in subparagraphs (A)
			 through (I).</text>
						</subparagraph></paragraph><paragraph id="ID7b63511f1764422da031dc5bc1fcdc30"><enum>(3)</enum><header>Twenty-First
			 Century Lamp Prize</header><text>The Secretary shall award a Twenty-First
			 Century Lamp Prize to an entrant that produces a solid-state-light-light
			 capable of—</text>
						<subparagraph id="IDd5a14a537f6b40b8b9dc640ca25735df"><enum>(A)</enum><text>producing a light
			 output greater than 1,200 lumens;</text>
						</subparagraph><subparagraph id="IDc67dacb8aafd4161814ca33c9e77b436"><enum>(B)</enum><text>having an
			 efficiency greater than 150 lumens per watt;</text>
						</subparagraph><subparagraph id="ID44c73483218d4454868930915fef2ec8"><enum>(C)</enum><text>having a color
			 rendering index greater than 90;</text>
						</subparagraph><subparagraph id="ID80d4c0058b0d4fbe88cc34394b216e61"><enum>(D)</enum><text>having a color
			 coordinate temperature between 2,800 and 3,000 degrees Kelvin; and</text>
						</subparagraph><subparagraph id="IDd94d0a70e9ac4ac6a123c09e5a443817"><enum>(E)</enum><text>having a lifetime
			 exceeding 25,000 hours.</text>
						</subparagraph></paragraph></subsection><subsection id="ID287eb4ac5d5a4051bacb75694dc0c81b"><enum>(c)</enum><header>Private
			 funds</header><text>The Secretary may accept and use funding from private
			 sources as part of the prizes awarded under this section.</text>
				</subsection><subsection id="ID02b45c0411f94361a28809d748aba7fb"><enum>(d)</enum><header>Technical
			 review</header><text>The Secretary shall establish a technical review committee
			 composed of non-Federal officers to review entrant data submitted under this
			 section to determine whether the data meets the prize specifications described
			 in subsection (b).</text>
				</subsection><subsection id="ID7f0832e282454bafb9be47c7149554a9"><enum>(e)</enum><header>Third party
			 administration</header><text>The Secretary may competitively select a third
			 party to administer awards under this section.</text>
				</subsection><subsection id="ID54bef1fc5bff40349970fd3f331f6883"><enum>(f)</enum><header>Award
			 amounts</header><text>Subject to the availability of funds to carry out this
			 section, the amount of—</text>
					<paragraph id="ID562daba1f4ec45e8b9b6c6f0f6bf649b"><enum>(1)</enum><text>the 60-Watt
			 Incandescent Replacement Lamp Prize described in subsection (b)(1) shall be
			 $10,000,000;</text>
					</paragraph><paragraph id="ID6b2420d376ff49a1b26f0536151c76b2"><enum>(2)</enum><text>the PAR Type 38
			 Halogen Replacement Lamp Prize described in subsection (b)(2) shall be
			 $5,000,000; and</text>
					</paragraph><paragraph id="ID65ce0e76180a449da1ba08e3bdb7b048"><enum>(3)</enum><text>the Twenty-First
			 Century Lamp Prize described in subsection (b)(3) shall be $5,000,000.</text>
					</paragraph></subsection><subsection id="id208A0557547E465FB10385C5B90C313B"><enum>(g)</enum><header>Federal
			 procurement of solid-state-lights</header>
					<paragraph id="ID547753192430413cb620ecbe3615415e"><enum>(1)</enum><header>60-watt
			 incandescent replacement</header><text>Subject to paragraph (3), as soon as
			 practicable after the successful award of the 60-Watt Incandescent Replacement
			 Lamp Prize under subsection (b)(1), the Secretary (in consultation with the
			 Administrator of General Services) shall develop governmentwide Federal
			 purchase guidelines with a goal of replacing the use of 60-watt incandescent
			 lamps in Federal Government buildings with a solid-state-light package
			 described in subsection (b)(1) by not later than the date that is 5 years after
			 the date the award is made.</text>
					</paragraph><paragraph id="IDcd05fa3d75a14da39c447bbed21a6ed9"><enum>(2)</enum><header>PAR 38 halogen
			 replacement lamp replacement</header><text>Subject to paragraph (3), as soon as
			 practicable after the successful award of the PAR Type 38 Halogen Replacement
			 Lamp Prize under subsection (b)(2), the Secretary (in consultation with the
			 Administrator of General Services) shall develop governmentwide Federal
			 purchase guidelines with the goal of replacing the use of PAR 38 halogen lamps
			 in Federal Government buildings with a solid-state-light package described in
			 subsection (b)(2) by not later than the date that is 5 years after the date the
			 award is made.</text>
					</paragraph><paragraph id="ID86eb79d72e514a5b952ed01b8c2d3579"><enum>(3)</enum><header>Waivers</header>
						<subparagraph id="idA450945827E2420D8AFDA0CD28887A70"><enum>(A)</enum><header>In
			 general</header><text>The Secretary or the Administrator of General Services
			 may waive the application of paragraph (1) or (2) if the Secretary or
			 Administrator determines that the return on investment from the purchase of a
			 solid-state-light package described in paragraph (1) or (2) of subsection (b),
			 respectively, is cost prohibitive.</text>
						</subparagraph><subparagraph id="IDe32f97c436ac4f1bbdb50df8a99ed4c8"><enum>(B)</enum><header>Report of
			 waiver</header><text>If the Secretary or Administrator waives the application
			 of paragraph (1) or (2), the Secretary or Administrator, respectively, shall
			 submit to Congress an annual report that describes the waiver and provides a
			 detailed justification for the waiver.</text>
						</subparagraph></paragraph></subsection><subsection id="ID85433ce03375480d9d08aecf6ced91d7"><enum>(h)</enum><header>Bright Light
			 Tomorrow Award Fund</header>
					<paragraph id="ID3b86eb1d75f846aca08c6c23acb1fd73"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the United States Treasury a Bright Light Tomorrow permanent
			 fund without fiscal year limitation to award prizes under paragraphs (1), (2),
			 and (3) of subsection (b).</text>
					</paragraph><paragraph id="ID67759e413db9484187d0ca07aec875b8"><enum>(2)</enum><header>Sources of
			 funding</header><text>The fund established under paragraph (1) shall
			 accept—</text>
						<subparagraph id="id490E645773E64002A44456D968B758C4"><enum>(A)</enum><text>fiscal year
			 appropriations; and</text>
						</subparagraph><subparagraph id="id4A511C19DD6F4BA9A0885DA84E3333C6"><enum>(B)</enum><text>private
			 contributions authorized under subsection (c).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD0A0E2E04EDD47169BACA3221BBBC466"><enum>(i)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section.</text>
				</subsection></section><section id="id93D1C3853D0C489AB9CFF4CDDFFB56C3"><enum>104.</enum><header>Sense of
			 Senate concerning efficient lighting standards</header>
				<subsection id="id0191D199CF704657BB97ED946160E649"><enum>(a)</enum><header>Findings</header><text>The
			 Senate finds that—</text>
					<paragraph id="IDda73bc4b68af4338ad339fdc2af05f31"><enum>(1)</enum><text>there are
			 approximately 4,000,000,000 screw-based sockets in the United States that
			 contain traditional, energy-inefficient, incandescent light bulbs;</text>
					</paragraph><paragraph id="ID789802f1d0ff482eaf41bd7d3177a1ca"><enum>(2)</enum><text>incandescent
			 light bulbs are based on technology that is more than 125 years old;</text>
					</paragraph><paragraph id="IDcebe69c9b29e4cb19faadb639963fe8e"><enum>(3)</enum><text>there are
			 radically more efficient lighting alternatives in the market, with the promise
			 of even more choices over the next several years;</text>
					</paragraph><paragraph id="ID0adf812bb7a143cb955b1b0da366f763"><enum>(4)</enum><text>national policy
			 can support a rapid substitution of new, energy-efficient light bulbs for the
			 less efficient products in widespread use; and,</text>
					</paragraph><paragraph id="IDe6c5daf5eb9e4c019bcdedf701fc32a4"><enum>(5)</enum><text>transforming the
			 United States market to use of more efficient lighting technologies can—</text>
						<subparagraph id="ID1237e49856a540d090674488b3f8c666"><enum>(A)</enum><text>reduce electric
			 costs in the United States by more than $18,000,000,000 annually;</text>
						</subparagraph><subparagraph id="IDde91510fad7b443bb9bb8ff00eae78c0"><enum>(B)</enum><text>save the
			 equivalent electricity that is produced by 80 base load coal-fired power
			 plants; and</text>
						</subparagraph><subparagraph id="ID6a769bfeeff04dd2946a2743017e61cb"><enum>(C)</enum><text>reduce fossil
			 fuel related emissions by approximately 158,000,000 tons each year.</text>
						</subparagraph></paragraph></subsection><subsection id="IDf917a2c5c94744ac9a853048c3d01d1a"><enum>(b)</enum><header>Sense of the
			 Senate</header><text>It is the sense of the Senate that the Senate
			 should—</text>
					<paragraph id="IDadb428c719864c3f8d9c4478f6a3f193"><enum>(1)</enum><text>pass a set of
			 mandatory, technology-neutral standards to establish firm energy efficiency
			 performance targets for lighting products;</text>
					</paragraph><paragraph id="IDcab155536b8940f5b66a2c3f298e7d61"><enum>(2)</enum><text>ensure that the
			 standards become effective within the next 10 years; and</text>
					</paragraph><paragraph id="ID458e6799091c4f8b9e00708d2951bd3c"><enum>(3)</enum><text>in developing the
			 standards—</text>
						<subparagraph id="id401A419B5ADD4A76B5130A91154CF2F3"><enum>(A)</enum><text>establish the
			 efficiency requirements to ensure that replacement lamps will provide consumers
			 with the same quantity of light while using significantly less energy;</text>
						</subparagraph><subparagraph id="IDf9f75056a4a4472eae7a0cf37ebf653d"><enum>(B)</enum><text>ensure that
			 consumers will continue to have multiple product choices, including
			 energy-saving halogen, incandescent, compact fluorescent, and LED light bulbs;
			 and</text>
						</subparagraph><subparagraph id="ID2782f9066b0f47b99bc85c089239adbe"><enum>(C)</enum><text>work with
			 industry and key stakeholders on measures that can assist consumers and
			 businesses in making the important transition to more efficient
			 lighting.</text>
						</subparagraph></paragraph></subsection></section></title><title id="idC693748E5AB449398DE4072D7758A386"><enum>II</enum><header>Expediting new
			 energy efficiency standards</header>
			<section id="ID3604d268a7f64bcca00d6b99da91b184"><enum>201.</enum><header>Definition of
			 energy conservation standard</header><text display-inline="no-display-inline">Section 321 of the
			 <act-name parsable-cite="EPCA">Energy Policy and Conservation Act (42 U.S.C.
			 6291) is amended by striking paragraph (6) and inserting the
			 following:</act-name></text>
				<quoted-block display-inline="no-display-inline" id="idC3933CF342F4443386BA021431E65431" style="OLC">
					<paragraph id="ID5fb9655dbefb4f9c9dcd443826e9f749"><enum>(6)</enum><header>Energy
				conservation standard</header>
						<subparagraph id="idF1A5B16FA399492D993624E730F4E55D"><enum>(A)</enum><header>In
				general</header><text>The term <term>energy conservation standard</term>
				means—</text>
							<clause id="IDd98bbf0e39a8457fa023928bff0e6317"><enum>(i)</enum><text>1
				or more performance standards that prescribe a minimum level of energy
				efficiency or a maximum quantity of energy use, and, in the case of a
				showerhead, faucet, water closet, urinal, clothes washer, and dishwasher, water
				use, for a covered product, determined in accordance with test procedures
				prescribed under section 323; and</text>
							</clause><clause id="ID7aa5a88216a44888828ab45f4842e50e"><enum>(ii)</enum><text>1 or more design
				requirements.</text>
							</clause></subparagraph><subparagraph id="idA86FFD63E6E24D23A90BA332F01E8DD8"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>energy conservation standard</term> includes any other requirements
				that the Secretary may prescribe under subsections (o) and (r) of section
				325.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDa59cf8cf05e746c7b88181984265a5ab"><enum>202.</enum><header>Regional
			 standards for heating and cooling products</header><text display-inline="no-display-inline">Section 325(o) of the
			 <act-name parsable-cite="EPCA">Energy Policy and Conservation Act</act-name>
			 (42 U.S.C. 6295(o)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9D0193D6B6024F4DB162CC013AC7B291" style="OLC">
					<paragraph id="ID0af85eacd3334903808fa5ba0c715d41"><enum>(6)</enum><header>Regional
				standards for heating and cooling products</header>
						<subparagraph id="idD4C243ADEB074AD1AC696C8BAF817800"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of this section, the
				Secretary may establish regional standards for space heating and air
				conditioning products.</text>
						</subparagraph><subparagraph id="id75AF9C603DBD4B3499C4D9CE5BD8C548"><enum>(B)</enum><header>Maximum number
				of regions</header><text>For each space heating and air conditioning product,
				the Secretary may establish not more than 3 regions with differing
				standards.</text>
						</subparagraph><subparagraph id="id08A7ACC7BD3E41BFB47E94A932BF19F6"><enum>(C)</enum><header>Boundaries of
				regions</header>
							<clause id="idDC2B8827EBE44D7789DB5A803245399B"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall establish the regions so as to
				achieve the maximum level of energy savings that are technically feasible and
				economically justifiable.</text>
							</clause><clause id="idF66920874CF04E25942F2F52D91A3354"><enum>(ii)</enum><header>State
				boundaries</header><text>Boundaries for a region shall conform to State borders
				and only include contiguous States (other than Alaska and Hawaii, which shall
				be noncontiguous).</text>
							</clause></subparagraph><subparagraph id="id26A0D757A7D64B36892C81C52CBCA235"><enum>(D)</enum><header>Factors for
				establishment</header><text>In deciding whether to establish 1 or more regional
				standards for space heating and air conditioning equipment, the Secretary shall
				consider all of the factors described in paragraphs (1) through
				(4).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID0f6c4d6095b944d397ca34e3dfb954a5"><enum>203.</enum><header>Furnace fan
			 rulemaking</header><text display-inline="no-display-inline">Section 325(f)(3)
			 of the <act-name parsable-cite="EPCA">Energy Policy and Conservation Act (42
			 U.S.C. 6295(f)(3)) is amended by adding at the end the
			 following:</act-name></text>
				<quoted-block display-inline="no-display-inline" id="idFC24B97E6F274D76BEA06B2182B5B7ED" style="OLC">
					<subparagraph id="IDa84cc9267c9b42f2a22d9b140b412439"><enum>(E)</enum><header>Final
				rule</header>
						<clause id="idD884BA1AE4D9476C9400E21B2DD49EC6"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall publish a final rule to carry out
				this subsection not later than December 31, 2012.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idB7B67412721346FD9AAA6F93F4E20AB5"><enum>(ii)</enum><header>Criteria</header><text>The
				standards shall meet the criteria established under subsection
				(o).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDf73e6dc4da2c4f10a96aa51384eba29e"><enum>204.</enum><header>Expedited
			 rulemakings</header><text display-inline="no-display-inline">Section 325 of the
			 Energy Policy and Conservation Act (42 U.S.C. 6295) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB3A8BED52C734F138C3D84F8159E664D" style="OLC">
					<subsection id="IDb2a7e0d321a74263bbfeafc7b2b75c0d"><enum>(hh)</enum><header>Expedited
				rulemaking for consensus standards</header>
						<paragraph id="IDa910609e8af44a0184dc1c6e64605413"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall conduct an expedited rulemaking based
				on an energy conservation standard or test procedure recommended by interested
				persons, if—</text>
							<subparagraph id="idCD058C670511414A9F4C7EC3D0BB052A"><enum>(A)</enum><text>the interested
				persons (demonstrating significant and broad support from manufacturers of a
				covered product, States, and environmental, energy efficiency, and consumer
				advocates) submit a joint comment recommending a consensus energy conservation
				standard or test procedure; and</text>
							</subparagraph><subparagraph id="id65DE0EF98B9848FA927AA388642ACC9A"><enum>(B)</enum><text>the Secretary
				determines that the joint comment includes evidence that (assuming no other
				evidence were considered) provides an adequate basis for determining that the
				proposed consensus energy conservation standard or test procedure proposed in
				the joint comment complies with the provisions and criteria of this Act
				(including subsection o)) that apply to the type or class of covered products
				covered by the joint comment.</text>
							</subparagraph></paragraph><paragraph id="IDd9d8f89903cd4eff9d20d28dbfa5578b"><enum>(2)</enum><header>Procedure</header>
							<subparagraph id="id0A40975DF48943DD853DE4016248EBD1"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding subsection (p) or section 336(a), if the
				Secretary receives a joint comment that meets the criteria described in
				paragraph (1), the Secretary shall conduct an expedited rulemaking with respect
				to the standard or test procedure proposed in the joint comment in accordance
				with this paragraph.</text>
							</subparagraph><subparagraph id="IDb369112d296e464bb71b0bb4c267d01f"><enum>(B)</enum><header>Advanced notice
				of proposed rulemaking</header><text>If no advanced notice of proposed
				rulemaking has been issued under subsection (p)(1) with respect to the
				rulemaking covered by the joint comment, the requirements of subsection (p)
				with respect to the issuance of an advanced notice of proposed rulemaking shall
				not apply.</text>
							</subparagraph><subparagraph id="IDc252b107faef4a67b228f2345f2a8a19"><enum>(C)</enum><header>Publication of
				determination</header><text>Not later than 60 days after receipt of a joint
				comment described in paragraph (1)(A), the Secretary shall publish a
				description of a determination as to whether the proposed standard or test
				procedure covered by the joint comment meets the criteria described in
				paragraph (1).</text>
							</subparagraph><subparagraph id="IDc543fb1022164845aa93d7d5a7b337ff"><enum>(D)</enum><header>Proposed
				rule</header>
								<clause id="id784E0E0CB8EB49CFA2442FDEBDB6C744"><enum>(i)</enum><header>Publication</header><text>If
				the Secretary determines that the proposed consensus standard or test procedure
				covered by the joint comment meets the criteria described in paragraph (1), not
				later than 30 days after the determination, the Secretary shall publish a
				proposed rule proposing the consensus standard or test procedure covered by the
				joint comment.</text>
								</clause><clause id="IDb6f56734ec644f13855173433c22f5c8"><enum>(ii)</enum><header>Public comment
				period</header><text>Notwithstanding paragraphs (2) and (3) of subsection (p),
				the public comment period for the proposed rule shall be the 30–day period
				beginning on the date of the publication of the proposed rule in the Federal
				Register.</text>
								</clause><clause id="ID17adf86fd9f64a0b99239b304fc1dce4"><enum>(iii)</enum><header>Public
				hearing</header><text>Notwithstanding section 336(a), the Secretary may waive
				the holding of a public hearing with respect to the proposed rule.</text>
								</clause></subparagraph><subparagraph id="ID73debb6e3fbd489f8b13796ae829588e"><enum>(E)</enum><header>Final
				rule</header><text>Notwithstanding subsection (p)(4), the Secretary—</text>
								<clause id="idAEA74227092343B89DEF29E4B119BB66"><enum>(i)</enum><text>may publish a
				final rule at any time after the 60-day period beginning on the date of
				publication of the proposed rule in the Federal Register; and</text>
								</clause><clause id="id99EBC7CC6726495D88F1077DBCE0482F"><enum>(ii)</enum><text>shall publish a
				final rule not later than 120 days after the date of publication of the
				proposed rule in the Federal
				Register.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDedc0f32bf95d4114962f6437854eedfc"><enum>205.</enum><header> Preemption
			 limitation</header><text display-inline="no-display-inline">Section 327 of the

			 <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="id1709B0B5FD4D4F199C0BB53DF5F3895B"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking the period at
			 the end and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="id733BE55AFA854822A5C16E8FC1A27E49"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				occurs that ultimately does not prescribe a Federal energy conservation
				standard for the product.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID9d653e94840445338650abe4ba31dbee"><enum>(2)</enum><text>in subsection
			 (c)—</text>

					</subparagraph></paragraph></section><section commented="no" id="id3BB91AA46DC147A28EF65003196E509F"><enum>206.</enum><header>Energy
			 efficiency labeling for consumer products</header>
				<subsection commented="no" id="ID00cb2ef80ec64393a8fefe70149c167e"><enum>(a)</enum><header>In
			 general</header><text>Not later than 18 months after the date of enactment of
			 this Act, the Federal Trade Commission, in consultation with the Secretary and
			 the Administrator of the Environmental Protection Agency (acting through the
			 Energy Star program), shall promulgate regulations to add the consumer
			 electronics product categories described in subsection (b) to the Energy Guide
			 labeling program of the Commission.</text>
				</subsection><subsection commented="no" id="ID297f91c31489400c8bbfa9fa554a658f"><enum>(b)</enum><header>Consumer
			 electronics product categories</header><text>The consumer electronics product
			 categories referred to in subsection (a) are the following:</text>
					<paragraph commented="no" id="IDdc7bab76a08d4014b0c9dcd0a34d0888"><enum>(1)</enum><text>Televisions.</text>
					</paragraph><paragraph commented="no" id="IDcbdf47950841480f832e4d245656e241"><enum>(2)</enum><text>Personal
			 computers.</text>
					</paragraph><paragraph commented="no" id="ID6827d4999bc2464f8dbea9c4d7d68841"><enum>(3)</enum><text>Cable or
			 satellite set-top boxes.</text>
					</paragraph><paragraph commented="no" id="ID23fbfd08ec5546b58b3beb8cd3d3bd3d"><enum>(4)</enum><text>Stand-alone
			 digital video recorder boxes (including TIVO and similar branded
			 products).</text>
					</paragraph><paragraph commented="no" id="ID542ceeadbfe144149676e04636211275"><enum>(5)</enum><text>Computer
			 monitors.</text>
					</paragraph></subsection><subsection commented="no" id="ID5d5ae6d713fd4b2cabd29c500fa0cf16"><enum>(c)</enum><header>Label
			 placement</header><text>The regulations shall include specific requirements for
			 each product on the placement of Energy Guide labels.</text>
				</subsection><subsection commented="no" id="IDe5020a18ba204cecadbd4e27313cd0b1"><enum>(d)</enum><header>Deadline for
			 labeling</header><text>Not later than 1 year after the date of promulgation of
			 regulations under subsection (a), the Commission shall require labeling
			 electronic products described in subsection (b) in accordance with this section
			 (including the regulations).</text>
				</subsection><subsection commented="no" id="IDdb6c07493a5d4aadad893e3c58650521"><enum>(e)</enum><header>Authority To
			 include additional product categories</header><text>The Commission may add
			 additional product categories to the Energy Guide labeling program if the
			 product categories include products, as determined by the Commission—</text>
					<paragraph commented="no" id="ID556dce6798054445ae8179f6f1a733a3"><enum>(1)</enum><text>that have an
			 annual energy use in excess of 100 kilowatt hours per year; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1648B8068BBB4931B1FAB3125FE2FF9A"><enum>(2)</enum><text>for which there
			 is a significant difference in energy use between the most and least efficient
			 products.</text>
					</paragraph></subsection></section><section id="idA5EC5DEB3FD148BF9E8E50E12D6EB56C"><enum>207.</enum><header>Residential
			 boiler efficiency standards</header><text display-inline="no-display-inline">Section 325(f) of the Energy Policy and
			 Conservation Act (42 U.S.C. 6295(f)) is amended—</text>
				<paragraph id="id065CA2C29E0648A2A7FB3BC2A81DAACA"><enum>(1)</enum><text>by redesignating
			 paragraph (3) as paragraph (4); and</text>
				</paragraph><paragraph id="id850CBCB0697F4F3C98056797D1114215"><enum>(2)</enum><text>by inserting
			 after paragraph (2) the following:</text>

				manufacturer shall not equip gas hot water or steam boilers with
				constant-burning pilot lights.</text>
							</subparagraph><subparagraph id="IDf8b650a9200b4eb8be1168797f6f9929"><enum>(C)</enum><header>Automatic means
				for adjusting water temperature</header>
								<clause id="idFC90E82F7873427F8D1853A119DF9D89"><enum>(i)</enum><header>In
				general</header><text>The manufacturer shall equip each gas, oil, and electric
				hot water boiler (other than a boiler equipped with tankless domestic water
				heating coils) with an automatic means for adjusting the temperature of the
				water supplied by the boiler to ensure that an incremental change in inferred
				heat load produces a corresponding incremental change in the temperature of
				water supplied.</text>
								</clause><clause id="id123CDF7F973B4E6F919076950109CF77"><enum>(ii)</enum><header>Certain
				boilers</header><text>For a boiler that fires at 1 input rate, the requirements
				of this subparagraph may be satisfied by providing an automatic means that
				allows the burner or heating element to fire only when the means has determined
				that the inferred heat load cannot be met by the residual heat of the water in
				the system.</text>
								</clause><clause id="id075F8B316B724D4AAFC3D055E2B32448"><enum>(iii)</enum><header>No inferred
				heat load</header><text>When there is no inferred heat load with respect to a
				hot water boiler, the automatic means described in clauses (i) and (ii) shall
				limit the temperature of the water in the boiler to not more than 140 degrees
				Fahrenheit.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id292EBF87546148A8AE8BDB985835EE88"><enum>(iv)</enum><header>Operation</header><text>A
				boiler described in clause (i) or (ii) shall be operable only when the
				automatic means described in clauses (i), (ii), and (iii) is
				installed.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idAC50081ADAB7427796D5C40E4A51DCD4"><enum>208.</enum><header>Technical
			 corrections</header><text display-inline="no-display-inline">Section
			 321(30)(B)(viii) of the Energy Policy and Conservation Act (42 U.S.C.

			</section><section id="id5AC9744653854B5BB378DA30EAFEBBED"><enum>209.</enum><header>Electric motor
			 efficiency standards</header>
				<subsection id="id4EE2211627B04E6388B5E107E15E326E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 340(13) of the Energy Policy and
			 Conservation Act (42 U.S.C. 6311(13)) is amended by striking subparagraph (A)
			 and inserting the following:</text>

				considered a general purpose motor under section 431.12 of title 10, Code of
				Federal Regulations (or successor regulations).</text>
							</clause><clause id="IDda8ceb3594fb40f69dcc2b156a03d168" indent="up1"><enum>(iii)</enum><text>The term <term>general purpose
				electric motor—subtype II</term> means a motor that, in addition to the design
				elements for a general purpose electric motor—subtype I, incorporates the
				design elements (as established in National Electrical Manufacturers
				Association MG–1 (2006)) (or successor design elements) for any of the
				following:</text>

								</subclause><subclause id="ID76064fbc17fd40808ee4c2bdb23a5fd8"><enum>(IV)</enum><text>A footless motor.</text>
								</subclause><subclause id="ID6882efb2db3744b9b22af09b36e13977"><enum>(V)</enum><text>A vertical solid shaft normal
				thrust (tested in a horizontal configuration).</text>
								</subclause><subclause id="IDaae75b3080804e66b8340a4b6a3da604"><enum>(VI)</enum><text>An 8-pole motor.</text>
								</subclause><subclause id="IDdc017b3e9fdc4f9185de7021fc5868a8"><enum>(VII)</enum><text>A poly-phase motor with voltage

								</clause></subparagraph><subparagraph id="ID0059acf6027d43379cd66ce2042c7cc8"><enum>(B)</enum><header>General purpose
				electric motors—subtype II </header><text>A general purpose electric
				motor—subtype II with a power rating of not less than 1, and not more than 200,
				horsepower manufactured (alone or as a component of another piece of equipment)

				general purpose electric motors</header><text>A NEMA Design B, general purpose
				electric motor with a power rating of not less than 201, and not more than 500,
				horsepower manufactured (alone or as a component of another piece of equipment)
				after the 3-year period beginning on the date of the enactment of this
				subparagraph shall have a nominal full load efficiency established in Table
				12–11 of NEMA MG–1 (2006) (or a successor
				table).</text>

				of at least 1.26; and</text>
								</subclause><subclause id="idE64F4AF4D94D42C19FA79D16A646453A"><enum>(II)</enum><text>a water factor
				of not more than 9.5.</text>
								</subclause></clause><clause id="idD72D03BB4B0B447A9BA8118363EC127F"><enum>(ii)</enum><header>Clothes
				washers manufactured on or after January 1, 2015</header><text>Not later than
				December 31, 2011, the Secretary shall publish a final rule determining whether
				to amend the standards in effect for residential clothes washers manufactured
				on or after January 1, 2015, and including any amended standards.</text>
							</clause></subparagraph><subparagraph id="idB3CDC3F5D6CD4FB9B86F193332EB11E0"><enum>(E)</enum><header>Dishwashers</header>
							<clause id="id89E2F1332C514F5CB94AA654A071D2ED"><enum>(i)</enum><header>Dishwashers
				manufactured on or after January 1, 2010</header><text>A dishwasher
				manufactured on or after January 2, 2010, shall use not more than—</text>
								<subclause id="id227AD06C94BD4B1CA2D9543AE9AB1932"><enum>(I)</enum><text>in the case of a
				standard-size dishwasher, 355 kWh per year or 6.5 gallons of water per cycle;
				and</text>
								</subclause><subclause id="idD34A01D6F4A444E6AF3409F56EBE86E9"><enum>(II)</enum><text>in the case of a
				compact-size dishwasher, 260 kWh per year or 4.5 gallons of water per
				cycle.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9A844C28B49042ECBC336014672EA92D"><enum>(ii)</enum><header>Dishwashers
				manufactured on or after January 1, 2018</header><text>Not later than December
				31, 2015, the Secretary shall publish a final rule determining whether to amend
				the standards for dishwashers manufactured on or after January 2, 2018, and
				including any amended
				standards.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 (b)(1), by inserting <quote>, or products with improved energy efficiency in
			 cold climates,</quote> after <quote>residential Energy Star products</quote>;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63D02B9D6A19433BB98F7FA3EF5796AF"><enum>(2)</enum><text>in subsection
			 (e), by inserting <quote>or product with improved energy efficiency in a cold
			 climate</quote> after <quote>residential Energy Star product</quote> each place
			 it appears.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id95C115FE82B0406CAB202178812CEB42"><enum>212.</enum><header>Deployment of
			 new technologies for high-efficiency consumer products</header>
				<subsection commented="no" display-inline="no-display-inline" id="id3A4136EEF94F4D08AD6E59DE096DBD7E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idBADEFC673B0C47BC95C8B728FD086ACA"><enum>(1)</enum><header>Energy
			 savings</header><text display-inline="yes-display-inline">The term <term>energy
			 savings</term> means megawatt-hours of electricity or million British thermal
			 units of natural gas saved by a product, in comparison to projected energy
			 consumption under the energy efficiency standard applicable to the
			 product.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4CDE0D9FE033447DB038BA3A07ABDF77"><enum>(2)</enum><header>High-efficiency
			 consumer product</header><text display-inline="yes-display-inline">The term
			 <term>high-efficiency consumer product</term> means a product that exceeds the
			 energy efficiency of comparable products available in the market by at least 25
			 percent.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4D7644B35B6E43C484A30D36AAEC4789"><enum>(b)</enum><header>Financial
			 incentives program</header><text display-inline="yes-display-inline">Effective
			 beginning October 1, 2007, the Secretary shall competitively award financial
			 incentives under this section for the manufacture of high-efficiency consumer
			 products.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE92019F2ED12469CAD4DB10B48951558"><enum>(c)</enum><header>Requirements</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idE3D3E0BB9108455E9DDDF30B74CA63B4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 make awards under this section to manufacturers of high-efficiency consumer
			 products, based on the bid of each manufacturer in terms of dollars per
			 megawatt-hour or million British thermal units saved.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA15648AA03F54CBAB1054E55EEA47D31"><enum>(2)</enum><header>Acceptance of
			 bids</header><text display-inline="yes-display-inline">In making awards under
			 this section, the Secretary shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id04F08DFA9FA341F2864003CDB1E93AB0"><enum>(A)</enum><text display-inline="yes-display-inline">solicit bids for reverse auction from
			 appropriate manufacturers, as determined by the Secretary; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2A057B7034B44057BF6383DE22CCADE7"><enum>(B)</enum><text display-inline="yes-display-inline">award financial incentives to the
			 manufacturers that submit the lowest bids that meet the requirements
			 established by the Secretary.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34B504FEEE144610874D8DA79D1E0B43"><enum>(d)</enum><header>Forms of
			 awards</header><text display-inline="yes-display-inline">An award for a
			 high-efficiency consumer product under this section shall be in the form of a
			 lump sum payment in an amount equal to the product obtained by
			 multiplying—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id2A603B7DFBA74465920D77BF52745983"><enum>(1)</enum><text display-inline="yes-display-inline">the amount of the bid by the manufacturer
			 of the high-efficiency consumer product; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF3849828A6804EFDA4D90F8553777E60"><enum>(2)</enum><text display-inline="yes-display-inline">the energy savings during the projected
			 useful life of the high-efficiency consumer product, not to exceed 10 years, as
			 determined under regulations issued by the Secretary.</text>
					</paragraph></subsection></section></title><title id="id1BC8E7FBD768401DAA4E04E2F2DA2619"><enum>III</enum><header>Promoting high
			 efficiency vehicles, advanced batteries, and energy storage</header>
			<section commented="no" display-inline="no-display-inline" id="IDee735546981f40759047e999ff2243cb" section-type="subsequent-section"><enum>301.</enum><header>Lightweight
			 materials research and development</header>
				<subsection commented="no" display-inline="no-display-inline" id="id7BCE9174408E4885B02CF9E4CBADD619"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary shall
			 establish a research and development program to determine ways in which—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id310DDA9194A74A2F9555F0595F1E18CE"><enum>(1)</enum><text display-inline="yes-display-inline">the weight of vehicles may be reduced to
			 improve fuel efficiency without compromising passenger safety; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38EDC6DF9446488993587A8C29B415E7"><enum>(2)</enum><text display-inline="yes-display-inline">the cost of lightweight materials (such as
			 steel alloys and carbon fibers) required for the construction of lighter-weight
			 vehicles may be reduced.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAC41CC53F3164053ACB36F103FACC4FE"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $60,000,000 for each of
			 fiscal years 2007 through 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID622d90a8af0d4c9683450d280f718786"><enum>302.</enum><header>Loan
			 guarantees for fuel-efficient automobile parts manufacturers</header>
				<subsection commented="no" display-inline="no-display-inline" id="idE9BA3E261F3B4920896E8ED5363FD428"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 712(a) of the
			 Energy Policy Act of 2005 (42 U.S.C. 16062(a)) is amended in the second
			 sentence by striking <quote>grants to automobile manufacturers</quote> and
			 inserting <quote>grants and loan guarantees under section 1703 to automobile
			 manufacturers and suppliers</quote>.</text>

			 technology vehicles manufacturing incentive program</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID622d14e987cc49aa960b291f65451d17"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDf1aa56379c304240b0f21f04a225f4ba"><enum>(1)</enum><header>Adjusted
			 average fuel economy</header><text display-inline="yes-display-inline">The term
			 <term>adjusted average fuel economy</term> means the average fuel economy of a
			 manufacturer for all light duty vehicles produced by the manufacturer, adjusted
			 such that the fuel economy of each vehicle that qualifies for an award shall be
			 considered to be equal to the average fuel economy for vehicles of a similar
			 footprint for model year 2002.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3ec0a80f4352445c9d86d643541bec6d"><enum>(2)</enum><header>Advanced
			 technology vehicle</header><text display-inline="yes-display-inline">The term
			 <term>advanced technology vehicle</term> means a light duty vehicle that
			 meets—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID2acdd41068244c109c65bee2ea785620"><enum>(A)</enum><text display-inline="yes-display-inline">the Bin 5 Tier II emission standard
			 established in regulations issued by the Administrator of the Environmental
			 Protection Agency under section 202(i) of the Clean Air Act (42 U.S.C.
			 7521(i)), or a lower-numbered Bin emission standard;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc9290d00c93e4c29bf73b8727138e321"><enum>(B)</enum><text display-inline="yes-display-inline">any new emission standard for fine
			 particulate matter prescribed by the Administrator under that Act (42 U.S.C.
			 7401 et seq.); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID47d85b7f4b474a35a4138d87a4487b15"><enum>(C)</enum><text display-inline="yes-display-inline">at least 125 percent of the average base
			 year combined fuel economy for vehicles of a substantially similar
			 footprint.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43D801FB3CAF44DAB0BB66DFEFA339E6"><enum>(3)</enum><header>Combined fuel
			 economy</header><text>The term <term>combined fuel economy</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id68CA3CFA4BAA421DAB82058AD69D0F74"><enum>(A)</enum><text>the combined
			 city/highway miles per gallon values, as reported in accordance with section
			 32908 of title 49, United States Code; and</text>
						</subparagraph><subparagraph id="id375276A3CA60437B9D20B57E33CC46A1"><enum>(B)</enum><text>in the case of an
			 electric drive vehicle with the ability to recharge from an off-board source,
			 the reported mileage, as determined in a manner consistent with the Society of
			 Automotive Engineers Recommended Practice J1711 or a similar practice
			 recommended by the Secretary.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9786280e8c59453ebbf2d530e295dd9b"><enum>(4)</enum><header>Engineering
			 integration costs</header><text display-inline="yes-display-inline">The term
			 <term>engineering integration costs</term> includes the cost of engineering
			 tasks relating to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID938dd577c56246e08232e3d1e6b34e87"><enum>(A)</enum><text display-inline="yes-display-inline">incorporating qualifying components into
			 the design of advanced technology vehicles; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf796b8ca31874f8db345c9ca869d1fec"><enum>(B)</enum><text display-inline="yes-display-inline">designing new tooling and equipment for
			 production facilities that produce qualifying components or advanced technology
			 vehicles.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7b8f7bd9969d4146890dc91d8c583aef"><enum>(5)</enum><header>Qualifying
			 components</header><text display-inline="yes-display-inline">The term
			 <term>qualifying components</term> means components that the Secretary
			 determines to be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID855b23256ec04185bae08587f0fdfbd9"><enum>(A)</enum><text display-inline="yes-display-inline">specially designed for advanced technology
			 vehicles; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb5284007c8284eb5853134f7ea469a9d"><enum>(B)</enum><text display-inline="yes-display-inline">installed for the purpose of meeting the
			 performance requirements of advanced technology vehicles.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3a69fb3d49e340e5a2902b25adfd5a25"><enum>(b)</enum><header>Manufacturer
			 facility conversion awards</header><text display-inline="yes-display-inline">The Secretary shall provide facility
			 conversion funding awards under this section to automobile manufacturers and
			 component suppliers to pay not more than 30 percent of the cost of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID7f2eabee25614e0b9666ca1ae3d76350"><enum>(1)</enum><text display-inline="yes-display-inline">reequipping or expanding an existing
			 manufacturing facility in the United States to produce—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDa510b6fb453a40ec8228c0b88aa5b4e5"><enum>(A)</enum><text display-inline="yes-display-inline">qualifying advanced technology vehicles;
			 or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID35c8ccf0bdcc4624a70e1faf9a22e097"><enum>(B)</enum><text display-inline="yes-display-inline">qualifying components; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd55b7fc6b98249358eb12c79e23f5dc5"><enum>(2)</enum><text display-inline="yes-display-inline">engineering integration performed in the
			 United States of qualifying vehicles and qualifying components.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID127d1c75df9c4f30aaea246373fd4b81"><enum>(c)</enum><header>Period of
			 availability</header><text display-inline="yes-display-inline">An award under
			 subsection (b) shall apply to—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDb7f076aa3ec14e4795fb2baf4c1affe0"><enum>(1)</enum><text display-inline="yes-display-inline">facilities and equipment placed in service
			 before December 30, 2017; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb5246fb941584a1293b3c512eaf8315e"><enum>(2)</enum><text display-inline="yes-display-inline">engineering integration costs incurred
			 during the period beginning on the date of enactment of this Act and ending on
			 December 30, 2017.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2eed9f477bc5464fb3d2cdd763238de4"><enum>(d)</enum><header>Improvement</header><text display-inline="yes-display-inline">The Secretary shall issue regulations that
			 require that, in order for an automobile manufacturer to be eligible for an
			 award under this section during a particular year, the adjusted average fuel
			 economy of the manufacturer for light duty vehicles produced by the
			 manufacturer during the most recent year for which data are available shall be
			 not less than the average fuel economy for all light duty vehicles of the
			 manufacturer for model year 2002.</text>
				</subsection></section><section id="id5E9EBA57B434432A8FEBEC11EBB03C4B"><enum>304.</enum><header>Energy storage
			 competitiveness</header>
				<subsection id="IDcc215210be08497c97b42f7736b7c67d"><enum>(a)</enum><header>Short
			 title</header><text>This section may be cited as the <quote><short-title>United States Energy Storage Competitiveness Act of
			 2007</short-title></quote>.</text>
				</subsection><subsection id="idC6E22D2AE49E4FF58E5B0B3DD65A5781"><enum>(b)</enum><header>Energy storage
			 systems for motor transportation and electricity transmission and
			 distribution</header>
					<paragraph id="IDec67fe210d2346ff8f4f7def0b7539e7"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
						<subparagraph id="idABC7E0CA95D546DDAB81AC6AA407040E"><enum>(A)</enum><header>Council</header><text>The
			 term <term>Council</term> means the Energy Storage Advisory Council established
			 under paragraph (3).</text>
						</subparagraph><subparagraph id="ID36ea30515cc94cd0a102fc8933709127"><enum>(B)</enum><header>Compressed air
			 energy storage</header><text>The term <term>compressed air energy
			 storage</term> means, in the case of an electricity grid application, the
			 storage of energy through the compression of air.</text>
						</subparagraph><subparagraph id="id26F506E6ECFB4B1B98E860C6F9CD6857"><enum>(C)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Energy.</text>
						</subparagraph><subparagraph id="ID0488f799ac5a421d8ae63f5da09a2d28"><enum>(D)</enum><header>Flywheel</header><text>The
			 term <term>flywheel</term> means, in the case of an electricity grid
			 application, a device used to store rotational kinetic energy.</text>
						</subparagraph><subparagraph id="IDa5dda4ce08874ec198252804bcd83305"><enum>(E)</enum><header>Ultracapacitor</header><text>The
			 term <term>ultracapacitor</term> means an energy storage device that has a
			 power density comparable to conventional capacitors but capable of exceeding
			 the energy density of conventional capacitors by several orders of
			 magnitude.</text>
						</subparagraph></paragraph><paragraph id="IDe223b0d2131c4ff1aade0046f4a91359"><enum>(2)</enum><header>Program</header><text>The
			 Secretary shall carry out a research, development, and demonstration program to
			 support the ability of the United States to remain globally competitive in
			 energy storage systems for motor transportation and electricity transmission
			 and distribution.</text>
					</paragraph><paragraph id="ID628ceaebd8c94d8c934eb51a2cc969b1"><enum>(3)</enum><header>Energy Storage
			 Advisory Council</header>
						<subparagraph id="ID7902b4ccb6a74553b0a09c6a7a6094f3"><enum>(A)</enum><header>Establishment</header><text>Not
			 later than 90 days after the date of enactment of this Act, the Secretary shall
			 establish an Energy Storage Advisory Council.</text>
						</subparagraph><subparagraph id="ID5e99f86cebb949a8b91eb1e0bd70e755"><enum>(B)</enum><header>Composition</header>
							<clause id="idC455273B91B946F98BF8C9478C44D289"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the Council shall consist of not
			 less than 15 individuals appointed by the Secretary, based on recommendations
			 of the National Academy of Sciences.</text>
							</clause><clause id="id5E871D1384714D2FA47122FD9F71F56F"><enum>(ii)</enum><header>Energy storage
			 industry</header><text>The Council shall consist primarily of representatives
			 of the energy storage industry of the United States.</text>
							</clause><clause id="id6E9A7F92D8DB42438C5ACAB3E4F1F95D"><enum>(iii)</enum><header>Chairperson</header><text>The
			 Secretary shall select a Chairperson for the Council from among the members
			 appointed under clause (i)</text>
							</clause></subparagraph><subparagraph id="IDd62f44a046514d66b2e34e8d2831dad2"><enum>(C)</enum><header>Meetings</header>
							<clause id="idD1667F7219554D819698DB73411BDF06"><enum>(i)</enum><header>In
			 general</header><text>The Council shall meet not less than once a year.</text>
							</clause><clause id="ID761332d2482148fa8f4912c3a47039a6"><enum>(ii)</enum><header>Federal
			 Advisory Committee Act</header><text>The Federal Advisory Committee Act (5
			 U.S.C. App. 2) shall apply to a meeting of the Council.</text>
							</clause></subparagraph><subparagraph id="IDc9d22d6509de457fb7055a3d4a0581bc"><enum>(D)</enum><header>Plans</header><text>No
			 later than 1 year after the date of enactment of this Act, in conjunction with
			 the Secretary, the Council shall develop 5-year plans for integrating basic and
			 applied research so that the United States retains a globally competitive
			 domestic energy storage industry for motor transportation and electricity
			 transmission and distribution.</text>
						</subparagraph><subparagraph id="ID16f57840440c49e7932561b349a63b19"><enum>(E)</enum><header>Review</header><text>The
			 Council shall—</text>
							<clause id="ID3bc18b5a9be54b8d8f0c2d0c77932aed"><enum>(i)</enum><text>assess the
			 performance of the Department in meeting the goals of the plans developed under
			 subparagraph (D); and</text>
							</clause><clause id="ID2f3f35d35f044cfba46b78e955bdbcaa"><enum>(ii)</enum><text>make specific
			 recommendations to the Secretary on programs or activities that should be
			 established or terminated to meet those goals.</text>
							</clause></subparagraph></paragraph><paragraph id="IDdb78f065cc5d44bd884a7a474e77d6a9"><enum>(4)</enum><header>Basic research
			 program</header>
						<subparagraph id="IDf57bf95b2fad4d95942bcd8dda7bc674"><enum>(A)</enum><header>Basic
			 research</header><text>The Secretary shall conduct a basic research program on
			 energy storage systems to support motor transportation and electricity
			 transmission and distribution, including—</text>
							<clause id="ID229ffd4049fc43c78ac72f0601340d97"><enum>(i)</enum><text>materials
			 design;</text>
							</clause><clause id="ID41d17934dff147d0aa742dd192a3a0cf"><enum>(ii)</enum><text>materials
			 synthesis and characterization;</text>
							</clause><clause id="ID7ca20cebbf5045738fea6e6899cc3a9b"><enum>(iii)</enum><text>electrolytes,
			 including bioelectrolytes;</text>
							</clause><clause id="IDc96090b3890847388050d5d539847956"><enum>(iv)</enum><text>surface and
			 interface dynamics; and</text>
							</clause><clause id="ID2b43a08ae62c4666a799fdaf4a402c35"><enum>(v)</enum><text>modeling and
			 simulation.</text>
							</clause></subparagraph><subparagraph id="IDb46c7dfb247b4913a2283541f59788e9"><enum>(B)</enum><header>Nanoscience
			 centers</header><text>The Secretary shall ensure that the nanoscience centers
			 of the Department—</text>
							<clause id="ID3ffd734664b34c92a4460058602e27b8"><enum>(i)</enum><text>support research
			 in the areas described in subparagraph (A), as part of the mission of the
			 centers; and</text>
							</clause><clause id="IDd4d56353a9ad4abcbfc9b64c17667193"><enum>(ii)</enum><text>coordinate
			 activities of the centers with activities of the Council.</text>
							</clause></subparagraph></paragraph><paragraph id="ID1ac682a7fc2e4036805f2d4de838f109"><enum>(5)</enum><header>Applied
			 research program</header><text>The Secretary shall conduct an applied research
			 program on energy storage systems to support motor transportation and
			 electricity transmission and distribution technologies, including—</text>
						<subparagraph id="IDdd8ff8e19755400c8ef9b51407ce3c9b"><enum>(A)</enum><text>ultracapacitors;</text>
						</subparagraph><subparagraph id="ID154e6923827b460eb091260b8dd5f84b"><enum>(B)</enum><text>flywheels;</text>
						</subparagraph><subparagraph id="ID83a6942f7f474840ab9ecfec2a45e38d"><enum>(C)</enum><text>compressed air
			 energy systems;</text>
						</subparagraph><subparagraph id="IDfeda03be724242e686a005438d46bc02"><enum>(D)</enum><text>power
			 conditioning electronics; and</text>
						</subparagraph><subparagraph id="ID3e905e5603064c1fa823dfc510f55e0e"><enum>(E)</enum><text>manufacturing
			 technologies for energy storage systems.</text>
						</subparagraph></paragraph><paragraph id="ID1426c59317364ccdb1f38d0c79b9b3a0"><enum>(6)</enum><header>Energy storage
			 research centers</header>
						<subparagraph id="id607292CDFFD54CD0980DCC0ED6D42F41"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall establish, through competitive bids,
			 4 energy storage research centers to translate basic research into applied
			 technologies to advance the capability of the United States to maintain a
			 globally competitive posture in energy storage systems for motor transportation
			 and electricity transmission and distribution.</text>
						</subparagraph><subparagraph id="ID1828b3cdc9044ff28947ec754b6b0a4a"><enum>(B)</enum><header>Program
			 management</header><text>The centers shall be jointly managed by the Under
			 Secretary for Science and the Under Secretary of Energy of the
			 Department.</text>
						</subparagraph><subparagraph id="ID5b46b7a56264470db177e20ba80ff607"><enum>(C)</enum><header>Participation
			 agreements</header><text>As a condition of participating in a center, a
			 participant shall enter into a participation agreement with the center that
			 requires that activities conducted by the participant for the center promote
			 the goal of enabling the United States to compete successfully in global energy
			 storage markets.</text>
						</subparagraph><subparagraph id="ID11e2c0c56d794bee83c95c391bdb99d3"><enum>(D)</enum><header>Plans</header><text>A
			 center shall conduct activities that promote the achievement of the goals of
			 the plans of the Council under paragraph (3)(D).</text>
						</subparagraph><subparagraph id="ID58d4866114024f7091925ad10fc7c426"><enum>(E)</enum><header>Cost
			 sharing</header><text>In carrying out this paragraph, the Secretary shall
			 require cost-sharing in accordance with section 988 of the Energy Policy Act of
			 2005 (42 U.S.C. 16352).</text>
						</subparagraph><subparagraph id="ID5a64d38e7a6f464b81026f327dae4494"><enum>(F)</enum><header>National
			 laboratories</header><text>A national laboratory (as defined in section 2 of
			 the Energy Policy Act 2005 (42 U.S.C. 15801)) may participate in a center
			 established under this paragraph as part of a cooperative research and
			 development agreement (as defined in section 12(d) of the Stevenson-Wydler
			 Technology Innovation Act of 1980 (15 U.S.C. 3710a(d))).</text>
						</subparagraph><subparagraph id="IDa120d9ba89604aa9b4c235a082619732"><enum>(G)</enum><header>Intellectual
			 property</header><text>A participant in a center under this paragraph shall
			 have a royalty-free, exclusive nontransferable license to intellectual property
			 that the center invents from funding received under this subsection.</text>
						</subparagraph></paragraph><paragraph id="IDe6e25114f9e94002bd1290b21fea7cc6"><enum>(7)</enum><header>Review by
			 National Academy of Sciences</header><text>Not later than 5 years after the
			 date of enactment of this Act, the Secretary shall offer to enter into an
			 arrangement with the National Academy of Sciences to assess the performance of
			 the Department in making the United States globally competitive in energy
			 storage systems for motor transportation and electricity transmission and
			 distribution.</text>
					</paragraph><paragraph id="IDb5c1b18a6b224704979b23578dd5544c"><enum>(8)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to
			 carry out—</text>
						<subparagraph id="IDa9c428927ef046e29445b7ab2a8f9289"><enum>(A)</enum><text>the basic
			 research program under paragraph (4) $50,000,000 for each of fiscal years 2008
			 through 2017;</text>
						</subparagraph><subparagraph id="IDf13e97fc88db48ccaf445868ad39983d"><enum>(B)</enum><text>the applied
			 research program under paragraph (5) $80,000,000 for each of fiscal years 2008
			 through 2017; and;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID54c93013844b4b40bb13354392001214"><enum>(C)</enum><text>the energy
			 storage research center program under paragraph (6) $100,000,000 for each of
			 fiscal years 2008 through 2017.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAD5AA08E70274F3A849B64307FC0CA50"><enum>(c)</enum><header>Advanced
			 battery and electric vehicle technology program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID104adb54eb5d4f7d8b349e7d8176763d"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID09b336f7fdfd4edbbe47f256df24ad7f"><enum>(A)</enum><header>Battery</header><text display-inline="yes-display-inline">The term <term>battery</term> means an
			 electrochemical energy storage device powered directly by electrical
			 current.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcc2d65b6205c4e94b8f07c052da6c3c9"><enum>(B)</enum><header>Electric drive
			 transportation technology</header><text display-inline="yes-display-inline">The
			 term <term>electric drive transportation technology</term> means vehicle
			 systems that use stored electrical energy to provide motive power, including
			 electric motors and drivetrain systems.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1516f1b46b964dc2a5f2525ffd2f874b"><enum>(2)</enum><header>Program</header><text display-inline="yes-display-inline">The Secretary shall conduct a program of
			 research, development, demonstration, and commercial application for batteries
			 and electric drive transportation technology, including—</text>
						<subparagraph id="IDb4bd22d31f4d4ec0b38b8b28d576c50e"><enum>(A)</enum><text>batteries;</text>
						</subparagraph><subparagraph id="IDe91cd97f90264247bc12266bb9c16287"><enum>(B)</enum><text>on-board and
			 off-board charging components;</text>
						</subparagraph><subparagraph id="IDde9c47e532734ce590047e7dd07b6a28"><enum>(C)</enum><text>drivetrain
			 systems;</text>
						</subparagraph><subparagraph id="ID273745b441dc49039b5d8de727ddc4f1"><enum>(D)</enum><text>vehicles systems
			 integration; and</text>
						</subparagraph><subparagraph id="IDa0188856148a471e8bcf87a287006541"><enum>(E)</enum><text>control systems,
			 including systems that optimize for—</text>
							<clause id="IDe24f3f983ea5469eb109b41600c5996e"><enum>(i)</enum><text>prolonging
			 battery life;</text>
							</clause><clause id="ID9d2ebf4595ba423da68c59ad0ab37e73"><enum>(ii)</enum><text>reduction of
			 petroleum consumption; and</text>
							</clause><clause id="IDa6e372e57e9247a18284507cba43db7e"><enum>(iii)</enum><text>reduction of
			 fossil fuel emissions.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc33dc6772f624a6bbdc9b07336b3acc7"><enum>(3)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this subsection $200,000,000 for
			 each of fiscal years 2007 through 2012.</text>
					</paragraph></subsection></section></title><title id="id464E742877534F0AB87E0BDFD099E459"><enum>IV</enum><header>Setting energy
			 efficiency goals</header>
			<section commented="no" display-inline="no-display-inline" id="ID55805116cb7a470a84ad931e64b385a4" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">National goals for energy savings in
			 transportation</header>
				<subsection commented="no" display-inline="no-display-inline" id="id63A25345D5494223891FDB62B83C5AFB"><enum>(a)</enum><header display-inline="yes-display-inline">Goals</header><text display-inline="yes-display-inline">The goals of the United States are to
			 reduce gasoline usage in the United States from the levels projected under
			 subsection (b) by—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id27CEB8F32DF7499789A19F6DBC1FAA60"><enum>(1)</enum><text display-inline="yes-display-inline">20 percent by calendar year 2017;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8041951E8EE94DB2A3C5C9371E9BFC76"><enum>(2)</enum><text display-inline="yes-display-inline">35 percent by calendar year 2025;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA13A55D3C73446FADEAEB3DE504994F"><enum>(3)</enum><text>45 percent by
			 calendar year 2030.</text>
					</paragraph></subsection><subsection id="ID9aeaa0cb3cde4b3289843c723968cff1"><enum>(b)</enum><header>Measurement</header><text>For
			 purposes of subsection (a), reduction in gasoline usage shall be measured from
			 the estimates for each year in subsection (a) contained in the reference case
			 in the report of the Energy Information Administration entitled <quote>Annual
			 Energy Outlook 2007</quote>.</text>
				</subsection><subsection id="IDc2a561fa3d1c432c9fd04f110c175ce6"><enum>(c)</enum><header>Strategic
			 plan</header>
					<paragraph id="ID77a83065c43f4ab4a10871e6c4b01d7c"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary, in cooperation with the Administrator of the Environmental
			 Protection Agency and the heads of other appropriate Federal agencies, shall
			 develop a strategic plan to achieve the national goals for reduction in
			 gasoline usage established under subsection (a).</text>
					</paragraph><paragraph id="IDc324556de7d249bebd33e00b08459fc3"><enum>(2)</enum><header>Public input
			 and comment</header><text>The Secretary shall develop the plan in a manner that
			 provides appropriate opportunities for public comment.</text>
					</paragraph></subsection><subsection id="IDe674aa2af7ac4fdaa2aaf77b781acdf8"><enum>(d)</enum><header>Plan
			 contents</header><text>The strategic plan shall—</text>
					<paragraph id="ID307111a6c6344ac08ca235340480e903"><enum>(1)</enum><text>establish future
			 regulatory, funding, and policy priorities to ensure compliance with the
			 national goals;</text>
					</paragraph><paragraph id="ID77564d9210604c128185081c041f3413"><enum>(2)</enum><text>include energy
			 savings estimates for each sector; and</text>
					</paragraph><paragraph id="ID57120215e39442cda1c171f6f1f88d72"><enum>(3)</enum><text>include data
			 collection methodologies and compilations used to establish baseline and energy
			 savings data.</text>
					</paragraph></subsection><subsection id="ID2e1fde2d68754868ae5bc6812c70df7c"><enum>(e)</enum><header>Plan
			 updates</header>
					<paragraph id="ID87cb071641164b769009f362b04877e9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall—</text>
						<subparagraph id="idAE3CD0F835F94CB382E0CA20F463A445"><enum>(A)</enum><text>update the
			 strategic plan biennially; and</text>
						</subparagraph><subparagraph id="id18B81D0467554AC38A140AB7D39BD84A"><enum>(B)</enum><text>include the
			 updated strategic plan in the national energy policy plan required by section
			 801 of the Department of Energy Organization Act (42 U.S.C. 7321).</text>
						</subparagraph></paragraph><paragraph id="IDf0a5b1637e9d45bfb26a2c09db95131f"><enum>(2)</enum><header>Contents</header><text>In
			 updating the plan, the Secretary shall—</text>
						<subparagraph id="IDaab6f395d5354ff793e8ca6b5d41d91d"><enum>(A)</enum><text>report on
			 progress made toward implementing efficiency policies to achieve the national
			 goals established under subsection (a); and</text>
						</subparagraph><subparagraph id="ID65614dffeba949628b708a1753daaea2"><enum>(B)</enum><text>to the maximum
			 extent practicable, verify energy savings resulting from the policies.</text>
						</subparagraph></paragraph></subsection><subsection id="IDb2937e9cb8ed4b56a5ae2126cd4361d2"><enum>(f)</enum><header>Report to
			 Congress and public</header><text>The Secretary shall submit to Congress, and
			 make available to the public, the initial strategic plan developed under
			 subsection (c) and each updated plan.</text>
				</subsection></section><section id="IDf3ab22ce3c8a46ca89b8ef9c1f24d747"><enum>402.</enum><header>National
			 energy efficiency improvement goals</header>
				<subsection id="idEE9EBC0E04404720B22CB991F77758BD"><enum>(a)</enum><header>Goals</header><text>The
			 goals of the United States are—</text>
					<paragraph id="id271154BBA1C74F028A842552D9D8CE51"><enum>(1)</enum><text>to achieve an
			 improvement in the overall energy productivity of the United States (measured
			 in gross domestic product per unit of energy input) of at least 2.5 percent per
			 year by the year 2012; and</text>
					</paragraph><paragraph id="idEF1001404FC6416BA4A92EA81C8797AC"><enum>(2)</enum><text>to maintain that
			 annual rate of improvement each year through 2030.</text>
					</paragraph></subsection><subsection id="ID34b60f3826ec4114ae08ae74ef8e8a9f"><enum>(b)</enum><header>Strategic
			 plan</header>
					<paragraph id="idF1BAF29290BE4D22B77A279B8A6D5E7A"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary, in cooperation with the Administrator of the Environmental
			 Protection Agency and the heads of other appropriate Federal agencies, shall
			 develop a strategic plan to achieve the national goals for improvement in
			 energy productivity established under subsection (a).</text>
					</paragraph><paragraph id="id73EB05BDF73442D59672510EDA46FDE8"><enum>(2)</enum><header>Public input
			 and comment</header><text>The Secretary shall develop the plan in a manner that
			 provides appropriate opportunities for public input and comment.</text>
					</paragraph></subsection><subsection id="IDcfe6b0b69a8f446f8feaed1e254ee265"><enum>(c)</enum><header>Plan
			 contents</header><text>The strategic plan shall—</text>
					<paragraph id="IDf57dd67a9e7f4e8e8142c5ac8b65f0ce"><enum>(1)</enum><text>establish future
			 regulatory, funding, and policy priorities to ensure compliance with the
			 national goals;</text>
					</paragraph><paragraph id="ID3289f7dbb8f74cdda24089d59300e101"><enum>(2)</enum><text>include energy
			 savings estimates for each sector; and</text>
					</paragraph><paragraph id="ID0dcf7bfa7e8043868e53bed987696695"><enum>(3)</enum><text>include data
			 collection methodologies and compilations used to establish baseline and energy
			 savings data.</text>
					</paragraph></subsection><subsection id="IDf44055b42f7d4d9cb618757352f2be5f"><enum>(d)</enum><header>Plan
			 updates</header>
					<paragraph id="ID063e960819d840bb86d15c7c522d8548"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall—</text>
						<subparagraph id="idF85B6ECE79604031BEA9800DCBC95A3F"><enum>(A)</enum><text>update the
			 strategic plan biennially; and</text>
						</subparagraph><subparagraph id="idEAC69CBE05B94F10A57DAD5312E315C4"><enum>(B)</enum><text>include the
			 updated strategic plan in the national energy policy plan required by section
			 801 of the Department of Energy Organization Act (42 U.S.C. 7321).</text>
						</subparagraph></paragraph><paragraph id="id24C5632472E14B8C9A2FF752BD345430"><enum>(2)</enum><header>Contents</header><text>In
			 updating the plan, the Secretary shall—</text>
						<subparagraph id="ID79344782263340179aa6ac07e7c33f4c"><enum>(A)</enum><text>report on
			 progress made toward implementing efficiency policies to achieve the national
			 goals established under subsection (a); and</text>
						</subparagraph><subparagraph id="ID825131d0b5504620b09eb899584197ee"><enum>(B)</enum><text>verify, to the
			 maximum extent practicable, energy savings resulting from the policies.</text>
						</subparagraph></paragraph></subsection><subsection id="IDefd8529e97cd4da3a27ecdac99ebf117"><enum>(e)</enum><header>Report to
			 Congress and public</header><text>The Secretary shall submit to Congress, and
			 make available to the public, the initial strategic plan developed under
			 subsection (b) and each updated plan.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9da2cffd4f924c1680cb60acd9914454"><enum>(f)</enum><header>National Action
			 Plan on Energy Efficiency</header><text>The Administrator of the Environmental
			 Protection Agency and the Secretary, with the heads of other Federal agencies
			 as appropriate, shall continue to support maintenance and updating of the
			 National Action Plan on Energy Efficiency to help inform the development of the
			 strategic plan under subsection (b).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID6e3d81dc2dce4e339136cdfd81c8e520"><enum>403.</enum><header display-inline="yes-display-inline">Nationwide media campaign to increase
			 energy efficiency</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID808837a649a14c1eaaad1989c2ca5ac6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant
			 Secretary for Energy Efficiency and Renewable Energy (referred to in this
			 section as the <quote>Secretary</quote>), shall develop and conduct a national
			 media campaign for the purpose of increasing energy efficiency throughout the
			 economy of the United States over the next decade.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2b5abef6c02d440ca84b717d45d593cd"><enum>(b)</enum><header display-inline="yes-display-inline">Contract with entity</header><text display-inline="yes-display-inline">The Secretary shall carry out subsection
			 (a) directly or through—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDdf9a28db8f48428393c78dae1dd5c254"><enum>(1)</enum><text display-inline="yes-display-inline">competitively bid contracts with 1 or more
			 nationally recognized media firms for the development and distribution of
			 monthly television, radio, and newspaper public service announcements;
			 or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6ba69fbe9a204f82a7ceb536784344d1"><enum>(2)</enum><text display-inline="yes-display-inline">collective agreements with 1 or more
			 nationally recognized institutes, businesses, or nonprofit organizations for
			 the funding, development, and distribution of monthly television, radio, and
			 newspaper public service announcements.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID16bbe73472dc421491e5776b756681d8"><enum>(c)</enum><header display-inline="yes-display-inline">Use of funds</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID2f0e4992e9ce40e1aa89cbf7c6b0a259"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Amounts made available to carry out this
			 section shall be used for the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDbf469a04815c461180b8ef31e29d3c71"><enum>(A)</enum><header display-inline="yes-display-inline">Advertising costs</header>
							<clause commented="no" display-inline="no-display-inline" id="IDcd3a39b6adb240dab512244f68e11e37"><enum>(i)</enum><text display-inline="yes-display-inline">The purchase of media time and
			 space.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID9ed08941b45e43f3985f795fbd05c804"><enum>(ii)</enum><text display-inline="yes-display-inline">Creative and talent costs.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDfa088580d94c4ee39bf1549d0405c3ba"><enum>(iii)</enum><text display-inline="yes-display-inline">Testing and evaluation of
			 advertising.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDeb1bebfde273479987565114c4bc4c08"><enum>(iv)</enum><text display-inline="yes-display-inline">Evaluation of the effectiveness of the
			 media campaign.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID3e88a4654ae648308c7ad704000f4dbc"><enum>(v)</enum><text display-inline="yes-display-inline">The negotiated fees for the winning bidder
			 on requests from proposals issued either by the Secretary for purposes
			 otherwise authorized in this section.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6033ec0e83ef449a94213ad8d914bc11"><enum>(vi)</enum><text display-inline="yes-display-inline">Entertainment industry outreach,
			 interactive outreach, media projects and activities, public information, news
			 media outreach, and corporate sponsorship and participation.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID95b5d4caa5f44041bc28910f021b32f9"><enum>(B)</enum><header display-inline="yes-display-inline">Administrative costs</header><text display-inline="yes-display-inline">Operational and management expenses.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7652e04697d04971a7455c27c8ffcf32"><enum>(2)</enum><header display-inline="yes-display-inline">Limitations</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary
			 shall allocate not less than 85 percent of funds made available under
			 subsection (e) for each fiscal year for the advertising functions specified
			 under paragraph (1)(A).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf6b1e5e5b7c142149ff6e7d8d12a8f6a"><enum>(d)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Secretary shall annually submit to
			 Congress a report that describes—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID743f49f4bafd484183995cd58d3be31f"><enum>(1)</enum><text display-inline="yes-display-inline">the strategy of the national media campaign
			 and whether specific objectives of the campaign were accomplished,
			 including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDac692a3e31b041c5a9e6c8f7cfb2e73c"><enum>(A)</enum><text display-inline="yes-display-inline">determinations concerning the rate of
			 change of energy consumption, in both absolute and per capita terms; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77330cd79d7a41b1a319c7fd66d99ff4"><enum>(B)</enum><text display-inline="yes-display-inline">an evaluation that enables consideration
			 whether the media campaign contributed to reduction of energy
			 consumption;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa553345ce024238b9674312c668205d"><enum>(2)</enum><text display-inline="yes-display-inline">steps taken to ensure that the national
			 media campaign operates in an effective and efficient manner consistent with
			 the overall strategy and focus of the campaign;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa29748c66a40449785c3b8b7017a5b69"><enum>(3)</enum><text display-inline="yes-display-inline">plans to purchase advertising time and
			 space;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc23fc0f608de4f2a83b93cb6acfe2b8e"><enum>(4)</enum><text display-inline="yes-display-inline">policies and practices implemented to
			 ensure that Federal funds are used responsibly to purchase advertising time and
			 space and eliminate the potential for waste, fraud, and abuse; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe46280fc6d3b489fa0e98ca0af9833c8"><enum>(5)</enum><text display-inline="yes-display-inline">all contracts or cooperative agreements
			 entered into with a corporation, partnership, or individual working on behalf
			 of the national media campaign.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID86a041f51992400e89f281a9ad8ab94d"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $5,000,000 for each of
			 fiscal years 2008 through 2012.</text>

			 conservation requirements</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id90D85BFA3A564C829E8F1A3C4F287BDE"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part J of title III
			 of the Energy Policy and Conservation Act (42 U.S.C. 6374 et seq.) is amended
			 by adding at the end the following:</text>

									<paragraph commented="no" display-inline="no-display-inline" id="id85196DE3C5A44BE4ADED6E391D579EF2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				issue regulations for Federal fleets subject to section 400AA requiring that
				not later than October 1, 2015, each Federal agency achieve at least a 20
				percent reduction in petroleum consumption, and that each Federal agency
				increase alternative fuel consumption by 10 percent annually, as calculated
				from the baseline established by the Secretary for fiscal year 2005.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92725F17DCB841D9B9460369296651D6"><enum>(2)</enum><header>Plan</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="id028A3617C2A94CD1BC8F79E3AA931869"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">The regulations shall require each Federal
				agency to develop a plan to meet the required petroleum reduction levels and
				the alternative fuel consumption increases.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD7BC8ADC5A164C70BA3877C6DC115E81"><enum>(B)</enum><header>Measures</header><text display-inline="yes-display-inline">The plan may allow an agency to meet the
				required petroleum reduction level through—</text>
											<clause commented="no" display-inline="no-display-inline" id="idCAC28535316049A794721FD664FC44EF"><enum>(i)</enum><text display-inline="yes-display-inline">the use of alternative fuels;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idECEA30BC7669401EB332F83DE4EB2CBE"><enum>(ii)</enum><text display-inline="yes-display-inline">the acquisition of vehicles with higher
				fuel economy, including hybrid vehicles and plug–in hybrid vehicles if the
				vehicles are commercially available;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id5B0E2304E68D47E6A5A273ECD54EDEB6"><enum>(iii)</enum><text display-inline="yes-display-inline">the substitution of cars for light
				trucks;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idF1EFBBDBF1DF4C2DBDE2E8B482EB3AAA"><enum>(iv)</enum><text display-inline="yes-display-inline">an increase in vehicle load factors;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id2B5348FE6B5F4B58B8B8093EC4520DA1"><enum>(v)</enum><text display-inline="yes-display-inline">a decrease in vehicle miles
				traveled;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id1D62279A6FB043AE949B2A4836F58785"><enum>(vi)</enum><text display-inline="yes-display-inline">a decrease in fleet size; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id97AF3CE4A47A4ADAAF8B9B2C57977239"><enum>(vii)</enum><text display-inline="yes-display-inline">other measures.</text>
											</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA9DED11554B241FEBD2B20DC30F8579D"><enum>(b)</enum><header>Federal
				employee incentive programs for reducing petroleum consumption</header>
									<paragraph commented="no" display-inline="no-display-inline" id="id2502429CF8B84C3D99C25496698354F2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each Federal agency
				shall actively promote incentive programs that encourage Federal employees and
				contractors to reduce petroleum through the use of practices such as—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idACC6D90CB0BB4CEBAFEC79A1E0691CC5"><enum>(A)</enum><text display-inline="yes-display-inline">telecommuting;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45C695B9B5EB4D7A999550C4D3A5DA8F"><enum>(B)</enum><text display-inline="yes-display-inline">public transit;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3522EF13410747F4BBC4C4D4CFB415D0"><enum>(C)</enum><text display-inline="yes-display-inline">carpooling; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3FBE27D715A14CFFB4725249F1809583"><enum>(D)</enum><text display-inline="yes-display-inline">bicycling.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8721026B6E064DD88228658DFD747084"><enum>(2)</enum><header>Monitoring and
				support for incentive programs</header><text display-inline="yes-display-inline">The Administrator of General Services, the
				Director of the Office of Personnel Management, and the Secretary of Energy
				shall monitor and provide appropriate support to agency programs described in
				paragraph (1).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DBD592B3FAB46B8B8928E02D1F7AC0A"><enum>(3)</enum><header>Recognition</header><text display-inline="yes-display-inline">The Secretary may establish a program under
				which the Secretary recognizes private sector employers and State and local
				governments for outstanding programs to reduce petroleum usage through
				practices described in paragraph (1).</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEE9DA97DE5814DA7BD90D309B415E2BF"><enum>(c)</enum><header>Replacement
				tires</header>
									<paragraph commented="no" display-inline="no-display-inline" id="id24BFDD37E199440D8B9E85B7722C663E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				paragraph (2), the regulations issued under subsection (a)(1) shall include a
				requirement that, to the maximum extent practicable, each Federal agency
				purchase energy-efficient replacement tires for the respective fleet vehicles
				of the agency.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64897B1D689244D0BBD8FF1552B26D5E"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This section does not apply to—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id0D12562DCF7C4858BC56BEBD3BDED857"><enum>(A)</enum><text display-inline="yes-display-inline">law enforcement motor vehicles;</text>

				on compliance</header><text display-inline="yes-display-inline">The Secretary
				shall submit to Congress an annual report that summarizes actions taken by
				Federal agencies to comply with this

			 following:</text>

				through the Secretary, shall ensure that, of the total quantity of domestic
				electric energy the Federal Government consumes during any fiscal year, the
				following percentages shall be renewable energy from facilities placed in
				service after January 1, 1999:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDede5c02050ee477e81f847b00534d543"><enum>(A)</enum><text display-inline="yes-display-inline">Not less than 10 percent in fiscal year

				complex</header><text display-inline="yes-display-inline">The Architect of the
				Capitol, in consultation with the Secretary, shall ensure that, of the total
				quantity of electric energy the Capitol complex consumes during any fiscal
				year, the percentages prescribed in paragraph (1) shall be renewable
				energy.</text>
						</paragraph><paragraph id="ID0457b4371ce94b53850e1a0b12341d8b"><enum>(3)</enum><header>Waiver
				authority</header><text>The President may reduce or waive the requirement under
				paragraph (1) on an annual basis, if the President determines that the average
				governmentwide cost per kilowatt hour of complying with paragraph (1) will be
				more than 50 percent higher than the average governmentwide cost per
				kilowatt-hour for electric energy in the preceding
				year.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id9E434DB5CB584364A6E8A811E520D56E"><enum>503.</enum><header>Energy savings
			 performance contracts</header>
				<subsection commented="no" display-inline="no-display-inline" id="id16ABBAEE5CB940E7ADB656265ED8309F"><enum>(a)</enum><header>Retention of
			 savings</header><text display-inline="yes-display-inline">Section 546(c) of the
			 National Energy Conservation Policy Act (42 U.S.C. 8256(c)) is amended by
			 striking paragraph (5).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id2622C0551F4145C78D2D9D0791223EB3"><enum>(b)</enum><header>Financing

				contract under this title, a Federal agency may—</text>

				services and conservation measures under the contract; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idC5947E2EA47E47989DAE8EB5E62D874B"><enum>(ii)</enum><text display-inline="yes-display-inline">provide all or part of the financing
				necessary to carry out the
				contract.</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1d93805990d945baac6773610f47016a"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9C5864ED58984653B2825B6E27D55F39"><enum>(A)</enum><header>Nonbuilding
			 application</header><text display-inline="yes-display-inline">The term
			 <term>nonbuilding application</term> means—</text>
							<clause commented="no" display-inline="no-display-inline" id="idFA4CC58C62F74D48AC578199B5E7B770"><enum>(i)</enum><text display-inline="yes-display-inline">any class of vehicles, devices, or
			 equipment that is transportable under the power of the applicable vehicle,
			 device, or equipment by land, sea, or air and that consumes energy from any
			 fuel source for the purpose of—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idB40A0C3160024C4FA7D14F1ADC0E2B06"><enum>(I)</enum><text display-inline="yes-display-inline">that transportation; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id8BEE29530175495B9D67C0BBEFEB152A"><enum>(II)</enum><text display-inline="yes-display-inline">maintaining a controlled environment within
			 the vehicle, device, or equipment; and</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID5653dc2878d84370b8701753a628bbb0"><enum>(ii)</enum><text display-inline="yes-display-inline">any federally-owned equipment used to
			 generate electricity or transport water.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2889a9326bb54ddba43226a1a7fa8a03"><enum>(B)</enum><header>Secondary
			 savings</header>
							<clause commented="no" display-inline="no-display-inline" id="idDA29544593AA463B8F8C7072E9B285BE"><enum>(i)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>secondary savings</term> means additional energy or cost savings that are
			 a direct consequence of the energy savings that result from the energy
			 efficiency improvements that were financed and implemented pursuant to an
			 energy savings performance contract.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9C75DA886102420BBF4F69DAFEFC417F"><enum>(ii)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>secondary savings</term>
			 includes—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id8E190CE478084F619E2B07E1A68E237A"><enum>(I)</enum><text display-inline="yes-display-inline">energy and cost savings that result from a
			 reduction in the need for fuel delivery and logistical support;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id019838DA9CE74F46B093DAC497AAF541"><enum>(II)</enum><text display-inline="yes-display-inline">personnel cost savings and environmental
			 benefits; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id8A6CABAB87964AC99E31965E9F7E2D4A"><enum>(III)</enum><text display-inline="yes-display-inline">in the case of electric generation
			 equipment, the benefits of increased efficiency in the production of
			 electricity, including revenues received by the Federal Government from the
			 sale of electricity so produced.</text>
								</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB851792A473B4344B161D9CD0DFEC070"><enum>(2)</enum><header>Study</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id951D9AFB4E244187822E8828F74207CB"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary and the
			 Secretary of Defense shall jointly conduct, and submit to Congress and the
			 President a report of, a study of the potential for the use of energy savings
			 performance contracts to reduce energy consumption and provide energy and cost
			 savings in nonbuilding applications.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id627082CE4B4E47748EDD1124C7416013"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The study under this subsection shall
			 include—</text>
							<clause commented="no" display-inline="no-display-inline" id="id3CD9D27EF44741E6A0F1FE04CF22CABF"><enum>(i)</enum><text display-inline="yes-display-inline">an estimate of the potential energy and
			 cost savings to the Federal Government, including secondary savings and
			 benefits, from increased efficiency in nonbuilding applications;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID8e691f75d9324c599bf4b248c9086ed2"><enum>(ii)</enum><text display-inline="yes-display-inline">an assessment of the feasibility of
			 extending the use of energy savings performance contracts to nonbuilding
			 applications, including an identification of any regulatory or statutory
			 barriers to such use; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID74df3257ae424577b70816f30385a698"><enum>(iii)</enum><text display-inline="yes-display-inline">such recommendations as the Secretary and
			 Secretary of Defense determine to be appropriate.</text>
							</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDcdc315c6206d4b4f8e037c11a2d44b4d"><enum>504.</enum><header>Energy

				technical assistance</header><text>The Secretary shall provide agencies with
				information and technical assistance that will enable the agencies to take
				advantage of the energy savings described in paragraph (1).</text>
						</paragraph><paragraph id="IDbe4b869da9eb4335a450dc8a4d3e9792"><enum>(3)</enum><header>Energy
				performance requirements</header><text>Any energy savings from the
				installations described in paragraph (1) may be applied to meet the energy
				performance requirements for an agency under subsection
				(a)(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID9be1d4a45eb04a4e93945d64591a50a5"><enum>506.</enum><header>Federal
			 building energy efficiency performance standards</header><text display-inline="no-display-inline">Section 305(a)(3) of the Energy Conservation
			 and Production Act (42 U.S.C. 6834(a)(3)) is amended by striking
			 <quote>(3)(A)</quote> and all that follows through the end of subparagraph (A)
			 and inserting the following:</text>

				<short-title>Energy Efficiency Promotion Act of
				2007</short-title>, the Secretary shall establish, by rule, revised Federal
				building energy efficiency performance standards that require that:</text>
							<clause id="IDAB38442C65D845FA9ACEFCB5AC7D2683"><enum>(i)</enum><text>For new Federal
				buildings and Federal buildings undergoing major renovations:</text>
								<subclause id="IDF5AB7DB5FDC841ACAA039FC0F2F91EC3"><enum>(I)</enum><text>The buildings be
				designed to achieve energy consumption levels that are at least 30 percent
				below the levels established in the version of the ASHRAE Standard or the
				International Energy Conservation Code, as appropriate, that is in effect as of
				the date of enactment of the <short-title>Energy
				Efficiency Promotion Act of 2007</short-title>.</text>
								</subclause><subclause id="id173F3AFC8CAE4CE6A58C3A934EE6E2AA"><enum>(II)</enum><text>The buildings be
				designed so that the fossil fuel-generated energy consumption of the buildings
				is reduced, as compared with the fossil fuel-generated energy consumption by a
				similar Federal building in fiscal year 2003 (as measured by Commercial
				Buildings Energy Consumption Survey or Residential Energy Consumption Survey
				data from the Energy Information Agency), by the percentage specified in the

				modifications to promote energy efficiency investments</header>
							<subparagraph id="idB40D56B23B21439BB7EDA9F7323DD911"><enum>(A)</enum><header>In
				general</header><text>The rates allowed to be charged by any electric utility
				shall—</text>

				incentives with the delivery of cost-effective energy efficiency; and</text>

				options</header><text>In complying with subparagraph (A), each State regulatory
				authority and each nonregulated utility shall consider—</text>
								<clause id="IDd616e40aff0943179f79490b0fdc1925"><enum>(i)</enum><text>removing the
				throughput incentive and other regulatory and management disincentives to
				energy efficiency;</text>
								</clause><clause id="IDe3ce67fbf30a4fbaa13ea66b5ef03e9e"><enum>(ii)</enum><text>providing
				utility incentives for the successful management of energy efficiency
				programs;</text>
								</clause><clause id="ID0dd3fe35b4d948b0b228f8a0fdd4136c"><enum>(iii)</enum><text>including the
				impact on adoption of energy efficiency as 1 of the goals of retail rate
				design, recognizing that energy efficiency must be balanced with other
				objectives;</text>
								</clause><clause id="ID2251167e213b440aba8e4ec5976eb491"><enum>(iv)</enum><text>adopting rate
				designs that encourage energy efficiency for each customer class; and</text>
								</clause><clause id="id50B05FFFC7E54D80BEA0E0ECA4E63C69"><enum>(v)</enum><text>allowing timely
				recovery of energy efficiency-related
				costs.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id2DB4BB36F94D473CA378070AA0900637"><enum>(b)</enum><header>Natural gas
			 utilities</header><text>Section 303(b) of the Public Utility Regulatory
			 Policies Act of 1978 (16 U.S.C. 3203(b)) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id740C51BD97884BA7A4096E3A0A0D9834" style="OLC">
						<paragraph id="id34F15C786A0B4A85A03D84985DB69467"><enum>(5)</enum><header>Energy
				efficiency</header><text>Each natural gas utility shall—</text>
							<subparagraph id="id0927D4C6178046B3B8FFD1433A299D71"><enum>(A)</enum><text>integrate energy
				efficiency resources into the plans and planning processes of the natural gas
				utility; and</text>
							</subparagraph><subparagraph id="id5AB921FD489542C58DCAFB48D14DB7F3"><enum>(B)</enum><text>adopt policies
				that establish energy efficiency as a priority resource in the plans and
				planning processes of the natural gas utility.</text>
							</subparagraph></paragraph><paragraph id="idB5D88E1DF6AD41CEA162624B03A83933"><enum>(6)</enum><header>Rate design
				modifications to promote energy efficiency investments</header>
							<subparagraph id="id294C162E388D4661B63DB01FD8B4A04D"><enum>(A)</enum><header>In
				general</header><text>The rates allowed to be charged by a natural gas utility
				shall align utility incentives with the deployment of cost-effective energy
				efficiency.</text>
							</subparagraph><subparagraph id="id0B8B7844A6374360A614E1BE21C1B852"><enum>(B)</enum><header>Policy
				options</header><text>In complying with subparagraph (A), each State regulatory
				authority and each nonregulated utility shall consider—</text>
								<clause id="idF1B4D396FED44AF9AB4E781D6E19B4F4"><enum>(i)</enum><text>separating
				fixed-cost revenue recovery from the volume of transportation or sales service
				provided to the customer;</text>
								</clause><clause id="id3DEEB8A4A388436089301DDA20F6EFBD"><enum>(ii)</enum><text>providing to
				utilities incentives for the successful management of energy efficiency
				programs, such as allowing utilities to retain a portion of the cost-reducing
				benefits accruing from the programs;</text>
								</clause><clause id="idB9CAF58A93E24923B2DC05414155947C"><enum>(iii)</enum><text>promoting the
				impact on adoption of energy efficiency as 1 of the goals of retail rate
				design, recognizing that energy efficiency must be balanced with other
				objectives; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id6F269053513647C688997BACFC50F38F"><enum>(iv)</enum><text>adopting rate
				designs that encourage energy efficiency for each customer
				class.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id0C0AC0D3FE774C2CA0300FE30CF07BAD"><enum>604.</enum><header>Energy
			 efficiency and demand response program assistance</header><text display-inline="no-display-inline">The Secretary shall provide technical
			 assistance regarding the design and implementation of the energy efficiency and
			 demand response programs established under this title, and the amendments made
			 by this title, to State energy offices, public utility regulatory commissions,
			 and nonregulated utilities through the appropriate national laboratories of the
			 Department of Energy.</text>
			</section><section id="idCD7E1015FF554EC0A6D751B4379A3E37"><enum>605.</enum><header>Energy and
			 environmental block grant</header>
				<subsection id="id5BFAD46A77AF481791FF71C874A8B752"><enum>(a)</enum><header>Definitions</header><text>In
			 this section</text>
					<paragraph id="id389552F3CFFC410285D15A0E4F8AE926"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means—</text>
						<subparagraph id="id54441604A80E475EA91B025D8B52FDCB"><enum>(A)</enum><text>a State;</text>
						</subparagraph><subparagraph id="ID78b0721f61eb452fbc3d471aefb790e0"><enum>(B)</enum><text>an eligible unit
			 of local government within a State; and</text>
						</subparagraph><subparagraph id="id85E78F1A9CC14BCBA861EF1170CD75B3"><enum>(C)</enum><text>the District of
			 Columbia.</text>
						</subparagraph></paragraph><paragraph id="id74293D0210E54FDE86156B93577F2D9F"><enum>(2)</enum><header>Eligible unit
			 of local government</header><text>The term <term>eligible unit of local
			 government</term> means—</text>
						<subparagraph id="id82989AB06A44467BBF60F0064193B4A1"><enum>(A)</enum><text>a city with a
			 population of at least 35,000; and</text>
						</subparagraph><subparagraph id="idE0AAE2C6B9EC43F9B4B93B99948D2431"><enum>(B)</enum><text>a county with a
			 population of at least 200,000.</text>
						</subparagraph></paragraph><paragraph id="IDCCC3E04600C14B6F9771BFAE30081547"><enum>(3)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
						<subparagraph id="IDA2AA1BB204044F37B57609466C60D3F9"><enum>(A)</enum><text>each of the
			 several States of the United States;</text>
						</subparagraph><subparagraph id="IDBC4DA767D65D450BA1A2FE1589E4D0E8"><enum>(B)</enum><text>the Commonwealth
			 of Puerto Rico;</text>
						</subparagraph><subparagraph id="ID447448DA718B4F0493B325C7EAD6974B"><enum>(C)</enum><text>Guam;</text>
						</subparagraph><subparagraph id="ID5C1E7DA6021D4934BE4ECBD82EEDF668"><enum>(D)</enum><text>American Samoa;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID740B2EC294E24A7691CFEE8367A9DD3F"><enum>(E)</enum><text>the United States
			 Virgin Islands.</text>
						</subparagraph></paragraph></subsection><subsection id="idD2DDD8AC02CB4ECAAE8BB0666EEDB185"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this section is to assist State and local governments in
			 implementing strategies—</text>
					<paragraph id="idD21C2CA9DFAF464BBB1F2FDB815586A2"><enum>(1)</enum><text>to reduce fossil
			 fuel emissions created as a result of activities within the boundaries of the
			 States or units of local government;</text>
					</paragraph><paragraph id="idF35F530F84AE42BF8E8C8E6F565AF1DD"><enum>(2)</enum><text>to reduce the
			 total energy use of the States and units of local government; and</text>
					</paragraph><paragraph id="idC9DC9EA7FF184C62ABD9C0767C7785C5"><enum>(3)</enum><text>to improve energy
			 efficiency in the transportation sector, building sector, and any other
			 appropriate sectors.</text>
					</paragraph></subsection><subsection id="id8E91AF516E0F40E4A2AC569DA4E18A34"><enum>(c)</enum><header>
			 Program</header>
					<paragraph id="IDc85499c9b02e4776b56dbb3126aa1dbb"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 provide to eligible entities block grants to carry out eligible activities (as
			 specified under paragraph (2)) relating to the implementation of
			 environmentally beneficial energy strategies.</text>
					</paragraph><paragraph id="id078522DAB35242E399AFB3BD45959A62"><enum>(2)</enum><header>Eligible
			 activities</header><text>The Secretary, in consultation with the Administrator
			 of the Environmental Protection Agency, the Secretary of Transportation, and
			 the Secretary of Housing and Urban Development, shall establish a list of
			 activities that are eligible for assistance under the grant program.</text>
					</paragraph><paragraph id="ID0925c30a18bc4ccdbf6a294936ff6ec2"><enum>(3)</enum><header>Allocation to
			 States and eligible units of local government</header>
						<subparagraph id="id61AF147EADFF49E890279E0AA3840DC8"><enum>(A)</enum><header>In
			 general</header><text>Of the amounts made available to provide grants under
			 this subsection, the Secretary shall allocate—</text>
							<clause id="id97BC83D49EEF4F47A62477614305320D"><enum>(i)</enum><text>70
			 percent to eligible units of local government; and</text>
							</clause><clause id="id3FAD519C3CE64CC3802FA661B4368563"><enum>(ii)</enum><text>30
			 percent to States.</text>
							</clause></subparagraph><subparagraph id="id84ED9DC0202744FCA7912512B237982B"><enum>(B)</enum><header>Distribution to
			 eligible units of local government</header>
							<clause id="idD81FCD4375184586AC0572ADED0BF98F"><enum>(i)</enum><header>In
			 general</header><text>The Secretary shall establish a formula for the
			 distribution of amounts under subparagraph (A)(i) to eligible units of local
			 government, taking into account any factors that the Secretary determines to be
			 appropriate, including the residential and daytime population of the eligible
			 units of local government.</text>
							</clause><clause commented="no" id="id176C695C9B864C81A3F50C8091DF7F1F"><enum>(ii)</enum><header>Criteria</header><text>Amounts
			 shall be distributed to eligible units of local government under clause (i)
			 only if the eligible units of local government meet the criteria for
			 distribution established by the Secretary for units of local government.</text>
							</clause></subparagraph><subparagraph id="idCB38A939B5B5479DB95CB830DF7627D7"><enum>(C)</enum><header>Distribution to
			 States</header>
							<clause id="id2C7B013B856F47F79C457225BB08C47E"><enum>(i)</enum><header>In
			 general</header><text>Of the amounts provided to States under subparagraph
			 (A)(ii), the Secretary shall distribute—</text>
								<subclause id="idFE7263FA24344CE79E0CC7C71ED6B80D"><enum>(I)</enum><text>at least 1.25
			 percent to each State; and</text>
								</subclause><subclause id="id2C91179497684EFAB9C277090602D998"><enum>(II)</enum><text>the remainder
			 among the States, based on a formula, to be determined by the Secretary, that
			 takes into account the population of the States and any other criteria that the
			 Secretary determines to be appropriate.</text>
								</subclause></clause><clause commented="no" id="idFBF3D2D81A654EC98B9D9744BEA7D7F7"><enum>(ii)</enum><header>Criteria</header><text>Amounts
			 shall be distributed to States under clause (i) only if the States meet the
			 criteria for distribution established by the Secretary for States.</text>
							</clause><clause id="id3F9E34895C0744679AC8F3B650822016"><enum>(iii)</enum><header>Limitation on
			 use of State funds</header><text>At least 40 percent of the amounts distributed
			 to States under this subparagraph shall be used by the States for the conduct
			 of eligible activities in nonentitlement areas in the States, in accordance
			 with any criteria established by the Secretary.</text>
							</clause></subparagraph></paragraph><paragraph id="id3DA7E5558BB84A41889D6943F3D00207"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on
			 which an eligible entity first receives a grant under this section, and every 2
			 years thereafter, the eligible entity shall submit to the Secretary a report
			 that describes any eligible activities carried out using assistance provided
			 under this subsection.</text>
					</paragraph><paragraph id="IDec25bb8415fc4637b503689f19a7281e"><enum>(5)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this subsection for each of fiscal years
			 2008 through 2012.</text>
					</paragraph></subsection><subsection id="idB07AF8D4405749AAA136FF44B2C78046"><enum>(d)</enum><header>Environmentally
			 beneficial energy strategies supplemental grant program</header>
					<paragraph id="id5E006B8E89C94CB4BB72C5D496D3D678"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 provide to each eligible entity that meets the applicable criteria under
			 subparagraph (B)(ii) or (C)(ii) of subsection (c)(3) a supplemental grant to
			 pay the Federal share of the total costs of carrying out an eligible activity
			 (as specified under subsection (c)(2)) relating to the implementation of an
			 environmentally beneficial energy strategy.</text>
					</paragraph><paragraph commented="no" id="idE4245B6A3DFE40CAAC2F4AFC3D989792"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">To be eligible for a grant under paragraph
			 (1), an eligible entity shall—</text>
						<subparagraph commented="no" id="idF0056D9A8F504C6F829E168B2FB5FED4"><enum>(A)</enum><text display-inline="yes-display-inline">demonstrate to the satisfaction of the
			 Secretary that the eligible entity meets the applicable criteria under
			 subparagraph (B)(ii) or (C)(ii) of subsection (c)(3); and</text>
						</subparagraph><subparagraph commented="no" id="id2B19AC4DFB564C2388F84CF79FC9F6ED"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the Secretary for approval a plan
			 that describes the activities to be funded by the grant.</text>
						</subparagraph></paragraph><paragraph id="ID9ec5bd39297844368ff6cbedfc173b23"><enum>(3)</enum><header>Cost-sharing
			 requirement</header>
						<subparagraph id="idD07237F996184D758DD0286B9684424C"><enum>(A)</enum><header>Federal
			 share</header><text>The Federal share of the cost of carrying out any
			 activities under this subsection shall be 75 percent.</text>
						</subparagraph><subparagraph id="id86D62EE40D154CE1B02B686645B8F150"><enum>(B)</enum><header>Non-Federal
			 share</header>
							<clause id="id763869BC5AB1420FAD8BCB254A786233"><enum>(i)</enum><header>Form</header><text>Not
			 more than 50 percent of the non-Federal share may be in the form of in-kind
			 contributions.</text>
							</clause><clause id="id9524146E769045CBB5249994893DF29E"><enum>(ii)</enum><header>Limitation</header><text>Amounts
			 provided to an eligible entity under subsection (c) shall not be used toward
			 the non-Federal share.</text>
							</clause></subparagraph></paragraph><paragraph id="ID2A0F9B881A164B52A0D973504D703CDF"><enum>(4)</enum><header>Maintenance of
			 effort</header><text>An eligible entity shall provide assurances to the
			 Secretary that funds provided to the eligible entity under this subsection will
			 be used only to supplement, not to supplant, the amount of Federal, State, and
			 local funds otherwise expended by the eligible entity for eligible activities
			 under this subsection.</text>
					</paragraph><paragraph id="idAFE6C587B94C4A809146B3065679DB9B"><enum>(5)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this subsection for each of fiscal years
			 2008 through 2012.</text>
					</paragraph></subsection><subsection id="id6CB923D986DE40348DE74EB7CC1C5774"><enum>(e)</enum><header>Grants to other
			 States and communities</header>
					<paragraph id="idCA3BB99552564440B58B89B6589F061A"><enum>(1)</enum><header>In
			 general</header><text>Of the total amount of funds that are made available each
			 fiscal year to carry out this section, the Secretary shall use 2 percent of the
			 amount to make competitive grants under this section to States and units of
			 local government that are not eligible entities or to consortia of such units
			 of local government.</text>
					</paragraph><paragraph id="id1E141279719F49C5A65FF1F5EE3FA0EA"><enum>(2)</enum><header>Applications</header><text>To
			 be eligible for a grant under this subsection, a State, unit of local
			 government, or consortia described in paragraph (1) shall apply to the
			 Secretary for a grant to carry out an activity that would otherwise be eligible
			 for a grant under subsection (c) or (d).</text>
					</paragraph><paragraph id="id2B8017340A274F84AAB59BC3754F70EB"><enum>(3)</enum><header>Priority</header><text>In
			 awarding grants under this subsection, the Secretary shall give priority
			 to—</text>
						<subparagraph id="id6894929CC5CB42D98B68FE94E05ADC04"><enum>(A)</enum><text>States with
			 populations of less than 2,000,000; and</text>
						</subparagraph><subparagraph id="idB80D0065ECFC4ECB88F05AAD5492149F"><enum>(B)</enum><text>projects that
			 would result in significant energy efficiency improvements, reductions in
			 fossil fuel use, or capital improvements.</text>
						</subparagraph></paragraph></subsection></section><section id="id3F00C49CD4FD4A0A88EF1E2308820A78"><enum>606.</enum><header>Energy
			 sustainability and efficiency grants for institutions of higher
			 education</header>
				<subsection id="idC1BE9F0E8BE349C4986C41EABA91BBBE"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph id="IDe7780d6cea2d49f0994bc9b123a46ebf"><enum>(1)</enum><header>Energy
			 sustainability</header><text>The term <term>energy sustainability</term>
			 includes using a renewable energy resource and a highly efficient technology
			 for electricity generation, transportation, heating, or cooling.</text>
					</paragraph><paragraph id="ID40a6205ddeb64e759b610bcce08135a4"><enum>(2)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given the term in section 2 of the Energy
			 Policy Act of 2005 (42 U.S.C. 15801).</text>
					</paragraph></subsection><subsection id="ID165612f4d1504eb0a9e38c3027732a53"><enum>(b)</enum><header>Grants for
			 energy efficiency improvement</header>
					<paragraph id="ID5ba2cf9d09474ee3a6acd15b2e9c0207"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall award not more than 100 grants to
			 institutions of higher education to carry out projects to improve energy
			 efficiency on the grounds and facilities of the institution of higher
			 education, including not less than 1 grant to an institution of higher
			 education in each State.</text>
					</paragraph><paragraph id="id704C587E8B3F4D6A8D6785BD789AAE08"><enum>(2)</enum><header>Condition</header><text>As
			 a condition of receiving a grant under this subsection, an institution of
			 higher education shall agree to—</text>
						<subparagraph id="id5C5ACD2F058848AC99384EEFB97B0B37"><enum>(A)</enum><text>implement a
			 public awareness campaign in the community in which the institution of higher
			 education is located to promote the project; and</text>
						</subparagraph><subparagraph id="id32317AA64EFA4D85B82F7C093108D141"><enum>(B)</enum><text>submit to the
			 Secretary, and make available to the public, reports on any improvements
			 achieved as part of a project carried out under paragraph (1).</text>
						</subparagraph></paragraph></subsection><subsection id="ID42e4bc11b2d74dd9b70c498761ae2ca9"><enum>(c)</enum><header>Grants for
			 innovation in energy sustainability</header>
					<paragraph id="ID88c72a41bb324ea48d2de4ce6e4d81b7"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall award not more than 250 grants to
			 institutions of higher education to engage in innovative energy sustainability
			 projects, including not less than 2 grants to institutions of higher education
			 in each State.</text>
					</paragraph><paragraph id="idB0529185CE694D399B489F65DDD4A833"><enum>(2)</enum><header>Innovation
			 projects</header><text>An innovation project carried out with a grant under
			 this subsection shall—</text>
						<subparagraph id="IDf87d793874374b899cd3ea9775511b0a"><enum>(A)</enum><text>involve an
			 innovative technology that is not yet commercially available;</text>
						</subparagraph><subparagraph id="ID288a8c1bb6e14c129b279e9e55e325db"><enum>(B)</enum><text>have the greatest
			 potential for testing or modeling new technologies or processes; and</text>
						</subparagraph><subparagraph id="ID0133ca02be754dafaedae211bc374fd3"><enum>(C)</enum><text>ensure active
			 student participation in the project, including the planning, implementation,
			 evaluation, and other phases of the project.</text>
						</subparagraph></paragraph><paragraph id="idC797D58FAEFA48AA9B29C85FCC275D79"><enum>(3)</enum><header>Condition</header><text>As
			 a condition of receiving a grant under this subsection, an institution of
			 higher education shall agree to submit to the Secretary, and make available to
			 the public, reports that describe the results of the projects carried out under
			 paragraph (1).</text>
					</paragraph></subsection><subsection id="id457186B77CED4887B0ABE98EFAAC9B9C"><enum>(d)</enum><header>Awarding of
			 grants</header>
					<paragraph id="HCF5EC380E36443FB9C46D15E935CBE16"><enum>(1)</enum><header>Application</header><text>An
			 institution of higher education that seeks to receive a grant under this
			 section may submit to the Secretary an application for the grant at such time,
			 in such form, and containing such information as the Secretary may
			 prescribe.</text>
					</paragraph><paragraph id="ID4b7610b77a09435bb012229ee157ed81"><enum>(2)</enum><header>Selection</header><text>The
			 Secretary shall establish a committee to assist in the selection of grant
			 recipients under this section.</text>
					</paragraph></subsection><subsection id="id60581AAFC304409EB8AEA7A4B938B68B"><enum>(e)</enum><header>Allocation to
			 institutions of higher education with small endowments</header><text>Of the
			 amount of grants provided for a fiscal year under this section, the Secretary
			 shall provide not less 50 percent of the amount to institutions of higher
			 education that have an endowment of not more than $100,000,000, with 50 percent
			 of the allocation set aside for institutions of higher education that have an
			 endowment of not more than $50,000,000.</text>
				</subsection><subsection id="ID17c1829a8d66420aac73da59bb771c9c"><enum>(f)</enum><header>Grant
			 amounts</header><text>The maximum amount of grants for a project under this
			 section shall not exceed—</text>
					<paragraph id="ID6ef348b70adf4307ad34e3d20c8febc1"><enum>(1)</enum><text>in the case of
			 grants for energy efficiency improvement under subsection (b), $1,000,000;
			 or.</text>
					</paragraph><paragraph id="ID3996d272ff3e4bdb8428cbd5bcfe8c89"><enum>(2)</enum><text>in the case of
			 grants for innovation in energy sustainability under subsection (c),
			 $500,000.</text>
					</paragraph></subsection><subsection id="id6D7E020C96DB43718AD32D199B7121BF"><enum>(g)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section for each of fiscal years 2008
			 through 2012.</text>
				</subsection></section><section id="id020E6BDBFD7F41E59BEA7280876C979A"><enum>607.</enum><header>Workforce
			 training</header><text display-inline="no-display-inline">Section 1101 of the
			 Energy Policy Act of 2005 (42 U.S.C. 16411) is amended—</text>
				<paragraph id="id6A1734A40C1243B4878CD590280BA491"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as
			 subsection (e); and</text>
				</paragraph><paragraph id="id5A8D17C3712E47EFB12708B615E69F03"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id05DA44B17A0449519C57A6A4484757F1" style="OLC">
						<subsection id="id6DF08D6F97E14A75924C12A69E622A07"><enum>(d)</enum><header>Workforce
				training</header>
							<paragraph id="idDFF4BD7EDC534CE5A8D9CF0F711E8AB7"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, in
				cooperation with the Secretary of Labor, shall promulgate regulations to
				implement a program to provide workforce training to meet the high demand for
				workers skilled in the energy efficiency and renewable energy
				industries.</text>
							</paragraph><paragraph id="id0982FF44460E49CDBDA0A8D215296527"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out this subsection, the
				Secretary shall consult with representatives of the energy efficiency and
				renewable energy industries concerning skills that are needed in those

			 to reduce school bus idling</header>
				<subsection commented="no" display-inline="no-display-inline" id="id8A88A06B8F8642B1A375DAA2ED74822A"><enum>(a)</enum><header>Statement of
			 policy</header><text display-inline="yes-display-inline">Congress encourages
			 each local educational agency (as defined in section 9101(26) of the Elementary
			 and Secondary Education Act of 1965 (20 U.S.C. 7801(26))) that receives Federal
			 funds under the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301
			 et seq.) to develop a policy to reduce the incidence of school bus idling at
			 schools while picking up and unloading students.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID39193a5941eb492d917467146c423895"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary, working in coordination with
			 the Secretary of Education, $5,000,000 for each of fiscal years 2007 through
			 2012 for use in educating States and local education agencies about—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idB9DDCE18411447F7B57EFF136023915E"><enum>(1)</enum><text display-inline="yes-display-inline">benefits of reducing school bus idling;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAF29107C4694DE28CA53F216A5B312F"><enum>(2)</enum><text display-inline="yes-display-inline">ways in which school bus idling may be
			 reduced.</text>
